Amparo proceeding (recurso de amparo) processed under case number 11-015654-0007-CO, filed personally by E.B.C., identity card […] and on behalf of S.U.J., against the DIRECCIÓN GENERAL DE TRANSPORTE Y COMERCIALIZACIÓN DE COMBUSTIBLES, BOTH OF THE MINISTERIO DE AMBIENTE, ENERGÍA Y TELECOMUNICACIONES, and the ÁREA RECTORA DE SALUD DE SARAPIQUÍ.
Background:
2011, the petitioner filed an amparo proceeding against the DIRECCIÓN GENERAL DE HIDROCARBUROS and others, stating that in August 2010, remodeling began at the San Miguel de Sarapiquí service station (Servicentro La Central) due to a change in its management. He states that when the service station resumed operations, problems began involving gasoline contamination of a stream that runs through the neighborhood where they live, together with a pervasive, strong smell of gasoline day and night. He explains that his house is located directly behind that service station and at a lower elevation, making him the person most directly harmed by this situation. He states that, as a result of the strong odor caused by these spills, particularly at night, he and his children have begun to suffer from respiratory problems. He adds that despite the numerous visits by the Ministerio de Ambiente, Energía y Telecomunicaciones and the Ministerio de Salud, they have still received no response from the authorities, and therefore the service station continues operating. Based on the foregoing, he considers his fundamental rights to have been violated. He requests that the Chamber grant his petition, with the corresponding legal consequences.

On August 8, the President of the Asociación de Desarrollo Integral de San Miguel de Sarapiquí was informed of the inspection and the administrative act (acto administrativo) issued. That same day, a response documenting compliance with the health order was received, stating that no fuel leaks existed. On August 9, they received a letter from the President of the Asociación de Desarrollo stating that the problem of foul odors had diminished. On August 12, the results of the operational report on the wastewater generated at the service station were received; one of the results showed that the permitted discharge parameters were being exceeded. Accordingly, that same day, the station was visited to follow up on the health order issued. On August 26, 2011, the legal representative of Las Trojitas CRC S.A.´ requested an extension to comply with item 8 of the order in question, and on September 1, the extension was authorized through September 9, 2011.
On September 22, another inspection was conducted, confirming compliance with the requirements of health order RG-089-2011. Despite such compliance, and based on the results of the operational report and the persistence of fuel odors, a new health order, RG-129-2011, was issued, requiring the traps for water from the washing of paved surfaces and stormwater to be cleaned again, the traps to be secured with locking systems, and a perimeter channel to be installed to collect possible spills in the area where the tanker truck is located during unloading. He adds that on October 18, a report concerning the problems at that station was sent to the Dirección General de Hidrocarburos of MINAET; however, no response was received. On October 27, a follow-up visit was conducted, confirming compliance with health order RG-129-2011. Despite such compliance, a fuel odor was detected, and therefore health order RG-143-2011 was issued, requiring that any anomalies that might be causing those odors be corrected within 8 business days.
On November 14, 2011, the site was visited again to follow up on the most recent health order, and the leak problem at the service station was clearly confirmed. Accordingly, a closure warning (apercibimiento de clausura) was issued through official letter CN-ARS-A1-3865-2011, granting a period of 20 calendar days to make the corrections. On December 5, 2011, the station was completely closed by means of notice recorded in report No. 018-2011, and the closure will remain in effect until compliance with the measures guaranteeing the safe operation of the service station has been verified.
the necessary technical information and relevant evidentiary materials were required to enable the Administration to determine the appropriate course of action. Consequently, they ordered studies consisting of a chemical analysis for the presence of hydrocarbons in the soil and subsoil of the operating area and surrounding areas; a study to determine the presence or absence of hydrocarbons and, if applicable, their movement through the water resources existing beneath the operating and surrounding areas; and the collection of samples from the service station’s monitoring and observation wells. Specifications were provided for all of the foregoing. It was also stated that the performance of the ordered studies could be coordinated with them and that assistance could be requested from institutions specializing in the analysis of that type of information. A period of 2 weeks was granted for compliance with those orders, and the subsequent processing was specified.
On November 21, 2011, that service station informed them that the Ministerio de Salud had issued an order directing it not to receive or reload fuel for sale at the station, to empty the tanks, and to conduct a thorough cleaning of the tanks. Consequently, through decision number R-DGTCC-0916-2011-MINAET at 8:00 hours on December 13, 2011, that Directorate ordered, as a precautionary measure, the immediate suspension of the service station’s operations until the integrity and safety of its operation were established and, within the framework of an ordinary administrative proceeding (procedimiento administrativo ordinario), the existence or absence of contamination from petroleum-derived fuels was verified. Consequently, the matter was forwarded for the commencement of an administrative proceeding based on a violation of Executive Decree number 30131, and RECOPE was requested to immediately suspend fuel sales until the precautionary measure imposed is lifted. He requests that the petition be denied.
Justice Rueda Leal drafts the opinion; and,
Considerations:
I.Subject matter of the petition. The petitioner alleges that in August 2010, remodeling began at the San Miguel de Sarapiquí service station, and that environmental contamination problems began at that time. He states that, as a result, he and his children suffer from respiratory problems. He states that despite the numerous visits by MINAET and the Ministerio de Salud, they have still received no response from the authorities, and therefore the station continues operating.
II.Proven facts. The following facts are deemed duly established and relevant to the resolution of this matter, either because they have been proven or because the respondent failed to address them as directed in the initial order:
Regarding the actions taken by the Área Rectora de Salud Alajuela 1:
1. On August 4, 201, the Área Rectora de Salud Alajuela 1 received a complaint from residents whose properties adjoin the service station and from the President of the Asociación de Desarrollo Integral de San Miguel de Sarapiquí, stating that their health was being affected by strong fuel odors and that a nearby stream was being contaminated with hydrocarbon residues (see the statements made under oath and the evidence submitted by the Director of the Área Rectora de Salud Alajuela 2. On August 5, 2011, the Área Rectora de Salud Alajuela 1 conducted an inspection of the location identified and issued health order RG-089-2011, with a compliance deadline of August 26 (see the statements made under oath and the evidence submitted by the Director of the Área Rectora de Salud Alajuela 3. On August 8, 2011, the Área Rectora de Salud Alajuela 1 provided response to the President of the Asociación de Desarrollo Integral de San Miguel de Sarapiquí regarding the inspection and the administrative act issued (see statements made under oath and evidence submitted by the Director del Área Rectora de Salud Alajuela).
4. On 8 de agosto de 2011, the service station informed the Área Rectora de Salud that there were no fuel leaks at that station (see statements made under oath and evidence submitted by the Director del Área Rectora de Salud Alajuela).
5. On 26 de agosto de 2011, the Service Station requested from the Área Rectora de Salud Alajuela 1 an extension to comply with item 8 of the aforementioned order; the extension was authorized on 1 de septiembre and was to expire on 9 de septiembre de 2011 (see statements made under oath and evidence submitted by the Director del Área Rectora de Salud Alajuela).
6. On 22 de septiembre de 2011, the Área Rectora de Salud verified compliance with sanitary order (orden sanitaria) RG-089-2011; however, based on the results of the operational report and the continued presence of fuel odors, it proceeded to issue a new sanitary order, RG-129-2011 (see statements made under oath and evidence submitted by the Director del Área Rectora de Salud Alajuela).
7. On 18 de octubre de 2011, the Área Rectora de Salud Alajuela 1 sent a report on the problems arising at that station to the Dirección General de Hidrocarburos del MINAET; however, they received no response (see statements made under oath and evidence submitted by the Director del Área Rectora de Salud Alajuela).
8. On 27 de octubre de 2011, the Área Rectora de Salud Alajuela verified compliance with sanitary order RG-129-2011; however, they found that the fuel odor was still perceptible, and therefore sanitary order RG-143-2011 was issued (see statements made under oath and evidence submitted by the Director del Área Rectora de Salud Alajuela 1).
9. On 14 de noviembre de 2011, the Área Rectora de Salud 1 visited the Service Station, where it confirmed the leak problem and therefore issued a “warning of closure” (apercibimiento de clausura) through official letter CN-ARS-A1-3865-2011, granting a period of 20 calendar days to make those corrections (see statements made under oath and evidence submitted by the Director del Área Rectora de Salud Alajuela).
10. On 5 de diciembre de 2011, the Service Station was completely closed by means of notice of record Nº 018-2011, and shall remain closed until compliance with the measures guaranteeing the safe operation of the Service Station has been verified (see statements made under oath and evidence submitted by the Director del Área Rectora de Salud Alajuela).
Regarding the actions taken by the Dirección General de Transporte y Comercialización de Combustible, MINAET:
11. On 5 de noviembre de 2010, the Dirección General de Transporte y Comercialización de Combustible, MINAET, received a complaint alleging the existence of fuel leaks and the handling of everyday waste at the service station in question (see statements made under oath and evidence submitted by the Director General de Transporte y Comercialización de Combustible, MINAET).
12. Through report DGTCC-INF-17-04-11 of 13 de abril de 2011, the Engineering Division of the Dirección General de Transporte y Comercialización de Combustible determined that, after analyzing the documentation submitted by the station, there were no leaks in the tanks; however, it recommended requesting photographic records and reports on the work performed (see statements made under oath and evidence submitted by the Director General de Transporte y Comercialización de Combustible, MINAET).
