Constitutional challenge (acción de inconstitucionalidad) brought by Guido Cubero Arce, of legal age, married, attorney, resident of San José, holder of identity card number 3- 220-312, against Articles 3, 4, 5, and 7 of Decree number 34043-MINAE, on the grounds that they are contrary to Articles 50, 10, 11, 28, 140 subsections 3, 18, and 20, 7, 48, 69, and 89 of the Political Constitution. The representative of the Procuraduría General de la República and the Ministro de Ambiente y Energía also participated in the proceedings.
Background:
Drafted by Justice Cruz Castro; and,
Considering:
A.- PROCEDURAL MATTERS AND ADMISSIBILITY OF THE ACTION.
I.Subject matter of the challenge.- The petitioner challenges Articles 3, 4, 5 and 7 of Decreto número 34043-MINAE, published in La Gaceta número 202 of 22 de octubre de 2007, which provide:
“Article 3º—Article 6º of Decreto Nº 16614-MAG is hereby amended to read as follows: ‘Article 6: The urban areas that, according to studies conducted by the Instituto Nacional de Vivienda y Urbanismo, fall within the communities of Gandoca, Manzanillo and Puerto Viejo shall not be subject to the regulations of this Decree. Cases currently subject to judicial or administrative proceedings following reports by SINAC shall not benefit from this provision.’ Article 4º—The Sistema Nacional de Áreas de Conservación, jointly with the Municipalidad de Talamanca, shall be responsible for describing the urban areas; for this purpose, they are granted a non-extendable period of thirty calendar days from the publication of this Decree.
Article 5º—The zoning plan (plan regulador) for the areas remaining under municipal administration must be submitted to the Ministerio del Ambiente y Energía for approval.
(…)
Article 7º—Decreto Nº 32753 of 25 de noviembre de 2005 is hereby repealed.” The petitioner considers these provisions unconstitutional because: A) They violate the right to a healthy and ecologically balanced environment (Art.50), the conservation principle and the precautionary principle (principio precautorio) in environmental matters (Arts. 7 and 48), the principle of sustainable development and rational exploitation of natural resources (Art.69), and the right to scenic beauty and landscape, which encompasses the right to physical and mental health (Art.69). This is because the refuge’s marine area is being expanded while its terrestrial area is being reduced, as follows from Article 3° of the decree, thereby threatening natural resources because infrastructure and pollution of the soil, water, and other resources would increase. The petitioner also points to the contradiction between Article 3° and Article 4°: while the former states that INVU is responsible for defining urban areas, the latter refers to the Municipalidad and SINAC.
He likewise states that international provisions are violated because Costa Rica is required to report modifications that would affect a territory included on the list of wetlands of international importance. B) They violate the principle of legality and statutory reservation (reserva legal) (Arts.11 and 28) and the principle requiring implementation of statutes (Arts. 140, subsections 3, 18 and 20), because the decree contravenes higher-ranking laws such as the Ley Forestal and the Ley Orgánica del Ambiente, the Ramsar conventions, and others; moreover, it alters the boundaries by decree. In summary, as may be observed, all the claims of unconstitutionality may be divided into two groups: on the one hand, the possible violation of the environment through the reduction of the dimensions of the Refugio Nacional de Vida Silvestre Gandoca Manzanillo and, on the other, the possible violation of the principle of statutory reservation by reducing that protected wildland area (área silvestre protegida) through a decree rather than a statute. As judicial precedents, the petitioner cites decisions 2000-10466, 2002- 8321, 2003-03480, 2003-8742 and 2006-5975 of this Chamber.
II.Standing requirements in actions of unconstitutionality.- Article 75 of the Ley de la Jurisdicción Constitucional governs the prerequisites determining the admissibility of actions of unconstitutionality, requiring the existence of a matter pending resolution in administrative or judicial proceedings in which unconstitutionality has been invoked. This requirement is unnecessary in the cases provided for in the second and third paragraphs of that article, namely, when the nature of the provision precludes individual or direct injury; when the action is based on the defense of diffuse interests (intereses difusos); when it concerns interests affecting the community; or when it is filed by the Procurador General de la República, the Contralor General de la República, the Fiscal General de la República, or the Defensor de los Habitantes, in the latter cases within their respective spheres of authority.
Regarding the possibility of appearing in defense of “diffuse interests,” this Chamber has held that these are interests belonging to groups of persons who are not formally organized but are united by a particular social need, physical characteristic, ethnic origin, particular personal or ideological orientation, consumption of a certain product, etc. In such cases, the interest is dispersed, diluted (diffuse) among an unidentified plurality of persons. This Chamber has listed various rights that it has characterized as “diffuse,” including the environment, cultural heritage, protection of the country’s territorial integrity, sound management of public expenditure, and the right to health, among others.
III.The petitioner’s standing in this case.- Based on the preceding paragraph, it is clear that the petitioner has sufficient standing (legitimación) to seek a declaration that the challenged provisions are unconstitutional, without needing a prior proceeding to serve as the basis for this action. This is because he appears in defense of an interest affecting the national community as a whole, or a diffuse interest, namely the protection of the environment and its natural wealth. Precisely because environmental protection is at issue, this Chamber understands this to be an action seeking to protect interests affecting the national community as a whole; the petitioner therefore has full standing to bring the action directly under paragraph 2° of Article 75 of the Ley de la Jurisdicción Constitucional. Moreover, this is a matter whose constitutionality may properly be reviewed through these proceedings, and the requirements established in sections 78 and 79 of the applicable procedural law (Ley de rito) were satisfied. In conclusion, this action is admissible, and the subject matter and merits of the case must therefore be addressed immediately.
IV.Methodology for analyzing the action.- To facilitate examination of the challenged provisions, the following recitals (considerandos) will first analyze the background of the matter and then the arguments presented by the petitioner.
