San José, at nine twenty a.m. on May twenty-four, two thousand two.- Amparo proceeding (recurso de amparo) filed by Nombre66326, identity card number CED3067; Nombre66327, identity card number CED35169; Nombre66328, identity card number CED35170; Nombre66329, identity card number CED35171; Nombre66330, identity card number CED35172; Nombre66331, identity card number CED35173; and Nombre66332, identity card number CED35174, on behalf of the "ASOCIACION CONFRATERNIDAD GUANACASTECA," against the MINISTERIO DE SALUD, the MINISTERIO DE AGRICULTURA Y GANADERIA (MAG), the MINISTERIO DEL AMBIENTE Y ENERGIA (MINAE), and "CENTRAL AZUCARERA DEL TEMPISQUE, SOCIEDAD ANONIMA" (CATSA).
Findings:
Justice Sancho González drafted the opinion; and,
Whereas:
I.Subject matter of the petition (Objeto del recurso). The petitioners maintain that CATSA operates under conditions that are intolerable for those living near the area close to Filadelfia de Carrillo because it generates foul odors during the sugarcane-harvest season, fosters mosquito breeding, and burns its sugarcane fields—which cover an area of cinco mil hectáreas de terreno—to facilitate harvesting, thereby generating soot, killing wild animals, and causing “harmful effects on public health” (folio 02). They also complain that the State entities do nothing to resolve the problem.
II.Facts deemed proven (Hechos que se estiman probados). The following facts are deemed established as relevant to the disposition of this matter, partly because they have been proven in the record, but also, and especially, because the respondent authorities and CATSA’s representative failed to address them as ordered in the initial ruling:
That CATSA has carried out a series of works and improvements to its facilities, including the installation of filters (“scrubbers”) in the boilers of its sugar mill (ingenio), silencers and noise-pollution attenuators, traps and separators for fats and oils contained in the cooling water from the sugarcane-milling equipment, ash separators, and the construction of a sedimentation and oxidation lagoon or channel to treat sugarcane wash water, among others (folios 12 to 18 and 126 et seq.).
That, moreover, according to the Ministry of Health, CATSA’s sugar mill currently has the following duly approved systems: 1) Ash Treatment System, whose project was approved under plan N° 214-23 by DECAP-99-97 on May third, nineteen ninety-seven. 2) Atmospheric Emissions Control Equipment, approved by DECAP1OO-97 of May third, nineteen ninety-seven. 3) Wastewater Treatment System, Plan N°05-01-97 (2000), approved on January sixth, two thousand, by Eng. Marcello De Simone C., an official with the Location and Construction Permits Process. 4) This sugar mill uses sugarcane wash water for irrigation following treatment (sedimentation and an anaerobic lagoon). 5) The vinasse, following treatment in anaerobic lagoons, is used to irrigate the sugarcane fields. For that purpose, in nineteen ninety-five the company submitted a “Vinasse Application–Fertigation Project” to that Ministry’s Directorate for the Protection of the Human Environment (folios 126 and 127).
In nineteen ninety-nine, the company submitted a new “proposal for managing vinasse as fertilizer,” for the purpose of eliminating controlled discharges into Río Tempisque (folio 127).
That, in view of the sugar mill’s compliance with all specifications required by the Ministry of Health, by official letter UPC-PSF-18 96-99 UAC5083-99 of December nineteenth, nineteen ninety-nine, signed by Eng. Eugenio Androvetto Villalobos, Licenciado Gonzalo Cubero Brealey, Legal Representative of Central Azucarera Tempisque, was informed that the aforementioned industry had been granted Operating Health Permit (Permiso Sanitario de Funcionamiento) number 217-99, which must be renewed on December thirteenth, two thousand four (folio 127).
That official letter AJ–018–2002, included at folio 129 et seq. of the case file, states the following: “…it is true that during the harvest season (Zafra), odors are generated by that company’s (CATSA’s) oxidation lagoons and can be detected at a considerable distance from their location; this affects other nearby communities, such as Paso Tempisque, Palmira, and Los Jocotes.” (See folio 129).
That the Minister of Health and CATSA’s representative acknowledge that the foul-odor problem caused by the company’s oxidation lagoons is real (folios 18 and 127), although both assert that enormous efforts have been made to solve the problem.
That, in fact, residents living near the sugar mill filed a complaint regarding the foul odors generated by the oxidation lagoon (see official letter RCH–ORSA 082–2001, folio 132).
That CATSA does in fact burn most of its sugarcane fields—approximately five thousand hectares of land. This follows from the statements contained in the application instituting these proceedings, the reports of the senior officials of MAG and MINAE, and the implicit admission by the representative of the respondent company (folios 19, 148 and 163).
That, notwithstanding the foregoing, the company has not applied for a permit to carry out such activity since December nineteen ninety-five (folios 148, 149 and 163).
That CATSA’s operations increase the proliferation of mosquitoes in the affected area.
IV.Regarding the applicants’ right to a healthy and ecologically balanced environment. This Court has repeatedly ruled on the constitutional nature of the rights held by the inhabitants of our country to enjoy a healthy and ecologically balanced environment; these matters therefore fall within the proper scope of Fundamental Rights. Thus, for example, in judgment N° 00644–99, issued at eleven twenty-four a.m. on January twenty-ninth, nineteen ninety-nine, the Chamber stated:
“III.– Regarding the law. Article 50 of the Political Constitution establishes that every person has the right to a healthy and ecologically balanced environment. The right to a healthy environment has broad content equivalent to the aspiration to improve the setting in which human beings live; it therefore extends beyond criteria of nature conservation and encompasses every sphere in which a person develops, whether the family sphere, the workplace, or the surroundings in which that person lives. It is therefore said to be a cross-cutting right—that is, one that extends throughout the legal system, shaping and reinterpreting its legal institutions. The Real Academia Española de la Lengua defines the environment as the ‘set of physical circumstances surrounding living beings,’ which further underscores the general nature of the right. By contrast, the right to an ecologically balanced environment is a narrower concept referring to an important part of the surroundings in which human beings develop: the balance that must exist between society’s advancement and the conservation of natural resources (recursos naturales).
Both rights are expressly recognized in Article 50 of the Political Constitution, which defines the Social State under the Rule of Law (Estado Social de Derecho). The placement of the right to a healthy and ecologically balanced environment within the constitutional provisions governing the Social State under the Rule of Law is the starting point from which that right must be analyzed. The Social State under the Rule of Law gives rise to the incorporation into the fundamental text of a series of political objectives of great social importance and to the introduction of a significant number of social rights that ensure the common good and the satisfaction of people’s basic needs. From this perspective, the Political Constitution emphasizes that protecting natural resources is an appropriate means of safeguarding and improving everyone’s quality of life, thereby requiring public authorities to intervene with respect to factors that may alter the balance of natural resources and, more broadly, prevent persons from developing and thriving in a healthy environment.
Just as the principle of the Social State under the Rule of Law is immediately applicable, so too is the right to a healthy and ecologically balanced environment, such that it manifests itself in the dual form of an individual right held by persons and a goal or objective of the actions of public authorities generally. The effect of the right to a healthy and ecologically balanced environment on State activity… rests first on the fact that, by definition, rights are not confined to individuals’ private sphere but also have significance for the very structure of the State in its role as guarantor of those rights and, second, on the fact that State activity is directed toward satisfying the interests of the community. The Political Constitution establishes that the State must guarantee, defend, and preserve that right. Prima facie, to guarantee means to secure and protect the right against any risk or need; to defend means to bar, prohibit, and prevent any activity that infringes the right; and to preserve is an action aimed at safeguarding the right in advance against possible dangers so that it may endure for future generations.
The State must adopt the dual conduct of acting and refraining from acting: on the one hand, it must itself refrain from infringing the right to a healthy and ecologically balanced environment; on the other, it must undertake the task of enacting measures that make it possible to satisfy constitutional requirements.” And also:
“All human life unfolds in an unavoidable relationship with its environment, particularly with the improvement of quality of life, which is the central objective that development must pursue; however, development must relate to the environment in a harmonious and sustainable manner.
The environment must therefore be understood as a potential source of development to be used appropriately, requiring integrated action with respect to its natural, sociocultural, technological, and political relationships; otherwise, its productivity for the present and the future is degraded, and the heritage of future generations could be placed at risk. The origins of environmental problems are complex and arise from the interaction of natural and social processes within the framework of the model of socioeconomic development adopted by the country. For example, environmental problems arise when methods of exploiting natural resources cause ecosystem degradation beyond those ecosystems’ capacity for regeneration, thereby harming broad sectors of the population and generating substantial environmental and social costs that result in a deterioration in quality of life; indeed, the primary objective of using and protecting the environment is to achieve development and progress beneficial to human beings.
Environmental quality is a fundamental parameter of that quality of life; other equally important parameters include health, food, work, housing, education, and so forth. More important still, however, is understanding that although human beings have the right to use the environment for their own development, they also have a duty to protect and preserve it for present and future generations. This is not particularly novel, because it is merely the application to this subject matter of the principle of ‘injury,’ already firmly established in ordinary law, under which the legitimate exercise of a right has two essential limits: on the one hand, the equal rights of others and, on the other, the rational exercise and beneficial enjoyment of the right itself.

To speak of sustainable development in terms of meeting present and future human needs and improving quality of life is to speak of the demand for natural resources at the individual level and of the direct or supporting means necessary for the economy to function by generating employment and creating capital goods, which in turn make it possible to transform resources into consumer, production, and export products.
(…)
Reference must be made to the meeting convened in July 1992 in Brasil, known as the Earth Summit, at which the integral and interdependent nature of the planet was proclaimed and recognized. That declaration signifies acceptance of certain principles guiding the transition from current development models to sustainability. The signatory States, including Costa Rica, undertook, as part of preserving sustainable development, to protect human beings above all. They proceeded from the principle that every person has the right to a healthy and productive life in harmony with nature; the right of present and future generations to development conducted in a manner that satisfies their environmental and development needs was included; the sovereign authority of States to exploit their resources was maintained, while emphasizing their responsibility to ensure that activities conducted within their jurisdiction and control do not cause environmental damage to other States or areas (sic) beyond the limits of their national jurisdiction.
They established the duty of States to cooperate in the conservation, protection, and restoration of the environment and their common responsibilities in that regard; international cooperation in promoting and supporting economic growth and sustainable development would thus make it possible to address the problems of environmental degradation more effectively. Likewise, a special duty was imposed on developed countries, based on their responsibility in the pursuit of sustainable development, given the evident pressure exerted on the global environment by the technologies they develop and the financial resources they possess." (Judgment number 3705–93 de las quince horas del treinta de julio de mil novecientos noventa y tres).
The cross-cutting nature of the Fundamental Rights under consideration also has important repercussions in the specific area of standing (legitimación) to seek amparo relief (amparo), and this issue has not gone unnoticed by the Chamber, which clearly set out its consequences in judgments such as number 3705–93 de las quince horas del treinta de julio de mil novecientos noventa y cuatro, which states, insofar as relevant:
"With respect to the legal protection of the environment, the standing of private individuals to bring judicial proceedings and secure the application of rules having that purpose, or to request judicial protection for their violated rights, is of great importance. However, it must be analyzed from several perspectives, that is, in relation to the nature of the proceeding, the claims, and the parties involved, while also taking into account that environmental rules may be breached, through action or omission, by either a private-law or public-law entity. The latter may do so simply by failing to exercise the required oversight over the conduct of private parties when they violate environmental rules, disregarding its functional authority, which requires it to exercise such oversight; or by directly violating, through its own actions, legal provisions intended to protect and conserve the environment.
In Judgment number 2233–93, this Chamber held that the preservation and protection of the environment is a fundamental right, thereby allowing standing to seek amparo relief. In environmental law, the procedural prerequisite of standing tends to be extended and broadened to such a degree that the traditional concept must necessarily be abandoned; it must instead be understood that, in general terms, every person may be a party and that such person’s right does not arise from property titles, specific rights, or causes of action that could be asserted under the rules of conventional law, but rather that the person’s participation in the proceeding reflects what modern legal scholars call a diffuse interest (interés difuso), through which the original standing of a person with a legitimate interest, or even of a merely interested person, is diffused among all members of a particular category of persons who are thus equally affected by the unlawful acts that infringe their rights.
