SummaryResumen

The Constitutional Chamber (Sala Constitucional) denied the amparo application filed against the Monte Romo ASADA for failing to grant potable-water availability to property in the Las Mercedes sector. The majority found that the ASADA had informed the applicant that there was no technical certainty regarding system capacity and that insufficient water resources prevented approval of new services. It reiterated that public or private water-service providers may deny or condition applications when technical or legal impossibilities or objective criteria justify doing so, provided the decision is not arbitrary. Determining whether the requested service should be granted and adjudicating disputes over the technical studies fell outside the scope of amparo and could be pursued before the ASADA or through the competent jurisdiction. Justices Cruz Castro and Rueda Leal dissented: they would have continued the proceeding and requested a report from Aresep to determine whether service providers bore responsibility for the current capacity of the water systems.

Key excerptExtracto clave

Under these circumstances, the respondent ASADA denied the protected party’s request and fully informed her of the technical reasons why it could not be granted, namely, that there is no technical certainty regarding the system’s capacity. Whether the requested service should be granted is not a matter to be adjudicated in this jurisdiction because it falls outside its scope of competence; moreover, this Court has repeatedly held that applications for potable-water service may be denied when technical impossibilities, failure to satisfy requirements established below the constitutional level, or supporting technical or legal criteria exist. This Chamber must not act as an intermediary before a particular natural or legal person—whether the latter is governed by public or private law—to intercede on behalf of a third person so that the amparo applicants obtain what they seek, as the applicant requests here. She must therefore raise her objections or claims before the respondent or through the competent jurisdiction, where she may fully litigate the merits and assert her claims. Consequently, in view of the foregoing considerations, the application must be denied, as is hereby ordered. The application is denied. Justices Cruz Castro and Rueda Leal dissent and would order the proceeding to continue so that a report may be requested from the regulator general of the Autoridad Reguladora de los Servicios Públicos.

Amparo proceeding filed by Nombre01, identity card CED01, against the ASOCIACIÓN ADMINISTRADORA DEL ACUEDUCTO Y ALCANTARILLADO SANITARIO DE MONTE ROMO DE HOJANCHA, GUANACASTE.

Background:

  1. 1By a filing submitted to the Office of the Clerk of this Chamber at 16:236 hours on 27 August 2026, the amparo applicant filed an amparo proceeding against the ASOCIACIÓN ADMINISTRADORA DEL ACUEDUCTO Y ALCANTARILLADO SANITARIO DE MONTE ROMO DE HOJANCHA, GUANACASTE. She states that on 22 April 2024 she first sent an email to the account ...02, through which she requested water-service availability from ASADA Monte Romo. She notes that on 16 June 2024 she was informed that her request had been denied because “...currently no new services are being provided in the community of Las Mercedes; work is underway to resolve the situation as soon as possible.” She explains that on 13 August 2024 she requested by email that the respondent authority provide the technical reasons for denying service and, when no response was received, on 26 August 2024 she sent another email to ASADA Monte Romo. She states that, on 2 September 2024, the respondent informed her that its email account had changed to ...03.She adds that, in response to her request, she was offered an in-person meeting at the ASADA Monte Romo office so that the technical reasons for denying potable-water availability could be provided to her. However, she clarified that she could not attend a meeting because of where she lived and therefore requested that the information be provided in writing through her personal email. She complains that, after receiving no response whatsoever to her request, on 21 October 2024 she sent another email to ASADA Monte Romo’s new address, noting the lack of a response both to her email and to her request for the required technical reasons. She reports that, on 24 October 2024, the respondent institution told her: “at present we cannot provide a technical response regarding the denial of water availability because the ASADA is conducting a technical study; this process takes several months due to the analyses involved ….” She recounts that on 12 November 2024 a representative of ASADA Monte Romo contacted her by telephone to inform her that service availability could possibly be provided within six months.Nevertheless, she alleges that almost ten months elapsed without any communication concerning her request, which is why on 11 September 2025 she sent a new email to ASADA Monte Romo in which she again explained her situation and requested: “a) that, based on Article 18 of the Technical Regulation ‘Provision of aqueduct, sanitary-sewer, and fire-hydrant services,’ which sets forth the reasons preventing the provision of services and the actions to be taken in such cases, they assist me by providing the technical assessment supporting the denial of the service request, as specified in subsection g) of that article (I copied for them what the article states); b) a copy of the minutes of the last 4 Board meetings so that I may learn about matters concerning new services; and c) Additionally, it is noted that, pursuant to Article 18 of the aforementioned regulation, once service has been denied there is a maximum period of 2 years to provide it; therefore, since 1 year and 3 months have already elapsed since that event, they are requested to inform me of the current status of the request.” She explains that on 18 December 2025, because no response had been given to the requests in the preceding email, she referred the case to the Oficina Regional de Acueductos Comunales (ORAC) for the Chorotega Region of ICAA, in order to obtain guidance on how to proceed in light of ASADA Monte Romo de Hojancha Guanacaste’s lack of attention and clear response. She explains that, on 6 January 2026, ORAC for the Chorotega Region replied: “We have already been in discussions with the ASADA, and they will provide us with the respective information. According to what they told me, the work is underway and the situation will be resolved soon.” Likewise, on 7 January 2026, that office sent her another email stating: “Indeed, the ASADA sent us the progress it has made on improving the pipeline; it is very likely that the situation can be resolved soon.” She states that on 19 January 2026 she sent an additional email to ASADA Monte Romo, attaching the chain of emails with ORAC for the Chorotega Region and again requesting water availability. In this regard, on 20 January 2026, the ASADA replied: “we are already working in that sector so that we can provide availability; as soon as everything is ready, we will inform you so that you can complete the corresponding procedure.” She asserts that on 26 February 2026 she sent another email to ASADA Monte Romo to follow up and ask about the estimated time for availability. She states that, because no response was given to that inquiry, on 24 March 2026 she requested information by email about the progress made and stated that she had learned of the notice convening a meeting to address availability matters. She adds that she requested the minutes of the meeting and asked to be told whether or not availability would be provided to her. On that same day, the ASADA informed her that “the Las Mercedes sector has a particular issue, namely that it does not have enough water to provide new availability; efforts have been was (sic) made to negotiate with owners of springs (nacientes) to train (sic) new sources and thus be able to provide availability (…) please be a little patient; we know that the request dates back more than two years, but this is not something to which the ASADA can provide an immediate response, because it depends not only on us but also on outside persons.” Additionally, with respect to the requested minutes, she was told, “...we can provide these only to members, and you are not listed as one,” which she considers incorrect under Article 67 of the new Reglamento de ASADAS.She states that on 26 March 2026 she sent another email to ASADA Monte Romo in which she requested availability, as well as a formal note or letter establishing whether the potable-water service would or would not be granted, supported by technical grounds. She complains that, as of the date on which this proceeding was filed, she had received no response whatsoever concerning the technical support for the denial, nor any clear response concerning progress and time frames. She considers that the foregoing violates her fundamental rights. She requests that the application be granted.
  2. 2By decision issued at 09:44 hours on 01 September 2026, this amparo proceeding was admitted for processing and notice was served on Nombre02, in his capacity as president and as judicial and extrajudicial representative with an unlimited general power of attorney of the Asociación Administradora del Acueducto y Alcantarillado Sanitario (ASADA) de Monte Romo de Hojancha, Guanacaste (see electronic record).
  3. 3Nombre02, in his capacity as Legal Representative of Asada Monte Romo, responded to the hearing (see electronic record) in the following terms: “I. ADMISSIBILITY AND OFFER OF EVIDENCE. Any facts not expressly accepted in this filing are denied. Pursuant to Article 6 of the Ley de la Jurisdicción Constitucional, this representation denies the facts and law invoked by the amparo applicant insofar as they are not expressly acknowledged. It is requested that the following documents be admitted into evidence: 1. Exhibit A: Diagram of the ASADA Monte Romo aqueduct system, showing the location of the water sources, the pipeline network, and the Las Mercedes sector. 2. Exhibit B: Photographic record of the improvements made to the aqueduct system, including: a. Installation of new distribution pipelines. b. Installation of fire hydrants for community safety. c. Records of flow measurements (aforos) at newly identified springs. 3.Exhibit C: Copies of the emails demonstrating the follow-up and communications with the amparo applicant and ORACCH. 4. Exhibit D: Report of the Contraloría General de la República No. DFOE-AE-IF-07-2013, which demonstrates the historical weaknesses in AyA’s governing role over community operators and the need for a policy to organize the sector. 5. Exhibit E: Política de Organización y Fortalecimiento de la Gestión Comunitaria de los Servicios de Agua Potable y Saneamiento, which establishes the guidelines for integrating ASADAS in compliance with the mandate of the Contraloría. 