*090105970007CO* Decision No. 2009014763 CONSTITUTIONAL CHAMBER OF THE SUPREME COURT OF JUSTICE. San José, at fourteen hours and thirty-three minutes on the eighteenth of September, two thousand nine.

Amparo proceeding (recurso de amparo) filed by MARÍA ELENA SOTO RAMÍREZ, holder of identity card No. 1-643-790, and RODRIGO HUMBERTO LORÍA ARIAS, holder of identity card No. 3-191-748, against THE MUNICIPALITY and THE GOVERNING HEALTH AREA, BOTH OF THE PROVINCE OF CARTAGO.

WHEREAS:

  1. 1By a written submission received by the Office of the Clerk of the Chamber at 11:52 hrs. on 19 July 2009 (appearing at folios 1-5), the petitioners filed an amparo proceeding and stated that, for several years, they have reported to the respondent authorities that waste is discharged on the east side of Hospital Max Peralta and flows along the gutter southward until it reaches their residence, causing pollution as well as putrid and nauseating odors. However, they alleged that, to date, those authorities have not taken the necessary steps to remedy that situation permanently. They stated that one possible solution proposed to the respondent municipal corporation, likewise without any response, is to pipe the gutter or to construct a sidewalk over it to serve as a cover. They further stated that, on 17 June 2009, they requested from the Environmental Management Office of the respondent Municipality (sic) a copy of the report issued concerning the study conducted on the gutter in question and the discharge of sewage. However, they alleged that, to date, that information has not been provided to them. They considered Articles 30 and 50 of the Political Constitution to have been violated. They requested that the proceeding filed be granted.
  2. 2By interlocutory decision No. 12062-09 at 13:46 hrs. on 31 July 2009 (appearing at folios 14-16), this Constitutional Court partially dismissed the present amparo proceeding.
  3. 3By decision at 14:40 hrs. on 6 August 2009 (appearing at folios 17-19), the proceeding was admitted and reports were requested from the respondent authorities.
  4. 4By a written submission received by the Office of the Clerk of the Chamber via fax at 05:22 hrs. on 12 August 2009 (appearing at folios 23-25), Ezequías Antonio Loría Muñoz and Argentina Arias Ballestero requested recognition as supporting intervenors (coadyuvantes activos) in the present amparo proceeding. In that regard, they asserted that they live on the street running from north to south, specifically 175 meters south of Hospital Max Peralta. They indicated that they are likewise being affected by the odors emanating from the gutter referred to by the petitioners. They maintained that this severe pollution is caused by waste discharged into that gutter, namely hospital waste and sewage. They indicated that the problem arises because 400 meters of the gutter are uncovered. They considered that the respondent Municipality should undertake works such as constructing a “gutter cover” (“sobrecaño”), as was done alongside the aforementioned medical center, to prevent the foul odors.
  5. 5Rolando Alberto Rodríguez Brenes, in his capacity as Mayor of the Municipality of Cartago, reported under oath (appearing at folios 30-36), likewise in accordance with the statements contained in report No. AOP-343-2009 dated 17 August 2009, issued by the person in charge of that municipal corporation’s Operations Area. He indicated that, in May 2009, the petitioner filed a complaint with that Mayor’s Office regarding alleged nauseating odors in the gutter running down the east side of Hospital Max Peralta, which was then forwarded to the official responsible for the Sanitary Sewer Department. That official prepared a report indicating that he had contacted petitioner Loría Arias, who told him that “(…) the foul odor occurs on some occasions and during the early morning hours (…)”. He stated that the aforementioned official visited the petitioner’s residence, where his parents told him that “(…) the phenomenon has NOT occurred for quite some time (…)”.He indicated that, additionally, at that time, as a preventive measure, the need was identified to refit the sealed cover of a sewage manhole located fifty meters north of the protected party’s residence. He stated that, regarding the foregoing, the official in charge of the sanitary sewer system issued a report on 3 July 2009 describing the reinforcement work and the removal of the concrete cover—replacement with thermoformed plastic—at the aforementioned manhole. He noted that the report mentions the field visit conducted at the site with the Ministry of Health Technician so that the latter could verify that no anomaly existed. He further noted that the official even stated that he considered the repair made to the manhole excellent, as the manhole could have been the source of gases evaporating from the sanitary sewer network. He clarified that the dates stated in that report are from June, not July.He added that, on 22 June 2009, the protected party filed a new complaint regarding environmental pollution from open-air sewage. However, he asserted that action had already been taken by that time, namely works had been performed and the case had been brought to the attention of the Ministry of Health. Accordingly, he affirmed that the Municipality does address the petitioners’ complaints. He stated that the aforementioned report No. AOP-343-2009 also records that the municipal officials responsible for handling the case in question have been unable to establish with certainty the existence of any discharge or presence of waste in the storm sewer system or in the open air originating from the east side of Hospital Max Peralta. He reiterated that the case was brought to the attention of the Ministry of Health so that the latter could conduct the relevant assessments. He indicated that the Sanitary Sewer Department, with support from the Environmental Unit and officials of the Ministry of Health, had prepared in the preceding days a survey or public-opinion instrument intended to determine whether sewage overflows occur in the community, specifically in the vicinity of the aforementioned hospital, Ruinas de Santiago Apóstol, and the Courts of Justice building.He asserted that this instrument was administered both to staff of the private medical clinics located near the petitioner’s residence and to personnel of the Administration of Hospital Max Peralta. He added that, on 17 August 2009, beginning at 11:00 hrs., municipal engineer Andrés Fernández of the Municipal Operations Area, the Head of the Sanitary Sewer Department, and the Inspector in Charge of the Human Environment of the Governing Health Area inspected the site in question and its surroundings and visited healthcare facilities, verifying their health operating permits and the proper operation of their wastewater disposal systems and treatment mechanisms, without finding any anomaly. He requested that the proceeding filed be dismissed.
  6. 6Luis Alberto Sanabria Varela, in his capacity as Director of the Ministry of Health’s Governing Health Area of Cartago, reported under oath (appearing at folio 47) that, according to visits conducted by that Ministry, the existence of the reported problem has not been corroborated. He affirmed that coordination has been established with officials of the Municipality of Cartago to verify in the field whether any particular situation exists that could give rise to an occurrence such as the one reported. In any event, he stated that, on the upcoming 21 August, an opinion survey would be administered among the residents of the affected community in order to establish the actual truth of the facts with greater certainty.
  7. 7By a written submission received by the Office of the Clerk of the Chamber at 06:57 hrs. on 21 August 2009 (appearing at folios 56-57), Ezequías Antonio Loría Muñoz and Argentina Arias Ballestero responded to the report submitted by the Municipal Mayor of Cartago.
  8. 8By decision at 09:19 hrs. on 21 August 2009 (appearing at folio 58), this Constitutional Court ordered as follows: “(…) Upon review of the record, the admission of the present amparo proceeding is expanded so that LUIS ALBERTO SANABRIA VARELA, or whoever serves in his stead as DIRECTOR, as well as FRANCISCO RODRÍGUEZ ALVARADO, or whoever serves in his stead as TECHNICIAN OF THE ENVIRONMENTAL MANAGEMENT AREA, BOTH OF THE GOVERNING HEALTH AREA OF CARTAGO, shall report to this Chamber, within TWO DAYS from service of this decision, regarding the additional allegations made by petitioners Loría Arias and Soto Ramírez, summarized as follows: That, since 17 June 2009, Rodríguez Alvarado, Technician of the Environmental Management Area of the respondent Governing Health Area, had been asked for a copy ‘(…) of the report issued concerning the study conducted at the time on the discharge of sewage into the gutter running southward from Hospital Max Peralta (…)’ (request bearing a receipt stamp appearing at folio 13). That, as of the date the amparo proceeding was filed, that information had not been provided to them. That such conduct violates the provisions of Article 30 of the Constitution (…)”.
  9. 9By a written submission received by the Office of the Clerk of the Chamber at 18:17 hrs. on 21 August 2009 (appearing at folios 59-64), the petitioners responded to the report submitted by the respondent authorities.
  10. 10By a pleading filed with the Office of the Clerk of the Chamber at 17:38 hrs. on 24 August 2009 (appearing at folios 115-118), the protected parties maintained that the Municipal Mayor had been untruthful in the report submitted to this Chamber.
  11. 11Through the written submission filed with the Office of the Clerk of the Chamber at 06:25 hrs. on 25 August 2009 (appearing at folios 119-124), the protected parties addressed the opinion surveys mentioned by the respondent authorities in their reports.
  12. 12By a written submission received by the Office of the Clerk of the Chamber at 19:02 hrs. on 28 August 2009 (appearing at folios 135-136), petitioner Loría Arias addressed the discussion held by the Municipal Council of Cartago at the Regular Session convened on 18 August of the current year concerning the sewage problem existing in the central canton of that province.
  13. 13José Francisco Rodríguez, in his capacity as Environmental Management Technician of the Governing Health Area of Cartago, reported under oath (appearing at folios 155-156) that, on 11 August 2009, the petitioner appeared at that Area, where he was assisted by the Director and the Regulatory Coordinator, who provided him with an explanation regarding the work performed in connection with the complaint filed. Consequently, he maintained that there was no need to send the report in question to the interested party. He reiterated that, according to inspections conducted jointly with the Municipality of Cartago, the existence of the reported problem has not yet been corroborated.
  14. 14By a written submission received by the Office of the Clerk of the Chamber at 13:09 hrs. on 1° September 2009 (appearing at folios 161-164), the petitioners addressed what had occurred with certain documents entered into the record by the respondent parties.
  15. 15By means of the pleading received by the Secretariat of the Chamber at 06:25 hrs. on 3 de septiembre de 2009 (appearing at folios 166-169), the interested parties addressed the supplemental report submitted by the Environmental Management Technician of the Cartago Governing Health Area. In that regard, they alleged that, as of that date, they had not been provided with the report concerning the sewage under examination.
  16. 16The Director of the Governing Health Area did not submit the report required by the ruling issued at 09:19 hrs. on 21 de agosto de 2009 (certification appearing at folio 180).
  17. 17In a written submission received by the Secretariat of the Chamber via fax at 18:56 hrs. on 14 de septiembre de 2009 (appearing at folios 182-185), the petitioners again addressed the reports submitted by the respondent authorities.
  18. 18The statutory requirements have been observed in the processing of these proceedings.

