SummaryResumen

The Constitutional Chamber (Sala Constitucional) summarily rejected an amparo application against the ASADA of San Juan de Escobal de Atenas concerning its refusal to issue potable-water availability letters for two properties, allegedly because no distribution network served the area. The majority reiterated that access to potable water is a fundamental right and that water supply is a public service that must be provided continuously, efficiently, and equally, but the right does not require service under all circumstances. Service providers may deny an application when duly justified legal, material, or technical impediments exist. Determining whether infrastructure, hydraulic capacity, or adequate technical grounds existed in this particular case would require verification of facts and ordinary-legality requirements, matters assigned to the competent administrative authorities or ordinary courts rather than amparo review. The interested parties may pursue their claims through ordinary proceedings. Justices Cruz Castro and Rueda Leal dissented, finding that additional evidence was needed and stating that they would allow the amparo to proceed.

In view of the foregoing, it has been recognized that service providers may deny potable-water service when technical reasons justify doing so. It must be noted, however, that verification of compliance with the legal or technical requirements for obtaining the requested availability determination falls to the respective administrative or judicial authorities; this Chamber may not enter into that subject because it involves matters of ordinary legality outside its jurisdiction. Accordingly, if the parties disagree with the lack of reasoning in the act denying the requested water availability, the proper course is to resort to ordinary proceedings and submit there such applications and claims as they deem appropriate, so that the matter may be decided according to law. Therefore, if the grounds for the denial are untrue or inconsistent with technical and/or legal criteria, that dispute must be resolved through subconstitutional proceedings. Accordingly, and pursuant to this Chamber’s repeated precedents, the amparo must be rejected, without prejudice to the interested party bringing its claims through ordinary proceedings. The application is summarily rejected. Justices Cruz Castro and Rueda Leal dissent and would allow the amparo to proceed.

CASE FILE: No. 26-032511-0007-CO PROCEEDING: AMPARO PROCEEDING DECISION: No. 2026035151 CONSTITUTIONAL CHAMBER (SALA CONSTITUCIONAL) OF THE SUPREME COURT OF JUSTICE. San José, at 9:20 a.m. on 10 September 2026.

Amparo proceeding processed under case file number 26-032511-0007-CO, filed by Nombre01 and Nombre03 against LA ASOCIACIÓN ADMINISTRADORA DEL ACUEDUCTO Y ALCANTARILLADO COMUNAL DE SAN JUAN DE ESCOBAL DE ATENAS DE ALAJUELA.

