San José, at sixteen hundred hours on dos de setiembre de mil novecientos noventa y siete.- Constitutional challenge (acción de inconstitucionalidad) filed by Nombre60819, of legal age, married, a surveying expert and law graduate, resident of Moravia, identity card number CED123946, against Considerando 3, Articles 2 and 3 of Decreto Ejecutivo número 224.400-MP-J-TUR and opinion N° Placa32340 of the Procuraduría General de la República, dated cuatro de agosto de mil novecientos noventa y tres, concerning Ley número 6758, which governs the development and implementation of the Proyecto del Golfo de Papagayo. Participating in the action are Farid Beirute Brenes, as Deputy Attorney General; Rodrigo Oreamuno Blanco, in his capacity as First Vice President of the Republic and Minister of the Presidency; Carlos Roesch Carranza, as Executive Nombre9143 of the Instituto Costarricense de Turismo with the rank of Minister; and Mauren Clarke Clarke, in her capacity as Minister of Justice. José Manuel Ortiz Dueñas appears as a supporting respondent (coadyuvante pasivo) in the action, as general attorney-in-fact without monetary limitation for “Ecodesarrollo Papagayo, Sociedad Anónima.” BACKGROUND:

  1. 1The petitioner files a constitutional challenge against Considerando 3, Articles 2 and 3 of Decreto Ejecutivo número 224.400-MP-J-TUR and opinion N° Placa32340 of the Procuraduría General de la República, dated cuatro de agosto de mil novecientos noventa y tres, concerning Ley número 6758, which governs the development and implementation of the Proyecto del Golfo de Papagayo; solely insofar as it amends decreto ejecutivo N° 22.489-MP-J-TUR, by virtue of which: 1.-

construction is permitted in the maritime-terrestrial zone (zona marítimo terrestre) within the comprehensive development project at Bahía Culebra (Proyecto de Papagayo) under the horizontal property regime (régimen de propiedad horizontal) (condominiums), thereby artificially removing from State ownership the land on which such structures are built; and 2.- banks within the national banking system or other State institutions are authorized to grant loans secured by the concession (concesión), buildings, improvements, and facilities—Article 67 of the Ley de la Zona Marítimo Terrestre—constructed in the maritime-terrestrial zone, allowing them to be secured by mortgage liens (gravámenes de carácter hipotecario); thereby violating Articles 11, 33, 49 in its final two paragraphs, 50, 89, 121 subsections 1.) and 14.), and 149 subsections 3.) and 19.) of the Constitución Política, as well as the case law of the Sala Constitucional concerning this subject matter.

Regarding horizontal property, he states that the horizontal property regime arose as a genuine social law intended to address the housing problem and achieve greater social welfare; that regime was subsequently applied to other purposes, such as commerce, offices, warehouses, industry, and tourism. According to legal scholarship and legislation, it is a new legal construct with its own nature, and its essence and characteristics, which distinguish it from other categories, types, and applications, are understood as such. It thus results from the “mixture” of private or individual ownership and common ownership, which extends from the foundations and land to the walls supporting the building; and without common areas (áreas comunes), there is no condominium. Horizontal property literally consists of floors in a building containing more than one story; that is, vertically superimposed floors.

If this regime is applied to public-domain assets (bienes de dominio público), the two are incompatible, given that the common areas are located within the maritime-terrestrial zone. How can private ownership of a public-domain asset (bien demanial) be explained when, under legal scholarship and legislation—Article 20 of the Ley de la Propiedad Horizontal—the land on which the building stands is necessarily common property under this ownership regime? Moreover, a condominium, as a consortium of properties, has independent legal personality, and when the Registro Público records the instrument establishing the regime, it assigns it an identification number, causing the original registration of the property subjected to the regime to disappear and giving rise to the parent property (finca matriz), which comprises the land, common areas, and buildings containing the floors, apartments, and premises that will subsequently give rise to the subsidiary properties (fincas filiales); and when recording those subsidiary properties, it assigns each a number identifying and distinguishing it from the others.

In this regard, he considers that the Procuraduría General de la República contradicts itself in its reasoning because it asserts that only the building is subjected to horizontal property, since the building is the private or individual asset, even though the common areas, which are situated on a public-domain asset, would be missing; and, as previously noted, without common areas there is no condominium. He likewise states that Costa Rica has not regulated the surface right (derecho de superficie), as other legal systems have—the case of Spain—which is the legal construct that the Procuraduría seeks to apply in this situation. The surface right entails the existence of two owners of the same real property: one owns the bare title (nuda propiedad), meaning the land, which remains under that owner’s ownership; and another (the third-party holder of the surface right, tercero superficiario) owns the structures or plantings erected on the land, over which that party has broad use and enjoyment, but always solely as holder of a surface right.

Under our legislation, the Código Civil expressly prohibits the surface right; consequently, private ownership has no limit to its extent—it encompasses the soil and its entire depth, as well as the airspace above the land along perpendicular lines—with total and absolute ownership of both the airspace and subsoil. Accordingly, the condominium construct must not be confused with the surface right, which consists of owning a building or planting on another person’s land. In the case of a condominium, the land is a common area belonging to all condominium owners—similar to traditional co-ownership (copropiedad tradicional)—and what is built on it would not stand on another person’s land, but on their own land held in condominium. The important issue to determine at this point is how to reconcile the fact that a person may be the owner only of the building while also being a concession holder.

With respect to securing concessions by mortgage, he states that the legislature does not provide that concessions must be secured through a mortgage; it governs the development and implementation of the Proyecto del Golfo de Papagayo, and the mortgage is established in the challenged decree. He considers that, in order to record such mortgages, the applicable legal regime in the Código Civil would have to be amended from its current form; and, in this particular case, if the concession itself is what is encumbered, the nature of the mortgage construct, as currently established, must not be distorted, particularly because the Registro Público de la Propiedad contains a Registro de Concesiones, in which the granted loan should therefore be recorded, since it would be protected by the registry principles (principios registrales) of request, priority, public reliance, and security. He also states that securing concessions by mortgage is authorized solely for the Papagayo project and not for the other concessions granted within the maritime-terrestrial zone.

