Amparo proceeding (recurso de amparo) filed by X.L.M. on behalf of F.E.D.O.M.A. against the Minister of Finance.
Background:
She explains that this situation has already been established in the opinions of the Procuraduría General de la República C-233-88 of 28 de noviembre de 1988 and C-111-89 of 276 de junio de 1989, which reconsidered the former. She further asserts that, on 16 de noviembre de 2010, the Procuraduría General de la República, through opinion C-234-2010, established that a harmonious interpretation of Transitory Provision IV of Law 6826 and Transitory Provision IV of Law 5662 showed that it was the legislature’s express intent to maintain the percentage of the sales tax allocated to IFAM through Article 35 of Law 3914; she therefore considers that the corresponding amounts must be transferred to that agency from the enactment of the law to the present date. She alleges that, notwithstanding the foregoing, the Ministerio de Hacienda, in official letter DM-888-2011 of 23 de junio de 2011, reiterated to IFAM that it could not transfer the funds, thereby thwarting the projects that the various municipalities seek to carry out.
She argues that the availability of funds to make the corresponding transfer to IFAM, for which the Executive Branch is merely an intermediary, does not depend on uncertain revenue because such funds are generated automatically whenever any sale is made and are therefore always available; nevertheless, the municipalities lose that revenue, and the Ministerio de Hacienda unlawfully transfers it to the central government to cover investments or expenditures other than those established through Law 3914. She says that the Constitutional Chamber has already considered similar situations in decisions 11165-2004 and 02547-2001. She explains that there is no legal impediment to transferring to IFAM the funds derived from the sales tax; rather, this is a decision by the Ministerio de Hacienda that fails to comply with Law 6826 of 8 de noviembre de 1982. She considers her constitutional rights to have been violated.
Justice Castillo Víquez authored the decision; and,
Considerations:
I.Subject matter of the proceeding. The petitioner objects to the Executive Branch’s failure to transfer to IFAM the 2% of the proceeds from the sales tax to which it is legally entitled.
II.Proven facts. The following facts are deemed duly established and relevant to the decision in this matter, either because they have been substantiated or because the respondent failed to address them as ordered in the initial ruling:
a. The General Sales Tax Law, No. 6826 of 8 de noviembre de 1982, established in its Transitory Provision IV that the percentage allocated to the Instituto de Fomento y Asesoría Municipal under Law No. 5662 of 23 de diciembre de 1974, which had initially been established in Law No. 3914 of 17 de julio de 1967, would be transferred (undisputed fact).
b. The Ministerio de Hacienda is not transferring to the Instituto de Fomento y Asesoría Municipal the percentage of the general sales tax to which it is legally entitled (report of the respondent authority).
III.Merits. Regarding the issue of specific allocations—that is, the budgetary principle against earmarking funds (principio presupuestario de la no afectación de los recursos), which in Costa Rica has constitutional protection only in its accounting expression (Article 185 of the Political Constitution)—the Constitutional Chamber has maintained several positions, although in its most recent decisions it has adopted the view that the budgetary legislature (legislador presupuestario) is bound by the ordinary legislature (legislador ordinario). It originally established the view that, regardless of whether the non-budgetary legislature had designated uses for State revenue and regardless of the validity of such intentions, matters concerning expenditures and their purposes fell to the budgetary legislature (see decision No. 1994-005754 at 14:54 hrs on 4 de octubre de 1994). In decisions Nos. 1995-000513 and 1995-000514, for its part, it had indicated that budgetary authorization (autorización presupuestaria) did not entail an obligation to execute the full expenditure approved by Parliament. In this regard, it stated the following:
“The Chamber considers that interpreting, as the proceeding proposes, that the Executive Branch must be compelled to make a payment that does not fall within the circumstances contemplated by constitutional Article 122—that is, that all transfers appearing in the budget must be paid without allowing it to make general assessments regarding the timeliness and advisability of the expenditure for the Public Treasury—would entail disregarding the administrative function constitutionally assigned to it as its own.
