>CASE FILE No. 8 and 6 Case: 11-016140-0007-CO Decision No. 2012002021 CONSTITUTIONAL CHAMBER OF THE SUPREME COURT OF JUSTICE. San José, at ten hours and five minutes on diecisiete de febrero de dos mil doce. Petition for constitutional relief (recurso de amparo) filed by Xxxx against the Ministry of Public Education, Ministry of Culture, Ministry of Health, and Municipality of Puntarenas. Findings:

  1. 1In a written submission received by the Secretariat of the Chamber at 18:40 hours on 11 de diciembre de 2011, the petitioner files a petition for constitutional relief against the Ministry of Public Education, Ministry of Culture, Ministry of Health, and Municipality of Puntarenas, and states that: a) The structure of Escuela Nuestra Señora del Carmen de Puntarenas is deteriorated, placing the physical safety of students, teachers, and parents at risk during the school year; nevertheless, the respondents have failed to remedy the situation. During the rainy season, the assembly hall floods, preventing assemblies or civic ceremonies from being held there; b) On 11 de diciembre of the current year, he sent the corresponding complaint to the respondents by email; c) The aforementioned school was declared part of the national heritage, and although the Ministry of Culture has a budget to undertake such repairs, they have not been performed in this case, and the structure of Escuela Nuestra Señora del Carmen de Puntarenas appears increasingly damaged each day. He requests that the petition be granted.
  2. 2CARLOS VILLALOBOS ARGUELLO, in his capacity as Director of the Directorate of Educational Infrastructure and Equipment of the Ministry of Public Education, reports under oath that: a) Although responsibility for attending to educational institutions lies with that Directorate, because the property has been declared National Heritage, the actions must be coordinated between that Directorate and the Center for Research and Conservation of National Heritage of the Ministry of Culture and Youth; b) Following the technical report issued by the Center for Research and Conservation of National Heritage, they proceeded to prepare a bill of quantities, a reference budget, and technical specifications. All of this was forwarded to the Contracting Department by official letter DIEE-DP-0118-2010 so that it could issue the corresponding authorization to commence the direct contracting procedure (contratación directa) instituted for that purpose.Official letter DIEE-DC-A-0240-2010 states: “Direct contracting for the restoration of Escuela El Carmen, Puntarenas, is authorized.” The Contracting Department therefore proceeded to hold the bid-opening proceeding. By official letter DIEE-DC-1840-2010, the Contracting Department recommended that the school’s Board of Education declare the direct contracting procedure unsuccessful; c) Because replacement of the electrical system was considered extremely urgent, authorization was requested from the Office of the Comptroller General of the Republic to commence an emergency direct contracting procedure. Authorization was granted by official letter DCA-2954, and therefore, by official letter DIEE-DC-1216-201, a copy of the duly executed public works contract, authorized by the Office of the Comptroller General of the Republic, was forwarded for purposes of coordinating the notice to proceed and inspection of the project; d) Official letter DIEE-DEC-3132-2011 from the Head of the Execution and Control Department states that the design phase would begin on lunes 02 de enero de 2012; e) In parallel with execution of the electrical-system replacement project, that Directorate will work on carrying out the contracting process to commence the remodeling of the infrastructure of Escuela Barrio el Carmen de Puntarenas, as recommended by the Heritage Center, which is not considered urgent. He requests that the petition be dismissed.
  3. 3RAFAEL ÁNGEL RODRÍGUEZ CASTRO, in his capacity as Municipal Mayor of the Central Canton of Puntarenas, reports under oath that: a) Official letter UTGV-0741-2011, issued by the Road Management Technical Unit, notes that the streets surrounding the school in question are currently in acceptable condition and show no standing water on the roadway surface or in the gutters; likewise, with respect to the condition of the sewer system, the inspection detected no defects that would cause flooding problems; b) The flooding of the grounds where the school is located is due to a difference in elevation of approximately 25 cm. between the sidewalk and the courtyards of the educational institution, which consequently act as water-collection areas. The Municipality is not responsible for remedying this situation because it is an internal problem at the educational institution, which is owned by the Ministry of Public Education and, because it is National Heritage, falls under the Ministry of Culture. He requests that the petition be dismissed.
  4. 4ERICA JIMÉNEZ VALVERDE, in her capacity as Director of the Puntarenas Health Governing Area, reports under oath that: a) Technical Report No. 078-Reg-2011 states that the building inspected is deteriorated (it has infrastructure problems involving its walls, roofs, ceiling, and floors; the entire electrical system of the building is in poor condition; and the roof covering has holes in the zinc sheets over the assembly hall), compounded by the limited maintenance it has received. No repairs have been made to the property since it was declared National Architectural Heritage in octubre de 1990. The alleged flooding of the assembly hall was not verified; b) No health order (orden sanitaria) was issued because there is an emergency-procedure construction contract between the School’s Board of Education and Empresa R Y S Consultores,S.A., under which execution of this contract was agreed upon as a result of the administrative contracting process, using the emergency direct-contracting procedure duly authorized by the Administrative Contracting Division of the Office of the Comptroller General of the Republic in its official letter DCA-2954;
  • c)The assessment of that structure identified relevant issues involving the electrical system, problems with the roof, window frames, and other matters that could potentially endanger the safety of the children, teachers, and other persons who attend the school; d) That Directorate will conduct the corresponding follow-up to determine when the restoration work begins. She requests that the petition be dismissed.
  1. 5ADRIÁN VINDAS CHÁVEZ, in his capacity as Acting Director of the Center for Research and Conservation of Cultural Heritage of the Ministry of Culture and Youth, reports that: a) Pursuant to Article 9(a) of Law 7555, Ley de Patrimonio Histórico Arquitectónico de Costa Rica, the owner is obligated to “properly conserve, preserve, and maintain the property”; accordingly, they reject the allegations because responsibility does not rest with the Center for Research and Conservation of Cultural Heritage, but rather, in this case, with the Ministry of Public Education; b) In fulfillment of the Center’s duties, they have sent numerous official letters to the Ministry of Public Education formally delivering the technical specifications, construction plans, and budget for the architectural restoration, structural reinforcement, lighting system, and electrical outlets at Escuela el Carmen de Puntarenas; d) The Center for Heritage of the Ministry of Culture and Youth’s 2012 budget does not include funds for investment in Escuela El Carmen en Puntarenas. He requests that the petition be dismissed.
  2. 6The legal requirements have been observed in the proceedings conducted. Justice Cruz Castro drafted the opinion; and,

