Res: 2005-00834 CONSTITUTIONAL CHAMBER OF THE SUPREME COURT OF JUSTICE. San José, at eleven hours and sixteen minutes on veintiocho de enero del dos mil cinco.- Amparo proceeding filed by IBÁ SUAREZ, of legal age, married, businessman, residence identification card number 418-544014-85, resident of Punta Uva, Talamanca, Limón, on behalf of COMPLEJO TURÍSTICO PUNTA UVA, SOCIEDAD ANÓNIMA, corporate identification number 3-758-58410, against the MINISTER OF THE ENVIRONMENT AND ENERGY.
Background:
Justice Solano Carrera drafts the opinion; and,
Considering:
I.It is not for this Chamber, but rather for the ordinary legality jurisdiction, to determine the scope and content of decision number R-089-93-DGVS of eight hours and fifteen minutes on cinco de marzo de mil novecientos noventa y tres (pages 16, 17 and 18), issued by the then Ministry of Natural Resources, Energy and Mines (MIRENEM)—now the Ministry of the Environment and Energy (MINAE)—which, based on the authority conferred by the Second Clause of Use Permit N° 351-90 of diecisiete de junio de mil novecientos noventa, granted to the protected company, ordered the revocation of that permit and directed Ibá Suarez, in his capacity as representative of Complejo Turístico Punta Uva S. A., to restore matters to the condition in which they were before that permit was granted. Thus, determining whether or not such restoration entails the eviction and demolition of the existing structures—as understood by the Administration, according to official letter DM-1409-04 of treinta de julo del dos mil cuatro (pages 19 and 20)—or does not, as the petitioner alleges, is merely a question of legality outside the jurisdiction of this Court, since it does not involve, at least directly, any fundamental right.
Contrary to the petitioner’s allegation, this is not a violation of the right of defense, due process, the principle of legality, or any other fundamental right, because it concerns the enforcement of an administrative act that was already litigated, including through judicial proceedings, and is final. Accordingly, no hearing or other form of due process was required prior to its enforcement; notice of the demand for compliance to the interested party was sufficient, as was in fact done. Now then, determining whether the order entails the eviction and demolition of the structures is not within the jurisdiction of this Court, which reviews constitutionality, not legality.
II.In any event, this Chamber has already ruled on other occasions regarding the facts underlying this proceeding. Thus, an amparo proceeding filed on behalf of the company protected herein against the then Minister of Natural Resources, Energy and Mines was processed before it under expediente number 93-003261-0007-CO. In deciding that proceeding, by judgment N° 0914-96 at fifteen hours on veintiuno de febrero de mil novecientos noventa y seis, this Court held:
“II. It is necessary to note, as a frame of reference, that the Ministry of Natural Resources, Energy and Mines, by decision No.351-90 at 9:13 hours on 17 de junio de 1990, granted Mr. Ibá Suarez, in his capacity as President with the powers of a General Attorney-in-Fact without Limitation of Amount of Complejo Turístico Punta Uva S.A., a use permit to utilize for tourism purposes a parcel of land located within the 150 meters of the Maritime-Terrestrial Zone in the area declared the Gandoca-Manzanillo National Wildlife Refuge, a refuge created by Decreto Ejecutivo No.16614-MAG of 1 de julio de 1985. That use permit was granted pursuant to the powers conferred by the Ley Forestal, the Wildlife Conservation Act, and its Regulations, provisions authorizing the Ministry of Natural Resources, Energy and Mines to grant use permits within areas belonging to the State Forest Heritage. When that permit was granted, it was expressly stipulated that the permit holder could neither encumber nor sell that authorization and could transfer it only with the approval of the Wildlife Directorate of the Ministry of Natural Resources, Energy and Mines, following completion of the corresponding procedure.
It was likewise established that the permit holder was required to deposit a certain amount of money as security against any possible breach of the obligations arising from that permit and that work in the area was to be performed within the framework of the Ley Forestal and the Wildlife Conservation Act, so as not to harm natural resources. He was permitted to build (sic) up to 84 cabins to serve tourists, two swimming pools, a reception building, kitchen facilities, a bar pavilion, a parking area, a cafeteria, a restaurant, a machinery building, two tennis courts, an access road, employee dormitories, and general services facilities, all in accordance with the submitted plan and building permits from the Municipality of Talamanca, the College of Engineers and Architects, the National Institute of Housing and Urban Development, the Ministry of Health, and the Costa Rican Tourism Institute.
It was stated that any violation of the legislation in force or of the conditions established therein would result in cancellation of the permit without any right of claim by the permit holder, and that the permit was valid for 10 years and would be deemed automatically renewed for equal and consecutive periods (page 102). In view of the failure to comply with the conditions under which the permit was granted, including the construction of structures without permits from INVU, the Ministry of Health, the Federated College of Engineers and Architects, and the Municipality of Talamanca; construction outside the area covered by the use permit; obstruction of access by officials of the General Wildlife Directorate; construction of an artificial lagoon outside the authorized area; construction and expansion of drainage systems within and outside the authorized area; obstruction of streams and diversion of natural watercourses; widening and deepening of the channel between the sea and the swamp; use of coral material to fill the interior of the swamp; among others; as well as due to the damage caused to the environment, such as changes in beach morphology, changes in sediment circulation, soil salinization, loss of habitat for certain species, flood risks due to interruption of natural drainage, reduction and obstruction of the public-zone area, significant damage to coral reefs, among others, by decision No. R-089-93 at 8:15 hours on 5 de marzo de 1993, signed by the Minister of Natural Resources, Energy and Mines and the President of the Republic, Use Permit No.351-90 was revoked, and the general attorney-in-fact without limitation of amount of Complejo Turístico Punta Uva S.A. was ordered to restore (sic) matters to the condition in which they were before the aforementioned Use Permit was granted, with a period of 6 months to comply with the provisions of that decision.