B.- BACKGROUND.
V.History of the executive decrees relating to the Refugio Nacional de Vida Silvestre Gandoca-Manzanillo (REGAMA) and the inclusion and exclusion of the so-called urban areas of Gandoca, Manzanillo and Puerto Viejo.- Through Decreto Ejecutivo N° 16614-MAG, of 1° de julio de 1985, published in La Gaceta N° 206, of 29 de octubre de 1985, the Refugio Nacional de Vida Silvestre Gandoca-Manzanillo was created, and its Article 6º established that the urban areas of Gandoca, Manzanillo and Puerto Viejo (as defined by INVU) would not be subject to the regulations of that decree. Article 6° subsequently underwent four amendments. First, (inclusion and expansion), through Article 16 of Decreto Ejecutivo N° 23069-MIRENEM, of 21 de marzo de 1994, published in La Gaceta N° 65 of 5 de abril de 1994, which declared access to the Playa Gandoca area restricted, the aforementioned Article 6º of Decreto Ejecutivo N° 16614-MAG was repealed, thereby nullifying the exclusion of the areas identified therein as urban from the application of the regulations governing the Refugio Nacional de Vida Silvestre; those areas were consequently understood to be included within the Refuge.
Second, (exclusion and reduction), through Decreto Ejecutivo N° 29019-MINAE, of 19 de setiembre del 2000, published in La Gaceta N° 208, of 31 de octubre del 2000, corresponding to the Reglamento para el Manejo Participativo de los Recursos Naturales en el Refugio de Vida Silvestre Gandoca-Manzanillo, Sector Gandoca, Decreto Ejecutivo N° 23069-MlRENEM was repealed in its entirety, whereupon Article 6º of Decreto Ejecutivo N° 16614-MAG again entered into force. This reduced the area of the Refugio Nacional de Vida Silvestre Gandoca–Manzanillo because the areas of Gandoca, Manzanillo and Puerto Viejo defined as urban were excluded. Third, (inclusion and expansion), through Article 2° of Decreto Ejecutivo no. 32753 of 16 de mayo del 2005, Article 6º of Decreto Ejecutivo N° 16614-MAG was repealed, once again nullifying the exclusion of the areas identified therein as urban from the application of the regulations governing the Refugio Nacional de Vida Silvestre and therefore subjecting them to regulation.
The Refuge was accordingly understood to have been expanded. Fourth, (exclusion and reduction), through Article 3° of Decreto Ejecutivo N°. 34043, published in La Gaceta número 202 of 22 de octubre de 2007, Article 6º of Decreto Ejecutivo N° 16614-MAG was amended and restored to legal effect, excluding the urban areas of the communities of Gandoca, Manzanillo and Puerto Viejo from the regulations of the Decree. In addition, Article 7° of the same Decreto N°. 34043 repealed Decreto Ejecutivo no. 32753 of 16 de mayo del 2005 in its entirety; that decree had recounted the history of Article 6° of Decreto Ejecutivo N° 16614-MAG and its reduction through Decreto Ejecutivo N° 29019-MINAE. The Refuge’s area was thus understood to have been reduced. As may be observed, the areas designated as urban in the communities of Gandoca, Manzanillo and Puerto Viejo have been included in and excluded from the Refugio Nacional de Vida Silvestre Gandoca-Manzanillo on several occasions through regulatory discretion.
VI.Expansion and reduction of protected wildland areas.- This Constitutional Court has already had occasion to address the constitutionality of including the urban areas of Gandoca, Manzanillo and Puerto Viejo within the Refugio Nacional de Vida Silvestre Gandoca-Manzanillo (REGAMA), in judgment number 2006-5975 of 3 de mayo de 2006, when it discussed the change corresponding to the second amendment—as stated in the preceding recital—:
“VII.- Expansion and reduction of protected wildland areas.
In the brief initiating the action of unconstitutionality, the petitioner challenges—and identifies as a ground of unconstitutionality—the repeal of Decreto 23069-MIRENEM by Decreto 29019-MINAE, because it tacitly reduced the extent of the Refugio de Vida Silvestre Gandoca-Manzanillo, since the former had expanded the Refuge’s boundaries.
Analyzing the decrees issued in connection with the Refugio Gandoca-Manzanillo, it can be seen that the Executive Branch has issued several decrees in an effort to regulate its status. To clarify the current situation, it is appropriate to review those related to the subject matter of this action. First, there is DE-16614-MAG of 29 de octubre de 1985, which created the Refugio Nacional de Vida Silvestre Gandoca-Manzanillo (REGAMA). The legal basis for the decree is specifically found in Article 2 of Ley N° 4465, but particularly in Article 18 of Ley N° 6919, Ley de Conservación de la Fauna Silvestre, which has since been repealed but at that time provided:
“Article 18.- National wildlife refuges (refugios nacionales de fauna silvestre) are those declared as such by the Executive Branch for the protection and study of wild flora and fauna, particularly those in danger of extinction. The Executive Branch is hereby authorized to establish, within forest reserves (reservas forestales) and on privately owned land, areas classified as national wildlife refuges, which, for purposes of wildlife conservation, shall remain under the administration of the Departamento de Vida Silvestre de la Dirección General Forestal del Ministerio de Agricultura y Ganadería.(…)” Article 6 of Decreto 16614-MAG expressly excluded the urban areas of Gandoca, Manzanillo and Puerto Viejo from that refuge. Subsequently, DE-23069-MIRENEM of 5 de abril de 1994 was issued; Article 16 of that Decree repealed Article 6 of DE-16614. The immediate consequence was that the urban areas of Gandoca, Manzanillo and Puerto Viejo became part of the Refugio Gandoca-Manzanillo.
