Petition for constitutional relief (recurso de amparo) filed by José Antonio Arias Chaves, of legal age, divorced, a doctor of general and forensic medicine, bearer of identity card number 4-111-569, resident of Mercedes Sur de Heredia; against the President of the Board of Directors of Asfaltos Pedregal Sociedad Anónima and María Adela Chaves Aguilar; the Minister of Environment, Energy and Telecommunications; the Director of Geology and Mines; the Secretary General of the Secretaría Técnica Nacional Ambiental; the President of the Tribunal Ambiental Administrativo; the Mayor of the Municipality of Alajuela; and the Assistant Prosecutor for Miscellaneous Offenses of the Fiscalía de Alajuela.
Findings of Fact:
The safety plan measures are not being complied with, since all employees were working without using the minimum safety equipment (hard hat, vest, and others). 1.1.2. During the two visits made to the extraction area, we were not offered any safety equipment, nor were we warned of a possible blasting operation. During the second visit, we observed the charges prepared for blasting without being warned of that situation. 1.1.3. In the stockyards (patios de acopio), the safety signs were found lying on the ground. 1.1.4. It was established that the provisions of Ley Forestal N° 7575 Art. 33 are being violated, because material is being piled within the protection zone (zona de protección) of Quebrada Copeyal, and its channel was diverted to extract the underlying materials. 1.1.5. Part of the diversion channel lies outside the concession area. 1.1.6. The allegations set forth in complaint N° 74-2008, filed by the Comité de Seguridad Comunitaria de La Garita, were verified. 1.1.7.
It was also observed that the dust-mitigation measures for dust generated by the extraction and processing of the extracted material are not being followed, because the access roads and crusher area are not dampened. Likewise, some of the loaded dump trucks leaving the site are not covered with their respective tarpaulins. 1.1.7. The facts alleged in the complaint and others observed in the field having been established, as well as the failure to comply with Resolution N° 1091 of 16 de mayo de 1998, at folio 24, Expediente Minero N° 1860, served on 16 de mayo of the same year, which instructs the concession holder to comply with the following: 1.1.7.1. To avoid, insofar as possible, working along the bank of the Río or Quebrada Copeyal so that no sediment is carried away. 1.2. Request for suspension. Based on the results set forth in official letter DGM-RC2-007-2008, the suspension of work under the concession is requested in official letter No. DGM-RC2-015-2008. 1.3.
Suspension of work. By Resolution No. 333 issued at eight hours on veintiuno de mayo de dos mil ocho, the Registro Minero ordered, as a precautionary measure (medida cautelar), the immediate suspension of extraction and processing work involving the quarry materials under Expediente Minero 1860, granting a period of ten business days to submit the corresponding evidence in defense. 1.4. Remedial plan (plan remedial). By an unnumbered official letter dated 03 de Junio 2008, the Programa de Restauración de un Segmento de la Quebrada Copeyal, prepared by biologists Lic. Grettel Agüero Alfaro, M.Sc. Moisés Mug Villanueva, and M.Sc. Karina Rodríguez Sáenz, was submitted to the DGM. 1.5. Verification visit regarding the remediation plan (plan de remediación). On 23 de Julio de 2008, a verification visit was conducted by forestry engineer M.Sc. Alberto Vásquez Rodríguez and geologists German González Marín and Vanessa Rojas, all officials of the DGM.
During that visit, it was observed that the stream no longer flowed through the artificial channel that had been constructed; rather, due to Tormenta Tropical Alma, it had changed course and was flowing through the quarry area, outside its original channel and outside the artificial channel. For that reason, the corresponding report, official letter DGM-CEA-058-2008, issued by forestry engineer Alberto Vásquez, states: 1.5.7. Make the pertinent amendments to the document Proyecto de Restauración de un Segmento de la Quebrada Copeyal en Turrúcares de Alajuela to reflect the current condition of the stream channel, since that document recommended a series of technical and environmental measures based on the artificial channel. 1.5.8. Have a duly licensed forestry engineer prepare a reforestation plan for the affected area using native species, detailing the various stages to be carried out and the corresponding schedule. 1.5.9.
Submit the corresponding authorization from the owner of the neighboring property (Adela Chaves), where the artificial channel was built, and from its adjoining areas, for the purpose of implementing the reforestation plan. 1.5.10. Eliminate and fill in the artificial channel constructed by the company to divert Quebrada Copeyal. 1.6. March 2009 inspection request. Official letter DGM/SD-117-2009 requests the following: “Please inspect the site covered by Expediente 1860, document its current condition, and send a report to the Registro Nacional Minero so that, once that report is received, a response may be provided to the company’s filings and appeals [appeal filed on 4 de junio del 2008, folios 544 – 552, and other filings (appeal of 7 de octubre del 2008 – folios 563 – 564), and others – folios 593 – 596)].” The inspection was conducted on 28 de abril de 2009 in the company of Licda. Rosa Ovares Alvarado and geologist Natalia Montes, both officials of the Dirección de Geología y Minas.
The observations from that inspection were recorded in official letter No. DGM-CRC2-037-2009. 1.7. In an unnumbered document dated 08 de mayo de 2009, an amendment to the Remediation Plan was submitted. 1.8. Request for the establishment of technical guidelines (official letter DGM-OD-0509-2009). 2. Discussion of the case. 2.1. Compliance with the recommendations in official letter DGM-RC2-007-2008. 2.1.1. Although Resolution 333 ordered only the suspension of extraction and processing work, several visits to the concession area established that no action had been taken to stabilize the slopes (taludes) of the stockyards. 2.1.1. Nor was any evidence in defense submitted regarding the work performed in the streambed (lecho) of Quebrada Copeyal and the construction of the artificial channel outside the concession area. 2.2. With regard to the Remediation Plan, the amendment submitted on 08 mayo was reviewed and referred to forestry engineer Alberto Vásquez for consultation, and he agreed with it. 3.
Recommendations. In order to proceed with the technical assessment for lifting the suspension of work ordered in Resolution No. 333, compliance with the following actions is recommended; such compliance must be confirmed in the field once the DGM has been notified that they have been completed: 3.1. Stabilize the stockyard slopes and grade them inward toward the interior of the area in order to channel the water into a drainage system that must be designed and built for that purpose. 3.2. Design and construct one or more sedimentation basins (pilas de sedimentación) to prevent sediment carried by runoff (aguas de escorrentía) from flowing directly into Quebrada Copeyal or Río Alajuela. Such basin or basins must be constructed in accordance with the size of the concession area and the runoff flow during the area’s maximum precipitation, also taking into account runoff that may come from neighboring properties.
Consideration must also be given to the infiltration capacity of the quarry floor and of any soil remaining in other areas of the concession, as well as the runoff transit time. 3.3. The designs for the drainage system and sedimentation basins, as well as for stabilizing the slopes facing Quebrada Copeyal, must be submitted to this Dirección for review and approval before construction. 3.4. Processed materials or materials awaiting processing must not be accumulated near the protection zone of Quebrada Copeyal, in order to prevent them from being washed into it. 3.5. The protection zone of Quebrada Copeyal must be respected at all times, as established by artículo 33 of Ley Forestal. 3.6. The provisions of the Reglamento de Seguridad e Higiene must be complied with at all times, and a copy thereof must always be displayed where workers and visitors can see it. 3.7. Safety equipment must be available for visitors. 3.8.
Dust-mitigation measures must be implemented in the extraction and processing areas and stockyards. 3.9. Comply, where pertinent, with the provisions of the Plan de Remediación de un segmento de la Quebrada Copeyal, since the situation described therein does not reflect current conditions; nevertheless, the soil conditions in the constructed channel and along the course currently followed by the stream are very similar. Likewise, comply with the amendment to the plan submitted on 08 de mayo de 2009. 3.2.1. In this regard, it is recommended that the inner side of the earthen dike (the slope facing the stream), which will be built to channel Quebrada Copeyal, be reinforced with rocks ranging from decimetric to metric diameter so that it is not undermined or destroyed by flooding during the rainy season. Alternatively, submit a separate design that addresses this potential problem.” It adds that, by Resolution 392 of 03 de junio de 2009, the aforementioned official letter was communicated to the concession holder, granting a period of 30 days for compliance, and that on 14 de julio de 2009 the concession holder submitted the required information.
It states that, as recorded in official letter DGM-CRC-2-055-2009 of 28 de julio de 2009, the geologist indicates: “…By means of the document received by the DGM on 14 de Julio de 2009, concession holder María Adela Chávez Aguilar, in response to official letter DGM-CRC2-039-2009 and for the purpose of proceeding with the technical assessment for lifting the precautionary suspension of work, stated the following: 1- The stockyard slopes were stabilized by planting grass during the 2008 rainy season. 2- Once extraction work resumes, we undertake not to accumulate processed materials near Quebrada Copeyal, in order to prevent them from being washed into it. 3- The protection zone of Quebrada Copeyal established in Ley Forestal N° 7575 will be respected at all times. 4- During work under the concession, the provisions of Reglamento General de Seguridad e Higiene de Trabajo, Decreto Ejecutivo N° 1 of 02 de enero de 1967, will be complied with, and a copy thereof will be kept in the entrance booth. 5- Safety equipment will be provided for workers in accordance with the job-specific recommendations made by our Occupational Health Officer. 6- Reflective vests and safety helmets will be available for visitors at the entrance booth. 7- During the dry season, the extraction and processing areas and stockyards experiencing dust-generation problems will be continuously watered using a water tanker truck. 8- During mayo and junio 2009, the Plan de Remediación de un Segmento de la Quebrada Copeyal was implemented, including construction of the corresponding dike to channel the water along a former course.
The slope facing the Quebrada was reinforced to prevent erosion, and the remainder of the slope was planted with perennial peanut grass. In the protection zone on both sides, 65 native-species trees were planted. 9- A design for the stormwater management system is attached. With regard to its implementation, we request that the Dirección de Geología y Minas allow us to construct it once the suspension of work ordered by Resolution N° 333 of 21 de mayo de 2008 has been lifted and extraction work has resumed, since machinery and processed materials are required in order to grade the stockyards and construct the drainage channels and sedimentation basin.” It adds that, in order to verify the information provided above, an on-site verification visit was conducted and coordinated with Licda.
Annette Solano, an employee of Pedregal, and Rafael Ángel Zamora, and during the visit it was possible to verify matters concerning the work performed in the stockpile yards and on the embankment of Quebrada Copeyal, as well as the future location of the sedimentation ponds. The visit was recorded in geological logbook No. 2711-09, and the plan containing the design of the drainage system and sedimentation ponds, including its modification, submitted to that Directorate on 27 de julio de 2009, was also reviewed. It concludes that the RNM was advised to lift the interim measure (medida cautelar) suspending operations, ordered by Resolution No. 333 at 08:00 hours on 21 de mayo de 2008, subject to the following conditions: 1- The provisions set forth in the document mentioned at the beginning of this official letter, the Mining Code and its regulations, as well as the terms of the Operating Plan approved by that Directorate, must be complied with. 2- Neither unprocessed nor processed material may be stockpiled near Quebrada Copeyal (adjacent to the protection zone (zona de protección)), in order to prevent it from being washed into the protection zone and the stream itself. 3- The request to allow construction of the drainage system and sedimentation ponds to begin once extraction operations resume is granted.