13. Through decision R-DGTCC-742-2011-MINAET issued at 13:00 hours on 2 de noviembre de 2011, it was decided that, notwithstanding the absence of leaks in the tanks at that station, as an environmental precaution, the technical information and relevant evidentiary materials necessary for the Administration to determine the appropriate course of action were required. Consequently, it ordered a chemical analysis for the presence of hydrocarbons in the soil and subsoil within the service station’s operating area and surrounding areas; a study to determine, in detail and through representative sampling, whether hydrocarbons were present and, if so, whether they were migrating through the water resources in the subsoil within the service station’s operating area and surrounding areas; and the collection of samples from the service station’s monitoring and observation wells. A period of 2 weeks was granted for compliance (see statements made under oath and evidence submitted by the Director General de Transporte y Comercialización de Combustible, MINAET).
14. On 21 de noviembre de 2011, the Service Station in question informed the Dirección General de Transporte y Comercialización de Combustible, MINAET, that the Ministerio de Salud had issued an order instructing it not to receive or refill fuel for sale at the station, to empty the tanks, and to carry out a thorough cleaning of the tanks (see statements made under oath and evidence submitted by the Director General de Transporte y Comercialización de Combustible, MINAET).
15. Consequently, by decision number R-DGTCC-0916-2011-MINAET issued at 8:00 hours on 13 de diciembre de 2011, it ordered—as a precautionary measure (medida cautelar)—the application of precautionary measures suspending operations and public service at the service station, based on Article 11 of the Constitución Política; Articles 10, 11, 15, and 113 of the Ley General de la Administración Pública; Articles 5 and 13 of the Ley de la Autoridad Reguladora de Servicios Públicos; Decreto Ejecutivo Nº 30131-MINAE-S-; and the recitals set forth in that decision (see statements made under oath and evidence submitted by the Director General de Transporte y Comercialización de Combustible, MINAET).
16. The Dirección General de Transporte y Comercialización de Combustible, MINAET, immediately forwarded decision number R-DGTCC-0916-2011-MINAET and the administrative record (expediente administrativo) to the Administrative Authority so that it could appoint a directing body for the proceeding (órgano director del procedimiento) concerning an alleged violation of the Reglamento para la regulación del Sistema de Almacenamiento y Comercialización de Hidrocarburos, Decreto Ejecutivo número 30131 (see statements made under oath and evidence submitted by the Director General de Transporte y Comercialización de Combustible, MINAET).
III.Regarding the right to a healthy and ecologically balanced environment and the State’s duty to protect and preserve it. On numerous occasions, this Chamber has had the opportunity to address the essential content of the right to a healthy environment. Environmental quality is a fundamental parameter of that quality of life; other no less important parameters include health, food, employment, housing, and education, among others. More importantly, however, it must be understood that although human beings have the right to use the environment for their own development, they also have a duty to protect and preserve it for present and future generations. On the one hand, there are the equal rights of others and, on the other, the rational exercise and beneficial enjoyment of the right itself (see, to that effect, judgment number 3705-93).
Article 50 of the Constitution requires State institutions to play an active role in protecting the environment by guaranteeing to everyone that it must be healthy and ecologically balanced (see, to the same effect, judgment number 2011010878 issued at 15:11 hours on 16 de agosto de 2011). It must now be clarified that the objective existence of a State obligation concerning the protection of the right to a healthy and ecologically balanced environment does not necessarily entail a subjective right (derecho subjetivo) of persons to demand, through judicial bodies, that a particular measure be taken, but it does entail a right to have measures adopted that are suitable for protecting that right when public authorities, or natural persons (personas físicas) or legal entities (personas jurídicas), are openly negligent. Accordingly, the State assumes the obligation to regulate those areas of social life from which dangers to the physical existence of the inhabitants of its territory may arise, as well as those that harm the environment.
It may do so through statutes, regulations, agreements, or other measures concerning administrative organization and procedures; persons have a subjective right to have such action taken diligently. Consequently, the possibility of judicially requiring, through an amparo proceeding (recurso de amparo), a specific form of service-providing activity by the State in fulfillment of its duty to protect the life, health, or environmental rights of its inhabitants is limited to clear verification of an imminent threat to those rights. It follows from the foregoing that intervention by the constitutional jurisdiction is viable only when the State’s failure, through its competent bodies, to address the demands made by the country’s inhabitants in the exercise of their rights has been established (see, to that effect, judgments number 2008-011853 issued at 16:09 hours on 29 de julio de 2008, and 2011010995 issued at 9:34 hours on 19 de agosto de 2011).
Therefore, oversight and enforcement in environmental matters and activities constitute an essential function of the State. This is consistent with the constitutional principle established in the second paragraph of Article 9 of the Constitución Política, which expressly prohibits the Branches of Government from delegating the exercise of their own functions, particularly when those functions are essential. Thus, with respect to environmental protection, the governance, oversight, and enforcement functions in environmental matters belong to the State, acting through its various administrative agencies. One of the guiding principles of Environmental Law is the precautionary principle, also known as the principle of prudent avoidance (principio precautorio o de evitación prudente). This principle is enshrined in the United Nations Conference on Environment and Development, or Rio Declaration, which literally states: “Principle 15.- In order to protect the environment, States shall widely apply the precautionary approach according to their capabilities.
Where there are threats of serious or irreversible damage, lack of full scientific certainty shall not be used as a reason for postponing the adoption of cost-effective measures to prevent environmental degradation.” Within the domestic legal system, the Ley de Biodiversidad (No. 7788 del 30 de abril de 1998), in Article 11, establishes the following principles as interpretive criteria (parámetros hermenéuticos):
importance of anticipating, preventing, and addressing the causes of the loss of biological diversity (biodiversidad) or threats to it. 2.- Precautionary principle or in dubio pro natura principle (criterio precautorio o indubio pro natura): When there is a danger or threat of serious or imminent harm to the elements of biological diversity and the knowledge associated with them, the absence of scientific certainty shall not be used as a reason for postponing the adoption of effective protective measures” (see judgment number 2009-012552 of 18:40 hours on 11 de agosto de 2009). Similarly, through Voto of this Chamber No. 1250-99 of 11:24 hours on 19 de febrero de 1999, reiterated in Votos 9773-00 of 9:44 hours on 3 de noviembre de 2000, 1711-01 of 16:32 hours on 27 de febrero de 2001, and 6322-03 of 14:14 hours on 3 de julio de 2003), this Court held that: (...) Prevention seeks to anticipate adverse effects and ensure the protection, conservation, and proper management of resources.
Consequently, the governing principle of prevention (principio rector de prevención) is based on the need to take and implement all precautionary measures (medidas precautorias) to prevent or contain possible harm to the environment or human health. Thus, where there is a risk of serious or irreversible harm—or doubt in that regard—a precautionary measure must be adopted, including postponement of the activity concerned. This is because, in environmental matters, ex post coercive action is ineffective, since once socially harmful biological consequences have occurred, enforcement may have moral significance but will hardly compensate for the environmental damage caused.” Subsequently, in Voto No. 3480-03 of 14:02 hours on 2 de mayo de 2003, this Court stated that the precautionary principle does not refer to the adoption of measures when the facts giving rise to risk are unknown, but rather when there is a lack of certainty as to whether such facts will actually have harmful effects on the environment.
For this reason, the precautionary principle, or in dubio pro natura, means that when there are no studies or reports that make it possible to reach a state of absolute certainty as to whether the activity complained of allegedly poses any threat to the environment, prompt, expeditious, and administratively coordinated action must be taken in order to provide effective protection.
IV.On coordination among public institutions in the comprehensive protection of the environment. This Chamber has recognized that one of the governing principles of administrative organization is the coordination (coordinación) that must exist among all public entities and bodies when exercising their powers and providing the services assigned to them by the legal system. The State—as a whole—is obligated to take the measures necessary to protect the environment in order to prevent levels of pollution, deforestation, extinction of flora and fauna, and excessive or improper use of natural resources that endanger the health of the governed population. In this task, a public institution includes both the Central Administration—Ministries such as the Ministerio del Ambiente y Energía and the Ministerio de Salud, which, by reason of their subject matter, have extensive involvement and responsibility regarding the conservation and preservation of the environment; and which operate, most often, through their specialized divisions, such as the Dirección General de Vida Silvestre, the Dirección Forestal, and the Secretaría Técnica Nacional Ambiental (SETENA)—as well as decentralized institutions such as the Instituto Nacional de Vivienda y Urbanismo, SENARA, the Instituto Costarricense de Turismo, or the Instituto Costarricense de Acueductos y Alcantarillados.
Given the diversity of actors that may be involved, it might be thought that this shared responsibility would cause chaos or duplication of actions in administrative management. Therefore, to prevent the simultaneous coexistence of spheres of authority of differing origins and natures, duplication of national and local efforts, and confusion regarding the rights and obligations of the various parties involved, it is necessary to establish a series of coordination arrangements among the various divisions of the Poder Ejecutivo and decentralized institutions, and between them and the municipalities, so that they may perform the functions entrusted to them (see judgment 2009005744 of 12:40 on 3 de abril de 2009). Similarly, judgment number 5445-99, of 14:30 hours on 14 de julio de 1999, stated the following regarding coordination: it is the ordering of the relationships among these various independent activities, addressing their convergence upon the same object or entity so as to make it useful to an overall public plan, without eliminating the reciprocal independence of the acting parties.