The representative of that company timely and properly filed the corresponding motion for reconsideration against that decision; however, by ruling at 8:15 hours on 28 de julio de 1993, also signed by the Minister of Natural Resources, Energy and Mines and the President of the Republic, it was held that there were no grounds to reconsider the decision revoking the use permit granted by decision No.351-90-MIRENEM, because the alleged facts had not been refuted; rather, the applicant admitted them to be true and even offered to adopt whatever corrective measures might be necessary to repair any damage caused. Consequently, that motion for reconsideration was denied, and decision No.089-93-DGVS therefore remained in effect.
III.In addressing the merits of the claims raised in this amparo proceeding (recurso de amparo), it must first be noted that the petitioner alleges that the incorporation of the property owned by Complejo Turístico Gandoca Manzanillo S.A., which he considers to be privately owned, into the Refugio Nacional de Protección Silvestre Gandoca Manzanillo occurred in absolute violation of the clear directives contained in the Ley Forestal, as well as in contravention of the constitutional guarantee contained in Article 45 of the Constitución Política, because at no time was any payment made through purchase or expropriation, which ultimately means that the Decreto Ejecutivo by which that National Refuge was created is unconstitutional. In this regard, it must be stated that, prior to filing this amparo proceeding, one of the petitioners herein filed constitutional challenge No. 0328-M-93 (acción de inconstitucionalidad), specifically against Decretos Ejecutivos No.16614-MAG and No.16631-MAG, which created and regulated the Refugio Nacional de Vida Silvestre Gandoca Manzanillo.
That Action raised exactly the same issue challenged here, since, in the petitioner’s view, those decrees imposed restrictions on private property without a basis in law, thereby violating Article 45 of the Constitution. That Action was summarily dismissed by Voto No.1063-95 at 15:00 hours on 23 de febrero de 1995, which expressly ruled that:
“...the claimant likewise lacks standing to allege a violation of Article 45 of the Constitución Política—the right to property—because, as is evident from his own statements and the other documentation contained in the case file (expediente), what he was granted was a ‘use permit’ (permiso de uso) to use land located within the maritime-terrestrial zone (zona marítimo terrestre), which is public-domain property (bien demanial) in respect of which no private individual could validly claim any property right in his favor; therefore, the arguments on the merits raised in the action are wholly inadmissible, and it must be so declared...” (judgment No.1063-95 at 15:00 hours on 23 de febrero de 1995).
That judgment further held that the inadmissibility of those arguments was also based on the criteria expressed by the Chamber on previous occasions, including judgment No.0407-91 at 15:30 hours on 21 de febrero de 1991, which, insofar as relevant, ruled:
that the State has had to enact legislation “...that exempts certain zones or parts of the coastline from the public domain so that the general legislation governing them does not apply. The premise on which the claimant relies is therefore untenable, because restrictions are not being imposed on private property; rather, by regulating the public domain, the law establishes the conditions under which private individuals may use and enjoy the maritime-terrestrial zone. Thus, anyone who seeks by unauthorized means to exercise exclusive use of that zone will be barred from accomplishing it, since it has also been accepted from time immemorial that such property cannot be acquired by private individuals through prescription and is outside the stream of commerce...” (judgment No.407-91 at 15:30 hours on 21 de febrero de 1991).
It is important to recall that this argument has been presented before this jurisdiction not only in the aforementioned Constitutional Challenge or in the present amparo proceeding, but also on many other occasions when Complejo Turístico Punta Uva S.A. has appeared before this Jurisdiction, and the Chamber has rejected it on every such occasion. For that reason, and given that the existing circumstances have not changed, the same position previously expressed is maintained at this time; accordingly, the Chamber finds that:
“...Article 45 of the Constitución Política has not been violated, because Complejo Turístico Punta Uva S.A. does not hold a property right but rather a ‘use permit’ to use for ten years land located ‘within the one hundred and fifty meters of the Zona Marítimo Terrestre in the area declared Refugio Nacional de Fauna Silvestre Gandoca Manzanillo’” (see judgment No.0480-93 at 9:09 hours on 29 de enero de 1993 and judgment No.1980-93 at 15:39 hours on 11 de mayo de 1993).
The petitioner’s argument that Article 45 of the Constitution has been violated is therefore refuted, and the proceeding is inadmissible as to this issue and must be so declared.
IV.From the analysis conducted in the preceding recital (considerando), it follows that Complejo Turístico Punta Uva S.A. does not hold a property right over the real property located within the Refugio Nacional de Vida Silvestre Gandoca Manzanillo, but merely a permit to use that property for a term of 10 years, subject to the legislation governing it. Nevertheless, in these proceedings the petitioner challenges the propriety and validity of resolutions No.089-93-DGVS at 8:15 hours on 5 de marzo de 1993 and No. R216-93-MIRENEM at 8:15 hours on 28 de julio de 1993, under which, as indicated above, the use permit for the property in question granted to Complejo Turístico Punta Uva S.A. was revoked, and the petitioner thereby seeks to have this Chamber assess the merits of those resolutions. In this regard, the applicants overlook the fact that this Chamber reviews constitutionality, not mere legality.
