SummaryResumen
The Constitutional Chamber (Sala Constitucional) granted a noncompliance motion against the Ministerio de Salud for failure to comply with judgment no. 2026012204, which had ordered a final decision within one month on a June 2023 sanitary complaint concerning noise and vibrations from a gym. Although the Área Rectora de Salud de Turrialba documented inspections, sound measurements, sanitary orders, administrative challenges, and review of a noise-confinement plan, its own report acknowledged that a regional technical assessment remained pending. The Chamber held that those preparatory, monitoring, and technical-assessment measures did not amount to the final resolution required by its judgment. Neither a final decision on sanitary complaint no. 0099-2023 nor notice of such a decision to the complainant appeared in the record within the prescribed period. It therefore personally reiterated the compliance order to the acting director of the Área Rectora, or the officeholder, warning that proven disobedience could lead to administrative proceedings and referral of certified records to the Ministerio Público concerning the possible offense of disobedience.
Key excerptExtracto clave
It follows from the foregoing and from the evidence entered into the record that the respondent authority reported multiple monitoring measures, as well as the receipt, formal review, and referral to the Dirección Regional Central Este of a noise-confinement plan submitted by the reported establishment. However, the authority's own report of 2 June 2026 stated that the result of the regional technical assessment remained pending and that, once received and evaluated, the results would be communicated to the amparo applicant and to this Chamber. Moreover, the record contains neither a final decision concerning sanitary complaint no. 0099-2023 nor notice of such a decision to the complainant within the period granted following notification of the judgment. Finally, it should be noted that the documented preparatory, monitoring, and technical-assessment measures do not constitute the specific action ordered, namely, to decide the complaint definitively and communicate the corresponding decision.

Post-judgment application filed by Nombre01, identity card no. CED01, against the MINISTERIO DE SALUD.
Background:
That technical assessment concluded that the document entitled “Acoustic Mitigation Plan,” submitted by the regulated party, did not fully comply with the requirements established in Article 23 of the Reglamento para el Control del Ruido, Decreto Ejecutivo N.º 44486-S, because it lacked information and technical elements essential for its evaluation, including a detailed description of the noise sources, sketches and specifications for the proposed containment works, engineering calculations, an implementation schedule, and the other technical requirements set forth in the applicable regulations. It was also stated that the plan submitted was incomplete for purposes of what had been required through Sanitary Order N.º 0312-2025, and it was recommended that this Governing Health Area (Área Rectora de Salud) require the regulated party to correct the identified inconsistencies and submit a proposal conforming to the requirements established in the regulations in force.
It was further indicated that the plan could not be deemed approved until those observations had been addressed. (See folios 0754 to 0756). Following up on the technical assessment issued by the Dirección Regional Central Este, through official letter CARTA-MS-DRRSCE-DARST-0436-2026 dated 16 March 2026, this Governing Health Area forwarded to Mr. Nombre03, legal representative of the establishment known as Grit Box, the observations made by the Regional Level concerning the Acoustic Mitigation Plan submitted in the administrative case file. That letter informed the regulated party that, in accordance with the technical assessment contained in official letter CARTA-MS-DRRSCE-URS-0101-2026, the plan submitted did not fully comply with the requirements established in Article 23 of the Reglamento para el Control del Ruido, Decreto Ejecutivo N.º 44486-S. He was therefore asked to review the stated observations and submit to this Health Authority corrected documentation conforming to the technical requirements indicated by the Regional Directorate.
He was also reminded that the plan submitted could not be deemed approved until the identified observations had been duly addressed. (See folios 0762 and 0763). FIFTEENTH. On 19 March 2026, this Governing Health Area received official letter PRO-19-03-2026, signed by Engineer Allan Herra Ávila, a representative of the company PROSERSA, reporting that the firm had been retained by the establishment known as Grit Box to provide the technical consulting services required to prepare the documentation necessary to address the observations made concerning the Acoustic Mitigation Plan submitted in the administrative case file relating to Sanitary Order N.º 0312-2025. The document stated that the consulting services would include preparing plans for improvements to the establishment, engineering calculations for noise containment, and a schedule of construction activities. It indicated that these actions were intended to comply with the requirements established in the Reglamento para el Control del Ruido, Decreto Ejecutivo N.º 44486-S, and to address the technical observations communicated by this Health Authority in follow-up to the assessment issued by the Dirección Regional Central Este.
