SummaryResumen
The Constitutional Chamber (Sala Constitucional) granted the noncompliance application seeking enforcement of judgment no. 2026009006, which had ordered the Ministry of Health to conduct dye tests and definitively remedy, within three months, harm caused by improper wastewater disposal. Although the Chamber recognized that the authorities had conducted inspections and tests, served notices, processed administrative challenges, and issued health orders, it found that the judgment had not been fully complied with: unhealthiness and eviction order MS-DRRSCS-DARSM-OS-76-2026 had not been obeyed, and dye tests conducted on 7 September 2026 were positive. It therefore reiterated that the Minister of Health and the director of the Moravia Health Governing Area must definitively resolve the problem. The Chamber warned that, if disobedience is established, it may order administrative proceedings against the noncompliant official and transmit certified portions of the record to the Ministerio Público concerning the possible offense contemplated by Articles 53 and 71 of the Ley de la Jurisdicción Constitucional.
Key excerptExtracto clave
In relation to the foregoing, this Chamber finds it established that, although the Ministry of Health authorities have taken steps to comply with judgment no. 2026009006, the fact remains that the order has not yet been fully complied with, because the evidence submitted in the record, together with the amparo applicant’s recent statements, demonstrates that Ministry of Health order no. MS-DRRSCS-DARSM-OS-76-2026 has not been obeyed and that the dye tests conducted on 7 September 2026 were positive. Consequently, the respondent authorities are again directed to comply with the order issued by this Chamber in judgment no. 2026009006 at 9:30 a.m. on 13 March 2026. The noncompliance application is granted. Alexander Sánchez Cabo and Hugo Ricardo Guevara Sánchez, respectively Minister of Health and director of the Moravia Health Governing Area Directorate, or whoever holds those offices, are again directed to comply with the order issued by this Chamber in judgment no. 2026009006 at 9:30 a.m. on 13 March 2026, by definitively resolving the problem reported by the amparo applicant.

Document Review Case: 25-030445-0007-CO Decision No. 2026036011 CONSTITUTIONAL CHAMBER (SALA CONSTITUCIONAL) OF THE SUPREME COURT OF JUSTICE. San José, at 9:30 a.m. on 23 September 2026.
Noncompliance application (gestión de desobediencia) filed by Nombre07, identity card no. CED03, against the MINISTERIO DE SALUD.
Background:
Justice Araya García drafts the opinion; and, Reasons:
I.Regarding what was ordered by this Chamber. By judgment no. 2026009006 at 9:30 on 13 March 2026, this Court ruled as follows:
“Therefore:
The amparo application is granted. Mary Denisse Munive Angermüller and Hugo Ricardo Guevara Sánchez, respectively the Minister of Health and director of the Moravia Health Governing Area, both of the Ministry of Health, or whoever holds those positions, are ordered to issue such orders as fall within the scope of their authority and to coordinate whatever is necessary so that, within a maximum period of THREE MONTHS from service of this judgment, the corresponding dye tests are conducted on the reported party’s property and the problem reported by the amparo applicant is definitively resolved. The respondent authorities are advised that, pursuant to Article 71 of the Law Governing this Jurisdiction, any person who receives an order issued in an amparo proceeding that the person must comply with or enforce, and fails to comply with or enforce it, shall be punished by imprisonment for three months to two years, or by a fine of twenty to sixty days, provided that the offense is not subject to a more severe penalty.
The State is ordered to pay the costs, damages, and losses caused by the facts underlying this ruling, which shall be assessed during enforcement of the judgment in the administrative-litigation jurisdiction. Justice Castillo Víquez files a separate note. Justice Salazar Alvarado files a separate note. Let notice be given.” The foregoing judgment was served on the respondent authorities on 17 March 2026.
II.Regarding the application alleging non-enforcement. In this matter, the amparo applicant alleges disobedience of the order issued in judgment no. 2026009006 at 9:30 on 13 March 2026. He states that, as of this date, the Ministry of Health authorities have not definitively resolved the reported problem.
