Amparo proceeding (recurso de amparo) filed by Alex Arturo Olivares Olivares, of legal age, married, painter, resident of Golfito, holder of identity card number 6-164-706, against the Municipalidad de Parrita and the Ministerio de Salud.

Considerations:
I.Subject matter of the proceeding. The petitioner considers that his fundamental rights have been violated because, he states, the respondent Municipalidad has neglected maintenance work on the channels, culverts, and drains in his neighborhood, as a result of which the community of Pueblo Nuevo has suffered flooding that endangers the health of its residents, since sewage and fecal matter flow through their homes.
a. On 15 de marzo de 2010, the protected party (amparado) filed a complaint with the Municipalidad de Parrita regarding the problems they were experiencing with flooding and the cleaning of primary, secondary, and tertiary channels and drains, as well as the sewer systems in urban centers (page 38).
b. The family that previously lived where the petitioner resides had been relocated; however, despite knowing this situation, the protected party nevertheless moved into the property, which is situated at a lower elevation such that ordinary rainfall causes water to enter his home. (page 26) c. During an inspection conducted by the respondent Municipalidad on 6 de abril de 2010, a large amount of garbage was found at the location in question (washing machines, a cooler, cans, bags, etc.), along with felled trees that, although not aggravating factors, were practically filling the channels with sediment; there were also many weeds. The Municipalidad therefore indicated that it would proceed with the cleaning within the following 15 days.
d. In a written communication dated 6 de abril de 2010, the Municipal Mayor of Parrita responded to the protected party’s complaint, informing him of the inspection results and of the problems affecting those homes, whose families had previously been relocated, and urging the petitioner to form an Assistance and Oversight Committee for channel cleaning and other needs. (page 36) e. On 21 de abril de 2010, the petitioner informed the respondent Municipalidad that he was already working to form the Support Committee in order to resolve the problems affecting them during the rainy season (page 35).
f. The respondent Municipalidad has cleaned the primary, secondary, and tertiary channels, as well as the drains; has constructed sewer systems; and has used municipal machinery to prevent flooding. Together with the Comisión Nacional de Emergencias, it has constructed several levees and new drainage channels. However, the problem at the location where the petitioner resides is a special case because of the property’s lower elevation. (page 26) g. On 10 de mayo de 2010, the petitioner filed a complaint with the respondent Ministerio describing problems involving overflowing and flooding of homes and septic tanks. (page 115) h. On 21 de mayo de 2010, health authorities inspected the protected party’s home, and their report verified:
III.The right to a healthy and ecologically balanced environment (derecho a un ambiente sano y ecológicamente equilibrado). Article fifty of the Political Constitution establishes as fundamental the right of every person to a healthy and ecologically balanced environment. Even before Article fifty was amended to expressly address environmental matters, the Chamber, through its case law, had already derived this right from the constitutional provisions of Articles twenty-one—the right to life and health—sixty-nine—the rational use of land—and eighty-nine—the protection of natural beauty. The Chamber has adopted an open or macro-level understanding of the concept of the environment and the protection afforded to it, going beyond the basic or primary protection of soil, air, water, marine and coastal resources, minerals, forests, the diversity of flora and fauna, and the landscape, to also consider elements relating to the economy, the generation of foreign currency through tourism, agricultural use, and others. Thus, in judgment number 1995-5893, at nine forty-eight a.m. on the twenty-seventh of October, nineteen ninety-three, the Chamber held that:
“[E]nvironmental law (Derecho Ambiental) must not be associated solely with nature, since nature is only part of the environment. Nature-protection policy also encompasses other matters, such as the protection of hunting, forests, natural parks, and natural resources. It is therefore a macro-environmental concept, so as not to exclude important concepts and thereby to unify the body of law that we call Environmental Law.”
IV.The State’s duty to safeguard the environment (tutela del ambiente). Following the amendment of Article fifty of the Constitution, which expressly enshrined environmental rights (derecho ambiental) as a fundamental right, the State’s obligation to guarantee, defend, and safeguard that right was also established in categorical terms, thereby making the State the guarantor of the protection and safeguarding of the environment and natural resources. Under this provision, read in conjunction with Articles twenty, sixty-nine, and eighty-nine of the Political Constitution, the State bears responsibility for exercising a protective and governing role in this field, as prescribed by the constitutional provision under discussion—a role further developed by environmental legislation. The constitutional mandate thus establishes the State’s duty to guarantee, defend, and preserve that right. In this connection, it must be considered that the regulations designate the Ministry of Environment and Energy as the governing body for the natural-resources, energy, and mining sector, pursuant to Article two of the Organic Law of that Ministry, number seven thousand one hundred fifty-two, of the fourth of June, nineteen ninety.