(See folios 0770 and 0772). Furthermore, after the submitted documentation was reviewed, it became evident that it consisted solely of an informational communication concerning the engagement of professional services to prepare the technical proposal, without providing the plans, engineering calculations, implementation schedule, or other technical documents necessary to assess compliance with the observations made concerning the Acoustic Mitigation Plan. Submission of the documentation required for the corresponding technical analysis therefore remained pending. (See folio 0776). In view of the foregoing, through official letter CARTA-MS-DRRSCE-DARST-0503-2026 dated 06 April 2026, duly served on the regulated party on that same date, this Governing Health Area formally required submission of the outstanding technical documentation relating to the establishment’s acoustic containment plan.
That letter stated that memorandum PRO-19-03-2026 referred to the engagement of professional services to develop an improvement plan aimed at containing noise; however, it neither provided the required technical documentation nor established a deadline for its submission. It also reiterated that the plan previously submitted continued not to comply with the requirements stated in official letter CARTA-MSDRRSCE-URS-0101-2026 issued by the Dirección Regional Central Este. The regulated party was therefore asked to submit the complete documentation for the noise-containment plan so that compliance with Sanitary Order N.º 0312-2025 could be verified. (See folios 0780 and 0781). On 13 April 2026, this Governing Health Area received an email from Mr. Nombre03, legal representative of the establishment known as Grit Box, formally requesting an extension for submitting the technical documentation relating to the acoustic containment plan required as part of the follow-up to Sanitary Order N.º 0312-2025.
In that request, the regulated party stated that the professional responsible for preparing the project required additional time to properly complete the necessary technical documentation, including the studies and elements required to prepare the acoustic containment plan. He also expressed his intention to comply with the requirements issued by this Health Authority and requested an extension of ten business days to submit the outstanding documentation. (See folios 0808 and 0809). On 20 April 2026, this Governing Health Area received an email from Engineer Allan Herra Ávila, representative of the consulting firm PROSERSA, reporting on the progress of the technical consulting services retained by the establishment known as Grit Box to address the requirements associated with Sanitary Order N.º 0312-2025. He stated that the plans for the proposed acoustic solution had already been completed and that the supplementary documentation for the acoustic containment plan and improvement schedule would be submitted in the following days.
Subsequently, on 27 April 2026, the same professional sent this Governing Health Area the technical documentation for the establishment’s acoustic containment proposal, including the technical memorandum, construction plans for the proposed improvements, and the implementation schedule for the recommended works. That documentation was added to the administrative case file for the corresponding technical review and analysis, in order to assess compliance with the observations previously made by this Health Authority and the Dirección Regional Central Este. (See folios 0813 and 0814, 0824 to 0887). Subsequently, through technical report CARTA-MS-DRRSCE-DARST-IT-0452-2026 dated 28 April 2026, this Governing Health Area conducted a documentary review of the information provided by the regulated party concerning the Acoustic Containment Plan for the establishment known as Grit Box. That analysis determined that the documentation submitted formally satisfied the documentary requirements of Sanitary Order N.º 0312-2025, including a technical memorandum, plans, schedule, and other information associated with the acoustic containment proposal.
Nevertheless, given the specialized nature of the required evaluation, it was concluded that the documentation should be forwarded to the Dirección Regional Central Este for technical review by the competent professional and issuance of the corresponding technical assessment concerning the suitability and sufficiency of the proposed measures. It was also placed on record that, once that assessment had been issued, the result would be communicated to the regulated party and the pertinent administrative actions in the case file would continue. (See folios 0892 to 0894). Pursuant to the conclusions contained in technical report CARTA-MS-DRRSCEDARST-IT-0452-2026, through official letter CARTA-MS-DRRSCE-DARST-0606-2026 dated 28 April 2026, this Governing Health Area forwarded to the Dirección Regional Central Este the documentation for the Acoustic Containment Plan submitted by the establishment known as Grit Box, requesting its technical evaluation by the competent professional.
That letter stated that the documentation provided had undergone a preliminary formal review and that, owing to the technical complexity of the case, a specialized assessment was essential to determine the suitability, sufficiency, and effectiveness of the proposed noise-mitigation measures and to guide decision-making in the administrative case file. The letter also requested that the case be assigned to a specialized professional and that the corresponding technical assessment be issued. (See folios 0906 and 0907). Furthermore, through official letter CARTA-MS-DRRSCE-DARST-0637-2026 dated 05 May 2026, communicated to Mr. Nombre01 by email sent on 06 May 2026, this Governing Health Area provided updated information on the status of the administrative case file, informing him that the acoustic containment plan submitted by the establishment had been received and subjected to a formal-compliance review and had subsequently been forwarded to the Dirección Regional Central Este for technical evaluation by the competent professional.
