Consolidated constitutional challenges (acciones de inconstitucionalidad) No. 04-005607-0007-CO, filed by the Asociación Sindical de Trabajadores del Ministerio del Ambiente y Energía (Sitraminae), represented by its Secretary General, Roberto Molina Ugalde, vested with the powers of an unlimited general attorney-in-fact (apoderado generalísimo sin límite de suma), of legal age, married, an employee of the Ministerio de Ambiente y Energía, identification card 5-195-151; No. 04-006157-0007-CO, filed by Quírico Jiménez Madrigal, of legal age, married, forestry engineer, identification card 1-556-870; and No. 04-006409-0007-CO, filed by Álvaro Sagot Rodríguez, of legal age, businessperson, identification card 2-365-227, and Andrea Corte, of legal age, residence card No. 790-154858-000461, against Decreto Ejecutivo No. 31750-MINAE-TUR. Also participating in the proceeding are Carlos Manuel Rodríguez Echandi, Farid Beirute Brenes, and Rodrigo Castro Fonseca, representing, respectively, the Ministerio de Ambiente y Energía, the Procuraduría General de la República, and the Instituto Costarricense de Turismo.-
Findings:
“To regulate the application of the term ecotourism, as provided for in Article 18 of the Ley Forestal. These regulations affect forest areas within the maritime-terrestrial zone (zona marítimo terrestre) previously demarcated by MINAE, the parameters of which must be incorporated into the regulations governing the respective zoning plans (Planes Reguladores) for the maritime-terrestrial zone.” That provision—she argues—purports, by means of a decree, to regulate a term in contravention of Articles 2, 13, 14, 15, 18, and 19 of the Ley Forestal, Article 50 of the Constitución Política, and international treaties signed by Costa Rica, specifically Articles 4, 5, 6, and 7 of the Convención para la Protección del Patrimonio Cultural Natural (Ley No. 5980) and Articles 1, 2, 3, 4, and 5 of the Convención de Ramsar (Ley No. 7224), because, through a legal device, it will permit activities that will cause serious environmental harm to the Protected Wilderness Areas (Zonas Silvestres Protegidas) of our national territory.
In legal scholarship, specialists have defined ecotourism primarily in accordance with the concept adopted by the Unión Mundial para la Conservación de la Naturaleza, as an environmentally responsible form of tourism consisting of traveling to or visiting natural areas in order to enjoy and appreciate nature, which promotes conservation, has a low visitor impact, and fosters active and socioeconomically beneficial involvement by local populations. Likewise, the following requirements are established for undertaking this activity: A. Having a low impact on the resources of protected natural areas. B. Involving stakeholders in the planning, development, implementation, and monitoring stages. C. Respecting local cultures and traditions. D. Generating sustainable and equitable income for local communities and for as many participating stakeholders as possible, including private tour operators.
E. Generating income for the conservation of protected areas. F. Educating all stakeholders involved about their role in conservation. Based on these definitions, it is clear that the challenged decree purports to regulate the use of the term ecotourism by altering its meaning and scope, thereby conflicting with the provisions of Costa Rican law and the international treaties signed by Costa Rica. The Decree purports to exclude ecotourism activity by restricting it to maritime-terrestrial zones containing forest, which is an error because it applies in all Protected Wilderness Areas whose classification permits it and in the manner technically described above; nevertheless, through its misinterpretation of the term, the body of regulations substantially impairs the State Natural Heritage (Patrimonio Natural del Estado) by allowing its land-use change (cambio de uso). As a second ground of unconstitutionality, the petitioner alleges that Articles 13 and 14 of the Ley Forestal define the concept of State Natural Heritage, which they declare immune from attachment (inembargable) and inalienable (inalienable), so that it includes forests and forestland located in the maritime-terrestrial zone.
However, Articles 2, 3, and 4 of the challenged decree allow activities intended to generate economic profit for a select few to be conducted within the State Natural Heritage. Article 2 permits buildings to be constructed and Article 4 permits forests to be cut down within the State Natural Heritage. For this reason, the challenged decree is contrary not only to the Ley Forestal, but also to the case law of this Chamber (decision No. 3789- 92). As a third ground of unconstitutionality, the petitioner alleges that Article 4, subsection 1, of the decree contravenes the Ley de la Zona Marítimo Terrestre and the Ley Forestal because, by means of a decree, it delegates to the Municipality the authority to grant a concession (concesión) over forested land in the maritime-terrestrial zone, even though those same laws have always been consistent as to the respective jurisdiction of Minae and the Municipalities over this strip of land.
The Municipalities’ sole authority is the administration of portions of the maritime-terrestrial zone that do not contain forest; portions that do contain forest fall under the exclusive jurisdiction of the State through the Ministerio de Ambiente y Energía (folios 1-13).
Although the provision appears in the chapter on private forest property, it does not seem logical to subject such property to a stricter conservation regime than public forest property, for which, as stated, there is no express provision authorizing logging or forest harvesting. It is undeniable that clearing forest in Áreas Silvestres Protegidas to construct works intended for tourism development changes the natural use of the land in the deforested area, contrary to the principles of the Ley del Uso, Manejo y Conservación de Suelos, and causes environmental damage to the forest ecosystem; actions to safeguard the integrity of those assets are grounded in article 50 of the Constitution. The TRIBUNAL DE CASACIÓN PENAL has repeatedly held that the unlawful change in the use of forest land in order to devote it to other purposes is an activity harmful to the environment. To that end, it has derived from the existing provisions the principle of forest irreducibility (principio de irreductibilidad del bosque) and ordered the affected forest area restored to its condition prior to the events, so as to guarantee the constitutional right to a healthy and ecologically balanced environment (judgments numbers 2003-0366, 2003-396 and 2003-0450).
The decree alleged to be unconstitutional regulates only ecotourism activities or projects in forests within the maritime-terrestrial zone, as demarcated by MINAE, and fails to regulate them in the other protected wilderness areas and forests of the Patrimonio Natural del Estado. Nevertheless, it does not justify this difference in treatment, which conflicts with the constitutional principles of reasonableness and proportionality in environmental matters recognized by that Chamber. Under this partial or fragmented regulation, which runs counter to unified management, ecotourism activities and projects in forests of the Patrimonio Natural del Estado are subject to disparate regulations depending on whether or not they are located within the maritime-terrestrial zone. It would even violate the principle of equality, given the differing rules applicable to parties seeking to undertake them based on the location of the properties.
Articles 1°, 2°, 3°, 5° and 7° of the Decree, in conjunction with article 4°, subsection 2, subject the forest areas of the maritime-terrestrial zone in which ecotourism projects involving tree cutting and forest harvesting will be undertaken to simultaneous and divergent planning, with different objectives, rules and regulatory techniques: Regulatory Plans (Planes Reguladores) and Management Plans (Planes de Manejo). This is contrary to the rational and sustainable use of that resource (article 50 of the Constitution). According to the petitioner, the contested Decree alters the meaning and scope of the term ecotourism, as defined in treaties signed by the country, by the international community, and in legislation currently in force. There is no known definition of ecotourism that is universally valid or unanimously accepted at the international level. Nor does the petitioner identify the articles of the international instruments and laws containing such a definition.
Neither does it appear in the texts on which the action is based. Thus, there is no higher-ranking legal standard against which to assess the alleged violation, and the argument cannot be accepted. Article 2° of the Reglamento a la Ley Forestal adopted the concise definition of ecotourism used by the Sociedad Mundial de Ecoturismo: “responsible travel to natural areas that conserves the environment and improves the well-being of local populations.” Article 8° of Decreto 31750-MINAE-TUR redefines ecotourism as “an activity that actively contributes to the conservation of natural and cultural heritage, includes local and indigenous communities in its planning, development and operation, and contributes to their well-being. It interprets the destination’s natural and cultural heritage for visitors and is best suited to independent travelers, as well as organized tours for small groups.” It defines ecotourism projects as those that promote “environmental education, the conservation of natural resources, and the socioeconomic development of residents, and that reflect an awareness of and commitment to sustainability” (article 2°).
