*050096620007CO* CONSTITUTIONAL CHAMBER OF THE SUPREME COURT OF JUSTICE. San José, at catorce horas y treinta y cinco minutos on veinticinco de agosto del dos mil diez.
Petition for amparo filed by Mario Andrés Boza Loría, identity card number 1-297-932, in his capacity as General Attorney-in-Fact without limitation as to amount for the conservation organization Fideicomiso Baulas, and on its behalf, against the National Environmental Technical Secretariat (SETENA).
Whereas:
He states that, because this amparo proceeding (amparo) requests a technical opinion regarding the effects of a construction process being carried out at playa Ventanas, and because that regulation seeks to govern the characteristics of construction developments in that area, he is transcribing part of the document produced, which could contribute some elements to the matter under consideration. He states that the professional opinions of the commission members are set forth below; these opinions could be challenged in forums convened for that purpose and are divided into the following areas: a) general observations; b) opinions regarding the appropriateness of the Regulation; c) administrative opinions; d) biological opinions; e) weaknesses of the Regulation; and f) participation and social implications. A) General observations: He indicates that the Regulation is based on the assumption that appropriate rules must be established to authorize construction in the coastal zone (zona costera) of playa Grande in Parque Nacional Marino Las Baulas (PNMB), on the premise that such regulation would protect the interests of property owners without harming the nesting areas (áreas de anidación) and would guarantee sustainable development (desarrollo sostenible).
He indicates that the Regulation is justified on the basis of certain “formal” considerations related to the interpretation of the boundaries of Parque Nacional Marino Las Baulas (Ley de Creación del Parque Nacional Marino Las Baulas N°7524 of diez de julio de mil novecientos noventa y cinco); primarily as regards the interpretation of its landward boundary, which runs “seaward” as the starting point for determining the line from which the distance of 125 metros is measured from the ordinary high-tide line (pleamar ordinaria) between coordinates N259100 and E332000. He adds that this serves as the basis for asserting the exclusively marine nature of the park, “because the sea is the leatherback turtle’s habitat and that is where protection must be strengthened.” He notes that this interpretation, although it had been exhaustively clarified by the Procuraduría General de la República even before the Regulation was issued, gives rise to three basic consequences: a) the zoning regulation (reglamento de zonificación) for distrito Cabo Velas is published, under which, among other things, the leatherback turtle’s nesting area is reduced to the public zone (zona pública), and the sphere of authority of the Ministerio de Ambiente y Energía (MINAE) is confined to that same area with respect to land cover (cobertura terrestre); b) it is assumed that the marine nature of the species and the park means that protection measures must focus primarily on the sea, where, although the critical conditions affecting the species as a result of fishing activities are not overlooked, this in no way justifies subjecting the nesting areas—which are crucial to its life cycle—to any form of alteration; and c) based on the foregoing, the Regulation opens the possibility that the land areas immediately adjacent to the park—beach areas that, according to binding opinions issued by the competent authorities, form part of Parque Nacional Marino Baulas and are therefore subject to the administration of the Ministerio de Ambiente y Energía—may be directly or indirectly affected by various types of construction.
He indicates that particular reference is made to the Inter-American Convention for the Protection and Conservation of Sea Turtles, ratified by Ley número.7906 of veintitrés de agosto de mil novecientos noventa y nueve; the Convention for the Conservation of Biodiversity and the Protection of Priority Wilderness Areas in Central America, ratified by Ley número 7433 of catorce de septiembre de mil novecientos noventa y cuatro; the Convention on Nature Protection and Wildlife Preservation in the Western Hemisphere, ratified by Ley número 3763 of diecinueve de octubre de mil novecientos setenta y seis; and the Convention on Biological Diversity, ratified by Ley 7416 of treinta de junio de mil novecientos noventa y cuatro. The Regulation substantially violates these instruments insofar as they are intended to conserve flora and fauna globally and form part of the legal system (ordenamiento jurídico). C) Administrative opinions:
It indicates that the survival strategy developed by these chelonians involves processes of mass migration toward nesting beaches and coordinated hatching, thereby ensuring that natural mortality levels among hatchlings are such as to guarantee sufficient survival for the future replacement of nesting populations; all of these processes occur on the beach and in the vicinity of nesting areas. It states that, in the particular case of leatherback turtles, the position must be uncompromising with regard to the protection of nesting areas; that is, irrespective of the legal and administrative alternatives that might eventually be implemented, absolute protection of the site must prevail in this case, and it therefore considers that any measure conducive to affecting the site runs counter to that principle.
It states that, in accordance with this preliminary scientific study, it is recommended that this regulation promoted by the Municipality of Santa Cruz not be implemented, given the short-term consequences for practically the entire ecosystem protected by Las Baulas National Marine Park. E) Regarding the weaknesses of the regulation, it notes that there are numerous errors and gaps, not only in terms of applicability but also of a conceptual nature: 1) from the commission’s perspective, it is clear that the powers assigned through the regulation do not belong to the Municipality of Santa Cruz and that the implementation of these management tools is the responsibility of the Ministry of Environment and Energy, specifically the Tempisque Conservation Area; 2) the regulation as published in La Gaceta on tres de julio del dos mil seis contains gaps and errors that do not comply with the relevant standardization, and reference is made, for example, to the terminology specified in Article 2, as well as to a series of matters that, in that Commission’s opinion, must be noted: a) item 43 (public zone): the public zone does not exist in protected areas (AAPP), pursuant to Article 73 of the Maritime-Terrestrial Zone Law; b) item 29 (beach): the definition of beach is not correct from the standpoint of a protected area (AAPP), which instead is based on biological and geographical criteria, as would be appropriate if the purpose of the regulation were precisely to safeguard and protect the species.
The regulation instead proposes a legal definition oriented toward its physical use, which is inconsistent with marine ecology criteria defining a beach as a geographical feature composed of unconsolidated sediments of various origins and consisting of: (1) the supralittoral zone, (2) the sublittoral zone, (3) the littoral zone, and (4) the berm, which in turn includes the vegetation zone extending to the point encompassing the same distribution of unconsolidated sediments that form the beach. In the case of the beaches of Las Baulas National Marine Park, this area extends between 40 and 60 m beyond the littoral zone; c) item 33 (meaning of environmental impact), which must be standardized in accordance with the definition used by the Central American Integration Secretariat (SICA) for this subject; d) item 34 (nesting season): the definition is erroneous, not because of the designation of the months, but because it does not define the biological process to which it refers; e) items 36, 37, 38, and 39 (regarding uses): the determination of the types of uses is confusing and facilitates interpretations detrimental to environmental quality.
They should fundamentally be defined as permitted and prohibited; f) item 44 (zoning): its definition does not use biological parameters as guiding criteria for uses; its approach disregards the protected area (AAPP), or its adjacency thereto, and instead takes a development-oriented approach; g) items 20 and 21 (hotels): it is an error to use the number of rooms rather than the number of beds as the measurement criterion, since the latter is more accurate because it can measure demands on resources (such as drinking water) or waste generation (for example, sewage, graywater, and solid waste); h) items 6 and 8 (area of influence, plant or green barriers): the “vegetation wall,” a tool for controlling light pollution, is highly questionable. Deciduous species are not defined; moreover, the attempt to direct light in vehicle parking areas is very unclear, and leaf density is not determined, among various other weaknesses, such that the project’s area of influence is based on subjective criteria; i) several sections of the regulation refer to the zones established by the Maritime-Terrestrial Zone Law, and it clarifies that this law has no jurisdiction in protected areas (AAPP); therefore, its zoning is not binding; j) Article 18 does not fall within the Municipality’s jurisdiction and tends to create institutional conflicts; k) Article 19 allows conflicting uses that could degrade the environment and permits municipal decisions that are not binding within its jurisdiction in the protected area; l) under Article 20, authorization to change land use is vested in the Ministry of Environment and Energy, not the municipality; m) the regulation fails to account for the variable and increasing occupancy density of places such as lodgings, small eateries, restaurants, supermarkets, among others; n) the regulation did not establish a technical foundation based on the carrying capacity of the site to be used and even disregards the fact that places such as restaurants have critically variable occupancy densities; o) the regulation is ineffective with respect to light pollution and lacks an understanding of this “psychological impact” on nesting females.
