Proceeding for protection of constitutional rights (recurso de amparo) being processed under case number 08-004784-0007-CO, filed by RODOLFO SOTOMAYOR AGUILAR, VICTOR RAFAEL HERRERA FLORES, of legal age, identity card numbers 0602690071, 0106750069, resident of, on behalf of, of legal age, identity card number, resident of, against MINISTERIO PUBLICO DE PUNTARENAS.- Findings of Fact (Resultando):

  1. 1The petitioner states that the TIUNA I vessel, flying the Panamanian flag, obtained a tuna-fishing license in Costa Rica. This was an administrative act (acto administrativo) of INCOPESCA, the institution that issued license number 0082008. On 29 de enero del 2008, while conducting fishing operations authorized by the license, the vessel was detained by Coast Guard authorities of the Ministerio de Seguridad Pública near Isla del Coco, at the geographic position of north latitude zero five degrees, forty-eight, and west longitude zero eighty-seven degrees, zero three minutes. This corresponds to sixteen point four nautical miles from the nearest territory belonging to Isla del Coco. The vessel was allegedly detained for engaging in illegal fishing activities. Based on these events, the Ministerio Público initiated criminal proceeding (proceso penal) 08-200413-431-PE. The waters in which it was detained had been expressly authorized by INCOPESCA for the TIUNA’s operations.The Coast Guard vessel was being directed and crewed by park-ranger officials armed with high-caliber weapons. A large vessel called PANGÓN served to hold the TIUNA in place so that the current would not move it. Upon approaching, the park rangers ordered the PANGON’s engines shut down because they had to wait for a “PRIVATE” vessel (the PROTEUS), aboard which, “coincidentally,” journalists and camera operators from several national news programs were traveling. The TIUNA’s crew obeyed the officials’ order and shut down all the pangón’s engines, causing both vessels to be left adrift. Once without propulsion, the park rangers were invited aboard with the clear and transparent purpose of allowing them to verify the position at which the TIUNA had been detained and the lawfulness of the fishing. The officials refused to board on the pretext that they had to wait for the others arriving aboard the PROTEUS, a private vessel.Approximately two hours later, representatives of the Proteus and the news programs appeared, and only then was the TIUNA boarded by the park rangers. In other words, for more than two hours, and because of an improper decision by duly empowered authorities, the TIUNA remained adrift. Once aboard, the park rangers began verifying positions. At that time, the park-ranger representatives arbitrarily ordered that the catch not yet placed in the vessel’s freezers be thrown into the sea, even though it was already dead. This caused genuine environmental harm because, given the quantity involved, that catch should never have been thrown into the sea. Once inside the vessel, all the park rangers observed that the initial fishing set had been made beyond the twelve-mile limit. Although the TIUNA had originally been detained beyond the twelve-mile limit, merely to satisfy the demands of representatives of Mar Viva and the news programs, after these persons contacted the Ministerio Público de Puntarenas, the TIUNA and the pangón were detained and forced to travel to Puerto de Puntarenas on 31 de enero del 2008.The petitioner argued that, contrary to law, the Fiscalía Adjunta de Puntarenas determined that all crew members were to be treated as accused persons (imputados), including the marine biologist, who did not work for the vessel but for the CIAT, a United Nations organization that monitors and supervises tuna fishing pursuant to an international agreement. The Fisheries Law provides that only the vessel’s Captain is liable for fishing operations under criminal, civil, and administrative law (Article 116 of the Fisheries and Aquaculture Law). The Fiscalía Adjunta de Puntarenas ordered that the vessel be guarded and maintained by the INSTITUTO COSTARRICENSE DE PESCA Y ACUICULTURA (INCOPESCA). However, that institute categorically refused to accept such responsibility, and by a decision issued at quince horas cincuenta minutos on dieciocho de febrero del dos mil ocho by the Fiscalía Adjunta de Puntarenas itself, it was ordered that responsibility for the care, custody, judicial deposit (depósito), and maintenance of the vessel and its catch would rest with a JOINT ADMINISTRATION (COADMINISTRACION) between INCOPESCA and the captain of the TIUNA.He considers that decision by the Ministerio Público absurd and unlawful and that it was imposed through a threat by the Prosecutor’s Office against INCOPESCA’s directors that, if they did not accept it, proceedings for disobedience of authority would be brought against them. He states that the fundamental rights violated or threatened are due process (debido proceso), access to the appropriate jurisdiction, the right to equality, and those rights grounded in the principles of legality, democracy, the natural judge (juez natural), the right to appropriate proceedings, and those affecting due process that derive from the requirement of strict judicial authority (estricta jurisdiccionalidad). The petitioner argued that prosecutors assist in the administration of justice but are not themselves a judicial body, and therefore amparo relief is proper against the disproportionate, arbitrary, illegitimate, and unlawful actions of the Ministerio Público de Costa Rica (Fiscalía Adjunta de Puntarenas and Fiscal General de la República).He argues that the principles of universality and exclusivity of criminal jurisdiction vested in the Poder Judicial render void any decision affecting a criminal proceeding that is imposed by entities whose members have not been appointed as judges. The Ministerio Público decided to place the TIUNA vessel in the judicial custody (depósito judicial) of INCOPESCA and the ship’s captain. This was not an act of a judicial nature but an administrative act of the Ministerio Público; therefore, once this amparo is admitted, that act must be suspended immediately in accordance with the law governing Costa Rican constitutional justice because the Ministerio Público does not fall within the substantive constitutional conception of the Poder Judicial. The acts of the Ministerio Público are not judicial acts, and judicial custody, as a judicial act, must be ordered by a judicial authority. He considers that this manner of proceeding has tainted the entire criminal proceeding instituted against the TIUNA’s crew and owners, rendering it void.In his petition, the petitioner stated that no criminal statute encompasses the conduct at issue, and therefore criminal law does not apply; that due process, both as a safeguard and as a