Findings of Fact:
Finally, in accordance with the proceedings conducted by this governing health authority, the municipal authority, in compliance with the health order (Orden Sanitaria) 019-09, was required to clean the storm drains, since they were obstructed by construction materials and other waste belonging to the residents themselves. The stormwater outlet was then restored; the water had been stagnant on the downstream property owned by Ms. XXXXXXXX, which received all the water from Blocks E and F. This eliminated all upstream ponding, which had caused foul odors, the proliferation of insects and rodents, etc. That area is currently free of ponding and properly enclosed with mesh fencing. In addition, the streets were repaired by patching the deteriorated roadways. The report notes that, because the residents’ initial complaint concerned the improper discharge of stormwater, wastewater, and sewage, this governing health authority conducted technical fluorescein tests at the homes in Blocks E and F. The tests revealed that some of those homes had their sewage and wastewater connected to the storm sewer system, thereby exacerbating the issue underlying the amparo proceeding (recurso de amparo); they were therefore ordered to properly eliminate any discharge of sewage or wastewater within their properties.
In the case of the homes in Block F—which is the block that actually has the problem of interconnected tanks—with final discharge into the stormwater drainage system, as is the case of one of the petitioners herein, Ms. Francini Sirias, the proper course of action under Ley General de Salud Article 285 is to order the owners of the homes in Block F to properly discharge and dispose of excreta, sewage, wastewater, and stormwater, in order to prevent contamination of the soil and natural water sources intended for human use and consumption, the formation of breeding grounds for disease vectors, and the pollution of the air through conditions that jeopardize its purity or quality, within a specified period. In the event of noncompliance, this governing authority must perform the duties inherent to its office and, pursuant to the applicable health regulations and Articles 320-321, declare the homes temporarily uninhabitable—until they remedy the problem that they themselves reported—and, additionally, the Municipality shall be ordered to close the inspection chamber located on the public sidewalk, since that system has not been approved by either the Municipality or the Ministerio de Salud. It is therefore concluded that the residents of Block F are violating health regulations through their conduct and that the system they accepted is illegitimate and illegal.

Considerations.
I.Subject matter of the appeal. The appellant alleges that stormwater and wastewater (aguas servidas) are not properly managed in Residencial Jardines de Roma.
III.The right to a healthy and ecologically balanced environment. Article 50 of the Constitution requires State institutions to play an active role in protecting the environment by guaranteeing everyone a healthy and ecologically balanced environment. This duty is by no means foreign to local governments; on the contrary, their actions in this field are of paramount importance. For precisely that reason, in implementing the aforementioned constitutional provision, the legislature has assigned them a leading role in environmental matters, as is readily apparent from a simple reading of the Ley Orgánica del Ambiente.
IV.The specific case. In this matter, the Director of the Área Rectora de Salud de Heredia states under oath what has occurred in Urbanización Roma since late 1988 with respect to stormwater and sewage, including the problems associated with their disposal. She likewise states that, on March 17, 2009, Mr. XXXXXXXX filed a complaint concerning the improper disposal of wastewater and stormwater, which was processed under expediente number 645-09. The report prepared in connection with that complaint determined that the housing development did not have the required stormwater-outfall provisions within the same property. An outfall headwall (cabezal de desfogue) was therefore identified along the southern boundary, near the last storm drain in the most severely affected sector. It was completely collapsed and lacked suitable piping to allow the water to flow under sanitary conditions. Consequently, Sanitary Order number 019-09-S dated May 22, 2009, addressed to the Mayor, was issued, ordering him to maintain and clean the storm drains and stormwater catch basins forming part of Urbanizadora Roma’s stormwater-disposal system and to submit a proposal under which the water would be conveyed through a suitable piping system to a receiving body or the nearest sewer, thereby preventing it from spreading and pooling on private properties.