He was also informed that this review was necessary to determine the suitability of the proposed measures and define the corresponding administrative actions, and it was reiterated that this Health Authority continued to actively follow up on the case in accordance with its powers and the regulations in force. (See folios 0919 and 0920).
(See folios 0921 to 0923). SIXTEENTH. In view of the foregoing, this Governing Health Area considers it important to note that, throughout the handling of sanitary complaint N.º 0099-2023, the technical and administrative actions necessary for the proper evaluation of the case have been carried out continuously and consistently, including sanitary inspections, sound-level measurements, the issuance of sanitary orders, the analysis of administrative challenges, the review of technical documentation, coordination with specialized regional bodies, and ongoing follow-up on the measures implemented by the reported establishment. In addition, throughout the entire process, continuous attention has been given to the various follow-up requests submitted by Mr.
Nombre01, as well as to requests for information made by various oversight and supervisory bodies, including the Defensoría de los Habitantes, through the preparation of reports and responses and through institutional coordination relating to this case file. Similarly, the various inspections and evaluations conducted established that the reported establishment progressively implemented several measures aimed at reducing the disturbances associated with the noise generated by its activities, including the installation of impact-absorbing surfaces, thicker rubber flooring, foam materials to reduce the impact caused by dropped weights, and operational adjustments relating to the use of sound equipment. These circumstances also had to be evaluated technically within the administrative procedure. The actions described demonstrate that this Health Authority has maintained active, continuous, and diligent follow-up on the case, endeavoring at all times to ensure that its actions conform to its legally conferred powers, the established procedures, the specialized technical assessments required by the nature of the matter, and the directives issued by the competent higher authorities.
Consequently, the steps taken reflect a continuous and sustained effort to address the complaint comprehensively, verify compliance with the ordered sanitary measures, and discharge the obligations imposed on this Administration, without any abandonment, inactivity, or neglect of the actions that could reasonably be required within the scope of its powers. Therefore, this esteemed authority is hereby informed that, once the Área Rectora de Salud de Turrialba receives and evaluates the results of the analysis of the noise-containment plan—submitted by the Great Box gym to the Regional Level—this Health Authority will immediately notify both the amparo applicant and the Constitutional Chamber (Sala Constitucional) of the results obtained, in order to guarantee due process and the effective protection of the fundamental rights invoked.”
Justice Araya García drafted the decision; and, Reasons:
I.Regarding the order issued by this Chamber. By judgment no. 2026012204 at 9:20 a.m. on 10 April 2026, this Court ordered as follows:

Likewise, within that same period, the complainant must be notified of the decision. The respondent is advised that failure to comply with the foregoing order will constitute the offense of disobedience and that, pursuant to Article 71 of the Law governing this jurisdiction, any person who receives an order that they must comply with or enforce, issued in an amparo proceeding, and fails to comply with or enforce it, shall be punished by imprisonment for three months to two years or by a fine of twenty to sixty days, provided that the offense is not subject to a more severe penalty.

The application is denied in all other respects. Justice Castillo Víquez files a separate note. Justice Salazar Alvarado files a separate note. Notice shall be given.” The foregoing judgment was served on the respondent authorities on 13 April 2026.
II.Regarding the application alleging noncompliance (gestión de incumplimiento). In the present matter, the amparo applicant alleges disobedience of the order contained in judgment no. 2026012204 at 9:20 a.m. on 10 April 2026. He states that, as of this date, the authorities of the Turrialba Health Governing Area have not resolved the complaint filed in June 2023.
In judgment no. 2026012204, this Chamber ordered as follows: “(…) within no more than one month from service of this judgment, a final decision shall be issued on the complaint filed by the applicant in June 2023, and the corresponding determination shall be communicated. Likewise, within that same period, the complainant must be notified of the decision.” In this regard, the Director of the Turrialba Health Governing Area informed this Chamber as follows:
“FACTUAL MATTERS. complainant reiterating objections concerning the establishment’s authorization process and again requesting review and possible revocation of the Health Operating Permit. • 16 June 2025: Issuance of official letter MS-DRRSCE-DARST-0885-2025, providing a comprehensive response to the complainant’s questions and concluding that the Health Operating Permit had been granted in accordance with law and that no technical or legal grounds existed for its revocation. • 27 May 2025: A new sound-level measurement in response to the complainant’s request and issuance of Technical Report MS-DRRSCE-DARST-IT-0666-2025. • Technical Report MS-DRRSCE-DARST-IT-0666-2025 concluded that the recorded continuous noise was within permitted limits; however, the impact noise exceeded the limit established by the regulations then in force. • Notwithstanding the foregoing, the same report determined that the report generated by the sound-level meter did not contain the post-calibration record required to validate the measurement formally, and it recommended conducting a new measurement to ensure the technical and legal validity of any subsequent action. • By official letter MS-DRRSCE-DARST-0976-2025, the complainant was informed of the results of that measurement and of the need to repeat the test because the post-calibration record had been omitted.