BACKGROUND

  1. 1In a written submission received by the Secretariat of the Chamber, the amparo applicants file an amparo application against La Asada de San Juan de Escobal de Atenas and state as follows: “(…) FACTS 1. The first applicant, Nombre01, identification card number CED01, am the owner of the property registered in ALAJUELA under record number PRN01, which has survey plan PRN02 and is located at Dirección01, entering by the road across from Selva Real State and proceeding uphill for 100 meters. The second applicant, Nombre03, identification card CED02, is the COURT-APPOINTED EXECUTOR (ALBACEA PROPIETARIA) of the ESTATE of my late father, Nombre02, identification card CED03, who died on 18 December 2021, with the executorship registered at Volume: 2025, Entry: 23535, sequence:!, subsequence: 1; and the current registered owner of the property registered in ALAJUELA under record number PRN03, which has survey plan PRN04 and is located at Dirección01, entering by the road across from Selva Real State and proceeding uphill for 150 meters. 3.- On 27 July 2026, we separately submitted formal requests to the respondent Association for a WATER-AVAILABILITY LETTER, complying with the requirements it requested. This is because water is an essential service indispensable for a dignified life, health, housing, and people’s basic needs. 4. On 07 de Agosto 2026, through official letters ASADA-052-2026 addressed to Nombre01 and ASADA-053-2026 addressed to Nombre03, signed by Mr. BRAYNER ARROYO GONZALEZ, identification card CED04, in his capacity as President of ASADA Escobal de Atenas, we were informed that potable-water service is NOT available for our properties because: ‘our ASADA currently does not have a DISTRIBUTION NETWORK in that area’ (boldface and underlining not in the original), without, to the best of my knowledge, being provided with a technical, objective, reasonable, proportionate, and duly reasoned justification explaining why our properties must be excluded from access to the service. 5.- In view of this situation, we conducted an inspection and verification of the properties adjoining or near the property that is the subject of the request, establishing that ALL those neighboring properties have access to potable-water service supplied by ASADA de Escobal.ALL this information is duly documented through photographs and videos demonstrating that A TRUE DISTRIBUTION NETWORK FOR THIS PRECIOUS LIQUID DOES EXIST, both along the main road from Escobal to Atenas and along the road that proceeds uphill across from SELVA Real State, where 09 meters were counted; moreover, along the road leading uphill to the ASADA supply tanks, there are 02 large swimming pools and approximately 10 buildings, all supplied by the ASADA and equipped with their respective water meters. 6. It is important to indicate that the road where our TWO lots are located (on the left-hand side) LEADS DIRECTLY to the ASADA collection tanks, meaning that our properties are extremely close to those tanks (approximately 400 meters); but if the water were drawn from the network along the main road, it would be 100 and 150 meters, respectively, from the indicated lots. 7. This situation reveals, at least on its face, unequal treatment requiring a sufficient technical and legal explanation, because while properties in the immediate vicinity have potable-water service, our 02 properties, which are the only ones located along that road, are denied availability of that service. 8.- The existence of potable-water service at neighboring properties is a relevant factor requiring the respondent authority to explain clearly and demonstrably the specific technical reasons why the denial is maintained exclusively with respect to my property. 9.The challenged denial directly affects the possibility of properly using and developing the property, as well as access to minimum conditions of sanitation, hygiene, housing, and a dignified life. 10. Water is neither an ancillary service nor a privilege. Access to potable water is indispensable for survival and the effective exercise of numerous fundamental human rights. 11. REGARDING THE INSPECTION OF NEIGHBORING PROPERTIES: One of the central elements of this AMPARO APPLICATION is that an inspection of the neighboring properties was conducted, confirming that ABSOLUTELY all the inspected properties have potable-water service supplied by ASADA DE ESCOBAL (RESPONDENT ASADA). This fact is fundamental because it demonstrates the need for an objective explanation of the decision adopted by the respondent ASADA, and I request that this point be examined specifically by the Constitutional Chamber in order to determine whether the principle of equality has been violated or arbitrary action has occurred. 12.Given that INFRASTRUCTURE AND WATER SERVICE DO IN FACT EXIST AT THE NEIGHBORING PROPERTIES, the following must be determined precisely: Whether connection is technically possible. Whether hydraulic capacity is available. Whether there are genuine limitations in flow or supply. Whether neighboring properties received the service under the same technical conditions. What specific differences would justify denying the service solely to my property. Whether the denial is based on an individualized and duly documented technical study. 13. The mere assertion that ‘there is no availability because our ASADA currently does not have a DISTRIBUTION NETWORK in that area,’ without the corresponding technical support, is insufficient when neighboring properties do have potable water (…) REQUEST For the foregoing reasons, I respectfully request that the Justices: FIRST: Grant this amparo application. THIRD: Require the ASADA to submit all studies, reports, hydraulic analyses, resolutions, minutes, and technical documents supporting the denial.FOURTH: Expressly consider the fact that, according to the inspection conducted and duly documented through photographs and videos, the neighboring properties have potable-water service, and determine whether there is an objective and reasonable justification for providing the service to those properties while denying it to the property that is the subject of this application. SECOND: Order ASADA de Escobal de Atenas to submit a complete and detailed report on the technical, administrative, and legal reasons underlying the denial of potable-water availability for the indicated property, including the precise technical reasons for the denial, ESPECIALLY REGARDING: The system’s current capacity, the hydraulic or technical studies supporting the decision, the location of the existing network in relation to the property, the reasons why neighboring properties have service, whether capacity for new connections exists, and the criteria used to grant availability to some properties and deny it to others.FIFTH: If it is established that technical capacity, nearby infrastructure, or a reasonable possibility of connection exists, order the ASADA to adopt the measures necessary to guarantee availability of and access to potable-water service within a reasonable and technically feasible period. SIXTH: If a genuine capacity limitation exists, order the ASADA to provide a complete and verifiable technical explanation and to identify the works, investments, or measures needed to remedy that situation and progressively guarantee access to the service. SEVENTH: Order the respondent authorities to refrain from maintaining arbitrary or discriminatory decisions, or decisions lacking sufficient reasons, concerning the provision of potable-water service. EIGHTH: Protect my fundamental rights to a dignified life, equality, and health. NINTH: I respectfully request that this Honorable Constitutional Chamber provide effective protection for the fundamental rights that have been infringed and examine ASADA de Escobal de Atenas’s denial in light of the right to life, human dignity, equality, health, the human right of access to potable water, access to basic conditions of existence, and the other related rights affected by the challenged denial. TENTH: Order the respondent party to pay costs, damages, and losses, where appropriate under the legal system. (…)”.

