Petition for amparo (recurso de amparo) being processed under expediente número 10-003510-0007-CO, filed by ULYSSES CALDERON GONZALEZ against EL INSTITUTO COSTARRICENSE DE ACUEDUCTOS Y ALCANTARILLADOS, LA MUNICIPALIDAD DE NANDAYURE, LA SECRETARIA TECNICA NACIONAL AMBIENTAL, and LA CONTRALORIA GENERAL DE LA REPUBLICA.
Findings:
Drafted by Justice Guerrero Portilla; and,
Considering:
The petitioner claims that the Instituto Costarricense de Acueductos y Alcantarillados is using public funds to construct a rural water-supply system (acueducto rural) to provide drinking water to Hotel Punta Islita. He also claims that this water-supply system draws from a well drilled a short distance from the well operated by the ASADA de Corozalito to provide drinking water to that community, compounded by the fact that the project lacks environmental feasibility, that there are no technical studies establishing that its operation will not affect the water resource used by the community of Corozalito, and that no prior consultation was conducted with that ASADA. He considers articles 21, 27, 30 and 50 of the Constitución Política to have been violated.
The following facts are deemed duly established and relevant to the disposition of this matter, either because they have been proven or because the respondent failed to address them as directed in the initial order:
1. The community of Corozalito, located in the Distrito de Bejuco, Cantón de Nandayure, Provincia de Guanacaste, obtains its drinking water from a well drilled by the Instituto Costarricense de Acueductos y Alcantarillados in febrero de 1994, number 94-42, which is currently administered by the ASADA de Corozalito (see report at folio 338 and folio 485 of volume II); 2. Between enero and febrero del 2003, the Instituto Costarricense de Acueductos y Alcantarillados drilled a second well, number 03-03, located 102 meters from well number 94-42 (see report at folio 391 and folio 489 of volume II); 3. According to studies conducted between 16 and 20 de julio del 2003 by the Instituto Costarricense de Acueductos y Alcantarillados, it was determined that the locality of Islita, located in the Distrito de Bejuco, Cantón de Nandayure, Provincia de Guanacaste, has a water-supply problem because the area contains a rock slab that prevents wells from being drilled to a depth greater than 12 meters, the springs (nacientes) are very shallow, and they dry up during the dry season (see folios 230 through 233 of the copy of the administrative file entitled “Islita de Nandayure” of the Departamento de Desarrollo Social del Instituto Costarricense de Acueductos y Alcantarillados); 4.
According to Design Report code number 05-09-06 of the Instituto Costarricense de Acueductos y Alcantarillados, the construction of a rural water-supply system to provide drinking water to the residents of Islita was designed in octubre del 2003, and it would draw from the aforementioned well number 03-03 (see folios 241 through 247 of the copy of the administrative file entitled “Islita de Nandayure” of the Departamento de Desarrollo Social del Instituto Costarricense de Acueductos y Alcantarillados); 5. On 5 de octubre del 2009, the Convenio de Delegación y Administración del Acueducto y Alcantarillado Sanitario de Islita was entered into between the Instituto Costarricense de Acueductos y Alcantarillados and the Asociación Administradora del Acueducto y Alcantarillado Sanitario de Islita (see folio 11 of the copy of the administrative file entitled “Islita de Nandayure” of the Departamento de Desarrollo Social del Instituto Costarricense de Acueductos y Alcantarillados); 6.
On 2 de marzo del 2010, the Instituto Costarricense de Acueductos y Alcantarillados submitted Environmental Assessment Document D-2 to the Secretaría Técnica Nacional Ambiental for the Acueducto Rural de Islita de Nandayure project (see report at folio 459 of volume II and folio 42 of the copy of administrative file number D2-581-2010-SETENA); 7. Through resolution number RVLA-0546-2010-SETENA, of 5 de marzo del 2010, the Secretaría Técnica Nacional Ambiental granted environmental feasibility to the aforementioned project (see report at folio 459 of volume II and folio 47 of the copy of administrative file number D2-581-2010-SETENA); 8. On 12 de febrero del 2010, the ASADA de Corozalito submitted official letter number ASADA-COR-2010-01 to the Departamento de Acueductos Rurales de la Región Chorotega del Instituto Costarricense de Acueductos y Alcantarillados, raising several concerns regarding the construction of the Acueducto Rural de Islita de Nandayure and requesting that the work be suspended (see folio 296 of the copy of the administrative file entitled “Islita de Nandayure” of the Departamento de Desarrollo Social del Instituto Costarricense de Acueductos y Alcantarillados); 9. on 4 de marzo del 2010, officials of the Instituto Costarricense de Acueductos y Alcantarillados visited Corozalito to address the community’s questions (see report at folio 396 of volume II); 10. between 3 and 5 de mayo del 2010, the Instituto Costarricense de Acueductos y Alcantarillados conducted pumping tests in the aforementioned wells, with the participation of representatives of the ASADAS of Islita and Corozalito, and it was determined that there was no effect on the levels between the wells under the conditions in which the tests were conducted (see folios 462 to 497 of volume II).
The following facts relevant to the resolution of this petition for constitutional relief (amparo) are not deemed proven:
Sole.- That, prior to drilling well number 03-03 and commencing the construction and operation of the Acueducto Rural de Islita de Nandayure, the Instituto Costarricense de Acueductos y Alcantarillados submitted an application to register the source and flow rate with the Registro Nacional de Concesiones de Agua y Cauce of the Dirección de Aguas del Ministerio de Ambiente, Energía y Telecomunicaciones (see folio 357 of volume II).
