The Chamber ordered the owners to grant accredited ASADA personnel immediate and continuing access to improve and maintain the water-system infrastructure, refrain from obstructing that work, and pay costs and damages, but denied the amparo as to AyA.La Sala ordenó a los propietarios permitir de inmediato y en lo sucesivo el ingreso del personal acreditado de la ASADA para mejorar y mantener la infraestructura del acueducto, abstenerse de obstaculizar esas labores y pagar costas, daños y perjuicios, pero desestimó el recurso respecto del AyA.
SummaryResumen
The Constitutional Chamber (Sala Constitucional) partially granted the amparo proceeding against the owners of land containing infrastructure for the water system administered by the Pueblo Nuevo de Duacarí ASADA, a community association that manages drinking-water and sanitation services. Although the evidence did not establish that the owners had cut pipes or prevented a specific repair, it did show that they installed a gate, padlock, and fencing to restrict access. The Chamber held that the property and land-registration dispute concerning occupation of the land must be resolved through the ordinary legal forums, but it does not authorize the owners to deny accredited ASADA personnel access to operate, improve, and maintain infrastructure essential to the continuity, quality, and safety of the public drinking-water service. It ordered immediate and continuing access and prohibited pressure or restraint measures that would prevent necessary work or maintenance. The owners were ordered to pay costs and damages. The amparo was denied as to AyA, which had assisted with regularizing the situation.

Thus, this Chamber considers that, although there is a dispute between third parties that this Chamber is not competent to resolve, arising from the unresolved legal status of the land on which infrastructure belonging to the water-supply system administered by the Pueblo Nuevo ASADA is located, the fact remains that the landowners may not prevent personnel duly authorized and identified by the ASADA, or competent officials of the Instituto Costarricense de Acueductos y Alcantarillados, from accessing the sites where the water-system infrastructure is located in order to conduct operations, inspections, preventive maintenance, corrective maintenance, monitoring, and responses to possible emergencies, so as to ensure the continuity, quality, and safety of the public drinking-water service. This is without prejudice to the owners asserting their rights or presenting their objections and claims in the ordinary legal forums. Consequently, the application is granted, subject to the order set forth in the operative part of this ruling. VII.- Finally, because the conduct at issue in these proceedings was caused by the private-law respondents and not by the Instituto Costarricense de Acueductos y Alcantarillados, the amparo application is denied as to that institution.

Document Review Case file: 26-018068-0007-CO Decision No. 2026037628 CONSTITUTIONAL CHAMBER (SALA CONSTITUCIONAL) OF THE SUPREME COURT OF JUSTICE. San José, at 9:25 a.m. on 2 October 2026.
Amparo proceeding in case file No. 26-018068-0007-CO, filed by [Nombre 001], identity card [Valor 001], on behalf of the ASOCIACIÓN ADMINISTRADORA DEL ACUEDUCTO Y ALCANTARILLADO SANITARIO DE PUEBLO NUEVO, DUACARÍ, GUÁCIMO, legal entity identification number [Valor 002], against ELIÁN SÁNCHEZ GRANADOS, ISMERAÍ SÁNCHEZ GRANADOS, EUNICE SÁNCHEZ GRANADOS, JAHZEL NOÉ SÁNCHEZ GRANADOS and MARTA DALILA SÁNCHEZ GRANADOS, and the INSTITUTO COSTARRICENSE DE ACUEDUCTOS Y ALCANTARILLADOS (AYA).