Whereas:

I.Subject matter of the petition.- The petitioner alleges that the infrastructure of Escuela Nuestra Señora del Carmen en Puntarenas is severely deteriorated (walls, gardens, electrical service connection, and assembly hall), and that flooding occurs in the assembly hall, all of which endangers the physical safety of students and teachers. He states that the educational institution was declared National Architectural Heritage and that several entities are therefore responsible for providing adequate maintenance to ensure its proper operation and preservation. Nevertheless, despite his efforts, the respondents have taken no steps to restore it.

II.Proven facts.- The following facts are deemed duly established and relevant to the determination of this matter, either because they have been substantiated or because the respondent failed to address them as ordered in the initial ruling:

  • a)Following the technical report issued by the Center for Research and Conservation of National Heritage, the Directorate of Educational Infrastructure and Equipment of the Ministry of Education proceeded to prepare a bill of quantities, a reference budget, and technical specifications. All of this was forwarded to the Contracting Department by official letter dated 27 de enero del 2010 so that it could issue the corresponding authorization to commence the direct contracting procedure instituted for that purpose (see report).
  • b)The direct contracting procedure for the restoration of Escuela El Carmen, Puntarenas, was declared unsuccessful by the Board of Education upon the recommendation made by the Contracting Department in an official letter dated 25 de noviembre del 2010 (see report).
  • c)Because replacement of the electrical system was considered extremely urgent, on 20 de setiembre del 2011, the Directorate of Educational Infrastructure and Equipment of the Ministry of Education requested authorization from the Office of the Comptroller General of the Republic to commence an emergency direct contracting procedure. Authorization was granted by official letter DCA-2954 dated 10 de noviembre del 2011 (see report and evidence submitted).
  • d)Official letter DIEE-DEC-3132-2011 dated 15 de diciembre del 2011 from the Head of the Execution and Control Department states that the design phase would begin on lunes 02 de enero de 2012 (see report).
  • e)The streets surrounding the school in question are in acceptable condition and show no standing water on the roadway surface or in the gutters; likewise, no defects that would cause flooding problems were detected in the sewer system (see municipal report).
  • f)The flooding of the grounds where Escuela is located is due to is due to a difference in elevation of approximately 25 cm. between the sidewalk and the grounds of the Educational Center (see municipal report). g) That subsequent to the filing of this proceeding, according to an inspection conducted by the Ministerio de Salud on December 15, 2011, the building housing the School in question was found to be deteriorating: its walls, roofs, ceiling, and floors have structural problems; the building’s entire electrical system is in poor condition; and the roof covering and the zinc sheets in the assembly hall have holes, compounded by the limited maintenance it has received. It was determined that no repairs have been made to the property since it was declared National Architectural Heritage in October 1990. The reported flooding of the assembly hall was not substantiated (see report of the Ministerio de Salud).
  • h)That, according to the aforementioned inspection by the Ministerio de Salud, significant issues were identified involving the electrical system, roof, window frames, and other elements that could potentially endanger the safety of the children, teachers, and other persons who attend the school (see report of the Ministerio de Salud).