The lack of mechanisms to give effect to those statements could be questioned, since otherwise they may remain merely rhetorical. In this case, however, the provisions redefining ecotourism activities would present constitutional defects only if they diminish environmental protection or weaken the protection afforded under the previous definition, thereby altering the essential features of the concept of ecotourism. Although this cannot be inferred from their wording, the Decree introduces two significant changes for the Justices to consider because of the potential implications of that kind: a) One is the repeal of article 11 of the Reglamento a la Ley Forestal (art 9° of Decreto 31750), which, in keeping with a conservation-oriented philosophy, provided: “The research and ecotourism activities contemplated in article 18 of the Law, where lodging facilities within areas of the Patrimonio Natural del Estado are concerned, shall be limited to rustic structures consistent with the natural surroundings and intended primarily to lodge researchers and secondarily tourists, provided that they do not interfere or compete with the well-being of local populations in the buffer zone (área de amortiguamiento).” Notably, the requirement that construction permitted within the Patrimonio Natural del Estado consist of rustic structures, which are more consistent with ecotourism, has been eliminated, and the projects to be carried out by private parties have now been given a commercial purpose.
Other provisions of the Decree authorizing those projects complement this new economic orientation, which, at least with respect to strict conservation areas or national parks, contravenes Ley N° 6084 del Servicio Nacional de Parques Nacionales, articles 5° subsection 15 and 12, and consequently violates the fundamental right enshrined in article 50 of the Constitution. b) In addition to eliminating the requirement for rustic structures, the Decree (article 3°) permits buildings of up to three stories and the use of substantial areas, without specifying where they will be located, in implementing the projects and activities (15% of the concession area for primary forests and 25% for secondary forests), with the resulting environmental transformations or alterations to the developed land. Ecotourism projects have a very low negative environmental impact and preferentially use clean technologies and native materials.
Ecotourism is a form of low-impact tourism that is ecologically sustainable and protects natural resources from deterioration so they remain available to meet the needs and aspirations of present and future generations. It promotes appreciation, rational use, conservation, study and improvement of the natural and scenic spaces and associated cultural elements that constitute its attractions and on which it depends. It contrasts with mass tourism, which concentrates large numbers of tourists in one place and seeks maximum profitability without regard to environmental and cultural repercussions. Because public wilderness areas, over which the State serves as guardian, comprise fragile ecosystems of great biodiversity, where damage may produce irreversible consequences and prevent the long-term preservation of resources, the environmental costs and associated social benefits of projects and activities to be undertaken within them must be carefully assessed.
This is all the more important because such tourism is sustained through publicly funded nature-conservation programs. Experts regard our country as the world’s leading ecotourism destination, with an emphasis on those natural areas. The equitable distribution of benefits is implicit in the intergenerational solidarity within which environmental protection is situated. That Chamber has repeatedly ruled on the necessary reconciliation between economic development and environmental protection. The petitioner does not explain in detail the violations relating to the two international instruments she invokes, and none are apparent from reading them, except for article 4° of the Convención de Ramsar, insofar as it concerns the obligation of States to promote the conservation of wetlands (including mangroves), whether or not they are included in the “List” of international importance, and to provide adequately for their management and care.
This applies insofar as Decreto 31750-MINAE-TUR encompasses them and permits cutting for ecotourism projects. The same applies with respect to the Convención sobre la Protección del Patrimonio Mundial, insofar as the Decree might encompass the Patrimonio Natural regulated therein and having outstanding universal value (art. 2°)—which has not been established—with regard to the State’s obligation to adopt legal measures for its adequate protection and conservation (arts. 4 to 6). Judgment N° 4587-97 of the Sala Constitucional reaffirms the public-domain status conferred by law on the Patrimonio Natural del Estado, while the opinions of the Procuraduría mentioned in the action (opinion C-321-2003 and Opinión Jurídica O. J.-014-2004) merely interpret article 13 et seq. of the Ley Forestal and article 73 of Ley 6043, under which the constitutional violations would fall, as explained above (folios 34-68).

Whereas:
I.Subject matter of the action: In these consolidated constitutional challenges (acciones de inconstitucionalidad), Executive Decree number 31-750-MINAE-TUR of May 14, 2004, which regulates the application of the term ecotourism provided for in Article 18 of the Ley Forestal, is challenged in its entirety for violating the fundamental right to a healthy and ecologically balanced environment, sustainable development, and the principles of legality, reasonableness, and proportionality, as well as for exceeding the regulatory authority vested in the Executive Branch, to the detriment of the legislative authority established in Article 121, subsection 1), of the Constitución Política. The literal text of the Decree reads as follows:
Nº 31750- MINAE-TUR THE PRESIDENT OF THE REPUBLIC, THE MINISTER OF ENVIRONMENT AND ENERGY AND THE MINISTER OF TOURISM Pursuant to the powers conferred upon them by Article 140, subsections 3) and 18), and Article 146) of the Constitución Política; Article 18 of Ley Forestal Nº 7575 of February 13, 1996, and its regulations; Ley Orgánica del Ambiente Nº 7554 of October 4, 1995; Decreto Ejecutivo Nº 25721-MINAE of October 17, 1996, and its amendments; Decreto Nº 27998- MINAE Principios Criterios Indicadores para el Manejo Sostenible de Bosque Secundario y Certificación Forestal; Decreto Ejecutivo Nº 30763-MINAE Principios Criterios Indicadores para el manejo Sostenible de Bosques Naturales y su Certificación en Costa Rica; Ley Nº 6043 Ley de la Zona Marítimo Terrestre of March 2, 1977; Articles 4 and 5 of the Ley Orgánica del Instituto Costarricense de Turismo; and Decreto Ejecutivo Nº 31045-MOPT of March 6, 2003.
Whereas:
1º- Ley Forestal Nº 7575 provides that the State’s essential and priority function is to ensure the conservation, protection, and administration of the State’s natural forests, in accordance with the principle of appropriate and sustainable use of renewable natural resources. 2º- Within the natural heritage (patrimonio natural), the State may conduct or authorize research, training, and ecotourism activities once they have been approved by the Ministerio del Ambiente y Energía, which shall determine, when appropriate, whether environmental impact assessments (evaluaciones del impacto ambiental) must be conducted, as established by the regulations to the Law.
3º- Ecotourism is a form of sustainable tourism, which in turn falls within the general framework of sustainable development. The latter has been defined as a pattern of structural socioeconomic transformations that optimizes similar benefits in the future.
4º- The concept of ecotourism refers to a segment within the tourism sector, whereas the principles of sustainability must apply to every form of activity.
Therefore:
THEY DECREE:
Article 1º- The application of the term ecotourism, provided for in Article 18 of the Ley Forestal, is hereby regulated. These regulations apply to forest areas within the maritime-terrestrial zone previously demarcated by MINAE, and their parameters must be incorporated into the regulations governing the respective Regulatory Plans (Planes Reguladores) for the maritime-terrestrial zone.
Article 2º- For purposes of these regulations, ecotourism projects shall mean investment projects developed in forest areas within the maritime-terrestrial zone demarcated by the Ministerio del Ambiente and incorporated into the respective Coastal Regulatory Plan (Plan Regulador Costero) within the framework of Ley Nº 6043, and that simultaneously promote environmental education, the conservation of natural resources, and the socioeconomic development of inhabitants, reflecting an awareness of and commitment to sustainability.
Article 3º- For previously established forest zones, the Regulatory Plan and its respective regulations shall incorporate the use designated as the “Ecotourism Development Zone (Zona de Desarrollo Ecoturístico, ZDE),” within which only the development of ecotourism projects that meet at least the following requirements shall be permitted:
a. Under no circumstances may projects or activities carried out within forests exceed coverage of 15 % of the concession area for primary forests and 25 % of the concession area for secondary forests. The foregoing percentages shall be calculated based on the effective area, meaning the area remaining after the applicable protection zones (zonas de protección) have been excluded.
b. The construction of infrastructure is not permitted in areas with slopes steeper than those established in Decreto Nº 27998 and 30763-MINAE.
c. Any project intended to be carried out in the forest must submit a proposal for the treatment and management of wastewater (aguas servidas), previously approved by the Ministerio de Salud.
d. Every project must present an architectural language consistent with its setting, using materials, textures, and colors that allow it to blend into nature without substantially affecting it.
e. Buildings intended to be constructed in these zones may not exceed three stories or 14 meters in height, excluding pilings where applicable.
f. When the forest canopy is lower than these dimensions because of the ecosystem’s particular characteristics, the works to be constructed may not rise above it. The exterior finishes of the buildings must be consistent with the natural environment existing in the area so as to prevent the introduction of visual pollution.
