SummaryResumen
The Constitutional Chamber (Sala Constitucional) denied the amparo application against the Ministerio de Salud concerning its alleged failure to respond effectively to complaints about wastewater seepage and discharges from an adjoining property. Although the 2022 administrative file documented no follow-up after the 2023 sanitary order, the Administration resumed its examination after a new complaint was filed in February 2026. Inspections and fluorescein tests conducted in August 2026 confirmed that domestic wastewater was passing through the dividing wall and discharging into a roadside drain. Before the Ministry was notified of the amparo proceeding, it had prepared a technical report, informed the applicant, and issued a new sanitary order prescribing corrective measures and allowing sixty working days for compliance, through 17 November 2026. The Chamber concluded that the Ministry had investigated the reported conditions and exercised its sanitary-enforcement powers; therefore, no current refusal, arbitrary omission, or constitutionally actionable administrative inaction had been established.
Key excerptExtracto clave
Nor can it be found, under the present circumstances, that the Ministerio de Salud committed an omission by not yet having secured the physical correction of the reported discharges. The Administration had already exercised its sanitary-enforcement powers by issuing a specific order to the responsible private party, and the compliance period remained open when the amparo application was filed and initially processed. It would therefore be unreasonable to attribute constitutionally actionable inaction to the respondent authority when it had investigated the facts, technically established an irregularity, imposed the corresponding corrective measures, and granted the responsible party the prescribed administrative period in which to carry them out. Only after that period expired and the existing conditions were verified could it be determined, where appropriate, whether noncompliance had occurred and justified further administrative measures. Accordingly, the established actions as a whole do not disclose a current violation of the applicant’s fundamental rights attributable to the Ministerio de Salud. On the contrary, the evidence shows that the sanitary authority addressed the complaints, performed the pertinent inspections and technical tests, determined the nature of the impact, prepared the corresponding technical report, issued a sanitary order containing specific measures, and informed the interested party of the actions taken. In all material respects, this occurred before notice was given of the order admitting this amparo proceeding. Consequently, because no omission or arbitrary conduct by the respondent authority susceptible to protection through this constitutional proceeding was established, the application must be denied.

Document Review Case: 26-030919-0007-CO Decision No. 2026035885 CONSTITUTIONAL CHAMBER (SALA CONSTITUCIONAL) OF THE SUPREME COURT OF JUSTICE. San José, at 9:35 a.m. on 17 September 2026.
Amparo proceeding processed under case No. 26-030919-0007-CO, filed by Nombre02, identity card CED01, against the MINISTERIO DE SALUD.
Background:
Justice Hess Herrera drafts the decision; and, Reasons:
The matter raised could constitute a violation of the right to prompt and effective administrative justice. In this regard, it must be clarified that, beginning with Voto 2008-02545 issued at 8:55 a.m. on 22 February 2008, this Chamber has referred to the administrative-litigation jurisdiction (jurisdicción contencioso-administrativa), with certain exceptions, matters involving disputes over whether the public administration complied with the time limits established by the Ley General de la Administración Pública (Articles 261 and 325) or by sector-specific laws governing special administrative proceedings, either to conclude an administrative proceeding by a final decision—whether initiated ex officio or at a party’s request—or to decide the applicable administrative challenges. This case presents precisely such an exception because it concerns an alleged failure to address complaints involving apparent sewage and wastewater problems affecting the person whose rights are protected by the amparo. With that point clarified, the Chamber proceeds to decide the specific situation raised in this amparo.
The applicant files an amparo proceeding against the Ministerio de Salud, alleging that, despite the complaints filed since 2022 concerning sewage and wastewater seepage from an adjoining property, the problem persists without a definitive solution. She states that this affects the health of her family and tenants, has caused financial losses, and demonstrates insufficient action by the Área Rectora de Salud de San Ramón. She requests that the application be granted and that effective measures be adopted to eliminate the reported contamination.