III.On the right to enjoy a healthy and ecologically balanced environment in Educational Centers.- The right to health recognized in Articles 21 of the Constitución Política, 1 and 11 of the Declaración Americana de los Derechos y Deberes del Hombre, 4 of the Convención Americana sobre Derechos Humanos, and 10 of the Protocolo Adicional a la Convención Americana sobre Derechos Humanos en Materia de Derechos is closely linked to the right to live in a healthy and balanced environment, enshrined in Article 50 of the Constitution. Environmental quality is a fundamental parameter of quality of life, as are health, food, work, housing, and education, among others. Consequently, the State has an obligation to ensure adequate environmental protection, for which purpose it must take the measures necessary to keep the environment free from pollution and to ensure that alterations caused by either humans or nature, in the immediate or distant surroundings, do not harm the environment or the health of the people who inhabit it.

This right is especially recognized when it is associated with other fundamental rights, such as the right to education. The latter is established as a fundamental right embodied in the public service provided by the State through the country’s various educational centers. Therefore, the least the State can do when providing this public service is to avoid infringing other fundamental rights, such as the right to health and to a healthy environment, of both the students and the teaching and administrative personnel of the educational institution.

IV.On the specific case.- From the reports submitted by the representatives of the respondent authority—which are deemed to have been given under oath, with the consequences, including criminal consequences, provided for in Article 44 of the Law governing this Jurisdiction—and the evidence submitted for resolution of this matter, this Chamber finds that Escuela Nuestra Señora del Carmen de Puntarenas does indeed suffer from certain infrastructure deficiencies that have endangered the safety—and consequently the health—of students, teaching and administrative personnel, parents, and others. As reported by the authorities of the Ministerio de Salud, the inspection conducted in December 2011 identified problems with the electrical system, roof, window frames, and other elements that could potentially endanger the safety of the children, teachers, and other persons who attend the school; the building is deteriorating and has structural problems involving its walls, roofs, ceiling, and floors; the building’s entire electrical system is in poor condition; and the roof covering and zinc sheets in the assembly hall have holes, compounded by the limited maintenance it has received.

It was determined that no repairs have been made to the property since it was declared National Architectural Heritage in October 1990. In the same vein, both the Director del Centro de Investigación y Conservación del Patrimonio Cultural del Ministerio de Cultura y Juventud and the Director de Infraestructura y Equipamiento Educativo del Ministerio de Educación Pública acknowledge that the educational center requires restoration. The former acknowledges this when reporting that, since August 2009, numerous official communications have been sent to the Ministerio de Educación Pública formally delivering the technical specifications, construction plans, and budget for the architectural restoration, structural reinforcement, and lighting and electrical outlet system work at Escuela el Carmen de Puntarenas. The latter acknowledges this when reporting that, in January 2010, they initiated a direct contracting procedure (procedimiento de contratación directa) to carry out the work (although that procedure was subsequently declared unsuccessful in November 2010), and when reporting that, in September 2011, they initiated an urgent direct contracting procedure, under authorization from the Contraloría General de la República, to replace the electrical system (which supposedly was to begin in January 2012).

Nevertheless, note the inertia of the authorities of the Ministerio de Educación Pública, who have made no repairs since 1990—the year in which the property was declared National Heritage. Despite knowing that certain restoration work was urgently needed, they did not initiate the procedure until January 2010. Moreover, after the procedure proved unsuccessful in November 2010, they allowed practically ONE YEAR to pass before proceeding in September 2011 with the urgent contracting procedure, and then only for the electrical system. Although it is reported that, in parallel with the implementation of the electrical-system replacement project, that Directorate would work on carrying out the contracting process to begin the infrastructure-renovation work at Escuela Barrio el Carmen de Puntarenas recommended by Patrimonio, the measures undertaken do not appear to have been either effective or sufficient.

Note that no specific dates, schedule or plan, or official communications documenting the measures taken in that regard are provided. In this respect, this Court cannot but be surprised that the Administración Pública itself has failed to comply with the requirements imposed by the State itself for operating an educational center of this kind. Moreover, it is also surprising that the authorities of the Ministerio de Salud report that, despite confirming the risk to personal safety, they did not issue any sanitary order (orden sanitaria). They justify this conduct by the existence of a contract awarded through an urgent procedure for construction work, but failed to realize that the contracted work covered only the electrical system and excluded the remaining problems they themselves had identified (roofs and ceilings, window frames and other elements, problems involving walls and floors, and holes in the zinc sheets in the assembly hall).