  1. 2The petitioner bases his standing (legitimación) to bring this action on the existence of diffuse interests (intereses difusos) affecting the community as a whole, in defense of State assets—the maritime-terrestrial zone—whose protection is mandatory for all inhabitants of the country, pursuant to Article 1° of the Ley de la Zona Marítimo Terrestre.
  2. 3By a ruling of the Office of the Presidency issued at diez horas quince minutos del veintisiete de octubre de mil novecientos noventa y cinco, the action was admitted for consideration, and the Procuraduría General de la República, the Minister of the Presidency, the Minister of Justice, and the Minister of Tourism were afforded a hearing.
  3. 4Farid Beirute Brenes, in his capacity as Deputy Attorney General, submitted his report on time. Regarding the petitioner’s standing (legitimación), he considers that the petitioner has standing to bring the action because the possible impairment of public-domain property (bien de dominio público) cannot cause an individual and direct injury, and therefore a pending matter could not be required; moreover, there is a diffuse interest (interés difuso) arising from the nature of the subject matter sought to be protected—public-domain property—(judgments numbers 980-91 and 3294-92). As to the merits, he considers that the petitioner’s arguments are unfounded because the alleged constitutional violations have not occurred, and the action should therefore be dismissed. It is beyond dispute that public-domain property cannot be mortgaged, transferred, or attached; however, what is intended to be mortgaged in this case is not the property—the maritime-terrestrial zone (zona marítimo terrestre)—but rather the concession granted over the public-domain property (bien demanial); this is because a public-domain concession (concesión demanial) gives rise to a genuine right in rem (derecho real), enforceable erga omnes, transferable, and mortgageable (“administrative rights in rem” (“derechos reales administrativos”)); in other words, it creates a property right (derecho patrimonial) that forms part of the concessionaire’s ownership rights.It is clear that works constructed on public-domain property are owned exclusively by the concessionaire, because such works are nothing more than the materialization or expression of the special right of use arising from the concession. Furthermore, both the Ley de la Zona Marítimo Terrestre—number 6043, of three of March of one thousand nine hundred seventy-seven—in Article 67, and the Ley que regula el desarrollo y ejecución del Proyecto de Papagayo en Bahía Culebra—number 6758, of four of June of one thousand nine hundred eighty-two—allow banks within the national banking system and State institutions to grant loans to concessionaires in the restricted zone (zona restringida) of the maritime-terrestrial zone, secured by the concession itself and by the works, buildings, and improvements; thus, the challenged decree merely reflects what is stated in the legislation, as applied to the specific case.From the foregoing, he concludes that the Costa Rican legal system permits a mortgage over both the concession and the works, improvements, and installations. This situation is not contrary to Article 33 of the Constitution, since the Ley de la Zona Marítimo Terrestre permits it throughout the country and it applies to all concessionaires in the restricted zone of the maritime-terrestrial zone. Regarding condominium ownership (propiedad horizontal), he notes that Article 3 of executive decree number 24.400-MP-J-TUR itself provided that the rules governing this ownership regime would apply in this area only insofar as they were compatible. Given the public nature of the property involved (public domain), public law prevails with respect to its use by private concessionaires, but principles and provisions governing condominium ownership may be applied where reasonably compatible. Thus, condominium ownership consists of common property and individually owned private property; in this case, the individual portion of the building, but not the land, will be treated as private property, while the shared, indivisible portion of the building will be treated as common property.When the ownership right in a building subject to those aspects of the condominium ownership regime that are compatible is sold, there is a partial assignment (cesión parcial) of the building and not of the concessionary right of use, because the latter is an intuitu personae relationship that must be authorized by the Instituto Costarricense de Turismo—Article 6, subsection 2.) of executive decree number 22.489-MP-J-TUR. He concludes by stating that there is no legal possibility for the concessionary right to use public-domain property (in the restricted zone of the Zona Marítimo Terrestre) to be subjected to the condominium ownership regime because that regime is incompatible with its public nature; however, he does consider that, because the buildings, improvements, and installations belong to the concessionaire, they may be subjected to that regime and, consequently, may also be mortgaged.
  4. 5Rodrigo Oreamuno Blanco, in his capacity as First Vice President of the Republic and Minister of the Presidency, states that the Executive Branch has shown particular interest in ensuring that all acts, concessions, and procedures relating to the Proyecto Turístico de Papagayo are carried out in compliance with the regulations in force and with the framework of our Democratic State governed by the rule of law; accordingly, he considers that the challenged provisions do not violate constitutional principles in any respect and have no purpose other than to contribute to the proper legal treatment of matters relating to the project. Both executive decree number 22.489-MP-J-TUR and executive decree number 24.400-MP-J-TUR regulate the Registro de Concesiones del Proyecto Turístico Golfo de Papagayo, assigning it the function of registering all concessions granted in this area, their extensions, amendments, and cancellations, as well as encumbrances (gravámenes) and any act affecting, modifying, or extinguishing the rights arising from the concessions; therefore, there can be no violation of Articles 11, 121 subsection 14.), and 140 of the Political Constitution, because, in the absence of any withdrawal of property from the public domain (desafectación), this is not a matter subject to a statutory reservation (reserva de ley), but merely the implementation of a special registry (a section of the Registro General de Concesiones del Registro Público de la Propiedad).Accordingly, both Article 2 and Article 3 of decree number 22.400-MP-J-TUR—challenged in the action—merely establish registration requirements in that registry for both encumbrances and the administrative rights in rem referred to in the decree. Likewise, the challenged provisions explicitly state that the condominium ownership regime will apply insofar as it is compatible; this must be interpreted to mean that the registration of concessions or other acts must satisfy the requirements established in the Ley de la Propiedad Horizontal, provided that they are compatible with the legal nature of the maritime-terrestrial zone. Consequently, any requirement incompatible with this subject matter—concessions over public-domain property—could not be applied at all; for example, the submission of a certificate of ownership for the real property could not be required because it belongs to the public domain.Regarding the mortgage lien (gravamen hipotecario), he states that both the Ley de la Zona Marítimo Terrestre and Law number 6758 empower the Instituto Costarricense de Turismo to grant concessions over the areas allocated to the Proyecto Turístico de Papagayo and also authorize banks and the State to extend credit to concessionaires, taking as security not the real property, since it is public property, but exclusively “the respective concession (administrative right in rem) and the buildings and installations”; nor is there any violation of the principle of statutory reservation merely because the challenged decrees classify these encumbrances as “mortgage” encumbrances, since no encumbrance is being registered over the maritime-terrestrial zone. This means that the zone is neither being allocated to nor withdrawn from the public domain by decree; instead, the concession and the buildings and installations constructed in that zone are encumbered—that is, rights belonging to their holder—thereby satisfying the mortgage requirement that the encumbrance attach to property belonging to the mortgagor.This is a special type of mortgage encumbrance arising from the special regime governing the Proyecto Turístico de Papagayo. The encumbrance is so designated for practical purposes, in order to establish unequivocally—by analogy—the requirements, conditions, procedures, and other legal effects of the registration regime applicable to the encumbrances created pursuant to Article 4 of Law number 6758. He concludes by stating that there is no violation of the principle of equality because a special law (number 7658) establishes a special legal regime for the development of the Golfo de Papagayo, which does not violate the principle of equality; nor is there any misuse of authority (desviación de poder) or any concealed illegitimate purpose, since the challenged provisions clearly define their legal and registration-related content. Lastly, the alleged violation of Articles 50 and 89 of the Constitution is insufficiently substantiated and must therefore be rejected as inadmissible.
  5. 6Carlos Roesch Carranza, in his capacity as Nombre9143 Executive of the Instituto Costarricense de Turismo with the rank of Minister, responds to the hearing granted and requests that the action be summarily dismissed for lack of standing (legitimación) on the part of the petitioner, because it is vague: 1.- “the potential compensation that would be charged to taxpayers” would not arise; 2.- he does not demonstrate that he is a concessionaire (concesionario) whose rights could be affected by the challenged provisions, nor does he establish that he could become a future concessionaire; and 3.- the assertion that general interests exist in this case is unfounded because the arguments are false. As to the merits, he states that the challenged regulations comply with statutory and constitutional provisions and that the action should therefore be dismissed. He considers the statements contained in the challenged provisions to be correct, lawful, and consistent with the concepts recognized by both legal scholarship and case law, since it is clear that public property—such as the maritime-terrestrial zone (zona marítimo terrestre)—may be removed from the public domain (desafectada) only by law, and that the only way private parties may use and enjoy such land, without this entailing private appropriation, is through a concession (concesión) granted by the competent authority.The challenged provisions do not violate the inalienable status of the maritime-terrestrial zone, nor do they seek to remove assets from the State’s patrimony. Thus, Article 3 of Executive Decree number 24.400-MP-J-TUR concerns the registration of administrative real rights (derechos reales administrativos) arising from concessions granted in Bahía Culebra, and not the land itself; moreover, the horizontal property regime (propiedad horizontal) shall apply only insofar as it is compatible. By statutory provision—Law number 6370, dated September thirteenth, nineteen seventy-nine, concerning the acquisition of land for the development of the Proyecto Turístico Golfo de Papagayo, and the Ley Reguladora del desarrollo y ejecución del Proyecto Turístico Golfo de Papagayo, number 6758, dated June twenty-second, nineteen eighty-two—the Instituto Costarricense de Turismo, on behalf of the State, owns the real property included within the project and administers the adjacent maritime-terrestrial zone; private parties may develop such land only under a concession, and the land may not be transferred to private parties as property.Nevertheless, a public-domain concession (concesión demanial) constitutes a true administrative act that confers upon a private party a genuine, exclusive right in rem, enforceable against all others, to make private use of public-domain property, with the immediate consequence that such right may be entered or recorded in the registry—Article 30 of the Ley de la Zona Marítimo Terrestre. Because it is an administrative real right, it may be registered and encumbered (gravarse), since the provisions governing property rights apply to it insofar as they do not conflict with its legal nature. Both Article 67 of the Ley de la Zona Marítimo Terrestre and section 4 of Law number 6758 provide for the possibility of granting loans to concessionaires “secured by the respective concession and its buildings, improvements, and facilities”; and in opinion number C-103-93, the Procuraduría General de la República interpreted that, because the concession is a “true right in rem,” the appropriate security interest (garantía) to be granted over it is a mortgage (hipoteca).He reiterates that the security interest attaches to the administrative real right arising from the concession and that, in the event of a default on the obligation, it is that right which is enforced; such right does not entail ownership of the real property, which remains with the State, because its removal from the public domain may be authorized only by a law of the Republic. The State’s patrimony is therefore not placed at risk. Application of the horizontal property regime is not intended to “artificially” remove the property from the State, since the State retains ownership of these assets under all circumstances, and what is granted consists of concessions and subconcessions (subconcesiones) “under legal arrangements that are fully applicable to them and allow that regime to be adapted to the actual needs of the activity.” He states that the original concession is treated as the parent property (finca matriz), while the corresponding subsidiary properties (fincas filiales) are treated as partial concessions, and that the public deed establishing the condominium sets forth the other conditions inherent to the respective regime, as required by law, taking into account the particular conditions of the concession.The subconcessions granted under that regime remain subject to the restrictions applicable to the original concessionaires, pay the existing fees (cánones) proportionally, and must be authorized by the competent authority, which shall verify compliance with statutory requirements. Lastly, he states that there is no violation of the principle of equality—Article 33 of the Political Constitution—because “the principle of equal treatment cannot be applied indiscriminately between the concessionaires of the Proyecto Papagayo and the concessionaires of the maritime-terrestrial zone elsewhere in the country. This is because Law No. 6043 itself classifies the development of the Proyecto Papagayo as a ‘special case’ (Chapter IX, Article 74), governed primarily by a special law (No. 6758). Article 12 of the Project Development Law itself states that the Board of Directors of the Instituto shall grant concessions in accordance with the terms and conditions established by the Instituto for that purpose.This clearly demonstrates the difference in the treatment of concessions in one sector and the other, since the Project may grant concessions for terms exceeding twenty years, to foreigners, and without the specific conditions established by Law No. 6043, as the Procuraduría General de la República has repeatedly held. That difference is clear from the Law, because its purpose was to carry out a comprehensive, large-scale tourism development with its own special characteristics and conditions that would make its realization possible; accordingly, its special regulations contain elements that distinguish concessions granted within the Project from those granted elsewhere in the country.”
  6. 7Mauren Clarke Clarke, in his capacity as Minister of Justice, states that the Proyecto Turístico de Papagayo seeks to promote tourism development in Bahía Culebra because of the area’s particular conditions, and that the project has been controversial. He states that the Procuraduría General de la República, as the highest technical-legal advisory body of the Public Administration, has ruled on the project’s legality and propriety through Opinions number C-181-94, dated November twenty-third, nineteen ninety-four; number C-100-95, dated May tenth; and PGR 267-95, dated November third, both from nineteen ninety-five. He therefore adopts the cited opinions and the statements made by that institution in its report submitted in this action.
  7. 8By order issued at sixteen hours and twenty-five minutes on December eighteenth, nineteen ninety-five, José Manuel Ortiz Dueñas, acting in his capacity as general attorney-in-fact without monetary limitation for “Ecodesarrollo Papagayo, Sociedad Anónima,” was admitted as a passive intervenor (coadyuvante pasivo) in the action in support of the State’s representatives and in defense of the challenged regulatory provisions. He objects to the petitioner’s standing because: 1.- “the intervention of an ordinary inhabitant of the national territory in matters involving substantial interests of the State and of private investors cannot be unrestricted, because it could be used to hinder the development of important business ventures”; 2.- “it is impermissible for constitutional jurisdiction to be invoked merely out of a desire for attention or intellectual speculation, to the detriment of the country’s overall development and with serious harm to business owners”; 3.- only the individual concessionaires in Golfo de Papagayo would have standing, since they would be responsible for the direct defense of their rights; and 4.- there are no diffuse interests (intereses difusos) in this matter, because concessionaires located in the maritime-terrestrial zone along the country’s coastlines may challenge these regulations in defense of their rights.As to the merits, he states that the action is misdirected because the consequences of the reversion (reversión) to the State of the concessioned land for any reason would not be aggravated by the existence of one or more mortgage liens, regardless of whether the condominium had been built. It therefore appears that the action is actually directed against the granting of the concession itself, in which case the challenge should have been brought against the statutory and regulatory provisions authorizing this type of contract. He states that registry entries affect not the land itself, but the concession rights, and therefore do not “artificially” remove from the State the land to which those entries relate. The incorporation of principles from the Ley de Propiedad Horizontal into the challenged regulations was in no way intended to circumvent the principle of inalienability established by the provisions governing the maritime-terrestrial zone, because the State’s ownership rights over these assets have never been at issue under the Ley Reguladora del Desarrollo y Ejecución del Proyecto Turístico del Golfo de Papagayo, number 6758.Rather, the intent was to make use, to the extent possible, of those provisions of the special horizontal property regime that relate primarily to the management of condominium property (propiedad condominal), thereby allowing the physical works and the quality of services to be preserved and maintained in both vertical and horizontal developments through the joint participation of the Project’s residents. This is the only means of preventing the deterioration or decline that invariably occurs in developments of this type when responsibility for maintaining buildings, urban infrastructure works, and urban services themselves is entrusted to national or regional public entities. He concludes that all of the petitioner’s concerns regarding the challenged regulations result from an erroneous interpretation that fails to account for important aspects, such as the fact that a concession over public-domain assets (bienes demaniales) creates administrative real rights that confer upon their holder certain attributes similar to ownership, without making the holder the owner, including the ability to provide security interests based on those rights that may be recorded in the Registro Público de la Propiedad.

