2002-02486 SALA CONSTITUCIONAL DE LA CORTE SUPREMA DE JUSTICIA.
San José, at ten hours and fifty-four minutes on ocho de marzo del dos mil dos.- Writ of amparo (recurso de amparo) filed by Nombre14137, holder of identity card number CED5963, President with powers as General Attorney-in-Fact without limitation as to amount of Asociación Justicia para la Naturaleza; Nombre14138, holder of identity card CED5964; Nombre14139, holder of passport number CED5965; Nombre14140, holder of identity card number CED5966; Clara Emilia Padilla Gutiérrez, holder of identity card number CED5967; Nombre14141, holder of identity card number CED5968, in his capacity as General Attorney-in-Fact without limitation as to amount of Asociación Centro Científico Tropical; Nombre14142, holder of identity card number CED5969, in his capacity as President with powers as General Attorney-in-Fact without limitation as to amount of Asociación Preservacionista de Flora y Fauna (APREFLOFAS); and the undersigned students of the Postgrado de Derecho Agrario y Ambiental de la Universidad de Costa Rica, on behalf of the environment and the great green macaw; against the Ministerio del Ambiente y Energía and the Costa Rican State.
Findings:
1.- In a written submission received by the Secretariat of the Chamber at fourteen hours and thirty minutes on treinta de noviembre de dos mil uno (folio 1), the petitioners filed a writ of amparo against the Ministerio del Ambiente y Energía and the Costa Rican State, stating that, because of the extreme hardness of its wood, the almendro tree remained unexploited by loggers for years. Recently, however, technology developed by the forestry sector made its extraction and use possible, resulting in the species becoming highly valued for forest exploitation in the area. They state that, by approving forest management plans (planes de manejo de bosque) permitting the selective extraction of almendro trees, the Ministerio de Ambiente y Energía has clearly caused the State to fail to fulfill its constitutional duty to safeguard an ecologically balanced environment. They assert that this demonstrates noncompliance with international provisions requiring the State to make every possible effort to ensure the survival of species, particularly those endangered by extinction.
They mention that a large number of trees are currently being cut down in pastures and open areas, further threatening the Lapa Verde species. They add that the clearest example of the State’s failure to discharge its duties is Decreto Ejecutivo 25167-MINAE, as amended by Decreto 25663-MINAE, which establishes a restriction on the cutting of almendro trees. Although the use of 50% is permitted, according to the data provided, in practice that percentage rises to 70% and even 80% of the almendro trees in the area. They mention that monitoring of the permits granted is very lax and that the absence of effective controls to mitigate the real and current threat to the Lapa Verde’s habitat, together with illegal capture for international trafficking, has brought the species to the brink of extinction. They allege that the Costa Rican State has failed to fulfill its obligation to act to preserve the species “Ara ambigua,” as well as the healthy and ecologically balanced environment required for human beings to develop in harmony with nature without eradicating existing species, as is occurring with the Lapa Verde, a symbol of the Sarapiquí and San Carlos area.
They state that the Costa Rican State has failed to fulfill its obligations arising from environmental laws and has also failed to comply with the settled case law of the Sala Constitucional in this field. They emphasize that the State has not undertaken to develop comprehensive policies to provide solutions to the socioeconomic problems of these areas: relations with the inhabitants of Nicaragua, lack of awareness of the environmental problem, and the expansion of livestock and forestry activities, thereby creating conditions conducive to the extinction of species so vulnerable to human activity. They stress that, to date, the Comisión Nacional de la Lapa Verde has not fulfilled the objectives set forth in its establishing decree, and some specific initiatives for the comprehensive management of the area have not been put into practice. They consider that, through its actions by means of the Ministerio del Ambiente y Energía, the Costa Rican State has openly and flagrantly violated the rights enshrined in Articles 7, 11, 50 and 89 of the Constitución Política.
As precautionary measures (medidas precautorias), the petitioners request application of the precautionary principle (principio precautorio); that the Costa Rican State, through the Ministerio de Ambiente y Energía, issue a decree totally and absolutely prohibiting the cutting and use of the almendro tree (Dipteryx panamensis) throughout the national territory; that the State provide the means for areas suited to forestry to be reforested with native species of commercial value that permit sustainable extractive activity, as well as Pago de Servicios Ambientales as a priority for the area; and that the State and the Ministerio de Ambiente y Energía establish a biological corridor (corredor biológico) in that region through clear and effective measures. The petitioners request that this writ of amparo be granted; that application of Decretos Ejecutivos N° 25167-MINAE and 25663-MINAE, which permit the partial use of the almendro tree, be suspended immediately so as not to accelerate the extinction of the Lapa Verde; and that the State be ordered to pay all costs of this proceeding, as well as compensation for the environmental damage caused.
