Writ of amparo (recurso de amparo) proceeding under expediente number 11-004776-0007-CO, filed by NURIA MARÍA CAMPOS CASTRO, identity card 0107720490, against the MUNICIPALIDAD DE ACOSTA, the INSTITUTO MIXTO DE AYUDA SOCIAL, the CONSEJO NACIONAL DE VIALIDAD, the MINISTERIO DE SALUD, and the MINISTERIO DE OBRAS PÚBLICAS Y TRANSPORTES.

Findings of Fact:

  1. 1In a brief filed with the Court’s Clerk’s Office at 12:05 on 25 de abril de 2011, the petitioner filed a writ of amparo against the Municipalidad de Acosta, the Instituto Mixto de Ayuda Social, the Consejo Nacional de Vialidad, the Ministerio de Salud, and the Ministerio de Obras Públicas y Transportes, and states that her home is located in San Ignacio de Acosta and has been in danger for several years because stormwater (aguas pluviales) is channeled through the gutter and culvert system, which collects all the water coming from several residential areas located above her property. She states that the situation has worsened in recent years due to the increase in new construction, the installation of a pipeline and culvert by the Ministerio de Obras Públicas y Transportes to channel water coming from route 209, and, principally, the climatic events that have seriously affected the area in recent years.This has created a grave danger because the drainage channel (desagüe) running alongside her property is growing ever larger and destabilizing the land. She emphasizes that originally there were only a few small houses and other livestock-related structures at that location, and that the Municipalidad at the time, with the owners’ consent, installed a culvert and built a concrete-and-stone gutter extending along what is now the boundary of her property and emptying into the local stream (quebrada). That gutter operated without any problems until approximately ten years ago, but, due to the aforementioned causes, the increase in the volume of water has been so great that it has completely destroyed it. She asserts that she has repeatedly submitted requests to the Municipalidad de Acosta to have the problem resolved, but to date she has received no response; the only thing she has been told verbally is that nothing can be done because the owner of the property where the problem is located is the Mayor’s brother.She has been advised to bring her case before I.M.A.S. or the Ministerio de Salud so that they may determine who is responsible and ensure that the water flows normally without causing any damage. She adds that, in response to one of her requests, the Ministerio de Salud informed her that, pursuant to sections 94 and 95 of the Ley de Aguas, it could not intervene, despite the fact that the problem she faces is not natural in origin but rather results from human intervention, since this water is channeled through the gutter and culvert system implemented by the various government agencies, which failed to complete adequate infrastructure for managing the water. She states that, after receiving the response from the Ministerio de Salud, she again approached the respondent Alcaldía Municipal, where she was verbally informed that there was no budget. She asserts that her persistence and efforts to protect her home have been such that she once again approached the Municipalidad, at which time, with the assistance of the Secretaria Municipal, she drafted a new letter addressed to the Concejo Municipal, dated 03 de agosto de 2010, requesting its intervention so that her case would be referred to I.M.A.S. to assist her in constructing a retaining wall (muro) that would minimize the deterioration of her land, which, if it continues to deteriorate, will soon undermine her house.She has received no response to that request either. She mentions that last year the rains severely affected the Acosta area and that her property was no exception; the channel through which the water flows alongside her house became so large that, at times, water even entered her house, carrying stones and tree trunks that endangered her entire family. During September and October, the rainiest months, she had to rent a house elsewhere because the danger was too great, as the volume of water continued increasing and the situation continued worsening because the land was becoming unstable. In view of the foregoing, her neighbor allowed her to divert the water slightly onto his land temporarily, until the problem could be resolved; recently, however, that neighbor brought in machinery to redirect the water to its original channel, once again placing her property at high risk. She adds that the rainy season is approaching and that this greatly concerns her because the respondent Municipalidad has not resolved anything; accordingly, by means of a letter dated 14 de marzo anterior, she again contacted the Concejo Municipal regarding the same matter, but received no response. She requests prompt intervention and a definitive solution to her problem.
  2. 2By means of a document received by the Court’s Clerk’s Office on 28 de abril de 2011, a copy was received of a letter addressed to the Director Ejecutivo del CONAVI and signed by the subdirectora de la Dirección Jurídica del Ministerio de Obras Públicas y Transportes, requesting a technical report regarding the facts alleged by the petitioner.
  3. 3María Luisa Ávila Agüero, in her capacity as Ministra de Salud, reports under oath that on 14 de junio de 2006 a visit was made to the petitioner’s home in response to a complaint that had been filed. On that occasion, it was verified that a drainage channel approximately 40 metros long, 70 cms wide, and un metro deep existed on the neighbor’s property and received a large volume of stormwater from the road and from homes located at a higher elevation and at un metro relative to the petitioner’s property, of which the petitioner was informed. Subsequently, on 28 de abril del año en curso, another inspection of the protected party’s home was conducted, and the corresponding sanitary orders (órdenes sanitarias) were issued against the Alcalde and the Presidente del Concejo, both of the Municipalidad de Acosta, and against the Director del CONAVI. Those orders will be served so that they may proceed to correct the damage caused.During the visit, the inspectors found that serious problems exist in the area identified in the complaint due to several factors: the abundance of stormwater, culvert crossings, and the lack of an appropriate structure for properly and hygienically collecting and channeling the stormwater. Accordingly, sanitary orders No. 001-29-4-2011 and No. 002-29-4-2001 and No. 03-29-4-200 were issued, requiring the recipients to submit a plan, proposal, and design for resolving the stormwater problem in that sector, including the petitioner’s home, and for constructing an adequate system to properly and hygienically collect and channel the stormwater. She requests that the petition be denied.
  4. 4Francisco J. Jiménez, in his capacity as Ministro de Obras Públicas y Transportes, reports under oath (see document filed at 16:20 hrs. on 03 de mayo de 2011) that this amparo action is time-barred because the gutters began experiencing problems ten years ago and the petitioner has only now sought relief from the Court, and, furthermore, the allegations concern a matter of ordinary legality (legalidad). Nevertheless, the gutters and sewer system are public services for which the Municipalidades are responsible, while administration of route 209, which passes through San Ignacio de Acosta, is the responsibility of the Consejo Nacional de Vialidad. He requests that the petition be denied.
  5. 5Carlos Acosta Monge, in his capacity as Director Ejecutivo del Consejo Nacional de Vialidad, reports under oath that on 5 de mayo de 2011 the Gerente de Conservación de Vías y Puentes del CONAVI informed him, by means of technical report Nº DR (Región Central)-33-11-0058, that he had visited the petitioner’s property and verified the reported damage, as well as the fact that it is located on a cantonal road (calle cantonal) in Potrerillos and that the water flows from the landslide site (sitio del deslizamiento) in La Ortiga, along national route 209. He states that the problem requires a comprehensive solution, including works to stabilize the roadway and the construction of water-conveyance structures extending to a discharge point, in a manner that ensures no harm is caused to the neighboring residents. He indicates that this Consejo expects to provide a solution through Direct Contracting (Contratación Directa) Nº 20011-CD-000016-CV0, which is currently undergoing award proceedings and was initiated to resolve problems requiring urgent attention along national route 209, among which the La Ortiga landslide is the most serious and complex. He considers that the petitioner’s property is located on a cantonal road in Potrerillos and that the Municipalidad de Acosta must therefore take the necessary measures.
  6. 6Fernando Marín Rojas, in his capacity as Executive President of IMAS, reports under oath that the petitioner lives in San Ignacio de Acosta, according to the social information form completed by IMAS. He states that this Institute’s intervention in the petitioner’s case arose from the referral made by the Área Rectora de Salud del Cantón de Acosta, pursuant to official letter Nº 001-30-09-2010 of 30 de septiembre de 2010, in coordination with the Comité Municipal de Emergencias de Acosta, by virtue of the state of emergency caused by tropical storm Thomas in the year 2010, when heavy rains caused damage in the area where the petitioner lives. As a result, on 01 de octubre de 2010, the petitioner was granted an emergency subsidy for the payment of rent, in the amount of one hundred fifty thousand colones, as recorded in resolution Nº 3858 of the administrative record (expediente administrativo) and in the letter of commitment to submit the corresponding rent receipts to IMAS.He maintains that he has no knowledge that, prior to the emergency described, the petitioner’s home was in danger as a result of stormwater (aguas pluviales) channeled through the system of gutters and culverts that collect all the water coming from several hamlets and neighboring houses located at elevations above her property. Likewise, no referral has ever been received from the Municipalidad de Acosta or from the petitioner requesting that a benefit be granted to the petitioner for the construction of a wall. He believes that, within the scope of its functions and powers, this Institute fully discharged its obligation to assist this family at the time of the emergency and that, pursuant to the constitutional principle of interagency coordination (principio constitucional de coordinación estatal), together with officials from other public entities, an on-site inspection was conducted and a census was taken of several families, including the petitioner’s, who must be relocated because their homes were declared uninhabitable.He considers that those families must apply for and process a housing grant through the Sistema Financiero Nacional de la Vivienda, which has already committed to providing up to the sum of fourteen million colones so that the homes may be rebuilt. He states that the geologist from the Comisión Nacional de Emergencias indicated that the construction of retaining walls (muros de retención) in the area was not appropriate. He adds that relocation and the subsequent provision of housing do not fall within the authority granted to IMAS by the legislature. He requests that the petition be denied.
  7. 7Luis Alberto Durán Gamboa, in his capacity as Municipal Mayor of the Municipalidad de Acosta, reports under oath that, by official letter dated 2 de julio de 2009, the Engineer of the Unidad Técnica de Gestión Vial reported to the Engineer responsible for national routes 209-301 the water problem on route 209, which was damaging the roadway and placing several houses at risk of flooding, and therefore requested that the water be channeled. By official letter A.M. 337-2009 of 17 de agosto de 2009, the Municipal Mayor forwarded to the Director de Conservación Vial a copy of memorandum OI (1-1)-454-2009, signed by the Unidad Técnico de Gestión Vial, confirming the existence of a water drop along a 6-meter slope without drainage, which flows toward the street, passing along the right side where there is a ditch and causing scouring (socavación); he therefore requested approval so that the required work could begin.On 16 de noviembre de 2009, the Engineer of the Unidad Técnica de Gestión Vial presented the aforementioned problem to the Concejo Municipal and proposed as a solution intercepting the water upstream, eliminating 100 meters of flow into the ditch, channeling the direct runoff portion, and enlarging the existing catch basin. Once again, by official letter A.M. 491-2009 dated 17 de noviembre de 2009, sent to the Organismo de Inspección, intervention was requested along the San Ignacio-La Esperanza de Acosta section of route 209 because the landslide problems had been referred to CONAVI without receiving attention, thereby endangering the lives of residents in the area. On 01 de febrero de 2010, a copy was forwarded to the then Municipal Mayor of official letter DVOP-385-10(01), addressed to the Executive Director of CONAVI and signed by the Vice Minister of Public Works, instructing that action be taken as soon as possible.On 22 de febrero de 2011, the Municipalidad sent official letter No. A.M.078-2011 to the Executive Director of CONAVI, requesting a report on the current process or risk-management stage (gestión de riesgo) of the intervention on route 209. In addition, official letter A.M.140-2011 was sent to the Executive Director of CONAVI, reiterating the requests for intervention regarding the problems described, without receiving a response. He believes that the petitioner’s case is not merely a problem involving the channeling of stormwater, but is a more complex problem because the home is located in a high-risk area and in the direct discharge zone for material that could eventually break away from the upper slope. Accordingly, coordination took place with the Geologist of the Comisión Nacional de Emergencia so that a comprehensive study of a possible massive landslide in the area could be conducted.He explains that, after reviewing reports of visits made to the site, it can be concluded that the petitioner must be relocated because of an imminent risk and that any construction work at the site is inappropriate. He requests that the petition be denied.
  8. 8Mauricio Fallas Durán, in his capacity as President of the Concejo Municipal of the Municipalidad de Acosta, reports under oath in the same terms as the report previously submitted by the Mayor of this Municipalidad.
  9. 9The legal requirements have been observed in the proceedings conducted.

