Amparo action (recurso de amparo) filed by Guadalupe Cordero Sojo, holder of identity card 6-261-157, and Juan Luis Vargas Montoya, holder of identity card 6-148-050, against the Mayor of Puntarenas.
Findings:
Opinion drafted by Justice Cruz Castro; and,
Considerations:
The petitioners allege that they must contend with serious flooding problems because the respondent Municipality left a sewerage and stormwater drainage project incomplete, and the water flowing from the I.C.E. facilities floods a stream that was blocked and filled in by municipal machinery, also causing their homes to flood.
The following facts are deemed duly established and relevant to the resolution of this matter, either because they have been proven or because the respondent failed to address them as directed in the initial order:
a. There are flooding problems in the homes near the southeastern wall surrounding the Instituto Costarricense de Electricidad station (see electronic record).
b. The Municipalidad de Puntarenas installed 18”-diameter drainage piping and inspection chambers to collect stormwater (see electronic record).
c. Because of the topography of the land, the slope of the piping required conveying the water to the property of the Instituto Costarricense del Electricidad (see electronic record).
d. A letter of commitment and authorization from the Instituto Costarricense del Seguro Social had been obtained in order to perform the sewerage work; however, when the work was being carried out, officials of the Instituto Costarricense del Seguro Social denied the Municipality the permits (see electronic record).
e. Because the sewerage work remained unfinished, there is currently a serious flooding problem in nearby homes, since when the water reaches the walls of the Instituto Costarricense de Electricidad facilities, it overflows from the piping and floods the surrounding properties (see electronic record).
III.THE RIGHT TO ENJOY A HEALTHY AND ECOLOGICALLY BALANCED ENVIRONMENT, STORMWATER SEWERAGE, AND THE POWERS OF PUBLIC ADMINISTRATIVE AUTHORITIES IN THAT REGARD.- In its settled case law, this Court has recognized that the right to enjoy a healthy and ecologically balanced environment is a fundamental right derived from Article 50 of the Constitution, which not only enshrines every citizen’s right to enjoy a healthy and ecologically balanced environment but also requires the State to guarantee the exercise of that right through the means established for that purpose by current legislation. Specifically, as this Chamber stated in judgment number 2005-009900, issued at diez horas del veintinueve de julio del dos mil cinco, the Municipality must construct the infrastructure necessary to ensure that water drains properly, thereby guaranteeing the right to health and to an environment free from pollution, without harming third parties:
“V.- Municipal obligations regarding stormwater sewerage.- It should be borne in mind that Article 169 of the Constitución Política establishes that the administration of local interests and services in each canton shall be entrusted to the Municipal Government. Local interests and services have been defined by the Chamber as indeterminate legal concepts (conceptos jurídicos indeterminados), the precise content of which is not established by law for their application to specific cases; consequently, the person responsible for applying them must rely on value judgments and experience to determine their content. The creation of adequate drainage facilities within a community so as not to cause property damage, harm to health, or environmental problems for its residents is, under the terms established by the Constitución Política, an interest of the canton and forms part of the services that the Municipality is required to provide.
Likewise, Article 285 of the Ley General de Salud establishes that stormwater must be disposed of properly and under sanitary conditions in order to prevent contamination of the soil and natural water sources intended for human use and consumption, the creation of breeding grounds for disease vectors, and air pollution through conditions that threaten its purity and quality. For that reason, the Municipalidad de Goicoechea is required to undertake specific action to fulfill its purposes by adopting the measures necessary to provide the protected community with an efficient stormwater drainage system. In accordance with standards of reasonableness, the Municipality must construct the infrastructure necessary to ensure that such water drains properly, thereby guaranteeing the right to health and to an environment free from pollution, without harming third parties.” As follows from the foregoing, authority over stormwater sewerage is expressly and implicitly established by ordinary legislation.
Although the current Código Municipal contains no specific provision on this matter, the Chamber held in judgment number 2002- 08696, issued at diez horas catorce minutos del seis de septiembre del dos mil dos, that this does not exclude the entities’ obligation to develop, among other community works, adequate aqueduct and sewerage systems. Indeed, Article 4(c) of the current Código Municipal establishes, in general terms, that the administration and provision of municipal public services are municipal powers, and those services unquestionably include the sewerage system.