fundamental right, is violated when, as described above, the Poder Judicial, through the Juez Penal de Puntarenas, fails to neutralize or prevent abuses by assisting agencies such as the Ministerio Público. He further stated that Costa Rican criminal procedure was recently reformed and that, through circumstances such as those occurring in the criminal proceeding against the TIUNA’s crew, the Chamber would define, on constitutional grounds, the methods of operation, the roles of participants in criminal proceedings, and the scope of their decisions, and the Costa Rican Constitutional Court would apply the safeguards. He considers that this Court must define the limits of the State’s criminal-prosecution authority and restrict the arbitrary and violent exercise of power by the Ministerio Público and certain criminal courts.The petitioner stated that the principles of equality and legality had been violated because there should be no criminal prosecution where there is no crime or applicable criminal statute; he believes the conduct is not legally defined as an offense and considers the matter to fall within the jurisdiction of the Tribunal ambiental administrativo, particularly under Article 153 of Ley 8436 de Pesca y Acuicultura: “Anyone who ...engages in commercial fishing activity..... within the protected wilderness areas indicated in the first paragraph of Article 9 of this Law shall be punished by a fine of twenty to sixty base salaries......”; and Article 131 adds: “INCOPESCA shall be responsible for imposing the administrative penalties consisting of fines and undertaking the collection procedures provided for in this Law.....” He stated that the democratic principle had also been violated in this case and was threatened by excessive resort to criminal proceedings to resolve social conflicts when criminal law should be the last resort (última ratio).He considers that the Ministerio Público encroached upon the jurisdiction of the Tribunal Ambiental Administrativo, with the subsequent acquiescence of the Juzgado Penal de Puntarenas. He also considers the principle of inviolability of the defense to have been violated and, in general, bases this amparo on Articles 1, 10, 11, 19, 27, 33, 35, 37, 39, 41, 45, 48 and 152 of the Constitución Política de la República de Costa Rica and Articles 29 to 56 of the Ley de la Jurisdicción Constitucional, as well as the provisions of the Ley de Pesca y Acuicultura generally applicable to tuna fishing, particularly Articles 61, 131 and 153, and Articles 1 through 15 of the Código Procesal Penal. With respect to due process, the requirement of strict judicial authority, and the right to equality before the law, he states that he relies on a lengthy list of decisions issued by this Sala Constitucional.He requests protection of the fundamental rights of the twenty-two crew members and the owners of the Tiuna, which were violated by the arbitrary acts of the Ministerio Público that forced criminal prosecution of a matter falling within the authority of the Tribunal Ambiental Administrativo; that all proceedings conducted in the criminal venue before the Juzgado Penal de Puntarenas be declared entirely void, the duly certified case file of which he submitted as an annex to this Amparo; that the appointment by the Ministerio Público of judicial custodians or depositaries (depositarios judiciales) of the Tiuna vessel—namely, the Instituto Costarricense de Pesca y Acuicultura and the captain of the TIUNA—be declared void; that such administrative act be suspended; and that the Tribunal Ambiental Administrativo be asked to act, take charge of the case involving the Tiuna, and comply with Costa Rican law, affording the right of defense if its decisions are challenged.
  2. 2By a decision issued at quince horas un minuto on diecisiete de marzo de dos mil ocho, the respondents were ordered to submit a report concerning the alleged facts.
  3. 3The Deputy Prosecutor of Puntarenas reports that the facts concerning the vessel Tiuna are under investigation; that on January 29, 2008, personnel from the Ministerio de Ambiente y Energía responsible for safeguarding Parque Nacional Isla del Coco, in coordination with officials from the Servicio Nacional de Guardacostas, detained the Panamanian-flagged tuna vessel “Tiuna” because its crew members were engaged in illegal fishing in the jurisdictional waters of Isla del Coco; that the detention was lawful because they were exercising the powers granted by Article 9 of the Ley de Pesca y Acuacultura; that the vessel’s captain was instructed to cease fishing; that, because of the number of people aboard the vessel and in order to protect themselves, they decided to board the vessel until reinforcements arrived from the patrol boat Proteus; that after detaining the persons aboard the vessel, they coordinated with the Fiscalía, which ordered them to bring the Tiuna and its crew members to Puerto Caldera so that their legal status could be determined; that the vessel was brought in on the morning of January 31, 2008, when a search (allanamiento) was conducted pursuant to an order from the Juzgado Penal de Puntarenas, during which the holds were opened and the presence of fishing gear was confirmed; that notice had been received of an offense committed against natural resources; that when proceedings were instituted, the rights of the accused were guaranteed; that the vessel’s position is an evidentiary matter open to dispute in criminal proceedings; that the license held by the vessel Tiuna is for tuna fishing in Pacific jurisdictional waters and does not authorize fishing within Costa Rica’s territorial sea, that is, within twelve miles; that the only conduct over which the Instituto Costarricense de Pesca y Acuicultura has jurisdiction is that provided for in Article 152 of the Ley de Pesca y Acuicultura, because the remaining conduct constitutes criminal offenses; that this is an investigative stage and, during it, the Ministerio Público is empowered to undertake any measures it deems necessary to identify the perpetrators and participants in an offense, such that measures undertaken for that purpose are valid; that fishing is not carried out solely by the captain and therefore all persons aboard the vessel, regardless of their duties, must be investigated; that provisional custody (depósito provisional) of the vessel must be granted to the Instituto Costarricense de Pesca y Acuicultura because it is the governing institution responsible for applying the Ley de Pesca y Acuicultura; that, given the vessel captain’s willingness to safeguard it, it was decided to entrust custody to him, and INCOPESCA was asked to share that responsibility; and that the work of the Ministerio Público complies with the law.
  4. 4The statutory time limits and requirements have been observed in the proceedings.