Later, Decreto DE- 29019-MINAE of 31 de octubre del 2000 was issued, Article 8 of which repealed Decreto 23069-MIRENEM; as a result, Article 6 of DE-16614 implicitly regained effect. At that time, the territory of the reserve was implicitly reduced by once again excluding the urban areas of Gandoca, Manzanillo and Puerto Viejo, thereby restoring the situation provided for by Decreto N° 16614-MAG. Subsequently, however, the Executive Branch issued DE-32753-MINAE of 16 de mayo del 2005, which expressly repealed Article 6 of DE-16614; the urban areas of Gandoca, Manzanillo and Puerto Viejo once again became part of the Refugio Nacional de Vida Silvestre Gandoca-Manzanillo, a situation that remains in effect to date.
Regarding increases and/or reductions in the territorial boundaries of the forest estate (patrimonio forestal), this Court, in Judgment N° 1999-5399 at 16:39 hours on 26 de octubre de 1993, stated:
“…if the Executive Branch is empowered to establish the boundaries of its forest estate, it must do so through regulations rather than legislation, with due compensation for the properties over which the forest estate is extended, since, by virtue of Article 9 of the Constitution and the theory of separation of powers, the Legislative Assembly is the only constitutional body empowered to enact laws. Therefore, where public-domain property (bien demanial) is involved, it would be illogical to consider the State limited or prevented from acting to protect the flora and fauna of our lands.
II.In this regard, because this action is directed against an executive decree that expanded the boundaries of a national park—Isla del Coco—extending them fifteen kilometers into the sea, measured from the coastal low-tide line, it is important to determine that the Executive Branch did so in the full exercise of its legal and constitutional powers, since public-domain property is involved.(…)
V.With respect to the alleged violation of Article 3 of the Convenio para la protección de la flora, de la fauna y de las bellezas escénicas naturales de los países de América—approved by Ley número 3763, de primero de octubre de mil novecientos sesenta y seis—in conjunction with Article 7 of the Constitution, which, insofar as relevant, provides:
‘The Contracting Governments agree that the boundaries of national parks shall not be altered, nor shall any portion thereof be transferred, except by action of the competent legislative authority. The natural resources existing therein shall not be exploited for commercial purposes.
The Contracting Governments agree to prohibit the hunting, killing and capture of specimens of fauna and the destruction and collection of specimens of flora in national parks, except when carried out by park authorities, or by their order or under their supervision, or for duly authorized scientific research.’ Those provisions must be interpreted restrictively, such that the requirement that the boundaries of national parks be established by law applies only when the change is detrimental to the park—that is, when its area is to be reduced—and not when the boundaries of the protected zones (zonas protectoras) within the State’s forest estate are to be expanded. This article must be read together with Article 40 of the Ley Forestal, which provides:
‘The area of forest reserves, protected zones, national parks, wildlife refuges, and biological reserves within the forest estate may be reduced only by a law of the Republic, following the corresponding technical studies justifying that measure.’ This is so because the legally protected interest (bien jurídico) is the ‘forest resource,’ a term that ‘means the protection and preservation of the integrity of the natural environment,’ (Judgment of the Constitutional Chamber number 2233-93, at nine hours and thirty-six minutes on veintiocho de mayo) existing in the area declared a national park, which is recognized by international legislation, the special statutes enacted for that purpose, and the texts of political constitutions alike. In this regard, Article 69 of the Political Constitution refers to the ‘rational use of land,’ the protection of which constitutes a fundamental principle (…).” (boldface not in the original) It is therefore evident that the Executive Branch may not reduce the territorial boundaries of a protected wilderness area (área silvestre), but it may expand them.
Consequently, decrees whose repeal or entry into force has had the immediate effect of increasing the territory of a particular protected area are constitutional.” Two conclusions may be drawn from all of the foregoing. First, the boundaries of the protected zones within the State’s forest estate may be expanded by regulation, but they may be reduced only by statute, provided, of course, that there is a prior opinion justifying the measure. Second, the repeal of Article 6 of executive decree DE-16614, thereby including the urban areas of Gandoca, Manzanillo and Puerto Viejo, constituted an expansion of the territory of the Refugio Nacional de Vida Silvestre de Gandoca-Manzanillo; accordingly, excluding those areas from the territory of the refuge constitutes a reduction of its territory.
C.- ANALYSIS OF THE CLAIMS OF UNCONSTITUTIONALITY
VII.On the unconstitutionality of Articles 3, 4, 5 and 7 of Decreto n°34043-MINAE.- As explained above, when Article 6 of Decreto Ejecutivo, N° 16614-MAG was repealed (by Article 2 of Decreto Ejecutivo no. 32753 del 16 de mayo del 2005), the communities of Gandoca, Manzanillo and Puerto Viejo were included within the boundaries of the Refugio Nacional de Vida Silvestre Gandoca-Manzanillo. However, through Article 3 of the challenged Decree, which reinstated the repealed Article 6, the urban areas of those communities were once again excluded from the boundaries of the Refuge, thereby reducing its area. This situation violates not only the principle of statutory reservation (principio de reserva legal), but also the right to enjoy a healthy and ecologically balanced environment. The principle of statutory reservation is violated because, as stated above, the State’s forest estate may be reduced only by statute, not by regulation.
This principle has been defined as a corollary of the principle of legality (principio de legalidad), compliance with which requires certain matters to be regulated exclusively by formal legislation enacted by the Legislative Branch through the procedure established in the Constitution for the enactment of laws. This is because the Constitution identifies certain matters which, owing to their significance, must necessarily be regulated by statute. Thus, for example, the creation of taxes, the imposition of penalties, the regulation of fundamental rights and—as in this case—the reduction of the boundaries of a protected zone within the State’s forest estate are all situations requiring legislative intervention, because regulation of these matters is best safeguarded through parliamentary debate. Accordingly, by reducing the boundaries of the Refugio Nacional de Vida Silvestre de Gandoca-Manzanillo, the challenged decree violates the principle of statutory reservation, because those boundaries may be reduced only by a statute duly justified for that purpose.