Article 4º- When an ecotourism project involves the cutting and harvesting of forest resources in forest areas within the maritime-terrestrial zone, authorization of those activities shall require compliance with these regulations and with the following requirements:
1. A concession granted by the competent Municipality and duly registered.
2. A forest management plan (plan de manejo del bosque) in accordance with Decreto Ejecutivo Nº 30763-MINAE, Principios Criterios Indicadores para el Manejo de Bosques Naturales y su Certificación en Costa Rica; Decreto Ejecutivo Nº 25721, Reglamento a la Ley Forestal; and this decree.
3. Environmental clearance (viabilidad ambiental) granted by the Secretaría Técnica Nacional Ambiental, whose assessments must include prior and binding consultation with the respective Área de Conservación, which has statutory authority over forestry matters.
Article 5º- The area demarcated as a protection zone and established in the respective Regulatory Plan may not be included in calculating the minimum requirements set forth in Article three of these regulations, in accordance with Article 33 of the Ley Forestal, Ley de Aguas No. 276 of August 27, 1942, and Decreto Ejecutivo Nº 31045-MOPT.
Article 6º- When ecotourism activities do not involve the cutting of trees, their requirements shall be governed by Article 11 of Decreto Nº 25721-MINAE, Reglamento a la Ley Forestal, which regulates use permits (permisos de uso) in the maritime-terrestrial zone.
Article 7—The Ministerio del Ambiente shall demarcate the forest areas in the country’s maritime-terrestrial zone (zona marítimo terrestre) at a scale of 1:1500 or 1: 2000, as applications for the preparation of Regulatory Plans (Planes Reguladores) are submitted, within a period not exceeding two years. Notwithstanding the foregoing, the Ministerio del Ambiente, on its own initiative and in coordination with the Plan Nacional de Desarrollo, may carry out such demarcation in priority tourism areas whose public zone has been duly demarcated by the Instituto Geográfico Nacional.
Article 8—Article 2 of Decreto Ejecutivo Nº 25721 is hereby amended with respect to its definition of ecotourism, which shall henceforth be defined as follows:
Ecotourism: an activity that actively contributes to the conservation of natural and cultural heritage, includes local and indigenous communities in its planning, development, and operation, and contributes to their well-being. It interprets the destination’s natural and cultural heritage for visitors and is best suited to independent travelers, as well as to organized tours for small groups.
Article 9—Repeals: The second paragraph of Article 11 of Decreto Nº 25721-MINAE is hereby repealed.
Article 10—This Decree shall enter into force upon its publication.
Issued at the Presidencia de la República.—San José, on the twenty-second day of April of the year two thousand four.”
II.Admissibility of the action. The actions meet the formal requirements established by the Ley de la Jurisdicción Constitucional and are admissible because they seek to defend the right to a healthy and ecologically balanced environment, for which Article 50 of the Constitution grants the broadest standing (legitimación), which, in such cases, requires no showing whatsoever regarding the applicants’ interest. Their standing also derives from Article 75, second paragraph, of the Ley de la Jurisdicción Constitucional, which permits an action to be filed without requiring a prior matter pending resolution before the courts or in proceedings to exhaust administrative remedies (agotar la vía administrativa), when the action concerns the defense of diffuse interests (intereses difusos), as in this case, which concerns the defense of the environment.—
III.Grounds of unconstitutionality alleged by the petitioners. The grounds of unconstitutionality of the challenged Decree, as alleged by the petitioners, may be summarized as follows:
IV.The Chamber finds that the challenged decree is unconstitutional in its entirety because it violates Article 50 of the Constitución Política, which recognizes the right to a healthy and ecologically balanced environment. Indeed, as emphasized in the report of the Procuraduría General de la República, the State Natural Heritage is public-domain property (bien de dominio público) whose conservation and administration are entrusted by law to the Ministerio del Ambiente y Energía through the Sistema Nacional de Áreas de Conservación (Ley Forestal, Arts. 6 subpara. a and 13 para. 2°, and 14; Ley Orgánica del Ambiente, Article 32, para. 2°). It consists of two important components: a) Protected Wilderness Areas, regardless of their management category, declared by Law or Executive Decree: forest reserves, protective zones, national parks, biological reserves, national wildlife refuges, wetlands, and natural monuments (Ley Forestal 7575, Arts. 1°, para. 2°, 3° subpara. i; Ley Orgánica del Ambiente 7554, Article 32; Ley de Biodiversidad N° 7788, Arts. 22 et seq. and 58; Ley del Servicio de Parques Nacionales N° 6084, Article 3°, subparas. d and f, in conjunction with Ley Orgánica del MINAE N° 7152 and its Regulations; Ley de Conservación de la Vida Silvestre N° 7317, Article 82, subpara. a). b) All other State and public-institution forests, forest lands, or lands suitable for forestry (Article 13 of Ley Forestal), which are immediately subject to a statutory designation (afectación legal).
With respect to the maritime-terrestrial zone, Ley 6043 itself (Article 73) excludes Protected Wilderness Areas from its scope and subjects them to their own legislation. The remaining forested areas and lands suitable for forestry along the coasts are also administered by the Ministerio del Ambiente and governed by their specific regulations (Ley Forestal, Article 13 and related provisions).
V.As indicated by the Procuraduría General de la República, the challenged Decree presupposes municipal administration of forest areas in the maritime-terrestrial zone, with the resulting authority to grant concessions and apply Ley 6043 within them. Thus, Article 2 incorporates the “forest areas of the maritime-terrestrial zone” into the “respective Coastal Regulatory Plan (Plan Regulador Costero) within the framework of Ley 6043.” That Coastal Regulatory Plan is the planning instrument specific to the maritime-terrestrial zone administered by the Municipalities and is an essential requirement for them to grant concessions for tourism purposes. (Ley 6043, Arts. 31, 33 and 38; Articles 17 and 18 of its Regulations, Decreto 7841-P). Articles 1°, 2°, 3°, 5° and 7° develop that incorporation of the forests of the maritime-terrestrial zone into the Regulatory Plan; moreover, the Decree is categorical regarding the authority it assigns to local governments in those areas by requiring, for ecotourism projects involving the harvesting and use of forest resources, a “concession granted by the competent Municipality” (Art. 4°, subpara. 1°).
In this respect, the Decree exceeds the limits governing the exercise of regulatory authority (potestad reglamentaria) by assigning the Municipalities authority that they do not have by law to administer and grant concessions over the State Natural Heritage along the coasts (Protected Wilderness Areas and other publicly owned forests or forest lands). In addition, it changes the designated use of public-domain property (mutación de destino del demanio público), converting it to private tourism operations, thereby violating Articles 13 of Ley Forestal and 73 of Ley 6043 and rendering them ineffective. Finally, a concession is the ordinary means of using areas of the maritime-terrestrial zone administered by the Municipalities (Ley 6043, Art. 39) and is irreconcilable with the absolute-conservation objectives of certain Protected Wilderness Areas, such as national parks and biological reserves.
For that reason, the Decree would be contrary to Ley de Parques Nacionales, N° 6084 (Art. 12), which prohibits granting concessions to exploit products from national parks or to establish facilities other than those of the Área de Conservación del MINAE, formerly the Servicio de Parques Nacionales. Ley de Biodiversidad, N° 7788, Article 39, also prohibits granting concessions within State Protected Wilderness Areas that authorize third parties to access elements of biodiversity or to construct private buildings. It permits such concessions only in favor of nonprofit organizations, particularly regional organizations, that support the conservation of natural resources, and only for nonessential services and activities, namely: parking facilities, restrooms, administration of physical facilities, food services, shops, construction and administration of trails, visitor services, and others defined by the Consejo Regional del Área de Conservación.
This Chamber has repeatedly held that “the subordination of regulations to statutes is absolute” and means that “regulations may not render statutory provisions ineffective or contradict them, nor may they supplant a statute by producing a particular effect not intended by the legislature or regulating specific content not contemplated in the provision being implemented” (SALA CONSTITUCIONAL, votes 2934-93, 5227-94, 6198-95, 2381-96, 2382-96, 6689-96, 1607-98, 0998-98, 1998-07967, 1999-05445, 1999-05669, 1999-07619, 1999-09236). Although a Decree’s violation of statutory provisions falls, in principle, within the realm of legality, when it simultaneously affects fundamental rights, such as the right to an adequate environment, the defect transcends that realm, enters the constitutional sphere, and acquires constitutional significance (SALA CONSTITUCIONAL, judgments numbers 459-91, 3550-91 and 4702-93, 2001-02074, among others).