Justice Rueda Leal drafted the opinion; and,

Whereas:

I.Proven facts. The following facts are deemed duly established and relevant to the decision in this matter, either because they have been proven or because the respondent failed to address them as ordered in the initial ruling:

  • a)The petitioner lives in San Ignacio de Acosta. (Undisputed fact) b) On 12 de junio de 2006, the petitioner filed a complaint with the respondent Área Rectora de Salud because of the improper channeling of water from neighboring properties. (See documentation submitted by the Ministra de Salud) c) By report No. DRAS-ACOSTA.096-2006 of 19 de junio de 2006, the respondent Área Rectora de Salud replied to the complaint filed by the petitioner. (See report of the Ministra de Salud) d) On 14 de junio de 2006, the respondent Área Rectora de Salud verified the existence of a drainage channel on the property neighboring the petitioner’s property, measuring 40 mts long, 70 cms wide, and one meter deep, which receives a large volume of water from the road and from homes located at a higher elevation. (See report of the Ministra de Salud) e) By official letter of 2 de julio de 2009, the Engineer of the Unidad Técnica de Gestión Vial of the respondent Municipalidad informed the official responsible for national routes 209-301 of the water problem caused by route 209.

(See report of the respondent Mayor) h) By official letter A.M. 491-2009 dated 17 de noviembre de 2009, the respondent Municipalidad requested that CONAVI intervene on route 209, along the San Ignacio-La Esperanza de Acosta section, because of the landslide problems, and received no response.

(See report of the respondent Mayor) i) On 03 de agosto de 2010, the petitioner requested that the respondent Municipalidad intervene by referring her case to I.M.A.S. so that she could obtain assistance with the construction of a wall. (See documentation submitted by the petitioner) j) IMAS never received any referral from the Municipalidad de Acosta or the petitioner requesting that a benefit be granted to the petitioner for the construction of a wall. (Report of the President of IMAS) k) On 01 de octubre de 2010, IMAS granted the petitioner an emergency subsidy for the payment of rent. (See report of the respondent authority) l) On 22 de febrero de 2011, the respondent Municipalidad sent official letter No. A.M.078-2011 to the Executive Director of CONAVI, requesting a report on the current process or risk-management stage of the intervention on route 209. (See report of the respondent Mayor) m) By memorandum No. oficio A.M.140-2011, the respondent Municipalidad reiterated to CONAVI its requests for intervention regarding the stormwater problems caused by route 209 and received no response.

(See report of the respondent Mayor) n) By report No. 001--29-4-2011, the inspectors of the Ministerio de Salud recorded that there is a drainage channel on the property neighboring the petitioner’s property, approximately six meters wide and 3 meters deep, which receives a large volume of stormwater from the road and from homes located at a higher elevation. (See report of the respondent Ministra) n) The community of Potrerillos de Acosta currently has serious problems due to the abundance of stormwater and the lack of channeling. (Report of the Ministra de Salud) o) On 14 de marzo de 2011, the petitioner requested that the Concejo Municipal of the respondent Municipalidad conduct an inspection to resolve the flooding caused by stormwater runoff. (See documentation submitted by the petitioner) p) On 29 de abril de 2011, the Área de Salud de Acosta issued health orders (órdenes sanitarias) No. 001-29-4-2011, No. 002-29-4-2001 and No. 03-29-4-200 against the President of the Concejo, the Mayor—both of the respondent Municipalidad—and CONAVI, ordering them to submit a plan, proposal, and design for resolving the stormwater problem in that area and to construct an adequate system for discharging and channeling the stormwater.

(See report of the Ministra de Salud) q) The petitioner’s home is located in a high-risk area and in the direct discharge zone for material that could eventually break away from the upper slope. (See report submitted by the respondent Mayor) r) The petitioner’s home was declared uninhabitable. (See report of the President of IMAS) r) The geologist of the Comisión Nacional de Emergencias indicated that the construction of retaining walls in the area was not appropriate. (See report of the President of IMAS)

II.Subject matter of the petition. The petitioner considers that her fundamental rights have been violated because the respondent authorities have not effectively and definitively resolved the problems of flooding, landslides, and soil instability (falseamiento de los terrenos) affecting the residents of San Ignacio de Acosta due to the improper channeling of water from route 209 and the lack of gutters and culverts for stormwater discharge.

III.On the principle of coordination. On various occasions, constitutional case law has indicated that environmental protection is a task that is equally incumbent upon everyone; that is, the State—as a whole—is under an obligation to take the measures necessary to protect the health and lives of those subject to the Administration (administrados). In this task, the term public institution must be understood to include both the Central Administration—Ministries such as the Ministerio de Obras Públicas y Transporte, the Ministerio de Ambiente, Energía y Telecomunicaciones, and the Ministerio de Salud—which, by reason of their subject matter, have broad involvement and responsibility with respect to the conservation and preservation of health and the environment; these institutions act, most often, through their specialized departments in the relevant field. Municipalities, of course, also bear significant responsibility for this task within their territorial jurisdiction.

It might therefore be thought that this multiple responsibility would cause chaos in administrative management; however, this is not the case because, in order to avoid the simultaneous coexistence of spheres of authority of different origins and natures, the duplication of national and local efforts, and confusion regarding the rights and obligations of the various parties involved, it is necessary to establish a series of coordinating relationships among the various departments of the Executive Branch and decentralized institutions, and between these institutions and the municipalities, so that they may carry out the functions entrusted to them. This Chamber previously—and quite clearly—addressed the principle of coordination between public agencies and municipalities in pursuing common objectives—which must obviously be extended to the relationship between Central Administration institutions and decentralized institutions in carrying out this important function—and therefore refers to what it stated on that occasion: “Thus, coordination is the ordering of relationships among these various independent activities, taking into account their convergence upon the same object or entity so as to make that convergence useful to an overall public plan, without eliminating the mutual independence of the participating entities.