The drainage system and sedimentation ponds must be constructed in accordance with the specifications of the design shown on the modified plan submitted to that Directorate on 27 de julio de 2009.” It states that, by Resolution 760 of 31 de agosto de 2009, the cited official letter was communicated and the ordered suspension of operations was lifted. It asserts that the order suspending extraction and processing operations was not violated; rather, the work performed at the site consisted of rearranging materials and carrying out maintenance work at the quarry. It states that the most recent control inspection conducted by that Directorate’s geologist took place on 02 de setiembre de 2009, and the following was reported: “…On 02 de Setiembre de 2009, at 1:20 p.m., a control visit was conducted at Tajo San Antonio to verify progress on the work relating to the drainage system and sedimentation ponds that were required to be constructed.
Field observations: 1- Overburden removal work was being performed in the southern sector, 2- no extraction work was being performed, and 3- only the secondary crusher was observed in operation. 4- A recently installed fuel tank was observed near the offices; it lacks a concrete slab and oil traps. 5- Numerous oil drums were observed near the fuel tank, and numerous oil drums were exposed to the elements. An entry was made in the logbook indicating the need to construct a concrete slab with oil traps for the fuel tank, as well as a suitable place for storing the drums. 6- It was observed that nearly all the channels for the drainage system had already been formed in the stockpile yards and crusher area. However, work on the construction of the sedimentation ponds had not begun. The visit was recorded in logbook No. 2711-09 at folio 73129 (copy attached). On 15 de octubre, the supervising geologist (geóloga regente) was contacted, and she stated that construction work on the sedimentation ponds had already begun by that date.
Conclusions and recommendations: 1- The corresponding permit from the Directorate of Fuel Transportation and Marketing for installation of the observed tank must be submitted to this Directorate. 2- A concrete slab with oil traps must be constructed for the fuel tank, provided it is verified that the required installation permit has been obtained. 3- A suitable place must be constructed for storing the oil or fuel drums.” It states that, in fulfillment of the powers established in the Mining Code and its Regulations, decreto ejecutivo 29300-MINAE, that Directorate addressed the complaint filed by Comité de Seguridad Comunitaria de La Garita, determined that problems did in fact exist, and consequently issued Resolution 333 of 21 de mayo de 2008, suspending material extraction and processing operations. It emphasizes that the sale of material was not suspended, in accordance with the final paragraph of Article 18 of the Mining Code.
It adds that the Directorate also fulfilled its obligation to inform SETENA, Departamento de Aguas, and Tribunal Ambiental Administrativo of what had occurred; by Resolution 460-09-TAA, the latter consolidated the proceedings under expediente 153-08-03-TAA, and a joint inspection was also conducted with Tribunal Ambiental. It explains that Departamento de Aguas of MINAET, for its part, sent that Directorate a copy of official letter IMN-DA-3615-2008, ordering the concession holder, within 10 days, to “…carry out closure and compaction work at the site where an attempt was made to divert the channel of Quebrada Copeyal. It must likewise remove the materials deposited in the protection areas…” It states that the measure imposed at the time by that Directorate through Resolution 333 of 21 de mayo de 2008 was an interim measure suspending material extraction and processing operations, which remained in effect for more than one year while the concession holder submitted a “remedial” plan, which was approved.
It explains that the interim measure could not become a punitive measure (medida sancionatoria); for that reason, once lifting it became technically feasible, it was lifted subject to the conditions established in official letter DGM-CRC-2-055-2009 dated 28 de julio del 2009, communicated through Resolution 760 of 31 de agosto de 2009. It notes that neither SETENA nor Tribunal Ambiental Administrativo has issued any interim measure ordering the suspension of operations, nor is there any judicial order to that effect on record. It explains that an analysis of Resolution 760 of 31 de agosto de 2009 shows that the appellant’s concerns regarding the extraction methodology were taken into account. It states that official letter DGM-CRC2-039-2009 identifies a series of technical and geological matters, such as slope stability, designs for the drainage system and sedimentation ponds, and stabilization of the slopes facing Quebrada Copeyal, which must be submitted to that Directorate for review and approval before construction; that processed or unprocessed materials must not be accumulated near the protection zone of Quebrada Copeyal, in order to prevent them from being washed into it; and that the protection zone of Quebrada Copeyal must be respected at all times, as established by Article 33 of the Ley Forestal, among other requirements that supported lifting the suspension pursuant to official letter DGM-CRC-2-055-2009 of 28 de julio de 2009. It requests that the appeal be dismissed.
Justice Rueda Leal is the author of the opinion; and, Whereas (Considerando):
The following facts relevant to the decision in this matter are deemed duly established:
1. Tajo San Antonio, located in La Garita de Alajuela, one kilometer south and 500 meters west of Escuela Ricardo Fernández Guardia, holds a mining concession whose project description is extraction from an open-pit quarry and crushing facilities, according to administrative expediente number 1860, registered in the Registro Nacional Minero in the name of Mrs. María Adela Chaves Aguilar. It has Approval of Environmental Study 1860 from the Comisión Gubernamental de Evaluación y Control de Estudios de Impacto Ambiental, dated 20 de marzo de 1989, although it does not have an Environmental Manager (Responsable Ambiental) (see sworn statements at folios 066 and 0074 and Volumes I and II of the mining case file).
2. On 20 de febrero de 2008, the Secretaría Técnica Nacional Ambiental received the D1 environmental assessment document for the Application to Expand the Mining Concession, Tajo San Antonio, Turrúcares project, submitted by Mrs. María Adela Chaves Aguilar (see sworn statements at folios 0074 and 0124).
3. On 17 de marzo de 2008, by fax, the Dirección de Geología y Minas of the Ministerio de Ambiente, Energía y Telecomunicaciones received a complaint from the Comité de Seguridad Comunitaria de La Garita reporting that the company operating Tajo San Antonio had dug a trench to divert Quebrada Copeyal, which crosses the property where the quarry is located, so that it could extract material from the area through which the stream flowed. The complaint was assigned number 74-2008 (see sworn statements at folio 0048).
4. By official letter DGM/RC2-007-2008 of 09 de abril de 2008, the geologists and surveyor of the Dirección de Geología y Minas of the Ministerio de Ambiente, Energía y Telecomunicaciones submitted their report on the inspection performed, in which they concluded and recommended: “The requirements of the safety plan are not being followed, since all employees were working without using the minimum safety equipment (hard hat, vest, and other items). During the two visits made to the extraction area, we were not offered any safety equipment or warned of a possible blasting operation. During the second visit, we observed the charges prepared for blasting without having been warned of that situation. Safety signs were found lying on the ground in the stockpile yards. It was established that the requirements of Ley Forestal N° 7575 Art. 33 are being violated because material is being piled within the protected area of Quebrada Copeyal, and its channel was diverted to extract the underlying materials.
Part of the diversion channel lies outside the concession area. The allegations made in complaint N° 74-2008, filed by the Comité de Seguridad Comunitaria de La Garita, were verified. It was also observed that the dust-mitigation measures (medidas de mitigación) for the extraction and processing of the extracted material are not being followed, since the access roads and crushing area are not moistened. In addition, some of the dump trucks leaving with loads are not covered with their respective tarpaulins. The facts alleged in the complaint and other facts observed in the field having been verified, as well as noncompliance with Resolution N° 1091 of 16 de mayo de 1998, at folio 24, Expediente Minero N° 1860, served on 16 de mayo of that same year, which instructs the concession holder to comply with the following: Avoid working, insofar as possible, along the bank of the river or Quebrada Copeyal, so that no sediment is carried away…” (see sworn statements at folio 0048 and folios 466 to 478 of Volume II of the mining case file).
5. On 06 de mayo de 2008, Mr. Orlando Vindas Mesén, in his capacity as a MINAE official assigned to the Subregión Central de la Cordillera Volcánica Central, filed an environmental complaint against the company Pedregal and Tajo San Antonio, mining concession expediente number 1860 of the Registro Nacional Minero, in the name of Adela Chávez, stating: “…residents of the community informed us of a complaint against the companies operating Tajo San Antonio for digging a trench to divert Quebrada Copeyal, which crosses the property where the quarry is located, in order to extract material located where the stream flows… Once at the site, a trench was identified with a length of 178 meters, a depth and width of 5 meters, in a pasture area through which the stream that was diverted had flowed… along a 98-meter section, the streambed was altered, including its protected area on both sides, part of which was removed…
The original streambed was blocked with quarry material, while mineral material forming part of the bank of the same stream was extracted in another downstream section… Attorney Annette Solano Castro, Environmental Manager of Corporación Pedregal, stated that the company Pedregal is the entity carrying out the material-extraction works and that no permit had been processed to perform the works to block and divert Quebrada Copeyal… the irregularities resulting from the work performed are evident and significant…”; this complaint was assigned expediente number 153-08-03-TAA by the Tribunal Ambiental Administrativo (see sworn statements at folio 0066 and folio 5 of the administrative case file of the Tribunal Ambiental Administrativo).
6. By Resolution number 333 at 08:00 hours on 21 de mayo de 2008, the Dirección de Geología y Minas del Ministerio de Ambiente, Energía y Telecomunicaciones resolved: “…In accordance with the foregoing, Articles 14, 67, 91, and 120 of the Código de Minería, and official letter DGM-RC2-007-2009 dated 9 de abril del 2007, signed by geologists German González, William Arrieta, Teresa Arrieta, and Luis Alberto Chavarría, and surveyor Luis Ureña, it is hereby resolved: a) As a precautionary measure (medida cautelar), the immediate suspension of the extraction and processing of quarry materials is ordered. b) In observance of the due process (debido proceso) and right of defense (derecho de defensa) afforded to the concessionaire (concesionario), pursuant to Article 67 of the Código de Minería, a period of ten business days, counted from the day following notice of this Resolution, is granted for the concessionaire to provide justification and submit the appropriate exculpatory evidence (pruebas de descargo) concerning the failure to comply with the terms under which the concession was granted.