With respect to environmental protection, the typically diffuse interest that gives a person standing to bring an action is transformed, by virtue of its incorporation into the body of human rights, into a true ‘right of response’ (derecho reaccional), which, as its name indicates, empowers its holder to ‘respond’ to a violation arising from unlawful acts or omissions. Accordingly, the infringement of that fundamental right constitutes constitutional unlawfulness, that is, a specific ground for amparo against concrete acts or self-executing rules (normas autoaplicativas), or, as applicable, for an action of unconstitutionality (acción de inconstitucionalidad) against all rules or acts not subject to amparo, and even against omissions. This latter category becomes especially important in the case of the right to the environment because, when the objective is to conserve the environment that nature has given us, the most frequent violation arises from the inertia of public authorities in carrying out the acts necessary to protect it.
Constitutional Jurisdiction, as the legally appropriate and necessary means of guaranteeing the supremacy of constitutional law, is not only supreme but also an essential matter of public policy; this generally means that much more flexible and less formalistic standing is necessary to associate citizens with the State governed by the rule of law’s own interest in overseeing and, where appropriate, restoring its own legality." That the problem described affects every level of human activity is, by now, evident, but it is worth emphasizing its special relationship with another Fundamental Right: the Right to Health. In this regard, the Chamber has stated:
"…Regarding the Right to Health. Our country’s Political Constitution does not expressly provide for the Right to Health, but it does protect human life, which it deems inviolable. Indeed, article twenty-one of our fundamental charter establishes fundamental protection of the Right to (human) Life by declaring that human life is inviolable. This clearly and unequivocally entails the right of every human being to enjoy a full life, which in turn entails the Fundamental requirement of enjoying Health, an indispensable and inseparable corollary and component of the Right to Life. Moreover, the aforementioned article twenty-one of the Political Constitution is closely related to the rule set forth in provision fifty of the constitutional text, which states as follows:
‘Article 50.- The State shall seek the greatest well-being of all the country’s inhabitants by organizing and promoting production and the most appropriate distribution of wealth.
Every person has the right to a healthy and ecologically balanced environment. Accordingly, every person has standing to report acts that infringe that right and to claim compensation for the damage caused.
The State shall guarantee, defend, and preserve that right. The law shall determine the corresponding liabilities and penalties.’ (Article amended by Ley No. 7412 de 24 de mayo de 1994, published in La Gaceta No. 111 de 10 de junio de 1994).
This provision establishes a system of guarantees which, in conjunction with the Fundamental Right to Life, seeks to fully realize and advance the constitutional aim that the life of every human being not only be respected but also enhanced in every respect. This means that our (sic) constituent authority clearly understood that, if the content of provision twenty-one of the Political Constitution were severed from the Fundamental Right to Health—not only in the physical sphere, but also in the psychological and spiritual spheres—the Right to Life would, in practice, amount to no more than a mere declaration of principles. In other words, it is evident that the constituent authority realized that the Right to Health is an inseparable aspect of the principle establishing the inviolability of life; it was precisely for this reason that the creation of a social insurance system was provided for, since such a system proved necessary to give concrete effect to the right of all inhabitants of the Republic to enjoy a genuine Right to Health…

Likewise, the unmistakable constitutional foundation of the Right to Health is supplemented by the International Covenant on Economic, Social and Cultural Rights, approved by Ley 4229 del once deciembre de mil novecientos sesenta y seis, which, in addition to forming part of the standard of constitutional review (parámetro de constitucionalidad), expressly provides for the Right to Health and governs it as follows:
‘Article 12 The States Parties to the present Covenant recognize the right of everyone to the enjoyment of the highest attainable standard of physical and mental health.
(...)’ This provision helps provide an even fuller interpretation of the constitutional rules, which—already in themselves—establish Health as a Fundamental Right. Given the importance of this issue, this Court has already issued extensive case law on the matter. Thus, the following has been stated:
‘VIII. With respect to the right to health, it is important to take advantage of the context presented by the case under review to clarify that, although our Political Constitution does not expressly provide for that right—although it does expressly regulate related matters classified as part of constitutional social rights, such as the right to social security—its existence cannot be denied, because it derives directly from the right to life protected under Article 21 of our Constitution, since the latter—the right to life—is the rationale and ultimate explanation for the right to health. The connection between the two is undeniable: the fundamental purpose of the right to health is to give effect to the right to life, because the latter protects not only a person’s biological existence, but also the other aspects arising from it. It is rightly said that the human being is the only being in nature whose conduct is teleological, because human beings live according to their ideas, purposes, and spiritual aspirations.
It is in this condition as cultural beings that the explanation lies for the necessary protection that, in a civilized world, must be afforded to their right to life in its fullest extent and, consequently, to a healthy life. If, as explained, the right to health or to health care is among the extensions of this right, it includes the State’s duty to guarantee the prevention and treatment of disease.’ (Voto 1915-92 of las catorce horas y doce minutos del veintidós de julio de mil novecientos noventa y dos).
As may readily be concluded from the foregoing, the Right to Health, which is developed in numerous legal texts, has as its essential characteristic the imposition of an obligation upon the State to endeavor to ensure that the population enjoys physical, mental, and even social well-being. Hence, legal doctrine classifies it as a Functional Right (Derecho Funcional), because it also entails ‘...the existence of specific obligations not only toward oneself, but also toward the family and the community.’ Accordingly, Ley General de Salud No. 5395 provides as follows:
‘Article 1.- The health of the population is a matter of public interest protected by the State.
Article 2.- It is an essential function of the State to safeguard the health of the population. The Executive Branch, through the Ministerio de Salud, which this law shall refer to in abbreviated form as the ‘Ministerio,’ is responsible for defining national health policy and for regulating, planning, and coordinating all public and private health-related activities, as well as carrying out those activities assigned to it by law. It shall have the authority to issue autonomous regulations governing these matters.’ From the provisions cited above (sic), it is concluded that there is a General Principle of Constitutional Law (Principio General del Derecho de la Constitución) requiring State entities to commit themselves actively to promoting the Health of the population—in all its manifestations. That obligation, of course, varies according to the sphere of authority held by each entity, body, or agency, but it is nevertheless generally applicable." (Judgment 2000–09051 of las diez horas con dieciocho minutos del trece de octubre de dos mil).
Compare this precedent with the ruling in decision number 6165-94 of las diecisiete horas doce minutos del diecinueve de octubre de mil novecientos noventa y cuatro:
"The term ‘natural beauty’ was the one used when the Constitution was enacted (7 de noviembre de 1949), and what it described has now developed into a specialized field of law: environmental law (derecho ambiental), which recognizes the need to preserve the environment not merely as a cultural end, but as a vital necessity for every human being. In this sense, the concept of a right to a healthy environment goes beyond recreational or cultural interests—which are also important aspects of life in society—and additionally constitutes an essential requirement for life itself. No rational result can come from denying our fragility as living beings dependent upon the environment for our subsistence and that of future generations.
XIV.From this second perspective on environmental matters, it becomes possible to endow classic individual rights with the conditions necessary for their full enjoyment and exercise, especially the right to life, which is particularly reinforced by Article 21 of our Constitution, declaring it inviolable. Thus, from the need for the full enjoyment of human rights arise rules directly derived from fundamental rules—understood as those already enshrined in the constitutional text—that operate as instrumental conditions for their preservation and exercise. Therefore, the conditions necessary to protect fundamental rights become true independent rights, enforceable separately from the former. They are genuine subconstitutional rules (normas subconstitucionales), as legal doctrine calls them, arising from a harmonious interpretation of constitutional law; one example is the genus-species relationship between freedom of commerce and freedom of contract, as developed by the Corte Plena, acting as a constitutional court, in the judgment of 26-8-82. The latter, as a consequence of the former, is an indispensable condition for its exercise, yet at the same time an autonomous right.
XV.We may therefore affirm that the right to life and the State’s obligation to ‘protect natural beauty,’ contained in Articles 21 and 89 of the Constitution, give rise to other rights of equal rank that must be protected, such as the rights to health and to a healthy environment, without which the former either could not be exercised or their enjoyment would be severely limited.
XVI.The right to Health, as a human right, was recognized by the Chamber in early judgments, such as No. 56-90, which declared that right inalienable, and judgment No. 1755-90, which stated:
‘In the present case, the right to Health is at stake, a fundamental human right—to the extent that life depends largely upon respect for it—such that, pursuant to Articles 10 and 48 of our Political Constitution and the Ley de la Jurisdicción Constitucional, the subject matter of this appeal... does indeed constitute a matter that this court is required to hear, insofar as it involves the alleged violation of a constitutional right...’ It is therefore clear that there is no longer any doubt concerning the constitutional protection of the right to health, which stems from the right to life and, through it, from a right to a healthy environment. By way of illustration, we may cite judgments 1580-90; 1833-91; 2362-91; 2728-91; 1297-92; 2233-93; 4894-93, which have recognized the rights to health and to a healthy environment as constitutionally protected individual rights." Thus, in summary, it may be said that every person has the right to a healthy and productive life in harmony with nature, and it is within this framework that the concept of the right to a healthy and ecologically balanced environment is situated.
On the one hand, the right to a healthy environment consists of the aspiration to improve the environment in which human beings live in every sphere in which they function, whether familial, occupational, or the physical surroundings they inhabit. In this sense, the concept goes beyond merely "recreational" or "cultural" interests because it constitutes an essential requirement for life itself. The right to an ecologically balanced environment, by contrast, is a narrower concept referring solely to the balance that must exist between society’s advancement and the conservation of natural resources. Not only are the two concepts not mutually exclusive, but they also complement and imply one another, to the point that they are generally treated as a single right. Accordingly, whether addressed jointly or separately, both are found to have the character of a cross-cutting right (derecho transversal).
This means that they extend throughout the entire legal system, shaping and reinterpreting its legal institutions. The right to a healthy and ecologically balanced environment is immediately applicable, manifesting itself both as an individual right (derecho subjetivo) held by persons and as a goal or purpose guiding the actions of public authorities generally. Environmental quality is a fundamental measure of quality of life, but it is not the only one: other equally important measures include health, food, work, housing, education, and so forth. In this regard, it should be added that it is now generally accepted that the right to health enjoys constitutional protection, stemming from the right to life and, through it, from a right to a healthy environment; this is because the Right to Health constitutes an inseparable aspect of the principle establishing the inviolability of life. Indeed, like the Right to a Healthy and Ecologically Balanced Environment, the essential characteristic of the Right to Health is that it imposes an obligation upon the State, although that obligation consists of endeavoring to ensure that the population enjoys physical, mental, and even social well-being.
For that reason, legal doctrine classifies it as a Functional Right, since it entails specific obligations not only toward oneself, but also toward the family and the community. Since both Rights—to some extent—also imply one another, it is not difficult to understand that both must strongly guide State action. It must be understood that there is a General Principle of Constitutional Law, derived from the Right to Life, requiring State entities to commit themselves actively, on the one hand, to promoting the Health of the population—in all its manifestations—and, on the other, to protecting the environment. That obligation, of course, varies according to the sphere of authority held by each entity, body, or agency, but it is nevertheless generally applicable. However, laws—by themselves—have thus far proved clearly insufficient to guarantee the conservation of natural resources and ensure future sustainable development.
It is therefore essential that legal rules have not only technical support, but also that individual and collective responsibility actually be assumed for complying with those rules at the various applicable levels and before the appropriate authorities. A violation of environmental rules may be caused, through action or omission, by either a private-law entity or a public-law entity. The latter may do so simply by failing to exercise proper oversight over the conduct of private parties when they violate environmental rules, thereby disregarding its functional authority, which requires it to exercise such oversight. For that very reason, if the Administration fails to carry out its protective and supervisory duties, an individual may seek relief through an amparo proceeding (vía del amparo).