Through official letter number ARS-SR-REG-245-09-IS, the Ministerio de Salud followed up on the order, stating that a new inspection was conducted on June 26, 2009, during which it confirmed that the respondent Municipalidad had failed to comply with Sanitary Order 019-09-S, and concluded that the stormwater-disposal system remained completely collapsed. Consequently, the Mayor of San Rafael submitted a project intended to provide a permanent solution to the problem. Although some actions have been taken, such as cleaning the storm drains, the fact remains that the problem has not yet been permanently resolved. In this regard, it must be noted that, as this Chamber has repeatedly held, municipalities cannot disregard their duties when approving construction or improvements. They are responsible for conducting inspections to determine whether sewage disposal was carried out as authorized. In this regard, Article 1 of the Ley de Construcciones is controlling and provides as follows:
“Article 1.- The Municipalities of the Republic shall be responsible for ensuring that cities and other population centers meet the necessary standards of safety, sanitation, convenience, and appearance in their public thoroughfares and in the buildings and structures erected on land located therein, without prejudice to the powers granted by law to other administrative bodies in these matters.” On this same issue, Article 87 of that law provides as follows:
“Article 87.- The Municipalidad shall supervise the works performed within its jurisdiction, as well as the uses to which they are put. Municipal inspectors are its agents and are charged with ensuring compliance with the provisions of this Regulation.” Finally, with respect to pollution prevention, Article 60 of the Ley Orgánica del Ambiente provides as follows:
“Article 60.- Prevention and control of pollution To prevent and control environmental pollution, the State, the municipalities, and other public institutions shall give priority, among other matters, to establishing and operating adequate services in areas essential to environmental health, such as:
(…) b) The sanitary disposal of excreta, wastewater, and stormwater.” As already noted, the municipalities are responsible for administering local interests and services in each canton, in accordance with the aforementioned Article 169 of the Political Constitution. From this derives the authority of municipalities to plan and oversee the urban development of their locality, which includes the duty to establish a comprehensive urban-planning policy that ensures urban development consistent with the efficient operation of a system for supplying potable water and collecting, treating, and finally disposing of wastewater (aguas residuales), as well as the obligation to adopt the measures required to provide the canton with an adequate sanitary and storm sewer system (sistema de alcantarillado sanitario y pluvial), in order to guarantee its inhabitants the right to health and to an environment free from pollution (see, to that effect, judgments number 2009-0908, issued at 13:34 hours on January 23, 2009, and 2009-03368, issued at 12:40 hours on February 27, 2009).
Accordingly, this Chamber concludes that, despite its legal obligation, the respondent Municipality has failed to fulfill its duty to inspect the construction of the Urbanización Jardines de Roma; consequently, there are problems not only concerning stormwater (aguas pluviales), but also sewage or wastewater (aguas negras o servidas). With regard to the Ministry of Health, it has been established that it has not firmly required proper compliance with the health orders (órdenes sanitarias) issued, since inspections have confirmed that the stormwater drainage system remains completely overwhelmed, which establishes that this authority also bears responsibility for the problem at Residencial Jardines de Roma. Specifically, this Court has recognized that one of the guiding principles of administrative organization is the coordination that must exist among all public entities and bodies when exercising their powers and providing the services assigned to them by the legal system.
Coordination, insofar as it ensures administrative efficiency and effectiveness, is a virtual or implicit constitutional principle that permeates the entire body of administrative law and binds all public entities. Coordination may be inter-organizational (interorgánica)—among the various bodies comprising a public entity that are not subject to a hierarchical relationship—or intersubjective (intersubjetiva)—that is, among public entities, each with its own legal personality, budget, autonomy, and specific powers. The purpose of administrative coordination is to prevent duplication and omissions in the performance of each public entity’s administrative functions; that is, to ensure that those functions are performed rationally and systematically (see, to that effect, judgment number 2007-015218, issued at 12 hours on October 19, 2007). Accordingly, this Court concludes that stormwater and wastewater problems do exist at Residencial Jardines de Roma, and therefore both the respondent Municipality and the Ministry of Health must coordinate with each other and take the actions necessary to provide an effective solution to that problem. In any event, the owners of properties in the aforementioned Residencial, including the petitioner, must comply with the health orders issued by the Ministry of Health.
VI.Justice Calzada Miranda files a separate statement. It has been determined in this amparo proceeding (amparo) that the conduct of the respondent authorities is contrary to the petitioners’ fundamental rights, since it has not been directed toward compliance with the obligations imposed by the Constitution and the law for the protection of public health and the right to a healthy and ecologically balanced environment. This is because their failure to inspect the construction of Residencial Jardines de Roma has caused an ongoing threat to those rights, to the detriment of the petitioners and the area’s residents. This Chamber has found that the problems arising at the aforementioned residential development concern not only the disposal of stormwater, but also wastewater and sewage. However, in the operative portion (parte dispositiva) of this judgment, the respondents have been granted a period of one year to carry out, in coordination, the corrective actions falling within the scope of their respective powers in order to provide a definitive solution to the problem of “stormwater and wastewater at Residencial Jardines de Roma.” Nevertheless, I consider that the problem to be resolved concerns not only the stormwater and wastewater identified in the Por tanto, but also, specifically, sewage, because the respondents have likewise failed to make provision for its proper disposal. Therefore, the order issued to the respondents must be directed toward resolving the stormwater and wastewater problem, as well as the sewage problem, at Residencial Jardines de Roma.