Furthermore, failures to fulfill the duty to protect the environment and to comply with environmental regulations are constitutionally significant, because the Administration’s inaction in this area may cause damage to the environment and natural resources, sometimes with consequences similar to or greater than those arising from actions of the Administration (in this regard, see judgment number 2001-6503, of 6 de julio de 2001). In view of the foregoing, the Chamber finds it striking that Área Rectora de Salud Alajuela 1 received no response when it informed the Dirección General de Hidrocarburos of MINAET of the problems arising at that service station. Specifically, this Court has recognized that one of the governing principles of administrative organization is the coordination that must exist among all public entities and bodies when exercising their powers and providing the services assigned to them by the legal system, insofar as it ensures administrative efficiency and effectiveness.
The purpose of administrative coordination (coordinación administrativa) is to prevent duplication and omissions in the performance of the administrative functions of each public entity, that is, to ensure that they are performed rationally and in an orderly manner (see, to that effect, judgment number 2007-015218 of 12 hours on 19 de octubre del 2007). Therefore, public entities are not only obligated to enforce environmental legislation but must also coordinate their actions to safeguard the environment, with no justification exempting them from compliance in this regard. This is because, when it is necessary to prevent any risk that causes or threatens to cause serious or irreparable harm to the environment, life, health, or personal safety in connection with the transportation and sale of fuels, action must be taken expeditiously, protectively, and in a coordinated manner. An omission in this regard would violate fundamental rights and, consequently, entail a breach of duties by the State, specifically by the person in charge who was required to act and failed to do so.
Moreover, when matters such as personal integrity and health are involved, the Ministerio de Salud must intervene within the scope of its powers, pursuant to the Ley General de Salud. Accordingly, both ministerial portfolios must act in coordination, as provided in article 5.1 of the Reglamento para la Regulación del Sistema de Almacenamiento y Comercialización de hidrocarburos, Decreto Ejecutivo número 30131, whose recital 5 and article 5, respectively, provide as follows:
That the Ministerio de Salud is responsible for establishing the regulatory or special requirements necessary to prevent the health risk or danger entailed by the storage and distribution of flammable materials.” Article 5 Jurisdiction (Competencia). The Ministerio del Ambiente y Energía, through the DGTCC, is responsible for enforcing this Regulation. For that purpose, the DGTCC shall have, among others, the following powers: 5.1 To regulate, supervise, and monitor matters relating to the transportation and sale of hydrocarbons, as well as safety and hygiene aspects in their operation and functioning, in coordination with MOPT and the Ministerio de Salud, respectively.”
V.Regarding the actions of the Ministerio de Salud.- In the present case, based on the evidence submitted and the sworn report of the Director of Área Rectora de Salud de Alajuela 1, the Chamber does not find that the right to health of the petitioner for amparo relief (amparada) and the other members of the community has been infringed, or that such right is under threat, because from the time the respondent received the complaint from residents adjoining the service station, it was addressed immediately and in a timely and proper manner. The respondent authority conducted on-site inspections (inspecciones in situ), issued the corresponding health orders (órdenes sanitarias) to the owner of the commercial establishment complained of—including both the order warning him of the irregularities found at the gasoline station and the order verifying noncompliance—and ultimately closed the business. Consequently, the petition is dismissed with respect to the Ministerio de Salud.
VI.Regarding the actions of the General Directorate of Fuel Transportation and Commercialization, MINAET.- Having reviewed the documents submitted and analyzed the facts, the appellant is correct in asserting that environmental damage (daños ambientales) attributable to the General Directorate of Fuel Transportation and Commercialization, MINAET, is presumed, since, according to the attached evidence, that Directorate was aware of the alleged anomalies and irregularities arising from the reported leak at the Service Station in question, both because of the complaint it was processing and because of the action taken on 18 de octubre de 2011 by the Área Rectora de Salud Alajuela 1, which sent it a report concerning the problems caused at that station. It was not until the General Directorate of Fuel Transportation and Commercialization, MINAET, became aware of this amparo proceeding (recurso de amparo) that it issued resolution number R-DGTCC-0916-2011-MINAET at 8:00 hours on 13 de diciembre de 2011, ordering—as a precautionary measure (medida cautelar)—the suspension of operations and public service until the integrity and safety of that Service Station’s operations had been established and the existence or absence of contamination caused by the presence of petroleum-derived fuels had been verified within the framework of an ordinary administrative proceeding (procedimiento administrativo ordinario).
The case file shows that, although those Authorities acted after the complaint filed by the appellant, the fact remains that, despite their duty to oversee activities related to the sale of fuel, given the danger to nature and human life, the General Directorate of Fuel Transportation and Commercialization, MINAET, failed to coordinate beforehand or promptly with the Área Rectora de Salud de Alajuela 1, even though the Área de Salud had notified it of the problem involving that Service Station. This entire situation demonstrates that the General Directorate of Fuel Transportation and Commercialization’s failure to act and to coordinate the oversight and control functions required by law is wholly reprehensible; consequently, the appeal must be granted with respect to that agency. Nevertheless, no order is issued because, according to the reports submitted under oath by those authorities, the General Directorate of Fuel Transportation and Commercialization, MINAET, has now immediately forwarded resolution number R-DGTCC-0916-2011-MINAET and the administrative case file (expediente administrativo) to the Administrative Head so that an adjudicating body (órgano director del procedimiento) may be appointed regarding the alleged violation of the Reglamento para la Regulación del Sistema de Almacenamiento y Comercialización de Hidrocarburos, Decreto Ejecutivo número 30131.
VII.Justice Piza partially dissents, solely with respect to Article 50 of the Constitution, for the following reasons. I.- THE RIGHT TO A HEALTHY AND ECOLOGICALLY BALANCED ENVIRONMENT AND ITS SUBCONSTITUTIONAL DEVELOPMENT THROUGH AN EXTENSIVE REGULATORY FRAMEWORK. Article 50 of the 1949 Constitution underwent a partial amendment in 1994 (Ley No. 7412 de 3 de junio de 1994) to introduce into its second paragraph, as an express and clearly defined fundamental right, the right of “Every person” to enjoy “a healthy and ecologically balanced environment.” Before the 1994 constitutional amendment, this fundamental right had been extensively developed through the progressive and protective case law of this Constitutional Court, based entirely on the existing body of international human rights law, which fostered and established the conditions for the partial amendment of Article 50 of the Constitution.
Following the partial amendment of Article 50 of the Constitution in 1994, a dense, broad, and detailed subconstitutional regulatory framework has been developed to ensure the effective enjoyment and exercise of the right to a healthy and ecologically balanced environment, given that the third paragraph provided that “The State shall guarantee, defend, and preserve that right”; these constitutional mandates and obligations have led the Costa Rican State to establish a vast and extensive subconstitutional regulatory framework comprising various statutes, regulations, and executive decrees addressing substantive and procedural matters relating to the guarantee, protection, and preservation of the right to a healthy and ecologically balanced environment. Additionally, that subconstitutional legal system has established an extensive and complex administrative organization to implement the constitutional mandates and obligations contained in the third paragraph of Article 50 of the Constitution.
Within this body or standard of legality, created to develop Article 50 of the Constitution, the Ley Orgánica del Ambiente No. 7554 de 4 de octubre de 1995 is especially noteworthy. Among other matters, it develops and regulates issues of primary importance, such as public participation in environmental matters (Chapter II), environmental impact assessment (evaluación del impacto ambiental) (Chapter IV), environmental protection and improvement in human settlements (Chapter V), land-use planning (ordenamiento territorial) and environmental protection (Chapter VI), protected wilderness areas (áreas silvestres protegidas) (Chapter VII), marine and coastal resources and wetlands (Chapter VIII), biological diversity (Chapter IX), natural resources such as air, water, and soil (Chapters XI, XII, and XIII), as well as forest and energy resources (Chapters X and XIV), pollution (Article XV), the environmental administrative organization (XVII), and the creation of an Environmental Administrative Tribunal to protect, defend, and preserve the right to a healthy and ecologically balanced environment (Chapter XXI).
Also noteworthy within this dense and extensive legislative framework are the Ley Forestal, No. 7575 de 5 de febrero de 1996 and its amendments; the Ley de Protección Fitosanitaria, No. 7664 de 8 de abril de 1997; the Ley de concesión y operación de marinas turísticas, No. 7744 de 19 de diciembre de 1997; the Ley de Biodiversidad, No. 7788 de 30 de abril de 1998; the Ley de Uso, manejo y conservación de suelos, No. 7779 de 30 de abril de 1998; and, more recently, the Ley para la Gestión Integral de Residuos, No. 8839 de 24 de junio de 2010. Moreover, even before Article 50 of the Constitution was partially amended, sector-specific statutes already existed for the protection and defense of certain aspects of the environment, such as the Ley de Aguas, No. 276 de 27 de agosto de 1942 and its amendments; the Ley General de Salud, No. 5395 de 30 de octubre de 1973 and its amendments; the Ley de Salud Animal, No. 6243 de 2 de mayo de 1978; the Ley de Conservación de la Vida Silvestre, No. 7317 de 21 de octubre de 1992 and its amendments; the Ley de Hidrocarburos, No. 7399 de 3 de mayo de 1994; and the Ley del uso racional de la energía, No. 7447 de 3 de noviembre de 1994.