The concessionaire is advised that if the requested material is not submitted within the established period, the proceeding will continue without reinstatement of expired time limits. c) Forward this Resolution to SETENA and the Tribunal Ambiental Administrativo so that the existence of environmental damage (daño ambiental) may be determined. Likewise, transfer the record to the Departamento de Aguas del MINAE so that it may proceed within the scope of its authority. The concessionaire is advised that, pursuant to Articles 146 et seq. of the Ley General de Administración Pública, she must comply with the order suspending operations issued herein; otherwise, the police authorities will be called upon to enforce it in accordance with the law. The concessionaire is advised that the Código Penal establishes the offense of disobedience of authority” (see statements given under oath at folio 0048 and folios 492 to 510 of Volume II of the mining file).
7. Resolution number 333 was communicated to the concessionaire, Ms. Chaves Aguilar; the complainant Committee; SETENA; the Departamento de Aguas del MINAET; and the Tribunal Ambiental Administrativo. In addition, official letters DGM/RNM 375-2008 to SETENA, DGM/RNM 376-2008 to the Departamento de Aguas, and DGM/RNM 377-2008 to the Tribunal Ambiental Administrativo were forwarded (see statements given under oath at folio 0048 and folios 511 to 513 of Volume II of the mining file).
8. Through Resolution 1509-2008-SETENA of 23 de mayo de 2008, notice of which was given on 28 of that same month and year, the developer (desarrollador) was informed that, in order to continue the environmental assessment process (proceso de evaluación ambiental) for the application to expand the concession, an Environmental Impact Study (Estudio de Impacto Ambiental) had to be submitted within a maximum period of one year from the date notice of that Resolution was given (see statements given under oath at folios 0074 and folio 0124).
9. On 04 de junio de 2008, the concessionaire responded to Resolution 333, which had been issued based on official letter DGM/RC2-007-2008 of 09 de abril de 2008; she requested that the proceeding be declared null and void and, in the alternative, requested that the suspension of operations be partially lifted, excluding Quebrada Copeyal, that she be given the opportunity to remediate the affected area (Quebrada Copeyal) and carry out mitigation works (obras de mitigación) there, and that the remedial plan (plan remedial) submitted at that time be approved (see statements given under oath at folio 0048 and folios 545 to 552 of Volume II of the mining file).
10. Because the matters involved were technical and geological in nature, an opinion was requested from a geologist who, in addition to being the mining coordinator for the area, recommended the suspension of operations and, through official letter number DGM-CRC2-029-2009 of 20 de agosto de 2008, replied: “…At the request of MSc. José Francisco Castro Muñoz, Director of the Dirección de Geología y Minas, the response submitted by María Adela Chaves Aguilar to Resolution No. 333 of 21 de mayo de 2008, which is based on official letters DGM-RC2-007-2008 and DGM-CRC2-015-2008, was reviewed. All of the foregoing concerns mining file No. 1860 (Tajo San Antonio). That review produced the following results, following the order in which the aforementioned response was presented: Regarding Memo DGM-RC2-007-2008, Point a), although the site had been approved as a stockpiling yard (patio de acopio), the protection zone (zona de protección) of Quebrada Copeyal should not have been disturbed, because the following was being violated: 1- Resolution No. 1091 of 16/05/1988, in which the Comisión Gubernamental sobre los Estudios de Impacto Ambiental notified the interested party that, among other matters, the party was required to comply with point 2, which states as follows: ‘To the extent possible, avoid working along the bank of Río or Quebrada Copeyal so that sediment is not carried away’” (see statements given under oath at folio 0048 and folios 24 and 34 of Volume I of the mining file).
11. The suspension of operations was partially lifted solely to allow the sale of processed materials held in stock in the yards adjoining Quebrada Copeyal. That partial lifting was conditioned upon the prior submission of a quantification of the stock volume and the weekly submission of sales reports to the Dirección de Geología y Minas del Ministerio de Ambiente, Energía y Telecomunicaciones, so that the materials could be removed and work to restore the banks of the Quebrada Copeyal streambed (cauce) could begin once the restoration plan (plan de recuperación) had been approved (see statements given under oath at folio 0048 and folios 554 to 555 of Volume II of the mining file).
12. Through official letter number ASA-650-2008-SETENA of 27 de agosto de 2008, the Departamento de Auditoría y Seguimiento Ambiental de la Secretaría Técnica Nacional Ambiental described its site visit, conducted in compliance with Resolution 333 of 21 de mayo de 2008, as follows: “Technical Report on the Field Visit. On 21 de agosto del 2008, a visit was made to this project as a follow-up measure concerning the Resolution issued by the Dirección de Geología y Minas. The following was observed in the project area (área del proyecto, AP): – We were assisted by the person in charge of Environmental Management, Lic. Annette Solano Castro, because the project does not have a currently authorized Environmental Manager (Responsable Ambiental). – At the time of the quarry inspection, the entrance was closed and guarded by a security guard. A container used as offices was observed, as well as a loader. – Once inside the AP, two stockpiles of materials measuring approximately 10 meters high by 12 meters in circumference could be seen, along with a primary crusher that was not in use.
The foundations where a secondary crusher had been located were observed, but according to Ms. Annette Solano, it had been taken to other facilities. – Continuing the inspection of the AP, at the specific site where quarry material was extracted, an area was observed in the southern sector where most of the material available at the site had already been extracted; however, in the northern sector, through which Quebrada Copeyal flows before emptying into Río Alajuela, there is another area where a large amount of material remains available. – The Developer built a dike and channel measuring approximately 150 meters long by 3 wide and 6 deep to store water and alter the course of Quebrada Copeyal, thereby allowing extraction of the material located where the Quebrada Copeyal streambed formerly ran. – At the time of the visit to the AP, due to the large amount of water flowing through the stream at this time of year, the dike had broken and the stream water had opened a path through the center of the quarry, where it is currently flowing.
On the other hand, the Developer did respect the protection zone of Río Alajuela, which runs through the western sector of the AP. – At the location of the crusher, near the (sic) stream, work yards (planteles) were constructed for stockpiling already processed material; however, the protection zone of Quebrada Copeyal was not respected at the site where the material was stockpiled, causing runoff water (agua de escorrentía) to carry materials into the stream. This is occurring along the left bank downstream for a distance of approximately 200 linear meters. Based on the technical and legal information contained in Administrative File No. 1860 for the aforementioned project, it was verified that the project has approval for Environmental Study 1860 from the Comisión Gubernamental de Evaluación y Control de Estudios de Impacto Ambiental, dated 20 de marzo de 1989. The project does not have an Environmental Manager.
CONCLUSIONS. FIRST: On the day the AP of Tajo San Antonio, located in La Garita de Alajuela, was inspected, it was confirmed that the extraction and processing of quarry materials had been suspended. The visit was conducted jointly with the person in charge of Environmental Management, Lic. Annette Solano Castro. SECOND: The visit confirmed the matters mentioned by the Dpto. Geología y Minas/MINAET; the location where a dike and channel had been constructed was verified. According to Lic. Annette Solano Castro, the dike was apparently built to divert the stream and, at the same time, formed a reservoir used as a water intake for dust mitigation during the extraction process. THIRD: Another matter mentioned by the Dpto. Geología y Minas/MINAET was also confirmed; it was verified that materials had been stockpiled within the stream’s protection zone and that, due to the slope and runoff water, the materials are being eroded into the streambed.
RECOMMENDATIONS. Based on the technical and legal elements, the following is recommended: – The Departamento de Auditoría y Seguimiento Ambiental shall continue following up on the suspension of extraction and processing operations at the quarry named Tajo San Antonio, located in La Garita de Alajuela. – Resolution 333 of the Dirección de Geología y Minas, Registro Nacional Minero, dated 20 de mayo del 2008, states in the First point of its Considerando that one of the technical conditions established for granting the extension of the operating term of Tajo San Antonio, File 1860, is: ‘to respect the protection area along the riverbed…,’ and it is evident that the concessionaire has violated this condition. Accordingly, because the situation warrants it, it is recommended that a working group be formed to assess the possible environmental damage caused and the impact on the water source, as mentioned in Point C of the Por Tanto of that Resolution” (see statements given under oath at folios 00074 and 00124 and folio 66 of administrative file 1860 Minero of the Secretaría Técnica Nacional Ambiental).
13. Through Resolution number 05-09-TAA at 09:30 hours on 16 de enero de 2009, the Tribunal Ambiental Administrativo resolved: “FIRST: It is essential to conduct an assessment of environmental damage (valoración del daño ambiental) in accordance with the reported facts. Accordingly, this Office orders Mr. Rafael Gutiérrez Rojas, in his capacity as Director of the Área de Conservación Cordillera Volcánica Central, or whoever holds that position, to issue the corresponding instructions so that an on-site visual inspection (inspección ocular ‘in situ’) may be conducted and a detailed report, as well as the corresponding economic valuation of the environmental damage (valoración económica del daño ambiental), may be prepared jointly with the Departamento de Aguas” (see statements given under oath at folio 0066 and folio 9 of the administrative file of the Tribunal Ambiental Administrativo).
14. By official letter (oficio) SRC-OA-239 dated 02 de abril de 2009, the Head of the Central Subregion, Alajuela office of ACCVC [Área de Conservación Cordillera Volcánica Central], informed the Environmental Administrative Tribunal (Tribunal Ambiental Administrativo) that on 27 de marzo de 2009, an on-site visual inspection (inspección ocular) was conducted to gather information for the economic valuation (valoración económica), and notice was given of the precautionary measure (medida cautelar). It was established that the activity in question had not been operating for several months, as recorded in the logbook (bitácora) maintained by the company Pedregal Tajo San Antonio, which had been monitored by SETENA; that the site where the damage occurred had not been repaired; and the Head further requested that the Directorate of Geology and Mines (Dirección de Geología y Minas) of MINAET and the Water Department (Departamento de Aguas) participate in the economic valuation of environmental damage (valoración del daño económico ambiental) (see statements made under oath at folio 0066 and folio 17 of the administrative case file (expediente administrativo) of the Tribunal Ambiental Administrativo).
15. By resolution (resolución) number 460-09-TAA at 08:00 hours on 28 de abril de 2009, the Tribunal Ambiental Administrativo ordered the consolidation (acumulación) of the two complaints (denuncias) filed in this case into a single case file, to be processed under number 153-08-03-TAA (see statements made under oath at folio 0066 and folio 78 of the administrative case file of the Tribunal Ambiental Administrativo).
16. By official letter number DGM-CRC2-039-2009 dated 01 de junio de 2009, the geologist of the Dirección de Geología y Minas of the Ministerio de Ambiente, Energía y Telecomunicaciones reported: “...3. Recommendations. To proceed with the technical assessment (evaluación técnica) for lifting the suspension of operations (suspensión de labores) ordered in Resolution No. 333, compliance with the following actions is recommended; their completion must be confirmed in the field once DGM is notified: 3.1. Stabilize the slopes (taludes) of the stockpiling yards (patios de acopio) and grade them inward toward the interior of the area, so that water is channeled into a drainage system (sistema de drenaje) that must be designed and constructed for that purpose. 3.2. Design and construct one or more sedimentation ponds (pilas de sedimentación) to prevent sediment carried by runoff (aguas de escorrentía) from flowing directly into Quebrada Copeyal or Río Alajuela.