V.On the Right to Health, to a Healthy and Ecologically Balanced Environment, and the Duties of the Constitutional Jurisdiction (Jurisdicción Constitucional): the “pro homine” and “pro libertatis” principles. In this context, it is necessary to recall that the ultimate purpose of constitutional interpretation (interpretación constitucional) is to enhance the practical operation of the constitutional order (ordenamiento constitucional), which—as has been stated—entails maximizing the normative force of the Constitution and interpreting the entire legal system (including the law governing this jurisdiction) consistently with the Constitution itself. At another level, namely, when examining a specific case in order to resolve it, this purpose translates into choosing, from among all possible answers, the option that is most correct from a constitutional perspective. As applied to the specific case, the correct constitutional interpretation must strengthen, to the greatest extent possible, the operation of the values, rules, and principles inherent in the constitutional standard of review (parámetro de constitucionalidad).
In this endeavor, the pro homine and pro libertatis principles constitute the indisputable guide for constitutional interpretation. The pro homine principle holds that the law must always be interpreted and applied in the manner most favorable to the human person. Thus, it has been stated that “…the system of liberty guaranteed by fundamental rights (derechos fundamentales) places beyond the reach of State action, whether through legislation, administrative activity, or the courts of justice, an inviolable sphere of liberty that no authority may encroach upon, because it is the human person, not society, who possesses dignity and the consequent fundamental rights and freedoms.” Indeed, the human person is the ultimate purpose of legal rules, and not merely their intended recipient; accordingly, those rules—and especially those enshrining fundamental rights—must be interpreted in the manner most favorable to the human person.
The pro libertatis principle, for its part, prescribes that fundamental rights must be interpreted as broadly as possible. Consequently, everything that maximizes individual liberty must be interpreted expansively, and everything that limits it must be interpreted narrowly. Hence, in cases of doubt, the liberty clause must always be favored, since fundamental rights were specifically enshrined to protect liberty rather than to limit it. Accordingly, with respect to the issue presented, the task of this Chamber is to determine, first, whether CATSA’s activity may be regarded, at least potentially, as dangerous to health, the environment, and therefore the quality of life enjoyed by the residents of Paso Tempisque, Palmira, Los Jocotes and the Filadelfia area, with the understanding that, in cases of doubt, the interpretation most favorable to the population’s Fundamental Rights must be adopted, in accordance with the pro homine and pro libertatis principles.
Second, the Chamber must ascertain whether the various State institutions have diligently undertaken—within the scope of their authority—to ensure that residents enjoy a healthy, ecologically balanced environment that does not, therefore, harm their health.
VI.On the Foul Odors Emitted by the Sugarcane-Washing Sedimentation Lagoon. The complainants object that the foul odors produced by the lagoon in question make life, in their words, “unbearable” for the residents of Paso Tempisque, Palmira, Los Jocotes and the entire area near Filadelfia de Carrillo in Guanacaste. In this regard, although the Chamber acknowledges that water-treatment systems have been built—which have not produced the desired results—and that, for this reason, it has been proposed that the washing of sugarcane cease in order to eliminate the problem entirely, the fact remains that, as Messrs. Pardo and LaVergne acknowledge, the foul odors persist. If one also considers that, in the meantime, the region’s residents must live under such conditions, it follows that their right to enjoy a healthy environment, encompassing every sphere in which a person lives and develops, is being irreparably violated.
VII.On the Right to Health, to a Healthy and Ecologically Balanced Environment, and Environmental Pollution: The Issue Raised by the Burning of Sugarcane Fields. The petitioners (recurrentes) assert that CATSA’s burning of sugarcane fields over an area of five thousand hectares to facilitate harvesting produces soot, causes the death of wild animals, and has “harmful effects on public health.” In this regard, the Health and Environment and Energy authorities, despite having been duly directed in the orders serving notice of this amparo proceeding (amparo), have remained completely silent, failing to make any reference whatsoever to the alleged harmful effects of fire and smoke on human health and local wildlife. The General Manager of Central Azucarera Tempisque S.A., by contrast, disputes those assertions and contends that these burns are actually beneficial to the environment because the sugarcane agroindustry “assists in the carbon dioxide sequestration process” (see folio 19, sixth section). Regarding environmental pollution, the Chamber has stated:
“III) – Pollution, which specifically concerns the challenge brought by the minor petitioner, may be understood as the presence in the environment of one or more pollutants, or a combination thereof, at concentrations and for periods of time such that they cause environmental conditions harmful to human life, health or well-being, flora or fauna, or substantially degrade the habitat of living beings, the air, water, soil, landscapes, or natural resources in general. To pollute is to introduce foreign substances or elements into the environment at levels and for periods of time that cause pollution in the sense described above. Conversely, to decontaminate is to reduce the concentration of pollutants present in the environment to levels deemed acceptable under the specific environmental-quality standards.
A pollution-free environment is therefore the condition of our surroundings when alterations caused by both human beings and nature, whether in the immediate or distant environment, do not exceed the maximum permissible levels established by those standards.
(…)
…Soil, water, air, marine and coastal resources, forests, biological diversity, mineral resources, and the landscape constitute the environmental framework without which basic needs—such as living space, food, energy, housing, sanitation, and recreation—could not be met. Likewise, our economy is also closely linked to the condition of the environment and natural resources; thus, for example, both the generation of foreign currency through agricultural activity and tourism and the success of major infrastructure investments ultimately depend on their conservation. The goals of sustainable development concern the survival and well-being of human beings and the maintenance of essential ecological processes—that is, environmental quality and the survival of other species. To speak of sustainable development in terms of satisfying present and future human needs and improving quality of life is to speak of the demand for natural resources at the individual level and of the direct or supporting means required for the economy to function by generating employment and creating capital goods, which in turn make it possible to transform resources into consumer, production, and export goods.
Every production process requires resources to be transformed and processed and, in turn, transported to consumption centers, all of which entails energy and environmental costs. Moreover, the production process not only requires natural resources in order to continue operating, but also generates waste and pollution of many different kinds, such as solid waste or emissions that pollute the air or water. It is evident that human beings, through their technological power, have succeeded in controlling and significantly altering their surroundings and have subjected other species to their dominion. However, since the Industrial Revolution—and at a significantly faster rate since the Second World War—the exponential growth of the population and the likewise exponential trends of the economy have increased the level of human intervention on the planet, destroying habitats, altering and polluting the environment’s life cycles, and exterminating living species. The accelerated deterioration of the environment in recent decades, the enormous costs of corrective measures, which are not always effective, and the time required, for example, to restore a watershed, a cleared natural forest, or a contaminated underground aquifer, are unmistakable signs of the abuse of natural resources and the negative impact of the human species on a finite world.
(…)
Human life is possible only in solidarity with the nature that sustains and supports us, not only by providing physical nourishment but also by promoting psychological well-being: this constitutes the right of all citizens to live in a pollution-free environment, which is the foundation of a just and productive society. Thus, Article 21 of the Political Constitution states: Human life is inviolable. It is undeniably from this constitutional principle that the right to health and to physical, mental, and social well-being arises—a human right inextricably linked to the right to health and to the State’s obligation to protect human life.
Likewise, from a psychological and intellectual standpoint, a person’s state of mind also depends on nature; therefore, because the landscape also becomes a useful space for rest and leisure, its preservation and conservation are mandatory. This latter aspect is protected by Article 89 of the Constitution, which literally states: Among the cultural purposes of the Republic are: to protect natural beauty, preserve and develop the Nation’s historical and artistic heritage, and support private initiative for scientific and artistic progress. Protecting nature from an aesthetic standpoint does not mean commercializing it or turning it into merchandise; it means educating citizens so that they learn to appreciate the aesthetic landscape for its intrinsic value.” (Judgment number 3705–93, issued at fifteen hours on treinta de julio de mil novecientos noventa y tres).
Furthermore, specific pollution problems, like the vast majority of environmental matters, pose serious challenges for State entities because they generally must be addressed from an interdisciplinary perspective. A single situation can often be approached from the perspective of public health, agriculture, industry, and so forth, and from disciplines as diverse as ecology, chemistry, oceanography, anthropology, and engineering. The fragmentation caused by all these possible perspectives creates a risk that policies affecting environmental disputes may be undermined by excessive “sectorization” of their objectives. The various public entities may fall victim to a narrow, partial, and uncoordinated view of matters that concern the entire community, when they should instead present a united front in addressing them. In practice, it is not unusual for problems of this kind to be completely disregarded by the machinery of the State, because the entities involved, rather than recognizing that there are constitutional purposes, principles, and values governing all State activity, merely interpret their own organic laws or regulations as restrictively as possible in order to minimize their involvement.
This attitude, indeed, is clearly apparent in the record. It is common knowledge that the burning (quemas) carried out in connection with sugarcane cultivation produces plant debris, ash, and haze capable of affecting human health, since they may cause irritation of the respiratory tract and eye conditions such as conjunctivitis. In addition, fires in agricultural activities are one source of the carbon dioxide that now accumulates in the Earth’s atmosphere and, it is claimed, could be responsible for the notorious “greenhouse effect” affecting the entire world. Article 2 of Law 7152, “Ley de Conversión del Ministerio de Industria, Energía y Minas en Ministerio de Recursos Naturales, Energía y Minas,” specifies that the responsibilities of that ministry are:
“(…)
To formulate, plan, and implement the Government of the Republic’s policies on natural resources, energy, mining, and environmental protection, as well as to direct, control, supervise, promote, and develop the aforementioned fields. It shall also conduct and supervise research, technical exploration, and economic studies concerning the sector’s resources.
To promote the development of natural, energy, and mineral resources.
To promote and administer legislation concerning the conservation and rational use of natural resources in order to achieve their sustainable development, and to ensure compliance therewith.
ch) To issue, by executive decree, mandatory rules and regulations concerning the rational use and protection of natural resources, energy, and mines.
(…)” It follows that, although authorization for burning is governed by Decreto 23850-MAG-SP, if such burning affects—or could affect—the environment, MINAE is required to intervene in some manner, even if only by coordinating efforts with other entities, such as MAG or Ministerio de Salud. In addition, the need for Ministerio de Salud—always within the scope of its powers—to address the smoke problem is urgent, given the potentially harmful nature of the aforementioned waste. As for Ministerio de Agricultura y Ganadería, it bears recalling that section 48.e) of its Organic Law provides that its function is: “To participate, jointly with other institutions in the Sector, in identifying the need to construct and maintain infrastructure appropriate for agricultural development and renewable natural resources.” Notwithstanding the foregoing, the heads of the first two ministries insist in their reports that matters relating to burning fall within the exclusive jurisdiction of Ministerio de Agricultura y Ganadería.
For the reasons already stated, this is only a half-truth. In fact, the logical course in this case would have been for the three authorities, concerned with ensuring that the residents of Paso Tempisque, Palmira, Los Jocotes, and the entire area surrounding Filadelfia de Carrillo were guaranteed their right to health and to a healthy and ecologically balanced environment, to conduct investigations to determine whether harm was being caused to health and/or the environment, the extent of that harm, and whether the situation described warranted the adoption of special measures of some kind. In this context, the actions of MAG deserve particular mention. The Ministro de Agricultura y Ganadería states that Decreto N° 23850-MAG-SP, “Reglamento para Quemas Controladas con fines Agrícolas y Pecuarios,” provides that authorization for burning on agricultural and livestock land must be granted by the offices of Ministerio de Agricultura y Ganadería, but that this regulation gives MAG no sanctioning authority to enforce its application because Articles 9 and 10 refer to the relevant provisions of the Criminal Code. Such excuses are entirely unacceptable. Articles 113 and 114 of the General Law of Public Administration clearly provide as follows:
“Article 113.- 1. A public servant shall perform their duties in a manner that primarily serves the public interest, which shall be regarded as the expression of the coinciding individual interests of the governed.