Justice Solano Carrera authored the opinion; and,

CONSIDERING:

I. REGARDING STANDING

Pursuant to the provisions of Article 75, second paragraph, of the Constitutional Jurisdiction Law (Ley de la Jurisdicción Constitucional), the petitioner has standing (legitimación) to bring this action in protection of diffuse interests (intereses difusos), since, as stated in the initial pleading, the Maritime-Terrestrial Zone Law (Ley Sobre Zona Marítimo Terrestre), N° 6043, of 2 de marzo de 1977, itself establishes in its first article that the maritime-terrestrial zone (zona marítimo terrestre) is part of the national patrimony and imposes a duty of protection upon all inhabitants of the country. Any person may therefore have recourse to the constitutional jurisdiction in pursuit of a declaration of unconstitutionality, without the need for a prior proceeding, since it would even be practically impossible to meet the requirements for being a party to an ordinary judicial proceeding, in which a present, specific, and personal interest is required in order to bring suit.

In the constitutional jurisdiction, by contrast, it is evident that the law provides much broader access, because the purpose is to preserve the principle of constitutional supremacy and, consequently, standing is more flexible, particularly in cases involving the defense of diffuse interests, as in this instance, or interests concerning the community as a whole. As the Procuraduría General de la República states in its report appearing at folios forty-five through sixty-five of the case file, there is virtually no possibility that harm to assets in the maritime-terrestrial zone would give rise to an individual and direct injury; accordingly, the “protection” referred to in Ley N° 6043 may perfectly well be understood in the terms in which Mr. Nombre60819 brings this action, as any person could, with no requirement beyond the defense of those diffuse interests in assets that may be regarded as belonging to everyone (“res comunes,” or for the enjoyment of all, as referred to in judgment N° 447-91 of this Chamber).

II. SCOPE OF THE MATTERS CHALLENGED IN THE ACTION

The action challenges Decreto Ejecutivo N° 2440-MP-J-TUR, which amends earlier decrees and Article 67 of Ley N° 6043, insofar as that legislation “allows Banks within the National Banking System or other State institutions to grant loans secured by the concession (concesión), buildings, improvements, and facilities (...) constructed in the maritime-terrestrial zone (...).” “The aforementioned decree authorizes such an encumbrance (gravamen) to be treated as a mortgage, in direct contradiction of our Constitution, the Civil Code, our most cherished case law, and other laws...,” as the heading of the filing instituting the action states. The petitioner emphasizes that Ley N° 6758, which governs the development of the Golfo de Papagayo tourism project, does not remove the area between Punta Cabuyal and Punta Cacique from its designation (desafectación) as maritime-terrestrial zone. And when he refers to the fact that Decreto Ejecutivo N° 22489 MP-J-TUR (now amended by DE-2440-MP-J-TUR) already implemented the provisions of Article 74 of that Law, he disagrees with its use of the term “exception regimes” rather than “special cases,” as he would understand those relating to that tourism project, given that its conditions and circumstances differ from those of other areas of the maritime-terrestrial zone.

In Judicial Bulletins numbers 217, 218, and 219, dated 15, 16, and 17 de noviembre de 1995, the Chamber reported the existence of this action for the purposes of Article 81 of the Law governing this jurisdiction. There it specified, for all purposes, but specifically for those of this proceeding, that the action had been admitted in very specific terms:

“This action is admitted solely insofar as it challenges the amendment of Decreto Ejecutivo número 22.489 MP-J-TUR, allowing construction in the Maritime-Terrestrial Zone, within the Bahía Culebra Comprehensive Development Project (Papagayo Project), under the condominium ownership regime (régimen de propiedad horizontal), thereby artificially removing from the State patrimony the land on which such condominiums are developed, and authorizing banks within the national banking system and other State institutions to grant loans secured by the concession, buildings, improvements, and facilities—Article 67—constructed in the maritime-terrestrial zone, allowing those loans to be secured by mortgage encumbrances, which the petitioner considers contrary to Articles 11, 33, 49, final two paragraphs, 50, 89, 121 subsections 1) and 14), and 149 subsections 3) and 19) of the Political Constitution, as well as contrary to the case law of this Chamber...”

III. THE MERITS PROPER

Articles 67 and 74 of Ley N° 6043/77 provide:

“Article 67. The banks of the National Banking System and State institutions are authorized to grant loans to concession holders in the restricted zone (zona restringida) of the maritime-terrestrial zone, secured by the respective concession and its buildings, improvements, and facilities.” “Article 74. With respect to the Bahía Culebra Comprehensive Development Project, whose coastline is bounded to the north at the point on the Costa Rica Lambert Grid, latitude 2/94 and longitude 3/50, that is, from Punta Cabuyal to Punta Cacique, the affected areas shall remain under the direct administration of the Instituto Costarricense de Turismo. The regulations governing that development shall be drafted by the Executive Branch, after consultation with that Institute...” It is true, as the Procuraduría General de la República states, that although the concession for the use of public assets (bienes públicos) is governed by rules of public law, this does not negate the fact that, for all purposes, the concession—that is, what has been granted—becomes part of the concession holder’s patrimony, since it grants the holder a right or advantage over the public-domain asset (bien demanial).

In that respect, the legitimacy of the statutory provision allowing the concession to be pledged as security for a loan obtained by its holder is beyond reproach. From that perspective, and as acknowledged by the legal scholarship that has developed around this issue, this constitutes the legitimate exercise of the rights that the concession holder derives from a genuine administrative property right (derecho real administrativo) granted over the public-domain asset (bien de dominio público). The same may be said, with even greater force, regarding security interests in buildings, improvements, and facilities, which no one disputes may be added by the concession holder, provided that the applicable statutory and regulatory land-use provisions (disposiciones urbanísticas) are observed.

Certainly, this provision has been applied extensively throughout the decades of its existence without significant difficulty. The concession regime governing the restricted portion of the maritime-terrestrial zone is special, and thus no one has until now suggested, for example, that because it conflicts with the general rule contained in Article 505 of the Civil Code, under which the right of ownership extends by accession (accesión) to what is situated upon the surface, it is legally impossible for a private party to acquire rights over a building constructed on the land covered by the concession.

The truth is that Articles 67 and 74 of Ley N° 6043/77 have not only been applied without difficulty, but, in light of that uncontroversial application, they are practically reproduced in Ley N° 6758, of 4 de junio de 1982, which governs the development and implementation of the Papagayo (Bahía Culebra) tourism project. Indeed, all of Ley 6758 was enacted in accordance with the concept set forth in Article 74 of N° 6043, while its Article 4° is identical to Article 67 transcribed above.

Within the context of the petitioner’s core argument, the question therefore arises: does encumbering a concession of this nature remove the maritime-terrestrial zone from its designation? The answer must be no, because if the grant of the concession does not remove that designation, neither would this ancillary aspect. There is no legal basis whatsoever for maintaining that a mortgage encumbrance on the concession, or on the works constructed there, results in removal from that designation. In any event, the State will retain a form of eminent domain (dominio eminente), regardless of the outcome of the encumbrance. It should be recalled that although the concession is permanent, it is revocable.

IV. POLITICAL CONSTITUTION AND THE MARITIME-TERRESTRIAL ZONE

It is also appropriate to bear in mind that the Political Constitution does not address matters relating to the maritime-terrestrial zone, its development as a concept, or the applicable legal regime. Instead, there has been a very longstanding legal tradition that, it bears noting, has not been consistent. It should be noted that there have been changes both to the width of the maritime-terrestrial zone—formerly the maritime mile—and to the specific regulation of certain islands which, although in principle and by operation of law forming part of the maritime-terrestrial zone, have over time become subject to exceptions based on classifications freely adopted by the ordinary legislature. As examples, one may cite Ley N° 7108/88, which exempted Isla de Chira from the general legislation, and Ley N° 6515/80, which likewise exempted from that general legislation the parcels in the maritime-terrestrial zone declared to be an urban area in the ninth district of the central canton of Puntarenas, provided that they had previously been lawfully possessed by private parties.

Also exempted under Ley N° 6043, and granted a fully private regime, are properties whose previously registered boundary directly adjoined the sea. What may be stated, given the extraordinary legislative variability in this area, is that the immutable core of the law governing the maritime-terrestrial zone has concerned the fifty-meter-wide strip measured from the ordinary high-tide line (pleamar ordinaria), which has been declared public and which, as such, not only cannot be appropriated by any means, but has also been placed at the service of all persons without exception. The public-domain status (demanialidad) of that strip has therefore received sustained legal recognition and might prima facie be regarded as beyond the legislature’s power to alter because of its immemorial nature, although this issue is unrelated to the principal matter disputed in the action and therefore need not be analyzed in this judgment.

Nevertheless, the foregoing helps us understand that, with respect to the restricted zone—that is, the remaining 150 meters of the maritime-terrestrial zone—the legislature must be recognized as having the authority to enact such regulations as circumstances require, provided, of course, that they do not impair vested rights (derechos adquiridos) or other constitutionally recognized rights, or exceed the bounds of reasonableness essential to every legal rule. Beyond those limits, the legislative provisions concerning the subject matter of this action are practically beyond alteration by the constitutional jurisdiction.

V. THE CONSTITUTION AND DECRETO EJECUTIVO N° 24400-MP-J-TUR

Executive Decree No. 24400-MP-J-TUR is part of a series of decrees concerning the matter. Its innovation lies in allowing the use of the condominium ownership system (sistema de propiedad horizontal) in buildings constructed within the Proyecto de Papagayo area. In the petitioner’s opinion, however, this regulation creates a blending of treatment between private or individual property and common property, fundamentally with regard to the land on which the building or buildings in question are situated. If the arguments offered by Mr. Nombre60819 on this point are carefully analyzed, we find neither a constitutional provision that is violated as a result of the foregoing nor even a principle that may be inferred from the Constitution as a whole, since in any event this would involve a premise uniformly accepted by the legal system: namely, that the so-called restricted zone (zona restringida), through a concession regime (régimen de concesión), may be placed in private possession, with the possibility of alteration.