At the substatutory level, the regulatory framework is even more extensive, encompassing various executive regulations implementing those statutes and decrees governing environmental protection, conservation, and defense. At this level of the hierarchy of protection, one example of particular note is Decreto Ejecutivo No. 31849 de 24 de mayo de 2004, the Reglamento General sobre los Procedimientos de Evaluación de Impacto Ambiental (EIA), which comprehensively regulates every aspect of environmental impact assessment procedures for activities, works, and projects, according to predefined categories, in order to prevent any environmental damage or harm, as well as their review and environmental feasibility (viabilidad ambiental), subsequent monitoring and follow-up, complaints, participation mechanisms, the environmental officer (responsable ambiental), compliance and operating guarantees, and a penalty regime.
Also prominent is Decreto Ejecutivo No. 34136 de 20 de junio de 2007, the Reglamento de procedimiento del Tribunal Ambiental Administrativo, governing the body charged with hearing and deciding complaints concerning threatened or actual violations of legislation protecting the environment and natural resources, and with determining compensation for damage or harm to them.
II.THE NEED TO DISTINGUISH CONSTITUTIONAL REVIEW FROM LEGALITY REVIEW IN THE PROTECTION OF THE RIGHT TO A HEALTHY AND ECOLOGICALLY BALANCED ENVIRONMENT. The dense subconstitutional regulatory framework or legal system that develops and strengthens the right to a healthy and ecologically balanced environment set forth in Article 50 of the Constitution and seeks to guarantee, protect, and preserve it requires this Constitutional Court to distinguish, in this field, the scope of constitutional review (control de constitucionalidad) from that of legality review (control de legalidad). With respect to constitutional review mechanisms or constitutional matters, as Title IV of the Ley de la Jurisdicción Constitucional calls them—a concept encompassing constitutional challenges (acción de inconstitucionalidad) and constitutional consultations (consulta de constitucionalidad), whether legislative or judicial—the boundary between constitutional review and legality review is clear and unequivocal, since this Constitutional Court unquestionably has exclusive jurisdiction to hear and decide such matters (Articles 10 of the Constitution and 1°, 2°, subsection b), and 73 to 108 of the Ley de la
Constitutional Jurisdiction (Jurisdicción Constitucional), thus, for example, when it is alleged that a statutory or regulatory provision is unconstitutional because it violates Article 50, that is, the right to a healthy and ecologically balanced environment and the values and principles underlying it. The real problem in delimiting the respective spheres of review arises with respect to the amparo remedy or proceeding (recurso o proceso de amparo), for several evident reasons, namely: a) the cross-cutting nature of the right to a healthy and ecologically balanced environment, which permeates every layer or stratum of the legal system; b) the open texture of constitutional provisions, whereby any grievance may appear to be constitutional in nature; and c) the tendency to use the amparo proceeding as a substitute for ordinary jurisdiction. Nevertheless, certain criteria may be established, based on Article 7 of the Ley de la Jurisdicción Constitucional, that make it possible to distinguish the amparo proceeding from other ordinary judicial proceedings.
Thus, when a public authority—an administrative entity or body—has intervened with respect to an activity, work, or project by conducting studies, assessments, reports, or evaluations of any kind pursuant to the dense and extensive infra-constitutional legal system (ordenamiento jurídico infra constitucional), it is clear that the matter must be brought before the ordinary courts and not the constitutional jurisdiction. The same applies when a public authority has failed to fulfill the obligations imposed upon it by the statutory or regulatory infra-constitutional legal system concerning protection of the environment and natural resources. Under this interpretation, this Constitutional Court may hear and decide a matter in an amparo proceeding only when no public authority has intervened by exercising its oversight or authorization powers and conduct is taking place that potentially or actually infringes the right to a healthy and ecologically balanced environment; additionally, the violation of that right must be evident and manifest or readily ascertainable—without extensive presentation or taking of evidence—and it must also be highly relevant or consequential and serious.
If a public authority has failed to comply with the obligations and duties established by the infra-constitutional legal system, the matter likewise must not be heard by the constitutional jurisdiction because, in addition to the complaint mechanisms available at the administrative level, the ordinary courts, particularly the administrative courts, have sufficient jurisdiction to review public entities’ substantive or procedural omissions. From the moment a public authority has intervened by exercising its statutory and regulatory powers, conducting a procedure—a linked series of administrative actions—and issuing administrative acts (actos administrativos), the matter falls outside the scope of constitutional review; the same is true if it fails to perform or omits its statutory and regulatory obligations. The amparo remedy is essentially a summary proceeding governed by simplicity or, in the terms of Article 25 of the American Convention on Human Rights, a remedy that must be simple and prompt.
Consequently, when it is necessary to review various administrative actions—procedures and formal acts reflected and embodied in an administrative record (expediente administrativo)—the matter ceases to fall within the scope of amparo because recourse must be had to a plenary adjudicatory proceeding, that is, a proceeding involving full consideration of the merits that can be conducted only before the ordinary courts. Amparo is not designed to compare or review technical or legal opinions rendered under the infra-constitutional legal system, or to take new evidence for comparison with the evidence contained in an administrative record that has been processed carefully over extended periods. Ultimately, the amparo proceeding cannot be converted into an ordinary proceeding involving full consideration of the merits (“ordinariarlo”), because doing so distorts and undermines its aims and purposes.
Accordingly, when a public authority has intervened by conducting studies, approving or validating expert assessments submitted by the interested parties, issuing reports, rendering administrative decisions, permits, licenses, or any other formal administrative act, or generally conducting one or more administrative procedures, the amparo proceeding is not the proper avenue for reviewing such actions; the administrative-litigation proceeding is. Administrative intervention that can be verified or established is determinative in assessing whether the matter lies within the inherently abstract and open realm or level of constitutionality or within the denser realm of legality. Nor should this Constitutional Court hear and decide cases concerning failure to fulfill obligations imposed by the statutory or regulatory framework, since powerful and effective mechanisms exist for that purpose at the administrative level (the sanctions regime, complaints, and the Tribunal Ambiental administrativo) and, ultimately, there is an administrative-litigation jurisdiction whose function is to review the legality of administrative action (constitutional Article 49), including statutory or regulatory, substantive or procedural omissions—an ordinary jurisdiction that, under the new procedural legislation, is now more flexible, expeditious, prompt, plenary, and comprehensive.
For the reasons stated, we consider that this amparo remedy should have been summarily dismissed ad limine litis because it concerns a matter properly subject to review for legality. However, since it was not, we consider that the remedy should be denied, without ruling on the merits of the matter, because it is for the ordinary courts, particularly the administrative-litigation jurisdiction, to determine whether the administrative actions and conduct undertaken (acts or omissions) in the sub lite comply substantively with the infra-constitutional legal system governing the protection, safeguarding, and preservation of the right to a healthy and ecologically balanced environment.
Therefore:
The remedy is partially granted, solely against the Dirección General de Transporte y Comercialización de Combustible, MINAET. The State is ordered to pay the costs, damages, and losses caused by the events on which this ruling is based, to be assessed during enforcement of the administrative-litigation judgment. As to the Área de Salud de Alajuela 1, del Ministerio de Salud, the remedy is denied. This judgment shall be served personally upon Humberto Cerdas Brenes, in his capacity as Director General de Transporte y Comercialización, or upon whoever holds that office in his stead. Justice Piza Rocafort partially dissents solely with respect to constitutional Article 50. Let notice be given. - Gilbert Armijo S.

#/ SALA CONSTITUCIONAL DE LA CORTE SUPREMA DE JUSTICIA. San José, a las nueve horas diez minutos del nueve de marzo de dos mil doce. Recurso de amparo que se tramita en expediente número 11-015654-0007-CO, interpuesto por E.B.C., cédula de identidad […] de forma personal y a favor de S.U.J., contra la DIRECCIÓN GENERAL DE TRANSPORTE Y COMERCIALIZACIÓN DE COMBUSTIBLES, AMBAS DEL MINISTERIO DE AMBIENTE, ENERGÍA Y TELECOMUNICACIONES y el ÁREA RECTORA DE SALUD DE SARAPIQUÍ.
Resultando:
Redacta el Magistrado Rueda Leal; y,
Considerando:
I.Objeto del recurso. El recurrente alega que desde agosto de 2010 se inició una remodelación en la estación gasolinera de San Miguel de Sarapiquí, y desde entonces empezaron los problemas de contaminación ambiental. Indica que sufre como consecuencia de ello, problemas respiratorios al igual que sus hijos. Manifiesta que pese a las múltiples visitas del MINAET y el Ministerio de Salud, aún no tienen respuesta alguna por parte de las autoridades, por lo que la estación continúa funcionando.