Accordingly, this Chamber finds that the Ministerio de Educación Pública bears primary responsibility for the violations at issue, followed by the Ministerio de Salud for failing to issue the corresponding order. No serious omissions are observed with respect to the Centro de Conservación del Patrimonio Cultural del Ministerio de Cultura y Juventud, since it apparently formally delivered the technical specifications, construction plans, and budget for the architectural restoration, structural reinforcement, and lighting and electrical outlet system work at Escuela el Carmen de Puntarenas. Thus, the delay in the work was not its responsibility, but rather resulted from the inertia of the Ministerio de Educación Pública. Likewise, no responsibility is attributed to the Municipalidad del cantón, because it is reported that the streets surrounding the school in question are in acceptable condition and have no standing water on the roadway surface or in the gutters; the same applies to the condition of the sewer system; and the flooding of the grounds may be due to a difference in elevation of approximately 25 cm. between the sidewalk and the grounds of the Educational Center.

In conclusion, because it has been established that the infrastructure conditions at Escuela Nuestra Señora del Carmen de Puntarenas—including the electrical system, roofs, ceilings, floors, walls, window frames, assembly hall, and other elements—have endangered personal safety, this proceeding is granted, and the Ministerio de Educación Pública is ordered to make the necessary improvements so that the right to health and the right to enjoy a healthy and ecologically balanced environment are respected for all persons who attend that educational center. The Ministerio de Salud is likewise ordered to monitor subsequent developments, as stated in the operative part (parte dispositiva) of this decision.

The amparo proceeding (recurso de amparo) is GRANTED. Consequently, LEONARDO GARNIER RIMOLO, in his capacity as Ministro de Educación Pública, or whoever holds that office in his stead, is ordered to issue the necessary instructions so that the required sanitary and infrastructure improvements are immediately made at Escuela de Nuestra Señora del Carmen de Puntarenas, in order to respect the right to health and the right to enjoy a healthy and ecologically balanced environment of all persons who attend it, particularly by remedying the problems involving the electrical system, roofs, ceilings, floors, walls, window frames, assembly hall, and other elements. ERICA JIMÉNEZ VALVERDE, in her capacity as Directora del Área Rectora de Salud de Puntarenas del Ministerio de Salud, or whoever holds that office in her stead, is likewise ordered to take all appropriate measures to monitor and follow up on the actions taken in this regard.

All of the foregoing is ordered with the warning that both authorities could incur the offense defined in Article 71 of the Ley de la Jurisdicción Constitucional, which provides that any person who receives an order issued in an amparo proceeding that the person must comply with or enforce, and who fails to comply with or enforce it, shall be punished by imprisonment for three months to two years or by a fine of twenty to sixty days, provided that the offense is not subject to a more severe penalty. The State is ordered to pay the legal costs and the damages and losses caused by the facts underlying this ruling, which shall be assessed during enforcement of the judgment before the contentious-administrative jurisdiction. >EXPEDIENTE N° 8 y 6 SALA CONSTITUCIONAL DE LA CORTE SUPREMA DE JUSTICIA. San José, a las diez horas cinco minutos del diecisiete de febrero de dos mil doce. Recurso de amparo interpuesto por Xxxx , contra Ministerio de Educación Publica, Ministerio de Cultura, Ministerio de Salud y la Municipalidad de Puntarenas. Resultando:

  1. 1Por escrito recibido en la Secretaría de la Sala a las 18:40 horas del 11 de diciembre de 2011, el recurrente interpone recurso de amparo contra Ministerio de Educación Publica, Ministerio de Cultura, Ministerio de Salud y la Municipalidad de Puntarenas y manifiesta que: a) La estructura de la Escuela Nuestra Señora del Carmen de Puntarenas está deteriorada, lo que pone en riesgo la integridad física de alumnos, docentes y padres de familia durante el curso lectivo; pese a ello, los recurridos han sido omisos en resolver esa situación. En la época lluviosa, el salón de actos se inunda, lo que impide que se realicen asambleas o actos cívicos dentro del mismo; b) El 11 de diciembre del presente año, envió vía correo electrónico la respectiva denuncia a los accionados; c) La citada escuela fue declarada patrimonio nacional, y pese a que el Ministerio de Cultura cuenta con presupuesto para reparar esas obras, en este caso no se ha hecho y cada día la Escuela Nuestra Señora del Carmen de Puntarenas se aprecia más dañada en su estructura. Solicita se declare con lugar el recurso.
  2. 2Informa bajo juramento, CARLOS VILLALOBOS ARGUELLO, en su calidad de Director de la Dirección de Infraestructura y Equipamiento Educativo del Ministerio de Educación Publica, que: a) Pese a que la atención de los centros educativos es competencia de esta dirección, al ser un inmueble declarado

Patrimonio Nacional, las acciones deben ser coordinada entre esa dirección y el Centro de Investigación y Conservación del Patrimonio Nacional de Ministerio de Cultura y Juventud; b) Luego del informe técnico emitido por el Centro de Investigación y Conservación del Patrimonio Nacional, proceden a elaborar una lista de cantidades de obra, presupuesto referencial y especificaciones técnicas. Todo lo cual fue trasladado al Departamento de Contrataciones, mediante oficio DIEE-DP-0118-2010 a fin de que emita la respectiva autorización para dar inicio con la contratación directa instaurada al efecto. Mediante oficio DIEE-DC-A-0240-2010 se indica ³Se autoriza la contratación directa para la restauración de la Escuela El Carmen, Puntarenas«´. Así que el Departamento de Contrataciones procede a realizar el acto de apertura de ofertas. Mediante oficio DIEE-DC-1840-2010 el Departamento de Contrataciones recomienda a la Junta de Educación de dicha Escuela declarar infructuosa la contratación directa de referencia; c) Por considerarse de extrema urgencia la sustitución del sistema eléctrico, se procedió a solicitar ante la Contraloría General de la Republica autorización para dar inicio con un procedimiento de contratación directa con carácter de urgencia.

