The Chamber annulled the disconnection based on accumulated debt and ordered the Municipality to accept payment of the latest bill, restore service if that bill was not in default, and, until then, immediately install a safe and accessible public water source no more than 50 meters away.

SummaryResumen

The Constitutional Chamber (Sala Constitucional) granted an amparo application filed by an older adult against the Municipalidad de Paraíso. It held that although the municipal administration may disconnect drinking-water service for nonpayment, that power may be based only on the unpaid most recent monthly bill, not on accumulated historical debt, which must be pursued through ordinary collection procedures. Any disconnection must also be accompanied by a public water source no more than fifty meters from the residence, at a safe and materially accessible location. The ongoing hydraulic-infrastructure renovation did not release the Municipality from its duty to coordinate an alternative supply. The Chamber annulled the disconnection order, required the Municipality to accept payment of the latest bill without conditioning it on other debts, and ordered restoration of service if that bill was not in default. Until then, a public water source had to be installed immediately. The Municipality was also ordered to pay costs and the resulting damages.

Key excerptExtracto clave

In this case, the respondent Municipality disconnected the service because of the entire amount owed, when it could do so only because of the latest unpaid bill, and it also failed to place a public water source no more than 50 meters from the protected person’s residence. Both circumstances constitute a violation of the protected person’s fundamental rights, requiring annulment of the disconnection order, without prejudice to the Administration’s authority to issue a new order limited solely to the latest unpaid bill and accompanied by a public water source, under the terms stated in this judgment. The protected person must also be allowed to pay the latest monthly bill without making that payment conditional on payment of the accumulated debt or other charges, without prejudice to the Municipality’s pursuit of the legally appropriate ordinary collection actions. Finally, as stated in judgment No. 2026-015401, any dispute over the existence, amount, or validity of the debt is a matter of ordinary legality outside this jurisdiction.

Document Review Case File: 26-033222-0007-CO Decision No. 2026038811 CONSTITUTIONAL CHAMBER (SALA CONSTITUCIONAL) OF THE SUPREME COURT OF JUSTICE. San José, at 9:30 a.m. on 8 October 2026.

Amparo proceeding processed under case file number 26-033222-0007-CO, filed by [Nombre 001], identity card [Valor 001], against the MUNICIPALIDAD DE PARAISO.

BACKGROUND:

  1. 1By a brief filed with the Office of the Clerk of this Chamber on 9 September 2026, the amparo applicant files an amparo application against the MUNICIPALIDAD DE PARAISO. The applicant states that he is an older adult and that his water service was disconnected. Despite this, no public water source was installed; therefore, he considers his fundamental rights to have been violated. He requests that the application be granted.
  2. 2By a decision of the President issued at 8:44 a.m. on 18 September 2026, this amparo proceeding was admitted for processing.
  3. 3Michaell Álvarez Quirós, in his capacity as Mayor of Paraíso, states under oath that:
“(…) FIRST: The applicant, [Nombre 001], files an amparo application against the Municipalidad de Paraíso, alleging that his drinking-water service was suspended and that, subsequently, no public water source was installed from which he could obtain water. SECOND: It is true that the drinking-water service associated with meter No. 0000035672 was suspended by the Municipal Water Utility; however, that action was taken strictly because of the delinquent status of the subscriber’s account and was carried out pursuant to the powers granted by the Reglamento del Acueducto Municipal de Paraíso. THIRD: As shown by the account statement issued by the Municipal Tax Administration, Mr. [Nombre 001] has had overdue obligations for drinking-water service since 2021, resulting in prolonged delinquency over several years. As of 23 September 2026, the total recorded debt amounted to ₡[Valor 002]. FOURTH: The suspension of service was neither arbitrary nor exceptional; rather, it formed part of the ordinary collection-management and delinquency-control procedures applied by the Municipal Water Utility to users who fail to meet their financial obligations. FIFTH: The operating record entitled Libro63 Y 64 LUNES 24-08-2026, corresponding to suspensions carried out by the Municipal Water Utility, expressly lists the applicant’s name in association with meter No. 0000035672 and includes the notation ‘Traerse medidor’ [Bring back meter], as part of the ordinary actions taken by the administration regarding services in delinquent status. SIXTH: The municipal action was based on Article 46 of the Reglamento del Acueducto Municipal, which provides: ‘The Municipalidad de Paraíso is authorized to issue an order suspending drinking-water service for nonpayment.’ Consequently, the challenged suspension constitutes the regular exercise of a power recognized by regulation as belonging to the Municipal Administration. II. EXISTING TECHNICAL CONDITIONS IN THE EL CALVARIO SECTOR. SEVENTH: At the time of the events alleged by the applicant, the Calle El Calvario sector was undergoing work pursuant to a comprehensive hydraulic-infrastructure renewal project undertaken by the Municipal Water Utility. EIGHTH: That project consisted of replacing the existing network with a new conduit constructed using high-density polyethylene (HDPE) pipes, a technology that provides greater hydraulic safety, durability, and reduction of losses. NINTH: According to the technical study prepared for the work, the project contemplated the installation of a total of 1.444 linear meters of HDPE piping of different diameters, including 4-inch, 3-inch, and 2-inch networks, carried out directly by the municipality. TENTH: Furthermore, through official letter MUPA-ACUE-CAEN-0232-2026 Respuesta Concejo Trabajos en el Calvario, the Municipal Water Utility officially informed the Municipal Council and the Mayor’s Office that the work included replacing drinking-water pipes, conducting hydraulic tests, verifying watertightness, and eliminating leaks on Calle El Calvario. ELEVENTH: During the execution of this work, the old piping was progressively taken out of operation and replaced with the new infrastructure, a situation that caused temporary operational changes in the sector’s distribution network. TWELFTH: The project used heat-fusion systems to assemble the new HDPE pipes, a technical process requiring specific implementation conditions and expressly identified in the municipal reports as one of the circumstances that affected the progress of the work. THIRTEENTH: Consequently, any assessment of whether it was materially possible to enable certain temporary connection points or perform work on the preexisting network must take into account that the system was undergoing a comprehensive and technically complex transformation intended to strengthen the public service in the future. III. THE HUMAN RIGHT TO WATER AND THE APPLICANT’S DELINQUENCY. FOURTEENTH: The Municipalidad de Paraíso fully recognizes access to drinking water as a fundamental human right and provides the public service in accordance with that principle. FIFTEENTH: Nevertheless, the Costa Rican legal system also recognizes users’ obligation to contribute financially to maintaining the service through the timely payment of legally approved rates. SIXTEENTH: Access to drinking water does not exempt users from complying with their financial obligations or prevent water-supply system operators from adopting regulatory suspension measures in cases of prolonged and repeated noncompliance. SEVENTEENTH: In the present case, the suspension was not based on arbitrary or discriminatory criteria, but on an objective situation of delinquency accumulated over several years and duly recorded in the municipal systems. EIGHTEENTH: The Administration acted in the exercise of powers expressly granted by the Reglamento del Acueducto Municipal, in accordance with criteria of legality, reasonableness, the financial sustainability of the service, and protection of the public interest. IV. THE PUBLIC WATER SOURCE MENTIONED IN ARTICLE 47 OF THE REGULATION. NINETEENTH: The applicant bases part of his claim on the application of Article 47 of the Reglamento del Acueducto Municipal. TWENTIETH: In that regard, it must be noted that this regulatory provision cannot be interpreted and applied in isolation or without regard to the actual technical conditions of the system. TWENTY-FIRST: At the time of the events, the sector in which the applicant’s property is located was undergoing hydraulic-infrastructure replacement work, including the progressive removal of the former network and the installation of new HDPE conduits, circumstances that directly affected the system’s operational capabilities. TWENTY-SECOND: The Municipality acted according to legitimate technical and operational criteria, while simultaneously seeking to ensure the continuation of the improvement work, the safety of the infrastructure, and the proper administration of the public service. V. ABSENCE OF ANY VIOLATION OF FUNDAMENTAL RIGHTS. TWENTY-THIRD: The facts set forth above establish that: a) There was a significant and prolonged debt for drinking-water service. b) The suspension was carried out pursuant to Article 46 of the Reglamento del Acueducto Municipal. c) The measure was applied within the ordinary administrative procedures used for other users in delinquent status. d) The sector in which the property is located was undergoing a project to replace and modernize the municipal hydraulic infrastructure. e) The administrative action was based on technical, financial, and regulatory criteria, without arbitrariness, persecution, discrimination, or misuse of power. TWENTY-FOURTH: Consequently, there is no unlawful impairment of fundamental rights attributable to the Municipalidad de Paraíso that would justify granting this amparo application. (…)” (sic).