Por tanto:
The petition is granted. Jorge Isaac Herrera Paniagua and Ana Lorena Sánchez Hernández, Mayor of the Municipalidad de San Rafael and Director of the Área Rectora de Salud de Heredia, respectively, or whoever may hold those offices in their stead, are ordered to carry out, in coordination, the actions falling within the scope of their respective powers in order to provide a definitive solution to the stormwater and wastewater problems at Residencial Jardines de Roma, within the non-extendable period of ONE YEAR from notice of this judgment. The respondent authorities are advised that, pursuant to Article 71 of the Ley de la Jurisdicción Constitucional, any person who receives an order issued in an amparo proceeding that the person is required to comply with or enforce, and who fails to comply with or enforce it, shall be subject to imprisonment for three months to two years or a fine of twenty to sixty days, provided that the offense is not subject to a more severe penalty.
The State and the Municipalidad de San Rafael de Heredia are ordered to pay the legal costs, damages, and losses caused by the facts underlying this ruling, which shall be assessed during enforcement of the judgment before the administrative litigation court (contencioso administrativo). Justice Calzada Miranda files a separate statement. This decision shall be served personally upon Jorge Isaac Herrera Paniagua and Ana Lorena Sánchez Hernández, Mayor of the Municipalidad de San Rafael and Director of the Área Rectora de Salud de Heredia, respectively, or whoever may hold those offices in their stead. Resultando:
Redacta el Magistrado Rueda Leal; y,
Considerando.
I.Objeto del recurso. La recurrente aduce que en el Residencial Jardines de Roma, no hay un manejo correcto de las aguas pluviales y servidas.
II.Hechos Probados. De importancia para la decisión de este asunto, se estiman como debidamente demostrados los siguientes hechos:
III.Sobre el derecho a un ambiente sano y ecológicamente equilibrado. El numeral 50 constitucional obliga a la instituciones del Estado a tener una función activa en la protección del ambiente al garantizar a todos que el mismo debe ser sano y ecológicamente equilibrado, tarea que de manera alguna es ajena a las corporaciones locales, antes bien, su actuación en este campo es de trascendental importancia y precisamente por ello el legislador, en desarrollo del referido canon constitucional, les ha dado papel protagónico en materia ambiental, tal y como es posible advertirlo con la simple lectura de la Ley Orgánica del Ambiente.
IV.Sobre el caso concreto. En el presente asunto, informa bajo juramento la Directora del Área Rectora de Salud de Heredia, lo acaecido en la Urbanización Roma desde finales del año 1988, respecto a las aguas pluviales y aguas negras, incluyendo la problemática presentada en su evacuación. Igualmente, indica que el 17 de marzo de 2009, el señor XXXXXXXX presentó una denuncia por problemas de disposición inadecuada de aguas servidas y pluviales, la que se tramitó bajo el expediente número 645-09. Del informe rendido con ocasión a la presentación de dicha denuncia, se determinó que el proyecto habitacional no tenía las previstas correspondientes de desfogue pluvial dentro de la misma finca, por lo que se ubicó un cabezal de desfogue en la colindancia sur cerca de la última alcantarilla del sector más afectado, el que se encuentra totalmente colapsado y carece de la tubería adecuada para que las aguas discurran en forma sanitaria, razón por la cual se emitió la Orden Sanitaria número 019-09-S del 22 de mayo de 2009, dirigida al Alcalde Municipal, en la que ordenó: dar mantenimiento y limpieza a las alcantarillas y cajas de registro pluvial del sistema de evacuación pluvial de la Urbanizadora Roma y presentar propuesta de forma tal que las mismas sean conducidas mediante sistema de tuberías adecuada a cuerpo receptor o alcantarillado más cercano, evitando con ello que éstas se desparramen y estanquen en propiedades privadas.