6. Exhibit F: Case law of the Constitutional Chamber establishing the criteria governing access to information held by ASADAS, specifically: a. Voto N° 2023025223 issued at 09:27 hours on 06 October 2023, Case 23-021394-0007-CO, which establishes that information related to the internal management of ASADAS (assembly minutes, Board of Directors minutes, reports from the president, treasurer, and fiscal officer, etc.) is connected to the right of association and that only members or subscribers are entitled to it. b. Voto N° 2023015629 issued at 09:20 hours on 30 June 2023, Case 23-009508-0007-CO, which establishes that, for a nonmember to request information from an ASADA, that person must demonstrate a legitimate interest associated with the provision of the public service, and that a merely commercial or personal interest does not qualify as such. c. Voto N° 2024004719 issued at 09:20 hours on 23 February 2024, Case 24-000159-0007-CO, which establishes that determining whether a person is a member or subscriber of an ASADA falls outside the Chamber’s jurisdiction and that a person who is neither lacks a legitimate interest in requesting information.II. FACTS: TRUE, FALSE, PARTIALLY TRUE. FIRST: On 22 April 2024, I sent ASADA Monte Romo an email for the first time at the address ...02 requesting water availability and attaching the requirements: a duly signed formal request letter containing the property information, a copy of the cadastral plan, and municipal approval. (See Exhibit1) R/True: It is true that the amparo applicant submitted the formal request on that date. Second: On 16 June 2024 (almost 2 months later), I received an email response from ASADA Monte Romo denying availability because ‘...currently no new services are being provided in the community of Las Mercedes; work is underway to resolve the situation as soon as possible’ (verbatim quotation from email of 16 June 2026), without stating the technical or other reasons for that decision. (See Exhibit2) R/Partially true: It is true that the ASADA issued a response denying the availability request. However, the amparo applicant omits the fact that, in that same communication, she was already informed that the reason for the denial was that the ASADA was working to resolve the water shortage in the Las Mercedes sector, a publicly known and technically verified problem. Although the response did not contain exhaustive technical details, it did state the fundamental cause: insufficient water resources in the sector, which constituted a valid and sufficient justification at that stage of the procedure, as recognized by Article 18 of the Aresep Technical Regulation, subsection g) of which establishes as a ground for denying new services: ‘When it is not technically feasible to provide the service.’ Third: On 27 June 2024, in order to learn the justification for the denial, I contacted AyA through the address ...01 and requested that information. On 28 June 2024, I received a response referring the case to the Oficina de Acueductos Comunales de la Región Chorotega (ORACCH) for follow-up there, and they suggested that I ‘...submit the request directly to the operator. This is pursuant to Article 100 of the Reglamento de ASADAS’ (verbatim quotation from the email of 28 June 2026), and they provided me with ASADA Monte Romo’s registered official contact information for follow-up. (See Exhibit3) R/Partially true: It is true that the amparo applicant contacted ORACCH and that it instructed her to submit her request directly to the operator (ASADA), as established by Article 100 of the Reglamento de ASADAS. Fourth: On 13 August 2024, following ORACCH’s instructions, I requested by email, for the first time, that ASADA Monte Romo provide the technical reasons for denying the service, and I explained that my request was supported by Article 18 of the Technical Regulation ‘Provision of aqueduct, sanitary-sewer, and fire-hydrant services.’ (See Exhibit4) R/True: It is true that the amparo applicant requested the technical reasons. Although there were delays, the respondent has answered all of the amparo applicant’s requests with information concerning the status of the matter and the efforts being made. Fifth: Because the ASADA did not respond to the email of 13 August, on 26 August 2024 I again sent the ASADA an email requesting confirmation of receipt and the appropriate response. (See Exhibit5) R/True: The amparo applicant exercised her right of petition. Sixth: It was not until 2 September 2024 (19 days later) that I received a response from ASADA Monte Romo stating that its email account had been changed to ...03 and that ‘for that reason this email is not checked as frequently’ (referring to the new email address (...02)); in response to my request for the technical reasons supporting the denial, they asked me to attend an in-person meeting at the ASADA Monte Romo office so that they could explain them to me. On that same date, I replied that, because of the location of my home and workplace, it was impossible for me to attend an in-person meeting, and I requested that the response be sent in writing through the personal email account by which we were communicating, so that the communication would be clearer and more objective. (See Exhibit6) R/Partially true: It is true that notice was given of the change in email address and that an in-person meeting was offered to provide a more detailed explanation. The ASADA acted in good faith by offering a direct channel of communication to clarify the technical aspects of the situation, which demonstrates its willingness to engage in dialogue. Seventh: After 1 month and 19 days had elapsed without a response from ASASA Monte Romo, on 21 October 2024 I again sent an email to the ASADA (at the new email address ...02), noting the lack of a response both to the email and to the request for technical reasons made in the email sent to them on 13 August 2024, and informing them that, if I did not receive a response, I might refer the case to a higher authority. (See Exhibit7) R/True: The amparo applicant reiterated her request. Eighth: On 24 October 2024, I received an email response from ASADA Monte Romo stating (quoted verbatim) ...‘at present we cannot provide a technical response regarding the denial of water availability because the ASADA is conducting a technical study; this process takes several months due to the analyses involved’.... (See Exhibit8) R/It is true. In this communication, the ASADA clearly and transparently explained the core reason for the denial: it was conducting a technical study that included flow measurements during the critical season (summer) and the commencement of negotiations with the owners of properties where the springs are located, in order to determine the springs’ actual capacity. This is not an excuse, but rather a technical and legal obligation with which the ASADA must comply before granting new availability, so as not to endanger service to current users, as required by Articles 9 of the RPSAyA and 9 of the Reglamento de Aresep. Ninth: On 12 November 2024, I was contacted by telephone by Mr. Nombre02, the ASADA’s representative, who made a telephone call in which we were asked to wait six months because they might then have what was necessary to provide the service. In view of that request, we took him at his word and decided to wait, even longer than that period. (See Exhibit9) R/True: It is true. During this call, the ASADA representative requested a period of six months to conduct the necessary studies and arrangements. This demonstrates the ASADA’s proactive willingness to resolve the situation. Tenth: After almost 10 months had elapsed since Mr. Nombre02’s telephone call (12 November 2024), and in the absence of any communication from ASADA Monte Romo concerning the matter at issue, on 11 September 2025 I again sent an email to ASADA Monte Romo referring to the time elapsed since ASADA Monte Romo denied the water-availability request (16 June 2024, that is, 1 year and almost 3 months) and the time elapsed since the communication with Mr. Nombre0 requesting 6 months to make the adjustments required by ASADA Monte Romo, and again requesting:a) that, based on Article 18 of the Technical Regulation ‘Provision of aqueduct, sanitary-sewer, and fire-hydrant services,’ which sets forth the reasons preventing the provision of services and the actions to be taken in such cases, they assist me by providing the technical assessment supporting the denial of the service request, as specified in subsection g) of that article (I copied for them what the article states);b) a copy of the minutes of the last 4 Board meetings so that I may learn about matters concerning new services; andc) Additionally, it is noted that, pursuant to Article 18 of the aforementioned regulation, once service has been denied there is a maximum period of 2 years to provide it; therefore, since 1 year and 3 months have already elapsed since that event, they are requested to inform me of the current status of the request. (See Exhibit10) R/True: It is true. Once the period had elapsed, the amparo applicant again requested information, as was her right. Eleventh: On 18 December 2025: Two months after sending the email described in the preceding paragraph to ASADA Monte Romo, and because it had not responded, I referred the case to ORACH of AYA, explaining and demonstrating that I had complied with what it had instructed me to do in the previous communication of 28 June 2024 (See Fact 3), and setting out the aforementioned facts in order to request guidance on how to proceed in light of the lack of attention and a clear, reasoned response from ASADA Monte Romo de Hojancha Guanacaste. That same email was answered on 19 December with the statement, ‘We will follow up with the ASADA to review the case and have it provide the corresponding response.’ (See Exhibit11) R/True: It is true. The ASADA values and appreciates ORACCH’s intervention. Twelfth: On 6 January 2026, I received a response from ORACCH stating ...‘We have already been in discussions with the ASADA, and they will provide us with the respective information. According to what they told me, the work is underway and the situation will be resolved soon’.... Additionally, on 7 January 2026, ORACCH added in another email ...‘Indeed, the ASADA sent us the progress it has made on improving the pipeline; it is very likely that the situation can be resolved soon.’ On that same date, I replied with thanks and asked whether they knew of any time frame for obtaining the service. They replied (on that same date), ‘Yes, according to what the ASADA stated, it would be a matter of days, but it is best to communicate directly with them.’ I replied by requesting the email address through which they communicated with the ASADA, because of the difficulty I had experienced in getting it to respond to emails. They immediately provided the email address ...03. (See Exhibit12) R/True: ORACCH confirms that the ASADA informed it of the progress made. This corroborates this representation’s position: the ASADA has not failed to act or been negligent, but has instead been engaged in a continuous process of management and communication. The ASADA does not own the water, and to ensure new availability it must secure new sources from private owners, a complex process that does not depend solely on its will. Thirteenth: Thirteen days after the communication with ORACCH, on 19 January 2026, I sent an email to ASADA Monte Romo showing the chain of emails with ORACCH and again requesting water availability. I again attached the cadastral plan and municipal approval. I did so because it was supposedly a matter of days, and on 20 January 2026 I received a response from ASADA Monte Romo stating, ‘we are already working in that sector so that we can provide availability; as soon as everything is ready, we will inform you so that you can complete the corresponding procedure.’ On 26 February 2026, I sent an email to follow up and ask for the estimated time by which availability would be ready. (See Exhibit13) R/Partially true: It is true that the ASADA responded that work was underway in the sector. This response was a progress report, not a definitive promise. Fourteenth: On 24 March 2026, because no response had been given to my specific inquiry about potable-water availability made a month earlier, I again emailed the ASADA, copying ORACCH, to request information about progress. I stated that I had been waiting since 22 April 2024, when I first requested availability, and particularly that I had learned from local residents that they had been convened to a meeting to address availability matters. I assumed that there was news, so I requested the minutes of that meeting (because, to my knowledge, they are public information) and asked them to tell me whether or not we would receive availability. That same day, I received a response from the ASADA confirming the meeting of 23 March and stating that the Las Mercedes sector (quoted verbatim) ‘has a particular issue, namely that it does not have enough water to provide new availability; efforts have been was made to negotiate with owners of springs to train new sources and thus be able to provide availability....’ (now raising an issue never previously mentioned and unsupported by any technical basis). They concluded by asking me to ...‘please be a little patient; we know that the request dates back more than two years’; however, they offered the justification that ‘this is not something to which the ASADA can provide an immediate response, because it depends not only on us but also on outside persons.’ Additionally, with respect to the requested minutes, I was told, ‘...we can provide these only to members, and you are not listed as one,’ which I believe is incorrect in view of the transparency principle set forth in Article 67 of the new Reglamento de ASADAS: ‘All financial, commercial, administrative, and technical information of ASADAS, and generally all acts issued in connection with the public service they provide, is public information and must be available to all interested persons. Within the capabilities of the ASADAS, efforts shall be made to ensure that the specified information can be accessed digitally through the internet.’ (See Exhibit14) R/Partially true: It is true that the ASADA confirmed the meeting of 23 March and reported that it did not have enough water to provide new availability, thereby stating the technical reason for the denial: insufficient water resources in the Las Mercedes sector. The ASADA did not change its account, but was transparent in reporting the sector’s current reality: it is an area with a water deficit, as demonstrated by the studies and flow measurements conducted. As to the refusal to provide the meeting minutes, that refusal is based on the Constitutional Chamber’s settled position, which has established that ASADAS are private-law legal persons and that access to information in their custody must be analyzed from two perspectives: 1. Right of association: Information related to the ASADA’s internal management (assembly minutes, Board of Directors minutes, reports from the president, treasurer, and fiscal officer, membership register, etc.) is connected to the right of association (Article 25 of the Constitución Política), not the right of petition (Article 27). Only members or subscribers have the right to obtain that information, and the amparo applicant does not hold either status (see Voto N° 2023025223 issued at 09:27 hours on 06 October 2023, Case 23-021394-0007-CO, pp. 7-9; and Voto N° 2024004719 issued at 09:20 hours on 23 February 2024, Case 24-000159-0007-CO, pp. 13-18). 2. Legitimate interest: For a nonmember to request information from an ASADA, that person must demonstrate a legitimate interest associated with the provision of the public service. The amparo applicant has not established a legitimate interest because her interest is merely personal and individual (obtaining water availability for her property), rather than a public or collective interest justifying access to the ASADA’s internal minutes (see Voto N° 2023015629 issued at 09:20 hours on 30 June 2023, Case 23-009508-0007-CO, pp. 11-12). Moreover, Article 67 of the Reglamento de ASADAS cited by the amparo applicant establishes that the information must be available ‘within the capabilities of the ASADAS.’ The ASADA lacks the technical and administrative capacity to digitize and publish all minutes of its meetings, and their disclosure must be undertaken in accordance with the principles of proportionality and respect for members’ personal data. The ASADA provided substantial information consistent with the process, confirming the technical reason for the denial (insufficient water resources) and the efforts it is making to resolve the matter. Therefore, the refusal to provide the minutes is neither arbitrary nor capricious, but is consistent with constitutional case law and the applicable regulations. Fifteenth: On 26 March 2026, I sent an email to the ASADA again requesting a formal note or letter establishing that availability would be provided or, failing that, denying potable-water service as required by law, supported by technical grounds. As of this date, more than 4 months after the last email to the ASADA, I have received no response whatsoever concerning the technical support for the denial, nor any clear response from ASADA Monte Romo concerning progress or time frames. In view of this situation, I consider that my right of access to potable water has been disregarded. I have followed due process and have been patient with the time frames; nevertheless, ASADA Monte Romo has been unable to provide technical justification for denying potable-water availability. This suggests that, if it cannot demonstrate through technical studies that there is insufficient supply (flow reports, flow measurements, drought reports, or any other applicable study)—studies which, incidentally, it stated in a communication dated 24 October 2024 that it was conducting—it should provide me with potable water; otherwise, my right of access to potable water would be disregarded. R/True: It is true that the amparo applicant requested a formal note. The ASADA has repeatedly stated that availability cannot be granted because there is no technical certainty concerning the system’s capacity. A formal note is not a magical act that creates water; it must be supported by the technical studies that are still underway. III. ARGUMENTS ON THE MERITS AND THE LAW: 1. The historical context of the Las Mercedes system and the ASADA’s actions. The amparo applicant omits a fundamental fact that provides context for the entire situation: the supply system for the Las Mercedes sector was constructed and operated by a Comité Administrador de Acueducto Rural (CAAR), a form of entity that is no longer recognized under the legal system, as stated by the Contraloría General de la República in its Report No. DFOE-AE-IF-07-2013 (Exhibit D). On pages 6 et seq., that report shows that 565 operators exist under forms that are no longer recognized, including 259 CAARs, confirming the unlawful situation in which the Las Mercedes system existed. Historically, this system was abandoned, received no investment, and lacked proper maintenance, a common problem in the community-aqueduct sector, as acknowledged by the Política de ASADAS in referring to the ‘lack of maintenance and new infrastructure in community aqueducts’ (Exhibit E, pp. 19-20) and the existence of ‘numerous ASADAS exposed to contamination.’ In view of this unlawful situation and abandonment, AyA, as the governing authority and in compliance with the guidelines of the Política de ASADAS (Strategic Pillar 5: ‘Integrate or take over ASADAS’), arranged for ASADA Monte Romo to assume the administration and operation of the Las Mercedes system. The Política de ASADAS (Exhibit E, p. 60) establishes the following guideline: ‘Integrate or take over ASADAS to improve service provision,’ in response to the provisions of the Contraloría (Provision 4.3 of the Report), which ordered AyA to define criteria for integrating community operators. The ASADA did not seek to take over this system; it did so pursuant to an AyA mandate and for the community’s benefit, even though the improvements required by the system exceed its technical and financial capabilities. The ASADA acted as an instrument of the State to resolve a historical problem, not as an entity seeking to profit or evade its responsibility. AyA’s institutional support in addressing the infrastructure challenges facing the Las Mercedes system has not been significant, as acknowledged by the Política de ASADAS itself in referring to the ‘insufficiency of resources’ for AyA’s governing role and its ‘meager oversight’ of operators (Exhibit E, p. 21). 