In this regard, the Minister of Health and the director of the Moravia Health Governing Area Directorate informed the Chamber as follows:
“(…) On 26 March 2026, as part of the actions taken to comply with judgment N.° 2026-009006, this Directorate sent CARTA-MS-DRRSCS-DARSM-093-2026 to the Minister of Health, providing a detailed report on the actions taken by the Moravia Health Governing Area. Similarly, through CARTAMS-DRRSCS-DARSM-094-2026, addressed to Justice Jorge Araya García of the Constitutional Chamber of the Supreme Court of Justice, notice was given of the steps and technical and administrative actions undertaken by this Health Authority in response to and in compliance with the order of the Constitutional Chamber. On 14 April 2026, this Directorate received Decision N.° 2026012874 of the Constitutional Chamber of the Supreme Court of Justice, which denied the application alleging disobedience filed by the amparo applicant. On 05 May 2026, according to ALT-MCV-05-05-26-02, a telephone call was made to follow up on the complaint and sanitary order.
At 11:04, an email was sent to Mr. Nombre05 stating that attempts had been made to call him but that it had not been possible to reach him, and asking whether he could provide a day and time when he could be called to discuss the case. On 09 May 2026, a response was received from the reported party, Mr. Nombre05, stating: ‘The work is already being done. It will be ready by Monday, 11 May.’ On 12 May 2026, at 9:25 a.m., an email was sent stating that an inspection to conduct dye tests had been scheduled for Tuesday, 19 May 2026. He was also asked to submit evidence of the work performed, as required by the sanitary order. At 9:49 a.m., an email was received stating as follows: ‘The work is already finished.’ On 13 May 2026 at 10:26 a.m., an email was sent to Mr. Nombre04 stating as follows: ‘As I indicated, among the required actions, in addition to verification through dye tests, it is necessary to submit evidence and supporting documentation regarding the work performed.
Accordingly, we await that information. We would also appreciate confirmation of your attendance next Tuesday so that the dye tests can be conducted in the four apartments.’ On 14 May 2026 at 12:55 p.m., an email was received stating: ‘The work has already been done. Thank you. Grupo gremio.’ On 14 May 2026 at 01:37 p.m., the following email was received: ‘Good afternoon, the case concerning Nombre05’s locations in Moravia has already been resolved. I am sending you a message through this email because the other one is blocked. Thank you for your attention, and I hope at some point to learn when you can come conduct the inspection. Once again. Thank you.’ On 14 May 2026 at 01:34 p.m., Mr. Nombre05 was informed that we were awaiting the evidence. He was also told that the tests would be conducted on Tuesday, 19 May, at 9:00 a.m. On 14 May 2026 at 01:37 p.m., nine photographs of the work performed were received.
They showed the use of a round septic tank, which is not permitted under the regulations in force. On 18 May 2026, Mr. Nombre05 was informed by email that the inspection was scheduled for 19 May at 9:00 a.m. On 19 May 2026, an on-site inspection was conducted pursuant to report AI-MCV-19-05-26-01 to follow up on the complaint and respond to the evidence submitted. At the site, nothing more could be observed in detail beyond recently poured concrete. During the inspection, Mr. Nombre05 confirmed that the improvements made did not have municipal permits. Accordingly, CARTA-MSDRRSCS-DARSM-215-2026 was served, through which the Ministry of Health, following a technical assessment of the evidence submitted, informed Mr. Nombre04 that the system used was not approved because it did not comply with the technical or regulatory requirements of the Reglamento para la disposición al subsuelo de aguas residuales ordinarias tratadas N°42075.
He was also informed that, before 22 July 2026, when the period granted under sanitary order MS-DRRSCS-DARSM-OS-09-2026 would expire, the improvements had to be made in compliance with the regulatory provisions. On 21 May 2026, a Motion for Reconsideration with a Subsidiary Administrative Appeal (Recurso De Revocatoria Con Apelación En Subsidio) was received. It was filed by the reported party, Mr. Nombre05, identity document CED01, against CARTA-MS-DRRSCS-DARSM-215-2026. On 26 May 2026, through CARTA-MS-DRRSCS-DARSM-0222-2026, Dr. Karla Rodríguez Montero, acting director of the Central South Regional Health Governance Directorate, was informed of the actions taken by the Moravia Health Governing Area Directorate. On 12 June 2026, the Regional Directorate issued MINISTERIAL DECISION MS-DRRSCS-1519-2026 concerning the motion for reconsideration filed by Nombre05 against CARTA-MS-DRRSCS-DARSM-215-2026, ‘Response to evidence MSDRRSCS-DARSM-OS-09-2026,’ in which the Central South Regional Health Governance Directorate ruled as follows: ‘The motion for reconsideration filed by Nombre05, identity document N°CED02, in his capacity as registered owner of the apartments located on lot 14 B of Residencial Montemayor, La Trinidad district, Moravia canton, San José province, against CARTA-MS-DRRSCSDARSM-215-2026, “Response to evidence MS-DRRSCS-DARSM-OS-09-2026,” is DENIED.