Mediante oficio DCA-2954 se otorgó la autorización, así que mediante oficio DIEE-DC-1216-201 se traslada copia del contrato de obra pública suscrito y debidamente autorizado por la Contraloría General de la República, a fin de coordinar la orden de inicio e inspección del proyecto; d) Mediante oficio DIEE-DEC-3132-2011 del Jefe del Departamento de Ejecución y Control se indica que la etapa de diseño arranca a partir del lunes 02 de enero de 2012; e) De manera paralela a la ejecución del proyecto de sustitución del sistema eléctrico, esa Dirección estará trabajando en la ejecución del proceso de contratación para dar inicio a las obras de remodelación de la infraestructura de la Escuela Barrio el Carmen de Puntarenas, recomendadas por Patrimonio y que no se consideran urgencia. Solicita que se desestime el recurso planteado.

  1. 3Informa bajo juramento RAFAEL ÁNGEL RODRÍGUEZ CASTRO, en su calidad de Alcalde Municipal del Cantón Central de Puntarenas, señala que: a) Mediante oficio UTGV-0741-2011 rendido por la Unidad Técnica de Gestión Vial se hace notar que en la actualidad el estado de las calles que rodean la escuela en mención, se encuentran en una condición aceptable y no presentan estancamientos de agua en la superficie de ruedo ni en las cunetas, lo mismo en cuanto al estado del sistema de alcantarillado que al momento de dicha inspección no han sido detectadas fallas que den origen a problemas de inundación; b) La inundación de los terrenos donde esta ubicada la Escuela se debe a una diferencia de nivel de aproximadamente 25 cm. entre la acera y los patios del Centro Educativo, por lo que actúan como acumuladoras de agua, lo cual dicha situación no corresponde solucionar a la Municipalidad pues es un problema a lo interno del centro educativo, propiedad del Ministerio de Educación Publica y por ser Patrimonio Nacional al Ministerio de Cultura. Solicita se desestime el recurso planteado.
  2. 4Informa bajo juramento, ERICA JIMÉNEZ VALVERDE, en su calidad de Directora del Área Rectora de Salud de Puntarenas, que: a) Mediante oficio N° de informe técnico 078-Reg-2011 se indica que la edificación del inmueble visitado se encuentra en deterioro (presenta problemas en cuanto a su infraestructura en

paredes, techos, cielo raso, pisos, toda la instalación eléctrica del edificio está en mal estado y la cubierta de techos, huecos en láminas de zinc en el salón de actos), aunado al poco mantenimiento que ha recibido. Desde que se declaró Patrimonio Arquitectónico Nacional, en octubre de 1990, no se han hecho reparaciones al inmueble. Referente a la inundación del salón de actos no se comprobó tal denuncia; b) No se procedió a girar ninguna orden sanitaria porque existe un contrato por procedimiento de urgencia para construcción de obras entre la Junta de Educación de la Escuela y la Empresa R Y S Consultores,S.A. donde se ha acordado la suscripción del presente contrato motivado por el proceso de contratación administrativa bajo la modalidad de contratación directa de procedimiento de urgencia debidamente autorizado por la División de la Contraloría Administrativa de la Contraloría General de la Republica, en su oficio DCA-2954; c) Al realizar la valoración de esa estructura se logró determinar aspectos relevantes como instalación eléctrica, problemas en el techo, marcos de ventanas y otros, que pueden eventualmente atentar contra la seguridad de los niños, profesores y otras personas que asisten a dicha escuela; d) Esa Dirección dará el seguimiento que corresponde a efectos de determinar el inicio de las obras de restauración. Solicita se desestime el recurso planteado.

