Constitutional relief proceeding (recurso de amparo) filed by [Nombre 001], [Valor 001], [Nombre 002], [Valor 002], [Nombre 003], [Valor 003], [Nombre 004], [Valor 004], [Nombre 005], [Valor 005], [Nombre 006], [Valor 006], [Nombre 007], [Valor 007], against the MUNICIPALIDAD DE GOLFITO, THE MINISTERIO DE SALUD, AND THE MINISTERIO DE AMBIENTE, ENERGÍA Y TELECOMUNICACIONES.
Findings of Fact:
Justice Rueda Leal drafted the opinion; and,
Whereas:
I.Subject Matter of the Proceeding. The petitioner alleges that the Municipalidad de Golfito constructed an artificial channel for the purpose of channeling natural waters without obtaining the corresponding permits, which she believes infringes their right to an ecologically balanced environment and to safety.
III.Regarding the specific case. In this matter, it follows from the report submitted under oath by the Director of the Governing Health Area of the Ministry of Publicly Education that, in the community of La Mona, located in the Canton of Golfito, the Municipality constructed, on a public roadway, an artificial channel approximately 120 meters long, 1.2 meters wide, and 1.1 meters deep, parallel to the protective fence of the local school, with the intention of channeling natural waters that flow from the mountain and cross several private properties, for the purpose of draining that property. The appellant disagrees with the construction of the channel, alleging the following: a) that the Municipality intends to construct a medium-sized facility without any urban development plan, without authorization from MINAET, and without environmental impact studies, which she believes places ecosystems at risk; b) that the lives of the community’s residents are endangered because the channel is a hole without any type of culvert, and is therefore uncovered, and no signs or caution tape have been placed; and c) that there is a risk to her health because the water that stagnates there causes foul odors and creates a risk that residents will contract dengue fever or malaria.
IV.Regarding the allegation that a medium-sized facility is intended to be constructed without any urban development plan, without authorization from MINAET, and without environmental impact studies, which she believes places ecosystems at risk. Although the reports submitted under oath by the authorities of the Ministry of Health and the Ministry of Environment, Energy and Telecommunications establish that the Municipality has not requested permits, the fact remains that the President of the Golfito Municipal Council states under oath that the Mayor’s Office informed him that no fill project is intended, since the only work performed was the drainage of the school property. Thus, the appellant’s assertion that a gymnasium is intended to be constructed without the corresponding permits is nothing more than mere supposition, since the reports prepared in connection with the inspections conducted by the respondent authorities do not indicate that any construction work has begun; only the channel was constructed.
V.Regarding the allegation that there is a risk to her health because the water that stagnates there causes foul odors and creates a risk that residents will contract dengue fever or malaria. In the report submitted under oath by the Director of the Governing Health Area of the Ministry of Health in Golfito, he states that the alleged foul odors were not detected and that “there is not, in this matter and at this time, an imminent or immediate public-health problem that the Ministry of Health must address within the scope of its authority.” Accordingly, this Chamber finds that the channel constructed by the Municipality of Golfito does not currently endanger the environment or the health of the residents.
VI.With respect to the argument that the lives of the community’s residents are endangered because the channel is a hole without any type of culvert, and is therefore uncovered, and no signs or caution tape have been placed, this Court concludes that the petitioner is correct. This is because, in the report submitted under oath, the Director of the Governing Health Area of the Ministry of Health in Golfito states that there is indeed a risk to the safety and physical integrity of persons, particularly schoolchildren who pass through the area every day, because the channel remains open and entirely unprotected, given that it is 1.1 meters deep. This Chamber has held that Municipalities are obligated to supervise and ensure compliance with the law on lands within their jurisdiction. This clearly includes ensuring safe passage for all pedestrians. This is so because the Municipalities’ obligation to ensure that roads and public thoroughfares comply with urban-planning standards forms part of the protection of local interests and services—in the terms of Article 169 of the Constitution—and they therefore may and must pursue all actions and procedures established by the legal system for that purpose.
This entails the right of citizens not only to travel freely through such areas, but also to do so under safe conditions (see, to that effect, judgment number 2010-19769, issued at 9:30 a.m. on November 26, 2010). In view of the foregoing, the appropriate disposition is to grant the appeal solely with respect to this issue.
VII.Lastly, the appellant alleges that the streets are gravel and that there are no sidewalks; however, she does not specifically identify any violation resulting from the gravel streets or the lack of sidewalks, a situation that, by itself, does not infringe any fundamental right.