In addition, the right to the environment is violated because reducing a wildlife refuge clearly not only diminishes the ability to enjoy that right in the Gandoca-Manzanillo area, but also deprives the area’s natural resources of protection by leaving the urban areas of the communities of Gandoca, Manzanillo and Puerto Viejo open to unrestricted exploitation. Clearly, property does not receive the same protection when it constitutes forest property (propiedad forestal). It should be recalled that this type of property is distinct, with its own characteristics and particular features and a special legal regime, because it is intended primarily for conservation, rather than production or participation in commerce among persons. All lands regarded as national reserves are immediately dedicated to the purposes of forestry legislation, which establishes a special regime applicable to all forest resources.
Accordingly, by excluding the urban areas of the communities of Gandoca, Manzanillo and Puerto Viejo from forest property, the challenged decree violates the right to the environment, because those areas would fall outside the limitations inherent to forest property, which are intended to promote conservation rather than exploitation of the property and its natural resources. All of the foregoing leads us to conclude that Article 3 of the challenged Decree—which reinstates the repealed Article 6 and reduces the boundaries of the refuge in question—is unconstitutional. Article 7 of the same decree is likewise unconstitutional because it repeals Decreto Ejecutivo no. 32753 del 16 de mayo del 2005 in its entirety, which had expanded the boundaries of the refuge in question. In addition, Articles 4 and 5 of the decree in question are unconstitutional by connection (por conexidad), because they directly concern the urban areas being excluded from the boundaries of the Refuge, one assigning authority to describe those areas (Article 4) and the other establishing MINAE’s authority to approve the land-use plan (plan regulador) for those areas (Article 5).
In the same vein, Article 1 of the decree in question must be understood to be unconstitutional insofar as, in ratifying the original decree creating the refuge, it does so without excepting Article 6, because failure to do so would produce the same reduction in the boundaries of the refuge.
VIII.Conclusion.- Accordingly, a declaration of nullity (declaratoria de nulidad) of Articles 3, 4, 5, and 7 of Decreto número 34043-MINAE, published in La Gaceta número 202 of 22 de octubre de 2007, is warranted, as is, by connection, the nullification of Article 1°, but only insofar as it also fails to exclude Article 6 of the original decree creating Refugio de Vida Silvestre Gandoca-Manzanillo Nº 16614-MAG of 1º de julio de 1985. The foregoing declaration shall have retroactive effect as of the decree’s entry into force, without giving special consideration to alleged vested rights (derechos adquiridos), since it is manifestly constitutionally impossible for anyone to have acquired any valid right within a Refugio Nacional de Vida Silvestre. This is without prejudice to the right of any party who considers its property interests adversely affected to seek the corresponding administrative liability (responsabilidad administrativa) before the competent courts.
Por tanto:
The action (acción) is GRANTED. Articles 3°, 4°, 5°, and 7° of Decreto n°34043-MINAE, published in La Gaceta número 202 of 22 de octubre de 2007, are annulled, as is, by connection, Article 1°, but only insofar as it also fails to exclude Article 6 of the original decree creating Refugio de Vida Silvestre Gandoca-Manzanillo Nº 16614-MAG of 1º de julio de 1985. This judgment shall have declaratory and retroactive effect as of the effective date of the annulled provisions. A summary of this ruling shall be published in the Diario Oficial La Gaceta, and the ruling shall be published in full in the Boletín Judicial. Let notice be given.- Ana Virginia Calzada M.

Acción de inconstitucionalidad promovida por Guido Cubero Arce, mayor, casado, abogado, vecino de San José, portador de la cédula de identidad número 3- 220-312 contra los artículos 3, 4, 5 y 7 del Decreto número 34043-MINAE por estimarlos contrarios a los artículos 50, 10, 11, 28, 140 incisos 3, 18 y 20, 7, 48, 69 y 89 de la Constitución Política. Intervinieron también en el proceso el representante de la Procuraduría General de la República, y el Ministro de Ambiente y Energía.
Resultando:
Redacta el Magistrado Cruz Castro; y,
Considerando:
A.- CUESTIONES DE TRÁMITE Y ADMISIÓN DE LA ACCIÓN.
I.Objeto de la impugnación.- El accionante impugna los artículos 3, 4, 5 y 7 del Decreto número 34043-MINAE publicado en La Gaceta número 202 del 22 de octubre de 2007, los cuales disponen:
“Artículo 3º—Modifíquese el artículo 6º del Decreto Nº 16614-MAG para que se lea de la siguiente manera: ´Artículo 6: Las áreas urbanas que de acuerdo con los estudios realizados por el Instituto Nacional de Vivienda y Urbanismo estén comprendidos dentro de las comunidades de Gandoca, Manzanillo y Puerto Viejo no estarán sometidas a las regulaciones del presente Decreto. Los casos que actualmente se encuentren con procesos judiciales o administrativos denunciados por el SINAC no se verán favorecidos por esta disposición´.
Artículo 4º—Corresponde al Sistema Nacional de Áreas de Conservación de manera conjunta con la Municipalidad de Talamanca, la descripción de las zonas urbanas; para lo cual se les otorga un plazo improrrogable de treinta días naturales a partir de la publicación de este Decreto.
Artículo 5º—Que el plan regulador para las áreas que quedan en administración municipal, debe ser sometido para visto bueno del Ministerio del Ambiente y Energía.
(…)
Artículo 7º—Deróguese el Decreto Nº 32753 del 25 de noviembre de 2005” .
