Writ of amparo (recurso de amparo) filed by WILLIAM PIÑA ESPINOZA, identity card 0601560001, against the INSTITUTO COSTARRICENSE DE ACUEDUCTOS Y ALCANTARILLADOS (AyA), the MINISTERIO DE OBRAS PÚBLICAS Y TRANSPORTES, the ÁREA RECTORA EN SALUD DEL MINISTERIO DE SALUD DE PUNTARENAS, and the MUNICIPALIDAD DE PUNTARENAS.- Background:

  1. 1In a brief received by the Chamber’s Secretariat on 1 de julio de 2011, the petitioner filed a writ of amparo against AyA, the Ministries of Health and Public Works and Transportation, and the Municipalidad de Puntarenas, stating that he lives in Puntarenas, Barrio 20 de noviembre, south of Escuela 125, by La Laguna, in the neighborhood known as Los Malinches; the respondents expose residents to disease because there is no sewer system or curb and gutter drainage (cordón y caños) through which stormwater (aguas fluviales) can flow, and it consequently stagnates, exposing them to diseases such as dengue, malaria, shigella, and salmonella. He requests that the Chamber order the respondents to resolve the problem, which endangers their homes and health.-
  2. 2The Municipal Mayor of the Central Canton of Puntarenas, Rafael Ángel Rodríguez Castro, reports that, according to Ing. Oscar Brenes Quirós, Director of the Unidad Técnica de Gestión Vial of the canton, in official letter UTGV-0399-2011, the water stagnation problem described by the petitioner was caused by the negligence of a resident who filled in the area of the lagoon into which stormwater from that street had flowed, thereby obstructing the outlet from a culvert (paso de alcantarilla) installed 100 metros south of Escuela del Barrio 20 de Noviembre. The culvert had been installed in 2005 and allowed water to drain into the lagoon; however, once the lagoon was filled in, the water that normally drained there remained stagnant, causing the reported pooling. The filling work performed did not have a municipal permit; to the contrary, the Departamento de Planificación Urbana y Control Constructivo conducted several site inspections to determine what had occurred in connection with the filling and earthworks (movimiento de tierra) on a wetland (humedal).MINAET was also notified and, together with the Coordinador de la Zona Marítimo Terrestre de la Municipalidad, conducted the corresponding field inspection at the site to determine the damage caused by filling the lagoon area. During the inspections conducted by the Coordinador del Departamento de Planificación Urbana y Control Constructivo, no machinery or persons working could be observed because the work was apparently performed on weekends or outside business hours; however, during the inspection tour conducted by municipal inspectors, they spoke with the operator of a dump truck at the site, who provided no further details. The Departamento de Zona Marítimo Terrestre was therefore notified again; it was working jointly with the Tribunal Ambiental Administrativo so that the proceedings could be referred to that body. To provide an immediate solution to the residents affected by the irresponsible actions of a third party, the Municipality will clean the culvert and construct a channel around the fill so that the water can be discharged toward the culvert area near the Escuela.Finally, the actions to be taken to identify those responsible for the filling and determine whether the lagoon was affected will be coordinated with MINAET. On those grounds, he requests that the writ be denied.-
  3. 3The Acting President of the Consejo Municipal de Puntarenas, Julieta Campos Sequeira, submits her report in the same terms as the preceding report.-
  4. 4The Minister of Public Works and Transportation, Francisco J. Jiménez, reports, insofar as relevant, that the facts underlying the amparo concern roads belonging to the Red Vial Cantonal de Puntarenas, and their administration therefore falls to the Municipalidad de ese Cantón.-
  5. 5AyA’s Deputy General Manager, Eduardo Lezama Fernández, reports that the petitioner’s complaint does not concern the drinking-water system or sanitary sewer system (alcantarillado sanitario) administered by AyA, but rather components of urban development that fall within the jurisdiction of the Municipalidad de Puntarenas. Under its Ley Constitutiva, AyA is not responsible for constructing drainage ditches (cunetas) in the cantonal road network.-
  6. 6The Director of the Área Rectora de Salud de Puntarenas-Chacarita de la Región Pacífico Central del Ministerio de Salud, Ericka Jiménez Valverde, reported that the Área Rectora first learned of the facts upon receiving notice of the amparo. In response, it inspected the site, verified the pooling of stormwater (aguas pluviales), and served health orders (órdenes sanitarias) 055 and 056, both F-2011, on the Municipal Mayor and Municipal President of Puntarenas, requiring them to perform the corresponding work to remedy the reported pooling. The Área Rectora’s files contain no complaint of this kind regarding the location. Moreover, the pooling of this type of water does not promote the proliferation of the mosquito that transmits dengue. She requests that the writ be denied.-
  7. 7The legal requirements have been observed in these proceedings.-

Considerations:

I. SUBJECT MATTER OF THE WRIT

The petitioner complains that in the area located in Puntarenas, in Barrio 20 de Noviembre, south of Escuela 125, in the area known as Los Malinches, the lack of curb and gutter drainage causes water to stagnate, endangering the health and homes of residents.-

II. AMPARO AGAINST THE MINISTERIO DE OBRAS PUBLICAS Y TRANSPORTES AND AyA

The amparo is inadmissible insofar as it was brought against the Ministerio de Obras Públicas y Transportes and the Instituto Costarricense de Acueductos y Alcantarillados, because the facts underlying the amparo concern roads belonging to the Red Vial Cantonal de Puntarenas, whose administration therefore falls to the Municipalidad de ese Cantón, and because the absence of curb and gutter drainage is not AyA’s responsibility, as the law likewise assigns it no authority over that matter.-

III. AMPARO AGAINST THE MINISTERIO DE SALUD

The report submitted by the Director of the Área Rectora de Salud de Puntarenas-Chacarita established that the Área did not learn of the facts until it received notice of the amparo; its files contain no complaint concerning the matter. It immediately inspected the site, verified the public-health problem, and served health orders 055- F-2011 and 056- F-2011 on the Municipal Mayor and Municipal President of Puntarenas, requiring them to perform the corresponding work to remedy the reported pooling. Public-health complaints must be submitted to the health authorities, not to this Chamber, which hears them only insofar as the authorities with jurisdiction over the matter violate, through action and generally through omission, the right to health and other individual rights. The Área Rectora acted diligently because, upon learning of the facts, it immediately issued the health orders to the Municipalidad.-

III. AMPARO AGAINST THE MUNICIPALIDAD DE PUNTARENAS

In repeated judgments, this Chamber has described the duties of municipalities in matters such as this one, ordering local governments to take the actions necessary to safeguard the right to health and other rights by properly disposing of stormwater (see, for example, judgment number 2010-015668, issued at dieciséis horas y cincuenta y nueve minutos del veintiuno de setiembre del dos mil diez). Although the Municipal Mayor and Municipal President attribute the cause of the problem reported by the petitioner to the actions of a private individual who filled in a lagoon into which the stormwater—now pooling in the area identified by the petitioner—had drained, the fact remains that, according to the respondents, the lagoon was filled in illegally. In such cases, the local government incurs liability for inadequate oversight and enforcement (control y fiscalización), and the excuse that the work was performed on non-business days and outside business hours does not relieve it of its obligation to perform the work necessary to resolve the pooling problem in accordance with the health authorities’ orders, which demonstrate the existence of a situation threatening the residents’ right to health.

In connection with the amparo, the municipal authorities have also disclosed an environmental problem involving protection of the maritime-terrestrial zone (zona marítimo terrestre), which is being handled by that municipality, MINAET, and the Tribunal Ambiental Administrativo and which exceeds the summary nature of amparo proceedings and the petitioner’s own interests. The writ must consequently be granted solely against the Municipalidad del Cantón Central de Puntarenas, which shall be ordered to comply fully and immediately with the cited health orders.-

IV. DISSENTING OPINION (VOTO SALVADO) OF JUSTICE CALZADA MIRANDA

I dissent and would also grant the writ against the Ministerio de Salud because, in my judgment, the Área Rectora de Salud Puntarenas-Chacarita should have acted on its own initiative (de oficio) to ensure that the Municipalidad de Puntarenas adopted the measures necessary to eliminate promptly the stagnant water in the area identified by the petitioner. This is because, in my view, the authority conferred on that ministry by the Ley General de Salud and the remainder of the legal system must be exercised on its own initiative to ensure effectively that situations such as those complained of here, which endanger public health, do not occur.

