Constitutional challenge (acción de inconstitucionalidad) brought by Nombre01, of legal age, married, attorney, identity card number CED01, resident of Concepción de San Rafael de Heredia; against Articles 27 and 28 of Ley Forestal number 7575 of 13 de febrero de 1996, as well as Articles 90 and 91 of its regulations, Decreto Ejecutivo number 25721-MINAE of 17 de octubre de 1996. Ana Lorena Brenes Esquivel also participated in the proceedings on behalf of the Procuraduría General de la República.

Findings:

  1. 1In a written submission received by the Secretaría de la Sala at ten hours and fifteen minutes on veintidós de agosto del dos mil cinco, (folios 1 to 3), the petitioner requests that Articles 27 and 28 of Ley Forestal number 7575 of 13 de febrero de 1996, as well as Articles 90 and 91 of its regulations, decreto ejecutivo number 25721-MINAE of 17 de octubre de 1996, be declared unconstitutional because he considers them contrary to Articles 46 and 50 of the Constitución Política, since they permit the unrestricted felling (tala) of trees merely because they do not qualify as native or indigenous to an area, even though they may perform an important function in protecting water resources and maintaining environmental and ecological balance. He states that Article 27 of Ley Forestal and Articles 90 and 91 of its regulations permit the cutting (corta) of any tree when located on agricultural land without forest, upon simple authorization from the Consejo Regional Ambiental or the Municipalidad, up to a limit of twenty trees.If more than twenty trees are to be cut, a forestry professional must certify that they do not form part of a forest before authorization may be granted. Ley Forestal itself, in Article 3(d), defines a forest as: a native or indigenous ecosystem occupying an area of two or more hectares, covering more than 70% of that area, and containing more than 60 trees per hectare; consequently, cypress trees are not considered part of a forest because they are not native or indigenous. He further states that Article 28 of Ley Forestal permits trees to be felled without a cutting permit when those trees are considered part of forest plantations (plantaciones forestales) or were planted individually. When the cutting of the cypress trees was reported to the Municipalidad, it was alleged that nothing could be done because cypress may be cut freely, without any control or limitation. The petitioner asserts that, because these types of trees constitute true forests in this area, their removal is leading to the desertification of the mountains and threatening the water resource, not only of local residents but also of a large portion of the inhabitants of the Valle Central. He requests that the challenge be granted.
  2. 2By decision issued at ten hours and thirty-five minutes on treinta de agosto del dos mil cinco, the petitioner was ordered to specify the grounds for the challenge (folio 4).
  3. 3In a written submission filed on 2 de setiembre del 2005, the petitioner complied with the foregoing order, stating that Article 27 of Ley Forestal has opened a loophole allowing any number of cypress trees or other non-native trees to be felled on land that is not considered a forest plantation and is classified as agricultural land without forest, by permitting more than ten trees per property to be cut with authorization from the Administración Forestal del Estado alone, without considering the environmental consequences that may result from the felling. The failure to consider the geological, hydrological, and environmental implications of felling cypress trees in the mountainous area of northern Heredia that is not part of a protected area—whether the land is claimed to be agricultural land or a forest plantation so that it may be cleared without further complication—has resulted, in nearly every case in which cypress trees have been felled, in land being left without trees, because the felling was carried out solely to remove all tree cover (cobertura arborícola) from the land and thereby make it suitable for residential, industrial, or hotel construction, rather than to replace non-native species with native species. He reiterates his request that the challenge be granted.
  4. 4In support of his standing (legitimación) to bring this constitutional challenge, he states that it arises from his effort to protect the environment and ecological balance, matters that the Sala’s settled case law has characterized as belonging to the diffuse interests (intereses difusos) referred to in Article 75, second paragraph, of the Law governing it.
  5. 5By decision issued at ten hours and forty-nine minutes on catorce de setiembre del dos mil cinco (appearing at folio 10 of the expediente), the challenge was admitted for consideration, and the Procuraduría General de la República and the Ministerio del Ambiente y Energía were granted a hearing.
  6. 6The Procuraduría General de la República, through Ana Lorena Brenes Esquivel, submitted its report, appearing at folios 15 to 37. The petitioner’s standing is not disputed. On the merits, it considers the concept of forest established in Article 3(d) of Ley Forestal, which limits those ecosystems to native or indigenous species, to be questionable. Although it acknowledges that the cypress trees of northern Heredia are not native, it nevertheless considers that they perform an important biological function while also creating scenic beauty, which is a component of environmental and ecological balance. It does not consider the cited Article 27 to be constitutionally defective, insofar as the cutting contemplated by that provision requires authorization from the competent bodies and must be understood to concern agricultural land without forest. In any event, the provision is supplemented by Articles 33 and 34 ibidem, which prohibit the cutting of trees within protection areas (áreas de protección), without distinction between native and exotic species.Nevertheless, it considers that the challenged Article 28 may produce devastating effects and therefore requests that the Sala interpret it as requiring authorization for the cutting of planted trees—whether native or not—when such cutting may affect natural and cultural assets in relation to which those trees have performed ecological functions over the years, and as requiring that such authorization be limited, proportionate, and reasonable. With respect to Article 90 of the Reglamento, it considers that the provision departs from the statutory rule limiting authorization to agricultural land (without forest), which may have harmful effects on natural resources. Therefore, it requests a corrective interpretation or, failing that, a declaration of unconstitutionality, because land without forest may be suitable for forestry and may need to be reforested if it contains aquifers (mantos acuíferos). Finally, with respect to Article 91, insofar as the provision requires a permit or authorization, it finds no constitutional defect.
  7. 7In a written submission filed by Nombre04 (folio 38), he requests recognition as a supporting respondent (coadyuvante pasivo) in this challenge, because he states that his father has planted cypress trees in the area since 1928, that this activity has been successful there, and that it has become a tradition. The springs (nacientes) have never been affected, nor has any harm been caused by deforestation, because the timber supplied by these cypress crops reduces pressure on the natural forest. He argues that, today, claiming that the unrestricted harvesting of cypress timber endangers water sources is to disregard the historical facts, because it is the cypress plantations that protect the natural forest surrounding them. As long as planting cypress trees remains profitable, the plantations are constantly renewed, as occurs with any other agricultural crop. Imposing restrictions on this or any other crop seriously jeopardizes its renewal and consequently leads to the product’s extinction.Subjecting timber producers’ harvests to conditions constitutes odious discrimination compared with other tree farmers, on whom no restrictions are imposed. He states that the petitioner seeks only to interfere with the timber harvest but says nothing about other tree farmers. Prohibiting the harvesting of cypress or any other product from planted trees, or making it subject to any type of permit, leaves the farmer with certainty of fair compensation for his work.
  8. 8In a written submission, Nombre03 and Marco Quesada Acuña, in their capacities as President and First Vice President of the Board of Directors of the Asociación Cámara Costarricense Forestal, request recognition as supporting intervenors for the respondent (coadyuvantes pasivos) in this constitutional challenge (acción de inconstitucionalidad), since they consider that, under Ley Forestal, Article 3, subsection f, a forest plantation (plantación forestal) is defined as: “land comprising one or more hectares, cultivated with one or more forest species, whose principal, but not exclusive, purpose shall be timber production.” The Cámara Forestal maintains that a forest plantation is conceived as a forest crop and is therefore artificially established on land preferably suited for forestry, using native and/or exotic species for various purposes, including forest production. Forest production is understood to mean the agricultural activity aimed at producing and selling timber.Plantation-management activities during the harvesting period, in addition to improving the condition of the trees, also significantly improve site conditions and are essential for controlling erosion, surface runoff, and the emergence of understory vegetation (sotobosque). Good silvicultural management practices (manejo silvicultural), including the periodic removal of trees from a forest plantation on technical grounds, have a direct effect on soil conservation because their subsequent effects include the emergence of pioneer individuals in the understory, thereby promoting the establishment of vegetation cover (cobertura vegetal). Cypress trees have been planted as part of reforestation projects for various purposes, including timber harvesting and sale. It is evident that a forest plantation is an artificial system, whereas a forest is an ecosystem in its natural state. The socioeconomic and environmental benefits of an environmental plantation are: the generation of a series of environmental services (servicios ambientales), including the mitigation of greenhouse-gas emissions, water protection, biodiversity protection, and ecosystem protection.They also include job creation through the various treatments required to maintain the plantations and carry out the timber-production process. The lack of plantations has negative effects, such as a shortage of timber needed for the domestic market and, consequently, the need to import it from other countries, thereby generating expenses for the country. The constitutional challenge filed entails a detriment with respect to the State’s investment through the Fondo Nacional de Financiamiento Forestal. Ley Forestal promotes forest plantations in Article 28. The unrestricted right to cut trees originating from forest plantations is necessary to provide legal and economic certainty for this investment. Likewise, on 10 de octubre del 2005, the Procuraduría de la República stated that unforested land may be suitable for forestry and must be reforested if it contains aquifers (mantos acuíferos); this clearly promotes this activity for both individual and collective benefit, for example through the protection of aquifers.They conclude that good silvicultural management practices, including the periodic removal of trees from a forest plantation on technical grounds, have a direct effect on soil conservation because their subsequent effects include the emergence of pioneer individuals in the understory, thereby promoting the establishment of vegetation cover.
  9. 9In a written submission, Raúl Solórzano Soto, in his capacity as Senior Director of the Sistema Nacional de Areas of the Ministerio de Ambiente y Energía, requests recognition as a supporting intervenor for the respondent in this action, since he considers that the State Forestry Administration (Administración Forestal del Estado) is of the view that certain concepts contained in Ley Forestal, Article 3, subsections d, f, and h, have been confused in the documents of the Procuraduría General de la República. Forest (Bosque): “a native or indigenous ecosystem, whether disturbed or undisturbed, regenerated through natural succession or other forestry techniques, occupying an area of two or more hectares and characterized by the presence of mature trees of different ages, species, and sizes, with one or more canopies covering more than seventy percent of that area and containing more than sixty trees per hectare with a diameter at breast height (DAP) of fifteen or more centimeters.” Forest Plantation (Plantación Forestal): “land comprising one or more hectares, cultivated with one or more forest species, whose principal, but not exclusive, purpose shall be timber production.” Agroforestry System (Sistema Agroforestal): “a form of land use involving the combination of forest species over time and space with agronomic species, with a view to the system’s sustainability.” The existence of forest plantations and individually planted trees results from a productive and economic decision by their owners, whether natural and/or legal persons.It is evident that cypress trees, like trees of other species located in different areas of the country, have been planted as part of tree-cultivation promotion programs implemented by the Costa Rican State for more than thirty years, for the purpose of producing timber and thereby reducing pressure on natural forests. The production of both fruit-bearing and timber trees may have beneficial effects on soil protection, aquifer recharge, and even scenic beauty. Maintaining incentives for this type of activity is essential because of the small number of hectares planted in the country (barely 54.000), which must supply the country’s timber industry; nevertheless, this is insufficient, and their exploitation and associated expense are very substantial. Promoting the planting of timber trees is very important in the country, and he concludes by requesting dismissal of the constitutional challenge.
  10. 10In a written submission, Nombre02 and Jhonny Méndez Gamboa, in their capacities as representatives of the Board of Directors of the Oficina Nacional Forestal, request recognition as supporting intervenors for the respondent in this action, since they consider it a fallacy and maintain that the petitioner’s assertion must be deemed reckless. They state that, merely upon reading its introduction, the Chamber should have summarily dismissed it. If that were occurring, it would be publicly known, and MINAE would have intervened given the seriousness of a situation that bears no relation to reality. Only individually planted trees located outside the protection areas (áreas de protección) established in Article 33 of Ley Forestal have been harvested. What they find surprising is the opinion of the Procuraduría General de la República, which, in their view, reflects a cursory analysis conducted without technical consultation and lacking a comprehensive study of the applicable provisions.If a person violates Article 33 of Ley Forestal regarding tree cutting, the violation must be reported. It is indeed important to regulate and protect forests and water resources (recurso hídrico) on timber-producing properties not covered by forest in the prescribed manner; however, the distinction cannot be drawn so finely as to compel persons to reforest properties that have lost their original cover, since that depends on their free choice. Article 19 of Ley Forestal regulates land-use change (cambio de uso) on forest-covered land and prohibits the removal of that forest, except in the cases specified therein and provided that the cutting is proportionate and reasonable; it is evident that none of the challenged articles refers to forests. Article 28 of Ley Forestal permits property owners to plant timber-tree crops at any time, because they provide benefits in terms of soil protection, aquifer recharge, and even scenic beauty.The cutting of trees challenged here is negligible and therefore does not affect the land’s suitability for forestry; nevertheless, cutting must not be permitted in water-resource areas. With regard to Article 91 of Ley Forestal, the forest inventory (inventario forestal), which is an essential requirement for cutting, is a document prepared by a qualified professional certifying, among other matters, that no forest exists and that water-resource protection areas will not be affected.
  11. 11By decision issued at nueve horas treinta y cuatro minutos del primero de febrero del dos mil seis, (folio 76), the applications submitted by the following parties seeking recognition as supporting intervenors for the respondent were rejected as untimely: Nombre04, acting in a personal capacity, (folios 38 a 41); Nombre03 and Marco Quesada Acuña, representing the Cámara Costarricense Forestal, (folios 44 a 57); Raúl Solózarno Soto, as Director of the Sistema Nacional de Áreas de Conservación del Ministerio del Ambiente y Energía, (folios 59 a 65); and Nombre02 and Jhonny Méndez Gamboa, representatives of the Oficina Nacional Forestal. (folios 66 a 71).

12- By decision issued at dieciséis horas quince minutos del tres de marzo del dos mil seis, (folio 83), the responses to the hearings granted to the Procuraduría General de la República and the Ministerio del Ambiente y Energía were deemed filed.

  1. 13The notices (edictos) referred to in the second paragraph of Article 81 of the Ley de la Jurisdicción Constitucional were published in Judicial Bulletins numbers 188, 189 and 190 dated 30 de setiembre, 3 y 4 de octubre del 2005 (folio 14).
  2. 14Pursuant to Article 9 of the Ley de la Jurisdicción Constitucional, the oral and public hearing provided for in Articles 10 and 85 of the Ley de la Jurisdicción Constitucional is dispensed with because the Court considers that sufficient grounds exist to decide this action.
  3. 15The statutory requirements have been observed in the proceedings.

Whereas:

I.Preliminary Matters. As a preliminary matter, it should be clarified that, although this Court, by decision issued at diez horas cuarenta y nueve minutos del catorce de setiembre del dos mil cinco, admitted the action for consideration and granted a hearing to the Procuraduría General de la República and the Ministerio del Ambiente y Energía, and both hearings were deemed answered, the fact is that the Minister did not respond to the corresponding hearing. Instead, Raúl Solórzano Soto, in his capacity as Senior Director of the Sistema Nacional de Areas of the Ministerio de Ambiente y Energía, entered an appearance, but as a supporting intervenor for the respondent in this action.

II.Admissibility. Article 75 of the Ley de la Jurisdicción Constitucional establishes the admissibility requirements (presupuestos de admisibilidad) for constitutional challenges. Accordingly, the first paragraph requires the existence of a prior proceeding (asunto previo), whether judicial or administrative, in which the provision’s unconstitutionality is invoked as a reasonable means of protecting the right or interest alleged to have been infringed. This establishes the general rule requiring a prior proceeding, while the possibilities of applying directly to the Chamber are exceptional and are governed by the second paragraph in cases where:

“[...] due to the nature of the matter, there is no individual and direct injury, or the case concerns the protection of diffuse interests (intereses difusos), or interests concerning the community as a whole”; The Chamber has held that diffuse interests (intereses difusos) are those held by groups of persons who are not formally organized but are united by a particular social need, physical characteristic, ethnic origin, personal or ideological orientation, consumption of a particular product, etc. In such cases, the interest is dispersed, diluted (diffuse) among an unidentified plurality of persons. In these cases, of course, any challenge brought by a member of one of these groups pursuant to paragraph 2 of Article 75 must necessarily concern provisions affecting that person in that capacity. Thus, through various decisions of this Chamber, the existence of a diffuse interest has been recognized in claims concerning violations of the environment, specifically in accordance with Article 50 of the Political Constitution, and on that basis the Chamber has developed a theory of direct standing (legitimación directa) in such cases:

“This Chamber has identified various rights that it has characterized as ‘diffuse,’ including the environment, cultural heritage, protection of the country’s territorial integrity, and sound management of public spending, among others. Two clarifications must be made in this regard: first, the aforementioned interests transcend the sphere traditionally recognized as pertaining to diffuse interests because, in principle, they concern matters affecting the national community rather than particular groups within it; environmental harm does not merely affect the residents of a region or the consumers of a product, but damages or places at serious risk the natural heritage of the entire country and even of Humanity. Likewise, ensuring the sound management of public funds authorized in the Budget of the Republic is an interest shared by all inhabitants of Costa Rica, not merely by any particular group among them.

Second, the list drawn up by the Constitutional Chamber amounts to no more than a simple description arising from its obligation—as a judicial body—to confine itself to hearing the cases submitted to it, and it can in no way be understood to mean that only those rights expressly recognized as such by the Chamber may be regarded as diffuse rights. Such an interpretation would entail an undesirable reversal of the scope of the Rule of Law and its correlative ‘State of rights,’ which—as in the Costa Rican model—is based on the premise that restrictions on freedoms must be express, since freedoms are inherent in the human condition itself and therefore require no official recognition. Finally, when paragraph 2 of Article 75 of the Constitutional Jurisdiction Act (Ley de la Jurisdicción Constitucional) refers to interests ‘concerning the community as a whole,’ it means the legally protected interests (bienes jurídicos) explained above; that is, those held by the very holders of sovereignty, each of the inhabitants of the Republic.

This does not mean, therefore, that any person may petition the Constitutional Chamber to protect any interest whatsoever (popular action (acción popular)); rather, every individual may act in defense of those interests affecting the entire national community, and no attempt to provide an exhaustive list is valid in this area either” (judgment number 2001-08239, cited above).

Similarly, judgment number 2002-01220, issued at fourteen hours and forty-eight minutes on February 6, 2002, stated that the right to a healthy and ecologically balanced environment has been conceptualized as a “third-generation” right, which is both a right and a duty of every inhabitant and whose values, as such, enjoy privileged protection under which any person may seek their protection, specifically on the basis of the authorization granted in this regard by Article 75, paragraph 2, of the Ley de la Jurisdicción Constitucional. Accordingly, such a person may directly file an action of unconstitutionality (acción de inconstitucionalidad); therefore, in cases where neither the interested party nor the order allowing the action to proceed identifies such special standing, the action filed is admissible insofar as it becomes a means of protecting such interests when the relief sought is the protection of the environment and natural resources.

II.Standing of the Petitioner in the Specific Case. To establish his standing to bring this action of unconstitutionality, the petitioner relies on Article 50 of the Political Constitution, which recognizes general standing to report both violations of environmental conservation requirements and to claim compensation for the harm caused. Indeed, in light of the foregoing considerations, and given that the application under review challenges a violation of the environment on the ground that the contested regulations permit the unrestricted felling of cypress trees in the mountains north of the Área Metropolitana in the province of Heredia, thereby affecting the natural drainage processes necessary for the development of aquifers (mantos acuíferos) because of increased water runoff and soil erosion, as well as impairing the scenic beauty of the area, it is clear that the action must be admitted for consideration on the merits because the petitioner is deemed to have proper standing, since this is precisely a case involving a genuine “diffuse interest or one concerning the community as a whole,” as provided in the second paragraph of Article 75 of the Ley de la Jurisdicción Constitucional.

III.Subject Matter of the Challenge. The petitioner challenges Articles 27 and 28 of the Ley Forestal and Articles 90 and 91 of its Regulations (Decreto No. 25721-MINAE), arguing that they are contrary to Articles 46 and 50 of the Political Constitution insofar as they permit the unrestricted felling of trees merely because they do not qualify as native or indigenous to an area, even though they may perform an important function in protecting water resources and maintaining environmental and ecological balance. For purposes of clarity, the provisions under review are quoted below:

“Article 27.- Authorization to Fell Trees A maximum of only three trees per hectare per year may be cut on agricultural land without forest, after authorization has been obtained from the Regional Environmental Council. If the cutting exceeds ten trees per property, authorization from the State Forestry Administration shall be required.

Promotion of Forest Plantations Article 28.- Exemption from Cutting Permit Requirement Forest plantations, including agroforestry systems (sistemas agroforestales), individually planted trees, and their products shall not require permits for cutting, transportation, processing, or export. However, where a forestry contract entered into with the State to receive Forest Credit Certificates or an income-tax deduction existed before this law took effect, cutting shall be carried out in accordance with the management plan (plan de manejo) approved by the State Forestry Administration.

CHAPTER SEVENTEEN

Forestry Oversight 1- Harvesting in Non-Forested Areas.

Article 90: Persons wishing to conduct timber harvesting (aprovechamiento forestal) or tree felling on non-forested land that, because of its characteristics, does not constitute an agroforestry system may choose whether to apply for authorization from the Regional Environmental Council or from the Municipality in which the property is located, provided that the total does not exceed twenty trees per year.

The application shall be submitted by the property’s owner or possessor in accordance with the requirements established for each case by both the Regional Councils and the respective Municipalities.

Within 10 days, the Regional Environmental Councils shall decide upon and issue cutting and transportation permits. The Regional Environmental Councils and the municipalities shall forward a copy of the documentation to the A.F.E.

Article 91: In cases where more than twenty trees are to be harvested in wooded areas excluded from the definition of forests, the application shall be processed by the corresponding A.C. Subregional Office. In addition to the general requirements established in these Regulations, an inventory shall be submitted specifying the number of species to be cut, the number of individual trees to be cut, and the volume to be extracted. That inventory shall be prepared and signed by a forestry professional, and a sketch of the property shall also be prepared indicating the approximate location of the trees to be cut. The application shall include a certification from the professional stating that the area does not constitute a forest or part of a forest under the definition in the Law and shall comply with the requirements established in Article 85 of these Regulations. Upon receiving the application, the corresponding A.C. Subregional Office shall verify the requirements and issue the appropriate permit without requiring a prior inspection.”