The following facts are considered duly established and relevant to the decision in this matter, either because they have been proven or because the respondent failed to address them as directed in the initial order:
Based on its analysis of the established facts, the report submitted under oath, and the evidence included in the file, this Court considers that the application must be denied.
In the present matter, the amparo applicant criticizes the Ministry of Health (Ministerio de Salud) for an alleged failure to take effective action regarding seepage and wastewater discharges originating from the adjoining property, despite the administrative complaints filed for that purpose. Nevertheless, the evidentiary record supports the conclusion that, by the time the respondent authority was notified of the order admitting this amparo proceeding for processing, it had already taken specific actions aimed at investigating the reported situation and adopting the corresponding public-health measures.
Indeed, the record shows that, in connection with complaint D-SR-023-2026, Ministry of Health officials conducted inspections on 06, 07 and 11 August 2026. During these proceedings, technical tests using fluorescein were performed to determine the source of the seepage. Although no connection could initially be established between the septic system of the reported property and the alleged harm, the health authority continued its investigation after observing a constant flow of water through the adjoining wall. Finally, on 11 August 2026, a new test made it possible to establish technically that sewage was flowing from the reported property and being discharged into a roadside drain located on the public roadway.
As a result of those actions, technical report IT-MS-DRRSCO-DARS-SR-RS-2576-2026 was prepared, documenting the findings and setting forth the corresponding public-health recommendations. That report was served on the amparo applicant, Nombre02, on 17 August 2026, meaning that, even before this constitutional proceeding was admitted for processing, the interested party had already been formally informed of the results of the investigation conducted by the Administration.
Furthermore, based on the technical findings, the Ministry of Health issued Health Order MS-DRRSCO-DARS-SR-RS-OS-2577-2026, ordering the person responsible for the property to adopt a series of measures intended to correct the deficiencies identified, including the construction of an adequate sewage-treatment system, the installation of drainage works and a grease-trap inspection box, the separation of stormwater and wastewater systems, and the correction of the discharge into the roadside drain located on the public roadway. That order was served on the obligated party on 21 August 2026, granting him sixty working days to comply, with the period expiring on 17 November 2026.
It is therefore clear that the substantive actions sought by the amparo applicant—namely, inspection of the site, technical determination of the source of the wastewater, and adoption of administrative measures aimed at correcting the reported situation—had been carried out before the Ministry of Health was notified of the order admitting this amparo for processing, which occurred on 02 September 2026. Consequently, no causal relationship can be established between the filing or processing of this proceeding and the administrative action taken, because the inspections, technical tests, report, and health order had previously been conducted or issued.
It is true that on 02 September 2026, the date on which the respondent authority was notified of the order admitting the proceeding for processing, letter MS-DRRSCO-DARS-SR-2778-2026 was also sent to the amparo applicant, once again informing her of the results of the investigation and advising her that a health order had been issued to the owner of the reported property. That temporal coincidence, however, does not support the conclusion that the communication was prompted by the intervention of this Chamber. By that time, the substantive aspects of the administrative investigation had already been completed, the technical report had been prepared and communicated to the amparo applicant on 17 August, and the health order had been issued and served on the obligated party on 21 August 2026. The communication of 02 September was therefore an informational action concerning administrative decisions adopted previously, rather than satisfaction of the relief sought as a result of the present amparo proceeding.
Nor can it be found, under the current circumstances, that the Ministry of Health has failed to act because it has not yet secured the physical correction of the reported discharges. The Administration had already exercised its public-health enforcement powers by issuing a specific order directed to the responsible private party, whose compliance period remained in effect when the amparo was filed and during its initial processing. It would therefore be unreasonable to attribute constitutionally objectionable inaction to the respondent authority when it had investigated the facts, technically determined the existence of an irregularity, imposed the corresponding corrective measures, and granted the obligated party the prescribed administrative period in which to carry them out. Only after that period has expired and the existing conditions have been verified could it be determined, if appropriate, whether noncompliance occurred that would justify the adoption of additional administrative measures.