Por tanto:

The writ is partially granted, solely against the Municipalidad del Cantón Central de Puntarenas. Accordingly, the Acting President of the Consejo Municipal de Puntarenas, Julieta Campos Sequeira, and the Municipal Mayor of the Central Canton of Puntarenas, Rafael Ángel Rodríguez Castro, or whoever holds their respective offices, are ordered to comply immediately with health orders 055- F-2011 and 056- F-2011, with notice that disobedience of this Chamber’s orders is subject to criminal penalties under article 71 of the Ley de la Jurisdicción Constitucional. The Municipalidad de Puntarenas is ordered to pay the costs, damages, and losses arising from the events that gave rise to this ruling, the amounts of which shall be determined during enforcement of judgment before the administrative-litigation court (contencioso administrativo). Justice Calzada Miranda dissents and would grant the writ.

Recurso de amparo interpuesto por WILLIAM PIÑA ESPINOZA, cédula de identidad 0601560001, contra el INSTITUTO COSTARRICENSE DE ACUEDUCTOS Y ALCANTARILLADOS (AyA), el MINISTERIO DE OBRAS PÚBLICAS Y TRANSPORTES, el ÁREA RECTORA EN SALUD DEL MINISTERIO DE SALUD DE PUNTARENAS y la MUNICIPALIDAD DE PUNTARENAS.-

Resultando:

  1. 1Por escrito recibido en la Secretaría de la Sala el 1 de julio de 2011, el recurrente interpone recurso de amparo contra el AyA, los Ministerios Salud y Obras Públicas y Transportes y la Municipalidad de Puntarenas, y manifiesta que habita en Puntarenas, Barrio 20 de noviembre, de la Escuela 125 al sur, por La Laguna, barrio conocido como Los Malinches; los recurridos exponen a los vecinos a enfermedades, pues no existe alcantarillado ni cordón y caños, para que fluyan las aguas fluviales, motivo por el cual se estancan, los expone a enfermedades tales como el dengue, la malaria, shigella, salmonella. Pide que la Sala ordene a los recurridos resolver el problema, que pone en peligro sus viviendas y su salud.-
  2. 2El Alcalde Municipal del Cantón Central de Puntarenas, Rafael Ángel Rodríguez Castro, informa que, según lo indicado por el Ing. Oscar Brenes Quirós, Director de la Unidad Técnica de Gestión Vial del cantón, en oficio UTGV-0399-2011, el problema de estancamiento de aguas a que se refiere el recurrente se produce por la negligencia de un vecino que rellenó el área correspondiente a la laguna hacia donde discurrían las aguas pluviales de esa calle, con lo cual se perjudicó la salida de las aguas de un paso de alcantarilla instalado 100 metros al sur de la Escuela del Barrio 20 de Noviembre. El paso de alcantarilla se había instalado desde 2005 y permitía desaguar hacia la laguna; no obstante, al rellenarla, las aguas que normalmente drenaban hacia el lugar quedan estancadas, provocando los problemas de empozamiento reportados. Los trabajos de relleno realizados no cuentan con permiso municipal; por el contrario, el departamento de Planificación Urbana y Control Constructivo realizó varias inspecciones en el sitio con el fin de determinar lo sucedido en relación con el relleno y movimiento de tierra sobre un humedal, por lo que también se puso en conocimiento del MINAET, que en conjunto con el Coordinador de la Zona Marítimo Terrestre de la Municipalidad, realizó la respectiva inspección de campo en el lugar, para determinar el daño causado a raíz del relleno sobre el área de la laguna.Durante las inspecciones realizadas por el Coordinador del Departamento de Planificación Urbana y Control Constructivo; no se logró ver maquinaria ni personas trabajando ya que, al parecer, los trabajos se realizaban los fines de semana o en horas inhábiles; sin embargo, durante el recorrido realizado por inspectores municipales, conversaron con el operador de una vagoneta que se encontraba en el sitio, el cual no dio más detalles, por lo que se informó nuevamente al Departamento de Zona Marítimo Terrestre, que hacía labores conjuntas con el Tribunal Ambiental Administrativo, con el fin de delegar las diligencias en esa instancia. Para brindar una solución pronta a los vecinos afectados por acciones irresponsables ejecutadas por un tercero, en forma inmediata, el Municipio ejecutará labores de limpieza del paso de alcantarilla y la construcción de un canal alrededor del relleno, con el fin de que las aguas puedan ser evacuadas hacia el sector del paso de Alcantarilla localizado cerca de la Escuela.Finalmente, se coordinará con MINAET las acciones a seguir para establecer los responsables de las acciones de relleno y si resultó afectada la laguna. Por lo anterior, pide que se declare sin lugar el recurso.-
  3. 3La Presidente a.i. del Consejo Municipal de Puntarenas, Julieta Campos Sequeira, rinde su informe en los mismos términos que el anterior.-
  4. 4El Ministro de Obras Públicas y Transportes, Francisco J. Jiménez, informa, en lo que interesa, que los hechos del amparo se refieren a vías pertenecientes a la Red Vial Cantonal de Puntarenas, por lo que su administración corresponde a la Municipalidad de ese Cantón.-
  5. 5El Subgerente del AyA, Eduardo Lezama Fernández, informa que la denuncia del recurrente no se refiere al sistema de agua potable ni al alcantarillado sanitario que se encuentran administrados por el AyA, sino a elementos que forman parte del desarrollo urbanístico, competencia de la Municipalidad de Puntarenas. La construcción de cunetas en la red vial ni cantonal no corresponde al AyA, de acuerdo con su Ley Constitutiva.-
  6. 6La Directora del Área Rectora de Salud de Puntarenas-Chacarita de la Región Pacífico Central del Ministerio de Salud, Ericka Jiménez Valverde, informó que fue a partir de la notificación del amparo que el Área Rectora tuvo conocimiento de los hechos, ante esa situación, se realizó una inspección al sitio, se tuvo por probado el empozamiento de las aguas pluviales y se notificó al Alcalde y al Presidente Municipales de Puntarenas las órdenes sanitarias 055 y 056, ambas F-2011, a efecto de que ejecuten las obras correspondientes, con el fin de solucionar el empozamiento denunciado. No hay en los archivos del Área Rectora ninguna denuncia de ese tipo en el lugar. Por otra parte, el empozamiento de ese tipo de aguas no propicia la proliferación del mosquito transmisor del dengue. Pide que se declare sin lugar el recurso.-
  7. 7En los procedimientos se han observado las prescripciones legales.-

Redacta el Magistrado Armijo Sancho; y,

Considerando:

I. OBJETO DEL RECURSO

El recurrente reclama que en el área ubicada en Puntarenas, en el Barrio 20 de Noviembre, de la Escuela 125 al sur, zona conocida como Los Malinches, por causa de la falta de cordón y caño se producen estancamientos de aguas que ponen en peligro la salud y vivienda de los vecinos.-

II. DEL AMPARO CONTRA EL MINISTERIO DE OBRAS PUBLICAS Y TRANSPORTES Y EL AyA

El amparo es improcedente en cuanto se dirigió contra el Ministerio de Obras Públicas y Transportes y el Instituto Costarricense de Acueductos y Alcantarillados, porque los hechos del amparo se refieren a vías pertenecientes a la Red Vial Cantonal de Puntarenas, por lo que su administración corresponde a la Municipalidad de ese Cantón y porque la inexistencia de cordón y caño no es responsabilidad del AyA, al que, por ley, no le corresponde tampoco esa materia.-

