Amparo proceeding (recurso de amparo) filed by Daniel Antonio Madrigal Sojo, identity card 0105140703, against the Centro de Investigación y Conservación de Patrimonio Cultural del Ministerio de Cultura y Juventud, the Dirección General de Adaptación Social, and the Municipalidad de Goicoechea.

Background:

  1. 1In a written submission received by the Secretariat of the Chamber at 15:19 hours on 19 de mayo del 2011, the petitioner states that the building housing the Municipalidad de Goicoechea, known as the “Palacio Municipal Amparo Zeledón,” is eighty-three years old. Construction of the building began in 1924, and it was inaugurated in 1928 as a women’s prison. It is considered the only building in the country with elements of monastic-style architecture and was declared an “architectural and historical landmark” during the Carazo Odio administration. He alleges that the eastern section of that building, which is occupied by the Centro de Confianza San José of the Dirección General de Adaptación Social, is not in good condition. There are holes, leaks, broken windows, sewage and wastewater discharges, and foul odors. He states that the western side, which is occupied by the Municipalidad, is in good condition. He considers the situation contrary to the provisions of Article 89 of the Constitution.
  2. 2Oscar Figueroa Fieujeam, in his capacity as Municipal Mayor of Goicoechea, reports under oath that the Municipalidad received the property in question (real property record #160331-000) as a donation pursuant to Law #6626 of 25 de setiembre de 1981, regulated by Executive Decree #14800-J of 12 de setiembre de 1983. The donation was made subject to the condition that the Ministerio de Justicia retain the right of use and usufruct (uso y usufructo) (sic) over a 3990.3-square-meter portion of the building. This comprises the entire eastern wing and the eastern parking lot of the property. That Ministry operates a social rehabilitation trust center there, even though the donation provided only for offices. The Municipalidad has properly maintained the property. The building also houses the Consultorio Jurídico de la Universidad de Costa Rica, the Escuela Municipal de Música de Goicoechea, the Banda Sinfónica Juvenil de Goicoechea, and the Concejo Municipal.It is the meeting place for the canton’s community organizations. Since 1992, they have made numerous representations to the Ministerio de Justicia and other central government authorities because the Ministry has departed from the purpose of the donation. In addition, the Dirección de Adaptación Social leased the building’s parking lot to a supermarket, a use that is likewise not authorized by the donation law. It is erroneous to interpret this as a lifetime usufruct (usufructo vitalicio), which would contravene Articles 289, 292, 343, 358, and 359 of the Civil Code. Property transferred without consideration cannot be subject to restrictions exceeding ten years, and twenty-nine years have already elapsed. In 1993, the then-Ministra de Justicia assured them that no further prison facilities would be maintained there, yet the property continues to be used for that purpose. Likewise, in setiembre de 2000, the Ministro de Cultura requested that the Ministra de Justicia properly maintain the building, but the request was not complied with.In 2007, the Ministerio de Justicia was again urged to vacate that portion of the building, without success. The Municipalidad should not be treated as a respondent, since it has fulfilled its duty to care for the property, but rather as an active supporting party (coadyuvante activa). He requests that the proceeding be dismissed.
  3. 3Jorge Rodríguez Bogle, Director General de Adaptación Social, submitted his report under oath in the following terms: on 9 de noviembre de 2010, the Center’s bathrooms, toilets, and washbasins were closed, and during the same week other bathrooms were made available in collaboration with the Departamento de Arquitectura, which supplied the materials necessary to install the new set of bathroom facilities. Subsequently, the entire electrical system was replaced, and the sewage and soapy wastewater in the Archivo Central section were channeled and piped. Corrective and preventive maintenance has been performed on the building. For 2011, according to information from the Patronato de construcciones, instalaciones y adquisición de bienes del Ministerio, forty-two million colones will be invested in the building, in a structural vulnerability study and various maintenance works. The Head of the Departamento de Arquitectura was placed in charge of the work. The bidding process to commission the vulnerability study was unsuccessful, so the procurement procedure must be conducted again. With respect to repairs, painting, and the repair of gutters and windows and their design, the proposal is pending approval by the Ministerio de Cultura. Efforts have been made to maintain the building, and he therefore requests dismissal of the amparo proceeding.
  4. 4Sandra Quirós Bonilla, Director of the Centro de Investigación y Conservación del Patrimonio Cultural del Ministerio de Cultura y Juventud, responded to the hearing granted, stating that the Centro de Adaptación Social “Amparo Zeledón” was declared part of Costa Rica’s historical and architectural heritage (patrimonio histórico arquitectónico) by Executive Decree #13021-C of 22 de octubre de 1981. It is occupied by the Municipalidad de Goicoechea and the Dirección General de Adaptación Social del Ministerio de Justicia y Paz. According to a registry study, it is owned by the aforementioned Municipalidad. Pursuant to Article 1 of Law #6626 of 3 de diciembre de 1981, the Dirección General de Adaptación Social was authorized to donate to the Municipalidad de Goicoechea the property on which the aforementioned center was located. Article 2 of the Law establishes the conditions of the donation, specifically that the Municipalidad was required to grant the Ministerio de Justicia the right of use and usufruct over part of the facilities.Responsibility for maintaining the property rests not with that Center but with the owner. Official letter CPC-0500-2011 of 1° de marzo de 2011 was sent to the Internal Auditor of the Municipalidad de Goicoechea, requesting that she include in her work plan verification that the Municipalidad is complying with its conservation obligation. With respect to the Ministerio de Justicia y Paz, following the 2010 inspection, the head of that Ministry was informed of its results and of a series of irregularities detected concerning work performed without permission from that Center.
  5. 5The statutory requirements have been observed in the proceedings conducted.

