The Constitutional Chamber found that the bill to approve the Montreal Protocol Amendment contains no procedural or substantive defects that contravene the Constitution, and aligns with Article 50 of the Constitution.
SummaryResumen
The Constitutional Chamber ruled on the mandatory legislative consultation regarding the bill to approve the Amendment to the Montreal Protocol, adopted at the Eleventh Meeting of the Parties in Beijing (1999). The Amendment introduces new controlled substances (HCFCs, BCCM), trade restrictions with non-Party States, and reporting obligations on methyl bromide for quarantine and pre-shipment applications. The Chamber reviewed the legislative procedure and found no defects: constitutional and regulatory requirements were met, and the initial omission of a plenary session record was corrected ex officio. Regarding the signing of the Amendment, the Court reaffirmed that, under its own precedent and Article 7(2)(c) of the Vienna Convention on the Law of Treaties, representatives accredited to an international conference have full powers to adopt the text, and the President's subsequent participation in ratification and deposit cures any defect. On the merits, the Court held that the Amendment aligns with the Constitution, particularly Article 50, as it aims to protect a healthy environment and restore the ozone layer. It concluded that the bill does not contravene constitutional norms or principles.

Mandatory legislative constitutional consultation (consulta legislativa preceptiva de constitucionalidad) submitted by the Legislative Assembly’s Governing Board concerning the bill entitled “Approval of the Amendment to the Montreal Protocol on Substances that Deplete the Ozone Layer,” being processed under legislative expediente number 16.018.-
Findings:
Justice Armijo Sancho drafts the opinion; and,
Considerations:
I.Subject matter of the consultation: This mandatory constitutional consultation is submitted by the Legislative Governing Board pursuant to Article 96(a) of the Ley de la Jurisdicción Constitucional, in connection with the Bill entitled “Approval of the Amendment to the Montreal Protocol on Substances that Deplete the Ozone Layer,” being processed under legislative expediente number 16.018. The purpose of the Amendment is to incorporate into that Protocol control measures governing the production of hydrochlorofluorocarbons (HCFCs) and bromochloromethane (BCM), to impose restrictions on trade in those substances with States that are not signatories to the Protocol, and to establish a duty to report on methyl bromide used for quarantine and pre-shipment applications, all for the purpose of protecting and restoring the ozone layer, in accordance with the Vienna Convention for the Protection of the Ozone Layer and the Montreal Protocol. The Amendment was adopted in accordance with the procedure established in paragraph 4 of Article 9 of that Vienna Convention.-
II.General aspects of the processing of expediente number 16.018 in the Legislative Assembly.- The bill entitled “Approval of the Amendment to the Montreal Protocol on Substances that Deplete the Ozone Layer” was signed by the then-President of the Republic, Abel Pacheco de la Espriella, and his Minister of Foreign Affairs, Roberto Tovar Faja; it was presented to the Secretariat of the Governing Board of the Legislative Assembly on 20 September 2005 by the then-Vice President of the Republic, Lineth Saborío Chaverri (folios 1 et seq. of the legislative expediente); the bill was published in La Gaceta No. 198 of 14 October 2005. The bill was initially assigned for review to the Comisión Permanente Especial de Relaciones Internacionales y Comercio Exterior by an order dated 20 September 2005 (f. 19); subsequently, at the initiative of the deputies chairing that Commission and the Comisión Permanente Especial de Ambiente, the bill was transferred to the latter by an order dated 21 June 2007 (f. 59).