Justice Araya García drafts the opinion; and,

WHEREAS:

I. REGARDING THE APPLICATION TO INTERVENE AS SUPPORTING PARTIES

In the written submission appearing at folios 23-25, Ezequías Antonio Loría Muñoz and Argentina Arias Ballestero requested recognition as active supporting intervenors (coadyuvantes activos) in these proceedings. In this regard, section 34, paragraph 3°, of the Ley de la Jurisdicción Constitucional provides that anyone possessing a legitimate interest in the proceedings may intervene, whether on the active or passive side, as a supporting party. In this specific case, according to the applicants, the waste dumped on the east side of Hospital Max Peralta and the resulting foul odors produced there also affect them because they live 175 metros south of that hospital. Consequently, by virtue of the aforementioned procedural rule and Article 50 of the Constitution, the application for active supporting intervention is admissible.

II. SUBJECT MATTER OF THE AMPARO PETITION

The petitioners allege that their right to enjoy a healthy and ecologically balanced environment has been violated because, according to their assertions, the respondent authorities, as of this date and despite the requests made in that regard, have not taken the measures necessary to mitigate the pollution and foul odors caused by the dumping of all types of waste on the east side of Hospital Max Peralta de Cartago. That waste also flows southward along the gutter until reaching their residence. They further allege a violation of their right of access to administrative information because the authorities of the Cartago Governing Health Area refused to provide them with a report, requested since 17 de junio de 2009, concerning a study conducted in connection with the problem at issue.

III. PROVEN FACTS

The following facts relevant to deciding this amparo proceeding (recurso de amparo) are deemed proven:

  • 1)From abril de 2004 to the present, the petitioners have reported to the Municipalidad and the Governing Health Area, both of Cartago, the alleged pollution and foul-odor problem caused by the dumping of all types of waste on the east side of Hospital Max Peralta (appearing at folios 7-11, 30-39, and report appearing at folio 30).
  • 2)On 17 de junio de 2009, petitioner Loría Arias requested from the official in charge of the Environmental Management Department of the Cartago Governing Health Area a copy “(…) of the report submitted concerning the study conducted at the time regarding the discharge of sewage into the gutter running southward from Hospital Max Peralta (…)”. (appearing at folio 13).
  • 3)On 19 de junio de 2009, the officials responsible for the sanitary sewer system (alcantarillado sanitario) of the Municipalidad de Cartago “refitted the sealing cover” of a sewage manhole located 50 metros north of the petitioner’s residence. On that occasion, the concrete cover was replaced with a plastic “flanger” (report appearing at folio 31 and folio 43).
  • 4)On 22 de junio de 2009, the protected party filed a new pollution complaint with the respondent municipal corporation (report appearing at folio 32).
  • 5)On 26 de junio de 2009, a Technician from the Ministerio de Salud inspected and approved the work performed on 19 de junio of that same year (report appearing at folio 31 and folio 43).
  • 6)On 19 de julio de 2009, the interested parties filed this amparo proceeding (appearing at folio 1).
  • 7)On 13 de agosto de 2009, the respondent authorities were served with notice of the amparo petition (records appearing at folios 27-28).
  • 8)On 17 de agosto de 2009, the respondent authorities jointly conducted an inspection at the site of the reported events and at two private clinics near it, verifying that they held the corresponding sanitary permits and that the wastewater treatment systems and mechanisms were operating properly (report appearing at folio 34 and at folios 40 and 52).
  • 9)Through official communications Nos. AOP-343-2009 of 17 de agosto and ARSC-R-201-09 of 18 de agosto de 2009, the Head of the Operations Area of the respondent Municipalidad and the Environmental Management Technician of the Cartago Governing Health Area, respectively, acknowledged that they had been unable to establish with certainty the “(…) existence of a discharge or presence of waste in the stormwater sewer system (alcantarillado pluvial) or in the open air originating from Hospital Max Peralta Jiménez (…)”. (report appearing at folios 32-33 and at folios 39 and 51).
  • 10)As of the date on which the Environmental Management Technician of the Cartago Governing Health Area submitted the supplemental report, namely, 31 de agosto de 2009, the protected party had still not been provided with the copy of the report requested on 17 de junio of that same year (report appearing at folios 155-156 and folio 167).

IV. UNPROVEN FACT

The following fact relevant to deciding this amparo proceeding is deemed unproven: Sole.- That the respondent authorities ruled out, among other things, the dumping on the east side of Hospital Max Peralta de Cartago of all types of waste producing pollution and foul odors that also flow southward along the gutter (the record).

V. REGARDING THE RIGHT TO A HEALTHY AND ECOLOGICALLY BALANCED ENVIRONMENT

Based on Articles 21, 50, and 89 of the Constitución Política, this Constitutional Court has broadly recognized the State’s duty to protect the right to enjoy a healthy and ecologically balanced environment. Those provisions, together with environmental legislation below the constitutional level, give rise to the State’s responsibility to exercise a protective and governing role in this field. In this regard, this Chamber stated the following in Voto No. 4830-02 of 16:00 hrs. on 21 de mayo de 2002:

“(…) Our Constitución Política, in Article 50, expressly recognizes the right of all present and future inhabitants of this country to enjoy a healthy environment in perfect balance. Fulfillment of this requirement is a fundamental guarantee for the protection of public life and health, not only for Costa Ricans but also for all members of the global community. Violation of these fundamental precepts creates the possibility of injury to, or endangerment of, interests in the short, medium, and long term. Environmental pollution is one of the ways in which the integrity of the environment may be disrupted, with consequences that are, in most cases, permanent and cumulative. The Costa Rican State is obligated to act preventively by avoiding—through oversight and direct intervention—the performance of acts that harm the environment, and is subject to the corresponding and equally inescapable prohibition against promoting its degradation (…)”.

Likewise, more recently, this Court held the following in Voto No. 17552-07 of 12:22 hrs. on 30 de noviembre de 2007:

“(…) The aforementioned Article 50 also defines the Social State under the Rule of Law (Estado Social de Derecho); therefore, we may conclude that the Constitución Política emphasizes that environmental protection is an appropriate mechanism for safeguarding and improving everyone’s quality of life, which makes intervention by the Public Authorities necessary with respect to factors that may disturb its balance and prevent individuals from developing and thriving in a healthy environment. The significance of the right to a healthy and ecologically balanced environment within State activity is grounded, first, in the fact that, by definition, rights are not confined to individuals’ private sphere but also have implications for the very structure of the State in its role as guarantor of those rights; and second, in the fact that State activity is directed toward satisfying the interests of the community.

In constitutional case law, the concept of the ‘environment’ has not been limited to the primary elements of nature, namely, soil, air, water, marine and coastal resources, minerals, forests, the biological diversity of flora and fauna, and the landscape, which together form the environmental framework without which basic needs—such as food, energy, housing, sanitation, and recreation—could not be met. It is important to emphasize that this term has been understood more comprehensively through the establishment of a ‘macro-environmental’ concept that also encompasses matters relating to the economy, the generation of foreign currency through tourism, agricultural exploitation, and others: ‘Accordingly, Environmental Law should not be associated solely with nature, because nature is only one part of the environment. Nature-protection policy also extends to other matters, such as the protection of hunting, forests, natural parks, and natural resources. It is therefore a macro-environmental concept intended to ensure that important concepts are not excluded and thus to unify the body of law that we call Environmental Law (…)’”.

Finally, it should be noted that this Chamber, as guarantor of fundamental rights, serves as an overseer of compliance with the obligations arising from Articles 21 and 50 of the Constitution, which compel the State not only to recognize the specified rights but also to employ materially and legally legitimate means to guarantee them.