II.Hechos probados. De importancia para la decisión de este asunto, se estiman como debidamente demostrados los siguientes hechos, sea porque así han sido acreditados o bien porque el recurrido haya omitido referirse a ellos según lo prevenido en el auto inicial:
Sobre las acciones realizadas por el Área Rectora de Salud Alajuela 1:
1. El 4 de agosto de 201, el Área Rectora de de Salud Alajuela 1 recibió denuncia por parte de vecinos colindantes de la estación de Servicio y por el Presidente de la Asociación de Desarrollo Integral de San Miguel de Sarapiquí en la cual indicaron afectación a la salud por fuertes olores a combustible y contaminación con residuos de hidrocarburos a una quebrada cercana (ver manifestaciones rendidas bajo juramento y prueba aportada por el Director del Área Rectora de Salud Alajuela 2. El 5 de agosto de 2011, el Área Rectora de Salud Alajuela 1 realizó una inspección al lugar señalado, y giró la orden sanitaria RG-089-2011 con vencimiento el 26 de agosto (ver manifestaciones rendidas bajo juramento y prueba aportada por el Director del Área Rectora de Salud Alajuela 3. El 8 de agosto de 2011, el Área Rectora de Salud Alajuela 1 le dio respuesta al Presidente de la Asociación de Desarrollo Integral de San Miguel de Sarapiquí respecto de la inspección y el acto administrativo girado (ver manifestaciones rendidas bajo juramento y prueba aportada por el Director del Área Rectora de Salud Alajuela .
4. El 8 de agosto de 2011, la estación de Servicio indicó al Área Rectora de Salud que no existían fugas de combustible en dicha estación (ver manifestaciones rendidas bajo juramento y prueba aportada por el Director del Área Rectora de Salud Alajuela 5. El 26 de agosto de 2011, la Estación de Servicio solicitó al Área Rectora de Salud Alajuela 1 prórroga para dar cumplimiento con el punto 8 de la orden referida, la que fue autorizada el 1 de septiembre a vencer el 9 de septiembre de 2011 (ver manifestaciones rendidas bajo juramento y prueba aportada por el Director del Área Rectora de Salud Alajuela 6. El 22 de septiembre de 2011, el Área Rectora de Salud comprobó el cumplimiento a la orden sanitaria RG-089-2011; sin embargo, con base en los resultados del reporte operacional y la continua presencia de olores a combustible, se procedió a girar nueva orden sanitaria, RG-129-2011 (ver manifestaciones rendidas bajo juramento y prueba aportada por el Director del Área Rectora de Salud Alajuela 7.
El 18 de octubre de 2011, el Área Rectora de Salud Alajuela 1 envió informe sobre la problemática generada en dicha estación a la Dirección General de Hidrocarburos del MINAET; sin embargo, no les dieron respuesta alguna (ver manifestaciones rendidas bajo juramento y prueba aportada por el Director del Área Rectora de Salud Alajuela 8. El 27 de octubre de 2011, el Área Rectora de Salud Alajuela comprobó el cumplimiento a la orden sanitaria RG-129-2011; sin embargo, constataron que se percibía aún el olor a combustible, por lo cual se giró la orden sanitaria RG-143-2011 (ver manifestaciones rendidas bajo juramento y prueba aportada por el Director del Área Rectora de Salud Alajuela 1).
9. El Área Rectora de Salud 1 realizó el 14 de noviembre de 2011 visita a la Estación de Servicio donde comprobó el problema de fuga, por lo cual realizó un ³apercibimiento de clausura´mediante el oficio CN-ARS-A1-3865-2011, y otorgó un plazo de 20 días naturales para realizar dichas correcciones (ver manifestaciones rendidas bajo juramento y prueba aportada por el Director del Área Rectora de Salud Alajuela 10. El 5 de diciembre de 2011, se clausuró totalmente la Estación de Servicio por medio de notificación de acta Nº 018-2011, la cual se mantendrá hasta tanto no se verifique el cumplimiento de las medidas que garanticen el funcionamiento seguro de la Estación de Servicio (ver manifestaciones rendidas bajo juramento y prueba aportada por el Director del Área Rectora de Salud Alajuela Sobre las acciones realizadas por la Dirección General de Transporte y Comercialización de Combustible, MINAET:
11. El 5 de noviembre de 2010 la Dirección General de Transporte y Comercialización de Combustible, MINAET, recibió denuncia donde se manifestó la existencia de fugas de combustible y el manejo de desechos de uso diario en la estación de servicio en cuestión (ver manifestaciones rendidas bajo juramento y prueba aportada por el Director General de Transporte y Comercialización de Combustible, MINAET).
12. Por informe DGTCC-INF-17-04-11 de 13 de abril de 2011, el Área de Ingeniería de la Dirección General de Transporte y Comercialización de Combustible, determinó que luego de analizar la documentación aportada por la estación, no existían fugas en los tanques; sin embargo, recomendó solicitar registros fotográficos e informes sobre los trabajos realizados (ver manifestaciones rendidas bajo juramento y prueba aportada por el Director General de Transporte y Comercialización de Combustible, MINAET).
13. Por resolución R-DGTCC-742-2011-MINAET de las 13:00 horas de 2 de noviembre de 2011, se resolvió que, no obstante no presentarse fugas en los tanques de dicha estación, desde el punto de vista cautelar del medio ambiente, se requería información técnica necesaria e insumos probatorios pertinentes que permitieran a la Administración determinar lo que correspondiera. En consecuencia se ordenó realizar un análisis químico de presencia de hidrocarburos en el suelo y subsuelo del área de operación de la estación se servicios y áreas circundantes, un estudio que determinara detalladamente y en forma representativa, la presencia o no de hidrocarburos y eventualmente el tránsito de estos en el recurso hídrico existente en el subsuelo del área de operación de la estación de servicio y áreas circundantes, y tomar muestras en los pozos de monitoreo y observación de la estación de servicio. Se otorgó un plazo de 2 semanas para su cumplimiento (ver manifestaciones rendidas bajo juramento y prueba aportada por el Director General de Transporte y Comercialización de Combustible, MINAET).
14. El 21 de noviembre de 2011, la Estación de Servicio en cuestión informó a la Dirección General de Transporte y Comercialización de Combustible, MINAET, que el Ministerio de Salud les había girado una orden con el fin de no recibir o recargar combustible para expendio de la estación, realizar el vacío de los tanques, y ejecutar una limpieza exhaustiva de los tanques (ver manifestaciones rendidas bajo juramento y prueba aportada por el Director General de Transporte y Comercialización de Combustible, MINAET).
15. En consecuencia, por medio de la resolución número R-DGTCC-0916-2011-MINAET de las 8:00 horas de 13 de diciembre de 2011, ordenó -como medida cautelar-, la aplicación de medidas cautelares de paralización de labores y del servicio público en la estación de servicio con fundamento en el artículo 11 de la Constitución Política, los artículos 10, 11, 15, 113 de la Ley General de la Administración Pública, 5 y 13 de la Ley de la Autoridad Reguladora de Servicios Públicos, el Decreto Ejecutivo Nº 30131-MINAE-S- y los considerandos prueba aportada por el Director General de transporte y Comercialización de Combustible, MINAET).
16. La Dirección General de Transporte y Comercialización de Combustible, MINAET, traslada de forma inmediata la resolución número R-DGTCC-0916-2011-MINAET y el Jerarca Administrativo para que nombrase un órgano director del procedimiento por presunta violación al Reglamento para la regulación del Sistema de Almacenamiento y Comercialización de Hidrocarburos, Decreto Ejecutivo número 30131 (ver manifestaciones rendidas bajo juramento y prueba aportada por el Director General de Transporte y Comercialización de Combustible, MINAET).
III.Sobre el derecho a un ambiente sano y ecológicamente equilibrado y el deber del estado en su protección y prevención. Esta Sala en numerosas ocasiones ha tenido oportunidad de hacer mención al contenido esencial del derecho a un ambiente sano. La calidad ambiental es un parámetro fundamental de esa calidad de vida; otros parámetros no menos importantes son salud, alimentación, trabajo, vivienda, educación, entre otros, pero más importante que ello, es entender que si bien el hombre tiene el derecho de hacer uso del ambiente para su propio desarrollo, también tiene el deber de protegerlo y preservarlo para el uso de las generaciones presentes y futuras. Por un lado, los iguales derechos de los demás y, por el otro, el ejercicio racional y el disfrute útil del derecho mismo (ver en ese sentido la sentencia número 3705-93). El numeral 50 constitucional obliga a las instituciones del Estado a tener una función activa en la protección del ambiente al garantizar a todos que el mismo debe ser sano y ecológicamente equilibrado (véase en igual sentido la sentencia número 2011010878 de las 15:11 horas de 16 de agosto de 2011).