Regarding the background related to complaint D-SR-349-2022, although the case file shows that no follow-up after Health Order OS-SR-11-2023 was documented, it also establishes that the amparo applicant filed a new complaint in February 2026 and that, in connection with that complaint, the Administration resumed its examination of the matter, conducted new inspections and technical tests, and determined that the situation existing in 2026 involved deficiencies related to sewage disposal, in response to which it issued a new health order. Accordingly, as of the date relevant to deciding this proceeding, there is no indication of a current refusal by the respondent authority to exercise its powers or of inaction regarding the public-health issue raised.
Accordingly, the actions established in the record do not disclose a current violation of the amparo applicant’s fundamental rights attributable to the Ministry of Health. On the contrary, the evidence shows that the health authority addressed the complaints, conducted the relevant inspections and technical tests, determined the nature of the harm, issued the corresponding technical report, entered a health order containing specific measures, and informed the interested party of the actions taken. In all substantive respects, this occurred before notification of the order admitting this amparo proceeding for processing.
Consequently, because no omission or arbitrary conduct by the respondent authority amenable to protection through this constitutional proceeding has been established, the amparo must be denied.
I have supported this Court’s position that, when a litigant alleges a violation of the right to prompt and effective justice in administrative proceedings, the Administrative-Litigation Courts, rather than this Chamber, must hear the legal dispute. However, the recent enactment of Ley n.° 9097, Ley de Regulación del Derecho de Petición, established that this right is eligible for judicial protection through the amparo proceeding provided for in Article 32 of the Ley de la Jurisdicción Constitucional, in relation to Article 27 of the Constitución Política de la República de Costa Rica, in those cases in which the petitioner considers that the Administration’s material actions, administrative acts, or response are affecting the petitioner’s fundamental rights. In my view, the recently enacted legislation does not require this Court to modify its line of precedent, because under Article 7 of its Law, this Court has exclusive authority to define its own jurisdiction.
Accordingly, except for those legal-constitutional disputes that this Chamber itself has recognized as exceptional circumstances that may properly be heard within this jurisdiction through the constitutional guarantee afforded by the amparo proceeding, in all other cases, and for the reasons given by this Court (judgment N° 2008-02545 at 8:55 on 22 February 2008), jurisdiction lies with the judges of the administrative-litigation jurisdiction. All of this is consistent with Article 25 of the Convención Americana sobre Derechos Humanos, the Law of the Constitution—its values, principles, and rules—and the corresponding statutory provisions, based on a logical, systemic, and purposive interpretation of the legal system.
I consider that, in environmental matters, if the Public Administration has already intervened, the administrative-litigation jurisdiction is responsible for hearing and deciding the matter. Nevertheless, I do address the merits when other rights of persons affected by the source of pollution are at stake, including health, quality of life, and the right to enjoy a healthy environment free of pollution (Article 50 of the Constitución Política), as occurs in this case, in which the complaint alleges the Ministry of Health’s apparent failure to issue a decision addressing complaints concerning seepage and wastewater discharge on the property adjoining the applicant’s home, thereby affecting the applicant’s right to enjoy a healthy, ecologically balanced environment and a dignified quality of life.
The amparo applicant is advised that, if she submitted any paper document, as well as any objects or evidence contained on any additional electronic, computer, magnetic, optical, or telematic device or produced using new technologies, she must retrieve them from the court office within a maximum period of 30 working days from service of this judgment. Otherwise, all material not retrieved within that period will be destroyed, pursuant to the “Reglamento sobre Expediente Electrónico ante el Poder Judicial,” approved by the Corte Plena at session No. 27-11 of 22 August 2011, Article XXVI, and published in the Boletín Judicial No. 19 of 26 January 2012, as well as the agreement approved by the Consejo Superior del Poder Judicial at session No. 43-12, held on 3 May 2012, Article LXXXI.

Considerando:
