Petition for constitutional relief filed by GABRIEL CABRERA ZÚÑIGA, holder of identity card No. 6-0218-0861, against the COSTA RICAN ELECTRICITY INSTITUTE, the MINISTRY OF ENVIRONMENT, ENERGY AND TELECOMMUNICATIONS, the NATIONAL ENVIRONMENTAL TECHNICAL SECRETARIAT, the MUNICIPALITY OF SIQUIRRES, the MINISTRY OF HEALTH, and the ADMINISTRATIVE ENVIRONMENTAL TRIBUNAL.

RESULTS:

  1. 1By a written submission received at the Secretariat of the Chamber at 16:25 hours on 8 de junio de 2011, the petitioner filed a petition for constitutional relief against the Costa Rican Electricity Institute and others. He stated that this entity is causing “large-scale environmental damage” in the Tigre stream, located in Guayacán de Siquirres, District 1°. He alleged that the area is home to a biodiversity of endangered animals—including the red frog and the toucan—whose habitat is being destroyed, as well as cedar, laurel, and other types of trees that have been improperly felled. Accordingly, he deemed his fundamental rights to have been violated and requested that this petition be granted.
  2. 2By resolution issued at 10:38 hours on 9 de junio de 2011, the proceedings were initiated and reports were requested from the General Manager of the Costa Rican Electricity Institute; the Deputy Minister and the Head of the Siquirres Subregional Office, both of the Ministry of Environment, Energy and Telecommunications; the National Environmental Technical Secretary; the Municipal Mayor and the President of the Municipal Council, both of the Municipality of Siquirres; the Director of the Siquirres Health Governing Area; and the President of the Administrative Environmental Tribunal.
  3. 3Ileana Camacho Rodríguez, in her capacity as General Judicial Attorney-in-Fact of the Costa Rican Electricity Institute, reported under oath that the Reventazón Hydroelectric Project harnesses the waters flowing toward the Reventazón River through the construction of a dam at a natural narrowing of its channel, and that most of the works are located on its right bank—the spillway, water intake, tunnel, surge tank, penstock, powerhouse, and substation. She stated that, through communication No. 0012-138-2010 of the Board of Directors of the Costa Rican Electricity Institute, development of the Project in question was unanimously approved in the districts of Siquirres and Florida, Siquirres canton, Limón province. Specifically, she stated that the Project is located in the middle basin of the Reventazón River, approximately 8 km southwest of the city of Siquirres and 38 km downstream from the discharge site of the Angostura Hydroelectric Plant powerhouse.She further stated that the Hydroelectric Project uses the river water between elevations of 265 meters above sea level and 120 meters above sea level. She noted that the Project has been under construction since septiembre de 2009, when repair work began on the access road to the central worksite, or road No. 1, and on the main access road to the works on the right bank, known as road No. 2. This was based on the environmental viability granted by the National Environmental Technical Secretariat through resolution No. 1778-SETENA of julio de 2009. She added that all environmental assessment phases established in the “General Regulations on Environmental Impact Assessment Procedures” have been completed in the implementation of the Reventazón Hydroelectric Project and that, as of 14 de junio de 2011, 22% of the works had been completed. She alleged that the Institution has implemented the environmental control measures specified in the Environmental Impact Study submitted to the National Environmental Technical Secretariat, including: “(…) the construction of 4.5 km of sidewalks, patching of 3.4 km of roads, sediment control during excavation processes, solid-waste management, archaeological assessments, biological studies and monitoring, rescue of flora and fauna, forest inventories and felling, revegetation of slopes, production of trees in a forest nursery, repair of local roads, and implementation of environmental education, local development, and literacy programs, as well as periodic meetings with community and institutional representatives to monitor the established compensation measures.” She emphasized that Institute professionals prepared an “Environmental Management Forecast-Plan” grouping the environmental measures for preventing, correcting, mitigating, or compensating for any environmental impacts that might be caused.Furthermore, once environmental viability was granted, the project’s environmental-management phase began with the support of an Environmental Management Department responsible for controlling, supervising, and monitoring the implementation of those control measures. She indicated that there is also an Environmental Officer before SETENA, who is responsible for issuing environmental oversight reports on progress in applying such measures, with a total of 10 reports filed to date. She stated that spoil-disposal site No. 12 is located in the Tigre stream micro-watershed and, contrary to the petitioner’s assertion, lies within the area assessed in the Environmental Impact Study. The area has the environmental viability granted by the Technical Secretariat, principally with respect to its use and that of the reservoir area. She explained that, according to the work program, the preliminary activities to prepare spoil-disposal site No. 12 involved intervention in the forested area located within the zone of influence and micro-watershed of the Tigre stream, as well as the felling of trees.Nevertheless, a permit for those purposes was processed before the Siquirres-Matina Subregional Office of the Ministry of Environment, Energy and Telecommunications, which granted it by resolution No. 047-2011-OSSM (IF) of 5 de abril de 2011. In addition, through communication No. CAN-034-2011 of the National Archaeological Commission, the recommendations of the Project’s archaeology group regarding the use of the site as a spoil-disposal area were approved. She stated that geologist Martha Chavés Quirós, biologist Jorge Leiva Navarro, and other officials of the Reventazón Hydroelectric Project conducted an inspection in febrero de 2011 of the area where spoil-disposal site No. 12 is located, concluding that: “No evidence was observed in the field of the presence of a permanent spring on the property of spoil-disposal site 12; rather, this is surface-water flow that remains at that point due to the topographic configuration and the presence of low-permeability rocks.The high-humidity and high-precipitation conditions occurring in the area contribute to the permanent moisture in the soil, which is not necessarily associated with regional groundwater levels surfacing at the site. In view of the foregoing, these conditions can be expected always to remain present, also considering the climatic conditions of the area, which must be taken into account in the design and configuration of the spoil-disposal site and in order to prevent problems, principally with site stability, through a sound design for the drainage pattern, slopes, and water discharge.” She stated that the management of runoff water at the spoil-disposal site included the construction of stone drains and earthen or lined ditches and, in parallel, sediment-control barriers were installed and sediment traps were excavated to control the transport of particles into bodies of water, particularly the Tigre stream.Furthermore, the Environmental Management Plan approved by the Technical Secretariat defined a Flora and Fauna Rescue Plan establishing the actions to be followed for their proper management. In this regard, she asserted that, because this involves the implementation of an environmental control measure associated with an EMP, they are addressing environmental impacts and not “damage,” as the petitioner claims. She indicated that the rescue of flora and fauna in the area of spoil-disposal site No. 12, which is within the zone of influence or micro-watershed of the Tigre stream, follows a protocol applied in three stages: “the first consists of extracting flora and fauna and intervening in the understory to force the migration of species; the second occurs when the forestry unit carries out felling operations; and the last when mechanized earthmoving is performed.” Regarding the animals rescued within the spoil-disposal site, she stated that reptiles were the most highly represented group, followed by amphibians and mammals, for a total of 145 animals rescued.She explained that the rescued animals are taken to the Rescued Wildlife Care Center, where they are identified and transferred to sites evaluated for their relocation. In addition, a total of 23 orchids, belonging principally to the genera Triginidium sp. and Epidendrum, were rescued and also relocated to protected areas within the property of the Costa Rican Electricity Institute. She stated that, in accordance with the authorization granted by resolution No. 047-2011 OSSM (IF) of the Siquirres-Matina Subregional Office of the La Amistad-Caribbean Conservation Area, 27 trees of species such as anonillo, jobo, caimito, and guaba had been felled to date, and the forest-covered area where the trees were felled was approximately 1 hectare. Regarding the alleged destruction of the roads, she explained that the public section of road No. 3 is being repaired to provide access to a terrace near the Reventazón River, where other roads associated with the dam and spillway will be constructed.For these purposes, authorization was obtained from the Municipality of Siquirres through communication No. AMS-692-2010, and prior to this work, the existing roadway was widened and improved. Finally, she clarified that the area where the trees were felled did not contain settlements at risk of extinction. Based on the foregoing, she requested that the petition be denied.
  4. 4Andrei Bourrouet Vargas, in his capacity as Acting Minister of Environment, Energy and Telecommunications, reported under oath that communication No. OSSM-395 of 15 de junio de 2011 from the Siquirres-Matina Subregional Office of the La Amistad-Caribbean Conservation Area—SINAC-MINAET—stated that the area mentioned by the petitioner is a rainwater-catchment area, from which the water is channeled to the Tigre stream and ultimately discharged into the Reventazón River. This area is known as spoil-disposal site No. 12 and has a permit from the State Forestry Administration for the felling and harvesting of 28 trees in a “non-forest” area, pursuant to the provisions of the Ley Forestal. The project was approved by resolutions Nos. 047-2011-OSSM and 131-2010-OSSM and, for construction purposes, has an Environmental Impact Assessment approved by resolution No. 1778-2009 SETENA issued at 8 hrs. on 29 de julio de 2009. It also has a Declaration of National Convenience and Public Interest pursuant to Decreto Ejecutivo No. 35603-MINAET of 8 de abril de 2010. He alleged that the Ministry is not carrying out work in the reported area and that its actions have complied with the principle of legality; accordingly, he requested that the petition be denied.