The pond or ponds must be constructed in accordance with the concession area (área de la concesión), the runoff flow rate during the area’s maximum precipitation, while also taking into account any runoff from neighboring properties. The infiltration capacity of the quarry floor (piso de la cantera), the soil that may remain in other areas of the concession, and the runoff transit time must also be taken into account. 3.3. The designs for the drainage system and sedimentation ponds, as well as for stabilizing the slopes facing Quebrada Copeyal, must be submitted to this Directorate for review and approval before construction. 3.4. Processed or unprocessed materials must not be stockpiled near the protection zone (zona de protección) of Quebrada Copeyal, in order to prevent them from being washed into it. 3.5. The protection zone of Quebrada Copeyal must be respected at all times, as established in article 33 of the Ley Forestal. 3.6.
The provisions of the Reglamento de Seguridad e Higiene must be observed at all times, and a copy thereof must always be displayed where workers and visitors can see it. 3.7. Safety equipment must be available for visitors. 3.8. Dust mitigation measures (medidas de mitigación de polvo) must be implemented in the extraction and processing areas and stockpiling yards. 3.9. Comply, as applicable, with the provisions of the Plan de Remediación de un segmento de la Quebrada Copeyal, because the situation described therein does not reflect current conditions; however, the soil conditions of the constructed channel and those of the course along which the stream currently flows are very similar. Likewise, comply with the amendment to the plan submitted on 08 de mayo de 2009. 3.2.1. In this regard, it is recommended that the interior portion (slope facing the stream) of the earthen dike (dique de tierra) to be built to channel Quebrada Copeyal be reinforced with rocks ranging from decimetric to metric diameter, so that it is not undermined or destroyed by flooding during the rainy season.
Alternatively, a proprietary design that remedies this potential problem may be submitted.” (see statements made under oath at folio 0048 and folios 663 a 667 of Tomo II of the mining case file (expediente minero)).
17. By resolution 392 dated 03 de junio de 2009, official letter number DGM-CRC2-039-2009 was communicated to the concessionaire (concesionaria), granting her a period of 30 días to comply with it (see statements made under oath at folio 0048 and folios 670 a 676 of Tomo II of the mining case file).
18. As recorded in official letter DGM-CRC-2-055-2009 dated 28 de julio de 2009, the geologist of the Dirección de Geología y Minas of the Ministerio de Ambiente, Energía y Telecomunicaciones stated: “...Through the document received by DGM on 14 de Julio de 2009, the concessionaire María Adela Chávez Aguilar, in response to official letter DGM-CRC2-039-2009 and for the purpose of continuing the technical assessment to lift the precautionary measure suspending operations, states the following: 1- The slopes of the stockpiling yards were stabilized by planting grass during the 2008 rainy season. 2- Once extraction operations resume, we undertake not to stockpile processed materials near Quebrada Copeyal, in order to prevent them from being washed into it. 3- The protection zone of Quebrada Copeyal established in Ley Forestal N° 7575 shall be respected at all times. 4- During operations at the concession, the provisions of the Reglamento General de Seguridad e Higiene de Trabajo, Decreto Ejecutivo N° 1 del 02 de enero de 1967, shall be observed, and a copy thereof shall be kept in the entrance booth. 5- Safety equipment shall be provided for workers in accordance with the job-specific recommendations made by our Occupational Health Officer. 6- Reflective vests and safety helmets shall be available for visitors at the entrance booth. 7- During the dry season, extraction and processing areas and stockpiling yards experiencing dust-generation problems shall be continuously watered using a tanker truck. 8- During mayo y junio 2009, the Plan de Remediación de un Segmento de la Quebrada Copeyal was implemented, and the corresponding dike was constructed to channel the water along a former course.
The slope facing Quebrada was reinforced with rock in order to prevent erosion, and the remainder of the slope was planted with perennial peanut grass. In the protection zone on both sides, 65 árboles of native species were planted. 9- A design for a stormwater management system (sistema para manejo de aguas pluviales) is attached. Regarding its implementation, we request that the Dirección de Geología y Minas allow us to construct it once the suspension of operations ordered by Resolution N° 333 del 21 de mayo de 2008 has been lifted and extraction operations have resumed, since machinery and processed materials are required in order to grade the stockpiling yards and construct the drains and sedimentation pond” (see statements made under oath at folio 0048).
19. By official letter SRC-OA-707 dated 12 de agosto de 2009, the Head of the Central Subregion, Alajuela Office of ACCVC, informed the Tribunal Ambiental Administrativo by fax that the valuation of environmental damage (valoración del daño ambiental) to the affected water resource amounted to exactly one million two hundred thousand colones (¢1.200.000.00) (see statements made under oath at folio 0066).
20. The Tribunal Ambiental Administrativo is analyzing the documentary and expert evidence (prueba documental y pericial) in order to schedule an oral, closed hearing (audiencia oral y privada), to which all parties involved will be summoned for the purpose of ascertaining the substantive truth of the facts (verdad real de los hechos) (see statements made under oath at folio 0066 and folio 5 of the administrative case file of the Tribunal Ambiental Administrativo).
21. The Dirección de Geología y Minas of the Ministerio de Ambiente, Energía y Telecomunicaciones recommended lifting the precautionary measure suspending operations ordered by Resolution No. 333 at 08:00 hours on 21 de mayo de 2008, subject to the following conditions: “1- The provisions set forth in the document mentioned at the beginning of this official letter, the Código de Minería and its regulations, and the provisions of the Plan de Explotación approved by that Directorate must be observed. 2- Neither unprocessed nor processed material may be stockpiled near Quebrada Copeyal (adjacent to the protection zone), in order to prevent it from being washed into the protection zone and the stream itself. 3- The request to allow construction of the drainage system and sedimentation ponds to begin once extraction operations resume is granted. The drainage system and sedimentation ponds must be constructed in accordance with the design specifications shown on the amended plan submitted to that Directorate on 27 de julio de 2009” (see statements made under oath at folio 0048 and folios 682 a 684 of Tomo II of the mining case file).
22. By resolution 760 dated 31 de agosto de 2009, the decision was communicated to the concessionaire and the ordered suspension of operations was lifted (see statements made under oath at folio 0048).
23. The latest control inspection conducted by the geologist of the Dirección de Geología y Minas of the Ministerio de Ambiente, Energía y Telecomunicaciones took place on 02 de setiembre de 2009, and the following was reported: “…On 02 de Setiembre de 2009, at 1:20 p.m., a control visit was conducted at Tajo San Antonio to verify progress on the work relating to the drainage system and the sedimentation ponds that were to be built. Field observations: 1- Clearing work was being carried out in the southern sector; 2- no extraction work was being performed; and 3- only the secondary crusher was observed in operation. 4- Near the offices, a recently installed fuel tank was observed; it lacked a concrete slab and oil traps. 5- Numerous oil drums were observed near the fuel tank, and numerous oil drums were exposed to the elements. An entry was made in the logbook indicating the need to build a concrete slab with oil traps for the fuel tank, as well as a suitable place for storing the drums. 6- It was observed that nearly all the channels for the drainage system had already been formed; these were observed in the stockpiling yards and in the crusher area.
However, work on constructing the sedimentation ponds had not begun. The visit was recorded in logbook No. 2711-09 at folio 73129 (copy attached). On 15 de octubre, a conversation was held with the supervising geologist (geóloga regente), who stated that construction work on the sedimentation ponds had already begun by that date. Conclusions and recommendations: 1- The corresponding permit from the Dirección de Transporte y Comercialización de Combustible for installation of the observed tank must be submitted to this Directorate. 2- A concrete slab with oil traps must be built for the fuel tank, provided it is verified that a permit has been obtained for its installation. 3- A suitable place must be built for storing the oil or fuel drums.” (see statements made under oath at folio 0048 and folios 694 to 696 of Volume II of the mining case file (expediente minero)).
24. According to the report of the Proceso de Control Fiscal y Urbano of the Municipalidad de Alajuela, this mining concession project holds health operating permit number ARSA-2-400-2007, valid until 07 de agosto de 2012 (see statements made under oath at folio 0101).
The petitioner alleges that the respondents have failed to discharge their responsibilities for environmental protection because irregular acts have been committed in the operation of a quarry concession, involving the diversion of a publicly owned watercourse (cauce de dominio público), the destruction of the protected area adjacent to that watercourse, and the breach of the terms and conditions of the concession, without the respondents having taken the corresponding action to prevent the resulting damage.
The analysis of the case shows that, in essence, the petitioner is correct. In this regard, it has been established that those operating the aforementioned quarry have, without legal authorization, taken actions contrary to the right to a healthy and ecologically balanced environment. In this respect, the established facts show that Quebrada Copeyal (a tributary of Río Alajuela), which crosses the property where the quarry is located, was diverted along a particular section; that material has been stockpiled in the stream’s protected area; that part of the diversion channel lies outside the concession area; that the dust-mitigation measures required for operation of the quarry have not been implemented; that trucks transporting the mineral leave uncovered; and that the condition requiring the prevention of sediment runoff into the stream has not been fulfilled. It was also verified that the stream’s original channel was blocked and that material has been extracted from the site where that channel had been located.
The Dirección de Geología y Minas, the Tribunal Ambiental Administrativo, and the Secretaría Técnica Nacional Ambiental were aware of the foregoing, as established in these proceedings. Nevertheless, although those bodies are aware of the problem, they have not taken action to establish the legal liability of the private parties who carried out all the irregular actions described above. In this respect, that Directorate issued a precautionary measure (medida cautelar) suspending the work, but did not determine whether the concession holder had engaged in any unlawful conduct warranting cancellation of the concession. The Tribunal Ambiental Administrativo has likewise not ruled on the complaints it received concerning those events. The Secretaría Técnica Nacional Ambiental was also notified of the irregular situation at the quarry site and conducted an inspection there in agosto de 2008; however, like the other respondents just mentioned, it has not conducted the corresponding proceeding to determine whether the concession holder has breached the obligations it assumed upon approval of the environmental impact study (estudio de impacto ambiental).
Finally, it has been established that the Dirección de Geología y Minas also reported the case to the Departamento de Aguas of the Ministerio de Ambiente; however, the report submitted by that Ministry does not indicate what measures were taken to protect the water resource endangered by the actions described above. Given the foregoing, the amparo proceeding against these bodies clearly has merit because they have not determined whether legal liability should be imposed in connection with the case, who is responsible, the extent of the damage, the legal consequences of those actions, or whether remediation must be undertaken and what form it may take.
