Considerations:
a. On veintidós de octubre del dos mil siete, the Liberia Health Governing Area received a complaint from residents of the Chorotega Housing Development due to the overflow of the Liberia River (folios 24 y 79); b. On seis de noviembre de dos mil siete, the Ministry of Health served health order 154-2007 on the Mayor of the Municipality of Liberia, ordering that, within treinta días hábiles, a plan be submitted for construction of the works that would prevent the Liberia River from overflowing into that housing development (folio 24); c. On veintiséis de marzo del dos mil ocho, the Liberia Health Governing Area received official letter DPM-INF-0129-2008 from the Head of the Risk Prevention and Emergency Response Department, stating that there was a high degree of vulnerability due to overflow of the Liberia River (folio 25); d. On dieciocho de abril del dos mil ocho, decision DM-J-1709-08 of veintisiete de marzo del dos mil ocho was received concerning the appeal filed by the Mayor of Liberia; that decision denied the appeal and affirmed the challenged health order.
(folios 25 y 52); e. On dos de mayo del dos mil ocho, the Liberia Health Governing Area filed complaint 013-2008 with the Public Prosecutor’s Office regarding the possible offense of disobeying authority (folios 25 y 46); f. On veintitrés de febrero del dos mil diez, the residents of Urbanización Chorotega requested that the Mayor and the President of the Municipal Council of the Municipalidad de Liberia complete the work on the dike (dique) and culvert (alcantarilla) to prevent erosion and flooding in the area (folio 3); g. On veintitrés de agosto del dos mil diez, the residents of Urbanización Chorotega requested that the Mayor of the Municipalidad and the Municipal Engineer of Liberia intervene to complete the work on the dike and culvert, in light of the flooding they had experienced (folio 4).
h. According to report RCH-IR-616-2010 of seis de setiembre del dos mil diez, the Ministerio de Salud stated that an inspection had been conducted at the site and that a fissure extending the full height of the dike had been found, which must be repaired. Likewise, the stormwater disposal system (sistema de disposición de aguas pluviales) must be redesigned and rebuilt to provide adequate discharge capacity. Accordingly, a new order will be issued to the Municipalidad de Liberia requiring it to repair the dike in question and to submit a plan ensuring that the stormwater disposal system in that sector has sufficient discharge capacity during events such as storms or heavy downpours (folios 25 and 34); i. According to official letter OF-DCU-485-09-2010 from the Coordinator of the Urban Development and Control Process of the Municipalidad de Liberia, the following was established: “The works referred to by the residents who filed this appeal were carried out in the year dos mil nueve and consisted of constructing an earthen dike and rebuilding a culvert line that had been obstructed for more than quince años, without previous administrations having addressed the matter.
Regarding the first work (the dike), it has been completed in its entirety, with an approximate length of ciento ochenta metros and an approximate height of dos metros. Like many others of its kind, this dike was constructed with reinforced earth. Because of the relatively wide cross-section of the Liberia River and the river’s average gradient (4%), it does not experience excessively high flow velocities that would indicate an urgent need to cover the dike with an artificial material (concrete or geomembrane). This is because the vegetation cover itself helps protect the face of the dike that is in contact with the river. The dike is scheduled to be covered during the primer semestre del dos mil once. It states that throughout the year dos mil nueve and the verano del dos mil diez, periodic maintenance has been performed to reshape and preventively reinforce the structure. For this purpose, the Municipalidad has invested more than ciento cincuenta horas of excavator time to carry out this work, equivalent to approximately cinco millones doscientos cincuenta mil colones.