  5. 5Uriel Juárez Baltodano, in his capacity as Secretary General of the Secretaría Técnica Nacional Ambiental, reported under oath that on 29 de enero de 2008 the Secretaría received official letter No. 45-0014-2008, by which the Instituto Costarricense de Electricidad submitted the terms of reference for the environmental impact study (estudio de impacto ambiental) of the Proyecto Hidroeléctrico Reventazón and requested the formation of an Evaluation Subcommittee (Subcomisión de Evaluación), in accordance with the provisions of the Manual de Instrumentos Técnicos para el Proceso de Evaluación de Impacto Ambiental. He stated that on 17 de marzo de 2008, that entity submitted the Initial Environmental Assessment (Evaluación Ambiental Inicial) of the Project in question, which was assigned expediente No. 331-2008-SETENA. He indicated that, through resolution No. 1204-2008-SETENA of 2 de mayo de 2008, the terms of reference for preparing the Project’s Environmental Impact Study (Estudio de Impacto Ambiental) were established, and the study was submitted to the Secretaría on the following 23 de setiembre.On 10 de diciembre de 2008, the Mayor of Siquirres and his staff were received at a private oral hearing, where they requested an extension of the deadline for submitting their observations regarding the Project. The Comisión Plenaria extended that deadline, at session No. 002-2009 of 6 de enero de 2009, until 31 de enero de 2009. He asserted that on 26 de diciembre de 2008, officials of the Instituto Costarricense de Electricidad appeared before the Comisión Plenaria and described the public participation processes (procesos de participación ciudadana) facilitated for the Project, and that on 17 de diciembre de 2008, the Director of the Centro de Gestión Ambiental of that Institute sent official letter No. 4501-0222-2008, together with the documents delivered to the 14 communities in the area. He added that on 26 de enero de 2009, through official letter No. CP-018-2009-SETENA, the Municipalidad de Siquirres was notified of the date, time, and place of the hearing it had requested to present its concerns; the hearing was held on 5 de febrero de 2009, with only the Comisión Plenaria in attendance.Accordingly, because the municipal officials failed to appear, it was agreed to maintain the deadline established in official letter No. CP-018-2009-SETENA—until 13 de febrero de 2009—for the Municipality to submit its observations regarding the Proyecto Hidroeléctrico. That decision was notified to the Mayor and the Concejo Municipal through official letter No. SG-093-2009-SETENA. On 24 de febrero de 2009, through resolution No. 451-2009, the Instituto Costarricense de Electricidad was asked to submit an Annex (Anexo) to the Proyecto Hidroeléctrico, and on 18 de marzo de 2009, as recorded in the minutes of ordinary session No. 029-2009-SETENA, the Comisión Plenaria agreed to accept the proposal submitted by the Institute “(…) to provide, in the environmental-manager reports (informes regenciales), the owners’ authorizations and the cadastral plans (planos catastrados) as the properties are acquired (…)”.On 3 de abril de 2009, the requested Annex was submitted to the Departamento de Evaluación Ambiental; it emphasized that 71% of the properties required for construction of the works were available and registered in the entity’s name, leaving the remaining 29% to be acquired. He explained that through resolution No. 1298-2009-SETENA of 3 de junio de 2009, the Secretaría approved the Project Annex and requested the submission of a Sworn Declaration of Environmental Commitments (Declaración Jurada de Compromisos Ambientales), the appointment of an environmental officer (responsable ambiental), an environmental logbook (bitácora ambiental), and the deposit of an environmental bond (garantía ambiental). He added that on 9 de junio de 2009, an appeal (recurso de apelación) was filed against resolution No. 1298-2009-SETENA, in which the petitioner alleged that he was directly affected by the flooding of properties No. 7-119019-000 and 7-1479-000 and that the private interests of their possessors had not been taken into account.Through official letter No. R-313-2009-MINAET of 8 de julio de 2009, the Ministro de Ambiente, Energía y Telecomunicaciones denied the appeal. He explained that on 19 de junio de 2009, the documents requested by the Secretaría in the resolution of the preceding 3 de junio were submitted, and through resolution No. 1778-2009-SETENA at 8 hrs. on 29 de julio de 2009, the Comisión Plenaria ordered as follows: “Environmental feasibility (viabilidad ambiental) is granted to the Proyecto Hidroeléctrico Reventazón under expediente No. 331-08, as well as for the construction and operation of the following works related to its execution: central worksite, cafeteria and main clinic, wastewater treatment plants and storage service stations for on-site consumption, as well as the use of bodies of water for human consumption and construction purposes and works within a publicly owned watercourse (cauce de dominio público) (…)”.He stated that on 4 de agosto de 2009, the Alcalde Municipal de Siquirres filed a motion for reconsideration with a subsidiary appeal (recurso de revocatoria con apelación en subsidio) against the preceding resolution, which was denied through resolution No. 2264-2009-SETENA of 23 de setiembre de 2009. On 1º de setiembre de 2009, the Municipalidad de Siquirres sent the Secretaría official letter No. AMS-635-09, requesting a series of clarifications that were addressed through official letter No. CP-258-2009 of 6 de octubre de 2009. He recounted that through resolution No. 448-2010 of 2 de marzo de 2010, the Secretaría Técnica Nacional Ambiental authorized the modification of the Proyecto Hidroeléctrico, and through official letter No. 4501-054-2010 of 17 de marzo de 2010, the Director of the Centro de Gestión Ambiental submitted a new Sworn Declaration (Declaración Jurada). On 21 de enero de 2011, the request to expand spoil-disposal site (escombrera) No. 3 of the Proyecto Hidroeléctrico Reventazón was clarified, and through resolution No. 320-2011 of 8 de febrero de 2011, the expansion was authorized.Finally, he reported that official letter No. DEA-1834-2011 of 15 de junio de 2011 from the Departamento de Evaluación Ambiental and the Auditoría y Seguimiento Ambiental stated that ICE had conducted fish monitoring in quebrada Tigre to plan the environmental oversight (control ambiental) of the works. ICE also has terrestrial and aquatic wildlife rescue plans, reforestation plans, and environmental measures to mitigate and/or offset the impacts that the project would generate during both its construction and operational phases. He considered that the Secretaría had not violated any constitutional provisions and therefore requested that the petition be denied.
  6. 6Krisbell Ríos Myrie, in her capacity as Presidenta Municipal de Siquirres, reported under oath that the Municipalidad’s responsibility regarding the Proyecto Hidroeléctrico was limited to granting municipal permits, negotiating works, and maintaining and authorizing municipal roads. She explained that the tree-felling and species-rescue procedure is governed by the Environmental Impact Studies prescribed by the Secretaría Técnica Nacional Ambiental and that the permits must be administered under the strict oversight of the Ministerio de Ambiente, Energía y Telecomunicaciones. In view of the foregoing, she requested that the petition be denied.
  7. 7Karen Mayorga Quirós, in her capacity as Directora del Área Rectora de Salud de Siquirres, reported under oath that the Proyecto Hidroeléctrico on the río Reventazón was endorsed through resolution No. 1778-2009 of the Secretaría Técnica. She stated that before the works contemplated in the Project were undertaken, various meetings were held with the communities in the area, at which the scope and effects of the Project were explained to them. She explained that the Área Rectora de Salud de Siquirres authorized the group of works proposed for the third stage of the project through health operating permit (Permiso sanitario de funcionamiento) No. DARSS-0184-2011. She indicated that the Área Rectora also approved the location of a Wastewater Treatment Plant (Planta de Tratamiento de Aguas Residuales) through health operating permit No. DARS-2010-0474, and that authorization to discharge water at the plant is recorded in resolution No. R-0799-2009 of the Departamento de Aguas del Ministerio de Ambiente, Energía y Telecomunicaciones.Likewise, under Municipal Siting Resolution (resolución Municipal de Ubicación) No. DI-DRU-136-2009, the Municipalidad de Siquirres stated that the plant’s location complied with the Municipality’s legal requirements. She affirmed that the construction plans for the aforementioned plant were approved by the regional authorities of the Unidad de Rectoría de la Salud, Regulación de la Salud, through official letter No. HA-URS-CRS-0609-2010. The authorities of the Área Rectora de Salud de Siquirres also approved the installation of a medical clinic at the Project’s central worksite through health operating permit No. 2010-0275 and, through health permit (Permiso sanitario) No. DARSS-0301-S-2011, allowed the installation and operation of an Institutional Cafeteria until 18 de junio de 2012. She asserted that the matter raised by the petitioner did not fall within the jurisdiction of the Ministerio de Salud and that the Customer Service Process contained no formal complaint regarding the damage alleged in this amparo proceeding (amparo).She reiterated that the governing authority had verified, before the project was implemented, that all requirements established by the country’s regulations had been met; she therefore requested that the petition be denied.
  8. 8By written instrument dated 28 de junio de 2011, the Secretario de la Sala Constitucional certified that it did not appear that, from 16 al 27 de junio de 2011, the Presidente del Tribunal Ambiental Administrativo, the Alcalde Municipal de Siquirres, or the Jefe de la Oficina Subregional del Ministerio de Ambiente, Energía y Telecomunicaciones de Siquirres had submitted any written filing for the purpose of providing the report ordered in the ruling issued at 10:38 hours on 9 de junio de 2011.
  9. 9The statutory requirements have been observed in the processing of these proceedings.