Justice Armijo Sancho drafted the decision; and,

Considering:

I.Subject matter of the proceeding. The petitioner considers that the Dirección General de Adaptación Social’s failure to maintain the portion of the Amparo Zeledón building in Goicoechea that it occupies violates his right to historical and architectural heritage.

II.Proven facts. The following facts are deemed duly established and relevant to the decision in this matter, either because they have been proven as such or because the respondent failed to address them as required in the initial order:

  • a)by Executive Decree #13021-C of 5 de octubre de 1981, the building that housed the Reformatorio de Mujeres, Centro de Adaptación Social Amparo Zeledón, was declared a landmark of architectural and historical interest (page 22 of the certified copy of the administrative record of the Centro de Adaptación Social Amparo Zeledón); b) pursuant to the authorization granted by Law #6626 of 3 de setiembre de 1981, the Dirección General de Adaptación Social donated to the Municipalidad de Goicoechea the property on which the Reformatorio de Mujeres was located (report of the Municipal Mayor of Goicoechea); c) in official letter CPC #1080-2010 of 28 de abril de 2010, the Director of the Centro de Investigación y Conservación del Patrimonio Cultural del Ministerio de Cultura y Juventud informed the Ministro de Justicia y Paz of the results of the inspection of the Centro de Adaptación Social Amparo Zeledón building, referring to work performed without permission from the Centro de Investigación that caused damage to the building, and detailing maintenance problems, while requesting that the Minister include the relevant appropriations in the budget for 2011 (pages 169 to 176 of the certified copy of the administrative record of the Centro de Adaptación Social Amparo Zeledón); d) on 14 de julio de 2010, the Head of Architecture of the Dirección General de Adaptación Social requested authorization from the Centro de Investigación y Conservación del Patrimonio Cultural to paint the façade and rear of the building and replace the gutters that were in poor condition (page 179 of the certified copy of the administrative record of the Centro de Adaptación Social Amparo Zeledón).

III.Merits. Principally, judgment #2003-3656, issued at 14:43 hours on 7 de mayo de 2007, explains the constitutional significance of protecting historical and architectural heritage in the following terms:

“XVIII.- Articles 50 and 89 of the Constitution impose an obligation upon the State to protect the environment in which the nation’s population lives, encompassing two spheres: the natural and the urban; consequently, the protection of cultural heritage, and more specifically historical and architectural heritage, falls within urban planning regulations (regulaciones de orden urbanístico). In view of the foregoing considerations, it may properly be stated that the preservation of cultural heritage contributes to maintaining the environmental balance necessary for urban development because its effective protection requires respect for urban scale, structure, and dimensions, regulates physical carrying capacity, and calls urban functions and services into question, thereby resulting in better environmental quality; it also contributes to preserving the city’s distinctive image or perceptual coherence, which gives it identity or formal cohesion.” (…)