Since there is no hierarchical relationship among decentralized institutions, or between the State itself and the municipalities, specific conduct cannot be imposed upon the latter. This gives rise to the indispensable interinstitutional ‘agreement,’ in the strict sense, whereby autonomous and independent centers of action reach agreement on that comprehensive preventive framework, within which each performs a role with a view to a mission entrusted to the others. Accordingly, relations between municipalities and other public entities may be conducted only on an equal footing, resulting in mutually agreed forms of coordination and excluding any compulsory arrangement detrimental to municipal autonomy that would subject corporate entities to a coordination framework without or against their consent; this does, however, permit the necessary subordination of those entities to the State and in the State’s interest (through the State’s ‘administrative oversight’ (tutela administrativa), and specifically through the function of reviewing legality that falls within its purview, with powers of general supervision over the entire sector).” (see judgment number 5445-99, at fourteen hours thirty minutes on July 14, 1999).-

IV.On the merits. In the present case, based on the documentary evidence submitted and the statements made under oath by the respondent authorities, the Chamber deems it established that the San Ignacio de Acosta area does in fact have a serious stormwater drainage (desfogue de aguas pluviales) problem that has even caused ground destabilization (falseamiento) and landslides, endangering the health and lives of the area’s residents. Because several public institutions are respondents in this proceeding, the actions of each will be analyzed separately.

V.Regarding the actions of the Municipalidad de Acosta.- This Court has repeatedly held that municipalities are obligated to safeguard the well-being of the inhabitants of their canton, pursuant to Article 169 of the Constitución Política, which entrusts the Municipal Government with the administration of the canton’s local services and interests. Likewise, this Chamber has clearly indicated that municipalities may not invoke a lack of budgetary resources as justification for failing to take action to remedy situations affecting the canton’s inhabitants, since it is unlawful to place purely economic considerations ahead of the protection of fundamental rights. Based on the foregoing, in this matter the Chamber finds that the respondent Municipality violated the amparo petitioner’s (amparada) right to health, failed in its responsibility to ensure the proper operation of public services, and violated the principle of coordination.

This is because, although the respondent Municipality determined several years ago that the petitioner (recurrente), her family, and the other residents of Potrerillos de Acosta faced a threat to their physical safety due to the heavy stormwater runoff flowing from Route 209 toward that area, it did not take the appropriate measures to correct the problem. Thus, in 2009 and at the beginning of the present year, the Municipality informed CONAVI of the problem caused by Route 209; however, CONAVI failed to respond to the requests submitted by the Municipal Mayor. Nevertheless, there is no evidence that the Municipality took any other action aimed at resolving the matter. The Chamber has repeatedly indicated that the role of municipalities must not be limited to referring health and environmental problems to other entities; rather, their obligation is to guarantee, defend, and preserve everyone’s right to enjoy a healthy and ecologically balanced environment.

In this Chamber’s view, despite having full knowledge of the problems affecting the residents of the Potrerillos de Acosta area, the Municipalidad de Acosta has merely confirmed their existence and referred the problem to CONAVI, thereby evading its responsibilities and duties. This demonstrates an inability to enforce the applicable laws, resulting in harm and a threat to public health. It must be recalled that, in situations such as this one, where the lack of adequate infrastructure is causing flooding and ground destabilization, the Municipality must act promptly, since a delay in carrying out the infrastructure works could even prove fatal, given that the physical safety and health of the area’s residents are at stake. Even if it is accepted that the Administration must operate within its budgetary appropriations, the fact remains that it has neglected its responsibility and has not taken the appropriate measures to protect the health and physical safety of the members of its community.

It should be recalled that municipalities, because of their proximity to citizens, are the first authorities called upon to fulfill their obligations and duties toward those subject to the Administration effectively and efficiently, including providing and maintaining the drainage outlets of the storm drains in good condition and proper working order. Accordingly, this appeal must be granted against the Municipalidad de Acosta for the constitutional violation of Articles 50 and 21 of the Constitución Política, to the detriment of the petitioners and the other residents of the San Ignacio de Acosta area, and the Municipality is ordered to take immediate and effective action to reduce the existing imminent danger and to commence the works required to resolve the sewerage problem at that location. The foregoing is without prejudice to its coordinating with the appropriate entities that may take the necessary steps to ensure that the sewerage system and the corresponding water drainage are adequate.

VI.- Regarding the actions of the Área Rectora de Salud de Acosta of the Ministerio de Salud.- Public health and environmental protection are principles safeguarded both at the constitutional level (Articles 21, 50, 73 and 89 of the Constitution) and under international law. The Ley General de Salud authorizes the Ministerio de Salud to adopt the appropriate health measures and impose sanctions; accordingly, that Ministry has not only the duty to enforce the Ley General de Salud, but also the duty to protect public health, which is classified as a matter of public interest, since the rights to health and to a healthy environment free from pollution—at least below the limits tolerable for human beings—are fundamental, inalienable rights, and their violation cannot legitimately be consented to. From the report submitted to this Chamber and the documentary evidence provided, it has been established that, after these proceedings were filed, inspectors from the Ministerio de Salud verified that there is a drainage channel on the property neighboring that of the appellant, approximately six meters wide and 3 meters deep, which receives a large volume of stormwater from the road and from homes located at a higher elevation.

Consequently, the community of Potrerillos de Acosta is currently experiencing serious problems due to the abundance of stormwater and the lack of proper drainage. In light of the foregoing, the health authority conducted an inspection and issued the corresponding health orders (órdenes sanitarias) against the Mayor, the President of the Concejo Municipal of the respondent Municipalidad, and CONAVI, ordering them to submit a plan, proposal, and design for resolving the stormwater problem in that area and for constructing an adequate system to properly collect and channel the stormwater. Nevertheless, its actions went no further, thereby failing to exercise the powers and duties conferred upon it by law, such as those established in Articles 355 and 356 of the Ley General de Salud, which authorize the competent health authorities, on their own authority, to order measures intended to prevent hazards from arising and to prevent harm from worsening or spreading, or the continued or repeated commission of statutory or regulatory violations that threaten human health.

Such measures may include orders to halt, demolish, or carry out works, as appropriate. In the case under review, the record establishes that, beyond the inspections conducted, the case file reflects no other action by this authority to provide a comprehensive solution to the problem. Accordingly, with respect to this institution as well, that omission warrants granting the constitutional protection action (recurso), because the health authorities failed to give the case the attention it required, thereby causing harm to the fundamental rights of all local residents. In a similar case, in Judgment No. 2006-08983, issued at eleven sixteen a.m. on the twenty-third of June 2006, the Chamber held: “This Constitutional Court finds that the Ministerio de Salud failed to fulfill its obligations to safeguard the right to health of the protected party and the other residents of the housing development in question, because it did not exercise its statutory powers to definitively resolve the health problem affecting them, which they had formally reported.

Its actions were insufficient, untimely, and ineffective, as demonstrated by the fact that the problem persists because it failed to take any concrete action in exercise of the police power vested in it by law to enforce its orders. The members of this Constitutional Court are therefore left with the impression that this was the conduct of a ‘paper Administration,’ whose activity ends with mere bureaucratic formalities, simply limiting itself to conducting inspections and issuing recommendations or health orders, without taking any measures to verify compliance and, worse still, without demonstrating any effective action genuinely directed toward definitively resolving the health problem presented, as required to fulfill the public purpose entrusted to it. This is detrimental to health and the environment and, consequently, violates Article 50 of the Constitution, a situation that this Chamber finds intolerable.” Based on the foregoing, and because there are no grounds for departing from the stated criterion or reconsidering the matter, the action must be granted with respect to the Ministerio de Salud, and it is ordered VII.- Regarding the actions of CONAVI and the MINISTERIO DE OBRAS PÚBLICAS Y TRANSPORTE.- The evidence submitted shows that, since 2009, the Mayor of the respondent Municipalidad had informed CONAVI of the problem discussed herein and advised it that there was a six-meter drop through which water flowed, without drainage, toward the street, passing along the right-hand side where there is a ditch and eroding the land.

Intervention was therefore requested to resolve the problem caused by Route 209; however, no response was ever received. The Chamber has found it established that Route 209, administered by CONAVI, causes stormwater problems in the area and that, despite being fully aware of the situation, CONAVI took no action to properly channel the water in coordination with the other responsible institutions. On this point, it is important to clarify that, although Article 20 of the Ley General de Caminos establishes the obligation of persons possessing real property under any form of title to allow water from roads to flow through their properties when this occurs because of the slope of the land, the flow must be reasonable, rather than excessive or abnormal in a manner that causes the property to flood, deteriorate, or become degraded, or that threatens life, as occurs in this case. In any event, it is important to consider that the Administration acknowledged the need to carry out works within the right-of-way (derecho de vía) to resolve the problem.

Under these circumstances, given the respondent authority’s inaction in performing the work for which it is responsible in order to end the situation identified by the appellant, this Constitutional Chamber must intervene to restore the protected party to the full enjoyment and exercise of her fundamental rights. Consequently, COSEVI violated the fundamental rights of the appellant and the other members of the community. As to the Ministerio de Obras Públicas y Transporte, the action is denied because administration of Route 209 falls to CONAVI.

