The Chamber denied the amparo because ICAA disconnected unauthorized connections in accordance with the applicable regulations and the later service-availability application had been pending for only three days, establishing neither unreasonable delay nor an acquired right to the supply.

SummaryResumen

The Constitutional Chamber (Sala Constitucional) denied the amparo application against the Instituto Costarricense de Acueductos y Alcantarillados (ICAA) concerning the disconnection of water service from several homes in Calle Camboya, Guácima de Alajuela. Although it recognized that access to potable water is indispensable to life, health, and human dignity, the Chamber held that this right must be exercised within the governing legal framework and does not require unauthorized connections to remain active. The evidence established that the service lines had been connected without authorization to infrastructure administered by ICAA and that their disconnection was based on Article 108(i) of the Reglamento para la Prestación de los Servicios de AyA. No prior master meter or approved individual meters were proven. The new service-availability application was filed two days after the disconnection and had been pending for only three days when the amparo was filed; therefore, there was neither unreasonable delay nor an established right to receive service under the requested conditions.

Key excerptExtracto clave

First, although constitutional case law has repeatedly recognized that access to potable water is an indispensable prerequisite for the enjoyment of other fundamental rights, particularly life, health, and human dignity, it has also held that this right must be exercised within the legal framework governing the provision of the corresponding public service. Consequently, constitutional protection of access to potable water cannot be interpreted as authorization to disregard the procedures, technical requirements, and regulatory provisions governing that service, or as a mechanism for legitimizing factual situations contrary to the legal system. From that perspective, it is not constitutionally admissible to maintain that the Administration was required to keep an unauthorized connection active while a possible water-availability application was being analyzed. A contrary conclusion would require the Administration to continue a situation expressly prohibited by the legal system, undermining the procedures established for allocating public services and compromising the principle of legality governing all administrative action. It must be recalled that, under Articles 11 of the Political Constitution and 11 of the General Public Administration Law, public authorities may act only within the powers and conditions expressly established by the legal system. Accordingly, it is not for this constitutional jurisdiction to order the restoration of connections acknowledged to be unauthorized or to use the amparo proceeding to validate or conceal situations contrary to the regulations in force.

Document Review Case File: 26-029906-0007-CO Decision No. 2026038644 CONSTITUTIONAL CHAMBER (SALA CONSTITUCIONAL) OF THE SUPREME COURT OF JUSTICE. San José, at 9:30 a.m. on 8 October 2026.

Amparo proceeding filed by [Nombre 001], identity card [Valor 001], and [Nombre 002], identity card [Valor 002], against the INSTITUTO COSTARRICENSE DE ACUEDUCTOS Y ALCANTARILLADOS (ICAA).

BACKGROUND:

  1. 1In a written submission filed with the Chamber on 17 August 2026, the amparo applicants filed an amparo proceeding. They state that the protected person [Nombre 001] is the representative of company 3-102-780785 SRL, which owns property registered under number 358586-000, located in Guácima de Alajuela. They indicate that the property measures 1,851.83 square meters. They state that Cubero had previously requested from the ICAA a master meter for that property, which comprised nine lots (only two lots had been established at that time), and that the meter was destroyed by a tanker truck. They allege that, despite a request for its replacement, it was never replaced. They mention that, because of what occurred, a temporary connection was made to the water main and eight meters were requested from the respondent institution, but they were never installed despite being available. They allege that the service has been suspended since 12 August 2026, leaving eight families without water even though they were awaiting the meters. They assert that the affected persons have limited financial resources and include children and older adults. They request “waiver of the fines because of the harm caused.” They mention that Ronal Castro Meneses, a resident of the aforementioned residential development, is appearing as a witness in this matter.
  2. 2In a written submission filed with the Chamber on 19 August 2026, the amparo applicant [Nombre 001] filed a request for interim relief. He indicates that eight individual meters were formally requested to regularize and formally establish water service to the homes. He alleges that, although the application was being processed, the ICAA suspended the service on 12 August. He alleges that this situation prevents the affected families from carrying out basic hygiene activities and affects their right to health. He requests that the respondents be ordered to immediately restore the drinking-water supply while this amparo is adjudicated.
  3. 3By decision issued at 10:24 a.m. on 28 August 2026, the President of the Chamber ordered as follows: “Before issuing the appropriate ruling in the AMPARO PROCEEDING being processed under case file No. 26-029906-0007-CO, filed by [Nombre 001] and [Nombre 002], the applicant party shall submit, within THREE DAYS from notification of this decision, the following: • A complete and legible copy, together with the corresponding acknowledgment of receipt or proof of email transmission, of the request to replace the master meter, as well as the request for the 8 water meters mentioned in the initial application. Furthermore, if any response was provided to their requests, they shall submit a complete copy thereof. They shall likewise submit any additional evidence on which they base their assertions. The foregoing is required because such information is essential for issuing the ruling required by law, with the warning that the application will be summarily dismissed if they fail to comply (Articles 38 and 42 of the Ley de la Jurisdicción Constitucional). Notice shall be given.”
  4. 4In a written submission filed with the Chamber on 1 September 2026, the applicant party complied with the directive issued and indicated that it was submitting “the only documents provided when I requested the 8 meters, which were denied, after which I proceeded to request at least 1 from that entity.”
  5. 5By decision issued at 7:42 p.m. on 6 September 2026, the President of the Chamber ordered as follows: “Before issuing the appropriate ruling in the AMPARO PROCEEDING being processed under case file No. 26-029906-0007-CO, filed by [Nombre 001] and [Nombre 002], the applicant party shall clarify, within THREE DAYS from notification of this decision, the following: Whether the request for drinking-water meters that the party alleges was denied is the request submitted on 07 May 2026. If so, the party shall submit a complete and legible copy of the document denying the request. The party shall likewise submit any additional evidence on which it bases its assertions. The foregoing is required because such information is essential for issuing the ruling required by law, with the warning that the application will be summarily dismissed if the party fails to comply (Articles 38 and 42 of the Ley de la Jurisdicción Constitucional). Notice shall be given.”
  6. 6In a written submission filed with the Chamber on 7 September 2026, the applicant party addressed the directive issued on 6 September 2026. The party explains that it appeared at the ICAA offices and requested the technical reasons for which water-service availability had been denied for the property, but states that it was told that the document could not be provided because the matter was under review. The party indicates that the failure to provide that decision also infringes its rights. It requests that the ICAA be ordered to issue a written statement concerning water availability at the property.
  7. 7By decision issued at 2:55 p.m. on 17 September 2026, the proceeding was admitted and reports were requested from the respondent authorities.
  8. 8In a written submission filed with the Chamber on 21 September 2026, the applicant party reiterated its arguments and submitted evidence.