“XX.- CONCEPTUALIZATION OF THE PROTECTION OF CULTURAL HERITAGE AS A FUNDAMENTAL RIGHT. Society’s process of cultural development and the exchange of cultural goods and expressions give rise to a framework of rights and obligations linked to social, political, and economic conditions in the world, such as the population’s growing sociocultural needs; the increasing importance of culture as an essential element of nationality (national identity); the challenges facing the survival of traditional, artisanal, and folkloric cultures; and the importance of the values and expressions of cultural heritage as a fundamental factor in national integration. This demonstrates the need for appropriate regulation encompassing the interests at stake. Within this context arises the State’s duty to safeguard or protect cultural heritage, since it falls within the framework of the social rule-of-law state (Estado Social de Derecho), with all its implications.

Accordingly, it is conceptualized as a true fundamental right (derecho fundamental), derived from the right to culture; it may therefore be enforced against the public authorities responsible for such protection, which translates into the right to demand effective and concrete actions by the Administration to safeguard cultural heritage. This right is grounded in the essential dignity of the human person and in the need to integrate this element into the development of the community; it therefore encompasses not only the individual’s right to personal self-fulfillment, but also the right of the community—the population—to shape its cultural identity, since cultural heritage is an essential element that contributes to this important task. It thus also has implications for the cultural sovereignty of States, specifically with regard to safeguarding the country’s cultural identity and requiring such international cooperation as may and should be provided in this respect.

It is a third-generation right, grounded in the principle of solidarity), and is therefore classified within the category of social rights. It is clearly significant insofar as it affects life in society, since it establishes the right of every individual—as required by the individual’s essential dignity—to participate in the heritage and cultural activity of the community to which that individual belongs; and it creates a duty—a responsibility—on the part of public authorities to provide appropriate means for effective participation, so as to guarantee access to and exercise of this right to the extent permitted by available resources. Culture thus constitutes the most significant element of awareness for safeguarding the essential heritage that defines national identity at various levels, encompassing the protection of folklore, the encouragement of intellectual and artistic endeavors, the promotion of international exchange, the protection of cultural heritage, the promotion of the development of the arts, arts education, and the promotion of books. Thus, every person has a right to culture, just as every person has a right to education, work, and freedom of expression, fundamental rights with which it is directly connected.” (…)

“State assistance in the preservation of this heritage, which takes the form of planning and development planning, specialized technical assistance, and the granting of donations, tax benefits, subsidies, or preferential loans suitable for these purposes to private owners and their users. Such assistance is subject to compliance with certain conditions imposed in the public interest, such as guaranteeing the integrity of buildings, allowing properties to be visited, providing access to parks, gardens, or sites, permitting photographs to be taken, allowing inspections to be conducted, etc.;” Likewise, in judgments #2004-13652 at 18:13 hours on 30 de noviembre de 2004 and #2010-15388 at 11:15 hours on 17 de setiembre del 2010, the matter was protected through the amparo proceeding (proceso de amparo), as it was understood to involve a fundamental right.

IV.In the present case, there is no doubt that the property is among those protected under article 89 of the Constitution, since it was formally declared a relic of architectural and historical interest in 1981. It is therefore appropriate to determine in an amparo proceeding whether serious acts or omissions have occurred that contravene the property’s status as an asset afforded special protection under the legal system. From that perspective, however, there is no evidence that the Centro de Investigación y Conservación del Patrimonio Cultural openly neglected its duty to supervise whether the property was receiving the preservation it required, since report CPC #1080-2010 of 28 de abril de 2010 identified the unlawful alterations that had been made to the building and urged the Ministerio de Justicia to invest in its preservation during the 2011 budget year. Consequently, the amparo claim against that agency must be dismissed.

