San José, at sixteen hours on catorce de diciembre de mil novecientos noventa y nueve.- Constitutional challenge (acción de inconstitucionalidad) brought by Danilo Vindas Chaves, Leonel Aguilar Fong, and José María Morillo Fernández, all of legal age and forestry engineers, holders of identity card numbers 4-126-153, 8-049-236, and 726-97547-3313, respectively, in their capacity as representatives of the ASOCIACION DE PROFESIONALES FORESTALES DE COSTA RICA, against Decreto Ejecutivo número 27694-MINAE.
Findings of Fact (Resultando):
Justice Sancho González drafted the opinion; and, Considerations (Considerando):
I.Sole. The applicants Danilo Vindas Chaves, Leonel Aguilar Fong, and José María Morillo Fernández bring this constitutional challenge against decreto 27694-MINAE on behalf of the Asociación de Profesionales Forestales and in defense of the interests of holders of unregistered land. First, it must be noted that only a person who proves that he or she is authorized to represent an association may bring an action on its behalf. In this case, this Court observes that the persons bringing the constitutional challenge on behalf of the Asociación de Profesionales Forestales de Costa Rica lack authority to do so, because the authority to represent that association—which is vested solely in the President of the Board of Directors of the Asociación de Profesionales Forestales de Costa Rica—expired on 15 de agosto de 1997 (registry certification issued by the Coordinadora del Area de Servicios del Registro de Personas Jurídicas at 15:00 on 16 de noviembre de 1999, folio 100).
Finally, this Court notes that the provisions identified as unconstitutional by the applicants are individually applicable. Because this action was filed without an underlying proceeding (asunto previo), in defense of the rights of owners of unregistered land, it also fails to satisfy the underlying-proceeding requirement established by Article 75 of the Law governing this Jurisdiction and therefore cannot succeed. In this regard, the Chamber has stated:
“Alternatively, the appellant contends that the second paragraph of the aforementioned Article 75 grants him standing (legitimación) to bring the constitutional challenge because he believes that he is acting in defense of interests that ‘affect the community, since they are detrimental to all public officials in the country.’ This Chamber likewise does not accept that argument, because provisions affecting the community are those that affect everyone without doing so in relation to any particular person; in the case under review, the appellant’s own allegations show that the provisions he identifies as unconstitutional can indeed be applied to the detriment of an identifiable person, who would suffer harm individually. For that reason, the action is likewise inadmissible on the basis of this second argument” (judgment número 305-90 of 15:45 on 22 de marzo de 1990).
From the foregoing, this Court concludes that, because the applicants lack standing to act on behalf of the Asociación de Profesionales Forestales de Costa Rica and the owners of unregistered land, this action must be summarily dismissed.

Resultando:
Redacta el Magistrado Sancho González; y,
Considerando:
I.- Ünico. Los promoventes Danilo Vindas Chaves, Leonel Aguilar Fong y José María Morillo Fernández presentan la acción de inconstitucionalidad contra el decreto 27694-MINAE, en nombre de la Asociación de Profesionales Forestales y en defensa de los intereses de los titulares de tierras sin inscribir. En primer término debe indicarse que puede accionar en nombre de una asociación, quien demuestre que le corresponde la representación de la misma. En el presente caso, observa este Tribunal que las personas que promueven la acción de inconstitucionalidad en nombre de la Asociación de Profesionales Forestales de Costa Rica carecen de representación para tal efecto, ya que la representación que ostenta únicamente el Presidente de la Junta Directiva de la Asociación de Profesionales Forestales de Costa Rica, se encuentra vencida desde el 15 de agosto de 1997 (certificación registral de la Coordinadora del Area de Servicios del Registro de Personas Jurídicas de las 15:00 horas del 16 de noviembre de 1999, folio 100).
Por último, advierte este Tribunal que las normas que señalan como inconstitucionales los promoventes son de aplicación individual, siendo que al haberse interpuesto esta acción sin asunto previo, en defensa de los derechos de los propietarios de tierras sin inscribir, carece además del requisito de asunto previo que exige el artículo 75 de la Ley de esta Jurisdicción además, por lo que la misma no podría prosperar. En tal sentido la Sala ha dicho:
"Subsidiariamene el recurrente considera que su legitimación para presentar el recurso de inconstitucionalidad se la concede el párrafo segundo del citado artículo 75, por considerar que su accionar lo es en defensa de intereses que "afectan a la colectividad, ya que van en perjuicio de todos los funcionarios públicos del país", tesis que tampoco comparte esta Sala, pues las normas que afectan a la colectividad son aquellas que afectando a todos no lo hacen referente a ninguna persona en particular y en el caso en análisis, de la propia alegación del recurrente se infiere que las normas que señala como inconstitucionalies si pueden aplicarse en perjuicio de persona individualizada, a la que se le causaría perjuicio en forma particular. por esa razón el recurso tampoco es admisible con base en estas segunda argumentación" (sentencia número 305-90 de las 15:45 horas del 22 de marzo de 1990).
De lo expuesto, concluye este Tribunal que al faltar la legitimación de los promomoventes para actuar en nombre de la Asociación de Profesionales Forestales de Costa Rica y de los propietarios de tierras sin inscribir, esta acción debe rechazarse de plano.
Por tanto:
Se rechaza de plano la acción.