Specifically, in judgment number 2001-02074, the Chamber held: “II.—…insofar as the failure to allocate resources to the forestry sector undermines the ability to give effect to every person’s right to enjoy a healthy and ecologically balanced environment, as protected by Article 50 of the Constitution, the matter in dispute falls within the jurisdiction of this Tribunal for the protection of fundamental rights. As resolution N° 5691- 98 states, ‘the Chamber’s commitment to ecological stability and harmony has been unwavering, because protecting nature, which is world heritage, also means safeguarding not only human life and health, but also humanity’s existence on Earth, thereby developing the substance not only of international agreements on the subject, but also of Article 21 of our Constitución Política (…). It follows from the foregoing that the denial of the financial resources legally allocated to forest protection and restoration programs entails a violation of the principles of Article 50 of the Constitución Política.
It is therefore a matter that extends far beyond what might be regarded as a mere statutory violation and acquires constitutional significance, since it entails the State’s failure to comply with the obligation expressly imposed on it by that provision to guarantee, defend, and preserve every person’s right to enjoy a healthy and ecologically balanced environment.’”
VI.Article 4 of the challenged Decree permits ecotourism projects involving tree cutting (corta de árboles) and exploitation of forest resources (aprovechamiento del recurso forestal). Consistent with Article 1 of the Ley Forestal, by virtue of the public interest and except as provided in Article 18 thereof, which authorizes ecotourism, “the cutting or exploitation of forests in national parks, biological reserves, mangroves, protected zones, wildlife refuges, and State-owned forest reserves is prohibited.” The legislation is conservation-oriented, and none of its provisions expressly permits logging (tala) within Protected Wild Areas (Áreas Silvestres Protegidas). On the contrary, the comments made within the Asamblea Legislativa during consideration of the Ley Forestal 7575 bill point in the opposite direction: “These first articles define the essence of the bill, which is intended to protect forests, ensure their proper management, and promote timber planting. It establishes a complete prohibition on cutting on State lands and in conservation areas, as well as something entirely novel: prohibiting land-use change (cambio de uso)…” (Acta N° 28 de la Comisión de Asuntos Agropecuarios, pg. 14; f. 2840 del expte. legislativo. Emphasis added).
VII.It is important to note that the case law of the Tribunal de Casación Penal has also included tree cutting within the offense of exploiting forest products on private property without authorization or in a manner inconsistent with the authorization granted, punishable under Article 61(a) (judgments numbers 226-F-97, 524-F-97, 704-F97 and 2001-929). Article 58(a) of the Ley Forestal classifies the invasion of conservation areas or protected wild areas as a criminal act, which, in the view of the Tribunal de Casación Penal, encompasses deforestation: “The act of deforesting a protected area is carried out” (…) “through the act of breaking into, entering, occupying, encroaching upon, etc., such that the act of invasion referred to by the appellant does not mean invasion for the purpose of exercising possession.” It characterizes the act as “deforesting a protected or managed forest, causing harm to the flora and fauna of the area” (judgment N° 2003-0713).
Article 6(a) assigns the Administración Forestal del Estado responsibility for conserving the country’s forest resources on lands belonging to the State Natural Heritage (Patrimonio Natural del Estado). Article 48 of the Ley Orgánica del Ambiente imposes upon the State the obligation to conserve, protect, and administer forest resources. By making no exception concerning strict conservation areas (áreas de conservación absoluta), the Decree contravenes Ley N° 6084, del Servicio de Parques Nacionales, which entrusts what is now MINAE with safeguarding the conservation of national parks (art 3° inc. d), prohibits therein the cutting of trees, the extraction of forest products, and the conduct of any commercial or industrial activities (art 8, incisos 1 y 15), and prohibits the granting of concessions for the exploitation of products from national parks or permits to establish facilities that do not belong to the respective Área de Conservación del MINAE (artículo 12).
In addition, the Ley de Biodiversidad, Article 39, establishes restrictions on concessions within State-owned Protected Wild Areas, while the Ley Orgánica del Ambiente establishes restrictions for mangroves and wetlands generally, declaring their conservation to be in the public interest (art. 41), entrusting MINAE with preventing and combating the degradation of these ecosystems (art. 42), and prohibiting the construction of works or infrastructure that damage them (art. 43). Decreto 31750- MINAE-TUR conflicts with Article 2 of the Reglamento a la Ley Forestal, which defines use permits (permisos de uso), where allowed within the management categories of the State Natural Heritage, as “authorizations to use portions of State-owned land for purposes that DO NOT entail forest exploitation.” (Emphasis added). The Decree also conflicts with Article 11, paragraph 1, of that Reglamento, which provides: “The Administración Forestal del Estado shall grant permits to use the State’s natural and forest heritage only to projects that DO NOT require forest exploitation and that do not affect ecosystems…, etc.” (Emphasis added).
Finally, Decreto 31750- MINAE-TUR also contradicts Article 3 of Decreto 22550-MIRENEN, which provides: “The Ministerio de Recursos Naturales, Energía y Minas—now MINAE—shall not grant permits or concessions in estuarine wetland areas occupied by mangroves when the activity to be undertaken entails a change in land use, except in cases involving the installation of saltworks, where the removal of mangroves shall be authorized according to technical criteria affecting the minimum area necessary to construct artificial channels.” The Ley Forestal prohibits changing land use (uso del suelo) on forest-covered land and makes violations thereof a criminal offense (arts. 19 and 62 inciso c). Although the provision appears in the chapter concerning private forest property, it would not seem logical to subject such property to a stricter conservation regime than public forest property, for which no express provision authorizes cutting or forest exploitation.
Clearing forests in Protected Wild Areas to construct works intended for tourism development changes the natural use of the land in the deforested sector, contrary to the principles of the Ley del Uso, Manejo y Conservación de Suelos, and causes environmental damage to the forest ecosystem; actions to safeguard the integrity of such assets are grounded in Article 50 of the Constitution.
VIII.As noted by the Procuraduría General de la República, the Tribunal de Casación Penal has also repeatedly held that the unlawful conversion of forest land to other uses is an environmentally harmful activity; to that end, it has derived from the existing provisions the principle of forest non-reduction (principio de irreductibilidad del bosque) and ordered that the affected forest area be restored to its condition before the events, in order to guarantee the constitutional right to a healthy and ecologically balanced environment. The challenged Decree regulates only ecotourism activities or projects in forests within the maritime-terrestrial zone (zona marítimo terrestre) demarcated by MINAE and fails to regulate them in other protected wild areas and forests belonging to the State Natural Heritage. Nevertheless, it provides no justification for this difference in treatment, which conflicts with the constitutional principles of reasonableness and proportionality in environmental matters.
Under this partial or fragmented regulation, which runs counter to unified management, ecotourism activities and projects in forests belonging to the State Natural Heritage are subject to disparate regulations depending on whether or not they are located within the maritime-terrestrial zone. This would violate the principle of equality because different rules would apply to parties interested in carrying them out based on the location of the properties. Articles 1, 2, 3, 5, and 7 of the Decree, read in conjunction with Article 4(2), subject forest areas within the maritime-terrestrial zone where ecotourism projects involving tree cutting and forest exploitation are to be undertaken to simultaneous and divergent planning under different objectives, rules, and regulatory techniques: Regulatory Plans (Planes Reguladores) and Management Plans (Planes de Manejo). This is contrary to the rational and sustainable use of that resource (Article 50 of the Constitution).
IX.Lastly, the challenged Decree repeals Article 11 of the Reglamento a la Ley Forestal (art 9° del Decreto 31750), which provided: “Research and ecotourism activities contemplated in Article 18 of the Law, when involving lodging facilities within areas belonging to the State Natural Heritage, shall be limited to rustic structures suited to the natural surroundings, intended primarily to accommodate researchers and secondarily tourists, provided they do not interfere or compete with the well-being of local communities in the buffer zone (área de amortiguamiento).” It restricted construction within the State Natural Heritage to permitted rustic structures more consistent with ecotourism, whereas the Decree authorizes a new economic orientation that provides less protection than the previous regime for strict conservation areas or national parks. In addition to eliminating the rustic-structure requirement, the Decree (Article 3) permits buildings of up to three stories and the use of substantial areas, without specifying where they will be located, in carrying out projects and activities (15% of the concession area for primary forests and 25% for secondary forests), with the ensuing environmental transformations or alterations to the developed land.