Ahora bien, es menester aclarar que la existencia objetiva de una obligación del Estado en lo referente a la protección del derecho a un ambiente sano y ecológicamente equilibrado no apareja, ineludiblemente, un derecho subjetivo de las personas a exigir, a través de los organismos judiciales, que se tome una medida determinada, pero sí a que se adopten las que sean idóneas en tutela de ese derecho, ante actitudes abiertamente negligentes de las autoridades públicas o bien, de personas físicas y jurídicas. De este modo, el Estado adquiere la obligación de regular las áreas de la vida social de las cuales puedan surgir peligros para la existencia física de los habitantes de su territorio así como también aquellas que vulneren el ambiente, lo cual puede hacer a través de la ley, de reglamentos, de acuerdos o de otras medidas relacionadas con la organización y los procedimientos administrativos, y del derecho subjetivo de las personas a que así se proceda, en forma diligente.
En consecuencia, la posibilidad de exigir, judicialmente, a través del recurso de amparo, un tipo específico de actividad prestacional por parte del Estado en cumplimiento de su deber de protección a la vida, salud o derecho al ambiente en beneficio de sus habitantes, está restringida a la clara verificación de un peligro inminente contra esos derechos de las personas. De lo anterior se desprende que la injerencia de la jurisdicción constitucional solamente es viable ante la inercia comprobada del Estado, a través de sus órganos competentes, en atender las demandas que en ejercicio de sus derechos realicen los habitantes del país (ver en ese sentido las sentencias número 2008-011853 de las 16:09 horas del 29 de julio de 2008, y 2011010995 de las 9:34 horas de 19 de agosto de 2011). Es por ello que el control y fiscalización de la materia y actividad ambiental se constituye en una función esencial del Estado; lo cual resulta concordante con el principio constitucional establecido en el párrafo segundo del artículo 9 de la Constitución Política, que expresamente prohíbe a los Poderes del Estado la delegación del ejercicio de funciones que le son propias, máxime cuando se constituyen en esenciales.
De esta manera, tratándose de la protección ambiental, las funciones de rectoría, control y fiscalización de la materia ambiental, corresponden al Estado, a cargo de las diversas dependencias administrativas. Uno de los principios rectores del Derecho Ambiental lo constituye el precautorio o de evitación prudente. Este principio se encuentra recogido en la Conferencia de las Naciones Unidas sobre el Medio Ambiente y el Desarrollo o Declaración de Río, la cual literalmente indica: ³Principio 15.- Con el fin de proteger el medio ambiente, los Estados deberán aplicar ampliamente el criterio de precaución conforme a sus capacidades. Cuando haya peligro de daño grave e irreversible, la falta de certeza científica absoluta no deberá utilizarse como razón para postergar la adopción de medidas eficaces en función de los costos para impedir la degradación del medio ambiente´. En el ordenamiento jurídico interno la Ley de Biodiversidad (No. 7788 del 30 de abril de 1998), en su artículo 11 recoge como parámetros ermenéuticos
los siguientes principios: 1.- Criterio preventivo: Se reconoce que es de vital importancia anticipar, prevenir y atacar las causas de la pérdida de biodiversidad o sus amenazas. 2.- Criterios precautorio o indubio pro natura: Cuando exista peligro o amenaza de daños graves o inminentes a los elementos de la biodiversidad y al conocimiento asociado con estos, la ausencia de certeza científica no deberá utilizarse como razón para postergar la adopción de medidas eficaces de protección´(véase la sentencia número 2009-012552 de las 18:40 horas de 11 de agosto de 2009). En sentido similar, por medio del Voto de esta Sala No. 1250-99 de las 11:24 horas del 19 de febrero de 1999, reiterado en los Votos 9773-00 de las 9:44 horas del 3 de noviembre de 2000, 1711-01 de las 16:32 horas del 27 de febrero de 2001 y 6322-03 de las 14:14 horas del 3 de julio de 2003) este Tribunal estimó que: (...) La prevención pretende anticiparse a los efectos negativos, y asegurar la protección, conservación y adecuada gestión de los recursos.
Consecuentemente, el principio rector de prevención se fundamenta en la necesidad de tomar y asumir todas las medidas precautorias para evitar contener la posible afectación del ambiente o la salud de las personas. De esta forma, en caso de que exista un riesgo de daño grave o irreversible ±o una duda al respecto-, se debe adoptar una medida de precaución e inclusive posponer la actividad de que se trate. Lo anterior debido a que en materia ambiental la coacción a posteriori resulta ineficaz, por cuanto de haberse producido ya las consecuencias biológicas socialmente nocivas, la represión podrá tener una trascendencia moral, pero difícilmente compensará los daños ocasionados en el ambiente´. Posteriormente, en el Voto No. 3480-03 de las 14:02 horas del 2 de mayo de 2003, este Tribunal indicó que el principio precautorio se refiere a la adopción de medidas no ante el desconocimiento de hechos generadores de riesgo, sino ante la carencia de certeza respecto de que tales hechos efectivamente producirán efectos nocivos en el ambiente.
Es por ello que el principio precautorio o indubio pro natura, supone que cuando no existan estudios o informes efectuados que permitan arribar a un estado de certeza absoluta acerca de si la actividad denunciada, presuntamente, presenta alguna amenaza al medio ambiente, se debe actuar de manera pronta, célere y coordinada administrativamente, ello con el objeto de garantizarlo de forma efectiva. IV.- Sobre la coordinación de las instituciones públicas en la protección integral al ambiente. Esta Sala ha reconocido que uno de los principios rectores de la organización administrativa, lo constituye la coordinación que debe mediar entre todos los entes y órganos públicos al ejercer sus competencias y prestar los ervicios que el ordenamiento jurídico les ha asignado. Existe una obligación para el Estado como un todo- de tomar las medidas necesarias para proteger el ambiente, a fin de evitar grados de contaminación, deforestación, extinción de flora y fauna, uso desmedido o inadecuado de los recursos naturales, que pongan en peligro la salud de los administrados.
En esta tarea, por institución pública se entiende tanto a la Administración Central ±Ministerios, como el Ministerio del Ambiente y Energía y el Ministerio de Salud, que en razón de la materia, tienen una amplia participación y responsabilidad en lo que respecta a la conservación y reservación del ambiente; los cuales actúan, la mayoría de las veces, a través de sus dependencias especializadas en la materia, como por ejemplo, la Dirección General de Vida Silvestre, la Dirección Forestal, y la Secretaría Técnica Nacional Ambiental (SETENA)-, así como también las instituciones descentralizadas como el Instituto Nacional de Vivienda y Urbanismo, el SENARA, el Instituto Costarricense de Turismo o el Instituto Costarricense de Acueductos y Alcantarillados. Debido a la diversidad de actores que pueden intervenir, podría pensarse que esta múltiple responsabilidad provocaría un caos o una duplicidad de acciones en lo que a la gestión administrativa respecta.
Por ello, a fin de evitar la coexistencia simultánea de esferas de poder de diferente origen y esencia, la duplicación de los esfuerzos nacionales y locales, así como la confusión de derechos y obligaciones entre las diversas partes involucradas, se hace necesario establecer una serie de relaciones de coordinación entre las diversas dependencias del Poder Ejecutivo y las instituciones descentralizadas, y entre éstas con las municipalidades, a fin de poder llevar a cabo las funciones que les han sido encomendadas (véase la sentencia 2009005744 de las 12:40 de 3 de abril de 2009). En igual sentido la sentencia número 5445-99, de las 14:30 horas de 14 de julio de 1999, indicó sobre la coordinación que: es la ordenación de las relaciones entre estas diversas actividades independientes, que se hace cargo de esa concurrencia en un mismo objeto o entidad, para hacerla útil a un plan público global, sin suprimir la independencia recíproca de los sujetos agentes .
Por otro lado, las omisiones al deber de protección del ambiente y de cumplimiento de la normativa ambiental son de relevancia constitucional, por cuanto como consecuencia de la inercia de la Administración en esta materia, se puede producir un daño al ambiente y a los recursos naturales, a veces, de similares o mayores consecuencias, que de las derivadas de las actuaciones de la Administración (al respecto véase la sentencia número 2001-6503, de 6 de julio de 2001). Por lo anteriormente expuesto, llama la atención a la Sala que el Área Rectora de Salud Alajuela 1 no haya obtenido respuesta alguna, cuando informó a la Dirección General de Hidrocarburos del MINAET, sobre la problemática generada en dicha estación de servicio. Precisamente, este Tribunal ha reconocido que uno de los principios rectores de la organización administrativa, lo constituye la coordinación que debe mediar entre todos los entes y órganos públicos al ejercer sus competencias y prestar los servicios que el ordenamiento jurídico les ha asignado, en cuanto asegura la eficiencia y eficacia administrativas.
La coordinación administrativa tiene por propósito evitar las duplicidades y omisiones en el ejercicio de las funciones administrativas de cada ente público, esto es, que sean desempeñadas de forma racional y ordenada (véase, al efecto, la sentencia número 2007-015218 de las 12 horas del 19 de octubre del 2007). Es por ello que los entes públicos no sólo están en la obligación de hacer cumplir la legislación ambiental, sino también, deben ajustar su accionar de manera coordinada a efecto de resguardar el medio ambiente, sin que exista justificación alguna que exima de cualquier cumplimiento al respecto. Ello en razón que cuando se debe prevenir cualquier riesgo que produzca o amenace con producir un daño grave o irreparable al medio ambiente, la vida, la salud, la seguridad de las personas, lo relacionado con el transporte y comercialización de los combustibles, se debe actuar célere, garante y coordinadamente.