VIII.- Regarding the right to petition and to a prompt decision (derecho de petición y pronta resolución). In this case, the appellant alleges that on 03 de agosto de 2010 she requested that the respondent Municipalidad intervene so that her case would be referred to I.M.A.S. to obtain assistance with the construction of a wall, and that on 14 de marzo de 2011 she requested that the Concejo Municipal of the respondent Municipalidad conduct an inspection to resolve the flooding caused by stormwater runoff. Notwithstanding the foregoing, as of the date on which the constitutional protection action (amparo) was filed, 25 de abril de 2011, the respondent authority had not responded to the appellant’s requests. This Court finds that the period that elapsed without providing the appellant with a response directly violated the right to petition and to a prompt decision. Finally, the complaint filed in 2006 with the respondent Área Rectora was addressed. Moreover, regarding the purported request submitted to the Instituto Mixto de Ayuda Social, the institution’s President states under oath that there is no record that the appellant submitted any such request or that it was forwarded by the respondent Municipalidad. Accordingly, that authority did not violate the right to petition and to a prompt decision.

IX.- Conclusion.- Although the respondent authorities acknowledge the reported problem, to date they have adopted no concrete measure to resolve it and continue to shift responsibility for the matter back and forth among themselves. In the view of this Constitutional Court, regardless of the actions for which each authority may be responsible in this matter within the scope of its powers, the fact remains that, in the case under review (sub examine), their inaction and lack of efficiency in promptly addressing the reported situation are evident. This constitutes not only a violation of the rights associated with the proper functioning of public services, but, more fundamentally, a breach of the objective duty to safeguard the life and physical integrity of the persons residing in San Ignacio de Acosta who are directly affected by the flooding at issue. Even though the representatives of CONAVI assert in their defense that a procurement process is already underway, that the Municipalidad reported the situation to CONAVI several years ago, and that the Área Rectora issued the corresponding health orders, to date none of the respondent authorities has begun the required work.

Finally, as to the Instituto Mixto de Ayuda Social and the Ministerio de Obras Públicas y Transportes, the action is denied. In view of the foregoing considerations, the action must be granted, with the consequences set forth below.

Por tanto:

The appeal is granted.

Consequently, María Luisa Ávila Agüero, Carlos Acosta Monge, Luis Alberto Durán Gamboa, and Mauricio Fallas Durán, respectively, in their capacities as Minister of Health, Executive Director of the Consejo Nacional de Vialidad, Municipal Mayor, and President of the Municipal Council—the latter two of the Municipalidad de Acosta—or whoever holds those offices, are ordered to coordinate the necessary measures so that, within the scope of their powers and authority and in conjunction with the corresponding institutions, they carry out all actions necessary to definitively resolve the stormwater (aguas pluviales) problem affecting the community of Potrerillos de San Ignacio de Acosta, within six months from notification of this decision. Likewise, the Contraloría General de la República, through the Manager of the Municipal Services Division, is ordered not to authorize the next budget submitted by the Municipalidad de Acosta, or any amendment thereto, unless it includes the corresponding appropriations necessary to comply with this judgment.

Furthermore, the Municipal Mayor and the President of the Municipal Council, both of the Municipalidad de Acosta, must respond to the petitions submitted by the petitioner (recurrente) on 3 August 201 and 14 March 2011 within THREE DAYS of notification of this judgment. As to the Instituto Mixto de Ayuda Social and the Ministerio de Obras Públicas y Transportes, the appeal is denied. The foregoing is ordered with the warning that, pursuant to Article 71 of the Ley de la Jurisdicción Constitucional, any person who receives an order issued in an amparo proceeding (recurso de amparo) that the person must comply with or cause to be complied with, and who fails to do so, shall be punished by imprisonment for three months to two years or by a fine of twenty to sixty days, provided that the offense is not subject to a more severe penalty. The Municipalidad de Acosta and the State are ordered to pay the legal costs (costas), damages (daños y perjuicios) caused by the events underlying this ruling, which shall be assessed in proceedings for enforcement of the judgment (ejecución de sentencia) before the contentious-administrative jurisdiction (jurisdicción de lo contencioso administrativo).

María Luisa Ávila Agüero, Carlos Acosta Monge, Luis Alberto Durán Gamboa, and Mauricio Fallas Durán, respectively, in their capacities as Minister of Health, Executive Director of the Consejo Nacional de Vialidad, Municipal Mayor, and President of the Municipal Council—the latter two of the Municipalidad de Acosta—or whoever holds those offices, shall be served PERSONALLY. This decision shall likewise be communicated to the Manager of the Municipal Services Division of the Contraloría General de la República. Let notice be given.

*110047760007CO* *110047760007CO* SALA CONSTITUCIONAL DE LA CORTE SUPREMA DE JUSTICIA. San José, a las once horas y treinta y nueve minutos del ocho de julio del dos mil once.

Recurso de amparo que se tramita en CAMPOS CASTRO, cédula de identidad 0107720490 contra la MUNICIPALIDAD DE ACOSTA, el INSTITUTO MIXTO DE AYUDA SOCIAL, el CONSEJO NACIONAL DE VIALIDAD, el MINISTERIO DE SALUD y el MINISTERIO DE OBRAS PÚBLICAS Y TRANSPORTES.

Resultando:

  1. 1En memorial presentado en la Secretaría de la Sala a las 12:05 horas del 25 de abril de 2011, la recurrente interpone recurso de amparo contra la Municipalidad de Acosta, el Instituto Mixto de Ayuda Social; el Consejo Nacional de Vialidad, el Ministerio de Salud y el Ministerio de Obras Públicas y Transportes y manifiesta que su casa de habitación se ubica en San Ignacio de Acosta y que desde hace varios años se encuentra en peligro, producto de las aguas pluviales que son encausadas por el sistema de caños y alcantarillas que recolectan todas las aguas provenientes de varios caseríos que se encuentran en los niveles superiores a su propiedad. Señala que la situación se ha visto agravada en los últimos años debido al aumento de nuevas construcciones, de la instalación de una tubería y alcantarilla por parte del Ministerio de Obras Públicas y Transportes para encausar las aguas provenientes de la ruta 209 y principalmente por los acontecimientos climáticos que han afectado la zona seriamente en los últimos años, por lo que se ha constituido en un gran peligro, ya que el desagüe que pasa a un lado de su propiedad es cada vez más grande y está falseando el terreno.Destaca que originalmente en ese lugar sólo se encontraban algunas pequeñas casas y otras infraestructuras de actividad pecuaria, y que la Municipalidad de aquel entonces, con el consentimiento de los dueños, instaló una alcantarilla e hizo un caño de cemento y piedra que se extendía a lo largo de lo que hoy es el lindero de su propiedad, el cual iba a desembocar a la quebrada del lugar. Dicho caño funcionó sin problema alguno hasta hace aproximadamente unos diez años pero debido a las causas ya mencionadas, el incremento de las aguas ha sido tal, que lo han desaparecido en su totalidad. Afirma que en reiteradas ocasiones ha remitido gestiones a la Municipalidad de Acosta para que resuelvan el problema, pero a la fecha no ha recibido respuesta alguna y lo único que se le ha manifestado verbalmente es que no se puede hacer nada al respecto porque el dueño de la propiedad en donde se encuentra el problema, es hermano del Alcalde y le sugieren que plantee su caso ante el I.M.A.S. o al Ministerio de Salud, para que sean ellos quienes determinen los responsables y que velen porque las aguas corran normalmente sin generar ningún daño.Agrega que ante una gestión suya, el Ministerio de Salud le indicó que de conformidad con lo previsto en los numerales 94 y 95 de la Ley de Aguas no podía intervenir, lo anterior, pese a que el problema que afronta no tiene un origen natural sino de la intervención del hombre, puesto que esas aguas son encausadas por el sistema de caños y alcantarillas implementados por las diferentes instancias gubernamentales, las cuales no concluyeron la infraestructura adecuada para el manejo de las aguas. Asegura que ante la respuesta del Ministerio de Salud se dirigió de nuevo a la Alcaldía Municipal recurrida en donde se le indicó verbalmente que no hay presupuesto. Asevera que ha sido tanta su insistencia y esfuerzo por luchar para proteger su casa que volvió a dirigirse a la Municipalidad, oportunidad en que con la ayuda de la Secretaria Municipal redactó una nueva carta dirigida al Concejo Municipal con fecha 03 de agosto de 2010, por medio de la cual solicitó su intervención para que remitieran su caso al I.M.A.S. para que le ayuden en la construcción de un muro que le permita minimizar el deterioro de su terreno, el cual si continúa dañándose, pronto socavará su casa, gestión de la cual tampoco ha recibido respuesta.Menciona que el año pasado las lluvias afectaron fuertemente la zona de Acosta y que su propiedad no fue la excepción, que el caudal por donde baja el agua a un costado de su casa, se hizo tan grande que, inclusive hubo momentos en donde el agua se metió en su casa, arrastrando piedras y troncos que pusieron en peligro a toda su familia y que en los meses de septiembre y octubre que fueron los meses más lluviosos, tuvo que irse a alquilar una casa en otro lugar porque era demasiado el peligro, ya que cada vez era más el agua que caía y se está dañando más porque el terreno se está falseando. En virtud de lo anterior, su vecino le permitió desviar el agua un poco a su terreno y por un tiempo, mientras se soluciona al problema pero recientemente dicho vecino metió maquinaria para encausar las aguas a su caudal original, poniendo nuevamente en alto riesgo su propiedad. Agrega que se aproxima el invierno y que ello le preocupa mucho ya que la Municipalidad recurrida no ha resuelto nada, por lo que nuevamente mediante nota del 14 de marzo anterior, se dirigió en este mismo sentido al Concejo Municipal, sin que haya obtenido respuesta alguna. Solicita la pronta intervención y una solución definitiva a su problema.
  2. 2Mediante escrito recibido en la Secretaría de la Sala el 28 de abril de 2011, se recibe copia de escrito dirigido al Director Ejecutivo del CONAVI, y suscrito por la subdirectora de la Dirección Jurídica del Ministerio de Obras Públicas y Transportes, en el que se solicita informe técnico de los hechos alegados por la recurrente.
  3. 3Informa bajo juramento María Luisa Ávila Agüero en su condición de Ministra de Salud, que el 14 de junio de 2006 se realizó una visita a la casa de la recurrente en virtud de una denuncia presentada, y en esa oportunidad se verificó que existía un desagüe en la propiedad del vecino de aproximadamente 40 metros de largo, 70 cms de ancho y un metro de profundidad, el cual recibía un gran caudal de aguas pluviales provenientes de la carretera y de viviendas ubicadas a un nivel superior y a un metro con respecto a la propiedad de la recurrente, lo cual le fue informado a la recurrente. Posteriormente, el 28 de abril del año en curso, se realizó otra inspección a la vivienda de la amparada y se confeccionaron las órdenes sanitarias respectivas contra el Alcalde y al Presidente del Concejo, ambos de la Municipalidad de Acosta, y al Director del CONAVI, las cuales se estarán notificando para que procedan a corregir el daño ocasionado.De conformidad a la visita efectuada, los inspectores constataron que en la zona denunciada existen problemas graves debido a varios factores: la abundancia de aguas pluviales, pasos de alcantarillas, no existe una apropiada construcción para depositar y encauzar adecuadamente y sanitariamente las aguas pluviales, por lo que debido a lo anterior se les giró las ordenas sanitarias No. 001-29-4-2011 y No. 002-29-4-2001 y No. 03-29-4-200 para que presenten un plan, propuesta y diseño de la solución al problema de las aguas pluviales en ese sector, en el que se incluye la vivienda de la recurrente, la construcción de un sistema adecuado para depositar y encauzar adecuadamente y sanitariamente las aguas pluviales. Solicita se declare sin lugar el recurso
  4. 4Informa bajo juramento Francisco J. Jiménez en su condición de Ministro de Obras Públicas y Transportes (ver documento presentado a las 16:20 hrs. del 03 de mayo de 2011), que el presente amparo se encuentra prescrito porque desde hace diez años que los caños empezaron a tener problemas y es hasta ahora es que recurre a la Sala y además lo alegado es un asunto de legalidad. No obstante, el caño y el alcantarillado son servicios públicos que le corresponden a las Municipalidades y la administración de la ruta 209 que pasa por San Ignacio de Acosta, le corresponde al Consejo Nacional de Vialidad. Solicita se declare sin lugar el recurso.
  5. 5Informa bajo juramento Carlos Acosta Monge en su condición de Director Ejecutivo del Consejo Nacional de Vialidad, que el 5 de mayo de 2011 el Gerente de Conservación de Vías y Puentes del CONAVI, mediante informe técnico Nº DR (Región Central)-33-11-0058, le comunicó que realizó visita en la propiedad de la recurrente, constatando el daño denunciado, además de que se trata de una calle cantonal de la localidad de Potrerillos y que las aguas discurren desde el sitio del deslizamiento en La Ortiga, sobre la ruta nacional 209. Manifiesta que el problema requiere una solución integral, que incluye las obras de estabilización de la calzada y la construcción de obras de conducción de aguas hasta un sitio de descarga, de forma tal que asegure que no se cause daño a los vecinos. Indica que este Consejo espera ofrecer una solución con la Contratación Directa Nº 20011-CD-000016-CV0, que se encuentra en proceso de adjudicación, y que se promovió para solucionar los problemas de urgente atención a la ruta nacional 209, dentro de los cuales aparece el deslizamiento de La Ortiga como el más grave y complejo. Estima que la propiedad de la recurrente se encuentra en ruta cantonal de la localidad de Potrerillos, por lo que deberá la Municipalidad de Acosta, tomar las medidas necesarias.
  6. 6Informa bajo juramento Fernando Marín Rojas, en su condición de Presidente Ejecutivo del IMAS, que la recurrente vive en San Ignacio de Acosta, según ficha de información social aplicada por el IMAS. Señala que la intervención de este Instituto en el caso de la recurrente se deriva de la referencia efectuada por el Área Rectora de Salud del Cantón de Acosta, según oficio Nº 001-30-09-2010 del 30 de septiembre de 2010, en coordinación con el Comité Municipal de Emergencias de Acosta, en virtud del estado de emergencia producido por la tormenta tropical Thomas en el año 2010, en que los fuertes aguaceros ocasionaron daños en el sector donde vive la recurrente. Debido a lo anterior el 01 de octubre de 2010, se le otorgó a la recurrente un subsidio por emergencia para el pago de alquiler, por la suma de ciento cincuenta mil colones, según consta en resolución Nº 3858 del recibos de alquiler correspondientes.Sostiene que no le consta que anterior a la emergencia descrita, la vivienda de la recurrente se encontrara en peligro, producto de las aguas pluviales que son encausadas por el sistema de caños y alcantarillas que recolectan todas las aguas provenientes de varios caseríos y casas vecinas que se encuentran en los niveles superiores de su propiedad. Asimismo nunca se ha recibido ninguna referencia por parte de la Municipalidad de Acosta o de la recurrente, en que se solicitara otorgar un beneficio a favor de la recurrente para la construcción de un muro. Estima que dentro del ámbito de sus funciones y competencias, este Instituto cumplió a cabalidad con su obligación de ayudar a esta familia en el momento de la emergencia, y que en atención al principio constitucional de coordinación estatal, junto con personeros de otras entidades públicas, se realizó una visita in situ, levantando un censo de algunas familias, incluyendo a la de la recurrente, que deben ser reubicadas por haber sido declaradas sus viviendas como inhabitables.Considera que esas familias deberán solicitar y tramitar el bono de vivienda ante el Sistema Financiero Nacional de la Vivienda, que ya se comprometió a entregar hasta la suma de catorce millones de colones, para que se puedan construir nuevamente las viviendas. Señala que el geólogo de la Comisión Nacional de Emergencias, indicó que no era procedente la construcción de muros de retención en la zona. Agrega que la reubicación y posterior otorgamiento de vivienda no es competencia dad por el legislador al IMAS. Solicita se declare sin lugar el recurso.
  7. 7Informa bajo juramento Luis Alberto Durán Gamboa, en su condición de Alcalde Municipal de la Municipalidad de Acosta, que mediante oficio fechado 2 de julio de 2009 el Ingeniero de la Unidad Técnica de Gestión Vial denunció a la Ingeniera encargada de la rutas nacionales 209-301, el problema de aguas en la ruta 209, las cuales están deteriorando la vía y poniendo en peligro de inundación varias casas, por lo que solicitó la canalización de dichas aguas. Mediante oficio A.M. 337-2009 del 17 de agosto de 2009, el Alcalde Municipal remitió al Director de Conservación Vial copia del memorial OI (1-1)-454-2009 suscrito por la Unidad Técnico de Gestión Vial, en el que se confirma que existe una caída de agua con una pendiente de 6 metros sin desagüe, que se traslada hacia la calle pasando por el lado derecho donde hay una cuneta y se provoca socavación, por lo que solicitó el visado para que el inicio de los trabajos requeridos.El 16 de noviembre de 2009, el Ingeniero de la Unidad Técnica de Gestión Vial expuso el problema en mención al Concejo Municipal y propuso como solución la corta de aguas arriba, la eliminación de 100 metros de caudal a la cuneta, encauzar la parte de escorrentía directa y agrandar la caja de registro existente. Nuevamente mediante oficio A.M. 491-2009 de fecha 17 de noviembre de 2009, remitido al Organismo de Inspección se solicitó la intervención en el trayecto San Ignacio-La Esperanza de Acosta de la ruta 209, en virtud de los problemas de deslizamiento que habían sido remitidos al CONAVI sin obtener atención, poniendo en peligro la vidas de los vecinos de la zona. El 01 de febrero de 2010, fue remitida una copia al entonces Alcalde Municipal, del oficio DVOP-385-10(01), dirigido al Director Ejecutivo de CONAVI y suscrito por el Viceministro de Obras Públicas, con indicaciones de que se actuara en el menor plazo posible.El 22 de febrero de 2011, la Municipalidad envío el oficio No. A.M.078-2011 al Director Ejecutivo de CONAVI, mediante el cual solicitó un informe del proceso actual o etapa de gestión de riesgo en el que se encuentra la intervención de la ruta 209. Además, se remitió al Director Ejecutivo del CONAVI, el oficio A.M.140-2011, donde se reiteran las solicitudes de intervención a los problemas expuestos, sin obtener respuesta. Estima que el caso de la recurrente, no es solo un problema de encarrilamiento de aguas pluviales, sino que es un problema más complejo, por cuanto la vivienda se encuentra en una zona de alto riesgo y en zona de descarga directa del material que eventualmente podría desprenderse de la ladera superior, por lo que se coordinó con el Geólogo de la Comisión Nacional de Emergencia, para que se realizara un estudio integral de un posible mega deslizamiento en el sector. que la recurrente debe ser reubicada por un riesgo inminente, y que es improcedente cualquier obra en el sitio. Solicita se declare sin lugar el recurso.
  8. 8Informa bajo juramento Mauricio Fallas Durán, en su condición de Presidente del Concejo Municipal de la Municipalidad de Acosta, en los mismo términos que el informe anteriormente rendido por el Alcalde de esta Municipalidad.
  9. 9En los procedimientos seguidos se ha observado las prescripciones legales.