Accordingly, the challenged administrative act is affirmed and the matter is submitted to the Minister’s Office for resolution of the administrative appeal filed in the alternative.’ On 12 June 2026, the administrative appeal, CARTA-MSDRRSCS-1520-2026, was forwarded to the Legal Affairs Directorate. All of the foregoing can be verified in the case files maintained through the Chamber in this matter. On 22 July 2026, an email was sent to Mr. Nombre05 stating that the sanitary order expired that day and that the Health Governing Area Directorate was awaiting evidence of the measures implemented. That same day, his attorney, Mr. Wilfred Arguello, responded as follows: ‘The undersigned, attorney Wilfred Arguello Muñoz, counsel for Mr. Nombre05 in these proceedings, hereby informs you that, with respect to administrative decision N.º CARTA-MS-DRRSCS-DARSM-215-2026 dated 19 May 2026, on 21 May 2026 we formally filed a Motion for Reconsideration and, in the alternative, an Administrative Appeal addressed to Dr. Hugo Guevera Sánchez at the Moravia Health Governing Area Directorate.
As of today, we have received a response only to the Motion for Reconsideration and are awaiting the response to the Administrative Appeal filed in the same instrument; accordingly, as required by law, we request that you refrain from any type of proceeding or administrative act until we receive the proper response to the administrative appeal filed.’ On 30 July 2026, report IT-MS-DRRSCS-DARSM-132-2026, signed by Engineer Mónica Chavarría, was issued. It showed that, as of that date, no evidence had been submitted of corrective action taken with respect to the treatment system in compliance with CARTA-MS-DRRRSCS-DARSM-215-2026 and sanitary order MS-DRRSCS-DARSM-09-2026, and therefore there was disobedience of the authority. On 30 July 2026, the corresponding administrative acts were served on the tenants occupying the apartments located at the property in question, namely: Sanitary Order Declaring Unsanitary Conditions MSDRRSCS-DARSM-OS-77-2026, addressed to Nombre02; Sanitary Order Declaring Unsanitary Conditions MS-DRRSCS-DARSM-OS-78-2026, addressed to Nombre06; Sanitary Order Declaring Unsanitary Conditions MS-DRRSCSDARSM-OS-79-2026, addressed to Nombre03; and Sanitary Order Declaring Unsanitary Conditions MS-DRRSCS-DARSM-OS-80-2026, addressed to Nombre04.
On 31 July 2026, the registered owner was served with Sanitary Order Declaring Unsanitary Conditions MS-DRRSCS-DARSM-OS-76-2026, as well as Sanitary Report No. CARTA-MS-DRRSCS-DARSM-347-2026, concerning the collection of the corresponding fine pursuant to Articles 378 and 378 bis of the Ley General de Salud. The served decision declaring the property unsanitary expressly ordered as follows: ‘Within twenty (20) business days from the business day following service of this sanitary order, property PRN01, survey plan SJ-1359472-2009, consisting of apartments located at Dirección02, La Trinidad district, Moravia canton, San José province, shall be vacated because of its unsanitary condition. The apartment may not be occupied again until it meets the minimum sanitary conditions established by the regulations in force.’ On 03 August 2026, a meeting was held with the reported party, BITACORA-MSDRRSCS-DARSM-34-2026, at which he expressly stated his interest in and willingness to perform the necessary repairs in order to avoid execution of the eviction measure, which had been issued with a period of twenty (20) business days from the business day following service.
It was therefore stated that a professional would be sought, and an inspection was scheduled for Thursday, 06 August, at 3:00 p.m., for the purpose of verifying the corrective actions proposed by the reported party and the professional in charge. On 03 August 2026, the Minister of Health issued MINISTERIAL DECISION RM-MS-DM-VA-4621-2026, ruling as follows: (…) the administrative appeal filed by Mr. Nombre05 against official letter CARTA-MS-DRRSCS-DARSM-215-2026, dated 19 May 2026, is DENIED. Accordingly, the challenged act is affirmed in all respects, and Sanitary Order N°MS-DRRSCS-DARSM-OS-009-2026 remains fully in effect because it complies with the legal system and its technical and sanitary grounds have not been rebutted. On 06 August 2026, an email was received from Mr. Nombre05 sharing a professional’s report certifying that the drains were in good condition and that the septic tank was being replaced because of a crack in the concrete tank.
He also submitted the technical specifications for the septic tank to be used. On 06 August, an on-site inspection was conducted pursuant to report AI-MCV-06-08-26-01, during which it was verified that work was underway to replace the former septic tank and that a septic tank with a 3:1 length-to-width configuration was present at the site, as certified by the professional retained by Mr. Nombre04. On 07 August 2026 at 9:10 a.m., Mr. Nombre07 was informed that new dye tests had been scheduled at property 14B, and the presence of an adult at the property was therefore requested to allow officials from the Health Regulation Process to enter and conduct the corresponding inspection. On 07 August 2026 at 10:27 a.m., Mr. Nombre07 stated as follows: ‘Officials of Health Regulation, with all due respect, in this case I do not accept the scheduled tests because, according to Ministry of Health records, the deadlines for repairs were not met and there is a declaration of unsanitary conditions, as shown in the document sent yesterday, 06-08-2026, containing a Sanitary Order Declaring Unsanitary Conditions, document MS-DRRSCS-DARSMOS-76-2026, issued by Mr.
Hugo Guevara. In other words, there is clear disregard for the regulations and procedures. We ask that the procedures already specified be respected. We await the eviction from the property and its eventual repair, supported by a professional certified in the field and duly licensed, in compliance with the health regulations in force. Health officials, we remind you that the procedures and dates already established must be respected. I attach a letter supporting everything stated above.’ On 07 August 2026 at 3:57 p.m., Mr. Nombre07 was informed: ‘You are hereby informed that this Health Governing Area Directorate has proceeded to address your complaint in accordance with the established procedure and the legal framework. The corresponding actions will also continue until a final resolution is reached. 1. Actions taken in compliance with the judgment issued by the Constitutional Chamber. In response to judgment N°2026-009006, issued by the Constitutional Chamber on 18 March 2026, which granted the amparo application filed by Mr.
Nombre07 and ordered the Ministry of Health to conduct the corresponding dye tests at the reported property and definitively resolve the reported problem within a maximum period of three months from service of the decision, the Legal Affairs Directorate is informed that this Directorate has continuously and diligently undertaken, within the scope of its legal and technical authority, a series of actions intended to identify the source of the sanitary impact, determine those responsible, order the corresponding corrective measures, and monitor compliance with them. As set out above in chronological order, the actions taken demonstrate constant and sustained administrative intervention. In summary: 1.1 Response to the complaint. Since November 2025, multiple inspections have been conducted at the properties involved to verify the reported situation and coordinate the performance of dye tests.
During these proceedings, telephone calls, coordination with the complainant, owners, and tenants, and site visits were undertaken to obtain access to the properties involved. 1.2 Performance of dye tests. Various sodium fluorescein tests were conducted in the apartments located on Mr. Nombre05’s property. As a result of those tests, it was technically confirmed that wastewater was being improperly disposed of and discharged toward the curb and gutter, as well as toward the affected property, a situation documented in the corresponding technical reports. The reports issued include: • MS-DRRSCS-DARSM-IT-MCV-68-2025. • IT-MS-DRRSCS-DARSM-18-2026. • IT-MS-DRRSCS-DARSM-21-2026. • IT-MS-DRRSCS-DARSM-27-2026. These reports confirmed that all four apartments had problems with wastewater management. 1.3 Issuance and service of sanitary orders. Based on the technical findings, the Ministry of Health issued the corresponding sanitary orders addressed both to the registered owner and to the occupants of the apartments involved.
The Health Governing Area Directorate made multiple attempts at service, including site visits, telephone calls, and emails. Finally, on 09 March 2026, Sanitary Order MS-DRRSCS-DARSM-OS-09-2026 was personally served on Mr. Nombre05 in his capacity as registered owner, granting him ninety (90) business days to carry out the required corrective measures. It is important to note that this sanitary order was issued and served before judgment N.° 2026-009006 of the Constitutional Chamber, which was handed down on 18 March 2026. Accordingly, when the constitutional decision was issued, this Directorate had already technically identified the sanitary problem, determined who was responsible for it, and exercised its oversight and governance powers by issuing and serving the corresponding administrative acts. The period granted for conducting the corresponding dye tests on the reported party’s property and definitively resolving the problem reported by the amparo applicant therefore exceeded by approximately one (1) month the period granted by the Chamber because, at that time, notice of the Chamber’s decision, which granted a mandatory period of three (3) months for resolution, had not been reported.