The foregoing actions form part of the numerous technical, administrative, and follow-up measures undertaken by this Health Authority between June 2023 and July 2025, which were extensively set out in official letter MS-DRRSCE-DARST-1066-2025, attached as background to this report. The following factual matters detail the actions taken after that report. (see folios 0447 to 0477). FOURTH: Following the actions detailed in official letter MS-DRRSCE-DARST-1066-2025 dated 23 July 2025, this Health Governing Area continued its ongoing monitoring of health complaint N.º 0099-2023 and undertook further technical and administrative actions aimed at verifying the reported facts and adopting the corresponding health measures, including the following: • 03 September 2025: A communication was received from Mr. Nombre01 indicating the dates and times convenient for him for a new sound-level measurement.
In response to that submission, telephone arrangements were made with the complainant to establish the date of the proceeding and ensure the conditions necessary for proper performance of the technical test. (see folio 0478) • 11 September 2025: Officials from this Health Governing Area conducted an inspection and sound-level measurement at the home of Mr. Nombre01, documented in Technical Report CARTA-MS-DRRSCE-DARST-IT-1098-2025 and performed as follow-up to complaint N.º 0099-2023. The purpose of the proceeding was to conduct a new technical assessment of the noise levels attributable to the establishment known as Grit Box, using properly calibrated measuring equipment and applying the procedure established in the Reglamento para el Control del Ruido Ambiental N.º 44486-S. The measurement yielded adjusted values of 54,4 dB(A) for continuous noise and 59,5 dB(A) for impact noise, both below the maximum permissible limit of 70 dB(A) applicable to mixed-use zones during daytime hours.
This action was recorded in Technical Report CARTA-MS-DRRSCE-DARST-IT-1128-2025. A Larson Davis model PLA01 sound-level meter provided by the Paraíso Health Governing Area was used for this proceeding. This new measurement yielded values of 51,4 dB(A) for continuous noise and 58,3 dB(A) for adjusted impact noise, likewise below the maximum permissible limit of 70 dB(A) established for the receiving zone classified as a mixed-use zone. During preparation of the technical report, it was also determined that the calibration certificate for the equipment used had exceeded by five days the period of validity recognized by the Administration, a circumstance expressly recorded in the case file. (see folios 0494 to 0509). • 21 November 2025: By email from the Dirección Regional Central Este to this Health Governing Area, Technical Report CARTA-MS-DRRSCE-URS-IT-0450-2025 and the corresponding inspection record were forwarded for analysis and decision-making.
The analysis in that report shows that, during the measurement conducted on 25 October 2025, the impact caused by dropped weights during activities at the establishment was identified as the principal source of noise. It was also determined that the adjusted impact-noise measurements reached values of 75,9 dB(A), 75,6 dB(A), and 75,2 dB(A), exceeding the maximum permissible limit of 70 dB(A) established for a mixed-use zone during daytime hours. The technical report concluded that the impact-noise levels generated by the activity conducted at the establishment exceeded the limits established by Decreto Ejecutivo N.° 44486-S, Reglamento para el Control del Ruido Ambiental, and recommended assessing the application of corrective health measures. (see folios 0536 to 0545). • 27 November 2025: After analyzing Technical Report CARTA-MS-DRRSCEURS-IT-0450-2025 and the recommendations issued by the Unidad Regional de Rectoría de la Salud, this Health Governing Area issued Health Order N.° 0312-2025 to Mr.
Nombre03, legal representative of the establishment known as Grit Box., which was served on 03 December 2025. Through that administrative act, the regulated party was ordered to suspend the noise-generating activity when technically possible or, within a maximum period of twenty business days, submit a corrective-action plan and/or an acoustic-containment plan intended to eliminate or mitigate the disturbances caused by noise generated by the activity conducted at the establishment. (see folios 0546 to 0549). • 04 December 2025: Official letter CARTA-MS-DRRSCE-DARST-1677-2025 was served on Mr. Nombre01, informing him of the actions taken regarding health complaint N.° 0099-2023, the results obtained during the investigation, and the status of the administrative steps taken by this Health Authority in handling the case; he was also informed that the corresponding follow-up would continue until compliance with the ordered measures had been verified.