The relationship among walls, building heights, illuminated paths, and lighting constitutes enormous gaps in this regulation. The angles at which light is emitted from buildings at any height constitute a loophole in the regulation; p) in addition to the problem of ambiguity in the regulation concerning the rules it establishes, it does not define methods for controlling light pollution and its impact on sea-turtle nesting and behavior; it neither considers nor provides how mechanisms will be established to control noise pollution, and it creates the possibility of uncontrolled access during nesting seasons by allowing each residence its own access to the beach. In practice, once the buildings have been constructed, none of the foregoing three matters will be physically controllable; q) the construction percentages are not based on, nor is evidence provided of, studies on soil and permeability, the availability of resources required by every building, or even the carrying capacity of the area under discussion; r) it is incomprehensible that the discharge of stormwater into the natural environment is recommended, particularly because sooner or later it will flow into the marine environment or, before that, into the Tamarindo mangrove; s) the construction of swimming pools is unacceptable, particularly because this is a protected area, and the regulation disregards the environmental impacts of chlorination, the disposal of swimming-pool water, and the demand for water in an area where it is a critically limited resource; t) Article 60 3b. contradicts other recommendations concerning how stormwater is to be disposed of, without defining what is meant by “significant impact on the environment or public health”; u) Article 60, subsection a, is already governed by the Traffic Law and is furthermore prohibited in the protected area.
Subsection c disregards the effects of manure disposal on adjacent aquatic environments (freshwater or marine), including eutrophication; v) subsection d of the same article warrants special mention because it implicitly authorizes, subject to ambiguous prevention criteria, the possible alteration of the beach, which, in the commission’s view, is entirely unacceptable; w) the regulation disregards the consequences relating to the demand for services resulting from the development it might allow (for example, drinking water and waste disposal, among others); x) dividing the area into sectors presupposes heterogeneous nesting without any scientific basis, which is a dangerous situation because it assumes low nesting densities and therefore relaxes restrictions on development. Although nesting does tend to be concentrated, at some sites this “concentration” is mobile and dynamic and varies annually and even seasonally. F) Regarding participation and social implications:

The following facts are deemed duly established and material to the resolution of this matter: a) that Rover Path of Guanacaste Sociedad Anónima owns land located in Playa Ventanas, in provincia de Guanacaste, within the restricted zone (zona restringida) of the maritime-terrestrial zone (zona marítimo terrestre), facing a leatherback turtle nesting beach and within the boundaries of Parque Nacional Marino Las Baulas (see sworn statements at folios 30, 31 and 264 and documents at folios 81 and 268); b) that, according to the opinion of the Secretaría Técnica Nacional Ambiental, the Ley de Creación del Parque Nacional Marino Las Baulas does encompass the area where that property is located, but there is no indication that expropriation of the property so that it may become State-owned is planned in either the short or medium term (see sworn statements at folios 28 and 29); c) that, on veinticuatro de agosto del dos mil cuatro, the representative of Rover Path of Guanacaste Sociedad Anónima applied to the Secretaría Técnica Nacional Ambiental for environmental feasibility approval (viabilidad ambiental) to build a residence on that property (folios 1 through 30 of the administrative record (expediente administrativo)); d) that the project evaluators, acting as officials of the Secretaría Técnica Nacional Ambiental, recommended in resolution number DAP-194-2004-SETENA of treinta de septiembre del dos mil cuatro that the Comisión Plenaria request an Environmental Management Plan (Plan de Gestión Ambiental) (folio 32 of the administrative record); e) that, by resolution number 1800-2004-SETENA issued at once horas diez minutos del veinte de octubre del dos mil cuatro, the Comisión Plenaria of the Secretaría Técnica Nacional Ambiental required Sociedad Rover Path de Guanacaste to submit an Environmental Management Plan (folio 41 of the administrative record); f) that, by resolution number 1349—2005—SETENA issued at once horas veinticinco minutos del nueve de junio del dos mil cinco, the Comisión Plenaria of the Secretaría Técnica Nacional Ambiental granted environmental feasibility approval to the residential project of Rover Path de Guanacaste Sociedad Anónima, finding that the Environmental Management Plan satisfied the applicable technical requirements (folio 69 of the administrative record); g) that, by resolution number 2076-2005-SETENA issued at trece horas cuarenta y cinco minutos del diecisiete de agosto del dos mil cinco, the Comisión Plenaria of the Secretaría Técnica Nacional Ambiental ordered the enforcement of the preceding resolution number 1349—2005—SETENA of once horas veinticinco minutos del nueve de junio del dos mil cinco suspended until the Sala Constitucional ruled otherwise (folio 37); h) that the leatherback turtle is a species of global importance whose conservation status is critical and that it is therefore neither acceptable nor justifiable to create legal and administrative instruments that, rather than strengthening conservation efforts, facilitate human activities such as construction that directly or indirectly threaten nesting areas, which are essential to ensuring the species’ reproduction (see sworn statements at folio 253); i) that, from a technical standpoint, treating the coastal strip separately from the marine area is not a viable option, particularly if this disregards the relationship between the mangroves of Tamarindo-Salinas and those of the estuary (estero) at Ventanas, on the one hand, and the marine sector protected by Parque Nacional Marino Las Baulas, on the other (see sworn statements at folio 255); j) that the construction of houses in the area would cause extremely severe impacts on the ecosystem because the resulting disturbances would bring about rapid and extensive changes, while the ecosystem recovers slowly, thereby substantially affecting the stability of the Parque Nacional Marino Las Baulas ecosystem; consequently, the short-, medium-, and long-term effects would be enormous, affecting not only leatherback turtle populations directly and in the short term, but virtually the entire marine ecosystem (see sworn statements at folio 255).
II.The right to a healthy and ecologically balanced environment. Article 50 of the Constitución Política establishes that every person has the right to a healthy and ecologically balanced environment. Both rights are expressly recognized in Article 50 of the Constitución Política, which defines the Social State under the Rule of Law (Estado Social de Derecho), such that the Constitución Política emphasizes that environmental protection is an appropriate means of safeguarding and improving everyone’s quality of life. This makes intervention by public authorities necessary with respect to factors that may disrupt the environment’s balance and prevent individuals from developing and conducting their lives in a healthy environment. Accordingly, this right has a dual dimension: as an individual right (derecho subjetivo) and as an objective or purpose of government action generally; the State must therefore guarantee, defend, and preserve it.
Thus, every activity that threatens this right must be barred, prohibited, and prevented, and measures must be taken to protect the right in advance against potential dangers so that it may endure for future generations. Accordingly, the State must, on the one hand, refrain from itself harming the environment and, on the other, undertake the task of adopting measures that ensure compliance with constitutional requirements, including preventive measures.
III.State obligations in environmental matters. The State’s role as guarantor of the preservation of a healthy and ecologically balanced environment derives from the aforementioned Article 50 of the Constitución Política. This obligation entails, as the Sala has stated on other occasions, including judgment number 2001-13295 issued at doce horas seis minutos del veintiuno de diciembre del dos mil uno:
“...that the State must take every technically feasible measure to ensure that the activity it approves will not cause environmental damage. Although the determination by the responsible State body is itself a technical matter, the duty to issue that determination and the requirement that it be rigorous are legal matters. In general terms, the State’s duty to guarantee the right to a healthy environment is not limited to satisfying a mere incidental requirement within the public procurement process (proceso licitatorio). The Constitution does not merely require compliance with certain formalities; rather, as stated, it requires the use of every legally and practically feasible means to preserve the environment.” (see, to the same effect, resolution number 05906-99 issued at dieciséis horas quince minutos del veintiocho de julio de mil novecientos noventa y nueve).
That duty, as the same judgment recognizes, rests more specifically with the Secretaría Técnica Nacional Ambiental, the respondent herein:
“The environmental concern of the Ministerio del Ambiente y Energía is practically limited to environmental impact studies (estudios de impacto ambiental), whose approval lies with SETENA. In other words, SETENA bears the State’s entire duty to guarantee a healthy and ecologically balanced environment, as provided in Article 50 of the Constitution. Given such an important responsibility, it would be reasonable to expect the responsible body to possess technical and administrative strength.” (see judgment number 2001-13295 issued at doce horas seis minutos del veintiuno de diciembre del dos mil uno) It is in this regard that, in environmental matters, any omission by the State that results in a deterioration of environmental conditions is especially serious (as may be inferred from judgments number 9735-00 issued at nueve horas seis minutos del tres de noviembre del dos mil and number 1645-02 issued at once horas cuatro minutos del quince de febrero del dos mil dos, among others).
IV.The precautionary principle and sustainable development. In addition to the foregoing, two principles of particular relevance in environmental matters must be taken into account in deciding this case: the precautionary principle (principio precautorio) and the principle of sustainable development (principio de desarrollo sostenible). With respect to the former, it should be noted that this Sala has recognized that the protection of our natural resources requires a preventive approach, under which the State must take all necessary measures—within the scope permitted by law—to prevent irreversible environmental damage. This is also known as the principle of “prudent avoidance” (evitación prudente), set forth in the Conferencia de las Naciones Unidas sobre el Medio Ambiente y el Desarrollo, Declaración de Río, which states verbatim:
“Principle 15.- In order to protect the environment, States shall widely apply the precautionary approach according to their capabilities. Where there is a threat of serious and irreversible damage, lack of full scientific certainty shall not be used as a reason for postponing cost-effective measures to prevent environmental degradation.” Consequently, action must be taken in advance to prevent the adverse effects of a project and to ensure the protection, conservation, and proper management of resources. Accordingly, the guiding principle of prevention (principio rector de prevención) is based on the need to take and implement all precautionary measures to prevent or contain potential harm to the environment or human health. Thus, where there is a risk of serious or irreversible harm—or uncertainty in that regard—a precautionary measure must be adopted, including postponement of the activity in question.