  1. 5Informa bajo juramento, ADRIÁN VINDAS CHÁVEZ, en su condición de Director a.i. del Centro de Investigación y Conservación del Patrimonio Cultural del Ministerio de Cultura y Juventud manifiesta que: a) Según el articulo 9 inciso a) de la ley 7555 Ley de Patrimonio Histórico Arquitectónico de Costa Rica es obligación del propietario ³conservar, preservar y mantener adecuadamente los

bienes´en virtud de lo cual rechazan los cargos, ya que no es responsabilidad del Centro de Investigación y Conservación del Patrimonio Cultural, por lo que corresponde en este caso al Ministerio de Educación Publica; b) En cumplimiento de las funciones del Centro, han remitido innumerables oficios al Ministerio de Educación Pública mediante los cuales se hace entrega formal de las especificaciones técnicas, planos constructivos y presupuesto para las obras de restauración arquitectónica, reforzamiento estructural y sistema de iluminación y tomas de la Escuela el Carmen de Puntarenas; d) En el presupuesto del año 2012 el Centro de Patrimonio del Ministerio de Cultura y Juventud no contempla recursos económicos para invertir en la Escuela El Carmen en Puntarenas. Solicita se desestime el recurso planteado.

  1. 6En los procedimientos seguidos se ha observado las prescripciones legales. Redacta el Magistrado Cruz Castro; y,

Considerando:

I.Objeto del recurso.- El recurrente alega que el estado de la infraestructura de la Escuela Nuestra Señora del Carmen en Puntarenas, se encuentra muy deteriorada (tapias, jardines, cometida eléctrica, salón de actos), se producen inundaciones en el salón de actos, todo lo cual pone en peligro la integridad física de los alumnos y docentes. Indica que dicho Centro Educativo fue declarado Patrimonio Arquitectónico Nacional, por lo que corresponde a varias entidades dar el mantenimiento adecuado para su buen funcionamiento y preservación. Sin embargo, pese a sus gestiones, los recurridos no se preocupan por restaurarla.

II.Hechos probados.- De importancia para la decisión de este asunto, se estiman como debidamente demostrados los siguientes hechos, sea porque así han sido acreditados o bien porque el recurrido haya omitido referirse a ellos según lo prevenido en el auto inicial:

  • a)Que luego del informe técnico emitido por el Centro de Investigación y Conservación del Patrimonio Nacional, la Dirección de Infraestructura y Equipamiento Educativo del Ministerio de Educación procede a elaborar una lista de cantidades de obra, presupuesto referencial y especificaciones técnicas. Todo lo cual fue trasladado al Departamento de Contrataciones, mediante oficio del 27 de enero del 2010, a fin de que emita la respectiva autorización para dar inicio con la contratación directa instaurada al efecto (ver informe).
  • b)Que la contratación directa para la restauración de la Escuela El Carmen, Puntarenas se declaró infructuosa por parte de la Junta de Educación, ante recomendación del Departamento de Contrataciones realizada mediante oficio del 25 de noviembre del 2010 (ver informe).
  • c)Que por considerarse de extrema urgencia la sustitución del sistema eléctrico, el 20 de setiembre del 2011, la Dirección de Infraestructura y Equipamiento Educativo del Ministerio de Educación procedió a solicitar ante la Contraloría General de la Republica autorización para dar inicio con un procedimiento de contratación directa con carácter de urgencia. Autorización otorgada mediante oficio DCA-2954 del 10 de noviembre del 2011 (ver informe y prueba aportada).
  • d)Que mediante oficio DIEE-DEC-3132-2011 del 15 de diciembre del 2011, el Jefe del Departamento de Ejecución y Control se indica que la etapa de diseño arranca a partir del lunes 02 de enero de 2012 (ver informe).
  • e)Que el estado de las calles que rodean la escuela en mención se encuentran en una condición aceptable y no presentan estancamientos de agua en la superficie de ruedo ni en las cunetas, lo mismo en cuanto al estado del sistema de alcantarillado pues no han sido detectadas fallas que den origen a problemas de inundación (ver informe municipal).
  • f)Que la inundación de los terrenos donde esta ubicada la Escuela se debe a una diferencia de nivel de aproximadamente 25 cm. entre la acera y los patios del Centro Educativo (ver informe municipal). g) Que con posterioridad a la presentación de este recurso, según inspección realizada por el Ministerio de Salud el 15 de diciembre del 2011, la edificación del inmueble de la Escuela en cuestión se encuentra en deterioro: presenta problemas en cuanto a su infraestructura en paredes, techos, cielo raso, pisos, toda la instalación eléctrica del edificio está en mal estado y la cubierta de techos, huecos en láminas de zinc en el salón de actos, aunado al poco mantenimiento que ha recibido. Determinándose que desde que se declaró Patrimonio Arquitectónico Nacional, en octubre de 1990, no se han hecho reparaciones al inmueble. Que referente a la inundación del salón de actos no se comprobó (ver informe del Ministerio de Salud).
  • h)Que según la inspección anterior del Ministerio de Salud, se logró determinar aspectos relevantes como instalación eléctrica, problemas en el techo, marcos de ventanas y otros, que pueden eventualmente atentar contra la seguridad de los niños, profesores y otras personas que asisten a dicha escuela (ver informe del Ministerio de Salud).

