San José, at fifteen hours and eleven minutes on cuatro de junio del dos mil dos.- Amparo proceeding (recurso de amparo) filed by Nombre66350, identity card number CED8103, and Nombre66351, identity card number CED8106, on behalf of the "ASOCIACION CONSERVACIONISTA DE LOS RIOS Y EL AMBIENTE DE CIRUELAS DE ALAJUELA" (ACORACI) and the "ASOCIACION DE AMIGOS DEL MEDIO AMBIENTE DEL RIO SIQUIARE Y SUS NACIENTES DE TURRUCARES" (ASAMARS); against the MINISTERIO DEL AMBIENTE Y ENERGIA, the MINISTERIO DE SALUD, the MUNICIPALIDAD DE ALAJUELA, the TRIBUNAL AMBIENTAL ADMINISTRATIVO, and "TUNATUN INTERNACIONAL COSTA RICA, SOCIEDAD ANONIMA." Considering:
I.Subject matter of the petition. The complainants allege that, since February of two thousand one, they have reported environmental contamination caused by the company Nombre10798 to the Municipalidad de Alajuela, Ministerio de Salud, Ministerio del Ambiente y Energía, and Tribunal Ambiental, and that although those entities have taken action, the process is extremely slow and the company has failed to respond and, through its conduct, violates the rights granted and recognized to them by the Constitución Política: the rights to health, private property, enjoyment of a healthy and ecologically balanced environment, and protection of natural beauty.
II.Facts deemed proven. The following facts are considered established and relevant to the resolution of this matter, either because they have been duly proven or because the respondents failed to address them as ordered in the initial ruling:
The company Nombre10798 did, in fact, cause contamination as a result of its industrial activity (folio 88).
The company Nombre10798 established operations at that location with the approval of the Ministerio de Salud, issued through official letter UPC-PC-A-532-99, and has plan No. 05-07-04-2000, approved through official letter PPC-l08-00. Those plans concern construction of the wastewater treatment system, and the calculation memorandum and operation and maintenance manual were attached to the plans (folio 95).
Through official letter UPC-PSF-1521-00, that Ministry granted a provisional operating permit (permiso de funcionamiento provisional) for six months in order to evaluate the efficiency of that treatment system (folio 95).
The company failed to submit the relevant operating reports (reportes operacionales), and the Región Central Norte was therefore asked to order their submission by means of a sanitary order (orden sanitaria) (folios 95 and 96).
On July eleven, two thousand one, official letter UPC-D-834-01-J was issued, informing the Región Central Norte that the assessment of that company had been conducted through official letter UPC-D365-01, a copy of which was attached (folio 96).
On August twenty-one, two thousand one, through official letter UPC-CAH-RO-680-0l, the Proceso de Control del Ambiente Humano informed Eng. Karla Miranda Cruz, Head of the Tunatun treatment plant, that she was required to submit a corrective-action schedule (cronograma de acciones correctivas) to optimize the quality of the industry’s wastewater (folio 96).
On September eleven, two thousand one, through official letter UPC-D-1426-01 -J, the Proceso de Denuncia informed the Tribunal Ambiental that the complaint filed by the complainants had been addressed through official letters UPC-D-365-01 and UPC-D-834-01. It further stated that the corresponding sanitary order had been issued to the company Tunatun through official letters PM-RCN-663-2001 and ARSAII-77 1-01. Lastly, a copy of that official letter was sent to the Proceso de Permisos de Funcionamiento so that the permit—which had already expired at that time—would not be renewed, and another copy was sent to the Región Central Norte so that the Minister responsible for the sector could be informed of the actions taken in connection with that case (folio 96).
On September fourteen, two thousand one, Dr. Virginia Céspedes Gaitán reported that a sanitary order had been issued to the company Tunatun on the basis of the statements contained in official letters IJPC-D-834-01 and UPCD-365-01 (folio 96).
On October nineteen, two thousand one, through official letter UPC-PSF-1801-2001, Eng. Francisco Amén, who was then in charge of the Proceso de Permisos de Funcionamiento, informed Mr. Asan Rahali, Deputy General Manager of Nombre10798 Internacional de Costa Rica S.A., that the proceedings to renew the Health Operating Permit (Permiso Sanitario de Funcionamiento) had been temporarily suspended pending the final decision to be issued by the Proceso Control e Inspección de Denuncias (folio 96).
On November two, two thousand one, the Proceso de Denuncias asked Eng. Ana Villalobos, who was in charge of the Proceso de Control del Ambiente Humano, to clarify the statements contained in official letter UPC-CAHRO-791-01. That request was answered through official letter UPC-CAH-l 702-01, dated November twenty-two, two thousand one, stating that the company did not comply with the parameters established by the legislation in force (folio 96).