This was stated in CARTA-MS-DRRSCS-DARSM-094-2026, addressed to Justice Jorge Araya García of the Constitutional Chamber of the Supreme Court of Justice. It is reiterated that this Health Governing Area Directorate has made numerous efforts, most of them unsuccessful, because there was considerable difficulty in carrying out the dye tests and the subsequent corresponding service of notices. There has been little cooperation from the reported party and the complainant, as can be corroborated in the visual inspection reports, telephone-call records, and service records, as demonstrated in this account. Despite the difficulties, the Health Governing Area has succeeded in conducting the dye tests and effectively serving sanitary orders on both the registered owner and the tenants, in accordance with the procedure established for addressing this type of complaint. 1.4 Monitoring compliance with the sanitary orders.
Subsequently, compliance with the sanitary orders issued was monitored through telephone calls and emails to verify implementation of the ordered corrective measures. During May 2026, the person subject to the administrative proceedings informed the Ministry of Health that the required work had been performed and submitted photographic evidence of that work. That evidence was rejected through CARTA-MS-DRRSCS-DARSM-215-2026 because the work did not meet the technical specifications required under the health regulations in force. As part of the monitoring actions, an email was sent to Mr. Nombre05 on 22 July 2026 informing him that the period granted by Sanitary Order MS-DRRSCS-DARSM-OS-09-2026 expired on that date and that the Health Governing Area Directorate was awaiting evidence establishing implementation of the ordered corrective measures. That same day, a response was received from attorney Wilfred Arguello Muñoz, in his capacity as counsel for Mr.
Nombre05, stating that on 21 May 2026 he had filed a motion for reconsideration with a subsidiary administrative appeal against CARTA-MS-DRRSCS-DARSM-215-2026, that they had received only a response regarding the motion for reconsideration, and that they remained awaiting a decision on the administrative appeal. He also requested that no additional administrative actions be taken until that appeal had been resolved. 1.5 Subsequent verification. After Sanitary Order MS-DRRSCS-DARSM-OS-09-2026 expired, Mr. Nombre05 was asked on 22 July 2026 to submit evidence of compliance. In response, his legal representative reported the filing of administrative challenges and requested that action be suspended until resolution of the administrative appeal. Nevertheless, this Directorate is clear that the filing of the challenge does not suspend the administrative act. In the absence of sufficient evidence of compliance, technical report ITMS-DRRSCS-DARSM-132-2026 was issued, concluding that there had been noncompliance and disobedience of the health authority.
Accordingly, on 30 and 31 July 2026, the respective Sanitary Orders Declaring Unsanitary Conditions were served on the tenants and the registered owner, together with the act relating to imposition of the corresponding fine. Subsequently, on 03 August 2026, Ministerial Decision RM-MS-DM-VA-4621-2026 denied the administrative appeal filed by Mr. Nombre05 and affirmed the validity of the administrative actions taken. That same day, the person subject to the administrative proceedings stated his intention to make the required corrections, and a new inspection was therefore arranged. On 06 August 2026, technical documentation relating to replacement of the septic tank was submitted, and an on-site inspection verified that corrective work was being performed at the property. Likewise, on 07 August 2026, new dye tests were arranged for 11 August to verify the effectiveness of the measures implemented; however, the complainant objected to their performance.
Nevertheless, this Directorate informed him that the administrative actions would continue until the case was definitively resolved. It is important to clarify that Sanitary Order Declaring Unsanitary Conditions MSDRRSCS-DARSM-OS-76-2026 does not impose a permanent or definitive prohibition on occupancy of the property. The administrative act orders the apartments to be vacated within twenty (20) business days from service because of the unsanitary conditions existing at the time of its issuance. Nevertheless, the decision itself expressly provides that the property may be occupied again once it meets the minimum sanitary conditions required by the regulations in force. In that regard, the purpose of the sanitary order is not to prohibit use of the property indefinitely, but to protect public health while the conditions giving rise to the declaration of unsanitary conditions persist. Consistent with that rationale, the subsequent actions undertaken by Mr.