IV.Merits. Having defined the subject matter of the action, and given that the petitioner’s challenge concerns permits to cut trees based on the type of land on which they stand and their nature, the corresponding constitutional analysis will now be conducted, first identifying the fundamental right infringed:

A.- The Fundamental Right to a Healthy and Ecologically Balanced Environment. In judgment No. 2003-6322, this Court explained the jurisprudential treatment that the Chamber has given this constitutional right; for purposes of reviewing this action, that treatment is summarized and supplemented by additional considerations. Even before Article 50 of the Political Constitution was amended, the Chamber’s case law had recognized environmental protection and preservation as a human right (judgment number 1993-2233), deriving it from Articles 21 (right to health), 69 (the constitutional requirement of “rational use of the land”), and 89 (protection of natural beauty), all of the Constitution, based on the following considerations:

“V.)- Human life is possible only in solidarity with the nature that sustains and supports us, not only by providing physical nourishment but also by promoting psychological well-being: it encompasses the right of all citizens to live in an environment free from pollution, which is the foundation of a just and productive society. Thus, Article 21 of the Political Constitution states: ‘Human life is inviolable.’ It is undeniably from this constitutional principle that the right to health and to physical, mental, and social well-being arises—a human right inextricably linked to the right to health and to the State’s obligation to protect human life.

Likewise, from a psychological and intellectual standpoint, one’s state of mind also depends on nature; therefore, because the landscape becomes a useful space for rest and leisure, its preservation and conservation are also mandatory. This latter aspect is protected under Article 89 of the Constitution, which literally states: “The cultural purposes of the Republic include: protecting natural beauty, preserving and developing the Nation’s historical and artistic heritage, and supporting private initiative for scientific and artistic progress.” Protecting nature from an aesthetic standpoint does not mean commercializing it or turning it into a commodity; it means educating citizens so that they learn to appreciate the aesthetic landscape for its intrinsic value” (judgment number 1993-3705, issued at fifteen hours on treinta de julio de mil novecientos noventa y tres).

“XIII.- The term ‘natural beauty’ was the term used when the Constitution was promulgated (7 de noviembre de 1949), and it has since developed into a specialized field of law: environmental law (derecho ambiental), which recognizes the need to preserve the environment not merely as a cultural purpose, but as a vital necessity for every human being. In this regard, the concept of the right to a healthy environment (derecho al ambiente sano) goes beyond recreational or cultural interests, which are also important aspects of life in society, and also constitutes an essential requirement for life itself. [...]

[...]

Accordingly, it is clear that there is no longer any doubt as to the constitutional protection of the right to health, linked to the right to life and, through it, to a right to a healthy environment. By way of example, we may cite judgments 1580-90; 1833-91, 2362-91; 2728-91; 2233-93; 4894-93; which have recognized the right to health and to a healthy environment as an individual constitutionally protected right” (judgment number 1993-6240, issued at fourteen hours on veintiséis de noviembre de mil novecientos noventa y tres).

“Provision 69 of the Political Constitution refers to the ‘rational use of land’ (explotación racional de la tierra), which constitutes a fundamental principle. Consequently, such protection and preservation, as well as the rational use of the aforementioned resources, are tenets of the constitutional order” (judgment number 1993-2233).

The principle of rational use of land derives from Article 69 of the Fundamental Charter, and both private parties and the State, in its broadest sense, are required to protect and preserve renewable natural resources:

“II. Protecting the environment is a task incumbent upon everyone equally: upon public institutions, by enforcing current legislation and promoting efforts to prevent or eliminate dangers to the environment; and upon private parties, by complying with those provisions and cooperating in the protection of soil, air, and water, since any harmful change resulting from a human act in their composition, content, or quality will also be detrimental to human quality of life” (judgment number 4480-94, issued at ten hours forty-one minutes on diecinueve de agosto de mil novecientos noventa y cuatro).

In constitutional case law, the concept of the “environment” has not been limited to the primary elements of nature, namely soil, air, water, marine and coastal resources, minerals, forests, biological diversity in flora and fauna, and the landscape; these form the environmental framework without which basic needs—such as food, energy, housing, sanitation, and recreation—could not be met. It is important to emphasize that this term has been understood more comprehensively, establishing a “macro-environmental” concept that also encompasses matters relating to the economy, the generation of foreign currency through tourism, agricultural use, and others:

“For the foregoing reasons, Environmental Law should not be associated solely with nature, because nature is only part of the environment. Nature-protection policy also extends to other matters, such as the protection of hunting, forests, natural parks, and natural resources. It is therefore a macro-environmental concept, intended to avoid excluding important concepts and thereby unify the body of law that we call Environmental Law” (judgment number 5893-95, issued at nine hours forty-eight minutes on veintisiete de octubre de mil novecientos noventa y cinco; and, to the same effect, numbers 3705- 93, cited supra, and 2988-99, issued at eleven hours fifty-seven minutes on veintitrés de abril de mil novecientos noventa y nueve).

1-Protection of environmental rights, a State duty. Following the amendment of Article 50 of the Constitution through Law number 7412, dated tres de junio de mil novecientos noventa y cuatro, which expressly enshrined environmental rights as a fundamental right, the State’s obligation to guarantee, defend, and protect that right was also established unequivocally, thereby making the State the guarantor of the protection and safeguarding of the environment and natural resources. It was through this amendment that citizens were granted full standing to defend it, thus giving express substance to this right:

“[...], this Chamber has established that the right to a healthy and ecologically balanced environment (ambiente sano y ecológicamente equilibrado) is a fundamental right, already enshrined and guaranteed as such by Constitutional Law, [which is why] it does not consider it pointless, much less objectionable, for that right to be expressly recognized and clearly individualized, [...]” (judgment number 1394-94, issued at fifteen hours twenty-one minutes on dieciséis de marzo de mil novecientos noventa y cuatro).

“II.- It follows, then, that the position adopted by this Court in this regard is now confirmed by the aforementioned constitutional amendment, which merely reflects the understanding that although human beings have the right to make use of the environment, they also have the obligation to protect and preserve it for the enjoyment of future generations” (judgment number 5668-94, issued at eighteen hours on veintiocho de septiembre de mil novecientos noventa y cuatro).

It is pursuant to this provision, in conjunction with Articles 20, 69, and 89 of the Political Constitution, that the State’s responsibility was derived and the Social State under the Rule of Law (Estado Social de Derecho) took shape. We may therefore conclude that the Political Constitution emphasizes that environmental protection is an appropriate mechanism for safeguarding and improving everyone’s quality of life, making intervention by the Public Authorities necessary with respect to factors that may disrupt its balance and hinder persons from developing and thriving in a healthy environment. Thus, the constitutional mandate establishes the State’s duty to guarantee, defend, and preserve that right:

“Prima facie, to guarantee means to secure and protect the right against some risk or necessity; to defend means to bar, prohibit, and prevent any activity that infringes upon the right; and to preserve means taking action aimed at shielding the right in advance from potential dangers so that it may endure for future generations. The State must adopt a dual course of action and restraint: on the one hand, it must refrain from itself infringing upon the right to a healthy and ecologically balanced environment; and, on the other, it must undertake the task of issuing the measures necessary to fulfill constitutional requirements” (judgment number 9193-2000, issued at sixteen hours twenty-eight minutes on diecisiete de octubre del dos mil).

This right’s impact on State activity has its primary rationale in the fact that, by definition, rights are not confined to the private sphere of individuals, but also have significance within the very structure of the State in its role as their guarantor; and, secondly, because State activity is directed toward satisfying the interests of the community. In this regard, it must be considered that the legislation designates the Ministerio del Ambiente y Energía as the governing body for the natural resources, energy, and mining sector, pursuant to Article 2 of the Organic Law (Ley Orgánica) of that ministry, number 7152, dated cuatro de junio de mil novecientos noventa:

“The functions of the Ministerio del Ministerio del Ambiente y Energía shall be the following:

  • a)To formulate, plan, and implement the Government of the Republic’s policies on natural resources, energy, mining, and environmental protection, as well as to direct, control, oversee, promote, and foster development in those fields. It shall also conduct and supervise research, technical explorations, and economic studies concerning the sector’s resources.
  • b)To foster the development of natural, energy, and mineral resources.
  • c)To promote and administer legislation concerning the conservation and rational use of natural resources in order to achieve their sustainable development, and to ensure compliance therewith.

ch) To issue, by executive decree, mandatory standards and regulations concerning the rational use and protection of natural resources, energy, and mines.

  • d)To promote scientific and technological research related to matters within its jurisdiction, in coordination with the Ministerio de Ciencia y Tecnología.
  • e)To promote and administer legislation concerning the exploration, exploitation, distribution, protection, management, and processing of natural resources related to its area of jurisdiction, and to ensure compliance therewith.
  • f)To process and grant permits and concessions concerning matters within its jurisdiction.
  • g)To encourage, in accordance with current legislation, the execution of international treaties, conventions, and agreements, and to represent the Government of the Republic in national and international matters within its jurisdiction. All of the foregoing shall be carried out in coordination with the Ministerio de Relaciones Exteriores y Culto.
  • h)To promote and develop environmental education programs at all educational levels and for the general public.
  • i)To prepare inventories of the country’s natural resources.
  • j)To advise public and private institutions concerning environmental planning and the development of natural areas.
  • k)Such other functions as may be assigned to it by the legal system.” In this Court’s view, this governing role in environmental matters encompasses not only the establishment of appropriate regulations for the use of forest resources and natural resources, as also provided in Article 56 of the Organic Environmental Law (Ley Orgánica del Ambiente), but also confers upon it the important function of exercising governing authority in environmental matters, which consists of maintaining a leading role in this field, for which purpose it “[...] shall issue general and specific measures concerning the investigation, exploration, exploitation, and development of those resources, based on the provisions of the Plan Nacional de Desarrollo”; In this regard, the control and oversight (control y fiscalización) of environmental matters and activities constitute an essential function of the State, pursuant to Article 50 of the Constitution, insofar as the relevant portion of its third paragraph provides: “The State shall guarantee, defend, and preserve that right”; this is consistent with the constitutional principle established in the second paragraph of Article 9 of the Political Constitution, which expressly prohibits the Branches of Government from delegating the exercise of their inherent functions, particularly when those functions are essential.

Accordingly, with respect to environmental protection, the functions of governance, control, and oversight (rectoría, control y fiscalización) of environmental matters belong to the State and are entrusted to its various administrative agencies.

2- Rational use of resources (uso racional de los recursos). A balance between the country’s development and the right to the environment (derecho al ambiente). Based on Article 69 of the Constitution, insofar as it provides for the “rational use of natural resources,” the Chamber has established in its case law the constitutional parameters for their proper use; under those parameters, it is clear that environmental protection must be directed toward the appropriate and intelligent use of its elements and their natural, sociocultural, technological, and political relationships—sustainable development (desarrollo sostenible)—thereby safeguarding the heritage to which present and future generations are entitled. Therefore, the primary objective of the use and protection of the environment is to ensure that the production and use of technology yield not only economic gains—freedom of enterprise (libertad de empresa)—but also development and evolution favorable to the environment, natural resources, and human beings, that is, without causing damage or harm:

“This Chamber has also recognized that both the right to health and the right to an environment free from pollution, without which the former could not be made effective, are fundamental rights (derechos fundamentales); accordingly, the State is obligated to protect them, whether through general policies designed to achieve that purpose or through specific actions by the Administration. Sustainable development is one of those general policies adopted by the State to expand the opportunities for everyone to fulfill their aspirations for a better life, by increasing production capacity or expanding the possibilities of achieving equitable progress in relation to population growth or between such growth and natural systems. Sustainable development is the process of transformation in the use of resources, the direction of investments, the channeling of technological development, institutional changes, and everything else that helps meet present and future human needs” (judgment number 1994-1763, de las dieciséis horas cuarenta y cinco minutos del trece de abril de mil novecientos noventa y cuatro).

The Chamber has stated that the environment must be understood as a development resource to be used appropriately and must be addressed in an integrated manner across its natural, sociocultural, technological, and political relationships; otherwise, its productivity for the present and future will be degraded, potentially jeopardizing the heritage of future generations. The origins of environmental problems are complex and arise from the interaction of natural and social processes within the framework of the socioeconomic development model adopted by the country. For example, environmental problems arise when methods of exploiting natural resources cause ecosystem degradation beyond their capacity for regeneration, thereby harming broad sectors of the population and generating high environmental and social costs that lead to a deterioration in quality of life; indeed, the primary objective of the use and protection of the environment is to achieve development and evolution favorable to human beings.

Environmental quality is a fundamental measure of that quality of life; other equally important measures include health, food, work, housing, education, and so forth. More importantly, however, it must be understood that although human beings have the right to use the environment for their own development, they also have a duty to protect and preserve it for present and future generations. This is not particularly novel, because it is simply the application to this field of the principle of “injury” (lesión), already well established in ordinary law (derecho común), under which the lawful exercise of a right has two essential limits: on the one hand, the equal rights of others and, on the other, the rational exercise and beneficial enjoyment of the right itself. Like any other nation, our country has depended and will continue to depend on its natural resources and environment to meet the basic needs of its inhabitants and keep operating the productive apparatus that sustains the national economy, whose principal foundation is agriculture and, in recent years, tourism, particularly ecotourism.

Soil, water, air, marine and coastal resources, forests, biological diversity, mineral resources, and the landscape make up the environmental framework without which basic needs—such as living space, food, energy, housing, sanitation, and recreation—could not be met. Likewise, our economy is also closely tied to the condition of the environment and natural resources. Moreover, the goals of sustainable development concern human survival and well-being and the maintenance of essential ecological processes, that is, environmental quality and the survival of other species. To speak of sustainable development in terms of meeting present and future human needs and improving quality of life is to speak of individual demand for natural resources and of the direct or supporting means required for the economy to function by generating employment and creating capital goods, which in turn make it possible to transform resources into consumer, production, and export goods.

The declaration made at the 1992 Earth Summit proclaimed and recognized the integral and interdependent nature of the planet; this signifies acceptance of certain principles guiding the transition from current development models to sustainability. The signatory States, including Costa Rica, undertook, within the framework of preserving sustainable development, to protect human beings above all. They proceeded from the principle that every person has the right to a healthy and productive life in harmony with nature; they included the right of present and future generations to have development carried out in a manner that meets their environmental and developmental needs; and they upheld the sovereign authority of States to exploit their resources while emphasizing their responsibility to ensure that activities conducted within their jurisdiction and control do not cause environmental damage to other States or to areas beyond the limits of their national jurisdiction.

They established the duty of States to cooperate in the conservation, protection, and restoration of the environment, as well as their common responsibilities in that regard; thus, international cooperation in promoting and supporting economic growth and sustainable development will make it possible to address the problems of environmental degradation more effectively. A special duty was also imposed on developed countries, based on their responsibility in pursuing sustainable development, given the evident pressure exerted on the global environment by the technologies they develop and the financial resources they possess.

3- The precautionary principle (principio precautorio) in environmental law (derecho ambiental). This principle is contained in the United Nations Conference on Environment and Development, Rio Declaration, which provides:

“Principle 15.- In order to protect the environment, States shall broadly apply the precautionary approach according to their capabilities. Where there is a danger of serious and irreversible damage, a lack of absolute scientific certainty shall not be used as a reason for postponing the adoption of cost-effective measures to prevent environmental degradation.” (See, to the same effect, Article 11 of the Biodiversity Law).

As the Chamber has already stated, the term prevention derives from the Latin “praeventio,” which refers to the action and effect of preventing, and to preparations and measures taken in advance to avoid a risk or carry something out. Prevention seeks to anticipate adverse effects and ensure the protection, conservation, and proper management of resources. Consequently, the guiding principle of prevention (principio rector de prevención) is based on the need to take and implement all precautionary measures (medidas precautorias) to avoid or contain possible harm to the environment or human health. Thus, where there is a risk of serious or irreversible harm—or uncertainty in that regard—based on technical studies, a precautionary measure must be adopted, and the activity in question may even be postponed. This is because, in environmental matters, ex post coercive action (coacción a posteriori) is ineffective: once harm has occurred, its biologically and socially damaging consequences may be irreparable; punishment may carry moral significance, but it is unlikely to compensate for the harm caused to the environment.

4- Coordination among public agencies must ensure environmental protection. On various occasions, constitutional case law (jurisprudencia constitucional) has held that protecting the environment is a task for which everyone is equally responsible; that is, the State—as a whole—is obligated to take the necessary measures to protect the environment, in order to prevent levels of pollution, deforestation, extinction of flora and fauna, and excessive or inappropriate use of natural resources that endanger the health of the governed. In this task, the term public institution must be understood to include both the Central Administration—ministries such as the Ministerio del Ambiente y Energía and the Ministerio de Salud, which, by reason of their subject-matter jurisdiction, have extensive involvement and responsibility regarding environmental conservation and preservation and which most often act through their specialized agencies in this field, such as the Dirección General de Vida Silvestre, the Dirección Forestal, and the Secretaría Técnica Nacional Ambiental (SETENA)—as well as decentralized institutions, such as the Instituto Nacional de Vivienda y Urbanismo, SENARA, the Instituto Costarricense de Turismo, or the Instituto Costarricense de Acueductos y Alcantarillados.

Municipalities, of course, also bear substantial responsibility for this task within their territorial jurisdiction. It might therefore be thought that this multiple responsibility would cause chaos in administrative management, but this is not the case. To prevent the simultaneous coexistence of spheres of authority of different origins and natures, the duplication of national and local efforts, and confusion regarding the rights and obligations of the various parties involved, it is necessary to establish a series of coordination arrangements among the various agencies of the Executive Branch and decentralized institutions, and between them and the municipalities, so that they may perform the functions entrusted to them. This Chamber has previously—and quite clearly—addressed the principle of coordination between public agencies and municipalities in pursuing common objectives—which must obviously be extended to the relationship between Central Administration institutions and decentralized institutions in carrying out this important function—and accordingly refers to what it held on that occasion (judgment number 1999-5445, de las catorce horas treinta minutos del catorce de julio de mil novecientos noventa y nueve):

"Thus, coordination is the ordering of relationships among these various independent activities, taking into account their concurrence with respect to the same object or entity so as to make it useful within an overall public plan, without eliminating the reciprocal independence of the acting entities. Because there is no hierarchical relationship among decentralized institutions, or between the State itself and the municipalities, specific conduct cannot be imposed upon them. This gives rise to the indispensable interinstitutional ‘concerted action,’ strictly speaking, whereby autonomous and independent centers of action agree upon that preventive and comprehensive framework, within which each performs a role with regard to a mission entrusted to the others. Accordingly, relations between municipalities and other public entities may be conducted only on an equal footing, resulting in agreed forms of coordination and excluding any mandatory arrangement detrimental to their autonomy that would subject corporate entities to a coordination framework without or against their will; this nevertheless permits the necessary subordination of those entities to the State and in its interest (through the State’s ‘administrative oversight’ (tutela administrativa), specifically its function of reviewing legality, which falls within its jurisdiction and includes powers of general supervision over the entire sector)." Furthermore, failures to fulfill the duty to protect the environment and to comply with environmental regulations are constitutionally significant because administrative inaction in this area may cause harm to the environment and natural resources, sometimes with consequences similar to or greater than those resulting from administrative action.

Examples include authorizing regulatory plans (planes reguladores) or construction without approval of the environmental impact study (estudio de impacto ambiental) by the Secretaría Técnica Nacional Ambiental; the Dirección General de Vida Silvestre of the Ministerio del Ambiente y Energía failing to monitor and oversee implementation of management plans (planes de manejo) for protected areas; allowing companies to operate without health permits concerning sewage or wastewater treatment (Acueductos y Alcantarillados and Ministerio de Salud); or failing to verify noise controls in bars, karaoke venues, and discotheques (municipalities and Ministerio de Salud), etc.

B.-Ley Forestal. In furtherance of the foregoing, the Ley Forestal provides that it is an essential and primary function of the State to safeguard the protection, conservation, use, industrialization, administration, and promotion of the country’s forest resources, in accordance with the principle of rational use of renewable natural resources, and distinguishes between the State’s forest estate (patrimonio forestal del Estado) and the private forest estate (patrimonio forestal privado). The former is subject to a public-domain regime (régimen de dominio público) and consists of all forests and forest lands within national reserves, areas declared inalienable, properties registered in the State’s name, and properties belonging to municipalities, autonomous institutions, and other Public Administration bodies. In this case, the Administration may grant use permits only for projects that do not require forest harvesting (aprovechamiento forestal) and do not affect ecosystems, wildlife, soils, wetlands, or aquifers.

The private forest estate, in turn, consists of all forests and lands suitable for forestry that belong to private natural or legal persons (artículos 1°, 32 y 43 de la Ley Forestal). Various activities may be conducted on these properties, depending on whether the land contains forest, contains forest plantations, or is agricultural land without forest. Nevertheless, the requirements and restrictions governing activities within these areas are essentially related to timber or forest harvesting. The latter refers to the cutting or removal of standing timber trees or the use of fallen trees on private land not included in artículo 1 de la Ley Forestal, which generates or may generate some profit, benefit, advantage, utility, or gain for the person carrying it out or for the person represented thereby. As previously noted, this concept excludes all land forming part of the State’s natural heritage (patrimonio natural del Estado), because such harvesting must occur on private properties.

The boundaries established by the Ley Forestal are clearly linked to the concept of forest. These regulations define what must be considered a forest and what constitutes a forest ecosystem (ecosistema boscoso). According to artículo 3 de esta Ley, a forest is a native or indigenous ecosystem regenerated through natural succession or other forestry techniques, occupying an area of two or more hectares and characterized by mature trees of different ages, species, and sizes, with one or more canopies covering more than 70% of that area and more than 60 trees per hectare having a diameter at breast height (diámetro a la altura del pecho, DAP) of fifteen or more centimeters. Accordingly, the determining characteristic is essentially the land area it must occupy: more than 2 hectares in order to be considered a forest. A contrario sensu, and as described, no forest exists on land with an area of less than two hectares or where the trees are not indigenous.