VI. ORIGIN, CONTENT, AND SCOPE OF THE PRECAUTIONARY PRINCIPLE (PRINCIPIO PRECAUTORIO)

Regarding this principle, Voto No. 17747-06 of 14:37 hrs. on 11 de diciembre de 2006, drafted by Justice Jinesta Lobo, held as follows:

“(...) From its inception, the precautionary principle has taken into account the fallibility of human understanding and the possibility of error. In the second half of the 1970s, the German federal government articulated the “Vorsorgeprinzip” principle, stating that “an environmental policy cannot be fully consolidated solely by eliminating imminent dangers and repairing harm that has occurred. A precautionary environmental policy also requires that natural resources be protected and that demands placed upon them be managed carefully,” and used it to justify the implementation of policies against acid rain and pollution of the North Sea. The principle emerged on the international stage through the North Sea Treaties (Bremen Declarations of 1984, London 1987, Den Haag 1990, and Esbjerg 1995). Thus, the 1984 Bremen Declaration (First International Conference on the Protection of the North Sea) referred to the need to adopt timely preventive measures in light of insufficient knowledge. Subsequently, the 1987 London Declaration (Second International Conference on the Protection of the North Sea) proclaimed the principle of safeguarding the North Sea ecosystem by reducing pollutant emissions at their source involving substances that are persistent, toxic, and liable to accumulate, through the use of the best available technology and other appropriate measures. This option would be particularly applicable when there was reason to presume that such substances could cause harm or adverse effects to living marine resources, even when there was no scientific evidence proving the link between the emissions and the effects (precautionary action principle). The latter declaration provided that “(...) a precautionary approach is necessary, which may require the adoption of measures (...) even before a causal relationship has been established by absolutely clear scientific evidence (...).” The principle was subsequently incorporated into various multilateral treaties and international declarations, such as the 1987 Montreal Protocol on Substances that Deplete the Ozone Layer; the 1990 Bergen Declaration on Sustainable Development in the EEC Region, adopted by representatives of European countries and Canada; the 1992 Convention on Biological Diversity; the 1992 Framework Convention on Climate Change; the 1992 Treaty on European Union; the 1992 Convention for the Protection of the Marine Environment of the North-East Atlantic; the 1994 Helsinki Convention on the Protection of the Marine Environment of the Baltic Sea Area; the 1994 World Trade Organization (WTO) Agreement on the Application of Sanitary and Phytosanitary Measures (SPS Agreement); the 1995 Washington Global Programme of Action for the Protection of the Marine Environment from Land-based Activities; the London Convention on the dumping of wastes at sea, originally adopted in 1992, pursuant to amendments adopted in 1997 for the protection of the marine ecosystem; the 2000 United Nations Protocol on Biosafety to the Convention on Biological Diversity of Montreal; the 2000 Cartagena Protocol on Biosafety; and the 2000 Communication from the European Union on the Precautionary Principle. Likewise, the precautionary principle quickly assumed a general scope—including natural resources, ecosystems, the fisheries and forestry sectors, and biological diversity—and was no longer confined solely to toxic substances. Thus, the Bergen Declaration (1990) stated that “Where there are threats of serious or irreversible damage, lack of absolute scientific certainty must not be used as a reason for postponing the adoption of measures to prevent environmental degradation.” Similarly, Principle 15 of the Rio Declaration on Environment and Development (3-14 June 1992) provided as follows: “In order to protect the environment, States shall widely apply the precautionary approach according to their capabilities. Where there is a danger of serious or irreversible damage, lack of absolute scientific certainty shall not be used as a reason for postponing cost-effective measures to prevent environmental degradation.” The precautionary principle thereby acquired even an ethical dimension—concerning science and technology—that guides States’ policies on the environment, health, trade, food safety, and sustainable development in general. Despite the uncertainty surrounding the definition or conceptualization of the precautionary principle, from a general perspective it dictates that, when environmental risks are uncertain, unforeseeable, and cannot be disregarded, a regulatory omission or failure to act is unjustified. Simply stated, the combination of scientific or technological uncertainty—due to a lack, insufficiency, or inadequacy of the available scientific information and knowledge regarding the causation, extent, probability, and nature of the harm—and the possibility or threat of eventual serious and irreversible harm equals, or must be equivalent to, precautionary or anticipatory action, which may even entail prohibiting or eliminating certain products, activities, or substances. This presupposes an objective assessment of the risk and of the cost-benefit relationship of precautionary inaction or action in light of the available scientific evidence, allowing the conclusion that such evidence is insufficient, absent, or inadequate; consequently, the precautionary principle cannot justify the adoption of arbitrary and potentially discriminatory measures. Moreover, applying the precautionary principle does not entail freezing the existing state of affairs at the time the relevant actions are adopted in a manner that prevents progress and innovation, because intervention or restrictive measures must remain in force only so long as the scientific information is incomplete or inconclusive and the risk of harm is serious and irreversible; they may therefore be reviewed periodically in light of scientific progress. Likewise, when restrictive or intervention measures are ordered, the principle of proportionality must be observed, so that such measures are proportionate to the level of protection and the extent of the potential or eventual harm. The precautionary principle is based on the fact that the environment and ecosystems lack the capacity to assimilate or withstand certain activities, products, or substances, and thus seeks to anticipate harm and protect human health and the environment (...).”

VII. REGARDING THE VIOLATION OF ARTICLE 50 OF THE CONSTITUTION IN THIS PARTICULAR CASE

In this matter, the protected parties allege that their right to enjoy a healthy and ecologically balanced environment has been violated because, according to their account, the respondent authorities have not, to date and despite the requests submitted to that effect, taken the necessary steps to mitigate the pollution and foul odors produced by the disposal of all types of waste on the eastern side of Hospital Max Peralta de Cartago, which also travel along the gutter channel southward until reaching their home. In this regard, this Constitutional Court considers the petitioners’ allegation to be well-founded. This is so, first, because the evidence entered into the record fully and reliably establishes that, although the situation in question was reported to the Municipalidad and the Área Rectora de Salud, both of Cartago, in April 2004, it was not until June of the current year—more than 5 years later—that the respondent authorities ordered any action whatsoever, specifically the replacement of the cover of a sewage manhole located 50 meters north of the home of petitioner Loría Arias, as well as, in August—in connection with the amparo proceeding—an inspection of the reported site and certain nearby private clinics to verify whether they held the respective health permits and whether their wastewater-treatment systems were operating properly.

Moreover, these actions proved wholly irrelevant to addressing the reported problem. This is particularly so given that this Constitutional Court did not find it established that the respondent authorities had effectively ruled out the existence, at the locations identified by the petitioners, of waste producing pollution and foul odors. Indeed, the record contains reports signed by officials from both entities responsible for addressing the aforementioned complaints, stating that they had been unable to establish with certainty the “(...) existence of a discharge or presence of waste in the stormwater drainage system or in the open air originating from Hospital Max Peralta Jiménez (...).” This position is further reaffirmed by the Director of the Área Rectora de Salud de Cartago, who expressly states in his report that the existence of the reported problem has not been corroborated and that he will therefore order certain measures to that effect.

Under these circumstances, we are faced with a clear and unmistakable state of scientific and technical uncertainty regarding the environmental risks and pollution that may be caused by the alleged disposal of waste on the eastern side of Hospital Max Peralta de Cartago. This situation necessarily requires application of the precautionary principle described above and, in this respect, that the petition be granted pursuant to Article 50 of the Constitución Política.

VIII. THE RIGHT OF ACCESS TO ADMINISTRATIVE INFORMATION

This Constitutional Court, in an opinion drafted by Justice Jinesta Lobo, held as follows in judgment No. 02120-03 at 13:30 hrs. on 14 March 2003:

“(…) I.- ADMINISTRATIVE TRANSPARENCY AND PUBLICITY (TRANSPARENCIA Y PUBLICIDAD ADMINISTRATIVAS). Within the framework of the Social and Democratic State Governed by Law (Estado Social y Democrático de Derecho), each and every public entity and body comprising the respective administration must be subject to the implicit constitutional principles of transparency and publicity, which must govern all administrative action and functions. Collective organizations under Public Law—public entities—are called upon to be true glass houses, whose interiors all members of the public may examine and scrutinize in broad daylight. Public administrations must create and foster permanent, open channels of communication and information exchange with members of the public and the mass media, in order to encourage greater direct and active participation in public administration and to give effect to the principles of performance evaluation and accountability now incorporated into our constitutional text (Article 11 of the Political Constitution).

Under this interpretation, administrative secrecy or confidentiality (reserva administrativa) is an exception justified solely under special circumstances when it serves to protect constitutionally significant values and interests. Various mechanisms exist for achieving greater levels of administrative transparency within a given legal system, such as stating the grounds for administrative acts (motivación de los actos administrativos); the means by which they are communicated—publication and service of notice (notificación); the public-information procedure (trámite de información pública) for drafting regulations and regulatory plans (planes reguladores); participation in administrative proceedings (procedimiento administrativo); and administrative procurement procedures (procedimientos de contratación administrativa), among others. Nevertheless, one of the most valuable tools for achieving that objective is the right of access to administrative information (derecho de acceso a la información administrativa).

II. THE RIGHT OF ACCESS TO ADMINISTRATIVE INFORMATION

Article 30 of the Political Constitution guarantees free access to “administrative departments for the purpose of obtaining information on matters of public interest,” a fundamental right that legal scholarship has called the right of access to administrative archives and records. The more accurate term, however, is the right of access to administrative information, since access to the physical or virtual media of public administrations is the instrument or mechanism for achieving the intended purpose: enabling members of the public to acquaint themselves with the information held by those administrations. It must be noted that administrative information of public interest sought by a member of the public is not always contained in an administrative case file, archive, or record. The right of access to administrative information is a mechanism of oversight available to members of the public because it enables them to exercise optimal oversight of legality and of timeliness, appropriateness, or merit and, in general, of the effectiveness and efficiency of the administrative function performed by the various public entities.