2. The right to potable water and the ASADA’s obligation. This representation recognizes and respects the human right to potable water. Nevertheless, the Constitutional Chamber has repeatedly held that this right must be guaranteed sustainably, without compromising the health of current users or their service. The ASADA has the legal and technical obligation to guarantee the quality, quantity, continuity, and reliability of service to all its subscribers, as required by Articles 9 of the RPS AyA and 6 of the Reglamento de Aresep. Granting availability without certainty concerning water capacity would be an irresponsible act that would endanger service to the entire community, contrary to the law and the public interest. 3. The technical impossibility of granting availability. Article 18 of the Aresep Technical Regulation, which repeals and replaces the former regulation, establishes in subsection g) that a ground preventing the provision of new services is: ‘When it is not technically feasible to provide the service.’ That is the ASADA’s current situation in the Las Mercedes sector. The ASADA has communicated and justified—not merely with a ‘no,’ but by reference to the reality of the studies and the lack of water capacity—that it is not yet technically feasible to grant availability. The ASADA cannot, and must not, issue an availability determination without certainty that the system can support new demand. Doing so would be negligent, would violate current users’ right to water, and would breach the principle of optimal public-service provision. 4. The nonexistent 2-year period for ‘resolving’ the situation. The amparo applicant makes a fundamental error by invoking a 2-year period within which the ASADA must provide the service. Article 18 of the Reglamento de Aresep clearly establishes: ‘Once the conditions set forth in subsection g. above have been met, the period within which the provider shall provide the services must not exceed 2 years.’ In other words, the 2-year period is not a period within which the ASADA must ‘resolve’ the problem; rather, it applies once the technical problem has been resolved and it has been determined that providing the service is technically feasible. The amparo applicant confuses the period for implementing the solution with the period for resolving the problem. In this case, the condition in subsection g) (lack of water capacity) persists, and therefore the 2-year period has not yet begun to run. 5. The impossibility of issuing a Constancia de Capacidad Hídrica (Water-Capacity Certificate). Article 39 of the RPS AyA establishes that a Water-Capacity Certificate is issued when the denial is ‘solely due to a lack of hydraulic capacity (infrastructure).’ In the amparo applicant’s case, the denial is not based solely on a lack of infrastructure, but also on a lack of water capacity (water). The ASADA has clearly stated that it does not have enough water in the Las Mercedes sector. Issuing a water-capacity certificate when no water is available would be unlawful because the essential condition of ‘actual and current water capacity,’ required by the definition in Article 21 of the RPS AyA and Article 5 of the Reglamento de Aresep (definition of water capacity), would not be met. The ASADA cannot certify a capacity it does not possess. 6. The technical progress and improvements undertaken by the ASADA. Far from failing to act, the ASADA has made concrete and tangible efforts to resolve the supply problem, as shown by the diagram of the aqueduct system attached as Exhibit A and the photographic record of the improvements submitted as Exhibit B. ● Identification of new sources: The ASADA has identified new water sources (‘as shown in the flow-measurement record’) to resolve the deficit in the Las Mercedes sector. Use of these sources is not immediate; it requires technical studies (flow measurements), such as those of which the ASADA informed the amparo applicant on 24 October 2024 (Fact 8), which are shown in the submitted photographs of the flow measurements, as well as negotiations with the landowners, a process beyond the ASADA’s control. ● Infrastructure improvements: The diagram shows a network of pipelines with different diameters (1", 1.1/2", 2", 2.1/2", 4"), and the submitted photographs document the installation of new pipelines and fire hydrants, demonstrating that the ASADA has been making improvements to the system to expand coverage and distribution capacity. The installation of fire hydrants, also documented photographically, demonstrates an investment in community safety in compliance with Article 39 of the Reglamento de Aresep. ● Technical planning: The preparation of the diagram by the responsible professionals (Engineer Marcos Espinoza López and Engineer Alejandro López Chavarría) and the execution of the photographed work demonstrate that the ASADA acts with appropriate technical and professional rigor in compliance with Article 117 of the Reglamento de Aresep, which requires all infrastructure to be designed by responsible professionals and constructed in accordance with current requirements. These actions demonstrate that the ASADA is complying with its legal obligation to guarantee optimal service provision, as required by Articles 8 and 91 of the Reglamento de Aresep, which require providers to prepare investment plans and secure resources to overcome shortages. 7. The complexity and time required by the improvements. The diagram and photographs also make it possible to see the complexity of the aqueduct system and the areas requiring expansion. Connecting the Las Mercedes sector, located at the lower left of the diagram, is not a minor undertaking. It entails expanding the distribution network and securing the supply source, which, as demonstrated, requires studies and negotiations that take time but that the ASADA is actively pursuing, as shown by the attached documentary and photographic evidence. Regulatory compliance and the sustainability of the public service cannot be subordinated to the individual urgency of an applicant, but must instead be governed by the principles of legal certainty and optimal service provision. Moreover, the Contraloría Report (Exhibit D) states that 187 community aqueducts will experience limitations in their capacity to supply communities within a 20-year period, and the Las Mercedes system is one of them. The ASADA cannot resolve in the short term a problem that the State neglected for decades. 8. Administrative silence and failure to respond in a timely and proper manner. This representation acknowledges that the response times have not been the most expeditious and that, in this regard, a judgment could be entered against the ASADA because of its delay in responding to some emails. However, this does not entail a violation of the right to potable water. The amparo applicant has received substantive responses; she has been informed of the reason for the denial, the steps the ASADA is taking, the arrangements with third parties, and the progress of the studies. Although the lack of procedural promptness is deserving of reproach, it cannot be equated with the violation of a fundamental right, particularly when the substantive reason is an unavoidable technical reality and the ASADA has demonstrated concrete and documented progress toward resolving the problem. 9. The binding nature of ORACCH’s information. ORACCH’s January 2026 communication (‘the situation will be resolved soon’) was based on the information that the ASADA provided at that time, which in turn was based on projected progress in the negotiations and studies. However, circumstances are variable and setbacks may occur. The ASADA was honest in informing the amparo applicant, in its March 2026 response, that the negotiations with the owners of the springs had not been finalized, an external cause beyond the ASADA’s control that, unfortunately, delayed the process. The photographic evidence demonstrates that, despite these setbacks, the ASADA has not stopped and continues to make progress on improving the system. IV. Relief Requested. Based on the foregoing facts and arguments, I respectfully request that the Constitutional Chamber: 1. DENY the amparo proceeding insofar as it requests that the ASADA be ordered to grant water availability immediately. A judgment to that effect would be technically unfeasible and could trigger a public-health crisis in the community by jeopardizing existing water resources. 2. Expressly clarify that any order issued by the Chamber does not mean that the ASADA must issue a positive availability determination if the technical circumstances in the area do not yet permit it. Compliance with the judgment would be limited to issuing the formal response, without prejudging the merits of the matter, which are subject to the system’s water capacity.”
  4. 4The legal requirements have been observed in the proceedings followed.

