Writ of amparo (recurso de amparo) proceeding under expediente número11-009725-0007-CO, filed by ANA LÍA HERNÁNDEZ UREÑA, identity card 0104850565, against the MUNICIPALIDAD DE MORA.
Findings:
Justice Cruz Castro is the author of the opinion; and,
Whereas:
I.Subject matter of the petition. The petitioner alleges a violation of the right to a healthy and ecologically balanced environment because the respondent Municipality granted Mr. Juan Alberto Monge Durán permits to place fill on his property, even though that work is undermining her residence, located behind the fill, and some trees have also fallen on top of her home.
II.Proven facts. The following facts relevant to the decision in this matter are deemed duly established, either because they have been substantiated or because the respondent failed to address them as ordered in the initial ruling:
In Vote No. 2003-11222 of 17:48 hrs. on 30 de septiembre de 2003, this Constitutional Court held:
“(…) III.- CONSTITUTIONAL PRINCIPLES OF EFFECTIVENESS, EFFICIENCY, SIMPLICITY, AND PROMPTNESS IN ADMINISTRATIVE ORGANIZATION AND FUNCTIONS. The organic part of the Constitución Política incorporates or sets forth certain guiding principles governing administrative functions and organization, which, as such, must guide, direct, and constrain all public administrations in their daily activities. Foremost among these principles are effectiveness, efficiency, simplicity, and promptness (articles—all of the Constitución Política—140, subsection 8, insofar as it imposes upon the Poder Ejecutivo the duty to ‘Ensure the proper operation of administrative services and agencies’; 139, subsection 4, insofar as it incorporates the concept of the ‘proper functioning of the Government’; and 191, which enshrines the principle of ‘administrative efficiency’). These constitutional principles have been developed through subconstitutional legislation.
Thus, the Ley General de la Administración Pública incorporates them in articles 4°, 225, paragraph 1°, and 269, paragraph 1°, and mandates that they guide and inform all administrative organization and functions. Effectiveness as a principle requires administrative organization and functions to be designed and conceived so as to ensure achievement of the objectives, purposes, and goals proposed and assigned by the legal system itself; it must therefore be linked to planning and evaluation or accountability (article 11, paragraph 2°, of the Constitución Política). Efficiency entails obtaining the best results with the greatest cost savings or through the rational use of human, material, technological, and financial resources. Simplicity requires administrative structures and their powers to be readily comprehensible and understandable, without convoluted procedures that delay fulfillment of the public interests at stake.
Promptness, in turn, requires public administrations to fulfill their objectives and purposes of serving the public interest through the various mechanisms in the most expeditious, rapid, and appropriate manner possible, in order to avoid undue delay. Taken together, these principles impose permanent requirements, responsibilities, and duties upon all public entities, which they may not set aside temporarily or in individual cases.
All public services provided by public administrations—including welfare or social services—are governed by a series of principles that must be observed and respected at all times and without exception by the public officials responsible for their management and provision. Such principles constitute a non-waivable legal obligation imposed upon every administrative entity or body by virtue of their direct and immediate normative effect, since the body or standard of legality (Article 11 of the Political Constitution) with which their actions must comply includes, among other elements, the general principles of administrative law (Article 6 of the General Law of Public Administration). It must not be overlooked that the General Principles of Law have the same rank as the provision they interpret, supplement, or delimit, and may therefore acquire constitutional rank if the provision with respect to which they perform such functions also has that status.
As we shall see in the following recital (considerando), our fundamental text recognizes the proper functioning of public services as a fundamental right of persons; consequently, the principles governing public services, insofar as they give effect to that right, have constitutional rank. Article 4 of the General Law of Public Administration clearly provides that: “The activity of public entities as a whole shall be subject to the fundamental principles of public service, in order to ensure its continuity, efficiency, adaptation to every change in the legal regime or in the social need it meets, and equal treatment of its recipients or beneficiaries.” Continuity means that the provision of services must not be interrupted. Various legal mechanisms within the administrative legal system seek to safeguard this principle, such as the prohibition of strikes and work stoppages in essential public services; the doctrine of unforeseen circumstances (teoría de la imprevisión), intended to address economic disruptions that may suspend or paralyze public services; the immunity from attachment of public-domain property allocated to the provision of a public service; etc. Any act—whether by action or omission—by officials, or any failure on their part to anticipate needs in the rational organization of resources, that tends to interrupt a public service is manifestly unlawful.