An excavator has been hired for trece de setiembre to perform repairs on the dike in accordance with the residents’ request.” Regarding the downpours that occurred in agosto de este año, they were exceptional in nature and were attributable to natural phenomena (La Niña) affecting the entire country; these exceed the design parameters of this type of work and of any other work that might be proposed. The dike sustained only minor damage, the repair of which will begin on trece de setiembre del año en curso. Regarding the culverts, the competent department stated: “As for the storm sewer system (alcantarillado), this work has been fully completed. It is an unavoidable physical phenomenon that, when the water level in the river channel rises, the river itself blocks the culvert outlets, causing a temporary obstruction. Accordingly, once the dike has been repaired, the river channel throughout the affected sector will be cleared to increase the width of the channel and thereby lower the river’s flood levels” (folios 111 and 112).
In judgment 4947-2002 of nueve horas con veinte minutos del 24 de mayo del 2002, this Constitutional Chamber ruled:
“(…) IV.- Concerning the applicants’ right to a healthy and ecologically balanced environment. This Court has repeatedly ruled on the constitutional nature of the rights enjoyed by the inhabitants of our country to a healthy and ecologically balanced environment; these matters consequently fall within the scope of Fundamental Rights (Derechos Fundamentales). Thus, for example, in judgment N° 00644–99 of once horas veinticuatro minutos del veintinueve de enero de mil novecientos noventa y nueve, the Sala stated:
“III.– On the law. Article 50 of the Political Constitution (Constitución Política) establishes that every person has the right to a healthy and ecologically balanced environment. The right to a healthy environment has broad content, equivalent to the aspiration to improve the environment in which human beings live; it therefore extends beyond natural-conservation criteria and encompasses every sphere in which a person develops, whether the family sphere, the workplace, or the surroundings in which the person lives. It is therefore said to be a cross-cutting right, meaning that it extends throughout the legal system, shaping and reinterpreting its institutions. The environment is defined by the Real Academia Española de la Lengua as the ‘set of physical circumstances surrounding living beings,’ which further emphasizes the general nature of the right. By contrast, the right to an ecologically balanced environment is a narrower concept referring to an important part of the surroundings in which human beings develop: the balance that must exist between the advancement of society and the conservation of natural resources.
Both rights are expressly recognized in Article 50 of the Political Constitution, which defines the Social Rule-of-Law State (Estado Social de Derecho). The placement of the right to a healthy and ecologically balanced environment within the constitutional provisions governing the Social Rule-of-Law State is the point from which that right must be analyzed. The Social Rule-of-Law State gives rise to the incorporation into the fundamental text of a series of political objectives of great social significance and the introduction of a substantial number of social rights that safeguard the common good and the satisfaction of people’s basic needs. From this perspective, the Political Constitution emphasizes that protecting natural resources is an appropriate means of safeguarding and improving everyone’s quality of life, making intervention by public authorities necessary with respect to factors that may disturb the balance of natural resources and, more broadly, prevent persons from developing and thriving in a healthy environment.
Just as the principle of the Social Rule-of-Law State is immediately applicable, so too is the right to a healthy and ecologically balanced environment, which manifests itself both as an individual right held by persons and as a goal or purpose of the actions of public authorities generally. The impact of the right to a healthy and ecologically balanced environment on State activity… is based, first, on the fact that, by definition, rights are not confined to the private sphere of individuals but also have significance for the very structure of the State in its role as guarantor of those rights and, second, on the fact that State activity is directed toward satisfying the interests of the community. The Political Constitution establishes that the State must guarantee, defend, and preserve that right. Prima facie, to guarantee means to secure and protect the right against any risk or need; to defend means to bar, prohibit, and prevent any activity that infringes the right; and to preserve means to take action aimed at protecting the right in advance against possible dangers so that it may endure for future generations.
The State must undertake the dual obligation to act and to refrain from acting: on the one hand, it must itself refrain from infringing the right to a healthy and ecologically balanced environment; on the other, it must undertake the task of adopting the measures necessary to satisfy constitutional requirements.” And also:
“All human life inevitably takes place in relation to the environment, particularly with regard to improving quality of life, which is the central objective required of development; however, development must relate to the environment in a harmonious and sustainable manner. (…) The origins of environmental problems are complex and correspond to an interplay of natural and social processes within the framework of the socioeconomic development model adopted by the country. For example, environmental problems arise when methods of exploiting natural resources cause degradation of ecosystems beyond their capacity for regeneration, resulting in harm to broad sectors of the population and generating high environmental and social costs that lead to a deterioration in quality of life; indeed, the primary objective of the use and protection of the environment is precisely to achieve development and progress favorable to human beings.