This is because, in environmental matters, ex post enforcement is ineffective: once biologically and socially harmful consequences have occurred, punishment may have moral significance, but it will scarcely compensate for the harm caused to the environment. On that basis arises the need for every State to achieve progress in harmony with nature, because only through sustainable development (desarrollo sostenible) can the availability of resources for present and future generations be guaranteed; this gives rise to the second principle, known as “sustainable development.” The Chamber has addressed the latter principle on other occasions, one example being judgment number 2006-13461 de las diez horas con veinte minutos del ocho de septiembre del dos mil seis, in which it held, insofar as relevant:
“... In that regard, Article 3, paragraph 4, of the aforementioned Framework Convention expressly provides that ‘The Parties have a right to, and should, promote sustainable development...’” Likewise, the principle of sustainable development is set forth in the 1992 Rio Declaration on Environment and Development, paragraph 3 of which provides as follows:
“The right to development must be fulfilled so as to equitably meet developmental and environmental needs of present and future generations.” Under this principle of sustainable development, the need to achieve the country’s development in order to address its social and economic shortcomings is recognized. However, it requires that development take place without destroying the environment or depleting natural resources, ensuring that the use of those resources does not exceed their capacity for replenishment. Accordingly, the possibility of the country’s development is recognized, but such development should not occur to the manifest detriment of the environment. The principle of sustainable development—widely recognized by this Court—transcends purely environmental issues because it constitutes an objective in the field of economics: in addition to seeking to preserve the natural resources that sustain human life, it also pursues efficiency in the use of resources so as to achieve development that meets the needs of present and future generations without compromising the availability of natural resources in general.
In light of the foregoing, sustainable resource management (gestión sostenible de los recursos) entails meeting countries’ needs while taking into account the requirements of present and future generations and balancing three principal objectives: environmental, social, and economic. This is intended to reverse trends that threaten human quality of life and prevent increased costs to society. In that regard, it is necessary to halt continuing environmental degradation through measures aimed at mitigating the adverse effects of economic and social development and ensuring the existence of a sustainable relationship between humanity and nature. Indeed, the adoption of sustainable policies is based on consistency among economic growth, social equity, and the conservation of natural resources, while promoting the use of renewable energy and increased energy efficiency (see, to that effect, judgment 2007-006315 de las catorce horas treinta y tres minutos del nueve de mayo del dos mil siete). In elaborating upon this principle, this Court has stated as follows:
“(...) In fact, the distinction between renewable and nonrenewable natural resources is a modern one, since even economics—which concerns itself with managing the surrounding environment in order to maximize the satisfaction (sic) of human needs using limited resources—did not incorporate the depletion and deterioration of the environment as an instrument of economic analysis until very recently.
All human life necessarily takes place in relation to the environment, particularly as regards improving quality of life, which is the central objective that development must pursue; however, development must relate to the environment in a manner that is harmonious and sustainable.
The environment, therefore, must be understood as a development resource to be used appropriately, requiring an integrated approach to its natural, sociocultural, technological, and political relationships; otherwise, its productivity for the present and future will be degraded, and the heritage of future generations could be placed at risk. The causes of environmental problems are complex and reflect an interaction between natural and social processes within the framework of the model of socioeconomic development adopted by the country. For example, environmental problems arise when methods of exploiting natural resources result in degradation of ecosystems beyond their capacity for regeneration, thereby harming broad sectors of the population and generating high environmental and social costs that lead to a deterioration in quality of life, since the primary objective of using and protecting the environment is precisely to achieve development and progress favorable to human beings.
Environmental quality is a fundamental parameter of that quality of life; other equally important parameters include health, food, work, housing, education, and so forth. More important still is the understanding that, although human beings have the right to use the environment for their own development, they also have a duty to protect and preserve it for the use of present and future generations. This is not particularly novel, because it is merely the application to this field of the principle of ‘injury’ (principio de la ‘lesión’), already well established in ordinary law, under which the lawful exercise of a right is subject to two essential limits: on the one hand, the equal rights of others and, on the other, the rational exercise and beneficial enjoyment of the right itself. (...)” Judgment 3705-1993 de las quince horas del treinta de julio de mil novecientos noventa y tres.” Consequently, the principles discussed above establish that any project undertaken, whether by the State or by a private-law entity (sujeto de derecho privado), must be carried out in harmony with the environment.
Although a nation’s progress cannot be denied, it must remain within appropriate sustainability parameters so as to ensure the conservation of resources for future generations (judgment 2007-006315 de las catorce horas treinta y tres minutos del nueve de mayo del dos mil siete). This must undoubtedly be taken into consideration when assessing the merits of the present matter.
V.Merits of the case (Sobre el fondo). In judgment number 2008-018529 de las ocho horas y cincuenta y ocho minutos del dieciséis de diciembre del dos mil ocho, this Chamber, ruling on a matter similar to the one now under consideration, held:
“VIII.- Conclusion.- Given the importance of the existence and protection of Parque Marino las Baulas from the standpoint of environmental conservation and protection; given that SETENA has been granting environmental approvals (viabilidad ambiental) to projects located within the park and its buffer zone (zona de amortiguamiento) on an individual basis, without conducting an analysis of the cumulative impact that such construction would have on the Park’s entire ecosystem; given that the Municipalidad de Santa Cruz has granted building permits within the park and its buffer zone even without the corresponding environmental approval; and taking into account the precautionary principle (principio precautorio) in environmental matters, the appropriate course is to grant the present petition, with all the consequences detailed in the operative portion (parte dispositiva).” And that operative portion expressly stated, insofar as relevant, as follows:
“The petition is hereby GRANTED; consequently: a) All environmental approvals granted for properties located within Parque Nacional Marino la Baulas are annulled, and the Ministerio de Ambiente y Energía is ordered to continue immediately with the expropriation proceedings for those properties. b) SONIA ESPINOZA VALVERDE, in her capacity as Secretaria General de la Secretaría Técnica Nacional Ambiental, or whoever holds that office, is ordered to issue instructions within the scope of her authority to refrain from processing new environmental approval applications within the park. c) SONIA ESPINOZA VALVERDE, in her capacity as Secretaria General de la Secretaría Técnica Nacional Ambiental, or whoever holds that office, is ordered, in coordination with the Ministerio de Ambiente y Energía, the Instituto Costarricense de Acueductos y Alcantarillados, and the Municipalidades de Santa Cruz, Nandayure, Hojancha, Nicoya y Carrillo, to conduct a comprehensive study of the environmental impact that construction and tourism and urban development in the buffer zone of Parque Nacional Marino Las Baulas would produce and of the necessary measures to be taken.
The study shall assess whether it would also be preferable to expropriate the properties located there and shall expressly indicate the impact that noise, lighting, the use of water for human consumption, sewage and wastewater, human presence, and other factors would have on the entire ecosystem of the area, particularly the leatherback sea turtle (...)”.
In turn, in judgment number 2008-008713 de las nueve horas seis minutos del veintitrés de mayo del dos mil ocho, which decided a constitutional challenge (acción de inconstitucionalidad) concerning the zoning regulations (reglamento de zonificación) for the distrito de Cabo Velas, whose geographic scope of application included part of Parque Nacional Marino Las Baulas and which is therefore applicable to the specific case, the Chamber held:
“D.- The protection area that must be afforded to the leatherback turtle. Although the Chamber has no doubts as to the unsoundness of the criteria supporting the challenged Zoning Regulations, or as to determining whether the leatherback turtle population is in serious decline and deciding what the optimal area should be to ensure that the turtles lay their eggs on the beaches governed by the aforementioned Zoning Regulations, international treaties and Article 50 of the Constitution provide legal mechanisms for granting the protection requested of this Court. The precautionary principle (principio precautorio) requires the Chamber to sustain the constitutional challenge (acción de inconstitucionalidad), in accordance with the case law stating that ‘where there is a risk of serious or irreversible harm—or an objective doubt in that regard—a precautionary measure must be adopted, including postponement of the activity concerned, because subsequent enforcement is ineffective in this field, given that biological effects are irreversible in most cases, and although punishment may have moral significance, it will scarcely compensate for the environmental damage caused.’ (judgment No. 2006-17126).