BACKGROUND:
“(…) On the basis of technical report No. GSD-UEN-GAR-2026-03556 of 6 August 2026, signed by the UEN Gestión de Acueductos Rurales-AyA, and its annexes submitted as evidence forming an integral part of the administrative case file, we respond as follows:
FACT ONE: Partially true. As to the first point, we can attest that there is an aqueduct whose administration has been delegated to the Asociación Administradora del Acueducto y Alcantarillado Sanitario de Pueblo Nuevo, Duacarí, Guácimo, Limón, legal entity identification No. [Valor 002], registered with the Registro Nacional on 12/01/2009, with a delegation agreement signed with AyA on 10 November 2014. According to Technical Report No. GSD-UEN-GAR-2025-01892, prepared by Engineer Yoiner Sánchez, an official of the Instituto Costarricense de Acueductos y Alcantarillados (AyA), the existence of infrastructure belonging to the drinking-water supply system administered by the ASADA of Pueblo Nuevo de Duacarí, Guácimo, Limón, was verified, including a storage tank, a disinfection system, conveyance pipes and distribution pipes, which are located within the property mentioned in the amparo application. However, regarding the assertion concerning the date on which that infrastructure was built and how long it has remained in operation, this Administration lacks sufficient technical or documentary evidence to substantiate those circumstances and therefore cannot attest to them.
FACT TWO: Partially true. Regarding the existence of springs or supply sources within the property identified by the amparo applicant, there is insufficient technical or registry evidence to confirm this, and therefore we cannot attest to it. We can attest to the existence of infrastructure belonging to the drinking-water supply system administered by the ASADA Pueblo Nuevo de Duacarí de Guácimo, Limón, specifically a storage tank, a disinfection system, and conveyance and distribution pipes associated with the provision of the public service, as shown in the institution’s technical records. We can attest that this infrastructure is essential to the operation and continuity of the public drinking-water supply service that the ASADA provides to the community. According to information contained in AyA’s institutional databases, the system supplies approximately 300 active service connections, and therefore any impairment of its operation could directly affect the continuity and quality of the service provided to the user population.
Accordingly, from a technical and operational standpoint, duly authorized and identified ASADA personnel, as well as the competent AyA officials, must be able to access the locations of the aqueduct system’s infrastructure in order to perform operational work, inspections, preventive maintenance, corrective maintenance and monitoring, and to address any emergencies, so as to ensure the continuity, quality and safety of the public drinking-water supply service.
FACT THREE: We cannot attest to it.
FACT FOUR: We cannot attest to it.
FACT FIVE: We cannot attest to it. We nevertheless place on record that the infrastructure of the drinking-water supply system administered by the ASADA requires periodic operation, inspection, maintenance and health-control work, as well as attention to incidents or emergencies that could affect continuity of service.
FACT SIX: It is true. As part of the activities inherent in the delegation, the ASADA has been advised on technical, administrative and legal matters in order to guarantee provision of the service and secure access to the property where the aqueduct infrastructure is located. The Oficina Regional de Acueductos Comunales Huetar Caribe has provided the ASADA of Pueblo Nuevo de Duacarí with ongoing assistance, coordination and technical advice, in accordance with the technical-governance authority granted to the Instituto Costarricense de Acueductos y Alcantarillados by the applicable regulations for strengthening community management of public drinking-water supply services. In various conversations, AyA officials recommended that they apply to the appropriate bodies so that the competent authorities would allow them access to the property where the ASADA infrastructure is installed. A formal request was indeed received from the ASADA Pueblo Nuevo de Duacarí de Guácimo, seeking institutional assistance in regularizing the legal status of the property where part of the drinking-water supply system’s infrastructure is located.
That request appears in report No. GSD-UEN-GAR-2026-03334, which was forwarded to the Dirección Jurídica of AyA for analysis and assessment, in order to determine the legal and administrative actions necessary to pursue regularization of the land’s registry status and ensure adequate protection of the infrastructure associated with the public service. In this official letter dated 27 July 2026, the Oficina de Gestión de ASADAS de la Región Huetar Caribe formally requested the corresponding institutional legal advice from Lic. Rodrigo Jacob Gutiérrez Campos, expressly stating the following: ‘… advice is respectfully requested regarding the steps to be followed and the assistance necessary to address the request submitted by ASADA Pueblo Nuevo de Duacarí, taking into account the requirements and conditions for regularizing the registry status of the land belonging to this aqueduct system.’ LEGAL CONSIDERATIONS In light of the foregoing and on the basis of the documentation submitted, it is concluded that AyA, through the ORAC Huetar Caribe, has provided technical and progressive assistance to the Asociación Administradora del Acueducto y Alcantarillado Sanitario de Pueblo Nuevo, Duacarí, Guácimo, Limón.