In response to the foregoing, the legal system, through decreto ejecutivo No. 27998 publicado el 29 de julio de 1999 denominado "Manejo Sostenible de Bosques Secundarios y Certificación Forestal", adopted a definition of secondary forest (bosque secundario) in order to protect forests of smaller area and lower density, defined as follows:

"Land with woody vegetation of a secondary successional nature that develops after the original vegetation has been removed by human activities and/or natural phenomena, with a minimum area of 0.5 hectares and a density of no fewer than 500 trees per hectare of all species, with a minimum diameter at breast height of 5 cm. This also includes secondary forest lands immediately after harvesting under the regeneration-cutting system" Nevertheless, this definition could not be effectively applied because it conflicts with a definition of forest established by statute, rendering it ineffective as protection against the permits and procedures established in the Ley Forestal. Under the legal system, on land considered forest pursuant to the cited artículo 3, SINAC may authorize certain types of activities, such as infrastructure projects, whether public or private, that are deemed nationally desirable; the construction of houses, offices, stables, corrals, nurseries, roads, bridges, and other facilities devoted to recreation, ecotourism, and related activities on privately owned land and properties; and the cutting of trees for reasons of human safety or scientific interest, to prevent forest fires, natural disasters, or for other analogous reasons, as well as for harvesting.

These forests may be harvested only if their lawful owners have a Management Plan (Plan de Manejo) duly approved by SINAC, provided that the potential impact thereof is assessed beforehand. For this purpose, the authorized person may submit the Management Plan to the Forest Certification System (Sistema de Certificación Forestal) through the participation of a Forest Certifier (Certificador Forestal) duly accredited by the Administración Forestal del Estado, or may submit an application to the subregional office for approval of the Management Plan. In the first case, a forest certifier duly accredited by the A.F.E. must first certify that the management plan complies with legal and technical requirements, after which the authorization procedure may continue; in the second case, the application initiating the proceeding must be signed by a forestry professional, who shall be responsible for the information certified therein. Pursuant to artículo 3 inciso e), this Management Plan must be understood as:

"A set of technical standards governing the actions to be carried out in a forest or forest plantation, on a property or part thereof, for the purpose of harvesting, conserving, and developing the tree vegetation that exists or is intended to be established, in accordance with the principle of rational use of renewable natural resources that ensures the sustainability of the resource." Likewise, pursuant to Article 21 of the Ley Forestal, there must be a forestry regent (regente forestal), who shall be responsible for implementing the management plan (plan de manejo) and ensuring compliance with it, subject to the criminal and civil liabilities arising from that office. The issue is that all this protection revolves around what the law encompasses within its aforementioned narrow definition of forest, intended to protect only areas larger than 2 hectares and consisting exclusively of native or indigenous species.

Hence, the petitioner considers that the alleged violation has occurred, insofar as he states that cypress is not protected under that definition. Indeed, cypress, whose common name belongs to the genus Cupressus, is a fast-growing tree found in warm or temperate regions that can reach a height of 20 m and an approximate diameter of 60 cm. It is an evergreen conifer belonging to the Cupressaceae family. It grows naturally anywhere in the world where temperatures and soils are suitable, but it is cultivated commercially in East Africa, South Africa, and New Zealand. The planting of cypress trees in our country dates back many years, since this is a non-native species planted by some persons for various purposes, including as part of reforestation projects (for harvesting and selling the timber), as windbreaks in highland areas, and for scenic beauty. The petitioner argues that the function performed by cypress trees should be protected in the same manner as a natural forest; however, this is a non-native species which, as already noted, is not protected under our legal system, a matter that first requires a ruling by this Court.

C.- Forests. Regardless of the definition set forth in the current Ley Forestal, broader definitions of forest may be formulated in legal scholarship. For example, a forest is a place populated by trees and shrubs, generally growing densely. Broadening the definition, it may also be stated that “a forest is any area of land on which plant communities are growing, predominantly trees of different sizes, whether or not they have been harvested, that are capable of producing timber or other products; they influence the climate and hydrological regime and also provide protection for wildlife.” The Procuraduría General also provides us with several definitions in its report: “forests are dynamic ecosystems, with continuous processes of change (growth and deterioration), containing representative and dominant trees.” They interact with other plants, animals, and microorganisms, as well as with their physical and geographic environment, producing a series of complex interactions among biotic and abiotic elements known as ecological functions, such as hydrological regulation, nutrient cycling, energy flow, and climate regulation.

Others distinguish between primary forest (bosque primario) and secondary forest (bosque secundario). The former, regarded as virgin or climax forests, are characterized by an abundance of mature trees that have not been altered by human activities; according to data provided by the Procuraduría, 78% of these forests worldwide have already been destroyed. Secondary forests, for their part, contain ecosystems that regenerate naturally over an average period of approximately 15 years following a substantial disturbance: flooding, agricultural burning, forest fires, land clearing, or extensive harvesting. They are characterized by a small number of mature trees, an abundance of fast-growing species, and dense undergrowth of seedlings and herbaceous plants. They are also characterized, on some occasions, by emerging from scrubland or secondary brush growth (charrales o tacotales). Indeed, it is extremely important to emphasize that, prior to its amendment through law No. 7575 of 5 de febrero de 1996, the Ley Forestal contained a very broad definition of forest in Article 6: “Forests are all plant communities composed predominantly of trees and other woody vegetation.” Neither that definition nor those cited above made any distinction requiring a forest to consist exclusively of native rather than exotic trees—which may even have regenerated naturally—or to cover more than 2 hectares.

Another important consideration is the services provided by forests, which are of the utmost importance to people and to the development of society itself. These include: timber services (use of timber, firewood, posts); non-timber services (medicinal herbs, dyes, ornamental plants, seeds, vines, palms and construction materials, and handicraft materials); maintenance of the hydrological cycle (water for human consumption and industrial, commercial, and domestic activities; protection of agriculture; hydroelectric power); microclimate regulation; control of flooding, erosion, sediment, winds, and noise; landscape-related services (photography, painting, videos, fishing, and tourism); recreation and ecotourism; maintenance of resilience; preservation of ecosystems and biodiversity (research material and scientific tourism); and climate-change mitigation (carbon-dioxide sequestration). Consequently, harm to forests causes serious problems for human beings, since deforestation results in flooding, landslides, water scarcity, sedimentation of rivers, streams, and reservoirs, crop losses, and so forth.

In light of the foregoing, it is clear to the Chamber that the Procuraduría is correct in stating that the definition of forest contained in the current Ley Forestal is insufficient and provides inadequate protection for our country’s forests, compounded by the fact that this definition serves as the basis for the other classifications of land on which trees may be felled—subject to regulation in some cases and even without restriction in others. Certainly, the purpose of the amendment to this law, enacted through law No. 7575 of 5 de febrero de 1996, was to promote and encourage reforestation in our country, for which purpose it sought to eliminate unnecessary procedures governing the felling of certain types of trees. Notwithstanding the foregoing, this Court considers that the law’s shift from a broad definition of forest, affording greater protection, to one so restrictive in terms of species and area has diminished the protection previously afforded to the environment without reasonable justification extending beyond the need to reforest and eliminate administrative obstacles as an incentive for that activity, and without first ensuring that its implementation would not endanger the environment.

We must recall that our country has undertaken international commitments to protect the environment, and one of the principles it must safeguard is the aforementioned precautionary principle (principio precautorio), under which prevention must anticipate adverse effects and ensure the protection, conservation, and proper management of resources. Accordingly, this guiding principle of prevention is grounded in the need to adopt and implement every precautionary measure necessary to prevent or contain possible harm to the environment or human health. Thus, where there is a risk of serious or irreversible harm—or uncertainty in that regard—a precautionary measure must be adopted, and the activity in question may even need to be postponed. This unquestionably requires the administration to maintain a preventive, active, and vigilant stance, since action taken only afterward and solely for punitive purposes would render ineffective any measure intended to protect the environment, given that once the damage occurs, it can rarely be remedied, and its harmful effects may be felt not only nationally but globally.

Prevention is, indeed, one of the guiding principles of environmental law (materia ambiental). This does not mean preventing development or halting progress and the economy; rather, a balance must be sought that allows human beings to develop while also enabling them to live in and enjoy that development, to which not only present but also future generations are entitled. The Chamber has stated:

“The origins of environmental problems are complex and arise from an interplay of natural and social processes within the framework of the socioeconomic-development model adopted by the country. Environmental problems arise, for example, when methods of exploiting natural resources cause ecosystems to deteriorate beyond their capacity for regeneration, with the result that broad sectors of the population are harmed and substantial environmental and social costs are generated, leading to a decline in quality of life; indeed, the primary objective of the use and protection of the environment is to achieve development and progress favorable to human beings...but more important still is to understand that although human beings have the right to use the environment for their own development, they also have a duty to protect and preserve it for present and future generations. This is not particularly novel, because it is merely the application to this field of the principle of ‘injury’ (lesión), already firmly established in ordinary law, under which the lawful exercise of a right has two essential limits: on the one hand, the equal rights of others and, on the other, the rational exercise and beneficial enjoyment of the right itself.” (see judgments 1993-3705 of fifteen hours on 30 de julio de 1993 and 1783-94 of nine hours and fifty-seven minutes on 15 de abril de 1994).

This analysis is not intended to indiscriminately equate the treatment that forests and forest plantations (plantaciones forestales) should receive, since ecological and socioeconomic studies may establish, for example, that an area should be designated as a protective forest area (área forestal protectora) because of the need to restore the soil or water or to protect plant and animal species, while in other cases restoration of the resource may be advisable by allowing its forest harvesting (aprovechamiento forestal) or forest renewal. Thus, what matters is not establishing a total and unreasonable prohibition preventing the use of resources, but ensuring that such use is properly regulated and preceded, at a minimum, by inspections guaranteeing that neither native nor exotic trees, regardless of the size of the area, are felled when they perform an essential environmental function in the sector where they were planted or naturally generated.

V.The challenged provisions. Under the challenged Article 27, a maximum of only 3 trees per hectare per year may be felled on land used for agriculture and livestock and containing no forest, after authorization has been obtained from the Consejo Regional Ambiental. If more than 10 trees are to be felled on a property, authorization from the Administración Forestal del Estado shall be required. Thus, this provision authorizes the felling of trees on land used for agriculture and livestock and containing no forest, which, under Article 2 of the Regulations to the Ley Forestal (Reglamento a la Ley Forestal), consists of private properties containing trees not established under an agroforestry system (sistema agroforestal), properties containing forest cover (cobertura boscosa) of less than two hectares, or trees located in urban areas. This Court does not find that the foregoing violates Article 50 of the Constitución Política, since the provision states that the respective felling requires prior authorization from the competent bodies and concerns land used for agriculture and livestock that contains no forest, subject also to the limitations established by Articles 33 and 34 of the Ley Forestal:

“Article 33.- Protection areas (áreas de protección) The following are declared protection areas:

  • a)Areas bordering permanent springs (nacientes), defined within a radius of cien metros measured horizontally.
  • b)A strip of quince metros in rural areas and diez metros in urban areas, measured horizontally on both sides along the banks of rivers, ravines, or streams, if the terrain is flat, and cincuenta metros horizontally if the terrain is rugged.
  • c)An area of cincuenta metros measured horizontally along the shores of natural lakes and reservoirs and of artificial lakes or reservoirs built by the State and its institutions. Privately owned artificial lakes and reservoirs are excluded.
  • d)The recharge areas and aquifers of the springs, whose boundaries shall be determined by the competent bodies established in the regulations to this law." "Article 34.- Prohibition on Felling Trees in Protected Areas The cutting or removal of trees in the protection areas (áreas de protección) described in the preceding article is prohibited, except for projects declared by the Poder Ejecutivo to be in the national interest (conveniencia nacional).

The boundary alignments (alineamientos) that must be processed in connection with these areas shall be performed by the Instituto Nacional de Vivienda y Urbanismo." Likewise, Articles 90 and 91 provide:

"1- Harvesting in Non-Forested Areas.

Article 90: Persons wishing to conduct forest harvesting (aprovechamiento forestal) or tree felling on non-forested land that, due to its characteristics, does not constitute an agroforestry system (sistema agroforestal), may choose whether to apply for authorization from the Consejo Regional Ambiental or from the Municipalidad where the property is located, provided that the total does not exceed veinte árboles per year.

The application must be submitted by the owner or possessor of the property in accordance with the requirements established for each case by both the Consejos Regionales and the respective Municipalidades.

Within 10 días, the Consejos Regionales Ambientales must decide on and issue the cutting and transportation permits. The Consejos Regionales Ambientales and the Municipalidades must forward a copy of the documentation to the A.F.E." "Article 91: In cases where the number of trees to be harvested exceeds veinte árboles, in wooded areas excluded from the definition of forests, the application must be processed through the corresponding Oficina Sub-Regional del A.C.; in addition to the general requirements established in these regulations, an inventory must be provided containing the number of species to be cut, the number of individual trees to be cut, and the volume to be extracted. This inventory must be prepared and signed by a forestry professional, and a sketch of the property must also be prepared indicating the approximate location of the trees to be cut. The application must contain a certification from the professional stating that the area does not constitute a forest or part of a forest under the definition in the Law, and it must comply with the requirements established in Article 85 of these regulations.

Upon receipt of the application, the corresponding Oficina Sub-Regional del A.C. shall verify the requirements and issue the corresponding permit without requiring a prior inspection." It should be noted that, under both articles, tree felling is not unrestricted but is subject to the conditions of the land and the corresponding permits. Our current regulations provide for two types of permits, depending on the number of trees to be cut. Thus, only a maximum of three árboles per hectare may be cut annually, after authorization has been obtained from the Consejo Regional Ambiental; if the cutting exceeds diez árboles per property, authorization from the Administración Forestal del Estado (A.F.E.) shall be required. Accordingly, for land with these characteristics, the permits that must be processed are permits for fewer than 20 árboles and inventories. The first case is governed by the challenged Articles 27 and 90, for which approval of the permit requires completion of an entire procedure established in the regulations.

Under that procedure, once the interested party submits an application, it is reviewed by the competent authority, which may request satisfaction of any missing requirements or further details regarding a particular requirement, granting a period of treinta días for compliance. The competent authority must issue a final decision within 10 días and shall then issue the cutting and transportation permits. The relevant authorities must forward a copy of the documentation to the A.F.E. In the event of noncompliance, after the interested party has been notified of the missing requirements, the case file shall be placed in temporary archival status for the seis meses following the noncompliance, without the need to issue any decision, and the case file may be reactivated during that period. Upon expiration of that period, the case file may be declared expired by decision and permanently archived.

Any subsequent filing concerning the same matter must be processed as a new filing. Motions for reconsideration (recursos de revocatoria) and appeals (apelación) may be filed against acts and decisions issued by the Consejos Regionales, including a decision denying an application for a harvesting permit on land used for agricultural and livestock purposes. In the first case, the matter shall be heard by the same authority and decided within a maximum of veinte días, while appeals shall be decided by the Ministerio del Ambiente y Energía. For its part, the inventory required by Article 91 is the type of permit that persons who own or possess properties must apply for when the land may be defined as non-forested agricultural and livestock land on which more than 20 árboles may be cut per year, although a forest inventory permit (permiso de inventario forestal) must be used. As a prerequisite, the area to be harvested must not fall within the definition of forest set forth in the Law.

Nevertheless, despite the preliminary delimitation made by Article 3 of that law in defining forest, this situation also requires an application for prior authorization, which must follow this procedure: An interested party wishing to conduct forest harvesting involving more than 20 árboles on non-forested agricultural and livestock land must submit to the corresponding Oficina Sub-Regional del Area de.Conservación an application containing the applicant’s information, the required documentation, and a clear explanation of the request. For that reason, the application must include an inventory containing the number of species to be cut, the number of individual trees to be cut, and the volume to be extracted. The inventory must be prepared and signed by a forestry professional. In addition, a sketch of the property must be prepared indicating the approximate location of the trees to be cut.

The application must also contain a certification from the professional stating that the area does not constitute a forest or part of a forest under the stated definition. The application submitted by the interested party is reviewed by the competent authority, which may request satisfaction of any missing requirements or further details regarding a particular requirement, granting a period of treinta días for compliance. The Administración Forestal del Estado (A.F.E.) shall issue its final decision within a maximum period of treinta días naturales. In the event of noncompliance, after the interested party has been notified of the missing requirements, the case file shall be placed in temporary archival status for the seis meses following the noncompliance, without the need to issue any decision, and the case file may be reactivated during that period. Upon expiration of that period, the case file shall be declared expired by decision and permanently archived.

Any subsequent filing concerning the same matter must be processed as a new filing. Motions for reconsideration and appeals may also be filed against acts and decisions of the AFE, including a decision denying an application for an inventory permit. Accordingly, and as has been duly explained, in this Tribunal’s view the cited provisions do not violate Article 50 of the Constitución Política because, as already stated, they concern regulated tree felling that excludes the forests of our country. Notwithstanding the foregoing, this Sala continues to find that there is indeed a problem with the definition of forest contained in Article 3 of the Ley Forestal.

—For its part, challenged Article 28 does establish an exception to the tree-cutting permit (permiso de corta), stating that forest plantations (plantaciones forestales), including agroforestry systems (sistemas agroforestales), individually planted trees, and their products do not require a permit for cutting, transportation, industrial processing, or export. When the provision refers to a forest plantation, it means one or more hectares cultivated with one or more forest species whose principal, but not exclusive, purpose is timber production. The foregoing distinctions are important because, for purposes of this analysis, it is relevant to differentiate a forest from a forest plantation and an agroforestry system in order to determine the degree of protection afforded to the species by the Ley Forestal. As already indicated, our law defines a forest as a native or indigenous ecosystem, regenerated through natural succession or other forestry techniques, occupying an area of two or more hectares, characterized by the presence of mature trees of different ages, species, and sizes, with one or more canopies covering more than 70% of that area, and containing more than 60 trees per hectare with a diameter at breast height (diámetro a la altura del pecho, DAP) of fifteen or more centimeters.

A forest plantation, in turn, is land comprising one or more hectares cultivated with one or more forest species, whose principal, but not exclusive, purpose is timber production. An agroforestry system, on the other hand, is a form of land use involving the combination, over time and space, of forest species with agronomic species in pursuit of the system’s sustainability. The foregoing is relevant in clarifying that the fundamental difference among them is that forest plantations and individually planted trees exist as a result of their owners’ productive and economic decisions, and it is therefore reasonable to facilitate their cutting, transportation, industrial processing, and export. This is the situation contemplated by challenged Article 28. A forest plantation is an artificial system, unlike a forest, which is an ecosystem in its natural state. In addition, forest plantations also generate environmental services (servicios ambientales), including: mitigation of greenhouse-gas emissions through fixation, reduction, sequestration, storage, and absorption; protection of urban, rural, or hydroelectric uses; protection of biodiversity for conservation and sustainable, scientific, and pharmaceutical use; research and genetic improvement; protection of ecosystems and forms of life; and so forth.

Another benefit is the employment generated when reforestation (reforestación) is promoted through timber harvesting, which is also extremely important for our domestic market, since the amount of timber that must be imported to cover any shortfall depends on the amount harvested. Studies by MINAE, FONAFIFO, and SINAC reveal that the number of planted hectares in the country has decreased substantially, resulting in a timber shortage. This entails another series of problems, not only for employment but also for the country’s economy and for nature itself, because the ideal course is certainly to promote reforestation and thus avoid reducing the payment for environmental services, which is a fund intended to promote it. This is the principal reason why the Ley Forestal provides for various incentives to make reforestation projects more attractive, one of which is precisely the exemption from the tree-cutting permit established in challenged Article 28.

The technical, social, environmental, and financial aspects, as well as compliance with other legal guidelines, are evaluated when establishing a reforestation project. One of the stated incentives is that investors in this field assess the profitability of the reforestation project, as well as the projected volume required by industry and the market generally, thereby generating a previously scheduled flow of raw materials and income. Clearly, the purpose is not to encourage unrestricted tree felling solely to favor investment to the detriment of the environment, but to seek a balance that contributes to sustainable development (desarrollo sostenible) within the framework of the principles of reasonableness and proportionality. The Chamber has stated that environmental quality is a fundamental parameter of quality of life; however, other equally important parameters include health, food, employment, housing, education, and so forth.

It has emphasized that the most important point is to understand that, although human beings have the right to use the environment for their own development, they also have a duty to protect and preserve it for present and future generations. Like any other nation, our country has depended and will continue to depend on its natural resources and environment to meet the basic needs of its inhabitants and keep the productive apparatus that sustains the national economy operating. Soil, water, air, marine and coastal resources, forests, biological diversity, mineral resources, and the landscape comprise the environmental framework without which basic needs—such as living space, food, energy, housing, sanitation, and recreation—could not be met. Likewise, our economy is also closely tied to the condition of the environment and natural resources. The goals of sustainable development, moreover, concern human survival and well-being and the maintenance of essential ecological processes—that is, environmental quality and the survival of other species.

To speak of sustainable development in terms of meeting present and future human needs and improving quality of life is to speak of the individual demand for natural resources and of the direct or supporting means required for the economy to function by generating employment and creating capital goods that, in turn, make it possible to transform resources into consumer, production, and export goods. Under these guidelines, establishing an incentive for forest plantations, such as authorization to cut certain tree species, is not unconstitutional. It should be noted that the very purpose of a forest plantation is to plant and subsequently harvest; in this case, the product is timber as a raw material. Furthermore, this exploitation is subject to a limit on the number of trees and to an obligation to reforest. Contrary to the petitioner’s assertion, such reforestation contributes to soil conservation and promotes the establishment of vegetation cover (cobertura vegetal).

There is also the separate situation in which owners, on their own initiative, planted a small number of trees to beautify their land. Depending on the number of trees, it would likewise be unreasonable subsequently to require a permit to cut each one, merely as a restriction on the exercise of their property rights. The solution sought by the petitioner—prohibiting all tree cutting—is unacceptable in this Court’s view, considering that some trees are planted precisely to be harvested; therefore, Article 28 is not unconstitutional per se. The Chamber does not doubt that a sound Reforestation Plan (Plan de Reforestación) guarantees the reasonable and proportionate exploitation of forest plantations—that is, it ensures the sustainable development of forest and water resources—and that it is also important to remove administrative obstacles relating to land used for agroforestry, where, as already indicated, agronomic and forest species are combined.