Efficient and effective public administrations are those subject to public oversight and scrutiny, but citizen oversight cannot exist without adequate information. A logical chain may therefore be established among access to administrative information, knowledge and handling of that information, effective or timely citizen oversight, and efficient public administrations. The right of access to administrative information is deeply grounded in a series of principles and values inherent in the Social and Democratic State Governed by Law, which it also puts into effect. Thus, effective and direct citizen participation in the administration and management of public affairs is inconceivable without a substantial body of information regarding administrative powers and services. Likewise, the democratic principle is strengthened when the various social, economic, and political forces and groups participate actively and knowledgeably in forming and implementing the public will.

Finally, the right of access to administrative information is an indispensable tool, among many others, for ensuring the full application of the principles of administrative transparency and publicity. The scope of the right of access to administrative information is truly broad and comprises a bundle of powers vested in the person exercising it, including the following: a) access to public departments, units, offices, and buildings; b) access to physical or automated archives, records, case files, and documents—databases and data files; c) the right of a member of the public to know what stored personal or identifying data affect that person in any way; d) the right of a member of the public to correct or delete such data if they are erroneous, inaccurate, or false; e) the right to know the contents of physical or virtual documents and case files; and f) the right to obtain certifications or copies thereof at that person’s own expense.

III. TYPOLOGY OF THE RIGHT OF ACCESS TO ADMINISTRATIVE INFORMATION

A clear distinction may be drawn between the right of access to administrative information (a) ad extra—outside—and (b) ad intra—within—an administrative proceeding. The former is granted to any person or member of the public interested in accessing particular administrative information—uti universi—whereas the latter is granted solely to interested parties in a specific, particular administrative proceeding—uti singuli. This right is governed by the General Law of Public Administration (Ley General de la Administración Pública), in Chapter Six, entitled “Access to the Case File and Its Constituent Documents,” Title Three of Book Two, Articles 272 through 274 (…)”.

IX. REGARDING THE VIOLATION OF ARTICLE 30 OF THE POLITICAL CONSTITUTION IN THIS SPECIFIC CASE

Furthermore, the facts appearing in the record fully establish—in clear violation of the right of access to administrative information—that, as of the date on which the requested supplemental report was submitted to the Environmental Management Technician of Área Rectora de Salud de Cartago, namely, 31 de agosto de 2009, the protected party had still not been provided with a copy of the report he requested on 17 de junio of that same year. In this Chamber’s view, that report is of clear and unequivocal public interest because it concerns a study conducted regarding the discharge of sewage into the roadside drainage channel running southward from Hospital Max Peralta, which, in turn, is unquestionably and closely related to the right to a healthy and ecologically balanced environment. Accordingly, this Court finds that, in this case, the fundamental right of the protected party, Loría Arias, enshrined in Article 30 of the Political Constitution, has been violated.

X. CONCLUSION

In view of the foregoing, the petition must be granted, with the consequences to be specified in the operative portion (parte dispositiva) of this judgment.

THEREFORE:

The petition is granted. Consequently, Rolando Alberto Rodríguez Brenes, or whoever holds the office of Mayor of Municipalidad de Cartago in his stead, and Luis Alberto Sanabria Valera, or whoever holds the office of Director of Área Rectora de Salud de Cartago in his stead, are ordered to IMMEDIATELY issue the necessary directives and take the appropriate measures within the scope of their authority to determine conclusively—through inspections and the necessary studies—whether waste that causes pollution and foul odors is being deposited on the east side of Hospital Max Peralta de Cartago and is also traveling southward along the roadside drainage channel. Should such pollution be substantiated, those authorities are ordered to immediately undertake whatever works are necessary to eradicate it permanently. Luis Alberto Sanabria Valera, or whoever holds the office of Director in his stead, and José Rodríguez, or whoever holds the office of Environmental Management Technician in his stead, both of Área Rectora de Salud de Cartago, are likewise ordered to IMMEDIATELY provide the petitioner, Rodrigo Loría Arias, at his own expense, with the information requested on 17 de junio de 2009.

The respondents are warned that, pursuant to Article 71 of the Constitutional Jurisdiction Law (Ley de la Jurisdicción Constitucional), any person who receives an order issued in an amparo proceeding (recurso de amparo) that the person must comply with or enforce, and who fails to comply with or enforce it, shall be subject to imprisonment for three months to two years or a fine of twenty to sixty days, provided that the offense is not subject to a more severe penalty. The State and Municipalidad de Cartago are ordered to pay the costs and the damages and losses caused by the facts underlying this ruling, the amounts of which shall be determined during enforcement of the judgment before the Contentious-Administrative Court. This decision shall be served personally upon Rolando Alberto Rodríguez Brenes, or whoever holds the office of Mayor of Municipalidad de Cartago in his stead; Luis Alberto Sanabria Valera, or whoever holds the office of Director in his stead; and José Rodríguez, or whoever holds the office of Environmental Management Technician in his stead, the latter two being officials of Área Rectora de Salud de Cartago. *090105970007CO* SALA CONSTITUCIONAL DE LA CORTE SUPREMA DE JUSTICIA. San José, a las catorce horas y treinta y tres minutos del dieciocho de septiembre del dos mil nueve.

Recurso de amparo interpuesto por MARÍA ELENA SOTO RAMÍREZ, portadora de la cédula de identidad No. 1-643-790 y RODRIGO HUMBERTO LORÍA ARIAS, portador de la cédula de identidad No. 3-191-748 contra LA MUNICIPALIDAD y EL ÁREA RECTORA DE SALUD, AMBOS DE LA PROVINCIA DE CARTAGO.

RESULTANDO:

  1. 1Por escrito recibido en la Secretaría de la Sala a las 11:52 hrs. de 19 de julio de 2009 (visible a folios 1-5), los recurrentes interpusieron recurso de amparo y manifestaron que desde hace algunos años han denunciado ante las autoridades recurridas que al costado este del Hospital Max Peralta se vierten desechos que recorren el cordón del caño hacia el sur hasta llegar a su casa de habitación y que provocan contaminación, así como olores pútridos y nauseabundos. Sin embargo, acusaron que, a la fecha, dichas autoridades no han realizado las gestiones necesarias para solventar dicha situación de manera definitiva. Refirieron, que una posible solución que se ha planteado ante la corporación recurrida, también, sin respuesta alguna, es la entubación del caño o bien, la construcción de una acera sobre éste que sirva como tapa. Asimismo, manifestaron que el 17 de junio de 2009, solicitaron ante la Oficina de Gestión Ambiental de la Municipalidad recurrida (sic), una copia del informe rendido sobre el estudio efectuado en el cordón de caño en cuestión y el vertido de aguas negras. Sin embargo, acusaron que, a la fecha, dicha información no les ha sido proporcionada. Estimaron vulnerado lo dispuesto en los artículos 30 y 50 de la Constitución Política. Solicitaron que se declare con lugar el recurso planteado.
  2. 2Mediante el voto interlocutorio No. 12062-09 de las 13:46 hrs. de 31 de julio de 2009 (visible a folios 14-16), este Tribunal Constitucional rechazó parcialmente el presente recurso de amparo.
  3. 3Por resolución de las 14:40 hrs. de 6 de agosto de 2009 (visible a folios 17-19), se le dio curso al proceso y se requirieron los informes a las autoridades recurridas.
  4. 4Por escrito recibido en la Secretaría de la Sala, mediante el sistema de fax, a las 05:22 hrs. de 12 de agosto de 2009 (visible a folios 23-25), Ezequías Antonio Loría Muñoz y Argentina Arias Ballestero, solicitaron que se les tuviera como coadyuvantes activos del presente proceso de amparo. En ese sentido, adujeron que habitan en la calle que viene de norte a sur, concretamente, 175 metros al sur del Hospital Max Peralta. Indicaron, que, igualmente, están siendo afectados por los olores provenientes del caño referido por los recurrentes. Sostuvieron, que esa grave contaminación es provocada por los desechos que se vierten en ese caño, sea, desechos hospitalarios y aguas negras. Indicaron, que el problema se presenta, dado que, hay 400 metros de caño que se encuentra al descubierto. Estimaron, que la Municipalidad recurrida debería de realizar obras como la construcción de un “sobrecaño”, tal y como se efectuó al costado del centro médico citado para evitar los malos olores.
  5. 5Informó bajo juramento, Rolando Alberto Rodríguez Brenes, en su condición de Alcalde de la Municipalidad de Cartago (visible a folios 30-36), de conformidad, a su vez, con lo señalado en el informe No. AOP-343-2009 de fecha 17 de agosto de 2009, emitido por el Encargado del Área de Operaciones de esa corporación. Indicó, que el recurrente, en el mes de mayo de 2009, presentó ante esa Alcaldía, una queja por presuntos olores nauseabundos en el cordón de caño que baja por el costado este del Hospital Max Peralta, la cual, a su vez, fue trasladada al responsable del Departamento de Alcantarillado Sanitario. El citado encargado elaboró un informe en el cual indicó que se había puesto en contacto con el recurrente Loría Arias quien le manifestó que “(…) el mal olor se da en algunas ocasiones y que ocurre en horas de la madrugada (…)”. Manifestó, que el citado funcionario visitó la casa de habitación del recurrente, en donde sus padres le indicaron que “(…) el fenómeno tiene bastante tiempo que NO se presenta (…)”.Indicó, que, adicionalmente, en aquel tiempo, como medida preventiva, se planteó la necesidad de reacondicionar la tapa de sello de un pozo de registro de aguas negras ubicada cincuenta metros al norte de la casa del amparado. Señaló, que de lo anterior, el encargado del alcantarillado sanitario emitió un informe el 3 de julio de 2009, en el cual señala las obras de reforzamiento y eliminación de tapa de concreto –cambio de plástico termoformado-, en el pozo de registro citado. Apuntó, que en ese informe se hace mención a la visita de campo realizada al sitio con el Técnico del Ministerio de Salud a fin que pudiera constatar que no existía ninguna anomalía. Incluso, apuntó que dicho funcionario manifestó que le parecía excelente la reparación que se le hizo al pozo de registro, la cual podría ser la causa de la evaporación de gases de la red sanitaria. Aclaró, que las fechas señaladas en dicho informe son del mes de junio y no de julio.Añadió, que el día 22 de junio de 2009, el tutelado presentó una nueva denuncia por contaminación ambiental de aguas negras a cielo abierto. Sin embargo, adujo que, para ese momento, ya se habían realizado acciones, sea, obras y la puesta en conocimiento del caso ante el Ministerio de Salud. Por consiguiente, afirmó que esa Municipalidad sí atiende las quejas de los recurrentes. Manifestó, que en el ya mencionado informe No. AOP-343-2009, consta, también, que los funcionarios municipales a cargo de la atención del caso en cuestión no han podido establecer de forma certera, la existencia de una descarga o presencia de desechos en el alcantarillado pluvial o bien, a cielo abierto, provenientes del costado este del Hospital Max Peralta. Reiteró, que el caso fue puesto en conocimiento del Ministerio de Salud, a efecto que dicho ente realizara las evaluaciones del caso. Indicó, que el Departamento de Alcantarillado Sanitario, con el apoyo de la Unidad Ambiental y personeros del Ministerio de Salud, elaboraron desde días anteriores una encuesta o instrumento de opinión pública tendente a determinar si existen rebalses de aguas negras en la comunidad, concretamente, en los alrededores del referido nosocomio, Ruinas de Santiago Apóstol y edificio de los Tribunales de Justicia.Aseveró, que ese instrumento fue aplicado a personal, tanto de las clínicas médicas privadas ubicadas en las cercanías de la vivienda del recurrente, como a personal de la Dirección del Hospital Max Peralta. Agregó, que el 17 de agosto de 2009, a partir de las 11:00 hrs., el ingeniero municipal Andrés Fernández del Área de Operaciones Municipales, el Jefe de Alcantarillado Sanitario y el Inspector Encargado del Ambiente Humano del Área Rectora de Salud, realizaron una inspección en el sitio en cuestión y alrededores y visitaron recintos relacionados con la salud, verificando los permisos sanitarios de funcionamiento y el correcto funcionamiento de los sistemas de disposición y mecanismo de tratamiento de aguas residuales, sin hallarse ninguna anomalía. Solicitó que se desestime el recurso planteado.
  6. 6Informó bajo juramento, Luis Alberto Sanabria Varela, en su condición de Director del Área Rectora de Salud de Cartago del Ministerio de Salud (visible a folio 47), que según visitas efectuadas por ese Ministerio, no se ha corroborado la existencia del problema denunciado. Afirmó, que se ha establecido coordinación con personeros de la Municipalidad de Cartago a efecto de constatar en el campo si existe alguna situación particular que condicione un hecho como el denunciado. En todo caso, manifestó que el próximo 21 de agosto se aplicará un instrumento de opinión entre los vecinos de la comunidad afectada con la finalidad de establecer, de manera más certera, la verdad real de los hechos.
  7. 7Por escrito recibido en la Secretaría de la Sala a las 06:57 hrs. de 21 de agosto de 2009 (visible a folios 56-57), Ezequías Antonio Loría Muñoz y Argentina Arias Ballestero, se refirieron al informe rendido por el Alcalde Municipal de Cartago.
  8. 8Por resolución de las 09:19 hrs. de 21 de agosto de 2009 (visible a folio 58), este Tribunal Constitucional dispuso lo siguiente: “(…) Revisados los autos, se amplia el curso del presente proceso amparo para que LUIS ALBERTO SANABRIA VARELA, o quien en su lugar ocupe el cargo de DIRECTOR, así como FRANCISCO RODRÍGUEZ ALVARADO, o quien en su lugar ocupe el cargo de TÉCNICO DEL ÁREA DE GESTIÓN AMBIENTAL, AMBOS DEL ÁREA RECTORA DE SALUD DE CARTAGO, informen a esta Sala, en el plazo de DOS DÍAS, contado a partir de la notificación de esta resolución, sobre lo adicionalmente alegado por los recurrentes Loría Arias y Soto Ramírez, en resumen: Que desde el día 17 de junio de 2009 se le solicitó a Rodríguez Alvarado, Técnico del Área de Gestión Ambiental del Área Rectora de Salud recurrida, una copia “(…) del informe rendido sobre el estudio efectuado en su oportunidad, sobre el vertido de aguas negras en el cordón de caño que va a dar hacia el sur del Hospital Max Peralta (…)” (gestión con sello de recibido visible a folio 13). Que a la fecha de interpuesto el amparo, dicha información no les había sido proporcionada. Que dicha actuación vulnera lo dispuesto por el numeral 30 constitucional (…)”.
  9. 9Por escrito recibido en la Secretaría de la Sala a las 18:17 hrs. de 21 de agosto de 2009 (visible a folios 59-64), los recurrentes se refirieron al informe rendido por las autoridades recurridas.
  10. 10Mediante libelo presentado a la Secretaría de la Sala a las 17:38 hrs. de 24 de agosto de 2009 (visible a folios 115-118), los amparados sostuvieron que el Alcalde Municipal falta a la verdad en el informe rendido a esta Sala.
  11. 11A través del memorial presentado en la Secretaría de la Sala a las 06:25 hrs. de 25 de agosto de 2009 (visible a folios 119-124), los tutelados se refirieron a las encuestas de opinión señaladas por las autoridades recurridas en sus informes.
  12. 12Por escrito recibido en la Secretaría de la Sala a las 19:02 hrs. de 28 de agosto de 2009 (visible a folios 135-136), el recurrente Loría Arias se refirió a lo discutido por el Concejo Municipal de Cartago en la Sesión Ordinaria celebrada el 18 de agosto del presente año, con respecto al problema de aguas negras que existe en el cantón central de esa provincia.
  13. 13Informó bajo juramento, José Francisco Rodríguez, en su condición de Técnico de Gestión Ambiental del Área Rectora de Salud de Cartago (visible a folios 155-156), que el 11 de agosto de 2009 el recurrente se hizo presente a dicha Área, donde fue atendido por el Director y el Coordinador de Regulación, quienes le brindaron una explicación relacionada con las labores realizadas con ocasión de la denuncia presentada. En consecuencia, sostuvo que no hubo necesidad alguna de enviar el informe en cuestión al interesado. Reiteró, que según inspecciones realizadas en consuno con la Municipalidad de Cartago, no se ha corroborado aún la existencia del problema denunciado.
  14. 14Mediante escrito recibido en la Secretaría de la Sala a las 13:09 hrs. de 1° de septiembre de 2009 (visible a folios 161-164), los recurrentes se refirieron a lo acontecido con algunos documentos aportados por las partes recurridas a los autos.
  15. 15A través del libelo recibido en la Secretaría de la Sala a las 06:25 hrs. de 3 de septiembre de 2009 (visible a folios 166-169), los interesados se manifestaron sobre el informe de ampliación rendido por el Técnico de Gestión Ambiental del Área Rectora de Salud de Cartago. En ese sentido, adujeron que, a la fecha, el informe de aguas negras bajo estudio no les había sido proporcionado.
  16. 16El Director del Área Rectora de Salud, no rindió el informe requerido mediante resolución de las 09:19 hrs. de 21 de agosto de 2009 (constancia visible a folio 180).
  17. 17Por escrito recibido en la Secretaría de la Sala, mediante el sistema de fax, a las 18:56 hrs. de 14 de septiembre de 2009 (visible a folios 182-185), los recurrentes se refirieron, nuevamente, a los informes rendidos por las autoridades recurridas.
  18. 18En la substanciación del proceso se han observado las prescripciones de ley.

Redacta el Magistrado Araya García; y,

CONSIDERANDO:

I. SOBRE LA SOLICITUD DE COADYUVANCIA

Mediante escrito visible a folios 23-25, Ezequías Antonio Loría Muñoz y Argentina Arias Ballestero, solicitaron que les tuviera como coadyuvantes activos en el presente proceso. Sobre este particular, el numeral 34, párrafo 3°, de la Ley de la Jurisdicción Constitucional, estipula que quien posea un interés legítimo en el proceso puede intervenir, sea en su perfil activo o pasivo, como coadyuvante. En el caso concreto, según lo indicado por los gestionantes, los desechos vertidos al costado este del Hospital Max Peralta y los consecuentes malos olores que allí se producen, igualmente, los afecta, pues habitan 175 metros al sur de ese nosocomio. En consecuencia, en virtud de lo dispuesto en la norma de rito supra señalada, así como en el artículo 50 constitucional, resulta admisible la solicitud de coadyuvancia activa.