In the Chamber’s view, this governing authority (rectoría) over environmental matters includes not only establishing appropriate regulations for the use of forest resources and natural resources, as also provided in Article fifty-six of the Organic Law of the Environment, but also confers upon it the important role of governing environmental matters, which entails maintaining a leading role in this field. In this regard, the supervision and oversight (control y fiscalización) of environmental matters and activities constitute an essential function of the State under Article fifty of the Constitution, insofar as its third paragraph provides, as relevant here: “The State shall guarantee, defend, and preserve that right”; this is consistent with the constitutional principle established in the second paragraph of Article nine of the Political Constitution, which expressly prohibits the Branches of Government from delegating the exercise of their own functions, particularly when those functions are essential.
Accordingly, with respect to environmental protection, the functions of governance, supervision, and oversight over environmental matters belong to the State and are entrusted to its various administrative agencies.
V.Prevention of environmental risk (prevención del riesgo ambiental). With this State obligation established at the constitutional level, it is important to consider how international human-rights protection instruments also establish specific obligations that must be respected. In environmental matters, the duty of prevention (deber de prevención) applicable in this field has been defined; the Rio Declaration, adopted at the United Nations Conference on Environment and Development, provides that:
“Principle 15.- In order to protect the environment, States shall widely apply the precautionary approach (criterio de precaución) according to their capabilities. Where there is a threat of serious and irreversible damage, lack of full scientific certainty shall not be used as a reason for postponing cost-effective measures to prevent environmental degradation.” Prevention seeks to anticipate adverse effects and to ensure the protection, conservation, and proper management of resources. Consequently, the guiding principle of prevention (principio rector de prevención) is based on the need to take and implement all precautionary measures (medidas precautorias) necessary to prevent or contain potential harm to the environment or human health. Accordingly, where there is a risk of serious or irreversible harm—or uncertainty in that regard—a precautionary measure must be adopted, and the activity concerned may even be postponed.
This is because, in environmental matters, enforcement after the fact is ineffective, since once harm has occurred, the biologically and socially harmful consequences may be irreparable; punishment may carry moral significance, but it will hardly compensate for the harm caused to the environment. As stated both in the cited international instrument and in Article fifty of the Constitution itself, the State is responsible for carrying out this preventive work, as this Chamber recognized in judgment number 2001-6503, of the sixth of July, two thousand one, when it stated:
“The third paragraph of Article 50 of the Constitution states with complete clarity that the State must guarantee, defend, and preserve every person’s right to a healthy and ecologically balanced environment; this means that public entities are not only required to ensure that private parties and other public entities comply with environmental legislation, but, above all, must themselves conduct their activities in accordance with the mandates of those protective bodies of law. State institutions are the first entities called upon to comply with protective environmental legislation, and there is no justification whatsoever for exempting them from compliance with environmental requirements such as, for example, the environmental impact study (estudio de impacto ambiental) required by the Organic Law of the Environment for activities undertaken by public entities that, by their nature, may alter or destroy the environment.” (emphasis added)
VI.Coordination among public institutions in the comprehensive protection of the environment. The State—as a whole—is obligated to take the measures necessary to protect the environment, in order to prevent levels of pollution, deforestation, extinction of flora and fauna, and excessive or improper use of natural resources that endanger the health of the public. For purposes of this task, “public institution” includes both the Central Administration—ministries such as the Ministry of Environment and Energy and the Ministry of Health, which, by reason of their subject matter, have extensive involvement and responsibility regarding the conservation and preservation of the environment and which most often act through their specialized agencies in this field, such as the Dirección General de Vida Silvestre, the Dirección Forestal, and the Secretaría Técnica Nacional Ambiental (SETENA)—and decentralized institutions such as the Instituto Nacional de Vivienda y Urbanismo, SENARA, the Instituto Costarricense de Turismo, and the Instituto Costarricense de Acueductos y Alcantarillados.