Accordingly, no omission or negligence by this Institution has been established; rather, it has acted responsibly and has provided ongoing assistance, coordination and technical advice. In this regard, it is respectfully requested that it be clarified and taken into account that the application filed by Mr. [Nombre 001] on behalf of the Asociación Administradora del Acueducto y Alcantarillado Sanitario de Pueblo Nuevo, Duacarí, Guácimo, Limón, is directed against the owners of the property where the drinking-water tank and other infrastructure are located, and NOT against this Institute, which has assisted and advised the representatives of that association in connection with this matter, recommending that they apply to the appropriate bodies so that the competent authorities will allow them access to the ASADA infrastructure installed on that property. This is because, under the legal system and pursuant to Article 18 of the Ley Constitutiva del AyA: All property and facilities of State entities that are intended for the provision of services relating to the collection, treatment and distribution of drinking water and the removal of sewage or storm water in the country constitute national assets.
(Emphasis added) It is respectfully requested that this amparo application be granted against the owners Elián Sánchez Granados, Ismeraí Sánchez Granados, Eunice Sánchez Granados, Jahzel Noé Sánchez Granados and Marta Dalila Sánchez Granados, because they are obstructing access to and maintenance of the infrastructure located on the property at issue, which is essential to the operation and continuity of the public drinking-water supply service provided by the ASADA to the community of Pueblo Nuevo, Duacarí, Guácimo, Limón (…)”.
“(…) We do not deny, question or seek to diminish the basic and inalienable human right of access to drinking water expressly recognized by Article 50 of the Constitución Política. Nor have we suspended the general drinking-water supply to the community of Pueblo Nuevo or carried out physical acts affecting the hydraulic infrastructure for the purpose of depriving the population of that service. The true dispute underlying this matter concerns the decades-long use of private property to house infrastructure intended for the community aqueduct without legally regularizing the occupied land, the necessary easements, access rights, entry conditions or the property-related consequences arising from that encumbrance. This circumstance has been acknowledged by the Dirección Jurídica of the Instituto Costarricense de Acueductos y Alcantarillados itself, which determined that, although the hydraulic works are used for a public service, the necessary easements and land must be formally acquired and are not acquired merely through the passage of time; the corresponding legal procedure must therefore be followed, including expropriation and compensation where appropriate.
Consequently, a distinction must be drawn between the population’s constitutional right to a drinking-water supply, which we fully respect, and the legal dispute concerning the ASADA’s purported right to permanently occupy, access and use private property without the rights necessary to do so having been formally established.
PARTIALLY ADMITTED. It is true that infrastructure related to the water-supply system administered by the applicant ASADA exists within property recorded under real-property folio number 7-22351, which is registered in several ownership interests belonging to the undersigned. It is likewise true that this infrastructure has existed for many years and that it was installed when the property belonged to our father, its former owner. We deny, however, that the ASADA has presented documentary proof that this infrastructure was built more than forty years ago under the conditions and terms it alleges. AyA itself has stated that it lacks sufficient technical or documentary evidence to establish the infrastructure’s construction date or the precise length of time it has remained in operation. Consequently, any assertion concerning the legal conditions under which the occupation originally occurred must be assessed in light of the absence of any written instrument establishing an easement, assignment, donation, lease or transfer of ownership in favor of the ASADA.
FACT TWO: PARTIALLY ADMITTED AND REJECTED AS TO ITS SCOPE AND CONCLUSIONS. It is true that there are water sources and hydraulic infrastructure related to the system administered by the ASADA. We deny, however, that every source used by the ASADA is duly authorized or regularized. By official letter DA-UHCAROG-0660-2025 of 18 September 2025, the Dirección de Aguas del Ministerio de Ambiente y Energía inspected the branches used by the ASADA and determined that two springs were being used without being duly registered, ORDERING THE UNLAWFUL USE THEREOF TO CEASE IMMEDIATELY and requiring the appropriate procedures to be completed if there remained an interest in using them. It is therefore incorrect to portray all existing use as an absolutely settled and regular legal situation. We likewise reject, for lack of sufficient proof, the assertion that the system supplies a population of more than two thousand two hundred people. The institutional documentation incorporated into the case file refers to approximately three hundred active service connections. This observation is not intended to minimize the importance of the public service, but to require that the factual assertions in the application be assessed in accordance with the objective evidence available.