(see folios 0550 and 0554). FIFTH: Subsequently, as part of the administrative processing arising from Health Order N.º 0312-2025, the following actions were taken: • 10 December 2025: A filing was received from Mr. Nombre03, legal representative of the establishment known as Grit Box, in which he filed a motion for reconsideration with a subsidiary appeal against Health Order N.º 0312-2025. In his filing, the challenging party raised various objections concerning the authority of the officials who participated in the sound-level measurement, the validity of Technical Report CARTA-MS-DRRSCE-URS-IT-0450-2025, the methodology applied during the inspection conducted on 25 October 2025, and the technical and legal grounds for the challenged administrative act. (see folios 0557 to 0587). • On that same date, through official letter CARTA-MS-DRRSCE-DARST-1727-2025, this Health Governing Area referred the challenge and its background materials to the Dirección Regional Central Este for the corresponding processing and decision, attaching the technical and administrative documentation that formed the basis for issuing Health Order N.º 0312-2025.
SIXTH: In parallel with the processing of the motion for reconsideration filed against Health Order N.º 0312-2025, this Health Governing Area continued handling the submissions made by Mr. Nombre01 in his capacity as complainant, conducting the corresponding technical and administrative assessments to determine the applicable course of action regarding implementation of the measures ordered in the administrative case file, and took the following actions: • The submission filed by Mr. Nombre01 on 09 December 2025 was received for analysis. In it, he requested immediate enforcement of Health Order N.º 0312-2025 based on alleged noncompliance with the provisions imposed on the establishment known as Grit Box. The submission was added to the administrative case file for the corresponding assessment. (see folios 0594 and 0595). • 15 December 2025: Technical Report CARTA-MS-DRRSCE-DARST-IT-1393-2025 provided a technical and documentary analysis of the complainant’s submission.
The review concluded that the request required a prior additional technical and legal opinion that would adequately support the administrative course of action concerning the possible immediate suspension of the noise-generating activity, and recommended referring the case to the regional level for specialized assessment. (see folios 0596 and 0597). • 07 January 2026: Through official letter CARTA-MS-DRRSCE-DARST-0022-2026, this Health Governing Area referred Technical Report CARTA-MS-DRRSCE-DARST-IT-1393-2025 and the submission filed by Mr. Nombre01 to the Dirección Regional Central Este, requesting a technical and legal opinion concerning the applicable administrative course of action in relation to Health Order N.º 0312-2025 and the possible immediate suspension of the noise-generating activity. That official letter was served on 09 January 2026. (see folios 0599 and 0600). • In addition, through official letter CARTA-MS-DRRSCE-DARST-0023-2026, Mr.
Nombre01 was informed that his submission and the analysis performed by this Health Authority had been referred to the regional level for issuance of the corresponding technical opinion and that the decision would be communicated to him in due course once the requested determination had been received. That official letter was served on 09 January 2026. (see folios 0601 and 0602). SEVENTH: In addition to the actions described above, Mr. Nombre01 had ongoing matters before the Defensoría de los Habitantes concerning the facts at issue in this complaint. In the exercise of its authority, that institution requested various items of information and technical and legal opinions from the Ministerio de Salud concerning noise, vibrations, and the application of the regulations in force to establishments devoted to physical-fitness activities. In that context, on 27 January 2026, this Health Governing Area received, by email forwarded by the Dirección Regional Central Este, official letter N.º 0825-2026-DHR-(CV), issued by the Defensoría de los Habitantes, together with documents CARTA-MS-AJ-UAL-ER-3210-2025 and CARTA-MS-DSA-UNAS-080-2025.
Those documents analyzed matters concerning the application of the Manual para la Habilitación de Centros de Acondicionamiento Físico (Decreto Ejecutivo N.º 33532-S), indicating that it provides for preventive measures such as impact-absorbing floors and acoustic insulation that indirectly contribute to mitigating vibrations. It was also noted that there are currently no specific national regulations establishing technical parameters for measuring and regulating vibrations in nonindustrial buildings; however, the documents emphasized the possibility of implementing technical, structural, and operational measures aimed at reducing the effects associated with noise and vibrations, as well as the need to develop specialized regulations on the subject. That documentation was added to the administrative case file for consideration and assessment as part of the comprehensive analysis of the case.
(see folios 0615 to 0622). EIGHTH: As part of the processing of the motion for reconsideration with a subsidiary appeal filed by Mr. Nombre03 against Health Order N.º 0312-2025, the Dirección Regional de Rectoría de la Salud Central Este analyzed the arguments raised by the challenging party and issued the corresponding decision. • 02 February 2026: Through decision CARTA-MS-DRRSCE-0067-2026, the Dirección Regional de Rectoría de la Salud Central Este decided the motion for reconsideration filed by Mr. Nombre03 against Health Order N.º 0312-2025. That decision analyzed the arguments concerning the authority of the officials who performed the sound-level measurement, the validity of Technical Report CARTA-MSDRRSCE-URS-IT-0450-2025, the identification of the regulated party, the methodology applied during the measurement, and the technical and legal grounds for the challenged health order.