  9. 9In a written submission filed with the Chamber on 23 September 2026, Lourdes María Suárez Barboza, in her capacity as Executive President of the Instituto Costarricense de Acueductos y Alcantarillados, submitted a report expressly stating the following: “I. REGARDING THE FACTS ALLEGED BY THE APPLICANT In response to the situation at issue in the amparo, raised by the applicant [Nombre 001] against the Instituto Costarricense de Acueductos y Alcantarillados, and based on Evidence 1, technical report MEMORANDUM No. GSP-RC-A-2026-00737 of 21 September 2026, prepared by Johnny Rodríguez Alvarado, Head of the Alajuela Cantonal Office, which is attached as evidence supporting this report, and on the scope of the applicable provision in the Reglamento para la Prestación de los Servicios de AyA, the following has been duly established: FIRST: Legal-personality certification 3-102-780785, certification number RNP Digital-1601053-2026, records the business name or designation as 3-102-780785 Sociedad de Responsabilidad Limitada and states that [Nombre 001], identity card number [Valor 001], holds judicial and extrajudicial representation of this company. The database of the Registro Nacional de la República de Costa Rica records that the property registered under real-property folio number 2-358586-000 has 5 property interests, of which company 3-102-780785 Sociedad de Responsabilidad Limitada appears as the owner of interest 002. As shown in the Visor Control de Disponibilidades Región Central Oeste, the property registered under number 358586-000 contains several housing units, although the exact number of existing units is not specified. The sector in which the property is located is known as Calle Camboya, located in Distrito Guácima, Cantón Alajuela, Provincia Alajuela. (See Evidence 1, MEMORANDUM No. GSP-RC-A-2026-00737.) SECOND: The applicant stated that some time ago he applied to the Instituto Costarricense de Acueductos y Alcantarillados (ICAA) for the installation of a master meter to supply the project; however, the meter was destroyed by a tanker truck and, although its replacement was requested, it was never replaced. It is necessary to point out that this statement is false, because there is no record that the applicant or any other interested party applied for the installation of a master meter to supply the project. This is confirmed by a search in the Sistema Integrado para Gestión de Disponibilidades y Desarrollos (former version), which shows that, for the property with real-property folio number 2-358586-000 and cadastral survey number 2-1104021-2006, the owner did not submit an application to AyA for a certificate of service availability while that version was in use (before September 2025). (See Evidence 1, MEMORANDUM No. GSP-RC-A-2026-00737.) THIRD: According to a search in the Sistema Integrado para Gestión de Disponibilidades y Desarrollos (current version), the legal representative of the owner company submitted an application for a certificate of service availability for the property with real-property folio number 2-358586-000 and cadastral survey number 2-1104021-2006 on 7 May 2026, for the following project: request for 8 water services for houses already built. In the application form for a certificate of service availability, the interested party wrote the following in the field labeled ‘detailed description of the project to be developed’: ‘8 meters are required for houses already built.’ AyA registered this application under sequential number 2026-00010641-1, but because the applicant was advised that the area in which the property was located was a service-deficient area, since the water-supply system in that sector was subject to water-resource and hydraulic restrictions, the applicant changed the purpose of the application for a certificate of service availability, and AyA proceeded to cancel the service-availability application registered under sequential number 2026-00010641-1. Subsequently, on 14 August 2026, the owner submitted a new application for a certificate of service availability, but for the following project: ‘Request for one water service for 8 homes already built.’ This application was registered under sequential number 2026-00018834-1 and is undergoing technical analysis to determine whether the project identified by the interested party is technically and legally feasible.(See Evidence 1, MEMORANDUM No. GSP-RC-A-2026-00737.) FOURTH: The applicant states that, because of that situation, a temporary connection was made to the water main, with installation of the meters by the ICAA remaining pending despite their availability. This is false. AyA did not make a connection to the water main to supply water to the property with real-property folio number 2-0358586-000 and cadastral survey number 2-1104021-2006. AyA has not approved the installation of water meters for this property. It bears repeating that the application for a certificate of service availability submitted by the interested party for this property, identified by sequential number 2026-00018834-1, is awaiting technical analysis by AyA to determine whether the project identified by the interested party is technically and legally feasible. According to the Sistema de Gestión Comercial OPEN (AyA’s commercial system), only one drinking-water service is installed on the property with real-property folio number 2-0358586-000: water-service