FACT THREE: PARTIALLY ADMITTED. We acknowledge that our father, the former owner, historically permitted the presence and use of certain infrastructure related to the community water supply. We deny, however, that this verbal authorization automatically amounts to the establishment of a perpetual easement, a transfer of the land, a property right or a right of free, permanent and unrestricted entry onto our property. The applicant itself acknowledges that there is no written authorization on record. This is precisely one of the central issues in the dispute: We received by donation a private property on which infrastructure intended for a public service is located, but not all the access and occupancy rights necessary for its operation have been properly determined and formalized; those necessary rights are not acquired merely through the passage of time, and the corresponding regularization process must be initiated, including acquisition or expropriation and compensation, as appropriate. Consequently, the historical use alleged by the applicant does not permit the conclusion, within summary amparo proceedings, that the claimed right of unrestricted access exists.
FACT FOUR: PARTIALLY ADMITTED. It is true that on 23 March 2026 a meeting took place between representatives of the ASADA and some of us, as well as persons involved in the administration of the property. It is also true that we raised the need to legally regularize a situation that had remained unformalized for decades. We reject, however, the characterization of those discussions as a threat to the water supply. The proposals made were intended precisely to seek a legal solution to the existing situation, with various alternatives being considered, including the formal establishment of easements, acquisition of the necessary land, compensation for use of the property, or any other legally appropriate arrangement. It is especially significant that AyA itself subsequently reached the same essential conclusion: The situation must be regularized. Its Dirección Jurídica ordered the case file to be technically prepared for the potential acquisition or expropriation of the affected land, a topographic survey to be conducted, the occupied areas and required radii to be demarcated, an appraisal to be performed, and the required easement strips and land to be determined.
Therefore, requesting legal regularization does not constitute a threat to a fundamental right, but rather the legitimate exercise of our right to request that a permanent encumbrance on our property be legally defined.
FACT FIVE: IT IS ADMITTED ONLY THAT FREE AND UNRESTRICTED ENTRY ONTO THE PROPERTY WAS LIMITED. THE REMAINING ALLEGED PHYSICAL ACTS ARE CATEGORICALLY DENIED. We installed a gate and padlock to control entry onto our private property after the efforts made to regularize the situation failed to produce a solution. Nevertheless, it must be made absolutely clear to this Chamber that WE HAVE NOT CUT ANY PIPE BELONGING TO THE DRINKING-WATER SUPPLY SYSTEM. We categorically deny the assertion in the application that we cut one of the conveyance pipes. The applicant makes a serious allegation without providing sufficient technical evidence identifying the alleged damage, determining when it occurred, establishing who caused it, and permitting it to be materially attributed to any of us. AyA’s subsequent reference to that alleged event arose from information submitted by the ASADA itself and not from a direct technical finding attributing the act to the undersigned. Likewise, the community’s general water supply was not cut off as a result of the padlock’s installation. There is therefore a fundamental difference between controlling physical entry onto private property and depriving a community of access to drinking water. The application attempts to equate these two situations without demonstrating that the closure of access actually caused the suspension of the supply.
FACT SIX: PARTIALLY ADMITTED. We are aware that the ASADA subsequently approached the Instituto Costarricense de Acueductos y Alcantarillados seeking institutional assistance. What is truly relevant is that the institution’s intervention ultimately confirmed that the legal status of the property had to be regularized. AyA’s documentation expressly refers to the need to regularize the registry status, and its Dirección Jurídica subsequently determined that the necessary easements and land had to be formally acquired, identifying the corresponding objective for their potential acquisition or expropriation. Consequently, AyA’s own subsequent actions confirm that there is a property, registry and administrative dispute pending regularization, precisely as we had maintained (…)” (sic).