IV.With respect to the Municipalidad de Alajuela and the Fiscalía de Delitos Varios del Primer Circuito Judicial de Alajuela, contrary to the petitioner’s assertions, their actions have not been arbitrary, unlawful, or injurious to fundamental rights. This is so because it has not been established that a complaint concerning the irregular acts committed in the operation of the aforementioned quarry was filed with the respondent Municipalidad. Likewise, under oath, that entity stated that since 17 de setiembre de 2004 it has had the Plan Regulador Urbano del Cantón Central de Alajuela (published in the Diario Oficial La Gaceta N° 182 on that date), which includes regulations governing land use, public spaces, roads and transportation, land-use zoning maps, and urban feasibility and density, such that this instrument governs all matters concerning urban development and its environmental impact (see report at folio 102).
As to the actions of the Fiscalía de Delitos Varios de Alajuela, it has been established that, as of the date on which that Office submitted its report to the Chamber on 28 de octubre de 2009, it was processing criminal case number 08-1855-305-PE for the offense of Violation of the Ley Forestal against María Adela Chaves Aguilar, to the detriment of the Mineral Resource, which had been pending since 02 de mayo de 2008. By that time, the accused person’s preliminary examination (indagatoria) had already been obtained, the Procuraduría General de la República had been notified, the Dirección de Geología y Minas had been asked to assess the environmental damage, and the Área de Conservación of MINAE had likewise been asked to assess that damage. In addition, documentation had been obtained from the Tribunal Ambiental Administrativo, and a technical report from the Departamento de Aguas and an investigative report from the Organismo de Investigación Judicial de Alajuela were available.
Consequently, since no violation of constitutional rules or principles by these last two respondent authorities has been established in this case, the amparo proceeding must be dismissed as to them. Similarly, with respect to the private parties named as respondents, although there is evidence of environmental violations, the identity of the perpetrators has not been established with certainty here; accordingly, the amparo proceeding must be dismissed as to them, without prejudice to the conduct, before the Administration and the courts exercising ordinary legality jurisdiction (jurisdicción de legalidad), of any proceedings or actions warranted under the law for the purpose of seeking remediation and any other relief applicable to the case.
Por tanto:
The amparo proceeding is partially granted for violation of Article 50 of the Political Constitution (Constitución Política). Consequently, José Francisco Castro Muñoz, in his capacity as Director of the Dirección de Geología y Minas of the Ministerio de Ambiente, or whoever holds that office, is ordered to issue immediately the appropriate directives for the purpose of concluding, by means of a final administrative decision (acto final), the proceeding initiated against the concession holder and developer of the Tajo San Antonio project referred to in this matter. José Lino Chaves López, in his capacity as President of the Tribunal Ambiental Administrativo, or whoever serves in that capacity in his stead, is ordered to proceed immediately to conclude, by means of a final administrative decision, the administrative proceeding conducted in connection with the events at issue in this case.
Uriel Juárez Baltodano, in his capacity as Secretary General of the Secretaría Técnica Nacional Ambiental, or whoever serves in that capacity in his stead, is ordered to direct immediately that the corresponding investigation be conducted to determine whether the concession holder and developer of the quarry operation project is complying with its applicable environmental commitments. René Castro Salazar, in his capacity as Minister of the Ministerio de Ambiente, Energía y Telecomunicaciones, or whoever serves in that capacity in his stead, is ordered to direct immediately the Head of that Ministry’s Departamento de Aguas to investigate whether the concession holder and developer of that project complied with the legislation governing the use and protection of a publicly owned watercourse. To comply with the orders issued herein, each respondent shall have a PERIOD OF TWO MONTHS, calculated from the respective notice of the operative portion (parte dispositiva) of this judgment.
As to the remaining respondents, the amparo proceeding is dismissed. The State is ordered to pay the costs, damages, and losses caused by the acts underlying this ruling, which shall be quantified during enforcement of the judgment before the administrative litigation court (contencioso administrativo). José Francisco Castro Muñoz, José Lino Chaves López, Uriel Juárez Baltodano, and René Castro Salazar, in the capacities indicated above, or whoever serves in those offices in their stead, are advised that, pursuant to Article 71 of the Ley de la Jurisdicción Constitucional, any person who receives an order issued in an amparo proceeding that he or she must comply with or cause to be complied with, and who fails to comply with it or cause it to be complied with, shall be sentenced to imprisonment for three months to two years or fined twenty to sixty day-fines, provided that the offense is not subject to a more severe penalty.
This decision shall be personally served on José Francisco Castro Muñoz, José Lino Chaves López, Uriel Juárez Baltodano, and René Castro Salazar, in the capacities indicated above, or on whoever holds those offices. Let notice be given.- Ana Virginia Calzada M.

*090142950007CO* SALA CONSTITUCIONAL DE LA CORTE SUPREMA DE JUSTICIA. San José, a las doce horas y cincuenta y uno minutos del cinco de agosto del dos mil once.
Recurso de amparo interpuesto por José Antonio Arias Chaves, mayor, divorciado, doctor en medicina general y forense, portador de la cédula de identidad número 4-111-569, vecino de Mercedes Sur de Heredia; contra el Presidente de la Junta Directiva de Asfaltos Pedregal Sociedad Anónima y María Adela Chaves Aguilar, el Ministro de Ambiente, Energía y Telecomunicaciones; el Director de Geología y Minas; la Secretaria General de la Secretaría Técnica Nacional Ambiental; el Presidente del Tribunal Ambiental Administrativo; la Alcaldesa Municipal de Alajuela, y el Fiscal Auxiliar de Delitos Varios de la Fiscalía de Alajuela.
Resultando:
Redacta el Magistrado Rueda Leal; y,
Considerando:
De importancia para la decisión de este asunto, se estiman como debidamente demostrados los siguientes hechos:
1. El Tajo San Antonio ubicado en La Garita de Alajuela, un kilómetro al sur, y 500 metros oeste de la Escuela Ricardo Fernández Guardia, posee una concesión minera en la cual la descripción del proyecto es extracción en cantera a cielo abierto y quebradores, según expediente administrativo número 1860 inscrito en el Registro Nacional Minero a nombre de la señora María Adela Chaves Aguilar y cuenta con Aprobación del Estudio Ambiental 1860, por parte de la Comisión Gubernamental de Evaluación y Control de Estudios de Impacto Ambiental, del 20 de marzo de 1989, aunque no cuenta con Responsable Ambiental (ver manifestaciones rendidas bajo juramento a folios 066 y 0074 y Tomos I y II del 2. El 20 de febrero de 2008, la Secretaría Técnica Nacional Ambiental recibió el documento de evaluación ambiental D1 del proyecto de Solicitud de Ampliación de Concesión Minera, Tajo San Antonio, Turrúcares, presentado por la señora María Adela Chaves Aguilar (ver manifestaciones rendidas bajo juramento a folios 0074 y 0124).
3. El 17 de marzo de 2008, vía fax, la Dirección de Geología y Minas del Ministerio de Ambiente, Energía y Telecomunicaciones recibió denuncia del Comité de Seguridad Comunitaria de La Garita, informando que la empresa explotadora del Tajo San Antonio hizo una zanja para desviar la Quebrada Copeyal que atraviesa la finca donde se encuentra el tajo, para poder explotar material por donde pasaba la quebrada, a la que se le asignó el número 74-2008 (ver manifestaciones rendidas bajo juramento a folio 0048).
4. Mediante oficio DGM/RC2-007-2008 del 09 de abril de 2008, los geólogos y el topógrafo de la Dirección de Geología y Minas del Ministerio de Ambiente, Energía y Telecomunicaciones, rinden informe de la inspección realizada, en donde concluyen y recomiendan: “No se está cumpliendo con las medidas del plan de seguridad, pues todos los empleados estaban laborando sin utilizar las medidas mínimas de seguridad (casco, chaleco y otros). En las dos visitas realizadas al área de explotación no se nos ofreció ningún equipo de seguridad ni se nos previno de una posible voladura. En la segunda visita pudimos observar las cargas preparadas para la voladura sin que se nos advirtiera de tal situación. En los patios de acopio se encontraron las señales de seguridad tiradas en el suelo. Se pudo constatar que se está incumpliendo con lo que estipula la Ley Forestal N° 7575 Art. 33 por cuanto se está apilando material en la zona de protección de la Quebrada Copeyal y se desvió el cauce de la misma para la fuera del área de concesión.
Se verificó lo expuesto en la denuncia N° 74-2008, interpuesta por el Comité de Seguridad Comunitaria de La Garita. Se observó también que no se cumple con las medidas de mitigación del polvo proveniente de la explotación y beneficiamiento del material extraído, por cuanto no se humedecen las vías de acceso y el área de quebradores. asimismo, algunas de las vagonetas que salen cargadas no se cubren con su respectiva lona. Habiéndose comprobado los hechos planteados en la denuncia y otros observados en el campo, así como el incumplimiento de la Resolución N° 1091 del 16 de mayo de 1998, de folio 24, Expediente Minero N° 1860, notificada el 16 de mayo del mismo año, donde se indica al concesionario cumplir con lo siguiente: Evitar en lo posible trabajar en la orilla del río o quebrada Copeyal, de manera que no exista arrastre de sedimento…” (ver manifestaciones rendidas bajo juramento a folio 0048 y folios 466 a 478 del Tomo II del expediente minero).
5. El 06 de mayo de 2008, el señor Orlando Vindas Mesén, en su condición de funcionario del MINAE destacado en la Subregión Central de la Cordillera Volcánica Central, interpuso denuncia de carácter ambiental contra la empresa Pedregal y el Tajo San Antonio, concesión minera expediente número 1860 del Registro Nacional Minero, a nombre de Adela Chávez, según la cual: “…se nos puso de conocimiento por parte de vecinos de la comunidad, denuncia contra las empresas explotadoras del Tajo San Antonio, por apertura de zanja para desviar la quebrada Copeyal, que atraviesa la finca donde se encuentra el tajo para explotar material ubicado por donde pasa la quebrada… Que una vez en el sitio se identifica apertura de zanja con una longitud de 178 metros de profundidad y 5 metros de ancho en área de potrero por donde fluía la quebrada que fue desviada… que un tramo de 98 metros de longitud el cauce de la quebrada fue alterado, incluyendo su área de protección a ambos lados removiendo parte de esta…
Que el cauce original de la quebrada fue tapado con material de tajo extrayendo en otro sector aguas abajo material mineral que forma parte de la ribera de la misma quebrada… la Licda. Annette Solano Castro, Gestora Ambiental de la Corporación Pedregal, manifestó que la empresa Pedregal es quien realiza las obras de extracción de materiales y que no se ha tramitado ningún permiso para realizar las obras de taponamiento y desvío de la quebrada Copeyal… que son evidentes y significativas las anomalías, producto de los trabajos realizados…”; denuncia a la que se le asignó el número de expediente 153-08-03-TAA del Tribunal Ambiental Administrativo (ver manifestaciones rendidas bajo juramento a folio 0066 y folio 5 del expediente administrativo del Tribunal Ambiental Administrativo).