I. PRELIMINARY ISSUE

In amparo proceedings brought against private parties, before analyzing the merits of the alleged constitutional violation, it must be determined whether the case falls within any of the circumstances in which such an application may be brought and, if so, whether it is admissible. Article 57 of the Ley de la Jurisdicción Constitucional provides that an amparo proceeding may be brought against acts or omissions of private-law entities when they act or are required to act in the exercise of public functions or powers, or when they hold, as a matter of law or fact, a position of power in relation to which ordinary judicial remedies would clearly be insufficient or untimely to safeguard the fundamental rights or freedoms referred to in Article 2(a) of that Law. In this case, if the claims of the protected party are true, the respondent ASADA could be in a position of power in relation to which ordinary judicial remedies might be insufficient to protect the fundamental rights of the protected party; therefore, the application must be admitted for examination by this Court.

II. SUBJECT MATTER OF THE APPLICATION

The amparo applicant alleges that on 22 April 2024 she first sent an email to the account ...02, through which she requested water-service availability from ASADA Monte Romo. She complains that, despite the time elapsed and a series of emails sent to date, the request has not been resolved. She requests that the ASADA be ordered to provide water-service availability for her property.

III. PROVEN FACTS

The following facts are deemed duly established and relevant to the determination of this matter, either because they have been substantiated or because the respondent authority failed to address them:

  • a)On 22 April 2024, the applicant first sent an email to ASADA Monte Romo at the address ...02 requesting water-service availability (case record).
  • b)On 16 June 2024, ASADA Monte Romo sent an email to the applicant stating that “...new services are not currently being provided in the Las Mercedes community; work is under way to resolve the situation as soon as possible” (case record).
  • c)On 13 August 2024, the applicant sent an email to ASADA Monte Romo requesting the technical reasons for the denial of service (case record).
  • d)On 02 September 2024, ASADA Monte Romo sent an email to the applicant stating that its email account had been changed to ...03 and that “for that reason, this email is not checked as frequently”; in response to her request for the technical reasons supporting the denial, it asked her to attend an in-person meeting at the ASADA office (case record).
  • e)The applicant informed ASADA Monte Romo that she was unable to attend an in-person meeting and requested that the response be sent in writing—a request reiterated on 21 October 2024—(case record).
  • f)On 24 October 2024, ASADA Monte Romo sent the applicant a response by email stating as follows: “at present, we cannot provide a technical response concerning the denial of water-service availability because the ASADA is conducting a technical study; this process takes several months because of the analyses involved” (case record).
  • g)On 12 November 2024, the applicant received a telephone call from ASADA Monte Romo in which it requested six months to conduct the necessary studies and procedures (case record).
  • h)On 11 September 2025, the applicant sent an email to ASADA Monte Romo referring to the time that had elapsed since ASADA Monte Romo denied the request for water-service availability (case record).
  • i)On 18 December 2025, given ASADA Monte Romo’s failure to provide a solution, the applicant referred the case to AyA’s ORACH (case record).
  • j)On 19 January 2026, the applicant sent an email to ASADA Monte Romo showing the chain of emails exchanged with ORACCH and again requesting water-service availability—a request reiterated on 26 February 2026—(case record).
  • k)On 24 March 2026, the applicant sent an email to the ASADA, copying ORACCH, requesting information about the progress made and stating that she had been waiting since 22 April 2024, when she first requested water-service availability (case record).
  • l)Water-service availability cannot be granted because there is no technical certainty regarding the system’s capacity (case record).