Mediante oficio número ARS-SR-REG-245-09-IS, el Ministerio de Salud dio seguimiento a lo ordenado, indicando que el 26 de junio de 2009 se llevó a cabo una nueva inspección en la que se verificó el incumplimiento por parte de la Municipalidad amparada de la Orden Sanitaria 019-09-S, concluyéndose que el sistema de evacuación pluvial continuaba totalmente colapsado. En virtud de ello, el Alcalde de San Rafael presentó un proyecto para dar una solución definitiva al problema. Al respecto, si bien se han realizado algunas acciones, tales como limpieza de las alcantarillas, lo cierto es que la problemática todavía no ha sido solucionada de manera definitiva. Al respecto, es menester señalar, como en reiteradas ocasiones ha indicado esta Sala, que las municipalidades no pueden desentenderse de sus cometidos al aprobar construcciones o mejoras. En este sentido, les corresponde realizar las inspecciones para determinar que la evacuación de aguas negras se hiciera conforme a lo autorizado. En tal sentido, es determinante lo dispuesto en el artículo 1 de la Ley de Construcciones, según el cual:
“Artículo 1.- Las Municipalidades de la República son las encargadas de que las ciudades y demás poblaciones reúnan las condiciones necesarias de seguridad, salubridad, comodidad y belleza en sus vías públicas y en los edificios y construcciones que en terrenos de las mismas se levanten sin perjuicio de las facultades que las leyes conceden en estas materias a otros órganos administrativos”.
Sobre este mismo particular, el artículo 87 de la misma ley establece lo siguiente:
“Artículo 87.- La Municipalidad ejercerá vigilancia sobre las obras que se ejecuten en su jurisdicción así como sobre el uso que se les esté dando. Los inspectores municipales son sus agentes, que tienen por misión vigilar la observancia de los preceptos de este Reglamento”.
Por último, respecto de la prevención de contaminación, el numeral 60 de la Ley Orgánica del Ambiente, dispone lo siguiente:
“Artículo 60.- Prevención y control de la contaminación Para prevenir y controlar la contaminación del ambiente, el Estado, las municipalidades y las demás instituciones públicas, darán prioridad, entre otros, al establecimiento y operación de servicios adecuados en áreas fundamentales para la salud ambiental, tales como:
(…) b) La disposición sanitaria de excretas, aguas servidas y aguas pluviales”.
Como ya se adelantó, corresponde a las municipalidades la administración de los intereses y servicios locales en cada cantón, de conformidad a lo dispuesto por el citado artículo 169 de la Constitución Política. De lo que deriva la competencia de las municipalidades para planificar y vigilar el desarrollo urbano de su localidad, lo que incluye el deber de establecer una política integral de planeamiento urbano, que garantice un desarrollo urbano en congruencia con el funcionamiento eficiente de un sistema de provisión de agua potable y de recolección, tratamiento y disposición final de las aguas residuales, así como la obligación de adoptar las medidas requeridas para proveer al cantón de un adecuado sistema de alcantarillado sanitario y pluvial, a fin de garantizar a sus habitantes el derecho a la salud y a un ambiente libre de contaminación (véase, al efecto, sentencias número 2009-0908 de las 13:34 horas del 23 de enero del 2009 y 2009-03368 de las 12:40 horas del 27 de febrero del 2009).
De este modo, concluye esta Sala que a pesar de la obligación legal, la Municipalidad accionada no ha cumplido con su deber de fiscalización de la construcción de la Urbanización Jardines de Roma, de ahí que haya problemática no solo en cuanto a las aguas pluviales, sino también respecto de las negras o servidas. Sobre el caso del Ministerio de Salud, se comprueba que este no ha exigido de manera determinante el debido cumplimiento de las órdenes sanitarias ordenadas, toda vez que se ha podido constatar en inspecciones realizadas que el sistema de evacuación pluvial continua totalmente colapsado, lo que determina que esta autoridad también tiene responsabilidad por el problema del Residencial Jardines de Roma. Precisamente, este Tribunal ha reconocido que uno de los principios rectores de la organización administrativa lo constituye la coordinación que debe mediar entre todos los entes y órganos públicos al ejercer sus competencias y prestar los servicios que el ordenamiento jurídico les ha asignado.
