Sole Ground: Pursuant to article 102 of the Ley de la Jurisdicción Constitucional, a judicial consultation is proper when the judge “has well-founded doubts regarding the constitutionality of a provision or act that must be applied, or of an act, conduct, or omission that must be adjudicated in a case before the judge.” In the matter under examination, it is clear that the judge’s consultation concerns how the specific provision—in this case, article 30 subsection j) of the Código Procesal Penal—must be applied, and not whether it is unconstitutional per se. What concerns the judge, rather, is the possibility that the provision could be interpreted unconstitutionally, which is a different matter.
