SummaryResumen
The Constitutional Chamber (Sala Constitucional) denied the amparo application against the Municipalidad de Paraíso concerning placement of a drinking-water meter 150 meters from the protected person’s property, the requested relocation of four neighbors’ meters, and the lack of a response to a municipal request. The Chamber found that the municipality had not arbitrarily denied service: it had approved water availability, received payment for the connection, issued the construction permit, and arranged to install the meter. It held that the precise location of the meters and the alleged need for an underground network extension were technical and subconstitutional-legality matters requiring specialized evidence; they must be pursued before the municipality itself or through the ordinary judicial avenues. It also found no proof of existing supply or contamination problems because the alleged risks were future and uncertain. Finally, the failure-to-respond claim was premature because only eighteen days had elapsed between the request and the filing of the amparo.
Key excerptExtracto clave
First: It has been shown that the respondent municipal authorities never arbitrarily or unjustifiably denied the applicant a drinking-water supply or public drinking-water service, or the installation of the corresponding water meter for that purpose. On the contrary, the record shows that, since February 2026, the protected person’s water-availability request for his property had been approved and that a decision had even been made to place a meter near it so construction of his home could begin. In essence, therefore, the applicant has had access to that public service, as further shown by his subsequent submission clarifying to the Chamber that he had recently asked the municipality to proceed with installing the meter (150 meters from the property) so that he could receive drinking water. Second, it is clear that what the applicant ultimately presents to this Chamber is a general disagreement with the location where the respondents decided to install the meter through which he would obtain drinking water (following approval of the request confirming availability of that water). While the municipality decided that it would be 150 meters from the applicant’s property, he strongly seeks and requests installation in front of the property, pursuant, in his view, to Articles 14 and 68 of the AyA Service Provision Regulation. He also complains about the location of four other meters installed in the area for other neighbors. Such disagreements, however, cannot be resolved through the summary amparo proceeding. Because these are matters of mere legality, it lies outside this Constitutional Court’s jurisdiction to analyze and determine the exact location where those water meters must be installed under subconstitutional law. Nor does this Chamber have jurisdiction to determine whether the municipality must perform the works expressly requested by the protected person in the requested-relief section of this amparo or how it would eventually have to perform them. Accordingly, grievances of this kind must be presented and examined before the respondent institution itself or through the ordinary judicial avenues specifically created for that purpose, where the claimant may fully litigate the merits and assert his claims.

Document Review Case: 26-026947-0007-CO Decision No. 2026034788 CONSTITUTIONAL CHAMBER (SALA CONSTITUCIONAL) OF THE SUPREME COURT OF JUSTICE. San José, at 9:20 a.m. on 10 September 2026.
Amparo proceeding filed by Nombre02, identity card CED01, on his own behalf and on behalf of Nombre03, identity card CED02, AND Nombre01, identity card CED03, against the MUNICIPALIDAD DE PARAISO.
BACKGROUND:
Justice Araya García writes for the Chamber; and, REASONS:
The applicant alleges that the authorities of the Municipalidad de Paraíso refuse to install, in front of his property, the drinking-water meter he needs to build his house, and also refuse to relocate and correctly arrange four other neighbors’ meters. He likewise complains that, as of the date this amparo was filed, the respondent had not answered a request submitted on 9 July 2026 that the meter be installed specifically at the location he seeks and that the situation involving the other four neighbors’ meters be addressed.
The following facts relevant to deciding this amparo application are deemed established:
The following facts relevant to deciding this amparo application are deemed unproven:
The applicant comes before the Chamber against the Municipalidad de Paraíso de Cartago and explains that he owns property No. PRN01, located in Paraíso de Cartago (cadastral plan No. PRN02), a lot that borders a public road to the northwest. He also asserts that he has water-service availability (DISAG-0080-2026) and approved building permit No. PC-137-2026-12882025 in his name to build a dwelling.
He states that, many years ago, there was a right-of-way easement where he plans to build the dwelling, which is why four neighbors’ meters are currently grouped together, in an obsolete arrangement, at the beginning of the external main road. He states, however, that because it is now an official public road (code PRN03), ARESEP’s technical regulations and the water-system regulations require the municipality to place each service connection in front of the respective lot.
In addition to the foregoing, he states that his property is located one hundred fifty meters from that main road, while the public road extends three hundred linear meters to the last lot. He notes that multiple private hoses and pipes are currently exposed above ground along the frontage of the lots throughout those three hundred meters, inadequately conveying water to the neighbors. He states that this causes constant damage, breakages, and leaks, thereby jeopardizing the potability of the water and public health.
He therefore maintains that, to resolve this situation permanently—and correctly relocate the four existing meters and his new water-service connection—the municipality is required to carry out an engineering project covering the three hundred meters of public road by routing the main pipeline underground. This, in turn, would make it possible to provide his service at the one-hundred-fifty-meter point and properly organize the water system throughout the area.