2.- Iván Vicenti Rojas, in his capacity as Acting Ministro del Ambiente y Energía, states under oath (folio 237) that, pursuant to the Ley Orgánica del Ambiente, a series of requirements must be met before that Ministry may create new protected wilderness areas (áreas silvestres protegidas). He states that the State must expropriate the privately owned properties located within the area proposed for the creation of Parque Nacional Maquenque and that the funds to do so are not currently available. Moreover, the State has a substantial outstanding debt to the owners of the many protected wilderness areas existing in the country, and it would therefore be inexcusable to issue decrees creating a protected wilderness area under those circumstances. He reports that the estimated amount required to expropriate the privately owned properties within the various established management categories (categorías de manejo) is three hundred billion colones.
He argues that the State has done what lies within its means, given its financial resources, and that this is why, through Decretos Ejecutivos N°25167-MINAE, 25663-MINAE, it established a restriction on the timber harvesting (aprovechamiento maderable) of almendro trees in the area bounded by the río San Carlos and the río Sarapiquí, to the north by the río San Juan, on the west by longitude 84.15, on the south by latitude 10.33, and on the east by longitude 83.53. He states that the purpose of these restrictions is not so much to preserve the almendro species as to provide the Lapa Verde with the necessary food, since the fruit of this tree forms part of its diet. He adds that the State has declared the specified area a priority zone for Pago de Servicios Ambientales for properties whose owners wish to place their forests under the forestry regime (régimen forestal) in the protection category.
He emphasizes that part of the area sought to be declared a protected zone has been under protection since the creation of Refugio Nacional Corredor Fronterizo Norte; likewise, two wetlands, Tamborcito and Maquenque, have been created. He requests that the writ be dismissed.
3.- The legal requirements have been observed in the proceedings conducted.
Justice Armijo Sancho drafts the decision; and,
Whereas:
I.- In this case, it is necessary to determine whether the petitioners have standing (legitimación) to file this writ of amparo. Regarding standing in environmental matters, this Chamber stated in judgment number 3705-93, issued at fifteen hours on treinta de julio de mil novecientos noventa y tres:
“With respect to the legal protection of the environment, the standing of private individuals to bring judicial proceedings and secure the application of the rules intended for that purpose, or to request judicial protection for their violated rights, is of great importance. (...) By stating in Judgment Number 2233-93 that the preservation and protection of the environment is a fundamental right, this Chamber recognizes standing to pursue amparo proceedings. In environmental law, the procedural prerequisite of standing tends to be extended and broadened to such a degree that the traditional concept must necessarily be abandoned. It must be understood that, in general terms, any person may be a party and that such person’s right does not arise from property titles, rights, or specific causes of action that might be exercised under the rules of conventional law. Rather, the person’s participation in the proceedings responds to what modern commentators call a diffuse interest (interés difuso), whereby the original standing of a legitimately interested party, or even of a merely interested party, is diffused among all members of a particular category of persons who are thus equally affected by the unlawful acts that infringe their rights.
With respect to environmental protection, the typically diffuse interest that gives a person standing to bring an action is transformed, by virtue of its incorporation into the body of human rights, into a true ‘right of response’ (derecho reaccional), which, as its name indicates, empowers its holder to ‘respond’ to a violation arising from unlawful acts or omissions.” The judgment transcribed above clearly establishes that, with respect to environmental protection, standing falls within the scope of so-called diffuse interests, and therefore any person may allege infringements of this class of rights. Accordingly, it is concluded that the petitioners have standing to appear as petitioners in this matter.
The petitioners allege that the right to a healthy and ecologically balanced environment is being violated because the Costa Rican State has been negligent in protecting the Lapa Verde, a species endangered by extinction.