(…) The right to a healthy environment consists of the aspiration to improve the environment in which human beings live in every sphere in which a person develops, whether the family sphere, the workplace, or the surroundings in which the person lives. In this regard, this concept goes beyond merely ‘recreational’ or ‘cultural’ interests because it constitutes an essential requirement for life itself. (…)” In the present case, the right to a healthy and ecologically balanced environment has been violated because the residents of Urbanización Chorotega de Liberia live under the constant threat that, during the rainy season, the Liberia River will overflow and flood the area. Clearly, in this case, the authority established to resolve problems of this kind must act as the protector of that environmental right and ensure that the affected community may enjoy its environment without fear and with its fundamental rights guaranteed.
III.Regarding the actions of the Ministerio de Salud: Based on its analysis of the evidence submitted, this Chamber finds no violation of fundamental rights by the Ministerio de Salud. The Chamber deems it established that, on the twenty-second of October of two thousand seven, the Área Rectora de Salud de Liberia received a complaint from residents of Urbanización Chorotega concerning the overflowing of the Liberia River. On the sixth of November of two thousand seven, the Ministerio de Salud served health order (orden sanitaria) 154-2007 on the Mayor of the Municipalidad de Liberia, ordering him to submit, within thirty working days, a plan for construction of the works that would prevent the Liberia River from overflowing in that residential development. On the eighteenth of April of two thousand eight, resolution DM-J-1709-08 of the twenty-seventh of March of two thousand eight was received, concerning the appeal (recurso de apelación) filed by the Mayor of Liberia; that resolution denied the appeal and upheld the challenged health order.
On the second of May of two thousand eight, the Área Rectora de Liberia filed complaint 013-2008 with the Ministerio Público concerning the possible offense of disobeying an authority. In report RCH-IR-616-2010 of the sixth of September of two thousand ten, the Ministerio de Salud states that an inspection was conducted at the site and that a fissure extending the full height of the dike was found, which must be repaired; likewise, the stormwater disposal system must be redesigned and rebuilt to increase its discharge capacity. A new order will therefore be issued to the Municipalidad de Liberia requiring it to repair the dike in question and submit a plan to ensure that the stormwater disposal system in that area has sufficient discharge capacity during events such as storms or heavy downpours. Based on the foregoing, the Chamber finds that, after receiving the complaint, the Ministerio de Salud proceeded to issue the required health order to the Municipalidad de Liberia and even filed a criminal complaint concerning the municipality’s failure to comply.
Accordingly, the allegation that the respondent ministry acted negligently is rejected. It should be noted that, following a recent inspection, the ministry ordered the issuance of additional health orders to resolve the problem of the damaged dike and address the stormwater problem. Consequently, the proper course is to deny the appeal on this issue.
IV.Regarding the Municipalidad de Liberia: In this specific case, the Chamber deems it established that, on the twenty-third of February of two thousand ten, residents of Urbanización Chorotega asked the Mayor and the President of the Concejo Municipal de Liberia to complete the work on the dike and culvert in order to prevent erosion and flooding in the area. On the twenty-third of August of two thousand ten, residents of Urbanización Chorotega asked the Mayor of the Municipalidad and the Municipal Engineer of Liberia to intervene so that the work on the dike and culvert would be completed, in light of the flooding they had experienced. In report RCH-IR-616-2010 of the sixth of September of two thousand ten, the Ministerio de Salud states that an inspection was conducted at the site and that a fissure extending the full height of the dike was found, which must be repaired; likewise, the stormwater disposal system must be redesigned and rebuilt to increase its discharge capacity.