Municipalities likewise bear significant responsibility for this task within their territorial jurisdictions. Given the diversity of actors that may be involved, one might think that this multiple allocation of responsibility would cause chaos in administrative management. Therefore, to prevent the simultaneous coexistence of spheres of authority having different origins and natures, the duplication of national and local efforts, and confusion regarding the rights and obligations of the various parties involved, it is necessary to establish a series of coordinating relationships among the various agencies of the Executive Branch and decentralized institutions, and between those entities and the municipalities, so that they may perform the functions entrusted to them. This Chamber has already addressed the principle of coordination (principio de coordinación) between public agencies and municipalities in pursuing common purposes, stating in judgment number 1999-5445, at two thirty p.m. on the fourteenth of July, nineteen ninety-nine, that:
“[C]oordination is the ordering of the relationships among these various independent activities, addressing their convergence upon the same object or entity so as to make it useful to an overall public plan, without eliminating the reciprocal independence of the acting entities. Because there is no hierarchical relationship among decentralized institutions, or between the State itself and the municipalities, it is not possible to impose particular conduct upon them; hence the indispensable need for interinstitutional ‘concerted action,’ in the strict sense, whereby autonomous and independent centers of action agree upon that preventive and comprehensive framework, in which each performs a role with a view to a mission entrusted to the others. Thus, relations between municipalities and other public entities may be conducted only on an equal footing, resulting in agreed forms of coordination and excluding any mandatory arrangement detrimental to their autonomy that would subject corporate entities to a coordination framework without or against their consent; this does, however, permit the necessary subordination of those entities to the State and in the State’s interest (through the State’s ‘administrative oversight’ (tutela administrativa), specifically in the function of reviewing legality entrusted to it, with powers of general supervision over the entire sector).” On the other hand, omissions in the duty to protect the environment and comply with environmental regulations are constitutionally significant, insofar as the Administration’s inaction in this area may cause damage to the environment and natural resources, sometimes with consequences similar to or greater than those resulting from actions by the Administration; examples include authorizing land-use plans (planes reguladores) or construction without approval of the environmental impact study (estudio de impacto ambiental) by the Secretaría Técnica Nacional Ambiental; failure by the Dirección General de Vida Silvestre del Ministerio del Ambiente y Energía to control and oversee the implementation of management plans (planes de manejo) for protected areas; allowing companies to operate without health permits for wastewater treatment—Acueductos y Alcantarillados and Ministerio de Salud—or failing to verify noise controls in bars, restaurants, or event venues (municipalities and Ministerio de Salud).
VI.The role of municipalities in environmental matters. In accordance with the foregoing, municipalities, as an integral part of the State as a whole, bear substantial responsibility for environmental matters within the scope of their powers and obligations, whether by directly approving permits or licenses that require prior compliance with requirements demonstrating proper environmental management before other public authorities, or through regular inspections and referral of hazardous situations to the agencies with greater authority to intervene. It has already been established that local governments are subject to the obligation to coordinate and prevent environmental harm within their territorial jurisdiction; accordingly, municipalities are indeed important participants in the task of protecting the environment. The authority of local governments to establish their own land-use planning (ordenación territorial) through land-use plans is unquestionable; however, the existence of such plans—most of which lack supplementary planning provisions from the standpoint of a healthy and ecologically balanced environment—does not render environmental protection legislation inapplicable.
On the contrary, the Chamber considers it a fundamental requirement, one that does not infringe the constitutional principle of municipal autonomy, that every land-use plan, before being approved and implemented, undergo an environmental impact assessment (examen del impacto ambiental) from the perspective established by Article Fifty of the Constitution, so that land-use regulation and its various systems are compatible with the scope of the higher-ranking provision, particularly considering that this provision establishes the right of all inhabitants to receive an environmental response from all public authorities. This undoubtedly includes municipalities, which are not exempt from the application of the constitutional provision and its implementing legislation. It is evident that, in this case, the national and local interests fully coincide; local governments therefore may and must require compliance with environmental requirements within their territory and, in the event of a dispute with the authorities responsible for environmental matters, may submit the controversies to the judicial oversight body having jurisdiction based on the nature of the violation.
For the foregoing reasons, environmental protection provisions are not constitutionally incompatible with the powers and authority of municipalities, which are required, by mandate of Article Fifty of the Political Constitution, to devote themselves to protecting the environment—see, to this effect, judgment number 2006-7994, at eight hours and fifty-seven minutes on the second of June, two thousand six.
VII.The specific case. The alleged municipal omission. From its review of the case file and the report submitted under oath, the Chamber finds it established that on 15 de marzo de 2010 the protected party (amparado) filed a complaint with the Municipalidad de Parrita concerning the flooding affecting their homes and the cleaning of primary, secondary, and tertiary channels and drains, as well as the sewer systems of urban centers. In response to this request, on 6 de abril de 2010 the respondent authority inspected the location in question and found a large amount of trash (washing machines, a cooler, cans, bags, etc.), fallen trees that, although not aggravating factors, were practically filling in the channels, and abundant weeds; the Municipalidad therefore stated that it would carry out the cleaning within the next 15 days. Thus, in a written response dated 6 de abril de 2010, the Alcalde Municipal de Parrita answered the protected party’s complaint, informing him of the inspection results and of the problems affecting those homes due to the slope of the land, reminding him that the family that had occupied that home had previously been relocated, and urging the petitioner (recurrente) to form a Committee for Assistance and Oversight of Channel Cleaning and Other Needs.