This Chamber has found it established that the great green macaw (Ara Ambigua) is considered an endangered species (especie en vías de extinción), not only on the basis of the documentation submitted, but also through the acknowledgment made in the challenged decrees themselves. Furthermore, in the report submitted, the Administration acknowledged the perilous situation of the great green macaw and its relationship with the almendro tree. According to the studies submitted, the population of great green macaws has been steadily declining, due, on the one hand, to illegal hunting because it is an exotic species and, on the other, to the progressive elimination of its sources of food and shelter, principally the almendro tree (Dipteryx panamensis). The record shows that there is a close relationship between the great green macaw and the almendro tree. Recognition of this essential relationship arises not only from scientific research; the State itself has also affirmed it through Executive Decrees 25167-MINAE and 25663-MINAE. In this regard, the recitals (considerandos) of Decree 25167-MINAE state as follows:
“6º.- That the Great Green Macaw (Ara Ambigua) is one of Costa Rica’s most impressive birds and is in danger of extinction if deforestation continues in the northern region of the country (…)
8º.- That, according to scientific studies, the great green macaw nests in natural cavities, principally in large almendro trees (Dipteryx panamensis) located in the country’s Atlantic region.
9º.- That in Costa Rica the optimal habitat for its survival has been substantially reduced to an area located between the río de San Carlos and the río Sarapiquí.
ased on the factual and legal framework set forth above, in the specific case at hand, through Executive Decrees 25167-MINAE and 25663-MINAE, the Administration established a series of restrictions on the felling (tala) of almendro trees in consideration of the conservation arguments presented. Nevertheless, as the petitioner alleges, these measures contravene the spirit of the conventions ratified by the Administration because they allow the felling of almendro trees to continue, thereby destroying the habitat of the green parrot. Although, as the Administration notes in its report, the measures promoted by both decrees, especially Decree 25167-MINAE, demonstrate the State’s interest in conservation—specifically, in this case, the conservation of the great green macaw and its habitat—in the opinion of this Chamber and according to the documentation submitted, the adopted measures, despite seeking to regulate the deforestation process, are not appropriate legal measures because they allow the habitat-reduction process to continue, both by authorizing felling and by limiting protection to a single area of the country.
In addition, the petitioners allege that the administrative authorities have not only failed to narrow the “loophole” allowing commercial use of the almendro tree, but have expanded it by granting a greater number of permits for its exploitation, while also neglecting the oversight duties for which they are responsible. In the report submitted, the Acting Minister of Environment and Energy failed to address those matters; therefore, pursuant to article 45 of the Ley de la Jurisdicción Constitucional, those actions are deemed true. Furthermore, this Court observes that the respondent has not shown the petitioners’ allegations to be unfounded; instead, it has merely invoked a lack of funding as an excuse for failing to perform its duties diligently, when the central issue is the strict enforcement of both international conventions and domestic law. For example, Ley Forestal number 7575 establishes in article 6:
“Art. 6.- The powers of the State Forestry Administration (Administración Forestal del Estado) are as follows:
Nombre472.- Accordingly, although the State has an obligation to ensure the survival of endangered species—and, in this case, the great green macaw—the fact remains that, as of this time, the public authorities responsible for giving practical effect and support to the protection of these species have not provided evidence that would lead this Court to conclude that the appropriate measures have been adopted to prevent the species’ extinction. Thus, the Chamber considers that article 25 of the Ley de Conservación de la Vida Silvestre and article 60 of the Regulations to that Law (Reglamento a esta Ley) have been disregarded. There can therefore be no doubt that the respondent Administration has allowed the right to a healthy and ecologically balanced environment protected by article 50 of the Constitution to be violated. Because the great green macaw was declared an endangered species—LEY DE CONSERVACION DE LA VIDA SILVESTRE, No. 7317—the State is obligated to implement every measure necessary to protect this species, which entails an obligation to prevent trade in the species and, because of its relationship with the almendro tree, also to prohibit the tree’s felling throughout the national territory.
This must, of course, be observed primarily in the areas containing the optimal habitat for the species’ survival, which, according to Decree N. 25167-MINAE, has been substantially reduced. In view of the foregoing, the Minister of Environment and Energy is advised to verify whether the measures adopted are both economically and legally effective in supporting the maintenance and development of the areas designated for almendro trees. To comply with the obligations legally imposed upon her, she must implement the necessary legal and punitive measures to ensure effective protection of the species “Ara Ambigua”; this must necessarily be carried out in conjunction with a nationwide monitoring plan addressing the great green macaw and the felling of almendro trees. In view of the considerations set forth, there is no alternative but to grant this petition, as is hereby ordered.
