Res. 35107-2026 Sala Constitucional · Sala Constitucional · 10/09/2026
OutcomeResultado
The majority rejected the amparo application outright because the dispute over technical water-system coverage and entitlement to service had to be pursued before AyA or through ordinary judicial proceedings, while Justice Cruz Castro dissented and would have ordered progressive measures to ensure access to potable water.
SummaryResumen
The Constitutional Chamber (Sala Constitucional) declared inadmissible an amparo proceeding in which the owner of property in La Rita de Pococí challenged the Instituto Costarricense de Acueductos y Alcantarillados (AyA) for denying her a potable-water connection and alleged unequal treatment compared with a neighbor. The majority found that AyA had identified the property as lying outside the coverage of the water-supply systems administered by its Pococí cantonal office. It held that the correctness of that technical determination and entitlement to the requested service must be contested before AyA itself or through ordinary judicial proceedings. The Chamber reiterated that providers may deny or condition water-service applications when justified technical or legal impediments exist. It also found the equality allegation insufficient because deciding whether the compared situations were equivalent would first require resolving an ordinary-legality dispute. Justice Cruz Castro dissented: he would have admitted the amparo and ordered concrete, progressive measures to ensure effective access to potable water within a reasonable period.
Key excerptExtracto clave
After reviewing the application and the evidence submitted, the Chamber finds that the respondent institution informed the person protected by the amparo that it was denying her potable-water application because the property is located in an area outside the coverage of the potable-water supply systems administered by the Pococí cantonal office. Accordingly, whether that technical determination—and, consequently, the requested service—is warranted is not a matter to be debated in this jurisdiction, as it falls outside the scope of its competence. Moreover, this Court has repeatedly held that applications for potable-water service may be denied when there are technical impediments, failures to satisfy requirements established below the constitutional level, or technical and/or legal determinations that justify the denial. Nor should this Court act as an intermediary before a particular natural or legal person—whether the latter is governed by public or private law—to intercede on behalf of a third party so that the party may obtain what she seeks, as the applicant requests here. Consequently, if she so chooses, the claimant must submit her objections or claims to the respondent authority itself or through ordinary judicial proceedings, forums in which she may fully litigate the merits and pursue her claims. Consequently, the amparo application is declared inadmissible.

Document Review CASE FILE N° 26-031945-0007-CO PROCEEDING: AMPARO PROCEEDING DECISION Nº 2026035107 CONSTITUTIONAL CHAMBER (SALA CONSTITUCIONAL) OF THE SUPREME COURT OF JUSTICE. San José, at nine twenty a.m. on 10 September 2026.
Amparo application filed by Nombre03, identity card CED01, against the INSTITUTO COSTARRICENSE DE ACUEDUCTOS Y ALCANTARILLADOS.
Background:
Justice Castillo Víquez drafts the decision; and, Reasons:
The amparo applicant states that she requested a water service connection from the respondent, but it was denied on the ground that her property belongs to Balastre and that providing the service was not the responsibility of that institute, even though the property is in La Rita. She mentions that a neighbor was granted the service. She considers her fundamental rights to have been violated.
Regarding the grievances raised, it should be noted that this Court has held that associations administering water supply and sewerage systems, municipalities, and other institutions that provide drinking-water service may validly deny applications for drinking-water service submitted to them, or make them subject to conditions, if technical or legal reasons justify doing so. Accordingly, in judgment No. 2016-006027 at 09:05 on 6 May 2016, this Chamber held:
“This Constitutional Court, in judgment 2014-9134 at 14:05 on 19 June 2014, which addressed an issue very similar to the one raised in this application, ruled: ‘(...) In repeated judgments concerning this issue, this Chamber has stated that the supply of drinking water is regarded under Costa Rican law as a public service and that, as such, every public-service provider—whether a public or private entity—is required to provide the service continuously, efficiently, under conditions of equality, and with adaptation to technological changes (see, in this regard, judgment 2001-09676 at eleven twenty-five a.m. on 26 September 2001 and judgment 2004-08161 at ten fifty-three a.m. on 23 July 2004). It is therefore clear that the Instituto Costarricense de Acueductos y Alcantarillados, as one of the State entities responsible for providing the public service of drinking water, is likewise required to provide this service continuously, adaptably, efficiently, and equally to all inhabitants.
Nevertheless, this Constitutional Court’s case law has also stated that, where there is a legal impediment (meaning failure to satisfy requirements established in the applicable regulations) or a formal impediment (meaning the absence of a Water Distribution Network), it is reasonable not to grant service applications or to require the interested party to bear the installation costs when there is no drinking-water distribution network and infrastructure must be built. Thus, it has been made clear in such cases that this does not constitute a denial of access to drinking-water service, but rather an inability to provide it or the necessary participation of the interested party in overcoming a technical impediment, namely, the lack of infrastructure. In other words, provided that the failure to furnish drinking-water service is not capricious, arbitrary, or unfounded, but is justified by a legal or material impediment, there is no violation of fundamental rights.
In this specific case, the evidence submitted and the report provided under oath confirm that AyA did not arbitrarily deny the applicant’s request, but did so because not all of the technical and legal requirements established by the Reglamento de Prestación de Servicios a los Clientes de Instituto Costarricense de Acueductos y Alcantarillados for approving new services had been satisfied.’” This ruling may be supplemented by decision No. 2017-005245 at 10:00 on 7 April 2017, which stated, in relevant part:
“The report provided by the authorities of the respondent municipality states that the Instituto Costarricense de Acueductos y Alcantarrillados must address the applicant’s claim regarding whether the place where Ms. Nombre02 owns the property is or is not outside the water-supply area, because the Municipality lacks jurisdiction over that matter. For its part, the Instituto Costarricense de Acueductos y Alcantarillados states that it has acted in accordance with the rules governing it, properly exercising its governing function and at all times taking duly supported and reasoned actions, as detailed above. It is therefore evident that the Institute has acted in accordance with law because, according to the technical report issued by UEN Optimización de Sistemas Nuevos Desarrollos GAM, official letter UEN-OSND-GAM- 2017-00082, there is clearly no availability of drinking water for the property cited by Ms.