Opinion drafted by Magistrada Abdelnour Granados; and,

WHEREAS:

I. SUBJECT MATTER OF THE PETITION

The petitioner alleges that, through the development of the Proyecto Hidroeléctrico Reventazón, the Instituto Costarricense de Electricidad is causing serious environmental damage in the forested areas of the río Reventazón and quebrada Tigre. In his view, those works are being carried out in violation of environmental legislation; he therefore considers his right to a healthy and ecologically balanced environment to have been infringed.

II. PROVEN FACTS

The following facts relevant to deciding this amparo proceeding are deemed established:

  • 1)The Reventazón Hydroelectric Project being developed by the Costa Rican Electricity Institute in the middle basin of this river is located in the districts of Siquirres and Florida, canton of Siquirres, province of Limón (report of the Costa Rican Electricity Institute, available in the digital case file).
  • 2)By official letter No. 4501-0014-2008 of 29 January 2008, the Costa Rican Electricity Institute submitted to the National Environmental Technical Secretariat the terms of reference for the Environmental Impact Study of the Reventazón Hydroelectric Project and requested the formation of an Evaluation Subcommittee (official letter available in the copy of administrative file No. 331-2008-SETENA attached to the SETENA report).
  • 3)On 17 March 2008, the Costa Rican Electricity Institute submitted the Initial Environmental Assessment for that Hydroelectric Project to the National Environmental Technical Secretariat (SETENA report).
  • 4)By resolution No. 1204-2008-SETENA of 2 May 2008, the terms of reference for the Environmental Impact Study of that Project were established (SETENA report).
  • 5)On 23 September 2008, the Costa Rican Electricity Institute submitted the Environmental Impact Study for the Reventazón Hydroelectric Project to the National Environmental Technical Secretariat (SETENA report).
  • 6)By resolution No. 451-2009 of the National Environmental Technical Secretariat, dated 24 February 2009, the Costa Rican Electricity Institute was requested to submit an Annex (SETENA report).
  • 7)On 3 April 2011, the requested material was submitted to the SETENA Environmental Assessment Department (SETENA report).
  • 8)By resolution No. 1298-2009-SETENA of 8:35 hrs. on 3 June 2009, the Plenary Commission of the National Technical Secretariat approved the Annex to the Reventazón Hydroelectric Project and required the Costa Rican Electricity Institute to submit a Sworn Declaration of Environmental Commitments, appoint an environmental officer, maintain an environmental logbook, and deposit an environmental bond before commencing the works (the record).
  • 9)On 19 June 2011, those documents were submitted (resolution attached to the SETENA report).
  • 10)By resolution No. 1778-2009-SETENA of 8 hrs. on 29 July 2009, the Plenary Commission of the National Environmental Technical Secretariat ordered as follows: “Environmental approval is granted to the Reventazón Hydroelectric Project under file No. 331-08, as well as for the construction and operation of the following works related to its implementation: central worksite, dining hall and main clinic, wastewater treatment plants and storage service stations for internal consumption, as well as the use of bodies of water for human consumption and construction purposes and works within publicly owned watercourses (…)” (resolution attached to the SETENA report).
  • 11)By resolution No. R-0799-2009 of 7:30 hrs. on 28 September 2009, the Water Department of the Ministry of Environment, Energy and Telecommunications granted the Reventazón Hydroelectric Project a wastewater discharge permit (resolution attached to the report of the Health Governing Area).
  • 12)According to resolution No. DI-DRU-136-2009 of the Municipality of Siquirres, the location of the Reventazón Hydroelectric Project’s wastewater treatment plant complied with legal requirements (report of the Health Governing Area).
  • 13)By Executive Decree No. 35503-MINAET of 8 April 2010, the Reventazón Hydroelectric Project was declared to be of National Convenience and Public Interest (SETENA report).
  • 14)On 26 August 2010, the Health Governing Area of Siquirres, Huetar Atlántica region, granted sanitary operating permit No. DARS-2010-0474 for the location of a wastewater treatment plant at the Reventazón Hydroelectric Project (sanitary permit attached to the report of the Health Governing Area).
  • 15)By Official Letter No. AMS-692-2010 of 1 October 2010, the Municipality of Siquirres authorized the repair of the public section of road No. 3 of the Reventazón Hydroelectric Project (official letter attached to the report of the Costa Rican Electricity Institute).
  • 16)On 16 December 2010, the Health Governing Area of Siquirres granted sanitary operating permit No. DARSS-2010-678 for the second-stage works at that Project’s central worksite (sanitary permit attached to the report of the Health Governing Area).
  • 17)By official letter No. HA-URS-CRS-0609-2010, the construction plans for the wastewater treatment plant at the Reventazón Hydroelectric Project were approved by the regional authorities of the Health Governance and Health Regulation Unit (report of the Health Governing Area).
  • 18)Spoil disposal site No. 12 is located in the micro-watershed of the Tigre stream, within the area assessed in the Project’s Environmental Impact Study, and therefore has environmental approval (report of the Costa Rican Electricity Institute).
  • 19)In an inspection report on spoil disposal site No. 12 dated 4 February 2011, Engineer William Solano Ocampo, Biologist Jorge Leiva Navarro, Engineer Alexandra Suárez Castro, and Geologist Marta Chaves Quirós concluded: “No evidence was observed on the land of the presence of a permanent spring on the property of spoil disposal site 12; rather, it consists of surface-water flow that remains at that point because of the topographic configuration and the presence of low-permeability rocks. The high-humidity and precipitation conditions in the area contribute to the soil remaining permanently moist, which is not necessarily associated with regional groundwater levels surfacing at the site. In view of the foregoing, these conditions can be expected always to remain present, also considering the climatic conditions of the area; this must be taken into account in the design and formation of the spoil disposal site and, in particular, to prevent problems with site stability through a sound design of drainage patterns, slopes, and water outlets” (document attached to the report of the Costa Rican Electricity Institute).
  • 20)By resolution of the Plenary Commission of the National Environmental Technical Secretariat, No. 320-2011-SETENA of 8:35 on 8 February 2011, the Costa Rican Electricity Institute’s request to expand the Project’s environmental approval and the size of spoil disposal site No. 3 was approved (resolution attached to the SETENA report).
  • 21)By resolution No. 047-2011-OSSM (IF) of 11 hrs. on 5 April 2011, issued by the Siquirres-Matina Subregional Office of the La Amistad-Caribe Conservation Area, the felling and harvesting of 28 trees on properties located within the Project was authorized (resolution available in administrative file No. AC-02-PUA-IF-138-2010-S, attached to the report of the Costa Rican Electricity Institute).
  • 22)On 7 April 2011, the Health Governing Area of Siquirres granted sanitary operating permit No. DARSS-0184-2011 for the third-stage works at the central worksite of the Reventazón Hydroelectric Project (sanitary permit attached to the report of the Health Governing Area).
  • 23)According to the Siquirres-Matina Subregional Office of the La Amistad-Caribe Conservation Area, the area of spoil disposal site No. 12 “(…) is a rainwater catchment area from which the water is channeled to the Tigre stream and discharged into the Reventazón River. (…) it is not a spring or stream, but rather a water-collection area (…)” (official letter No. OSSM-395 of 15 June 2011, attached to the MINAET report).
  • 24)According to Oversight Report No. 1 for the Reventazón Hydroelectric Project, of undetermined date, the Costa Rican Electricity Institute conducted fish monitoring in the Tigre Stream, which “(…) has facilitated the planning of environmental control for the works, because knowing the diversity at particular sites makes it possible to anticipate the effect of works on the biodiversity of bodies of water, as well as to plan control measures” (official letter No. DEA-1834-2011 of the SETENA Department of Environmental Assessment and Environmental Monitoring, dated 15 June 2011 and attached to the SETENA report).
  • 25)The environmental control measures contemplated in the Environmental Impact Study for the Reventazón Hydroelectric Project include: “(…) the construction of 4,5 km of sidewalks, patching of 3,4 km of roads, sediment control during excavation processes, solid-waste management, archaeological assessments, biological studies and monitoring, rescue of flora and fauna, forest inventories and felling, revegetation of slopes, production of trees in a forest nursery, repair of local roads, and implementation of environmental education, local development, and literacy programs, as well as periodic meetings with community and institutional representatives to follow up on the established compensation measures.” (report of the Costa Rican Electricity Institute).
  • 26)The Reventazón Hydroelectric Project has an Environmental Management Plan (PGA) that brings together environmental measures intended to prevent, correct, mitigate, or compensate for the environmental impacts it generates (report of the Costa Rican Electricity Institute).
  • 27)The Reventazón Hydroelectric Project includes a Flora and Fauna Rescue Plan, under which the plant and animal species residing in the area of spoil disposal site No. 12 are rescued and relocated (report of the Costa Rican Electricity Institute).