number NIS 2010275, which is registered in the name of Mary Esperanza Herrera Herrera and installed at the address 200 meters west and 60 meters south of the Misión Bautista, Distrito Guácima, Cantón Alajuela, Provincia Alajuela. This water service is in good standing and has drinking water. (See Evidence 1, MEMORANDUM No. GSPRC-A-2026-00737.) FIFTH: He states that eight individual meters were formally requested for the purpose of regularizing and formally establishing drinking-water service to the homes, and that this application was being processed. However, the application for a certificate of service availability submitted by the interested party on 7 May 2026 for the property with real-property folio number 2-358586-000 and cadastral survey number 2-1104021-2006, for the project involving a request for 8 water services for houses already built, was canceled by AyA because the interested party changed the purpose of the service-availability application; in other words, he modified the nature of the project and instead submitted an application for a certificate of service availability for the following project: Request for one water service for eight homes already built, currently under analysis.(See Evidence 1, MEMORANDUM No. GSP-RC-A-2026-00737.) SIXTH: Finally, the applicant asserts that, beginning on 12 August 2026, AyA suspended the drinking-water supply, leaving the resident families without access to drinking water and creating an urgent situation and an immediate public-health crisis because they could not meet their basic food and hygiene needs, particularly affecting children, older adults, and other residents in vulnerable circumstances. They maintain that this situation endangers the health of the affected families. Regarding this fact, AyA detected unauthorized drinking-water connections in the Calle Camboya sector, located in Distrito Guácima, Cantón Alajuela. Specifically, without completing the procedures before AyA for an application for a certificate of service availability and an application to connect new services, service connection points were installed on a transmission pipe administered by AyA, and those connection points were unlawfully connected to properties located in the Calle Camboya sector.Upon detecting these irregularities, the unauthorized services were disconnected in accordance with the legal system, specifically Article 108(i) of the Reglamento de Prestación de Servicios, which establishes that an unlawful connection is one of the grounds for suspending the drinking-water supply. As a result, some families in the Calle Camboya sector whose homes were supplied by these unlawfully connected water services appeared before AyA to file a complaint, but it was explained to them that their water services were unlawful, had been connected by third parties not authorized by AyA, and did not comply with the established procedures for requesting the availability of new services. (See Evidence 1, MEMORANDUM No. GSP-RC-A-2026-00737.) II. APPLICABLE PROVISIONS ➢ AyA’s actions are based on Article 11 of the Constitución Política. ➢ Articles 11 and 16 of the Ley General de la Administración Pública. - ➢ Reglamento para la Prestación de los Servicios de AyA, published in La Gaceta No. 27, Supplement No. 29, on 9 February 2021.- ➢ Reglamento Técnico para la Prestación de Servicios de Agua Potable, Alcantarillado Sanitario e Hidrantes de ARESEP.III. CONCLUSIONS ➢ In view of the foregoing, it must be clearly understood that AyA’s actions are subject to the Principle of Legality enshrined in Article 11 of our Constitution and Article 11 of the Ley General de la Administración Pública. This principle requires the entire Public Administration to act in accordance with the legal system and with the unequivocal rules of science and technology, as supported by Article 16 of the latter Law and within the scope regulated by the Reglamento para la Prestación de los Servicios de AyA and the Reglamento Técnico para la Prestación de Servicios de Agua Potable, Alcantarillado Sanitario e Hidrantes de ARESEP. ➢ Accordingly, AyA disconnected unlawful services that had been installed without AyA’s authorization, pursuant to Article 108(i) of the Reglamento de Prestación de Servicios de AyA, and reinstalling these water services would contravene the applicable provisions and the nature of service provision. ➢ It has been established with sufficient clarity that the application for a certificate of service availability submitted by the interested party on 7 May 2026 was canceled by AyA because the interested party changed the purpose of the service-availability application; in other words, he modified the nature of the project and instead submitted an application for a certificate of service availability for the following project: Request for one water service for eight homes already built, currently under analysis. ➢ Because AyA has acted in accordance with the established procedures and current law (Principle of Legality), and no constitutional right has been infringed, I request that this amparo proceeding be denied.”
  10. 10In a written submission filed with the Chamber on 28 September 2026, the applicant changed the email address designated for receiving notices.
  11. 11The statutory requirements have been observed in the processing of this proceeding.