On November ten, two thousand one, Dr. Marco Tulio Zumbado, Director of the Area de Salud Alajuela II, reported through official letter ARSA-2-1055-01 that sanitary order number FM-22-01 had been issued to the company, granting it one month to comply with the requirements set forth in official letter UPC-D-365-01-S (folio 96).
On December seventeen, two thousand one, official letter UPC-CAI-I-1752-01, signed by Eng. Ana Villalobos, was issued to Lic. Mario Leiva, President of the Tribunal Ambiental Administrativo, informing him, in response to the request submitted by that Tribunal, that Nombre10798 had not submitted a corrective-action schedule to optimize wastewater quality. It also informed him that the company was required to clarify the inconsistency between the generator entity’s report (reporte del ente Generador) and the Laboratorio Lambda report (folio 97).
On February four, two thousand two, through official letter UPC-D-1 527-01, the Región Central Norte was instructed to order the closure of the company Tunatun because it did not have an operating permit and, moreover, its latest operating report indicated that it did not comply with the parameters established in the Reglamento de Vertido y Reuso de Aguas Residuales (folio 97.
III.On the right to enjoy a healthy and ecologically balanced environment. Article 50 of the Political Constitution establishes that every person has the right to a healthy and ecologically balanced environment. The right to a healthy environment has broad content equivalent to the aspiration to improve the human living environment, such that it extends beyond the criteria of nature conservation to encompass every sphere in which a person develops, whether family, work, or the surroundings in which that person lives. Hence, it is characterized as a cross-cutting right, that is, one that permeates the entire legal system, shaping and reinterpreting its institutions. The environment is defined by the Real Academia Española de la Lengua as the “set of physical circumstances surrounding living beings,” which further underscores the general nature of the right. By contrast, the right to an ecologically balanced environment is a narrower concept referring to an important part of the surroundings in which human beings develop: the balance that must exist between society’s advancement and the conservation of natural resources.
Both rights are expressly recognized in Article 50 of the Political Constitution, which defines the Social Rule-of-Law State (Estado Social de Derecho). The placement of the right to a healthy and ecologically balanced environment within the constitutional provisions governing the Social Rule-of-Law State is the starting point from which that right must be analyzed. The Social Rule-of-Law State gives rise to the incorporation into the fundamental text of a series of political objectives of great social significance and to the introduction of a substantial number of social rights that safeguard the common good and the satisfaction of people’s basic needs. From this perspective, the Political Constitution emphasizes that protecting natural resources is an appropriate means of safeguarding and improving everyone’s quality of life, which makes intervention by public authorities necessary with respect to factors that may disrupt the balance of natural resources and, more broadly, hinder a person’s development and ability to live in a healthy environment (Judgment N° 00644-98, at las once horas veinticuatro minutos del veintinueve de enero de mil novecientos noventa y nueve).
Now, having reviewed the statements made under oath by all the respondent authorities in this matter, and having verified that through official communication UPC-PSF-1521-00 the Ministry authorized Nombre10798 to operate provisionally for seis meses “in order to evaluate the efficiency of that treatment system,” and that this act allowed the company to pollute Río Siquiares, this appeal (recurso) must be granted. Indeed, the health authorities were obligated to determine, before allowing the company to operate, that the system to be used in its industrial activities would cause no environmental harm. Therefore, although the company’s closure has already been ordered, the fact remains that, in the interim, pollutants capable of harming the fauna, flora, and local population were also discharged. Accordingly, this appeal must be declared well-founded, as it hereby is.

San José, a las quince horas con once minutos del cuatro de junio del dos mil dos.- Recurso de amparo interpuesto por Nombre66350, cédula de identidad número CED8103 y Nombre66351, cédula de identidad número CED8106, a favor de la "ASOCIACION CONSERVACIONISTA DE LOS RIOS Y EL AMBIENTE DE CIRUELAS DE ALAJUELA" (ACORACI) y la "ASOCIACION DE AMIGOS DEL MEDIO AMBIENTE DEL RIO SIQUIARE Y SUS NACIENTES DE TURRUCARES" (ASAMARS); contra el MINISTERIO DEL AMBIENTE Y ENERGIA, el MINISTERIO DE SALUD, la MUNICIPALIDAD DE ALAJUELA, el TRIBUNAL AMBIENTAL ADMINISTRATIVO y "TUNATUN INTERNACIONAL COSTA RICA, SOCIEDAD ANONIMA".