The Código Municipal establishes the obligation of municipalities to ensure that persons subject to the administration (administrados) are guaranteed the real and effective enjoyment of the right to health and to a healthy environment. In particular, Article 75 provides that, in accordance with the Municipal Regulatory Plan (Plan Regulador Municipal), individuals or legal entities that own or possess real property under any title must, among other activities, fence and clean both lots without buildings and those containing unoccupied dwellings or structures undergoing demolition; remove objects, materials, or similar items from sidewalks or property they own that pollute the environment or obstruct passage; and adequately ensure the safety, cleanliness, and maintenance of properties when roads, public property, or third parties connected with them are affected. Failure to comply with the foregoing authorizes the respective municipality to levy fines, subject to compliance with due process (debido proceso).
The aforementioned article states that, where those obligations have been omitted and the municipality is aware of the dangerous situation, it has an obligation to remedy the omission at the expense of the person subject to the administration, so as to prevent greater harm. In the present case, it has been established that the respondent authority’s actions have demonstrated an inability to enforce the applicable laws and to fulfill its obligation to guarantee the residents of the area the enjoyment of a healthy and ecologically balanced environment, for the reasons set forth below. During the rainy season, residents of the neighborhood located behind the Bodegas de ABOPAC must contend with serious flooding on their properties because, when the water reaches the walls of the Instituto Costarricense de Electricidad facilities, it overflows from the pipes and floods the surrounding properties.
It must be borne in mind that the principle of legality (principio de legalidad) has moved beyond its former formalism, which represented a considerable obstacle to the activities of state bodies and to the effective realization of the fundamental rights established by the Constitución Política, specifically the right to the provision of public services by the State. Local Governments must change from their passive role as spectators to that of vital and decisive protagonists in achieving the welfare objectives set forth in the constitutional text, since they are designated as the administrators of local interests and services. Accordingly, they must devote their full attention to the needs of their community. In view of the foregoing, the petitioners must be found to be correct, and the local government shall take the appropriate measures to resolve the reported sewerage problem.
Por tanto:
The amparo action (recurso de amparo) is granted. Rafael Rodríguez Castro, in his capacity as Mayor of the Municipalidad de Puntarenas, or whoever holds that office, is ordered to immediately adopt the appropriate measures to definitively resolve the flooding problem caused by the overflow of the pipes at the walls of the Instituto Costarricense de Electricidad facilities in Puntarenas; that work must be completed no later than six months. The foregoing is ordered with the warning that, pursuant to Article 71 of the Ley de la Jurisdicción Constitucional, any person who receives an order issued in an amparo action that the person must comply with or cause to be complied with, and who fails to comply with it or cause it to be complied with, shall be punished by imprisonment for three months to two years or by a fine of twenty to sixty days, provided that the offense is not subject to a more severe penalty.
The Contraloría General de la República is ordered not to approve any budgets or amendments thereto submitted by the Municipalidad de Puntarenas during the next budget year. The Municipalidad de Puntarenas is ordered to pay the legal costs, damages, and losses caused by the facts underlying this judgment, the amounts of which shall be determined during enforcement of the judgment (ejecución de sentencia) in the administrative litigation proceedings (contencioso administrativo). This decision shall be served PERSONALLY on Rafael Rodríguez Castro, in his capacity as Mayor of the Municipalidad de Puntarenas, or on whoever holds that office.

Recurso de amparo presentado por Guadalupe Cordero Sojo, portadora de la cédula de identidad 6-261-157 y Juan Luis Vargas Montoya, portador de la cédula de identidad 6-148-050, contra el Alcalde de Puntarenas.
Resultando:
Redacta el Magistrado Cruz Castro; y,
Considerando:
Alegan los recurrentes que tienen que enfrentar serios problemas de inundaciones toda vez que al dejar la Municipalidad recurrida un proyecto de alcantarillado y evacuación de aguas pluviales incompleto, las aguas que discurren de las instalaciones del I.C.E. inundan una quebrada que fue bloqueada y aterrada por maquinaria municipal, provocando que también se inunden sus casas.
