Proceeding for a writ of amparo (recurso de amparo) under expediente número 11-007644-0007-CO, filed by LIDIANETT CASTRO SALAS, identity card number 0203200019, against LA DEFENSORÍA DE LOS HABITANTES, EL GERENTE GENERAL DEL BANCO HIPOTECARIO DE LA VIVIENDA, LA GERENTE GENERAL DEL INSTITUTO MIXTO DE AYUDA SOCIAL (IMAS), LA PRESIDENTA DE LA COMISIÓN NACIONAL DE PREVENCIÓN DE RIESGOS Y ATENCIÓN DE EMERGENCIAS, AND EL VICEMINISTRO DE VIVIENDA Y ASENTAMIENTOS URBANOS.- Findings of Fact:
Justice Castillo Víquez drafted the opinion; and,
Whereas:
I.Proven facts. The following facts are deemed duly established and relevant to the decision in this matter, either because they have been substantiated or because the respondent failed to address them as ordered in the initial ruling:
It was therefore necessary to adopt a series of prevention and mitigation measures urgently, including channeling wastewater from the dwellings located above the slope and waterproofing the slope with plastic sheeting while a retaining wall was being built. (Report and evidence from the Comisión Nacional de Prevención de Riesgos y Atención de Emergencias) f) By health order SR-443-2004 dated 5 de noviembre de 2004, the dwelling of Jesús Gerardo López Montoya was ordered evacuated because of the existing risk of collapse (Report and evidence from the Ministerio de Salud).
III.Merits. In this matter, the appellant asserts that the respondent authorities have not provided an effective solution to the problems caused by the construction carried out on the property adjoining hers. After analyzing the evidence submitted in the record, it is deemed established that Mr. Jesús López Montoya built a dwelling on the property adjoining that of the appellant and that the construction had the respective municipal permits. It is also deemed established that, after conducting an inspection, the Comisión Nacional de Prevención de Riesgos y Atención de Emergencias determined that the dwelling in question had deficiencies in its design and construction process. Specifically, it was found that an excavation had been made into a slope to build the house, forming a terrace 10 metros wide and seis metros high. It was also established that three more houses had been built above that slope, which had an inclination of 75 ° and was 6 metros high; aside from being located less than 5 metros from its edge, they lacked the necessary waterproof drainage system for stormwater discharge.
These conditions, combined with heavy rainfall, caused the ground to become rapidly saturated and the soil to lose cohesion, resulting in a landslide of approximately 20 metros cúbicos of material that damaged one of Mr. López Montoya’s buildings and placed all four dwellings at risk, including that of the protected party. In response to this situation, on primero de mayo de dos mil diez the Municipalidad de San Ramón ordered Mr. López Montoya to construct a retaining wall, an order that has not yet been complied with because an appeal filed before the Contencioso Administrativo remains pending. Furthermore, it is deemed established that, as a result of the aforementioned events, in 2004 the Área Rectora de Salud de San Ramón inspected Mr. López Montoya’s house and found that it presented a high risk of collapse. It therefore issued health order number R-443-2004 dated 5 de noviembre de 2004; however, there is no evidence that it had been complied with as of the date on which the Director of the Área Rectora de Salud submitted her report.
In light of the foregoing, this Court finds a series of omissions by the Municipalidad de San Ramón and the Área Rectora de Salud of that canton, which have endangered not only the property and physical safety of the protected party, but also those of other persons residing in several properties adjacent to that of the appellant. In this regard, the failure of the Municipalidad de San Ramón to exercise effective oversight over the construction of Mr. Jesús López Montoya’s dwelling is contrary to the obligation established in section 169 of the Constitución Política, because when it granted the respective permits, it should have ensured that the work was carried out in accordance with the regulations established by the Legal System, in order to prevent situations such as those that ultimately occurred and endangered the safety of several people. This Chamber also finds it noteworthy that, although the Municipality was aware of the circumstances involving the aforementioned dwelling, it was not until 2010, and only following the intervention of the Defensoría de los Habitantes, that the municipal corporation issued an order requiring Mr.
López Montoya to construct a retaining wall at his dwelling, which reflects a passive attitude on the part of that authority in addressing the problem in question. Accordingly, in view of the foregoing, the petition must be granted against that authority for purposes of compensation, taking into account that it already issued the decision of 13:30 hours on 1° de mayo de 210, “Notice to Construct a Retaining Wall,” which has not been enforceable for reasons beyond that authority’s control.