Justice Godínez Vargas drafts the opinion; and,

Whereas:

I.Regarding the facts. The following facts are relevant to the resolution of this matter: a) on January 29, 2008, the Servicio Nacional de Guardacostas located the Panamanian-flagged vessel Tiana approximately 9.5 nautical miles northeast of Islote Manuelita, Isla del Coco, engaged in fishing operations, and therefore waited for additional security personnel before boarding the vessel (see report at folio 5 of the copies of expediente número 08- 200413-0431-PE); b) by order of the Fiscal de Puntarenas, the officials proceeded to release a large number of fish caught in the nets, immediately close the holds, and seize (secuestro) the logbooks, all of which was transported to Muelle de Caldera (see folio 14); c) once the vessel arrived at Muelle de Caldera, judicial officials went there and coordinated with MINAE to file the corresponding complaint (see folio 15); d) the Fiscal requested from the Juez Penal de Puntarenas an order to search, inspect, and seize (allanamiento, registro y secuestro) the vessel Tiuna in order to obtain evidence with which to proceed in the illegal-fishing case (see folio 16); e) the Juez Penal de Puntarenas ordered the search, inspection, and seizure of the vessel Tiuna for an infringement of the Ley de Pesca (see resolución de las 8:00 horas del 31 de enero de 2008 at folio 20 of the copies of the judicial case file); f) the accused were questioned (indagados) by the Ministerio Público (see folio 99); g) the vessel Tiuna was placed in the provisional custody of the Instituto Costarricense de Pesca y Acuicultura and the vessel’s captain, Mr.

Ariel Bustamante Sánchez; the auction of the perishable product was also ordered (see folios 449, 461 y 557); g) the Fiscalía de Puntarenas denied the request submitted by the Presidente Ejecutivo de INCOPESCA to revoke the appointment of the institution he represents as provisional custodian (depositario provisional) of the vessel Tiuna, because it is the institution required to assume responsibilities related to the application of the Ley de Pesca y Acuicultura (see folio 624); h) the Juzgado Penal de Puntarenas ruled on the motions for final dismissal (sobreseimiento definitivo) and the motions for reconsideration and appeals (recursos de revocatoria y apelación) filed against the actions of the Ministerio Público, regarding the accused persons’ unloading of the product pending the legally appropriate determination, and denied the request for donation because the perishable product was in the process of being sold (see folios 691 y 692).