Public wild areas, over which the State serves as guardian, comprise fragile ecosystems of great biodiversity, damage to which may have irreversible consequences and prevent the long-term preservation of resources. The foregoing requires a careful assessment of the environmental costs and social benefits associated with the projects and activities to be carried out within them.-
X.As a consequence of the foregoing, the present constitutional challenge must be upheld and the challenged Decree annulled.-
Por tanto:
The present consolidated constitutional challenges are upheld and, consequently, Decreto Ejecutivo No. 31750-MINAE-TUR de 30 de marzo de 2004 is annulled. This judgment shall have declaratory and retroactive effect as of the date on which the challenged provision entered into force, without prejudice to rights acquired in good faith and settled legal situations. It shall be published in full in the Boletín Judicial, and a summary shall be published in the Diario Oficial La Gaceta. Acciones de inconstitucionalidad acumuladas No. 04-005607-0007-CO, promovida por la Asociación Sindical de Trabajadores del Ministerio del Ambiente y Energía (Sitraminae), representada por su Secretario General con facultades de apoderado generalísimo sin límite de suma, Roberto Molina Ugalde, mayor, casado, funcionario del Ministerio de Ambiente y Energía, cédula 5-195-151; No. 04-006157-0007-CO, promovida por Quírico Jiménez Madrigal, mayor, casado, ingeniero forestal, cédula 1-556-870 y No. 04-006409-0007-CO, promovida por Álvaro Sagot Rodríguez, mayor, empresario, cédula 2-365-227 y Andrea Corte, mayor, cédula de residencia No. 790-154858-000461, contra el Decreto Ejecutivo No. 31750-MINAE-TUR. Intervienen también en el proceso Carlos Manuel Rodríguez Echandi, Farid Beirute Brenes y Rodrigo Castro Fonseca, en representación, respectivamente del Ministerio de Ambiente y Energía, la Procuraduría General de la República, y el Instituto Costarricense de Turismo.-
Resultando:
«Reglamentar la aplicación del término ecoturismo, previsto en el artículo 18 de la Ley Forestal. Dicha reglamentación afecta las áreas de bosques de la zona marítimo terrestre demarcadas previamente por el MINAE, cuyos parámetros deberán incorporarse en los reglamentos de los Planes Reguladores respectivos de la zona marítimo terrestre».
Dicha disposición -argumenta- pretende, vía decreto, reglamentar un término para contravenir la Ley Forestal en sus artículos 2, 13, 14, 15, 18 y 19, la Constitución Política en su artículo 50 y tratados internacionales suscritos por Costa Rica, específicamente, los artículos 4, 5, 6 y 7 de la Convención para la Protección del Patrimonio Cultural Natural (Ley No. 5980) y los artículos 1, 2, 3, 4 y 5 de la Convención de Ramsar (Ley No. 7224), ya que permitirá mediante un artificio jurídico, actividades que a nivel ambiental causarán graves daños a las Zonas Silvestres Protegidas de nuestro territorio nacional. Doctrinariamente, el término ecoturismo ha sido definido por los especialistas, ajustándose principalmente al concepto adoptado por la Unión Mundial para la Conservación de la Naturaleza, como aquella modalidad turística ambientalmente responsable consistente en viajar o visitar áreas naturales con el fin de disfrutar y apreciar la naturaleza, que promueve la conservación, tiene bajo impacto de visitación y propicia un involucramiento activo y socioeconómicamente benéfico de las poblaciones locales.
De igual manera, se establecen como requisitos para el desarrollo de esta actividad los siguientes: A. Tener un bajo impacto sobre los recursos de las áreas naturales protegidas. B. Involucrar a los actores en las fases de planificación, desarrollo, implementación y monitoreo. C. Respetar las culturas y tradiciones locales. D. Generar ingresos sostenibles y equitativos para las comunidades locales y para tantos actores participantes como sea posible, incluidos los operadores turísticos privados. E. Generar ingresos para la conservación de las áreas protegidas. F. Educar a todos los actores involucrados acerca de su papel en la conservación. Partiendo de estas definiciones, es claro que el decreto impugnado pretende reglamentar el uso del término ecoturismo variando su significado y alcances, de manera que entra en contradicción con lo que la ley costarricense y los tratados internacionales suscritos por Costa Rica disponen.
El Decreto pretende excluir la actividad ecoturismo, limitándola a la Zona Marítimo Terrestre en la que existe bosque, lo cual es un error, debido a que ésta es aplicable en todas las Áreas Silvestres Protegidas cuya clasificación lo permita y de la forma en que técnicamente se expuso con anterioridad; sin embargo, el cuerpo normativo, con la mala interpretación del término propicia un deterioro sustancial del Patrimonio Natural de Estado al permitir su cambio de uso. Como segundo motivo de inconstitucionalidad, la accionante alega que los artículos 13 y 14 de la Ley Forestal definen el concepto de Patrimonio Natural del Estado, el cual declaran inembargable e inalienable, de manera que incluye los bosques y terrenos forestales ubicados en la Zona Marítimo Terrestre. Sin embargo, los artículos 2, 3 y 4 del decreto impugnado permiten que dentro del Patrimonio Natural de Estado se desarrollen actividades tendientes a la ganancia económica para algunos pocos.
El artículo 2 permite construir edificaciones y el 4 talar el bosque, dentro del Patrimonio Natural del Estado. El decreto impugnado es contrario, por este motivo, no solo a la Ley Forestal, sino también a la jurisprudencia de esta Sala (voto No. 3789- 92). Como tercer motivo de inconstitucionalidad, la accionante alega que el artículo 4 inciso 1 del decreto contraviene la Ley de la Zona Marítimo Terrestre y la Ley Forestal, pues vía decreto está delegando la función de otorgar la concesión sobre la zona marítimo terrestre con bosque en la Municipalidad, cuando la mismas leyes citadas han concordado siempre en cuál es la competencia en esta franja de terreno tanto del Minae como de las Municipalidades. La única potestad de las Municipalidades es la Administración de la Zona Marítimo Terrestre que no contenga bosque; la que sí lo tiene es competencia única del Estado por medio del Ministerio de Ambiente y Energía (folios 1-13).
Redacta el Magistrado Armijo Sancho; y,
Considerando:
I.Objeto de la acción: En las presentes acciones de inconstitucionalidad acumuladas se impugna, en su totalidad, el Decreto Ejecutivo número 31-750-MINAE-TUR de 14 de mayo de 2004, el cual reglamenta la aplicación del término ecoturismo previsto en el artículo 18 de la Ley Forestal, por vulnerar el derecho fundamental al ambiente sano y ecológicamente equilibrado, al desarrollo sostenible, a los principios de legalidad, razonabilidad y proporcionalidad, así como por exceder la potestad reglamentaria atribuida al Poder Ejecutivo, en menoscabo de la potestad legislativa establecida en el artículo 121 inciso 1) de la Constitución Política. El texto literal del Decreto, dice así:
Nº 31750- MINAE-TUR EL PRESIDENTE DE LA REPÚBLICA, EL MINISTRO DEL AMBIENTE Y ENERGÍA Y EL MINISTRO DE TURISMO Con fundamento en las facultades que les confiere los artículos 140, incisos 3) y 18) y 146) Constitución Política, y el artículo 18 de la Ley Forestal Nº 7575 del 13 de febrero de 1996 y su reglamento, Ley Orgánica del Ambiente Nº 7554 del 4 de octubre de 1995, Decreto Ejecutivo Nº 25721-MINAE del 17 de octubre de 1996, y sus reformas. Decreto Nº 27998- MINAE Principios Criterios Indicadores para el Manejo Sostenible de Bosque Secundario y Certificación Forestal Decreto Ejecutivo Nº 30763-MINAE Principios Criterios Indicadores para el manejo Sostenible de Bosques Naturales y su Certificación en Costa Rica, Ley Nº 6043 Ley de la Zona Marítimo Terrestre del 2 de marzo de 1977, artículos 4 y 5 de la Ley Orgánica del Instituto Costarricense de Turismo y el Decreto Ejecutivo Nº 31045-MOPT del 6 de marzo del 2003.