Regularity means that a public service must be provided or performed in accordance with certain pre-established rules, standards, or conditions. Continuity must not be confused with regularity: the former means that the service must operate without interruption, while the latter means that it must adhere to the rules comprising the legal system. Adaptation to every change in the legal regime or to needs imposed by the socioeconomic context means that administrative entities and bodies must have the capacity for foresight and, above all, for programming or planning in order to address new requirements and challenges, whether arising from an increase in the volume of demand for the public service or from technological changes. No public entity, body, or official may invoke a lack of budgetary or financial resources, an absence of equipment, a failure to technologically update such equipment, or excessive or saturated demand for the public service as grounds for failing to provide it continuously and regularly.
Equality or universality of access requires that all inhabitants have the right to demand, receive, and use the public service under equal conditions and in accordance with the rules governing it; consequently, all persons in the same situation may demand identical benefits. One of the governing principles of public service that is not set forth in Article 4 of the General Law of Public Administration is its mandatory nature, since it would serve no purpose to state that services must be continuous, regular, uniform, and general if the service provider were under no obligation to provide them. The public administration providing the public service may not select its clientele or users; it must provide the service to anyone who requests it.”
V.The particular case. In the present matter, the report submitted under oath by the respondent Mayor shows that, during the present year, three of the four projects being carried out by the neighbor—adjacent to the appellant’s home—do not have the corresponding permits, which entails a potential impact on the environment as well as a risk to the health and property of the other neighbors. The reporting official explains that Mr. Monge Durán has been subject to several closure orders (clausuras) this year for earthworks (movimientos de tierra) performed after completion of the previously authorized work, and that in every instance he has been advised that, in order to process authorization for the earthworks subject to closure, he must submit SETENA environmental feasibility approval (viabilidad ambiental), a document that has not been submitted to the Department of Urban Development and Control of that Municipality.
From the factual circumstances described, the Chamber observes that although the respondent Municipality has verified the reported problem and ordered the person responsible for the earthworks to comply with the necessary requirements before carrying out the work, the Municipality’s argument that it is not responsible for the situation is nevertheless inadmissible because, as stated in the preceding recital, municipalities are responsible for planning and overseeing urban development within their localities. This includes the duty to ensure that projects being carried out meet the applicable environmental requirements. In the present case, on three occasions during the same year, the respondent municipal authority merely issued different warnings to Mr. Monge Durán concerning new earthworks undertaken without the necessary permits, but did nothing to prevent him from continuing to act unlawfully and thereby safeguard its inhabitants’ rights to health and to a healthy environment.
For this reason, the present constitutional relief proceeding (amparo) against the Municipality must be granted, and the Municipal Mayor must be ordered, in coordination with other institutions and within the scope of his powers, to take immediate measures necessary to provide a definitive solution to the problem reported by the appellant.
Por tanto:
The appeal is granted. GILBERTO MONGE PIZARRO, in his capacity as MUNICIPAL MAYOR OF THE CANTON OF MORA, or whoever may hold that office in his stead, is ordered to proceed in a coordinated and immediate manner to adopt the appropriate measures within the scope of his authority to provide a definitive solution to the problem reported by the appellant. He is further advised that failure to comply with said order will constitute the offense of disobedience and that, pursuant to Article 71 of the Law governing this jurisdiction, any person who receives an order issued in an amparo proceeding that he or she is required to comply with or enforce, and who fails to comply with or enforce it, shall be sentenced to imprisonment for three months to two years or fined twenty to sixty day-fines, provided that the offense is not subject to a more severe penalty. Municipalidad de Mora is ordered to pay the legal costs, damages, and losses caused by the acts serving as the basis for this ruling, the amount of which shall be determined during enforcement of the judgment before the administrative litigation court. This decision shall be served personally upon GILBERTO MONGE PIZARRO, in his capacity as MUNICIPAL MAYOR OF THE CANTON OF MORA, or upon whoever may hold that office in his stead.- Ana Virginia Calzada M.

Recurso de amparo que se tramita en expediente número11-009725-0007-CO, interpuesto por ANA LÍA HERNÁNDEZ UREÑA, cédula de identidad 0104850565 , contra la MUNICIPALIDAD DE MORA.
Resultando:
Redacta el Magistrado Cruz Castro; y,
Considerando:
I.Objeto del recurso. La recurrente acusa violación del derecho a un ambiente sano y ecológicamente equilibrado pues la Municipalidad recurrida otorgó permisos al señor Juan Alberto Monge Durán - para que realizara un relleno en su propiedad -, pese a que esa obra está falseando su casa de habitación, ubicada en la parte trasera del relleno, y además algunos árboles han caído encima de su vivienda.