Redacta el Magistrado Rueda Leal; y,

Considerando:

I.Hechos probados. De importancia para la decisión de este asunto, se estiman como debidamente demostrados los siguientes hechos, sea porque así han sido acreditados o bien porque el recurrido haya omitido referirse a ellos según lo prevenido en el auto inicial:

  • a)Que la recurrente vive en San Ignacio de Acosta. (Hecho no controvertido) b) El 12 de junio de 2006 la recurrente interpuso ante el Área Rectora de Salud recurrida una denuncia debido a la mala canalización de aguas vecinas. (Ver documentación aportada por la Ministra de Salud) c) Mediante informe No. DRAS-ACOSTA.096-2006 del 19 de junio de 2006 el Área Rectora de Salud accionada da respuesta a la queja presentada por la recurrente. (Ver informe de la Ministra de Salud) d) El 14 de junio de 2006 el Área Rectora de Salud recurrida verificó la existencia de un desagüe en la propiedad vecina a la de la recurrente de 40 mts de largo, 70 cms de ancho y un metro de profundidad y que recibe un gran caudal de aguas provenientes de la carretera y de las viviendas ubicadas en la parte superior. (Ver informe de la Ministra de Salud) e) Mediante oficio del 2 de julio de 2009 el Ingeniero de la Unidad Técnica de Gestión Vial de la Municipalidad recurrida le comunicó a la encargada de la rutas nacionales 209-301, el problema de aguas que genera la ruta 209.

(Ver informe del Alcalde Municipal recurrido) f) Por oficio A.M. 337-2009 del fecha 17 de agosto de 2009, el Alcalde Municipal le comunicó al Director de Conservación Vial que había un problema de una caída de agua con una pendiente de 6 metros sin desagüe, que se trasladaba hacia la calle pasando por el lado derecho donde hay una cuneta y provoca socavación de terrenos. (Ver informe del Alcalde Municipal recurrido) g) El 16 de noviembre de 2009, el Ingeniero de la Unidad Técnica de Gestión Vial de la Municipalidad informó al Concejo Municipal la problemática del sitio y su posible solución. (Ver informe del Alcalde recurrido) h) Por oficio A.M. 491-2009 de fecha 17 de noviembre de 2009, la Municipalidad recurrida solicitó al CONAVI la intervención de la ruta 209, en el trayecto San Ignacio-La Esperanza de Acosta, debido a los problemas de deslizamiento, y no obtuvo respuesta. (Ver informe del Alcalde recurrido) i) El 03 de agosto de 2010 la recurrente solicitó a la Municipalidad recurrida la intervención para que remitiera su caso al I.M.A.S. para obtener una ayuda en la construcción de un muro.

(Ver documentación aportada por la recurrente) j) Que el IMAS nunca recibió ninguna referencia por parte de la Municipalidad de Acosta o de la recurrente, en la que se solicitara un beneficio a favor de la recurrente para la construcción de un muro. (Informe del Presidente del IMAS) k) Que 01 de octubre de 2010 el IMAS le otorgó a la recurrente un subsidio por emergencia para el pago de alquiler. (Ver informe de la autoridad recurrida) l) El 22 de febrero de 2011, la Municipalidad recurrida envío el oficio No. A.M.078-2011 al Director Ejecutivo de CONAVI, mediante el cual solicitó un informe del proceso actual o etapa de gestión de riesgo en el que se encuentra la intervención de la ruta 209. (Ver informe del Alcalde recurrido) m) Mediante memorial No. oficio A.M.140-2011, la Municipalidad accionada reiteró al CONAVI las solicitudes de intervención a los problemas aguas pluviales que genera la ruta 209 y no obtiene respuesta.

(Ver informe del Alcalde recurrido) n) Mediante informe No. 001--29-4-2011 los inspectores del Ministerio de Salud hacen constar que existe un desagüe en la propiedad vecina a la de la recurrente de aproximadamente seis metros de ancho y 3 metros de profundidad, el cual recibe un gran caudal de aguas pluviales provenientes de la carretera y de las viviendas ubicadas a un nivel superior. (Ver informe de la Ministra recurrida) n) Actualmente la comunidad de Potrerillos de Acosta tiene problemas graves debido a la abundancia de aguas pluviales y a la falta de canalización. (informe de la Ministra de Salud) o) El 14 de marzo de 2011 la recurrida solicitó al Concejo Municipal de la Municipalidad accionada una inspección para dar solución a las inundaciones que provoca la escorrentía de aguas pluviales. (Ver documentación aportada por la recurrente) p) El 29 de abril de 2011, el Área de Salud de Acosta giró las ordenas sanitarias No. 001-29-4-2011, No. 002-29-4-2001 y No. 03-29-4-200 en contra del Presidente del Concejo, el Alcalde, ambos de la Municipalidad recurrida y el CONAVI , en las que ordenó la presentación de un plan, propuesta y diseño de la solución al problema de las aguas pluviales en ese sector, la construcción de un sistema adecuado para depositar y encauzar las aguas pluviales.

(Ver informe de la Ministra de Salud) q) Que la vivienda de la recurrente se encuentra en una zona de alto riesgo, y de descarga directa del material que eventualmente podría desprenderse de la ladera superior. (Ver informe rendido por el Alcalde recurrido) r) Que la vivienda de la recurrente fue declarada como inhabitable. (Ver informe del Presidente del IMAS) r) Que el geólogo de la Comisión Nacional de Emergencias indicó que no era procedente la construcción de muros de retención en la zona. (Ver informe del Presidente del IMAS)

II.Objeto del recurso. La recurrente considera lesionados sus derechos fundamentales, debido a que las autoridades recurridas no han solucionado en forma efectiva y definitiva el problema de inundaciones, deslizamientos y el falseamiento de los terrenos que aqueja a los vecinos de San Ignacio de Acosta debido a la mala canalización de aguas provenientes de la ruta 209 y a la falta de caños y alcantarillas para el desfogue de las aguas pluviales.

III.Sobre el principio de coordinación. En diversas oportunidades, la jurisprudencia constitucional ha indicado que la protección del ambiente, es una tarea que corresponde a todos por igual, es decir, que existe una obligación para el Estado -como un todo- de tomar las medidas necesarias para proteger la salud y vida de los administrados. En esta tarea, por institución pública, debe entenderse comprendida tanto la Administración Central -Ministerios, como el Ministerio de Obras Públicas y Transporte, Ministerio de Ambiente, Energía y Telecomunicaciones y el Ministerio de Salud, que en razón de la materia, tienen una amplia participación y responsabilidad en lo que respecta a la conservación y preservación de la salud y el ambiente; los cuales actúan, la mayoría de las veces, a través de sus dependencias especializadas en la materia; tarea en la que por supuesto tienen gran responsabilidad las municipalidades, en lo que respecta a su jurisdicción territorial.