V.With respect to the Dirección General de Adaptación Social, the aforementioned 2010 report by the Centro de Investigación y Conservación del Patrimonio Cultural demonstrates that it violated the property’s status as an asset of historical and architectural value in two respects: by carrying out works incompatible with its preservation and by failing to provide timely and adequate maintenance. In his report, the Director General de Adaptación Social describes work carried out in noviembre de 2010 on the Center’s bathrooms, toilets, and washbasins, and states that the entire electrical system was replaced and that the sewage and graywater in the Archivo Central area were channeled and piped. Painting and repairs to gutters and windows are scheduled for this year and are pending approval by the Centro de Investigación. Those works would remedy some of the deficiencies identified by the Centro de Investigación, but there is no assurance that they fully satisfy the Directorate’s duty to provide the property with the preservation it requires, and some of the work has not yet been performed.

For these reasons, the petition against the Directorate is granted, and its Director General is ordered to take the necessary measures to ensure that, as soon as possible, the portion of the Amparo Zeledón building occupied by the Directorate receives the preservation required by its status as a property of architectural and historical interest. The judgment must be served on the Ministro de Justicia y Paz because the respondent Directorate is attached to that Ministry.

VI.Finally, it should be noted that a report was requested from the Municipalidad de Goicoechea in its capacity as owner of the property; however, since it has been established that the Municipality provides the property with the required maintenance, the amparo claim against it must be dismissed. This is subject to the clarification that some of the matters it raises fall outside the scope of constitutional law and are incompatible with the summary nature of amparo proceedings. Specifically, these matters concern whether the usufruct (usufructo) imposed as a condition of the donation made by the Dirección General de Adaptación Social—the property’s original titleholder—is subject to a term and, if so, what that term would be, as well as the use to which the portion of the property subject to the usufruct should be put. Those matters must be discussed and decided through administrative proceedings or before the competent ordinary court.

Por tanto:

The petition is granted solely against the Dirección General de Adaptación Social. Jorge Rodríguez Bogle, Director General de Adaptación Social, or whoever holds that office, is ordered to take the necessary measures to ensure that, as soon as possible, the portion of the Amparo Zeledón building occupied by the Directorate receives the preservation required by its status as a property of architectural and historical interest. In all other respects, the amparo petition is denied. The State is ordered to pay the legal costs, damages, and losses incurred, which shall be assessed during enforcement of the judgment in the administrative litigation jurisdiction (jurisdicción de lo contencioso administrativo). The aforementioned official is warned that, pursuant to article 71 of the Ley de la Jurisdicción Constitucional, any person who receives an order issued in an amparo proceeding that the person must comply with or enforce, and who fails to comply with or enforce it, shall be subject to imprisonment for three months to two years or a fine of twenty to sixty days, provided that the offense is not punishable by a more severe penalty. This decision shall be served personally on the respondent and on the Ministro de Justicia y Paz.

*110059630007CO* SALA CONSTITUCIONAL DE LA CORTE SUPREMA DE JUSTICIA. San José, a las diecisiete horas y tres minutos del catorce de junio del dos mil once.

Recurso de amparo interpuesto por Daniel Antonio Madrigal Sojo, cédula de identidad 0105140703, contra el Centro de Investigación y Conservación de Patrimonio Cultural del Ministerio de Cultura y Juventud, la Dirección General de Adaptación Social y la Municipalidad de Goicoechea.

Resultando:

  1. 1Por escrito recibido en la Secretaría de la Sala a las 15:19 horas del 19 de mayo del 2011, la recurrente manifiesta que el edificio que alberga la Municipalidad de Goicoechea y que se denomina "Palacio Municipal Amparo Zeledón", tiene ochenta y tres años de existencia. La construcción del edificio inició en 1924 y su inauguración fue en 1928 como cárcel para mujeres. Es considerado el único en el país con elementos de arquitectura tipo monástico y fue declarado "reliquia arquitectónica e histórica" en la administración Carazo Odio. Alega que el sector este de dicho edificio, está ocupado por el Centro de Confianza San José de la Dirección General de Adaptación Social y no se encuentra en buenas condiciones. Hay huecos, goteras, ventanales quebrados, salidas de aguas negras y aguas servidas, malos olores. Indica que el lado oeste, que es el que ocupa la Municipalidad, sí se encuentra en buenas condiciones. Considera que la situación es contraria a lo establecido en el artículo 89 constitucional.
  2. 2Informa bajo juramento Oscar Figueroa Fieujeam, en su calidad de Alcalde Municipal de Goicoechea que esa Municipalidad recibió la donación del inmueble en cuestión (folio real #160331-000), con base en la Ley #6626 del 25 de setiembre de 1981, reglamentada mediante Decreto Ejecutivo #14800-J del 12 de setiembre de 1983. La donación se condicionó a que el Ministerio de Justicia se reservara el uso y usufructo (sic) de una parte del edificio de 3990.3 metros cuadrados. Esto equivale a la totalidad del ala este y del parqueo este del inmueble. Ese Ministerio mantiene ahí un centro de confianza de adaptación social, cuando la donación se estableció solamente para oficinas. La Municipalidad ha dado mantenimiento adecuado al inmueble. En el edificio funciona también el Consultorio Jurídico de la Universidad de Costa Rica, la Escuela Municipal de Música de Goicoechea, la Banda Sinfónica Juvenil de Goicoechea y el Concejo Municipal.Es el centro de reunión de las fuerzas vivas del cantón. Desde 1992 han efectuado múltiples gestiones ante el Ministerio de Justicia y otras instancias del gobierno central debido a que el Ministerio ha desvirtuado el propósito de la donación. Adicionalmente, la Dirección de Adaptación Social dio en arriendo el parqueo del edificio a un supermercado, uso tampoco autorizado por la ley de donación. Es erróneo entender que se trata de un usufructo vitalicio, lo cual contravendría los artículos 289, 292, 343, 358 y 359 del Código Civil. Los bienes que se transmiten a título gratuito no pueden tener limitaciones que superen los diez años y ya han transcurrido veintinueve años. En 1993 la entonces Ministra de Justicia aseguró que no se mantendrían ahí más instalaciones carcelarias, pero se le continúa dando ese destino al inmueble. También en setiembre de 2000 el Ministro de Cultura requirió a la Ministra de Justicia dar mantenimiento adecuado al edificio, sin que se acatara la petición.En 2007 se insistió ante el Ministerio de Justicia que se desalojara esa parte del edificio, sin éxito. No debería tenerse como accionada a la Municipalidad, pues ha satisfecho su deber de cuidado del inmueble, sino como coadyuvante activa. Solicita que se desestime el recurso planteado.
  3. 3Jorge Rodríguez Bogle, Director General de Adaptación Social, rindió su informe bajo juramento, en los siguientes términos: el 9 de noviembre de 2010 se clausuraron los baños, servicios y lavatorios del Centro y en la misma semana se habilitaron otros baños, en colaboración con el Departamento de Arquitectura y aportando el material necesario para instalar la nueva batería de baños. Posteriormente se cambió toda la instalación eléctrica, se encausaron y entubaron las aguas negras y jabonosas en el sector del Archivo Central. Se ha dado mantenimiento correctivo y preventivo al edificio. Para el 2011, según información del Patronato de construcciones, instalaciones y adquisición de bienes del Ministerio se invertirá cuarenta y dos millones de colones en el edificio, en un estudio de vulnerabilidad estructural y en obras varias de mantenimiento. Se encargó al Jefe del Departamento de Arquitectura los trabajos. La licitación para contratar el estudio de vulnerabilidad resultó infructuosa, por lo que hay que tramitar de nuevo el concurso. Sobre las reparaciones, pintura y reparación de canoas, ventanas y su diseño, está en proceso de aprobación la propuesta ante el Ministerio de Cultura. Se ha realizado esfuerzos para dar mantenimiento al edificio, por lo que pide la desestimatoria del amparo.
  4. 4Contestó la audiencia conferida Sandra Quirós Bonilla, Directora del Centro de Investigación y Conservación del Patrimonio Cultural del Ministerio de Cultura y Juventud, diciendo que el Centro de Adaptación Social “Amparo Zeledón” fue declarado patrimonio histórico arquitectónico de Costa Rica, mediante el Decreto Ejecutivo #13021-C del 22 de octubre de 1981. Es ocupado por la Municipalidad de Goicoechea y la Dirección General de Adaptación Social del Ministerio de Justicia y Paz. Según estudio registral es propiedad de la Municipalidad señalada. De acuerdo con el artículo 1° de la Ley #6626 del 3 de diciembre de 1981 se autorizó a la Dirección General de Adaptación Social para donar a la Municipalidad de Goicoechea el inmueble donde se encontraba el centro en mención. El artículo 2° de la Ley establece las condiciones de la donación, concretamente que la Municipalidad debía conceder el uso y usufructo de parte de las instalaciones al Ministerio de Justicia.No es responsabilidad de ese Centro, sino del propietario, dar mantenimiento al bien. Se remitió el oficio CPC-0500-2011 del 1° de marzo de 2011 a la Auditora Interna de la Municipalidad de Goicoechea, solicitándole incluir en su plan de trabajo la verificación de que en la Municipalidad se está dando cumplimiento a la obligación de conservación. Respecto del Ministerio de Justicia y Paz, luego de la inspección del año 2010, se comunicó al Jerarca de esa Cartera Ministerial sus resultados y una serie de anomalías detectadas, sobre trabajos realizados sin permiso de ese Centro.
  5. 5En los procedimientos seguidos se ha observado las prescripciones legales.