2. Article 9 of the Ley de la Jurisdicción Constitucional empowers the Chamber, at any time and even upon filing, to summarily dismiss or deny on substantive grounds any application submitted for its consideration that is manifestly inadmissible, when it considers that sufficient grounds exist to deny it, or when the application merely reiterates or reproduces an identical or similar application that was previously denied.

Justice Castillo Víquez delivers the opinion; and, REASONS

I. SUBJECT MATTER OF THE APPLICATION

The applicants allege a violation of their fundamental rights because, they assert, the respondent institution refuses to grant potable-water availability for their property on the ground that “our ASADA currently does not have a DISTRIBUTION NETWORK in that area,” which they maintain is untrue. They therefore request the Chamber’s intervention.

II. INADMISSIBILITY OF THE APPLICATION

The applicants are advised that the Chamber has long held that, although a fundamental right to potable water exists, its exercise is not indiscriminate, because the entities providing that service are not required to provide it under any and all conditions or at any given time. For example, in judgment No. 2018-12838, issued at 09:30 on 10 August 2018, this Chamber held as follows:

“IV.- Regarding the specific case. In the sub lite, the applicant considers that her fundamental right of access to potable water has been violated. She states that she and her husband own the property recorded under real-property folio No. 672411 in San José Province, registered survey plan No. SJ-1843630-2015. She states that, through a request submitted by her husband to the Instituto Costarricense de Acueductos y Alcantarillados, water availability was requested for the aforementioned land; however, through official letter No. UNDGAM-0583-2018-1803 of 21 February 2018, the respondent institute denied the request on the ground that no availability existed (…) In the area identified by the applicant, the existing potable-water infrastructure in front of the property does not have sufficient capacity to supply the property. The potable-water production currently available, which supplies the infrastructure located in front of the property, does not have sufficient capacity to supply it.

The area’s population has been increasing, creating substantial demand that has made the system supplying the area insufficient at present. The situation is aggravated by the area’s topographic elevation, the limited collection sources in the area, and the competent municipality’s lack of cadastral control there. Accordingly, the amparo application must be denied. In repeated judgments on this issue, this Constitutional Court has stated that the supply of potable water is regarded under the Costa Rican legal system as a public service and that, as such, every public-service provider—whether a public or private entity—is required to provide the service continuously, efficiently, and under conditions of equality, and must adapt to technological changes (see Judgment No. 2001-09676 and No. 2004-08161). It is therefore clear that the Instituto Costarricense de Acueductos y Alcantarillados, as one of the state entities responsible for providing the public service of potable water, is likewise required to provide that service continuously, adaptably, efficiently, and equally to all inhabitants.

However, this Court’s case law has also held that, when there is a legal impediment (meaning failure to satisfy requirements established in the applicable regulations) or a formal impediment (meaning the absence of a water-distribution network), it is reasonable not to grant service requests or to require the interested party to bear the installation costs when no potable-water distribution network exists and infrastructure must be built. Thus, it has been made clear in such cases that this is not a denial of access to potable-water service, but rather an inability to provide it or a need for the interested party to participate in overcoming a technical impediment, namely, the lack of infrastructure. In other words, provided that the failure to supply potable-water service is not capricious, arbitrary, or unfounded but is justified by a legal or material impediment, there is no violation of fundamental rights.