Es por ello, que podría pensarse que esta múltiple responsabilidad provocaría un caos en la gestión administrativa, lo cual no es cierto, por cuanto a fin de evitar la coexistencia simultánea de esferas de poder de diferente origen y esencia, la duplicación de los esfuerzos nacionales y locales, así como la confusión de derechos y obligaciones entre las diversas partes involucradas, es que se hace necesario establecer una serie de relaciones de coordinación entre las diversas dependencias del Poder Ejecutivo y las instituciones descentralizadas, y entre éstas con las municipalidades, a fin de poder llevar a cabo las funciones que les han sido encomendadas. Esta Sala con anterioridad -y en forma bastante clara- se refirió al principio de coordinación de las dependencias públicas con las municipalidades en la realización de fines comunes -lo cual, obviamente se debe hacer extensivo a la relación que en esta importante función realizan las instituciones de la Administración Central y las descentralizadas-, para lo cual se remite a lo indicado en aquella ocasión: "De manera que la coordinación es la ordenación de las relaciones entre estas diversas actividades independientes, que se hace cargo de esa concurrencia en un mismo objeto o entidad, para hacerla útil a un plan público global, sin suprimir la independencia recíproca de los sujetos agentes.

Como no hay una relación de jerarquía de las instituciones descentralizadas, ni del Estado mismo en relación con las municipalidades, no es posible la imposición a éstas de determinadas conductas, con lo cual surge el imprescindible "concierto" interinstitucional, en sentido estricto, en cuanto los centros autónomos e independientes de acción se ponen de acuerdo sobre ese esquema preventivo y global, en el que cada uno cumple un papel con vista en una misión confiada a los otros. Así, las relaciones de las municipalidades con los otros entes públicos, sólo pueden llevarse a cabo en un plano de igualdad, que den como resultado formas pactadas de coordinación, con exclusión de cualquier forma imperativa en detrimento de su autonomía, que permita sujetar a los entes corporativos a un esquema de coordinación sin su voluntad o contra ella; pero que sí admite la necesaria subordinación de estos entes al Estado y en interés de éste (a través de la "tutela administrativa" del Estado, y específicamente, en la función de control la legalidad que a éste compete, con potestades de vigilancia general sobre todo el sector)." (ver sentencia número 5445-99, de las catorce horas treinta minutos del 14 de julio de 1999).-

IV.Sobre el fondo. En el presente caso de la prueba documental aportada y lo informado bajo juramento por las autoridades recurridas la Sala tiene por demostrado que efectivamente en la zona de San Ignacio de Acosta existe un grave problema de desfogue de aguas pluviales que incluso ha llegado a provocar falseamiento y deslizamientos de terrenos poniendo en peligro la salud y vida de los habitantes de la zona. Debido a que en el presente proceso se encuentran recurridas varias instituciones públicas, se procederá hacer el análisis de la actuación de cada una de ellas en forma independiente.

V.En cuanto a la actuación de la Municipalidad de Acosta.- En reiteradas ocasiones este Tribunal ha señalado que las Municipalidades se encuentran obligadas a velar por el bienestar de los habitantes de su cantón, ello conforme lo dispuesto por el artículo 169 de la Constitución Política que encomienda al Gobierno Municipal la administración de los servicios locales e intereses del cantón. Asimismo, esta Sala ha sido clara en indicar que las Municipalidades no pueden escudarse en la falta de presupuesto como justificación para no llevar a cabo acciones tendientes a solventar situaciones que afectan a los habitantes del cantón, pues resulta ilegítimo que se antepongan criterios meramente económicos cuando existen derechos fundamentales que tutelar. Partiendo de lo anterior, en el presente asunto esta Sala verifica una violación al derecho a la salud de la amparada por parte de la Municipalidad accionada, además una falta a la responsabilidad del buen funcionamientos de los servicios públicos y una violación al principio de coordinación, por cuanto a pesar de que desde hace varios años la Municipalidad recurrida constató el peligro que existe para la integridad física de la recurrente, su familia y demás vecinos de Potrerillos de Acosta, debido a la fuerte escorrentía de las aguas pluviales que discurren desde la ruta 209 hacia dicha zona, no adoptó las medidas correspondientes para corregir dicho problema.

Así las cosas desde el año 2009 y principios del presente año, la Municipalidad puso en conocimiento del CONAVI del problema que genera la ruta 209; sin embargo el CONAVI fue omiso ante tales gestiones presentadas por el Alcalde Municipal. No obstante, no consta la ejecución de algún otro acto por parte de la Municipalidad tendente a solucionar dicha cuestión. Reiteradamente la Sala ha indicado que el papel de las Municipalidades no se debe de limitar a trasladar los problemas de salud, ambiental a otros entes, sino que su obligación se encuentra en garantizar, defender y preservar el derecho de todos a disfrutar de un ambiente sano y ecológicamente equilibrado. A juicio de esta Sala, la Municipalidad de Acosta teniendo pleno conocimiento de la problemática que afecta a los pobladores de la zona de Potrerillos de Acosta se ha limitado a constatar su existencia, trasladar el problema al CONAVI y así evadir su responsabilidad y deberes lo que demuestra una incapacidad para hacer cumplir las leyes en la materia, con el consecuente perjuicio y amenaza a la salud de las personas.

Debe recordarse que en situaciones como la presente, en las que debido a la falta de infraestructura adecuada se está provocando inundaciones y falseamiento de terrenos, la actuación de la Municipalidad debe de ser célere dado que un retraso en la ejecución de las obras de infraestructura podría ser incluso fatal, dado que está de por medio la integridad física y la salud de los vecinos de la zona. Aún cuando se admita que la Administración debe sujetarse al contenido presupuestario, lo cierto del caso es que ha omitido su responsabilidad y no ha tomado las medidas pertinentes en aras de proteger la salud e integridad física de los miembros de su comunidad. Recuérdese que las Municipalidades, por su cercanía con el ciudadano, son las primeras llamadas a cumplir sus obligaciones y deberes para con el administrado de forma eficaz y eficiente, tal como es proporcionar y mantener en buen estado y en correcto funcionamiento el desfogue de las alcantarillas.

En tal virtud, se impone la estimatoria de este recurso contra la Municipalidad de Acosta por la violación constitucional a los artículos 50 y 21 de la Constitución Política en perjuicio de los recurrentes y demás vecinos de la zona de San Ignacio de Acosta y se ordena que deberá realizar en forma inmediata las acciones efectivas para reducir el peligro inminente que existe y deberá iniciar las obras para solucionar el problema del alcantarillado en dicho lugar. Lo anterior, sin perjuicio de que coordine con los entes correspondientes que puedan gestionar para que ese alcantarillado y el correspondiente desfogue de aguas sea el adecuado.

VI.En cuanto a la actuación del Área Rectora de Salud de Acosta del Ministerio de Salud.- La Salud Pública y la protección del medio ambiente son principios tutelados tanto a nivel constitucional (artículos 21, 50, 73 y 89 de la Carta Magna), como a través de la normativa internacional. La Ley General de Salud autoriza al Ministerio de Salud para tomar las medidas sanitarias correspondientes e imponer las sanciones, con lo cual el citado Ministerio no solo tiene el deber de hacer cumplir la Ley General de Salud sino el de proteger la salud pública calificada como bien de interés público, pues los derechos a la salud y a un ambiente sano y libre de contaminación -al menos por debajo de los límites tolerables para el ser humano- son derechos fundamentales irrenunciables y en cuya violación no se puede legítimamente consentir. Del informe presentado a esta Sala y la prueba documental aportada, se tiene por demostrado que posterior a la interposición del presente proceso los inspectores del Ministerio de Salud verificaron que existe un desagüe en la propiedad vecina a la de la recurrente de aproximadamente seis metros de ancho y 3 metros de profundidad, el cual recibe un gran caudal de aguas pluviales provenientes de la carretera y de viviendas ubicadas a un nivel superior, por lo que actualmente la comunidad de Potrerillos de Acosta sufre problemas graves debido a la abundancia de aguas pluviales y a la falta de canalización.

En virtud de lo anterior, la autoridad sanitaria realizó un reconocimiento y giró las órdenes sanitarias respectivas contra el Alcalde, el Presidente del Concejo Municipal de la Municipalidad accionada y el CONAVI, y les ordenó presentar un plan, propuesta y diseño de la solución al problema de las aguas pluviales en ese sector y la construcción de un sistema adecuado para depositar y encauzar adecuadamente las aguas pluviales; no obstante, de dicha actuación no ha pasado, declinando en el ejercicio de sus competencias y atribuciones otorgadas por el ordenamiento jurídico, como por ejemplo lo establecido en los artículos 355 y 356 de la Ley General de Salud que faculta a las autoridades de salud competentes a decretar por propia autoridad, medidas cuya finalidad tiendan a evitar la aparición de peligros y la agravación o difusión del daño, o la continuación o reincidencia en la perpetración de infracciones legales o reglamentarias que atenten contra la salud de las personas y entre ellas podrán dar la orden de paralización, destrucción o ejecución de obras, según corresponda.