Una omisión en este sentido estaría violando derechos fundamentales y en consecuencia, apareja un incumplimiento de deberes por parte del Estado, propiamente por la cabeza de quien debía actuar y no lo hizo. Aunado a lo anterior, cuando se relacionan aspectos como la integridad y salud de las personas, debe el Ministerio de Salud intervenir, dentro del ámbito de sus competencias, con fundamento en la Ley General de Salud. Por ello, ambas carteras ministeriales deben actuar de forma coordinada, tal como lo señala el artículo 5.1 del Reglamento para la Regulación del Sistema de Almacenamiento y Comercialización de hidrocarburos, Decreto Ejecutivo número 30131, el cual dispone en su considerando 5, y artículo 5, respectivamente, lo siguiente:
Que corresponde al Ministerio de Salud establecer las exigencias reglamentarias o especiales para prevenir el riesgo o peligro a la salud que conlleva el almacenamiento y distribución de materias inflamables´.
Artículo 5 Competencia. Corresponde al Ministerio del Ambiente y Energía por medio de la DGTCC, la aplicación del presente Reglamento. Para tal efecto, la DGTCC tendrá entre otras competencias las siguientes: 5.1 Regular, fiscalizar y controlar lo relativo al transporte y comercialización de hidrocarburos, así como los aspectos de seguridad e higiene en la operación y funcionamiento, en coordinación con el MOPT y el Ministerio de Salud, respectivamente´.
V.En cuanto a la actuación del Ministerio de Salud.- En el presente caso, de la prueba aportada y lo informado bajo juramento por el Director del Área Rectora de Salud de Alajuela 1, la Sala no constata que haya lesionado el derecho a la salud de la amparada y demás miembros de la comunidad o que exista una amenaza al mismo, por cuanto desde que la accionada recibió la denuncia por parte de los vecinos colindantes de la estación de servicio, en forma inmediata fue atendida en tiempo y forma. La autoridad recurrida realizó las inspecciones in situ, giró las ordenes sanitarias correspondiente al propietario del local comercial denunciado, tanto la que lo apercibe de las irregularidades encontradas en la gasolinera como la de verificación de incumplimiento y finalmente la clausura del negocio. En consecuencia, se declara sin lugar el recurso en relación con el Ministerio de Salud.
VI.En cuanto a la actuación de la Dirección General de Transporte y Comercialización de Combustible, MINAET.- Habiendo revisado los documentos aportados y analizado los hechos, lleva razón la parte recurrente al señalar que se presumen daños ambientales imputables a la Dirección General de Transporte y Comercialización de Combustible, MINAET, ya que de conformidad con la prueba adjunta, dicha Dirección conocía sobre las presuntas anomalías e irregularidades que se estaban presentando en cuanto al problema de fuga denunciado en la Estación de Servicio en cuestión, ello tanto por la denuncia que estaban tramitando, como por la gestión realizada el 18 de octubre de 2011 por el Área Rectora de Salud Alajuela 1 donde les envió un informe sobre la problemática generada en dicha estación. No fue sino hasta que la Dirección General de Transporte y Comercialización de Combustible, MINAET, tuvo conocimiento del presente recurso de amparo que emitió la resolución número R-DGTCC-0916-2011-MINAET de las 8:00 horas de 13 de diciembre de 2011, donde ordenó -como medida cautelar-, la paralización de labores y del servicio público, hasta tanto no se comprobara la integridad y seguridad en la operación de esa Estación de Servicio, y se verificara dentro del marco de un procedimiento administrativo ordinario la existencia o no de contaminación por presencia de combustibles derivados de petróleo.
Del expediente se desprende que si bien dichas Autoridades actuaron con posterioridad a la denuncia presentada por el recurrente, lo cierto es que a pesar de que su deber es vigilar el desarrollo de actividades relacionadas con el expendio de combustible, dado el peligro para la naturaleza y la vida humana, no hubo coordinación previa ni pronta por parte de la Dirección General de Transporte y Comercialización de Combustible, MINAET, con el Área Rectora de Salud de Alajuela 1, no obstante el Área de Salud había comunicado sobre el problema con dicha Estación de Servicio. Toda esta situación pone en evidencia que la omisión de actuar de la Dirección General de Transporte y Comercialización de Combustible, sin coordinar las funciones de vigilancia y control como lo requiere la legislación, es absolutamente reprochable y, por ello, el recurso debe acogerse en cuanto a tal dependencia. Sin embargo, no se emite ninguna orden porque de los informes rendidos bajo juramento por esas autoridades, actualmente la Dirección General de Transporte y Comercialización de Combustible, MINAET, trasladó de forma inmediata la resolución número R-DGTCC-0916-2011-MINAET y el expediente administrativo al Jerarca Administrativo para que nombrase un órgano director del procedimiento por presunta violación al Reglamento para la Regulación del Sistema de Almacenamiento y Comercialización de Hidrocarburos, Decreto Ejecutivo número 30131.
VII.El Magistrado Piza salva parcialmente el voto, únicamente, en cuanto al artículo 50 constitucional, por las razones siguientes. I.- DERECHO A UN AMBIENTE SANO Y ECOLÓGICAMENTE EQUILIBRADO Y SU DESARROLLO INFRA CONSTITUCIONAL A TRAVÉS DE UN VASTO ENTRAMADO NORMATIVO. El artículo 50 de la Constitución de 1949, en el año de 1994 (Ley No. 7412 de 3 de junio de 1994) sufrió una reforma parcial para introducir en el, párrafo 2°, como un derecho fundamental expreso y claramente tipificado el que tiene ³Toda persona´ de gozar a un ambiente sano y ecológicamente equilibrado ´. Este derecho fundamental, antes de la reforma constitucional de 1994,fue ampliamente desarrollado por una jurisprudencia
progresista y tuitiva de este Tribunal Constitucional, todo con fundamento en la normativa existente en el Derecho Internacional de los Derechos Humanos, lo que propició y estableció las condiciones para la reforma parcial del artículo 50 de la Constitución. Después de la reforma parcial al numeral 50 de la Constitución en 1994, se ha venido desarrollando un denso, amplio y prolijo marco normativo infra constitucional para la protección efectiva del goce y ejercicio del derecho a un ambiente sano y ecológicamente equilibrado, habida cuenta que el párrafo 3° dispuso que El Estado garantizará, defenderá y preservará ese derecho´; imperativos y obligaciones constitucionales que han llevado al Estado costarricense a establecer un vasto y extenso entramado normativo infra constitucional que se traduce en diversas leyes, reglamentos y decretos ejecutivos, los que se encargan de cuestiones sustantivas y formales para la garantía, tutela y preservación del derecho a un ambiente sano y ecológicamente equilibrado.
Adicionalmente, ese ordenamiento jurídico sub constitucional, ha establecido una organización administrativa extensa y compleja para actuar los imperativos y obligaciones constitucionales contenidas en el párrafo 3° del artículo 50 constitucional. Dentro de este bloque o parámetro de legalidad, creado para desarrollar el artículo 50 de la Constitución, destaca la Ley Orgánica del Ambiente No. 7554 de 4 de octubre de 1995, la que, entre otros extremos, desarrolla y regula temas de primer orden como la participación ciudadana en materia ambiental (Capítulo II), la evaluación del impacto ambiental (Capítulo IV), la protección y mejoramiento del ambiente en asentamientos humanos (Capítulo V), el ordenamiento territorial y la protección del ambiente (Capítulo VI), las áreas silvestres protegidas (Capítulo VII), los recursos marinos, costeros y humedales (Capítulo VIII), la diversidad biológica (Capítulo IX), los recursos naturales como el aire, agua y suelo (Capítulos XI, XII, XIII), así como los forestales y energéticos (Capítulos X y XIV), la contaminación (artículo XV), la organización administrativa ambiental (XVII) y la creación de un Tribunal Ambiental Administrativo para la tutela, defensa y preservación del derecho a un ambiente sano y ecológicamente equilibrado (Capítulo XXI).
También destacan, en ese denso y vasto entramado legislativo, la Ley Forestal, No. 7575 de 5 de febrero de 1996 y sus reformas, la Ley de Protección Fitosanitaria, No. 7664 de 8 de abril de 1997, la Ley de concesión y operación de marinas turísticas, No. 7744 de 19 de diciembre de 1997, la Ley de Biodiversidad, No. 7788 de 30 de abril de 1998, la Ley de Uso, manejo y conservación de suelos, No. 7779 de 30 de abril de 1998 y, más recientemente, la Ley para la Gestión Integral de Residuos, No. 8839 de 24 de junio de 2010. De otra parte, incluso, antes de reformarse parcialmente el artículo 50 de la Constitución, ya existían leyes sectoriales de protección y defensa de ciertos aspectos del medio ambiente, tales como la Ley de Aguas, No. 276 de 27 de agosto de 1942 y sus reformas, la Ley General de Salud, No. 5395 de 30 de octubre de 1973 y sus reformas, la Ley de Salud Animal, No. 6243 de 2 de mayo de 1978, la Ley de Conservación de la Vida Silvestre, No. 7317 de 21 de octubre de 1992 y sus reformas, la Ley de Hidrocarburos, No. 7399 de 3 de mayo de 1994 y la Ley del uso racional de la energía, No. 7447 de 3 de noviembre de 1994.