Considerando:
1º-Que la Ley Forestal Nº 7575 dispone que la función esencial y prioritaria del Estado, es velar por la conservación, protección y administración de los bosques naturales del Estado, de acuerdo con el principio de uso adecuado y sostenible de los recursos naturales renovables. 2º- Que en el patrimonio natural, el Estado podrá realizar o autorizar labores de investigación, capacitación y ecoturismo, una vez aprobadas por el Ministerio del Ambiente y Energía quién definirá cuando corresponda la realización de evaluaciones del impacto ambiental, según lo establezca el reglamento de la Ley.
3º-Que el ecoturismo es una modalidad del turismo sostenible, que a su vez se inserta dentro del marco general de desarrollo sostenible. Este último ha sido definido como un patrón de transformaciones estructural de índole socioeconómica que optimiza los beneficios similares en el futuro.
4º-Que el concepto de ecoturismo se refiere a un segmento dentro del sector turístico, en tanto que los principios de sostenibilidad deben aplicarse a toda forma de actividad.
Por tanto:
DECRETAN:
Artículo 1º-Reglamentar la aplicación del término ecoturismo, previsto en el artículo 18 de la Ley Forestal. Dicha reglamentación afecta las áreas de bosques de la zona marítimo terrestre demarcadas previamente por el MINAE, cuyos parámetros deberán incorporarse en los reglamentos de los Planes Reguladores respectivos de la zona marítimo terrestre.
Artículo 2º-Los proyectos de ecoturismo, para efectos de esta reglamentación, se entenderán como aquellos proyectos de inversión que se desarrollan en las áreas de bosques de la zona marítimo terrestre demarcadas por el Ministerio del Ambiente e incorporadas en el respectivo Plan Regulador Costero en el marco de la Ley Nº 6043, y en los cuales se promueven simultáneamente la educación ambiental, la conservación de los recursos naturales, el desarrollo socioeconómico de los habitantes, que reflejen una conciencia e identificación de sostenibilidad.
Artículo 3º-En el Plan Regulador y su respectivo reglamento se incorporará para las zonas de bosque previamente establecidas, el uso denominado “Zona de Desarrollo Ecoturístico (ZDE)”, dentro del cual se permitirán únicamente el desarrollo de proyectos ecoturísticos que como mínimo cumplan con los siguientes elementos:
a. En ningún caso, los proyectos o actividades a ejecutar dentro de bosques, podrán sobrepasar una cobertura superior al 15 % del área de concesión para bosques primarios y 25 % del área de concesión para bosques secundarios. Los anteriores porcentajes se entenderán sobre el área efectiva, es decir, el área restante una vez excluidas las zonas de protección que correspondan.
b. No se permite la construcción de infraestructura en zonas que presenten pendientes superiores a las establecidas en el decreto Nº 27998 y 30763-MINAE.
c. Todo proyecto que se pretenda ejecutar en el bosque, deberá presentar una propuesta para el tratamiento y manejo de aguas servidas, previamente aprobada por el Ministerio de Salud d. Todo proyecto deberá presentar un lenguaje arquitectónico acorde con el contexto, utilizando para ello materiales, texturas y colores que permitan integrarlo a la naturaleza, sin impactarla sustancialmente.
e. Las construcciones que se pretendan realizar en estas zonas, no podrán ser mayores a tres niveles ni superar los 14 metros de altura excluyendo pilotes cuando corresponda.
f. Cuando por las características propias del ecosistema, el dosel del bosque sea inferior a estas medidas, las obras a construir no podrán sobrepasarlo. Los acabados externos de las edificaciones deberán guardar concordancia con el entorno natural existente en la zona, de manera que se evite la introducción de contaminación visual.
Artículo 4º-Cuando el proyecto ecoturístico implique la corta y el aprovechamiento del recurso forestal en las áreas de bosque de la zona marítimo terrestre, será necesario para autorizar estas actividades cumplir con la presente normativa y con los siguientes requisitos:
1. Concesión otorgada por la Municipalidad competente debidamente inscrita.
2. Plan de manejo del bosque conforme el Decreto Ejecutivo Nº 30763-MINAE, Principios Criterios Indicadores para el Manejo de Bosques Naturales y su Certificación en Costa Rica y el Decreto Ejecutivo Nº 25721, Reglamento a la Ley Forestal y el presente decreto.
3. Viabilidad ambiental otorgada por la Secretaría Técnica Nacional Ambiental, la cual deberá incorporar en sus valoraciones una consulta previa y vinculante al Área de Conservación respectiva, competentes por Ley en materia Forestal.
Artículo 5º-En los requisitos mínimos contemplados en el artículo tercero de este reglamento no se podrá considerar el área demarcada como zona de protección que haya sido establecida en el respectivo Plan Regulador, de conformidad con lo dispuesto en el artículo 33 de la Ley Forestal, Ley de Aguas No. 276 de 27 de agosto de 1942, así como el Decreto Ejecutivo Nº 31045-MOPT.
Artículo 6º-Cuando las labores de ecoturismo no impliquen corta de árboles, han de regirse en cuanto a sus requisitos por lo establecido en el artículo 11 del Decreto Nº 25721-MINAE, reglamento a la Ley Forestal que regula los permisos de uso en la zona marítimo terrestre.
Artículo 7º-El Ministerio del Ambiente demarcará las áreas de bosque en la zona marítimo terrestre del país en una escala de 1:1500 o 1: 2000, conforme se vayan presentando las solicitudes para la elaboración de Planes Reguladores, en un plazo no mayor de dos años. No obstante lo anterior, el Ministerio del Ambiente, a iniciativa propia y en coordinación con el Plan Nacional de Desarrollo podrá proceder a esta demarcatoria en las zonas de prioridad turística cuya zona pública se encuentre debidamente demarcada por el Instituto Geográfico Nacional.
Artículo 8º-Modifíquese el artículo 2 del Decreto Ejecutivo Nº 25721 en su concepto de ecoturismo el cual de ahora en adelante será definido como:
Ecoturismo: es aquella actividad que contribuye activamente a la conservación del patrimonio natural y cultural, incluye a las comunidades locales e indígenas en su planificación, desarrollo y explotación y contribuye a su bienestar. Interpreta el patrimonio natural y cultural del destino para los visitantes y se presta mejor a los viajeros independientes, así como a los circuitos organizados para grupos de tamaño reducido.
Artículo 9º-Derogatorias: Se deroga el párrafo segundo del artículo 11 del Decreto Nº 25721-MINAE.
Artículo 10.-Rige a partir de su publicación.
Dado en la Presidencia de la República.-San José, a los veintidós días del mes de abril del año dos mil cuatro”.
II.Sobre la admisibilidad de la acción. Las acciones cumplen los requisitos formales exigidos por la Ley de la Jurisdicción Constitucional y son admisibles por tratarse de la defensa del derecho a un ambiente sano y ecológicamente equilibrado, para lo cual el artículo 50 de la Constitución otorga la más amplia legitimación, la cual no requiere, en estos casos, calificación alguna del interés de los accionantes; también, su legitimación se deriva de lo dispuesto en el artículo 75 párrafo segundo de la Ley de la Jurisdicción Constitucional, que permite la interposición de la acción sin requerir la existencia de un asunto previo, pendiente de resolver, ante los tribunales de justicia o en procedimientos para agotar la vía administrativa, cuando se trata de la defensa de intereses difusos, como ocurre en este caso, en que se trata de la defensa del ambiente.-
III.Los motivos de inconstitucionalidad alegados por los recurrentes. Los motivos de inconstitucionalidad del Decreto impugnado, alegados por los recurrentes, pueden resumirse así:
IV.La Sala considera que el decreto impugnado es inconstitucional en su totalidad, por vulnerar el artículo 50 de la Constitución Política, que reconoce el derecho a un medio ambiente sano y ecológicamente equilibrado. En efecto, como lo ha puesto de relieve el informe de la Procuraduría General de la República, el Patrimonio Natural del Estado es un bien de dominio público cuya su conservación y administración están encomendadas, por la ley, al Ministerio del Ambiente y Energía, mediante el Sistema Nacional de Áreas de Conservación (Ley Forestal, arts. 6 inc. a y 13 pfo.2°, y 14; Ley Orgánica del Ambiente, artículo 32, pfo. 2°). Lo integran dos importantes componentes: a) Las Áreas Silvestres Protegidas, cualquiera sea su categoría de manejo, declaradas por Ley o Decreto Ejecutivo: reservas forestales, zonas protectoras, parques nacionales, reservas biológicas, refugios nacionales de vida silvestre, humedales y monumentos naturales (Ley Forestal 7575, arts. 1°, pfo. 2°, 3° inciso i; Ley Orgánica del Ambiente 7554, artículo 32; Ley de Biodiversidad N° 7788, arts. 22 y sigts. y 58; Ley del Servicio de Parques Nacionales N° 6084, artículo 3° incs. d y f, en relación con la Ley Orgánica del MINAE N° 7152 y su Reglamento; Ley de Conservación de la Vida Silvestre N° 7317, artículo 82, inciso a). b) Los demás bosques y terrenos forestales o de aptitud forestal del Estado e instituciones públicas (artículo 13 de la Ley Forestal), que tienen una afectación legal inmediata.