III. SPECIFIC CASE

It has been fully and properly established that, before the corresponding works commenced, the respective Environmental Impact Assessment was completed and the Project obtained environmental approval—resolution No. 1778-2009-SETENA of the Plenary Commission of the National Environmental Technical Secretariat, issued at 8 hrs. on 29 July 2009. In this regard, the Project’s potential environmental impacts were duly anticipated by the respondent entity and, on that basis, the environmental control measures capable of mitigating and/or compensating for them were also planned. In this regard, it cannot be overlooked that the Project has an Environmental Management Plan and that, although a portion of the forest located within the area of influence had to be disturbed, entailing the felling of trees, the respondents deny that these were endangered varieties. In addition, the existence of a plan to rescue the flora and fauna of the area, which provides for the relocation of the collected species, was established.

It was also shown that the Costa Rican Electricity Institute obtained the respective sanitary operating permits from the Health Governing Area of Siquirres, as well as authorization from the Municipality of the canton for road repairs and the construction of other works inherent to the Project. Likewise, it was granted a permit by the Water Department of the Ministry of Environment, Energy and Telecommunications for the discharge of wastewater and the location of its treatment plant. Additionally, the record shows that the necessary measures were taken to determine the nature of the water flowing at spoil disposal site No. 12, and it was ruled out that it was a permanent spring. Accordingly, this Chamber finds that the respondent authorities did, in fact, carry out appropriate environmental administrative management in their assessment of the Reventazón Hydroelectric Project; the alleged violation of Article 50 of the Constitution must therefore be rejected.

IV. COROLLARY

In view of the foregoing, the appeal filed must be dismissed.

Recurso de amparo interpuesto por GABRIEL CABRERA ZÚÑIGA, portador de la cédula de identidad No. 6-0218-0861, contra el INSTITUTO COSTARRICENSE DE ELECTRICIDAD, el MINISTERIO DE AMBIENTE, ENERGÍA Y TELECOMUNICACIONES, la SECRETARÍA TÉCNICA NACIONAL AMBIENTAL, la MUNICIPALIDAD DE SIQUIRRES, el MINISTERIO DE SALUD y el TRIBUNAL AMBIENTAL ADMINISTRATIVO.

RESULTANDO:

  1. 1Por escrito recibido en la Secretaría de la Sala a las 16:25 horas de 8 de junio de 2011, el recurrente interpuso recurso de amparo contra el Instituto Costarricense de Electricidad y otros. Manifestó, que esta entidad se encuentra causando “daños ambientales de grandes proporciones” en la quebrada Tigre, la cual se ubica en Guayacán de Siquirres, Distrito 1°. Alegó, que en la zona existe una biodiversidad de animales en peligro de extinción -entre estos, la rana roja y el tucán-, a los cuales se está destruyendo su hábitat, así como árboles de cedro, laurel y otros tipos, que han sido talados, indebidamente. Por lo anterior, estimó vulnerados sus derechos fundamentales y solicitó, que se declare con lugar el presente recurso.
  2. 2Mediante resolución de las10:38 horas de 9 de junio de 2011, se dio curso al proceso y se solicitó informe al Gerente General del Instituto Costarricense de Electricidad, al Viceministro y al Jefe de la Oficina Subregional de Siquirres, ambos del Ministerio de Ambiente, Energía y Telecomunicaciones; a la Secretaria Técnica Nacional Ambiental, al Alcalde Municipal y al Presidente del Concejo Municipal, ambos de la Municipalidad de Siquirres; a la Directora del Área Rectora de Salud de Siquirres y al Presidente del Tribunal Ambiental Administrativo.
  3. 3Informó bajo juramento Ileana Camacho Rodríguez, en su condición de Apoderada General Judicial del Instituto Costarricense de Electricidad, que el Proyecto Hidroeléctrico Reventazón aprovecha las aguas que fluyen hacia el río Reventazón, mediante la construcción de una presa en un estrechamiento natural de su cauce y la mayoría de las obras se localizan en su margen derecho –vertedero, toma de aguas, túnel, tanque de oscilación, tubería forzada, casa de máquinas y subestación-. Señaló, que mediante oficio del Consejo Directivo del Instituto Costarricense de Electricidad, No. 0012-138-2010, se aprobó unanimidad el desarrollo del Proyecto en cuestión, en los distritos de Siquirres y Florida, del cantón Siquirres en la provincia de Limón. En específico, mencionó que el Proyecto se ubica en la cuenca media del río Reventazón, aproximadamente, a 8 km al suroeste de la ciudad de Siquirres y a 38 km aguas abajo del sitio de restitución de la casa de máquinas de la Planta Hidroeléctrica Angostura.Además, que el Proyecto Hidroeléctrico hace uso del agua del río entre las cotas de 265 msnm y 120 msnm. Apuntó, que el Proyecto se encuentra en etapa de construcción desde septiembre de 2009, cuando iniciaron los trabajos de reparación del camino de acceso al plantel central o camino No. 1 y del camino principal de acceso a las obras del margen derecho, denominado camino No. 2. Esto, con base en la viabilidad ambiental otorgada por la Secretaría Técnica Nacional Ambiental, mediante resolución No. 1778-SETENA de julio de 2009. Agregó, que en la ejecución del Proyecto Hidroeléctrico Reventazón se ha cumplido todas las fases de evaluación ambiental establecidas en el “Reglamento General sobre los Procedimientos de Evaluación de Impacto Ambiental)” y al 14 de junio de 2011, se cuenta con un avance del 22% de las obras. Alegó, que la Institución ha trabajado en las medidas de control ambiental indicadas en el Estudio de Impacto Ambiental presentado a la Secretaría Técnica Nacional Ambiental, entre ellas: “(…) la construcción de 4,5 km de aceras, bacheo de 3,4 km de caminos, control de sedimentos en los procesos de excavación, gestión de residuos sólidos, evaluaciones arqueológicas, estudios y monitoreos biológicos, rescate de flora y fauna, inventarios forestales y corta, revegetación de taludes, producción de árboles en vivero forestal, reparación de caminos vecinales y ejecución de los programas de educación ambiental, desarrollo local y alfabetización, así como reuniones periódicas con representantes comunales e institucionales para dar seguimiento a las medidas de compensación establecidas.” Recalcó, que profesionales del Instituto confeccionaron un “Pronóstico- Plan de Gestión Ambiental” que agrupa las medidas ambientales para la prevención, corrección, mitigación o compensación de los impactos ambientales que se pudieran causar.Además, una vez otorgada la viabilidad ambiental inició la etapa de gestión ambiental del proyecto, con el apoyo de un Departamento de Gestión Ambiental encargado de controlar, supervisar y dar seguimiento a la ejecución de dichas medidas de control. Indicó, que existe también un Responsable Ambiental ante la SETENA, quien se encarga de emitir los informes de regencia ambiental sobre los avances en la aplicación de tales medidas, registrándose, a la fecha, un total de 10 informes-. Mencionó, que la escombrera No. 12 se encuentra en la microcuenca de la quebrada Tigre y contrario a lo que indica el recurrente, se ubica dentro del área evaluada en el Estudio de Impacto Ambiental. La zona cuenta con la viabilidad ambiental otorgada por la Secretaría Técnica en lo que respecta, principalmente, a su uso y el de la zona del embalse. Relató, que de acuerdo con el programa de trabajo, las actividades preliminares para la habilitación de la escombrera No. 12 implicaron una intervención en el área de bosque ubicada en la zona de influencia y microcuenca de la quebrada Tigre, así como la corta de árboles.No obstante, para tales efectos se tramitó un permiso ante la Oficina Subregional Siquirres-Matina del Ministerio de Ambiente, Energía y Telecomunicaciones, el cual lo otorgó mediante resolución No. 047-2011-OSSM (IF) de 5 de abril de 2011. Además, por oficio de la Comisión Arqueológica Nacional, No. CAN-034-2011, se aprobaron las recomendaciones del grupo de arqueología del Proyecto, referentes a la utilización del sitio como escombrera. Refirió, que la geóloga Martha Chavés Quirós, el biólogo Jorge Leiva Navarro y otros funcionarios del Proyecto Hodroeléctrico Reventazón, en febrero de 2011 realizaron una inspección en la zona donde se ubica la escombrera No. 12, concluyendo que: “No se observaron evidencias en el terreno de la presencia de un manantial permanente en la propiedad de la escombrera 12, se trata del flujo de aguas superficiales que se mantienen en ese punto debido a la conformación topográfica y a la presencia de rocas de baja permeabilidad.Las condiciones de alta humedad y precipitación que se dan en la zona contribuyen a que se mantenga una humedad permanente en el suelo, lo cual no ésta asociado necesariamente a niveles de agua subterránea regionales que estén aflorando en el sitio. Debido lo anterior, es de esperar que dichas condiciones se mantengan siempre presente, considerando además, las condiciones climáticas de la zona, lo cual debe ser tomado en cuenta para el diseño y conformación de la escombrera y para evitar problemas principalmente en la estabilidad del sitio, con un buen diseño de patrón de drenajes, taludes y de desfogue de aguas”. Señaló, que para el manejo de las aguas de escorrentía en la escombrera, se contempló la conformación de drenajes en piedra y cunetas en tierra o revestidas y, paralelamente, se instalaron barreras de control de sedimentos y se excavaron sedimentadotes para controlar el arrastre de partículas hacia los cuerpos de agua, en particular, hacia la quebrada Tigre.Por otra parte, en el Plan de Gestión Ambiental aprobado por la Secretaría Técnica, se definió un Plan de Rescate de Flora y Fauna, donde se establecieron las acciones a seguir para su adecuada gestión. En este sentido, adujo que al tratarse de la ejecución de una medida de control ambiental, asociada a un PGA, están atendiendo impactos ambientales y no “daños”, como estima el recurrente. Indicó, que el rescate de la flora y fauna en el área de la escombrera No. 12, misma que está en el área de influencia o microcuenca de la quebrada Tigre, cuenta con un protocolo que se aplica en tres etapas: “la primera consiste en la extracción de flora y fauna, así como intervención del soto bosque para forzar la migración de especies; la segunda cuando la unidad forestal hace maniobras de corta, y por último cuando se hace la acción de movimiento mecanizado del suelo.” En cuanto a los animales rescatados dentro de la escombrera, mencionó que el grupo con más representación corresponde al de los reptiles, seguido por el de los anfibios y los mamíferos, rescatándose así un total de 145 animales.Explicó, que los animales rescatados son llevados al Centro de Atención de Fauna Rescatada, donde se identifican y trasladan a sitios valorados para su reubicación. Por otro lado, se rescataron un total de 23 orquídeas pertenecientes, principalmente, a los géneros Triginidium sp. y Epidendrum, las cuales también fueron reubicadas en zonas de protección dentro de la propiedad del Instituto Costarricense de Electricidad. Afirmó, que según lo autorizado en la resolución No. 047-2011 OSSM (IF) de la Oficina Subregional Siquirres- Matina del Área de Conservación La Amistad- Caribe, a la fecha se han cortado 27 árboles de especies como anonillo, jobo, caimito y guaba y el área de cobertura boscosa donde se realizó la corta de árboles fue de, aproximadamente, 1 hectárea. Respecto a la alegada destrucción de los caminos, explicó, que el camino No. 3 está siendo reparado en su tramo público para brindar acceso a una terraza cercana al río Reventazón, en la cual se construirán otros caminos asociados a la presa y al vertedero.Para tales efectos, mediante oficio No. AMS-692-2010 se obtuvo autorización de la Municipalidad de Siquirres y previo a dichos trabajos, se realizaron labores de ampliación y mejoramiento de la vía existente. Finalmente, aclaró que la zona donde se efectuó la corta de árboles, no presentaba poblados en riesgo de extinción. Por lo descrito, solicitó que se declare sin lugar el recurso.