Justice Salazar Alvarado writes the decision; and, REASONS:
Article 57 of the Ley de la Jurisdicción Constitucional establishes that an amparo application may be brought against the actions or omissions of persons governed by private law when they perform, or are required to perform, public functions or exercise public powers, or when, as a matter of law or fact, they occupy a position of power in relation to which ordinary judicial remedies are clearly insufficient or untimely to guarantee the fundamental rights or freedoms of the protected persons. In the case under review, the respondents Elián Sánchez Granados, Ismeraí Sánchez Granados, Eunice Sánchez Granados, Jahzel Noé Sánchez Granados and Marta Dalila Sánchez Granados are allegedly within the second circumstance established by the cited article, and the application was therefore admitted.
The amparo applicant considers that his fundamental rights and those of the members of the ASADA de Pueblo Nuevo, Duacarí, Guácimo, have been violated. He alleges that the respondents surnamed Sánchez Granados own a property on which a drinking-water catchment and storage tank, as well as a spring and various items of hydraulic infrastructure essential to the community system, have been built and are operating. He states that the respondents began carrying out physical acts that threaten and obstruct the operation of the community system, and that on 18 May 2026 Mr. Esteban Sánchez Granados informed the protected association that a padlock and fence would be installed and that entry would no longer be permitted for inspection, repairs or any other activity until the property’s status was legally resolved. He further warned that any damage, water outage or problem arising from the inability to service the system would be the sole responsibility of the Association.
He adds that the respondents recently cut one of the conveyance pipes running through the property, which was used to supply drinking water to a family served by the aqueduct. He requests that the application be granted and that the respondents be ordered to refrain from any physical act that prevents, limits or obstructs the protected association’s personnel from accessing the springs, storage tank, pipes and other hydraulic infrastructure; that they be ordered to allow free, immediate, permanent and unrestricted access by the protected association’s technical, administrative and operational personnel, as well as by officials of the Instituto Costarricense de Acueductos y Alcantarillados, the Ministerio de Salud and other competent authorities; and that the respondents be ordered to refrain from making cuts or closures, creating obstructions or restrictions, or taking any other action that jeopardizes the continuity of the community system.
The following relevant facts are deemed duly established and material to the decision in this matter:
The following fact relevant to this decision is not deemed established:
SOLE FACT. That the Sánchez Granados respondents, owners of the property, cut any pipe belonging to the drinking-water supply system or prevented ASADA representatives from performing any repair necessary for optimal maintenance of the infrastructure (the case file).
Articles 21 and 50 of the Constitución Política, read together, establish the rights of persons to life, health, and a healthy and ecologically balanced environment. These rights are closely interrelated because life, as the supreme value of the Constitución Política, requires special protection, since without life the protection of all other fundamental rights would be of little use. Accordingly, life must be protected in all its dimensions, including the physical, mental and environmental dimensions, and it is precisely in this context that protecting the environment and natural resources becomes important in order to promote human well-being. Among other things, such well-being is achieved by protecting and preserving the quality and quantity of water resources so that the water is safe for human consumption, thereby protecting human health. Because water is necessary for hygiene, food preparation and drinking, its contamination may cause serious harm to public health.
The protection and preservation referred to must therefore be provided by the State through the bodies designated for that purpose, which must adopt the measures necessary to guarantee everyone access to this resource and ensure compliance with those measures. In this context arises the right to water, which may be protected by this Constitutional Court through amparo proceedings (Judgment No. 2007-005482 issued at 2:39 p.m. on 24 April 2007, reiterated in No. 2021-005089 issued at 9:15 a.m. on 12 March 2021 and, recently, in No. 2025-002839 issued at 9:20 a.m. on 31 January 2025).
In this specific case, the amparo applicant seeks an order from this Chamber allowing entry onto private property where the water-storage tank belonging to the ASADA he represents is located, because the respondents installed a gate and padlock to control entry. He also reports that a pipe belonging to the drinking-water supply system was cut.