IV. THE SPECIFIC CASE

The response submitted by the Legal Representative of ASADA Monte Romo, together with the evidence added to the case record, established that on 22 April 2024 the applicant first sent an email to ASADA Monte Romo at the address ...02 requesting water-service availability. It was established that on 16 June 2024 ASADA Monte Romo sent an email to the applicant stating that “...new services are not currently being provided in the Las Mercedes community; work is under way to resolve the situation as soon as possible.” Subsequently, on 13 August 2024, the applicant sent an email to ASADA Monte Romo requesting the technical reasons for the denial of service. It was stated that on 02 September 2024 ASADA Monte Romo sent an email to the applicant indicating that its email account had been changed to ...03 and that “for that reason, this email is not checked as frequently”; in response to her request for the technical reasons supporting the denial, it asked her to attend an in-person meeting at the ASADA office.

It was established that the applicant informed ASADA Monte Romo that she was unable to attend an in-person meeting and requested that the response be sent in writing—a request reiterated on 21 October 2024. It was verified that on 24 October 2024 ASADA Monte Romo sent the applicant a response by email stating as follows: “at present, we cannot provide a technical response concerning the denial of water-service availability because the ASADA is conducting a technical study; this process takes several months because of the analyses involved.” Subsequently, on 12 November 2024, the applicant received a telephone call from ASADA Monte Romo in which it requested six months to conduct the necessary studies and procedures. On 11 September 2025, the applicant sent an email to ASADA Monte Romo referring to the time that had elapsed since ASADA Monte Romo denied the request for water-service availability.

It was established that on 18 December 2025, given ASADA Monte Romo’s failure to provide a solution, the applicant referred the case to AyA’s ORACH, and that on 19 January 2026 the applicant sent an email to ASADA Monte Romo showing the chain of emails exchanged with ORACCH and again requesting water-service availability—a request reiterated on 26 February 2026. It was established that on 24 March 2026 the applicant sent an email to the ASADA, copying ORACCH, requesting information about the progress made and stating that she had been waiting since 22 April 2024, when she first requested water-service availability. Finally, it was clarified that water-service availability cannot be granted because there is no technical certainty regarding the system’s capacity. In this regard, this Court has held that AyA, water-supply and sewer-system management associations, municipalities, and other institutions that provide drinking-water service may validly deny requests for drinking-water service or impose conditions upon them when technical or legal reasons so warrant. Thus, in Judgment No. 2016-006027, issued at 09:05 on 06 May 2016, this Chamber held:

“In Judgment 2014-9134, issued at 14:05 on 19 June 2014, which addressed an issue very similar to that raised in this application, this Constitutional Court ruled: ‘(...) In repeated judgments concerning this issue, this Chamber has stated that the supply of drinking water is regarded under the Costa Rican legal system as a public service and that, as such, every public-service provider—whether a public or private entity—is required to provide the service continuously, efficiently, under conditions of equality, and in a manner adaptable to technological changes (see, in this regard, Judgment 2001-09676, issued at 11:25 on 26 September 2001, and Judgment 2004-08161, issued at 10:53 on 23 July 2004). It is therefore clear that the Instituto Costarricense de Acueductos y Alcantarillados, as one of the State entities responsible for providing the public drinking-water service, is likewise required to provide that service continuously, adaptably, efficiently, and equally to all inhabitants.

Nevertheless, the case law of this Constitutional Court has also held that, where there is a legal impediment (meaning failure to satisfy the requirements established in the applicable regulations) or a formal impediment (meaning the absence of a water distribution network), it is reasonable not to grant service requests or to require the interested party to bear the installation costs when no drinking-water distribution network exists and infrastructure must be constructed. Thus, in such cases, it has been made clear that this is not a denial of access to drinking-water service, but rather an inability to provide it or the need for the interested party to participate in removing a technical impediment, namely the lack of infrastructure. In other words, provided that the failure to supply drinking-water service is not capricious, arbitrary, or unsupported, but is justified by a legal or material impediment, there is no violation of fundamental rights.

In the specific case, the evidence submitted and the report rendered under oath confirm that AyA did not arbitrarily deny the applicant’s request, but did so because not all of the technical and legal requirements established by the Reglamento de Prestación de Servicios a los Clientes de Instituto Costarricense de Acueductos y Alcantarillados for the approval of new services had been satisfied.’” This ruling may be supplemented by Judgment No. 2017-005245, issued at 10:00 on 07 April 2017, which, insofar as relevant, held:

“The report submitted by the authorities of the respondent municipality states that the applicant’s claim as to whether the location of Ms. Nombre03’s property lies outside the water-supply area must be addressed by the Instituto Costarricense de Acueductos y Alcantarrillados, since the Municipality lacks jurisdiction over that matter. For its part, the Instituto Costarricense de Acueductos y Alcantarillados states that it has acted in accordance with its governing regulations, properly exercising its oversight function and at all times taking duly substantiated and reasoned actions, as described above. This shows that the Institute has acted in accordance with the law because, according to the technical report issued by the UEN Optimización de Sistemas Nuevos Desarrollos GAM, official letter UEN-OSND-GAM- 2017-00082, drinking-water availability does not exist for the property identified by Ms.