II. OBJETO DEL RECURSO

Los recurrentes aducen vulnerado su derecho a disfrutar de un ambiente sano y ecológicamente equilibrado, dado que, según su dicho, las autoridades recurridas, a la fecha y, a pesar de las solicitudes planteadas en ese sentido, no han realizado las gestiones necesarias a efecto de mitigar la contaminación y malos olores que produce el depósito de todo tipo desechos que se lleva a cabo en el costado este del Hospital Max Peralta de Cartago, los cuales, además, recorren el cordón del caño hacia el sur hasta llegar a su casa de habitación. Asimismo, acusan quebrantado su derecho de acceso a la información administrativa, por cuanto, las autoridades del Área Rectora de Salud de Cartago negaron proporcionarles un informe, requerido desde el 17 de junio de 2009, referente a un estudio realizado con ocasión de la problemática en cuestión.

III. HECHOS PROBADOS

De relevancia para dirimir el presente recurso de amparo, se tienen por acreditados los siguientes:

  • 1)Desde el mes de abril de 2004, a la fecha, los recurrentes han denunciado ante la Municipalidad y ante el Área Rectora de Salud, ambas de Cartago, el presunto problema de contaminación y malos olores producido por el vertido de todo tipo de desechos al costado este del Hospital Max Peralta (visible a folios 7-11, 30-39 e informe visible a folio 30).
  • 2)El 17 de junio de 2009, el recurrente Loría Arias le solicitó al encargado del Departamento de Gestión Ambiental del Área Rectora de Salud de Cartago, una copia “(…) del informe rendido sobre el estudio efectuado en su oportunidad, sobre el vertido de aguas negras en el cordón de caño que va a dar hacia el sur del Hospital Max Peralta (…)”. (visible a folio 13).
  • 3)El 19 de junio de 2009, los encargados del Alcantarillado Sanitario de la Municipalidad de Cartago “reacondicionaron la tapa de sello” de un pozo de registro de aguas negras ubicado 50 metros al norte de la casa de habitación del recurrente. En dicha oportunidad, se procedió a sustituir la tapa de concreto por un “flanger” plástico (informe visible a folio 31 y a folio 43).
  • 4)El 22 de junio de 2009, el amparado presentó una nueva denuncia por contaminación ante la corporación municipal recurrida (informe visible a folio 32).
  • 5)El 26 de junio de 2009, un Técnico del Ministerio de Salud fiscalizó y aprobó la obra llevada a cabo el 19 de junio de ese mismo año (informe visible a folio 31 y a folio 43).
  • 6)El 19 de julio de 2009, los interesados interpusieron el presente proceso de amparo (visible a folio 1).
  • 7)El 13 de agosto de 2009, las autoridades recurridas fueron notificadas del amparo (actas visibles a folios 27-28).
  • 8)El 17 de agosto de 2009, las autoridades recurridas realizaron, conjuntamente, una inspección en el lugar de los hechos denunciados y en dos clínicas privadas cercanas a éste, verificando que poseyeran los respectivos permisos sanitarios, así como que se diera un correcto funcionamiento de los sistemas y mecanismos de tratamiento de aguas residuales (informe visible a folio 34 y a folios 40 y 52).
  • 9)Mediante los oficios Nos. AOP-343-2009 de 17 de agosto y ARSC-R-201-09 de 18 de agosto de 2009, el Encargado del Área de Operaciones de la Municipalidad recurrida y el Técnico de Gestión Ambiental del Área Rectora de Salud de Cartago, respectivamente, reconocieron no haberse podido establecer, de forma certera, la “(…) existencia de una descarga o presencia de desechos en el alcantarillado pluvial o bien a cielo abierto provenientes del Hospital Max Peralta Jiménez (…)”. (informe visible a folios 32-33 y a folios 39 y 51).
  • 10)A la fecha de rendido el informe de ampliación por el Técnico de Gestión Ambiental del Área Rectora de Salud de Cartago, sea, el 31 de agosto de 2009, la copia del informe requerido por el tutelado el 17 de junio de ese mismo año, no le había sido aún proporcionada (informe visible a folios 155-156 y a folio 167).

IV. HECHO NO PROBADO

De relevancia para dirimir el presente recurso de amparo, se tiene por indemostrado el siguiente: Único.- Que las autoridades recurridas hayan descartado, entre otras cosas, que al costado este del Hospital Max Peralta de Cartago no se depositen todo tipo de desechos que produzcan contaminación y malos olores, los cuales, además, recorren el cordón del caño hacia el sur (los autos).

V. SOBRE EL DERECHO A UN AMBIENTE SANO Y ECOLÓGICAMENTE EQUILIBRADO

A partir de lo dispuesto en los artículos 21, 50 y 89 de la Constitución Política, este Tribunal Constitucional ha reconocido, ampliamente, el deber del Estado de proteger el derecho a disfrutar de un ambiente sano y ecológicamente equilibrado. Es a tenor de dichos numerales, así como de la normativa infraconstitucional ambiental, que nace la responsabilidad del Estado de ejercer una función tutelar y rectora en esta materia. En este sentido, esta Sala, en el Voto No. 4830-02 de las 16:00 hrs. de 21 de mayo de 2002, señaló lo siguiente:

"(…) Nuestra Constitución Política, en su artículo 50, reconoce expresamente el derecho de todos los habitantes presentes y futuros de este país, de disfrutar de un medio ambiente saludable y en perfecto equilibrio. El cumplimiento de este requisito es fundamental garantía para la protección de la vida y la salud públicas, no sólo de los costarricenses, sino además de todos los miembros de la comunidad mundial. La violación a estos fundamentales preceptos conlleva la posibilidad de lesión o puesta en peligro de intereses a corto, mediano y largo plazo. La contaminación del medio es una de las formas a través de las cuales puede ser rota la integridad del ambiente, con resultados la mayoría de las veces imperecederos y acumulativos. El Estado costarricense se encuentra en la obligación de actuar preventivamente evitando -a través de la fiscalización y la intervención directa- la realización de actos que lesionen el medio ambiente, y en la correlativa e igualmente ineludible prohibición de fomentar su degradación (…)”.

Asimismo, recientemente, este Tribunal, en el Voto No. 17552-07 de las 12:22 hrs. de 30 de noviembre de 2007, dispuso lo siguiente “(…) El artículo 50 citado, también perfila el Estado Social de Derecho, por lo que podemos concluir que la Constitución Política enfatiza que la protección del ambiente es un mecanismo adecuado para tutelar y mejorar la calidad de vida de todos, lo que hace necesaria la intervención de los Poderes Públicos sobre los factores que pueden alterar su equilibrio y obstaculizar que la persona se desarrolle y desenvuelva en un ambiente sano. La incidencia que tiene el derecho a un ambiente sano y ecológicamente equilibrado dentro de la actividad del Estado, encuentra su primera razón de ser, en que por definición, los derechos no se limitan a la esfera privada de los individuos, sino que tienen asimismo trascendencia en la propia estructura del Estado, en su papel de garante de los mismos y, en segundo término, porque la actividad del Estado se dirige hacia la satisfacción de los intereses de la colectividad.

En la jurisprudencia constitucional el concepto de "ambiente", no ha sido limitado a los elementos primarios de la naturaleza, sea el suelo, el aire, el agua, los recursos marinos y costeros, los minerales, los bosques, la diversidad biológica en la flora y fauna, y el paisaje; a partir de los cuales se conforma el marco ambiental sin el cual las demandas básicas -como la alimentación, energía, vivienda, sanidad y recreación- serían imposibles. Es importante resaltar que este término se ha entendido de una manera más integral, estableciéndose un concepto "macro-ambiental", al comprender también aspectos referentes a la economía, a la generación de divisas a través del turismo, la explotación agrícola y otros: "Por lo anterior, el Derecho Ambiental no debe asociarse sólo con la naturaleza, pues ésta es únicamente parte del ambiente. La política de protección a la naturaleza se vierte también sobre otros aspectos como la protección de la caza, de los bosques, de los parques naturales y de los recursos naturales. Se trata, entonces, de un concepto macro-ambiental, para no dejar conceptos importantes por fuera y así lograr unificar el conjunto jurídico que denominamos Derecho Ambiental (…)”.

Finalmente, cabe señalar que esta Sala, como garante de los derechos fundamentales, se erige como un contralor del cumplimiento de las obligaciones que derivan de lo dispuesto en los artículos 21 y 50 constitucionales, los cuales constriñen al Estado no sólo a reconocer los derechos señalados, sino, además, a utilizar los medios material y jurídicamente legítimos para garantizarlos.