IV).- The concept of ‘budgetary authorization’ presupposes the Administration’s obligation to collect revenue, whereas the full amounts allocated for expenditures need not necessarily be used. Furthermore, given the very nature of the Budget Law, the Chamber cannot accept that merely providing therein a specific appropriation for a particular expenditure or beneficiary, as applicable, transforms its purpose into an unavoidable obligation to act or grants the beneficiary an individual right (derecho subjetivo), thereby automatically obligating the Executive Branch to disburse the designated amount without any recognized cause. As the Contraloría General de la República correctly indicates in its report to the Chamber, legislative authorization of the expenditure ceiling does not mean that the budgetary allocation must be fully exhausted; throughout the budget execution process, the Administration will commit the financial resources actually available to it in accordance with its priorities.” Until the year 1995, the Constitutional Chamber’s position could be summarized as follows:
That body of case law, developed over the years, was changed by the Constitutional Chamber in decision No. 1999-009317 at 10:15 hrs on November 26, 1999 (advisory opinion), with Justice Arguedas Ramírez dissenting, when it ruled that the budgetary legislature may not change the allocation of funds to which the ordinary legislature had previously assigned a specific purpose. And based on the single-treasury principle (the accounting expression of the principle that revenues may not be earmarked), which derives from Article 185 of the Political Constitution, such resources must be included in the ordinary budget of the Republic. As can be seen, this new position modifies the rules that had governed this matter until November 26, 1999. It establishes a new criterion, diametrically opposed to the previous one, with serious implications not only of a legal but also of an economic nature. In 2002, by a divided vote—four to three—it upheld the position that taxes earmarked for a specific purpose are constitutional with respect to revenues of a fiscal nature; however, it returned to the original position by establishing “(…) that the mere provision therein of a specific appropriation for a particular beneficiary does not make that beneficiary the holder of a subjective right, nor is the Executive Branch, absent any recognized cause, automatically required to budget and disburse the allocated amount; that legislative authorization of an expenditure does not mean that the budgetary appropriation must be fully exhausted; and that the Administration, in accordance with its priorities, will commit only the resources actually available to it.
This entails a view extending beyond the Executive Branch’s duty to budget earmarked allocations, not strictly in the quantum established by law, but by adjusting it to current national circumstances and seeking good governance” (see decision No. 2002-004884 at 14:59 hrs on May 22, 2002). In that case, it introduced a qualification by clarifying that already-established social programs had to continue operating in accordance with the State’s priorities and the reasonable use of public resources. In summary, it accepted the position that the budgetary legislature was not bound by the ordinary legislature, except in cases involving constitutionally “tied” funds and funds allocated to social programs. Subsequently, it returned to the position that the budgetary legislature is subject to the provisions enacted by the ordinary legislature and therefore may not change the purpose assigned by the latter to the resources (see decision No. 2004-011165 at 9:56 hrs on October 8, 2004).
Finally, in decision No. 2004-014247 at 14:10 hrs on December 15, 2004 (advisory opinion), the Court followed this position, adding the proposition that earmarked allocations linked to the progressive development of fundamental rights are constitutionally lawful. “Under this understanding, insofar as specific tax allocations are aimed at developing, strengthening, and implementing fundamental rights, particularly rights to public benefits, they are substantively consistent with Constitutional Law.” Having said this, and upon better consideration, the Court’s position is that the budgetary legislature is not bound by the ordinary legislature, except in cases involving constitutionally “tied” funds and funds allocated to financing social programs. With respect to the former, this is due to a constitutional mandate. As to the latter, it is because the original constituent authority opted for a social State governed by the rule of law, which entails binding public authorities to this legal and social reality.
Therefore, in the latter case, the Executive Branch, insofar as revenues permit, has an obligation to finance social programs in order to maintain and further develop the social State governed by the rule of law. It should be noted that both the International Covenant on Economic, Social and Cultural Rights and the Protocol of San Salvador, which adds economic, social, and cultural rights to the American Convention on Human Rights, make these rights contingent upon the availability of resources in order to achieve progressively, and in accordance with domestic legislation, their full realization (Articles 2 and 1, respectively). Thus, given that the petitioner’s claim does not fall within either of the two stated exceptions, the petition for amparo must be denied, as it hereby is.