A new order will therefore be issued to the Municipalidad de Liberia requiring it to repair the dike in question and submit a plan to ensure that the stormwater disposal system in that area has sufficient discharge capacity during events such as storms or heavy downpours. According to official letter OF-DCU-485-09-2010 from the Coordinator of the Urban Development and Control Process of the Municipalidad de Liberia: “The works mentioned by the residents who filed this appeal were performed in the year two thousand nine. They consisted of constructing an earthen dike and rebuilding a culvert line that had been obstructed for more than fifteen years without previous administrations addressing the matter. The first project (the dike) has been fully constructed, with an approximate length of one hundred eighty meters and a height of approximately two meters. Like many dikes of its kind, this dike was constructed using reinforced earth.
Given the type of cross-section of the Liberia River (relatively wide) and the average gradient of this river (4%), it does not experience excessively high flow velocities that would make it absolutely necessary to cover the dike with an artificial material (concrete, geomembrane). This is because the vegetation cover itself helps protect the face of the dike that is in contact with the river. The dike is scheduled to be covered during the first half of two thousand eleven. It states that periodic maintenance involving reshaping and preventive reinforcement of the structure was carried out during the year two thousand nine and the summer of two thousand ten. For this purpose, the Municipalidad has invested more than one hundred fifty excavator hours in carrying out this work, equivalent to approximately five million two hundred fifty thousand colones. An excavator has been hired for the thirteenth of September to perform the repairs to the dike requested by the residents.” Regarding the heavy rains that occurred in August of this year, they were exceptional in nature and were caused by natural phenomena (La Niña) affecting the entire country; they exceed the design parameters of this type of structure and of any other structure that might be proposed.
The dike sustained only minor damage, repairs to which will begin on the thirteenth of September of the current year. Regarding the culverts, the competent department states: “As for the sewer system, this project has been fully completed. It is an unavoidable physical phenomenon that, when the level of the river channel rises, the river itself blocks the culvert outlets, causing a temporary obstruction. For this purpose, once the dike has been repaired, the river channel throughout the affected area will be cleared to increase its capacity and thereby lower the river’s flood levels.” In this regard, the Chamber notes that the flooding experienced by residents of Urbanización Chorotega was first raised in the year two thousand seven and that the work performed by the Municipalidad de Liberia—clearing the channels and constructing the dike—did not resolve the problem. On the contrary, the problems persist, particularly because the dike currently has cracks and the culverts failed due to the rainfall. The Chamber therefore finds a violation of Article 50 of the Political Constitution.

The appeal for constitutional relief (recurso de amparo) is partially granted. Carlos Luis Marín Muñoz, Mayor of the Municipalidad de Liberia, and Eugenio Román Ocampo, President of the Concejo Municipal de Liberia, or whoever may hold their respective offices, are ordered, within six months following notice of this judgment, to issue the appropriate instructions and take the necessary actions to repair the dike on the Liberia River, as well as the stormwater disposal system. They are warned that, pursuant to Article 71 of the Ley de la Jurisdicción Constitucional, any person who receives an order issued in an appeal for constitutional relief that the person is required to comply with or enforce, and who fails to comply with or enforce it, shall be subject to imprisonment for three months to two years or a fine of twenty to sixty days, provided that the offense is not subject to a more severe penalty.