It should first be noted that the fundamental rights to health and to a healthy and ecologically balanced environment are constitutionally recognized (Articles 21, 50, 73 and 89 of the Constitución Política), as well as through the international rules applicable in Costa Rica. In this regard, in judgment 2006-005928 at 15 hours on 2 de mayo del 2006, this Court held:
“(…) The right to life recognized in Article 21 of the Constitution is the cornerstone upon which the remaining fundamental rights of the inhabitants of the Republic rest. Likewise, the right to health is grounded in that provision of the political charter, since life is inconceivable unless human beings are guaranteed the minimum conditions necessary for an adequate and harmonious psychological, physical, and environmental balance. Public health and the right to a healthy and ecologically balanced environment are constitutionally recognized in Articles 21, 50, 73 and 89 of the Constitución Política. Specifically, Article 50 of the Constitution expressly recognizes the right of all inhabitants of the country to enjoy a healthy and perfectly balanced environment. That right is a fundamental guarantee for the protection of life and public health. In support of the foregoing, this Court has employed the concept of ‘environmental quality’ (‘calidad ambiental’) precisely as a measure of people’s quality of life, considered together with other elements such as health, food, work, and housing, recognizing that every person has the right to use the environment for their own development, but not without limitation, since there is also a duty to protect and preserve the environment for present and future generations—the principle of sustainable development (principio de desarrollo sostenible).” Furthermore, Article 50 of the Constitución Política establishes the State’s obligation to protect the environment. That provision states:
“The State shall seek the greatest welfare of all inhabitants of the country by organizing and encouraging production and the most appropriate distribution of wealth.
Every person has the right to a healthy and ecologically balanced environment. Accordingly, every person has standing to report acts that infringe that right and to claim compensation for the harm caused.
The State shall guarantee, defend, and preserve that right. The law shall determine the corresponding liabilities and penalties.” This confirms that the various public authorities have an inescapable duty to preserve, defend, and guarantee every person’s fundamental right to health and to a healthy and ecologically balanced environment.
This Constitutional Court has also recognized in its case law that the rights to life and health are fundamental rights whose enjoyment requires access to drinking water. For human beings to enjoy health, they must be guaranteed a set of minimum conditions necessary to attain an adequate and harmonious psychological, physical, and environmental balance, as well as to prevent the emergence of dysfunctions that impair their full growth and development. One of those conditions is precisely the supply of water fit for human consumption. This Chamber has therefore concluded that, as part of Constitutional Law, there is a fundamental right to the supply of drinking water. Thus, in judgment number 2003-04654 at 15:44 hrs. on 27 de mayo del 2003, this Chamber held:
“(…) The Chamber recognizes, as part of Constitutional Law, a fundamental right to drinking water, derived from the fundamental rights to health, life, a healthy environment, food, and adequate housing, among others, as has also been recognized in international human-rights instruments applicable in Costa Rica: it appears explicitly in the Convention on the Elimination of All Forms of Discrimination against Women (Art. 14) and the Convention on the Rights of the Child (Art. 24); it is also stated in the International Conference on Population and Development in Cairo (Principle 2), and declared in numerous other instruments of International Humanitarian Law. Within our Inter-American Human Rights System, the country is particularly bound in this area by Article 11.1 of the Additional Protocol to the American Convention on Human Rights in the Area of Economic, Social and Cultural Rights (‘Protocol of San Salvador’ of 1988), which provides:
‘Article 11. Right to a healthy environment 1. Everyone shall have the right to live in a healthy environment and to have access to basic public services.’ Moreover, the UN Committee on Economic, Social and Cultural Rights recently reiterated that access to water is a human right which, in addition to being indispensable for living a healthy life, is a prerequisite for the realization of all other human rights.
VI.The foregoing regulatory framework gives rise to a series of fundamental rights linked to the State’s obligation to provide basic public services. These rights imply, on the one hand, that persons may not be unlawfully deprived of such services; however, in the case of drinking water, it cannot be maintained that any individual holds an enforceable right requiring the State to provide drinking-water service immediately and wherever that person may be. Rather, as provided in the Protocol of San Salvador itself, rights of this kind require States to adopt measures, as stipulated in Article 1 of that Protocol:
‘The States Parties to this Additional Protocol to the American Convention on Human Rights undertake to adopt the necessary measures, both domestically and through cooperation among the States, especially economic and technical cooperation, to the extent allowed by their available resources and taking into account their degree of development, for the purpose of achieving progressively and in accordance with domestic legislation the full observance of the rights recognized in this Protocol…’” Consistent with the foregoing, Article 264 of the Ley General de Salud clearly provides: “Water is a public-utility resource (bien de utilidad pública), and its use for human consumption shall take priority over any other use.” Article 266 further provides: “The country’s water-supply systems shall meet the structural and operational requirements established by the standards and technical specifications issued by the Executive Branch in consultation with the Servicio Nacional de Acueductos y Alcantarillado.” Finally, Article 267 provides: “Every water-supply system intended for the population’s use and consumption shall provide drinking water continuously, in sufficient quantity to meet people’s needs, and with the pressure necessary to permit the proper operation of the sanitary fixtures in use.” Furthermore, pursuant to Article 1 of the Ley Constitutiva del Instituto Costarricense de Acueductos y Alcantarillados, that autonomous institution was created for the express purpose of directing, setting policies, establishing and applying standards, carrying out and promoting planning, financing, and development, and resolving all matters related to the supply of drinking water.