Clarifying that at no point does the petitioner explain his reasons for considering this to be so, it is appropriate to review, in the order in which he cites them, the provisions of the Political Constitution that he considers to have been infringed by virtue of Decree 24.400 MP-J-TUR:

A. Article 11. This provision embodies the principle of legality (principio de legalidad), and consequently the so-called principle of constitutional legality (principio de legalidad constitucional), under which no public official may act except in accordance with constitutional and statutory mandates. This fidelity required of public officials or authorities thus embodies and is inspired by the principle of constitutional supremacy (principio de supremacía constitucional). Notwithstanding its importance, in this specific case the petitioner does not explain how the principle of legality is affected when it is precisely the law that regulates the possibility that the concession, or the structures erected by a private party in the maritime-terrestrial zone (zona marítimo terrestre), may be encumbered as security for loans from banking institutions.

B. Article 33. The petitioner considers that the equality before the law guaranteed by this provision of the Constitution has been violated, but here too no reasons are provided. Since the petitioner has no prior proceeding, it is clear that he cannot base his claim of unequal treatment on an act or acts that, by virtue of the challenged provisions, place him at a disadvantage or subject him to differentiated, discriminatory, or unfair treatment. Moreover, if we consider that the challenged rules allow the concession holder (concesionario) to encumber the structures that he builds in the restricted zone, it could instead be said that their purpose is to place him in a position to reasonably exercise the benefit conferred by the concession because, as we have stated, it constitutes a true administrative property right (derecho real administrativo).

C. Article 49 (last two paragraphs). It is obvious that these provisions concern the scope of jurisdiction of the administrative litigation courts (jurisdicción contencioso administrativa). From that perspective, therefore, they provide no support for the petitioner’s position, particularly because, as already indicated in the preceding sections, he likewise fails to explain the extent to which the Chamber could rule on the matter in these proceedings.

D. Article 50. There is no argument at all that must be examined in relation to this point, and if the issue were the quality of life that the State must guarantee to individuals, it would be necessary to examine specific acts or authorizations for use of the maritime-terrestrial zone and to challenge such actions through appropriate procedural mechanisms. With regard to Article 50 of the Constitution, it is worth noting that constitutional case law has broadened the standing (legitimación) of individuals to pursue amparo proceedings (vía del amparo) in defense of the rights guaranteed therein to all inhabitants of the country.

E. Article 89. The same may be said of this constitutional provision, because the Chamber has not been given any reasons that must be examined to determine the extent to which the challenged rules undermine the purposes assigned to the State.

F. Article 121, subsections 1) and 14). Nor are any reasons provided to establish the extent to which this article, concerning the powers and duties of the Legislative Assembly in the exercise of its legislative authority, has been infringed. Rather, for purposes of understanding legislative powers, our system assumes a principle of freedom for the Legislative Assembly, limited only by an express prohibition in the Political Constitution.

G. Article 140, subsections 3) and 19). With respect to this provision, the action states that, by issuing Executive Decree No. 24400-MP-J-TUR, the Executive Branch contravenes the law and therefore “is not fulfilling its constitutional obligation to ensure exact compliance with the laws.” The application instituting the action states that “if what is sought through the challenged decrees is carried out, the nature of the maritime-terrestrial zone would cease to be a reality and become a mere appearance, because the Executive has disregarded the mandates established by the Constitution” (sic, folio 23); however, as we stated supra, the petitioner’s assertions are inconsistent with the nature of the maritime-terrestrial zone and the legal doctrines (institutos jurídicos) under discussion. We therefore return to the central issue. The action seeks to have the Chamber accept that, because the land on which a building subject to condominium ownership stands is common property under the Civil Code, it is plainly legally impossible for such an arrangement to exist in the maritime-terrestrial zone.

As already stated, the Political Constitution provides no guidance regarding the maritime-terrestrial zone; consequently, this is a matter in which the legislature has freedom, with its rules subject only to standards of reasonableness. In the situation under review, the State may, through legislation and the corresponding regulations, establish a legal framework governing concessions granted in the maritime-terrestrial zone (restricted zone), particularly in a region that approximately twenty years ago was declared by the legislature to be a high priority for the development of tourism in the country.

As to the “cara jurisprudencia” existing on the subject and referred to in the action, there is not even a citation that would make it necessary to analyze the matter; therefore, as stated in the preceding recitals (considerandos), the issue in dispute cannot be resolved in the manner sought by Mr. Nombre60819.

For the foregoing reasons, the action must be dismissed.

THEREFORE (POR TANTO):

The action is dismissed.

Decision No. 0506-1-97 INTERLOCUTORY ORDER CONSTITUTIONAL CHAMBER OF THE SUPREME COURT OF JUSTICE. San José, at fourteen hours thirty minutes on the twenty-eighth day of October, nineteen ninety-seven.

Having reviewed the application by the Solicitor General of the Republic appearing from folio 182 onward, in which he requests clarification of a paragraph contained in Recital IV of Judgment No. 5210-97, which appears in the record.

Opinion authored by Justice Solano Carrera; and,

CONSIDERING:

I: The paragraph that the Solicitor General requests be clarified states:

“Also excepted, by provision of Law No. 6043, and granted a fully private regime, are properties whose boundary directly adjoining the sea had been officially recorded prior thereto…” Certainly, as the applicant argues, the aforementioned Law recognizes situations such as those referenced when they have arisen legitimately, and not, as in the examples he cites, outside or contrary to legal requirements and provisions. However, aside from the fact that Article 6 of Law No. 6043 would make no sense except as a means of recognizing legal situations that had become vested (situaciones jurídicas consolidadas), within the meaning of Article 34 of the Constitution, the concept of a “fully private regime” cited in the paragraph at issue should be qualified, insofar as it may go beyond what the Law establishes and what is described in the application, such as, for example, the provisions of Article 25 thereof.

In any event, so that the Solicitor General does not carry his concerns beyond what is reasonable, it must be added that the point from the judgment that he has singled out is not material to the ruling in the aforementioned judgment and merely formed part of a list of exceptions within the tension between public domain (dominio público) and private domain (dominio privado) that has arisen throughout the legislative history of the maritime-terrestrial zone.

As a consequence of the foregoing, what must be deemed clarified in the judgment on the merits (sentencia de mérito) concerns the phrase “fully private regime” appearing in Recital IV.

THEREFORE (POR TANTO):

It is clarified that the concept of a “fully private regime,” contained in Recital IV of Judgment No. 5210-97 of 16 hours on 02 September 1997, must be understood, among other things, within the provisions of Article 25 of Law No. 6043. In all other respects, the application is denied.

Intervienen en la acción Farid Beirute Brenes, de Procurador General Adjunto, Rodrigo Oreamuno Blanco, en su condición de Primer Vicepresidente de la República y Ministro de la Presidencia, Carlos Roesch Carranza, como Nombre9143 Ejecutivo del Instituto Costarricense de Turismo con rango de Ministro y Mauren Clarke Clarke, en su condición de Ministro de Justicia. Figura como coadyuvante pasivo de la acción José Manuel Ortiz Dueñas, como apoderado general sin límite de suma de "Ecodesarrollo Papagayo, Sociedad Anónima".

RESULTANDO:

  1. 1El accionante promueve acción de inconstitucionalidad contra el Considerando 3, artículos 2 y 3 del Decreto Ejecutivo número 224.400-MP-J-TUR y el dictamen de la Procuraduría General de la República N° Placa32340, del cuatro de agosto de mil novecientos noventa y tres, referente a la Ley número 6758, que regula el desarrollo y ejecución del Proyecto del Golfo de Papagayo; únicamente en cuanto reforma el decreto ejecutivo N° 22.489-MP-J-TUR, en virtud de lo cual: 1.-

se permite la construcción en la zona marítimo terrestre en el proyecto de desarrollo integral en Bahía Culebra (Proyecto de Papagayo) bajo el régimen de propiedad horizontal (condominios), haciendo salir artificiosamente del patrimonio del Estado los terrenos en que aquellos se construyan; y 2.- se autoriza a los bancos del sistema bancario nacional o a otras instituciones del Estado para que concedan préstamos sobre la concesión, edificaciones, mejoras e instalaciones -artículo 67 de la Ley de la Zona Marítimo Terrestre- que en la zona marítimo terrestre se hagan, permitiendo garantizarlos con gravámenes de carácter hipotecario; con lo que resultan infringidos los artículos 11, 33, 49 en sus últimos dos párrafos, 50, 89, 121 incisos 1.) y 14.), 149 incisos 3.) y 19.) de la Constitución Política y la Jurisprudencia de la Sala Constitucional referentes a la materia. En cuanto a la propiedad horizontal, indica que el régimen de la propiedad horizontal surgió como una verdadera ley social, tendente a solucionar el problema de la vivienda, para lograr un mayor bienestar social; régimen que posteriormente se aplicó a otros fines, como comercio, oficinas, bodegas, industria y turismo.

De conformidad con la doctrina y la legislación, es una nueva figura que tiene su propia naturaleza, y como tal se entiende su esencia y características, que la distinguen de otros géneros o especies y aplicación. Así, ésta resulta de la "mezcla" de una propiedad particular o individual y una propiedad común, la cual abarca desde los cimientos y el terreno hasta las paredes que sustentan el edificio; y sin áreas comunes no hay condominio. La propiedad horizontal es literalmente la de pisos en un edificio que consta de más de una planta, es decir, se trata de pisos superpuestos en sentido vertical, y en el caso de aplicarse este régimen sobre bienes de dominio público, resulta que son incompatibles, dado que las áreas comunes se ubican sobre la zona marítimo terrestre, ¿cómo se explica la propiedad privada sobre un bien demanial, dado que según la doctrina y legislación -artículo 20 de la Ley de la Propiedad Horizontal-, el terreno sobre el que se asienta el edificio es un bien necesariamente común de éste régimen de propiedad?