Accordingly, on 21 de abril de 2010, the petitioner informed the respondent Municipalidad that he was already working to establish the Support Committee in order to resolve the problems affecting them during the rainy season. The Chamber therefore finds that the request submitted by the petitioner on that occasion was addressed and answered by the municipal authorities. The representatives of this Municipio also reported under oath that, generally, they had proceeded to clean the primary, secondary, and tertiary channels and the drains, had constructed sewer systems, and had deployed municipal machinery to prevent flooding, working jointly with the Comisión Nacional de Emergencias and successfully creating several dikes and new drainage channels. However, the location where the petitioner resides presents a special case because of the difference in elevation affecting the property. Notwithstanding the statements made by this Municipio, the fact remains that the most recent inspection by the Ministerio de Salud found that, although it was not possible to verify contamination caused by sewage discharge into the drains or fecal matter in the water, because it is a very extensive open ditch used to discharge stormwater, an urban-planning problem exists at the site: the homes are built alongside a street owned by Palma Tica, meaning that they illegally occupy the land.
Nevertheless, the occupants have not been evicted, and the Ministerio recommended following up on the case because, as of 21 de mayo de 2010—a date after the Municipalidad had promised to undertake the necessary cleaning work—another inspection of the protected party’s home by health authorities verified:

The petition is granted solely against the Municipalidad de Parrita. Consequently, Nelson Masís Campos, in his capacity as Presidente del Concejo Municipal, and Gerardo Acuña Calderón, in his capacity as Alcalde, both of the Municipalidad de Parrita, or whoever may hold those offices in their stead, are ordered to proceed IMMEDIATELY to clean the channels and drains affecting the petitioner and ensure the free flow of stormwater through them. They are warned of the consequences, including criminal consequences, arising from disobedience of the orders issued by this Constitutional Court, Article 71 of the Ley de la Jurisdicción Constitucional. As to the Ministerio de Salud, the petition is denied. The Municipalidad de Parrita is ordered to pay costs and damages, which shall be determined during enforcement of the judgment in the administrative litigation proceedings (ejecución de sentencia de lo contencioso administrativo). This judgment shall be served personally on Nelson Masís Campos, in his capacity as Presidente del Concejo Municipal, and Gerardo Acuña Calderón, in his capacity as Alcalde, both of the Municipalidad de Parrita, or whoever may hold those offices in their stead. Recurso de amparo interpuesto por Alex Arturo Olivares Olivares; mayor, casado, pintor, vecino de Golfito, con cédula de identidad número 6-164-706; contra la Municipalidad de Parrita y el Ministerio de Salud.
Resultando:
Redacta el Magistrado Araya Garcia; y,
Considerando:
I.Objeto del recurso. El recurrente considera lesionados sus derechos fundamentales, por cuanto señala que la Municipalidad recurrida ha descuidado las obras de mantenimiento de los canales, alcantarillas y desagües de su vecindario; razón por la cual, la comunidad de Pueblo Nuevo ha sufrido inundaciones que ponen en riesgo la salud de los habitantes, ya que discurren aguas negras y materia fecal por sus casas.
II.Hechos probados. De importancia para la decisión de este asunto, se estiman como debidamente demostrados los siguientes hechos:
a. El 15 de marzo de 2010 el amparado presentó una denuncia ante la Municipalidad de Parrita por la problemática que tienen con las inundaciones y la limpieza de canales, primarios, secundarios y terciarios, así como desagües, además del alcantarillado de los centros urbanos (folio 38) b. La familia que habitaba anteriormente donde vive el recurrente había sido reubicada, sin embargo conocedor de esta situación, aún así el amparado se instaló en el inmueble, el cual está ubicado con un desnivel que una lluvia común ocasiona que se introduzca agua a su casa. (folio 26) c. En inspección realizada por la Municipalidad recurrida el 6 de abril de 2010 determinó en el lugar en cuestión gran cantidad de basura (lavadoras, enfriador, tarros, bolsas, etc), árboles derramados, que aunque no son agravantes prácticamente están aterrando los canales y hay mucha maleza, por lo que la Municipalidad indicó que procedería a realizar la limpieza en los próximos 15 días.
d. Por escrito del 6 de abril de 2010 el Alcalde Municipal de Parrita contestó la denuncia del amparado, poniéndolo en conocimiento del resultado de la inspección, de la problemática de esas viviendas que en ocasiones anteriores las familias han sido reubicadas e insta al recurrente a formar un Comité de Ayuda y Vigilancia de limpieza de canales y demás necesidades. (folio 36) e. El 21 de abril de 2010 el recurrente informó a la Municipalidad recurrida que ya se encontraba trabajando en la conformación del Comité de Apoyo, a fin de dar solución a los problemas que les aquejan en época lluviosa (folio 35) f. La Municipalidad recurrida ha limpiado los canales primarios, secundarios y terciarios, así como los desagües, ha hecho los alcantarillados y la maquinaria municipal ha trabajado para evitar el problema de inundaciones, en unión con la Comisión Nacional de Emergencias, ha logrado la creación de varios diques y nuevos canales de desagüe, sin embargo el problema del lugar donde se encuentra el recurrente es un caso especial, por el desnivel que presenta la propiedad.