Resultando:
Redacta el Magistrado Ulate Chacón; y,
Considerando:
I.Hechos probados: De importancia para la decisión de este asunto, se estiman como debidamente demostrados los siguientes hechos:
a. El veintidós de octubre del dos mil siete se recibe en el Área Rectora de Salud de Liberia denuncia de los vecinos de la Urbanización Chorotega debido al desbordamiento del río Liberia (folios 24 y 79); b. El seis de noviembre de dos mil siete el Ministerio de Salud notifica la orden sanitaria 154-2007 al Alcalde de la Municipalidad de Liberia, ordenándose en el plazo de treinta días hábiles presentara un plan para la construcción de la obra que evitaría el problema de desbordamiento del río Liberia en dicha urbanización (folio 24); c. El veintiséis de marzo del dos mil ocho se recibe en el Área Rectora de Liberia oficio DPM-INF-0129-2008 del Jefe del Departamento de Prevención del Riesgo y Atención de Emergencias, en el cuál se indica que existe una alta vulnerabilidad por el desbordamiento del Río Liberia (folio 25); d. El dieciocho de abril del dos mil ocho, se recibe la resolución DM-J-1709-08 del veintisiete de marzo del dos mil ocho, del recurso de apelación formulado por el Alcalde de la Liberia, en dicha resolución se declara sin lugar el recurso y se ratifica la orden sanitaria recurrida.
(folios 25 y 52); e. El dos de mayo del dos mil ocho el Área Rectora de Liberia interpone denuncia 013-2008 ante el Ministerio Público por el posible delito de desobediencia a la autoridad (folios 25 y 46); f. El veintitrés de febrero del dos mil diez, los vecinos de la Urbanización Chorotega solicitan al Alcalde y al Presidente del Concejo Municipal de la Municipalidad de Liberia concluir los trabajos en el dique y alcantarilla para evitar la erosión e inundaciones en la zona (folio 3); g. El veintitrés de agosto del dos mil diez, los vecinos de la Urbanización Chorotega solicitan al Alcalde de la Municipalidad y al Ingeniero Municipal de Liberia intervenir para concluir los trabajos en el dique y alcantarilla, esto por las inundaciones sufridas (folio 4) h. Por informe RCH-IR-616-2010 del seis de setiembre del dos mil diez, el Ministerio de Salud señala que se hizo una inspección en el sitio y se encontró una hendidura a todo lo alto del dique, la cuál debe ser reparada, de igual manera el sistema de disposición de aguas pluviales requiere ser rediseñado y reconstruido en su capacidad de desfogue, por lo que se va emitir un nuevo ordenamiento a la Municipalidad de Liberia para la reparación del dique de marras y para que presente un plan para que el sistema de disposición de aguas pluviales en ese sector tenga la capacidad suficiente de desfogue ante eventos como tormenta o aguaceros de gran intensidad (folios 25 y 34); i. Según oficio OF-DCU-485-09-2010 del Coordinador del Proceso de Desarrollo y Control Urbano de la Municipalidad de Liberia se establece: “Las obras a que hace mención los vecinos que interpusieron dicho recurso fueron realizadas en el año dos mil nueve, las mismas consistieron en la construcción de un dique conformado de tierra y la reconstrucción de una línea de alcantarilla, que por más de quince años se encontraba obstruida, sin que anteriores administraciones atendieran el caso.
Con respecto a la primera obra (dique) se encuentra construída en su totalidad para una longitud aproximada de ciento ochenta metros y una altura de dos metros aproximadamente. Este dique como muchos en su tipo se construyó con tierra armada. Por el tipo de sección transversal (relativamente ancha) del río Liberia y la pendiente promedio de este río (4%) hace que no presente velocidades de flujo excesivamente altas que presupongan la imperiosa necesidad de darle un recubrimiento al dique con algún material artificial (concreto, geomenbrana). Esto por cuanto el mismo recubrimiento vegetal, ayuda a darle protección a la cara del dique en contacto con el río. Se tiene previsto el recubrimiento del dique para el primer semestre del dos mil once. Dice que durante el año dos mil nueve y el verano del dos mil diez se ha estado dando un mantenimiento periódico de reconformación y reforzamiento preventivo de la estructura.