In this regard, property recorded under real-property folio No. 7-22351 is registered in several ownership interests belonging to the Sánchez Granados respondents, and infrastructure belonging to the water-supply system administered by the ASADA de Pueblo Nuevo exists on that property. Furthermore, on 18 September 2025, the Dirección de Agua del Ministerio de Ambiente y Energía inspected the sources used by the ASADA de Pueblo Nuevo and determined that two springs were being used without being duly registered, ordering the unlawful use thereof to cease immediately and the corresponding procedures to be completed if there remained an interest in using them. In view of the foregoing, on 23 March 2026, representatives of the ASADA de Pueblo Nuevo and the Sánchez Granados respondents participated in a meeting at which the need to regularize the property’s legal status was raised. The Sánchez Granados respondents, owners of the property on which the supply system administered by the ASADA de Pueblo Nuevo is located, admit that they restricted free and unrestricted entry onto the property and state: “(..) We installed a gate and padlock to control entry onto our private property after the efforts made to regularize the situation failed to produce a solution.
Nevertheless, it must be made absolutely clear to this Chamber that WE HAVE NOT CUT ANY PIPE BELONGING TO THE DRINKING-WATER SUPPLY SYSTEM. We categorically deny the assertion in the application that we cut one of the conveyance pipes (..).” It was also established that, on an unspecified date in 2026, the ASADA de Pueblo Nuevo requested institutional assistance from the Oficina Regional de Acueductos Comunales Huetar Caribe of the Instituto Costarricense de Acueductos y Alcantarillados to regularize the legal status of the property. That request was forwarded to the Dirección Jurídica on 27 July 2026, requesting the following: “(…) advice regarding the steps to be followed and the assistance necessary to address the request submitted by ASADA Pueblo Nuevo de Duacarí, taking into account the requirements and conditions for regularizing the registry status of the land belonging to this aqueduct system (…).” In addition, the executive president of the Instituto Costarricense de Acueductos y Alcantarillado states that, through the Oficina Regional de Acueductos Comunales Huetar Caribe, the institution has provided progressive technical assistance to the Asociación Administradora del Acueducto y Alcantarillado Sanitario de Pueblo Nuevo and recommended applying to the appropriate bodies so that the competent authorities would allow them access to the ASADA infrastructure.
Thus, this Chamber has no evidence that the Sánchez Granados respondents, owners of the property, cut any pipe belonging to the drinking-water supply system. It is established, however, that they installed a padlock and fences restricting access by the ASADA and the Instituto Costarricense de Acueductos y Alcantarillados. This occurred even though such work is essential to guarantee the operation and continuity of the public drinking-water supply service provided by the ASADA to the community. The executive president of the Instituto Costarricense de Acueductos y Alcantarillados states that the system supplies approximately three hundred active service connections, and therefore any impairment of its operation could directly affect the continuity and quality of the service provided to the user population.
Thus, this Chamber considers that, although there is a dispute between third parties that this Chamber lacks jurisdiction to resolve, arising from the failure to determine the legal status of the property where infrastructure belonging to the water-supply system administered by the ASADA of Pueblo Nuevo is located, the fact remains that the property owners may not prevent personnel duly authorized and identified by the ASADA, as well as the competent officials of the Instituto Costarricense de Acueductos y Alcantarillados, from accessing the sites where the aqueduct-system infrastructure is located in order to perform operational work, inspections, preventive maintenance, corrective maintenance, monitoring, and responses to potential emergencies, for the purpose of ensuring the continuity, quality, and safety of the public drinking-water supply service. The foregoing is without prejudice to the owners’ right to assert their rights or raise their objections and claims in the ordinary forums. Accordingly, the amparo application is granted, subject to the order to be issued in the operative portion of this judgment.
VII.Finally, because the actions at issue in these proceedings were caused by the private-law respondents and not by the Instituto Costarricense de Acueductos y Alcantarillados, the application is denied insofar as it concerns that institute.