Además, el condominio como consorcio de propiedades tiene una personalidad jurídica independiente, y el Registro Público al inscribir el título constitutivo del régimen le otorga un número de cédula, desapareciendo la inscripción original de la finca sometida al régimen y da lugar a la finca matriz, que es la suma del terreno, áreas comunes y edificaciones que contiene los pisos, departamentos y locales, que posteriormente darán lugar a las fincas filiales; y al inscribir las filiales le asigna un número que les identifica y diferencia de las demás. A este respecto, estima que la Procuraduría General de la República se contradice en su fundamentación, ya que afirma que únicamente lo sometido a la propiedad horizontal es el edificio, ya que éste es el bien privado o particular, por cuanto le haría falta las áreas comunes, que se ubican sobre un bien demanial, y como se había indicado, sin áreas comunes no hay condominio.

Asimismo señala que Costa Rica no tiene regulado el derecho de superficie, como si lo tienen otras legislaciones -caso de España-, figura que la Procuraduría pretende aplicar en esta situación. El derecho de superficie implica la existencia de dos propietarios sobre un mismo bien inmueble: a uno pertenece la nuda propiedad, o sea el terreno, que continua sobre su dominio; y a otro (tercero superficiario) las construcciones o plantaciones sobre el terreno erigidas, sobre las que tendrá un amplio goce o disfrute, pero siempre únicamente superficiario. De conformidad con nuestra legislación, el Código Civil expresamente prohibe el derecho de superficie; por lo que la propiedad privada no tiene límite para su extensión -abarca el suelo y toda su profundidad y al espacio aéreo sobre el suelo en líneas perpendiculares- con un dominio total y absoluto tanto en el espacio aéreo como subsuelo. En virtud de lo anterior, no debe confundirse la figura del condominio con el derecho de superficie que consiste en tener una edificación o una plantación en terreno ajeno.

En el caso del condominio, el terreno área común de todos los condóminos -semejante a la copropiedad tradicional-, lo construido sobre él no sería terreno ajeno, sino propio en condominio. Lo importante a determinar en este punto, es cómo conjugar el hecho de que se pueda ser propietario sólo del edificio sino concesionario también. En lo que se refiere a la garantía de las concesiones mediante hipoteca; señala que el legislador no establece que la garantía sobre las concesiones deba hacerse mediante la hipoteca, regula el desarrollo y ejecución del Proyecto del Golfo de Papagayo, y ésta es establecida en el decreto impugnado. Estima que para poder inscribir tales hipotecas, debería de modificarse tal y como ahora está establecido su régimen jurídico en el Código Civil; y en el caso en particular, si lo que se grava es la concesión misma, no debe desnaturalizarse la figura de la hipoteca, tal y como está establecida, sobre todo que en el Registro Público de la Propiedad existe un Registro de Concesiones, por lo cual el préstamo concedido debería inscribirse en este registro, ya que estaría garantizado con los principios de registrales de rogación, prioridad, fe pública y seguridad. Asimismo, señala que la garantía sobre concesiones mediante hipoteca, se hace únicamente para el proyecto de Papagayo, y no para el resto de las concesiones dadas en la zona marítima terrestre.