To fulfill that purpose, and pursuant to Article 2 of the same body of law, the Instituto Costarricense de Acueductos y Alcantarillados is responsible for directing and overseeing everything necessary to provide the inhabitants of the Republic with drinking-water service, as well as for developing, using, managing, or overseeing, as applicable, all public-domain waters indispensable for duly complying with the provisions of the aforementioned law. This establishes that the Instituto Costarricense de Acueductos y Alcantarillados is the institution primarily responsible for ensuring that all inhabitants of the Republic may benefit from a drinking-water supply system capable of providing that water continuously and in sufficient quantity to adequately meet everyone’s basic needs, thereby effectively safeguarding their fundamental rights to life and health.
THE NEED TO PROVIDE POTABLE WATER TO THE COMMUNITY OF ISLITA AND THE AVAILABILITY OF THE WATER RESOURCE. It may be inferred from the foregoing statement of proven facts that, according to studies conducted between 16 and 20 July 2003 by the Instituto Costarricense de Acueductos y Alcantarillados, the locality of Islita had a serious potable-water supply problem because a rock slab in the area prevents wells from being drilled to a depth greater than 12 meters, the springs (nacientes) are very shallow, and they are prone to substantial reductions in water during the dry season. This created a serious risk to the health of local residents due to the lack of an adequate potable-water supply. It was therefore concluded that construction of a rural aqueduct (acueducto rural) was necessary to supply potable water to the inhabitants of that locality. It was also concluded that drilling a well in the community of Islita itself for those purposes was not feasible because of the aforementioned hydrogeological conditions.
Accordingly, it was ultimately determined that the aqueduct should be supplied by a well that the Instituto Costarricense de Acueductos y Alcantarillados had drilled in the community of Corozalito between January and February 2003. This establishes, first, that contrary to the appellant’s assertion, the purpose of developing the aforementioned aqueduct was not specifically to benefit Hotel Punta Islita; rather, it was intended to guarantee the inhabitants of the community of Islita access to potable water, thereby safeguarding their rights to life and health. Furthermore, the evidence submitted in the proceedings shows that, through resolution number RVLA-0546-2010-SETENA, dated 5 March 2010, the Secretaría Técnica Nacional Ambiental granted environmental approval (viabilidad ambiental) to the aqueduct project after confirming that the requirements established by the applicable regulations had been met.
Moreover, both the Instituto Costarricense de Acueductos y Alcantarillados and the Secretaría Técnica Nacional Ambiental agree that this is a project with a very low environmental impact, given the scale of the works required to construct the aqueduct. Finally, between 3 and 5 May 2010, the Instituto Costarricense de Acueductos y Alcantarillados conducted pumping tests on the aforementioned wells, which are managed by the ASADAS of Islita and Corozalito, and determined that there was no effect on water levels between the wells. Indeed, the report submitted by the Deputy General Manager of the Instituto Costarricense de Acueductos y Alcantarillados—which was rendered under oath, with due warning of the consequences, including criminal consequences, established in Article 44 of the Ley de la Jurisdicción Constitucional—states that the various pumping tests and technical studies conducted by the institution made it possible to determine that both wells have sufficient flow rate (caudal) or water potential to supply potable water to both communities.
This refutes the substantive ground of this amparo proceeding (recurso de amparo), concerning the appellant’s concern about the possible harm that the community of Corozalito might suffer from the exploitation of the aforementioned well by the ASADA of Islita. Accordingly, this Chamber finds no violation of constitutional law arising from the construction of the aforementioned rural aqueduct, in view of the following relevant factors, which have been duly established in the case under consideration: a) construction of the aforementioned aqueduct is intended to satisfy a real and urgent need to supply potable water to the inhabitants of the community of Islita; b) construction of the aqueduct constitutes a project with a very low environmental impact and has the corresponding environmental approval granted by the Secretaría Técnica Nacional Ambiental; and c) according to the technical studies conducted in situ by the Instituto Costarricense de Acueductos y Alcantarillados, there is no interference between the wells operated by the ASADAS of Corozalito and Islita, and both wells have sufficient water capacity to adequately meet the needs of both communities. The alleged violation of Articles 21 and 50 of the Constitution is therefore not established.
VI.Added to the foregoing is the reported fact that officials of the Instituto Costarricense de Acueductos y Alcantarillados have visited the community of Corozalito to address questions from the community and from the ASADA of Corozalito itself concerning construction of the Islita rural aqueduct. Moreover, between 3 and 5 May 2010, pumping tests were conducted on the wells managed by the ASADAS of Islita and Corozalito, in the presence of representatives of both associations, to determine technically whether the wells affected one another’s water levels. This establishes that the ASADA of Corozalito has indeed been afforded participation in matters relating to the construction and commissioning of the Islita rural aqueduct. Therefore, no grounds are found on this issue either for granting the amparo under consideration.
VII.Finally, if it is considered that the Convenio de Delegación y Administración del Acueducto y Alcantarillado Sanitario de Islita entered into between the Instituto Costarricense de Acueductos y Alcantarillados and the Asociación Administradora del Acueducto y Alcantarillado Sanitario de Islita contains any defect due to a violation of the statutory or regulatory provisions governing the matter, that claim may be raised in the appropriate administrative forum or ordinary court, since it constitutes an ordinary legality dispute (conflicto de legalidad ordinaria) properly resolved in those forums.