Redacta el Magistrado Armijo Sancho; y,

Considerando:

I.Objeto del recurso. Considera el actor contrario a su derecho al patrimonio histórico arquitectónico la falta de mantenimiento que da la Dirección General de Adaptación Social a la parte que posee del edificio Amparo Zeledón en Goicoechea.

II.Hechos probados. De importancia para la decisión de este asunto, se estiman como debidamente demostrados los siguientes hechos, sea porque así han sido acreditados o bien porque el recurrido haya omitido referirse a ellos según lo prevenido en el auto inicial:

  • a)por medio del Decreto Ejecutivo #13021-C del 5 de octubre de 1981 se declaró reliquia de interés arquitectónico e histórico el edificio donde se encontraba el Reformatorio de Mujeres, Centro de Adaptación Social Amparo Zeledón (folio 22 de la copia certificada del expediente administrativo del Centro de Adaptación Social Amparo Zeledón); b) con base en la autorización conferida por Ley #6626 del 3 de setiembre de 1981 la Dirección General de Adaptación Social donó a la Municipalidad de Goicoechea, el inmueble donde se encontraba el Reformatorio de Mujeres (informe del Alcalde Municipal de Goicoechea); c) en el oficio CPC #1080-2010 del 28 de abril de 2010 la Directora del Centro de Investigación y Conservación del Patrimonio Cultural del Ministerio de Cultura y Juventud dio cuenta al Ministro de Justicia y Paz del resultado de la inspección del edificio del Centro de Adaptación Social Amparo Zeledón, donde alude a obras que se han ejecutado sin permiso del Centro de Investigación, causando daños al edificio, y se detalla problemas de mantenimiento, solicitando al Ministro incluir las partidas pertinentes en el presupuesto para el año 2011 (folios 169 a 176 de la copia certificada del d) el 14 de julio de 2010 el Jefe de Arquitectura de la Dirección General de Adaptación Social solicitó al Centro de Investigación y Conservación del Patrimonio Cultural autorización para pintar la fachada y la parte posterior del edificio, y cambiar las canoas en mal estado (folio 179 de la copia certificada del expediente administrativo del Centro de Adaptación Social Amparo Zeledón).

III.Sobre el fondo. Principalmente en la sentencia #2003-3656 de las 14:43 horas del 7 de mayo de 2007 se desarrolla la relevancia constitucional de la protección del patrimonio histórico arquitectónico, en los siguientes términos:

“XVIII.- Es a partir de los artículos 50 y 89 constitucionales que se genera una obligación para el Estado de proteger el entorno en el que se desarrolla la vida de la población de la nación, y que abarca estos dos ámbitos: lo natural y lo urbano; de manera que la tutela del patrimonio cultural, y más específico, del patrimonio histórico-arquitectónico, se ubica dentro de las regulaciones de orden urbanístico. Es en atención a las anteriores consideraciones que bien puede afirmarse que la conservación del patrimonio cultural contribuye a mantener el equilibrio ambiental necesario en el desarrollo urbano, al requerir, para su efectiva tutela, el respeto de la escala, la estructura y el dimensionamiento urbanos, regula la capacidad de cargas físicas, cuestiona las funciones y servicios urbanos, lo cual da como resultado, una mejor calidad ambiental; además de que contribuye a mantener la imagen propia o concurrencia perceptiva de la ciudad, lo que le da identidad o cohesión formal.” (…)