  1. 2El Patente fundamenta su legitimación para promover esta acción en la existencia de intereses difusos que atañen a la colectividad en su conjunto, en defensa de los bienes del Estado -zona marítimo terrestre-, cuya protección es obligatoria de todos los habitantes del país, de conformidad con lo dispuesto en el artículo 1° de la Ley de la Zona Marítimo Terrestre.
  2. 3Mediante resolución de Presidencia de las diez horas quince minutos del veintisiete de octubre de mil novecientos noventa y cinco, se le dio curso a la acción, confiriéndosele audiencia a la Procuraduría General de la República, al Ministro de la Presidencia, al Ministro de Justicia y al Ministro de Turismo.
  3. 4Farid Beirute Brenes, en su condición de Procurador General Adjunto, presentó su informe en tiempo. En cuanto a la legitimación del accionante, estima que se encuentra legitimado para promover la acción, en razón de que la posible afectación de un bien de dominio público no puede causar una lesión individual y directa, por lo que no podría exigirse un asunto pendiente de resolver; además de que hay un interés difuso por la naturaleza del objeto que se intenta proteger -bienes de dominio público-(sentencias números 980-91 y 3294-92). En cuanto al fondo, considera que no lleva razón el accionante, por no darse las violaciones inconstitucionales alegadas, debiendo declararse sin lugar la acción. Es incuestionable que el bien de dominio público no puede ser hipotecado, enajenado ni embargado; sin embargo, lo que se pretende hipotecar en este caso no es el bien -zona marítimo terrestre-, sino la concesión dada sobre el bien demanial; por cuanto de la concesión demanial nace un auténtico derecho real eficaz erga omnes, enajenable e hipotecable ("derechos reales administrativos"), es decir, se deriva un derecho patrimonial que integra el derecho de propiedad del concesionario.Es claro que las obras realizadas en un bien de dominio público son propiedad exclusiva del concesionario, por que tales obras no son otra cosa que la materialización o expresión del derecho de uso especial emergente de la concesión. Además, tanto la Ley de la Zona Marítimo Terrestre -número 6043, de tres de marzo de mil novecientos setenta y siete-, en su artículo 67, como la Ley que regula el desarrollo y ejecución del Proyecto de Papagayo en Bahía Culebra -número 6758, de cuatro de junio de mil novecientos ochenta y dos-, permiten a los bancos del sistema bancario nacional e instituciones del Estado conceder préstamos a concesionarios de la zona restringida, de la zona marítimo terrestre, con garantía de la propia concesión, obras, edificaciones y mejoras; por lo que el decreto impugnado lo que hace es reflejar lo dicho en la legislación, pero aplicado al caso concreto. De lo anterior, concluye que en el ordenamiento jurídico costarricense es posible admitir la hipoteca tanto sobre la concesión como sobre las obras, mejoras e instalaciones.Esta situación no deviene contraria al artículo 33 de la Constitución, ya que es la Ley de la Zona Marítimo Terrestre la que permite tal situación en todo el país, aplicándose a todos los concesionarios de la zona restringida de la zona marítimo terrestre. En lo que se refiere a la propiedad horizontal, señala que el propio artículo 3 del decreto ejecutivo número 24.400-MP-J-TUR dispuso que las normas referentes a este régimen de propiedad únicamente serán aplicables en esta zona en cuanto éstas fueren compatibles. Dada la naturaleza pública de los bienes que se encuentran de por medio (dominio público), priva sobre ellos el derecho público, en cuanto a su uso por parte de particulares concesionarios, pero pueden aplicarse principios y disposiciones de la propiedad horizontal, que razonablemente sean compatibles. Así, la propiedad horizontal está formada por bienes comunes y particulares individuales; y en este caso, se tendrán como bienes particulares la porción individual de la edificación, no del terreno; y se tendrán como bienes comunes, la porción parcial común no indivisible de la edificación.Al realizarse una venta del derecho de propiedad de la edificación sometida a lo que fuere compatible con el régimen de la propiedad horizontal, se realiza una cesión parcial del edificio y no del derecho de concesión de uso, ya que éste es una relación intuito personae, que deberá ser autorizada por el Instituto Costarricense de Turismo -artículo 6 inciso 2.) del decreto ejecutivo número 22.489-MP-J-TUR. Y termina señalando que no hay posibilidad jurídica de que del derecho de concesión de uso de bien dominio público (sobre la zona restringida de la Zona Marítimo Terrestre) sea sometido al régimen de propiedad horizontal, por no ser compatible con su naturaleza pública; pero si considera que al ser las edificaciones, mejoras e instalaciones propiedad del concesionario, éstas si pueden sujetarse a éste régimen, y por lo tanto, también pueden ser hipotecadas.
  4. 5Rodrigo Oreamuno Blanco, en su condición de Primer Vicepresidente de la República y Ministro de la Presidencia, afirma que el Poder Ejecutivo ha demostrado especial interés en que todos los actos, concesiones y procedimientos relativos al Proyecto Turístico de Papagayo se realicen con apego a la normativa vigente y al régimen de nuestro Estado Democrático de Derecho; en virtud de lo cual estima que la normativa impugnada en nada violentan los principios constitucionales, ni tiene otro fin que el de contribuir a un correcto tratamiento jurídico de los asuntos relativos al proyecto. Tanto el decreto ejecutivo número 22.489-MP-J-TUR como el decreto ejecutivo número 24.400-MP-J-TUR regulan el Registro de Concesiones del Proyecto Turístico Golfo de Papagayo, otorgándole la función de inscribir todas las concesiones que se otorguen en esta zona, sus prórrogas, modificaciones y cancelaciones, además de los gravámenes y cualquier acto que afecte, modifique o extinga los derechos derivados de las concesiones; por lo que no puede haber violación de los artículos 11, 121 inciso 14.) y 140 de la Constitución Política, ya que al no haber desafectación de un bien demanial no se está en presencia de materia de reserva de ley, sino que únicamente se está implementando un registro especial (sección del Registro General de Concesiones del Registro Público de la Propiedad).De este modo, tanto el artículo 2 como el 3 del decreto número 22.400-MP-J-TUR -impugnados en la acción- solamente establecen requisitos de inscripción en dicho registro, tanto para los gravámenes como de los derechos reales administrativos a que se refiere el decreto. Asimismo, la normativa cuestionada explícitamente señala que el régimen de la propiedad horizontal será aplicado en lo que fuere compatible; con lo cual debe interpretarse que la inscripción de concesiones u otros actos, se deben exigir los requisitos establecidos en la Ley de la Propiedad Horizontal, siempre y cuando fueren compatibles con la naturaleza jurídica de la zona marítimo terrestre, con lo cual, cualquier requisito que no sea compatible con esta materia -concesiones sobre un bien de dominio público- no podría aplicarse del todo, así por ejemplo, no podría exigírsele la presentación de la certificación de propiedad del inmueble, por ser éste de dominio público.En cuanto al gravamen hipotecario, indica que tanto la Ley de la Zona Marítimo Terrestre como la Ley número 6758 facultan al Instituto Costarricense de Turismo para otorgar concesiones sobre las áreas afectadas en el proyecto turístico de Papagayo, y también autorizan a los bancos y al Estado para otorgar créditos a los concesionarios, poniendo como garantía no el inmueble, pues es bien público, sino exclusivamente "sobre la respectiva concesión (derecho real administrativo) y sobre las edificaciones e instalaciones)"; y no hay violación al principio de reserva legal por el hecho de que sean los decretos impugnados los que establezcan la calificación de estos gravámenes como "hipotecario", por cuanto no se trata de la inscripción de gravamen sobre la zona marítimo terrestre, lo cual implica que no se está afectando (ni desafectando) esa zona vía decreto, sino que lo que se grava son la concesión, edificaciones e instalaciones sobre esa zona construidas; es decir, sobre derechos propios del titular, con lo cual se da cumplimiento al requisito hipotecario de que recaiga sobre cosa propia.Se está frente a un tipo de gravamen hipotecario de carácter especial, generado por el régimen especial del proyecto turístico de Papagayo. Se le denomina así al gravamen por efectos prácticos, para determinar de modo inequívoco -por analogía- los requisitos, condiciones, trámites y demás efectos jurídicos del régimen registral de los gravámenes creados, conforme al artículo 4 de la Ley número 6758. Concluye señalando que no hay violación al principio de igualdad, toda vez que existe una ley especial (la número 7658) que determina un régimen jurídico especial para el desarrollo del Golfo de Papagayo, lo cual no violenta el principio de igualdad; ni tampoco existe desviación de poder ni fines ilegítimos ocultos, ya que la normativa cuestionada es clara al determinar su contenido jurídico-registral. Por último, no hay fundamentación suficiente sobre la violación de los artículos 50 y 89 de la Constitución, por lo cual debe rechazarse por improcedente este alegato.
  5. 6Carlos Roesch Carranza, en su condición de Nombre9143 Ejecutivo del Instituto Costarricense de Turismo con rango de Ministro, contesta la audiencia concedida y solicitada que la acción sea rechazada de plano por falta de legitimación del accionante, ya que la misma resulta vaga: 1.- "las posibles indemnizaciones que se cargarían a los contribuyentes" no se darían; 2.- no demuestra su condición de concesionario que pudiera ser afectado en su derecho por las normas impugnadas, ni tampoco acredita que pueda ser un futuro concesionario; y 3.- carece de fundamento la consideración de que en este caso existen intereses generales, por ser argumentos falsos. En cuanto al fondo, señala que la normativa cuestionada se encuentra apegada a las disposiciones legales y constitucionales, por lo que la acción debe ser declarada sin lugar. Considera correctos y apegados a derecho y a los conceptos manejados tanto por la doctrina como por la jurisprudencia, lo manifestado en las normas impugnadas, ya están claros que un bien público -como lo es la zona marítimo terrestre- sólo puede ser desafectada por ley, y la única forma en que los sujetos privados puedan usar y gozar de dichos terrenos, sin que implique apropiación privada- es mediante la concesión que haga la autoridad competente.Las normas cuestionadas no violan la condición de inalienabilidad de la zona marítimo terrestre, ni tampoco pretende extraer patrimonio del Estado. Así, el artículo 3 del decreto ejecutivo número 24.400-MP-J-TUR se refiere a la inscripción de los derechos reales administrativos derivados de las concesiones otorgadas en Bahía Culebra, y no a los terrenos; además la propiedad horizontal será aplicable únicamente en lo que fuere compatible. Por disposición legal -Ley número 6370, de trece de setiembre de mil novecientos setenta y nueve, relativa a la adquisición de tierras para el desarrollo del Proyecto Turístico Golfo de Papagayo y la Ley Reguladora del desarrollo y ejecución del Proyecto Turístico Golfo de Papagayo, número 6758, de veintidós de junio de mil novecientos ochenta y dos- el Instituto Costarricense de Turismo, en representación del Estado, es el propietario de los bienes inmuebles incluidos dentro del proyecto, y el administrador de la zona marítimo terrestre adyacente; y sólo por concesión los particulares pueden desarrollar tales terrenos, no pudiendo ser trasladados a particulares a título de propiedad.Sin embargo, la concesión demanial constituye un verdadero acto administrativo que confiere al particular un verdadero derecho real, exclusivo y excluyente, de utilizar privativamente un bien de dominio público, y la consecuencia inmediata es que tal derecho es inscribible o registrable -artículo 30 de la Ley de la Zona Marítimo Terrestre-. Por ser un derecho real administrativo, es afecto a inscribirse y también a gravarse, ya que le son aplicables las disposiciones propias del derecho de propiedad, en tanto no se opongan a la naturaleza jurídica de la misma. Tanto la Ley de la Zona Marítimo Terrestre en su artículo 67, como la Ley número 6758 en su numeral 4, establecen la posibilidad de otorgar préstamos a los concesionarios "con garantía de la respectiva concesión, sus edificios, mejoras e instalaciones"; y en el informe número C-103-93, la Procuraduría General de la República interpretó que por tratarse la concesión de un "verdadero derecho real", la garantía que correspondía otorgar sobre la concesión, es la hipoteca.Reitera que la garantía recae sobre el derecho real administrativo de concesión, y que en caso de incumplimiento de la obligación, lo que se ejecuta es ese derecho, el cual no conlleva el derecho de propiedad sobre el inmueble, que mantiene el Estado, por cuanto su afectación sólo puede ser autorizada por ley de la República, con lo cual no se pone en peligro el patrimonio del Estado. Con la aplicación del régimen de la propiedad horizontal no se pretende hacer salir "artificiosamente" la propiedad del Estado, ya que éste conserva bajo cualquier circunstancia la propiedad de estos bienes, y lo que se otorgan son concesiones y subconcesiones "bajo figuras jurídicas que le son de plena aplicación y que le permiten adaptar dicho régimen a las necesidades reales de la actividad." Asegura que se tiene la concesión original como la finca matriz y las fincas filiales correspondientes como concesiones parciales, estableciéndose en la escritura pública de la constitución del condominio las demás condiciones inherentes al régimen respectivo, según exige la ley; tomando en cuenta las condiciones propias de la concesión.Estas subconcesiones que se otorguen bajo el referido régimen, mantienen las restricciones que se establecen para los concesionarios originarios, pagando proporcionalmente los cánones existentes, y deben ser autorizadas por la autoridad competente, que verificará el cumplimiento de los requisitos de ley. Por último, señala que no hay violación al principio de igualdad -artículo 33 de la Constitución Política-, toda vez que "no puede aplicarse indiscriminadamente el principio de igualdad de condiciones entre los concesionarios del Proyecto Papagayo, con los concesionarios de la Zona Marítimo Terrestre del resto del país. Lo anterior, por cuanto la misma Ley No. 6043, ubica el desarrollo del Proyecto Papagayo como un "caso especial", (capítulo IX, artículo 74), regido prioritariamente por una ley especial (No. 6758). La misma Ley de Desarrollo del Proyecto, en su artículo 12, indica que la Junta Directiva del Instituto otorgará las concesiones de conformidad con los plazos y las condiciones que el Instituto establezca al efecto.Lo anterior deja clara la diferencia de tratamiento a las concesiones de uno u otro sector, pudiendo en el Proyecto otorgarse concesiones con plazos superiores a los veinte años, a extranjeros, y sin los condicionamientos específicos que establece la Ley No. 6043, según reiteradamente lo ha establecido la Procuraduría General de la República. Dicha diferencia es clara en la Ley, por cuanto con la misma lo que se pretendió fue la realización de un desarrollo turístico integral de gran envergadura, con características y condiciones especiales y propias, que permitiesen hacerlo realidad, por lo que su normativa especial contiene elementos diferenciadores para las concesiones que se otorguen en el mismo, de las que se otorguen en el resto del país."
  6. 7Mauren Clarke Clarke, en su condición de Ministro de Justicia, señala que el Proyecto Turístico de Papagayo procura el desarrollo en Bahía Culebra en materia turística, por las condiciones particulares de la zona, proyecto que ha sido polémico. Que la Procuraduría General de la República, como órgano superior consultivo técnico-jurídico de la Administración Pública, mediante los Pronunciamientos número C-181-94, de veintitrés de noviembre de mil novecientos noventa y cuatro, número C-100-95, de diez de mayo, y PGR 267-95, de tres de noviembre, ambos de mil novecientos noventa y cinco, se ha manifestado sobre la legalidad y procedencia del proyecto, por lo que se adhiere a los dictámenes referidos y a lo dicho por ella en su informe dado en esta acción.
  7. 8Mediante resolución de las dieciséis horas veinticinco minutos del dieciocho de diciembre de mil novecientos noventa y cinco, se tuvo como coadyuvante pasivo de la acción a José Manuel Ortiz Dueñas, quien actúa en su condición de apoderado general sin límite de suma de "Ecodesarrollo Papagayo, Sociedad Anónima"; a favor de los representantes del Estado, en defensa de las normas reglamentarias reglamentarias impugnadas. Objeta la legitimación del accionante, por cuanto: 1.- "la intervención de un simple habitante del territorio nacional en asuntos en que se encuentran involucrados cuantiosos intereses del Estado, así como de inversionistas privados, no puede ser irrestricta, porque podría darse para entorpecer el desarrollo de importantes negocios"; 2.- "no es permisible que por un simple plurito protagónico o especulación intelectual se utilice la jurisdicción constitucional con menoscabo del desarrollo general del país, y con grave perjuicio de empresarios"; 3.- únicamente estarían legitimados los concesionarios particulares del Golfo de Papagayo, a quienes competería la defensa directa de sus derechos; y 4.- no hay intereses difusos en este asunto, en razón de que los concesionarios ubicados en la zona marítimo terrestre de los litorales del país pueden acudir a impugnar esta normativa en defensa de sus derechos.En cuanto al fondo, que la acción está mal dirigida, porque las implicaciones de una reversión de los terrenos concesionados al Estado por cualquier causa, no se agravaría por tratarse de uno o varios gravámenes hipotecarios, construido o no el condominio, por lo que pareciera que más bien la acción la dirige contra el otorgamiento mismo de la concesión, en cuyo caso la impugnación debió ser dirigida contra las disposiciones legales y reglamentarias que autorizan este tipo de contrato. Señala que lo que se afecta con las inscripciones en el Registro no son los terrenos en sí, sino los propios derechos de concesión, con lo cual no se hace salir "artificiosamente" del Estado los terrenos que se asientan. Lo que se trató de incorporar al reglamento cuestionado con los principios de la Ley de Propiedad Horizontal, en ningún caso fue el burlar el principio de inalienabilidad de las normas de la zona marítimo terrestre, por cuanto en ningún momento ha estado en juego el derecho de propiedad del Estado sobre estos bienes en las Ley Reguladora del Desarrollo y Ejecución del Proyecto Turístico del Golfo de Papagayo, número 6758; sino más bien el aprovechamiento en lo posible de aquellas normas del régimen especial de la propiedad horizontal, básicamente relativas a la administración de la propiedad condominal que permiten que tanto para el desarrollo vertical como horizontal, se pueda conservar y mantener las obras materiales y la excelencia de los servicios con base en la participación conjunta de los moradores del Proyecto, como único medio de evitar el deterioro o desmejora que en este tipo de desarrollos siempre se producen si la atención de las edificaciones de las obras urbanas de infraestructura y de los propios servicios urbanos se encomiendan a entidades públicas de carácter nacional o regional.Concluye que todas las preocupaciones del accionante en relación con la normativa impugnada son consecuencia de una errónea interpretación, a cuya comprensión escapan aspectos importantes; como que la concesión sobre bienes demaniales crea derechos reales administrativos, que le confieren a su titular ciertos atributos similares al dominio, sin que llegue a ser propietario, como el hecho de poder otorgar garantías inscribibles en el Registro Público de la Propiedad con base en dichos derechos.
  8. 9Los edictos a que se refiere el párrafo segundo del artículo 81 de la Ley de la Jurisdicción Constitucional, fueron publicados en los Boletines Judiciales números 217, 218 y 219 del quince, dieciséis y diecisiete de noviembre de mil novecientos noventa y cinco.
  9. 10Esta sentencia se dicta sin necesidad de celebrar audiencia.