(folio 26) g. El 10 de mayo de 2010 el recurrente interpuso denuncia ante el Ministerio recurrido indicando problemas de desbordamiento e inundación de las viviendas, así como en los tanques sépticos. (folio 115) h. El 21 de mayo de 2010 las autoridades de salud realizaron una inspección a la casa del amparado cuyo informe verificó:
III.El derecho a un ambiente sano y ecológicamente equilibrado. El artículo cincuenta de la Constitución Política establece como fundamental el derecho de toda persona a un ambiente sano y ecológicamente equilibrado. De previo a la modificación de este artículo cincuenta para considerar de manera expresa lo relativo al ambiente, ya la Sala, a través de su labor jurisprudencial, había derivado este derecho a partir de las disposiciones constitucionales de los artículos veintiuno –derecho a la vida y a la salud-, sesenta y nueve –explotación racional de la tierra- y ochenta y nueve –protección de las bellezas naturales-. La Sala ha optado por una consideración abierta o macro del concepto ambiente y de la protección que se brinda al mismo, trascendiendo de la protección básica o primaria del suelo, el aire, el agua, los recursos marinos y costeros, minerales, bosques, diversidad de flora y fauna, y paisaje, para considerar también elementos referentes a la economía, a la generación de divisas a través del turismo, la explotación agrícola y otros. Así, mediante sentencia número 1995-5893, de las nueve horas cuarenta y ocho minutos del veintisiete de octubre de mil novecientos noventa y tres, la Sala estableció que:
“[E]l Derecho Ambiental no debe asociarse sólo con la naturaleza, pues ésta es únicamente parte del ambiente. La política de protección a la naturaleza se vierte también sobre otros aspectos como la protección de la caza, de los bosques, de los parques naturales y de los recursos naturales. Se trata, entonces, de un concepto macro-ambiental, para no dejar conceptos importantes por fuera y así lograr unificar el conjunto jurídico que denominamos Derecho Ambiental"
IV.El deber del Estado en la tutela del ambiente. A partir de la reforma del artículo cincuenta constitucional, en la cual se consagró expresamente el derecho ambiental como un derecho fundamental, se estableció también -en forma terminante- la obligación del Estado de garantizar, defender y tutelar este derecho, con lo cual, el Estado se constituye en el garante en la protección y tutela del medio ambiente y los recursos naturales. Es a tenor de esta disposición, en relación con los artículos veinte, sesenta y nueve y ochenta y nueve de la Constitución Política, que se derivó la responsabilidad del Estado de ejercer una función tutelar y rectora en esta materia, según lo dispone la propia norma constitucional en comentario, función que desarrolla la legislación ambiental. Es así como el mandato constitucional establece el deber para el Estado de garantizar, defender y preservar ese derecho.
En este orden de ideas, debe considerarse que la normativa establece al Ministerio del Ambiente y Energía como el órgano rector del sector de los recursos naturales, energía y minas, según lo dispuesto en el artículo dos de la Ley Orgánica de este ministerio, número siete mil cientos cincuenta y dos, de cuatro de junio de mil novecientos noventa. Esta función de rectoría en la materia ambiental, a criterio de la Sala, comprende no solo el establecimiento de regulaciones adecuadas para el aprovechamiento del recurso forestal y los recursos naturales, según lo dispone también el artículo cincuenta seis de la Ley Orgánica del Ambiente, sino que le confiere la importante función de ejercer la rectoría en la materia ambiental, consistente en mantener un papel preponderante en esta materia. En este sentido, el control y fiscalización de la materia y actividad ambiental se constituye en una función esencial del Estado según lo dispuesto en el artículo cincuenta de la Constitución, en tanto dispone en lo que interesa en el párrafo tercero: "El Estado garantizará, defenderá y preservará ese derecho"; lo cual resulta concordante con el principio constitucional establecido en el párrafo segundo del artículo nueve de la Constitución Política, que expresamente prohíbe a los Poderes del Estado la delegación del ejercicio de funciones que le son propias, máxime cuando se constituyen en esenciales.