II.Regarding the law. The Chamber deems it necessary to recall that the amparo proceeding (recurso de amparo) was established solely to provide timely protection against violations of, or imminent threats to, fundamental rights and freedoms. Accordingly, as a general rule, its admissibility depends not only on proof of interference—or threatened interference—with one or more of the rights or guarantees recognized in the Political Constitution or in the international human-rights instruments signed by the country, but also on the alleged grievance constituting a direct and gross threat to or violation of those rights that, because of its urgency, does not permit waiting for the ordinary judicial remedies to take effect. This means that not every alleged violation of one of those rights is suitable for adjudication in this forum, because the alleged violation must also endanger that portion of its content which is essential and inherent to it; that is, the core that gives it its distinctive character and makes it recognizable as a right of a particular nature.

In other words, this is its very reason for being: the indispensable component that enables its holder to secure the satisfaction of those interests for whose attainment the right was granted and that, for this reason, lies beyond the regulatory authority of all public powers. In legal doctrine, the foregoing is known as the minimum essential content (contenido mínimo esencial) of the right. Thus, it has been held that a limitation affects the essential content of a Fundamental Right when it reduces the person subject to the Administration (Administrado) to a mere object of state activity. This occurs, for example, when the exercise of that Right is conditioned on compliance with conditions, prerequisites, or requirements of such a nature that, in practice, they make its exercise materially impossible or ineffective (on this matter, see sentencia número 6482-96 de las 14:54 horas del 28 de noviembre de 1996).

Consequently, any conduct by the Administration that entails an injury of this kind is a matter for amparo, whereas conduct that does not is a matter of ordinary legality. The appellant’s disagreement is based on several fundamental issues: on the one hand, the dispute concerning the circumstances surrounding the detention of the vessel Tiuna and its authorization from Incopesca to conduct fishing operations; however, determining whether authorization existed, the vessel’s location, whether the conduct constitutes a criminal offense, whether it was in territorial waters, and whether the Tribunal Ambiental Administrativo must intervene are matters to be resolved in the investigation being conducted by the Fiscalía de Puntarenas. On the other hand, the detention of the tuna vessel and its crew members, the boarding of the vessel, and the disposition of the product they were transporting were all actions ordered by the Fiscal in the performance of his investigative duties, whose proper conduct and protection of fundamental rights were supervised by the Juez Penal de Puntarenas.

Finally, the decision to place the vessel in the provisional custody of the Instituto Costarricense de Pesca y Acuicultura also had the consent of the Juez de Garantías. Pursuant to Article 17 of the Código Procesal Penal, even in the absence of a formal complaint (instancia), the representative of the Ministerio Público is empowered to undertake urgent and indispensable procedural acts (actos procesales) to preserve evidence; moreover, numeral 29 of the Ley Orgánica del Ministerio Público provides that the Fiscal responsible for investigating an offense must identify and gather the incriminating evidence (elementos de convicción) in a manner that permits review by the superior authority and the defense of the victim and the other parties. In any event, if there is any procedural irregularity or illegality, as the appellant claims, it must be raised before the criminal courts and not in these proceedings. For these reasons, the Chamber finds no violation of the rights protected by this remedy.

Therefore:

The petition is DENIED.

Resultando:

  1. 1Manifiesta el recurrente que la embarcación TIUNA I, de bandera panameña, adquirió en Costa Rica la licencia de pesca de atún. Un acto administrativo de INCOPESCA, institución que otorgó la licencia bajo la numeración 0082008. El 29 de enero del 2008, la embarcación fue detenida, mientras realizaba faenas de pesca autorizada por la licencia, por autoridades de guardacostas del Ministerio de Seguridad Pública, en las cercanías de la Isla del Coco, con posición geográfica latitud norte cero cinco grados, cuarenta y ocho y longitud oeste cero ochenta y siete grados, cero tres minutos. Eso corresponde a dieciséis punto cuatro millas náuticas del territorio más cercano perteneciente a la isla del Coco. La embarcación fue detenida supuestamente por estar ejerciendo actividades de pesca ilegal. Por estos hechos, el Ministerio Público inició el proceso penal 08-200413-431-PE. Las aguas donde fue detenida estaban nave guardacostas era guiada y tripulada por funcionarios de guardaparques, armados con armas de grueso calibre.Una embarcación grande, denominada PANGÓN tiene la función de sostener al TIUNA para que la corriente no lo mueva. Al momento de aproximarse, los guardaparques ordenaron apagar las máquinas del PANGON pues, debían de esperar a una embarcación "PRIVADA" (el PROTEUS), en la cual "coincidentemente" venían periodistas y camarógrafos de algunos noticieros nacionales. La tripulación del TIUNA obedeció la orden de los funcionarios y apagaron todos los motores del pangón, lo que hizo que ambas naves quedaran a la deriva. Una vez sin fuerza motriz, se invitó a los guardaparques a subir abordo con el claro y transparente objetivo que verificaran la posición en que fue detenido el TIUNA y la legalidad de la pesca. Los funcionarios se negaron a subir a bordo bajo la excusa de que debían de esperar a aquellos otros que venían en el PROTEUS, nave privada. Dos horas después, aproximadamente, aparecieron los personeros del Proteus y de los noticieros y no fue sino hasta ese momento que el TIUNA fue abordado por los guardaparques.O sea por más de dos horas y debido a una decisión impropia de autoridades investidas, el TIUNA estuvo a la deriva. Una vez a bordo, los guardaparques comenzaron a verificar posiciones. En ese momento, los personeros de guardaparques, arbitrariamente, ordenaron tirar al mar el producto que faltaba de introducir en los congeladores de la embarcación, producto que en ese momento, se encontraba sin vida. Se produjo así un verdadero daño ambiental pues dicho producto, debido a la cantidad, jamás debió haber sido lanzado al mar. Una vez dentro de la embarcación todos los guardaparques observaron que el lance inicial de pesca se hizo fuera de las doce millas. A pesar que el TIUNA originalmente había sido detenido fuera de las doce millas y simplemente para satisfacer los requerimientos de los representantes de Mar Viva y de los noticieros, una vez que estas personas se comunicaron con el Ministerio Público de Puntarenas, el TIUNA y el pangón fueron detenidos y obligados a trasladarse al Puerto de Puntarenas, el día a 31 de enero del 2008.El recurrente argumentó que contra la ley, la Fiscalía Adjunta de Puntarenas, estableció que todos los tripulantes (incluso el Biólogo marino, quien no labora para la embarcación sino que trabaja para la CIAT, organización de las Naciones Unidas quien vigila y supervisa la pesca del atún con base a un acuerdo internacional) fueran tenidos como imputados. La Ley de Pesca establece que solamente el Capitán de la embarcación es el responsable de las faenas de pesca desde el punto de vista penal, civil y administrativo (artículo 116 de la Ley de Pesca y Acuicultura). La Fiscalía Adjunta de Puntarenas, ordenó que la embarcación debiera ser custodiada y mantenida por el INSTITUTO COSTARRICENSE DE PESCA Y ACUICULTURA (INCOPESCA). Pero este instituto se negó rotundamente a aceptar tal responsabilidad y por decisión de las quince horas cincuenta minutos del dieciocho de febrero del dos mil ocho de la propia Fiscalía Adjunta de Puntarenas, se ordenó que la responsabilidad del cuido, custodia, depósito y mantenimiento de la embarcación y del producto, le correspondía a una COADMINISTRACION entre INCOPESCA y el capitán del TIUNA.Considera que esa decisión del Ministerio Público es absurda e ilegal y fue impuesta bajo amenaza de parte de la Fiscalía a los directores de INCOPESCA, en el sentido que de no aceptarla se les seguiría causa por desobediencia a la autoridad. Expresa que los derechos fundamentales violentados, o amenazados, son el debido proceso, el acceso a la jurisdicción idónea, el derecho de igualdad y aquellos sustentados en los principios de legalidad, democrático, juez natural y derecho al proceso apropiado y aquellos que afectan al debido proceso y que derivan del presupuesto de estricta jurisdiccionalidad. Argumentó el recurrente que los Fiscales coadyuvan a la administración de Justicia, pero no son entidad jurisdiccional por sí mismos, por lo que procede el amparo contra las actuaciones desproporciónales, arbitrarias, ilegítimas e ilegales del Ministerio Público de Costa Rica (Fiscalía Adjunta de Puntarenas y Fiscal General de la República).Argumenta que el principio de universalidad y exclusividad de la jurisdicción penal por parte del Poder Judicial hacen nula cualquier decisión, de impacto en un proceso penal, impuesta por entidades cuyos miembros no hayan sido investidos como jueces. El Ministerio Público decidió dar en depósito judicial la nave TIUNA al INCOPESCA y al capitán del barco. Este no fue un acto de naturaleza jurisdiccional, sino administrativo del Ministerio Público y por lo tanto al darse curso a este amparo se habrá de suspender, de acuerdo a la Ley que regula la justicia constitucional costarricense, tal acto de manera inmediata porque el Ministerio Público no entra dentro de la concepción material-constitucional del Poder Judicial. Los actos del Ministerio Público no son jurisdiccionales y un depósito judicial, como acto jurisdiccional, debe ser hecho por una autoridad jurisdiccional. Considera que esta forma de hacer las cosas ha contaminado todo el proceso penal incoado contra la tripulación y los propietarios del TIUNA, convirtiéndolo en nulo.El recurrente indicó en su recurso que no existe ley penal que incluya la hipótesis realizada así que no es aplicable el Derecho Penal, que se violenta el debido proceso (tanto como garantía como derecho fundamental) cuando, como se ha venido describiendo, el Poder