Redacta el magistrado Solano Carrera; y,

CONSIDERANDO:

I. SOBRE LA LEGITIMACIÓN

De conformidad con lo que dispone el artículo 75 párrafo segundo de la Ley de la Jurisdicción Constitucional, el accionante se encuentra legitimado para formular la presente acción, en protección de los intereses difusos, pues como en el libelo inicial se consigna, la propia Ley Sobre Zona Marítimo Terrestre, N° 6043, de 2 de marzo de 1977, establece en su artículo primero, que la zona marítimo terrestre es patrimonio nacional e impone un deber de protección a todos los habitantes del país. Cualquier persona, pues, puede acceder a la jurisdicción constitucional en procura de obtener una declaratoria de inconstitucionalidad, sin necesidad de contar con un proceso previo, ya que incluso sería prácticamente imposible reunir condiciones para poder ser parte en un proceso jurisdiccional común, en donde sí se requiere un interés actual para demandar, concreto y personalizado. En la jurisdicción constitucional, por el contrario, es evidente que la ley exhibe una apertura muchísimo mayor, en virtud de que se trata de preservar el principio de supremacía constitucional y de allí que haya una legitimación más flexible, particularmente en los casos en que deban defenderse intereses difusos, tal cual sucede en esta ocasión, o de intereses que atañan a la colectividad en su conjunto.

Como lo indica la Procuraduría General de la República en su informe que corre entre folios cuarenta y cinco y sesenta y cinco del expediente, es prácticamente inexistente la posibilidad de que por la afectación de bienes de la zona marítima terrestre se configure una lesión individual y directa, de allí que la "protección" a que se refiere la ley N° 6043 perfectamente puede entenderse en los términos en que plantea la presente acción el señor Nombre60819 , como lo haría cualquier persona, sin mayor exigencia que la defensa de esos intereses difusos respecto de bienes que pueden considerarse de todos ("res comunes" o para el disfrute de todos, a que se refiere la sentencia de esta Sala N° 447-91).

II. EL ALCANCE DE LO IMPUGNADO EN LA ACCIÓN

La acción ataca el Decreto Ejecutivo N° 2440-MP-J-TUR, que reforma otros anteriores y el artículo 67 de la Ley N° 6043, en cuanto a través de esa normativa se "permite a los Bancos del Sistema Bancario Nacional o a otras instituciones del Estado conceder préstamos sobre la concesión, edificaciones, mejoras e instalaciones (...) que en la zona marítimo terrestre (...) se hagan. "Se autoriza mediante el mencionado decreto, darle a dicho gravamen el carácter de hipotecario, en abierta contradicción con nuestra Constitución, el Código Civil, nuestra más cara jurisprudencia y otras leyes...", como reza el encabezado del escrito de interposición. El accionante pone de relieve que la Ley N° 6758, que regula el desarrollo del proyecto turístico del Golfo de Papagayo no llega a desafectar de la condición de zona marítimo-terrestre, a la comprendida entre Punta Cabuyal y Punta Cacique. Y, cuando hace referencia a que ya el Decreto Ejecutivo N° 22489 MP-J-TUR (hoy reformado por el DE-2440-MP-J-TUR) desarrollaba lo establecido por el artículo 74 de esa Ley, discrepa de la denominación que allí se le da de "regímenes de excepción" y no de "casos especiales", como él entendería las de ese proyecto turístico, en relación a las condiciones y circunstancias diferentes, de las de otras áreas de la zona marítimo terrestre.

En los Boletines Judiciales números 217, 218 y 219, de los días 15, 16 y 17 de noviembre de 1995, la Sala da cuenta de la existencia de esta acción, para los fines del artículo 81 de la Ley que rige esta jurisdicción. Allí precisa, para todo efecto, pero específicamente para los fines de este proceso, que le ha dado curso en términos muy concretos:

"Esta acción se admite únicamente en cuanto reforma el decreto ejecutivo número 22.489 MP-J-TUR, permitiendo la construcción, en la Zona Marítimo Terrestre, en el Proyecto de Desarrollo Integral en Bahía Culebra (Proyecto de Papagayo), bajo el régimen de propiedad horizontal (condominios), haciendo salir artificiosamente del patrimonio del Estado los terrenos en que aquellos se desarrollen, y por autorizar a los bancos del sistema bancario nacional y a otras instituciones del Estado para que concedan préstamos sobre la concesión, edificaciones, mejoras e instalaciones -artículo 67- que en la zona marítimo terrestre se hagan, permitiendo garantizarlos con gravámenes de carácter hipotecario, lo cual estima contrario a los artículos 11, 33, 49 últimos dos párrafos, 50, 89, 121 incisos 1) y 14) y 149 incisos 3) y 19) de la Constitución Política, además de resultar contrario a la jurisprudencia de esta Sala..." (Resolución de las 10:15 horas del 27 de octubre de 1995. Ni el énfasis, ni el subrayado, corresponden al original).

III. SOBRE EL FONDO PROPIAMENTE

Los artículos 67 y 74 de la Ley N° 6043/77, disponen:

"Artículo 67. Los bancos del Sistema Bancario Nacional e instituciones del Estado quedan autorizados para conceder préstamos a los concesionarios de la zona restringida en la zona marítimo terrestre, con garantía de la respectiva concesión, y sus edificaciones, mejoras e instalaciones".

"Artículo 74. En cuanto al proyecto de Desarrollo Integral de la Bahía Culebra, cuyo litoral limita al Norte en el punto de la Cuadrícula Lamber Costa Rica, latitud 2/94 y longitud 3/50, o sea desde Punta Cabuyal hasta Punta Cacique, las áreas afectadas quedarán bajo la administración directa del Instituto Costarricense de Turismo. La reglamentación que regirá ese desarrollo será formulada por el Poder Ejecutivo, previa consulta a ese Instituto..." Es cierto, como lo indica la Procuraduría General de la República, que la concesión de uso de bienes públicos, si bien regida por normas de derecho público, no enerva la circunstancia de que, para todo efecto, la concesión -esto es, lo concedido- se incorpore al patrimonio del concesionario, desde que le concede un derecho o ventaja sobre el bien demanial y en tal sentido resulta irreprochable la legitimidad de lo dispuesto en la ley en cuanto a que la concesión puede ser dada en garantía de un préstamo obtenido por su titular.

Se trata, desde esa perspectiva y, como lo admite la doctrina que se ha venido desarrollando alrededor de este tema, del ejercicio legítimo de los derechos que deriva el concesionario de un verdadero derecho real administrativo que se le ha concedido sobre el bien de dominio público. Lo propio puede afirmarse, con mayor razón, en relación a la garantía sobre edificaciones, mejoras e instalaciones que nadie discute, pueden ser incorporadas por parte del concesionario, siempre que se observen las disposiciones urbanísticas -legales y reglamentarias- del caso.

Ciertamente, se trata de una norma que ha sido aplicada profusamente a lo largo de sus lustros de existencia, sin mayores sobresaltos. El régimen de concesión de la porción restringida, en la zona marítimo terrestre, es especial y de allí que a nadie se le haya ocurrido hasta ahora afirmar, por ejemplo, que por oponerse a la previsión general que contiene el Código Civil en su artículo 505, por el cual el derecho de propiedad se extiende por accesión a lo que está sobre la superficie, resulte jurídicamente imposible que un particular adquiera derechos sobre la edificación que realice sobre el terreno de la concesión.

La verdad es que los numerales 67 y 74 de la Ley N° 6043/77, no solamente han sido utilizados sin sobresalto, sino que en atención a esa pacífica utilización, prácticamente se reproducen en la Ley N° 6758, del 4 de junio de 1982, a propósito de regular el desarrollo y ejecución del proyecto turístico de Papagayo (Bahía Culebra). Ciertamente, toda la Ley 6758 es dictada de conformidad con la idea que se contiene en el artículo 74 de la N° 6043, mientras que su artículo 4° es idéntico al 67 arriba transcrito.

Si nos ubicamos en el contexto de la argumentación base del accionante, cabe preguntarse entonces, ¿se desafecta la zona marítimo terrestre con el hecho de gravar una concesión de esa naturaleza? La respuesta debe ser negativa, pues si no está desafectada con la concesión, tampoco lo sería por ese aspecto accesorio. No hay motivo jurídico alguno para sostener que un gravamen hipotecario sobre la concesión, o las obras allí construidas, tenga como consecuencia una desafectación. El Estado, en todo caso, mantendrá una especie de dominio eminente, sea cual sea el resultado del gravamen. Debe recordarse que la concesión, si bien es permanente, tiene carácter revocable.

IV. CONSTITUCIÓN POLÍTICA Y ZONA MARÍTIMO TERRESTRE

Resulta conveniente tener en cuenta, por otra parte, que la Constitución Política no llega a ocuparse de temas relacionados con la zona marítimo terrestre y en en su desarrollo como concepto, así como en lo que tiene que ver con el régimen jurídico aplicable, lo que ha existido es una tradición legal muy antigua que, valga consignar, tampoco ha sido consistente. Nótese que ha habido cambios en el ancho de la zona marítimo terrestre -antiguamente milla marítima-, como en la regulación específica de algunas islas que, no obstante formar parte, en principio y por virtud de la ley, de la zona marítimo terrestre, con el tiempo se han ido dando excepciones, según una calificación que con libertad ha manejado el legislador ordinario. Sobre esto, a modo de ejemplo puede citarse la Ley N° 7108/88, que excepcionó de la normativa general a la Isla de Chira, o la Ley N° 6515/80, que también exceptuó de aquella normativa general, los predios de la zona marítimo-terrestre declarada zona urbana, del distrito noveno, cantón central de Puntarenas, siempre que estuvieran legítimamente poseídos con anterioridad por particulares.