IV.Furthermore, regarding the Área Rectora de Salud de San Ramón, this Court considers it unjustified that, more than six years after health order number R-443-2004 was issued, it still had not been enforced, even though there is a clear risk that the property to which it applies may collapse, thereby endangering the physical safety of the persons who live there. Accordingly, in view of the foregoing, the petition must be granted, subject to the considerations set forth in the operative portion.
Therefore:
The action is granted solely with respect to Municipalidad de San Ramón and Área Rectora de Salud de San Ramón. Judith Marcela Rodríguez Rojas, in her capacity as Director of Área de Salud de San Ramón, or whoever holds that position, is ordered to take the actions within the scope of her authority so that sanitary order (orden sanitaria) number R-443-2004 is implemented immediately, if the conditions on which it was issued still persist. The respondent, or whoever holds that position, is hereby advised that, pursuant to Article 71 of Ley de la Jurisdicción Constitucional, anyone who receives an order issued in an amparo proceeding (recurso de amparo), which they are required to comply with or enforce, and who fails to comply with or enforce it, shall be punished by imprisonment for three months to two years or by a fine of twenty to sixty days, provided that the offense is not subject to a more severe penalty.
The State and Municipalidad de San Ramón are ordered to pay the legal costs, damages, and losses caused by the facts underlying this ruling, which shall be assessed during enforcement of the judgment (ejecución de sentencia) before the administrative litigation court. This decision shall be personally served on Judith Marcela Rodríguez Rojas, in her capacity as Director of Área de Salud de San Ramón, and on Mercedes Moya Araya, in her capacity as Mayor of San Ramón, or on whoever holds their respective positions.

Recurso de amparo que se tramita en expediente número 11-007644-0007-CO, interpuesto por LIDIANETT CASTRO SALAS, cédula de identidad 0203200019, contra LA DEFENSORÍA DE LOS HABITANTES, EL GERENTE GENERAL DEL BANCO HIPOTECARIO DE LA VIVIENDA, LA GERENTE GENERAL DEL INSTITUTO MIXTO DE AYUDA SOCIAL (IMAS), LA PRESIDENTA DE LA COMISIÓN NACIONAL DE PREVENCIÓN DE RIESGOS Y ATENCIÓN DE EMERGENCIAS Y EL VICEMINISTRO DE VIVIENDA Y ASENTAMIENTOS URBANOS.-
Resultando:
Redacta el Magistrado Castillo Víquez; y,
Considerando:
I.Hechos probados. De importancia para la decisión de este asunto, se estiman como debidamente demostrados los siguientes hechos, sea porque así han sido acreditados o bien porque el recurrido haya omitido referirse a ellos según lo prevenido en el auto inicial:
Por lo tanto, era necesario adoptar con urgencia una serie de medidas de prevención y mitigación, entre las cuales figuraba canalizar las aguas servidas de las viviendas ubicadas en la parte superior del talud y además, mientras se realizaba la construcción de un muro de retención, impermeabilizar el talud por medio de plásticos.(Informe y prueba de la Comisión Nacional de Prevención de Riesgos y Atención de Emergencias f) Por orden sanitaria SR-443-2004 del 5 de noviembre de 2004, se ordenó desalojar la casa de habitación de Jesús Gerardo López Montoya por el riesgo de derrumbe existente (Informe y prueba del Ministerio de Salud).
III.Sobre el fondo. En el presente asunto, la recurrente manifiesta que las autoridades accionadas no han dado una solución efectiva a los problemas generados por la construcción realizada en el inmueble que colinda con su propiedad. Ahora bien, tras analizar los elementos aportados a los autos, se tiene por demostrado que el señor Jesús López Montoya procedió a edificar una vivienda en la propiedad contigua a la de la accionante, construcción que contó con los respectivos permisos municipales. Asimismo, se tiene por demostrado que tras realizar una inspección, la Comisión Nacional de Prevención de Riesgos y Atención de Emergencias determinó que la vivienda mencionada presentaba deficiencias en su diseño y en su proceso constructivo. En ese sentido, se constató que para la edificación de esa casa, se había efectuado un corte en un talud, el cual formó una terraza de 10 metros de ancho y seis metros de altura.
Además, se comprobó que sobre dicho talud, que tenía una inclinación de 75 ° y 6 metros de altura, se construyeron tres casas más que, aparte de ubicarse a menos de 5 metros de su borde, carecían del drenaje impermeabilizado necesario para la evacuación de aguas pluviales. Esas condiciones, al combinarse con fuertes precipitaciones pluviales, provocaron una rápida saturación del terreno y la pérdida de cohesión del suelo, generándose un deslizamiento de aproximadamente 20 metros cúbicos de material que dañó una de las edificaciones pertenecientes al señor López Montoya, aparte de poner en riesgo las cuatro viviendas, entre ellas la de la tutelada. Ante dicha situación, la Municipalidad de San Ramón ordenó al señor López Montoya la construcción de un muro de contención el primero de mayo de dos mil diez, disposición que no se ha cumplido aún, por estar pendiente un recurso planteado ante el Contencioso Administrativo.