III.Sobre el derecho a gozar de un ambiente sano y ecológicamente equilibrado en los Centros de Educación.- El derecho a la salud reconocido en los artículos 21 de la Constitución Política, 1 y 11 de la Declaración Americana de los Derechos y Deberes del Hombre, 4 de la Convención Americana sobre

Derechos Humanos y 10 del Protocolo Adicional a la Convención Americana sobre Derechos Humanos en Materia de Derechos, se encuentra íntimamente ligado al derecho a vivir en un ambiente sano y equilibrado, consagrado en el artículo 50 constitucional. La calidad ambiental es un parámetro fundamental de la calidad de vida; al igual que la salud, alimentación, trabajo, vivienda, educación, entre otros. En consecuencia, el Estado tiene la obligación de procurar una protección adecuada al ambiente, para lo cual debe tomar las medidas necesarias a fin de que el medio esté libre de contaminación, y que las alteraciones producidas tanto por el hombre como por la naturaleza, en el entorno próximo o lejano, no constituyan una lesión al ambiente ni a la salud de las personas que en él habitan. Se reconoce especialmente este derecho cuando está asociado a otros derechos fundamentales, como lo sería el derecho a la educación. Este último se configura como un derecho fundamental, el cual se traduce en el servicio público que brinda el Estado en los distintos centros educativos del país. Por lo tanto, lo menos que puede hacer el Estado es que al brindar la prestación de este servicio público no lesione otros derechos fundamentales, como sería el derecho a la salud y a un ambiente sano, tanto de los estudiantes como del personal docente y administrativo de la institución educativa.

IV.Sobre el caso concreto.- De los informes rendidos por los representantes de la autoridad recurrida -que se tienen por dados bajo fe de juramento con las

consecuencias, incluso penales, previstas en el artículo 44 de la Ley que rige esta Jurisdicción-, y la prueba aportada para la resolución del presente asunto, esta Sala comprueba que efectivamente la Escuela Nuestra Señora del Carmen de Puntarenas adolece de ciertas deficiencias en su infraestructura que han puesto en riesgo la seguridad ±y consecuentemente la salud- de estudiantes, personal docente y administrativo, padres de familia y otros. Tal como informan las autoridades del Ministerio de Salud, según la inspección realizada en diciembre del 2011 se logró determinar problemas en la instalación eléctrica, el techo, marcos de ventanas y otros, que pueden eventualmente atentar contra la seguridad de los niños, profesores y otras personas que asisten a dicha escuela; que la edificación se encuentra en deterioro, presenta problemas en cuanto a su infraestructura en paredes, techos, cielo raso, pisos, toda la instalación eléctrica del edificio está en mal estado y la cubierta de techos, huecos en láminas de zinc en el salón de actos, aunado al poco mantenimiento que ha recibido; determinándose que desde que se declaró Patrimonio Arquitectónico Nacional, en octubre de 1990, no se han hecho reparaciones al inmueble.

En este mismo sentido, tanto el Director del Centro de Investigación y Conservación del Patrimonio Cultural del Ministerio de Cultura y Juventud, como el Director de Infraestructura y Equipamiento Educativo del Ministerio de Educación Pública, reconocen que dicho centro educativo necesita de restauración. El primero lo reconoce cuando informa que desde agosto del 2009 han remitido innumerables oficios al Ministerio de Educación Pública mediante los cuales se hace entrega formal de las especificaciones técnicas, planos constructivos y presupuesto para las obras de restauración arquitectónica, reforzamiento estructural y sistema de iluminación y tomas de la Escuela el Carmen de Puntarenas. El segundo lo reconoce cuando informa que iniciaron en enero del 2010 un procedimiento de contratación directa para realizar las obras (aunque luego en noviembre del 2010 dicho procedimiento se declaró infructuoso), y cuando informa que en setiembre del 2011, iniciaron un procedimiento de contratación directa con carácter de urgencia, bajo la autorización de la Contraloría General de la República para la sustitución del sistema eléctrico (el cual supuestamente arrancaría en enero del 2012).

Sin embargo, nótese la inercia de las autoridades del Ministerio de Educación Pública, quienes desde 1990 ±fecha en que fue declarado patrimonio nacional el inmueble- no han procedido con reparaciones; conociendo la urgencia de realizar ciertas obras de restauración inician el procedimiento hasta enero del 2010, y no sólo eso, sino que, ante lo infructuoso del procedimiento en noviembre del 2010, dejan pasar prácticamente UN AÑO antes de proceder en setiembre del 2011 con el procedimiento de contratación de urgencia, pero únicamente del sistema eléctrico. Si bien es cierto se informa que de manera paralela a la ejecución del proyecto de sustitución del sistema eléctrico, esa Dirección estará trabajando en la ejecución del proceso de contratación para dar inicio a las obras de remodelación de la infraestructura de la Escuela Barrio el Carmen de Puntarenas, recomendadas por Patrimonio, no parece que las acciones emprendidas hayan sido ni eficientes ni suficientes.