De importancia para la decisión de este asunto, se estiman como debidamente demostrados los siguientes hechos, sea porque así han sido acreditados o bien porque el recurrido haya omitido referirse a ellos según lo prevenido en el auto inicial:
a. Que existen problemas de inundación en las viviendas cercanas a la tapia sur-este que rodea la estación del Instituto Costarricense de Electricidad (ver registro electrónico).
b. Que la Municipalidad de Puntarenas instaló un alcantarillado de 18” de diámetro y cajas de registro para recibir las aguas pluviales (ver registro electrónico).
c. Que por la topografía del terreno la pendientes de las tubería implicaba la conducción de las aguas hasta la propiedad del Instituto Costarricense del Electricidad (ver registro electrónico).
d. Que para realizar los trabajos de alcantarillado se contaba con una nota de compromiso y autorización por parte del Instituto Costarricense del Seguro Social, sin embargo, al momento de ejecutar las obras los personeros del Instituto Costarricense del Seguro Social les denegaron a la Municipalidad los permisos (ver registro electrónico).
e. Que al quedar inconclusos los trabajos de alcantarillado en la actualidad se genera un problema serio de inundaciones en las viviendas cercanas, ya que al encontrarse las aguas en las tapias de las instalaciones del Instituto Costarricense de Electricidad las mismas se rebalsan de la tubería e inundan los terrenos aledaños (ver registro electrónico).
III.SOBRE EL DERECHO A GOZAR DE UN AMBIENTE SANO Y ECOLÓGICAMENTE EQUILIBRADO, EL ALCANTARILLADO PLUVIAL Y LAS COMPETENCIAS DE LAS ADMINISTRACIONES PÚBLICAS AL RESPECTO.- Este Tribunal en jurisprudencia reiterada ha reconocido que el derecho a gozar de un ambiente sano y ecológicamente equilibrado es un derecho fundamental que deriva del artículo 50 Constitucional, según el cual, no sólo consagra el derecho de todo ciudadano a gozar de un medio ambiente sano y ecológicamente equilibrado, sino que además obliga al Estado a garantizar el ejercicio de dicho derecho, mediante los medios establecidos al efecto por la legislación vigente. Concretamente, tal como lo ha dicho esta Sala en la sentencia número 2005-009900 de las diez horas del veintinueve de julio del dos mil cinco debe la Municipalidad construir la infraestructura necesaria para hacer discurrir adecuadamente las aguas, para así garantizar el derecho a la salud y a un ambiente libre de contaminación y sin perjudicar a terceros:
“V.- Sobre las obligaciones municipales en materia de alcantarillado pluvial.- Es conveniente tomar en cuenta que el artículo 169 de la Constitución Política establece que la administración de los intereses y servicios locales en cada cantón, estará a cargo del Gobierno Municipal. Los intereses y servicios locales han sido definidos por la Sala como conceptos jurídicos indeterminados donde la ley no resuelve con exactitud su contenido para su aplicación a casos concretos, por lo que resulta necesario acudir a criterios de valor y de experiencia, por parte de quien le corresponde aplicarlo, para determinar su contenido. La creación de medios de drenaje adecuados dentro de una comunidad a efectos de no causar daños a la propiedad, a la salud ni problemas de ambientales a sus vecinos es, dentro de los términos indicados por la Constitución Política, de interés del cantón y es parte de los servicios que la Municipalidad está en la obligación de brindar.
En este mismo sentido la Ley General de Salud en su artículo 285 establece que las aguas pluviales deberán ser eliminadas adecuada y sanitariamente a fin de evitar la contaminación del suelo y de las fuentes naturales de agua para el uso y consumo humano, la formación de criaderos de vectores y enfermedades y la contaminación del aire mediante condiciones que atenten contra su pureza y calidad. Por tal motivo, la Municipalidad de Goicoechea, está obligada a asumir un determinado comportamiento para la satisfacción de sus fines, tomando las medidas requeridas para proveer a la comunidad amparada, de un sistema eficiente de drenaje de las aguas pluviales. Ajustado a criterios de razonabilidad debe la Municipalidad construir la infraestructura necesaria para hacer discurrir adecuadamente esas aguas, para así garantizar el derecho a la salud y a un ambiente libre de contaminación y sin perjudicar a terceros.” Como se desprende de lo expuesto anteriormente, la competencia en materia de alcantarillado pluvial, se encuentra establecida, expresa e implícitamente, por la legislación común.