Por otra parte, se tiene por probado que a raíz de los hechos antes mencionados, en el año 2004, el Área Rectora de Salud de San Ramón realizó una inspección en la casa del señor López Montoya y constató que ésta presentaba un alto riesgo de derrumbe, razón por la cual giró la orden sanitaria número R-443-2004 del 5 de noviembre de 2004, no obstante, no existe prueba de que ésta se hubiera cumplido a la fecha en que la Directora del Área Rectora de Salud rinde su informe. Con vista en lo expuesto anteriormente, este Tribunal constata una serie de omisiones por parte de la Municipalidad de San Ramón y el Área Rectora de Salud de ese cantón, que han puesto en peligro no sólo la propiedad y la integridad física de la tutelada, sino de otras personas que habitan varios inmuebles aledaños a la accionante. En ese sentido, resulta contraria la obligación establecida por el numeral 169 de la Constitución Política, el hecho de que la Municipalidad de San Ramón no ejerciera una fiscalización efectiva sobre la construcción de la vivienda del señor Jesús López Montoya, pues al momento en que otorgó los permisos respectivos, debió procurar que éstos se ejecutaran conforme a las regulaciones establecidas por el Ordenamiento Jurídico, con el fin de evitar situaciones como las que finalmente acaecieron, y que pusieron en riesgo la integridad de varias personas.
Asimismo, llama la atención de esta Sala, que a pesar de que la Municipalidad conocía los antecedentes que se presentaron en la vivienda citada, fue hasta el año 2010, y en virtud de la intervención de la Defensoría de los Habitantes, que dicha corporación procedió a emitir una orden al señor López Montoya para la construcción de un muro de contención en su vivienda, lo que denota una actitud pasiva por parte de dicha autoridad para brindar una solución al problema mencionado. Así, en virtud de lo anterior, el recurso debe acogerse contra dicha autoridad para efectos indemnizatorios, tomando en cuenta que ya emitió la resolución de las 13:30 horas del 1° de mayo de 210, "Apercibimiento para la Realización de Construcción de Muro de Retención", la que no ha podido ejecutarse por razones ajenas a dicha autoridad.
IV.Por otra parte, en lo que atañe al Área Rectora de Salud de San Ramón, debe indicarse que este Tribunal estima injustificado el hecho de que tras más de seis años de haberse dictado la orden sanitaria número R-443-2004, ésta no se hubiera ejecutado todavía, a pesar de que existe un claro riesgo de derrumbe del inmueble sobre el que ésta fue girada, con lo que se pone en riesgo la integridad física de las personas que habitan ese lugar. Así, en virtud de lo anterior, lo procedente es acoger el recurso, con las consideraciones que se dirán en la parte dispositiva.
Por tanto:
Se declara con lugar el recurso, únicamente en cuanto a la Municipalidad de San Ramón y el Área Rectora de Salud de San Ramón. Se ordena a Judith Marcela Rodríguez Rojas, en su calidad de Directora. del Área de Salud de San Ramón, o a quien ocupe su cargo, realizar las acciones que estén dentro del ámbito de sus competencias para que de inmediato se ejecute la orden sanitaria número R-443-2004, si aún persisten las condiciones que fundamentaron su dictado. Se advierte a la recurrida, o a quien ocupe su cargo, que de conformidad con lo establecido por el artículo 71 de la Ley de la Jurisdicción Constitucional se impondrá prisión de tres meses a dos años o de veinte a sesenta días multa, a quien recibiere una orden que deba cumplir o hacer cumplir, dictada dentro de un recurso de amparo y no la cumpliere o no la hiciere cumplir, siempre que el delito no esté más gravemente penado. Se condena al Estado y a la Municipalidad de San Ramón al pago de las costas, daños y perjuicios causados con los hechos que sirven de base a esta declaratoria, los que se liquidarán en ejecución de sentencia de lo contencioso administrativo. Notifíquese esta resolución a Judith Marcela Rodríguez Rojas, en su calidad de Directora. del Área de Salud de San Ramón, y a Mercedes Moya Araya, en su calidad de Alcaldesa de San Ramón, o a quienes ocupen sus cargos, en forma personal.