Por tanto:
The petition is granted. Due to the violation of article 50 of the Constitution, subsections 1, 2, 5, and 7 of article III of Decree N.25663-MINAE are annulled. The State is ordered to pay the resulting costs, damages, and losses, which shall be assessed, where applicable, in proceedings for enforcement of the judgment before the contentious-administrative jurisdiction (vía de ejecución de sentencia de lo contencioso administrativo).

San José, a las diez horas con cincuenta y cuatro minutos del ocho de marzo del dos mil dos.- Recurso de amparo interpuesto por Nombre14137, portador de la cédula de identidad número CED5963, Presidente con facultades de Apoderado Generalísimo sin límite de suma de la Asociación Justicia para la Naturaleza, Nombre14138, portadora de la cédula de identidad CED5964, Nombre14139, con pasaporte número CED5965, Nombre14140, portador de la cédula de identidad número CED5966, Clara Emilia Padilla Gutiérrez, portadora de la cédula de identidad número CED5967, Nombre14141, portador de la cédula de identidad número CED5968 en su condición de Apoderado Generalísimo sin límite de suma de la Asociación Centro Científico Tropical, Nombre14142, portador de la cédula de identidad número CED5969, en su carácter de Presidente con facultades de Apoderado Generalísimo sin límite de suma de la Asociación Preservacionista de Flora y Fauna (APREFLOFAS), y los abajo firmantes, estudiantes del Postgrado de Derecho Agrario y Ambiental de la Universidad de Costa Rica a favor del medio ambiente y la lapa verde; contra el Ministerio del Ambiente y Energía y del Estado costarricense.
Resultando:
1.- Por escrito recibido en la Secretaría de la Sala a las catorce horas y treinta minutos del treinta de noviembre de dos mil uno (folio 1), los recurrentes interponen recurso de amparo contra el Ministerio del Ambiente y Energía y del Estado costarricense y manifiestan que dadas las condiciones de extrema dureza de su madera, el almendro se mantuvo fuera de la explotación de los madereros durante años, sin embargo, recientemente la tecnología desarrollada por el sector forestal hizo posible la extracción y el aprovechamiento, lo cual derivó en que la especie fuese muy preciada en la explotación de bosques en la zona. Indican que al aprobar el Ministerio de Ambiente y Energía planes de manejo de bosque donde se permite la extracción selectiva de árboles de almendro, es claro que el Estado ha incumplido con el deber constitucional de velar por un ambiente ecológicamente equilibrado. Señalan que se evidencia el incumplimiento de las disposiciones internacionales que obligan al Estado a realizar todos los esfuerzos posibles para asegurar la supervivencia de las especies, en especial aquellas que se encuentren en peligro de extinción.
Mencionan que existe una gran cantidad de árboles que en la actualidad están siendo cortados en potreros y áreas abiertas, lo cual amenaza más a la especie Lapa Verde. Agregan que la ejemplificación más clara de esta omisión del Estado de cumplir con sus deberes, lo constituye el Decreto Ejecutivo 25167-MINAE, modificado por el Decreto 25663-MINAE, mediante el cual se establece una restricción a la corta del almendro. Que aunque se permite el aprovechamiento de un 50%, según datos aportados, en la práctica ese porcentaje se eleva a un 70% y hasta un 80% de los almendros de la zona. Mencionan que el seguimiento que se le da a los permisos otorgados es muy laxo, aunado a que la ausencia de controles efectivos para paliar la amenaza real y actual al hábitat de la lapa verde, y la captura ilegal para el tráfico internacional, ha conducido a la especie al borde de su desaparición. Alegan que el Estado costarricense ha incumplido con su obligación de actuar para preservar la especie del "Ara ambigua", así como el ambiente sano y ecológicamente equilibrado que se requiere para que en armonía con la naturaleza el hombre pueda desarrollarse, sin acabar con las especies existentes, tal y como está sucediendo con la Lapa Verde símbolo de la zona de Sarapiquí y San Carlos.