Nombre01 in her amparo application. The report further states that an analysis of this property’s history shows that it formed part of the property with cadastral number PRN01 and, according to a search of the Registro Nacional, the latter was subdivided (fraccionada), resulting in four properties without the required water-availability procedure having been undertaken for that subdivision. Accordingly, this Chamber is unable to establish any omission or arbitrary action by the respondent authority. The appropriate disposition is therefore to deny the amparo and reiterate that, according to the evidence submitted, the failure to furnish drinking-water service to the applicant’s lot is not capricious, arbitrary, or unfounded, but is justified by the lack of drinking-water availability in the area. (See, to similar effect, judgments numbers 2014-9134 at 14:05 on 19 June 2014 and 2016007240 at 09:20 on 27 May 2017, among others).
Under that reasoning, there is no violation of fundamental rights and, therefore, the appropriate course is to deny the amparo application.” After reviewing the initial application and the evidence submitted, it is established that the respondent institute informed the protected party (parte tutelada) that it was denying her drinking-water application because the property is located in an area outside the coverage of the drinking-water supply systems administered by the Pococí cantonal office.
Accordingly, whether that technical criterion, and therefore the requested service, is warranted is not a matter to be adjudicated in this jurisdiction, because it falls outside the scope of its authority. It should be added that this Court has repeatedly held that applications seeking drinking-water service may be denied when there are technical impediments, a failure to satisfy subconstitutional requirements, or technical and/or legal criteria justifying denial. Moreover, this Court must not act as a mediator before a particular natural or legal person—whether the latter is governed by public or private law—to intercede on behalf of a third party so that the third party may obtain what she seeks, as the applicant requests in this case. Consequently, if she deems it appropriate, the claimant must bring her objections or claims before the respondent authority itself or through the ordinary judicial process, forums in which she may fully litigate the merits of the matter and assert her claims.
Furthermore, this Chamber has repeatedly stated that, in cases alleging a violation of Article 33 of the Constitution, it is not enough for the applicant to assert that two persons have received different Political treatment for a breach of the constitutional provision to be deemed established, because anyone alleging a violation of this principle must provide, ab initio, sufficient evidence suggesting—with a reasonable degree of probability—that equal situations have unjustifiably received different treatment. However, given the eminently summary nature of the amparo proceeding, it is evident that the comparator must be of such a nature that it is unnecessary first to analyze the affected party’s situation under ordinary law. Consequently, given that, in this case, the applicant fails to recognize that determining whether the alleged inequality occurred would require this Chamber first to rule on a dispute involving mere ordinary legality, it is clear that her argument cannot be entertained in this proceeding because that admissibility requirement has not been met.
Consequently, the application is declared inadmissible.
I dissent from the majority’s position. In the present case, the Administration’s refusal to provide an essential service is upheld on the basis of technical considerations concerning the insufficiency of water infrastructure; however, the fact that access to drinking water constitutes a fundamental right indispensable to life, health, and human dignity is not adequately weighed.
Article 21 of the Constitución Política protects human life, and this Court has recognized that access to water for human consumption is a material prerequisite for that right. Likewise, Article 50 of the Constitution imposes on the State the duty to guarantee the well-being of all inhabitants, which necessarily includes effective, sufficient, and continuous access to drinking water. At the international level, instruments such as the International Covenant on Economic, Social and Cultural Rights—as interpreted by the Committee on Economic, Social and Cultural Rights in its General Comment No. 15—recognize the human right to water and require States to adopt positive measures for its full realization. The State bears a heightened obligation in a social and democratic State governed by the rule of law; for that reason, the supply of water is a priority obligation of public authorities.
From this perspective, the invocation of technical limitations cannot become an absolute justification for failing to meet a basic subsistence need. The Administration cannot limit itself to establishing that the system is insufficient; it has a legal duty to plan, anticipate, and carry out the actions necessary to progressively guarantee access to water service, especially when it is intended for human consumption.
The majority’s approach normalizes a structural omission: it accepts that the lack of infrastructure relieves the State of its obligation, when that very deficiency demonstrates a failure to fulfill its duty of foresight. This does not mean requiring the impossible, but rather requiring the Administration to adopt reasonable, alternative, or progressive measures so that people are not left without protection.
Water is not merely another service; it is an essential human right. Accordingly, the respondent authority cannot disregard its duty to guarantee it by sheltering behind technical limitations without offering effective solutions.
For these reasons, I consider that the application should have been admitted, at least to order the Administration to adopt concrete and progressive measures that would guarantee the protected party effective access to drinking water within a reasonable period. Water is a good and a fundamental right whose effective enjoyment must be ensured; this is an unavoidable duty.
The parties are advised that, if they submitted any paper document, as well as objects or evidence contained on any additional electronic, computer, magnetic, optical, telematic device or produced using new technologies, these must be retrieved from the Court’s offices within a maximum period of 30 business days following notice of this judgment. Otherwise, all material not retrieved within that period will be destroyed pursuant to the “Reglamento sobre Expediente Electrónico ante el Poder Judicial,” approved by the Full Court at session N° 27-11 on 22 August 2011, Article XXVI, and published in Boletín Judicial number 19 on 26 January 2012, as well as pursuant to the resolution approved by the Consejo Superior del Poder Judicial at session N° 43-12 held on 3 May 2012, Article LXXXI.
