OutcomeResultado
The Chamber ordered the Municipalidad de Moravia to conduct, within six months after notification, an individualized technical and legal assessment of each reported building in the Ipís River protected area, coordinate with competent authorities, and pursue applicable proceedings if irregularities or environmental harm are verified, without prejudging acquired rights and with full respect for due process.
SummaryResumen
The Constitutional Chamber (Sala Constitucional) granted the amparo application against the Municipalidad de Moravia because it had not individually investigated buildings located within the protected area of the Ipís River. Although aerial photographs showed buildings in existence since 1965, before the 1969 Forestry Law, their age did not establish that every present structure remained unchanged, had not been expanded or modified, possessed the required permits, or caused no current environmental impact. The constitutional guarantee against retroactivity protects acquired property rights and consolidated legal situations, but it does not release the Municipality from its present environmental oversight and protection responsibilities. The Chamber neither ordered demolition nor determined whether acquired rights existed. It ordered an individualized technical and legal assessment within six months after notification, coordination with other competent authorities, and the initiation or promotion of legally applicable proceedings if irregularities or environmental harm are verified, with full observance of due process.

Article 34 of the Political Constitution provides that no law shall be given retroactive effect to the detriment of any person, their acquired property rights, or consolidated legal situations. The guarantee against retroactivity must also be respected in environmental matters. Its application, however, requires distinguishing between retroactively imposing legal consequences on acts completed under earlier rules and requiring present compliance with environmental protection duties or overseeing situations whose effects continue today. Judgment No. 2004-014576, issued at 16:04 on 21 December 2004 and invoked even in the materials incorporated into the case file, explained that, when protection of the environment, health, life, and safety is concerned, the age of an activity does not by itself constitute an acquired right to continue conducting it outside the requirements legitimately imposed by the legal system to protect those constitutional interests. That criterion neither authorizes disregard of consolidated legal situations nor permits the removal of old buildings to be ordered without proceedings; it does, however, prevent retroactivity from being used automatically as grounds for declining to exercise present oversight and protection powers.

Document Review Case: 26-008956-0007-CO Decision No. 2026037620 CONSTITUTIONAL CHAMBER (SALA CONSTITUCIONAL) OF THE SUPREME COURT OF JUSTICE. San José, at 9:25 a.m. on 2 October 2026.
Amparo proceeding filed by [Name 001], identity card [Value 001], against the MUNICIPALIDAD DE MORAVIA.
Background:
Justice Salazar Alvarado writes the opinion; and, Reasons:
The applicant alleges that the Municipalidad de Moravia, despite acknowledging the existence of buildings within the Río Ipís protection area, has not taken the actions necessary to protect that area and enforce the environmental legal framework.
The following facts are deemed duly established and relevant to the determination of this matter:
The following relevant fact has not been established:
Sole fact. That, after acknowledging the present existence of buildings within the Río Ipís protection area, the Municipality conducted an individualized assessment of each property to determine its current legal status, any subsequent alterations or expansions, the existence of permits, the present environmental impact, or the need to coordinate measures to protect the riverbed and its bank with the other competent authorities (the case record).
Before analyzing the merits of the facts challenged in this amparo proceeding, it should be noted that, within the framework of the Social and Democratic State under the Rule of Law, Economic, Social and Cultural Rights have the fundamental objective of ensuring economic well-being and the development of human beings and peoples. Accordingly, those rights may be said to have both subjective and objective dimensions. In their subjective dimension, rights to affirmative benefits require general State action to satisfy individual or collective needs. Their objective dimension, in turn, defines those rights as minimum conditions essential to life that the State must safeguard for the benefit of individuals. Satisfying those needs entails creating the necessary conditions and undertaking to achieve their progressive enjoyment. Within Costa Rica’s body of constitutional law, those rights are found in Article 50 of the Political Constitution and Article 26 of the American Convention on Human Rights.