Para tales efectos la Municipalidad ha invertido más de ciento cincuenta horas de excavadora para realizar estos trabajos, lo que equivale a cinco millones doscientos cincuenta mil colones aproximadamente. Para el día trece de setiembre se tiene contratada una excavadora para realizar las reparaciones al dique de acuerdo a la solicitud de los vecinos”. Con relación a los aguaceros que se dieron en el mes de agosto de este año, los mismos fueron de carácter excepcional y corresponden a fenómenos naturales (la niña) que afectan a todo el país; los cuales se escapan de a los alcances del diseño de este tipo de obra y cualquier otra que se plantee, el dique sólo sufrió un ligero daño, cuya reparación iniciará el trece de setiembre del año en curso. Con relación al tema de las alcantarillas, el departamento competente indica: “Con respecto al alcantarillado esta obra ha sido completamente terminada, es un fenómeno físico inevitable, que al subir el nivel del cauce del río, este mismo obstruya la salida de de las alcantarillas y ocasionen una obstrucción momentánea de la misma.
Para tales efectos, una vez realizada la reparación del dique se procederá a una limpieza del cauce del río en todo el sector afectado, para propiciar una mayor amplitud del cauce y con esto bajar el nivel de crecidas del río” (folios 111 y 112).
En sentencia 4947-2002 de las nueve horas con veinte minutos del 24 de mayo del 2002, esta Cámara Constitucional dispuso:
“(…) IV.- Acerca del derecho de los recurrentes a un ambiente sano y ecológicamente equilibrado. Este Tribunal se ha pronunciado reiteradamente sobre la naturaleza constitucional de los derechos a gozar de un medio ambiente sano y ecológicamente equilibrado que ostentan los pobladores nuestro país; materias que, por consiguiente, se ubican en el ámbito propio de los Derechos Fundamentales. Así por ejemplo, en sentencia N° 00644–99 de las once horas veinticuatro minutos del veintinueve de enero de mil novecientos noventa y nueve, la Sala indicó:
“III.– Sobre el derecho. El artículo 50 de la Constitución Política establece que toda persona tiene derecho a un ambiente sano y ecológicamente equilibrado. El derecho a un ambiente sano tiene un contenido amplio que equivale a la aspiración de mejorar el entorno de vida del ser humano, de manera que desborda los criterios de conservación natural para ubicarse dentro de toda esfera en la que se desarrolle la persona, sea la familiar, la laboral o la del medio en el cual habita. De ahí que se afirme que se trata de un derecho transversal, es decir, que se desplaza a todo lo largo del ordenamiento jurídico, modelando y reinterpretando sus institutos. El ambiente es definido por la Real Academia Española de la Lengua como el ‘conjunto de circunstancias físicas que rodean a los seres vivos’, lo que recalca aún más el carácter general del derecho. En cambio el derecho a un ambiente ecológicamente equilibrado es un concepto más restringido referido a una parte importante de ese entorno en el que se desarrolla el ser humano, al equilibrio que debe existir entre el avance de la sociedad y la conservación de los recursos naturales.
Ambos derechos se encuentran reconocidos expresamente en el artículo 50 de la Constitución Política, que perfila el Estado Social de Derecho. La ubicación del derecho a un ambiente sano y ecológicamente equilibrado dentro de las regulaciones constitucionales del Estado Social de Derecho es el punto a partir del cual debe éste ser analizado. El Estado Social de Derecho produce el fenómeno de incorporación al texto fundamental de una serie de objetivos políticos de gran relevancia social y de la introducción de un importante número de derechos sociales que aseguran el bien común y la satisfacción de las necesidades elementales de las personas. En esta perspectiva, la Constitución Política enfatiza que la protección de los recursos naturales es un medio adecuado para tutelar y mejorar la calidad de vida de todos, lo que hace necesaria la intervención de los poderes públicos sobre los factores que pueden alterar el equilibrio de los recursos naturales y, más ampliamente, obstaculizar que la persona se desarrolle y desenvuelva en un ambiente sano.