2. The public interest shall prevail over the interest of the Public Administration whenever the two may conflict.
3. In assessing the public interest, primary consideration shall be given to the values of legal certainty and justice for the community and the individual, which may under no circumstances be subordinated to mere expediency.
Article 114.- 1. A public servant shall be a servant of the governed in general and, in particular, of each individual or governed person with whom the servant interacts by virtue of the duties performed; in each individual case, every governed person shall be regarded as a representative of the community upon which the official depends and whose interests the official must safeguard.
2. Without prejudice to any provisions established for public servants by other laws, any act, event, or omission that, through fault or negligence, creates unjustified or arbitrary impediments or obstacles for the governed shall, in particular, be deemed an improper performance of their duties.” Consistent with the spirit underlying those articles, the Code of Criminal Procedure imposes the following obligation:
“Article 281.- Duty to report The following shall be required to report offenses prosecutable ex officio:
(…)
(…)” Accordingly, if MAG personnel were aware that CATSA had not requested authorization to burn its sugarcane fields since nineteen ninety-five, they should have acted diligently in accordance with the law. But the matter does not end there. Section eleven of Decreto N° 23850-MAG-SP suggests that one of the guiding principles of the entire Reglamento is that the problem of fires should be addressed comprehensively. Thus, although the legal rule does not expressly state so, a proper reading of its provisions in light of the principles set forth in the preceding recitals (considerandos) can lead only to the conclusion that, if MAG officials became aware that the controlled fires conducted by CATSA could affect the environment and the health of local residents, they were required to notify and, where appropriate, coordinate efforts with other State agencies, such as Ministerio de Salud and MINAE, to determine the seriousness of these events so that solutions could be adopted within the framework of a joint strategy; all of which would have made it possible to go beyond the scope of MAG’s powers.
Nevertheless, despite knowing that the activity in question could be disturbing nearby communities (see folio 163 § 3), those officials did nothing about it. Such conduct violates the constitutional principles protecting human life and health and constitutes a flagrant breach of the duties inherent in public office. The Sala Constitucional is a judicial rather than a technical body and therefore cannot determine whether, in CATSA’s specific case, the practice of burning on its properties actually produces the harmful effects mentioned in the preceding recital. However, the case file contains numerous indications strongly pointing in that direction, namely: the filing of this appeal itself, the complaints submitted by residents to MINAE and included in the case file, and the reporting parties’ implicit acknowledgment that some type of problem exists in connection with this practice. It is telling, for example, that the company’s own manager acknowledges that there is currently “…a trend in all sugarcane-growing areas toward eliminating the burning of sugarcane fields through the use of suitable varieties (greater natural leaf shedding), so that they can be harvested with combine harvesters…” and that, during the latest harvest season, CATSA harvested approximately ten percent of the land it owns using that technique (folio 19). This clearly should have provided an impetus for intervention by the Administration.
VIII.On the Principle of Prudence (Principio de Prudencia). Consequently, in observance of the pro homine principle (principio pro homine), the Chamber (Sala) considers that merely acknowledging the situation and, even so, doing nothing about it because CATSA and the Ministerio de Salud have shown good faith, particularly with regard to eliminating the foul odors caused by the sedimentation lagoon (laguna de sedimentación), would be irresponsible, considering that the matter as a whole appears to constitute a serious problem concerning the Fundamental Rights (Derechos Fundamentales) of the residents of neighboring settlements. However, at this point, it should be noted that the petitioners’ (recurrentes) request that the plant of the respondent company (compañía recurrida) be closed appears excessive to this Court, especially considering that the agricultural activity carried out by CATSA invigorates the region’s economy.
Indeed, a principle of paramount importance in the task of interpreting and applying Constitutional Law (Derecho Constitucional) is to act prudently. The Judge, as interpreter of the Constitution, must not lose sight of the consequences of the Judge’s interpretations. In legal scholarship, this is known as the “Principle of Prudence,” and it has been extensively developed in the case law of the Supreme Court of the United States, which has held that the Constitution “is not a suicide pact” but, rather, an instrument that makes social coexistence possible. This means that, in order to preserve the continued validity of that instrument, every constitutional interpretation must tend to allow society to survive and prosper. Returning to the present case, the Chamber considers that the aforementioned principle does not permit it to validate a measure of such magnitude as closing the sugar mill, particularly considering that the respondents (recurridos) themselves have made efforts to eliminate the reported problem.
Furthermore, this Court is not an integral part of the active Administration (Administración activa) of the Republic either, and therefore it is not for this Court to assume the assessment duties belonging to the Ministerio de Salud or any other administrative body, such as declaring that CATSA’s large-scale burning of sugarcane fields is harmful to health and, worse still, deciding what measure should be implemented to put an end to the problem, weighing technical, economic, and political matters that exceed the nature of the judicial function (función jurisdiccional). In this regard, the Chamber considers that the principal problem revealed in the case file (expediente) is the absolute lack of coordination among the respondent Ministries in addressing and reasonably resolving the environmental problems described. The State is obligated to provide the protection necessary for all individuals to enjoy an environment free from pollution.
Based on the foregoing considerations, the appropriate solution, following a proper harmonization of the aforementioned principles, is to order all these State agencies to provide a reasonable solution to the problems described within a specified period.
Por tanto:
The constitutional amparo action (recurso) is GRANTED. The persons holding the offices of MINISTRO DE SALUD, MINISTRO DE AMBIENTE Y ENERGIA Y MINISTRO DE AGRICULTURA Y GANADERIA, and EDGAR ALEJANDRO PONCIANO LAVERGNE, in his capacity as General Manager of CENTRAL AZUCARERA TEMPISQUE S.A., or whoever serves in his position, are ORDERED, UNDER PENALTY OF DISOBEDIENCE, within the non-extendable period of TEN MONTHS from notification of this judgment, to jointly prepare and implement a plan that reasonably resolves the problems alleged by the petitioners. The STATE is ordered to pay the legal costs, damages, and losses caused by the facts underlying this ruling, which shall be quantified during enforcement of the judgment before the contentious-administrative jurisdiction (jurisdicción de lo contencioso administrativo). The respondents are advised that, pursuant to Article 71 of the Law governing this jurisdiction, any person who receives an order issued in an amparo action that the person must comply with or cause to be complied with, and who fails to comply with it or cause it to be complied with, shall be subject to imprisonment for three months to two years, or a fine of twenty to sixty day-fines, provided that the offense is not punishable by a more severe penalty.
This decision shall be served PERSONALLY upon Mr. LAVERGNE, or whoever holds that position in his place, and upon the MINISTROS DE SALUD, AMBIENTE Y ENERGIA Y AGRICULTURA Y GANADERIA.– Luis Fernando Solano C.

Resultando:
Redacta el magistrado Sancho González; y,
Considerando:
I.Objeto del recurso. Los recurrentes consideran que la empresa CATSA opera en condiciones que resultan insoportables para quienes habitan en las inmediaciones de la zona cercana a Filadelfia de Carrillo, porque genera malos olores durante la temporada de zafra, prohija la reproducción de zancudos y quema sus cañales –que abarcan un área de cinco mil hectáreas de terreno– para facilitar su cosecha, lo que genera hollín, la muerte de animales silvestres y provoca "efectos nocivos para la salud pública" (folio 02). Asimismo, se quejan de que las entidades del Estado no hacen nada para solucionar el problema.
II.Hechos que se estiman probados. De importancia para la decisión de este asunto, se estiman como demostrados los siguientes hechos, en parte porque así han sido acreditados en autos, pero también, especialmente, porque las autoridades recurridas y el representante de CATSA han omitido referirse a ellos según lo prevenido en el auto inicial:
Que la empresa CATSA ha realizado una serie de obras y mejoras a sus instalaciones, que comprenden la instalación de filtros ("scrubbers") en las calderas de su ingenio, silenciadores y atenuadores de contaminación sónica, trampas y separadoras de grasas y aceites contenidas en las aguas de enfriamiento del equipo de molienda de caña, separadores de ceniza y la construcción de una laguna o canal de sedimentación y oxidación para depurar el levado de caña, entre otras (folios 12 a 18 y 126 y siguientes).
Que, además, según informa el Ministerio de Salud, el ingenio de CATSA cuenta, a la fecha, con los siguientes sistemas debidamente aprobados: 1) Sistema de Tratamiento de Cenizas, aprobado el proyecto mediante plano N° 214-23 con DECAP-99-97 el tres de mayo de mil novecientos noventa y siete. 2) Equipo de Control de Emisiones Atmosféricas, aprobado con DECAP1OO-97 del tres de mayo de mil novecientos noventa y siete. 3) Sistema de Tratamiento de Aguas Residuales, Plano N°05-01-97 (2000) aprobado el seis de enero del dos mil por el Ing. Marcello De Simone C., funcionario del Proceso Permisos de Ubicación y Construcción. 4) Este ingenio utiliza las aguas de lavado de la caña de azúcar para riego, previo tratamiento (sedimentación y laguna anaeróbica). 5) Las vinazas, previo tratamiento mediante lagunas anaeróbicas, se utilizan para el riego de los cañales. Para ello dicha empresa presentó, en el año de mil novecientos noventa y cinco, en la Dirección de Protección al Ambiente Humano de ese Ministerio, un "Proyecto de aplicación de vinaza–Fertirriego" (folios 126 y 127) En el año mil novecientos noventa y nueve, la empresa presentó nueva "propuesta para el manejo de la vinaza como fertilizante"; con el fin de eliminar las descargas controladas al Río Tempisque (folio 127).
Que en vista de que dicho ingenio ha cumplido con todas las especificaciones pedidas por el Ministerio de Salud, mediante oficio UPC-PSF-18 96-99 UAC5083-99 del diecinueve de diciembre de mil novecientos noventa y nueve, suscrito por el Ing. Eugenio Androvetto Villalobos, se le informó al Licenciado Gonzalo Cubero Brealey, Representante Legal de Central Azucarera Tempisque, sobre el otorgamiento del Permiso Sanitario de Funcionamiento a la industria citada, que corresponde al número 217-99 y debe ser renovado el día trece de diciembre del dos mil cuatro (folio 127).
Que en oficio AJ–018–2002 que corre agregado a folio 129 y siguientes del expediente, se afirma lo siguiente: "…es cierto que en tiempos de Zafra, de las lagunas de oxidación de dicha empresa (CATSA) se generan olores que se perciben a distancia considerable de su ubicación; lo cual afecta a otras comunidades cercanas como es el caso de Paso Tempisque, Palmira, Los Jocotes." (Ver folio 129).
Que el Ministro de Salud y el representante de CATSA admiten que el problema de los malos olores creado por las lagunas de oxidación de la empresa es cierto (folios 18 y 127), aunque ambos alegan que se han hecho ingentes esfuerzos para solucionar el problema.
Que, de hecho, los vecinos del Ingenio presentaron una denuncia por los malos olores generados por la laguna de oxidación (ver oficio RCH–ORSA 082–2001, folio 132).
Que la empresa CATSA efectivamente quema la mayoría de sus cañales –aproximadamente cinco mil hectáreas de tierra. Lo anterior se desprende de las afirmaciones contenidas en el líbelo de interposición, los informes de los Jerarcas del MAG y del MINAE, y la velada admisión del representante de la empresa recurrida (folios 19, 148 y 163).
Que no obstante lo anterior, esa compañía no ha solicitado un permiso para realizar tal actividad desde diciembre de mil novecientos noventa y cinco (folio 148, 149 y 163).
Que la actividad de CATSA incremente la proliferación de mosquitos en el área afectada.