VI. ORIGEN, CONTENIDO Y ALCANCE DEL PRINCIPIO PRECAUTORIO

Sobre este principio, en el Voto No. 17747-06 de las 14:37 hrs. de 11 de diciembre de 2006, con redacción del Magistrado Jinesta Lobo, se consideró lo siguiente:

"(...) El principio precautorio, desde su origen, tiene en consideración la falibilidad de la comprensión humana y la posibilidad de cometerse errores. En la segunda mitad de la década de los 70 del siglo pasado el gobierno federal de Alemania enunció el principio "Vorsorgeprinzip", al indicar que "no se consolida totalmente una política ambiental sólo mediante la eliminación de los peligros inminentes y la reparación del daño ocurrido. Una política ambiental precautoria requiere además que los recursos naturales sean protegidos y que las demandas sobre los mismos se manejen con cuidado" habiéndolo empleado para justificar la implementación de políticas contra la lluvia ácida y la contaminación del Mar del Norte. El principio aparece en el escenario internacional con los Tratados del Mar del Norte (Declaraciones de Bremen 1984, Londres 1987, Den Haag 1990 y Esbjerg 1995). Así, en la Declaración de Bremen de 1984 (Primera Conferencia Internacional sobre Protección del Mar del Norte) se refiere la necesidad de adoptar medidas preventivas oportunas ante el nivel insuficiente de los conocimientos. Posteriormente, en la Declaración de Londres de 1987 (Segunda Conferencia Internacional sobre la Protección del Mar del Norte), se proclamó el principio para salvaguardar el ecosistema del Mar del Norte a través de la reducción de emisiones contaminantes de sustancias que son persistentes, tóxicas y susceptibles de acumulación en la fuente, mediante el uso de la mejor tecnología disponible y otras medidas apropiadas. Opción que resultaría de especial aplicación cuando mediara razón para presumir que tales sustancias pueden causar algún daño o efectos nocivos en los recursos marinos vivos, junto cuando no haya evidencia científica que pruebe el vínculo entre las emisiones y los efectos (principio de acción precautoria). En esta última declaración se dispuso que "(…) es necesario un criterio de precaución que pueda exigir la adopción de medidas (…) incluso antes de que se haya establecido una relación causal mediante pruebas científicas absolutamente manifiestas (…)". Con posterioridad, el principio es recogido en diversos tratados multilaterales y declaraciones internacionales tales como el Protocolo de Montreal sobre sustancias que debilitan la capa de ozono de 1987, la Declaración de Bergen sobre el Desarrollo Sustentable en la región de la CEE adoptada por los representantes de países europeos y Canadá de 1990, el Convenio sobre la Diversidad Biológica de 1992, el Convenio Marco de Cambio Climático de 1992, el Tratado de la Unión Europea de 1992, el Convenio para la Protección del Medio Ambiente Marino del Atlántico Nororiental de 1992, el Convenio de Helsinki sobre protección del medio ambiente marino en el Báltico de 1994, Acuerdo sobre la Aplicación de Medidas Sanitarias y Fitosanitarias (Acuerdos MSF) de la Organización Mundial del Comercio (OMC) de 1994, el Programa de Acción de Washington para la Protección del Medio Marino de las actividades realizadas en Tierra de 1995, el Convenio de Londres sobre vertimientos al Mar, originalmente de 1992, en virtud de una enmiendas adoptadas en 1997 para la protección del ecosistema marino y el Protocolo de Naciones Unidas sobre Seguridad de la Biotecnología del Convenio sobre la Diversidad Biológica de Montreal en el 2000, el Protocolo de Cartagena de Bioseguridad de 2000 y la Comunicación de la Unión Europea sobre el Principio Precautorio de 2000. Del mismo modo, el principio precautorio rápidamente asumió un enfoque general -que incluye los recursos naturales, ecosistemas, sector pesquero y forestal y la diversidad biológica- y no sólo circunscrito a las sustancias tóxicas. Así en la Declaración de Bergen (1990) se indico que "Cuando haya amenazas de daño serio o irreversible, la falta de certeza científica absoluta no debe usarse como razón para posponer la adopción de medidas que prevengan la degradación ambiental". Del mismo modo, la Declaración de Río sobre el Medio Ambiente y el Desarrollo (3-14 junio de 1992), en su principio 15, dispuso lo siguiente: "Con el fin de proteger el medio ambiente, los Estados deberán aplicar ampliamente el criterio de precaución conforme a sus capacidades. Cuando haya peligro de daño grave o irreversible, la falta de certeza científica absoluta no deberá utilizarse como razón para postergar la adopción de medidas eficaces en función de los costos para impedir la degradación del medio ambiente". Es así como el principio precautorio adquirió, incluso, una dimensión ética - de la ciencia y tecnología- que orienta las políticas ambientales, de salud, comercio, seguridad alimentaria y, en general, de desarrollo sostenible de los Estados. Pese al halo de incertidumbre que existe al definir o conceptuar el principio precautorio, desde una perspectiva general, impone que cuando los riesgos ambientales son inciertos, imprevisibles y no desatendibles por una omisión o inacción de regulación ésta resulta injustificada. Dicho simplemente, la suma de un estado de incertidumbre científica o tecnológica -ante la carencia, insuficiencia o inadecuación de la información y conocimientos científicos disponibles acerca de la causalidad, magnitud, probabilidad y naturaleza de la lesión- y la posibilidad o amenaza de un eventual daño serio e irreversible es igual o debe ser equivalente a una acción precautoria o anticipada, la que puede tener por contenido, incluso, la prohibición o eliminación de determinados productos, actividades o sustancias. Lo anterior supone una evaluación objetiva del riesgo y de la relación costo-beneficio de la omisión o acción precautoria a la luz de la evidencia científica disponible que permita concluir que ésta es insuficiente, ausente o inadecuada, de modo que el principio precautorio no puede justificar la adopción de medidas arbitrarias y eventualmente discriminatorias. De otra parte, la aplicación del principio precautorio no supone una fosilización del estado de cosas vigente, al momento de adoptar las acciones pertinentes, que impida el progreso y la innovación, puesto que, las medidas de intervención o restricción deben mantenerse vigentes en tanto la información científica sea incompleta o no concluyente y el riesgo de lesión sea serio e irreversible, por lo que admiten su revisión periódica a la luz del progreso científico. Asimismo, al disponerse las medidas de restricción o intervención se debe respetar el principio de proporcionalidad, de modo que sean proporcionadas al nivel de protección y a la magnitud del daño potencial o eventual. El principio precautorio tiene sustento en que el medio ambiente y los ecosistemas no tienen la capacidad de asimilar o resistir ciertas actividades, productos o sustancias, de modo que busca anticiparse al daño y proteger la salud humana y el medio ambiente (...)".

VII. ACERCA DE LA VIOLACIÓN AL ARTÍCULO 50 CONSTITUCIONAL EN EL CASO CONCRETO

En el presente asunto, los tutelados alegan vulnerado su derecho a disfrutar de un ambiente sano y ecológicamente equilibrado, dado que, según su dicho, las autoridades recurridas, a la fecha y, a pesar de las solicitudes planteadas en ese sentido, no han realizado las gestiones necesarias a efecto de mitigar la contaminación y malos olores que produce el depósito de todo tipo de desechos que se lleva a cabo en el costado este del Hospital Max Peralta de Cartago, los cuales, además, recorren el cordón del caño hacia el sur hasta llegar a su casa de habitación. Sobre el particular, este Tribunal Constitucional estima que llevan razón los recurrentes en su alegato. Lo anterior, en primer término, por cuanto, de la prueba allegada a los autos, se tiene plena e idóneamente acreditado que aún cuando desde abril de 2004 se denunció la situación en cuestión ante la Municipalidad y el Área Rectora de Salud, ambas de Cartago, no fue sino hasta el mes de junio del año en curso -luego de transcurridos más de 5 años-, que las autoridades recurridas dispusieron realizar algún tipo de acciones, concretamente, el cambio de una tapa de un pozo de registro de aguas negras ubicado 50 metros al norte de la casa de habitación del recurrente Loría Arias, así como, en el mes de agosto -con ocasión del amparo-, una inspección en el lugar denunciado y en algunas clínicas privadas cercanas a efecto de verificar si contaban con los respectivos permisos sanitarios y funcionaban correctamente los mecanismos de tratamiento de aguas residuales.

Acciones que, además, demostraron no ser relevantes, de modo alguno, para atender la problemática denunciada. Esto, si se toma en consideración que este Tribunal Constitucional no tuvo, paralelamente, por acreditado, que las autoridades recurridas hayan logrado descartar, efectivamente, que en los lugares alegados por los recurrentes no se existan desechos que produzcan contaminación y malos olores. Lo anterior, toda vez que, en los autos constan informes suscritos por los funcionarios de ambas entidades encargados de atender las denuncias mencionadas, donde afirman no haberse podido establecer, de forma certera, la “(…) existencia de una descarga o presencia de desechos en el alcantarillado pluvial o bien a cielo abierto provenientes del Hospital Max Peralta Jiménez (…)”. Posición que, incluso, reafirma el Director del Área Rectora de Salud de Cartago al indicar, expresamente, en su informe que no se ha logrado corroborar la existencia del problema denunciado, por lo que, dispondrá la realización de algunas medidas en ese sentido.

Bajo tal orden de consideraciones, nos encontramos frente a un claro e indubitable estado de incertidumbre científico y técnico en punto a los riesgos y contaminación ambiental que pueda ocasionar el presunto depósito de desechos que se realiza al costado este del Hospital Max Peralta de Cartago. Situación anterior que impone, inevitablemente, aplicar el principio precautorio arriba señalado y, en ese particular, declarar con lugar el recurso planteado, en lo que a este extremo se refiere, en virtud de lo dispuesto en el numeral 50 de la Constitución Política.