Nevertheless, the Chamber finds that the law does not establish precautionary measures (medidas precautorias) to ensure the proper application of challenged Article 28, because not every plantation requires a management plan (plan de manejo), and the only document required is a certificate of origin (certificado de origen), which is needed to remove and transport the timber. That certificate must establish the existence of a forest plantation or agroforestry system on a particular property and indicate the planted area, the number of trees, the species, the location, and the name of the male or female owner. However, as already indicated, that certificate is issued before the timber is moved—that is, after it has been cut. The Chamber considers that the foregoing, coupled with the highly restrictive definition of forest introduced by the amendment to the Ley Forestal, constitutes an omission that violates the precautionary principle (principio precautorio), which must safeguard the right to a healthy and ecologically balanced environment.

The preceding analysis duly established that the definition of forest set forth in Article 3 of the Ley Forestal provides the basis from which the application and scope of all other permits and restrictions established in this field are derived. Accordingly, when ruling on Articles 27 and 28 of the law and Articles 90 and 91 of the challenged regulations, this Court must, by unavoidable connection, also address Article 3. One of the petitioner’s arguments is that cypress is a non-native species and, therefore, its cutting is not protected under any circumstances because it was excluded from the definition of forest. Articles 33 and 34 of the Ley Forestal do indeed protect areas deemed protected areas (áreas protegidas), because they are located near water resources, regardless of the nature of the species. However, the Chamber considers this insufficient, taking into account that a forest, broadly defined—including under the definition in the Ley Forestal before its amendment—may also comprise non-native species from which the same environmental services identified above may be obtained.

Similarly, if the protection concerned the species or the method of production or regeneration of the trees, the Chamber likewise does not consider it reasonable to have required an area larger than 2 hectares. The foregoing reveals inadequate legislative protection in this regard: rather than ensuring protection when the law was amended in 1995 and 1998, the amendments reduced the scope of protection and, consequently, the protection of the right to a healthy and ecologically balanced environment, without even adopting preventive measures. The Executive Branch subsequently attempted, by decree, to protect areas smaller than those 2 hectares, with the aggravating circumstance that a restriction not established by law cannot be imposed by decree. Consequently, forests smaller than two hectares, or forests comprising non-native species regardless of their area, were left unprotected. It should be recalled that one of the prerequisites for a forest plantation or agroforestry system is that whatever is planted from the outset must be planted solely for the purpose of being harvested.

It was on that basis that the law sought to encourage such plantations and systems by eliminating certain administrative procedures. Nevertheless, it must be verified before the trees are cut that this is in fact the case, because the lack of oversight could facilitate the cutting of areas that do not actually constitute either a forest plantation or an agroforestry system.

Moreover, there are lands where, due to their owners’ inaction, a veritable forest has been allowed to proliferate on the property and is then felled without any regulation whatsoever, as well as trees that, even when planted, serve as windbreaks because of their number, location, and the function they have performed for many years; in order to protect fundamental values, this warrants their conservation and the regulation of their felling, regardless of the nature of the species. In some areas, plantations have even been established, such as those planted by ICE, to protect adjacent protection zones (zonas de protección) or aquifer-recharge areas (zonas de recarga de los acuíferos). Evidence of the importance of this protection, including because of the area concerned, is found in the provisions of Decree-Law No. LXV of July 30, 1888:

“Whereas the conservation of the mountains in which the streams and springs (manantiales) that supply water to the province of Heredia and part of the province of Alajuela originate is a matter of public utility, Article 1—A strip of land two kilometers wide on either side of the summit of the mountain known as Montaña del Volcán de Barba (sic), from the hill called el Zurquí to the one known as Concordia, is hereby declared inalienable, whether such land is owned by the national government or a municipality.

Article 2—The Executive Branch is authorized to increase or decrease the extent of the area referred to in the preceding article if, after the corresponding survey has been conducted by a scientific commission, it deems it appropriate to modify the area as recommended by that commission.” According to legal opinion No. OJ-118-2004 of the Office of the Attorney General dated 27 de setiembre del 2004, approximately 82% of the area at issue in this action is currently located within the areas covered by the Reserva Forestal Cordillera Volcánica Central and Parque Nacional Braulio Carrillo, and it encompasses approximately 40 springs identified in the official cartography. The foregoing illustrates the importance of this sector as a water resource, warranting preventive and protective measures to guarantee its conservation. For this reason, this Court considers that the challenged Article 28 is unconstitutional, not because of its content, but because of a legislative omission (omisión legislativa), since the Ley Forestal does not provide for measures to be taken before trees are cut, regardless of their nature and the area involved.

The purpose is to provide regulated parties with legal certainty that their conduct complies with the law and to ensure environmental protection by preventing cutting in areas where, according to experts in the field, it is inadvisable because of the serious environmental consequences that could result. Prevention seeks to anticipate adverse effects and ensure the protection, conservation, and proper management of resources. Consequently, the guiding principle of prevention (principio rector de prevención) is based on the need to take and implement all precautionary measures (medidas precautorias) to prevent or contain possible harm to the environment or human health. Thus, where there is a risk of serious or irreversible harm—or doubt in that regard—a precautionary measure must be adopted, and the activity concerned may even have to be postponed. This is because, in environmental matters, action taken after the fact is ineffective, since once harm has occurred, its ecologically and socially harmful consequences may be irreparable.

Having determined that the provision in question is unconstitutional because it fails to protect the right to a healthy environment, in relation to which the precautionary principle (principio precautorio) must prevail, reference must necessarily be made to the effects of a declaration to that effect. As already explained, the provision is deficient because the Ley Forestal does not establish prior measures, which may range from authorization to an inspection before the trees are cut, regardless of their nature and the area involved. The legislature’s failure to provide for preventive measures in this regard constitutes what is known as relative unconstitutionality by omission (inconstitucionalidad por omisión relativa). This omission arises in cases where a statutory provision regulates a particular legal situation but does so defectively, omitting one of its dimensions from the regulatory scheme.

In this type of silence, the express statutory provision is the subject of review, although the basis for challenging it is not its text but precisely what the text does not say, and that omission creates a situation contrary to the Constitution. A typical example of unconstitutionality by omission is found in statutory provisions that violate the principle of equality, either because they expressly exclude, without apparent reason, a particular group of individuals from a benefit to which they would be entitled or for which they would have a legitimate expectation, or because the provision, when regulating that benefit, grants it to a particular group and remains silent regarding everyone else (as in the case before us). According to legal scholarship, a provision may remain silent concerning a legal situation that must be protected because the Constitution so requires. An implicit rule may therefore be derived from the provision, regulating the legal situation subject to constitutional protection differently from the express rule, as in this case with the right to a healthy and ecologically balanced environment, which implicitly encompasses the precautionary principle.

According to the analysis of the challenged article, the legislature modified the concept of forest (bosque) that serves as the basis for the protections, restrictions, and permits established under the Ley Forestal—as in the case of the Article 28 at issue, “Exception from cutting permit requirement” (“Excepción de permiso de corta”)—thereby restricting, without technical justification, the previous concept of forest that existed in the law before its amendment. Consequently, non-native species and forested areas of less than two hectares were left without statutory protection, with the result that, under the challenged Article 28, no permit to cut is required, nor even a prior inspection to ensure that the situation is one the provision intended to encourage: any forest plantation (plantación forestal), agroforestry system (sistema agroforestal), or individually planted tree. This leaves exposed areas that, because of their location, quantity, and the function they have performed for many years, warrant conservation and regulation of their cutting, regardless of the nature of the species or the nature of the land where they are located.

Accordingly, for the reasons stated, this Chamber considers that relative unconstitutionality by omission exists in this case. Nevertheless, although the Constitutional Chamber has jurisdiction to declare a provision unconstitutional, a violation of this nature must be remedied by the Legislative Assembly by extending application of the law to cases not expressly covered by it, such as, in this case, the species and areas left unprotected under the current concept of forest, and by adopting preventive and oversight measures regarding areas in which cutting is permitted. For all the foregoing reasons, we find that the challenged Article 28 violates Article 50 of the Political Constitution. However, to avoid violating the principle of separation of powers, we consider it appropriate to grant the Legislative Assembly a reasonable period within which to remedy the stated violation.

VI.Conclusion. For all the foregoing reasons, the action is granted solely on the ground of the relative omission in Article 28 of the Ley Forestal to establish precautionary measures ensuring environmental protection in this regard. In all other respects, the action is denied. Justice Jinesta dissents and would deny the action.

Por tanto:

The action is granted solely on the ground that Article 28 of the Ley Forestal omits precautionary measures ensuring environmental protection. It is incumbent upon the Legislative Assembly to remedy the absence of precautionary measures that ensure, in advance, the proper application of Article 28 in protection of the environment, as stated in the reasoning section of this judgment. Notice of this judgment shall be given to the Legislative and Executive Branches. A summary of this decision shall be published in the Official Gazette “La Gaceta,” and the decision shall be published in full in the Boletín Judicial. In all other respects, the action is denied. Justice Jinesta dissents and would deny the action.

DISSENTING OPINION OF JUSTICE JINESTA LOBO The undersigned Justice dissents and would deny the action for the following reasons: I agree with the majority opinion’s analysis of the fundamental right to a healthy and ecologically balanced environment, as well as the State’s duty to protect it. However, I disagree regarding Article 28 of the Ley Forestal. Under that provision, “Forest plantations, including agroforestry systems and individually planted trees” do not require a cutting permit (permiso de corta). According to the majority opinion, precautionary measures must be added to Article 28 to ensure environmental protection, and it therefore orders the Legislative Assembly to do so. I consider amending the provision in the manner indicated to be unnecessary and potentially detrimental to environmental protection. It must be borne in mind, on the one hand, that halting forest exploitation is in the public interest.

On the other hand, promoting forest plantations is one of the policies adopted by the State to achieve that objective. These plantations meet society’s need for timber and timber products without harming the forest. They thus promote a sustainable development model (modelo de desarrollo sostenible) that harmonizes human needs with forest protection. Consequently, it must not be overlooked that the provision in question is the first article of Chapter III (Promotion of Forest Plantations), Title II (Private Forest Property), of Ley No. 7575 (Ley Forestal). Specifically, it grants landowners permission to cut trees they plant for commercial purposes, thereby giving them the confidence to undertake such planting. It is a measure intended to encourage forest plantations and thereby discourage forest exploitation; its ultimate purpose is environmental protection, not environmental destruction.

It is acceptable to grant permission in advance because it is clear that, to engage in that activity—as with any other activity—the interested party must comply with land-use limitations (limitaciones de uso de suelo). Consequently, there is no purpose in having MINAE issue a cutting permit for trees in a forest plantation when the law has already granted it. Making the harvesting (aprovechamiento) of those trees subject to an administrative decision eliminates the incentive. The Administration not only has the authority but is also required to verify that timber produced in the country comes from a forest plantation rather than illegal cutting, without any need for each article of the Ley Forestal—including Article 28—to so provide. On the contrary, requiring a cutting permit, or even another less burdensome measure, could only discourage investment in forest plantations, increase the cost of timber, and consequently make the irrational exploitation of forests, even in violation of the legal system, more profitable.

I understand the concern expressed in the majority opinion (considerando V) regarding the possible misuse of Article 28 in areas that are neither plantations nor agroforestry systems. Such misuse, however, does not arise from the provision, nor would it be prevented by reiterating that the provision applies only to certain types of plantations—that is already understood; it is a problem of inadequate enforcement. MINAE’s enforcement powers are neither diminished by the wording of the provision nor would they be increased if the provision repeated them. In sum, although well intentioned, I consider that a legislative amendment to the challenged article would create more disadvantages than benefits for environmental protection, and therefore I believe that the action filed should be denied.

Acción de inconstitucionalidad promovida por Nombre01, mayor, casado, abogado, cédula de identidad número CED01, vecino de Concepción de San Rafael de Heredia; contra los artículos 27 y 28 de la Ley Forestal número 7575 de 13 de febrero de 1996, así como los artículos 90 y 91 de su reglamento, Decreto Ejecutivo número 25721-MINAE de 17 de octubre de 1996. Intervino también en el proceso Ana Lorena Brenes Esquivel, en representación de la Procuraduría General de la República.

Resultando:

  1. 1Por escrito recibido en la Secretaría de la Sala a las diez horas quince minutos del veintidós de agosto del dos mil cinco, (folios 1 a 3), el accionante solicita se declare la inconstitucionalidad de los artículos 27 y 28 de la Ley Forestal número 7575 de 13 de febrero de 1996, así como los artículos 90 y 91 de su reglamento, decreto ejecutivo número 25721-MINAE de 17 de octubre de 1996, por estimarlos contrarios a los artículos 46 y 50 de la Constitución Política, ya que permite una tala irrestricta de árboles por el hecho de no calificar como nativos o autóctonos de una zona, a pesar de que puedan estar desempeñando una función de importancia desde el punto de vista de la protección de los recursos hídricos y del equilibrio ambiental y ecológico. Indica que el artículo 27 de la Ley Forestal y artículos 90 y 91 de su reglamento, permiten la corta de cualquier árbol cuando están en terrenos de uso agropecuario y sin bosque, con una simple autorización del Consejo Regional Ambiental o de la Municipalidad hasta un límite de veinte árboles.Si se requiere cortar más de veinte árboles un profesional en ciencias forestales debe dar fe de que no son parte de un bosque para que se de la autorización. La misma ley forestal en el artículo tercero inciso d), define al bosque como: al ecosistema nativo u autóctono que ocupa una superficie de dos o más hectáreas que cubran más del 70% de esta superficie y donde existan más de 60 árboles por hectárea, por lo que los cipreses no se consideran parte de un bosque, por no ser nativos o autóctonos. Por otro lado, indica que el artículo 28 de la Ley Forestal permite la tala de árboles sin permiso de corta, cuando se consideran que dichos árboles son parte de plantaciones forestales o que fueron plantados individualmente. Al denunciarse a la Municipalidad la corta de los cipreses, se alega que no pueden hacer nada, ya que el ciprés se puede cortar libremente, sin ningún control ni limitación.Refiere el accionante que por constituir este tipo de árboles verdaderos bosques en esta zona, su eliminación está llevando a la desertificación de las montañas y atenta contra el recurso hídrico, no solo de los habitantes del lugar, sino de una gran parte de los del Valle Central. Solicita que se declare con lugar la acción.
  2. 2Por resolución de las diez horas y treinta y cinco minutos del treinta de agosto del dos mil cinco, se previno al accionante precisar los fundamentos de impugnación (folio 4).
  3. 3Por escrito presentado el 2 de setiembre del 2005 el accionante cumple con la prevención señalada, indicando que el artículo 27 de la Ley Forestal ha abierto un portillo para que se de la tala en terrenos que no se consideren plantaciones forestales y que sean terrenos de uso agropecuario y sin bosque de cualquier cantidad de cipreses u otros árboles no autóctonos, al permitir la corta de más de diez árboles por inmueble, con la sola autorización de la Administración Forestal del Estado, sin considerar las consecuencias ambientales que se pueden dar con la tala. El no considerar las implicaciones geológicas, hídricas, ambientales que pueda llevar la tala de cipreses en el área montañosa del norte de Heredia y que no forman parte de áreas protegidas, ya sea que se alegue que son terrenos agrícolas o plantaciones forestales, para así talar sin mayores complicaciones, ha llevado a que en casi todos los casos donde se ha talado los cipreses, los terrenos han quedado sin árboles, ya que se ha hecho la tala con el único objetivo de dejar el terreno totalmente limpio de cualquier cobertura arborícola y así sea apto para construcciones de edificaciones habitacionales, industriales o hoteleras y no con el fin de sustituir las especies no autóctonas por especies nativas. Reitera la solicitud de que se declare con lugar la acción.
  4. 4A efecto de fundamentar la legitimación que ostenta para promover esta acción de inconstitucionalidad, señala que proviene del hecho de procurar la protección del ambiente y del balance ecológico, materias a las que la reiterada jurisprudencia de la Sala ha calificado como propias de los intereses difusos a los que alude el ordinal 75, párrafo segundo, de la Ley que la rige.
  5. 5Por resolución de las diez horas cuarenta y nueve minutos del catorce de setiembre del dos mil cinco (visible a folio 10 del expediente), se le dio curso a la acción, confiriéndole audiencia a la Procuraduría General de la República y al Ministerio del Ambiente y Energía.
  6. 6La Procuraduría General de la República, Ana Lorena Brenes Esquivel, rindió su informe visible a folios 15 a 37. No se objeta la legitimación del accionante. En cuanto al fondo considera cuestionable el concepto de bosque previsto en el artículo 3 inciso d) de la Ley Forestal que limita esos ecosistemas a las especies nativas o autóctonas. Si bien admite el hecho de que los árboles de ciprés del norte de Heredia no son nativos, estima aún así que estos cumplen una importante función biológica, a la vez que generan belleza escénica, que es un componente del equilibrio ambiental y ecológico. No considera que el artículo 27 citado posea vicios de inconstitucionalidad, en tanto la corta prevista en esa norma requiere la autorización de los órganos competentes y ha de entenderse que se trata de terreno de uso agropecuario sin bosque. En todo caso, la norma es complementada por los artículos 33 y 34 ibidem, que prohíben la corta de árboles, sin distingo de especie nativa o exótica dentro de las áreas de protección.No obstante, estima que del artículo 28 cuestionado sí se pueden generar efectos devastadores, por lo que solicita a la Sala hacer una interpretación para indicar que la corta de árboles sembrados -sean nativos o no- sí precisa de autorización cuando pueda afectar los bienes naturales y culturales donde han prestados funciones ecológicas a través de los años y que esa autorización debe ser limitada, proporcional y razonable. Con respecto al artículo 90 del Reglamento, considera que se aparta del precepto legal que circunscribe la autorización en terrenos agropecuarios (sin bosque), lo cual puede causar efectos inconvenientes en los recursos naturales. Por tanto, solicita realizar una interpretación correctiva o en su defecto declararlo inconstitucional, pues los terrenos sin bosque pueden ser de aptitud forestal y requieren la necesidad de reforestarlos en caso de que tengan mantos acuíferos. Finalmente, en cuanto al artículo 91, en el tanto la norma prevé un permiso o autorización, no aprecia vicio de inconstitucionalidad.
  7. 7Por escrito presentado por Nombre04 (folio 38), solicita que se le tenga como coadyuvante pasivo en esta acción, toda vez que considera que su padre desde 1928 ha sembrado ciprés en la zona, esta actividad ha sido exitosa en la zona y se ha vuelto una tradición. Nunca se ha afectado las nacientes de agua, ni se le ha causado algún daño por la deforestación, ya que la madera suplida por estos cultivos de ciprés le quita la presión al bosque natural. Argumenta que hoy en día, decir que la libre cosecha de madera de ciprés pone en peligro las fuentes de agua es ignorar los hechos históricos, ya que son las plantaciones de ciprés, las que protegen el bosque natural alrededor de las mismas. Mientras las siembras de ciprés sean rentables, estás se renuevan constantemente, como sucede con cualquier otra cosecha agrícola. Poner restricciones a esta y a cualquier otra cosecha, pone en serio peligro su renovación, y en consecuencia lleva a la extinción del producto.Condicionar la cosecha a los productores de madera es una odiosa discriminación con respecto a los otros agricultores de árboles a los que no se les imponen restricciones. Señala que el accionante sólo pretende interferir la cosecha de madera, pero no comenta nada acerca de los demás agricultores de árboles. Prohibir la cosecha de ciprés o de cualquier otro producto de árboles sembrados, o condicionarla a algún tipo de permiso deja al agricultor con la certeza de su justa remuneración a su trabajo.
  8. 8Por escrito presentado por Nombre03 y Marco Quesada Acuña, en su condición Presidente y I Vicepresidente de la Junta Directiva de la Asociación Cámara Costarricense Forestal, solicitan que se les tenga como coadyuvantes pasivos en esta acción, toda vez que consideran que según la Ley Forestal, artículo 3, inciso f, plantación forestal se define como: "terreno de una o más hectáreas, cultivado de una o más especies forestales cuyo objetivo principal, pero no único, será la producción de la madera". La Cámara Forestal, respalda que una plantación forestal se concibe como un cultivo forestal, por ende establecido de manera artificial en terrenos de aptitud preferentemente forestal, utilizando especies nativas y/o exóticas, con diferentes propósitos, entre ellos la producción forestal. Se entiende como producción forestal aquella actividad agrícola con el objetivo de producir y vender madera.Las actividades de manejo de las plantaciones, en periodo de cosecha aparte de mejorar las condiciones de los árboles, también mejoran significativamente las condiciones del sitio, siendo fundamentales en el control de la erosión, escorrentía superficial y la aparición del sotobosque. Las buenas prácticas de manejo silvicultural donde se incluyen árboles que se extraen bajo fundamento técnico y periódicamente en una plantación forestal, generan un efecto directo en la conservación de los suelos a causa de sus efectos a posteriori con la aparición de individuos pioneros en el soto bosque, lo que establece un favorecimiento al establecimiento de cobertura vegetal. Los árboles de ciprés han sido plantados como parte de proyectos de reforestación, con diferentes objetivos entre ellos el aprovechamiento y venta de madera. La plantación forestal queda de manifiesto ser un sistema artificial y el bosque un ecosistema en estado natural.Los beneficios socioeconómicos y ambientales de una plantación ambiental son: generar una serie de servicios ambientales entre ellos, mitigación de emisiones de gases de efecto invernadero, protección del agua, protección de la biodiversidad y protección de ecosistemas. También la generación de empleo por los distintos tratamientos necesarios para mantener las plantaciones y el proceso maderero. La falta de plantaciones trae efectos negativos como el faltante de madera necesaria para el mercado nacional, y por ende la necesidad de traer de otros países esta misma, generando gastos al país. La acción de inconstitucionalidad planteada, conlleva un detrimento refiriéndose a la inversión del Estado a través del Fondo Nacional de Financiamiento Forestal. La Ley Forestal fomenta las plantaciones forestales, en su artículo 28. El libre derecho de corta de árboles provenientes de plantaciones forestales, es necesaria para dar seguridad jurídica y económica en esta inversión.También la Procuraduría de la República en fecha 10 de octubre del 2005 indicó que los terrenos sin bosque pueden ser de aptitud forestal y requieren la necesidad de reforestarlos en caso de que tengan mantos acuíferos, esto es claramente un fomento a esta actividad tanto para el beneficio de uno como el de todos, por ejemplo en el cuido de los mantos acuíferos. Concluye que las buenas prácticas de manejo silvicultural donde se incluyen los árboles que se extraen bajo fundamento técnico y periódicamente en una plantación forestal, generan un efecto directo en la conservación de los suelos a causa de sus efectos a posteriori con la aparición de individuos pioneros en el sotobosque, lo que favorece al establecimiento de cobertura vegetal.
  9. 9Por escrito presentado por Raúl Solórzano Soto, en su condición de Director Superior del Sistema Nacional de Areas de Ministerio de Ambiente y Energía, solicita se le tenga como coadyuvante pasivo en esta acción, toda vez que considera que la Administración Forestal del Estado es del criterio que en los documentos de la Procuraduría General de la República se confunden algunos conceptos, contenidos en la Ley Forestal en el Artículo 3, incisos d, f y h. Bosque: "ecosistema nativo o autóctono, intervenido o no, regenerado por sucesión natural u otras técnicas forestales, que ocupa una superficie de dos o más hectáreas, caracterizada por la presencia de árboles maduros de diferentes edades, especies y porte variado, con uno o más doseles que cubran más del setenta por ciento de esa superficie y donde existan más de sesenta árboles por hectárea de quince o más centímetros de diámetro a la altura del pecho (DAP)".Plantación Forestal: "terreno de una o más hectáreas, cultivado de una o más especies forestales cuyo objetivo principal, pro no único, será la producción de la madera". Sistema Agroforestal: "forma de usar la tierra que implica la combinación de especies forestales en tiempo y espacio con especies agronómicas, en procura de la sostenibilidad de sistema". La existencia de plantaciones forestales y árboles individualmente plantados obedecen a una decisión productiva y económica de sus propietarios, sean personas físicas y/o jurídicas. Es evidente que los árboles de Ciprés, como los de otras especies localizados en diferentes zonas del país, han sido plantados como parte de programas de fomento al cultivo de árboles que el Estado costarricense ha venido implementando por espacio de más de treinta años, con el propósito de producir madera y así disminuir la presión sobre los bosques naturales.La producción de árboles tanto frutales como maderables, pueden tener efectos beneficiosos en la protección de los suelos, abastecimiento de los mantos acuíferos y hasta la belleza escénica. La necesidad de mantener los incentivos a este tipo de actividades es esencial por la poca cantidad de hectáreas sembradas en el país (apenas 54.000), las cuales deben proveer a la industria maderera del país, sin embargo, no es suficiente y la explotación y el gasto de estos es muy grande. El fomento de la actividad de siembra de árboles madereros es muy importante en el país y concluye pidiendo la desestimación de la acción de inconstitucionalidad.
  10. 10Por escrito presentado por Nombre02 y Jhonny Méndez Gamboa en su condición de representantes de la Junta Directiva de la Oficina Nacional Forestal, solicitan se les tenga como coadyuvantes pasivos en esta acción, toda vez que consideran que es una falacia y la aseveración del accionante debe reputarse como temeraria. Comenta que con solo leer su introducción la Sala debió haberla rechazado de plano. Si eso estuviere sucediendo sería de dominio público y el MINAE hubiera intervenido por la gravedad de una situación que es ajena a la realidad. Sólo se han aprovechado los árboles sembrados individualmente los cuales están ubicados fuera de las áreas de protección del artículo 33 de la Ley Forestal. Lo sorprendente para ellos es la opinión de la Procuraduría General de la República, la que según su opinión, denota un análisis a la ligera, inconsulta desde la óptica técnica y carente de un estudio integral de las normas correspondientes.Si una persona transgrede lo dicho en el artículo 33 de la Ley Forestal, acerca de la tala de árboles, es necesario denunciarlo. Es importante si, regular y proteger en la forma establecida los bosques y el recurso hídrico en los inmuebles maderables no cubiertos de bosque, sin embargo, no se puede hilar tan delgado y obligar a las personas a reforestar los inmuebles que han perdido su cobertura original, pues depende de su libre albedrío. El artículo 19 de la Ley Forestal regula el cambio de uso en terrenos cubiertos de bosque y prohíbe su eliminación, salvo en los casos en él contemplados y siempre y cuando, la corta sea proporcional y razonable, se evidencia que ninguno de los artículos impugnados se refiere al bosque. Mediante el artículo 28 de la Ley Forestal se posibilita la siembra de cultivos de árboles maderable por parte de los dueños de las propiedades en cualquier momento, por cuanto, producen beneficios en la protección de los suelos, el abastecimiento de los mantos acuíferos y hasta la belleza escénica.La corta de los árboles aquí cuestionada es ínfima, lo cual no afecta a la aptitud forestal, sin embargo, no debe de permitirse la corta en áreas del recurso hídrico. En relación con el artículo 91 de la Ley Forestal, el inventario forestal, el cual es un requisito esencial para la corta, es un documento elaborado por un profesional competente, que da fe, entre otros, que no existe bosque y que no se afectarán las áreas de protección del recurso hídrico.
  11. 11Mediante resolución de las nueve horas treinta y cuatro minutos del primero de febrero del dos mil seis, (folio 76), se rechazaron por extemporáneas las gestiones que presentaron como coadyuvantes pasivos, Nombre04 en su condición personal, (folios 38 a 41), Nombre03 y Marco Quesada Acuña, en representación de la Cámara Costarricense Forestal, (folios 44 a 57), Raúl Solózarno Soto como Director del Sistema Nacional de Áreas de Conservación del Ministerio del Ambiente y Energía, (folios 59 a 65), Nombre02 y Jhonny Méndez Gamboa, representantes de la Oficina Nacional Forestal. (folios 66 a 71).