Parque Nacional Las Bualas de Guanacaste has a very clear purpose: protecting the leatherback turtle nesting area (área de desove), which, pursuant to Decreto Ejecutivo No. 20518-MIRENEM, is necessary to ensure the continued existence of the leatherback turtle (Dermochelys coriacea) colony and other natural resources, as well as tourism and ecological activity, in view of the nesting that occurs throughout the year. The Chamber notes with concern that the bill creating the Park reiterates some of the criteria set forth in the Executive Decree and expresses concern about hotel developments, since they will bring lighting, waste, pedestrian traffic, outboard motor noise, music, nightclubs, and automobiles, which will destroy this natural habitat. Accordingly, a protection strip extending two hundred meters from the ordinary high-tide line (pleamar ordinaria) was initially proposed during the legislative proceedings; however, the Affirmative Majority Report, despite maintaining those same justifications, reduced the protection strip to 125 meters from the ordinary high-tide line, consistent with the aforementioned Executive Decree.
Because our country has undertaken internationally to protect ‘sea turtle habitats,’ the constitutional challenge must be sustained, and pursuant to the precautionary principle and the principle that environmental regulations are binding (principio de vinculatoriedad de la normativa ambiental), the Zona Marítimo Terrestre must likewise be included as a protection area required for the various sea turtles that use that area as part of their environment during stages of their life cycle.” At that time, the operative portion (parte dispositiva) of that judgment ruled as follows:
“The action is SUSTAINED. Consequently, the Reglamento de Zonificación Distrito Cabo Velas enacted by the Concejo Municipal de Santa Cruz and published in La Gaceta No. 127 del 3 de julio de 2006 is annulled. This judgment shall have declaratory and retroactive effect as of the date on which the annulled Regulations entered into force, without prejudice to rights acquired in good faith. A summary of this ruling shall be published in the Diario Oficial La Gaceta, and the ruling shall be published in full in the Boletín Judicial. Notice shall be served on the petitioner, the Municipalidad de Santa Cruz, and the Procuraduría General de la República.-” In the matter under review, as evidence obtained to assist in adjudication (prueba para mejor resolver), a technical report was requested from the Director de la Escuela de Biología Marina de la Universidad Nacional. In the document appearing at folios 247 to 258, he provides important warnings concerning the short-, medium-, and long-term consequences that could result from the construction process that has long been underway in Parque Nacional Marino Las Baulas, specifically at Playa Grande and Playa Ventanas.
Those consequences will directly affect not only leatherback turtles but also the entire ecosystem in the area. That report fully accords with the Chamber’s findings in the judgments transcribed above, which, taking the precautionary principle into account, conclude that the area must be protected by preventing changes to the environment and therefore state that the expropriation process (proceso expropiatorio) must continue in order to guarantee preservation of the ecosystem. The report identifies the adverse effects that artificial lighting on nesting beaches and the construction of buildings lacking an adequate setback (retiro) from the beach may have specifically on turtles. It states that the purpose of that setback is to protect both the beachfront and the nesting habitat, because many turtle species preferentially select wide, unobstructed beaches for nesting. Coastal development, particularly along the beachfront, may reduce the quantity and quality of available nesting sites; accordingly, every type of development and any potential barrier must be set back from the sandy area, including lights, buildings, and physical objects such as chairs, umbrellas, boats, and recreational equipment, among others.
Since the identified risk is known to most of the population and certainly to the Secretaría Técnica Nacional Ambiental, it would have been reasonable, when issuing an authorization such as the one challenged here, at least to have contemplated and ruled upon the potential risk of harm, given that the land on which construction is planned lies within Parque Nacional Marino Las Baulas. This national park was created by Decreto Ejecutivo número 20518-MIRENEM de nueve de julio de mil novecientos noventa y uno, its principal objective being the perpetual protection of the leatherback turtle (Dermochelys coriacea) colony and the other natural resources existing in the area. Consideration was given to the fact that there are three globally important nesting areas for leatherback sea turtles, two of which are Playas Grande and Langosta in Bahía Tamarindo, where Playa Ventanas is located—the site of the property to which this amparo proceeding (amparo) relates.
All of the foregoing requires application of the precautionary principle in this case and a decision not to endanger the interest protected by the legislation concerning the establishment of Parque Nacional Marino Las Baulas, specifically at Playa Grande and Playa Ventanas. The principle of sustainable development (principio de desarrollo sostenible), which is also applicable here, required that environmental approval (viabilidad ambiental) not be granted in this particular case because, as stated supra, the State is obligated to foster development that does not destroy the environment or exhaust natural resources, ensuring that the use of those resources does not exceed their capacity for replenishment. Thus, the country’s potential for development must not be pursued to the manifest detriment of the environment; rather, resources must be used efficiently so as to achieve development that meets the needs of present and future generations without compromising the availability of natural resources and, in this case, without further endangering the leatherback turtle species, which is already endangered.
VI.It must also be taken into account that, specifically with regard to the preservation of sea turtles, Costa Rica signed—el treinta y uno de enero de mil novecientos noventa y siete—and approved—el veintitrés de agosto de mil novecientos noventa y nueve—the Convención Interamericana para la Protección y Conservación de las Tortugas Marinas, whose second annex, concerning the protection and conservation of these animals’ habitats, provides:
“Each Party shall consider and, where necessary, may adopt, in accordance with its laws, regulations, policies, plans, and programs, measures to protect and conserve, within its territory and in the maritime areas over which it exercises sovereignty, sovereign rights, or jurisdiction, sea turtle habitats, such as:
VII.In addition to the foregoing, the Chamber notes that although, through Ley 7524 del diez de julio de mil novecientos noventa y cinco, entitled Ley de Creación del Parque Nacional Marino Las Baulas de Guanacaste, this park was created based on the State’s interest in and intention to acquire the land located within that national park, the fact remains that, as already stated in judgment number 2008-007549 de las diecisiete horas treinta y ocho minutos del treinta de abril del dos mil ocho, even though that Law entered into force on el dieciséis de agosto de mil novecientos noventa y cinco, the period of almost ten years that elapsed before the Executive Branch began the expropriation (expropiación) of those properties is unjustified and violates the rights protected under articles 21 and 50 of the Political Constitution, insofar as the State has disregarded its obligation to take appropriate and necessary measures, in accordance with international law and on the basis of the most reliable scientific data available, for the protection, conservation, and recovery of sea turtle populations and their habitats, including restricting human activities that may seriously affect sea turtles, particularly during periods of reproduction, incubation, and migration, under the terms of the Convención Interamericana para la Protección y Conservación de las Tortugas Marinas, approved through Ley 7906 del veinticuatro de septiembre de mil novecientos noventa y nueve.
From this perspective, when the Secretaría Técnica Nacional Ambiental granted environmental approval (viabilidad ambiental) to the project of Rover Path de Guanacaste in resolution number 1349-2005-SETENA de las once horas veinticinco minutos del nueve de junio del dos mil cinco, it did not take the provisions of that Law into account. Although this Chamber was informed under oath that the administrative record did not indicate that expropriation of the project area was planned, it is also true that this constituted another implicit indication or warning to the respondent Secretaría Técnica that this was not an ordinary property, but rather a property located within a national park, with a purpose different from that of merely private property, and therefore it was essential to adopt all necessary measures to protect the natural resources that the creation of that national park was intended to protect.
VIII.In view of the foregoing, the proper course is to grant this amparo petition (recurso de amparo), which entails once again advising the Secretaría Técnica that it may not continue granting construction permits and environmental approvals without considering the provisions of the law creating the park, which was created more than ten years ago and whose purpose, as observed, is the State’s acquisition of the land located within that national park. In addition, it must be taken into account that, in judgment number 2008-008713 de las nueve horas seis minutos del veintitrés de mayo del dos mil ocho, partially transcribed herein, this Chamber granted the constitutional challenge (acción de inconstitucionalidad) number 06-008369-0007-CO filed against the Reglamento de Zonificación Distrito Cabo Velas, Sector Costero, approved by the Municipalidad de Santa Cruz and published in La Gaceta number 127 del tres de julio del dos mil seis.
In that judgment, the Chamber annulled that regulation—which encompassed the area where the property at issue in this amparo proceeding is located—and unanimously held that this body of regulations infringed the Law of the Constitution, as well as the rules of international law in force in the country and the laws concerning the protection of wildlife, the environment, and the natural heritage of the Nation, which impose an obligation to adopt measures to preserve the leatherback turtle’s habitat, as well as areas whose conditions and characteristics make them a natural destination for its nesting and egg-laying. For these reasons, in this particular case, the proper course is to annul the permits granted to Rover Path de Guanacaste Sociedad Anónima for the construction of a residence at Playa Ventanas within the seventy-five-meter strip that forms part of Parque Nacional Marino Las Baulas.