De igual forma que el principio del Estado Social de Derecho es de aplicación inmediata, el derecho a un ambiente sano y ecológicamente equilibrado también lo es, de manera que se manifiesta en la doble vertiente de derecho subjetivo de las personas y configuración como meta o fin de la acción de los poderes públicos en general. La incidencia que tiene el derecho a un ambiente sano y ecológicamente equilibrado dentro de la actividad del Estado… encuentra su primera razón de ser en que por definición los derechos no se limitan a la esfera privada de los individuos sino que tienen asimismo trascendencia en la propia estructura del Estado en su papel de garante de los mismos y, en segundo término, porque la actividad del Estado se dirige hacia la satisfacción de los intereses de la colectividad. La Constitución Política establece que el Estado debe garantizar, defender y preservar ese derecho.
Prima facie garantizar es asegurar y proteger el derecho contra algún riesgo o necesidad, defender es vedar, prohibir e impedir toda actividad que atente contra el derecho, y preservar es una acción dirigida a poner a cubierto anticipadamente el derecho de posibles peligros a efectos de hacerlo perdurar para futuras generaciones. El Estado debe asumir un doble comportamiento de hacer y de no hacer; por un lado debe abstenerse de atentar él mismo contra el derecho a contar con un ambiente sano y ecológicamente equilibrado, y por otro lado, debe asumir la tarea de dictar las medidas que permitan cumplir con los requerimientos constitucionales.” Y también:
“Toda la vida del hombre ocurre en relación inevitable con su ambiente, en especial con el mejoramiento de la calidad de vida que es el objetivo central que el desarrollo necesita, pero éste debe estar en relación con el ambiente de modo tal que sea armónico y sustentable.(…) Los orígenes de los problemas ambientales son complejos y corresponden a una articulación de procesos naturales y sociales en el marco del estilo de desarrollo socioeconómico que adopte el país. Por ejemplo, se producen problemas ambientales cuando las modalidades de ecosistemas superior a su capacidad de regeneración, lo que conduce a que amplios sectores de la población resulten perjudicados y se genere un alto costo ambiental y social que redunda en un deterioro de la calidad de vida; pues precisamente el objetivo primordial del uso y protección del ambiente es obtener un desarrollo y evolución favorable al ser humano.
(…) el derecho a un ambiente sano consiste en la aspiración de mejorar el entorno de vida del ser humano dentro de toda esfera en la que se desarrolle la persona, sea la familiar, la laboral o la del medio en el cual habita. En este sentido, este concepto supera los meros intereses “recreativos” o “culturales” porque constituye un requisito capital para la vida misma.(…)” En el caso presente, se encuentra violado el derecho a un ambiente sano y ecológicamente equilibrado, ya que, los vecinos de la Urbanización Chorotega de Liberia se encuentran viviendo en una constante amenaza, que es que en la época de invierno, el río Liberia se desborde e inunde la zona. Evidentemente en este caso, la autoridad erigida para solucionar este tipo de problemas, tiene que convertirse en protectora de ese derecho al ambiente, y mantener a la comunicad afectada disfrutando su ambiente sin temor y en garantía de sus derechos fundamentales.
III.Sobre la actuación del Ministerio de Salud: Del análisis de los elementos probatorios aportados esta Sala descarta la lesión a los derechos fundamentales por parte del Ministerio de Salud. La Sala tiene por acreditado que el veintidós de octubre del dos mil siete, se recibe en el Área Rectora de Salud de Liberia denuncia de los vecinos de la Urbanización Chorotega debido al desbordamiento del río Liberia. El seis de noviembre de dos mil siete el Ministerio de Salud notifica la orden sanitaria 154-2007 al Alcalde de la Municipalidad de Liberia, ordenándose en el plazo de treinta días hábiles presentara un plan para la construcción de la obra que evitaría el problema de desbordamiento del río Liberia en dicha urbanización. El dieciocho de abril del dos mil ocho, se recibe la resolución DM-J-1709-08 del veintisiete de marzo del dos mil ocho del recurso de apelación formulado por el Alcalde de la Liberia, en dicha resolución se declara sin lugar el recurso y se ratifica la orden sanitaria recurrida.