“XX.- CONCEPTUALIZACIÓN DE LA TUTELA AL PATRIMONIO CULTURAL COMO UN DERECHO FUNDAMENTAL. El proceso de desarrollo cultural de la sociedad y el intercambio de bienes y expresiones culturales, motivan el surgimiento de un contexto de derechos y obligaciones ligados a situaciones sociales, políticas y económicas del mundo, tales como las crecientes necesidades socioculturales de la población, la importancia cada vez mayor de la cultura como elemento esencial de la nacionalidad (identidad nacional), los problemas de la supervivencia de las culturas tradicionales, artesanales y folklóricas, y la importancia de los valores y expresiones del patrimonio cultural como factor fundamental de integración nacional, lo cual evidencia la necesidad de una adecuada regulación que involucre los intereses en juego. Bajo este contexto surge la tutela o protección del patrimonio cultural a cargo del Estado, toda vez que se enmarca dentro de la configuración del Estado Social de Derecho, con todas sus implicaciones, en virtud de lo cual se le conceptualiza como un verdadero derecho fundamental, que deriva del derecho a la cultura; y por lo tanto es exigible frente a las autoridades públicas responsables de esta tutela, lo cual se traduce en la exigibilidad de actuaciones efectivas y concretas de la Administración que tutelen el patrimonio cultural.

Este derecho tiene su sustento en la dignidad esencial de la persona humana, y en la necesidad de integrar este elemento con el desarrollo de la comunidad; de manera que comprende, no sólo el derecho de la persona a su autorrealización personal, sino también el derecho de la colectividad -población- a conformar su identidad cultural, toda vez que se constituye en un elemento esencial que coadyuva en esta importante tarea, por lo que también tiene implicaciones en la soberanía cultural de los Estados, concretamente en lo que respecta al resguardo de la personalidad cultural del país y a la exigencia de la cooperación internacional que al respecto pueda y deba darse. Es un derecho de la tercera generación, que se sustenta en el principio de solidaridad), por lo que se clasifica en la categoría de los derechos sociales, el cual tiene evidente trascendencia en tanto repercute en la vida en sociedad, por cuanto en virtud de éste se configura un derecho de todo individuo -como exigencia de su dignidad esencial-, a participar en el patrimonio y en la actividad cultural de la comunidad a que pertenece; y genera el deber -responsabilidad- para las autoridades públicas de propiciar los medios adecuados de participación efectiva para garantizar el acceso y ejercicio de este derecho, en la medida en que los recursos de que disponga lo permitan.

De este modo, la cultura se constituye en el elemento de conciencia más significativo para la salvaguardia del patrimonio esencial que define la identidad nacional en diversos niveles, y que comprende la protección del folklore, el estímulo de intelectuales y artísticas, el fomento del intercambio internacional, la protección del patrimonio cultural, el fomento del desarrollo de las artes, la educación artística y el fomento del libro. Es así como todo hombre tiene derecho a la cultura, del mismo modo que a la educación, al trabajo y la libertad de expresión, derechos fundamentales con los que guarda directa relación.”(…)

“la ayuda estatal en la conservación de este patrimonio, la cual se traduce en la planificación y planeamiento, asistencia técnica especializada, el otorgamiento de donaciones, ventajas fiscales, subsidios o préstamos blandos y adecuados para estos fines a los propietarios privados y sus usuarios, las cuales quedan subordinadas al respeto de ciertas condiciones impuestas en razón del interés público, como el garantizar la integridad de los edificios, la posibilidad de visitar los inmuebles, el tener acceso a los parques, jardines o lugares, tomar fotografías, la realización de inspecciones, etc.;” Asimismo en las sentencias #2004-13652 de las 18:13 horas del 30 de noviembre de 2004 y #2010-15388 de las 11:15 horas del 17 de setiembre del 2010 se tuteló el tema por medio del proceso de amparo, entendiéndolo como derecho fundamental.