Furthermore, based on the considerations set forth above and in view of the Chamber’s most recent holdings on this matter, including judgment number 2008-008713 de las nueve horas seis minutos del veintitrés de mayo del dos mil ocho and, specifically, the findings in judgment number 2008-007549 de las diecisiete horas treinta y ocho minutos del treinta de abril del dos mil ocho, the proper course is to order the immediate commencement of the expropriation proceedings referenced in Ley número 7524 de diez de julio de mil novecientos noventa y cinco, so that this property is transferred to the State.
Por tanto:
The petition is granted and, consequently, resolution number 1349-2005-SETENA de las once horas veinticinco minutos del nueve de junio del dos mil cinco, through which the Plenary Commission of the Secretaría Técnica Nacional Ambiental granted environmental approval for the residential construction project of Rover Path de Guanacaste Sociedad Anónima, is annulled. Likewise, any other authorization that may have been granted for construction on that property is annulled. Jorge Rojas Soto, in his capacity as Secretary General of the Secretaría Técnica Nacional Ambiental, or whoever holds that office in his stead, is ordered to immediately issue the necessary instructions so that the competent bodies may initiate the appropriate administrative proceedings to expropriate the property at issue in this amparo proceeding. He is further advised that failure to comply with this order will constitute the offense of disobedience and that, pursuant to artículo 71 de la Ley de esta jurisdicción, any person who receives an order issued in an amparo proceeding that the person is required to comply with or enforce, and who fails to comply with or enforce it, shall be sentenced to imprisonment for tres meses a dos años, or a fine of veinte a sesenta días, provided that the offense is not subject to a more severe penalty.
The State is ordered to pay the costs, damages, and losses caused by the events underlying this ruling, which shall be assessed during enforcement of the judgment before the administrative-litigation jurisdiction (jurisdicción de lo contencioso administrativo). This resolution shall be personally served upon Jorge Rojas Soto, in his capacity as Secretary General of the Secretaría Técnica Nacional Ambiental, or whoever holds that office in his stead. Recurso de amparo interpuesto por Mario Andrés Boza Loría, cédula de identidad número 1-297-932, en su condición de Apoderado Generalísimo sin límite de suma de la organización conservacionista Fideicomiso Baulas; y a favor de ésta; contra la Secretaría Técnica Nacional Ambiental (SETENA).
Resultando:
Redacta el Magistrado Mora Mora; y,
Considerando:
I.Hechos probados. De importancia para la decisión de este asunto, se estiman como debidamente demostrados los siguientes hechos: a) que la sociedad Rover Path of Guanacaste Sociedad Anónima es dueña de un terreno ubicado en Playa Ventanas, en provincia de Guanacaste y que se encuentra dentro de la zona restringida de la zona marítimo terrestre, frente a una playa de anidación de la tortuga baula, dentro de los límites del Parque Nacional Marino Las Baulas (ver manifestaciones rendidas bajo juramento de folios 30, 31 y 264 y documentos de folios 81 y 268); b) que según criterio de la Secretaría Técnica Nacional Ambiental, la Ley de Creación del Parque Nacional Marino Las Baulas sí contempla el área donde está ubicada esa propiedad pero no consta que ni a corto ni a mediano plazo se tenga prevista la expropiación del inmueble para que pertenezca al Estado (ver manifestaciones rendidas bajo juramento de folios 28 y 29); c) que el veinticuatro de agosto del dos mil cuatro, el representante de Rover Path of Guanacaste Sociedad Anónima solicitó a la Secretaría Técnica Nacional Ambiental que se otorgara la viabilidad ambiental para construir una casa de habitación en ese inmueble (folios 1 al 30 del funcionarios de la Secretaría Técnica Nacional Ambiental en resolución número DAP-194-2004-SETENA del treinta de septiembre del dos mil cuatro, recomendaron a la Comisión Plenaria solicitar un Plan de Gestión Ambiental (folio 32 del 1800-2004-SETENA de las once horas diez minutos del veinte de octubre del dos mil cuatro, la Comisión Plenaria de la Secretaría Técnica Nacional Ambiental solicitó a la Sociedad Rover Path de Guanacaste la presentación de un Plan de Gestión Ambiental (folio 41 del expediente administrativo); f) que mediante resolución número 1349—2005—SETENA de las once horas veinticinco minutos del nueve de junio del dos mil cinco, la Comisión Plenaria de la Secretaría Técnica Nacional Ambiental otorgó la viabilidad ambiental al proyecto de casa de habitación de Rover Path de Guanacaste Sociedad Anónima al considerar que el plan de gestión ambiental cumplía con los requerimientos técnicos exigidos (folio 69 del expediente administrativo); g) que mediante resolución número 2076-2005-SETENA de las trece horas cuarenta y cinco minutos del diecisiete de agosto del dos mil cinco, la Comisión Plenaria de la Secretaría Técnica Nacional Ambiental resolvió suspender la ejecución de la resolución anterior número 1349—2005—SETENA de las once horas veinticinco minutos del nueve de junio del dos mil cinco hasta tanto la Sala Constitucional no disponga otra cosa (folio 37); h) que la tortuga baula es una especie de relevancia mundial con una condición crítica en términos de su estado de conservación por lo que no es aceptable ni justificable que se generen instrumentos jurídico administrativos que, lejos de fortalecer las acciones de conservación, más bien propicien acciones humanas como construcciones que atentan de manera directa o colateral los espacios de anidación los cuales resultan vitales para garantizar la reproducción de la especie (ver manifestaciones rendidas bajo juramento de folio 253); i) que técnicamente no es una opción viable considerar separada la franja costera de la zona marina y sobre todo obviar la relación existente entre los manglares de Tamarindo-Salinas y el del estero Ventanas con el sector marino protegido por el Parque Nacional Marino Las Baulas (ver manifestaciones rendidas bajo juramento de folio 255); j) que la construcción de casas en la zona ocasionaría impactos muy severos al ecosistema pues las perturbaciones que genera ocasionan cambios rápidos y grandes en tanto el ecosistema se recupera lentamente, lo que provocará que se afecte de manera importante la estabilidad del ecosistema del Parque Nacional Marino Las Baulas, de modo que el efecto a corto, mediano y largo plazo sería enorme, con lo cual no es solo un efecto directo y de corto plazo el que se provocaría sobre las poblaciones de tortuga baula, sino prácticamente sobre todo el ecosistema marino (ver manifestaciones rendidas bajo juramento de folio 255).
II.Sobre el derecho a un ambiente sano y ecológicamente equilibrado. El artículo 50 de la Constitución Política establece que toda persona tiene derecho a un ambiente sano y ecológicamente equilibrado. Ambos derechos se encuentran reconocidos expresamente en el artículo 50 de la Constitución Política que perfila el Estado Social de Derecho de forma que la Constitución Política enfatiza que la protección del medio ambiente es un mecanismo adecuado para tutelar y mejorar la calidad de vida de todos, lo que hace necesaria la intervención de los poderes públicos sobre los factores que pueden alterar su equilibrio y obstaculizar que la persona se desarrolle y desenvuelva en un ambiente sano. En ese sentido, este derecho se manifiesta en la doble vertiente: como derecho subjetivo de las personas, y como meta o fin de la acción de los poderes públicos en general, por lo que el Estado debe garantizarlo, defenderlo y preservarlo.
En ese sentido, se debe vedar, prohibir e impedir toda actividad que atente contra el derecho y desplegar acciones dirigidas a proteger anticipadamente el derecho de posibles peligros, a efectos de hacerlo perdurar para futuras generaciones. Por lo anterior, el Estado debe por un lado abstenerse de atentar él mismo contra el ambiente, y por otro lado, debe asumir la tarea de dictar las medidas que permitan cumplir con los requerimientos constitucionales, dentro de las cuales se encuentran las de carácter preventivo.
III.Obligaciones del Estado en materia ambiental. Deriva del citado artículo 50 de la Constitución, el carácter de garante que ostenta el Estado de la conservación de un ambiente sano y ecológicamente equilibrado. Esta obligación implica, en los términos en que lo ha dicho la Sala en otras ocasiones como en la sentencia número 2001-13295 de las doce horas seis minutos del veintiuno de diciembre del dos mil uno, entre otras:
“...que el Estado debe tomar todas las medidas técnicas posibles para asegurarse que la actividad que aprueba no causará daños al ambiente. Si bien el pronunciamiento del órgano estatal encargado es en sí un asunto técnico, el deber de pronunciarse y la exigencia de rigurosidad es un asunto jurídico. En términos generales, el deber estatal de garantizar el derecho a un ambiente sano no se reduce a satisfacer un simple requisito marginal dentro del proceso licitatorio. La Constitución no exige solo cumplir con ciertas formalidades, sino utilizar como se dijo todos los medios jurídica y fácticamente posibles para preservar el ambiente.” (ver en el mismo sentido la resolución número 05906-99 de las dieciséis horas quince minutos del veintiocho de julio de mil novecientos noventa y nueve).