De esta manera, tratándose de la protección ambiental, las funciones de rectoría, control y fiscalización de la materia ambiental, corresponden al Estado, a cargo de las diversas dependencias administrativas.
V.La prevención del riesgo ambiental. Estableciéndose a nivel constitucional esta obligación del Estado, resulta importante apreciar cómo a nivel de los instrumentos internacionales de protección de los derechos humanos también se establecen obligaciones concretas que deben ser respetadas. En materia ambiental se ha definido el deber de prevención que debe existir en este ámbito; la Declaración de Río, adoptada en la Conferencia de las Naciones Unidas sobre el Medio Ambiente y el Desarrollo, dispone que:
"Principio 15.- Con el fin de proteger el medio ambiente, los Estados deberán aplicar ampliamente el criterio de precaución conforme a sus capacidades. Cuando haya peligro de daño grave e irreversible, la falta de certeza científica absoluta no deberá utilizarse como razón para postergar la adopción de medidas eficaces en función de los costos para impedir la degradación del medio ambiente".
La prevención pretende anticiparse a los efectos negativos, y asegurar la protección, conservación y adecuada gestión de los recursos. Consecuentemente, el principio rector de prevención se fundamenta en la necesidad de tomar y asumir todas las medidas precautorias para evitar o contener la posible afectación del ambiente o la salud de las personas. De esta forma, en caso de que exista un riesgo de daño grave o irreversible -o una duda al respecto-, se debe adoptar una medida de precaución e inclusive posponer la actividad de que se trate. Lo anterior debido a que en materia ambiental la coacción a posteriori resulta ineficaz, por cuanto de haberse producido el daño, las consecuencias biológicas y socialmente nocivas pueden ser irreparables; la represión podrá tener una trascendencia moral, pero difícilmente compensará los daños ocasionados al ambiente. Tal como lo señala el instrumento internacional de cita como el mismo artículo cincuenta constitucional, es el Estado el llamado a efectuar esta labor de prevención, y así lo ha reconocido esta Sala al afirmar, mediante sentencia número 2001-6503, de seis de julio de dos mil uno, que:
“El párrafo tercero del numeral 50 Constitucional señala con toda claridad que el Estado debe garantizar, defender y preservar el derecho de todas persona a un ambiente sano y ecológicamente equilibrado; lo que implica afirmar que los entes públicos no sólo están en la obligación de hacer cumplir –a los particulares y otros entes públicos- la legislación ambiental, sino también, ante todo, que deben ajustar su accionar a los dictados de esos cuerpos normativos tutelares. Las instituciones del Estado son las primeras llamadas a cumplir con la legislación tutelar ambiental, sin que exista justificación alguna para eximirlas del cumplimiento de requisitos ambientales como, a manera de ejemplo, el estudio de impacto ambiental que exige la Ley Orgánica del Ambiente para las actividades que emprendan los entes públicos que, por su naturaleza, puedan alterar o destruir el ambiente." (énfasis añadido)
VI.La coordinación de las instituciones públicas en la protección integral al ambiente. Existe una obligación para el Estado –como un todo- de tomar las medidas necesarias para proteger el ambiente, a fin de evitar grados de contaminación, deforestación, extinción de flora y fauna, uso desmedido o inadecuado de los recursos naturales, que pongan en peligro la salud de los administrados. En esta tarea, por institución pública se entiende tanto a la Administración Central –Ministerios, como el Ministerio del Ambiente y Energía y el Ministerio de Salud, que en razón de la materia, tienen una amplia participación y responsabilidad en lo que respecta a la conservación y preservación del ambiente; los cuales actúan, la mayoría de las veces, a través de sus dependencias especializadas en la materia, como por ejemplo, la Dirección General de Vida Silvestre, la Dirección Forestal, y la Secretaría Técnica Nacional Ambiental (SETENA)-, así como también las instituciones descentralizadas como el Instituto Nacional de Vivienda y Urbanismo, el SENARA, el Instituto Costarricense de Turismo o el Instituto Costarricense de Acueductos y Alcantarillados.