Justice Araya García authored the opinion; and, REASONS:

I. SUBJECT MATTER OF THE APPLICATION

The applicant party complains that, on 12 August 2026, the ICCA authorities arbitrarily and without any basis disconnected the drinking-water service provided to eight social-housing units, even though a formal application was pending.

II.Preliminary Issue. Before analyzing the merits of the matter concerning the alleged violation of the right to prompt and proper administrative justice, it must be clarified that, beginning with judgment No. 2008-02545 issued at 8:55 a.m. on 22 February 2008, this Chamber has referred to the administrative-litigation jurisdiction, with certain exceptions, matters in which the issue is whether the Public Administration complied with the time limits prescribed by the Ley General de la Administración Pública (Articles 261 and 325) or by sector-specific laws governing special administrative proceedings, either to conclude an administrative proceeding initiated ex officio or at a party’s request by issuing a final administrative act, or to decide the applicable administrative remedies. This case presents precisely such an exception, as recognized by a majority of this Constitutional Tribunal, because it concerns an application for the public service of drinking water that allegedly was not decided within a reasonable period. Having clarified this point, the Chamber proceeds to decide the specific situation raised in this amparo.

III. PROVEN FACTS

The following facts relevant to deciding this amparo proceeding have been established:

  • 1)The applicant [Nombre 001], identity card number [Valor 001], holds judicial and extrajudicial representation of company No. 3-102-780785 Sociedad de Responsabilidad Limitada (see report and evidence).
  • 2)The property with real-property folio registration number 2-358586-000 has five property interests, of which company 3-102-780785 Sociedad de Responsabilidad Limitada appears as the owner of interest 002 (see report and evidence).
  • 3)The property registered under number 358586-000 contains several housing units. The sector in which the property is located is known as Calle Camboya, located in Distrito Guácima, Cantón Alajuela, Provincia Alajuela (see initial application, report, and evidence).
  • 4)The ICAA did not make a connection to the water main to supply water to the property with real-property folio number 2-0358586-000 and cadastral survey number 2-1104021-2006. Nor has the ICAA approved the installation of water meters for that property (see report and evidence).
  • 5)Only one drinking-water service is installed on the aforementioned property (water-service number NIS 2010275), and it is registered in the name of Mary Esperanza Herrera Herrera. The water service is installed at the address 200 meters west and 60 meters south of the Misión Bautista, Distrito Guácima, Cantón Alajuela, Provincia Alajuela. This water service is in good standing and has drinking water (see report and evidence).
  • 6)Neither [Nombre 001] nor any third party has requested from the ICAA the installation of a master meter to supply the aforementioned housing project (see report and evidence).
  • 7)On 7 May 2026, the legal representative of the owner company submitted to the ICAA an application for a certificate of service availability for the property with real-property folio number 2-358586-000, for the following project: a request for eight water services for houses already built (see report and evidence).
  • 8)In the application form for a certificate of service availability, the interested party wrote the following in the field labeled “detailed description of the project to be developed”: “8 meters are required for houses already built.” The ICAA registered this application under sequential number 2026-00010641-1 (see report and evidence).
  • 9)Because the applicant was advised that the area in which the property was located was a service-deficient area, since the water-supply system in that sector was subject to water-resource and hydraulic restrictions, the applicant changed the purpose of the application for a certificate of service availability, and the ICAA proceeded to void or cancel the service-availability application registered under sequential number 2026-00010641-1 (see report and evidence).
  • 10)On 12 August 2026, pursuant to Article 108(i) of the Reglamento de Prestación de Servicios, the ICAA disconnected the drinking-water supply to several housing units on the aforementioned property because they were found to be unlawfully connected. According to the report submitted, “without completing the procedures before AyA for an application for a certificate of service availability and an application to connect new services, service connection points were installed on a transmission pipe administered by AyA” (see report and evidence).
  • 11)On 14 August 2026, the aforementioned owner submitted to the ICAA a new application for a certificate of service availability, but for the following project: “Request for one water service for 8 homes already built.” This application was registered under sequential number 2026-00018834-1 (see report and evidence).
  • 12)This amparo was filed on 17 August 2026 (see initial application).
  • 13)On the date this amparo was filed and even on the date the respondent party submitted its report, namely 23 September 2026, the application of 14 August 2026 remained at the technical-analysis stage “to determine whether the project identified by the interested party is technically and legally feasible” (see report and evidence).