Deber que, según lo reconoce esa misma sentencia, recae con mayor especificidad sobre la Secretaría Técnica Nacional Ambiental, aquí recurrida:
“La preocupación ambiental del Ministerio del Ambiente y Energía se reduce prácticamente a los estudios de impacto ambiental, cuya aprobación está en manos de SETENA. Es decir, en SETENA recae todo el deber del Estado de garantizar un ambiente sano y ecológicamente equilibrado, como indica el artículo 50 constitucional. Ante tan importante responsabilidad, sería razonable esperar la fortaleza técnica y administrativa del órgano encargado.”(ver sentencia número 2001-13295 de las doce horas seis minutos del veintiuno de diciembre del dos mil uno) Es en este sentido que, en materia ambiental, resulta especialmente grave toda conducta omisiva estatal que tenga como resultado un desmejoramiento de las condiciones del medio ambiente (así se deduce de las sentencias número 9735-00 de las nueve horas seis minutos del tres de noviembre del dos mil y número 1645-02 de las once horas cuatro minutos del quince de febrero del dos mil dos, entre otras).
IV.Sobre el principio precautorio y el desarrollo sostenible. Además de lo dicho, resulta de importancia para la resolución de este asunto, tener en cuenta dos principios de especial relevancia en materia ambiental, como lo son el principio precautorio y el principio de desarrollo sostenible. En cuanto al primero, debe indicarse que esta Sala ha reconocido que en la protección de nuestros recursos naturales, debe existir una actitud preventiva, a partir de la cual el Estado tiene que disponer todo lo que sea necesario – dentro del ámbito permitido por la ley – a efecto de impedir que se produzcan daños irreversibles en el medio ambiente. Es el también llamado principio de “evitación prudente”, contenido en la Conferencia de las Naciones Unidas sobre el Medio Ambiente y el Desarrollo, Declaración de Río, que literalmente indica:
"Principio 15.- Con el fin de proteger el medio ambiente, los Estados deberán aplicar ampliamente el criterio de precaución conforme a sus capacidades. Cuando haya peligro de daño grave e irreversible, la falta de certeza científica absoluta no deberá utilizarse como razón para postergar la adopción de medidas eficaces en función de los costos para impedir la degradación del medio ambiente".
En consecuencia, deben desplegarse actuaciones anticipadamente para evitar los efectos negativos de un proyecto, y asegurar la protección, conservación y adecuada gestión de los recursos. Consecuentemente, el principio rector de prevención se fundamenta en la necesidad de tomar y asumir todas las medidas precautorias para evitar o contener la posible afectación del ambiente o la salud de las personas. De esta forma, en caso de que exista un riesgo de daño grave o irreversible -o una duda al respecto- se debe adoptar una medida de precaución e inclusive posponer la actividad de que se trate. Lo anterior debido a que en materia ambiental la coacción a posteriori resulta ineficaz, por cuanto de haberse producido ya las consecuencias biológicas y socialmente nocivas, la represión podrá tener una trascendencia moral, pero difícilmente compensará los daños ocasionados al ambiente. Partiendo de ello, nace la necesidad de que todo Estado alcance su progreso de la mano con la naturaleza, pues sólo a través del desarrollo sostenible, puede garantizarse la existencia de recursos a las generaciones presentes y futuras, surgiendo así el segundo principio denominado “desarrollo sostenible”.
Sobre este último la Sala se ha referido en otras oportunidades, siendo un ejemplo de ello la sentencia número 2006-13461 de las diez horas con veinte minutos del ocho de septiembre del dos mil seis, en la cual dispuso en lo conducente:
“... En esa tesitura, el artículo 3, inciso 4), de la Convención Marco señalada dispone, expresamente, que “Las Partes tienen derecho al desarrollo sostenible y deberían promoverlo... ”.
Asimismo, el principio del desarrollo sostenible está previsto en la Declaración de Río de 1992 sobre el Medio Ambiente y Desarrollo que dispone en numeral 3° lo siguiente:
“El derecho al desarrollo debe ejercerse en forma tal que responda equitativamente a las necesidades de desarrollo y ambientales de las generaciones presentes y futuras.” Bajo este principio de desarrollo sostenible, se reconoce la necesidad de alcanzar el desarrollo del país en aras de atender las insuficiencias sociales y económicas que se padecen. Pero proclama que el desarrollo se realice sin destruir el medio ambiente y sin agotar las existencias de recursos naturales, permitiendo que el uso de estos recursos no sea superior a su capacidad de reposición. Por ello, se reconoce la posibilidad de desarrollo del país pero el mismo no debiera ir en abierto detrimento del medio ambiente. El principio de desarrollo sostenible –ampliamente reconocido por este Tribunal– trasciende las cuestiones meramente ambientales, porque se erige como un objetivo en el ámbito de la ciencia económica, pues además de procurar preservar los recursos naturales que dan soporte a la vida de los seres humanos, también persigue la eficiencia en la utilización de los recursos para que se consiga el desarrollo que satisfaga las necesidades de las generaciones presentes y futuras, sin comprometer la disponibilidad de los recursos naturales en general.
Conforme con lo expuesto, una gestión sostenible de los recursos implica satisfacer las necesidades de los países, teniendo en consideración los requerimientos de las generaciones presentes y futuras y balanceando tres objetivos principales: ambiental, social y económico. Lo anterior, en aras de invertir las tendencias que amenazan la calidad de vida de los seres humanos y evitar un aumento de los costos para la sociedad. En ese sentido, es preciso detener la continua degradación ambiental con medidas tendientes a atenuar los efectos negativos del desarrollo económico y social y velar por la existencia de un vínculo sostenible entre la humanidad y la naturaleza. Incluso, la adopción de políticas sostenibles está basada en la concordancia entre el crecimiento económico, la equidad social y la conservación de los recursos naturales, fomentando el uso de energías renovables y el aumento de la eficiencia energética (ver en ese sentido la sentencia 2007-006315 de las catorce horas treinta y tres minutos del nueve de mayo del dos mil siete). Al desarrollar este principio, este Tribunal ha señalado lo siguiente:
“(…) De hecho, la división entre recursos naturales renovables y no renovables es moderna, pues aún la ciencia económica, que se preocupa de la administración del entorno para lograr la satisfación (sic) al máximo de las necesidades humanas con recursos limitados, no incorporó el desgaste y deterioro del medio como herramienta del análisis económico, sino hasta en fecha muy reciente.
Toda la vida del hombre ocurre en relación inevitable con su ambiente, en especial con el mejoramiento de la calidad de vida que es el objetivo central que el desarrollo necesita, pero éste debe estar en relación con el ambiente de modo tal que sea armónico y sustentable.
El ambiente, por lo tanto, debe ser entendido como un potencial de desarrollo para utilizarlo adecuadamente, debiendo actuarse de modo integrado en sus relaciones naturales, socioculturales, tecnológicas y de orden político, ya que, en caso contrario, se degrada su productividad para el presente y el futuro y podría ponerse en riesgo el patrimonio de las generaciones venideras. Los orígenes de los problemas ambientales son complejos y corresponden a una articulación de procesos naturales y sociales en el marco del estilo de desarrollo socioeconómico que adopte el país. Por ejemplo, se producen problemas ambientales cuando las modalidades de explotación de los recursos naturales dan lugar a una degradación de los ecosistemas superior a su capacidad de regeneración, lo que conduce a que amplios sectores de la población resulten perjudicados y se genere un alto costo ambiental y social que redunda en un deterioro de la calidad de vida; pues precisamente el objetivo primordial del uso y protección del ambiente es obtener un desarrollo y evolución favorable al ser humano.
La calidad ambiental es un parámetro fundamental de esa calidad de vida; otros parámetros no menos importantes son salud, alimentación, trabajo, vivienda, educación, etc., pero más importante que ello es entender que si bien el hombre tiene el derecho de hacer uso del ambiente para su propio desarrollo, también tiene el deber de protegerlo y preservarlo para el uso de las generaciones presentes y futuras, lo cual no es tan novedoso, porque no es más que la traducción a esta materia, del principio de la "lesión", ya consolidado en el derecho común, en virtud del cual el legítimo ejercicio de un derecho tiene dos límites esenciales: Por un lado, los iguales derechos de los demás y, por el otro, el ejercicio racional y el disfrute útil del derecho mismo. (…)” Sentencia 3705-1993 de las quince horas del treinta de julio de mil novecientos noventa y tres.” En consecuencia, a partir de los principios comentados se reconoce la necesidad de que cualquier proyecto que se desarrolle ya sea por el Estado o por un sujeto de derecho privado, vaya de la mano con el ambiente, pues si bien no puede negarse el progreso de una Nación, éste debe enmarcarse dentro de parámetros adecuados de sostenibilidad, para asegurar la conservación de los recursos a las generaciones futuras (sentencia 2007-006315 de las catorce horas treinta y tres minutos del nueve de mayo del dos mil siete). Esto sin duda debe tenerse en consideración al momento de valorarse el fondo del presente asunto.