Nombre05 are directed toward correcting the sanitary deficiencies identified by this Directorate in order to demonstrate compliance with the technical requirements and definitively remedy the impact giving rise to the complaint filed by Mr. Nombre07. Honorable Justice Jorge Araya García, the actions taken by this Ministry have at all times been directed toward addressing and remedying the impact that the reported property has caused Mr. Nombre07. Nevertheless, the position adopted by the complainant is concerning, as he has repeatedly made statements asserting that the Ministry of Health has taken no action to resolve the matter raised. Those assertions are unfounded because the administrative case file contains numerous actions taken by this Directorate that demonstrate continuous, diligent, and timely handling of the case. Indeed, the Ministry of Health has continuously followed up on the complaint and taken the steps falling within the scope of its legal authority in order to guarantee the protection of public health and address the concerns raised by Mr.
Nombre07. Accordingly, the complainant’s statements purporting to show alleged institutional inaction are rejected, as the actions recorded in the case file demonstrate the commitment, diligence, and continuity with which this Ministry has handled the matter at issue in this complaint. (…)” Based on the foregoing and the facts set out by the amparo applicant, it is determined that this Ministry’s actions fully comply with the legal system in force and that no disobedience has occurred, given that, in exercising health governance and monitoring public-health risks relating to environmental pollution, the Ministry of Health’s authority to intervene is contingent upon objective verification of the reported facts through technical inspections or sufficient evidence. In the present case, it has been demonstrated that the Moravia Health Governing Area has acted continuously, diligently, and proportionately by conducting inspections and dye tests; issuing and serving sanitary orders; technically assessing the evidence submitted; addressing the administrative challenges filed; monitoring compliance with the ordered measures; and issuing subsequent administrative acts in response to verified noncompliance.
All of this demonstrates that there has been no institutional inaction, but rather an effective exercise of the legal authority assigned to this Ministry to protect public health and seek a definitive solution to the reported impact. It must also be reiterated, Justice, that the administrative actions taken have respected due process, the applicable health regulations, and the time periods corresponding to each procedural phase, and that the amparo applicant’s statements do not rebut the technical and administrative actions recorded in the case file. On the contrary, those actions demonstrate that this administration has handled the case continuously and within the scope of its authority, seeking at all times to verify, order, monitor, and correct the identified sanitary conditions.” In relation to the foregoing, this Chamber deems it established that, although the Ministry of Health authorities have taken steps to comply with the order in judgment no. 2026009006, the fact remains that the order has not yet been fully complied with because the evidence submitted to the case file, as well as the amparo applicant’s recent statements, demonstrate that sanitary order no. MS-DRRSCS-DARSM-OS-76-2026 issued by the Ministry of Health has not been complied with and that the dye tests conducted on 7 September 2026 yielded positive results.
Accordingly, the respondent authorities are again directed to comply with the order issued by this Chamber in judgment no. 2026009006 at 9:30 on 13 March 2026.
III.Documentation submitted to the case file. The parties are advised that, if they have submitted any paper document, as well as objects or evidence contained on any additional electronic, computerized, magnetic, optical, or telematic device, or produced using new technologies, these items must be collected from the Court’s offices within a maximum period of 30 business days from service of this judgment. Otherwise, any material not collected within that period shall be destroyed pursuant to the “Reglamento sobre Expediente Electrónico ante el Poder Judicial,” approved by the Full Court at session no. 27-11 of 22 August 2011, Article XXVI, and published in Boletín Judicial no. 19 of 26 January 2012, as well as the agreement approved by the Consejo Superior del Poder Judicial at session no. 43-12 held on 3 May 2012, Article LXXXI.
Therefore:
The application alleging disobedience is granted. Alexander Sánchez Cabo and Hugo Ricardo Guevara Sánchez, respectively the Minister of Health and director of the Moravia Health Governing Area Directorate, or whoever holds those positions, are again directed to comply with the order issued by this Chamber in judgment no. 2026009006 at 9:30 on 13 March 2026 by definitively resolving the problem reported by the amparo applicant. The foregoing is subject to the warning that, if disobedience is established, an administrative proceeding may be ordered against the official who refuses to comply with this Chamber’s ruling, and certified copies of the relevant portions of the case file may also be ordered transmitted to the Ministerio Público regarding the possible commission of the offense of disobedience (Articles 53 and 71 of the Ley de la Jurisdicción Constitucional). Let Alexander Sánchez Cabo and Hugo Ricardo Guevara Sánchez, respectively the Minister of Health and director of the Moravia Health Governing Area Directorate, or whoever holds those positions, be served personally.- Fernando Castillo V.