Judicial, mediante el Juez Penal de Puntarenas, no llega a neutralizar, o impedir, los abusos de aquellas agencias coadyuvante como el Ministerio Público. Expresó además, que el proceso penal costarricense fue reformado recientemente, y con hechos como los sucedidos dentro del proceso penal contra la tripulación del TIUNA la Sala delimitará constitucionalmente las formas de operar, los roles de los operadores del proceso penal y los alcances de sus decisiones, el Tribunal Constitucional costarricense aplicará las garantías. Considera que este tribunal debe delimitar el poder de persecución penal del Estado y que ponga límites al ejercicio arbitrario y violento del Ministerio Público, y de algunos tribunales penales.El recurrente manifestó que ha sido violentado el principio de igualdad y el de legalidad por cuanto no debiera de haber persecución penal donde no hay crimen, ni una ley penal aplicable, estima que la conducta no está tipificada, considera que esto es competencia del Tribunal ambiental administrativo, en especial por lo establecido en el artículo 153 de la Ley 8436 de Pesca y Acuicultura: "Quien ...ejerza la actividad de pesca comercial..... en las áreas silvestres protegidas indicadas en el primer párrafo del artículo 9 de esta Ley, se sancionará con multa de veinte a sesenta salarios base......" y en su artículo 131 agrega: "El INCOPESCA será el encargado de aplicar las sanciones administrativas de multa y gestión de cobro contempladas en esta Ley....." Señaló que también se ha violentado en la especie el principio democrático, amenazado por la búsqueda excesiva de la vía penal para resolver los conflictos sociales, cuando debía ser la última ratio.Considera que se dio una invasión de las competencias del Tribunal Ambiental Administrativo por parte del Ministerio Público, -con la complacencia posterior del Juzgado Penal de Puntarenas. Considera violentado también el principio de inviolabilidad de la defensa, y en general apoya este amparo en los artículos 1, 10, 11, 19, 27, 33, 35, 37, 39, 41, 45, 48 y 152 de la Constitución Política de la República de Costa Rica y los artículos 29 a 56 de la Ley de la Jurisdicción Constitucional, además de lo dispuesto en la Ley de Pesca y Acuicultura aplicable en general a la pesca del atún y en particular los artículos 61, 131 y 153, y los artículos 1 al 15 del Código Procesal Penal. En materia de debido proceso, presupuesto de estricta jurisdiccionalidad y derecho de igualdad ante la ley manifiesta apoyarse en una larga lista de votos de esta Sala Constitucional. Solicita se tutelen los derechos fundamentales de los veintidós miembros de la tripulación y de los propietarios del Tiuna, violentados por los actos arbitrarios del Ministerio Público que han obligado a perseguir judicialmente en vía penal lo que corresponde al Tribunal Ambiental Administrativo, que se declare totalmente nulo lo actuado en sede penal ante el Juzgado Penal de Puntarenas y cuyo declare nulo el nombramiento de custodios o depositarios judiciales de la nave Tiuna llevado a cabo por el Ministerio Público y que recayó en el Instituto Costarricense de Pesca y Acuicultura y el capitán del barco TIUNA, que se suspenda tal acto administrativo se le pida al Tribunal Ambiental Administrativo actúe y se encargue del caso del barco Tiuna y cumpla con lo ordenado por la legislación costarricense, concediendo el derecho de defensa en caso que se discrepe de sus decisiones.
  2. 2En resolución de las quince horas un minuto del diecisiete de marzo de dos mil ocho, se solicitó informe a los recurridos sobre los hechos alegados.
  3. 3El fiscal Adjunto de Puntarenas informa que los hechos en relación a la embarcación Tiuna se encuentran en investigación; que el 29 de enero de 2008, personeros del Ministerio de Ambiente y Energía, encargados de custodiar el Parque Nacional Isla del Coco, en coordinación con funcionarios del Servicio Nacional de Guardacostas, detuvieron a la embarcación Atunera “Tiuna”, de bandera panameña, ya que sus tripulantes estaban realizando pesca ilegal en aguas jurisdiccionales de la Isla del Coco; que la detención fue conforme a derecho, ya que estaban ejerciendo las potestades que otorga el artículo 9 de la Ley de Pesca y Acuacultura; que al capitán de la embarcación se le indicó que dejaran de pescar; que debido a la cantidad de personas que había en la embarcación y a fin de protegerse, se dispuso abordar la nave hasta el momento en que llegaran refuerzos de la lancha Proteus; que posterior a la detención de las personas que estaban en la embarcación, se pusieron en coordinación con la Fiscalía, donde se ordenó que trajeran el Tiuna y sus tripulantes a Puerto Caldera a fin de resolver su situación jurídica; que la nave fue presentada el 31 de enero de 2008 en horas de la mañana, donde se realizó un allanamiento por orden del Juzgado Penal de Puntarenas, en el cual se realizó la apertura de las bodegas y se constató la existencia de instrumentos de pesca; que existió una noticia del delito cometido en perjuicio de los recursos naturales; que al abrirse el proceso se garantizó los derechos de los imputados; que la posición de la embarcación es un elemento de prueba discutible en la vía penal; que la licencia que tiene el barco Tiuna es para pesca de atún en aguas jurisdiccionales del Pacífico y no autoriza la pesca dentro del mar territorial de Costa Rica, es decir, las doce millas; que la única conducta que debe conocer el Instituto Costarricense de Pesca y Acuicultura son las previstas en el artículo 152 de la Ley de Pesca y Acuicultura, pues las demás conductas constituyen delitos, que se trata de de una etapa de investigación y en la misma, el Ministerio Público esta facultado para realizar las diligencias que considere necesarias para determinar los autores y participes de un delito, de tal manera que las diligencias para llegar a ese fin tienen validez; que la pesca no la realiza solo el capitán, por lo que todas las personas que están en la embarcación, sin importar la labor, deben ser investigadas; que el deposito provisional de la nave se le debe dar al Instituto Costarricense de Pesca y Acuicultura, al ser la institución rectora en la aplicación de la Ley de Pesca y Acuicultura; que ante la anuencia del capitán del barco de custodiarlo, se dispuso dársela y se le solicitó a INCOPESCA que fuera compartido; que la labor del Ministerio Público se encuentra apegada a derecho.
  4. 4En los procedimientos se han observado los términos y prescripciones de ley.