12- Mediante resolución de las dieciséis horas quince minutos del tres de marzo del dos mil seis, (folio 83), se tuvo por contestadas las audiencias conferidas a la Procuraduría General de la República y al Ministerio del Ambiente y Energía.

  1. 13Los edictos a que se refiere el párrafo segundo del artículo 81 de la Ley de la Jurisdicción Constitucional fueron publicados en los boletines judiciales números 188, 189 y 190 de los días 30 de setiembre, 3 y 4 de octubre del 2005 (folio 14).
  2. 14Con fundamento en lo dispuesto por el artículo 9 de la Ley de la Jurisdicción Constitucional, se prescinde de la audiencia oral y pública prevista en los artículos 10 y 85 de la Ley de la Jurisdicción Constitucional, por considerar que existen suficientes elementos de juicio para resolver esta acción.
  3. 15En los procedimientos se ha cumplido las prescripciones de ley.

. Redacta la Magistrada Calzada Miranda; y,

Considerando:

I.Cuestiones Preliminares. Como aspecto previo, procede aclarar, que aún y cuando este Tribunal por resolución de las diez horas cuarenta y nueve minutos del catorce de setiembre del dos mil cinco le dio curso a la acción, confiriéndole audiencia a la Procuraduría General de la República y al Ministerio del Ambiente y Energía; y se tuvo por contestadas ambas audiencias, lo cierto es que el Ministro no contestó la audiencia correspondiente, sino que Raúl Solórzano Soto, en su condición de Director Superior del Sistema Nacional de Areas de Ministerio de Ambiente y Energía, se apersonó, pero como coadyuvante pasivo en esta acción.

II.Sobre la admisibilidad. El artículo 75 de la Ley de la Jurisdicción Constitucional, establece los presupuestos de admisibilidad para las acciones de inconstitucionalidad. De esta suerte, en el párrafo primero se exige la existencia de un asunto previo, en sede jurisdiccional o administrativa, en que se invoque la inconstitucionalidad de la norma, como medio razonable de amparar el derecho o interés considerado lesionado. Se conceptúa así, la regla general de la necesidad de contar con un asunto previo, siendo excepcionales las posibilidades de acudir en forma directa a la Sala, y que se encuentran regulados en el párrafo segundo en aquellos supuestos en que:

"[...] por la naturaleza del asunto no exista lesión individual y directa, o se trate de la defensa de intereses difusos, o que atañen a la colectividad en su conjunto"; La Sala ha señalado, que los intereses difusos son aquellos cuya titularidad pertenece a grupos de personas no organizadas formalmente, pero unidas a partir de una determinada necesidad social, una característica física, su origen étnico, una determinada orientación personal o ideológica, el consumo de un cierto producto, etc. El interés, en estos casos, se encuentra difuminado, diluido (difuso) entre una pluralidad no identificada de sujetos. En estos casos, claro, la impugnación que el miembro de uno de estos sectores podría efectuar amparado en el párrafo 2° del artículo 75, deberá estar referida necesariamente a disposiciones que lo afecten en cuanto tal. De suerte que a través de las diversas resoluciones de esta Sala, se ha reconocido la existencia de un interés difuso en los reclamos contra la violación del medio ambiente, precisamente al tenor de lo dispuesto en el artículo 50 de la Constitución Política, a partir de las cuales ha elaborado una teoría de legitimación directa en estos casos:

"Esta Sala ha enumerado diversos derechos a los que les ha dado el calificativo de "difusos", tales como el medio ambiente, el patrimonio cultural, la defensa de la integridad territorial del país y del buen manejo del gasto público, entre otros. Al respecto deben ser efectuadas dos precisiones: por un lado, los referidos bienes trascienden la esfera tradicionalmente reconocida a los intereses difusos, ya que se refieren en principio a aspectos que afectan a la colectividad nacional y no a grupos particulares de ésta; un daño ambiental no afecta apenas a los vecinos de una región o a los consumidores de un producto, sino que lesiona o pone en grave riesgo el patrimonio natural de todo el país e incluso de la Humanidad; del mismo modo, la defensa del buen manejo que se haga de los fondos públicos autorizados en el Presupuesto de la República es un interés de todos los habitantes de Costa Rica, no tan solo de un grupo cualquiera de ellos.

Por otra parte, la enumeración que ha hecho la Sala Constitucional no pasa de una simple descripción propia de su obligación -como órgano jurisdiccional- de limitarse a conocer de los casos que le son sometidos, sin que pueda de ninguna manera llegar a entenderse que solo pueden ser considerados derechos difusos aquellos que la Sala expresamente haya reconocido como tales; lo anterior implicaría dar un vuelco indeseable en los alcances del Estado de Derecho, y de su correlativo "Estado de derechos", que -como en el caso del modelo costarricense- parte de la premisa de que lo que debe ser expreso son los límites a las libertades, ya que éstas subyacen a la misma condición humana y no requieren por ende de reconocimiento oficial. Finalmente, cuando el párrafo 2° del artículo 75 de la Ley de la Jurisdicción Constitucional habla de intereses "que atañen a la colectividad en su conjunto", se refiere a los bienes jurídicos explicados en las líneas anteriores, es decir, aquellos cuya titularidad reposa en los mismos detentores de la soberanía, en cada uno de los habitantes de la República.

No se trata por ende de que cualquier persona pueda acudir a la Sala Constitucional en tutela de cualesquiera intereses (acción popular), sino que todo individuo puede actuar en defensa de aquellos bienes que afectan a toda la colectividad nacional, sin que tampoco en este campo sea válido ensayar cualquier intento de enumeración taxativa" (sentencia número 2001-08239, supra citada).

Por su parte, en igual sentido, en sentencia número 2002-01220, de las catorce horas cuarenta y ocho minutos del 6 de febrero del 2002, se indicó que el derecho a un ambiente sano y ecológicamente equilibrado se ha conceptualizado como un derecho de "tercera generación", que es derecho y deber de cada uno de los habitantes, y que como tal, sus valores gozan de una protección privilegiada mediante la cual cualquier persona puede reclamar su protección, precisamente basada en la autorización que al respecto confiere el artículo 75 párrafo 2° de la Ley de la Jurisdicción Constitucional, de manera que puede interponer directamente la acción de inconstitucionalidad, razón por la que, en los casos en que ni el interesado ni la resolución de curso de la acción se indique esa especial legitimación, la acción interpuesta es admisible, en el tanto se convierte en un medio de protección de ese tipo de intereses cuando lo reclamado sea la protección del medio ambiente y los recursos naturales.

II.De la legitimación del accionante en el caso concreto. A efecto de fundamentar la legitimación que ostenta para promover esta acción de inconstitucionalidad, el accionante se sustenta en lo dispuesto por el artículo 50 de la Constitución Política, que reconoce una legitimación genérica para denunciar tanto las infracciones a la conservación del ambiente, como el derecho a reclamar la reparación del daño causado. Efectivamente, al tenor de las consideraciones dadas, y constatándose que en la gestión en estudio se cuestiona la vulneración del medio ambiente, por estimarse que la normativa impugnada permite la tala irrestricta de árboles de ciprés de las montañas del norte del Área Metropolitana en la provincia de Heredia, afectándose los procesos de drenaje natural necesarios para el desarrollo de los mantos acuíferos, ante la mayor escorrentía de las aguas y la erosión de los suelos, así como el menoscabo a la belleza paisajista de la zona, es claro que debe admitirse para su estudio por el fondo, por estimarse debidamente legitimada, ya que precisamente se está en el supuesto de la existencia de un verdadero "interés difuso o que atañe a la colectividad en su conjunto", dispuesto en el párrafo segundo del artículo 75 de la Ley de la Jurisdicción Constitucional.

III.Objeto de la impugnación. El accionante impugna los artículos 27 y 28 de la Ley Forestal y 90 y 91 de su Reglamento, (Decreto No. 25721-MINAE), por estimarlos contrarios a los artículos 46 y 50 de la Constitución Política, en tanto permiten una tala irrestricta de árboles por el hecho de no calificar como nativos, o autóctonos de una zona, a pesar de que puedan estar desempeñando una función de importancia desde el punto de vista de la protección de los recursos hídricos y del equilibrio ambiental y ecológico. Para efectos de mejor comprensión, se procede a citar las normas de estudio:

"Artículo 27.- Autorización para talar Solo podrán cortarse hasta un máximo de tres árboles por hectárea anualmente en terrenos de uso agropecuario y sin bosque, después de obtener la autorización del Consejo Regional Ambiental. Si la corta sobrepasare los diez árboles por inmueble, se requerirá la autorización de la Administración Forestal del Estado.

Fomento de las plantaciones forestales Artículo 28.- Excepción de permiso de corta Las plantaciones forestales, incluidos los sistemas agroforestales y los árboles plantados individualmente y sus productos, no requerirán permiso de corta, transporte, industrialización ni exportación. Sin embargo, en los casos en que antes de la vigencia de esta ley exista un contrato forestal, firmado con el Estado para recibir Certificados de Abono Forestal o deducción del impuesto sobre la renta, la corta deberá realizarse conforme a lo establecido en el plan de manejo aprobado por la Administración Forestal del Estado.

CAPITULO DECIMO SETIMO

Del Control Forestal 1- Del aprovechamiento en áreas sin bosque.

Artículo 90: Las personas que deseen realizar aprovechamiento forestal o tala de árboles en terrenos sin bosque y que por sus características no es un sistema agroforestal, podrán decidir si solicitan la autorización ante el Consejo Regional Ambiental o en la Municipalidad donde se encuentre el inmueble, siempre y cuando no superen un total de veinte árboles por año.

La solicitud deberá ser presentada por el propietario o propietaria o poseedor del inmueble según los requisitos que para cada caso establezcan tanto los Consejos Regionales como las respectivas Municipalidades.

En un plazo de 10 días los Consejos Regionales Ambientales deberán resolver y extender los permisos de corta y transporte. Los Consejos Regionales Ambientales y las municipalidades deberán remitir copia de la documentación a la A.F.E.

Artículo 91: Para aquellos casos donde el número de árboles a aprovechar sea superior a veinte árboles, en áreas arboladas excluidas de la definición de bosques, deberá ser tramitado en la Oficina Sub-Regional del A.C. correspondiente, debiendo adicionar a los requisitos generales establecidos en este reglamento un inventario que deberá contener, número de especies a cortar, número de individuos a cortar y volumen a extraer. Dicho inventario deberá ser elaborado y firmado por un profesional en ciencias forestales, además se debe elaborar un croquis de la finca indicando la ubicación aproximada de los árboles a cortar. La solicitud deberá contener una constancia del profesional en la cual establezca que el área no corresponde a un bosque o parte de un bosque según la definición de la Ley, y cumplir con los requisitos establecidos en el artículo 85 de este reglamento. Recibida la solicitud por la Oficina Sub-Regional del A.C. correspondiente, esta verificará los requisitos y entregará el permiso correspondiente sin requerir de inspección previa."

IV.Sobre el fondo. Una vez delimitado el objeto de la acción y siendo que lo impugnado por el accionante está vinculado al permiso de corta de árboles cuando están en determinado tipo de terrenos y por su naturaleza, se procede a realizar el análisis de constitucionalidad correspondiente, determinando previamente el derecho fundamental lesionado:

A.- Sobre el Derecho Fundamental a un Ambiente Sano y Ecológicamente Equilibrado. Este Tribunal en la sentencia No. 2003-6322, desarrolló el tratamiento jurisprudencial que le ha dado la Sala a este derecho constitucional, el cual se resume para los efectos de estudio en esta acción y se complementa con otras consideraciones. De previo a la reforma del artículo 50 de la Constitución Política, la jurisprudencia de la Sala ya había reconocido la protección y preservación del ambiente como un derecho humano (sentencia número 1993-2233), al derivarlo de lo dispuesto en los artículos 21 (derecho a la salud), 69 (exigencia constitucional a la "explotación racional de la tierra") y 89 (protección de las bellezas naturales), todos de la Constitución, con fundamento en las siguientes consideraciones:

"V.)- La vida humana sólo es posible en solidaridad con la naturaleza que nos sustenta y nos sostiene, no sólo para alimento físico, sino también como bienestar psíquico: constituye el derecho que todos los ciudadanos tenemos de vivir en un ambiente libre de contaminación, que es la base de una sociedad justa y productiva. Es así como el artículo 21 de la Constitución Política señala: "La vida humana es inviolable." Es de este principio constitucional de donde innegablemente se desprende el derecho a la salud, al bienestar físico, mental y social, derecho humano que se encuentra indisolublemente ligado al derecho de la salud y a la obligación del Estado de proteger de la vida humana.

Asimismo, desde el punto de vista psíquico e intelectual, el estado de ánimo depende también de la naturaleza, por lo que también al convertirse el paisaje en un espacio útil de descanso y tiempo libre es obligación su preservación y conservación. Aspecto este último que está protegido en el artículo 89 constitucional, el cual literalmente dice: "Entre los fines culturales de la República están: proteger las bellezas naturales, conservar y desarrollar el patrimonio histórico y artístico de la Nación, y apoyar la iniciativa privada para el progreso científico y artístico". Proteger la naturaleza desde el punto de vista estético no es comercializarla ni transformarla en mercancía, es educar al ciudadano para que aprenda a apreciar el paisaje estético por su valor intrínseco" (sentencia número 1993-3705, de las quince horas del treinta de julio de mil novecientos noventa y tres).

"XIII.- El término "bellezas naturales" era el empleado al momento de promulgarse la Constitución (7 de noviembre de 1949) que hoy se ha desarrollado como una especialidad del derecho: el derecho ambiental que reconoce la necesidad de preservar el entorno no como un fin cultural únicamente, sino como una necesidad vital de todo ser humano. En este sentido, el concepto de derecho al ambiente sano, supera los intereses recreativos o culturales que también son aspectos importantes de la vida en sociedad, sino que además constituye un requisito capital para la vida misma. [...]

[...]

De manera que es claro que ya no existe duda sobre la protección constitucional del derecho a la salud jalonado del derecho a la vida y por allí de un derecho al ambiente sano. A manera de ejemplo podemos citar las sentencias 1580-90; 1833-91, 2362-91; 2728-91; 2233-93; 4894-93; que han reconocido el derecho a la salud y a un ambiente sano, como un derecho individual constitucionalmente protegido" (sentencia número 1993-6240, de las catorce horas del veintiséis de noviembre de mil novecientos noventa y tres).

"La norma 69, la Carta Política habla de la "explotación racional de la tierra" lo que constituye un principio fundamental. En consecuencia, son cánones del orden constitucional, aquella protección y preservación, así como la explotación racional de los recursos que se han indicado" (sentencia número 1993-2233).

Del artículo 69 de la Carta Fundamental se deriva el principio de explotación racional de la tierra, y se impone, tanto a los particulares como al Estado en su acepción más amplia, la obligación de proteger y preservar los recursos naturales renovables:

"II. La protección del medio ambiente es una tarea que corresponde a todos por igual: a las instituciones públicas, haciendo respetar la legislación vigente y promoviendo esfuerzos que prevengan o eliminen peligros para el medio ambiente; a los particulares, acatando aquellas disposiciones y colaborando en la defensa del suelo, el aire y el agua, pues todo cambio nocivo resultante de un acto humano en la composición, contenido o calidad de éstos resultará también perjudicial para la calidad de vida del humano" (sentencia número 4480-94, de las diez horas cuarenta y un minutos del diecinueve de agosto de mil novecientos noventa y cuatro).

En la jurisprudencia constitucional, el concepto de "ambiente" no ha sido limitado a los elementos primarios de la naturaleza, sea el suelo, el aire, el agua, los recursos marinos y costeros, los minerales, los bosques, la diversidad biológica en la flora y fauna, y el paisaje; a partir de los cuales se conforma el marco ambiental sin el cual las demandas básicas -como la alimentación, energía, vivienda, sanidad y recreación- serían imposibles. Es importante resaltar que este término se ha entendido de una manera más integral, estableciéndose un concepto "macro-ambiental", al comprender también aspectos referentes a la economía, a la generación de divisas a través del turismo, la explotación agrícola y otros:

"Por lo anterior, el Derecho Ambiental no debe asociarse sólo con la naturaleza, pues ésta es únicamente parte del ambiente. La política de protección a la naturaleza se vierte también sobre otros aspectos como la protección de la caza, de los bosques, de los parques naturales y de los recursos naturales. Se trata, entonces, de un concepto macro-ambiental, para no dejar conceptos importantes por fuera y así lograr unificar el conjunto jurídico que denominamos Derecho Ambiental" (sentencia número 5893-95, de las nueve horas cuarenta y ocho minutos del veintisiete de octubre de mil novecientos noventa y cinco; y en igual sentido, las número 3705- 93, supra citada, y número 2988-99, de las once horas cincuenta y siete minutos del veintitrés de abril de mil novecientos noventa y nueve).

