CONSTITUTIONAL CHAMBER OF THE SUPREME COURT OF JUSTICE. San José, at thirteen hours and nine minutes on February fourth, two thousand eleven.

Petition of disobedience filed by LUIS DIEGO SALAZAR FLORES, holder of identity card number 1-1161-198.

WHEREAS:

1. 1By written submission received at the Secretariat of the Chamber on November 3, 2010, the petitioner alleged non-execution of the order contained in Voto Nº 2010-05408 of 10:23 hrs. on March 19, 2010, since, in his opinion, the respondent authorities have taken no measure to arrange what is necessary to definitively eliminate the environmental contamination problems occurring on the properties of the Ministry of Public Works and Transport and the National Institute of Housing and Urbanism, located in Barrio San José, Curridabat.
2. 2By resolution of 10:20 hrs. on November 9, 2010, said petition was served and the corresponding reports were requested (see folio 164).
3. 3Eugenia Vargas Guardián, in her capacity as Executive President of the National Institute of Housing and Urbanism, reported under oath (visible at folio 196) that her represented party, as registered owner of a strip of land comprised by the properties registered at real folios 1-567316-000, 1-597314-000, 1-5797314-000 and 1-597315-000, cadastral maps numbers SJ-476779-1998, SJ-476742-1998, SJ-476744-1998 AND SJ-886778-1990, summoned the co-respondents to a meeting to discuss compliance with the order in Voto Nº 2010-05408. To date, it has not been possible to hold said meeting. Those lands have been maintained as an integral part of the San José-Cartago concession project, in view of the public interest. By official letter No. C-PPT-231-2010 of March 5, 2010, the Municipality of Curridabat was notified regarding the suspension of post replacement and cleaning of those properties. She notes that the Administration is subject to the legal framework in force regarding contracting and to budgetary availability. She requested that the appeal be dismissed.
4. 4Edgar Eduardo Mora Altamirano, in his capacity as Municipal Mayor of Curridabat, reported under oath (visible at folio 227) that his represented party has arranged for the cleaning of the properties owned by the Ministry of Public Works and Transport at least once a week. Likewise, he requested from the Completed Projects Department of the National Institute of Housing and Urbanism the frequent and permanent maintenance of its lands.
5. 5Francisco J. Jiménez, in his capacity as Minister of Public Works and Transport, reported under oath (visible at folio 235) that his office has no involvement, nor has it had any participation in the omission being claimed. Therefore, he is ordering the Demolitions Department to comply with the order.
6. 6By brief filed on November 29, 2010, the petitioner stated (folio 274) that the National Institute of Housing and Urbanism cannot burden the citizen with its deficiencies. Although on October 13, 2010, the property was cleaned, all the debris was left at the site. The Municipal Mayor's Office of Curridabat only ensures that just one of the properties is kept clean; however, it is neglectful regarding the other lands. In this regard, it fails to comply with Article 75 of the Municipal Code. The measures taken to eliminate the existing architectural barriers in Barrio San José and surrounding areas are also not indicated. For its part, the Ministry of Public Works complied with the order on a single occasion and partially.
7. 7Guillermo Alberto Morales Rodríguez, in his capacity as President of the Municipal Council of Curridabat, reported under oath (folio 298) that he adheres to the report of the Municipal Mayor.

WHEREAS:

Sole.- The petitioner alleged non-execution of the order contained in Voto Nº 2010-05408 of 10:23 hrs. on March 19, 2010, which ordered the respondent authorities to arrange what is necessary to definitively eliminate the environmental contamination problems occurring on the properties of the Ministry of Public Works and Transport and the National Institute of Housing and Urbanism located in Barrio San José, Curridabat (brief visible at folios 150-154). From the reports of the respondent authorities, it is inferred that only the Municipality of Curridabat has sought to comply with what was ordered by the Chamber (folios 196, 227 and 235). Under this reasoning, the appropriate course is to reiterate to Eugenia Vargas Guardián and to Francisco J. Jiménez, respectively, in their capacities as Executive President of the National Institute of Housing and Urbanism and Minister of Public Works, compliance with the provisions of Voto Nº 2010-05408 of 10:23 hrs. on March 19, 2010, under the warning that certification of the relevant documents will be ordered for submission to the Public Prosecutor's Office if they fail to do so. Regarding the Municipality of Curridabat, the petition is dismissed.

THEREFORE:

Compliance with the provisions of Voto Nº 2010-05408 of 10:23 hrs. on March 19, 2010, is reiterated to Eugenia Vargas Guardián and to Francisco J. Jiménez, respectively, in their capacities as Executive President of the National Institute of Housing and Urbanism and Minister of Public Works and Transport, under the warning that certification of the relevant documents will be ordered for submission to the Public Prosecutor's Office if they fail to do so. Regarding the Municipality of Curridabat, the petition is dismissed.

Gestión de desobediencia presentada por LUIS DIEGO SALAZAR FLORES, portador de la cédula de identidad número 1-1161-198.