Redacta el Magistrado Godínez Vargas; y,

Considerando:

I.Sobre los hechos. De importancia para la resolución de este asunto, se tienen los siguientes hechos: a) que el Servicio Nacional de Guardacostas localizó, en fecha 29 de enero de 2008, la embarcación Tiana, de bandera panameña, a unas 9.5 millas náuticas del nor-este del Islote Manuelita Isla del Coco, en faenas de pesca, por lo que esperaron más personal de seguridad para abordar la nave (ver informe a folio 5 de las copias del expediente número 08- 200413-0431-PE); b) que por orden del Fiscal de Puntarenas, los funcionarios procedieron a liberar gran cantidad de peces que se encontraban en las redes, al cierre inmediato de las bodegas, y al secuestro de las bitácora, todo lo cual fue trasladado al Muelle de Caldera (ver folio 14); c) que una vez llegada la embarcación al Muelle de Caldera, se trasladaron funcionarios judiciales, quienes coordinaron con el MINAE para la interposición de la denuncia correspondiente (ver folio 15); d) que el Fiscal le solicitó al Juez Penal de Puntarenas una orden de allanamiento, registro y secuestro en la nave Tiuna, con el fin de obtener material probatorio para proseguir con la causa por pesca ilegal (ver folio 16); e) que el Juez Penal de Puntarenas ordenó el allanamiento, registro y secuestro de la embarcación Tiuna por Infracción a la Ley de Pesca (ver resolución de las 8:00 horas del 31 de enero de 2008 a folio 20 de las copias del expediente judicial); f) que imputados fueron indagados por el Ministerio Público (ver folio 99); g) que la embarcación Tiuna fue dada en deposito provisional al Instituto Costarricense de Pesca y Acuicultura y al capitán de la nave, señor Ariel Bustamante Sánchez; asimismo se ordenó la subasta del producto perecedero (ver folios 449, 461 y 557); g) que la Fiscalía de Puntarenas rechazó la solicitud interpuesta por el Presidente Ejecutivo de INCOPESCA para que se dejara sin efecto en nombramiento de su representada como depositario provisional del barco Tiuna, por ser la institución obligada a asumir las responsabilidades relacionadas con la aplicación de la Ley de Pesca y Acuicultura (ver folio 624); h) que el Juzgado Penal de Puntarenas resolvió las gestiones de sobreseimiento definitivo, recursos de revocatoria y apelación presentados contra las actuaciones del Ministerio Público, sobre la descarga del producto por parte de los imputados hasta tanto se resuelva lo que en derecho corresponda y se rechazó la solicitud de donación, ya que se encuentra en proceso de venta del producto perecedero (ver folios 691 y 692).