FAILURE TO PROCESS THE APPLICATION TO REGISTER THE SOURCE AND FLOW RATE IN THE REGISTRO NACIONAL DE CONCESIONES DE AGUA Y CAUCE OF THE DIRECCIÓN DE AGUAS DEL MINISTERIO DE AMBIENTE, ENERGÍA Y TELECOMUNICACIONES. Notwithstanding the foregoing, this Chamber cannot disregard the fact that the Director of the Dirección de Aguas del Ministerio de Ambiente, Energía y Telecomunicaciones informed this Court that, before well number 03-03 was drilled and construction and operation of the Acueducto Rural de Islita de Nandayure began, the Instituto Costarricense de Acueductos y Alcantarillados did not submit an application to register the source and flow rate in the Registro Nacional de Concesiones de Agua y Cauce maintained by that Dirección de Aguas. This omission is constitutionally significant because the purpose of that registry, in which the sources and flow rates to be used to supply potable water to the population must be registered, is to maintain an up-to-date hydrological record that makes it possible to coordinate and guarantee the rational use of the water resource. It may therefore be concluded that this omission, attributable to the Instituto Costarricense de Acueductos y Alcantarillados, does constitute a violation of Articles 21 and 50 of the Constitution. This warrants granting the proceeding under consideration with respect to this particular issue.
As a consequence of the foregoing, the amparo under consideration must be partially granted, solely against the Instituto Costarricense de Acueductos y Alcantarillados, because of its failure to process an application to register the source and flow rate in the Registro Nacional de Concesiones de Agua y Cauce of the Dirección de Aguas del Ministerio de Ambiente, Energía y Telecomunicaciones before well number 03-03 was drilled and construction and operation of the Acueducto Rural de Islita de Nandayure began. In all other respects, the amparo under consideration must be denied, as hereby ordered.
Por tanto:
The proceeding is declared partially GRANTED against the Instituto Costarricense de Acueductos y Alcantarillados. Eduardo Lezama Fernández, or whoever holds the position of Deputy General Manager of the Instituto Costarricense de Acueductos y Alcantarillados in his stead, is ordered to immediately adopt the necessary measures, within his respective sphere of authority, to ensure that the source, flow rate, and other information pertaining to the well operated by the Asociación Administradora del Acueducto y Alcantarillado Sanitario de Islita are duly registered in the Registro Nacional de Concesiones de Agua y Cauce of the Dirección de Aguas del Ministerio de Ambiente, Energía y Telecomunicaciones. Eduardo Lezama Fernández, or whoever holds the position of Deputy General Manager of the Instituto Costarricense de Acueductos y Alcantarillados in his stead, is warned that failure to comply with this order will constitute the offense of disobedience and that, pursuant to Article 71 of the Ley de esta jurisdicción, anyone who receives an order issued in an amparo proceeding that must be complied with or enforced and who fails to comply with or enforce it shall be sentenced to imprisonment for three months to two years, or a fine of twenty to sixty days, provided that the offense is not subject to a more severe penalty.
The Instituto Costarricense de Acueductos y Alcantarillados is ordered to pay the costs and damages caused by the events underlying this ruling, which shall be assessed during enforcement of the judgment before the administrative-law court. In all other respects, the amparo is denied. This decision shall be personally served upon Eduardo Lezama Fernández, or whoever holds the position of Deputy General Manager of the Instituto Costarricense de Acueductos y Alcantarillados in his stead.

Recurso de amparo que se tramita en expediente número 10-003510-0007-CO, interpuesto por ULYSSES CALDERON GONZALEZ, contra EL INSTITUTO COSTARRICENSE DE ACUEDUCTOS Y ALCANTARILLADOS, LA MUNICIPALIDAD DE NANDAYURE, LA SECRETARIA TECNICA NACIONAL AMBIENTAL y LA CONTRALORIA GENERAL DE LA REPUBLICA.
Resultando:
Redacta el Magistrado Guerrero Portilla; y,
Considerando:
El recurrente reclama que el Instituto Costarricense de Acueductos y Alcantarillados está utilizando fondos públicos para construir un acueducto rural para suministrar de agua potable al Hotel Punta Islita. También reclama que dicho acueducto se abastece de un pozo que se perforó a escasa distancia del pozo que explota la ASADA de Corozalito para suministrar de agua potable a dicha comunidad, con el agravante que tal proyecto no cuenta con viabilidad ambiental, no existen estudios técnicos que determinen que su funcionamiento no afectará el recurso hídrico que aprovecha la comunidad de Corozalito y no se realizó previa consulta a la mencionada ASADA. Estima infringidos los artículos 21, 27, 30 y 50 de la Constitución Política.