IV. MERITS

The applicant party alleges that the respondent authorities infringed its fundamental rights by disconnecting, on 12 August 2026, the water supply serving several homes located on a property in Guácima de Alajuela, even though, according to the applicant, an administrative application to regularize the service through the installation of meters was pending. The applicant also considers that its right to prompt and proper administrative justice was infringed because the petition submitted to the respondent institution had not been decided.

After analyzing the evidence entered into the case file, this Chamber finds no constitutional violation as alleged.

First, although constitutional case law has repeatedly recognized that access to drinking water is an indispensable prerequisite for the enjoyment of other fundamental rights, particularly life, health, and human dignity, it has also held that this right must be exercised within the legal framework governing the provision of the corresponding public service. Consequently, constitutional protection of access to drinking water cannot be interpreted as authorization to disregard the procedures, technical requirements, and legal provisions governing the provision of that service, or as a mechanism for legitimizing factual situations that contravene the legal system.

In this particular case, the evidence entered into the record shows that the applicant party is incorrect in asserting that the service was disconnected arbitrarily or without any basis. On the contrary, the report submitted under oath by the respondent authorities establishes that the installations supplying water to the homes in question were unauthorized or unlawful connections made to infrastructure administered by the ICAA. Indeed, the respondent institution explained that it detected, in the sector known as Calle Camboya, several service connection points directly connected to a transmission pipe administered by that entity, without institutional authorization, a certificate of service availability, or any approval for connecting new customers. In response, it disconnected those branches, an action expressly based on Article 108(i) of the Reglamento para la Prestación de los Servicios de AyA, which identifies the existence of unlawful connections as grounds for suspending the supply.

It has also been established that the ICAA never made a temporary connection to the water main to supply the homes involved, nor did it approve the installation of individual meters for that housing project. Nor was the applicant’s assertion that a master meter had previously existed and that its replacement was requested but not performed by the institution substantiated. Rather, the technical evidence submitted by the respondent reveals that no application of that nature is on record and that the only recorded applications concern service-availability procedures initiated in May and August 2026.

Of particular relevance is the fact that the situation for which the applicant seeks protection arose precisely from an irregular condition that had not previously been authorized by the Administration. It should be noted that the disconnection occurred on 12 August 2026, when the unlawful connections were detected, whereas the new administrative application invoked by the applicant to justify regularizing the situation was not submitted until 14 August 2026, after the challenged administrative action. Thus, the chronology established in the case file shows that the institution did not frustrate an already-established regularization process; instead, a new application seeking a technical and legal assessment of the project was initiated only after the irregular connections had been removed.

From that perspective, it is not constitutionally tenable to maintain that the Administration was required to keep an unauthorized connection active while a possible application for water availability was under review. The opposite conclusion would require the Administration to continue a situation expressly prohibited by the legal system, thereby undermining the procedures established for the allocation of public services and compromising the principle of legality governing all administrative action. It must be recalled that, pursuant to Articles 11 of the Constitución Política and 11 of the Ley General de la Administración Pública, public authorities may act only within the powers and under the conditions expressly prescribed by the legal system. Accordingly, it is not for this constitutional jurisdiction to order the reinstatement of connections acknowledged to be unlawful or to use an amparo proceeding to validate or conceal situations contrary to current law.

Furthermore, the documentation submitted shows that the sector in which the property is located is subject to water-resource and hydraulic restrictions, requiring the respondent institution to conduct prior technical assessments before authorizing new services. It was precisely for this reason that the first application, submitted on 7 May 2026 for eight water services, was subsequently canceled after the interested party changed the purpose of the procedure and later submitted a new application for a different project. This circumstance demonstrates that the legal situation concerning the possible provision of the service was still pending technical and legal analysis; therefore, it cannot reasonably be asserted that there was an established right to receive the supply under the conditions sought by the applicant.

