Sole.- In the matter under review, the petitioner alleges that the Instituto Nacional de Vivienda y Urbanismo offered for sale several parcels of land forming part of environmental reserves, without legal authorization to do so. The documents contained in the case file and the reports submitted under oath by the respondent authorities establish that the properties offered for sale by the respondent entity through Policitación Notice No. 75-04 do not form part of the State Natural Heritage (Patrimonio Natural del Estado). Indeed, the term “reserve” used in the notice refers to the concept of a reserved remainder, that is, those portions of land that, after a housing project has begun, have not been developed for such purposes and remain reserved in favor of the Instituto Nacional de Vivienda for subsequent use or conveyance. Accordingly, those properties do not constitute protected wilderness areas (áreas silvestres protegidas) and therefore are not allocated to the public domain. On the contrary, those properties are proprietary assets (bienes patrimoniales) of the Administration that may be conveyed in accordance with the procedures established by the legal system currently in force. Consequently, the proper disposition is to deny the proceeding, as is hereby done.

En efecto, el término “reserva” que emplea el cartel hace referencia al concepto de resto reservado, esto es, aquellas porciones de terreno que, iniciado un proyecto habitacional, no han sido desarrolladas para tales fines y que quedan reservadas a favor del Instituto Nacional de Vivienda para su posterior uso o enajenación.