Del mismo modo, en esta tarea tienen gran responsabilidad las municipalidades en lo que respecta a su jurisdicción territorial. Debido a la diversidad de actores que pueden intervenir, podría pensarse que esta múltiple responsabilidad provocaría un caos en la gestión administrativa. Por ello, a fin de evitar la coexistencia simultánea de esferas de poder de diferente origen y esencia, la duplicación de los esfuerzos nacionales y locales, así como la confusión de derechos y obligaciones entre las diversas partes involucradas, se hace necesario establecer una serie de relaciones de coordinación entre las diversas dependencias del Poder Ejecutivo y las instituciones descentralizadas, y entre éstas con las municipalidades, a fin de poder llevar a cabo las funciones que les han sido encomendadas. Esta Sala se ha referido ya al principio de coordinación de las dependencias públicas con las municipalidades en la realización de fines comunes, al señalar mediante sentencia número 1999-5445, de las catorce horas treinta minutos del catorce de julio de mil novecientos noventa y nueve, que:
"[L]a coordinación es la ordenación de las relaciones entre estas diversas actividades independientes, que se hace cargo de esa concurrencia en un mismo objeto o entidad, para hacerla útil a un plan público global, sin suprimir la independencia recíproca de los sujetos agentes. Como no hay una relación de jerarquía de las instituciones descentralizadas, ni del Estado mismo en relación con las municipalidades, no es posible la imposición a éstas de determinadas conductas, con lo cual surge el imprescindible «concierto» interinstitucional, en sentido estricto, en cuanto los centros autónomos e independientes de acción se ponen de acuerdo sobre ese esquema preventivo y global, en el que cada uno cumple un papel con vista en una misión confiada a los otros. Así, las relaciones de las municipalidades con los otros entes públicos, sólo pueden llevarse a cabo en un plano de igualdad, que den como resultado formas pactadas de coordinación, con exclusión de cualquier forma imperativa en detrimento de su autonomía, que permita sujetar a los entes corporativos a un esquema de coordinación sin su voluntad o contra ella; pero que sí admite la necesaria subordinación de estos entes al Estado y en interés de éste (a través de la «tutela administrativa» del Estado, y específicamente, en la función de control la legalidad que a éste compete, con potestades de vigilancia general sobre todo el sector).” Por otro lado, las omisiones al deber de protección del ambiente y de cumplimiento de la normativa ambiental son de relevancia constitucional, por cuanto como consecuencia de la inercia de la Administración en esta materia, se puede producir un daño al ambiente y a los recursos naturales, a veces, de similares o mayores consecuencias que de las derivadas de las actuaciones de la Administración; como lo es la autorización de planes reguladores, o construcciones sin la aprobación del estudio de impacto ambiental por parte de la Secretaría Técnica Nacional Ambiental, o la falta de control y fiscalización en la ejecución de los planes de manejo de las áreas protegidas por parte de la Dirección General de Vida Silvestre del Ministerio del Ambiente y Energía, el permitir el funcionamiento de empresas sin los permisos de salud en lo que respecta al tratamiento de aguas residuales -Acueductos y Alcantarillados y Ministerio de Salud-, o no verificar los controles sónicos en bares, restaurantes o centros de fiestas (municipalidades y Ministerio de Salud).
VI.El papel de las municipalidades en materia ambiental. De conformidad con lo dicho, las municipalidades, como parte integrante del todo que es el Estado, tienen dentro del ámbito de sus competencias y obligaciones una alta responsabilidad en materia ambiental, sea mediante la aprobación directa de permisos o licencias para las cuales se exija el previo cumplimiento de requisitos que acrediten ante otras instancias del poder público el adecuado manejo ambiental, como mediante inspecciones regulares y canalización de situaciones de riesgo ante las instancias con mayor competencia de intervención. Ha quedado establecido ya que a los gobiernos locales les alcanza la obligación de coordinación y prevención en materia ambiental dentro del ámbito de su jurisdicción territorial, de donde resulta que ciertamente las municipalidades son actores importantes en la tarea de protección al ambiente. Es indubitable la facultad de los gobiernos locales para darse su propia ordenación territorial a través de los planes reguladores; pero la existencia de éstos -que en su mayoría carecen de complementos de ordenación desde el punto de vista del ambiente sano y ecológicamente equilibrado- no produce la desaplicación de la legislación tutelar ambiental.
Por el contrario, estima la Sala que debe ser requisito fundamental, que no atenta contra el principio constitucional de la autonomía municipal, el que todo plan regulador deba considerar, de previo a ser aprobado y desarrollado, con un examen del impacto ambiental desde la perspectiva que da el artículo cincuenta constitucional, para que el ordenamiento del suelo y sus diversos regímenes sean compatibles con los alcances de la norma superior, sobre todo, valorando que esta disposición establece el derecho de todos los habitantes a obtener una respuesta ambiental de todas las autoridades públicas y ello incluye, sin duda, a las municipalidades, quienes no están exentas de la aplicación de la norma constitucional y de su legislación de desarrollo. Es evidente que en este caso, es totalmente coincidente el interés nacional y el local, y por ello los gobiernos locales pueden y deben exigir el cumplimiento de requisitos ambientales en su territorio, y en caso de conflicto con las autoridades rectoras de la materia ambiental, pueden someter las controversias al contralor jurisdiccional que corresponda según la naturaleza de la infracción.