II.Hechos probados. De importancia para la decisión de este asunto, se estiman como debidamente demostrados los siguientes hechos, sea porque así han sido acreditados o bien porque el recurrido haya omitido referirse a ellos según lo prevenido en el auto inicial:
En el Voto No. 2003-11222 de las 17:48 hrs. del 30 de septiembre de 2003, este Tribunal Constitucional, la Sala dispuso:
“(…) III.- PRINCIPIOS CONSTITUCIONALES DE EFICACIA, EFICIENCIA, SIMPLICIDAD Y CELERIDAD DE LA ORGANIZACIÓN Y FUNCIÓN ADMINISTRATIVAS. La Constitución Política, en su parte orgánica, recoge o enuncia algunos principios rectores de la función y organización administrativas, que como tales deben orientar, dirigir y condicionar a todas las administraciones públicas en su cotidiano quehacer. Dentro de tales principios destacan la eficacia, eficiencia, simplicidad y celeridad (artículos –todos de la Constitución Política- 140, inciso 8, en cuanto le impone al Poder Ejecutivo el deber de “Vigilar el buen funcionamiento de los servicios y dependencias administrativas”, el 139, inciso 4, en la medida que incorpora el concepto de “buena marcha del Gobierno” y el 191 al recoger el principio de “eficiencia de la administración”). Estos principios de orden constitucional, han sido desarrollados por la normativa infraconstitucional, así, la Ley General de la Administración Pública los recoge en los artículos 4°, 225, párrafo 1°, y 269, párrafo 1°, y manda que deben orientar y nutrir toda organización y función administrativa.
La eficacia como principio supone que la organización y función administrativa deben estar diseñadas y concebidas para garantizar la obtención de los objetivos, fines y metas propuestos y asignados por el propio ordenamiento jurídico, con lo que debe ser ligado a la planificación y a la evaluación o rendición de cuentas (artículo 11, párrafo 2°, de la Constitución Política). La eficiencia, implica obtener los mejores resultados con el mayor ahorro de costos o el uso racional de los recursos humanos, materiales, tecnológicos y financieros. La simplicidad demanda que las estructuras administrativas y sus competencias sean de fácil comprensión y entendimiento, sin procedimientos alambicados que retarden la satisfacción de los intereses públicos empeñados. Por su parte, la celeridad obliga a las administraciones públicas cumplir con sus objetivos y fines de satisfacción de los intereses públicos, a través de los diversos mecanismos, de la forma más conjunto de principios le impone exigencias, responsabilidades y deberes permanentes a todos los entes públicos que no pueden declinar de forma transitoria o singular.
Todos los servicios públicos prestados por las administraciones públicas –incluidos los asistenciales o sociales- están regidos por una serie de principios que deben ser observados y respetados, en todo momento y sin excepción alguna, por los funcionarios públicos encargados de su gestión y prestación. Tales principios constituyen una obligación jurídica de carácter indeclinable impuesta a cualquier ente u órgano administrativo por su eficacia normativa directa e inmediata, toda vez que el bloque o parámetro de legalidad (artículo 11 de la Constitución Política) al que deben ajustarse en sus actuaciones está integrado, entre otros elementos, por los principios generales del derecho administrativo (artículo 6° de la Ley General de la Administración Pública). No debe perderse de perspectiva que los Principios Generales del Derecho, tienen el rango de la norma que interpretan, integran o delimitan, con lo que pueden asumir un rango constitucional si el precepto respecto del cual cumplen tales funciones tiene también esa jerarquía.
Como veremos en el considerando subsiguiente nuestro texto fundamental recoge como derecho fundamental de las personas el del buen funcionamiento de los servicios públicos, consecuentemente los principios que informan los servicios públicos en cuanto hacen efectivo tal derecho tienen un rango constitucional. El ordinal 4° de la Ley General de la Administración Pública dispone claramente que “La actividad de los entes públicos deberá estar sujeta en su conjunto a los principios fundamentales del servicio público, para asegurar su continuidad, su eficiencia, su adaptación a todo cambio en el régimen legal o en la necesidad social que satisfacen y la igualdad en el trato de los destinatarios o beneficiarios”. La continuidad supone que la prestación de los servicios no se debe interrumpir, diversos mecanismos jurídicos del ordenamiento administrativo pretenden asegurar este principio, tales como la prohibición de la huelga y de paro en los servicios públicos esenciales, la teoría de la imprevisión para hacerle frente a los trastornos económicos que pueden suspender o paralizar los servicios públicos, el carácter inembargable de los bienes dominicales destinados a la prestación de un servicio público, etc..
Cualquier actuación –por acción u omisión- de los funcionarios o imprevisión de éstos en la organización racional de los recursos que propenda a interrumpir un servicio público es abiertamente antijurídica. La regularidad implica que el servicio público debe prestarse o realizarse con sujeción a ciertas reglas, normas o condiciones preestablecidas. No debe confundirse la continuidad con la regularidad, el primer concepto supone que debe funcionar sin interrupciones y el segundo con apego a las normas que integran el ordenamiento jurídico. La adaptación a todo cambio en el régimen legal o a las necesidades impuestas por el contexto socioeconómico significa que los entes y órganos administrativos deben tener capacidad de previsión y, sobre todo, de programación o planificación para hacerle frente a las nuevas exigencias y retos impuestos, ya sea por el aumento en el volumen de la demanda del servicio público o bien por los cambios tecnológicos.