6. Por resolución número 333 de las 08:00 horas del 21 de mayo de 2008, la Dirección de Geología y Minas del Ministerio de Ambiente, Energía y Telecomunicaciones resolvió: “…De conformidad con lo expuesto, artículos 14, 67, 91 y 120 del Código de Minería, y oficio DGM-RC2-007-2009 de fecha 9 de abril del 2007, suscrito por los geólogos German González, William Arrieta, Teresa Arrieta, Luis Alberto Chavarría y el topógrafo Luis Ureña resuelve: a) se ordena como medida cautelar, la inmediata suspensión de labores de extracción y procesamiento de materiales de la cantera. b) Respetando el debido proceso y derecho de defensa que le asiste al concesionario, se concede de conformidad con el artículo 67 del Código de Minería, un plazo de diez días hábiles contados a partir del día siguiente a la notificación de la presente resolución para que justifique y presente las pruebas de descargo que a derecho corresponden, con relación al incumplimiento de los términos en los que se otorgó la concesión.
Se advierte que de no presentar dentro del plazo establecido lo requerido, se continuará el procedimiento sin retroactividad de términos. c) Remítase la presente resolución a la SETENA y al Tribunal Ambiental Administrativo para que se determine la existencia del daño ambiental. Asimismo trasládese los antecedentes al Departamento de Aguas del MINAE para que este proceda de acuerdo con sus competencias. Se advierte a la concesionaria, que de conformidad con los artículos 146 y siguientes de la Ley General de Administración Pública, debe acatar la orden de suspensión de labores aquí emitida, caso contrario se recurrirá a las autoridades de policía a efecto de hacerla cumplir conforme la Ley. Se advierte a la concesionaria, que el Código Penal establece el delito de desobediencia a la autoridad” (ver manifestaciones rendidas bajo juramento a folio 0048 y folios 492 a 510 del Tomo II del expediente minero).
7. La resolución número 333 fue comunicada a la concesionaria señora Chaves Aguilar, al Comité denunciante, a la SETENA, al Departamento de Aguas del MINAET, al Tribunal Ambiental Administrativo y adicionalmente, se remitieron los oficios DGM/RNM 375-2008 a la SETENA, DGM/RNM 376-2008 al Departamento de Aguas y DGM/RNM 377-2008 al Tribunal Ambiental Administrativo (ver manifestaciones rendidas bajo juramento a folio 0048 y folios 511 a 513 del Tomo II del expediente minero).
8. Mediante resolución 1509-2008-SETENA del 23 de mayo de 2008, notificada el 28 del mismo mes y año, se le comunicó al desarrollador, que a efecto de continuar con el proceso de evaluación ambiental de la solicitud de ampliación de concesión, debía presentar un Estudio de Impacto Ambiental en el plazo máximo de un año contado a partir del día de la notificación de esa resolución (ver manifestaciones rendidas bajo juramento a folios 0074 y folio 0124).
9. El 04 de junio de 2008, la concesionaria dio respuesta a la resolución 333 que se emitió con base en el oficio DGM/RC2-007-2008 del 09 de abril de 2008, solicitó la nulidad del procedimiento y en forma subsidiaria solicitó que se levantara en forma parcial la suspensión de labores, dejando por fuera la Quebrada Copeyal, que se concediera la oportunidad de remediar y ejercer obras de mitigación en el área afectada (Quebrada Copeyal) y que se aprobara el plan remedial que en ese momento aportó (ver manifestaciones rendidas bajo juramento a folio 0048 y folios 545 a 552 del Tomo II del expediente minero).
10. Por tratarse de aspectos técnicos-geológicos, se le solicitó criterio a un geólogo, quien además de ser el coordinador minero de la zona, recomendó la suspensión de labores y mediante oficio número DGM-CRC2-029-2009 del 20 de agosto de 2008 respondió: “…A solicitud del MSc. José Francisco Castro Muñoz, Director de la Dirección de Geología y Minas, se procedió a revisar la respuesta que María Adela Chaves Aguilar le da a la Resolución No. 333 del 21 de mayo de 2008, la cual se basa en los oficios DGM-RC2-007-2008 y DGM-CRC2-015-2008. Todo lo anterior en referencia al expediente minero No. 1860 (Tajo San Antonio). Dicha revisión arrojó los siguientes resultados, siguiendo el orden en que se presentó la respuesta arriba citada: Respecto al Memo DGM-RC2-007-2008 Punto a), si bien el sitio estaba aprobado para patio de acopio, no se debió afectar la zona de protección de la quebrada Copeyal, puesto que se estaba incumpliendo con: 1- La Resolución No. 1091 del 16/05/1988, donde la Comisión Gubernamental sobre los Estudios de Impacto Ambiental notifica al interesado que debe cumplir entre otros aspectos con lo anotado en el punto 2, que dice lo siguiente, “Evitar en lo posible trabajar en la orilla del río o quebrada Copeyal de manera que no exista arrastre de sedimentos” (ver manifestaciones rendidas bajo juramento a folio 0048 y folios 24 y 34 del Tomo I del expediente minero).
11. Se hizo levantamiento parcial de la suspensión de labores, únicamente para que se pudiera efectuar la venta de los materiales procesados en stock en los patios colindantes con la quebrada Copeyal y se condicionó ese levantamiento parcial a la presentación previa de la cuantificación del volumen de stock y a la presentación semanal del reporte de ventas, ante la Dirección de Geología y Minas del Ministerio de Ambiente, Energía y Telecomunicaciones, con el objetivo de que los materiales fueran removidos y se pudiera iniciar las obras para la recuperación de las márgenes del cauce de la quebrada Copeyal, una vez que el plan de recuperación haya sido aprobado (ver manifestaciones rendidas bajo juramento a folio 0048 y folios 554 a 555 del Tomo II del expediente minero).
12. Mediante oficio número ASA-650-2008-SETENA del 27 de agosto de 2008, el Departamento de Auditoría y Seguimiento Ambiental de la Secretaría Técnica Nacional Ambiental describió su visita al sitio, en acatamiento de la Resolución 333 del 21 de mayo de 2008, el cual indica: “Informe Técnico de la visita de campo. El 21 de agosto del 2008, se realizó visita a este proyecto como medida de seguimiento de la Resolución emitida por la Dirección de Geología y Minas, en el AP se pudo observar lo siguiente: - Fuimos atendidos por la encargada de Gestión Ambiental la Lic. Annette Solano Castro, porque el proyecto no cuenta con Responsable Ambiental vigente. – A la hora de la inspección en el tajo, la entrada se encontraba cerrada y en resguardo por un guarda de seguridad, se observa un contenedor que es usado como oficinas, además de un cargador. – Ya adentro del AP se pudo divisar dos apilamientos de materiales de unos 10 metros de alto por 12 metros de circunferencia, un quebrador primario que no está en uso, se observó las bases donde se localizaba un quebrador secundario, pero, según indicó la señora Annette Solano este fue llevado a otras instalaciones. – Continuando con el recorrido por el AP, estando en el sitio específico de extracción de material de la cantera, se notó el sector sur una zona donde ya se extrajo la mayoría del material disponible en el sitio; sin embargo, en el sector norte, por donde pasa la quebrada Copeyal que desfoga en el río Alajuela, hay otra zona donde todavía queda gran cantidad de material disponible. – El Desarrollador hizo un dique y canal que mide aproximadamente 150 metros de largo por 3 de ancho y 6 de profundidad, para almacenar agua y cambiar la dirección de la quebrada Copeyal, y así, poder extraer el material que está por donde pasaba el cauce de la quebrada Copeyal. – Al momento de la visita al AP y debido a la gran cantidad de agua que fluye por la quebrada en esta época, se rompió el dique y el agua de la quebrada abrió paso por el centro de la Cantera, que es por donde está fluyendo en este momento.
Por otro lado, el Desarrollador sí respetó la zona de protección del Río Alajuela que pasa en el sector oeste del AP. – Donde se ubica el quebrador, cerca del (sic) quebrada se construyeron planteles para el apilamiento de material ya procesado; sin embargo, el sitio donde se apiló el material no se respetó la zona de protección de la quebrada Copeyal, provocando que con el agua de escorrentía se produjera arrastre de materiales que caen dentro de la quebrada, esto se da en el margen izquierdo aguas abajo de la quebrada, por una longitud de unos 200 metros lineales. Con base en la información técnica y legal que consta en el proyecto cuenta con Aprobación del Estudio Ambiental 1860 por parte de la Comisión Gubernamental de Evaluación y Control de Estudios de Impacto Ambiental, el 20 de marzo de 1989. El proyecto no cuenta con Responsable Ambiental. CONCLUSIONES. PRIMERO: El día que se realizó la inspección al AP del tajo San Antonio ubicado en la Garita de Alajuela, se corroboró que están suspendidas las labores de extracción y procesamiento de materiales de la cantera.
La visita se realizó en conjunto con la encargada de Gestión Ambiental la Lic. Annette Solano Castro. SEGUNDO: En la visita se constató los aspectos mencionados por el Dpto. Geología y Minas/MINAET; corroborándose el lugar donde se construyó un dique y un canal, según la Lic. Annette Solano Castro el dique aparentemente se construyó para desviar la quebrada, y al mismo tiempo formaba un embalse utilizado para la toma de agua que se usaba para la mitigación del polvo en el proceso de extracción. TERCERO: También se constató otro aspecto mencionado por el Dpto. Geología y Minas/MINAET; Corroborándose que se realizaron apilamientos de material en la zona de protección de la quebrada, y a causa de la pendiente y el agua de escorrentía los materiales están siendo erosionados hacia el cauce de la quebrada. RECOMENDACIONES. De acuerdo a los elementos técnicos y legales, se recomienda: - El Departamento de Auditoría y Seguimiento Ambiental deberá continuar con el proceso de seguimiento a la suspensión de labores de extracción y procesamiento de la cantera con nombre tajo San Antonio, ubicada en la Garita de Alajuela. – en la Resolución 333 de la Dirección de Geología y Minas.
Registro Nacional Minero del 20 de mayo del 2008; en el punto Primero del Considerando menciona que una de las condiciones técnicas establecidas para el otorgamiento de la prórroga de la vigencia para el Tajo San Antonio Exp. 1860 es: “respetar el área de protección al cauce del río…” y es evidente que el concesionario ha irrespetado esta condición. Por lo tanto, ya que la situación lo amerita, se recomienda formar un equipo de trabajo para valorar el posible daño ambiental producido y la afectación a la fuente de agua, como es mencionado en dicha Resolución en el punto C del Por Tanto” (ver manifestaciones rendidas bajo juramento a folio 00074 y 00124 y folio 66 del expediente administrativo 1860 Minero de la Secretaría Técnica Nacional Ambiental).