He requests that the application be denied.

  1. 4The legal requirements have been observed in the proceedings conducted.

Justice Cruz Castro drafts the decision; and, REASONS:

I. SUBJECT MATTER OF THE APPLICATION

The applicant considers that his fundamental rights have been infringed. He states that he is an older adult whose public water service was disconnected. Despite this, he complains that no public water source was installed.

II. PROVEN FACTS

The following facts, which are relevant to the resolution of this matter, are deemed duly proven:

The protected person is a resident of the “Calle El Calvario” sector in the canton of Paraíso (undisputed fact).

On an undetermined date, the drinking-water service associated with meter No. 0000035672, corresponding to the protected party, was suspended by the Municipal Water Utility. That action was taken because of the delinquent status of the subscriber’s account (see the report submitted and the documentation provided).

As shown by the account statement issued by the Municipal Tax Administration, the protected person has had overdue obligations for drinking-water service since 2021, resulting in prolonged delinquency over several years, the total amount of which was ₡[Valor 002] as of 23 September 2026 (see the report submitted and the documentation provided).

The service-suspension order was issued and enforced on account of the entirety of that accumulated debt, with no evidence that it was limited to the most recent overdue and unpaid monthly bill (see the report submitted and the documentation provided).

At the time of the events alleged by the applicant, the Calle El Calvario sector was undergoing work pursuant to a comprehensive hydraulic-infrastructure renewal project undertaken by the Municipal Water Utility. This prevented the installation of a public water source for the protected person’s access (see the report submitted and the documentation provided).

III. UNPROVEN FACTS

The following facts, which are relevant to the resolution of this matter, are deemed unproven: First. That, after the public water service was suspended, the respondent municipality installed a public water source for the protected person’s access. Second. That the suspension of service was based strictly on the nonpayment of the most recent monthly drinking-water bill, or that the protected person was allowed to pay that bill without such payment being conditioned on payment of the accumulated debt.

IV. THE SPECIFIC CASE

After analyzing the evidence provided, this Court finds that the protected person is a resident of the “Calle El Calvario” sector in the canton of Paraíso. It further finds that, on an undetermined date, the drinking-water service associated with meter No. 0000035672, corresponding to the protected party, was suspended by the Municipal Water Utility. That action was taken because of the delinquent status of the subscriber’s account. In relation to the foregoing, the account statement issued by the Municipal Tax Administration shows that the protected person has had overdue obligations for drinking-water service since 2021, resulting in prolonged delinquency over several years. It is also established that, at the time of the events alleged by the applicant, the Calle El Calvario sector was undergoing work pursuant to a comprehensive hydraulic-infrastructure renewal project undertaken by the Municipal Water Utility. This prevented the installation of a public water source for the protected person’s access.