As a result of that analysis, the Regional Directorate rejected the arguments raised by the challenging party and upheld the validity of the actions taken in the administrative case file. • In addition, by email sent on 02 February 2026, the Dirección Regional de Rectoría de la Salud Central Este served decision CARTA-MS-DRRSCE-0067-2026 on Mr. Nombre03, expressly indicating that it constituted the response to the motion for reconsideration filed against Health Order N.º 0312-2025. (see folios 0632 to 0652) NINTH: On 27 January 2026, this Health Governing Area received technical and legal documentation concerning the issue of noise and vibrations associated with the operation of physical-fitness centers, which was added to the administrative case file for assessment as part of the comprehensive analysis of the case. The documentation received included official letter CARTA-MS-DSA-UNAS-080-2025 dated 15 December 2025, issued by the Dirección de Salud Ambiental, setting out a technical opinion on vibrations generated by activities such as those conducted in gyms.
Among other matters, it stated that the country currently has no specific regulations governing the measurement and regulation of vibrations in nonindustrial buildings and described various technical and structural measures aimed at mitigating such effects. Official letter CARTA-MS-AJ-UAL-ER-3210-2025 dated 18 December 2025, issued by the Dirección de Asuntos Jurídicos del Ministerio de Salud, was also received. It analyzed the application of the Manual para la Habilitación de Centros de Acondicionamiento Físico (Decreto Ejecutivo N.º 33532-S) and concluded that the provisions concerning impact-absorbing floors and acoustic insulation constitute preventive measures that help reduce both noise and vibrations transmitted to adjoining buildings. That documentation was added to the administrative case file and considered by this Health Authority as technical and legal input for the comprehensive assessment of the reported facts and for determining subsequent administrative action concerning compliance with Health Order N.º 0312-2025.
(see folios 0652 to 0656). TENTH: As part of the follow-up conducted by this Health Governing Area to verify compliance with Health Order N.º 0312-2025 and address the pending matters in the administrative case file, the following actions were taken: • Technical Report CARTA-MS-DRRSCE-DARST-IT-0123-2026 documented the inspection conducted on 29 January 2026 at the establishment known as Grit Box to verify compliance with the provisions of Health Order N.º 0312-2025. During the inspection, it was established that the establishment continued to be out of compliance with the provisions ordered in the first and second points of that health order, with both the suspension of the noise-generating activity and the submission of the corrective actions and/or acoustic-containment plan required by this Health Authority remaining outstanding. The inspection also included physical verification of the current condition of the facilities and the measures implemented by the regulated party to mitigate noise-related disturbances.
A new, thicker rubber floor had been installed in the training area, a measure that could help reduce the disturbances associated with noise generated by the activity. The report concluded that Health Order N.º 0312-2025 had not been complied with and recommended again requiring the regulated party to comply with the health provisions in force. (see folios 0657 to 0562). • 05 February 2026: Technical Report CARTA-MS-DRRSCE-DARST-IT-0137-2026 provided a documentary review of the opinions forwarded by the regional level in response to the inquiry submitted by this Health Governing Area regarding the filing made by Mr. Nombre01 on 08 December 2025. The analysis determined that, in accordance with the regional technical opinion contained in official letter CARTA-MS-DRRSCE-URS-0049-2026, this particular case called for the submission and implementation of corrective actions and/or an acoustic-containment plan because the nature of the activity conducted did not allow for the immediate suspension sought by the complainant.
It was also recorded that decision CARTA-MSDRRSCE-0067-2026 had rejected the motion for reconsideration filed against Health Order N.º 0312-2025 and that the obligation to comply with the provisions ordered by this Health Authority remained in force. Finally, it was concluded that the technical and legal opinions received constituted sufficient input to respond to the questions raised by the complainant in the administrative case file. (see folios 0661 and 0662). ELEVENTH: On 11 February 2026, this Health Governing Area issued official letter CARTA-MS-DRRSCEDARST-0230-2026, which was duly served on Mr. Nombre01 on 12 February 2026 in response to his filings dated 08 December 2025 and 23 January 2026 concerning enforcement of Health Order N.° 0312-2025 and follow-up on health complaint N.° 0099-2023. That official letter responded to the complainant’s questions and requests, informing him of the actions taken by this Health Authority, the results of the technical assessments performed, the specialized opinions issued by the competent bodies, and the status of the matters referred to the Regional Level for analysis.