  4. 4Informó bajo juramento, Andrei Bourrouet Vargas, en su condición de Ministro a.i de Ambiente, Energía y Telecomunicaciones, que en oficio de la Oficina Subregional Siquirres Matina del Área de Conservación La Amistad Caribe –SINAC- MINAET, No. OSSM-395 de 15 de junio de 2011, se indicó que la zona mencionada por el recurrente corresponde a un área de captación de aguas pluviales, las cuales son encausadas hasta la quebrada Tigre y, finalmente, depositadas en el río Reventazón. Esta zona se denomina escombrera No. 12 y cuenta con permiso de la Administración Forestal del Estado para la corta y aprovechamiento de 28 árboles en un área de “no bosque”, de conformidad con lo dispuesto en la Ley Forestal. El proyecto fue aprobado mediante resoluciones Nos. 047-2011-OSSM y 131-2010-OSSM y para efectos constructivos, cuenta con una Evaluación de Impacto Ambiental, aprobada mediante resolución No. 1778-2009 SETENA de las 8 hrs. de 29 de julio de 2009. Asimismo, cuenta con la Declaratoria de Conveniencia Nacional e Interés Público, según Decreto Ejecutivo No. 35603-MINAET de 8 de abril de 2010. Alegó, que el Ministerio no se encuentra realizando obras en la zona denunciada y su actuación se ha apegado al principio de legalidad, por lo cual solicitó que se declare sin lugar el recurso.
  5. 5Informó bajo juramento, Uriel Juárez Baltodano, en su condición de Secretario General de la Secretaría Técnica Nacional Ambiental, que el 29 de enero de 2008 se recibió en la Secretaría el oficio No. 45-0014-2008, mediante el cual, el Instituto Costarricense de Electricidad presentó los términos de referencia del estudio de impacto ambiental del Proyecto Hidroeléctrico Reventazón y solicitó la conformación de una Subcomisión de Evaluación, de conformidad con lo establecido en el Manual de Instrumentos Técnicos para el Proceso de Evaluación de Impacto Ambiental. Mencionó que el 17 de marzo de 2008, ese ente envió la Evaluación Ambiental Inicial del Proyecto en cuestión y se procedió a asignársele el expediente No. 331-2008-SETENA. Señaló, que mediante resolución No. 1204-2008-SETENA de 2 de mayo de 2008, se fijaron los términos de referencia para la elaboración del Estudio de Impacto Ambiental del Proyecto, el cual se presentó en la Secretaría el 23 de setiembre siguiente.El 10 de diciembre de 2008, se recibió en audiencia oral y privada al Alcalde de Siquirres y a sus colaboradores, quienes solicitaron una extensión del plazo para emitir sus observaciones al Proyecto. Dicho plazo fue prorrogado por la Comisión Plenaria, en sesión No. 002-2009 de 6 de enero de 2009, hasta el 31 de enero de 2009. Adujo, que el 26 de diciembre de 2008 se recibió en la Comisión Plenaria a funcionarios del Instituto Costarricense de Electricidad, quienes dieron a conocer los procesos de participación ciudadana que fueron facilitados en el Proyecto y el 17 de diciembre de 2008, el Director del Centro de Gestión Ambiental de ese Instituto envió el oficio No. 4501-0222-2008, con los documentos trasladados a las 14 comunidades de la zona. Agregó, que el 26 de enero de 2009, mediante oficio No. CP-018-2009-SETENA se comunicó a la Municipalidad de Siquirres la fecha, hora y el lugar de la audiencia que solicitó para única presencia de la Comisión Plenaria.En este sentido, al ausentarse los funcionarios municipales, se acordó proseguir con el plazo establecido en el oficio No. CP-018-2009-SETENA –hasta el 13 de febrero de 2009-, para que el Municipio presentara sus observaciones al Proyecto Hidroeléctrico. Dicho acuerdo fue notificado al Alcalde y al Concejo Municipal, mediante oficio No. SG-093-2009-SETENA. El 24 de febrero de 2009, por resolución No. 451-2009 se solicitó al Instituto Costarricense de Electricidad que presentara un Anexo al Proyecto Hidroeléctrico y el 18 de marzo de 2009, mediante acta de la sesión ordinaria No. 029-2009-SETENA, la Comisión Plenaria acordó aceptar la propuesta presentada por el Instituto “(…) de suministrar en los informes regenciales la autorización de los propietarios y los planos catastrados según se vayan adquiriendo las propiedades (…)”. El 3 de abril de 2009, el Anexo solicitado a éste fue presentado en el Departamento de Evaluación Ambiental, en el cual se destacó que se disponía del 71% de las propiedades para la construcción de las obras y que se encontraban inscritas a nombre de la entidad, quedando por adquirir un 29% restante.Detalló, que mediante resolución No. 1298-2009-SETENA de 3 de junio de 2009, la Secretaría aprobó el Anexo al Proyecto y solicitó la presentación de una Declaración Jurada de Compromisos Ambientales, el nombramiento de un responsable ambiental, una bitácora ambiental y el depósito de una garantía ambiental. Agregó, que el 9 de junio de 2009, se recibió un recurso de apelación contra la resolución No. 1298-2009-SETENA, en el cual el accionante alegó verse, directamente, afectado por la inundación de las fincas No. 7-119019-000 y 7-1479-000 y que no se tomaron en cuenta los intereses privados de sus poseedores, recurso que mediante oficio No. R-313-2009-MINAET de 8 de julio de 2009, el Ministro de Ambiente, Energía y Telecomunicaciones declaró sin lugar. Detalló, que el 19 de junio de 2009, se presentaron los documentos solicitados por la Secretaria en la resolución de 3 de junio anterior y por resolución No. 1778-2009-SETENA de las 8 hrs. de 29 de julio de 2009, la Comisión Plenaria dispuso lo siguiente: “Se otorga la viabilidad ambiental al Proyecto Hidroeléctrico Reventazón con obras relacionadas con su ejecución: plantel central, comedor y dispensario principal, plantas de tratamiento de aguas residuales y estaciones de servicio de almacenamiento para autoconsumo, así como el uso de cuerpos de agua para consumo humano y constructivo y obras en cauce de dominio público (…)”.Refirió, que el 4 de agosto de 2009 el Alcalde Municipal de Siquirres interpuso un recurso de revocatoria con apelación en subsidio contra la anterior resolución, el cual fue declarado sin lugar mediante resolución No. 2264-2009-SETENA de 23 de setiembre de 2009. El 1º de setiembre de 2009, la Municipalidad de Siquirres remitió a la Secretaría el oficio No. AMS-635-09, en el cual solicitó una serie de aclaraciones que se atendieron mediante oficio No. CP-258-2009 de 6 de octubre de 2009. Relató, que mediante resolución de la Secretaría Técnica Nacional Ambiental, No. 448-2010 de 2 de marzo de 2010, autorizó la modificación del Proyecto Hidroeléctrico y por oficio No. 4501-054-2010 de 17 de marzo de 2010, el Director del Centro de Gestión Ambiental envió una nueva Declaración Jurada. El 21 de enero de 2011, se aclaró la solicitud de ampliación de la escombrera No. 3 del Proyecto Hidroeléctrico Reventazón y mediante resolución No. 320-2011 de 8 de febrero de 2011, ésta se autorizó.Finalmente, informó que en oficio No. DEA-1834-2011 de 15 de junio de 2011 del Departamento de Evaluación Ambiental y de la Auditoría y Seguimiento Ambiental se dispuso que el ICE efectuó un monitoreo de peces en la quebrada Tigre, para planificar el control ambiental de las obras. Asimismo, éste cuenta con planes de rescate de la fauna terrestre y acuática, planes de reforestación y medidas ambientales para mitigar y/o compensar los impactos que generaría el proyecto, tanto en su fase constructiva como operativa. Estimó, que la Secretaría no ha incurrido en violación alguna a las normas constitucionales, por lo que solicitó que se declare sin lugar el recurso.
  6. 6Informó bajo juramento, Krisbell Ríos Myrie, en su condición de Presidenta Municipal de Siquirres, que en el Proyecto Hidroeléctrico la responsabilidad de la Municipalidad se circunscribió al otorgamiento de los permisos municipales, la negociación de obras y el mantenimiento y autorización de los caminos municipales. Explicó, que el procedimiento de tala de árboles y rescate de especies está regulado en los estudios de Impacto Ambiental dictados por el Secretaría Técnica Nacional Ambiental y los permisos deben seguirse bajo un estricto control del Ministerio de Ambiente, Energía y Telecomunicaciones. En virtud de lo anterior, solicitó que se declare sin lugar el recurso.
  7. 7Informó bajo juramento, Karen Mayorga Quirós, en condición de Directora del Área Rectora de Salud de Siquirres, que el Proyecto Hidroeléctrico en el río Reventazón fue avalado por resolución de la Secretaría Técnica, No. 1778-2009. Señaló, que previo al desarrollo de las obras contempladas en el Proyecto, se realizaron distintas reuniones con las comunidades de la zona, en las cuales se les explicó sus alcances y afectaciones. Explicó, que el Área Rectora de Salud de Siquirres autorizó el conjunto de obras propuestas para la tercera etapa del proyecto, mediante Permiso sanitario de funcionamiento No. DARSS-0184-2011. Señaló, que el Área Rectora también avaló la ubicación de una Planta de Tratamiento de Aguas Residuales, mediante Permiso sanitario de funcionamiento No. DARS-2010-0474 y la autorización del vertido de aguas en la planta, consta en la resolución No. R-0799-2009 del Departamento de Aguas del Ministerio de Ambiente, Energía y Telecomunicaciones.En igual sentido, según resolución Municipal de Ubicación No. DI-DRU-136-2009, la Municipalidad de Siquirres indicó que la ubicación de la planta se ajustaba a los requerimientos legales del Municipio. Afirmó, que los planos constructivos de la aludida planta fueron aprobados por las autoridades regionales de la Unidad de Rectoría de la Salud, Regulación de la Salud, mediante oficio No. HA-URS-CRS-0609-2010. Asimismo, las autoridades del Área Rectora de Salud de Siquirres avalaron la instalación de un dispensario médico en el plantel central del Proyecto, mediante Permiso sanitario de funcionamiento No. 2010-0275 y por Permiso sanitario No. DARSS-0301-S-2011, permitieron la instalación y funcionamiento de un Comedor Institucional hasta el 18 de junio de 2012. Alegó, que la situación planteada por el recurrente no resulta competencia del Ministerio de Salud y no consta en el Proceso de Atención al Cliente, una denuncia formal por los daños aludidos en este amparo.Reiteró, que el ente rector verificó que de previo a la implementación del proyecto se hayan cumplido todos los requerimientos que establece la normativa del país, por lo cual, solicitó que se declare sin lugar el recurso.
  8. 8Mediante el escrito de fecha 28 de junio de 2011, el Secretario de la Sala Constitucional hizo constar que no aparece que del 16 al 27 de junio de 2011, el Presidente del Tribunal Ambiental Administrativo, el Alcalde Municipal de Siquirres y el Jefe de la Oficina Subregional del Ministerio de Ambiente, Energía y Telecomunicaciones de Siquirres, hubieran presentado escrito alguno, con el fin de rendir el informe que se ordenó en el auto de las 10:38 horas de 9 de junio de 2011.
  9. 9En la substanciación del proceso se ha observado las prescripciones legales.