Thus, if the permit itself provided that failure to comply with the terms under which it was granted could result in its revocation without any right of recourse by the permit holder (permisionario), and if, in this particular case, the evidence in the record supported a finding of such noncompliance by the petitioner, the fact that the permit was revoked through administrative proceedings because the applicable conditions for doing so apparently existed cannot be assessed by this constitutional jurisdiction, which lacks authority to do so. The underlying issue must be litigated—and in fact is already being litigated—in the contentious-administrative jurisdiction (vía contencioso-administrativa); this Chamber may, however, examine compliance with due process (debido proceso) and protection of the right of defense (derecho de defensa). Accordingly, and specifically with respect to Complejo Turístico Gandoca Manzanillo S.A., the Chamber finds that, before the challenged resolutions were issued, due process was observed and the exercise of the right of defense was guaranteed. This matter was also analyzed by this Chamber in amparo proceeding No.0107-C-93, in which judgment No.0480-93 at 9:09 hours on 29 de enero de 1993 stated:
“Pursuant to Article 9 of the Ley de la Jurisdicción Constituiocnal (sic), this proceeding must be summarily dismissed because it is manifestly inadmissible and unsupported, given that the resolution challenged herein, rather than violating due process, guarantees it. Indeed, it gives Complejo Turístico Punta Uva S.A. notice of the alleged nine irregularities attributed to it by the Administration...; it provides for a hearing and the opportunity for the aforementioned Complejo Turístico to submit rebuttal evidence; it makes the administrative case file available to it... and assigns the Director General de Vida Silvestre responsibility for conducting and deciding the proceeding. The use permit granted to the petitioner is expressly conditioned on the permit holder performing ‘work in the area within the framework of the Ley Forestal and the Ley de Conservación de Fauna Silvestre, in such a manner as not to harm natural resources’..., and ‘any violation of the legislation in force or of the provisions established herein shall result in revocation of the permit without any right of recourse by the permit holder’....
The proceeding challenged herein is intended precisely to determine whether the specified irregularities warrant its revocation.” It must further be stated that, in judgment No.1980-93 at 15:39 hours on 11 de mayo de 1993, this Constitutional Chamber granted amparo proceeding No.0792-C-93 because the officer directing the proceeding had also served as an expert witness in the proceeding against Complejo Turístico. The Chamber therefore found that, in that respect, due process had been violated and that the interim measure (medida cautelar) ordered by that official had to be annulled because he was disqualified from acting. At the same time, however, that ruling preserved all other acts in the proceeding, demonstrating that due process and the right of defense had in fact been observed up to that point, except with respect to that determination. Following that proceeding, the resolutions challenged herein were issued, and, based on its analysis of the evidence submitted to the case file, the Chamber does not find that any further violation of due process or the right of defense occurred.
As can be seen, the petitioner had an opportunity to obtain full knowledge of the irregularities attributed to it, rather than only some of them as it alleges; it also had access to the case file and could have appeared at the hearing scheduled for 15 de enero de 1993, but did not do so. It exercised its right to file all interlocutory motions (incidentes) it deemed appropriate, as well as the relevant appeals, such as the appeal filed against resolution No.089-93-DGVS, the disposition of which resulted in ruling No.216-93-MIRENEM (both challenged in this proceeding). Ultimately, it participated extensively in that administrative proceeding. The Chamber therefore finds that the alleged violation of the constitutional rights to due process and a defense did not occur, because Complejo Turístico Punta Uva S.A. was at all times aware of all the acts attributed to it and had the opportunity to exercise its right of defense; accordingly, its argument that the final resolutions contain new elements cannot be accepted.
The petitioner further alleges that the order to demolish the structures as a consequence of revoking the use permit for the real property is improper. It must be reiterated, however, that the Chamber lacks authority to determine whether that demolition order is proper, and given that the terms under which the permit was granted provided that any noncompliance by the permit holder would result in revocation of that authorization, it is the Administration that, after assessing the noncompliance and the damage caused, must determine the consequences of such revocation.
V.The appellant also challenges the authority of the Ministerio de Recursos Naturales, Energía y Minas to grant and revoke the use permit (permiso de uso) for the property located within the Refugio Nacional de Vida Silvestre Gandoca Manzanillo. In this regard, Article 82 of the Ley de Conservación de la Vida Silvestre establishes that the natural resources located within national wildlife refuges fall under the exclusive jurisdiction and management of the Dirección General de Vida Silvestre of the Ministerio de Recursos Naturales, Energía y Minas; consequently, the Ley de la Zona Marítimo Terrestre does not apply within national parks or equivalent reserve areas. The Procuraduría General de la República has ruled to this effect, stating that the administration of Wildlife Refuge areas included within the maritime-terrestrial zone (zona marítimo terrestre) falls exclusively to that Service and not to the Municipalities, naturally within the boundaries of such refuges, because adjacent areas forming part of the maritime-terrestrial zone remain under municipal jurisdiction (see opinion [dictámen (sic)] No. C-052-89 of March 7, 1989).
