San José, at ten twenty a.m. on April thirtieth, two thousand four.- Petition for constitutional relief (recurso de amparo) filed by Rodrigo Abarca Núñez, holder of identity card number 1-602-206, against the Administrator of Parque Nacional Manuel Antonio.

Findings:

  1. 1By a filing received by the Chamber’s Secretariat at 16:28 on November 18, 2003, the petitioner filed a petition for constitutional relief against the Administrator of Parque Nacional Manuel Antonio and stated that he is a tour guide at that park and learned that, at the Administrator’s direction, a group of tour guides had formed an association to engage exclusively in tourism activities; consequently, those who are not members of the association are not permitted to provide guiding services within the park. He states that the members are permitted to conduct commercial activities within the Park, although this is prohibited under ley 6084 artículo 8 inciso 15, which prohibits visitors from engaging in commercial activities in the area.
  2. 2The petitioner submitted filings appearing at pages 28 through 38 and 46 through 49, requesting that the petition be granted.
  3. 3In a sworn report dated December 18, 2003, José Antonio Salazar Álvarez, in his capacity as Administrator of Parque Nacional Manuel Antonio (page 50), states that, through official letter PNMA-510 of November 13, 2003, the petitioner’s request was answered, informing him that Park officials are responsible for ensuring that tour guides meet the applicable requirements; that, in coordination with INA, a course was provided free of charge to a group of guides, in which Mr. Abarca Núñez declined to participate. He states that no one has ever been denied access to the Park and that, as to working within it, ley 6084 establishes limits on the conduct of certain activities in protected areas (áreas protegidas). He states that the petitioner has never been prevented from working in the Park and, in fact, continues to do so. He acknowledges that tour-guide organizations do exist; however, it is not true that they have the exclusive right to work in the Area.
  4. 4The statutory requirements have been observed in the proceedings conducted.

Resultando:

  1. 1Por escrito recibido en la Secretaría de la Sala a las 16:28 horas del 18 de noviembre del 2003, el recurrente interpone recurso de amparo contra el Administrador del Parque Nacional Manuel Antonio y manifiesta que es guía turístico de dicho parque y se enteró de que por disposición del Administrador un grupo de Guías Turísticos se asociaciaron para desarrollar de forma exclusiva la actividad turística; por lo cual no se le permite a aquellos que no estén asociados guiar dentro del parque. Menciona que a los asociados se les permite realizar actividades comerciales dentro del Parque, lo cual les esta prohibido por mandato de ley 6084 artículo 8 inciso 15, en donde se prohíbe a los visitantes ejercer actos de comercio en la zona.
  2. 2El recurrente presentas escritos a folios 28 a 38 y 46 a 49, en el sentido de que el recurso sea declarado con lugar.
  3. 3Informa bajo juramento en fecha 18 de Diciembre del 2003 José Antonio Salazar Álvarez, en su calidad de Administrador del Parque Nacional Manuel Antonio (folio 50), que mediante oficio PNMA-510 del 13 de noviembre del 2003, se dio respuesta a la solicitud del recurrente, indicándole que es responsabilidad de los funcionarios del Parque velar porque lo Guías Turísticos cuenten con los requisitos para tal efecto; que en coordinación con el INA se impartió un curso de forma gratuita a un grupo de guías, en el cual el señor Abarca Núñez no quiso participar. Menciona que nunca se le ha negado a nadie el acceso al Parque, y en cuanto a laborar dentro de éste, la ley 6084 establece límites para el desarrollo de ciertas actividades en las áreas protegidas. Menciona que al aquí recurrente nunca se le ha impedido laborar en el Parque y de hecho lo continua haciendo, admite que es cierto que existen organizaciones de guías turísticos, sin embargo, no es cierto que estas cuenten con la exclusividad para trabajar en el Área.
  4. 4En los procedimientos seguidos se han observado las prescripciones legales.

Considerando:

ÚNICO.- El recurrente acude a esta Sala porque se obstaculiza su actividad como guía turístico en el Parque Nacional Manuel Antonio y se permite esta actividad exclusivamente a aquellos guías que se han asociado con este objeto. Pero del informe bajo juramento del Administrador del Parque, a folio 50 y 51 se observa que los hechos invocados por el recurrente no se han demostrado, de modo que la alegada violación de los derechos del petente no se constata que se haya producido.

Por tanto:

Se declara sin lugar el recurso.