II.Sobre el derecho. La Sala considera necesario recordar que el recurso de amparo ha sido instituido únicamente para brindar tutela oportuna contra infracciones o amenazas inminentes a los derechos y libertades fundamentales. De ahí que, en general, su procedencia esté condicionada no sólo a que se acredite la existencia de una turbación —o amenaza de turbación— a uno o más de los derechos o garantías contemplados en la Carta Política o en los instrumentos internacionales de derechos humanos suscritos por el país; sino a que, además, el agravio alegado comporte una amenaza o quebranto directo y grosero de aquellos derechos, que por su carácter apremiante no permita esperar a que surtan efecto los remedios jurisdiccionales ordinarios. Esto quiere decir que no toda supuesta vulneración de uno de tales derechos es idónea para ser discutida en esta sede, ya que, además, la presunta violación debe poner en peligro aquella parte de su contenido que le es esencial y connatural; es decir, el núcleo que le presta su peculiaridad y lo hace reconocible como derecho de una naturaleza determinada.

En otras palabras, se trata de su razón de ser; el componente indispensable para que su titular pueda obtener la satisfacción de aquellos intereses para cuya consecución ese derecho se ha otorgado y que, por ello, queda sustraído de la esfera de regulación de todos los poderes públicos. Lo anterior, en doctrina, es conocido como el contenido mínimo esencial del derecho. Así las cosas, se ha dicho que una limitación afecta el contenido esencial de un Derecho Fundamental cuando torna al Administrado en un mero objeto de la actividad estatal. Esto ocurre, por ejemplo, cuando se condiciona el ejercicio de ese Derecho al cumplimiento de condiciones, presupuestos o requisitos de tal naturaleza que, en la práctica, hacen materialmente imposible o nugatorio su uso (sobre el particular véase la sentencia número 6482-96 de las 14:54 horas del 28 de noviembre de 1996). Por consiguiente, cualquier conducta de la Administración que comporte una lesión de esa índole, es materia de amparo, y aquella que no lo haga, es materia de mera legalidad.

La disconformidad del recurrente está basada en varios aspectos fundamentales: por un lado la discusión sobre los hechos en la detención de la embarcación Tiuna y su autorización por Incopesca para realizar faenas de pesca, pero el determinar si existió autorización, el punto de ubicación de la nave, si la conducta es típica o no, si estaba o no en aguas territoriales, y si debe el Tribunal Ambiental Administrativo intervenir, son aspectos que deben resolverse en la investigación que realiza la Fiscalía de Puntarenas. Por otra parte, en la detención del barco atunero y sus tripulantes, el abordaje del navío y la disposición del producto que transportaban, todas ellas fueron actuaciones ordenadas por el Fiscal en su labor investigativa, cuya correcta observancia y tutela de derechos fundamentales fue ejercida por el Juez Penal de Puntarenas. Finalmente, la decisión de dar en depósito provisional la nave al Instituto Costarricense de Pesca y Acuicultura contó también con la anuencia del Juez de Garantías.

De conformidad con el artículo 17 del Código Procesal Penal, aunque no existiera instancia, se faculta al representante del Ministerio Público a realizar los actos procesales urgentes e imprescindibles para conservar los elementos de prueba, aunado a ello el numeral 29 de la Ley Orgánica del Ministerio Público dispone que es el Fiscal a cargo de la investigación de un delito, el que debe identificar y reunir los elementos de convicción de forma que permita el control del superior, la defensa de la víctima y las demás partes. En todo caso, si existe una irregularidad o ilegalidad del proceso, como lo reclama el recurrente, ella debe ser planteada ante la jurisdicción penal y no en esta vía. Por estas razones, no encuentra la Sala que haya lesión a los derechos protegidos por este recurso.

Por tanto:

Se declara SIN LUGAR el recurso.