IV.Acerca del derecho de los recurrentes a un ambiente sano y ecológicamente equilibrado. Este Tribunal se ha pronunciado reiteradamente sobre la naturaleza constitucional de los derechos a gozar de un medio ambiente sano y ecológicamente equilibrado que ostentan los pobladores nuestro país; materias que, por consiguiente, se ubican en el ámbito propio de los Derechos Fundamentales. Así por ejemplo, en sentencia N° 00644–99 de las once horas veinticuatro minutos del veintinueve de enero de mil novecientos noventa y nueve, la Sala indicó:
"III.– Sobre el derecho. El artículo 50 de la Constitución Política establece que toda persona tiene derecho a un ambiente sano y ecológicamente equilibrado. El derecho a un ambiente sano tiene un contenido amplio que equivale a la aspiración de mejorar el entorno de vida del ser humano, de manera que desborda los criterios de conservación natural para ubicarse dentro de toda esfera en la que se desarrolle la persona, sea la familiar, la laboral o la del medio en el cual habita. De ahí que se afirme que se trata de un derecho transversal, es decir, que se desplaza a todo lo largo del ordenamiento jurídico, modelando y reinterpretando sus institutos. El ambiente es definido por la Real Academia Española de la Lengua como el ‘conjunto de circunstancias físicas que rodean a los seres vivos’, lo que recalca aún más el carácter general del derecho. En cambio el derecho a un ambiente ecológicamente equilibrado es un concepto más restringido referido a una parte importante de ese entorno en el que se desarrolla el ser humano, al equilibrio que debe existir entre el avance de la sociedad y la conservación de los recursos naturales.
Ambos derechos se encuentran reconocidos expresamente en el artículo 50 de la Constitución Política, que perfila el Estado Social de Derecho. La ubicación del derecho a un ambiente sano y ecológicamente equilibrado dentro de las regulaciones constitucionales del Estado Social de Derecho es el punto a partir del cual debe éste ser analizado. El Estado Social de Derecho produce el fenómeno de incorporación al texto fundamental de una serie de objetivos políticos de gran relevancia social y de la introducción de un importante número de derechos sociales que aseguran el bien común y la satisfacción de las necesidades elementales de las personas. En esta perspectiva, la Constitución Política enfatiza que la protección de los recursos naturales es un medio adecuado para tutelar y mejorar la calidad de vida de todos, lo que hace necesaria la intervención de los poderes públicos sobre los factores que pueden alterar el equilibrio de los recursos naturales y, más ampliamente, obstaculizar que la persona se desarrolle y desenvuelva en un ambiente sano.
De igual forma que el principio del Estado Social de Derecho es de aplicación inmediata, el derecho a un ambiente sano y ecológicamente equilibrado también lo es, de manera que se manifiesta en la doble vertiente de derecho subjetivo de las personas y configuración como meta o fin de la acción de los poderes públicos en general. La incidencia que tiene el derecho a un ambiente sano y ecológicamente equilibrado dentro de la actividad del Estado… encuentra su primera razón de ser en que por definición los derechos no se limitan a la esfera privada de los individuos sino que tienen asimismo trascendencia en la propia estructura del Estado en su papel de garante de los mismos y, en segundo término, porque la actividad del Estado se dirige hacia la satisfacción de los intereses de la colectividad. La Constitución Política establece que el Estado debe garantizar, defender y preservar ese derecho.
Prima facie garantizar es asegurar y proteger el derecho contra algún riesgo o necesidad, defender es vedar, prohibir e impedir toda actividad que atente contra el derecho, y preservar es una acción dirigida a poner a cubierto anticipadamente el derecho de posibles peligros a efectos de hacerlo perdurar para futuras generaciones. El Estado debe asumir un doble comportamiento de hacer y de no hacer; por un lado debe abstenerse de atentar él mismo contra el derecho a contar con un ambiente sano y ecológicamente equilibrado, y por otro lado, debe asumir la tarea de dictar las medidas que permitan cumplir con los requerimientos constitucionales." Y también:
"Toda la vida del hombre ocurre en relación inevitable con su ambiente, en especial con el mejoramiento de la calidad de vida que es el objetivo central que el desarrollo necesita, pero éste debe estar en relación con el ambiente de modo tal que sea armónico y sustentable.
El ambiente, por lo tanto, debe ser entendido como un potencial de desarrollo para utilizarlo adecuadamente, debiendo actuarse de modo integrado en sus relaciones naturales, socioculturales, tecnológicas y de orden político, ya que, en caso contrario, se degrada su productividad para el presente y el futuro y podría ponerse en riesgo el patrimonio de las generaciones venideras. Los orígenes de los problemas ambientales son complejos y corresponden a una articulación de procesos naturales y sociales en el marco del estilo de desarrollo socioeconómico que adopte el país. Por ejemplo, se producen problemas ambientales cuando las modalidades de explotación de los recursos naturales dan lugar a una degradación de los ecosistemas superior a su capacidad de regeneración, lo que conduce a que amplios sectores de la población resulten perjudicados y se genere un alto costo ambiental y social que redunda en un deterioro de la calidad de vida; pues precisamente el objetivo primordial del uso y protección del ambiente es obtener un desarrollo y evolución favorable al ser humano.
La calidad ambiental es un parámetro fundamental de esa calidad de vida; otros parámetros no menos importantes son salud, alimentación, trabajo, vivienda, educación, etc., pero más importante que ello es entender que si bien el hombre tiene el derecho de hacer uso del ambiente para su propio desarrollo, también tiene el deber de protegerlo y preservarlo para el uso de las generaciones presentes y futuras, lo cual no es tan novedoso, porque no es más que la traducción a esta materia, del principio de la ‘lesión’, ya consolidado en el derecho común, en virtud del cual el legítimo ejercicio de un derecho tiene dos límites esenciales: Por un lado, los iguales derechos de los demás y, por el otro, el ejercicio racional y el disfrute útil del derecho mismo.

Hablar de desarrollo sostenible en términos de satisfacción de las necesidades humanas presentes y futuras y del mejoramiento de la calidad de vida es hablar de la demanda de los recursos naturales a nivel individual y de los medios directos o de apoyo necesarios para que la economía funcione generando empleo y creando los bienes de capital, que a su vez hagan posible la transformación de los recursos en productos de consumo, de producción y de exportación.
(…)
No puede dejar de hacerse referencia a la reunión convocada en julio de 1992 en Brasil, denominada Cumbre de la Tierra, en la cual se proclamó y reconoció la naturaleza integral e independiente del planeta. Dicha declaración significa la aceptación de ciertos principios que informan la transición de los actuales estilos de desarrollo a la sustentabilidad. Los Estados signatarios, entre los que figura Costa Rica, se comprometieron, dentro de la preservación del desarrollo sostenible, a la protección sobre todo del ser humano. Se partió del principio de que toda persona tiene derecho a una vida saludable y productiva en armonía con la naturaleza; se incluyó el derecho de las generaciones presentes y futuras a que el desarrollo se realice de modo tal que satisfaga sus necesidades ambientales y de progreso; se mantuvo la potestad soberana de los Estados de explotar sus recursos, recalcando su responsabilidad de asegurar que las actividades que realicen dentro de su jurisdicción y control no causen daños ambientales a otros Estados o areás (sic) más allá de los límites de su jurisdicción nacional.
Establecieron el deber de los Estados de cooperar en la conservación, protección y restauración del ambiente y sus responsabilidades comunes en ese sentido; de ese modo la cooperación internacional en la promoción y apoyo del crecimiento económico y el desarrollo sostenible permitirá abordar mejor los problemas de la degradación ambiental. Asimismo, se impuso un deber especial a los países desarrollados fundado en su responsabilidad en la búsqueda del desarrollo sostenible, dada la evidente presión que ejercen en el ambiente global las tecnologías que desarrollan y los recursos financieros que poseen." (Sentencia número 3705–93 de las quince horas del treinta de julio de mil novecientos noventa y tres).
La naturaleza transversal de los Derechos Fundamentales que se analizan, por cierto, tiene importantes repercusiones en el ámbito propio de la legitimación para acudir a la vía del amparo, y esta cuestión no ha pasado inadvertida para la Sala, que expuso claramente sus consecuencias en sentencias como la número 3705–93 de las quince horas del treinta de julio de mil novecientos noventa y cuatro que, en lo conducente, expresa:
"Tratándose de la protección jurídica del ambiente, la legitimación de los particulares para actuar judicialmente y lograr la aplicación de las normas que tienen esa finalidad o bien, solicitar la tutela jurisdiccional para amparar sus derechos violados, es de gran importancia. Pero debe analizarse desde varios puntos de vista, es decir, en relación con la naturaleza del proceso, las pretensiones y las partes intervinientes y, también tomando en cuenta que el quebranto de las normas ambientales puede provocarlo con su actuación u omisión tanto un sujeto de derecho privado como de derecho público. Este último, simplemente omitiendo ejercer el control debido sobre la actuación de los sujetos privados, cuando infringen las normas ambientales, ignorando su competencia funcional, que le exige ejercer ese control; o bien, infringiendo directamente con su actuación disposiciones jurídicas destinadas a proteger y conservar el ambiente.
Esta Sala en Sentencia número 2233–93 al señalar que la preservación y protección del ambiente es un derecho fundamental, da cabida a la legitimación para acudir a la vía de amparo. En el derecho ambiental, el presupuesto procesal de la legitimación tiende a extenderse y ampliarse en una dimensión tal, que lleva necesariamente al abandono del concepto tradicional, debiendo entender que en términos generales, toda persona puede ser parte y que su derecho no emana de títulos de propiedad, derechos o acciones concretas que pudiera ejercer según las reglas del derecho convencional, sino que su actuación procesal responde a lo que los modernos tratadistas denominan el interés difuso, mediante el cual la legitimación original del interesado legítimo o aún del simple interesado, se difunde entre todos los miembros de una determinada categoría de personas que resultan así igualmente afectadas por los actos ilegales que los vulneran.
Tratándose de la protección del ambiente, el interés típicamente difuso que legitima al sujeto para accionar, se transforma, en virtud de su incorporación al elenco de los derechos de la persona humana, convirtiéndose en un verdadero ‘derecho reaccional’, que, como su nombre lo indica, lo que hace es apoderar a su titular para ‘reaccionar’ frente a la violación originada en actos u omisiones ilegítimos. Es por ello que la vulneración de ese derecho fundamental, constituye una ilegalidad constitucional, es decir, una causal específica de amparo contra los actos concretos o normas autoaplicativas o, en su caso, en la acción de inconstitucionalidad contra todas las normas o contra los actos no susceptibles de amparo, e incluso, contra las omisiones, categoría ésta que en el caso del derecho al ambiente se vuelve especialmente importante, porque al tratarse de conservar el medio que la naturaleza nos ha dado, la violación más frecuente se produce por la inercia de las autoridades públicas en realizar los actos necesarios para protegerlos.
La Jurisdicción Constitucional, como medio jurídicamente idóneo y necesario para garantizar la supremacía del derecho de la Constitución es, además de supremo, de orden público esencial, y ello implica, en general, que una legitimación mucho más flexible y menos formalista, es necesaria para asociar a los ciudadanos al interés del propio Estado de Derecho de fiscalizar y, en su caso, restablecer su propia juridicidad." Que la problemática expuesta incida en todos los niveles del quehacer humano, a estas alturas, resulta evidente, pero vale la pena destacar la especial relación que guarda con otro Derecho Fundamental: el Derecho a la Salud. A este respecto, a dicho la Sala:
"…Sobre el Derecho a la Salud. La Constitución Política de nuestro país no contempla expresamente el Derecho a la Salud, pero sí tutela la vida humana, que reputa como inviolable. En efecto, el artículo veintiuno de nuestra carta fundamental establece una tutela fundamental del Derecho a la Vida (humana) al expresar que la vida humana es inviolable. Esto conlleva clara e inequívocamente el derecho de todo ser humano a disfrutar de una vida plena, lo cual entraña a su vez exigencia Fundamental a gozar de la Salud, que resulta ser un corolario y componente indispensable e inescindible del Derecho a la Vida. El referido artículo veintiuno de la Constitución Política, por otra parte, guarda una relación muy cercana con la norma prevista en el ordinal cincuenta del texto constitucional, que dispone lo siguiente:
‘Artículo 50.- El Estado procurará el mayor bienestar a todos los habitantes del país, organizando y estimulando la producción y el más adecuado reparto de la riqueza.