Nombre04 in her amparo application. The report further states that a review of the property’s history shows that it belonged to the property recorded under cadastral reference PRN01 and that, according to the National Registry, the latter was subdivided (fraccionada), resulting in four properties, without any application for water-service availability having been processed for that subdivision (fraccionamiento). Accordingly, this Chamber is unable to establish any omission or arbitrary conduct by the respondent authority. The proper course is therefore to deny the amparo and to reiterate that, according to the evidence submitted, the failure to provide drinking-water service to the applicant’s lot is not capricious, arbitrary, or unsupported conduct, but is justified by the lack of drinking-water availability in the area. (See, to similar effect, Judgments Nos. 2014-9134, issued at 14:05 on 19 June 2014, and 2016007240, issued at 09:20 on 27 May 2017, among others.) Under that reasoning, there is no infringement of fundamental rights and, therefore, the appropriate course is to deny the amparo application.” Regarding the denial of drinking-water service for objective reasons, mention must be made of Judgment No. 2019-023102, issued at 08:50 on 22 November 2019, in which the Chamber, when considering a similar amparo application, held as follows:

“Furthermore, the report rendered under oath by the respondent authority explains that, although properties adjoining the applicant’s property have water service, this is because they have different characteristics. It distinguishes the three parcels derived from the parent property PRN02, including the applicant’s parcel, which were entered in the cadastre in April 2018, as verified by the survey plan submitted by the interested party, after opinions C-258-2017 of 9 November 2017 and C-300-2017 of 13 December 2017 of the Procuraduría General de la República (PGR). Those opinions confirm that the obligations contained in Article 10(2) of the Ley de Planificación Urbana remain fully in force, while also recalling the need to obtain prior approval from AyA pursuant to Article 21 of its organic law. Accordingly, there is no indication that the lots segregated from the parent property of the applicant’s parcel were granted water-service availability despite lacking AyA’s approval—which is required for the subdivision under Article 21 of the Ley Constitutiva del AyA, N° 2726—or the approval of the Instituto Nacional de Vivienda y Urbanismo (INVU), as required by Article 10(2) of the Ley de Planificación Urbana and Article 21 of the Ley Constitutiva del AyA.

Unequal treatment to the detriment of the protected party is therefore ruled out, and the denial of drinking-water availability is found to have been based on objective reasons. Consequently, it is ruled out that the respondent authority acted arbitrarily, and the application must be denied in all respects, as is hereby ordered, without prejudice to advising the applicant of her right to challenge the decision concerning her request for drinking water before the authority or before the administrative-litigation jurisdiction (jurisdicción contencioso-administrativa).” Given these circumstances, the respondent ASADA denied the protected party’s request and fully informed her of the technical reasons why it could not be granted, namely that there is no technical certainty regarding the system’s capacity. Whether the requested service should be provided is not a matter to be adjudicated in this jurisdiction, since it falls outside the scope of its authority.

It should also be noted that this Court has repeatedly held that applications for drinking-water service may be denied when technical impediments exist, requirements established by rules below the constitutional level have not been met, or technical or legal criteria otherwise warrant denial. It should be noted that this Chamber must not act as an intermediary before a particular natural or legal person—whether the latter is governed by public or private law—to intercede on behalf of a third party so that the relief sought by the applicants is granted, as the petitioner requests in this case. She must therefore raise her objections or claims before the respondent or in the competent judicial forum, where she may fully litigate the merits of the matter and assert her claims. Consequently, in light of the foregoing considerations, the appropriate course is to deny the application, as is hereby ordered.

V. DISSENTING OPINION OF JUSTICES CRUZ CASTRO AND RUEDA LEAL, DRAFTED BY THE LATTER

In the matter under examination, the applicant complains that new water-service availability requests are not being approved because the property is located in an area with an insufficient water supply.

In this regard, we consider it essential to join the Autoridad Reguladora de Servicios Públicos (Aresep) as a party in order to determine whether the service providers in the area bear any responsibility for the current capacity of the water systems. In another matter, this Court (Judgment No. 2020007754, issued at 9:45 on 24 April 2020) considered that Aresep, when submitting its report, identified a series of problems at the Instituto Costarricense de Acueductos y Alcantarillados concerning infrastructure investment, losses from unaccounted-for water, and implementation capacity. On that occasion, the Chamber held: “In this regard, the record establishes not only that the water-shortage problem had been apparent since 2017, but also that ARESEP noted that ICAA had a backlog in infrastructure investment and, moreover, significant losses from unaccounted-for water. The regulatory authority further stated that the drinking-water service operators’ capacity to implement projects had not been satisfactory.” Consequently, we dissent and would order that the processing of the application continue so that a report may be requested from the General Regulator of the Autoridad Reguladora de los Servicios Públicos.

VI. DOCUMENTATION SUBMITTED TO THE CASE RECORD

The parties are advised that, if they submitted any paper document, as well as any objects or evidence contained on any additional electronic, computer, magnetic, optical, or telematic device, or produced through new technologies, they must retrieve such materials from the Court’s office within no more than thirty business days following notice of this judgment. Otherwise, any material not retrieved within that period will be destroyed, pursuant to the “Reglamento sobre Expediente Electrónico ante el Poder Judicial,” approved by the Full Court in Session No. 27-11 of 22 August 2011, Article XXVI, and published in Boletín Judicial No. 19 of 26 January 2012, as well as the resolution approved by the Consejo Superior del Poder Judicial in Session No. 43-12, held on 3 May 2012, Article LXXXI.

Therefore:

The application is denied. Justices Cruz Castro and Rueda Leal dissent and would order that the processing of the application continue so that a report may be requested from the General Regulator of the Autoridad Reguladora de los Servicios Públicos.

Recurso de amparo presentado por Nombre01, cédula de identidad CED01, contra la ASOCIACIÓN ADMINISTRADORA DEL ACUEDUCTO Y ALCANTARILLADO SANITARIO DE MONTE ROMO DE HOJANCHA, GUANACASTE.

Resultando:

Considerando:

I. CUESTIÓN PRELIMINAR