V.With respect to the installation of a public water source, this Chamber ruled in judgment number 2020-17717, issued at 9:20 a.m. on 18 September 2020, as follows:

“(…) Under conditions similar to the facts examined here, this Chamber, by decision 2019021906, the following (sic):

‘Now, taking the cited precedent into consideration, although the suspension of water service due to an outstanding debt is reasonable, that action must be accompanied by the installation of a public water source no more than 50 meters away, in order to safeguard the protected person’s right of access to drinking water. In that regard, the Chamber, by judgment No. 2018-004812, issued at 9:30 a.m. on 23 March 2018, ruled:

“V. Without prejudice to the foregoing, this Court has established that, if the regular supply is to be suspended, the responsible company or entity must make available to the interested party a public water source located within 50 meters, from which that person may obtain this vital resource. Because the right to health, derived from Article 21 of the Political Constitution, is implicated, drinking-water service must be accessible to every person (judgment 2003-01185, issued at 9:40 a.m. on 14 February 2003). In other words, when the drinking-water supply to domestic consumers is interrupted for nonpayment, the user must have a free source of supply, namely a public water source that is accessible so that, through reasonable diligence, the user may obtain water for essential activities (to that effect, see judgment No. 2017-16420, issued at 9:15 a.m. on 13 October 2017).” (…)’ (emphasis not in the original).

Subsequently, this Chamber, in judgment No. 2022-004589, issued at 9:15 a.m. on 25 February 2022, held, insofar as relevant:

‘VII.- With respect to the public water source, on 21 January 2022 a public water source was installed beside the dwelling in which the protected party resides. Subsequently, on 28 January 2022, officials of the Municipalidad de Oreamuno conducted an inspection and found an illegal connection; accordingly, the water connection was removed and the public water source was relocated to a distance of 76 meters. Contrary to the applicant’s assertion, the public water source was initially installed beside the property in which she resides and was then relocated to a distance of 76 meters. Although there is insufficient evidence to conclude that the events occurred as the protected party alleged, it is nevertheless true that the public water source was relocated in clear violation of this Court’s jurisprudential rule on the matter: the public water source must be located no more than 50 meters away. Accordingly, the Constitutional Chamber must also intervene with respect to this particular issue’ (emphasis not in the original).

Thereafter, by decision No. 2022-005659, issued at 9:20 a.m. on 11 March 2022, this Court ruled as follows:

‘[I]t is established that the applicant’s drinking-water service was suspended at 9:54 a.m. on 14 February 2022 because of the failure to pay the bill for January 2022. Since 15 January 2022, the respondents proceeded, as required, to install a public water source at NIS CED01, at a distance of 50 meters south and 15 meters west of the applicant’s property. In this regard, the respondent Institute acted in accordance with the applicable rules when it suspended the service for failure to pay the previous month’s bill; however, the public water source was installed more than 50 meters from the property, thereby violating her fundamental rights. In view of the foregoing, this amparo application must be granted’ (emphasis not in the original).

Those considerations apply to the case under examination because this Court finds no reason to depart from the position stated in the judgments partially transcribed above, nor any grounds for assessing the situation presented differently, given that, in the present matter, as in the cited precedents, the public water source was installed at a distance exceeding the fifty meters that this jurisdiction has established as reasonable. In view of the foregoing, a violation of the protected party’s fundamental rights regarding this particular matter is established and, consequently, the application is granted, with the consequences to be stated in the operative portion of this judgment” (emphasis in the original).

Based on the foregoing, the alleged violation is established because, under the applicable rules and the constitutional jurisprudence previously cited, although the Administration is authorized to suspend drinking-water service for nonpayment, that measure must be accompanied by the installation of a public water source or water tap (paja de agua) that allows the user to meet basic needs. In this specific case, it was not established that the respondent authorities had installed a water tap or adopted any other measure that would allow the protected person to obtain water following the suspension of service. Although the respondent authorities stated that hydraulic-infrastructure renewal work was being carried out in the sector, that circumstance did not exempt them from complying with this obligation, because they were required to adopt the measures and undertake the coordination necessary to guarantee an alternative water source while the work was being performed. Consequently, because it has not been shown that such a supply was provided, a violation of fundamental rights is established and the application is granted.