Manifiestan que el Estado costarricense ha incumplido las obligaciones derivadas de las leyes en medio ambiente así como ha sido omiso en el acatamiento de la reiterada jurisprudencia de la Sala Constitucional en esta materia. Recalcan que el Estado no se ha preocupado por desarrollar políticas integrales para ofrecer soluciones a los problemas socioeconómicos de estas zonas: las relaciones con los habitantes de Nicaragua, el desconocimiento del problema ambiental, la extensión de la actividad ganadera y silvícola, creando el marco de condiciones idóneas para la extinción de especies tan vulnerables a la actividad humana. Enfatizan que hasta la fecha, la Comisión Nacional de la Lapa Verde no ha cumplido con los objetivos propuestos en su decreto de creación y no se han llevado a la práctica algunas de las iniciativas concretas para el manejo integral del área. Consideran que con su actuación el Estado costarricense, a través del Ministerio del Ambiente y Energía, ha incurrido en violación abierta y flagrante de los derechos consagrados en los artículos 7, 11, 50 y 89 de la Constitución Política.
Como medidas precautorias solicitan los recurrentes la aplicación del principio precautorio; que el Estado costarricense a través del Ministerio de Ambiente y Energía, emita un decreto para prohibir en forma total y absoluta la corta y aprovechamiento del árbol de almendro (Dipteryx panamensis) en todo el territorio nacional. Que el Estado procure los medios para que las áreas con aptitud forestal sean reforestadas con especies nativas de valor comercial que permitan una actividad extractiva sostenible así como el pago de servicios ambientales prioritarios para la zona. Que el Estado y el Ministerio de Ambiente y Energía establezcan con medidas claras y efectivas un corredor biológico en dicha región. Solicitan los recurrentes que se declare con lugar el presente recurso de amparo, que se proceda a suspender de inmediato la aplicación de los Decretos Ejecutivos N° 25167-MINAE y 25663-MINAE, que permiten el aprovechamiento parcial del árbol de almendro, a efectos de no acelerar la extinción de la Lapa Verde y que se condene al Estado al pago de ambas costas de este recurso, así como al pago de los daños y perjuicios al ambiente causados.
2.- Informa bajo juramento Iván Vicenti Rojas, en su calidad de Ministro a.i del Ambiente y Energía (folio 237), que de conformidad con la Ley Orgánica del Ambiente existen una serie de requisitos para que ese Ministerio proceda a la creación de nuevas áreas silvestres protegidas. Señala que el Estado debe expropiar las fincas de propiedad privada que se encuentren dentro del área que se propone para crear el Parque Nacional Maquenque y en este momento no se cuenta con el dinero para realizarlo, además, el Estado mantiene una gran deuda con los propietarios de la gran cantidad de áreas silvestres protegidas existentes en el país, por lo que resultaría imperdonable emitir decretos de creación de un área silvestre protegida en esas condiciones. Informa que la suma estimada para cumplir con la expropiación de las fincas de propiedad privada dentro de las diferentes categorías de manejo creadas es de trescientos mil millones de colones.
Alega que el Estado ha realizado lo que está a su alcance de acuerdo con sus posibilidades económicas y es por eso que mediante Decretos Ejecutivos N°25167-MINAE, 25663-MINAE, estableció una restricción para el aprovechamiento maderable de árboles de almendro en la zona comprendida entre el río San Carlos y el río Sarapiquí, por el norte el río San Juan, por el lado oeste longitud 84.15, por el lado sur latitud 10.33 y por el lado este longitud 83.53. Señala que lo que se busca con las anteriores restricciones no es tanto la preservación de la especie del almendro, sino de dotar de la alimentación necesaria a la Lapa Verde ya que los frutos de este árbol forman parte de su dieta. Agrega que el Estado ha declarado el área indicada como zona prioritaria para el pago de servicios ambientales para aquellas fincas cuyos propietarios quieran someter sus bosques al régimen forestal bajo la modalidad de protección.
Recalca que parte del área que se solicita se declare zona protegida, se encuentra en protección desde la creación del Refugio Nacional Corredor Fronterizo Norte, de igual manera se han creado dos humedales Tamborcito y Maquenque. Solicita que se desestime el recurso planteado.
3.- En los procedimientos seguidos se ha observado las prescripciones legales.