Estima el accionante que tales normas son inconstitucionales porque: A) Violan el derecho a un ambiente sano y ecológicamente equilibrado (art.50), el principio de conservación y principio precautorio en materia ambiental (arts. 7 y 48), principio de desarrollo sostenible y explotación racional de los recursos naturales (art.69), derecho a las bellezas escénicas y al paisaje que comprende el derecho a la salud física y mental (art.69). Lo anterior por cuanto se está ampliando la zona marina del refugio y disminuyendo la zona terrestre, lo que se desprende del artículo 3° del decreto, atentando contra los recursos naturales pues habría un incremento de la infraestructura, contaminación del suelo, aguas y otros. Señala además la contradicción entre el artículo 3° y el 4° pues mientras el primero indica que es el INVU quien define las zonas urbanas en el segundo se refiere a la Municipalidad y al SINAC.
De igual manera menciona que se violan disposiciones internacionales porque Costa Rica está obligada a informar sobre las modificaciones que sufriría un territorio de la lista de zonas húmedas de importancia internacional. B) Violan el principio de legalidad y reserva legal (art.11 y 28) y el principio de ejecución de las leyes (arts. 140 incisos 3, 18 y 20), por cuanto el decreto violenta normas de rango superior como la Ley Forestal, la Ley Orgánica del Ambiente. Las convenciones Ramsar y otros; además de que está variando los límites mediante decreto. En síntesis, según se observa, todos los alegatos de inconstitucionalidad pueden ser agrupados en dos grupos, por un lado la posible violación al ambiente por reducir las dimensiones del Refugio Nacional de Vida Silvestre Gandoca Manzanillo y por otro lado la posible violación al principio de reserva legal al reducir dicha área silvestre protegida mediante un decreto y no mediante ley. El accionante cita como antecedentes jurisprudenciales los votos 2000-10466, 2002- 8321, 2003-03480, 2003-8742 y 2006-5975 de esta Sala.
II.Las reglas de legitimación en las acciones de inconstitucionalidad.- El artículo 75 de la Ley de la Jurisdicción Constitucional regula los presupuestos que determinan la admisibilidad de las acciones de inconstitucionalidad, exigiendo la existencia de un asunto pendiente de resolver en sede administrativa o judicial en el que se invoque la inconstitucionalidad, requisito que no es necesario en los casos previstos en los párrafos segundo y tercero de ese artículo, es decir, cuando por la naturaleza de la norma no haya lesión individual o directa; cuando se fundamente en la defensa de intereses difusos; cuando se trate de intereses que atañen a la colectividad; o cuando sea presentada por el Procurador General de la República, el Contralor General de la República, el Fiscal General de la República o el Defensor de los Habitantes, en estos últimos casos, dentro de sus respectivas esferas competenciales.
Sobre la posibilidad de acudir en defensa de "intereses difusos" esta Sala ha establecido que estos son aquellos cuya titularidad pertenece a grupos de personas no organizadas formalmente, pero unidas a partir de una determinada necesidad social, una característica física, su origen étnico, una determinada orientación personal o ideológica, el consumo de un cierto producto, etc. El interés, en estos casos, se encuentra difuminado, diluido (difuso) entre una pluralidad no identificada de sujetos. Esta Sala ha enumerado diversos derechos a los que les ha dado el calificativo de "difusos", tales como el medio ambiente, el patrimonio cultural, la defensa de la integridad territorial del país, el buen manejo del gasto público, y el derecho a la salud, entre otros.
III.La legitimación del accionante en este caso.- A partir de lo dicho en el párrafo anterior, es claro que el actor ostenta legitimación suficiente para demandar la inconstitucionalidad de las normas impugnadas, sin que para ello resulte necesario que cuenten con un asunto previo que les sirva de base a esta acción. Lo anterior porque acude en defensa de un interés que atañe a la colectividad nacional en su conjunto o interés difuso, como lo es la defensa del medio ambiente y sus riquezas naturales. Precisamente por estar en juego la tutela al ambiente, esta Sala entiende que estamos ante una acción que pretende la tutela de intereses que atañen a la colectividad nacional en su conjunto, por lo que el actor se encuentra perfectamente legitimado para accionar en forma directa, a la luz de lo que dispone el párrafo 2° del artículo 75 de la Ley de la Jurisdicción Constitucional. Además, se trata de materia cuya constitucionalidad procede revisar en esta vía y se cumplió con los requisitos estipulados en los numerales 78 y 79 de la Ley de rito. En conclusión, la presente acción es admisible, por lo que debe entrarse de inmediato a discutir el objeto y el fondo del asunto.
IV.Sobre la metodología de análisis de la acción.- Para facilitar el estudio de la normativa impugnada, en los considerandos siguientes se analizará primero los antecedentes sobre el tema para luego analizar los argumentos expuesto por el accionante.
B.- ANTECEDENTES.
V.Sobre el historial de los decretos ejecutivos relacionados con el Refugio Nacional de Vida Silvestre Gandoca-Manzanillo (REGAMA) y la inclusión- exclusión de las llamadas zonas urbanas de Gandoca, Manzanillo y Puerto Viejo.- Mediante Decreto Ejecutivo N° 16614-MAG, de 1° de julio de 1985, publicado en La Gaceta N° 206, de 29 de octubre de 1985, se creó el Refugio Nacional de Vida Silvestre Gandoca-Manzanillo, estableciéndose en su artículo 6º que las zonas urbanas de Gandoca, Manzanillo y Puerto Viejo (definidas por el INVU), no estarían sometidas a las regulaciones de ese decreto. Posterior a ello, este artículo 6° pasó por cuatro modificaciones. Primera, (inclusión y ampliación) mediante el artículo 16 del Decreto Ejecutivo N° 23069-MIRENEM, de 21 de marzo de 1994, publicado en La Gaceta N° 65 de 5 de abril de 1994, que declaró de acceso restringido de la zona de Playa Gandoca, se derogó el citado artículo 6º del Decreto Ejecutivo, N° 16614-MAG, dejando sin efecto la exclusión de la aplicación de las regulaciones correspondientes al Refugio Nacional de Vida Silvestre para las áreas ahí mencionadas como urbanas, entendiéndose entonces que dichas zonas estaban incluidas dentro del Refugio.