DISSENTING OPINION OF JUSTICES ARMIJO SANCHO, JINESTA LOBO, AND CRUZ CASTRO, AUTHORED BY THE SECOND We, the undersigned Justices, dissent and would grant the petition, based on the following considerations:
Xenia Lozano Makay filed the petition for amparo on behalf of the Western Federation of Municipalities of Alajuela (FEDOMA). The petitioner alleged that the Ministry of Finance refuses to transfer to the Municipal Development and Advisory Institute (IFAM) the amount of 2% of the proceeds from the sales tax, for the purpose of creating a capital fund through which local governments would be financed by means of loans for the construction of sanitary and environmental sanitation works, pursuant to Article 35 of Law No. 3914 and its amendments (the applicable provision, according to opinion No. C - 234 – 2010 of November 16, 2010, issued by the Office of the Attorney General of the Republic). After analyzing the various positions historically adopted by this Court on the matter, the majority of the Constitutional Chamber chose as the governing rule that the budgetary legislature is not bound by the ordinary legislature, except: a) when constitutionally committed funds are involved, and b) when funds are allocated to financing social programs.
Because the present matter did not fall within either of the exceptions described, the petition was denied. We disagree, however, with the assessments made. Undoubtedly, the failure to transfer the aforementioned funds to the Municipal Development and Advisory Institute (IFAM) has direct repercussions on the establishment of the capital fund intended to provide loans for the construction of sanitary and environmental sanitation works. We respectfully consider that the majority opinion overlooks the fact that, pursuant to Article 50 of the Political Constitution, “(…) Every person has the right to a healthy and ecologically balanced environment (…) The State shall guarantee, defend, and preserve that right (…)” (emphasis not in the original). Without question, through the decision taken, the Ministry of Finance is obstructing the development of projects that would contribute not only to the progressive realization of the right to a healthy and ecologically balanced environment—an obligation borne by the Costa Rican State, both centralized and decentralized, as follows from the cited provision as well as Article 169 of the supreme body of law, which grants municipal corporations the administration of local interests and services—but also to the protection of the rights to health and life, which are deeply connected to the former. For the foregoing reasons, we depart from the majority’s position and would grant the petition with its attendant consequences.

Resultando:
Redacta el Magistrado Castillo Víquez; y,
Considerando:
I.Objeto del recurso. La recurrente objeta que el Poder Ejecutivo no gire al IFAM lo correspondiente al 2% del producto de impuesto de ventas que legalmente le corresponde.
II.Hechos probados. De importancia para la decisión de este asunto, se estiman como debidamente demostrados los siguientes hechos, sea porque así han sido acreditados o bien porque el recurrido haya omitido referirse a ellos según lo prevenido en el auto inicial:
<![if !supportLists]>a. <![endif]>La Ley de Impuesto General sobre las Ventas, No. 6826 del 8 de noviembre de 1982, estableció, en su transitorio IV, que se girará el porcentaje asignado al Instituto de Fomento y Asesoría Municipal en la Ley No. 5662 del 23 de diciembre de 1974, que inicialmente había sido establecido en la Ley No. 3914 del 17 de julio de 1967 (hecho no controvertido).
<![if !supportLists]>b. <![endif]>El Ministerio de Hacienda no está girando al Instituto de Fomento y Asesoría Municipal, el porcentaje que legalmente le corresponde del impuesto general sobre las ventas (informe de la autoridad recurrida).
III.Sobre el fondo. Acerca del tema de los destinos específicos, es decir, sobre el principio presupuestario de la no afectación de los recursos, el cual sólo tiene cobertura constitucional, en nuestro medio, en su expresión contable (artículo 185 Constitución Política), la Sala Constitucional ha sostenido varios criterios, aunque en las últimas resoluciones asume la postura de que el legislador presupuestario se encuentra vinculado al legislador ordinario. Originalmente, había sentado el criterio que, independientemente, de que el legislador no presupuestario hubiera establecido destinos para los ingresos del Estado y de la validez de tales pretensiones, era al legislador presupuestario a quien le correspondía la materia del gasto y su destino (véase el voto No. 1994-005754 de las 14:54 hrs del 4 de octubre de 1994). Por su parte, en las resoluciones números 1995-000513 y 1995-000514, había indicado que la autorización presupuestaria no llevaba aparejada la obligación de ejecutar el gasto total aprobado por el Parlamento. Al respecto expresó lo siguiente:
“La Sala estima que interpretar, como lo hace el recurso, que se deba obligar al Poder Ejecutivo a realizar un pago que no se encuentra en los supuestos que prevé el artículo 122 constitucional, esto es, que se deban pagar todas las transferencias que aparecen en el presupuesto, sin permitirle hacer valoraciones generales de oportunidad y conveniencia del gasto para la Hacienda Pública, implicaría desconocer la función de administración que constitucionalmente le es atribuida como propia.