The role of the Municipalities and their bodies—including district municipal councils—is relevant to the development, protection, and full enjoyment of the aforementioned rights; under Article 169 of the Constitution, they are required to provide effectively the public services entrusted to them. As applicable to this specific case, those obligations entail the effective maintenance of public thoroughfares—roads, sidewalks, and sewer systems—through which other rights are exercised and enjoyed, including freedom of movement, health, and the right to a healthy environment. With respect to the latter, this Court’s statements in its case law are relevant. Thus, in Judgment N° 2007-017552 issued at 12:22 hours on 30 November 2007, it stated:
“(…) The aforementioned Article 50 also defines the Social State under the Rule of Law; we may therefore conclude that the Political Constitution emphasizes that environmental protection is an appropriate means of safeguarding and improving everyone’s quality of life, making intervention by the Public Authorities necessary in relation to factors that may disrupt its balance and prevent individuals from developing and living in a healthy environment. The significance of the right to a healthy and ecologically balanced environment within State activity is grounded, first, in the fact that, by definition, rights are not confined to individuals’ private sphere but also bear upon the very structure of the State in its role as guarantor of those rights and, second, in the fact that State activity is directed toward satisfying the interests of the community. In constitutional case law, the concept of the ‘environment’ has not been limited to the primary elements of nature, namely soil, air, water, marine and coastal resources, minerals, forests, biological diversity in flora and fauna, and the landscape, which together form the environmental framework without which basic needs—such as food, energy, housing, sanitation, and recreation—could not be met.
It is important to emphasize that this term has been understood more comprehensively, establishing a ‘macro-environmental’ concept that also encompasses matters relating to the economy, the generation of foreign exchange through tourism, agricultural production, and others: ‘For the foregoing reasons, Environmental Law must not be associated solely with nature, because nature is only one part of the environment. Nature-protection policy also extends to other matters, such as the protection of hunting, forests, natural parks, and natural resources. It is therefore a macro-environmental concept, so as not to exclude important concepts and thereby to unify the body of law that we call Environmental Law (…)’.” Having stated the foregoing, this Chamber, as guarantor of Fundamental Rights, serves as an overseer of compliance with the obligations arising from Articles 21 and 50 of the Political Constitution, which require the State to recognize the rights identified above and also to arrange for the use of materially and legally legitimate means to guarantee them.
Article 34 of the Political Constitution provides that no law shall be given retroactive effect to the detriment of any person, their acquired property rights, or settled legal situations. The guarantee of non-retroactivity must also be respected in environmental matters. Nevertheless, its application requires distinguishing between retroactively imposing legal consequences on acts completed under prior legislation and requiring present compliance with environmental-protection duties or overseeing situations whose effects persist at present.
Judgment N° 2004-014576 issued at 16:04 hours on 21 December 2004, which was invoked even in the materials incorporated into the case file, explained that, where protection of the environment, health, life, and safety is concerned, the length of time an activity has existed does not, by itself, constitute an acquired right to continue conducting it free from the requirements legitimately imposed by the legal system to safeguard those constitutional interests. That standard does not authorize disregard for settled legal situations, nor does it permit the removal of old buildings to be ordered without proceedings; it does, however, preclude automatic reliance on non-retroactivity as grounds for refraining from exercising present oversight and protection powers.
In the matter under review, the applicant complains that, despite requests made by Moravia residents concerning buildings located near the Río Ipís, and despite the matter being fully known to the local authorities, the Municipalidad de Moravia has taken no action to inspect, regulate, or sanction the buildings located along the banks of the aforementioned tributary. In this regard, based on the established facts and all the materials in the case record, it has been proven that the respondent municipal corporation acknowledges that buildings exist within the Río Ipís protection area and that, for this purpose, it even states that it obtained aerial photographs from the Instituto Geográfico Nacional dating from 1965 and concluded on that basis that the structures predate the Ley Forestal of 1969. Based on that fact, the municipal offices concluded that the subsequent forestry legislation could not be applied retroactively.
In this Court’s view, however, that response is insufficient in light of Article 50 of the Constitution. Those 1965 photographs, as well as the various materials available to the Municipality for verifying that buildings existed before the Ley Forestal, are certainly relevant to determining the age of particular structures; nevertheless, they do not exhaust the analysis that the Administration must conduct. Thus, without an individualized investigation, the existence of structures predating the forestry legislation does not permit the conclusion that all works currently in existence are exactly the same as those observed in 1965, that they were not subsequently expanded or altered, that they possess the applicable titles and permits, or that their continued presence does not currently cause any impact requiring prevention, mitigation, or interinstitutional coordination measures. In this regard, it is appropriate to recall this Court’s holding in Judgment N° 2025-035949 issued at 09:30 hours on 31 October 2025, which determined that the Municipalidad de Moravia had failed to properly address requests submitted concerning the problem discussed here.