I must note that, since judgment no. 2019002355 at 9:30 a.m. on 12 February 2019, my position regarding amparo applications filed on behalf of a legal entity has been as follows:
“…in Advisory Opinion 22-16 of 26 February 2016, the Inter-American Court of Human Rights stated that, although some States recognize a right of petition for legal entities subject to special conditions, such as labor unions, political parties, or representatives of Indigenous peoples, Afro-descendant communities, or specific groups, the fact remains that ‘Article 1(2) of the American Convention enshrines rights only in favor of natural persons; therefore, legal entities do not hold the rights enshrined in that treaty.’ Furthermore, in the same advisory opinion, the Inter-American Court held that, in certain particular contexts, natural persons may exercise their rights through legal entities (for example, through a media outlet, as occurred in the case of Nombre32579 et al. v. Venezuela); nevertheless, for this to be protectable under the inter-American system, ‘the exercise of the right through a legal entity must involve an essential and direct relationship between the natural person requiring protection from the inter-American system and the legal entity through which the violation occurred, because a mere connection between the two persons is insufficient to conclude that the rights of natural persons, rather than those of legal entities, are in fact being protected.
Indeed, something beyond the natural person’s mere participation in the legal entity’s own activities must be proven, such that such participation is substantially related to the rights alleged to have been violated.’ (emphasis added) (OC. 22/16).” In the sub lite matter, the amparo application was filed on behalf of the Asociación Administradora del Acueducto y Alcantarillado Sanitario de Pueblo Nuevo. In light of the foregoing, I consider that, given its legal nature, there is an essential relationship between the alleged harm to a legal entity and the potential injury to a natural person that, in the sub examine matter, warrants an examination of the merits to determine whether the fundamental right allegedly infringed was in fact violated.
The parties are advised that, if they submitted any paper document, as well as any objects or evidence contained on an additional electronic, computer, magnetic, optical, or telematic device, or produced using new technologies, they must retrieve them from the court office within no more than thirty business days from notice of this judgment. Otherwise, any material not retrieved within that period will be destroyed, pursuant to the “Reglamento sobre Expediente Electrónico ante el Poder Judicial,” approved by the Corte Plena at session N° 27-11 of 22 August 2011, Article XXVI, and published in Boletín Judicial number 19 of 26 January 2012, as well as the resolution approved by the Consejo Superior del Poder Judicial at session N° 43-12 held on 3 May 2012, Article LXXXI.
THEREFORE:
The amparo application is partially granted solely as to respondents Elián, Ismerai Eunice, Jahzel Noe, and Marta Dalila, all surnamed Sánchez Granados. Accordingly, respondents Elián Sánchez Granados, identity-card number [Valor 003]; Ismerai Sánchez Granados, identity-card number [Valor 004]; Eunice Sánchez Granados, identity-card number [Valor 005]; Jahzel Noe Sánchez Granados, identity-card number [Valor 006]; and Marta Dalila Sánchez Granados, identity-card number [Valor 007], are ordered to IMMEDIATELY allow duly accredited personnel of the Asociación Administradora del Acueducto y Alcantarillado Sanitario de Pueblo Nuevo, Duacarí, Guácimo Limón, legal-entity identification number [Valor 002], to enter property registration number 22351---000, located in District Four, Río Jiménez, Sixth Canton, Guácimo, Province of Limón, so that they may maintain the ASADA water-distribution line and make the improvements necessary to ensure continuity in the provision of the service; furthermore, from this point forward, personnel of that association must be allowed to enter to maintain the aqueduct infrastructure.
They are also ordered to refrain from obstructing, or exerting any form of pressure or restraint that would prevent, the performance of the necessary works and their subsequent maintenance. The respondent is advised that, pursuant to Article 71 of the Ley de la Jurisdicción Constitucional, anyone who receives an order issued in an amparo proceeding that they must comply with or cause to be complied with, and who fails to comply with it or cause it to be complied with, shall be punished by imprisonment for three months to two years or by a fine of twenty to sixty days, provided that the offense is not subject to a more severe penalty. The respondents are ordered to pay the legal costs, damages, and losses caused by the facts underlying this ruling, which shall be quantified in civil judgment-enforcement proceedings. As to the Instituto Costarricense de Acueductos y Alcantarillados, the application is denied. Justice Rueda Leal files a note.- Fernando Castillo V.

RESULTANDO:
HECHO PRIMERO: Parcialmente cierto.
HECHO SEGUNDO: Parcialmente cierto.