La coordinación, en cuanto asegura la eficiencia y eficacia administrativas, es un principio constitucional virtual o implícito que permea el entero ordenamiento jurídico administrativo y obliga a todos los entes públicos. La coordinación puede ser interorgánica -entre los diversos órganos que conforman un ente público no sujetos a una relación de jerarquía- o intersubjetiva -esto es, entre los entes públicos, cada uno con personalidad jurídica, presupuesto propio, autonomía y competencias específicas-. La coordinación administrativa tiene por propósito evitar las duplicidades y omisiones en el ejercicio de las funciones administrativas de cada ente público, esto es, que sean desempeñadas de forma racional y ordenada (véase, al efecto, la sentencia número 2007-015218 de las 12 horas del 19 de octubre del 2007). De esta manera, este Tribunal concluye que sí existen problemas de aguas pluviales y servidas en el Residencial Jardines de Roma, razón por la que tanto la Municipalidad accionada como el Ministerio de Salud, deberán coordinar entre sí y ejercer las acciones necesarias para darle una solución efectiva a dicha problemática. En todo caso, los dueños de las propiedades en el Residencial citado, incluyendo la recurrente, deben cumplir las órdenes sanitarias giradas por el Ministerio de Salud.
VI.La Magistrada Calzada Miranda pone nota. Se ha estimado en el presente amparo que la actuación de las autoridades accionadas resulta contraria a los derechos fundamentales de los recurrentes, toda vez que no ha tendido al cumplimiento de las obligaciones impuestas por la Constitución y la ley, para la protección de la salud pública y el derecho a un ambiente sano y ecológicamente equilibrado. Lo anterior, por cuanto su falta de fiscalización sobre la construcción del Residencial Jardines de Roma, ha provocado en perjuicio de los recurrentes y los habitantes de la zona, una permanente amenaza a los derechos referidos. Ahora bien, esta Sala ha considerado que los problemas presentados en el residencial de cita, no sólo tienen que ver con la disposición de las aguas pluviales, sino también con las aguas servidas y las aguas negras. Sin embargo, en la parte dispositiva de esta sentencia se le ha otorgado a los recurridos el plazo de un año para realizar de forma coordinada las acciones correctivas que se encuentren dentro del ámbito de sus competencias para darle una solución definitiva al problema de las “aguas pluviales y servidas del Residencial Jardines de Roma”.
No obstante, considero que el problema a solucionar no sólo se refiere a las aguas pluviales y servidas señaladas en el por tanto, sino también y de forma específica a las aguas negras, ya que sobre ellas los recurridos tampoco han tomado las previsiones para su adecuada disposición. De modo que la orden girada a los recurridos debe ir encaminada a solucionar tanto el problema de aguas pluviales y servidas, como de aguas negras del Residencial Jardines de Roma.
Por tanto:
Se declara con lugar el recurso. Se ordena a Jorge Isaac Herrera Paniagua y a Ana Lorena Sánchez Hernández, por su orden Alcalde de la Municipalidad de San Rafael y Directora del Área Rectora de Salud de Heredia, o a quienes en sus lugares ejerzan los cargos, realizar de forma coordinada las acciones que se encuentren dentro del ámbito de sus competencias para darle una solución definitiva al problemas de aguas pluviales y servidas del Residencial Jardines de Roma, en el improrrogable plazo de UN AÑO, contado a partir de la notificación de esta sentencia. Se advierte a las autoridades recurridas que, de conformidad con lo establecido por el artículo 71 de la Ley de la Jurisdicción Constitucional se impondrá prisión de tres meses a dos años o de veinte a sesenta días multa, a quien recibiere una orden que deba cumplir o hacer cumplir, dictada dentro de un recurso de amparo y no la cumpliere o no la hiciere cumplir, siempre que el delito no esté más gravemente penado.
Se condena al Estado y a la Municipalidad de San Rafael de Heredia al pago de las costas, daños y perjuicios causados con los hechos que sirven de base a esta declaratoria, los que se liquidarán en ejecución de sentencia de lo contencioso administrativo. La Magistrada Calzada Miranda pone nota. Notifíquese esta resolución a Jorge Isaac Herrera Paniagua y a Ana Lorena Sánchez Hernández, por su orden Alcalde de la Municipalidad de San Rafael y Directora del Área Rectora de Salud de Heredia, o a quienes en sus lugares ejerzan los cargos, en forma personal.