III. DEL AMPARO CONTRA EL MINISTERIO DE SALUD

El informe rendido por la Directora del Área Rectora de Salud de Puntarenas-Chacarita acreditó que no fue sino hasta la notificación del amparo que en el Área se tuvo conocimiento de los hechos; no hay en los archivos ningún reclamo al respecto y, de forma inmediata, se realizó una inspección al sitio, se tuvo por probado el problema sanitario y notificó al Alcalde y al Presidente Municipales de Puntarenas las órdenes sanitarias 055- F-2011 y 056- F-2011, a efecto de que ejecuten las obras correspondientes, con el fin de solucionar el empozamiento denunciado. Las denuncias en materia de salud pública deben dirigirse a las autoridades de Salud y no ante esta Sala, que las conoce sólo en la medida en que las autoridades competentes en esa materia vulneran, por acción y, generalmente, por omisión, el derecho a la salud y otros de las personas. El Área Rectora actuó con diligencia pues, al tener conocimiento de los hechos, inmediatamente giró las órdenes sanitarias a la Municipalidad.-

III. DEL AMPARO CONTRA LA MUNICIPALIDAD DE PUNTARENAS

En reiteradas sentencias, esta Sala ha señalado los deberes de las Municipalidades en materia como la presente, ordenando a los gobiernos locales las acciones necesarias a fin de tutelar los derechos a la salud y otros, mediante la adecuada disposición de las aguas pluviales (v. por ejemplo, la sentencia número 2010-015668 de dieciséis horas y cincuenta y nueve minutos del veintiuno de setiembre del dos mil diez. Aunque el Alcalde y el Presidente Municipales achacan la causa del problema acusado por el recurrente a la acción de un particular, que rellenó una laguna en la cual drenaban las aguas pluviales que ahora se empozan en el área referida por el recurrente, lo cierto es que el relleno de esa Laguna se realizó en forma ilegal, según el dicho de los recurridos. En estos casos, se genera responsabilidad del gobierno local por insuficiencia de control y fiscalización y, la excusa de que las obras se realizaran en días y horas inhábiles no la exime de realizar las obras necesarias para resolver el problema de empozamiento, de acuerdo con lo ordenado por las autoridades de Salud, que ponen de manifiesto la existencia de una situación que amenaza el derecho a la salud de los vecinos.

Con ocasión del amparo, las autoridades municipales han revelado, además, un problema ambiental y de tutela de la zona marítimo terrestre, que está en manos de esa municipalidad, el MINAET y el Tribunal Ambiental Administrativo, que excede la naturaleza sumaria del amparo y los intereses mismos del recurrente. En consecuencia, procede declarar con lugar el recurso, únicamente contra la Municipalidad del Cantón Central de Puntarenas y ordenar que, en forma inmediata, brinde pleno cumplimiento a las órdenes sanitarias señaladas.-

IV. VOTO SALVADO DE LA MAGISTRADA CALZADA MIRANDA

Salvo el voto y declaro con lugar el recurso también contra el Ministerio de Salud, porque a mi juicio el Área Rectora de Salud Puntarenas-Chacarita, debió actuar de oficio a fin de que la Municipalidad de Puntarenas adoptara las medidas necesarias para que el estancamiento de aguas en el sector que señala el recurrente fuera eliminado oportunamente. Lo anterior, porque es mi criterio que las competencias que le da la Ley General de Salud, y el resto del ordenamiento jurídico a ese ministerio deben ser ejercidas oficiosamente, a fin de garantizar en forma efectiva que situaciones como las que aquí se reclaman, y que ponen en riesgo la salud pública, no se produzcan.

Por tanto:

Se declara parcialmente con lugar el recurso, únicamente contra la Municipalidad del Cantón Central de Puntarenas y, en consecuencia, se ordena al Presidente a.i. del Consejo Municipal de Puntarenas, Julieta Campos Sequeira Alcalde Municipal del Cantón Central de Puntarenas, Rafael Ángel Rodríguez Castro, o a quienes ejerzan sus cargos, que en forma inmediata, cumplan las órdenes sanitarias 055- F-2011 y 056- F-2011, apercibidos de que la desobediencia a las órdenes de esta Sala se encuentra sancionada penalmente en el artículo 71 de la Ley de la Jurisdicción Constitucional. Se condena a la Municipalidad de Puntarenas al pago de las costas, daños y perjuicios ocasionados por los hechos que han dado lugar a esta declaratoria, los que se liquidarán en ejecución de sentencia de lo contencioso administrativo. La Magistrada Calzada Miranda salva el voto y declara con lugar el recurso.