He was also informed that, in accordance with the technical and legal opinions obtained, this particular case called for the regulated party to implement corrective actions and noise-mitigation measures and for compliance with those actions and measures to be verified; Health Order N.° 0312-2025 remained in force, and this Health Authority would continue the follow-up work necessary to verify compliance. (see folios 0672 to 0674). TWELFTH. On 13 February 2026, this Health Governing Area received documentation submitted by Mr. Nombre03, legal representative of the establishment known as Grit Box, providing a proposed acoustic-mitigation plan in response to the requirements imposed by this Health Authority through Health Order N.º 0312-2025. The documentation was submitted to describe the actions and measures that the establishment would implement to reduce the noise levels generated by its activities and comply with the health provisions issued in the administrative case file concerning health complaint N.º 0099-2023.
That documentation was added to the administrative case file for review and technical assessment by this Health Authority to determine whether the proposed measures were sufficient to comply with Health Order N.º 0312-2025. Subsequently, through Technical Report CARTA-MS-DRRSCE-DARST-IT-0180-2026 dated 19 February 2026, this Health Governing Area conducted a technical assessment of the documentation submitted and a follow-up inspection of the establishment. That analysis determined that the regulated party had implemented certain measures aimed at reducing noise disturbances, including placing foam padding to absorb the impact of dropped weights and lowering the volume of the music used during the activity. It was also concluded that the document submitted constituted a preliminary acoustic-mitigation proposal; however, it did not comprehensively address the requirements established for a noise-containment plan under Article 23 of the Reglamento para el Control del Ruido Ambiental because, among other matters, it did not include a detailed implementation schedule or all the technical calculations required to estimate the projected sound attenuation.
It was further recommended that specialized support be requested from the Regional Level for technical review of the proposal submitted, given the technical and legal complexity of the case. (see folios 0696 to 0700). In response to the conclusions and recommendations contained in Technical Report CARTA-MS-DRRSCE-DARST-IT-0180-2026, through official letter CARTA-MS-DRRSCEDARST-0295-2026 dated 20 February 2026, this Health Governing Area forwarded the plan submitted by the regulated party, together with the technical assessment report prepared by this Health Authority, to the Dirección Regional Central Este, requesting a specialized technical opinion concerning the sufficiency and suitability of the proposed measures to ensure compliance with the maximum permissible limits established in the Reglamento para el Control del Ruido Ambiental. This was done because of the technical complexity of the case and the need for a specialized assessment that would adequately support subsequent administrative action in the case file.
That official letter also noted that the plan had been submitted after the period granted in Health Order N.º 0312-2025 and that the preliminary analysis had identified various technical matters requiring further assessment. (see folios 0701 to 0702). THIRTEENTH. During March 2026, follow-up actions continued concerning compliance with Health Order N.º 0312-2025 and the handling of health complaint N.º 0099-2023. • On 03 March 2026, this Health Governing Area received notice of Ministerial Decision N.° RM-MS-DM-YA-0882-2026, through which the Ministerial Office decided the appeal filed by Mr. Nombre03, legal representative of the establishment known as Grit Box, against Health Order N.º 0312-2025. That decision analyzed the arguments and evidence submitted by the challenging party and concluded that the actions taken by this Health Authority complied with the regulations in force, that the technical evidence added to the case file was valid and sufficient to support the measures ordered, and that Health Order N.º 0312-2025 had been issued in accordance with law.
Accordingly, the Ministerial Office denied the appeal, and the Health Order issued in connection with health complaint N.º 0099-2023 remained in force. (see folios 0718 to 0725). • On 06 March 2026, this Health Governing Area conducted a follow-up inspection at the establishment known as Grit Box, as requested by the Ministerial Office through Decision N.º RM-MS-DM-YA-0882-2026, to verify the status of compliance with Health Order N.º 0312-2025. Technical Report CARTA-MS-DRRSCE-DARST-IT-0258-2026 dated 10 March 2026 was issued as a result of that action. During the inspection, it was established that the establishment had implemented and maintained various measures aimed at reducing disturbances associated with the noise generated by its activities, including installing thicker rubber flooring in the training areas, using foam padding to absorb the impact of dropped weights, and reducing the volume of the sound equipment used within the establishment.