13. Mediante resolución número 05-09-TAA de las 09:30 horas del 16 de enero de 2009, el Tribunal Ambiental Administrativo resolvió: “PRIMERO: Que es determinante realizar la valoración del daño ambiental de conformidad con los hechos denunciados por lo que este Despacho, ordena al señor Rafael Gutiérrez Rojas en su condición de Director del Área de Conservación Cordillera Volcánica Central o a quien ocupe su cargo, girar las instrucciones correspondientes a efecto de que, se realice una inspección ocular “in situ” y rendir un informe detallado así como la respectiva valoración económica del daño ambiental de manera conjunta con el Departamento de Aguas (ver manifestaciones rendidas bajo juramento a folio 0066 y folio 9 del expediente administrativo del Tribunal Ambiental Administrativo).
14. Mediante oficio SRC-OA-239 del 02 de abril de 2009, la Jefa de la Subregión Central, oficina de Alajuela del ACCVC [Área de Conservación Cordillera Volcánica Central], comunicó al Tribunal Ambiental Administrativo que el 27 de marzo de 2009, se efectuó inspección ocular en el sitio con el fin de tomar información para realizar la valoración económica y se notificó la medida cautelar, constatando que la actividad cuestionada no estaba operando desde hace varios meses, según consta en la bitácora que lleva la empresa Pedregal Tajo San Antonio, la cual ha sido monitoreada por SETENA, que el sitio en donde se produjeron los daños no había sido reparado, además solicitó que en la valoración del daño económico ambiental participaran la Dirección de Geología y Minas del MINAET y el Departamento de Aguas (ver manifestaciones rendidas bajo juramento a folio 0066 y folio 17 del expediente administrativo del Tribunal Ambiental Administrativo).
15. Mediante resolución número 460-09-TAA de las 08:00 horas del 28 de abril de 2009, el Tribunal Ambiental Administrativo resolvió acumular las dos denuncias presentadas en este caso en un solo expediente, y tramitarlas bajo el número 153-08-03-TAA (ver manifestaciones rendidas bajo juramento a folio 0066 y folio 78 del expediente administrativo del Tribunal Ambiental Administrativo).
16. Por oficio número DGM-CRC2-039-2009 del 01 de junio de 2009, el geólogo de la Dirección de Geología y Minas del Ministerio de Ambiente, Energía y Telecomunicaciones informó: “…3. Recomendaciones. A fin de seguir adelante con la evaluación técnica para el levantamiento de la suspensión de labores ordenada en la Resolución No. 333, se recomienda el cumplimiento de las siguientes acciones, las cuales deberán ser confirmadas en el campo una vez se comunique a la DGM su finiquito: 3.1. Estabilizar los taludes de los patios de acopio y conformación de una pendiente en los mismos, hacia lo interno del área, a fin de encausar las aguas en un sistema de drenaje que deberá ser diseñado y construido para dicho fin. 3.2. Diseñar y construir una o varias pilas de sedimentación que eviten que los sedimentos acarreados por las aguas de escorrentía caigan directamente a la Quebrada Copeyal o al Río Alajuela.
Dicha pila o pilas deberán ser construidas en concordancia con el área de la concesión, el caudal de las aguas de escorrentía durante las precipitaciones máximas de la zona, considerando también para ello las aguas de escorrentía que puedan venir de fincas aledañas. Deberá tomarse en cuenta también la capacidad de infiltración del piso de la cantera y el suelo que pueda quedar en otras áreas de la concesión, y el tiempo de tránsito de las aguas de escorrentía. 3.3. Los diseños del sistema de drenaje y de las pilas de sedimentación, así como el de la estabilización de los taludes que dan a la Quebrada Copeyal, deberán presentarse ante esta Dirección para su estudio y aprobación, antes de su construcción. 3.4. No se deberá acumular materiales procesados o por procesar en las cercanías de la zona de protección de la Quebrada Copeyal, para evitar su deslave hacia la misma. 3.5. Se deberá respetar en todo momento la zona de protección de la Quebrada Copeyal, según lo establece el artículo 33 de la Ley Forestal. 3.6.
Deberá cumplirse en todo momento con lo establecido en el Reglamento de Seguridad e Higiene, una copia del cual deberá estar siempre visible para los trabajadores y visitantes. 3.7. Deberá disponerse de equipo de seguridad para los visitantes. 3.8. Deberán implementarse medidas de mitigación de polvo en las áreas de extracción, procesamiento y patios de acopio. 3.9. Cumplir con lo estipulado en el Plan de Remediación de un segmento de la Quebrada Copeyal en lo que sea pertinente, ya que la situación descrita en el mismo no se ajusta a la realidad actual; sin embargo, las condiciones de suelo del canal practicado y las del trayecto por el que actualmente corre la quebrada, son muy similares. asimismo, cumplir con la modificación al plan presentado el 08 de mayo de 2009. 3.2.1. En relación a esto, se recomienda reforzar con rocas de diámetro disimétrico a métrico, la parte interna (talud hacia la quebrada) del dique de tierra, que se construirá para encausar la Quebrada Copeyal, a fin de que no sea socavado o destruido por las crecidas de la misma en época lluviosa. O en su defecto presentar un diseño propio que solvente dicho problema potencial.” (ver manifestaciones rendidas bajo juramento a folio 0048 y folios 663 a 667 del Tomo II del expediente minero).
17. Por resolución 392 del 03 de junio de 2009, se comunicó a la concesionaria el oficio número DGM-CRC2-039-2009, concediéndole un plazo de 30 días para su cumplimiento (ver manifestaciones rendidas bajo juramento a folio 0048 y folios 670 a 676 del Tomo II del expediente minero).
18. Según consta en el oficio DGM-CRC-2-055-2009 del 28 de julio de 2009, el geólogo de la Dirección de Geología y Minas del Ministerio de Ambiente, Energía y Telecomunicaciones indicó: “…Mediante el documento recibido el día 14 de Julio de 2009 por la DGM, la concesionaria María Adela Chávez Aguilar, en respuesta al oficio DGM-CRC2-039-2009, y con el fin de que se prosiga con la evaluación técnica para el levantamiento de la medida cautelar de suspensión de labores, manifiesta lo siguiente: 1- Los taludes de los patios de acopio fueron estabilizados mediante la siembra de zacate durante el período invierno 2008. 2- Una vez reanudadas las labores extractivas, nos comprometemos a no acumular materiales procesados en las cercanías de la Quebrada Copeyal, a fin de evitar su deslave hacia la misma. 3- En todo momento se respetará la zona de protección de la Quebrada Copeyal establecida en la Ley Forestal N° 7575. 4- Durante los trabajos en la concesión se cumplirá con lo establecido en el Reglamento General de Seguridad e Higiene de Trabajo, Decreto Ejecutivo N° 1 del 02 de enero de 1967, una copia del cual se mantendrá en la Caseta de entrada. 5- Se dispondrá del equipo de seguridad para los trabajadores, de acuerdo a las recomendaciones por puesto de trabajo realizadas por nuestro Encargado de Salud Ocupacional. 6- En la Caseta de Entrada se dispondrá para los visitantes de chalecos reflectivos y cascos de seguridad. 7- Durante la época seca se realizará riego permanente mediante camión cisterna, de las áreas de extracción, procesamiento y patios de acopio que presenten problemas de generación de polvo. 8- Durante los meses de mayo y junio 2009 se procedió a implementar al Plan de Remediación de un Segmento de la Quebrada Copeyal, construyéndose el dique respectivo para encauzar las aguas por un antiguo trayecto.
El talud que da hacia la Quebrada fue reforzado convoca a fin de evitar su erosión y el resto del talud se sembró con zacate maní. En la zona de protección a ambos lados, se sembraron 65 árboles de especies nativas. 9- Se adjunta diseño de sistema para manejo de aguas pluviales. Con respecto a su implementación, se solicita a la Dirección de Geología y Minas se nos permita construirlo una vez que sea levantada la suspensión de labores ordenada mediante Resolución N° 333 del 21 de mayo de 2008 y se reinicien las labores de extracción, pues se requiere disponer de maquinaria y materiales procesados, para poder conformar las pendientes en los patios de acopio y construir los drenajes y la pila de sedimentación” (ver manifestaciones rendidas bajo juramento a folio 0048).
19. Mediante oficio SRC-OA-707 del 12 de agosto de 2009, el Jefe de la Subregión Central, Oficina de Alajuela del ACCVC, comunicó vía fax al Tribunal Ambiental Administrativo que la valoración del daño ambiental por el recurso hídrico afectado asciende a la cantidad de un millón doscientos mil colones exactos (¢1.200.000.00) (ver manifestaciones rendidas bajo juramento a folio 0066).
20. El Tribunal Ambiental Administrativo se encuentra analizando la prueba documental y pericial para realizar la programación de audiencia oral y privada en donde se citará a todas las partes involucradas, con el fin de verificar la verdad real de los hechos (ver manifestaciones rendidas bajo juramento a folio 0066 y folio 5 del expediente administrativo del Tribunal Ambiental Administrativo).
21. La Dirección de Geología y Minas del Ministerio de Ambiente, Energía y Telecomunicaciones recomendó el levantamiento de la medida cautelar de suspensión de labores ordenada mediante Resolución No. 333 de las 08:00 horas del 21 de mayo de 2008, bajo las siguientes condiciones: “1- Se deberá cumplir con lo expuesto en el documento mencionado al inicio de este oficio, y lo que dispone el Código de Minería y su reglamento, así como lo estipulado en el Plan de Explotación aprobado por esa Dirección. 2- No se deberá acopiar material sin procesar ni procesado en las cercanías de la Quebrada Copeyal (junto a la zona de protección), para evitar su deslave hacia la zona de protección y la quebrada misma. 3- Se acepta la petición de permitir que la construcción del sistema de drenaje y las pilas de sedimentación se inicie una vez que se retomen las labores de explotación. El sistema de drenaje y las pilas de sedimentación deberán construirse respetando las especificaciones del diseño presentado en el plano modificado, entregado a esa Dirección el día 27 de julio de 2009” (ver manifestaciones rendidas bajo juramento a folio 0048 y folios 682 a 684 del Tomo II del 22. Por resolución 760 del 31 de agosto de 2009, se comunicó a la concesionaria lo acordado y se procedió a levantar la suspensión de labores ordenada (ver manifestaciones rendidas bajo juramento a folio 0048).