También quedan exceptuadas, por disposición de la Ley N° 6043, y se les otorga un régimen privado pleno, las fincas cuya colindancia registralmente reconocida con anterioridad, lo fuera directamente el mar. Lo que puede afirmarse, dada la extraordinaria variabilidad legislativa en la materia, es que el núcleo inamovible de la ley reguladora de la zona marítimo terrestre ha sido el relativo a la franja de cincuenta metros de ancho a partir de la pleamar ordinaria, que ha sido declarada pública y que como tal, no solamente es imposible apropiársela por ningún medio, sino que ha sido puesta al servicio de todas las personas, sin excepción. La demanialidad de esa franja, pues, ha tenido un reconocimiento jurídico sostenido y podría estimarse prima facie que, por inveterada, resulta intangible para el legislador, si bien este no es un tema que tenga relación con el principal discutido en la acción y por ello, deba ser analizado en la presente sentencia.

Sin embargo, lo anterior nos sirve para entender que en lo que tiene que ver con la zona restringida, sea, los restantes 150 metros de la zona marítimo terrestre, debe reconocerse al legislador la posibilidad de dictar regulaciones que las circunstancias hagan necesarias, claro está, siempre que no se afecten derechos adquiridos u otros derechos reconocidos constitucionalmente, o que excedan el marco de la razonabilidad, esencial a cualquier norma jurídica. Fuera de allí, las disposiciones legislativas sobre la materia a que se contrae esta acción, son prácticamente intangibles para la jurisdicción constitucional.

V. LA CONSTITUCIÓN Y EL DECRETO EJECUTIVO N° 24400-MP-J-TUR

El Decreto Ejecutivo N° 24400-MP-J-TUR forma parte de una serie de ellos relacionados con el tema. Su innovación estriba en que permite la utilización del sistema de propiedad horizontal en edificios que se construyan dentro de la zona del Proyecto de Papagayo. En opinión del accionante, sin embargo, esta regulación produce una mezcla de trato entre propiedad particular o individual y propiedad común, fundamentalmente en lo relacionado con el terreno donde se asiente el edificio o edificios en cuestión. Si se analiza cuidadosamente la argumentación que sobre este extremo aporta el señor Nombre60819 , no encontramos la norma constitucional que se viole a raíz de lo anterior, ni siquiera un principio que pueda extraerse de su normativa de conjunto, puesto que en cualquier caso se estaría ante una premisa pacíficamente aceptada por el ordenamiento, en el sentido de que la llamada zona restringida, a través de un régimen de concesión, puede quedar bajo posesión particular, con posibilidad de transformación.

Aclarando que en ningún supuesto, el accionante se detiene a explicar los motivos que tiene para estimarlo así, resulta conveniente que repasemos, en el orden que él las cita, las normas de la Constitución Política que estima infringidas por virtud del Decreto 24.400 MP-J-TUR:

A. Artículo 11. Esta norma recoge el principio de legalidad, consecuentemente el llamado principio de legalidad constitucional, según el cual ningún funcionario público puede actuar sino en concordancia con los mandatos constitucionales y legales. Esta fidelidad exigida a los funcionarios o autoridades públicas, pues, recoge y se inspira en el principio de supremacía constitucional. No obstante su importancia, para el caso concreto no dice el accionante cómo resulta afectado el principio de legalidad cuando precisamente es la ley la que regula la posibilidad de que la concesión, o las edificaciones realizadas por el particular en zona marítimo terrestre, puedan ser gravadas para responder a préstamos de instituciones bancarias.

B. El artículo 33. Estima el recurrente que se da una violación a la igualdad ante la ley que garantiza este numeral de la Constitución, pero sobre este extremo también existe una ausencia de razones. Como el accionante no tiene juicio previo, es claro que no puede cifrar el reclamo sobre la desigualdad, en un acto o actos que, por virtud de las normas impugnadas, lo coloquen en una situación de desventaja, o se le dé un trato diferenciado, discriminatorio o injusto. Y, si por otra parte, vemos que la normativa impugnada le permite al concesionario someter a gravamen las edificaciones que construya en la zona restringida, más bien podría decirse que es para situarlo en posibilidad de ejercer razonablemente la ventaja que la concesión le otorga, puesto que, como dijimos, constituye un verdadero derecho real administrativo.

C. El artículo 49 (últimos dos párrafos). Es obvio que estas disposiciones, que se refieren al ámbito de competencia de la jurisdicción contencioso administrativa. Desde esa perspectiva, pues, no ofrecen refuerzo alguno a la tesis del accionante, máxime si, como ya se ha indicado en los extremos precedentes, tampoco él se encarga de fundamentar en qué medida en esta vía podría pronunciarse la Sala.

D. El artículo 50. No hay del todo algún argumento que deba examinarse en relación a este punto, y si fuera por el tema de la calidad de vida que el Estado debe garantizar a las personas, habría que examinar actos o autorizaciones concretas de uso de la zona marítimo terrestre, para a través de mecanismos procesales idóneos, atacar tales acciones. A propósito del artículo 50 Constitucional, no resulta ocioso señalar, que la jurisprudencia constitucional ha ampliado la legitimación de las personas para acudir a la vía del amparo en defensa los derechos que allí se consagran para todos los habitantes del país.

E. El artículo 89. Otro tanto cabe afirmar de esta norma constitucional, porque no se le dan a la Sala razones que deban ser examinadas para ver en qué medida la normativa que se impugna atenta contra los fines que al Estado se le atribuyen.

F. El artículo 121 incisos 1) y 14). Tampoco se dan razones para saber en qué medida hay una infracción a este artículo que se refiere a las atribuciones y deberes de la Asamblea Legislativa en su competencia de legislar. Más bien, para entender las competencias legislativas, nuestro sistema asume un principio de libertad para la Asamblea Legislativa, solamente enervada por prohibición a texto expreso en la Constitución Política.

G. El artículo 140 incisos 3) y 19). Respecto de este numeral, se indica en la acción que el Poder Ejecutivo, al dictar el Decreto Ejecutivo N° 24400-MP-J-TUR contraría a la ley y, por tanto, "no está cumpliendo con su obligación constitucional de velar por el exacto cumplimiento de las leyes". En el escrito de interposición de la acción se dice que, "de concretarse lo que se pretende mediante los decretos impugnados, la naturaleza de la zona marítimo terrestre dejaría de ser una realidad para convertirse en una apariencia, al irrespetar el Ejecutivo los mandatos que la Constitución establecen" (sic, folio 23), pero como hemos dicho supra, las afirmaciones del accionante no se corresponden con la naturaleza de la zona marítima terrestre y los institutos jurídicos que comentamos. Aquí, entonces, se vuelve sobre la cuestión principal. La acción lo que pretende es que la Sala acepte que, siendo área común el terreno donde se asienta un edificio sometido a propiedad horizontal, según lo establece el Código Civil, evidentemente hay una imposibilidad jurídica para que en el caso de la zona marítimo terrestre se pueda dar esa figura.

Ya se dijo, la Constitución Política no se ocupa de ofrecer alguna orientación en relación con la zona marítimo terrestre, de manera que se trata de una materia en la que el legislador tiene libertad, quedando sometidas sus reglas solamente a criterios de razonabilidad. En la situación que se examina, el Estado, a través de la ley y los respectivos reglamentos, puede establecer un marco jurídico a través del cual se regirán las concesiones otorgadas en la zona marítimo terrestre (zona restringida), particularmente en una región que, desde hace ya alrededor de veinte años fue declarada por el legislador, como de alta prioridad para el desarrollo del turismo en el país.

En cuanto a la "cara jurisprudencia" existente en la materia y a que se refiere la acción, no existe siquiera una cita que lleve a la necesidad de entrar a analizar el tema, de modo que como queda expresado en los considerandos precedentes, la cuestión debatida no puede resolverse conforme lo pretende el señor Nombre60819 .

Por lo expuesto, la acción debe declararse sin lugar.

POR TANTO:

Se declara sin lugar la acción.

Voto N° 0506-1-97 INTERLOCUTORIO SALA CONSTITUCIONAL DE LA CORTE SUPREMA DE JUSTICIA. San José, a las catorce horas treinta minutos del día veintiocho de octubre de mil novecientos noventa y siete.

Vista la gestión del señor Procurador de la República que corre a partir de folio 182, en la que solicita aclaración de un párrafo contenido en el Considerando IV de la sentencia N° 5210-97 que corre en autos.

Redacta el Magistrado Solano Carrera. y,

CONSIDERANDO:

I: El párrafo que solicita aclarar el señor Procurador General, dice:

“También quedan exceptuadas, por disposición de la Ley N° 6043, y se les otorga un régimen privado pleno, las fincas cuya colindancia registralmente reconocida con anterioridad, lo fuere directamente al mar…” Ciertamente, como lo argumenta el gestionante, la indicada Ley reconoce situaciones como las de referencia, cuando legítimamente se hubiere producido y no como en los ejemplos que él señala, al margen o contra los requisitos y disposiciones legales. Pero, aparte de que el artículo 6° de la Ley N° 6043 no tendría sentido, sino para reconocer situaciones jurídicas que estuvieran consolidadas, en los términos del artículo 34 Constitucional, debería matizarse el concepto de “régimen privado pleno”, que el párrafo en cuestión cita, en cuanto puede ir más allá de lo que la Ley establece y que se reseña en la gestión, como por ejemplo lo reglado por su artículo 25.

De toda suerte, a los fines de que el señor Procurador General no lleve sus temores más allá de lo razonable, debe agregarse que el punto de la sentencia por él rescatado, no es sustancial a lo decidido en la sentencia de repetida cita y simplemente formaba parte de un elenco de excepciones en esa tensión dominio público / dominio privado, que se ha producido a lo largo de la historia legislativa sobre zona marítimo terrestre.

Como consecuencia de lo dicho, lo que debe tenerse por aclarado en la sentencia de mérito es lo relativo a la frase “régimen privado pleno “que se desliza en el Considerando IV.

POR TANTO:

Se aclara que el concepto de “régimen privado pleno”, contenido en el Considerando IV de la Sentencia N° 5210-97 de las 16 horas del 02 de setiembre de 1997, debe entenderse entre otras cosas, dentro de lo preceptuado por el artículo 25 de la Ley N° 6043. En lo demás, se rechaza la gestión.