Toda persona tiene derecho a un ambiente sano y ecológicamente equilibrado. Por ello está legitimada para denunciar los actos que infrinjan ese derecho y para reclamar la reparación del daño causado.
El Estado garantizará, defenderá y preservará ese derecho. La ley determinará las responsabilidades y las sanciones correspondientes.’ (Artículo reformado mediante Ley No. 7412 de 24 de mayo de 1994, publicada en La Gaceta No. 111 de 10 de junio de 1994).
Esta disposición establece un sistema de garantías que, en forma correlativa al Derecho Fundamental a la Vida, tienden a realizar e impulsar plenamente el afán constitucional de que la vida de todo ser humano sea, no sólo respetada, sino potenciada en todos sus aspectos. Esto significa que nuesto (sic) constituyente comprendió claramente que, de desvincularse el contenido del numeral veintiuno de la Constitución Política del Derecho Fundamental a la Salud, no sólo en el ámbito físico, sino también en el psíquico y el espiritual, el Derecho a la Vida no pasaría de ser, en la práctica, más que una mera declaración de principios. Dicho de otro modo, resulta obvio que el constituyente se percató de que Derecho a la Salud constituye un aspecto indisociable del principio que establece la inviolabilidad de la vida; y es precisamente por esta razón que se previó la creación de un sistema de seguro social, pues éste se revelaba como necesario para concretar el derecho de todos los habitantes de la República de gozar de un verdadero Derecho a la Salud…
(…)
Asimismo, la clarísima raigambre constitucional del Derecho a la Salud se ve complementada por el Pacto Internacional de Derechos Económicos, Sociales y Culturales, aprobado por la Ley 4229 del once deciembre de mil novecientos sesenta y seis, que además de formar parte del parámetro de constitucionalidad, contempla expresamente el Derecho a la Salud, y lo disciplina de la siguiente manera:
‘Artículo 12 Los Estados Partes en el presente Pacto reconocen el derecho de toda persona al disfrute del más alto nivel posible de salud física y mental.
(...)’ Esta disposición ayuda a interpretar en forma todavía más plena la normativa constitucional que –ya de por sí– postula a la Salud como un Derecho Fundamental. Dada la importancia de este tema, este Tribunal ya ha emanado abundante jurisprudencia al respecto. Así, se ha dicho lo siguiente:
‘VIIIo. En cuanto al derecho a la salud, es importante aprovechar el contexto que nos presenta el caso en estudio para aclarar que, si bien nuestra Constitución Política no contempla en forma expresa ese derecho –aunque sí se preocupa de regular expresamente los aspectos con ella relacionados, catalogados como parte de los derechos constitucionales sociales, como el derecho a la seguridad social–, no se puede negar su existencia, por ser derivado directo del derecho a la vida protegido en el artículo 21 de nuestra Constitución, ya que éste –el derecho a la vida– es la razón de ser y explicación última del derecho a la salud. La conexión existente entre ambos es innegable, el derecho a la salud tiene como propósito fundamental hacer efectivo el derecho a la vida, porque éste no protege únicamente la existencia biológica de la persona, sino también los demás aspectos que de ella se derivan.
Se dice con razón, que el ser humano es el único ser de la naturaleza con conducta teleológica, porque vive de acuerdo a sus ideas, fines y aspiraciones espirituales, en esa condición de ser cultural radica la explicación sobre la necesaria protección que, en un mundo civilizado, se le debe otorgar a su derecho a la vida en toda su extensión, en consecuencia a una vida sana. Si dentro de las extensiones que tiene éste derecho está, como se explicó, el derecho a la salud o de atención a la salud ello incluye el deber del Estado de garantizar la prevención y tratamiento de las enfermedades.’(Voto 1915-92 de las catorce horas y doce minutos del veintidós de julio de mil novecientos noventa y dos).
Como se puede concluir sin mayor esfuerzo de lo expuesto anteriormente, el Derecho a la Salud, que se encuentra desarrollado en numerosos textos legales, tiene como característica esencial el entrañar una obligación del Estado de procurar que la población disfrute de un bienestar físico, mental y hasta social. De ahí que la doctrina lo califique como un Derecho Funcional, ya que implica ‘...también la existencia de obligaciones específicas respecto no sólo de sí mismo, sino también de la familia y la comunidad.’ En tal medida, la Ley General de Salud No. 5395, prevé lo siguiente:
‘Artículo 1.- La salud de la población es un bien de interés público tutelado por el Estado.
Artículo 2.- Es función esencial del Estado velar por la salud de la población. Corresponde al Poder Ejecutivo, por medio del Ministerio de Salud, al cual se referirá abreviadamente la presente ley como ‘ Ministerio ‘, la definición de la política nacional de salud, la normación, planificación y coordinación de todas las actividades públicas y privadas relativas a salud, así como la ejecución de aquellas actividades que le competen conforme a la ley. Tendrá potestades para dictar reglamentos autónomos en estas materias.’ De las normas citadas anterioremente (sic), se concluye que existe un Principio General del Derecho de la Constitución que obliga a los entes estatales a comprometerse activamente en procurar la Salud de la población –en todas las manifestaciones que esta implique–. Tal obligación, por supuesto, varía en relación con la esfera de competencias que cada ente, órgano o dependencia exhiba, pero aun así es de aplicación general." (Sentencia 2000–09051 de las diez horas con dieciocho minutos del trece de octubre de dos mil).
Compárese este precedente con lo dispuesto en el pronunciamiento número 6165-94 de las diecisiete horas doce minutos del diecinueve de octubre de mil novecientos noventa y cuatro:
"El término ‘bellezas naturales’ era el empleado al momento de promulgarse la Constitución, (7 de noviembre de 1949) que hoy se ha desarrollado como una especialidad del derecho; el derecho ambiental que reconoce la necesidad de preservar el entorno no como un fin cultural únicamente, sino como una necesidad vital de todo ser humano. En este sentido, el concepto de un derecho al ambiente sano, supera los intereses recreativos o culturales que también son aspectos importantes de la vida en sociedad, sino que además constituye un requisito capital para la vida misma. Ningún resultado racional puede producir la negación de nuestra fragilidad como seres animados, dependientes del entorno para nuestra subsistencia y la de generaciones futuras.
XIV.De esta segunda visión del tema ambiental, se hace posible revestir a los derechos individuales clásicos de las condiciones necesarias para su pleno disfrute y ejercicio, en especial del derecho a la vida particularmente reforzado por nuestro artículo 21 constitucional, que la declara inviolable. Así, de la necesidad de disfrutar plenamente de los derechos humanos, surgen normas directamente derivadas de las fundamentales –entendidas como las ya consagradas en el texto constitucional– que operan como condiciones instrumentales para su preservación y ejercicio. Por ello las condiciones necesarias para la protección de los derechos fundamentales, se constituyen en verdaderos derechos independientes y exigibles con autonomía de aquéllos. Son verdaderas normas subconstitucionales como las denomina la doctrina, surgidas de la interpretación armónica del derecho de la Constitución; como por ejemplo la relación género–especie entre la libertad de comercio y la libertad de contratación según lo desarrolló la Corte Plena en funciones de tribunal constitucional, en la sentencia de 26-8-82. La segunda como consecuencia de la primera, es una condición indispensable para su ejercicio y sin embargo un derecho autónomo a la vez.
XV.Por ello podemos afirmar que del derecho a la vida y de la obligación estatal de ‘proteger las bellezas naturales’ contenidos en los artículos 21 y 89 de la Constitución, surgen otros derechos de obligada protección e igual rango como son los de la salud y a un ambiente sano, en ausencia de los cuales o no sería posible el ejercicio de los primeros, o su disfrute se vería severamente limitado.
XVI.El derecho a la Salud, como derecho humano, fue reconocido por la Sala en tempranas sentencias, como la N°56-90 que declaró ese derecho como irrenunciable; y la sentencia N°1755-90 en la que se dijo:
‘En el presente caso, está de por medio del derecho a la Salud, derecho fundamental del ser humano –en la medida en que la vida depende en gran parte de su respecto– de tal forma que conforme a nuestra Constitución Política, artículos 10 y 48, y la Ley de la Jurisdicción Constitucional, la materia objeto del presente recurso... sí se constituye en objeto de obligado conocimiento de esta instancia, en la medida en que involucra la presunta violación de un derecho constitucional...’ De manera que es claro que ya no existe duda sobre la protección constitucional del derecho a la salud jalonado del derecho a la vida y por allí de un derecho al ambiente sano. A manera de ilustración podemos citar las sentencias 1580-90; 1833-91; 2362-91; 2728-91; 1297-92; 2233-93; 4894-93; que han reconocido el derecho a la salud y a un ambiente sano, como un derecho individual constitucionalmente protegido." Así, en síntesis, puede decirse que toda persona tiene derecho a una vida saludable y productiva en armonía con la naturaleza y, en esta tesitura, se enmarca el concepto del derecho a un ambiente sano y ecológicamente equilibrado.
Por un lado, el derecho a un ambiente sano consiste en la aspiración de mejorar el entorno de vida del ser humano dentro de toda esfera en la que se desarrolle la persona, sea la familiar, la laboral o la del medio en el cual habita. En este sentido, este concepto supera los meros intereses "recreativos" o "culturales" porque constituye un requisito capital para la vida misma. En cambio, el derecho a un ambiente ecológicamente equilibrado es una noción más restringida, que únicamente se refiere al equilibrio que debe existir entre el avance de la sociedad y la conservación de los recursos naturales. Ambos conceptos no sólo no son excluyentes, sino que se complementan e implican el uno al otro, al extremo de que generalmente se los trata como uno solo. A la sazón, tanto si se los aborda en conjunto o separadamente, se descubre que ambos revisten el carácter de derecho transversal. Esto quiere decir que se desplazan a todo lo largo del ordenamiento jurídico, modelando y reinterpretando sus institutos.
El derecho a un ambiente sano y ecológicamente equilibrado es de aplicación inmediata, de manera que se manifiesta en la doble vertiente de derecho subjetivo de las personas y configuración como meta o fin de la acción de los poderes públicos en general. La calidad ambiental es un parámetro fundamental de la calidad de vida, pero no es el único: otros parámetros, no menos importantes, son la salud, la alimentación, el trabajo, la vivienda, la educación, etc. A este respecto, cabe añadir que en la actualidad se acepta pacíficamente que existe una tutela de rango constitucional del derecho a la salud, jalonado del derecho a la vida y, por allí, de un derecho al ambiente sano; esto por cuanto el Derecho a la Salud constituye un aspecto indisociable del principio que establece la inviolabilidad de la vida. De hecho, al igual que el Derecho a un Ambiente Sano y Ecológicamente Equilibrado, el Derecho a la Salud tiene como característica esencial el entrañar una obligación del Estado; si bien ella consiste en procurar que la población disfrute de un bienestar físico, mental y hasta social.
Por esa razón, la doctrina lo califica como un Derecho Funcional, puesto que entraña obligaciones específicas respecto no sólo de sí mismo, sino también de la familia y la comunidad. En tanto ambos Derechos –en alguna medida– también se implican el uno al otro, no es difícil entender que ambos deben orientar poderosamente el quehacer Estatal. Debe entenderse que existe un Principio General del Derecho de la Constitución, derivado del Derecho a la Vida, que obliga a los entes estatales a comprometerse activamente en procurar, por un lado, la Salud de la población –en todas las manifestaciones que esta implique–, y por el otro, a tutelar al medio ambiente. Tal obligación, por supuesto, varía en relación con la esfera de competencias que cada ente, órgano o dependencia exhiba, pero aun así es de aplicación general. No obstante, las leyes –por sí solas– hasta ahora han resultado evidentemente insuficientes para garantizar la conservación de los recursos naturales y asegurar un desarrollo sostenible futuro.