De importancia para la decisión de este asunto, se estiman como debidamente demostrados los siguientes hechos, sea porque así han sido acreditados o bien porque el recurrido haya omitido referirse a ello según lo prevenido en el auto inicial:
1. la comunidad de Corozalito, ubicada en el Distrito de Bejuco, Cantón de Nandayure, Provincia de Guanacaste, se abastece de agua potable por medio de un pozo que fue perforado por el Instituto Costarricense de Acueductos y Alcantarillados en febrero de 1994, número 94-42, y que actualmente es administrado por la ASADA de Corozalito (ver informe a folio 338 y folio 485 del tomo II); 2. entre enero y febrero del 2003, el Instituto Costarricense de Acueductos y Alcantarillados perforó un segundo pozo, número 03-03, ubicado a una distancia de 102 metros del pozo número 94-42 (ver informe a folio 391 y folio 489 del tomo II); 3. según estudios realizados entre el 16 al 20 de julio del 2003, por el Instituto Costarricense de Acueductos y Alcantarillados, se determinó que en la localidad de Islita, ubicada en el Distrito de Bejuco, en el Cantón de Nandayure, Provincia de Guanacaste, existe un problema de abastecimiento de agua, ya que en la zona existe una loza rocosa que impide perforar pozos con una profundidad mayor a los 12 metros, las nacientes son muy superficiales y éstas se secan en época seca (ver de folio 230 a 233 de la copia del expediente administrativo titulado “Islita de Nandayure” del Departamento de Desarrollo Social del Instituto Costarricense de Acueductos y Alcantarillados); 4. según Informe de Diseño código número 05-09-06, del Instituto Costarricense de Acueductos y Alcantarillados, en octubre del 2003 se diseñó la construcción de un acueducto rural para suministrar agua potable a los habitantes de la localidad de Islita, que se abastecería del citado pozo número 03-03 (ver de folio 241 a 247 de la copia del expediente administrativo titulado “Islita de Nandayure” del Departamento de Desarrollo Social del Instituto Costarricense de Acueductos y Alcantarillados); 5. el 5 de octubre del 2009 se suscribió el Convenio de Delegación y Administración del Acueducto y Alcantarillado Sanitario de Islita, entre el Instituto Costarricense de Acueductos y Alcantarillados y la Asociación Administradora del Acueducto y Alcantarillado Sanitario de Islita (ver folio 11 de la copia del expediente administrativo titulado “Islita de Nandayure” del Departamento de Desarrollo Social del Instituto Costarricense de Acueductos y Alcantarillados); 6. el 2 de marzo del 2010, el Instituto Costarricense de Acueductos y Alcantarillados presentó Documento de Evaluación Ambiental D-2 ante la Secretaría Técnica Nacional Ambiental, correspondiente al proyecto de Acueducto Rural de Islita de Nandayure (ver informe a folio 459 del tomo II y folio 42 de la copia del expediente administrativo número D2-581-2010-SETENA); 7. por medio de resolución número RVLA-0546-2010-SETENA, del 5 de marzo del 2010, la Secretaría Técnica Nacional Ambiental otorgó viabilidad ambiental al referido proyecto (ver informe a folio 459 del tomo II y folio 47 de la copia del expediente administrativo número D2-581-2010-SETENA); 8. el 12 de febrero del 2010 la ASADA de Corozalito presentó oficio número ASADA-COR-2010-01, ante el Departamento de Acueductos Rurales de la Región Chorotega del Instituto Costarricense de Acueductos y Alcantarillados, en la que planteó una serie de inquietudes respecto de la construcción del Acueducto Rural de Islita de Nandayure y solicitó se suspendieran los trabajos (ver folio 296 de la copia del expediente administrativo titulado “Islita de Nandayure” del Departamento de Desarrollo Social del Instituto Costarricense de Acueductos y Alcantarillados); 9. el 4 de marzo del 2010, funcionarios del Instituto Costarricense de Acueductos y Alcantarillados visitaron Corozalito para atender las consultas de la comunidad (ver informe a folio 396 del tomo II); 10. entre el 3 y el 5 de mayo del 2010, el Instituto Costarricense de Acueductos y Alcantarillados realizó pruebas de bombeo en los citados pozos, con la participación de representantes de las ASADAS de Islita y Corozalito, y se determinó que no existe afectación de niveles entre los pozos en las condiciones en que se efectuaron las pruebas (ver de folio 462 a 497 del tomo II).
No se estiman demostrados los siguientes hechos de relevancia para la resolución de este amparo:
Unico.- Que, de previo a realizarse la perforación del pozo número 03-03 y de iniciarse la construcción y puesta en funcionamiento del Acueducto Rural de Islita de Nandayure, el Instituto Costarricense de Acueductos y Alcantarillados haya gestionado solicitud de inscripción de fuente y caudal en el Registro Nacional de Concesiones de Agua y Cauce de la Dirección de Aguas del Ministerio de Ambiente, Energía y Telecomunicaciones (ver folio 357 del tomo II).
Debe indicarse, en primer lugar, que los derechos fundamentales a la salud y a un ambiente sano y ecológicamente equilibrado se encuentran reconocidos constitucionalmente (artículos 21, 50, 73 y 89 de la Constitución Política), así como a través de la normativa internacional aplicable en Costa Rica. En este sentido, en sentencia 2006-005928 de las 15 horas del 2 de mayo del 2006, este Tribunal resolvió:
“(…) El derecho a la vida reconocido en el numeral 21 de la Constitución es la piedra angular sobre la cual descansan el resto de los derechos fundamentales de los habitantes de la república. De igual forma, en ese ordinal de la carta política encuentra asidero el derecho a la salud, puesto que, la vida resulta inconcebible si no se le garantizan a la persona humana condiciones mínimas para un adecuado y armónico equilibrio psíquico, físico y ambiental. Ahora bien, la salud pública y el derecho a un ambiente sano y ecológicamente equilibrado se encuentran reconocidos constitucionalmente en los artículos 21, 50, 73 y 89 de la Constitución Política. Específicamente, el artículo 50 constitucional reconoce de forma expresa el derecho de todos los habitantes del país a disfrutar de un medio ambiente saludable y en perfecto equilibrio. Ese derecho es garantía fundamental para la protección de la vida y la salud pública.