Si bien, el actual Código Municipal no establece ninguna disposición específica en cuanto este tema, la Sala ha declarado, en sentencia número 2002- 08696 de las diez horas catorce minutos del seis de septiembre del dos mil dos, que esto no excluye la obligación de los entes de desarrollar, entre otras obras de carácter comunal, lo relativo a adecuados sistemas de acueductos y alcantarillados. En efecto, el artículo 4 inciso c) del Código Municipal vigente establece en términos generales, como una atribución municipal, el administrar y prestar los servicios públicos municipales, dentro de los cuales, sin duda alguna, se encuentra el sistema de alcantarillado.
El Código Municipal establece la obligación de las Municipalidades de velar porque al administrado se le garantice el disfrute real y efectivo del derecho a la salud y a un ambiente sano y en particular modo el numeral 75 dispone que de conformidad con el Plan Regulador Municipal, las personas físicas o jurídicas, propietarias o poseedoras, por cualquier título, de bienes inmuebles, deberán, entre otras actividades, cercar y limpiar tanto los lotes donde no haya construcciones como aquellos con viviendas deshabitadas o en estado de demolición, remover objetos, materiales o similares de las aceras o los predios de su propiedad que contaminen el ambiente u obstaculicen el paso y garantizar adecuadamente la seguridad, la limpieza y el mantenimiento de propiedades, cuando se afecten las vías o propiedades públicas o a terceros relacionados con ellas. El incumplimiento de lo anterior faculta a la Municipalidad respectiva al cobro de multas, previo cumplimiento del debido proceso.
El mencionado artículo expresa la obligación de la municipalidad, ante la omisión de las obligaciones mencionadas, y conociendo de la situación de peligro, de suplir la omisión a costa del administrado, a fin de que no se cause un perjuicio mayor. En el presente caso se acredita que la actuación de la autoridad recurrida ha mostrado incapacidad para hacer cumplir las leyes en la materia y su obligación de garantizar el disfrute de los habitantes de la zona a un ambiente sano y ecológicamente equilibrado con fundamento en las razones que a continuación se exponen. Los vecinos del barrio ubicado detrás de las Bodegas de ABOPAC deben enfrentarse en época lluviosa a serias inundaciones en sus terrenos, toda vez que al encontrarse las aguas en las tapias de las instalaciones del Instituto Costarricense de Electricidad las mismas se rebalsan de la tubería e inundan los terrenos aledaños. Debe tenerse en cuenta que el principio de legalidad ha dejado atrás su formalidad, lo que representaba un obstáculo considerable para la actividad de los órganos estatales y la efectiva realización de los derechos fundamentales que establece la Constitución Política, propiamente, el derecho a la prestación de servicios públicos por parte del Estado.
Los Gobiernos Locales deben de cambiar su papel pasivo de espectador ante uno de protagonista vital y definitivo en los propósitos de bienestar trazados en el texto Constitucional, al señalárseles que son los administradores de los intereses y servicios locales. Ante ello deben volcar toda su atención a las necesidades de su comunidad. Bajo este panorama, se debe dar razón a los recurrentes y deberá el gobierno local tomar las medidas pertinentes a fin de solucionar el problema de alcantarillado denunciado.
Por tanto:
Se declara con lugar el recurso. Se ordena a Rafael Rodríguez Castro en calidad de Alcalde Municipal de Puntarenas o a quien ocupe el cargo adoptar en forma inmediata las medidas pertinentes para que se solucione definitivamente el problema de inundaciones generado por el rebalse de la tubería en las tapias de las instalaciones del Instituto Costarricense de Electricidad en Puntarenas, trabajo que deberá estar concluidos a más tardar en seis meses. Lo anterior bajo el apercibimiento de que con base en lo establecido en el artículo 71 de la Ley de la Jurisdicción Constitucional, se impondrá prisión de tres meses a dos años, o de veinte a sesenta días multa, a quien recibiere una orden que deba cumplir o hacer cumplir, dictada en un recurso de amparo y no la cumpliere o no la hiciere cumplir, siempre que el delito no esté más gravemente penado. Se ordena a la Contraloría General de la República, no aprobar presupuestos o modificaciones a éstos durante el próximo ejercicio presupuestario provenientes de la Municipalidad de Puntarenas.
Se condena a la Municipalidad de Puntarenas al pago de las costas, daños y perjuicios causados con los hechos que sirven de base para esta declaratoria, los que se liquidarán en ejecución de sentencia de lo contencioso administrativo. Notifíquese la presente resolución a Rafael Rodríguez Castro en calidad de Alcalde Municipal de Puntarenas o a quien ocupe el cargo EN FORMA PERSONAL.