Segunda, (exclusión y reducción) mediante el Decreto Ejecutivo N° 29019-MINAE, de 19 de setiembre del 2000, publicado en La Gaceta N° 208, de 31 de octubre del 2000, correspondiente al Reglamento para el Manejo Participativo de los Recursos Naturales en el Refugio de Vida Silvestre Gandoca- Manzanillo, Sector Gandoca, se derogó en su totalidad el Decreto Ejecutivo N° 23069-MlRENEM, con lo cual entró en vigencia nuevamente el artículo 6º del Decreto Ejecutivo N° 16614-MAG, lo cual implicó una reducción del área del Refugio Nacional de Vida Silvestre Gandoca – Manzanillo al quedar excluidas las áreas definidas como urbanas de Gandoca, Manzanillo y Puerto Viejo. Tercera, (inclusión y ampliación) mediante el artículo 2° del Decreto Ejecutivo no. 32753 del 16 de mayo del 2005 se deroga el artículo 6º del Decreto Ejecutivo, N° 16614-MAG, dejando nuevamente sin efecto la exclusión de la aplicación de las regulaciones correspondientes al Refugio Nacional de Vida Silvestre para las áreas ahí mencionadas como urbanas, y por lo tanto sometiéndolas a regulación.
Con lo cual se entendió que el Refugio se tenía por ampliado. Cuarta, (exclusión y reducción) mediante el artículo 3° del Decreto Ejecutivo N°. 34043, publicado en La Gaceta número 202 del 22 de octubre de 2007 se reforma y vuelve a traer a la vida jurídica el artículo 6º del Decreto Ejecutivo, N° 16614-MAG, excluyendo las áreas urbanas de las comunidades de Gandoca, Manzanillo y Puerto Viejo a las regulaciones del Decreto. Además, el artículo 7° del mismo decreto N°. 34043 deroga en su totalidad el Decreto Ejecutivo no. 32753 del 16 de mayo del 2005, el cual daba cuenta del historial del artículo 6° del Decreto Ejecutivo N° 16614-MAG y de su reducción mediante el Decreto Ejecutivo N° 29019-MINAE. Con lo cual se entiende que el área del refugio se veía reducida. Según se observa las áreas denominadas como urbanas de las comunidades de Gandoca, Manzanillo y Puerto Viejo han sido incluidas y excluidas del Refugio Nacional de Vida Silvestre Gandoca-Manzanillo en varias ocasiones, por arbitrio reglamentario.
VI.Sobre el aumento y reducción de las áreas silvestres protegidas.- Este Tribunal Constitucional ya tuvo la ocasión de referirse a la constitucionalidad de inclusión de las áreas urbanas de Gandoca, Manzanillo y Puerto Viejo al área del Refugio Nacional de Vida Silvestre Gandoca-Manzanillo (REGAMA), mediante la sentencia número 2006-5975 del 3 de mayo de 2006 cuando se refirió al cambio que corresponde a la segunda modificación -según lo expresado en el considerando anterior-:
“VII.- Sobre el aumento y reducción de las áreas silvestres protegidas.
En el memorial de interposición de la acción de inconstitucionalidad, el accionante impugna –y lo señala como motivo de inconstitucionalidad-, la derogatoria del Decreto 23069-MIRENEM por el Decreto 29019-MINAE pues tácitamente redujo la extensión del Refugio de Vida Silvestre Gandoca- Manzanillo, dado que éste último había ampliado los límites del Refugio.
Analizando los decretos promulgados relacionados con el Refugio Gandoca- Manzanillo, se observa como el Poder Ejecutivo ha emitido varios en procura de regular la situación del mismo. Con el objeto de aclarar la situación actual, es conveniente hacer un recuento de los relacionados con el objeto de esta acción. Tenemos en primer término el DE-16614-MAG de 29 de octubre de 1985, que crea el Refugio Nacional de Vida Silvestre Gandoca-Manzanillo (REGAMA). El fundamento legal del decreto está concretamente en el artículo 2 de la Ley N° 4465, pero especialmente en el artículo 18 de la Ley N° 6919, Ley de Conservación de la Fauna Silvestre, ya derogada, pero que en aquel momento disponía:
“Artículo 18.- Son refugios nacionales de fauna silvestre los que el Poder Ejecutivo declare como tales, para la protección y la investigación de la flora y la fauna silvestre, en especial de aquella en vías de extinción. Queda autorizado el Poder Ejecutivo para establecer, dentro de las reservas forestales y en terrenos particulares, áreas bajo la clasificación de refugios nacionales de fauna silvestre, las que, para efectos de conservación de la fauna silvestre, quedarán bajo la administración del Departamento de Vida Silvestre de la Dirección General Forestal del Ministerio de Agricultura y Ganadería.(…)” El artículo 6° del Decreto 16614-MAG excluyó expresamente de ese refugio la zona urbana de Gandoca, Manzanillo y Puerto Viejo. Posteriormente se emitió el DE-23069-MIRENEM de 5 de abril de 1994; el artículo 16 de ese Decreto derogó el art. 6 del DE-16614. La consecuencia inmediata de ello, es que las áreas urbanas de Gandoca, Manzanillo y Puerto Viejo pasaron a formar parte del Refugio Gandoca-Manzanillo.
