Considerando:
I.Regarding the lack of standing to sue alleged by the respondent authority, it is necessary to point out that, in amparo actions, the Ley de la Jurisdicción Constitucional in its Article 33 establishes vicarious standing by stating that "any person may file an amparo action on behalf of a third party." Thus, the petitioners do have standing to file the present proceeding.
II.The amparo action was filed for violation of the right to a prompt and diligent administrative procedure. The Chamber's jurisprudence, specifically regarding proceedings filed before the Dirección Nacional de Pensiones, is extremely abundant and, therefore, it is unnecessary to delve into theoretical aspects of what the amparo action is and to define the principles and rights that are violated by the delay in resolving. As in the instant case, the documentary evidence provided allows verification that the administrative act that the protected person sought from the Dirección Nacional de Pensiones was issued after the calendar month referred to in Article 89 of Law No. 7531 – as amended by Law 7946 of December 3, 1999 – had amply elapsed, this Chamber deems the alleged administrative delay (mora administrativa) to be proven. Consequently, the action is admissible and must be declared as such.

Resultando:
Redacta el Magistrado Batalla Bonilla; y,
Considerando:
I.En lo tocante a la falta de legitimación activa aducida por la autoridad recurrida es preciso indicar que, en el recurso de amparo, la Ley de la Jurisdicción Constitucional en su numeral 33 establece una legitimación vicaria al indicar que "cualquier persona podrá interponer el recurso de amparo a favor de un tercero". Así las cosas, los recurrentes sí tienen legitimación para interponer el presente proceso.
II.El amparo se ha presentado por violación del derecho a un procedimiento administrativo pronto y cumplido. La jurisprudencia de la Sala, concretamente, por las gestiones que se presentan ante la Dirección Nacional de Pensiones, es abundantísima y, por ello, es innecesario ahondar en aspectos teóricos de lo que es el recurso de amparo y definir los principios y derechos que se violentan con la tardanza en resolver. Como en la especie, la prueba documental aportada permite constatar que el acto administrativo que la persona amparada pedía a la Dirección Nacional de Pensiones fue emitido, luego de que había transcurrido sobradamente el mes calendario a que se refiere el artículo 89 de la Ley Nº 7531 –reformada por Ley 7946 de 3 de diciembre de 1999–, esta Sala tiene por acreditada la mora administrativa alegada. En consecuencia, el recurso resulta procedente y así debe declararse.
Por tanto:
Se declara con lugar el recurso. Se condena al Estado al pago de las costas, daños y perjuicios causados con los hechos que sirven de base a esta declaratoria, los que se liquidarán en ejecución de sentencia de lo contencioso administrativo.