IV.En el presente caso, no cabe duda que se trata de un bien de los protegidos en el artículo 89 de la Constitución, pues se decretó su formal declaratoria de reliquia de interés arquitectónico e histórico en 1981, por lo que cabe discutir en amparo si se ha incurrido en actos u omisiones graves que contravengan la condición de bien de protección especial que le confiere el ordenamiento jurídico. Desde esa perspectiva, sin embargo, no hay prueba de que el Centro de Investigación y Conservación del Patrimonio Cultural haya desatendido abiertamente su deber de supervisar que al bien se le de la conservación que requiere, pues, en el informe CPC #1080-2010 del 28 de abril de 2010 destacó las modificaciones ilegales que se habían efectuado al edificio e instado al Ministerio de Justicia a invertir en su conservación en el ejercicio presupuestario 2011. En consecuencia, respecto de esa dependencia debe desestimarse el amparo.

V.En cuanto a la Dirección General de Adaptación Social el citado informe de 2010 del Centro de Investigación y Conservación del Patrimonio Cultural pone en evidencia que violentó la condición de bien de valor histórico arquitectónico del inmueble en dos vertientes: al ejecutar obras incompatibles con su conservación y al omitir darle mantenimiento oportuno y adecuado. En su informe, el Director General de Adaptación Social señala obras ejecutadas en noviembre de 2010 en los baños, servicios y lavatorios del Centro y refiere que se cambió toda la instalación eléctrica, se encausaron y entubaron las aguas negras y jabonosas en el sector del Archivo Central. Que este año están programados trabajos de pintura, reparación de canoas y ventanas, en fase de aprobación por el Centro de Investigación. Con esas obras se estaría remediando parte de los defectos señalados por el Centro de Investigación, pero no se asegura que ellas satisfacen plenamente el deber de la Dirección de dar la conservación que corresponde al bien y una parte no se ha ejecutado aún.

Por lo anterior se declara con lugar el recurso en contra de la Dirección, ordenando a su Director General adoptar las medidas necesarias para que, a la mayor brevedad posible, se de a la parte que ocupa del edificio Amparo Zeledón la conservación que corresponde a su condición de bien de interés arquitectónico e histórico. De la sentencia deberá notificarse al Ministro de Justicia y Paz, por estar adscrita la Dirección accionada a esa Cartera.

VI.Cabe señalar, por último, que se requirió informe a la Municipalidad de Goicoechea, en su condición de propietaria del inmueble, pero habiéndose constatado que da el mantenimiento que corresponde al bien, debe desestimarse el amparo en su contra. Lo anterior con la aclaración que parte de los temas que sugiere son ajenos a la materia constitucional y extraños a la sumariedad que caracteriza al amparo. Concretamente si el usufructo al cual se condicionó la donación efectuada por la Dirección General de Adaptación Social –titular originario del bien– está sujeto a plazo y cuál sería ese plazo, así como el destino que deba darse a la parte usufructuada del inmueble. Esos extremos deberán discutirse y definirse en sede administrativa o en la jurisdiccional ordinaria competente.

Por tanto:

Se declara con lugar el recurso únicamente en contra de la Dirección General de Adaptación Social. Se ordena a Jorge Rodríguez Bogle, Director General de Adaptación Social, o a quien ocupe su cargo, adoptar las medidas necesarias para que, a la mayor brevedad posible, se de a la parte que ocupa del edificio Amparo Zeledón la conservación que corresponde a su condición de bien de interés arquitectónico e histórico. En lo demás, se declara sin lugar el amparo. Se condena al Estado al pago de las costas, daños y perjuicios ocasionados, los cuales se liquidarán en ejecución de sentencia de lo contencioso administrativo. Se advierte al funcionario dicho que, de conformidad con el artículo 71 de la Ley de la Jurisdicción Constitucional, se impondrá prisión de tres meses a dos años, o de veinte a sesenta días multa, a quien recibiere una orden que deba cumplir o hacer cumplir, dictada en un recurso de amparo y no la cumpliere o no la hiciere cumplir, siempre que el delito no esté más gravemente penado. Notifíquese al recurrido y al Ministro de Justicia y Paz la presente resolución en forma personal.