Para la zona marítimo terrestre, la misma Ley 6043 (artículo 73) excluye de su ámbito las Áreas Silvestres Protegidas y las sujeta a su propia legislación. El resto de áreas boscosas y terrenos de aptitud forestal de los litorales, están también bajo la administración del Ministerio del Ambiente y se rigen por su normativa específica (Ley Forestal, artículo 13 y concordantes).
V.Como lo indica la Procuraduría General de la República, el Decreto impugnado presupone la administración municipal de las áreas de bosques de la zona marítimo terrestre, con la consiguiente competencia para otorgar concesiones y aplicar dentro de ellas la Ley 6043. Así, el artículo 2° incorpora las "áreas de bosque de la zona marítimo terrestre" al "respectivo Plan Regulador Costero en el marco de la Ley 6043". Ese Plan Regulador Costero es la figura propia de planificación de la zona marítimo terrestre administrada por las Municipalidades, y requisito esencial para que éstas puedan otorgar concesiones con fines turísticos. (Ley 6043, arts. 31, 33 y 38; 17 y 18 de su Reglamento, Decreto 7841-P). Los artículos 1°, 2°, 3°, 5° y 7° desarrollan esa incorporación de los bosques de la zona marítimo terrestre al Plan Regulador; además, es categórico acerca de la competencia que asigna a los gobiernos locales en dichas áreas, al exigir para los proyectos ecoturísticos que impliquen corta y aprovechamiento del recurso forestal, la "concesión otorgada por la Municipalidad competente" (art. 4° inc. 1°).
En este extremo, el Decreto excede los límites del ejercicio de la potestad reglamentaria, al atribuir a las Municipalidades una competencia que por ley no tienen para administrar y otorgar concesiones sobre el Patrimonio Natural del Estado en los litorales (Áreas Silvestres Protegidas y demás bosques o terrenos forestales públicos), aparte de que producen una mutación de destino del demanio público, convirtiéndolo en explotación turística particular, con lo cual infringe los artículos 13 de la Ley Forestal y 73 de la Ley 6043, los cuales deja insubsistentes. Por último, la concesión es el medio normal de aprovechamiento de las áreas de la zona marítimo terrestre administradas por las Municipalidades (Ley 6043, art. 39) e irreconciliable con los objetivos de ciertas Áreas Silvestres Protegidas, de conservación absoluta; por ejemplo, parques nacionales y reservas biológicas. Por esa razón, el Decreto sería contrario a la Ley de Parques Nacionales, N° 6084 (art. 12), que prohíbe otorgar concesiones para la explotación de productos de los parques nacionales o para establecer otras instalaciones que las del Área de Conservación del MINAE, antes Servicio de Parques Nacionales.
Por su parte, la Ley de Biodiversidad, N° 7788, artículo 39, contiene otra prohibición de otorgar concesiones dentro de las áreas silvestres protegidas estatales que autoricen el acceso a los elementos de la biodiversidad a favor de terceros o la construcción de edificaciones privadas. Sólo las permite en favor de organizaciones, sobre todo regionales, sin fines de lucro, que apoyen la conservación de los recursos naturales, para servicios y actividades no esenciales, que son: estacionamientos, servicios sanitarios, administración de instalaciones físicas, servicios de alimentación, tiendas, construcción y administración de senderos, de la visita y otros que defina el Consejo Regional del Área de Conservación. Es criterio reiterado de esta Sala que "la sumisión del reglamento a la ley es absoluta" e implica que "no puede dejar sin efecto los preceptos legales o contradecirlos, no puede suplir la ley produciendo un determinado efecto no querido por el legislador o regular un cierto contenido no contemplado en la norma que se reglamenta (SALA CONSTITUCIONAL, votos 2934-93, 5227-94, 6198-95, 2381-96, 2382-96, 6689-96, 1607-98, 0998-98, 1998-07967, 1999-05445, 1999-05669, 1999-07619, 1999-09236).
Aunque la infracción de un Decreto a textos de Ley se ubica, en principio, en el plano de legalidad, cuando la misma afecta a la vez derechos fundamentales, como sería el derecho a un medio ambiente adecuado, el vicio trasciende a la esfera constitucional y adquiere esa connotación (SALA CONSTITUCIONAL, sentencias números 459-91, 3550-91 y 4702-93, 2001-02074, entre otros). Concretamente, en la sentencia número 2001-02074, la Sala consideró que: "II.- …en tanto el incumplimiento en la asignación de recursos para el sector forestal lesiona la posibilidad de hacer efectivo el derecho de toda persona a gozar de un ambiente sano y ecológicamente equilibrado que protege el artículo 50 constitucional, el asunto discutido se logra enmarcar dentro del ámbito de competencia de este Tribunal de garantías fundamentales. Como dispone la resolución N° 5691- 98 "la inquietud de la Sala por la estabilidad y la armonía ecológica ha sido férrea, pues proteger la naturaleza, que es patrimonio mundial, es también salvaguardar no solo la vida del hombre y su salud, sino también la de la humanidad sobre la tierra, desarrollando de esta forma el contenido, no solo de los convenios internacionales en esa materia, sino también el artículo 21 de nuestra Constitución Política (…).
De lo expuesto se concluye que la negación de los recursos económicos que por ley corresponden a los programas de protección y restauración forestal conlleva una infracción a los postulados del artículo 50 de la Constitución Política, y por ello se trata de un asunto que rebasa sensiblemente lo que pudiera estimarse como un mero incumplimiento legal, para adquirir relevancia constitucional, toda vez que implica la inobservancia por parte del Estado de la obligación que expresamente le impone esa norma en el sentido de garantizar, defender, y preservar el derecho de toda persona a gozar de un ambiente sano y ecológicamente equilibrado".
VI.El Decreto impugnado, en su artículo 4°, admite la ejecución de proyectos ecoturísticos con corta de árboles y aprovechamiento del recurso forestal. A tono con la Ley Forestal, artículo 1°, en virtud del interés público y salvo lo estipulado en su artículo 18, que autoriza el ecoturismo, "se prohíbe la corta o el aprovechamiento de los bosques en parques nacionales, reservas biológicas, manglares, zonas protectoras, refugios de vida silvestre y reservas forestales propiedad del Estado". La legislación es conservacionista, y ninguna de sus normas permite, en forma expresa, la tala dentro de las Áreas Silvestres Protegidas. Antes bien, los comentarios hechos en el seno de la Asamblea Legislativa durante el trámite del Proyecto de la Ley Forestal 7575, van en sentido contrario: "Estos primeros artículos definen la esencia del proyecto, el cual es para la protección de los bosques, el manejo adecuado y la siembra de la madera. Establece la prohibición total a la corta en terrenos del Estado y en las áreas de conservación, además, algo que es completamente novedoso, que es el no cambio de uso…" (Acta N° 28 de la Comisión de Asuntos Agropecuarios, pg. 14; f. 2840 del expte. legislativo. Se agrega el subrayado).