Nor, moreover, is there any established infringement of the right enshrined in Article 41 of the Constitución Política. The record shows that the administrative application in effect at the time of the events was submitted on 14 August 2026 under sequential number 2026-00018834-1. This proceeding, in turn, was filed only three days later, on 17 August 2026. It is clear that such a short period does not permit the conclusion that the Administration incurred undue, unreasonable, or disproportionate delay in handling the application.

Constitutional case law has held that assessing a possible violation of the right to obtain a response within a reasonable period requires consideration of the complexity of the matter submitted to the Administration, the measures necessary to decide it, and the time that actually elapsed without a response. In this case, the submitted application requires a technical analysis to determine water-resource, hydraulic, and legal feasibility for a housing project located in an area that, according to the respondent, is subject to service restrictions. Consequently, an immediate decision could not be required, nor could a constitutional violation be deemed established when the application had been filed only three days before this jurisdiction was petitioned.

In sum, the evidence gathered demonstrates that the supply was disconnected because the institution administering the service detected unlawful connections, and not because of an arbitrary or capricious decision by the respondent authority. It has likewise been established that the administrative application invoked by the applicant was submitted after the challenged disconnection and that, when this amparo was filed, insufficient time had elapsed to consider the right to prompt and proper administrative justice infringed. Consequently, because no infringement of the invoked fundamental rights has been established, the application must be denied.

iv.- Separate note by Justice Castillo Víquez concerning prompt and proper administrative justice. I have supported this Tribunal’s position that, when a person subject to the justice system alleges an infringement of the right to prompt and proper administrative justice, the legal dispute must be heard by the Administrative-Litigation Courts and not by this Chamber. That said, the recent enactment of Ley n.° 9097, Ley de Regulación del Derecho de Petición, established that this right is eligible for judicial protection through the amparo proceeding provided for in Article 32 of the Ley de la Jurisdicción Constitucional, in conjunction with Article 27 of the Constitución Política de la República de Costa Rica, in cases in which the petitioner considers that the Administration’s material conduct, administrative acts, or response are affecting the petitioner’s fundamental rights. In my view, the recently enacted legislation does not mean that this Tribunal must alter its line of precedent, as it has exclusive authority under Article 7 of its Law to define its own jurisdiction.

Therefore, except for those constitutional-law disputes that this Chamber itself has recognized as exceptional situations and that may properly be heard in this jurisdiction through the constitutional guarantee proceeding of amparo, jurisdiction in all other cases lies with the judges of the administrative-litigation jurisdiction, for the reasons provided by this Tribunal (judgment N° 2008-02545 issued at 8:55 a.m. on 22 February 2008). All of the foregoing is consistent with Article 25 of the American Convention on Human Rights, the Law of the Constitution—its values, principles, and provisions—and the corresponding statutory provisions, based on a logical, systemic, and purposive interpretation of the legal system.

V.Documentation submitted to the case file. The parties are advised that, if they submitted any paper document, or any objects or evidence contained on an additional electronic, computer, magnetic, optical, or telematic device or produced using new technologies, those materials must be retrieved from the court office within no more than 30 business days from notification of this judgment. Otherwise, any material not retrieved within that period will be destroyed, in accordance with the “Reglamento sobre Expediente Electrónico ante el Poder Judicial,” approved by the Corte Plena at session number 27-11 of 22 August 2011, Article XXVI, and published in Boletín Judicial number 19 of 26 January 2012, as well as the agreement approved by the Consejo Superior del Poder Judicial at session number 43-12 held on 3 May 2012, Article LXXXI.

(ver prueba 1 MEMORANDO No. GSP-RC-A-2026-00737). (ver prueba 1 MEMORANDO No. GSP- RC-A-2026-00737). (ver prueba 1 MEMORANDO No. GSPRC-A-2026-00737). (ver prueba 1 MEMORANDO No. GSP-RC-A-2026-00737). II.

CONSIDERANDO:

I. OBJETO DEL RECURSO