En apoyo de lo anterior este Tribunal ha recurrido a la utilización de la noción de “calidad ambiental” como un parámetro, precisamente, de la calidad de vida de las personas, que se conjuga con otros elementos tales como la salud, la alimentación, el trabajo y la vivienda, haciendo referencia a que toda persona tiene derecho a hacer uso del ambiente para su propio desarrollo pero no de manera ilimitada, ya que, también, existe un deber de protección y preservación del medio ambiente para las generaciones presentes y futuras –principio de desarrollo sostenible–.” Asimismo, del artículo 50 de la Constitución Política se deriva la obligación del Estado de proteger el ambiente. Norma que establece al efecto:
"El Estado procurará el mayor bienestar a todos los habitantes del país, organizando y estimulando la producción y el más adecuado reparto de la riqueza.
Toda persona tiene derecho a un ambiente sano y ecológicamente equilibrado. Por ello está legitimada para denunciar los actos que infrinjan ese derecho y para reclamar la reparación del daño causado.
El Estado garantizará, defenderá y preservará ese derecho. La ley determinará las responsabilidades y las sanciones correspondientes" Con lo que se corrobora que las distintas autoridades públicas tienen el deber ineludible de preservar, defender y garantizar el derecho fundamental de toda persona a la salud y a un ambiente sano y ecológicamente equilibrado.
Este Tribunal Constitucional también ha reconocido en su jurisprudencia que el derecho a la vida y a la salud son derechos fundamentales cuyo goce exige el acceso al agua potable. Para que el ser humano disfrute de salud requiere que se le garanticen un conjunto de condiciones mínimas necesarias para alcanzar un adecuado y armónico equilibrio psíquico, físico y ambiental, así como para impedir el surgimiento de disfunciones que alteren su pleno crecimiento y desarrollo. Una de esas condiciones es precisamente el suministro de agua apta para el consumo humano. Por lo que esta Sala ha concluido que, como parte del Derecho de la Constitución, existe un derecho fundamental al suministro de agua potable. Así, en sentencia número 2003-04654 de las 15:44 hrs. del 27 de mayo del 2003, esta Sala resolvió:
“(…) La Sala reconoce, como parte del Derecho de la Constitución, un derecho fundamental al agua potable, derivado de los derechos fundamentales a la salud, la vida, al medio ambiente sano, a la alimentación y la vivienda digna, entre otros, tal como ha sido reconocido también en instrumentos internacionales sobre Derechos Humanos aplicables en Costa Rica: así, figura discriminación contra la mujer (art. 14) y la Convención sobre los Derechos del Niño (art. 24); además, se enuncia en la Conferencia Internacional sobre Población y el Desarrollo de El Cairo (principio 2), y se declara en otros numerosos del Derecho Internacional Humanitario. En nuestro Sistema Interamericano de Derechos Humanos, el país se encuentra particularmente obligado en esta materia por lo dispuesto en el artículo 11.1 del Protocolo Adicional a la Convención Americana sobre Derechos Humanos en Materia de Derechos Económicos, Sociales y Culturales ("Protocolo de San Salvador" de 1988), el cual dispone que:
‘Artículo 11. Derecho a un medio ambiente sano 1. Toda persona tiene derecho a vivir en un medio ambiente sano y a contar con servicios públicos básicos’.
Además, recientemente, el Comité de Derechos Económicos, Culturales y Sociales de la ONU reiteró que disponer de agua es un derecho humano que, además de ser imprescindible para llevar una vida saludable, es un requisito para la realización de todos los demás derechos humanos.
VI.Del anterior marco normativo se deriva una serie de derechos fundamentales ligados a la obligación del Estado de brindar los servicios públicos básicos, que implican, por una parte, que no puede privarse ilegítimamente de ellos a las personas, pero que, como en el caso del agua potable, no puede sostenerse la titularidad de un derecho exigible por cualquier individuo para que el Estado le suministre el servicio público de agua potable, en forma inmediata y dondequiera que sea, sino que, en la forma prevista en el mismo Protocolo de San Salvador, esta clase de derechos obligan a los Estados a adoptar medidas, conforme lo dispone el artículo primero del mismo Protocolo:
‘Los Estados Partes en el presente Protocolo Adicional a la Convención Americana sobre Derechos Humanos se comprometen a adoptar las medidas necesarias tanto de orden interno como mediante la cooperación entre los Estados, especialmente económica y técnica, hasta el máximo de los recursos disponibles y tomando en cuenta su grado de desarrollo, a fin de lograr progresivamente, y de conformidad con la legislación interna, la plena efectividad de los derechos que se reconocen en el presente Protocolo…”.
En consonancia con lo anterior, el artículo 264 de la Ley General de Salud dispone claramente: “El agua constituye un bien de utilidad pública y su utilización para el consumo humano tendrá prioridad sobre cualquier otro uso”. Mientras que en el artículo 266 se agrega: "Los abastecimientos de agua del país deberán llenar los requisitos de estructura y funcionamiento fijados por las normas y especificaciones técnicas que el Poder Ejecutivo dicte, en consulta con el Servicio Nacional de Acueductos y Alcantarillado". Finalmente, en el artículo 267 se establece: “Todo sistema de abastecimiento de agua, destinada al uso y consumo de la población, deberá suministrar agua potable, en forma continua, en cantidad suficiente o para satisfacer las necesidades de las personas y con presión necesaria para permitir el correcto funcionamiento de los artefactos sanitarios en uso”. Además, conforme a lo dispuesto en el artículo 1 de la Ley Constitutiva del Instituto Costarricense de Acueductos y Alcantarillados, se ha creado dicha institución autónoma con el expreso objeto de dirigir, fijar políticas, establecer y aplicar normas, realizar y promover el planeamiento, financiamiento y desarrollo y de resolver todo lo relacionado con el suministro de agua potable.