Redacta el magistrado Armijo Sancho; y,
Considerando:
I.- En este caso es necesario establecer si los recurrentes cuentan con legitimación para interponer este recurso de amparo. En cuanto a la legitimación en asuntos relacionados con el medio ambiente, esta Sala, en sentencia número 3705-93, de las quince horas del treinta de julio de mil novecientos noventa y tres señaló:
"Tratándose de la protección jurídica del ambiente, la legitimación de los particulares para actuar judicialmente y lograr la aplicación de las normas que tienen esa finalidad o bien, solicitar la tutela jurisdiccional para amparar sus derechos violados, es de gran importancia.(...) Esta Sala en Sentencia Número 2233-93 al señalar que la preservación y protección del ambiente es un derecho fundamental, da cabida a la legitimación para acudir a la vía de amparo. En el derecho ambiental, el presupuesto procesal de la legitimación tiende a extenderse y ampliarse en una dimensión tal, que lleva necesariamente al abandono del concepto tradicional, debiendo entender que en términos generales, toda persona puede ser parte y que su derecho no emana de títulos de propiedad, derechos o acciones concretas que pudiera ejercer según las reglas por del derecho convencional, sino que su actuación procesal responde a lo que los modernos tratadistas denominan el interés difuso, mediante el cual la legitimación original del interesado legítimo o aún del simple interesado, se difunde entre todos los miembros de una determinada categoría de personas que resultan así igualmente afectadas por los actos ilegales que los vulneran.
Tratándose de la protección del ambiente, el interés típicamente difuso que legitima al sujeto para accionar, se transforma, en virtud de su incorporación al elenco de los derechos de la persona humana, convirtiéndose en un verdadero "derecho reaccional", que, como su nombre lo indica, lo que hace es apoderar a su titular para "reaccionar" frente a la violación originada en actos u omisiones ilegítimos." Es clara la sentencia transcrita en el sentido de que entratándose de la protección al ambiente, la legitimación se enmarca dentro de los llamados intereses difusos, pudiendo entonces, cualquier persona, alegar infracciones de esta clase de derechos. Por lo dicho, se concluye que los recurrentes están legitimados para figurar como recurrentes en este asunto.
Los recurrentes alegan que se está lesionando el derecho al ambiente sano y ecológicamente equilibrado por cuanto el Estado costarricense ha sido negligente en la protección de la lapa verde, especie que se encuentra en peligro de extinción.
Esta Sala ha tenido por demostrado, que la lapa verde (Ara Ambigua), es considerada como una especie en vías de extinción, no solo por la documentación aportada, sino también por el mismo reconocimiento hecho por los decretos impugnados. Por otra parte, la Administración en el informe rendido, ha reconocido la situación de peligro en la cual se encuentra la lapa verde, y la relación de ésta con el árbol de almendro. Según estudios aportados, demuestran como la población de lapas verdes ha ido en constante disminución, y que la razón de la misma, ha sido por un lado la caza ilegal en razón de ser un especie exótica, y por otro lado, la eliminación progresiva de sus fuentes de alimentación y refugio, principalmente el árbol de almendro (Dipteryx panamensis). De autos se desprende que existe una estrecha relación entre la lapa verde y el árbol de almendro. El reconocimiento de ese vínculo esencial, no deviene solo de las investigaciones científicas, sino que también, el mismo Estado lo ha afirmado mediante los Decretos Ejecutivos 25167-MINAE y 25663-MINAE. En este sentido el Decreto 25167-MINAE reza en sus considerandos lo siguiente:
"6º.- Que la Lapa Verde (Ara Ambigua) constituye una de las aves más impresionantes de Costa Rica y que se encuentra en peligro de extinción, en caso de continuar la deforestación en la zona norte del país(…)
8º.- Que según los estudios científicos, la lapa verde anida en hoyos naturales, principalmente en árboles grandes de almendro (Dipteryx panamensis), ubicados en la zona Atlántica del país.