Más adelante se promulgó el Decreto DE- 29019-MINAE de 31 de octubre del 2000, el cual, a través del artículo 8°, derogó el Decreto 23069-MIRENEM; con ello, tácitamente recobró vigencia el artículo 6 del DE-16614. Se produce en ese momento una disminución tácita del territorio de la reserva al excluirse de nuevo las áreas urbanas de Gandoca, Manzanillo y Puerto Viejo, lo que dejaba las cosas en la situación en que lo habría dispuesto el Decreto N° 16614-MAG. Sin embargo, posteriormente el Poder Ejecutivo emitió el DE-32753-MINAE de 16 de mayo del 2005, el cual derogó expresamente el artículo 6 del DE-16614; nuevamente las zonas urbanas de Gandoca, Manzanillo y Puerto Viejo pasan a formar parte del Refugio Nacional de Vida Silvestre Gandoca-Manzanillo, situación que se mantiene a la fecha.
Sobre el aumento y/o disminución de los límites territoriales del patrimonio forestal, este Tribunal, en la sentencia N° 1999-5399 de las 16:39 horas del 26 de octubre de 1993, en la cual la Sala señaló:
“…si el Poder Ejecutivo está legitimado para señalar los límites de su patrimonio forestal lo será a través de la vía reglamentaria y no la legal, con la debida indemnización de las propiedades sobre las que se extienda el patrimonio forestal, ya que en virtud del artículo 9 constitucional y de la teoría de la separación de Poderes, la Asamblea Legislativa es el único órgano constitucional facultado para emitir leyes. Por ello cuando se trate de un bien demanial resulta ilógico pensar que el Estado esté limitado o imposibilitado en su actuación en resguardo de la flora y la fauna de nuestras tierras.
II.En este orden de ideas, puesto que esta acción se dirige contra un decreto ejecutivo que amplió los límites de un parque nacional -Isla del Coco- extendiéndose a una distancia de quince kilómetros sobre el mar, medida desde la línea de bajamar de la costa, es que es importante determinar que lo hace en el pleno ejercicio de sus facultades, tanto legales como constitucionales, por tratarse de un bien demanial.(…)
V.En relación con la alegada violación del artículo 3 del Convenio para la protección de la flora, de la fauna y de las bellezas escénicas naturales de los países de América -aprobado por Ley número 3763, de primero de octubre de mil novecientos sesenta y seis- en relación con el artículo 7 constitucional, que en lo que interesa dice así:
"Los Gobiernos Contratantes convienen en que los límites de los parques nacionales no serán alterados ni enajenada parte alguna de ellos sino por acción de la autoridad legislativa competente. Las riquezas existentes en ellos no se explotarán con fines comerciales.
Los Gobiernos Contratantes convienen en prohibir la caza, la matanza y la captura de especimenes de la fauna y la destrucción y recolección de ejemplares de la flora en los parques nacionales, excepto cuando se haga por las autoridades del parque o por orden o bajo vigilancia de las mismas o para investigaciones científicas debidamente autorizadas." Deben esas normas interpretarse en sentido restrictivo, de manera que, la exigencia de establecer los límites de los parques nacionales a través de una ley es únicamente cuando va en detrimento del mismo, es decir, cuando se quiera reducir su extensión, y no cuando se quieran extender los límites de las zonas protectoras del patrimonio forestal del Estado. Este artículo debe completarse con el artículo 40 de la Ley Forestal que dice:
"El área de las reservas forestales, zonas protectoras, parques nacionales, refugios de vida silvestre, reservas biológicas del patrimonio forestal, sólo podrá ser reducida por ley de la República, previos estudios técnicos correspondientes que justifiquen esta medida." Y esto es así en virtud de que el bien jurídico que se protege es el "recurso forestal", término que "significa la protección y preservación de la integridad del medio ambiente natural," (resolución de la Sala Constitucional número 2233-93, de las nueve horas treinta y seis minutos del veintiocho de mayo) que existe en la zona declarada como parque nacional, y que es reconocido tanto por la legislación internacional, por las leyes especiales dictadas al efecto, como por los textos de las cartas políticas. En este sentido, el artículo 69 de la Constitución Política es que habla de "explotación racional de la tierra", constituyéndose un principio fundamental su protección (…).” (la negrita no es de original) Es evidente entonces que el Poder Ejecutivo, no puede reducir los límites territoriales un área silvestre, pero sí puede extenderlos.
De ahí que los Decretos cuya derogación o puesta en vigencia hayan producido como consecuencia inmediata el aumento del territorio de una determinada área protegida, son constitucionales.” De todo lo cual se pueden derivar dos conclusiones. Por un lado, cuando de la ampliación de los límites de las zonas protectoras del patrimonio forestal del Estado se trata es posible hacerlo vía reglamento, pero cuando de su reducción se trata únicamente se puede hacer vía legal, claro está, siempre y cuando exista un criterio previo que justifique la medida . Por otro lado, la derogatoria del artículo 6° del decreto ejecutivo DE-16614, incluyendo las zonas urbanas de Gandoca, Manzanillo y Puerto Viejo implicó un aumento del territorio del Refugio Nacional de Vida Silvestre de Gandoca-Manzanillo, siendo entonces que la exclusión de dichas zonas dentro del territorio del refugio implica una reducción del territorio de este.