Redacta la Magistrada Abdelnour Granados; y,

CONSIDERANDO:

I. OBJETO DEL RECURSO

El recurrente acusa que el Instituto Costarricense de Electricidad se encuentra causando serios daños ambientales en las zonas boscosas del río Reventazón y en la quebrada Tigre, con el desarrollo del Proyecto Hidroeléctrico Reventazón. Tales obras, a su criterio, se están ejecutando al margen de la legislación ambiental, por lo cual, estima vulnerado su derecho a un ambiente sano y, ecológicamente, equilibrado.

II. HECHOS PROBADOS

De relevancia para dirimir el presente recurso de amparo, se tienen por acreditados los siguientes:

  • 1)El Proyecto Hidroeléctrico Reventazón que desarrolla el Instituto Costarricense de Electricidad en la cuenca media de este río, se ubica en los distritos Siquirres y Florida, cantón Siquirres, de la provincia de Limón (informe del Instituto Costarricense de Electricidad, visible en el expediente digital).
  • 2)Mediante oficio No. 4501-0014-2008 de 29 de enero de 2008, el Instituto Costarricense de Electricidad aportó a la Secretaría Técnica Nacional Ambiental, los términos de referencia del Estudio de Impacto Ambiental del Proyecto Hidroeléctrico Reventazón y solicitó la conformación de una Subcomisión de Evaluación (oficio visible en copia del expediente administrativo No. 331-2008-SETENA, adjunto a informe de la SETENA).
  • 3)El 17 de marzo de 2008, el Instituto Costarricense de Electricidad presentó la Evaluación Ambiental Inicial de ese Proyecto Hidroeléctrico a la Secretaría Técnica Nacional Ambiental (informe de la SETENA).
  • 4)Mediante resolución No. 1204-2008-SETENA de 2 de mayo de 2008, se fijaron los términos de referencia del Estudio de Impacto Ambiental de ese Proyecto (informe de la SETENA)
  • 5)El 23 de setiembre de 2008, el Instituto Costarricense de Electricidad presentó el Estudio de Impacto Ambiental del Proyecto Hidroeléctrico Reventazón, ante la Secretaría Técnica Nacional Ambiental (informe de la SETENA).
  • 6)Mediante resolución de la Secretaría Técnica Nacional Ambiental, No. 451-2009 de 24 de febrero de 2009, se solicitó al Instituto Costarricense de Electricidad que presentara de un Anexo (informe de la SETENA).
  • 7)El 3 de abril de 2011, se aportó lo prevenido ante el Departamento de Evaluación Ambiental de la SETENA (informe de la SETENA).
  • 8)Por resolución No. 1298-2009-SETENA de las 8:35 hrs. de 3 de junio de 2009, la Comisión Plenaria de la Secretaría Técnica Nacional aprobó el Anexo al Proyecto Hidroeléctrico Reventazón y solicitó al Instituto Costarricense de Electricidad una Declaración Jurada de Compromisos Ambientales, el nombramiento de un responsable ambiental, una bitácora ambiental y el depósito de una garantía ambiental antes de dar inicio a las obras (los autos).
  • 9)El 19 de junio de 2011, se aportó esos documentos (resolución adjunta a informe de la SETENA).
  • 10)Mediante resolución No. 1778-2009-SETENA de las 8 hrs. de 29 de julio de 2009, la Comisión Plenaria de la Secretaría Técnica Nacional Ambiental dispuso lo siguiente: “Se otorga la viabilidad ambiental al Proyecto Hidroeléctrico Reventazón con expediente No. 331-08, así como la construcción y operación de las siguientes obras relacionadas con su ejecución: plantel central, comedor y dispensario principal, plantas de tratamiento de aguas residuales y estaciones de servicio de almacenamiento para autoconsumo, así como el uso de cuerpos de agua para consumo humano y constructivo y obras en cauce de dominio público (…)” (resolución adjunta a informe de la SETENA).
  • 11)Por resolución No. R-0799-2009 de las 7:30 hrs. de 28 de setiembre de 2009, el Departamento de Aguas del Ministerio de Ambiente, Energía y Telecomunicaciones otorgó el permiso de vertido de aguas residuales al Proyecto Hidroeléctrico Reventazón (resolución adjunta a informe del Área Rectora de Salud).
  • 12)Según la resolución No. DI-DRU-136-2009 de la Municipalidad de Siquirres, la ubicación de la planta de tratamiento de aguas residuales del Proyecto Hidroeléctrico Reventazón se ajustó a los requerimientos legales (informe del Área Rectora de Salud).
  • 13)En Decreto Ejecutivo No. 35503- MINAET de 8 de abril de 2010, se declaró de Conveniencia Nacional e Interés Público el Proyecto Hidroeléctrico Reventazón (informe de SETENA).
  • 14)El 26 de agosto de 2010, el Área Rectora de Salud de Siquirres, región Huetar Atlántica, otorgó el permiso sanitario de funcionamiento No. DARS-2010-0474, para la ubicación de una planta de tratamiento de aguas residuales en el Proyecto Hidroeléctrico Reventazón (permiso sanitario adjunto a informe del Área Rectora de Salud).
  • 15)En. Oficio No. AMS-692-2010 de 1º de octubre de 2010, la Municipalidad de Siquirres autorizó la reparación del tramo público del camino No. 3 del Proyecto Hidroeléctrico Reventazón (oficio adjunto a informe del Instituto Costarricense de Electricidad).
  • 16)El 16 de diciembre de 2010, el Área Rectora de Salud de Siquirres otorgó el permiso sanitario de funcionamiento No. DARSS-2010-678, a las obras de la segunda etapa del plantel central de ese Proyecto (permiso sanitario adjunto a informe del Área Rectora de Salud).
  • 17)Mediante oficio No. HA-URS-CRS-0609-2010, los planos constructivos de la planta de tratamiento de aguas residuales en el PH Reventazón, fueron aprobados por las autoridades regionales de la Unidad de Rectoría de la Salud, Regulación de la Salud (informe del Área Rectora de Salud).
  • 18)La escombrera No. 12 se localiza en la microcuenca de la quebrada Tigre, dentro del área evaluada en el Estudio de Impacto Ambiental del Proyecto, por lo que cuenta con viabilidad ambiental (informe del Instituto Costarricense de Electricidad).