1-Tutela del derecho ambiental, un deber Estatal. A partir de la reforma del artículo 50 constitucional mediante Ley número 7412, de tres de junio de mil novecientos noventa y cuatro, en la cual se consagró expresamente el derecho ambiental como un derecho fundamental, se estableció también -en forma terminante- la obligación del Estado de garantizar, defender y tutelar este derecho, con lo cual, el Estado se constituye en el garante en la protección y tutela del ambiente y los recursos naturales. Es a partir de esta reforma, donde se otorga a los ciudadanos, plena acción para defenderlo, dando así contenido expreso a este derecho:

"[...], esta Sala ha establecido que el derecho a un ambiente sano y ecológicamente equilibrado es un derecho fundamental, como tal ya consagrado y garantizado por el Derecho de la Constitución, [motivo por el que] no considera inútil ni, mucho menos, objetable que se reconozca de manera expresa y claramente individualizado, [...]" (sentencia número 1394-94, de las quince horas veintiún minutos del dieciséis de marzo de mil novecientos noventa y cuatro).

"II.- Se tiene entonces que la posición asumida por este Tribunal al respecto, se ve confirmada en la actualidad por la reforma constitucional de cita, reforma esta que no es sino reflejo de la concepción de que el hombre si bien tiene derecho a hacer uso del medio ambiente, tiene también la obligación de protegerlo y preservarlo para el disfrute de generaciones futuras" (sentencia número 5668-94, de las dieciocho horas del veintiocho de septiembre de mil novecientos noventa y cuatro).

Es a tenor de esta disposición, en relación con los artículos 20, 69 y 89 de la Constitución Política, que se derivó la responsabilidad del Estado y se perfila el Estado Social de Derecho; por lo que podemos concluir, que la Constitución Política enfatiza que la protección del ambiente, es un mecanismo adecuado para tutelar y mejorar la calidad de vida de todos, lo que hace necesaria la intervención de los Poderes Públicos sobre los factores que pueden alterar su equilibrio y obstaculizar que la persona se desarrolle y desenvuelva en un ambiente sano. Es así, como el mandato constitucional establece el deber para el Estado de garantizar, defender y preservar ese derecho:

"Prima facie garantizar es asegurar y proteger el derecho contra algún riesgo o necesidad, defender es vedar, prohibir e impedir toda actividad que atente contra el derecho, y preservar es una acción dirigida a poner a cubierto anticipadamente el derecho de posibles peligros a efectos de hacerlo perdurar para futuras generaciones. El Estado debe asumir un doble comportamiento de hacer y de no hacer; por un lado debe abstenerse de atentar él mismo contra el derecho a contar con un ambiente sano y ecológicamente equilibrado, y por otro lado, debe asumir la tarea de dictar las medidas que permitan cumplir con los requerimientos constitucionales" (sentencia número 9193-2000, de las dieciséis horas veintiocho minutos del diecisiete de octubre del dos mil).

La incidencia que tiene este derecho dentro de la actividad del Estado, encuentra su primera razón de ser, en que por definición, los derechos no se limitan a la esfera privada de los individuos, sino que tienen asimismo trascendencia en la propia estructura del Estado, en su papel de garante de los mismos y, en segundo término, porque la actividad del Estado, se dirige hacia la satisfacción de los intereses de la colectividad. En este orden de ideas, debe considerarse que la normativa establece al Ministerio del Ambiente y Energía, como el órgano rector del sector de los recursos naturales, energía y minas, según lo dispuesto en el artículo 2 de la Ley Orgánica de este ministerio, número 7152, de cuatro de junio de mil novecientos noventa:

"Serán funciones del Ministerio del Ministerio del Ambiente y Energía, las siguientes:

  • a)Formular, planificar y ejecutar las políticas de recursos naturales, energéticas, mineras y de protección ambiental del Gobierno de la República, así como la dirección, el control, la fiscalización, promoción y el desarrollo en los campos mencionados. Asimismo, realizar y supervisar las investigaciones, las exploraciones técnicas y los estudios económicos de los recursos del sector.
  • b)Fomentar el desarrollo de los recursos naturales, energéticos y mineros.
  • c)Promover y administrar la legislación sobre conservación y uso racional de los recursos naturales, a efecto de obtener un desarrollo sostenido de ellos, y velar por su cumplimiento.

ch) Dictar, mediante decreto ejecutivo, normas y regulaciones, con carácter obligatorio, relativas al uso racional y a la protección de los recursos naturales, la energía y las minas.

  • d)Promover la investigación científica y tecnológica relacionada con las materias de su competencia, en coordinación con el Ministerio de Ciencia y Tecnología.
  • e)Promover y administrar la legislación sobre exploración, explotación, distribución, protección, manejo y procesamiento de los recursos naturales relacionados con el área de su competencia, y velar por su cumplimiento.
  • f)Tramitar y otorgar los permisos y concesiones referentes a la materia de su competencia.
  • g)Propiciar, conforme con la legislación vigente, la suscripción de tratados, convenios y acuerdos internacionales, así como representar al Gobierno de la República en los actos de su competencia, de carácter nacional e internacional. Todo lo anterior en coordinación con el Ministerio de Relaciones Exteriores y Culto.
  • h)Fomentar y desarrollar programas de formación ambiental en todos los niveles educativos y hacia el público en general.
  • i)Realizar inventarios de los recursos naturales con que cuenta el país.
  • j)Asesorar a instituciones públicas y privadas en relación con la planificación ambiental y el desarrollo de áreas naturales.
  • k)Las demás que le asigne el ordenamiento jurídico." Esta función de rectoría en la materia ambiental, a criterio de este Tribunal, comprende no sólo el establecimiento de regulaciones adecuadas para el aprovechamiento del recurso forestal y los recursos naturales, según lo dispone también el artículo 56 de la Ley Orgánica del Ambiente, sino que le confiere la importante función de ejercer la rectoría en la materia ambiental, consistente en mantener un papel preponderante en esta materia, para lo cual, "[...] dictará las medidas generales y particulares, relacionadas con la investigación, la exploración, la explotación y el desarrollo de esos recursos, con base en lo dispuesto en el Plan Nacional de Desarrollo"; En este sentido, el control y fiscalización de la materia y actividad ambiental se constituye en una función esencial del Estado, según lo dispuesto en el artículo 50 de la Constitución, en tanto dispone en lo que interesa en el párrafo tercero: "El Estado garantizará, defenderá y preservará ese derecho"; lo cual resulta concordante con el principio constitucional establecido en el párrafo segundo del artículo 9 de la Constitución Política, que expresamente prohíbe a los Poderes del Estado la delegación del ejercicio de funciones que le son propias, máxime cuando se constituyen en esenciales.

De esta manera, tratándose de la protección ambiental, las funciones de rectoría, control y fiscalización de la materia ambiental, corresponden al Estado, a cargo de las diversas dependencias administrativas.

2- Uso racional de los recursos. Un equilibrio entre el desarrollo del país y el derecho al ambiente. A partir del artículo 69 constitucional, en cuanto dispone el "uso racional de los recursos naturales", es que la Sala en su jurisprudencia, ha establecido los parámetros constitucionales para el uso adecuado de los mismos; y en virtud de los cuales, queda claro que la protección al ambiente debe encaminarse a la utilización adecuada e inteligente de sus elementos y en sus relaciones naturales, socioculturales, tecnológicos y de orden político (desarrollo sostenible), para con ello salvaguardar el patrimonio al que tienen derecho las generaciones presentes y futuras. Por ello, el objetivo primordial del uso y protección del ambiente es que a través de la producción y uso de la tecnología, se obtengan no solo ganancias económicas (libertad de empresa), sino un desarrollo y evolución favorable del ambiente y los recursos naturales con el ser humano, esto es, sin que se cause daño o perjuicio:

"Esta Sala también ha reconocido, que tanto el derecho a la salud como a un ambiente libre de contaminación, sin el cual el primero no podría hacerse efectivo, son derechos fundamentales, de modo que, es obligación del Estado proveer a su protección, ya sea a través de políticas generales para procurar ese fin o bien, a través de actos concretos por parte de la Administración. El desarrollo sostenible es una de esas políticas generales que el Estado dicta para ampliar las posibilidades de que todos puedan colmar sus aspiraciones a una vida mejor, incrementando la capacidad de producción o bien, ampliando las posibilidades de llegar a un progreso equitativo entre un crecimiento demográfico o entre éste y los sistemas naturales. Es el desarrollo sostenible, el proceso de transformación en la utilización de los recursos, orientación de las inversiones, canalización del desarrollo tecnológico, cambios institucionales y todo aquello que coadyuve para atender las necesidades humanas del presente y del futuro" (sentencia número 1994-1763, de las dieciséis horas cuarenta y cinco minutos del trece de abril de mil novecientos noventa y cuatro).

La Sala ha indicado que el ambiente, debe ser entendido como un potencial de desarrollo para utilizarlo adecuadamente, debiendo actuarse de modo integrado en sus relaciones naturales, socioculturales, tecnológicas y de orden político, ya que, en caso contrario, se degrada su productividad para el presente y el futuro y podría ponerse en riesgo el patrimonio de las generaciones venideras. Los orígenes de los problemas ambientales son complejos y corresponden a una articulación de procesos naturales y sociales en el marco del estilo de desarrollo socioeconómico que adopte el país. Por ejemplo, se producen problemas ambientales cuando las modalidades de explotación de los recursos naturales dan lugar a una degradación de los ecosistemas superior a su capacidad de regeneración, lo que conduce a que amplios sectores de la población resulten perjudicados y se genere un alto costo ambiental y social que redunda en un deterioro de la calidad de vida; pues precisamente el objetivo primordial del uso y protección del ambiente es obtener un desarrollo y evolución favorable al ser humano.

La calidad ambiental es un parámetro fundamental de esa calidad de vida; otros parámetros no menos importantes son salud, alimentación, trabajo, vivienda, educación, etc., pero más importante que ello es entender que si bien el hombre tiene el derecho de hacer uso del ambiente para su propio desarrollo, también tiene el deber de protegerlo y preservarlo para el uso de las generaciones presentes y futuras, lo cual no es tan novedoso, porque no es más que la traducción a esta materia, del principio de la "lesión", ya consolidado en el derecho común, en virtud del cual el legítimo ejercicio de un derecho tiene dos límites esenciales: Por un lado, los iguales derechos de los demás y, por el otro, el ejercicio racional y el disfrute útil del derecho mismo. Nuestro país ha dependido y seguirá dependiendo, al igual que cualquier otra nación, de sus recursos naturales y su medio para llenar las necesidades básicas de sus habitantes y mantener operando el aparato productivo que sustenta la economía nacional, cuya principal fuente la constituye la agricultura y, en los últimos años, el turismo, especialmente en su dimensión de ecoturismo.

El suelo, el agua, el aire, los recursos marinos y costeros, los bosques, la diversidad biológica, los recursos minerales y el paisaje conforman el marco ambiental sin el cual las demandas básicas -como espacio vital, alimentación, energía, vivienda, sanidad y recreación- serían imposibles. De igual modo, nuestra economía también está íntimamente ligada al estado del ambiente y de los recursos naturales. Por otro lado, las metas del desarrollo sostenible tienen que ver con la supervivencia y el bienestar del ser humano y con el mantenimiento de los procesos ecológicos esenciales, es decir, de la calidad ambiental y de la sobrevivencia de las otras especies. Hablar de desarrollo sostenible en términos de satisfacción de las necesidades humanas presentes y futuras y del mejoramiento de la calidad de vida es hablar de la demanda de los recursos naturales a nivel individual y de los medios directos o de apoyo necesarios para que la economía funcione generando empleo y creando los bienes de capital, que a su vez hagan posible la transformación de los recursos en productos de consumo, de producción y de exportación.

La declaración que se hizo en la Cumbre de la Tierra en 1992, se proclamó y reconoció la naturaleza integral e independiente del planeta, ello significa la aceptación de ciertos principios que informan la transición de los actuales estilos de desarrollo a la sostenibilidad. Los Estados signatarios, entre los que figura Costa Rica, se comprometieron, dentro de la preservación del desarrollo sostenible, a la protección sobre todo del ser humano. Se partió del principio de que toda persona tiene derecho a una vida saludable y productiva en armonía con la naturaleza; se incluyó el derecho de las generaciones presentes y futuras a que el desarrollo se realice de modo tal que satisfaga sus necesidades ambientales y de progreso; se mantuvo la potestad soberana de los Estados de explotar sus recursos, recalcando su responsabilidad de asegurar que las actividades que realicen dentro de su jurisdicción y control no causen daños ambientales a otros Estados o áreas más allá de los límites de su jurisdicción nacional.

Establecieron el deber de los Estados de cooperar en la conservación, protección y restauración del ambiente y sus responsabilidades comunes en ese sentido; de ese modo la cooperación internacional en la promoción y apoyo del crecimiento económico y el desarrollo sostenible permitirá abordar mejor los problemas de la degradación ambiental. Asimismo, se impuso un deber especial a los países desarrollados fundado en su responsabilidad en la búsqueda del desarrollo sostenible, dada la evidente presión que ejercen en el ambiente global las tecnologías que desarrollan y los recursos financieros que poseen.

3- El Principio precautorio en materia de derecho ambiental. Este principio está contenido en la Conferencia de las Naciones Unidas sobre el Medio Ambiente y el Desarrollo, Declaración de Río, la cual dispone:

"Principio 15.- Con el fin de proteger el medio ambiente, los Estados deberán aplicar ampliamente el criterio de precaución conforme a sus capacidades. Cuando haya peligro de daño grave e irreversible, la falta de certeza científica absoluta no deberá utilizarse como razón para postergar la adopción de medidas eficaces en función de los costos para impedir la degradación del medio ambiente". (En igual sentido ver artículo 11 de la Ley de Biodiversidad).

Como ya indicó la Sala, el término prevención deriva del latín "praeventio", que alude a la acción y efecto de prevenir, a aquellas preparaciones y disposiciones que se hacen anticipadamente para evitar un riesgo o ejecutar una cosa. La prevención pretende anticiparse a los efectos negativos, y asegurar la protección, conservación y adecuada gestión de los recursos. Consecuentemente, el principio rector de prevención, se fundamenta en la necesidad de tomar y asumir todas las medidas precautorias para evitar o contener, la posible afectación del ambiente o la salud de las personas. De esta forma, en caso de que exista un riesgo de daño grave o irreversible -o una duda al respecto-, basada en estudios técnicos, se debe adoptar una medida de precaución e inclusive posponer la actividad de que se trate. Lo anterior, debido a que en materia ambiental la coacción a posteriori resulta ineficaz, por cuanto de haberse producido el daño, las consecuencias biológicas y socialmente nocivas pueden ser irreparables, la represión podrá tener una trascendencia moral, pero difícilmente compensará los daños ocasionados al ambiente.

4- La coordinación entre las dependencias públicas, debe garantizar la protección del medio ambiente. En diversas oportunidades, la jurisprudencia constitucional ha indicado que la protección del ambiente es una tarea que corresponde a todos por igual, es decir, que existe una obligación para el Estado -como un todo- de tomar las medidas necesarias para proteger el medio, a fin de evitar grados de contaminación, deforestación, extinción de flora y fauna, uso desmedido o inadecuado de los recursos naturales, que pongan el peligro la salud de los administrados. En esta tarea, por institución pública, debe entenderse comprendida tanto la Administración Central -Ministerios, como el Ministerio del Ambiente y Energía y el Ministerio de Salud, que en razón de la materia, tienen una amplia participación y responsabilidad en lo que respecta a la conservación y preservación del ambiente; los cuales actúan, la mayoría de las veces, a través de sus dependencias especializadas en la materia, como por ejemplo, la Dirección General de Vida Silvestre, la Dirección Forestal, y la Secretaría Técnica Nacional Ambiental (SETENA); así como también las instituciones descentralizadas, caso del Instituto Nacional de Vivienda y Urbanismo, el SENARA, el Instituto Costarricense de Turismo o el Instituto Costarricense de Acueductos y Alcantarillados; tarea en la que por supuesto tienen gran responsabilidad las municipalidades, en lo que respecta a su jurisdicción territorial.

Es por ello, que podría pensarse que esta múltiple responsabilidad provocaría un caos en la gestión administrativa, lo cual no es cierto, por cuanto a fin de evitar la coexistencia simultánea de esferas de poder de diferente origen y esencia, la duplicación de los esfuerzos nacionales y locales, así como la confusión de derechos y obligaciones entre las diversas partes involucradas, es que se hace necesario establecer una serie de relaciones de coordinación entre las diversas dependencias del Poder Ejecutivo y las instituciones descentralizadas, y entre éstas con las municipalidades, a fin de poder llevar a cabo las funciones que les han sido encomendadas. Esta Sala con anterioridad -y en forma bastante clara- se refirió al principio de coordinación de las dependencias públicas con las municipalidades en la realización de fines comunes -lo cual, obviamente se debe hacer extensivo a la relación que en esta importante función realizan las instituciones de la Administración Central y las descentralizadas-, para lo cual se remite a lo indicado en aquella ocasión (sentencia número 1999-5445, de las catorce horas treinta minutos del catorce de julio de mil novecientos noventa y nueve):

"De manera que la coordinación es la ordenación de las relaciones entre estas diversas actividades independientes, que se hace cargo de esa concurrencia en un mismo objeto o entidad, para hacerla útil a un plan público global, sin suprimir la independencia recíproca de los sujetos agentes. Como no hay una relación de jerarquía de las instituciones descentralizadas, ni del Estado mismo en relación con las municipalidades, no es posible la imposición a éstas de determinadas conductas, con lo cual surge el imprescindible "concierto" interinstitucional, en sentido estricto, en cuanto los centros autónomos e independientes de acción se ponen de acuerdo sobre ese esquema preventivo y global, en el que cada uno cumple un papel con vista en una misión confiada a los otros. Así, las relaciones de las municipalidades con los otros entes públicos, sólo pueden llevarse a cabo en un plano de igualdad, que den como resultado formas pactadas de coordinación, con exclusión de cualquier forma imperativa en detrimento de su autonomía, que permita sujetar a los entes corporativos a un esquema de coordinación sin su voluntad o contra ella; pero que sí admite la necesaria subordinación de estos entes al Estado y en interés de éste (a través de la "tutela administrativa" del Estado, y específicamente, en la función de control la legalidad que a éste compete, con potestades de vigilancia general sobre todo el sector)." Por otro lado, las omisiones al deber de protección del ambiente y de cumplimiento de la normativa ambiental son de relevancia constitucional, por cuanto a consecuencia de la inercia de la Administración en esta materia, se puede producir un daño al ambiente y a los recursos naturales, a veces, de similares o mayores consecuencias, que de las derivadas de las actuaciones de la Administración; como lo es la autorización de planes reguladores, o construcciones sin la aprobación del estudio de impacto ambiental por parte Secretaría Técnica Nacional Ambiental, o la falta de control y fiscalización en la ejecución de los planes de manejo de las áreas protegidas por parte de la Dirección General de Vida Silvestre del Ministerio del Ambiente y Energía, o el permitir el funcionamiento de empresas sin los permisos de salud en lo que respecta al tratamiento de aguas negras o residuales (Acueductos y Alcantarillados y Ministerio de Salud), o no verificar los controles sónicos en bares, karaokes y discotheques (municipalidades y Ministerio de Salud), etc.

B.-La ley Forestal. En desarrollo de lo anterior, la Ley Forestal señala que es función esencial y primordial del Estado, velar por la protección, la conservación, el aprovechamiento, la industrialización, la administración y el fomento de los recursos forestales del país, de acuerdo con el principio de uso racional de los recursos naturales renovables y se distingue entre el patrimonio forestal del Estado y el patrimonio forestal privado. El primero está sometido a un régimen de dominio público y es formado por todos los bosques y terrenos forestales de las reservas nacionales, de las áreas declaradas inalienables, de las fincas inscritas a su nombre y de las pertenecientes a las municipalidades, a las instituciones autónomas y a los demás organismos de la Administración Pública. En este caso, la administración puede conceder permisos de uso únicamente para proyectos que no requieran aprovechamiento forestal y que no afecten los ecosistemas, la vida silvestre, los suelos, los humedales y los mantos acuíferos.

Por su parte, constituye patrimonio forestal privado, todos aquellos bosques y terrenos de aptitud forestal que pertenezcan a personas físicas o jurídicas particulares (artículos 1°, 32 y 43 de la Ley Forestal). En estas propiedades pueden llevarse a cabo diversas actividades, según se trate de terrenos con bosque, con plantaciones forestales o sean terrenos de uso agropecuario sin bosque. No obstante, los requisitos y restricciones para el ejercicio de una actividad dentro de estas zonas, están básicamente relacionadas con el aprovechamiento maderable o forestal. Este último se refiere a la acción de corta, eliminación de árboles maderables en pie o utilización de árboles caídos, realizada en terrenos privados, no incluida en el artículo 1 de la Ley Forestal, que genere o pueda generar algún provecho, beneficio, ventaja, utilidad o ganancia para la persona que la realiza o para quien esta representa.