V.Sobre el fondo. En sentencia número 2008-018529 de las ocho horas y cincuenta y ocho minutos del dieciséis de diciembre del dos mil ocho, esta Sala resolviendo un asunto similar al que ahora se analiza, consideró:
“VIII.- En conclusión.- Dada la importancia de la existencia y protección del Parque Marino las Baulas desde el punto de vista de conservación y protección al medio ambiente, dado que SETENA ha estado otorgando la viabilidad ambiental a proyectos situados dentro del parque y en su zona de amortiguamiento de forma individual sin haber hecho un análisis sobre el impacto integral que tales construcciones producirían en todo el ecosistema del Parque, dado que la Municipalidad de Santa Cruz ha otorgado permisos de construcción dentro del parque y su zona de amortiguamiento incluso sin contar con la respectiva viabilidad ambiental, y tomando en cuenta el principio precautorio en materia ambiental, lo procedente es acoger el presente recurso con todas las consecuencias que se detallan en la parte dispositiva”.
Y en esa parte dispositiva, se indicó expresamente, en lo que interesa, lo siguiente:
“Se declara CON lugar el recurso, en consecuencia se: a) Anulan todas las viabilidades ambientales otorgadas en las propiedades ubicadas dentro del Parque Nacional Marino la Baulas, y se ordena al Ministerio de Ambiente y Energía continuar de inmediato con los procesos de expropiación de tales propiedades. b) Ordena a SONIA ESPINOZA VALVERDE, en su calidad de Secretaria General de la Secretaría Técnica Nacional Ambiental, o a quien ocupe este cargo, girar las instrucciones dentro del ámbito de su competencia para no tramitar nuevas viabilidad dentro del parque. c) Ordena a SONIA ESPINOZA VALVERDE, en su calidad de Secretaria General de la Secretaría Técnica Nacional Ambiental, o a quien ocupe este cargo, proceder en coordinación con el Ministerio de Ambiente y Energía, el Instituto Costarricense de Acueductos y Alcantarillados y las Municipalidades de Santa Cruz, Nandayure, Hojancha, Nicoya y Carrillo, a realizar un estudio integral sobre el impacto que las construcciones y el desarrollo turístico y urbanístico en la zona de amortiguamiento del Parque Nacional Marino Las Baulas producirían al ambiente y las medidas necesarias a tomar, en donde se valore si conviene mejor también impacto que el ruido, las luces, el uso de agua para consumo humano, las aguas negras y servidas, la presencia humana y otros produciría sobre todo el ecosistema de la zona, en especial, la tortuga baula (…)”.
A su vez, en sentencia número 2008-008713 de las nueve horas seis minutos del veintitrés de mayo del dos mil ocho en que se resolvió una acción de inconstitucionalidad sobre el reglamento de zonificación del distrito de Cabo Velas que incluía en su área geográfica de aplicación una parte del Parque Nacional Marino Las Baulas, por lo cual es aplicable al caso concreto, se estimó:
“D.- El área de protección que debe darse a la Tortuga Baula. Aún cuando la Sala no tiene dudas sobre la inviabilidad de los criterios que sirven de apoyo al Reglamento de Zonificación impugnado, así como para determinar si la población de las tortugas Baula se encuentra en un grave declive, y resolver cuál debe ser el área optima para garantizar que las tortugas desoven en las playas que regula el mencionado Reglamento de Zonificación, existen los Tratados internacionales y el artículo 50 constitucional como mecanismos jurídicos para dar protección pedida a este Tribunal. El principio precautorio obliga a la Sala a estimar la acción de inconstitucionalidad, en los términos que indica la jurisprudencia que “en caso de que exista un riesgo de daño grave o irreversible -o una duda objetiva al respecto-, se debe adoptar una medida de precaución e inclusive posponer la actividad de que se trate; por cuanto la coacción posterior resulta ineficaz en esta materia, dado que, en la mayoría de los casos, los efectos biológicos son irreversibles, donde la represión podrá tener una trascendencia moral, pero difícilmente compensará los daños ocasionados al ambiente.” (sentencia No. 2006-17126).
El Parque Nacional Las Bualas de Guanacaste tiene una finalidad muy clara: la protección del área de desove de la Tortuga Baula, que conforme al Decreto Ejecutivo No. 20518-MIRENEM se hace necesario para asegurar la perpetuidad de la colonia de la tortuga baula (Dermochelys coriacea) y otros recursos naturales, de la actividad turística y ecológica, respecto de la nidificación que se da durante todo el año. Llama a la atención de esta Sala que el proyecto de Ley de Creación del Parque reitera algunos criterios expresados por el Decreto Ejecutivo, y la preocupación por desarrollos hoteleros, pues con ello se implantará la iluminación, desechos, tránsito de personas, ruido de motores fuera de borda, música, discotecas y automóviles que vendrá a destruir este habitat natural. De ahí que se propuso inicialmente en el trámite legislativo una franja de protección de doscientos metros desde la pleamar ordinaria, sin embargo con el Dictamen Afirmativo de Mayoría, aún cuando se mantienen esas mismas justificaciones, reduce la franja de protección a 125 metros de la pleamar ordinaria, en el mismo sentido que lo hace el Decreto Ejecutivo mencionado.
Como nuestro país se ha comprometido internacionalmente a observar la protección y “hábitats de tortugas marinas” la acción de inconstitucionalidad debe declararse con lugar, y conforme al principio precautorio, así como el de vinculatoriedad de la normativa ambiental, la Zona Marítimo Terrestre igualmente debe incluirse como área de protección necesaria para las diferentes tortugas marinas que utilizan esa área como parte del ambiente utilizado por ellas durante sus etapas de su ciclo de vida.” Y se resolvió en aquélla oportunidad, en la parte dispositiva de esa sentencia, lo siguiente:
“Se declara CON LUGAR la acción. En consecuencia, se anula el Reglamento de Zonificación Distrito Cabo Velas dictado por el Concejo Municipal de Santa Cruz, publicado en La Gaceta No. 127 del 3 de julio de 2006. Esta sentencia tiene efectos declarativos y retroactivos a la fecha de vigencia del Reglamento anulado, sin perjuicio de derechos adquiridos de buena fe. Reséñese este pronunciamiento en el Diario Oficial La Gaceta y publíquese íntegramente en el Boletín Judicial. Notifíquese al accionante, a la Municipalidad de Santa Cruz y a la Procuraduría General de la República.-“ En el asunto bajo estudio, como prueba para mejor resolver se solicitó un informe técnico al Director de la Escuela de Biología Marina de la Universidad Nacional quien en documento visible en folios 247 a 258 hace importantes advertencias sobre las consecuencias a corto, mediano y largo plazo que podría provocar el proceso constructivo que desde hace mucho tiempo se ha venido desarrollando en el Parque Nacional Marino Las Baulas y específicamente en Playa Grande y Playa Ventanas, consecuencias que no solo afectarán de manera directa a las tortugas baula sino en general a todo el ecosistema que existe en la zona.
Ese informe concuerda plenamente con las consideraciones hechas por la Sala en las sentencias transcritas, en las que tomando en consideración el principio precautorio se estima que la zona debe protegerse, evitando la alteración del medio, para lo cual se señala que debe continuarse con el proceso expropiatorio que garantice la preservación del ecosistema. En dicho informe se señalan los efectos negativos que se pueden producir específicamente en cuanto a las tortugas por la iluminación artificial en playas de desove así como por la construcción de edificaciones que no guardan un retiro adecuado desde la playa. Se indica que ese retiro tiene como objetivo el proteger tanto el frente de la playa como el hábitat de anidación pues muchas especies de tortugas preferiblemente seleccionan playas anchas, libres de obstáculos para anidar, pero el desarrollo costero, especialmente al frente de las playas, puede reducir la cantidad y calidad de los sitios de anidación disponibles, con lo cual, cada tipo de desarrollo y cualquier barrera potencial necesita retirarse de la zona de arena y esto incluye luces, construcciones, objetos físicos como sillas, sombrillas, botes y equipo recreacional, entre otros.