RESULTANDO:

1. 1Por escrito recibido en la Secretaría de la Sala el 3 de noviembre de 2010, el recurrente acusó la inejecución de lo ordenado en el Voto Nº 2010-05408 de las 10:23 hrs. de 19 de marzo de 2010, pues, en su criterio, las autoridades recurridas no han tomado medida alguna para disponer lo necesario para eliminar, definitivamente, los problemas de contaminación ambiental que se producen en los inmuebles del Ministerio de Obras Públicas y Transportes e Instituto Nacional de Vivienda y Urbanismo, que se ubican en el Barrio San José, Curridabat.
2. 2Mediante resolución de las 10:20 hrs. de 9 de noviembre de 2010, se dio traslado a esa gestión y se solicitó los informes correspondientes (ver folio 164).
3. 3Informó bajo juramento Eugenia Vargas Guardián, en su condición de Presidente Ejecutiva del Instituto Nacional de Vivienda y Urbanismo (visible a folio 196), que su representado como propietario registral de una franja de terreno compuesto por las fincas inscritas a folios reales 1-567316-000, 1-597314-000, 1-5797314-000 y 1-597315-000, planos catastrados números SJ-476779-1998, SJ-476742-1998, SJ-476744-1998 Y SJ-886778-1990, convocó a los correcurridos a una reunión, para discutir el cumplimiento de lo ordenado en el Voto Nº 2010-05408. A la fecha no ha sido posible efectuar dicha reunión. Esos terrenos se han mantenido como parte integral del proyecto concesión San José- Cartago, habida cuenta del interés público. Mediante el oficio Nº C-PPT-231-2010 de 5 de marzo de 2010, se le comunicó a la Municipalidad de Curridabat, respecto de la suspensión de la reposición de postes y limpieza de esos inmuebles. Apunta que la Administración está supeditada al ordenamiento jurídico vigente en materia de contratación y a la disponibilidad presupuestaria. Solicitó que se declare sin lugar el recurso.-
4. 4Informó bajo juramento Edgar Eduardo Mora Altamirano, en su condición de Alcalde Municipal de Curridabat (visible a folio 227), que su representada ha dispuesto la limpieza de los inmueble propiedad del Ministerio de Obras Públicas y Transportes al menos una vez a la semana. Asimismo, solicito al Departamento de Proyectos Terminados del Instituto Nacional de Vivienda y Urbanismo, el mantenimiento frecuente y permanente de sus terrenos.
5. 5Informó bajo juramento Francisco J. Jiménez, en su condición de Ministro de Obras Públicas y Transportes (visible a folio 235), que su despacho no tiene injerencia, ni ha tenido participación alguna en la omisión que se reclama. Por lo anterior, está ordenando al Departamento de Demoliciones cumplir lo ordenado.
6. 6Por memorial presentado el 29 de noviembre de 2010, el recurrente indicó (folio 274), que no puede el Instituto Nacional de Vivienda y Urbanismo cargar al ciudadano de sus deficiencias. Si bien el 13 de octubre de 2010, se procedió a la limpieza del inmueble, todos los escombros se dejaron en el lugar. La Alcaldía Municipal de Curridabat se procura, únicamente, por mantener limpio solo uno de los inmuebles; sin embargo, es omiso respecto de los demás terrenos. En este sentido, omite cumplir lo dispuesto en el artículo 75 del Código Municipal. Tampoco, se indican las medidas que se han tomado para eliminar las barreras arquitectónicas existentes en el Barrio San José y zonas aledañas. Por su parte, el Ministerio de Obras Públicas, cumplió con lo ordenado por una única vez y de manera parcial.
7. 7Informó bajo juramento Guillermo Alberto Morales Rodríguez, en su condición de Presidente del Concejo Municipal de Curridabat (folio 298), que se adhiere a lo informado por el Alcalde Municipal.

Redacta la Magistrada Salazar Cambronero; y,

CONSIDERANDO:

Único.- El recurrente acusó la inejecución de lo ordenado en el Voto Nº Voto Nº 2010-05408 de las 10:23 hrs. de 19 de marzo de 2010, que ordenó a las autoridades recurridas, disponer lo necesario para eliminar, definitivamente, los problemas de contaminación ambiental que se producen en los inmuebles del Ministerio de Obras Públicas y Transportes e Instituto Nacional de Vivienda y Urbanismo que se ubican en el Barrio San José, Curridabat (memorial visible a folios 150- 154). De los informes de las autoridades recurridas, se colige que, únicamente, la Municipalidad de Curridabat ha procurado cumplir lo ordenado por Sala (folios 196, 227 y 235). Bajo esta inteligencia, lo procedente es reiterarle a Eugenia Vargas Guardián y a Francisco J. Jiménez, respectivamente, en su condición de Presidente Ejecutiva del Instituto Nacional de Vivienda y Urbanismo y Ministro de Obras Públicas el cumplimiento de lo dispuesto en el Voto Nº 2010-05408 de las 10:23 hrs. de 19 de marzo de 2010, bajo la advertencia de ordenarse el testimonio de piezas para ante el Ministerio Público si no lo hicieren. En lo que respecta a la Municipalidad de Curridabat, no ha lugar a la gestión.-

POR TANTO:

Se le reitera a Eugenia Vargas Guardián y a Francisco J. Jiménez, respectivamente, en su condición de Presidente Ejecutiva del Instituto Nacional de Vivienda y Urbanismo y Ministro de Obras Públicas y Transportes, el cumplimiento de lo dispuesto en el Voto Nº 2010-05408 de las 10:23 hrs. de 19 de marzo de 2010, bajo la advertencia de ordenarse el testimonio de piezas para ante el Ministerio Público si no lo hicieren. En lo que respecta a la Municipalidad de Curridabat, no ha lugar a la gestión.- Ana Virginia Calzada M.