VII.Es importante señalar que la misma jurisprudencia del Tribunal de Casación Penal ha incluido también la corta de árboles en el ilícito de aprovechamiento de productos forestales en propiedad privada, sin autorización o sin ajustarse a lo autorizado, que sanciona el articulo 61 inciso a) (sentencias números 226-F-97, 524-F-97, 704-F97 y 2001-929). El artículo 58 inciso a) de la Ley Forestal, califica como acto delictivo la invasión de las áreas de conservación o áreas silvestres protegidas, que en criterio del Tribunal de Casación Penal abarca la acción de deforestar: "La acción de deforestar en un área protegida se ejecuta" (…) con la acción de irrumpir, penetrar, ocupar, acometer, etc., de tal forma que la acción de invadir a que alude el recurrente, no se refiere a la de invadir con fines de ejercer posesión". Y encasilla el acto de "deforestar un bosque protegido o intervenido, causando un perjuicio a la flora y fauna del lugar" (sentencia N° 2003-0713).
El artículo 6°, inciso a), asigna a la Administración Forestal del Estado la competencia de conservar los recursos forestales del país en terrenos del Patrimonio Natural del Estado. Y el 48 de la Ley Orgánica del Ambiente impone al Estado la obligación de conservar, proteger y administrar el recurso forestal. Al no hacer ninguna reserva referente a las áreas de conservación absoluta, el Decreto contraviene lo dispuesto en la Ley N° 6084, del Servicio de Parques Nacionales, que encarga al hoy MINAE velar por la conservación de los parques nacionales (art 3° inc. d), prohíbe en estos la tala de árboles, extraer productos forestales, realizar cualquier tipo de actividades comerciales e industriales (art 8, incisos 1 y 15), y otorgar concesiones para la explotación de productos de los parques naciones, o permisos para establecer instalaciones que no sean de la respectiva Área de Conservación del MINAE (artículo 12).
Además, existen las limitantes para concesiones dentro de las Áreas Silvestres Protegidas estatales que contempla la Ley de Biodiversidad, artículo 39, y para manglares o, en general, los humedales en la Ley Orgánica del Ambiente, que declara de interés público su conservación (art. 41), encomienda al MINAE prevenir y combatir la degradación de estos ecosistemas (art. 42), y prohíbe la construcción de obras o infraestructura que los dañen (art. 43). El Decreto 31750- MINAE-TUR se contrapone al Reglamento a la Ley Forestal en su artículo 2º, que define los permisos de uso, a otorgar en las categorías de manejo del Patrimonio Natural del Estado donde sean permitidos, como las "autorizaciones para el uso de partes de terrenos de propiedad Estatal, para fines que NO conlleven el aprovechamiento forestal". (Se añade el subrayado). También, el Decreto se contrapone al artículo 11, párrafo 1° de ese Reglamento que señala que: "La Administración Forestal del Estado concederá permisos de uso del patrimonio natural y forestal del Estado únicamente a aquellos proyectos que NO requieran aprovechamiento forestal y que no afecten los ecosistemas…, etc" (Se destaca el subrayado).
Finalmente, el Decreto 31750- MINAE-TUR también contradice el artículo 3° del Decreto 22550-MIRENEN, según el cual: "El Ministerio de Recursos Naturales, Energía y Minas -hoy MINAE- no otorgará permisos o concesiones en áreas de humedales estuarinos ocupados por manglar cuando la actividad a desarrollar implica un cambio de uso de la tierra, salvo en los casos de instalación de salinas, en las cuales se autorizará la eliminación de manglar de acuerdo a criterios técnicos que afecten el área mínima necesaria para construir canales artificiales". La Ley Forestal prohíbe cambiar el uso del suelo en terrenos cubiertos de bosque y castiga como delito su transgresión (arts. 19 y 62 inciso c). Si bien la norma está inmersa en el capítulo de la propiedad forestal privada, no parece lógico someter ésta a un régimen conservacionista más estricto que la propiedad forestal pública, para la que no hay norma expresa que autorice la corta o aprovechamiento forestal.
La tala del bosque en las Áreas Silvestres Protegidas para construir obras con miras a la explotación turística cambia el destino natural del suelo en el sector deforestado, contra los postulados de la Ley del Uso, Manejo y Conservación de Suelos, y provoca daños ambientales al ecosistema boscoso, teniendo las acciones para tutelar la integridad de los bienes asidero en el artículo 50 constitucional.
VIII.Como lo señalara la Procuraduría General de la República, el Tribunal de Casación Penal ha insistido también en que el cambio ilícito del uso del suelo del bosque, para dedicarlo a otros fines, es una actividad nociva al ambiente; al efecto, ha derivado de las disposiciones existentes el principio de irreductibilidad del bosque y dispuesto la restitución del área de bosque afectada al estado anterior a los hechos, para garantizar el derecho constitucional de un ambiente sano y equilibrado. El Decreto impugnado regula únicamente la actividad o proyectos de ecoturismo en los bosques de la zona marítimo terrestre, demarcados por el MINAE, y omite hacerlo para las demás áreas silvestres protegidas y bosques del Patrimonio Natural del Estado. Con todo, no justifica esta diversidad de trato, que riñe con los principios constitucionales de razonabilidad y proporcionalidad en materia ambiental. Esta regulación parcial o fragmentaria, que adversa la unidad de gestión, la actividad y proyectos de ecoturismo en los bosques del Patrimonio Natural del Estado quedan sujetos a regulaciones dispares, según se hallen o no en la zona marítimo terrestre.
Esto atentaría contra el principio de igualdad, por la disímil normativa aplicable a los interesados en llevarlos a cabo, en razón de la ubicación de los inmuebles. El Decreto, artículos 1°, 2°, 3°, 5° y 7°, en concordancia con el 4° inciso 2, subordina las áreas de bosque de la zona marítimo terrestre en que se realizarán proyectos ecoturísticos implicativos de corta de árboles y aprovechamiento forestal, a una simultánea y divergente planificación, con distintos objetivos, normas y técnicas regulatorias: los Planes Reguladores y Planes de Manejo. Lo que es contrario a la utilización racional y sostenible de ese recurso (artículo 50 constitucional).
IX.Por último, el Decreto impugnado deroga el artículo 11 del Reglamento a la Ley Forestal (art 9° del Decreto 31750), el cual disponía que: "Las labores de investigación y ecoturismo contempladas en el artículo 18 de la Ley, cuando se trate de facilidades para hospedaje dentro de las áreas del Patrimonio Natural del Estado, se limitarán a estructuras rústicas, de acuerdo con el entorno natural, orientadas principalmente al hospedaje de investigadores y secundariamente turistas, con tal de no interferir o competir con el bienestar de las poblaciones locales en el área de amortiguamiento". Condicionaba las construcciones a estructuras rústicas permitidas en el Patrimonio Natural del Estado, más acordes con el ecoturismo y el Decreto viene a autorizar una nueva orientación económica, que brinda menor protección que el régimen anterior, para las áreas de conservación estricta o parques nacionales.
Aparte de suprimirse la exigencia de las estructuras rústicas, el Decreto (artículo 3°) permite construcciones de hasta tres niveles y utilizar considerables espacios, sin precisar el sitio en que se ubicarán, en la ejecución de los proyectos y actividades (15% del área en concesión para bosques primarios y 25% para bosques secundarios), con las transformaciones o alteraciones ambientales que se seguirían en el suelo edificado. Las áreas silvestres públicas, de las que es guardián el Estado, conforman ecosistemas frágiles de gran biodiversidad, cuyos daños pueden producir consecuencias irreversibles e impedir la preservación de los recursos a largo plazo. Lo anterior, impone una cuidadosa valoración de los costos ambientales y beneficios sociales anejos a los proyectos y actividades a ejecutar dentro de ellas.-
X.Como consecuencia de lo anterior, procede declarar con lugar la presente acción de inconstitucionalidad y anular el Decreto impugnado.-
Por tanto:
Se declaran con lugar las presentes acciones de inconstitucionalidad acumuladas y, en consecuencia, se anula el Decreto Ejecutivo No. 31750-MINAE-TUR de 30 de marzo de 2004. Esta sentencia tiene efectos declarativos y retroactivos a la fecha de vigencia de la norma impugnada, sin perjuicio de los derechos adquiridos de buena fe y las situaciones jurídicas consolidadas. Publíquese íntegramente en el Boletín Judicial y reséñese en el Diario Oficial La Gaceta. Notifíquese al Poder Ejecutivo para lo de su cargo.- Ana Virginia Calzada M.