The Departamento de Servicios Técnicos de la Asamblea Legislativa issued its Socio-Environmental Technical Report on 20 March 2006 (fs. 21 to 44) and its Legal Report on 14 June 2006 (fs. 45 to 54). At the request of the Comisión Permanente Especial de Ambiente, the Minister of Health, María Luisa Ávila Agüero, expressed support for the adoption of the Amendment (fs. 80 and 81). On 18 October 2007, the Comisión Permanente Especial de Ambiente issued a unanimous favorable report (fs. 98 to 108), which was received by the Secretariat of the Governing Board on 7 November 2007 (f. 111); the Bill was included in the call for special sessions by Executive Decree number 34676-MP of 25 August 2008; at the session of 25 August 2008, the plenary approved the bill in the first debate by the unanimous vote of the thirty-nine deputies present (fs. 136 to 141). The copy of the legislative expediente originally sent to the Chamber omitted the folios corresponding to the minutes of the legislative plenary session of 12 August 2008, at which discussion of the bill under consultation began; however, the omission was remedied ex officio by the Secretariat of the Governing Board through a certification forwarded on 2 September 2008 (fs. 5 to 34), which established that the Bill had been sufficiently explained and discussed at that session.-
III.Absence of procedural defects. Examination of legislative expediente no.16.018 shows that the essential requirements established by the Constitution and the Legislative Assembly Rules of Procedure regarding its processing have been satisfactorily fulfilled. To dispel any doubts, reference should be made to an issue noted at the time in the legal report issued by the Departamento de Servicios Técnicos de la Asamblea Legislativa concerning the signature of the Amendment (see folio 49), although it is an issue that is immaterial in this case. As stated, the Bill submitted to the Legislative Assembly was signed by the President of the Republic and his Minister of Foreign Affairs; the expediente contains a certification from the Head of the Oficina Asesora de Tratados Internacionales of the Dirección General de Política Exterior of the Ministerio de Relaciones y Culto stating that the copies of the text to be approved are true and exact reproductions of the text of the Amendment adopted at the Eleventh Meeting of the Parties, held in Beijing, China, from 29 November to 3 December 1999.
The Departamento de Servicios Técnicos indicated that it could not verify whether the representative accredited by the Government of Costa Rica had attended that Meeting, nor could it verify that representative’s corresponding authority, but it concluded that, under constitutional case law (judgment No. 3388-98), the Amendment could properly be approved by the legislature (f. 50). Indeed, the State may validly express its consent to be bound through means other than signing the instrument, as in this case, where it was adopted by vote within an international conference under the Vienna Convention for the Protection of the Ozone Layer and its Montreal Protocol on Substances that Deplete the Ozone Layer, to which the State of Costa Rica is a Party and whose provisions form part of our domestic law (laws No. 7228 and 7808). When consulted regarding a similar situation, the Chamber held that:
“the Departamento de Servicios Técnicos noted that there was no record that full powers had been granted to the Ambassador who signed the instrument and therefore considered that her authority should be established; it accordingly recommended requesting that the Executive Branch provide, in addition to certification of the signatures, certification of the corresponding authority. Although the recommendation has not been followed with respect to the deficiency in establishing the signature and authority of the person who signed the Treaty on behalf of the State, Article 7, paragraph 2(c), of the Vienna Convention on the Law of Treaties provides that representatives accredited by States to an international conference or to an international organization or one of its organs are considered to represent the State with full powers for the purpose of adopting the text of a treaty at such conference, organization, or organ, as in the present case, in which the Treaty was signed by the Permanent Ambassador to the FAO during the 31st session of that organization’s Conference.
On this matter, the Chamber has also held that the participation of the President of the Republic through his assent at subsequent procedural stages—the ratification and deposit of the Treaty—makes it possible to cure any defect that may have existed in the effective representation (see, among others, judgments number 6624-94 and 2002- 08190)”.-
As to the merits of the Bill under consultation, no inconsistency with the Constitution is observed either; it is an Amendment to an international instrument that adds new substances to be subject to the control measures established in the Treaty and sets deadlines for their adoption, all for the purpose of contributing to the preservation of a healthy and ecologically balanced environment for humankind, in accordance with Article 50 of the Political Constitution. Provided that the interpretation and application of these provisions do not produce results contrary to the Constitution, their text does not itself conflict with it in any way.-
Por tanto:
The mandatory consultation is answered by finding that the bill entitled “Approval of the Amendment to the Montreal Protocol on Substances that Deplete the Ozone Layer,” being processed under legislative expediente number 16.018, does not conflict with constitutional principles or provisions.