Para cumplir tal objeto, y de conformidad a lo previsto en el artículo 2 de ese mismo cuerpo normativo, al Instituto Costarricense de Acueductos y Alcantarillados le corresponde dirigir y vigilar todo lo concerniente para proveer a los habitantes de la República de un servicio de agua potable, así como aprovechar, utilizar, gobernar o vigilar, según sea el caso, todas las aguas de dominio público indispensables para el debido cumplimiento de las disposiciones de la citada ley. Con lo que se verifica que el Instituto Costarricense de Acueductos y Alcantarillados es el primer llamado en procurar porque todos los habitantes de la República puedan beneficiarse de un sistema de abastecimiento de agua potable, capaz de suministrar dicho líquido de forma continua y en cantidad suficiente para satisfacer debidamente las necesidades básicas de todas las personas, en resguardo efectivo de sus derechos fundamentales a la vida y a la salud.
SOBRE LA NECESIDAD DE DOTAR DE AGUA POTABLE A LA COMUNIDAD DE ISLITA Y SOBRE LA DISPONIBILIDAD DEL RECURSO HIDRICO. De la anterior relación de hechos probados se pueden desprender que, según estudios realizados entre el 16 al 20 de julio del 2003, por el Instituto Costarricense de Acueductos y Alcantarillados, se determinó que en la localidad de Islita existía un grave problema de abastecimiento de agua potable, ya que en la zona existe una loza rocosa que impide perforar pozos con una profundidad mayor a los 12 metros, las nacientes son muy superficiales y están propensas a disminuciones sustanciales de agua en época seca. Lo que generaba un grave riesgo para la salud de los pobladores del lugar ante la falta de un adecuado suministro de agua potable. Por lo que se concluyó que era necesaria la construcción de un acueducto rural para abastecer de agua potable a los habitantes de esa localidad.
También se concluyó que no era factible que, para tales efectos, se perforara un pozo en la propia comunidad de Islita, por las condiciones hidrogeológicas ya indicadas. De allí que, finalmente, se determinara que el citado acueducto debía abastecerse de un pozo que había sido perforado por el propio Instituto Costarricense de Acueductos y Alcantarillados en la comunidad de Corozalito, entre enero y febrero del 2003. Con lo que se verifica, en primer lugar, que distinto a lo que alega el recurrente, el desarrollo del mencionado acueducto no ha tenido por propósito beneficiar específicamente al Hotel Punta Islita, sino que, por el contrario, ha tenido por fin garantizar a los habitantes de la comunidad de Islita el acceso al agua potable en resguardo de sus derechos a la vida y a la salud. Por otra parte, de la prueba aportada a los autos se desprende que, por medio de resolución número RVLA-0546-2010-SETENA, del 5 de marzo del 2010, la Secretaría Técnica Nacional Ambiental otorgó viabilidad ambiental al referido proyecto de acueducto, al corroborarse que se cumplían los requisitos previstos por la normativa aplicable.
Además, tanto el Instituto Costarricense de Acueductos y Alcantarillados como la Secretaría Técnica Nacional Ambiental coinciden en que se está en presencia de un proyecto de muy bajo impacto ambiental, en atención al tamaño de las obras que exige la construcción del referido acueducto. Finalmente, entre el 3 y el 5 de mayo del 2010, el Instituto Costarricense de Acueductos y Alcantarillados realizó pruebas de bombeo en los citados pozos, administrados por las ASADAS de Islita y Corozalito, y se determinó que no existía afectación de niveles entre los pozos. De hecho, en el informe rendido por el Subgerente General del Instituto Costarricense de Acueductos y Alcantarillados –que ha sido rendido bajo la solemnidad del juramento, con oportuno apercibimiento de las consecuencias, incluso penales, previstas en el artículo 44 de la Ley de la Jurisdicción Constitucional-, se indica que las distintas pruebas de bombeo y estudios técnicos realizados por la institución han permitido determinar que ambos pozos tienen caudal o potencial hídrico suficiente para suministrar de agua potable a ambas comunidades.
Con lo que se desvirtúa el motivo de fondo del presente recurso de amparo, referente a la preocupación del recurrente ante la posible afectación que podía sufrir la comunidad de Corozalito con la explotación del citado pozo por la ASADA de Islita. Así las cosas, esta Sala no constata una infracción al Derecho de la Constitución por la construcción del referido acueducto rural, en razón de los siguientes elementos de relevancia que se han tenido por debidamente acreditados en el caso en estudio: a) la construcción del citado acueducto tiene por objeto o fin satisfacer una necesidad real y urgente de suministro de agua potable a favor de los habitantes de la comunidad de Islita; b) la construcción del referido acueducto supone una obra de muy bajo impacto ambiental y cuenta, al efecto, con la respectiva viabilidad ambiental otorgada por la Secretaría Técnica Nacional Ambiental; y c) según los estudios técnicos realizados in situ por el Instituto Costarricense de Acueductos y Alcantarillados, no existe interferencia entre los pozos explotados por las ASADAS de Corozalito e Islita, y ambos pozos cuentan con suficiente capacidad hídrica como para satisfacer adecuadamente las necesidades de ambas comunidades. Por lo que no se constata la acusada infracción a los artículos 21 y 50 constitucionales.