From this perspective, the appellant’s argument is without merit and, contrary to the petitioning party’s assertion, the Municipalidad de Talamanca would not be authorized to grant concessions (concesiones) and construction permits (permisos de construcción) in an area over which it has no jurisdiction. This is the case with the property for which Complejo Turístico Punta Uva S.A. was granted a use permit. Those jurisdictional issues are ultimately matters of ordinary legality and may be litigated before the appropriate ordinary court; therefore, the appeal must also be dismissed with respect to this claim.
VI.Accordingly, the Chamber does not find that, in the present matter, the Administration has committed any violation of constitutional provisions; and it is precisely because no violation of that nature exists that this amparo proceeding (recurso de amparo) must be dismissed, as is hereby ordered.”
III.The statements made in the judgment partially transcribed above are fully applicable to the case under consideration, and there are no grounds or reasons justifying a departure from the position expressed on that occasion. Consequently, the alleged violations of the fundamental rights of the appellant and the entity he represents have not occurred, and the appeal is therefore inadmissible with respect to those claims, as is hereby declared. Furthermore, as may be confirmed from judgment number 000285-F-04, issued at eleven thirty on April twenty-eight, two thousand four (a decision reviewed by this Chamber), the Sala Primera de la Corte Suprema de Justicia adjudicated the dispute concerning whether restoration to the condition in which matters stood when the permit at issue was granted entailed eviction (desalojo) and demolition (derribo) of the structures. In any event, those matters may not be reviewed in these proceedings.
Moreover, this Chamber could not review decision R-089-93-DGVS, issued at eight fifteen on March five, nineteen ninety-three, because it was already challenged and affirmed in the ordinary courts and was even addressed by the Sala Primera de la Corte Suprema de Justicia in the aforementioned judgment number 000285-F-04, issued at eleven thirty on April twenty-eight, two thousand four. Such review would necessarily entail this Chamber’s reconsideration of a ruling issued in that jurisdiction, which is inadmissible pursuant to Article 30(b) of the Ley de la Jurisdicción Constitucional.
IV.In light of the foregoing considerations, the alleged violations of the fundamental rights of the appellant and the person on whose behalf relief is sought have not occurred; therefore, the appeal is inadmissible with respect to the claims indicated.
V.Without prejudice to the foregoing, the amparo proceeding shall be admitted exclusively with respect to the possible violation of Articles 27 and 41 of the Constitución Política, because the appellant alleges that, on September first, two thousand four, the Special Attorney-in-Fact (Apoderado Especial) of Complejo Turístico Punta Uva S.A. requested that the Ministro del Ambiente y Energía provide him with the Record and Inventory of the items existing within the area that had been authorized before use permit number 351-90—which was subsequently revoked—was granted, and that he has not yet received any response to that request (folios 21 and 22).
Por tanto:
The amparo proceeding is hereby admitted exclusively with respect to the alleged violation of Articles 27 and 41 of the Constitución Política. In all other respects, the appeal is dismissed on the merits.

Res: 2005-00834 SALA CONSTITUCIONAL DE LA CORTE SUPREMA DE JUSTICIA. San José, a las once horas con dieciséis minutos del veintiocho de enero del dos mil cinco.- Recurso de amparo interpuesto por IBÁ SUAREZ, mayor, casado, empresario, cédula de residencia número 418-544014-85, vecino de Punta Uva, Talamanca, Limón, a favor de COMPLEJO TURÍSTICO PUNTA UVA, SOCIEDAD ANÓNIMA, cédula jurídica número 3-758-58410, contra el MINISTRO DEL AMBIENTE Y ENERGÍA.
Resultando:
Redacta el Magistrado Solano Carrera; y,
Considerando:
I.No corresponde a esta Sala, sino a la vía de legalidad ordinaria, determinar cuáles son los alcances y contenido de la resolución número R-089-93-DGVS de las ocho horas quince minutos del cinco de marzo de mil novecientos noventa y tres (folios 16, 17 y 18), dictada por el entonces Ministerio de Recursos Naturales, Energía y Minas (MIRENEM) –hoy Ministerio del Ambiente y Energía (MINAE)- en la que se dispuso, con fundamento en la facultad conferida en el Cláusula Segunda del Permiso de Uso N° 351-90 del diecisiete de junio de mil novecientos noventa, otorgado a la sociedad amparada, revocar dicho permiso y ordenar a Ibá Suarez, en su condición de representante de la sociedad Complejo Turístico Punta Uva S. A, restituir las cosas al estado en que se encontraban antes del otorgamiento de dicho permiso. De modo que, establecer si dicha restitución implica o no el desalojo y el derribo de las construcciones existentes –como lo entiende la Administración, según oficio DM-1409-04 del treinta de julo del dos mil cuatro (folios 19 y 20)- o no, según lo alega el recurrente, no es sino una discusión de mera legalidad ajena al ámbito de competencia de este Tribunal, pues en ello no está involucrado, al menos en forma directa, derecho fundamental alguno.