  • 19)Mediante informe de inspección a la escombrera No. 12 de 4 de febrero de 2011, el Ingeniero William Solano Ocampo, el Biólogo Jorge Leiva Navarro, la Ingeniera Alexandra Suárez Castro y la Geóloga Marta Chaves Quirós, concluyeron que: “No se observaron evidencias en el terreno de la presencia de un manantial permanente en la propiedad de la escombrera 12, se trata del flujo de aguas superficiales que se mantienen en ese punto debido a la conformación topográfica y a la presencia de rocas de baja permeabilidad. Las condiciones de alta humedad y precipitación que se dan en la zona contribuyen a que se mantenga una humedad permanente en el suelo, lo cual no está asociado necesariamente a niveles de agua subterránea regionales que estén aflorando en el sitio. Debido lo anterior, es de esperar que dichas condiciones se mantengan siempre presente, considerando además, las condiciones climáticas de la zona, lo cual debe ser tomado en cuenta para el diseño y conformación de la escombrera y para evitar problemas principalmente en la estabilidad del sitio, con un buen diseño de patrón de drenajes, taludes y de desfogue de aguas” (documento adjunto al informe del Instituto Costarricense de Electricidad).
  • 20)Por resolución de la Comisión Plenaria de la Secretaría Técnica Nacional Ambiental, No. 320-2011-SETENA de 8:35 de 8 de febrero de 2011, se aprobó la solicitud del Instituto Costarricense de Electricidad para ampliar la viabilidad ambiental del Proyecto y el tamaño de la escombrera No. 3 (resolución adjunta a informe de SETENA)
  • 21)Mediante resolución de la Oficina Subregional Siquirres-Matina del Área de Conservación La Amistad-Caribe, No. 047-2011-OSSM (IF) de las 11 hrs. de 5 de abril de 2011, se autorizó la corta y aprovechamiento de 28 árboles en propiedades ubicadas dentro del Proyecto (resolución visible en expediente administrativo No. AC-02-PUA-IF-138-2010-S, adjunta al informe del Instituto Costarricense de Electricidad).
  • 22)El 7 de abril de 2011, el Área Rectora de Salud de Siquirres otorgó permiso sanitario de funcionamiento No. DARSS-0184-2011, a las obras de la tercera etapa del plantel central del PH Reventazón (permiso sanitario adjunto a informe del Área Rectora de Salud).
  • 23)Según la Oficina Subregional Siquirres Matina del Área de Conservación La Amistad-Caribe, la zona de la escombrera No. 12 “(…) se trata de un área de captación de aguas pluviales las cuales son encausadas hasta la quebrada Tigre y depositadas en el río Reventazón. (…) no se trata de una naciente o quebrada, sino de una zona de recolección de aguas (…)” (oficio No. OSSM-395 de 15 de junio de 2011, adjunto a informe de MINAET).
  • 24)Según el Informe regencial No. 1 del PH Reventazón de fecha indeterminada, el Instituto Costarricense de Electricidad realizó un monitoreo de peces en la Quebrada Tigre, que “(…) ha permitido la planificación en el control ambiental de las obras, ya que conociendo la diversidad de determinados sitios se puede prever el efecto de obras en la biodiversidad de cuerpos de agua, así como la planificación de medidas de control” (oficio No. DEA-1834-2011 del Departamento de Evaluación Ambiental y de Seguimiento Ambiental de la SETENA de 15 de junio de 2011, adjunto a informe de la SETENA).
  • 25)Entre las medidas de control ambiental que contempla el Estudio de Impacto Ambiental del PH Reventazón, se encuentran: “(…) la construcción de 4,5 km de aceras, bacheo de 3,4 km de caminos, control de sedimentos en los procesos de excavación, gestión de residuos sólidos, evaluaciones arqueológicas, estudios y monitoreos biológicos, rescate de flora y fauna, inventarios forestales y corta, revegetación de taludes, producción de árboles en vivero forestal, reparación de caminos vecinales y ejecución de los programas de educación ambiental, desarrollo local y alfabetización, así como reuniones periódicas con representantes comunales e institucionales para dar seguimiento a las medidas de compensación establecidas.” (informe del Instituto Costarricense de Electricidad).
  • 26)El Proyecto Hidroeléctrico Reventazón cuenta con un Plan de Gestión Ambiental (PGA) que agrupa medidas ambientales dirigidas a prevenir, corregir, mitigar o compensar los impactos ambientales que genere (informe del Instituto Costarricense de Electricidad)
  • 27)El Proyecto Hidroeléctrico Reventazón contempla un Plan de Rescate de Flora y Fauna, por lo cual, las especies vegetales y animales que residen en la zona de la escombrera No. 12, son rescatados y reubicados (informe del Instituto Costarricense de Electricidad).

III. CASO CONCRETO

Ha quedado plena e, idóneamente, acreditado, que previo a iniciar las obras correspondientes, se cumplió con la respectiva Evaluación de Impacto Ambiental y el Proyecto obtuvo la viabilidad ambiental -resolución de la Comisión Plenaria de la Secretaría Técnica Nacional Ambiental. No. 1778-2009-SETENA de las 8 hrs. de 29 de julio de 2009-. En este sentido, los eventuales impactos ambientales del Proyecto fueron, debidamente, previstos por la entidad recurrida y a partir de esto, fueron también planificadas las medidas de control ambiental susceptibles de mitigarlos y/o compensarlos. En este sentido, no puede obviarse que el Proyecto cuenta con un Plan de Gestión Ambiental y que si bien es cierto, se ha tenido que intervenir una parte del bosque que se ubica en la zona de influencia, que implicó la corta de árboles, los recurridos niegan que hayan sido variedades en peligro de extinción. Aunado a lo anterior, se acreditó la existencia de un plan de rescate de la flora y fauna de la zona, que contempla el traslado de la especies recolectadas.

Asimismo, se demostró que el Instituto Costarricense de Electricidad obtuvo los respectivos permisos sanitarios de funcionamiento, por parte del Área Rectora de Salud de Siquirres, así como la autorización de la Municipalidad del cantón, para la reparación de caminos y la construcción de otras obras propias del Proyecto. De igual forma, le fue otorgado el permiso para el vertido de aguas residuales, del Departamento de Aguas del Ministerio de Ambiente, Energía y Telecomunicaciones y para la ubicación de su planta de tratamiento. Adicionalmente, consta que se dispuesto lo necesario para determinar la naturaleza de las aguas que fluyen en la escombrera No. 12 y se descartó que se tratará de un manantial permanente. En esta inteligencia, considera esta Sala que, efectivamente, las autoridades recurridas han llevado a cabo una adecuada gestión administrativa ambiental, en la valoración del Proyecto Hidroeléctrico Reventazón, de ahí que, deba descartarse la aducida violación al artículo 50 constitucional.

IV. COROLARIO

En mérito de lo expuesto, se impone declarar sin lugar el recurso planteado.

POR TANTO:

Se declara sin lugar el recurso.