As previously noted, the authorities of the respondent Municipality attempt in their report to justify their position by asserting the non-retroactivity of the law; however, as stated in Reason V of this judgment, that principle does not relieve the Municipality of its present powers and duties. It must therefore be borne in mind that determining that a particular building constitutes a settled legal situation that cannot be disregarded through the retroactive application of a later rule is one thing, while asserting that this circumstance precludes all current environmental oversight is another. With sufficient technical and legal support, and in coordination with the competent national authorities when necessary, the Administration must determine the status of each structure and the measures appropriate to protect the Río Ipís and its riverbank area. It should be clarified that, in these summary proceedings, it is not for this Chamber to order the demolition of the buildings at issue or to declare on its own that they lack acquired rights, because those matters require the institution of the corresponding administrative proceedings, with respect for due process and the right of defense of those who may be affected.
What must be protected, however, is the right of the applicant and the community to have the municipal authority do more than merely reach a general conclusion based exclusively on the presumption of rights acquired before the forestry law entered into force, and instead effectively exercise its investigative, oversight, and environmental-protection powers.
Under these circumstances, the Municipalidad de Moravia is deemed not to have taken the corresponding inspection, regulatory, and enforcement actions regarding the buildings constructed along the bank of the Río Ipís. This amparo proceeding must therefore be granted, and the Municipality ordered, within a reasonable period, to conduct an individualized technical and legal assessment of the buildings located within the Río Ipís protection area in the reported sector; to determine, for each one, its age, current construction and legal status, any subsequent alterations, and the existence of environmental impacts; to coordinate with any competent authority regarding matters exceeding its powers; and, if irregularities or impacts are verified, to institute or initiate the legally appropriate proceedings. All of this shall be done without prejudging the outcome of those proceedings or disregarding the guarantees arising from Articles 34 and 39 of the Political Constitution.
As a matter of principle, I consider that cases concerning action or inaction by the Public Administration in the repair, construction, alteration, or demolition of any infrastructure work should be dismissed because such an omission is a matter of legality whose adjudication belongs to the ordinary jurisdiction, where the interested person may challenge the matter more fully. However, when such administrative conduct, whether by omission or otherwise, results in a violation of other fundamental rights protected within this constitutional jurisdiction, or affects groups considered vulnerable, I do address the merits because such a situation constitutes an exception to my position on this subject, as occurs in this case, in which the applicant alleges that he filed an environmental complaint that, as of the date this application was filed, had not been finally resolved, nor had the applicants been informed how the respondent authorities would proceed in addressing it.
The parties are advised that, if they have submitted any paper documents, as well as objects or evidence contained in any additional electronic, computer, magnetic, optical, telematic, or new-technology device, they must retrieve them from the court office within a maximum period of thirty business days following notice of this judgment. Otherwise, any material not retrieved within that period will be destroyed in accordance with the administrative regulations applicable to the electronic judicial case file.
Therefore:
The application is granted. Diego Armando López López and Randall Montero Rodríguez, mayor and president of the Municipal Council of Moravia, respectively, or whoever holds those offices, are ordered, within the scope of their powers, to take immediately the measures necessary so that, within SIX MONTHS following notice of this judgment, the respondent Municipality conducts an individualized technical and legal assessment of the buildings located within the Río Ipís protection area in the sector at issue in this application, in order to determine their current status, age, any subsequent alterations or expansions, existing permits, and possible environmental impacts. They must likewise coordinate with any competent authority regarding matters exceeding their powers and, if irregularities or impacts are verified, institute or initiate the legally appropriate proceedings, with full respect for due process.
The respondent authorities are warned that, pursuant to Article 71 of the Ley de la Jurisdicción Constitucional, anyone who receives an order issued in an amparo proceeding that they must comply with or cause to be complied with, and who fails to comply with it or cause it to be complied with, shall be subject to imprisonment for three months to two years or a fine of twenty to sixty days, provided that the offense is not subject to a more severe penalty. The Municipalidad de Moravia is ordered to pay the costs, damages, and losses caused by the acts on which this ruling is based, which shall be quantified during enforcement of the judgment in the administrative-litigation jurisdiction.- Fernando Castillo V.