No se trata, como lo acusa el recurrente, de la violación al derecho de defensa, al debido proceso, al principio de legalidad o a cualquier otro derecho fundamental, ya que se trata de la ejecución de un acto administrativo que ya fue discutido incluso en la vía jurisdiccional y que se encuentra firme, de modo que no se debía cumplir con ninguna audiencia o, de alguna forma, cumplir con el debido proceso, de previo a su ejecución, basta con la comunicación de la prevención al interesado para que cumpla con lo dispuesto, como en efecto se hizo. Ahora bien, definir si lo acordado implica o no el desalojo y derribo de las construcciones, no es competencia de este Tribunal, que no es un contralor de legalidad, sino de constitucionalidad.
II.En todo caso, ya esta Sala, en otras ocasiones, se ha pronunciado en relación con los hechos que sirven de fundamento a este recurso. Así, ante ella se tramitó un recurso de amparo interpuesto a favor de la sociedad aquí amparada contra el entonces Ministro de Recursos Naturales, Energía y Minas, bajo el expediente número 93-003261-0007-CO. Al resolver dicho recurso, por sentencia N° 0914-96 de las quince horas del veintiuno de febrero de mil novecientos noventa y seis, este Tribunal consideró:
“II. Resulta necesario indicar, a modo de marco de referencia, que el Ministerio de Recursos Naturales, Energía y Minas, mediante resolución No.351-90 de las 9:13 horas del 17 de junio de 1990, concedió permiso de uso al señor Ibá Suarez en su condición de Presidente con facultades de Apoderado Generalísimo de la Compañía Complejo Turístico Punta Uva S.A., para utilizar con fines turísticos un terreno que se encuentra ubicado dentro de los 150 metros de la Zona Marítimo Terrestre del área declarada Refugio Nacional de Fauna Silvestre Gandoca Manzanillo, refugio que fuera creado por Decreto Ejecutivo No.16614-MAG de 1 de julio de 1985. Ese permiso de uso se otorgó de conformidad con las potestades dadas por la Ley Forestal, la Ley de Conservación de Fauna Silvestre y su Reglamento, normativa que faculta al Ministerio de Recursos Naturales, Energía y Minas para conceder permisos de uso dentro de áreas de Patrimonio Forestal del Estado.
Al concederse ese permiso, se dispuso expresamente que el permisionario no podía gravar ni vender esa autorización y que sólo podría traspasarlo con el visto bueno de la Dirección de Vida Silvestre del Ministerio de Recursos Naturales, Energía y Minas, previo cumplimiento del trámite respectivo. Se estableció de igual modo que el permisionario debía depositar cierta cantidad de dinero como garantía para responder a un eventual incumplimiento de las obligaciones que se derivan de ese permiso, además de que debería realizar las labores en el área dentro del marco de la Ley Forestal y la Ley de Conservación de Fauna Silvestre, de modo que no perjudicara los recursos naturales. Podía construír (sic) hasta 84 cabinas para la atención del turismo, dos piscinas, un edificio para recepción, construcciones para cocinas, un rancho bar, área de parqueo, una cafetería, un restaurante, una casa de máquinas, dos canchas de tenis, carretera de acceso, dormitorios de empleados y servicios generales, todos de conformidad con el plano presentado y permisos para construcción de la Municipalidad de Talamanca, Colegio de Ingenieros y Arquitectos, Instituto Nacional de Vivienda y Urbanismo, Ministerio de Salud y el Instituto Costarricense de Turismo.
Se indicó que cualquier violación a la legislación vigente o a lo ahí establecido, daría lugar a la cancelación del permiso sin derecho de reclamación alguna por parte del permisionario y que tal permiso tenía una validez de 10 años que se tendría por prorrogado automáticamente por períodos iguales y consecutivos (folio 102). En vista del incumplimiento a las condiciones bajo las cuales se otorgó el permiso, entre las que se citan la construcción de obras sin contar con los permisos del INVU, Ministerio de Salud, Colegio Federado de Ingenieros y Arquitectos, Municipalidad de Talamanca, construcciones fuera del área amparada por el permiso de uso, obstaculización para el ingreso de funcionarios de la Dirección General de Vida Silvestre, construcción de laguna artificial fuera del área autorizada, construcción y ampliación de drenajes dentro y fuera del área autorizada, obstrucción de quebradas y desviación de cauces naturales, ampliación y profundización del canal entre el mar y el pantano, utilización de masa coralina para relleno interno del pantano, entre otros; así como debido a los daños ocasionados en el ambiente, tales como el cambio en la morfología de la playa, cambio en la circulación de los sedimentos, salinización de suelos, pérdidas de habitat de algunas especies, riesgos de inundación por la interrupción de drenajes naturales, disminución y obstrucción del área de la zona pública, afectación importante de arrecifes coralinos, entre otros, mediante resolución No. R-089-93 de las 8:15 horas del 5 de marzo de 1993, suscrita por el Ministro de Recursos Naturales, Energía y Minas y el Presidente de la República, se revocó tal permiso de uso No.351-90 y se ordenó al apoderado generalísimo sin límite de suma de la sociedad Complejo Turístico Punta Uva S.A., proceder a restituír (sic) las cosas al estado en que éstas se encontraban antes del otorgamiento del Permiso de Uso citado, otorgándole un plazo de 6 meses para el cumplimiento de lo dispuesto en esa resolución.