VIII.Conclusion. In light of the foregoing, the appropriate disposition is to partially grant the appeal, solely against the Municipality of Golfito, because the existence of the channel places the safety of citizens at risk.

The appeal is partially granted, solely against the Municipality of Golfito. Rodolfo Delgado Jiménez, President of the Golfito Municipal Council, or whoever serves in his stead, is ordered to take the measures within the scope of his authority so that, within ONE MONTH following notice of this judgment, the lack of protection around the channel located alongside La Mona School in Golfito is remedied. The foregoing is ordered with the warning that, pursuant to Article 71 of the Law governing this jurisdiction, anyone who receives an order issued in an amparo proceeding that he or she is required to comply with or enforce, and fails to comply with or enforce it, shall be punished by imprisonment for three months to two years, or by a fine of twenty to sixty days, provided that the offense is not subject to a more severe penalty. The Municipality of Golfito is ordered to pay the costs, damages, and losses caused by the facts underlying this ruling, which shall be assessed during enforcement of the judgment in the administrative-law proceedings.
As to the Osa Conservation Area of the Ministry of Environment, Energy and Telecommunications and the Directorate of the Governing Health Area of the Ministry of Health in Golfito, the appeal is denied. This judgment shall be served personally upon Rodolfo Delgado Jiménez, President of the Golfito Municipal Council, or whoever serves in his stead. Let notice be given.

Recurso de amparo interpuesto por [Nombre 001], [Valor 001] , [Nombre 002], [Valor 002], [Nombre 003], [Valor 003], [Nombre 004], [Valor 004], [Nombre 005], [Valor 005], [Nombre 006], [Valor 006], [Nombre 007], [Valor 007] , contra la MUNICIPALIDAD DE GOLFITO, EL MINISTERIO DE SALUD Y EL MINISTERIO DE AMBIENTE, ENERGÍA Y TELECOMUNICACIONES.
Resultando:
Redacta el Magistrado Rueda Leal; y,
Considerando:
I.Objeto del recurso. La recurrente acusa que la Municipalidad de Golfito construyó un canal artificial con la intención de encausar aguas naturales, sin contar con los permisos correspondientes, lo que estima lesiona su derecho a un ambiente ecológicamente equilibrado y a la seguridad.
II.Hechos Probados. De importancia para la decisión de este asunto, se estiman como debidamente demostrados los siguientes hechos:
III.Sobre el caso concreto. En este asunto, se desprende del informe rendido bajo juramento por el Director del Área Rectora de Salud del Ministerio de Educación Pública, que en la comunidad La Mona, ubicada en el Cantón de Golfito, la Municipalidad construyó en vía pública un canal artificial de aproximadamente 120 metros de largo por 1.2 metros de ancho y 1.1 metros de hondo, paralelo a la malla protectora de la escuela del lugar, con la intención de encausar aguas naturales que provienen de la montaña y atraviesan varias propiedades privadas, ello con la intención de drenar esa propiedad. La recurrente se encuentra disconforme con la construcción del canal, pues alega lo siguiente: a) que la Municipalidad pretende construir una infraestructura de medianas dimensiones, sin mediar ningún tipo de plan urbanístico, sin permiso del MINAET y sin estudios de impacto ambiental lo que estima pone en riesgo los ecosistemas; b) que peligra la vida de los habitantes de la comunidad porque el canal es un hueco sin ningún tipo de alcantarilla, por lo que está descubierto y no han colocado rótulos ni cinta de precaución y c) que hay un riesgo para su salud, ya que el agua que ahí se estanca provoca malos olores y riesgo de enfermar a los habitantes de dengue o de malaria.
IV.Sobre el alegato de que se pretende construir una infraestructura de medianas dimensiones, sin mediar ningún tipo de plan urbanístico, sin permiso del MINAET y sin estudios de impacto ambiental lo que estima pone en riesgo los ecosistemas. Si bien, en los informes rendidos bajo juramento por las autoridades del Ministerio de Salud y del Ministerio Ministro de Ambiente, Energía y Telecomunicaciones, se constata que la Municipalidad no ha solicitado permisos, lo cierto es que bajo juramento el Presidente del Concejo de Golfito indica que la Alcaldía le informó que no se pretende realizar un relleno, ya que la única obra que se ha hecho es el desagüe del terreno de la escuela. De esta manera, el dicho de la recurrente en cuanto a que se pretende construir un gimnasio sin contar con los permisos respectivos, no es otra cosa que una mera suposición, pues de los informes elaborados con ocasión a las inspecciones realizadas por las autoridades recurridas, no se colige que se haya iniciado ninguna labor de construcción, solamente se construyó el canal.