Furthermore, the maximum distance of fifty meters is not a purely numerical parameter. This Chamber clarified that point in judgment No. 2026-015401, issued at 9:20 a.m. on 30 April 2026, in which it stated:

“(…) The jurisprudential parameter concerning distance is not merely a numerical formula, but a concrete manifestation of the principle of material accessibility of the right to water. In other words, the existence of a water outlet within a fifty-meter radius is insufficient if, in order to use it, the person must face objective risks, overcome physical obstacles, or assume disproportionate burdens incompatible with reasonable diligence. The constitutional standard requires a nearby and genuinely usable water source. (…)” Similarly, that same judgment stated:

“(…) The Chamber has repeatedly held that disconnection of the supply for delinquency is permissible only because of the failure to make timely payment of the most recent overdue monthly amount; accumulated amounts corresponding to earlier periods are debts enforceable through ordinary legal collection procedures, but do not, by themselves, authorize depriving a person of the essential drinking-water service.

In the matter under examination (sub examine), the proven facts show that the municipal debt included not only charges related to water service but also taxes and other municipal services, with respect to which a payment arrangement had even been formalized in December 2020. It is also established that various partial payments were made during 2021. However, the Municipality does not establish with precision that the suspension ordered on 20 July 2022 was based strictly on the nonpayment of the most recent monthly drinking-water bill. Nor does it show that reconnection of the service depends exclusively on payment of that most recent overdue amount. Rather, the sequence of events reasonably indicates that restoration of service is conditioned on payment of the accumulated historical debt or full compliance with the arrangement entered into, which is incompatible with current constitutional doctrine. The Administration may not use the suspension of drinking-water service as an indirect means of exerting pressure to collect past obligations or other taxes unrelated to the most recent bill due.” Consequently, the public water source to be installed must be located no more than fifty meters from the protected person’s dwelling and must also be in a safe and materially accessible location; likewise, suspension is permissible only for nonpayment of the most recent service bill.

VI. SCOPE OF SERVICE SUSPENSION FOR DELINQUENCY

The violation is not limited to the failure to install the public water source. The report submitted and the documentation provided show that the suspension order was issued on account of the entirety of the debt accumulated since 2021, which amounted to ₡[Valor 002] as of 23 September 2026, and not solely on account of the most recent overdue and unpaid monthly bill. Regarding this issue, this Chamber held as follows in judgment No. 2026-015401, issued at 9:20 a.m. on 30 April 2026:

“(…) Although this Court has recognized that entities administering the service are authorized to suspend it when a user is delinquent, that power is not absolute and may not be exercised in an unreasonable or disproportionate manner or in a manner that impairs the essential content of the right to water. Accordingly, every suspension measure must reconcile the Administration’s collection interest with the enhanced protection warranted by access to this vital resource. (…) The Chamber has repeatedly held that disconnection of the supply for delinquency is permissible only because of the failure to make timely payment of the most recent overdue monthly amount; accumulated amounts corresponding to earlier periods are debts enforceable through ordinary legal collection procedures, but do not, by themselves, authorize depriving a person of the essential drinking-water service. (…) The Administration may not use the suspension of drinking-water service as an indirect means of exerting pressure to collect past obligations or other taxes unrelated to the most recent bill due. (…)” That position is consistent with this Court’s earlier jurisprudence. In judgment No. 2017-013012, issued at 9:30 a.m. on 18 August 2017, the Chamber reiterated the ruling in judgment No. 2016-1843, issued at 10:20 a.m. on 5 February 2016, in the following terms:

“IV.- SUSPENSION OF DRINKING-WATER SUPPLY SERVICE. This Chamber has also clarified in its jurisprudence that, even though access to drinking water is both a service and a fundamental right, it is provided for a fee, and a user’s delinquency may therefore authorize the service provider to suspend it. However, when a basic service of an essential nature, such as drinking-water supply service, is disconnected, this Chamber has stated that a series of requirements and minimum safeguards must be met. (…) More recently, in judgment No. 2011-006855, issued at 11:21 a.m. on 27 May 2011, this Chamber reiterated: ‘The jurisprudential line of this Constitutional Chamber is clear in establishing that, although the Instituto Costarricense de Acueductos y Alcantarillados may disconnect drinking-water supply service because of current delinquency, it must simultaneously guarantee the supply of water through an easily accessible public water source (…)’.” Subsequently, in judgment No. 2017-011001, issued at 9:30 a.m. on 14 July 2017, when applying that line of jurisprudence, this Court expressly considered that the suspension was based on a single unpaid bill and held as follows:

“(…) it has been duly established that the service was suspended at 10:55 a.m. on 5 June of the current year because one bill, which had been due since 26 May 2017, remained unpaid as of that date. The Chamber likewise finds that, when the service was disconnected, the corresponding public water source was installed (…), thereby guaranteeing access to drinking-water service. (…)” Similarly, in decision No. 2022-005659, cited above, the suspension of service “for failure to pay the previous month” was found to comply with the applicable rules. It follows from the foregoing that the authority to suspend drinking-water service is based on the failure to make timely payment of the most recent overdue monthly bill, not on the accumulated historical balance, which must be pursued through the ordinary collection procedures available to the Administration. Depriving an older adult of a service essential to health and life in order to compel payment of obligations accumulated over several years is a disproportionate and unreasonable measure in relation to the legitimate objective of ensuring payment for the service.

In this specific case, the respondent Municipality suspended the service because of the total amount owed, when suspension was permissible only because of the most recent unpaid bill, and it also failed to install a public water source no more than 50 meters from the protected person’s dwelling. Both matters constitute a violation of the protected party’s fundamental rights. The suspension order must therefore be annulled, without prejudice to the Administration’s authority to issue a new order limited solely to the most recent unpaid bill and accompanied by a public water source under the terms stated in this judgment. The protected person must also be allowed to pay the most recent monthly bill without such payment being conditioned on payment of the accumulated debt or other charges, without prejudice to the Municipality’s pursuit, through ordinary procedures, of any collection actions available under the law. Finally, as stated in judgment No. 2026-015401, any dispute concerning the existence, amount, or validity of the debt is a matter of ordinary legality outside this jurisdiction.

VII. DOCUMENTATION SUBMITTED TO THE CASE FILE

The parties are advised that, if they submitted any paper documents, as well as objects or evidence contained on any additional electronic, computing, magnetic, optical, or telematic device or produced using new technologies, those materials must be collected from the Court within a maximum period of 30 business days following notice of this judgment. Otherwise, any material not collected within that period will be destroyed pursuant to the “Reglamento sobre Expediente Electrónico ante el Poder Judicial,” approved by the Full Court at session No. 27-11 of 22 August 2011, Article XXVI, and published in Boletín Judicial number 19 of 26 January 2012, as well as the resolution approved by the Consejo Superior del Poder Judicial at session No. 43-12 held on 3 May 2012, Article LXXXI.

THEREFORE:

The application is GRANTED. The order suspending the drinking-water service associated with meter No. 0000035672 is annulled, without prejudice to the Administration’s authority to issue a new order limited solely to the most recent overdue and unpaid monthly bill, provided that the protected party is guaranteed a public water source no more than 50 meters from his dwelling, in a safe and materially accessible location. MICHAELL ÁLVAREZ QUIRÓS, in his capacity as Mayor of Paraíso, or whoever holds that office, is ordered to issue the appropriate directives and undertake the necessary coordination so that the protected party is immediately allowed to pay the most recent monthly drinking-water service bill without such payment being conditioned on payment of the accumulated debt or other charges, and so that service is restored if that most recent bill is not in default. Until that occurs, a public water source must be installed no more than 50 meters from the protected party’s dwelling, in a safe and materially accessible location.

The respondent authorities are advised that, pursuant to Article 71 of the Law Governing This Jurisdiction, any person who receives an order issued in an amparo proceeding that the person must comply with or enforce, and who fails to comply with or enforce it, will be subject to imprisonment for three months to two years or a fine of twenty to sixty days, provided that the offense is not punishable by a more severe penalty. The Municipalidad de Paraíso is ordered to pay the costs and the damages caused by the events underlying this ruling, which shall be quantified during enforcement of the judgment before the administrative-litigation jurisdiction. Let notice be given.

CONSIDERANDO:

I. OBJETO DEL RECURSO

III. HECHOS NO PROBADOS