It was also verified that the regulated party had submitted documentation concerning a proposed acoustic-containment plan, which had previously been forwarded to the Regional Level for specialized technical assessment. Nevertheless, at the time of the inspection, the regional technical assessment of that proposal had not yet been entered in the administrative case file. That opinion was necessary to determine the degree of compliance with the provisions of Health Order N.º 0312-2025 and define subsequent administrative action; accordingly, it was recommended that the Regional Level be contacted regarding the status of its review of the documentation submitted by the regulated party. (see folios 0727 to 0730). • On 10 March 2026, Mr. Nombre01 filed a new follow-up submission concerning health complaint N.º 0099-2023, requesting information on the current status of the case file and the actions taken by this Health Authority.
In response, through official letter CARTA-MS-DRRSCE-DARST-0406-2026 of that same date, this Health Governing Area formally responded to the complainant, informing him of the follow-up actions taken, the inspections conducted, the measures implemented by the regulated party, the status of the Regional Level’s review of the acoustic-containment plan, and the administrative actions that remained pending for the comprehensive assessment of the case and determination of the corresponding health measures. (see folios 0733 to 0737). FOURTEENTH. On 13 March 2026, this Health Governing Area received official letter CARTA-MS-DRRSCEURS-0101-2026, issued by the Unidad de Rectoría de la Salud of the Dirección Regional Central Este in response to the technical inquiry submitted through official letter CARTA-MSDRRSCE-DARST-0295-2026 concerning the assessment of the acoustic-mitigation plan submitted by the establishment known as Grit Box.
Therefore, this esteemed authority is hereby informed that, once the Área Rectora de Salud de Turrialba receives and evaluates the results of the analysis of the noise-containment plan—submitted by the Great Box gym to the Regional Level—this Health Authority will immediately notify both the amparo applicant and the Constitutional Chamber (Sala Constitucional) of the results obtained, in order to guarantee due process and the effective protection of the fundamental rights invoked.” By virtue of the foregoing and the evidence entered into the record, it follows that the respondent authority reported multiple follow-up actions, as well as the receipt, formal review, and referral to the Dirección Regional Central Este of an acoustic-confinement plan submitted by the establishment against which the complaint was filed.
However, the report dated 2 June 2026 itself indicated that the outcome of the regional technical assessment was pending and that, once received and evaluated, the results would be brought to the attention of the amparo applicant and this Chamber.
Moreover, the record does not contain a final decision concerning health complaint no. 0099-2023, or evidence that such a decision was served on the complainant within the period granted following service of the judgment.
Finally, it should be noted that the documented preparatory, follow-up, and technical-assessment actions do not constitute the specific action ordered, namely, issuing a final decision on the complaint and communicating the corresponding determination.
Accordingly, although the authorities of the respondent hospital have taken steps intended to comply with the order in judgment no. 2026012204, the fact remains that the order has not yet been fully complied with.
Accordingly, the proper course is to reiterate to the respondent authorities that they must comply with the provisions ordered by this Chamber in judgment no. 2026012204, issued at 9:20 a.m. on 10 April 2026.
III.Documents submitted to the case file. The parties are hereby advised that, if they submitted any paper document, as well as any objects or evidence contained on any additional electronic, computer, magnetic, optical, or telematic device, or any device produced through new technologies, they must retrieve them from the court office within a maximum period of 30 business days following service of this judgment. Otherwise, any material not retrieved within that period shall be destroyed, pursuant to the “Reglamento sobre Expediente Electrónico ante el Poder Judicial,” approved by the Corte Plena at session no. 27-11 of 22 August 2011, Article XXVI, and published in Boletín Judicial no. 19 of 26 January 2012, as well as the resolution approved by the Consejo Superior del Poder Judicial at session no. 43-12, held on 3 May 2012, Article LXXXI.
Therefore:
The motion alleging disobedience is granted. Compliance with the provisions ordered by this Chamber in judgment no. 2026012204, issued at 9:20 a.m. on 10 April 2026, is withdrawn from Luis Fernando Gómez Cordero, in his capacity as acting director of the Área Rectora de Salud de Turrialba, or from whoever holds that position in his stead, insofar as the complaint filed by the amparo applicant in June 2023 must be finally decided, the corresponding determination communicated, and the complainant notified of the decision. The foregoing is subject to the warning that, should disobedience be established, the commencement of an administrative proceeding may be ordered against the official who fails to comply with this Chamber’s ruling, and certified copies of the relevant portions of the record may also be transmitted to the Ministerio Público regarding the possible commission of the offense of disobedience (Articles 53 and 71 of the Ley de la Jurisdicción Constitucional). Luis Fernando Gómez Cordero, in his capacity as acting director of the Área Rectora de Salud de Turrialba, or whoever holds that position in his stead, shall be personally served.