V.En cuanto al alegato de que hay un riesgo para su salud, ya que el agua que ahí se estanca provoca malos olores y riesgo de enfermar a los habitantes de dengue o de malaria. En el informe rendido bajo juramento por el Director del Área Rectora de Salud del Ministerio de Salud en Golfito, este indica que no se detectan los malos olores acusados y que “no hay en el asunto y en este momento un problema sanitario inminente o inmediato que deba abordar el Ministerio de Salud desde sus competencias”. De esta forma, esta Sala comprueba que el canal realizado por la Municipalidad de Golfito, actualmente no pone en peligro el ambiente o la salud de los habitantes.
VI.Con relación al argumento que peligra la vida de los habitantes de la comunidad porque el canal es un hueco sin ningún tipo de alcantarilla, por lo que está descubierto y no han colocado rótulos ni cinta de precaución, este Tribunal concluye que si lleva razón la accionante. Lo anterior toda vez que en el informe rendido bajo juramento, el Director del Área Rectora de Salud del Ministerio de Salud en Golfito, indica que sí hay un riesgo para la seguridad y la integridad de las personas, principalmente los niños de escuela que transitan a diario por el lugar, a causa del canal que se mantiene abierto y sin protección alguna, dado que su profundidad es de 1.1 metros. Esta Sala ha indicado que es obligación de las Municipalidades fiscalizar y velar por el cumplimiento de la ley en los terrenos que forman parte de su jurisdicción. Lo que incluye, evidentemente, garantizar a todos los peatones un tránsito seguro.
Ello se considera así, por cuanto forma parte de la tutela de los intereses y servicios locales -en los términos del artículo 169 constitucional- la obligación de las Municipalidades de velar por la adecuación de los caminos y las vías públicas a las normas de urbanismo, por lo que puede y debe promover todas las acciones y procedimientos que el ordenamiento establece con ese propósito, ello implica el derecho de los ciudadanos no solo de circular libremente por las zonas, sino también poder hacerlo bajo condiciones de seguridad (véase en ese sentido la sentencia número 2010-19769 de las 9:30 horas del 26 de noviembre de 2010). En virtud de lo anterior, lo procedente es declarar con lugar el recurso, únicamente en cuanto a este punto se refiere.
VII.Por último, la recurrente alega que las calles son de lastre y que no hay aceras; sin embargo, no indica concretamente la interesada la vulneración que se produce con ocasión a que las calles sean de lastre y a la falta de aceras, situación que por sí sola no lesiona ningún derecho fundamental.
VIII.Corolario. En mérito de lo expuesto, lo procedente es declarar parcialmente con lugar el recurso, únicamente contra la Municipalidad de Golfito porque la existencia del canal pone en riesgo la seguridad de los ciudadanos.
Por tanto:
Se declara parcialmente con lugar el recurso, únicamente contra la Municipalidad de Golfito. Se ordena a Rodolfo Delgado Jiménez, Presidente del Concejo de Golfito, o a quien en su lugar ejerza el cargo que tome las medidas que están dentro del ámbito de sus competencias para que en el plazo de UN MES a partir de la comunicación de esta sentencia se resuelva el problema de falta de protección del canal ubicado en un costado de la Escuela La Mona en Golfito. Lo anterior, bajo apercibimiento que, de conformidad con lo establecido en el artículo 71 de la Ley de esta jurisdicción, se impondrá prisión de tres meses a dos años, o de veinte a sesenta días multa, a quien recibiere una orden que deba cumplir o hacer cumplir, dictada en un recurso de amparo y no la cumpliere o no la hiciere cumplir, siempre que el delito no esté más gravemente penado. Se condena a la Municipalidad de Golfito al pago de las costas, daños y perjuicios causados con los hechos que sirven de base a esta declaratoria, los que se liquidarán en ejecución de sentencia de lo contencioso administrativo.
En cuanto al Área de Conservación de Osa del Ministerio de Ambiente, Energía y Telecomunicaciones y a la Dirección del Área Rectora de Salud del Ministerio de Salud de Golfito, se declara sin lugar el recurso. Notifíquese esta sentencia a Rodolfo Delgado Jiménez, Presidente del Concejo de Golfito, o a quien en su lugar ejerza el cargo, en forma personal. Comuníquese.