El representante de esa empresa interpuso en tiempo y forma el respectivo recurso de reposición en contra de tal resolución, sin embargo, mediante pronunciamiento de las 8:15 horas del 28 de julio de 1993, también suscrita por el Ministro de Recursos Naturales, Energía y Minas, así como por el Presidente de la República, se dispuso que no existía mérito para reponer la decisión adoptada en el sentido de revocar el permiso de uso concedido mediante resolución No.351-90-MIRENEM, por cuanto los hechos atribuídos (sic) no fueron desvirtuados, siendo que, más bien, el gestionante los admite como ciertos, ofreciendo incluso la adopción de las medidas correctivas que fueren necesarias para la reparación de cualquier daño que hubieren causado, y declarándose, en consecuencia, sin lugar ese recurso de reposición, manteniéndose entonces la resolución No.089-93-DGVS.
III.Al entrar a valorar por el fondo las pretensiones planteadas en este recurso, debe decirse que en primer lugar, alega el recurrente, que la incorporación del inmueble propiedad del Complejo Turístico Gandoca Manzanillo S.A. que considera de dominio privado, al Refugio Nacional de Protección Silvestre Gandoca Manzanillo, se produjo en forma absolutamente violatoria de las claras directrices contenidas en la Ley Forestal así como en contravención con la garantía constitucional contenida en el artículo 45 de la Constitución Política, pues en ningún momento medió pago por compra o por expropiación, lo que significa, en definitiva, la inconstitucionalidad del Decreto Ejecutivo mediante el cual se creó ese Refugio Nacional. Al respecto, debe indicarse que previo a la interposición del presente recurso de amparo, uno de los aquí recurrentes interpuso acción de inconstitucionalidad No. 0328-M-93, precisamente en contra de los Decretos Ejecutivos No.16614-MAG y No.16631-MAG, que crearon y reglamentaron el Refugio Nacional de Vida Silvestre Gandoca Manzanillo.
En dicha Acción se alegó exactamente el mismo punto que aquí se impugna, toda vez que en criterio del recurrente, tales decretos estaban imponiendo limitaciones a la propiedad privada sin fundamento en la ley, lo que violaba el artículo 45 constitucional. Esta Acción fue rechazada de plano por el Voto No.1063-95 de las 15:00 horas del 23 de febrero de 1995, disponiéndose expresamente que:
“...tampoco tiene legitimación el accionante para alegar la violación al artículo 45 de la Constitución Política -derecho de propiedad-, pues según se desprende de sus propias manifestaciones y de la demás documentación que obra en el expediente, a éste lo que se le otorgó fue un ‘permiso de uso’ para utilizar un terreno que se encuentra localizado dentro de la zona marítimo terrestre, bien demanial dentro del que ningún particular podría válidamente, alegar derecho de propiedad alguno a su favor, y por ello, los alegatos de fondo planteados en la acción son absolutamente improcedentes, y así debe declararse...” (sentencia No.1063-95 de las 15:00 horas del 23 de febrero de 1995).
Se dispuso además en dicha sentencia que la improcedencia de esos alegatos también se fundamentaba en los criterios externados por la Sala en anteriores ocasiones, entre los cuales se cita la sentencia No.0407-91 de las 15:30 horas del 21 de febrero de 1991, que en lo que interesa dispuso:
que el Estado ha tenido que ir emitiendo legislación “...en la que exceptúa del dominio público ciertas zonas o partes del litoral de manera que no se les aplique la legislación general que para ellas regía. No es atendible, entonces la premisa de la que parte el accionante, ya que no se imponen limitaciones a la propiedad privada, sino que al regularse el dominio público, la ley lo que hace es establecer condiciones mediante las que es posible el uso y disfrute de la zona marítimo terrestre, por parte de los particulares. Así, quien pretenda por medios no autorizados ejercer un uso privativo de esa zona tendrá vedada la posilidad (sic) de consumarlo, pues es aceptado también, desde tiempo inmemorial que se trata de bienes imprescriptibles en favor de particulares y que están fuera del comercio...” (sentencia No.407-91 de las 15:30 horas del 21 de febrero de 1991).
Resulta importante recordar que tal planteamiento ha sido interpuesto ante esta instancia no sólo en la citada Acción de Inconstitucionalidad o en el presente recurso de amparo, sino también en otras muchas ocasiones en que el Complejo Turístico Punta Uva S.A. se ha apersonado ante esta Jurisdicción, siendo que en todas esas oportunidades, la Sala lo ha rechazado. Por tal razón, y en vista de que no han variado las circunstancias existentes, se mantiene en este momento el mismo criterio que se ha externado anteriormente, considerando entonces que no “...ha sido violentado el artículo 45 de la Constitución Política, porque el Complejo Turístico Punta Uva S.A., no cuenta con un derecho de propiedad sino con un ‘permiso de uso’ para utilizar por diez años un terreno localizado ‘dentro de los ciento cincuenta metros de la Zona Marítimo Terrestre del área declarada Refugio Nacional de Fauna Silvestre Gandoca Manzanillo’”( ver sentencia No.0480-93 de las 9:09 horas del 29 de enero de 1993 y sentencia No.1980-93 de las 15:39 horas del 11 de mayo de 1993).
Queda entonces, de este modo, desvirtuada la tesis de la parte recurrente según la cual se ha dado una violación al artículo 45 constitucional, resultando improcedente el recurso en cuanto a este punto y así debe declararse.