Nótese que no se indica en concreto, ni fechas, ni un cronograma o un plan, ni oficios que hagan constar las acciones que se han tomado al respecto. Al respecto, no deja de sorprender a este Tribunal que sea la misma Administración Pública quien incumpla con los requisitos impuestos por el mismo Estado para funcionar un centro educativo de este tipo. Por lo demás, también sorprende que las autoridades del Ministerio de Salud informen que, pese a constatar el riesgo a la seguridad de las personas, no se procedió a girar ninguna orden sanitaria. Justifican tal accionar en la existencia de un contrato por procedimiento de urgencia para construcción de obras, pero no se percataron de que las obras contratadas fueron solo para el sistema eléctrico, y el resto de problemas que ellos mismos constatan (techos y cielos raso, marcos de ventanas y otros, problemas en cuanto paredes y pisos, y huecos en láminas de zinc en el salón de actos) quedaron por fuera.

De esta forma, esta Sala encuentra básicamente responsable de las violaciones en cuestión al Ministerio de Educación Pública en primer lugar, y al Ministerio de Salud por no haber girado la orden correspondiente. En cuanto al Centro de Conservación del Patrimonio Cultural del Ministerio de Cultura y Juventud no se observan graves omisiones pues al parecer han hecho entrega formal de las especificaciones técnicas, planos constructivos y presupuesto para las obras de restauración arquitectónica, reforzamiento estructural y sistema de iluminación y tomas de la Escuela el Carmen de Puntarenas, así que el atraso en las obras no ha sido su responsabilidad sino la inercia del Ministerio de Educación Pública. De igual forma, tampoco se observa responsabilidad de la Municipalidad del cantón, pues se informa el estado de las calles que rodean la escuela en mención se encuentran en una condición aceptable y no presentan estancamientos de agua en la superficie de ruedo ni en las cunetas, lo mismo en cuanto al estado del sistema de alcantarillado y que la inundación de los terrenos puede deberse a una diferencia de nivel de aproximadamente 25 cm. entre la acera y los patios del Centro Educativo.

En conclusión, dado que se comprueba que es cierto que las condiciones de infraestructura de la Escuela Nuestra Señora del Carmen de Puntarenas (en cuanto al sistema eléctrico, techos, cielos raso, pisos, paredes, marcos de ventanas, salón de actos, y otros) han puesto en riesgo la seguridad de las personas, se impone declarar con lugar este recurso y se ordena al Ministerio de Educación Pública realizar las mejoras del caso a efectos de que se respete el derecho a la salud y el derecho a gozar de un ambiente sano y ecológicamente equilibrado de todos los que asisten a dicho centro educativo; asimismo se ordena al Ministerio de Salud ser vigilante de lo que suceda, conforme se indica en la parte dispositiva de esta resolución.

Por tanto:

Se declara CON lugar el recurso, en consecuencia se ordena a LEONARDO GARNIER RIMOLO, en su calidad de Ministro de Educación Pública, o a quien en su lugar ocupe este cargo girar las instrucciones necesarias para que de inmediato se realicen las mejoras sanitarias e infraestructurales del caso a la Escuela de Nuestra Señora del Carmen de Puntarenas a efectos de que se respete el derecho a la salud y el derecho a gozar de un ambiente sano y ecológicamente equilibrado de todos los que asisten, particularmente para solventar los problemas del sistema eléctrico, techos, cielos raso, pisos, paredes, marcos de ventanas, salón de actos, y otros. Asimismo se ordena a ERICA JIMÉNEZ VALVERDE, en su calidad de Directora del Área Rectora de Salud de Puntarenas del Ministerio de Salud, o a quien en su lugar ocupe este cargo, tomar todas las acciones pertinentes para ser vigilante y darle seguimiento a las acciones que se tomen al respecto.

Todo lo anterior, bajo apercibimiento de que podrían incurrir, ambos autoridades, en el delito tipificado en el artículo 71 de la Ley de la Jurisdicción Constitucional, el cual dispone que se impondrá prisión de tres meses a dos años, o de veinte a sesenta días multa, a quien recibiere una orden que deba cumplir o hacer cumplir, dictada en un recurso de amparo y no la cumpliere o no la hiciere cumplir, siempre que el delito no esté más gravemente penado. Se condena al Estado al pago de las costas, daños y perjuicios causados con los hechos que sirven de base a esta declaratoria, los que se liquidarán en ejecución de sentencia de lo contencioso administrativo. Notifíquese en forma personal a LEONARDO GARNIER RIMOLO, en su calidad de Ministro de Educación Pública, y a ERICA JIMÉNEZ VALVERDE, en su calidad de Directora del Área Rectora de Salud de Puntarenas del Ministerio de Salud, o a quienes en su lugar ocupen estos cargos.- Gilbert Armijo S.