Este concepto como ya fue señalado, excluye todos aquellos terrenos que formen parte del patrimonio natural del Estado, pues dicho aprovechamiento debe tomar lugar en fincas privadas. Ahora bien, las delimitaciones de la Ley Forestal están claramente vinculadas al concepto de bosque. Esta normativa define lo que debe ser considerado bosque y lo que refiere, a un ecosistema boscoso. Según el artículo 3 de esta Ley, el bosque es un ecosistema nativo o autóctono, regenerado por sucesión natural u otras técnicas forestales, que ocupa una superficie de dos o más hectáreas, caracterizada por la presencia de árboles maduros de diferentes edades, especies y porte variado, con uno o más doseles que cubran más del 70% de esa superficie y donde existan más de 60 árboles por hectárea de quince o más centímetros de diámetro a la altura del pecho (DAP). De conformidad con lo anterior, el carácter determinante es básicamente la superficie de terreno que debe ocupar, de más de 2 hectáreas para ser considerado tal.

A contrario sensu y en la forma descrita, no existe bosque en aquellos terrenos con una superficie inferior a las dos hectáreas, ni por aquellos árboles que no sean autóctonos. Frente a lo anterior, el ordenamiento jurídico mediante el decreto ejecutivo No. 27998 publicado el 29 de julio de 1999 denominado "Manejo Sostenible de Bosques Secundarios y Certificación Forestal", acogió una definición de bosque secundario, con el fin de tutelar aquel bosque de menor superficie y con menor densidad, el cual es definido de la siguiente manera:

"Tierra con vegetación leñosa de carácter sucesional secundaria que se desarrolla una vez que la vegetación original ha sido eliminada por actividades humanas y/o fenómenos naturales, con una superficie mínima de 0,5 hectáreas y con una densidad no menor a 500 árboles por hectárea de todas las especies, con diámetro mínimo a la altura del pecho de 5 cm. Se incluyen también las tierras de bosque secundario inmediatamente después de aprovechadas bajo el sistema de cortas de regeneración" No obstante lo anterior, su aplicación no podría ser efectiva al encontrarse frente a una definición de bosque establecida vía ley, lo cual la convierte en una ineficaz protección frente a los permisos y procedimientos establecidos en la ley forestal. De conformidad con el ordenamiento jurídico, en terrenos considerados bosque, según el artículo 3 citado, el SINAC puede autorizar determinado tipo de actividades, como por ejemplo: proyectos de infraestructura, de naturaleza estatal o privada, de conveniencia nacional; construcción de casas, oficinas, establos, corrales, viveros, caminos, puentes y otras instalaciones dedicadas a la recreación, ecoturismo y otros afines en terrenos y fincas de dominio privado; cortar árboles por razones de seguridad humana o de interés científico, prevenir incendios forestales, desastres naturales u otras causas análogas, así como para el aprovechamiento.

Estos bosques sólo pueden ser aprovechados, si sus titulares legítimos cuentan con un Plan de Manejo debidamente aprobado por el SINAC, siempre y cuando se analice previamente el impacto que éste pueda ocasionar. Para ello, la persona legitimada puede someterse al Plan de Manejo al Sistema de Certificación Forestal, a través de la participación de un Certificador Forestal debidamente acreditado por la Administración Forestal del Estado o presentar una solicitud ante la oficina subregional para la respectiva aprobación del Plan de Manejo. En el primer caso, será un certificador forestal debidamente acreditado por la A.F.E. quien deberá garantizar previamente que el plan de manejo cumple con los requisitos legales y técnicos, para luego continuar el procedimiento de autorización; en el segundo, la solicitud que inicia el trámite, debe ir firmada por un profesional forestal, quien será responsable por la información que suscriba. Este Plan de manejo, según el artículo 3 inciso e), debe entenderse como aquel:

"Conjunto de normas técnicas que regularán las acciones por ejecutar en un bosque o plantación forestal, en un predio o parte de este con el fin de aprovechar, conservar y desarrollar la vegetación arbórea que exista o se pretenda establecer, de acuerdo con el principio del uso racional de los recursos naturales renovables que garantizan la sostenibilidad del recurso." Asimismo, de conformidad con el artículo 21 de la Ley Forestal, debe existir un regente forestal, quien será el que esté a cargo de la ejecución del plan de manejo y será responsable de que el mismo se cumpla, con las responsabilidades penales y civiles que derivan de su cargo. La discusión es que toda esta protección circunda alrededor de lo que concibe la ley, en su concepción restringida de bosque ya citada, destinada a proteger únicamente áreas superiores a las 2 hectáreas y que sean únicamente de especies nativas o autóctonas.

De ahí que el accionante considere la violación acusada, por cuanto señala que el ciprés no se encuentra protegido dentro de dicho supuesto. Efectivamente, el ciprés, cuyo nombre común es del género Cupressus, es un árbol de zonas cálidas o templadas, de crecimiento rápido, que puede alcanzar los 20 m de altura con un diámetro aproximado de unos 60 cm. Es una conífera de hojas perennes, de la familia de las Cupresáceas. Crece naturalmente en cualquier parte del mundo, con las temperaturas y suelos adecuados, pero es cultivado comercialmente en África oriental, Sudáfrica y Nueva Zelanda. La plantación de árboles de ciprés en nuestro país data de hace muchos años, pues se trata de una especie no autóctona, sembrada por algunas personas con diversos fines, algunos como parte de proyectos de reforestación (de aprovechamiento y venta de la madera), así como de rompevientos en zonas altas, y otros les han dado el uso de belleza escénica.

El accionante cuestiona que la función que realizan los árboles de ciprés, debe ser tutelado de la misma forma que un bosque natural, sin embargo se trata de una especie no autóctona, que como ya se indicó, no está tutelada en nuestro ordenamiento jurídico, lo que amerita previamente un pronunciamiento de este Tribunal.

C.-Los bosques. Independientemente del concepto señalado en la Ley Forestal actual, es posible concebir doctrinariamente conceptos más amplios de bosque. Por ejemplo, bosque es un sitio poblado de árboles y matas, generalmente en espesura. Ampliando el concepto, también puede señalarse que "bosque es toda aquella superficie de tierra en donde se hallan creciendo asociaciones vegetales, predominando árboles de diferentes tamaños que han sido explotados o no, capaces de producir madera u otros productos; influyen en el clima y en el régimen hidrológico y además brindan protección a la vida silvestre.". La Procuraduría General nos ilustra en su informe también con algunas definiciones: "los bosques son ecosistemas dinámicos, con procesos continuos de cambio (crecimiento y deterioro) con árboles representativos y dominantes". Se relacionan con otras plantas, animales y microorganismos, así como con su medio físico, geográfico, produciendo una serie de interacciones complejas de elementos bióticos y abióticos denominadas funciones ecológicas, tales como: regulación hidrológica, ciclaje de nutrientes, flujo de energía y regulación climática.

Otros distinguen entre bosque primario y bosque secundario. Los primeros, considerados bosques vírgenes o climáticos, se caracterizan por una abundancia de árboles maduros, que no han sido alterados por las actividades humanas, los cuales según datos aportados por la Procuraduría, un 78% de estos bosques a nivel mundial han sido ya destruidos. Los secundarios, por su parte, contienen ecosistemas que se regeneran naturalmente en un plazo medio de 15 años aproximadamente, a partir de una alteración sustancial: inundación, quemas agrícolas, incendios forestales, limpia de terreno o aprovechamiento extensivo. Se caracterizan por la poca cantidad de árboles maduros, con una abundancia de especies de rápido crecimiento y un espeso sotobosque de plántulas y plantas herbáceas. Se caracterizan además por surgir, en algunas ocasiones, a partir de charrales o tacotales. De hecho, es de suma importancia recalcar, que la Ley Forestal previo a su reforma mediante ley No. 7575 de 5 de febrero de 1996, tenía una concepción de bosque amplísima en el artículo 6: "Son bosques todas las asociaciones vegetales compuestas, predominantemente de árboles y de otra vegetación leñosa".

No se hacía distinción alguna en aquella definición ni en las citadas, el hecho de que para ser considerado bosque, deba estar formado únicamente por árboles nativos y no por exóticos, que incluso pudieron haberse regenerado naturalmente y que deba ser mayor a 2 hectáreas. Otro aspecto importante a considerar son los servicios que prestan los bosques, los cuales son de suma importancia para las personas y para el desarrollo de la misma sociedad, entre ellos podemos citar: servicios maderables (uso de la madera, leña, postes), no maderables (hierbas medicinales, tintes, plantas ornamentales, semillas, bejucos, palmas y materiales de construcción, material para artesanía), mantenimiento del ciclo hidrológico (agua para el consumo humano, labores industriales, comerciales y domésticas; protección de la agricultura, energía hidroeléctrica), regulación del microclima, control de inundaciones, de la erosión, de sedimentos, de vientos y ruidos; paisaje (fotografía, pintura, videos, pesca y turismo), recreación y ecoturismo, mantenimiento de la resistencia, preservación del ecosistema y la biodiversidad (material de investigación, turismo científico), y cambio climático (fijación de dióxido de carbono).

De ahí que la afectación de los mismos, acarree graves problemas para el mismo ser humano, toda vez que la deforestación provoca inundaciones, derrumbes, escasez del agua, sedimentación de ríos, riachuelos y represas, pérdidas de cosechas, etc. Visto lo anterior, resulta claro para la Sala, que lleva razón la Procuraduría al señalar, que la definición de bosque contenida en la actual ley Forestal, es insuficiente y tutela en forma deficitaria los bosques de nuestro país, con el agravante, de que es a partir de ésta, que se producen las demás definiciones de los tipos de terrenos que son objeto de la corta de los mismos, en algunos casos reguladamente y en otras, hasta en forma irrestricta. Ciertamente la reforma a esta ley, que se produjo mediante ley No. 7575 de 5 de febrero de 1996, tuvo como fin el promover e incentivar la reforestación en nuestro país, para lo cual intentó librar de trámites innecesarios la corta de determinado tipo de árboles.

No obstante lo anterior, considera este Tribunal que al haber pasado la ley de una definición amplia de bosque, con mayor cobertura de protección, a una tan restringida en cuanto a especies y superficie, hace que la protección dada con anterioridad al ambiente, haya sido disminuida sin una justificación razonable, que vaya más allá de la necesidad de reforestar y eliminar las trabas administrativas, como un incentivo de esta actividad, pero sin asegurar previamente, que ésta en su ejecución, no pusiera en peligro el ambiente. Debemos recordar que nuestro país ha suscrito compromisos internacionales de protección al ambiente y uno de los principios que debe resguardar es el principio precautorio ya citado, según el cual, la prevención debe anticiparse a los efectos negativos, y asegurar la protección, conservación y adecuada gestión de los recursos. Consecuentemente, este principio rector de prevención, se fundamenta en la necesidad de tomar y asumir todas las medidas precautorias para evitar o contener la posible afectación del ambiente o la salud de las personas.

De esta forma, en caso de que exista un riesgo de daño grave o irreversible -o una duda al respecto-, se debe adoptar una medida de precaución e inclusive posponer la actividad de que se trate. Sin duda alguna, para ello se requiere de una posición preventiva, activa y alerta por parte de la administración, pues una conducta posterior y únicamente sancionatoria, haría nugatoria cualquier acción efectiva que se pretenda a favor del ambiente, donde una vez producido el daño, difícilmente puede ser restaurado y sus efectos nocivos pueden afectar no sólo a nivel nacional, sino mundial. Y es que este, es uno de los principios rectores en materia ambiental, la prevención. Con ello no se trata tampoco de evitar el desarrollo y detener el progreso y la economía, sin embargo se debe procurar un equilibrio que le permita al ser humano desarrollarse, pero también vivir y disfrutar ese desarrollo, al cual tienen derecho no sólo las generaciones actuales, sino también las venideras. La Sala ha indicado:

"Los orígenes de los problemas ambientales son complejos y corresponden a una articulación de procesos naturales y sociales en el marco del estilo de desarrollo socioeconómico que adopte el país. Por ejemplo, se producen problemas ambientales cuando las modalidades de explotación de los recursos naturales dan lugar a una degradación de los ecosistemas superior a su capacidad de regeneración, lo que conduce a que amplios sectores de la población resulten perjudicados y se genere un alto costo ambiental y social que redunda en un deterioro de la calidad de vida; pues precisamente el objetivo primordial del uso y protección del ambiente es obtener un desarrollo y evolución favorable al ser humano...pero más importante que ello es entender que si bien el hombre tiene el derecho de hacer uso del ambiente para su propio desarrollo, también tiene el deber de protegerlo y preservarlo para el uso de las generaciones presentes y futuras, lo cual no es tan novedoso, porque no es más que la traducción a esta materia, del principio de la "lesión" ya consolidado en el derecho común, en virtud del cual el legítimo ejercicio de un derecho tiene dos límites esenciales : por un lado, los iguales derechos de los demás, y, por el otro, el ejercicio racional y el disfrute útil del derecho mismo". (véanse sentencias 1993-3705 de las quince horas del 30 de julio de 1993 y 1783-94 de las nueve horas cincuenta y siete minutos del 15 de abril de 1994).

Este desarrollo no pretende igualar el trato que deben recibir los bosques y las plantaciones forestales indiscriminadamente, toda vez que a partir de estudios ecológicos y socioeconómicos se puede determinar por ejemplo, que un área debe ser forestal protectora, por la necesidad de recuperar el suelo, el agua o proteger especies de flora y fauna, así como en algunos casos lo recomendable puede ser la recuperación del recurso, permitiendo su aprovechamiento forestal o la renovación del bosque. De modo que, lo relevante no es establecer una prohibición total e irrazonada que impida el aprovechamiento de los recursos, pero sí debidamente regulada y que cuente previamente, al menos, con inspecciones que garanticen que no sean talados árboles nativos o exóticos sin importar el área, que estén cumpliendo una función esencial ambiental en el sector donde fueron sembrados o generados naturalmente.

V.Sobre las normas impugnadas. Según el artículo 27 cuestionado, sólo podrán cortarse hasta un máximo de 3 árboles por hectárea anualmente en terrenos de uso agropecuario y sin bosque, después de obtener la autorización del Consejo Regional Ambiental. Si la corta sobrepasare los 10 árboles por inmueble, se requerirá la autorización de la Administración Forestal del Estado. De modo, que esta norma autoriza la tala de árboles en terrenos de uso agropecuario y sin bosque, los cuales según el artículo 2 del Reglamento a la Ley Forestal, son aquellas fincas privadas con la presencia de árboles no establecidos bajo un sistema agroforestal o fincas que tienen áreas con cobertura boscosa menores a dos hectáreas, ó aquellos árboles ubicados en áreas urbanas. Este Tribunal no estima de lo anterior, que se esté lesionando el artículo 50 de la Constitución Política, por cuanto el mismo señala, que para la corta respectiva, se requiere de la autorización previa de los órganos competentes y se trata de terrenos de uso agropecuario que no tienen bosque, con las limitaciones que además establecen los artículos 33 y 34 de la Ley Forestal:

"Artículo 33.- Áreas de protección Se declaran áreas de protección las siguientes:

  • a)Las áreas que bordeen nacientes permanentes, definidas en un radio de cien metros medidos de modo horizontal.
  • b)Una franja de quince metros en zona rural y de diez metros en zona urbana, medidas horizontalmente a ambos lados, en las riberas de los ríos, quebradas o arroyos, si el terreno es plano, y de cincuenta metros horizontales, si el terreno es quebrado.
  • c)Una zona de cincuenta metros medida horizontalmente en las riberas de los lagos y embalses naturales y en los lagos o embalses artificiales construidos por el Estado y sus instituciones. Se exceptúan los lagos y embalses artificiales privados.
  • d)Las áreas de recarga y los acuíferos de los manantiales, cuyos límites serán determinados por los órganos competentes establecidos en el reglamento de esta ley." "Artículo 34.- Prohibición para talar en áreas protegidas Se prohíbe la corta o eliminación de árboles en las áreas de protección descritas en el artículo anterior, excepto en proyectos declarados por el Poder Ejecutivo como de conveniencia nacional.

Los alineamientos que deban tramitarse en relación con estas áreas, serán realizados por el Instituto Nacional de Vivienda y Urbanismo." Asimismo, los artículos 90 y 91 disponen:

"1- Del aprovechamiento en áreas sin bosque.

Artículo 90: Las personas que deseen realizar aprovechamiento forestal o tala de árboles en terrenos sin bosque y que por sus características no es un sistema agroforestal, podrán decidir si solicitan la autorización ante el Consejo Regional Ambiental o en la Municipalidad donde se encuentre el inmueble, siempre y cuando no superen un total de veinte árboles por año.

La solicitud deberá ser presentada por el propietario o propietaria o poseedor del inmueble según los requisitos que para cada caso establezcan tanto los Consejos Regionales como las respectivas Municipalidades.

En un plazo de 10 días los Consejos Regionales Ambientales deberán resolver y extender los permisos de corta y transporte. Los Consejos Regionales Ambientales y las municipalidades deberán remitir copia de la documentación a la A.F.E." "Artículo 91: Para aquellos casos donde el número de árboles a aprovechar sea superior a veinte árboles, en áreas arboladas excluidas de la definición de bosques, deberá ser tramitado en la Oficina Sub-Regional del A.C. correspondiente, debiendo adicionar a los requisitos generales establecidos en este reglamento un inventario que deberá contener, número de especies a cortar, número de individuos a cortar y volumen a extraer. Dicho inventario deberá ser elaborado y firmado por un profesional en ciencias forestales, además se debe elaborar un croquis de la finca indicando la ubicación aproximada de los árboles a cortar. La solicitud deberá contener una constancia del profesional en la cual establezca que el área no corresponde a un bosque o parte de un bosque según la definición de la Ley, y cumplir con los requisitos establecidos en el artículo 85 de este reglamento.

Recibida la solicitud por la Oficina Sub- Regional del A.C. correspondiente, esta verificará los requisitos y entregará el permiso correspondiente sin requerir de inspección previa." Nótese que en ambos artículos, la tala no es irrestricta, sino que está sujeta a las condiciones del terreno y a los permisos correspondientes. Actualmente nuestra regulación, prevé dos tipos de permisos, según la cantidad de árboles a cortar. De modo que, sólo podrán cortarse hasta un máximo de tres árboles por hectárea anualmente, después de obtener la autorización del Consejo Regional Ambiental y si la corta sobrepasare los diez árboles por inmueble, se requerirá la autorización de la Administración Forestal del Estado (A.F.E.); en ese orden y para los terrenos con estas características, los permisos que deben tramitarse son: Permisos menores a 20 árboles y los inventarios. El primer caso es el contemplado en los artículos 27 y 90 impugnados, cuyo permiso de aprobación requiere de todo un procedimiento, dispuesto en el reglamento, según el cual, una vez que el interesado presenta una solicitud, ésta es analizada por la autoridad competente, quien podrá solicitar el cumplimiento de los requisitos faltantes o la ampliación de alguno en especial, para lo cual otorgará un plazo de treinta días para su cumplimiento.

La autoridad competente, deberá resolver en forma definitiva en un plazo de 10 días, extendiendo así los permisos de corta y transporte. Las autoridades pertinentes deberán remitir copia de la documentación a la A.F.E. En caso de que exista incumplimiento, previa notificación al interesado de los requisitos faltantes, el expediente entra en un archivo temporal durante los seis meses siguientes al incumplimiento, sin necesidad de emitir acto alguno, pudiendo durante ese plazo reactivar el expediente. Vencido este último plazo, se podría decretar mediante resolución la caducidad del expediente y se archiva el mismo definitivamente. Cualquier gestión posterior sobre ese mismo asunto, debe ser tramitada como una nueva gestión. Contra los actos y resoluciones que emitan los Consejos Regionales, entre ellas la que rechace la solicitud del permiso de aprovechamiento en terrenos de uso agropecuario, cabrán recursos de revocatoria y apelación.

En el primer caso será conocida por la misma autoridad y resueltos en un plazo máximo de veinte días y las apelaciones, serán resueltas por el Ministerio del Ambiente y Energía. Por su parte, el inventario que requiere el artículo 91, es el tipo de permiso que deben pedir las personas, titulares o poseedores, de fincas, cuyos terrenos puedan ser definidos como agropecuarios sin bosque, donde pueden cortar más de 20 árboles por año, sin embargo debiendo utilizar el permiso de inventario forestal. Como requisito previo, debe tratarse de un área a aprovechar que no está contemplada en la definición de bosque contenida en la Ley. Sin embargo, y a pesar de la incipiente delimitación que hace el artículo 3 de dicha ley al definir el bosque, al menos en este supuesto, también se cuenta con la necesidad de solicitar un permiso previo, el cual debe seguir el siguiente procedimiento: El interesado en realizar un aprovechamiento forestal superior a los 20 árboles en terreno agropecuario sin bosque, debe presentar en la Oficina Sub-Regional del Area de.Conservación correspondiente, una solicitud con sus datos, la documentación requerida, así como una explicación clara de lo que solicita.

Es por lo anterior, que debe incluir un inventario que contenga: el número de especies a cortar, el número de ellos a cortar y el volumen a extraer. Dicho inventario debe ser elaborado y firmado por un profesional en ciencias forestales. Además, debe elaborar un croquis de la finca indicando la ubicación aproximada de los árboles a cortar. La solicitud debe contener también una constancia del profesional, en la cual se establezca que el área no corresponde a un bosque o sea parte de un bosque, según el concepto dado. La solicitud que presente el interesado, es analizada por la autoridad competente, quien puede solicitar el cumplimiento de los requisitos faltantes o la ampliación de alguno en especial, para lo cual, se otorga un plazo de treinta días para su cumplimiento. La Administración Forestal del Estado (A.F.E.), procede a su resolución definitiva en un período máximo de treinta días naturales.

En caso de que exista incumplimiento, previa notificación al interesado de los requisitos faltantes, el expediente entra en un archivo temporal durante los seis meses siguientes al incumplimiento, sin necesidad de emitir acto alguno, pudiendo durante ese plazo reactivar el expediente. Vencido este último plazo, se decreta mediante resolución la caducidad del expediente y se archiva definitivamente. Cualquier gestión posterior sobre ese mismo asunto, debe ser tramitado como una nueva gestión. Contra los actos y resoluciones de la AFE, entre ellas la que rechace la solicitud del permiso de inventario, también caben los recursos de revocatoria y apelación. Así las cosas y según ha quedado debidamente expuesto, la normativa señalada no presenta a criterio de este Tribunal, una lesión al artículo 50 de la Constitución Política, toda vez que, como ya se indicó, se trata de una tala regulada y que excluye los bosques de nuestro país. No obstante lo anterior, esta Sala lo que sigue evidenciando, es que efectivamente se presenta un problema con la definición de bosque contenida en el artículo 3 de la Ley Forestal.