In this case, the respondent authority clearly indicates that the applicant must comply with the Ley de Planificación Urbana and the Plan Regulador. Moreover, the person protected by the amparo (amparada) was informed that there was no associated availability for the subdivision (fraccionamiento) of the parent property from which the property under examination originated and that the area also lacked supply capacity. Lastly, the respondent states that, in the area identified by the applicant, the existing potable-water infrastructure in front of the property does not have sufficient capacity to supply the property. Accordingly, both a legal and a formal or technical impediment exists because the land was subdivided without first obtaining an availability determination and because there is insufficient capacity to provide the public service in the area where the property is located. As a corollary to the foregoing, the Chamber considers that the amparo application must be denied because, under the line of precedent established by this Court in similar cases, the supply of potable water may be denied when a legal and/or formal technical impediment is found to exist, as in this case, and therefore the applicant’s fundamental rights have not been infringed.

If the applicant disagrees with the denial itself and the reasons supporting it, that is an issue of ordinary legality that cannot be adjudicated through this proceeding. Furthermore, the Chamber finds that the person protected by the amparo was expressly informed of the reasons why authorization of the service was not appropriate, and therefore her fundamental rights were not violated in that respect either” (emphasis not in the original).

In view of the foregoing, it has been recognized that service providers may deny potable-water service when technical reasons justify doing so. It must also be stated that verification of compliance with the legal or technical requirements for obtaining the requested availability determination falls to the respective administrative or judicial authorities, and this Chamber may not enter into that matter because it concerns issues of ordinary legality beyond its jurisdiction. Accordingly, if the applicants disagree with the insufficient reasoning of the act through which the requested water availability was denied, the proper course is to seek relief through ordinary legal proceedings and submit there any applications and claims they consider appropriate, so that the matter may be resolved as required by law. Thus, if the reasons for the denial are untrue or inconsistent with the technical and/or legal criteria, that dispute must be resolved through proceedings below the constitutional level.

Accordingly, and pursuant to this Chamber’s repeated precedents, the amparo must be dismissed, without prejudice to the interested party’s submission of claims through ordinary proceedings.

III. DISSENTING OPINION OF JUSTICES CRUZ CASTRO AND RUEDA LEAL, AUTHORED BY THE LATTER

In the sub lite, the majority of the Chamber dismisses the amparo on the ground that institutions providing potable-water service may validly deny or condition requests for potable-water service when technical or legal reasons justify doing so. We dissent, however, based on the following considerations:

Article 50 of the Constitution establishes that every person holds the basic and nonwaivable human right of access to potable water as an essential resource for life. It adds that water is an asset of the nation indispensable to protecting that human right. It also provides that its use, protection, sustainability, conservation, and exploitation shall be governed by the legislation enacted for those purposes and that priority shall be given to supplying potable water for consumption by individuals and communities.

It follows that the priority status constitutionally afforded to the supply of potable water requires the competent entities to adopt appropriate measures to ensure that this public service is provided equally, continuously, and efficiently. This in turn requires the pertinent adaptation or modification so that, within a framework of reasonableness, infrastructure and technologies are adjusted to society’s new requirements and to changes in nature.

Accordingly, we consider that further evidence is required to establish or rule out whether a constitutionally significant impairment warranting the Chamber’s intervention occurred in the sub examine.

IV. DOCUMENTATION SUBMITTED TO THE CASE FILE

This Chamber must advise the parties that, if they submitted any paper documents, objects, or evidence stored on any additional device or through electronic, computer, magnetic, optical, telematic, or new-technology media, those materials must be collected from the court office within 30 business days after notice of this judgment is received. Otherwise, all such materials will be destroyed pursuant to the “Reglamento sobre Expediente Electrónico ante el Poder Judicial,” approved by the Full Court at session No. 27-11 of 22 August 2011, Article XXVI, and published in Boletín Judicial number 19 of 26 January 2012, as well as pursuant to the resolution approved by the Consejo Superior del Poder Judicial at session No. 43-12 held on 3 May 2012, Article LXXXI.

THEREFORE:

The application is summarily dismissed. Justices Cruz Castro and Rueda Leal dissent and would order the amparo application to proceed.

PROCESO: RECURSO DE AMPARO RESOLUCIÓN: No. 2026035151 SALA CONSTITUCIONAL DE LA CORTE SUPREMA DE JUSTICIA.

CONSIDERANDO

I. OBJETO DEL RECURSO