IV).- El concepto de "autorización presupuestaria", presupone la obligación de la Administración de recaudar los ingresos, mientras que no es forzoso utilizar íntegramente los montos de los gastos. Además, por la misma naturaleza de la Ley de Presupuesto, la Sala no puede admitir que la simple previsión en ella de una partida específica para un determinado gasto o beneficiario, según sea el caso, transforme al objeto en una ineludible obligación de hacer o haga al beneficiario acreedor de un derecho subjetivo y que el Poder Ejecutivo, como consecuencia y sin causa alguna reconocida, esté automáticamente obligado a desembolsar el monto destinado. Como bien lo indica la Contraloría General de la República en su informe a la Sala, la autorización legislativa del límite del gasto no conlleva que la previsión presupuestaria tenga que agotarse íntegramente y la administración, de acuerdo con sus prioridades, comprometerá los recursos económicos con que efectivamente cuente, durante todo el proceso de ejecución del presupuesto”.
Hasta el año de 1995 la postura de la Sala Constitucional se podía resumir de la siguiente manera:
Esa construcción jurisprudencial, elaborada durante años, fue cambiada por la Sala Constitucional en el voto No. 1999-009317 de las 10:15 hrs del 26 de noviembre del 1999, (opinión consultiva), con el voto salvado del Magistrado Arguedas Ramírez, al disponer que el legislador presupuestario no puede variar el destino de los fondos a los que el legislador ordinario señaló uno previamente. Y con base en el principio de caja única (expresión contable del principio de la no afectación de los recursos), que se desprende del artículo 185 de la Constitución Política, tales recursos deben ser incluidos en el presupuesto ordinario de la República. Según puede observarse, en esta nueva postura, se modifican las reglas que estuvieron vigentes en esta materia hasta el 26 de noviembre de 1999. Se fija un nuevo criterio, diametralmente opuesto al anterior, que tiene serias implicaciones no solo de naturaleza jurídica sino económica.
Para el año 2002, en una votación dividida –cuatro contra tres-, mantiene la tesis de la constitucionalidad de los impuestos con destino específico para ingresos de naturaleza fiscal, sin embargo, vuelve a la tesis original al establecer “(…) que la simple previsión en ella de una partida específica para un determinado beneficiario haga a éste acreedor de un derechos subjetivo y que el Poder Ejecutivo, sin causa alguna reconocida, esté automáticamente obligado a presupuestar y desembolsar el monto destinado; que la autorización legislativa de un gasto no conlleva que la previsión presupuestaria tenga que agotarse íntegramente y que la administración, de acuerdo con sus prioridades comprometerá únicamente los recursos con que efectivamente cuente. Lo que implica una visión más allá del deber por parte del Poder Ejecutivo de presupuestar los destinos específicos no estrictamente en el cuantum establecido por ley, sino ajustándolo a la realidad nacional actual y buscando una buena gobernabilidad” (véase el voto No. 2002-004884 de las 14:59 hrs del 22 de mayo del 2002).
En este caso introdujo un matiz, al aclarar que cuando se trata de los programas sociales que ya han sido gestados, debían continuar funcionando de acuerdo con las prioridades del Estado y al razonable uso de los recursos públicos. En resumen, aceptó la tesis de que el legislador presupuestario no estaba vinculado por el ordinario, salvo en los casos de fondos “atados” constitucionalmente y aquellos que se destinan a los programas sociales. Posteriormente, vuelve a la tesis de que el legislador presupuestario queda sujeto a lo dispuesto por el legislador ordinario, por lo que no puede variar el destino asignado por éste a los recursos (véase el voto No. 2004-011165 de las 9:56 hrs del 8 de octubre del 2004). Finalmente, en la resolución No. 2004-014247 de las 14:10 hrs del 15 de diciembre del 2004 (opinión consultiva), el Tribunal ha seguido esta postura, adicionando la tesis de la licitud constitucional de los destinos específicos vinculados al desarrollo progresivo de los derechos fundamentales.