C.- ANÁLISIS DE LOS ALEGATOS DE INCONSTITUCIONALIDAD
VII.Sobre la inconstitucionalidad de los artículos 3°, 4°, 5° y 7° del Decreto n°34043-MINAE.- Tal como se expuso, al derogarse artículo 6º del Decreto Ejecutivo, N° 16614-MAG (mediante el artículo 2° del Decreto Ejecutivo no. 32753 del 16 de mayo del 2005) se incluyeran las comunidades de Gandoca, Manzanillo y Puerto Viejo dentro de los límites del Refugio Nacional de Vida Silvestre Gandoca-Manzanillo. Sin embargo, mediante el artículo 3° del Decreto impugnado, que vuelve a traer a la vida jurídica el derogado artículo 6º, las áreas urbanas de dichas comunidades quedaban nuevamente excluidas de los límites del Refugio, lo que implicó su reducción. Esta situación, no sólo violenta el principio de reserva legal sino el derecho a gozar de un ambiente sano y ecológicamente equilibrado. Se viola el principio de reserva legal pues, según lo expresado, la reducción del patrimonio forestal del Estado sólo puede operar vía legal y no reglamentaria.
Este principio ha sido definido como un corolario del principio de legalidad cuyo respeto obliga a que determinadas materias son de regulación exclusiva por ley formal, emanada del Poder Legislativo y por el procedimiento previsto en la Constitución para la emisión de las leyes. Ello por cuanto constitucionalmente se han establecido ciertas materias, que por su trascendencia, para ser reguladas, deben serlo obligatoriamente por medio de una ley. Así nos encontramos por ejemplo con que la creación de impuestos, la imposición de penas, la regulación de los derechos fundamentales, y –como en este caso- la reducción de los límites de una zona protectora del patrimonio forestal del Estado, son todas situaciones donde se requiere de la intervención del legislador, pues es en el debate parlamentario donde mejor se asegura la regulación de estas materias. De esta forma, al proceder el decreto impugnado a reducir los límites del Refugio Nacional de Vida Silvestre de Gandoca-Manzanillo viola el principio de reserva legal pues la reducción de tales límites sólo puede operar mediante una ley debidamente justificada al efecto.
Además, se viola el derecho al ambiente pues la reducción de un refugio de vida silvestre claramente no sólo disminuye las posibilidades de gozar de este derecho en la zona de Gandoca-Manzanillo sino que desprotege los recursos naturales de la zona al dejar a las áreas urbanas de las comunidades de Gandoca, Manzanillo y Puerto Viejo a la libre explotación sin restricciones algunas. Evidentemente no es la misma protección que recibe la propiedad cuando se trata de propiedad forestal. Sobre este tipo de propiedad recuérdese que es un tipo diferente de propiedad con características y particularidades propias y un régimen especial, pues se concibe fundamentalmente para conservar, no para producir ni ser parte del comercio de los hombres. Todas las tierras consideradas como reservas nacionales quedan afectadas en forma inmediata a los fines de la normativa forestal, la cual establece un régimen especial aplicable a todos los recursos forestales.
De esta forma, al proceder el decreto impugnado a excluir de la propiedad forestal las áreas urbanas de las comunidades de Gandoca, Manzanillo y Puerto Viejo, viola el derecho al ambiente pues tales áreas quedarían fuera de los límites propios de la propiedad forestal que tienden a la conservación y no a la explotación de la propiedad y sus recursos naturales. Todo lo anterior nos lleva a concluir que el mencionado artículo 3° del Decreto impugnado -que vuelve a traer a la vida jurídica el derogado artículo 6º disminuyendo los límites del refugio en cuestión- resulta inconstitucional. De la misma forma resulta inconstitucional el artículo 7° del mismo decreto, pues, deroga en su totalidad el Decreto Ejecutivo no. 32753 del 16 de mayo del 2005, el cual ampliaba los límites del refugio en cuestión. Además, por conexidad, resultan inconstitucionales los artículos 4° y 5° del decreto en cuestión pues estos están directamente referidos a estas áreas urbanas que se están excluyendo de los límites del Refugio, uno fijando las competencias para la descripción de dichas áreas (art.4°) y otro estableciendo la competencia del MINAE para dar el visto bueno al plan regulador de dichas áreas (art.5°).
En el mismo sentido debe entenderse que el artículo 1° del decreto en cuestión resulta inconstitucional en la medida en que, al ratificar el decreto original de creación del refugio, lo hace sin excepcionar el artículo 6°, pues al no hacerlo se tendría la misma situación de reducción de los límites del refugio.
VIII.Conclusión.- Así entonces, procede la declaratoria de nulidad de los artículos 3, 4, 5 y 7 del Decreto número 34043-MINAE publicado en La Gaceta número 202 del 22 de octubre de 2007 y por conexidad del artículo 1° pero únicamente en tanto no excluye además el artículo 6 d el decreto original de creación de Refugio de Vida Silvestre Gandoca-Manzanillo Nº 16614-MAG del 1º de julio de 1985. La anterior declaratoria tiene efectos retroactivos a la entrada en vigencia del decreto y sin tomar especial consideración sobre supuestos derechos adquiridos, pues a todas luces, no es constitucionalmente posible haber adquirido derecho válido alguno dentro de un Refugio Nacional de Vida Silvestre. Lo anterior, sin perjuicio de que si alguna parte se siente perjudicada en su patrimonio acuda ante las instancias judiciales pertinentes a reclamar la respectiva responsabilidad administrativa.
Por tanto:
Se declara CON lugar la acción. Se anulan los artículos 3°, 4°, 5° y 7° del Decreto n°34043-MINAE publicado en La Gaceta número 202 del 22 de octubre de 2007 y por conexidad el artículo 1° pero únicamente en tanto no excluye además el artículo 6 d el decreto original de creación de Refugio de Vida Silvestre Gandoca-Manzanillo Nº 16614-MAG del 1º de julio de 1985 . Esta sentencia tiene efectos declarativos y retroactivos a la fecha de vigencia de la normativa anulada. Reséñese este pronunciamiento en el Diario Oficial La Gaceta y publíquese íntegramente en el Boletín Judicial. Notifíquese.- Ana Virginia Calzada M.