El marco normativo, en el plano infra legal, es aún más nutrido con diversos reglamentos ejecutivos de esas leyes y decretos que regulan la protección, conservación y defensa del medio ambiente. En este nivel jerárquico de protección, a modo de ejemplo, destaca el Decreto Ejecutivo No. 31849 de 24 de mayo de 2004 que es el Reglamento General sobre los Procedimientos de Evaluación de Impacto Ambiental (EIA) que regula, prolijamente, todas las aristas de los procedimientos de Evaluación del Impacto ambiental de actividades, obras y proyectos, según categorías predefinidas, para prevenir cualquier daño o lesión al ambiente, su revisión y la viabilidad ambiental, su control y seguimiento posterior, denuncias, mecanismos de participación, el responsable ambiental, las garantías de cumplimiento y de funcionamiento y un régimen sancionador. También descuella el Decreto Ejecutivo No. 34136 de 20 de junio de 2007 que es el Reglamento de procedimiento del Tribunal Ambiental Administrativo encargado de conocer y resolver las denuncias por amenaza de infracción o violación efectiva a la legislación tutelar del ambiente y de los recursos naturales y para establecer las indemnizaciones por daños o lesiones a éstos.
II.NECESIDAD DE DESLINDAR EL CONTROL DE CONSTITUCIONALIDAD Y DE LEGALIDAD EN MATERIA DE PROTECCIÓN DEL DERECHO A UN AMBIENTE SANO ECOLÓGICAMENTE EQUILIBRADO. El denso marco normativo o ordenamiento jurídico infra constitucional que desarrolla y fortalece el derecho a un ambiente sano y ecológicamente equilibrado contemplado en el artículo 50 de la Constitución y que procura su garantía, tutela y preservación, obliga a este Tribunal Constitucional a tener que deslindar, en la materia, la órbita del control de constitucionalidad de la esfera del control de legalidad. Tratándose de los mecanismos o de las cuestiones de constitucionalidad, tal y como se denomina el Título IV de la Ley de la Jurisdicción Constitucional, concepto que comprende a la acción de inconstitucionalidad y la consulta de constitucionalidad ±legislativas y judiciales-, la delimitación entre el control de constitucionalidad y de legalidad es clara e inequívoca, por cuanto, sin duda alguna, le compete a este Tribunal Constitucional conocer y resolver tales materias de manera exclusiva y excluyente (artículos 10 de la Constitución, 1°, 2°, inciso b), 73 a 108 de la Ley de la
Jurisdicción Constitucional) así, por ejemplo, cuando se aduce que una norma legal o reglamentaria es inconstitucional por quebrantar el artículo 50, sea el derecho a un ambiente sano y ecológicamente equilibrado, los valores y principios subyacentes en éste. El problema real en la delimitación de sendas esferas de control, surge respecto del recurso o proceso de amparo, por varias razones evidentes que son las siguientes: a) El carácter transversal del derecho a un ambiente sano y ecológicamente equilibrado que penetra todas las capas o estratos del ordenamiento jurídico; b) la textura abierta de la normas constitucionales con lo que cualquier agravio puede parecer que tiene naturaleza constitucional y c) la tendencia de utilizar el proceso de amparo como una vía sustitutiva de la jurisdicción ordinaria. Empero, pueden establecerse algunos criterios, con fundamento en el artículo 7° de la Ley de la Jurisdicción Constitucional, que permiten delimitar el proceso de amparo de otros procesos jurisdiccionales ordinarios.
Así, cuando respecto de una actividad, obra o proyecto haya intervenido un poder público ente u órgano administrativo- efectuando estudios, evaluaciones, informes o valoraciones de cualquier naturaleza, por aplicación del denso y vasto ordenamiento jurídico infra constitucional, es claro que la cuestión debe ser residenciada ante la jurisdicción ordinaria y no la constitucional. Lo mismo sucede cuando un poder público ha omitido cumplir con las obligaciones que le impone, en materia de protección del ambiente y de los recursos naturales, el ordenamiento jurídico infra constitucional sea de naturaleza legal o reglamentario. Bajo esta inteligencia, este Tribunal Constitucional debe conocer y resolver un asunto en el proceso de amparo, únicamente, cuando ningún poder público haya intervenido ejerciendo sus competencias de fiscalización o de autorización y se esté desarrollando una conducta, potencial o actualmente, lesiva del derecho a un ambiente sano y ecológicamente equilibrado, adicionalmente, debe tratarse de una violación de ese derecho evidente y manifiesta o fácilmente constatable ±sin mayor producción o evacuación de prueba- y, además, debe revestir gran relevancia o trascendencia y ser grave.
Si un poder público ha incumplido las obligaciones y deberes que desarrolla el ordenamiento jurídico infra constitucional, el tema tampoco debe ser conocido por la jurisdicción constitucional, por cuanto, además de los mecanismos de denuncia previstos en sede administrativa, la jurisdicción ordinaria, en especial la contencioso-administrativa, tiene competencia suficiente para fiscalizar las omisiones materiales o formales de los entes públicos. Desde el momento en que un poder público ha intervenido ejerciendo sus competencias legales y reglamentarias, sustanciando un procedimiento ±serie concatenada de actuaciones administrativas- y dictando actos administrativos, el asunto estará fuera de la órbita del control de constitucionalidad, lo mismo si incumple u omite sus obligaciones legales y reglamentarias. El recurso de amparo es, esencialmente, un proceso sumario y regido por la simplicidad o, en los términos del artículo 25 de la Convención Americana sobre Derechos Humanos, un recurso que debe ser sencillo y rápido.
Consecuentemente, cuando es menester revisar diversas actuaciones administrativas ±procedimientos y actos formales que se traducen y materializan en un expediente administrativo- el asunto deja de ser materia del amparo, por cuanto, debe acudirse a un proceso de cognición plenaria, sea un proceso de conocimiento pleno que solo es posible sustanciarlo ante la jurisdicción ordinaria. El amparo no está diseñado para contrastar o revisar criterios técnicos o jurídicos vertidos a la luz del ordenamiento jurídico infra constitucional o para evacuar nuevos elementos de convicción para contrastar los que obran en un expediente administrativo que ha sido tramitado durante lapsos prolongados y reposadamente. El proceso de amparo, en definitiva, no puede ser convertido en un proceso ordinario de cognición plena (³ordinariarlo´), por cuanto, se desnaturaliza y pervierte en sus fines y propósitos, de ahí que, cuando un poder público ha intervenido efectuando estudios, avalando u homologando experticias presentadas por las partes interesadas, rendido informes, emitiendo resoluciones administrativas, permisos, licencias o cualquier otro acto administrativo formal o, en general, sustanciando uno o varios procedimientos administrativos, el proceso de amparo no es la vía para fiscalizar tales actuaciones sino el proceso contencioso-administrativo.
La intervención administrativa que se logre verificar o comprobar, es determinante para estimar que el asunto se ubica en el plano o nivel, de por sí abstracto y abierto, de la constitucionalidad o en el más denso de la legalidad. Tampoco, este Tribunal Constitucional debe entrar a conocer y resolver el incumplimiento de las obligaciones que impone el marco normativo legal o reglamentario, puesto que, para tal efecto, existen poderosos y eficientes instrumentos en sede administrativa (régimen sancionador, quejas, el Tribunal Ambiental administrativo) y, en último término, una jurisdicción contencioso-administrativa cuya función es controlar la legalidad de la función administrativa (artículo 49 constitucional), dentro de la que figuran las omisiones legales o reglamentarias, materiales o formales, jurisdicción ordinaria que ahora, con la nueva legislación adjetiva, es más flexible, expedita, célere, plenaria y universal.
Por lo expuesto, estimamos que el presente recurso de amparo debió haber sido rechazado de plano ad limine litis por entrañar una cuestión propia del control de legalidad, sin embargo, no habiendo sido así, consideramos que se debe declarar sin lugar, sin pronunciarme en cuanto al mérito del asunto, por cuanto, le corresponde a la jurisdicción ordinaria, en particular, a la contencioso-administrativa, determinar si las actuaciones y conductas administrativas desplegadas (activas u omisivas) en el sub-lite se ajustan o no, sustancialmente, al ordenamiento jurídico infra constitucional de protección, garantía y preservación del derecho a un ambiente sano y ecológicamente equilibrado.
Por tanto:
Se declara parcialmente con lugar el recurso, únicamente contra la Dirección General de Transporte y Comercialización de Combustible, MINAET. Se condena al Estado al pago de las costas, daños y perjuicios causados con los hechos que sirven de base a esta declaratoria, los que se liquidarán en ejecución de sentencia de lo contencioso administrativo. En cuanto al Área de Salud de Alajuela 1, del Ministerio de Salud, se declara sin lugar el recurso. Notifíquese esta sentencia a Humberto Cerdas Brenes, en calidad de Director General de Transporte y Comercialización, o a quien en su lugar ejerza el cargo, en forma personal. El Magistrado Piza Rocafort salva parcialmente el voto únicamente en cuanto al artículo 50 constitucional. Comuníquese. - Gilbert Armijo S.