IV.Una vez realizado el análisis del considerando anterior del mismo se rescata el hecho de que el Complejo Turístico Punta Uva S.A. no ostenta un derecho de propiedad sobre el inmueble que se ubica dentro del Refugio Nacional de Vida Silvestre Gandoca Manzanillo, sino tan sólo un permiso de uso de ese inmueble por un término de 10 años y sujeto a la legislación que lo regula. Sin embargo, impugna el recurrente en esta instancia la procedencia y validez de las resoluciones No.089-93-DGVS de las 8:15 horas del 5 de marzo de 1993, así como la No. R216-93-MIRENEM de las 8:15 horas del 28 de julio de 1993, según las cuales, como se indicó líneas atrás, se cancela el permiso de uso del inmueble de marras otorgado en favor de Complejo Turístico Punta Uva S.A., con lo que pretende la parte recurrente que esta Sala entre a valorar sobre el fondo de tales resoluciones. Al respecto, olvidan los gestionantes que esta Sala no es contralora de legalidad sino de constitucionalidad, de modo tal que, si el mismo permiso establecía que ante el incumplimiento de los términos bajo los cuales se otorgaba se podría dar la cancelación del mismo sin derecho de reclamo por parte del permisionario, y en el caso concreto, de las probanzas existentes se deducía ese supuesto incumplimiento de la parte recurrente, la circunstancia de que se hubiera decretado en la vía administrativa la cancelación de tal permiso por cuanto, aparentemente, se dieron los supuestos para ello, no puede ser valorada por esta jurisdicción constitucional puesto que no tiene competencia para ello, el tema de fondo debe ser discutido, y de hecho ya se está haciendo en la vía contencioso-administrativa; pero sí puede analizar el cumplimiento del debido proceso así como la satisfacción del derecho de defensa.
Así las cosas, y específicamente respecto del Complejo Turístico Gandoca Manzanillo S.A., estima la Sala que previo dictado de las resoluciones impugnadas, se cumplió con el debido proceso y se garantizó el ejercicio del derecho de defensa, situación que ya fue también analizada por esta Sala en el recurso de amparo No.0107-C-93, en el que mediante sentencia No.0480-93 de las 9:09 horas del 29 de enero de 1993 indicó:
“Conforme al artículo 9 de la Ley de la Jurisdicción Constituiocnal (sic), el presente recurso debe rechazarse de plano por su evidente improcedencia y falta de fundamentación, dado que garantiza el debido proceso la resolución aquí tachada por el contrario de infringirlo. En efecto, da traslado al Complejo Turístico Punta Uva S.A. de las presuntas nueve irregularidades que la Administración le imputa...; preveé (sic) el otorgamiento de audiencia y la posibilidad de presentación de prueba de descargo por parte del referido Complejo Turístico; pone el expediente administrativo a su disposición... y encarga al Director General de Vida Silvestre la instrucción y resolución del proceso. el permiso de uso concedido al recurrente está expresamente condicionado a que el permisionario realice ‘las labores en el área dentro del marco de la Ley Forestal y la Ley de Conservación de Fauna Silvestre, de tal manera que no perjudique los recursos naturales’..., y ‘cualquier violación a la legislación vigente o a la aquí establecida dará lugar a la cancelación del permiso sin derecho de reclamo por parte del permisionario’....
El procedimiento aquí impugnado pretende, precisamente, determinar si las irregularidades especificadas ameritan su cancelación.” Debe decirse además que, en sentencia No.1980-93 de las 15:39 horas del 11 de mayo de 1993, esta Sala Constitucional declaró con lugar el recurso de amparo No.0792-C-93 por cuanto el órgano director del procedimiento también había fungido como perito en el proceso en contra del Complejo Turístico, considerando entonces la Sala que en cuanto a ese extremo había existido una violación al debido proceso y que por ello debía anularse la medida cautelar dictada por ese funcionario toda vez que el mismo se encontraba impedido, pero se dispuso a la vez en ese acto, que se conservaban todos los demás actos del procedimiento, lo que evidencia el hecho de que efectivamente, hasta ese momento se había cumplido el debido proceso y el derecho de defensa, salvo en lo que se refería a tal declaratoria.
Posterior a este recurso, se dictaron las resoluciones aquí impugnadas y del análisis de las probanzas allegadas al expediente, debe decirse que la Sala no estima que se haya dado ninguna otra violación al debido proceso o al derecho de defensa, pues como se observa, la parte recurrente tuvo oportunidad de conocer por completo, las irregularidades que se le imputaban y no de una sóla (sic) parte de ellas como lo alega, además tuvo acceso al expediente, pudo haber comparecido a la audiencia fijada para el día 15 de enero de 1993, pero no lo hizo, ejerció su derecho a presentar todos los incidentes que consideró oportunos así como los recursos pertinentes, tales como el que presentó en contra de la resolución No.089-93-DGVS y cuya resolución dio lugar al pronunciamiento No.216-93-MIRENEM (ambas impugnadas en este recurso); y en definitiva, tuvo amplia participación dentro de ese procedimiento administrativo, estimando por ello, la Sala, que no ha existido la alegada violación al derecho constitucional del debido proceso y del derecho de defensa, pues en todo momento el Complejo Turístico Punta Uva S.A. tuvo conocimiento de todos los hechos que se le imputaban y tuvo posibilidad de ejercer su derecho de defensa, por lo que no es de recibo su alegato de que las resoluciones finales contienen elementos nuevos.