-Por su parte, el artículo 28 impugnado, sí dispone una excepción al permiso de corta de árboles, señalando que en las plantaciones forestales, incluidos los sistemas agroforestales y los árboles plantados individualmente y sus productos, no requieren permiso, transporte, industrialización, ni exportación. Cuando la norma hace alusión a plantación forestal, se refiere a una o más hectáreas cultivadas de una o más especies forestales cuyo objetivo principal, pero no único, será la producción de madera. Las anteriores precisiones son importantes, porque resulta relevante a efectos de este estudio, diferenciar un bosque, de una plantación forestal y del sistema agroforestal, con el objeto de determinar el grado de tutela y protección que le otorga la Ley Forestal a las especies. Como ya se indicó, nuestra ley concibe el bosque como un ecosistema nativo o autóctono, regenerado por sucesión natural u otras técnicas forestales, que ocupa una superficie de dos o más hectáreas, caracterizada por la presencia de árboles maduros de diferentes edades, especies y porte variado, con uno o más doseles que cubran más del 70% de esa superficie y donde existan más de 60 árboles por hectárea de quince o más centímetros de diámetro a la altura del pecho (DAP).

Por su parte, la plantación forestal, es aquel terreno de una o más hectáreas cultivadas de una o más especies forestales, cuyo objetivo principal, pero no único, es la producción de madera. El sistema agroforestal por otro lado, es la forma de usar la tierra que implica la combinación de especies forestales en tiempo y espacio con especies agronómicas, en procura de la sostenibilidad del sistema. Lo anterior es de relevancia, a efecto de clarificar que la diferencia sustancial entre ellas, es que la existencia de plantaciones forestales y árboles plantados individualmente obedecen a una decisión productiva y económica de sus propietarios, por lo que razonablemente se requiere de la facilidad para su corta, transporte, industrialización y exportación. Este es el supuesto contemplado en el artículo 28 impugnado. Una plantación forestal es un sistema artificial, a diferencia del bosque que es un ecosistema en estado natural.

Además, las plantaciones forestales, también generan servicios ambientales, dentro los cuales podemos citar: mitigación de emisiones de gases de efecto invernadero (fijación, reducción, secuestro, almacenamiento y absorción), protección del uso urbano, rural o hidroeléctrico, protección de la biodiversidad para conservarla y uso sostenible, científico y farmacéutico, investigación y mejoramiento genético, protección de ecosistemas, formas de vida, etc. Otro beneficio, es la generación de empleo que promueve la reforestación por el aprovechamiento de la madera, lo cual es de suma relevancia también para nuestro mercado nacional, pues dependiendo de la cantidad de madera extraída, así será la importación por el faltante que se requiere. Los estudios del MINAE, FONAFIFO y SINAC revelan que en el país, se han disminuido sustancialmente las hectáreas plantadas, lo que está ocasionando un desabastecimiento de la madera.

Esto trae consigo otra serie de problemas, no sólo laborales, sino económicos para el país y para la misma naturaleza, porque lo ideal, es ciertamente fomentar la reforestación y así, no reducir el pago por servicios ambientales, que es un fondo destinado a su promoción. Este es el motivo principal por el cual la Ley Forestal, contempla el otorgamiento de diferentes incentivos, con el fin de hacer más atractivos los proyectos de reforestación y uno de ellos es precisamente, la excepción del permiso de corta dispuesto en el artículo 28 impugnado. Para establecer un proyecto de reforestación, se evalúan los aspectos técnicos, sociales, ambientales y financieros, además del cumplimiento de otros lineamientos legales. Uno de los incentivos señalados, es que los inversionistas en esta materia, analizan la rentabilidad del proyecto de reforestación, así como la proyección del volumen requerido por la industria y el mercado en general, generando un flujo de materia prima e ingresos previamente programados.

Claro está, no se trata de incentivar la tala de árboles en forma irrestricta, con el único fin de favorecer la inversión en detrimento del ambiente, sino de buscar un equilibrio que contribuya a un desarrollo sostenible, bajo el marco de los principios de razonabilidad y proporcionalidad. La Sala ha indicado, que la calidad ambiental es un parámetro fundamental de la calidad de vida; sin embargo, hay otros parámetros no menos importantes que son salud, alimentación, trabajo, vivienda, educación, etc. Se ha enfatizado que lo más importante es entender, que si bien el hombre tiene el derecho de hacer uso del ambiente para su propio desarrollo, también tiene el deber de protegerlo y preservarlo para el uso de las generaciones presentes y futuras. Nuestro país ha dependido y seguirá dependiendo, al igual que cualquier otra nación, de sus recursos naturales y su medio para llenar las necesidades básicas de sus habitantes y mantener operando el aparato productivo que sustenta la economía nacional.

El suelo, el agua, el aire, los recursos marinos y costeros, los bosques, la diversidad biológica, los recursos minerales y el paisaje conforman el marco ambiental sin el cual las demandas básicas -como espacio vital, alimentación, energía, vivienda, sanidad y recreación- serían imposibles. De igual modo, nuestra economía también está íntimamente ligada al estado del ambiente y de los recursos naturales. Por otro lado, las metas del desarrollo sostenible, tienen que ver con la supervivencia y el bienestar del ser humano y con el mantenimiento de los procesos ecológicos esenciales, es decir, de la calidad ambiental y de la sobrevivencia de las otras especies. Hablar de desarrollo sostenible en términos de satisfacción de las necesidades humanas presentes y futuras y del mejoramiento de la calidad de vida, es hablar de la demanda de los recursos naturales a nivel individual y de los medios directos o de apoyo necesarios, para que la economía funcione generando empleo y creando los bienes de capital, que a su vez, hagan posible la transformación de los recursos, en productos de consumo, de producción y de exportación.

Bajo estos lineamientos, no resulta inconstitucional establecer un incentivo a la plantación forestal, como lo es la autorización de talar unas especies determinadas de árboles. Nótese que el fin mismo de la plantación forestal, es sembrar para luego cosechar, en este caso, el producto es la madera como materia prima. Además, esta explotación va acompañada de un límite de árboles y con la obligación de reforestar nuevamente. Reforestación, que a contrario sensu de lo indicado por el accionante, contribuye a la conservación de los suelos y favorece el establecimiento de la cobertura vegetal. Ahora bien, también está el otro caso en el que los propietarios por decisión propia, sembraron una pequeña cantidad de árboles con el fin de embellecer su terreno. Dependiendo de la cantidad de éstos, no resultaría razonable tampoco, que posteriormente requiera de un permiso para talar cada uno de éstos, como mera imposición al ejercicio de su derecho de propiedad.

La solución pretendida por el accionante, en el sentido de impedir cualquier tala, es inaceptable en criterio de este Tribunal, tomando en consideración, que algunos árboles son plantados precisamente para ser aprovechados, por lo que el artículo 28 per se no resulta inconstitucional. Ahora bien, la Sala no duda que un buen Plan de Reforestación, garantiza una explotación razonable y proporcional de las plantaciones forestales, es decir, asegura el desarrollo sostenible de los recursos forestales e hídricos; y que además es importante liberar de trabas administrativas, lo relacionado con los terrenos de uso agroforestal, donde como ya se indicó, se combinan las especies agronómicas con las forestales. Sin embargo, la Sala sí evidencia, que la ley no determina medidas precautorias que aseguren la correcta aplicación, de lo dispuesto en el artículo 28 impugnado, toda vez que, no toda plantación requiere de un plan de manejo y lo único requerido es el certificado de origen, pero para sacar la madera y transportarla.

Con ese certificado, se debe acreditar la existencia de una plantación forestal o un sistema agroforestal en determinada finca, indicar el área plantada, el número de árboles, las especies, la ubicación, el nombre del propietario o propietaria. No obstante, como ya se indicó, dicho certificado se emite previamente, pero a la movilización de la madera, o sea una vez talada. Lo anterior, aunado al concepto tan restringido de bosque que vino a reformar la Ley Forestal, considera esta Sala, configura una omisión que viola el principio precautorio que debe resguardar el derecho a un ambiente sano y ecológicamente equilibrado. Con el desarrollo anterior, quedó debidamente expuesto que el concepto de bosque, dispuesto en el artículo 3 de la Ley Forestal, es a partir del cual, se deriva la aplicación y delimitación de todos los demás permisos y restricciones establecidas en esta materia. Es por ello, que este Tribunal al pronunciarse respecto a los artículos 27, 28 de la ley y 90 y 91 del reglamento impugnados, debe hacer alusión por conexidad ineludible al artículo 3.

Uno de los argumentos del accionante, es que el ciprés es una especie no autóctona y por ende, no es protegida su tala bajo ningún concepto, pues quedó excluida del concepto de bosque. Ciertamente los artículos 33 y 34 de la Ley Forestal, protegen lo que se consideran áreas protegidas, por tratarse de zonas cercanas a recursos hídricos, independientemente de la naturaleza de la especie. Sin embargo, la Sala considera que ello es insuficiente, tomando en consideración que un bosque, en un concepto amplio, incluso concebido en la Ley Forestal previo a su reforma, puede estar conformado también por especies no autóctonas, de las cuales también se pueden obtener los mismos servicios ambientales que fueron anteriormente señalados. De igual modo, si la tutela fue respecto a la especie, el modo de producción o de regeneración de los árboles, tampoco considera la Sala razonable que se haya establecido que debía tratarse de una zona mayor a 2 hectáreas.

Lo expuesto deja en evidencia, una insuficiente tutela legislativa al respecto, que en lugar de asegurar la protección cuando se reformó la ley en los años 1995 y 1998, redujo el ámbito de protección, y por ende del derecho a un ambiente sano y ecológicamente equilibrado, sin tomar siquiera medidas preventivas al respecto, tratando incluso posteriormente el Poder Ejecutivo, mediante decreto, tratar de proteger las áreas menores a esas 2 hectáreas, con el agravante de que vía decreto, no puede ser impuesta una restricción que no fue dispuesta en la ley, quedando de este modo desprotegidos los bosques menores de dos hectáreas o conformados por especies no autóctonas independientemente de su área. Debe recordarse, que uno de los presupuestos de una plantación forestal o sistema agroforestal, es que lo plantado desde un inicio, lo sea con el único fin de ser aprovechado. Es bajo ese supuesto, que la ley intentó incentivar las mismas, eliminando ciertos trámites administrativos.

No obstante, debe garantizarse que ello es así, previo a la corta de los árboles, toda vez que podría estarse propiciando por la falta de control, que sean taladas áreas que en realidad no constituyen ni una plantación forestal, ni un sistema agroforestal. Además, existen terrenos que por la inercia de sus propietarios, han dejado proliferar un verdadero bosque en su propiedad y luego es talado sin regulación alguna, o árboles que aún cuando hayan sido plantados, sirven de rompevientos, por la cantidad, su ubicación y la función que han ejercido durante muchísimos años, lo que en protección de valores fundamentales, amerita la conservación y regulación de su tala, independientemente de la naturaleza de su especie. Hay zonas donde incluso se han realizado plantaciones como las realizadas por el ICE, con el fin de proteger zonas de protección aledañas o de recarga de los acuíferos. Muestra de la importancia de esta tutela, incluso por la zona, es lo dispuesto en el Decreto Ley No. LXV de 30 de julio de 1888:

"Siendo de utilidad pública la conservación de las montañas en que tienen origen los arroyos y manantiales que abastecen que abastecen de agua a la provincia de Heredia y a una parte de la de Alajuela, Art. 1- Se declara inalienable una zona de terreno de dos kilómetros de ancho, a uno y otro lado de la cima de la montaña conocida con el nombre de Montaña del Volcán de Barba (sic), desde el cerro llamado el Zurquí hasta el que se conoce con el nombre de Concordia, ya sea dicha zona de propiedad nacional o municipal.

Art.2- Se autoriza al Poder Ejecutivo para aumentar o disminuir la extensión de la zona a que se refiere el artículo anterior si después de practicado el reconocimiento respectivo por medio de una comisión científica, juzga conveniente modificarla en el sentido que dicha comisión indique." Según opinión jurídica de la Procuraduría No. OJ-118-2004 del 27 de setiembre del 2004, la zona objeto de esta acción está actualmente aproximadamente comprendiendo, un 82% dentro de las áreas cubiertas por la Reserva Forestal Cordillera Volcánica Central y el Parque Nacional Braulio Carrillo, y abarca aproximadamente 40 nacientes que describe la cartografía oficial. Lo anterior, nos ilustra la relevancia de este sector como recurso hídrico, lo cual amerita medidas de prevención y protección que garanticen su conservación. Es por lo anterior que este Tribunal considera, que el artículo 28 impugnado resulta inconstitucional, pero no por su contenido, sino por omisión legislativa, al no contemplar la Ley Forestal medidas previas, a la corta de los árboles, independientemente de su naturaleza y área.

Ello, con el fin de dar seguridad jurídica a los administrados de que su actuación se ajusta a derecho y se asegura la protección al ambiente, al evitar la corta en áreas, que de acuerdo al criterio de expertos en la materia, no es recomendable, por las consecuencias ambientales gravosas que se puedan llegar a producir. La prevención pretende anticiparse a los efectos negativos, y asegurar la protección, conservación y adecuada gestión de los recursos. Consecuentemente, el principio rector de prevención, se fundamenta en la necesidad de tomar y asumir todas las medidas precautorias, para evitar o contener, la posible afectación del ambiente o la salud de las personas. De esta forma, ante la existencia de un riesgo de daño grave o irreversible -o una duda al respecto-, se debe adoptar una medida de precaución e inclusive posponer la actividad de que se trate. Lo anterior, debido a que en materia ambiental, la acción a posteriori resulta ineficaz, por cuanto de haberse producido el daño, las consecuencias ecológicas y socialmente nocivas pueden ser irreparables.

Una vez determinado que la norma en cuestión, es inconstitucional por ser omisa en la protección del derecho a un ambiente sano, en el que debe prevalecer el principio precautorio, se debe hacer alusión ineludible a los efectos de una declaratoria en este sentido. Como ya fue expuesto, la norma resulta omisa al no contemplar la Ley Forestal medidas previas, que pueden ir desde la autorización, hasta la inspección previa a la corta de los árboles, independientemente de su naturaleza y área. El no haber contemplado el legislador medidas preventivas al respecto, se constituye lo denominado inconstitucionalidad por omisión relativa. Esta omisión consiste en aquellos casos en que un enunciado legal, regula una determinada situación jurídica, pero lo hace defectuosamente, omitiendo en su regulación alguna de sus dimensiones. En este tipo de silencio, lo que es objeto de control es la norma legal explícita, aunque el motivo de su impugnación no sea su texto, sino lo que justamente, no dice el texto, y esa omisión crea una situación contraria a la Constitución.

Ejemplo típico de la inconstitucionalidad por omisión, lo es el de los enunciados de una ley que vulnera el principio de igualdad, bien porque excluye expresamente a un grupo determinado de individuos sin razón aparente, de un beneficio al que tendrían derecho o una expectativa fundada; o bien, porque el enunciado al regular ese beneficio, lo hace a favor de un grupo determinado y guarda silencio sobre el resto (como el caso que nos ocupa). Según la doctrina, puede suceder que la disposición, guarde silencio sobre una situación jurídica que amerita ser tutelada, porque así lo ordena la Constitución. Del enunciado cabe derivar entonces una norma implícita, que regula de modo distinto en la norma explícita, la situación jurídica objeto de protección constitucional, como en este caso, el derecho a un ambiente sano y ecológicamente equilibrado, que lleva implícito el principio de precaución.

Según el análisis practicado al artículo impugnado, el legislador modificó el concepto de bosque a partir del cual se desarrolla la protección, restricciones y permisos otorgados en la Ley Forestal -como es el caso del artículo 28 en cuestión "Excepción de permiso de corta"-, de tal manera que, restringió sin fundamento técnico, el concepto anterior de bosque existente en la ley previo a su reforma. De modo que fueron dejadas sin protección vía ley, las especies no autóctonas y las áreas inferiores a dos hectáreas que constituyeran bosque, trayendo como consecuencia, que a través del artículo 28 impugnado, no se requiera de permiso para talar, ni siquiera de inspección previa, que permita asegurar que se trata del supuesto que la norma quiso incentivar, toda plantación forestal, sistema agroforestal o cualquier árbol plantado, quedando expuestas áreas que por su ubicación, cantidad y la función que han ejercido durante muchísimos años, amerita la conservación y regulación de su tala, independientemente de la naturaleza de su especie y de la naturaleza del terreno donde se ubique.

Así las cosas, esta Sala considera de conformidad con lo expuesto, que en este caso, se produce una inconstitucionalidad por omisión relativa. No obstante, si bien la Sala Constitucional es la competente para declarar la inconstitucionalidad de una norma, una violación de esta naturaleza debe ser subsanada por la Asamblea Legislativa, extendiendo la aplicación de la ley a los casos no contemplados expresamente por ella, como en este caso, a las especies y áreas que quedaron desprotegidas en el concepto de bosque actual, así como tomar medidas de prevención y control sobre las áreas en las que son permitidas la tala. Por todo lo expuesto, estimamos que el artículo 28 cuestionado lesiona el artículo 50 de la Constitución Política. Sin embargo, con el fin de no violentar el principio de separación de poderes, resulta procedente a nuestro criterio, otorgar un plazo prudencial a la Asamblea Legislativa para que subsane la violación indicada.

VI.Conclusión. Por todo lo expuesto, la acción se declara con lugar únicamente por la omisión relativa del artículo 28 de la Ley Forestal de establecer medidas precautorias que aseguren la protección del ambiente respecto. En lo demás, se declara sin lugar la acción. El Magistrado Jinesta salva el voto y declara sin lugar la acción.

Por tanto:

Se declara con lugar la acción únicamente, por la omisión del artículo 28 de la Ley Forestal de establecer medidas precautorias que aseguren la protección del ambiente. Corresponde a la Asamblea Legislativa subsanar la ausencia de medidas precautorias, que aseguren de previo, la correcta aplicación de lo dispuesto en el artículo 28 en tutela del ambiente, según lo señalado en la parte considerativa de esta sentencia.Comuníquese esta sentencia a los Poderes Legislativo y Ejecutivo.Reséñese este pronunciamiento en el Diario Oficial "La Gaceta" y publíquese íntegramente en el Boletín Judicial. En lo demás, se declara sin lugar la acción. El Magistrado Jinesta salva el voto y declara sin lugar la acción.

VOTO SALVADO DEL MAGISTRADO JINESTA LOBO El suscrito Magistrado salva el voto y declara sin lugar la acción por las siguientes razones: Comparto el análisis del voto de mayoría sobre el Derecho Fundamental a un ambiente sano y ecológicamente equilibrado, así como sobre el deber del Estado en protegerlo. Por el contrario, difiero en cuanto se refiere al numeral 28 de la Ley Forestal. Según dicha norma, no requieren permiso de corta «Las plantaciones forestales, incluidos los sistemas agroforestales y los árboles plantados individualmente». De conformidad con el voto de mayoría, es necesario añadir al artículo 28 medidas precautorias para asegurar la protección del ambiente y, en consecuencia, ordena a la Asamblea Legislativa hacerlo. Considero que la modificación de la norma en el sentido apuntado es innecesaria y podría ser más bien perjudicial para la protección del ambiente. Debe tenerse presente, por un lado, que es de interés público detener la explotación del bosque.

Por otra parte, el fomento de las plantaciones forestales es una de las políticas adoptadas por el Estado para alcanzar ese objetivo. Gracias a estas plantaciones, se satisfacen las necesidades sociales de madera y productos derivados sin dañar el bosque. Se promueve así un modelo de desarrollo sostenible, que armoniza las necesidades humanas con la protección del bosque. No puede perderse de vista, en consecuencia, que la norma en cuestión es el primer artículo del capítulo III (Fomento de las plantaciones forestales), Título II (Propiedad forestal privada), de la Ley No. 7575 (Ley Forestal). Precisamente concede al propietario de un terreno permiso para talar los árboles que siembre con fines comerciales para que, con confianza, se decida a hacerlo. Es una medida para incentivar las plantaciones forestales y desincentivar así la explotación del bosque; su fin último es la protección del ambiente y no su destrucción.

Es aceptable conceder el permiso anticipadamente, porque es claro que para dedicarse a tal actividad —así como a cualquier otra—, el interesado debe ajustarse a las limitaciones de uso de suelo. Por consiguiente, carece de interés, que el MINAE extienda un permiso de corta de árboles de una plantación forestal, cuando ya la ley lo hizo. Supeditar el aprovechamiento de esos árboles a una decisión administrativa anula el incentivo. Ahora bien la Administración no solo tiene la potestad, sino que está obligada a comprobar que la madera que se produce en el país provenga de una plantación forestal y no de una corta ilegal, sin que sea necesario que cada uno de los artículos de la Ley Forestal —entre ellos el 28— así lo disponga. Por el contrario, exigir permiso de corta o, incluso, otra medida menos gravosa, solo podría traer como consecuencia desincentivar la inversión en plantaciones forestales, encarecer la madera y, en consecuencia, hacer más lucrativa la explotación irracional, incluso al margen del ordenamiento jurídico, del bosque.

Entiendo la preocupación externada en el voto de mayoría (considerando V) sobre el posible abuso en la aplicación del artículo 28 a áreas que no son ni plantaciones ni sistemas agroforestales. Sin embargo, tal exceso no se deriva de la norma ni se evitaría reiterando que sólo se aplica a cierto tipo de plantaciones —ya eso es sabido—; es un problema de falta de fiscalización. Los poderes del MINAE para fiscalizar no se ven reducidos por el texto de la norma ni aumentarían porque ésta se los repita. En suma, aunque bien intencionada, considero que una modificación legislativa del artículo impugnado traería más desventajas que beneficios para la protección del ambiente, por lo que considero que la acción interpuesta debe declararse sin lugar.