“Bajo esta inteligencia, en la medida que los destinos tributarios específicos estén orientados a desarrollar, fortalecer y actuar los derechos fundamentales, sobre todo los de prestación, resultan sustancialmente conformes con el Derecho de la Constitución”. Dicho lo anterior, y bajo una mejor ponderación, la postura del Tribunal es que el legislador presupuestario no está vinculado por el ordinario, salvo en los casos de fondos “atados” constitucionalmente y aquellos que se destinan a financiar los programas sociales. En relación con los primeros, por imperativo constitucional. En cuanto a los segundos, porque el constituyente originario optó por un Estado social de Derecho, lo que conlleva una vinculación de los poderes públicos a esta realidad jurídica y social. Ergo, en este último caso, el Poder Ejecutivo, en la medida que los ingresos así lo permitan, tiene la obligación de financiar los programas sociales para mantener y profundizar el Estado social de Derecho.
Nótese que tanto en el Pacto Internacional de Derechos Económicos, Sociales y Culturales como en el Protocolo de San Salvador, que adiciona los derechos económicos, sociales y culturales a la Convención Americana sobre Derechos Humanos, se condicionan estos derechos a la disponibilidad de los recursos, a fin de lograr progresivamente, y de conformidad con la legislación interna, su plena efectividad (artículos 2 y 1, respectivamente). Así, en vista de que la pretensión de la recurrente no es subsumible en ninguna de las dos excepciones señaladas, el recurso de amparo debe ser declarado sin lugar, como en efecto se hace.
Por tanto:
Se declara sin lugar el recurso. Los Magistrados Armijo Sancho, Jinesta Lobo y Cruz Castro salvan el voto y declaran con lugar el recurso con todas sus consecuencias.

VOTO SALVADO DE LOS MAGISTRADOS ARMIJO SANCHO, JINESTA LOBO Y CRUZ CASTRO, CON REDACCION DEL SEGUNDO Los suscritos Magistrados salvamos el voto y declaramos con lugar el recurso, con sustento en las siguientes consideraciones:
Xenia Lozano Makay, planteó el recurso de amparo a favor de la Federación Occidental de Municipalidades de Alajuela (FEDOMA). La recurrente alegó que el Ministerio de Hacienda se niega a girar al Instituto de Fomento y Asesoría Municipal (IFAM), el monto de 2% del producto del impuesto sobre las ventas, con el objetivo de formar un fondo de capital, por medio del cual se financiaría a los gobiernos locales mediante créditos para la construcción de obras sanitarias y de saneamiento ambiental, esto, de conformidad con el artículo 35 de la Ley No. 3914 y sus reformas (norma aplicable, de acuerdo con el dictamen No. C - 234 – 2010 de 16 de noviembre de 2010, de la Procuraduría General de la República). La mayoría de la Sala Constitucional - luego de analizar las diversas posiciones que, históricamente, este Tribunal ha asumido sobre el tema - optó por considerar como regla la no vinculatoriedad del legislador presupuestario, al ordinario, salvo: a) cuando se trate de fondos comprometidos constitucionalmente y, b) aquellos que se destinan a financiar los programas sociales.
Al no encontrarse el presente asunto en alguna de las excepciones descritas, el recurso fue desestimado. Sin embargo, nosotros disentimos de las valoraciones efectuadas Indudablemente, la omisión de transferir los fondos aludidos al Instituto de Fomento y Asesoría Municipal (IFAM), tiene repercusiones directas en la constitución del fondo de capital destinado a otorgar créditos para la edificación de obras sanitarias y saneamiento ambiental. Consideramos, respetuosamente, que el voto de mayoría pierde de vista que, a tenor de lo preceptuado por el articulo 50 de la Constitución Política "(…) Toda persona tiene derecho a un ambiente sano y ecológicamente equilibrado (…) El Estado garantizará, defenderá v preservará ese derecho (…) " (el énfasis no pertenece al original). Sin lugar a dudas, con la decisión tomada, el Ministerio de Hacienda obstaculiza el desarrollo de proyectos que redundarían, no solamente en la progresiva realización del derecho a un ambiente sano y ecológicamente equilibrado - obligación que pesa sobre el Estado costarricense, centralizado y descentralizado, según se desprende de la lectura del citado numeral, así como del ordinal 169 del supremo cuerpo normativo, que confiere a la corporaciones municipales la administración de los intereses y servicios locales - sino sobre la protección del derecho a la salud y a la vida, profundamente vinculados al anterior. Es por lo expuesto que nos separamos del criterio de mayoría y declaramos con lugar el recurso con sus consecuencias.