9º.- Que en Costa Rica el hábitat óptimo para la sobrevivencia ha sido reducido en un sustancialmente hábitat que se encuentra entre el río de San Carlos y el río Sarapiquí.
on base en el marco fáctico y normativo expuesto, en el caso concreto, la Administración mediante los Decretos Ejecutivos 25167-MINAE y 25663-MINAE, determinó una serie de restricciones a la tala del árbol de almendro, en consideración a los argumentos de conservación expuestos, sin embargo tal y como lo alega el recurrente, estas medidas contravienen el espíritu de los convenios ratificados por la administración, ya que otorgan la oportunidad de continuar con la tala del almendro con lo cual se destruye el hábitat de la lora verde. Si bien es cierto, como lo señala la Administración en su informe, las medidas patrocinadas por ambos decretos, en especial el 25167-MINAE son una evidencia del interés estatal en materia de conservación, en este caso de la lapa verde y su hábitat, a criterio de esta Sala y de conformidad con la documentación aportada, las medidas adoptadas a pesar de que tratan de regular el proceso de deforestación, no constituyen las medidas legales apropiadas, por cuanto permiten que el proceso de reducción del hábitat continúe, no sólo facultando la tala, sino también mediante la limitación de la protección a una sola área del país.
Aunado a lo anterior, los recurrentes acusan que las autoridades de la Administración, no sólo no han reducido el "portillo" para el uso comercial del almendro, sino que lo han ampliado otorgando un mayor número de permisos para su explotación, además de descuidar la labor de fiscalización de la que es responsable. En el informe presentado, el Ministro a.i. de Ambiente y Energía fue omiso con relación a esos aspectos, por lo que de conformidad con el artículo 45 de la Ley de la Jurisdicción Constitucional se tienen por ciertos tales actuaciones. Aunado a ello, observa este Tribunal que la parte recurrida no ha demostrado que los alegatos de los recurrentes carezcan de fundamento, más bien se ha limitado a argumentar la ausencia de presupuesto como una excusa para no asumir de forma diligente sus funciones, cuando el eje del asunto está en la aplicación estricta tanto de los convenios internacionales, como de la normativa interna. Por ejemplo, la Ley Forestal número 7575 en su artículo 6 establece:
"Art. 6.- Son competencias de la Administración Forestal del Estado las siguientes:
Nombre472.- Así las cosas, a pesar de que existe una obligación del Estado de velar por la supervivencia de las especies en peligro de extinción -y en este caso de la lapa verde- lo cierto del caso es que, las autoridades públicas encargadas de darle vida y sustento a la protección de estas especies, todavía para este momento, no han acreditado elementos que lleven a este Tribunal a concluir que se han dispuesto las medidas pertinentes para evitar la extinción de la especie. De este modo, considera la Sala que se ha desconocido con ello lo dispuesto en el artículo 25 de la Ley de Conservación de la Vida Silvestre y en el artículo 60 del Reglamento a esta Ley, por lo que no cabe duda alguna de que la Administración recurrida, ha permitido que se lesione el derecho a un ambiente sano y ecológicamente equilibrado que se encuentra tutelado en el artículo 50 constitucional, pues al haber sido la lapa verde declarada como una especie en peligro de extinción, -LEY DE CONSERVACION DE LA VIDA SILVESTRE, No. 7317- el Estado tiene la obligación de implementar todas las medidas que sean necesarias para proteger esta especie, lo que conlleva la obligación de impedir el comercio de tal especie y por su relación con el árbol de almendro, también se debe impedir su tala en todo el territorio, claro está que ello debe respetarse principalmente en las zonas donde se encuentra el hábitat óptimo para la sobrevivencia de dicha especie, la cual según Decreto N. 25167-MINAE se ha visto reducida sustancialmente.
En razón de lo dicho, se recomienda a la Ministra de Ambiente y Energía, verificar si las acciones adoptadas son tanto económica como legalmente efectivas para favorecer el mantenimiento y el desarrollo de las áreas destinadas a los árboles de Almendro y en aras de cumplir con las obligaciones que legalmente le han sido impuestas por la ley, deberá implementar las medidas legales y sancionatorias necesarias para procurar un efectivo resguardo de la especie "Ara Ambigua", ello necesariamente deberá de darse concomitantemente con un plan de vigilancia hacia la lapa verde y la tala del árbol de almendro, en todo el país. En virtud de las consideraciones externadas, no procede otra cosa más que la estimación del presente recurso como en efecto se ordena.
Por tanto:
Se declara con lugar el recurso. Por violación al artículo 50 constitucional se anulan los incisos 1, 2, 5, y 7 del artículo III del Decreto N.25663-MINAE. Se condena al Estado al pago de las costas, daños y perjuicios ocasionados, los que se liquidarán, en su caso, en la vía de ejecución de sentencia de lo contencioso administrativo.