Por ello, es indispensable que la norma jurídica tenga no solo un respaldo técnico, sino que, de hecho, se asuman responsabilidades individuales y colectivas respecto al cumplimiento de dicha normativa en los diferentes niveles e instancias que corresponda. El quebranto de las normas ambientales puede provocarlo con su actuación u omisión tanto un sujeto de derecho privado como de derecho público. Este último, simplemente omitiendo ejercer el control debido sobre la actuación de los sujetos privados, cuando infringen las normas ambientales, ignorando su competencia funcional, que le exige ejercer ese control. Y por eso mismo, si la Administración omite ejercer sus cometidos de tutela y fiscalización, el administrado puede acudir a la vía del amparo.
V.Acerca del Derecho a la Salud, a un medio Ambiente Sano y Ecológicamente Equilibrado, y los cometidos de la Jurisdicción Constitucional: los principios "pro homine" y "pro libertatis". Ahora bien, en este contexto es necesario recordar que la finalidad última de la interpretación constitucional es potenciar la actuación práctica del ordenamiento constitucional, lo cual –se ha dicho– entraña expandir al máximo la fuerza normativa de la Constitución y la interpretación de todo el ordenamiento jurídico (incluyendo la ley de esta jurisdicción) en consonancia con ella misma. En otro nivel, sea al estudiar un caso concreto para darle solución, este propósito se traduce en elegir entre todas las posibles respuestas aquella opción que resulte más correcta desde la perspectiva constitucional. Aplicada al caso concreto, la interpretación constitucional correcta debe fortalecer en la mayor medida posible la actuación de los valores, las normas y los principios íncitos en el parámetro de constitucionalidad.
Y en esta labor, se constituyen como norte indiscutible de la interpretación constitucional, los principios pro homine y pro libertatis. El principio pro homine postula que el derecho debe interpretarse y aplicarse siempre de la manera que más favorezca al ser humano. De esa forma, se ha dicho que "…el sistema de libertad que garantizan los derechos fundamentales, deja fuera del alcance de la acción del Estado, ya sea por medio de la ley, de la actividad administrativa o de los tribunales de justicia, una esfera intangible de libertad, la cual no puede ser tocada por ninguna autoridad, porque es el hombre, no la sociedad, quien tiene dignidad y los consiguientes derechos y libertades fundamentales." En efecto, el ser humano es el fin último de las normas jurídicas, y no meramente un destinatario de ellas, de tal modo que éstas –y especialmente las que consagran derechos fundamentales–, deben interpretarse en la forma en que más favorezcan a la persona humana.
El principio pro libertatis, por su parte, prescribe que los derechos fundamentales deben interpretarse del modo más amplio posible. Por consiguiente, debe interpretarse extensivamente todo lo que maximice y restrictivamente todo lo que limite libertad de los individuos. De ahí que, en caso de duda, siempre se deberá favorecer la cláusula de libertad, pues los derechos fundamentales han sido justamente consagrados para proteger la libertad, en vez de limitarla. De ahí que con relación a la problemática expuesta, la tarea de esta Sala es establecer, por una parte, si la actividad de CATSA puede reputarse, al menos potencialmente, como peligrosa para la salud, el medio ambiente y, por ende, la calidad de vida que disfrutan los habitantes de Paso Tempisque, Palmira, Los Jocotes y la zona de Filadelfia, en el entendido que, ante la duda, debe optarse por la interpretación que más favorezca los Derechos Fundamentales de la población, de conformidad con los principios pro homine y pro libertatis.
Por la otra, la Sala debe constatar si las distintas instituciones del Estado se han avocado diligentemente a procurar –dentro de sus competencias– que los pobladores gocen de un ambiente sano, ecológicamente equilibrado, y que, por ende, no que perjudique su salud.
VI.Sobre los malos olores emanados por la laguna de sedimentación del lavado de caña. Objetan los reclamantes que los malos olores que produce la laguna en mención hacen, en sus palabras, "insoportable" la vida para los vecinos de Paso Tempisque, Palmira, Los Jocotes y toda la zona cercana a Filadelfia de Carrillo en Guanacaste. En este sentido, aunque la Sala reconoce que se han construido sistemas de tratamiento para las aguas –que no han surtido los efectos deseados– y que, por esa razón, se ha propuesto dejar de lavar la caña a fin de eliminar por completo el problema, lo cierto es que los malos olores, según admiten los señores Pardo y LaVergne, persisten. Si a ello se le suma que, mientras tanto, los pobladores de la región deben vivir sometidos a tales condiciones, se concluye que su derecho a gozar de un ambiente sano, que abarca toda esfera en la que se desarrolle la persona, esta siendo irremisiblemente vulnerado.
VII.Acerca del Derecho a la Salud, a un Ambiente Sano y Ecológicamente Equilibrado, y la contaminación ambiental: La cuestión planteada por la quema de cañales. Afirman los recurrentes que la quema de cañales en un área de cinco mil hectáreas que lleva a cabo CATSA para facilitar su cosecha, produce hollín, la muerte de animales silvestres y provoca "efectos nocivos para la salud pública". A este respecto, las autoridades de Salud y de Ambiente y Energía, pese a haber sido debidamente prevenidas en las resoluciones que les dieron traslado del presente amparo, guardan un absoluto mutismo, omitiendo hacer cualquier referencia sobre los presuntos efectos nocivos que el fuego y el humo tienen en la salud de las personas y la fauna local. El Gerente General de la Central Azucarera Tempisque S.A., en cambio, refuta tales afirmaciones, y aduce que estas quemas más bien son beneficiosas para el entorno, porque la agroindustria de la caña "ayuda en el proceso de fijación del dioxido de carbono" (ver folio 19, apartado sexto). Sobre la contaminación ambiental, la Sala ha dicho:
"III) – La contaminación, que se refiere específicamente a la impugnación que hace el menor recurrente, puede considerarse como la presencia en el medio ambiente de uno o más contaminantes, o combinación de ellos, en concentraciones tales y con un tiempo de permanencia tal, que causen en dicho ambiente características negativas para la vida humana, la salud o el bienestar del hombre, la flora o fauna, o produzcan en el habitat de los seres vivos, aire, agua, suelos, paisajes o recursos naturales en general, un deterioro importante. Contaminar es introducir sustancias o elementos extraños al ambiente en niveles y con una duración tales, que produzcan contaminación en el sentido expuesto. Contrariamente, descontaminar es reducir el nivel de concentración de los contaminantes que se encuentren presentes en el ambiente, a sus valores aceptables conforme a las normas específicas sobre calidad ambiental.
Ambiente libre de contaminación es, pues, la condición en que se encuentra el medio que nos rodea, cuando las alteraciones producidas tanto por el hombre como por la naturaleza en el entorno próximo o lejano, no sobrepasan los máximos permisibles fijados por aquellas normas.
(…)
…El suelo, el agua, el aire, los recurso (sic) marinos y costeros, los bosques, la diversidad biológica, los recursos minerales y el paisaje conforman el marco ambiental sin el cual las demandas básicas –como espacio vital, alimentación, energía, vivienda, sanidad y recreación– serían imposibles. De igual modo, nuestra economía también está íntimamente ligada al estado del ambiente y de los recursos naturales; así, por ejemplo, tanto la generación de divisas por explotación agrícola y turística, como el éxito de importantes inversiones en infraestructura dependen, en última instancia, de la conservación de aquéllos. Las metas del desarrollo sostenible tienen que ver con la supervivencia y el bienestar del ser humano y con el mantenimiento de los procesos ecológicos esenciales, es decir, de la calidad ambiental y de la sobrevivencia de las otras especies. Hablar de desarrollo sostenible en términos de satisfacción de las necesidades humanas presentes y futuras y del mejoramiento de la calidad de vida es hablar de la demanda de los recursos naturales a nivel individual y de los medios directos o de apoyo necesarios para que la economía funcione generando empleo y creando los bienes de capital, que a su vez hagan posible la transformación de los recursos en productos de consumo, de producción y de exportación.
En todo proceso de producción es necesario transformar y procesar recursos y, a su vez, transportarlos hasta los centros de consumo, todo lo cual significa un costo energético y ambiental. Asimismo, el proceso productivo no sólo requiere de recursos naturales para mantenerse, sino que genera desechos y contaminación de muy variada indóle (sic) como, por ejemplo, los desechos sólidos o emanaciones que contaminen el aire o el agua. Es evidente que el hombre con su poderío tecnologíco (sic) ha logrado controlar y alterar notablemente su entorno y ha sometido el resto de las especies a su dominio. Empero, desde la revolución industrial –y en una forma significativamente más acelerada a partir de la segunda guerra mundial–, el crecimiento exponencial de la población y las tendencias también exponenciales de la economía han incrementado el nivel de intervención del hombre en el planeta destruyendo habitats, alterando y contaminandos (sic) los ciclos vitales del medio ambiente y exterminando especies vivientes.
El acelerado deterioro del medio en las últimas decádas (sic), los costos enormes de las medidas correctivas, no siempre efectivas, y los plazos necesarios, por ejemplo, para la recuperación de una cuenca o de un bosque natural talado, o de un manto de agua subterráneo contaminado, son signos inequívocos del abuso de los recursos naturales y del impacto negativo de la especie humana sobre un mundo limitado.
(…)
La vida humana sólo es posible en solidaridad con la naturaleza que nos sustenta y nos sostiene, no sólo para alimento físico, sino también como bienestar psíquico: constituye el derecho que todos los ciudadanos tenemos a vivir en un ambiente libre de contaminación, que es la base de una sociedad justa y productiva. Es así como el artículo 21 de la Constitución Política señala: La vida humana es inviolable. Es de este principio constitucional de donde innegablemente se desprende el derecho a la salud, al bienestar físico, mental y social, derecho humano que se encuentra indisolublemente ligado al derecho de la salud y a la obligación del Estado de proteger de la vida humana.
Asimismo, desde el punto de vista psíquico e intelectual, el estado de ánimo depende también de la naturaleza, por lo que también al convertirse el paisaje en un espacio útil de descanso y tiempo libre es obligación su preservación y conservación. Aspecto este último que está protegido en el artículo 89 constitucional, el cual literalmente dice:Entre (sic) los fines culturales de la República están: proteger las bellezas naturales, conservar y desarrollar el patrimonio histórico y artístico de la Nación, y apoyar la iniciativa privada para el progreso científico y artístico. Proteger la naturaleza desde el punto de vista estético no es comercializarla ni transformarla en mercancía, es educar al ciudadano para que aprenda a apreciar el paisaje estético por su valor intrínseco." (Sentencia número 3705–93 de las quince horas del treinta de julio de mil novecientos noventa y tres).
Por otra parte, los problemas concretos de contaminación, al igual que la gran mayoría de los asuntos relativos al medio ambiente, plantean serios desafíos para las entidades del Estado, porque generalmente deben abordarse desde una óptica interdisciplinaria. Es frecuente que una misma situación pueda enfocarse desde la perspectiva de la salud pública, la agricultura, la industria, etcétera, y de disciplinas tan disímiles como la ecología, la química, la oceanografía, la antropología y la ingeniería. La atomización provocada por todas estas perspectivas posibles hace que las políticas que inciden sobre controversias ambientales tengan el riesgo de verse minadas por una excesiva "sectorización" de sus objetivos. Es posible que los distintos entes públicos caigan víctimas de una visión chata, parcial y descoordinada de los asuntos que interesan a toda la comunidad, cuando más bien deberían presentar un frente común ante ellos.