Resultando:
Redacta el magistrado Sancho González; y,
Considerando:
I.Objeto del recurso. Los reclamantes acusan que han denunciado una situación de contaminación ambiental producida por la empresa Nombre10798 ante la Municipalidad de Alajuela, al Ministerio de Salud, el Ministerio del Ambiente y Energía y el Tribunal Ambiental, desde febrero de dos mil uno, y a pesar de que estos han actuado, el proceso es extremadamente lento y la empresa no responde y violenta con su accionar los derechos que les otorga y reconoce la Constitución Política, derechos a la salud, a la propiedad privada, al disfrute de un ambiente sano y ecológicamente equilibrado, y la protección de las bellezas naturales.
II.Hechos que se tienen por probados. De importancia para la decisión de este asunto, se estiman como demostrados los siguientes hechos, sea porque así han sido acreditados o bien porque los recurridos han omitido referirse a ellos según lo prevenido en el auto inicial:
Que, efectivamente, la empresa Nombre10798 produjo contaminación como resultado de su actividad industrial (folio 88).
Que la empresa Nombre10798 se ubicó en ese sitio con el visto bueno del Ministerio de Salud, emitido mediante el oficio UPC-PC-A-532-99, que cuenta con el plano No. 05-07-04-2000 aprobado mediante el oficio PPC-l08-00. Dichos planos se refieren a la construcción del sistema de tratamiento de las aguas residuales, que adjuntó a los planos la memoria de cálculo y el manual de operación y mantenimiento (folio 95).
Que mediante el oficio UPC-PSF-1521-00, ese Ministerio otorgó un permiso de funcionamiento provisional por seis meses, a fin de evaluar la eficiencia de ese sistema de tratamiento (folio 95).
Que la empresa no presentó los reportes operacionales pertinentes, por lo que se le solicitó a la Región Central Norte que ordenara la presentación de los mismos mediante orden sanitaria (folios 95 y 96).
El once de julio de dos mil uno, se emitió el oficio UPC-D-834-01-J, en el cual se le informó a la Región Central Norte que la valoración de esa empresa se hizo con el oficio UPC-D365-01, y se adjuntó copia del mismo (folio 96).
El veintiuno de agosto de dos mil uno, con el oficio UPC-CAH-RO-680-0l, el Proceso de Control del Ambiente Humano le indicó a la Ing. Karla Miranda Cruz, Encargada de la Planta de Tratamiento de la empresa Tunatun, que debía presentar un cronograma de acciones correctivas a efecto de optimizar la calidad del agua residual de esa industria (folio 96).
El once de septiembre de dos mil uno, con el oficio UPC-D-1426-01 -J, el Proceso de Denuncia le informó al Tribunal Ambiental que mediante los oficios UPC-D-365-01 y UPC-D-834-01, se atendió la denuncia presentada por los quejosos. Además, se indicó que mediante los oficios PM-RCN-663-2001 y ARSAII-77 1-01, se giró la orden sanitaria correspondiente a la empresa Tunatun. Por último, se mandó copia de ese oficio al Proceso de Permisos de Funcionamiento, a fin de que no se renovara el permiso –que en ese entonces ya estaba vencido– y copia a la Región Central Norte, con el objeto de que se le informara al Ministro del ramo de lo actuado con relación a ese caso (folio 96).
El catorce de septiembre de dos mil uno, la Dra. Virginia Céspedes Gaitán informó que se le giró la orden sanitaria a la empresa Tunatun, tomando como base lo indicado en el oficio IJPC-D-834-01 y UPCD-365-01 (folio 96).
El diecinueve de octubre de dos mil uno, con el oficio UPC-PSF-1801-2001, el Ing. Francisco Amén, encargado en ese entonces del Proceso de Permisos de Funcionamiento, le indicó al señor Asan Rahali, Sub Gerente General de Nombre10798 Internacional de Costa Rica S.A., que dejó sin efecto temporalmente los trámites de renovación del Permiso Sanitario de Funcionamiento, quedando a la espera de la resolución final que debía emitir el Proceso Control e Inspección de Denuncias (folio 96).
El dos de noviembre de dos mil uno, el Proceso de Denuncias le solicitó a la Ing. Ana Villalobos, encargada del Proceso de Control del Ambiente Humano, una aclaración de lo indicado en el oficio UPC-CAHRO-791-01. Esa solicitud fue contestada con el oficio UPC-CAH-l 702-01 con fecha veintidós de noviembre del dos mil uno, indicando que la empresa no cumple con los parámetros establecidos en la legislación vigente (folio 96).