El dos de mayo del dos mil ocho el Área Rectora de Liberia interpone denuncia 013-2008 ante el Ministerio Público por el posible delito de desobediencia a la autoridad. Por informe RCH-IR-616-2010 del seis de setiembre del dos mil diez el Ministerio de Salud señala que se hizo una inspección en el sitio y se encontró una hendidura a todo lo alto del dique, la cuál debe ser reparada, de igual manera el sistema de disposición de aguas pluviales requiere ser rediseñado y reconstruido en su capacidad de desfogue, por lo que se va emitir un nuevo ordenamiento a la Municipalidad de Liberia para la reparación del dique de marras y para que presente un plan para que el sistema de disposición de aguas pluviales en ese sector tenga la capacidad suficiente de desfogue ante eventos como tormenta o aguaceros de gran intensidad. De lo expuesto, la Sala determina que el Ministerio de Salud, una vez recibida la denuncia, procedió a emitir la orden sanitaria requerida a la Municipalidad de Liberia, e inclusive presentó una denuncia penal por el incumplimiento municipal.
De manera que, se rechaza que la actuación del ministerio recurrido fuera negligente. Nótese que, en inspección reciente el ministerio dispuso la emisión de otras órdenes sanitarias a efectos de solventar el problema del dique dañado y atender el problema de las aguas pluviales. En consecuencia, lo procedente es declarar sin lugar el recurso en este extremo.
IV.Referente a la Municipalidad de Liberia: En el caso concreto la Sala tiene por acreditado que el veintitrés de febrero del dos mil diez, los vecinos de la Urbanización Chorotega solicitan al Alcalde y al Presidente del Concejo Municipal de la Municipalidad de Liberia concluir los trabajos en el dique y alcantarilla para evitar la erosión e inundaciones en la zona. El veintitrés de agosto del dos mil diez los vecinos de la Urbanización Chorotega solicitan al Alcalde de la Municipalidad y al Ingeniero Municipal de Liberia intervenir para concluir los trabajos en el dique y alcantarilla, esto por las inundaciones sufridas. Al respecto la Sala advierte que el problema de inundaciones sufridas por los vecinos de la Urbanización Chorotega fue planteado desde el año dos mil siete, siendo que, los trabajos realizados por la Municipalidad de Liberia – limpieza de cauces y construcción del dique- no solventaron el problema, por el contrario, éstos persisten, máxime que el dique a la fecha presenta fisuras, además de que las alcantarillas colapsaron por las lluvias. De ahí que, la Sala constata la lesión al artículo 50 de la Constitución Política.
Por tanto:
Se declara parcialmente con lugar el recurso. Se ordena a Carlos Luis Marín Muñoz, Alcalde de la Municipalidad de Liberia y a Eugenio Román Ocampo, Presidente del Concejo Municipal de Liberia, o a quienes ocupen sus cargos, que en el plazo de seis meses a partir de la notificación de esta sentencia, giren las instrucciones pertinentes y ejecuten las acciones necesarias para reparar el dique del río Liberia, además del sistema de disposición de aguas pluviales. Bajo el apercibimiento de que, con base en lo establecido en el artículo 71 de la Ley de la Jurisdicción Constitucional, se impondrá prisión de tres meses a dos años, o de veinte a sesenta días multa, a quien recibiere una orden que deba cumplir o hacer cumplir, dictada en un recurso de amparo y no la cumpliere o no la hiciere cumplir, siempre que el delito no esté más gravemente penado. Se condena a la Municipalidad de Liberia al pago de las costas, daños y perjuicios causados, los que se liquidarán en ejecución de sentencia de lo contencioso administrativo. Notifíquese la presente resolución a Carlos Luis Marín Muñoz, Alcalde de la Municipalidad de Liberia y a Eugenio Román Ocampo, Presidente del Concejo Municipal de Liberia, o a quienes ocupen sus cargos, EN FORMA PERSONAL. Comuníquese. Con relación al Ministerio de Salud se declara sin lugar el recurso.