En la práctica, no es raro que este tipo de problemas terminen por ser dejados totalmente de lado por la maquinaria estatal, ya que las entidades involucradas, en vez de percatarse de que existen fines, principios y valores de orden constitucional que rigen toda la actividad del Estado, únicamente se dedican a interpretar sus propias leyes orgánicas o reglamentos de la forma más restrictiva posible, a fin de limitar al máximo su injerencia en ellos. Esta actitud, por cierto, es claramente apreciable en los autos. Es del dominio público que las quemas que se realizan con ocasión del cultivo de la caña de azúcar producen brozas, cenizas y brumas susceptibles de afectar la salud humana, ya que pueden provocar irritaciones en el tracto respiratorio y afecciones de los ojos como la conjuntivitis. Además, los incendios en la actividad agrícola son una de las fuentes del dióxido de carbono que hoy día se acumula en la atmósfera terrestre y según, se afirma, podría ser responsable del tristemente célebre "efecto de invernadero" que afecta a todo el mundo.
Ahora bien, el artículo 2° de la Ley 7152, "Ley de Conversión del Ministerio de Industria, Energía y Minas en Ministerio de Recursos Naturales, Energía y Minas", precisa que es atribución de esa cartera:
"(…)
Formular, planificar y ejecutar las políticas de recursos naturales, energéticas, mineras y de protección ambiental del Gobierno de la República, así como la dirección, el control, la fiscalización, promoción y el desarrollo en los campos mencionados. Asimismo, deberá realizar y supervisar las investigaciones, las exploraciones técnicas y los estudios económicos de los recursos del sector.
Fomentar el desarrollo de los recursos naturales, energéticos y mineros.
Promover y administrar la legislación sobre conservación y uso racional de los recursos naturales, a efecto de obtener un desarrollo sostenido de ellos, y velar por su cumplimiento.
ch) Dictar, mediante decreto ejecutivo, normas y regulaciones, con carácter obligatorio, relativas al uso racional y a la protección de los recursos naturales, la energía y las minas.
(…)" De donde se colige que, aunque la autorización de quemas está regulada por el Decreto 23850-MAG-SP, si éstas inciden –o pudieran incidir– sobre el medio ambiente, obligan al MINAE a intervenir de alguna forma, aunque sea coordinando esfuerzos con otros entes, como el MAG o el Ministerio de Salud. Aunado a lo anterior, la necesidad de que el Ministerio de Salud se ocupe –siempre dentro de sus competencias– del problema del humo es apremiante, dada la naturaleza potencialmente nociva de los desechos mencionados. Y, en cuanto, al Ministerio de Agricultura y Ganadería, vale recordar que el numeral 48.e) de su Ley Orgánica estatuye que es su función: "Participar, conjuntamente con otras instituciones del Sector, en la identificación de las necesidades de construcción y mantenimiento de la infraestructura propia para el desarrollo agropecuario y de recursos naturales renovables." No obstante lo anterior, los jerarcas de los dos primeros ministerios insisten en sus informes que lo referente a las quemas es competencia exclusiva del Ministerio de Agricultura y Ganadería.
Esto, por las razones ya expuestas, es una verdad a medias. En realidad, lo lógico en este caso hubiera sido que las tres autoridades, preocupadas de que los vecinos de Paso Tempisque, Palmira, Los Jocotes y toda la zona cercana a Filadelfia de Carrillo tuvieran garantizado su derecho a la salud y a un ambiente sano y ecológicamente equilibrado, hubieran realizado investigaciones para determinar si se estaba provocando un daño a la salud y/o al medio y ambiente, su magnitud, y si la situación expuesta ameritaba la adopción de medidas especiales de algún tipo. En este contexto, merece particular mención lo actuado por el MAG. Manifiesta el Ministro de Agricultura y Ganadería que el Decreto N° 23850-MAG-SP, "Reglamento para Quemas Controladas con fines Agrícolas y Pecuarios", estatuye que la autorización para quemas en terrenos agrícolas y pecuarios debe ser concedida por las oficinas del Ministerio de Agricultura y Ganadería, pero que dicha regulación no le otorga al MAG ninguna facultad sancionadora para disciplinar su aplicación, puesto que, en sus artículos 9 y 10, remite a las disposiciones pertinentes del Código Penal. Tales excusas son totalmente inaceptables. Los artículos 113 y 114 de la Ley General de la Administración Pública disponen claramente lo siguiente:
"Artículo 113.- 1. El servidor público deberá desempeñar sus funciones de modo que satisfagan primordialmente el interés público, el cual será considerado como la expresión de los intereses individuales coincidentes de los administrados.
2. El interés público prevalecerá sobre el interés de la Administración Pública cuando pueda estar en conflicto.
3. En la apreciación del interés público se tendrá en cuenta, en primer lugar, los valores de seguridad jurídica y justicia para la comunidad y el individuo, a los que no puede en ningún caso anteponerse la mera conveniencia.
Artículo 114.- 1. El servidor público será un servidor de los administrados, en general, y en particular de cada individuo o administrado que con él se relacione en virtud de la función que desempeña; cada administrado deberá ser considerado en el caso individual como representante de la colectividad de que el funcionario depende y por cuyos intereses debe velar.
2. Sin perjuicio de lo que otras leyes establezcan para el servidor, considérese, en especial, irregular desempeño de su función todo acto, hecho u omisión que por su culpa o negligencia ocasione trabas u obstáculos injustificados o arbitrarios a los administrados." Y, en forma consecuente con el espíritu que anima esos artículos, el Código Procesal Penal impone la siguiente obligación:
"Artículo 281.- Obligación de denunciar Tendrán obligación de denunciar los delitos perseguibles de oficio:
(…)
(…)" De tal forma que si los servidores del MAG estaban al tanto de que la empresa CATSA no solicitaba autorización para realizar la quema de sus cañales desde mil novecientos noventa y cinco, debieron actuar diligentemente, conforme a la ley. Pero la cuestión no termina ahí. El numeral onceavo del Decreto N° 23850-MAG-SP deja entrever que uno de los principios rectores de todo el Reglamento, es que se atienda la problemática de los incendios en forma integral. De ahí que, aunque la norma jurídica no lo declara en forma explícita, una correcta lectura de su articulado, a la luz de los principios expuestos en los considerandos anteriores, no puede sino arrojar como conclusión que si los personeros del MAG se percataban de que los incendios controlados efectuados por CATSA podían afectar al medio ambiente y la salud de los vecinos del lugar, debían notificar y, en su caso, coordinar esfuerzos con otras dependencias estatales, como el Ministerio de Salud y el MINAE, para determinar la gravedad de estos hechos, a fin de que se adoptaran soluciones en el seno de una estrategia conjunta; todo lo cual hubiera permitido ir más allá del ámbito de competencias del MAG. Sin embargo, aun a sabiendas de que la actividad indicada podría estar perturbando a las comunidades cercanas (véase el folio 163 § 3), dichos funcionarios no hicieron nada al respecto.
Tal actitud infringe los principios constitucionales que tutelan la vida y la salud de los seres humanos y se configura en una violación flagrante de los deberes propios de la función pública. Ahora bien, la Sala Constitucional es un órgano de índole jurisdiccional, no técnica, y por ende no es capaz de determinar si en el caso específico de CATSA, la práctica de quemas en sus predios efectivamente produce los efectos perniciosos mencionados en el considerando anterior. Sin embargo, en el expediente existen numerosos indicios que apuntan fuertemente en esa dirección, a saber: la misma interposición de este recurso, las denuncias formuladas por los vecinos ante el MINAE que corren agregadas al expediente, y la velada admisión de los informantes de que existe algún tipo de problema referido a esta costumbre. Es sintomático, por ejemplo, que el propio gerente de esa compañía acepte que en la actualidad existe "…una tendencia en todas las zonas cañeras para eliminar la quema de los cañales mediante el uso de variedades adecuadas (mayor despaje natural) para cosecharlas mediante máquinas cosechadoras combinadas…" y que, en el último periodo de zafra, CATSA cosechó alrededor de un diez por ciento del área de su propiedad mediante esa técnica (folio 19). Esto, evidentemente, debió ser acicate para estimular la intervención de la Administración.
VIII.Sobre el Principio de Prudencia. Consecuentemente, en atención al principio pro homine, estima la Sala que conformarse con reconocer la situación y, aun así, no hacer nada al respecto porque CATSA y el Ministerio de Salud han dado muestras de buena fe, particularmente en cuanto a erradicar los malos olores provocados por la laguna de sedimentación, resultaría irresponsable, si se toma en cuenta que el asunto, como un todo, da muestras de ser un problema serio en lo concerniente a los Derechos Fundamentales de los pobladores de los asentamientos vecinos. Sin embargo, en este punto, cabe observar que la pretensión de los recurrentes de que se cierre la planta de la compañía recurrida le parece excesiva a este Tribunal, especialmente si se toma en cuenta que la actividad agrícola desarrollada por CATSA inyecta bríos a la economía de la región. En efecto, un principio de capital importancia en la tarea de interpretar y aplicar el Derecho Constitucional es actuar con prudencia.
El Juzgador, como intérprete de la Constitución, no debe perder de vista las consecuencias de sus interpretaciones. Esto, en doctrina, es denominado "Principio de Prudencia", y ha sido muy desarrollado por la jurisprudencia de la Corte Suprema de los Estados Unidos, que ha sostenido que la Constitución "no es un pacto suicida" sino, por el contrario, un instrumento que hace posible la convivencia social. Ello significa que, en aras de mantener la vigencia del instrumento, toda interpretación constitucional debe tender a permitir la supervivencia y la prosperidad de la sociedad. Volviendo al presente caso, la Sala estima que el principio aludido no le permite validar una medida de tal magnitud como el cierre del ingenio, especialmente si se considera que los propios recurridos se han esforzado para erradicar el problema denunciado. A mayor abundamiento, tampoco es este Tribunal parte integrante de la Administración activa de la República, de tal modo que no le corresponde asumir las tareas de evaluación propias del Ministerio de Salud, o cualquier otro ente administrativo, como lo sería declarar que la quema masiva de cañales que realiza CATSA es perjudicial para la salud y, peor aun, decidir que medida debe implantarse para darle fin al problema, ponderando para ello cuestiones de orden técnico, económico y político que exceden a la naturaleza de la función jurisdiccional.
A este respecto, estima la Sala que el principal problema que se ha evidenciado en el expediente, es la absoluta falta de coordinación de los Ministerios recurridos a la hora de abordar y resolver razonablemente los problemas ambientales expuestos. Es obligación del Estado proporcionar la protección necesaria para que todos los individuos disfruten de un ambiente libre de contaminación. Partiendo de las anteriores consideraciones, la solución que se impone, luego de efectuar una correcta armonización de los principios mencionados, es disponer que todas estas dependencias estatales le den una solución razonable a los problemas expuestos, en un plazo determinado.
Por tanto:
Se declara CON LUGAR el recurso. Se le ORDENA a las personas que ejerzan los cargos de MINISTRO DE SALUD, MINISTRO DE AMBIENTE Y ENERGIA Y MINISTRO DE AGRICULTURA Y GANADERIA, y a EDGAR ALEJANDRO PONCIANO LAVERGNE, en su calidad de Gerente General de la CENTRAL AZUCARERA TEMPISQUE S.A., o a quien se desempeñe en su puesto, BAJO PENA DE DESOBEDIENCIA, que en el término improrrogable de DIEZ MESES contado a partir de la notificación de esta sentencia, elaboren en forma coordinada e implanten un plan que solucione en forma razonable los problemas que acusan los recurrentes. Se condena al ESTADO al pago de las costas, daños y perjuicios causados con los hechos que sirven de base a esta declaratoria, los que se liquidarán en ejecución de sentencia de lo contencioso administrativo. Se le advierte a los recurridos que, de conformidad con el artículo 71 de la Ley de esta jurisdicción, se impondrá prisión de tres meses a dos años, o de veinte a sesenta días multa, a quien recibiere una orden que deba cumplir o hacer cumplir, dictada en un recurso de amparo y no la cumpliere o no la hiciere cumplir, siempre que el delito no esté más gravemente penado. Notifíquese la presente resolución al señor LAVERGNE, o a quien ocupe ese puesto en su lugar, y a los MINISTROS DE SALUD, AMBIENTE Y ENERGIA Y AGRICULTURA Y GANADERIA, EN FORMA PERSONAL.– Luis Fernando Solano C.