Es por lo anterior que las normas tutelares del ambiente no son incompatibles, desde el punto de vista constitucional, con las facultades y competencias de las municipalidades, las que están obligadas, por imperativo del artículo cincuenta de la Constitución Política, a prodigarse en la protección del ambiente –ver, en este sentido, sentencia número 2006-7994, de las ocho horas cincuenta y siete minutos del dos de junio de dos mil seis-.
VII.El caso concreto. La aducida omisión municipal. Del estudio de los autos y del informe rendido bajo fe de juramento, la Sala tiene por acreditado que el 15 de marzo de 2010 el amparado presentó una denuncia ante la Municipalidad de Parrita, por la problemática que tienen en sus casas de habitación con las inundaciones y la limpieza de canales, primarios, secundarios y terciarios, así como desagües, además del alcantarillado de los centros urbanos. En atención a esta gestión, la autoridad recurrida procedió el 6 de abril de 2010 a realizar una inspección al lugar en cuestión, donde se determinó la existencia de gran cantidad de basura (lavadoras, enfriador, tarros, bolsas, etc), árboles derramados, que aunque no son agravantes, prácticamente están aterrando los canales y hay mucha maleza, por lo que la Municipalidad indicó que procedería a realizar la limpieza en los próximos 15 días. De manera que por escrito del 6 de abril de 2010 el Alcalde Municipal de Parrita contestó la denuncia del amparado, poniéndolo en conocimiento del resultado de la inspección, de la problemática de esas viviendas por el declive del terreno, recordándole que en ocasiones anteriores la familia que habitaba esa vivienda había sido reubicada e insta al recurrente a formar un Comité de Ayuda y Vigilancia de limpieza de canales y demás necesidades.
De manera que el 21 de abril de 2010, el recurrente informó a la Municipalidad recurrida que ya se encontraba trabajando en la conformación del Comité de Apoyo, a fin de dar solución a los problemas que les aquejan en época lluviosa. De tal forma, la Sala aprecia que la gestión planteada por el recurrente en aquella oportunidad fue atendida y contestada por las autoridades municipales. Asimismo, informaron bajo juramento los representantes de este Municipio, que han procedido en general, a limpiar los canales primarios, secundarios y terciarios, así como los desagües, han hecho los alcantarillados y la maquinaria municipal ha trabajado para evitar el problema de inundaciones, en unión con la Comisión Nacional de Emergencias, logrando la creación de varios diques y nuevos canales de desagüe, sin embargo el problema del lugar donde se encuentra el recurrente es un caso especial, por el desnivel que presenta la propiedad.
No obstante lo señalado por este municipio, lo cierto es que en la última inspección realizada por el Ministerio de Salud se determinó que aunque no se logró constatar la contaminación por la descarga de aguas negras a los drenajes, ni materia fecal en el agua, ya que es un zanjo abierto muy extenso y que es utilizado para la evacuación de las aguas pluviales; existe un problema de planificación urbana en el sitio, ya que las viviendas están construidas a la orilla de una calle propiedad de Palma Tica, o sea en posesión de tierra ilegal, sin embargo no han sido desalojados y recomendó dar seguimiento al caso, por cuanto todavía al 21 de mayo de 2010, fecha posterior a la que la Municipalidad prometió realizar las diligencias necesarias de limpieza, en otra inspección de las autoridades de salud a la casa del amparado, se verificó:
Por tanto:
Se declara con lugar el recurso únicamente contra la Municipalidad de Parrita. En consecuencia, se ordena a Nelson Masís Campos, en su condición de Presidente del Concejo Municipal y a Gerardo Acuña Calderón, en su calidad de Alcalde, ambos de la Municipalidad de Parrita, o a quienes en su lugar ocupen esos cargos, que de INMEDIATO procedan a limpiar y asegurar el libre curso de las aguas pluviales de los canales y desagües que aquejan al recurrente. Lo anterior bajo apercibimiento de las consecuencias, incluso penales, que se desprenden por la desobediencia a las órdenes dictadas por este Tribunal Constitucional, artículo 71 de la Ley de la Jurisdicción Constitucional. En cuanto al Ministerio de Salud, se declara sin lugar el recurso. Se condena a la Municipalidad de Parrita al pago de costas, daños y perjuicios, los que se liquidarán en ejecución de sentencia de lo contencioso administrativo. Notifíquese esta sentencia a Nelson Masís Campos, en su condición de Presidente del Concejo Municipal y a Gerardo Acuña Calderón, en su calidad de Alcalde, ambos de la Municipalidad de Parrita, o a quienes en su lugar ocupen esos cargo, en forma personal. Comuníquese.-