Por otra parte, alega la parte recurrente que no procede la orden de derribo de las obras como consecuencia de la cancelación del permiso de uso sobre el bien inmueble, sin embargo, debe reiterarse que la Sala no tiene competencia para determinar si procede o no esa orden de derribo y en vista de que los límites dentro de los cuales fue otorgado el permiso establecían que cualquier incumplimiento de parte del permisionario darían lugar a la cancelación de tal autorización, es precisamente la Administración la que, previa valoración del incumplimiento ocasionado y de los daños causados, debe determinar las consecuencias de tal cancelación.
V.Impugna también el recurrente la potestad que tiene el Ministerio de Recursos Naturales, Energía y Minas para otorgar y cancelar el permiso de uso del inmueble ubicado dentro del Refugio Nacional de Vida Silvestre Gandoca Manzanillo. Al respecto, establece el artículo 82 de la Ley de Conservación de la Vida Silvestre que los recursos naturales comprendidos dentro de los refugios nacionales de vida silvestre, quedan bajo la competencia y el manejo exclusivo de la Dirección General de Vida Silvestre del Ministerio de Recursos Naturales, Energía y Minas, siendo entonces que en las áreas de parques nacionales o de reservas equivalentes, no se aplica la Ley de la Zona Marítimo Terrestre. En este sentido se ha pronunciado la Procuraduría General de la República para decir que en las áreas de los Refugios de Vida Silvestre, incluídos (sic) en la zona marítimo terrestre, la administración corresponde exclusivamente a ese Servicio y no a las Municipalidades, ello desde luego en el ámbito de su delimitación, pues las áreas aledañas que formen parte de la zona marítimo terrestre continúan bajo competencia municipal (ver dictámen (sic) No. C-052-89 de 7 de marzo de 1989).
Desde esta perspectiva, no lleva razón el recurrente en su alegato, y en consecuencia, a contrario de lo que afirma la parte gestionante, la Municipalidad de Talamanca no se encontraría autorizada para otorgar concesiones y permisos de construcción en un área en la cual la competencia le es ajena, siendo ese el caso del inmueble respecto del cual se le otorgó permiso de uso al Complejo Turístico Punta Uva S.A., competencias que en definitiva son materia propia de legalidad y pueden ser discutidas en la instancia común que corresponda, debiendo por ello declararse sin lugar el recurso también en cuanto a este extremo.
VI.De este modo, no estima la Sala que en el presente asunto la Administración haya ocasionado violación alguna a normas constitucionales, y es precisamente por no existir ninguna violación de esa naturaleza que el presente recurso de amparo debe ser declarado sin lugar como en efecto se ordena.”
III.Lo dicho en la sentencia parcialmente transcrita es de plena aplicación al caso bajo estudio, sin que existan motivos ni razones que justifiquen variar el criterio externado en aquella oportunidad. Por consiguiente, no se han producido las alegadas violaciones a los derechos fundamentales del recurrente y su representada, motivo por el cual el recurso es improcedente en cuanto a esos extremos y así se declara. Por otra parte, según se constata, mediante sentencia número 000285-F-04 de las once horas treinta minutos del veintiocho de abril del dos mil cuatro (resolución que se tuvo a la vista), la Sala Primera de la Corte Suprema de Justicia discutió el diferendo relativo a sí la restitución al estado en que se encontraban las cosas al momento del otorgamiento del permiso en cuestión, implicaba el desalojo y derribo de las obras. De cualquier modo, no es en esta vía que cabe revisar esos extremos.
A mayor abundamiento, no podría esta Sala entrar a revisar la resolución R-089-93-DGVS de las ocho horas quince minutos del cinco de marzo de mil novecientos noventa y tres, pues ella ya fue impugnada y confirmada en la jurisdicción ordinaria, incluso fue objeto de pronunciamiento por parte de la Sala Primera de la Corte Suprema de Justicia en la citada sentencia número 000285-F-04 de las once horas treinta minutos del veintiocho de abril del año dos mil cuatro, lo que implicaría necesariamente que esta Sala entrara a revisar lo resuelto en dicha jurisdicción, lo cual es improcedente de conformidad con lo dispuesto en el artículo 30 inciso b) de la Ley de la Jurisdicción Constitucional.
IV.Dadas las consideraciones anteriores, no se han producido las alegadas violaciones a los derechos fundamentales del recurrente y su amparada, motivo por el cual el recurso es improcedente en cuanto a los extremos indicados.
V.Sin perjuicio de lo afirmado anteriormente, procede dar curso al amparo, exclusivamente, por la eventual violación a lo dispuesto en los artículos 27 y 41 de la Constitución Política, por cuanto el recurrente alega que el primero de setiembre del dos mil cuatro, el Apoderado Especial de Complejo Turístico Punta Uva S.A., solicitó al Ministro del Ambiente y Energía que le proporcionara el Registro e Inventario de las cosas existentes dentro del área que fue autorizada antes del otorgamiento del permiso de uso número 351-90 -que luego fuera revocado- y aún no ha recibido respuesta alguna sobre lo pedido (folios 21 y 22).
Por tanto:
Se ordena darle curso al amparo, exclusivamente, en cuanto a la alegada violación a los artículos 27 y 41 de la Constitución Política. En lo demás, se rechaza por el fondo el recurso.