VI.Agréguese a lo anterior, que según se informa, funcionarios del Instituto Costarricense de Acueductos y Alcantarillados se han presentado en la comunidad de Corozalito para atender las consultas de la comunidad y de la propia ASADA de Corozalito, en cuanto el tema de la construcción del acueducto rural de Islita. Además, entre el 3 y el 5 de mayo del 2010 se realizaron pruebas de bombeo en los pozos administrados por las ASADAS de Islita y Corozalito, con presencia de representantes de ambas asociaciones, a fin de establecer técnicamente si existía afectación de niveles entre los pozos. Con lo que se verifica que sí se le ha otorgado participación a la ASADA de Corozalito en lo referente a la construcción y puesta en funcionamiento del acueducto rural de Islita. Por lo que tampoco se estima que, respecto a este extremo, exista motivo para estimar el amparo en estudio.
VII.Finalmente, si se considera que existe algún vicio en el Convenio de Delegación y Administración del Acueducto y Alcantarillado Sanitario de Islita suscrito entre el Instituto Costarricense de Acueductos y Alcantarillados y la Asociación Administradora del Acueducto y Alcantarillado Sanitario de Islita, por infracción de la normativa legal o reglamentaria que rige la materia, así se podrá alegar en la propia sede administrativa o en la jurisdicción ordinaria correspondiente, por constituir ello un conflicto de legalidad ordinaria propio de dilucidarse en tales instancias.
SOBRE LA OMISION DE TRAMITAR SOLICITUD DE INSCRIPCION DE FUENTE Y CAUDAL EN EL REGISTRO NACIONAL DE CONCESIONES DE AGUA Y CAUCE DE LA DIRECCION DE AGUAS DEL MINISTERIO DE AMBIENTE, ENERGIA Y TELECOMUNICACIONES. No obstante lo anterior, no puede obviar esta Sala que el Director de la Dirección de Aguas del Ministerio de Ambiente, Energía y Telecomunicaciones le informa a este Tribunal que, de previo a realizarse la perforación del pozo número 03-03 y de iniciarse la construcción y puesta en funcionamiento del Acueducto Rural de Islita de Nandayure, el Instituto Costarricense de Acueductos y Alcantarillados no planteó solicitud de inscripción de fuente y caudal en el Registro Nacional de Concesiones de Agua y Cauce de dicha Dirección de Aguas. Omisión que adquiere relevancia constitucional, por cuanto la existencia de tal registro, en que se han de inscribir las fuentes y caudales que se aprovecharán para el abastecimiento de agua potable a la población, tiene por propósito contar con un registro hidrológico actualizado que permita coordinar y garantizar un uso racional del recurso hídrico. Por lo que se puede concluir que tal omisión, imputable al Instituto Costarricense de Acueductos y Alcantarillados, sí supone una infracción a los artículos 21 y 50 constitucionales. Lo que motiva que se acoja el recurso en estudio en cuanto a este extremo en particular.
Como corolario de lo anterior, procede acoger parcialmente el amparo en estudio, únicamente en contra del Instituto Costarricense de Acueductos y Alcantarillados, en razón de su omisión de tramitar solicitud de inscripción de fuente y caudal en el Registro Nacional de Concesiones de Agua y Cauce de la Dirección de Aguas del Ministerio de Ambiente, Energía y Telecomunicaciones, de previo a realizarse la perforación del pozo número 03-03 y de iniciarse la construcción y puesta en funcionamiento del Acueducto Rural de Islita de Nandayure. En lo demás procede desestimar el amparo en estudio, como así se dispone.
Por tanto:
Se declara parcialmente CON LUGAR el recurso, contra el Instituto Costarricense de Acueductos y Alcantarillados. Se ordena a Eduardo Lezama Fernández, o a quien ocupe en su lugar el cargo de Subgerente General del Instituto Costarricense de Acueductos y Alcantarillados, que de forma inmediata adopte las medidas necesarias, dentro de su respectivo ámbito de competencia, para que se proceda a inscribir debidamente la fuente, caudal y demás datos correspondientes el pozo operado por la Asociación Administradora del Acueducto y Alcantarillado Sanitario de Islita, en el Registro Nacional de Concesiones de Agua y Cauce de la Dirección de Aguas del Ministerio de Ambiente, Energía y Telecomunicaciones. Se le advierte a Eduardo Lezama Fernández, o a quien ocupe en su lugar el cargo de Subgerente General del Instituto Costarricense de Acueductos y Alcantarillados, que de no acatar la orden dicha, incurrirá en el delito de desobediencia y, que de conformidad con el artículo 71 de la Ley de esta jurisdicción, se le impondrá prisión de tres meses a dos años, o de veinte a sesenta días multa, a quien recibiere una orden que deba cumplir o hacer cumplir, dictada en un recurso de amparo y no la cumpliere o no la hiciere cumplir, siempre que el delito no esté más gravemente penado.
Se condena al Instituto Costarricense de Acueductos y Alcantarillados al pago de las costas, daños y perjuicios causados con los hechos que sirven de base a esta declaratoria, los que se liquidarán en ejecución de sentencia de lo contencioso administrativo. En cuanto a lo demás, se declara sin lugar el amparo. Notifíquese la presente resolución a Eduardo Lezama Fernández, o a quien ocupe en su lugar el cargo de Subgerente General del Instituto Costarricense de Acueductos y Alcantarillados, en forma personal.