Ningún ente, órgano o funcionario público pueden aducir razones de carencia presupuestaria o financiera, ausencia de equipos, falta de renovación tecnológica de éstos, exceso o saturación de la demanda en el servicio público para dejar de prestarlo de forma continua y regular. La igualdad o universalidad en el acceso demanda que todos los habitantes tienen derecho a exigir, recibir y usar el servicio público en igualdad de condiciones y de conformidad con las normas que los rigen, consecuentemente, todos los que se encuentran en una misma situación pueden exigir idénticas ventajas. Uno de los principios rectores del servicio público que no se encuentra enunciado en el artículo 4° de la Ley General de la Administración Pública lo constituye el de su obligatoriedad, puesto que, de nada serviría afirmar que deben ser continuos, regulares, uniformes y generales si el sujeto prestador no tiene la obligación de prestarlo. La administración pública prestadora del servicio público no puede escoger su clientela o usuarios, debe brindárselo a cualquiera que se lo requiera”.
V.Del caso particular. En el presente asunto, del informe rendido por el Alcalde recurrido, que es dado bajo juramento, se desprende que en el presente año tres de las cuatro obras que realiza el vecino -contiguo a la vivienda de la recurrente – no cuentan con los correspondientes permisos, lo que supone una posible afectación al ambiente así como un riesgo a la salud y propiedad de los demás vecinos. Explica el informante que el señor Monge Durán posee diversas clausuras este año por movimientos de tierra efectuados -una vez finalizado el ya autorizado- y en todos los casos ha sido advertido de que para efectuar el trámite de los movimientos de tierra clausurados, debe presentar la viabilidad Ambiental de Setena, documento que no ha sido presentado ante el Departamento de Desarrollo y Control Urbano de esa Municipalidad. Del cuadro fáctico descrito observa la Sala que si bien la Municipalidad recurrida ha constatado el problema denunciado y ordenado al responsable de los movimientos de tierra cumplir los requisitos necesarios previo a ejecutar las obras, lo cierto es que no resulta admisible el argumento de la Municipalidad en el sentido que no es responsable por tal situación, ya que, como ya se indicó en el considerando anterior, corresponde a las municipalidad planificar y vigilar el desarrollo urbano de su localidad.
Lo que incluye el deber de vigilar que las obras que se realicen cuenten con los debidos requisitos ambientales. En el presente caso, en tres ocasiones en el mismo año la autoridad municipal recurrida se ha limitado a hacerle distintas advertencias al señor Monge Durán por nuevos movimientos de tierra sin contar con los permisos necesarios, mas no ha hecho nada por impedir que continúe actuando de manera ilegítima, a fin garantizar a sus habitantes el derecho a la salud y a un ambiente sano. Motivo, por el cual, debe ser estimado el presente amparo en contra de la Municipalidad y procede ordenar al Alcalde Municipal que, de manera coordinada con otras instituciones y dentro del ámbito de sus competencias, procedan de manera inmediata a adoptar las medidas que sean necesarias, para brindarle una solución definitiva al problema denunciado por la recurrente.
Por tanto:
Se declara con lugar el recurso. Se ordena a GILBERTO MONGE PIZARRO, en su calidad de ALCALDE MUNICIPAL DEL CANTON DE MORA, o a quien en su lugar ejerza ese cargo, proceder de manera coordinada e inmediata a adoptar las medidas que correspondan dentro del ámbito de su competencia, para dar una solución definitiva al problema denunciado por la recurrente. Asimismo, se le advierte que de no acatar la orden dicha, incurrirá en el delito de desobediencia y que, de conformidad con el artículo 71 de la Ley de esta jurisdicción, se le impondrá prisión de tres meses a dos años, o de veinte a sesenta días multa, a quien recibiere una orden que deba cumplir o hacer cumplir, dictada en un recurso de amparo y no la cumpliere o no la hiciere cumplir, siempre que el delito no esté más gravemente penado. Se condena a la Municipalidad de Mora, al pago de las costas, daños y perjuicios causados con los hechos que sirven de base a esta declaratoria, los que se liquidarán en ejecución de sentencia de lo contencioso administrativo. Notifíquese esta resolución a GILBERTO MONGE PIZARRO, en su calidad de ALCALDE MUNICIPAL DEL CANTON DE MORA, o a quien en su lugar ejerza ese cargo, en forma personal.- Ana Virginia Calzada M.