Si el riesgo señalado no es desconocido para la mayoría de la población y mucho menos para la Secretaría Técnica Nacional Ambiental, lo lógico es que al emitirse una autorización como la que aquí se impugna, al menos se hubiera presupuesto el eventual riesgo de daño que se podría ocasionar en la medida en que el terreno en cuestión donde se proyecta construir, está dentro del Parque Nacional Marino Las Baulas y se resolviera sobre ello. Este parque nacional fue creado mediante Decreto Ejecutivo número 20518-MIRENEM de nueve de julio de mil novecientos noventa y uno, siendo su principal objetivo la protección a perpetuidad de la colonia de tortuga baula (Dermochelys coriacea) y de los otros recursos naturales existentes en el área, tomándose en cuenta que existen tres áreas de importancia mundial donde anidan las tortugas marinas baula, siendo dos de esos sitios: las playas Grande y Langosta en la Bahía Tamarindo, donde justamente está ubicada la playa Ventanas, sitio en el que se encuentra el inmueble al que se refiere este amparo.
Todo lo considerado conlleva a que en el caso deba aplicarse el principio precautorio y optar por no poner en peligro el bien que pretende protegerse con la legislación relacionada con la constitución del Parque Nacional Marino Las Baulas y específicamente en Playa Grande y Playa Ventanas. El principio de desarrollo sostenible, también aplicable aquí, conlleva que no se otorgara la viabilidad ambiental en el caso concreto pues como se dijo supra, es obligación del Estado propiciar que el desarrollo se realice sin destruir el medio ambiente y sin agotar las existencias de recursos naturales, permitiendo que el uso de estos recursos no sea superior a su capacidad de reposición, con lo cual, la posibilidad de desarrollo del país no debe ir en abierto detrimento del medio ambiente, persiguiéndose la eficiencia en la utilización de los recursos para que se consiga el desarrollo que satisfaga las necesidades de las generaciones presentes y futuras, sin comprometer la disponibilidad de los recursos naturales y en este caso, sin comprometer más a la especie de tortugas baulas, de lo que ya de por sí lo está.
VI.Además debe tomarse en cuenta que tratándose concretamente de la preservación de las tortugas marinas, Costa Rica firmó –el treinta y uno de enero de mil novecientos noventa y siete– y aprobó –el veintitrés de agosto de mil novecientos noventa y nueve– la Convención Interamericana para la Protección y Conservación de las Tortugas Marinas, cuyo anexo segundo, sobre la protección y conservación de los hábitats de estos animales dispone:
“Cada Parte considerará y, de ser necesario, podrá adoptar, de acuerdo con sus leyes, reglamentos, políticas, planes y programas, medidas para proteger y conservar, dentro de sus territorios y en las áreas marítimas respecto a las cuales ejerce soberanía, derechos de soberanía o jurisdicción, los hábitats de las tortugas marinas, tales como:
VII.Aunado a lo anterior, la Sala advierte que a pesar de que mediante Ley 7524 del diez de julio de mil novecientos noventa y cinco, denominada Ley de Creación del Parque Nacional Marino Las Baulas de Guanacaste, este parque se creó por el interés y voluntad del Estado de adquirir los terrenos ubicados dentro del mencionado parque nacional, lo cierto del caso es que, como ya se ha dicho en la sentencia número 2008-007549 de las diecisiete horas treinta y ocho minutos del treinta de abril del dos mil ocho, a pesar de que esa Ley entró en vigencia desde el dieciséis de agosto de mil novecientos noventa y cinco, el plazo transcurrido para que el Poder Ejecutivo comenzara la expropiación de esos inmuebles, de casi diez años, es injustificado y lesiona los derechos protegidos en los artículos 21 y 50 de la Constitución Política en cuanto soslaya el Estado su obligación de tomar las medidas apropiadas y necesarias, de conformidad con el derecho internacional y sobre la base de los datos científicos más fidedignos disponibles, para la protección, conservación y recuperación de las poblaciones de tortugas marinas y de sus hábitat, entre ellas, la restricción de las actividades humanas que puedan afectar gravemente a las tortugas marinas, sobre todo durante los períodos de reproducción, incubación y migración en los términos de la Convención Interamericana para la Protección y Conservación de las Tortugas Marinas aprobada por medio de la Ley 7906 del veinticuatro de septiembre de mil novecientos noventa y nueve.
Bajo esta perspectiva, cuando se otorgó la viabilidad ambiental al proyecto de la empresa Rover Path de Guanacaste por parte de la Secretaría Técnica Nacional Ambiental en resolución número 1349-2005-SETENA de las once horas veinticinco minutos del nueve de junio del dos mil cinco, no se tomó en cuenta lo dispuesto por esa Ley y aún cuando bajo juramento se haya informado a esta Sala que no constaba en el proyecto, también es lo cierto que ello era otra señal o advertencia implícita para la Secretaría Técnica recurrida en el sentido de que no se trataba de una propiedad cualquiera sino de un inmueble ubicado dentro de un parque nacional, con una vocación diferente a la de la mera propiedad privada y por tanto, era indispensable que se adoptaran todas las medidas que fueran necesarias para proteger los recursos naturales que se pretenden proteger con la creación de ese parque nacional.
VIII.En atención a lo dicho lo procedente es declarar con lugar este recurso, que conlleva se señale nuevamente a la Secretaría Técnica que no es posible que se siga otorgando permisos de construcción y viabilidades ambientales sin tomar en consideración lo dispuesto en la ley de creación del parque con más de diez años de haberse creado y, que como se observó, tiene por finalidad la adquisición por parte del Estado de los terrenos ubicados dentro del mencionado parque nacional. Aunado a lo anterior debe tomarse en cuenta que esta Sala en sentencia número 2008-008713 de las nueve horas seis minutos del veintitrés de mayo del dos mil ocho, transcrita en parte, declaró con lugar la acción de inconstitucionalidad número 06-008369-0007-CO que se interpuso en contra del Reglamento de Zonificación Distrito Cabo Velas, Sector Costero aprobado por la Municipalidad de Santa Cruz y publicado en La Gaceta número 127 del tres de julio del dos mil seis.
En esa sentencia la Sala anuló ese reglamento -que abarcaba la zona donde se ubica el inmueble al que se refiere este amparo- y consideró en forma unánime que ese cuerpo normativo infringía el Derecho de la Constitución así como las normas de derecho internacional vigentes en el país y las leyes relativas a la protección de la fauna, el ambiente y el patrimonio natural de la Nación, las cuales imponen la obligación de adoptar medidas para conservar el hábitat de la tortuga baula así como de las áreas que por sus condiciones y características son un destino natural para su anidación y desove. Por tales razones, en el caso concreto, lo procedente es anular los permisos otorgados a la empresa Rover Path de Guanacaste Sociedad Anónima, para la construcción de una casa de habitación en Playa Ventanas dentro de la franja de setenta y cinco metros que constituye parte del Parque Nacional Marino Las Baulas.
Además de ello, al amparo de las consideraciones externadas supra y en atención a los últimos criterios externados por la Sala en esta materia como la sentencia número 2008-008713 de las nueve horas seis minutos del veintitrés de mayo del dos mil ocho y específicamente por lo considerado en la sentencia número 2008-007549 de las diecisiete horas treinta y ocho minutos del treinta de abril del dos mil ocho, lo procedente es ordenar que se inicien de manera inmediata los procedimientos de expropiación a que hace referencia la Ley número 7524 de diez de julio de mil novecientos noventa y cinco de manera tal que ese inmueble pase a manos del Estado.
Por tanto:
Se declara con lugar el recurso y en consecuencia, se anula la resolución número 1349-2005-SETENA de las once horas veinticinco minutos del nueve de junio del dos mil cinco, mediante la cual la Comisión Plenaria de la Secretaría Técnica Nacional Ambiental otorgó la viabilidad ambiental al proyecto de construcción de casa de habitación de Rover Path de Guanacaste Sociedad Anónima. Del mismo modo se anula cualquier otra autorización que hubiera sido otorgada para la construcción de ese inmueble. Se ordena a Jorge Rojas Soto en su condición de Secretario General de la Secretaría Técnica Nacional Ambiental, o a quien en su lugar ejerza ese cargo, que de manera inmediata gire las instrucciones que sean necesarias a fin de que los órganos competentes inicien los procedimientos administrativos que sean procedentes para expropiar el inmueble al que se refiere este amparo, así mismo, que de no acatar la orden dicha, incurrirá en el delito de desobediencia y que, de conformidad con el artículo 71 de la Ley de esta jurisdicción, se le impondrá prisión de tres meses a dos años, o de veinte a sesenta días multa, a quien recibiere una orden que deba cumplir o hacer cumplir, dictada en un recurso de amparo y no la cumpliere o no la hiciere cumplir, siempre que el delito no esté más gravemente penado.
Se condena al Estado al pago de las costas, daños y perjuicios causados con los hechos que sirven de base a esta declaratoria, los que se liquidarán en ejecución de sentencia de lo contencioso administrativo. Notifíquese esta resolución a Jorge Rojas Soto en su condición de Secretario General de la Secretaría Técnica Nacional Ambiental, o a quien en su lugar ejerza ese cargo, en forma personal.