El diez de noviembre de dos mil uno, el Dr Marco Tulio Zumbado, Director del Area de Salud Alajuela II, con el oficio ARSA-2-1055-01 informó que se le giró a la empresa la orden sanitaria número FM-22-01, con un plazo de un mes para el cumplimiento de lo indicado en el oficio UPC-D-365-01-S (folio 96).
El diecisiete de diciembre de dos mil uno, se emitió el oficio UPC-CAI-I-1752-01, suscrito por la Ing. Ana Villalobos, el cual fue dirigido al Lic. Mario Leiva, Presidente del Tribunal Ambiental Administrativo, indicándole que en atención a la solicitud presentada por ese Tribunal, se le informaba que Nombre10798 no había presentado un cronograma de acciones correctivas a efecto de optimizar la calidad del agua residual, además le comunica que la empresa debe aclarar la incongruencia existente entre el reporte del ente Generador y el reporte del Laboratorio Lambda (folio 97).
El día cuatro de febrero de dos mil dos, mediante el oficio UPC-D-1 527-01, se le indicó a la Región Central Norte que debía ordenar el cierre de la empresa Tunatun, por cuanto la misma no cuenta con permiso de funcionamiento y además el último reporte operacional indicaba que no cumplía con los parámetros establecidos en el Reglamento de Vertido y Reuso de Aguas Residuales (folio 97.
III.Sobre el derecho a gozar de un medio ambiente sano y ecológicamente equilibrado. El artículo 50 de la Constitución Política establece que toda persona tiene derecho a un ambiente sano y ecológicamente equilibrado. El derecho a un ambiente sano tiene un contenido amplio que equivale a la aspiración de mejorar el entorno de vida del ser humano, de tal manera que desborda los criterios de conservación natural para ubicarse dentro de todos los ámbitos en los que se desarrolle la persona, sea el familiar, el laboral o el del medio en el cual habita. De ahí que se afirme que se trata de un derecho transversal, es decir, que se desplaza a todo lo largo del ordenamiento jurídico, modelando y reinterpretando sus institutos. El ambiente es definido por la Real Academia Española de la Lengua como el "conjunto de circunstancias físicas que rodean a los seres vivos", lo que recalca aún más el carácter general del derecho.
En cambio el derecho a un ambiente ecológicamente equilibrado es un concepto más restringido referido a una parte importante de ese entorno en el que se desarrolla el ser humano, al equilibrio que debe existir entre el avance de la sociedad y la conservación de los recursos naturales. Ambos derechos se encuentran reconocidos expresamente en el artículo 50 de la Constitución Política, que perfila el Estado Social de Derecho. La ubicación del derecho a un ambiente sano y ecológicamente equilibrado dentro de las regulaciones constitucionales del Estado Social de Derecho es el punto a partir del cual debe éste ser analizado. El Estado Social de Derecho produce el fenómeno de incorporación al texto fundamental de una serie de objetivos políticos de gran relevancia social y de la introducción de un importante número de derechos sociales que aseguran el bien común y la satisfacción de las necesidades elementales de las personas.
En esta perspectiva, la Constitución Política enfatiza que la protección de los recursos naturales es un medio adecuado para tutelar y mejorar la calidad de vida de todos, lo que hace necesaria la intervención de los poderes públicos sobre los factores que pueden alterar el equilibrio de los recursos naturales y, más ampliamente, obstaculizar que la persona se desarrolle y desenvuelva en un ambiente sano (Sentencia N° 00644-98 las once horas veinticuatro minutos del veintinueve de enero de mil novecientos noventa y nueve). Ahora bien, vistas las manifestaciones rendidas bajo gravedad de juramento por todas las Autoridades recurridas en este asunto y constatándose que mediante el oficio UPC-PSF-1521-00, el Ministerio autorizó el funcionamiento provisional de Nombre10798 por seis meses "a fin de evaluar la eficiencia de ese sistema de tratamiento" y este acto permitió que la compañía contaminara al Río Siquiares, el presente recurso debe acogerse.
En efecto, la obligación de las Autoridades Sanitarias era determinar que el sistema a emplearse en la actividad industrial de la compañía no produciría ningún daño al medio ambiente antes de permitir su funcionamiento. Por lo tanto, aunque ya se ha decretado el cierre de la empresa, lo cierto es que en el ínterin también se han vertido contaminantes susceptibles de dañar a la fauna, a la flora y a la población local. Por consiguiente, el presente recurso debe declararse con lugar, como en efecto se hace.
Por tanto:
Se declara con lugar el recurso. Se condena al Estado y a Nombre10798 Internacional Costa Rica, S. A. al pago de las costas, daños y perjuicios causados con los hechos que sirven de base a esta declaratoria, los que se liquidarán en ejecución de sentencia de lo contencioso administrativo.