VIII. EL DERECHO DE ACCESO A LA INFORMACIÓN ADMINISTRATIVA

Este Tribunal Constitucional, con redacción del Magistrado Jinesta Lobo, en la sentencia No. 02120-03 de las 13:30 hrs. del 14 de marzo del 2003, estimó lo siguiente:

“(…) I.- TRANSPARENCIA Y PUBLICIDAD ADMINISTRATIVAS. En el marco del Estado Social y Democrático de Derecho, todos y cada uno de los entes y órganos públicos que conforman la administración respectiva, deben estar sujetos a los principios constitucionales implícitos de la transparencia y la publicidad que deben ser la regla de toda la actuación o función administrativa. Las organizaciones colectivas del Derecho Público –entes públicos- están llamadas a ser verdaderas casas de cristal en cuyo interior puedan escrutar y fiscalizar, a plena luz del día, todos los administrados. Las administraciones públicas deben crear y propiciar canales permanentes y fluidos de comunicación o de intercambio de información con los administrados y los medios de comunicación colectiva en aras de incentivar una mayor participación directa y activa en la gestión pública y de actuar los principios de evaluación de resultados y rendición de cuentas actualmente incorporados a nuestro texto constitucional (artículo 11 de la Constitución Política).

Bajo esta inteligencia, el secreto o la reserva administrativa son una excepción que se justifica, únicamente, bajo circunstancias calificadas cuando por su medio se tutelan valores y bienes constitucionalmente relevantes. Existen diversos mecanismos para alcanzar mayores niveles de transparencia administrativa en un ordenamiento jurídico determinado, tales como la motivación de los actos administrativos, las formas de su comunicación –publicación y notificación-, el trámite de información pública para la elaboración de los reglamentos y los planes reguladores, la participación en el procedimiento administrativo, los procedimientos de contratación administrativa, etc., sin embargo, una de las herramientas más preciosas para el logro de ese objetivo lo constituye el derecho de acceso a la información administrativa.

II. EL DERECHO DE ACCESO A LA INFORMACIÓN ADMINISTRATIVA

El ordinal 30 de la Constitución Política garantiza el libre acceso a los “departamentos administrativos con propósitos de información sobre asuntos de interés público”, derecho fundamental que en la doctrina se ha denominado derecho de acceso a los archivos y registros administrativos, sin embargo, la denominación más acertada es la de derecho de acceso a la información administrativa, puesto que, el acceso a los soportes materiales o virtuales de las administraciones públicas es el instrumento o mecanismo para alcanzar el fin propuesto que consiste en que los administrados se impongan de la información que detentan aquéllas. Es menester indicar que no siempre la información administrativa de interés público que busca un administrado se encuentra en un expediente, archivo o registro administrativo. El derecho de acceso a la información administrativa es un mecanismo de control en manos de los administrados, puesto que, le permite a éstos, ejercer un control óptimo de la legalidad y de la oportunidad, conveniencia o mérito y, en general, de la eficacia y eficiencia de la función administrativa desplegada por los diversos entes públicos.

Las administraciones públicas eficientes y eficaces son aquellas que se someten al control y escrutinio público, pero no puede existir un control ciudadano sin una adecuada información. De este modo, se puede establecer un encadenamiento lógico entre acceso a la información administrativa, conocimiento y manejo de ésta, control ciudadano efectivo u oportuno y administraciones públicas eficientes. El derecho de acceso a la información administrativa tiene un profundo asidero en una serie de principios y valores inherentes al Estado Social y Democrático de Derecho, los cuales, al propio tiempo, actúa. Así, la participación ciudadana efectiva y directa en la gestión y manejo de los asuntos públicos resulta inconcebible si no se cuenta con un bagaje importante de información acerca de las competencias y servicios administrativos, de la misma forma, el principio democrático se ve fortalecido cuando las diversas fuerzas y grupos sociales, económicos y políticos participan activa e informadamente en la formación y ejecución de la voluntad pública.

Finalmente, el derecho de acceso a la información administrativa es una herramienta indispensable, como otras tantas, para la vigencia plena de los principios de transparencia y publicidad administrativas. El contenido del derecho de acceso a la información administrativa es verdaderamente amplio y se compone de un haz de facultades en cabeza de la persona que lo ejerce tales como las siguientes: a) acceso a los departamentos, dependencias, oficinas y edificios públicos; b) acceso a los archivos, registros, expedientes y documentos físicos o automatizados –bases de datos ficheros-; c) facultad del administrado de conocer los datos personales o nominativos almacenados que le afecten de alguna forma, d) facultad del administrado de rectificar o eliminar esos datos si son erróneos, incorrectos o falsos; e) derecho de conocer el contenido de los documentos y expedientes físicos o virtuales y f) derecho de obtener, a su costo, certificaciones o copias de los mismos.

III. TIPOLOGIA DEL DERECHO DE ACCESO A LA INFORMACIÓN ADMINISTRATIVA

Se puede distinguir con claridad meridiana entre el derecho de acceso a la información administrativa (a) ad extra –fuera- y (b) ad intra –dentro- de un procedimiento administrativo. El primero se otorga a cualquier persona o administrado interesado en acceder una información administrativa determinada –uti universi- y el segundo, únicamente, a las partes interesadas en un procedimiento administrativo concreto y específico –uti singuli-. Este derecho se encuentra normado en la Ley General de la Administración Pública en su Capítulo Sexto intitulado “Del acceso al a 274 (…)”.

IX. TOCANTE A LA VULNERACIÓN DEL NUMERAL 30 DE LA CONSTITUCIÓN POLÍTICA EN EL CASO CONCRETO

De otra parte, de los hechos que constan en autos se encuentra plenamente acreditado -en claro quebranto al derecho de acceso a la información administrativa-, que, a la fecha de rendido el informe de ampliación requerido al Técnico de Gestión Ambiental del Área Rectora de Salud de Cartago, sea, el 31 de agosto de 2009, la copia del informe solicitado por el tutelado el 17 de junio de ese mismo año, no le había sido aún brindada. Informe que, en criterio de esta Sala, reviste un claro e inequívoco interés público, por cuanto, está referido a un estudio efectuado sobre el vertido de aguas negras en el cordón de caño que va a dar hacia el sur del Hospital Max Peralta, el que, a su vez, sin duda alguna, se encuentra relacionado, íntimamente, con el derecho a un ambiente sano y ecológicamente equilibrado. Así las cosas, este Tribunal estima que, en la especie, se ha quebrantado el derecho fundamental del tutelado Loría Arias consagrado en el numeral 30 de la Constitución Política.

X. COROLARIO

En mérito de lo expuesto, se impone declarar con lugar el recurso planteado, con las consecuencias que se detallarán en la parte dispositiva de la presente sentencia.

POR TANTO:

Se declara con lugar el recurso. En consecuencia, se le ordena a Rolando Alberto Rodríguez Brenes, o a quien en su lugar ocupe el cargo de Alcalde de la Municipalidad de Cartago y a Luis Alberto Sanabria Valera, o a quien en su lugar ocupe el cargo de Director del Área Rectora de Salud de Cartago que, DE MANERA INMEDIATA, giren las órdenes y tomen las medidas pertinentes que estén dentro del ámbito de su competencia a efecto de descartar, efectivamente -a través de inspecciones y los estudios necesarios-, que al costado este del Hospital Max Peralta de Cartago se depositan desechos que producen contaminación y malos olores, los cuales, además, recorren el cordón del caño hacia el sur. En caso que dicha contaminación se acredite, se le ordena a tales autoridades realizar, inmediatamente, las obras que sean necesarias para erradicarla, de manera definitiva. Asimismo, se le ordena a Luis Alberto Sanabria Valera, o a quien en su lugar ocupe el cargo de Director y a José Rodríguez, o a quien en su lugar ocupe el cargo de Técnico de Gestión Ambiental, ambos de Área Rectora de Salud de Cartago, que DE MANERA INMEDIATA, le proporcionen al recurrente Rodrigo Loría Arias, la información requerida el día 17 de junio de 2009, a costa de éste.

Se advierte a los recurridos que, de conformidad con lo establecido en el artículo 71 de la Ley de la Jurisdicción Constitucional, se impondrá prisión de tres meses a dos años, o de veinte a sesenta días multa, a quien recibiere una orden que deba cumplir o hacer cumplir, dictada en un recurso de amparo y no la cumpliere o no la hiciere cumplir, siempre que el delito no esté más gravemente penado. Se condena al Estado y a la Municipalidad de Cartago, al pago de las costas, daños y perjuicios causados con los hechos que sirven de fundamento a esta declaratoria, los que se liquidarán en ejecución de sentencia de lo contencioso administrativo. Notifíquese esta resolución a Rolando Alberto Rodríguez Brenes, o a quien en su lugar ocupe el cargo de Alcalde de la Municipalidad de Cartago, a Luis Alberto Sanabria Valera, o a quien en su lugar ocupe el cargo de Director y a José Rodríguez, o a quien en su lugar ocupe el cargo de Técnico de Gestión Ambiental, ambos de Área Rectora de Salud de Cartago, en forma personal.