En el caso bajo estudio, quedó demostrado en autos que más allá de las inspecciones realizadas, no se desprende del expediente ninguna otra actuación de parte de esta autoridad para dar solución integral al problema y por ende, tal omisión implica también en cuanto a esta institución, la estimación del recurso debido a que las autoridades sanitarias no le dieron la importancia que el caso amerita lo que ha ocasionado lesiones a los derechos fundamentales de todos los habitantes del lugar. En un caso similar, la Sala en sentencia No. 2006-08983 de las once horas dieciséis minutos del veintitrés de junio de 2006 dispuso: “ Estima este Tribunal Constitucional que el Ministerio de Salud ha sido omiso en el cumplimiento de sus obligaciones en tutela del derecho a la salud del amparado y demás vecinos de la urbanización de marras, al no hacer uso de sus potestades legales con el fin de solucionar, definitivamente, el problema sanitario que les afecta y que han denunciado formalmente, pues ha realizado una actividad insuficiente, inoportuna e ineficaz que se comprueba con el hecho de que el problema subsiste, al no haber concretado ninguna acción en ejercicio del poder de policía que le asiste por ley para hacer cumplir sus órdenes.

Queda así en los miembros de este Tribunal Constitucional la percepción de que ha sido la actuación de una “Administración de papel”, que agota su actividad en meros trámites burocráticos, simplemente limitándose a realizar inspecciones y girar recomendaciones u órdenes sanitarias, sin que se tome medida alguna para corroborar que se hayan cumplido y, lo que es peor, sin que se evidencien de su parte acciones eficaces, verdaderamente encaminadas a resolver en definitiva la problemática sanitaria expuesta, como corresponde para cumplir el fin público que se le ha encomendado, lo que redunda en detrimento de la salud y el medio ambiente y, por consiguiente, en violación del artículo 50 constitucional, situación que resulta intolerable para esta Sala”. Partiendo de lo anterior y no existiendo ningún motivos para variar el criterio con respecto al Ministerio de Salud y se ordena

VII.En cuanto a las actuaciones del CONAVI y el MINISTERIO DE OBRAS PÚBLICAS Y TRANSPORTE.- De la prueba aportada, se desprende que desde el año 2009 el Alcalde de la Municipalidad recurrida puso en conocimiento del CONAVI el problema aquí discutido y les informó que había una caída de agua con una pendiente de 6 metros sin desagüe, que se trasladaba hacia la calle pasando por el lado derecho donde hay una cuneta y socavaba terrenos, por lo se solicitó la intervención para que se solucionara el problema que era provocado por la ruta 209; sin embargo nunca obtuvo respuesta. La Sala ha tenido por demostrado que la ruta 209 que administra el CONAVI genera problemas de aguas pluviales en la zona, y a pesar de tener pleno conocimiento de ello, no efectúo ningún acto para canalizar debidamente las aguas en coordinación con las otras instituciones responsables. En cuanto a este punto, es importante aclarar que, si bien es cierto el artículo 20 de la Ley General de Caminos establece la obligación de los poseedores de bienes inmuebles, por cualquier título, de dejar discurrir dentro de sus predios, las aguas de los caminos cuando así ocurra por el desnivel del terreno, se debe de tratar de un flujo razonable, no de uno excesivo o anormal que implique el anegamiento, deterioro o degradación del inmueble o amenazar la vida, como sucede en el presente asunto.

En todo caso, es importante tener en cuenta que la administración aceptó la necesidad de llevar a cabo obras en el derecho de vía para solucionar el problema. Así las cosas, ante la inercia de la autoridad demandada para ejecutar los trabajos que le corresponden con el fin de poner fin a la situación que apuntó la recurrente, esta Sala Constitucional debe intervenir, con el fin de restablecer a la amparada en el pleno goce y ejercicio de sus derechos fundamentales. En consecuencia, el COSEVI lesionó los derechos fundamentales de la recurrente y demás miembros de la comunidad. En cuanto al Ministerio de Obras Públicas y Transporte, se declara sin lugar el recurso en virtud de que la administración de la Ruta 209 le corresponde al CONAVI.

VIII.Sobre el derecho de petición y pronta resolución. En el presente caso el recurrente acusa que el 03 de agosto de 2010 solicitó a la Municipalidad recurrida la intervención para que se remitiera su caso al I.M.A.S. para obtener una ayuda en la construcción de un muro y el 14 de marzo de 2011 gestionó ante el Concejo Municipal de la Municipalidad accionada una inspección para dar solución a las inundaciones que provoca la escorrentía de aguas pluviales. No obstante lo anterior, a la fecha de interposición del amparo, 25 de abril de 2011 la autoridad recurrida no ha brindado una respuesta a lo solicitado por la recurrente. Estima este Tribunal que el plazo transcurrido sin darle una respuesta a la recurrente, lesiona de manera directa el derecho de petición y pronta resolución. Finalmente con respecto con la denuncia presentada en el año 2006 ante el Área Rectora recurrida, la misma fue atendida. Por otra parte, en cuanto a la supuesta solicitud presentada ante el Instituto Mixto de Ayuda Social, bajo fe de juramento el Presidente de la institución manifiesta que no consta que la recurrente haya presentado alguna gestión al respecto o que haya sido trasladada por la Municipalidad accionada, por lo que dicha autoridad no ha lesionado el derecho de petición y pronta resolución.

IX.Conclusión.- A pesar que las autoridades recurridas reconocen la problemática denunciada, a la fecha, no han adoptado ninguna medida concreta para solucionarla e insisten en trasladarse, recíprocamente, la responsabilidad en cuanto al tema. En criterio de este Tribunal Constitucional, independientemente, de las actuaciones que le correspondan en esta materia a cada una de las autoridades según el marco de sus competencias, lo cierto es que, en el sub examine, queda manifiesta su inercia y falta de eficiencia para atender con prontitud, la situación acusada, lo cual, configura no sólo un quebranto a los derechos al buen funcionamiento de los servicios públicos sino que, esencialmente, implica una transgresión a la obligación objetiva de tutelar la vida y la integridad física de las personas que residen en San Ignacio de Acosta, directamente, afectadas por las inundaciones en cuestión. Aún cuando los representantes del CONAVI aleguen a su favor que ya está en proceso una licitación, que la Municipalidad desde hace varios años acusó la situación al CONAVI y que el Área Rectora giró las ordenes sanitarias respectiva, a la fecha ninguna de las autoridades recurridas han iniciado los trabajos requeridos.

Finalmente en cuanto el Instituto Mixto de Ayuda Social y el Ministerio de Obras Públicas y Transportes, se declara sin lugar el recurso. En mérito de las consideraciones expuestas, se impone declarar con lugar el recurso con las consecuencias que a continuación se disponen.

Por tanto:

Se declara con lugar el recurso. En consecuencia se ordena a María Luisa Ávila Agüero, Carlos Acosta Monge, Luis Alberto Durán Gamboa y a Mauricio Fallas Durán respectivamente, en su condición de Ministra de Salud, Director Ejecutivo del Consejo Nacional de Vialidad, Alcalde Municipal y Presidente del Concejo Municipal, estos últimos de la Municipalidad de Acosta o a quienes ejerzan el cargo, que coordinen lo necesario para que, que dentro del marco de sus atribuciones y competencias, y en asocio con las instituciones correspondientes realicen todos los actos necesarios para solventar en definitiva el problema de aguas pluviales que se presenta en la comunidad de Potrerillos de San Ignacio de Acosta, lo anterior en un plazo de seis meses contado a partir de la comunicación de la presente resolución. Asimismo, se ordena a la Contraloría General de la República, en la persona del Gerente de Área de Servicios Municipales, que no autorice el presupuesto ni ninguna modificación presupuestaria para el siguiente presupuesto, proveniente de la Municipalidad de Acosta, si no incluye las partidas respectivas para dar cumplimiento a este fallo.

Además, debe el Alcalde Municipal y el Presidente del Concejo, ambos de la Municipalidad de Acosta dar respuesta a las gestiones presentadas por la recurrente los días 3 de agosto de 201 y 14 de marzo de 2011 en el plazo de TRES DÍAS a partir de la notificación de la presente sentencia. En cuanto el Instituto Mixto de Ayuda Social y al Ministerio de Obras Públicas y Transportes se declara sin lugar el recurso. Lo anterior, bajo el apercibimiento de que, con base en lo establecido en el artículo 71 de la Ley de la Jurisdicción Constitucional, se impondrá prisión de tres meses a dos años, o de veinte a sesenta días multa, a quien recibiere una orden que deba cumplir o hacer cumplir, dictada en un recurso de amparo y no la cumpliere o no la hiciere cumplir, siempre que el delito no esté más gravemente penado. Se condena a la Municipalidad de Acosta y al Estado al pago de las costas, daños y perjuicios causados con los hechos que sirven de base a esta declaratoria, los cuales se liquidaran en ejecución de sentencia de lo contencioso administrativo.

Notifíquese a María Luisa Ávila Agüero, Carlos Acosta Monge, Luis Alberto Durán Gamboa y a Mauricio Fallas Durán respectivamente, en su condición de Ministra de Salud, Director Ejecutivo del Consejo Nacional de Vialidad, Alcalde Municipal y Presidente del Concejo Municipal, estos últimos de la Municipalidad de Acosta, o a quienes ejerzan dicho cargo EN FORMA PERSONAL. Asimismo, comuníquese la presente resolución al Gerente de Área de Servicios Municipales de la Contraloría General de la República. Comuníquese.