23. La última inspección de control realizada por el geólogo de la Dirección de Geología y Minas del Ministerio de Ambiente, Energía y Telecomunicaciones fue el 02 de setiembre de 2009 y al efecto se informó: “…El día 02 de Setiembre de 2009, al ser las 1:20 p.m. se procedió a realizar una visita de control al Tajo San Antonio, con el fin de verificar los avances en los trabajos relacionados con el sistema de drenaje y las pilas de sedimentación que se debían construir. Observaciones de campo: 1- Se estaban realizando labores de destape en el sector sur, 2- no se realizaban labores de extracción y 3- solo se observó en operación el quebrador secundario. 4- En las cercanías de las oficinas, se observó la instalación reciente de un tanque de combustible, carece de planché y trampas para aceite. 5- Se observaron numerosos bidones de aceite en las cercanías del tanque de combustible y numerosos bidones de aceite a la intemperie.
Se dejó en bitácora la indicación de la necesidad de construir un planché con trampas de aceite para el tanque de combustible, así como un lugar adecuado para el almacenamiento de los bidones. 6- Se pudo observar que ya se habían conformado casi la totalidad los canales para el sistema de drenaje, los cuales se observaron en los patios de apilamiento y en el área de quebradores. Sin embargo, no se habían iniciado los trabajos para la construcción de las pilas de sedimentación. Se anotó la visita en la bitácora No. 2711-09 en el folio 73129 (copia adjunta). El día 15 de octubre, se conversó con la geóloga regente, la cual manifestó que a esa fecha ya se habían iniciado los trabajos de construcción de las pilas de sedimentación. Conclusiones y recomendaciones: 1- Se deberá presentar ante esta Dirección el permiso correspondiente de la Dirección de Transporte y Comercialización de Combustible para la instalación del tanque observado. 2- Deberá construirse el planché con trampas para aceite para el tanque de combustible, esto de comprobarse que cuentan con el permiso para su instalación. 3- Deberá construirse un lugar adecuado para el almacenamiento de los bidones de aceite o combustible.” (ver manifestaciones rendidas bajo juramento a folio 0048 y folios 694 a 696 del Tomo II del 24.
Según el reporte del Proceso de Control Fiscal y Urbano de la Municipalidad de Alajuela, este proyecto de concesión minera cuenta con el permiso sanitario de funcionamiento número ARSA-2-400-2007 vigente hasta el 07 de agosto de 2012 (ver manifestaciones rendidas bajo juramento a folio 0101).
El recurrente alega que los accionados no han cumplido con sus competencias en la protección del ambiente, dado que se han cometido hechos irregulares en la operación de una concesión de tajo, que tienen que ver con la desviación de un cauce de dominio público, con la destrucción de la zona protegida adyacente a ese cauce, y con la infracción de los términos y condiciones de la concesión, sin que los recurridos hubieren realizado los actos correspondientes para evitar el daño que se ha producido.
Del análisis del caso se desprende que, en lo esencial, lleva razón el recurrente. Al respecto, está acreditado que quienes realizan la autorización legal, acciones contra el derecho a un ambiente sano y ecológicamente equilibrado. En este sentido, de los hechos probados se desprende que se desvió, en determinada sección, la Quebrada Copeyal (afluente del Río Alajuela), que atraviesa la finca donde está el tajo, que se ha apilado material en la zona de protección de la quebrada, que una parte del canal de desvío se encuentra fuera del área de concesión, que no se ha cumplido con las medidas de mitigación del polvo que produce la explotación del tajo, que los camiones que transportan el mineral salen descubiertos, y que no se ha cumplido con la condición de evitar que no exista arrastre de sedimentos hacia la quebrada, además de que se comprobó que el cauce original de la quebrada fue tapado y que se ha extraído material del sitio donde estaba el cauce de esa quebrada.
Lo anterior ha sido de conocimiento de la Dirección de Geología y Minas, del Tribunal Ambiental Administrativo y de la Secretaría Técnica Nacional Ambiental, de acuerdo con lo que se ha acreditado en este proceso. Empero, a pesar de que esos órganos conocen el problema, no han llevado a cabo actuaciones para establecer la responsabilidad legal de los sujetos privados que han llevado a cabo todas las acciones irregulares que se han descrito. En este sentido, se tiene que esa Dirección dictó una medida cautelar de suspensión de obras, pero no resolvió si la concesionaria incurrió en alguna situación ilegal que amerite la cancelación de la concesión. El Tribunal Ambiental Administrativo tampoco ha resuelto las denuncias que recibió respecto de esos hechos. Por su parte, la Secretaría Técnica Nacional Ambiental también fue notificada sobre la situación irregular acontecida en el sitio de la embargo, al igual que los otros accionados que se acaban de mencionar, no ha efectuado el procedimiento correspondiente para determinar si la concesionaria ha incumplido las obligaciones que adquirió con la aprobación del estudio de impacto ambiental.
Finalmente, está acreditado que la Dirección de Geología y Minas también comunicó del caso al Departamento de Aguas del Ministerio de Ambiente, sin embargo, en el informe rendido por esa Cartera, no se indican cuáles fueron las medidas que se realizaron para la protección del recurso hídrico, puesto en peligro por las acciones arriba indicadas. Dado lo anterior, es clara la procedencia del amparo contra estos órganos, ya que no han resuelto si corresponde atribuir responsabilidades legales por el caso, quiénes son los responsables, la magnitud del daño, las consecuencias legales que esas acciones tienen, y no han establecido si se deben hacer reparaciones y cuáles pueden ser.
IV.En lo que respecta a la Municipalidad de Alajuela y la Fiscalía de Delitos Varios del Primer Circuito Judicial de Alajuela, contrariamente a lo dicho por el amparado, sus actuaciones no han sido arbitrarias, ilegítimas o lesivas de los derechos fundamentales. Esto es así, porque no se ha acreditado que ante la Municipalidad recurrida se hubiere interpuesto denuncia por los hechos irregulares cometidos en la explotación del referido tajo. Asimismo, bajo juramento, esa entidad ha dicho que desde el 17 de setiembre de 2004 cuenta con el Plan Regulador Urbano del Cantón Central de Alajuela (publicado en el Diario Oficial La Gaceta N° 182 de dicha fecha), el cual incluye reglamentación de uso de suelo, espacios públicos, vialidad y transporte, mapas de zonificación de uso de suelo, y viabilidad y densidad urbana, de manera que mediante ese instrumento se rige todo lo concerniente a la materia de desarrollo urbano y su impacto sobre el ambiente (ver informe a folio 102).
Ahora, respecto de las actuaciones de la Fiscalía de Delitos Varios de Alajuela, está probado que a la fecha en que rindió su informe a la Sala el 28 de octubre de 2009, ese Despacho tenía en trámite la causa penal número 08-1855-305-PE por el delito de Infracción a la Ley Forestal contra María Adela Chaves Aguilar, en perjuicio del Recurso Mineral, desde el 02 de mayo de 2008, y que ya se contaba con la indagatoria de la persona denunciada, la comunicación a la Procuraduría General de la República, la solicitud de valoración del daño ambiental a la Dirección de Geología y Minas, y también, solicitud al Área de Conservación de MINAE de la valoración del daño ambiental. Asimismo, se había recabado la documentación del Tribunal Ambiental Administrativo, se contaba con informe técnico del Departamento de Aguas y con informe de investigación del Organismo de Investigación Judicial de Alajuela.
En consecuencia, al no constatarse que en la especie se haya dado vulneración a normas o principios constitucionales por parte de estas dos últimas autoridades recurridas, procede desestimar el amparo respecto de ellas. Del mismo modo, en relación con los sujetos privados que se han tenido como demandados, aunque existe prueba de vulneraciones al ambiente, no se tiene aquí certeza respecto de los autores, de manera que, corresponde desestimar el amparo en lo que a estos se refiere; sin perjuicio de que en la Administración y en la jurisdicción de legalidad, se realicen los procedimientos o procesos que conforme con las leyes procedan, con el objeto de exigir las reparaciones y demás pretensiones del caso.
Por tanto:
Se declara parcialmente con lugar el recurso por violación al artículo 50 de la Constitución Política. En consecuencia, se ordena a José Francisco Castro Muñoz, en su condición de Director de la Dirección de Geología y Minas del Ministerio de Ambiente, o a quien ocupe ese cargo, que en forma inmediata dicte las disposiciones que correspondan, con el objeto de concluir mediante acto final el procedimiento que se inició contra la concesionaria y desarrolladora del proyecto del Tajo San Antonio a que se refiere este asunto. Se ordena a José Lino Chaves López, en su calidad de Presidente del Tribunal Ambiental Administrativo, o a quien en su lugar ejerza ese cargo, que en forma inmediata, proceda a concluir mediante acto final el procedimiento administrativo seguido por los hechos a que se refiere este caso. Se ordena a Uriel Juárez Baltodano, en su condición de Secretario General de la Secretaría Técnica Nacional Ambiental, o a quien en su lugar ejerza ese cargo, que ordene en forma inmediata la realización de la investigación respectiva a efecto de establecer si la concesionaria y desarrolladora del proyecto de explotación de ese tajo está cumpliendo los compromisos ambientales que le corresponden.
Se ordena a René Castro Salazar, en su condición de Ministro de Ambiente, Energía y Telecomunicaciones, o a quien en su lugar ejerza ese cargo, que en forma inmediata ordene al Jefe del Departamento de Aguas de ese Ministerio, que investigue si la concesionaria y desarrolladora de ese proyecto cumplió la legislación sobre uso y protección de cauce de dominio público. Para el cumplimiento de lo aquí ordenado, cada accionado dispone del PLAZO DE DOS MESES, que se contará a partir de la respectiva comunicación de la parte dispositiva de esta sentencia. En cuanto a los demás recurridos se declara sin lugar el recurso. Se condena al Estado al pago de las costas, daños y perjuicios causados con los hechos que sirven de base a esta declaratoria, los que se liquidarán en ejecución de sentencia de lo contencioso administrativo. Se advierte a José Francisco Castro Muñoz, José Lino Chaves López, Uriel Juárez Baltodano, y René Castro Salazar, en sus condiciones antes indicadas, o a quienes en sus lugares ejerzan esos cargos, que de conformidad con el artículo 71 de la Ley de la Jurisdicción Constitucional, se impondrá prisión de tres meses a dos años, o de veinte a sesenta días multa, a quien recibiere una orden que deba cumplir o hacer cumplir, dictada en un recurso de amparo y no la cumpliere o no la hiciere cumplir, siempre que el delito no esté más gravemente penado.
Notifíquese esta resolución en forma personal a José Francisco Castro Muñoz, José Lino Chaves López, Uriel Juárez Baltodano, y René Castro Salazar, en sus condiciones antes indicadas, o a quienes ocupen esos cargos. Comuníquese.- Ana Virginia Calzada M.