He states that, in light of the respondent’s inaction, on 9 July 2026 he submitted a written request to the Mayor’s Office (proceeding ALC-2026-114), demanding the immediate installation of his meter at the public-road frontage and in accordance with the proper parameters for arranging the network. In this regard, he states that the Mayor’s Office’s internal system set 22 July 2026 as the final deadline for resolving the situation described. He alleges, however, that when he filed this amparo, the municipality had not issued a response, thereby preventing him from continuing the construction work. He maintains that he urgently requires a water supply to proceed with construction.
He requests that the application be granted and that the respondents be ordered to carry out the hydraulic-infrastructure works necessary to extend the secondary distribution network underground along the public road, thereby ensuring the physical and permanent installation of his meter in front of the property, one hundred fifty meters from the beginning of the road. He also requests that they be ordered to carry out the works necessary to relocate the four neighbors’ meters in accordance with ARESEP regulations and to bear the costs.
In a subsequent filing, the protected person explains that, because of the urgency of continuing the construction work, he was compelled, under protest, to agree to the municipality’s installation of the meter at the peripheral point imposed upon him, located one hundred fifty meters from his lot. He maintains that it is unreasonable to require a customer to maintain a private service line extending one hundred fifty meters along a public road. He asserts that “This excessive length causes a severe loss of dynamic pressure through friction, jeopardizing the ordinary water supply to the house. It also exposes the hose to constant mechanical damage, breakages caused by vehicle traffic, and vandalism, which will result in hidden leaks, unjustifiably high bills, and a high risk of drinking-water contamination through back-siphonage, thereby violating the right to public health and to quality water service (quality, continuity, and coverage).” Having reviewed the arguments presented by the applicant, the sworn report submitted by the head of the Municipalidad de Paraíso water system, and all the evidence provided, this Constitutional Court finds no basis for granting this amparo proceeding. This is so for the specific reasons set forth below.
First: It has been demonstrated that the respondent municipal authorities have never arbitrarily or unjustifiably denied the applicant a supply of drinking water, drinking-water public service, or placement of the corresponding water meter for those purposes. On the contrary, the record shows that the protected person’s request for drinking-water availability for his property was approved as early as February 2026 and that a decision was even made to place a meter near the property so that construction of his dwelling could begin. In essence, therefore, the applicant has had access to that public service, as demonstrated by the fact that, in a subsequent filing, he clarified to the Chamber that the municipality had recently been asked to proceed with installation of the meter, one hundred fifty meters from the property, so that he could receive drinking water.
Second: It is clear that, fundamentally, what the applicant presents to this Chamber is a general disagreement regarding the location where the respondents determined that they would install the meter through which he would receive drinking water, following approval of the aforementioned request for availability of that water. While the municipality decided that the meter would be placed one hundred fifty meters from the applicant’s property, he strongly desires and requests that it be installed in front of the property, in accordance with what, in his view, is required by Articles 14 and 68 of the AyA Service Provision Regulations. He also complains about the location of four other meters installed in the area for other neighbors. Such disagreements, however, cannot be resolved through the summary amparo procedure. Because they concern issues of ordinary legality, it is beyond this Constitutional Court’s jurisdiction to analyze and determine the exact location at which the cited water meters should be installed under the subconstitutional legal framework. Nor does this Chamber have jurisdiction to determine whether the municipality must carry out the works expressly requested by the protected person in the requested-relief section of this amparo application or how it must ultimately perform them.
It must be borne in mind that, under oath, the head of the Paraíso Municipal Water System maintained and reported that the location of those meters is based on technical judgment duly adopted within the institution. That judgment likewise cannot be refuted or invalidated by this Chamber, because it also concerns a matter of ordinary and purely statutory legality. In essence, that authority stated and explained the following to this Chamber:
“determination of the connection point falls within the technical judgment of the service operator, in this case the Municipal Water System, based on the characteristics of the existing infrastructure and hydraulic, topographic, operational, and public-service continuity criteria (…) What exists in this case is a disagreement between the location sought by the service user and the technical assessment that the entity administering the public service must conduct regarding the existing infrastructure and the technically appropriate connection point. This is an eminently technical and administrative matter requiring specialized analysis, not an arbitrary denial of access to the service (…) In this case, determining the connection point for a new service connection is a technical decision related to: • Network capacity. • Location of existing infrastructure. • Continuity and safety of the service. • Operating conditions of the distribution system.
Accordingly, the service user has no individual right to impose a specific connection location on the Administration when the regulations and administrative acts issued reserve that determination to the technical judgment of the system operator” It should be noted that it is neither materially nor reasonably possible to undertake a complicated and lengthy evidentiary process to resolve all the issues raised by the applicant, because, as stated, they exceed both the summary nature of the amparo proceeding and the jurisdiction conferred upon this Court by the Constitutional Jurisdiction Law and the Political Constitution itself.
Accordingly, claims of this kind must be presented and analyzed before the respondent institution itself or before the ordinary judicial forums specifically established for that purpose, where the claimant may fully litigate the merits of the matter and assert his claims.
Third: It was not demonstrated in this amparo proceeding that, because of the location of the meters in question, the cited neighbors are currently and actually experiencing problems with their drinking-water supply or contamination of that water. The protected person did not refer to any specific case or submit any evidence supporting his assertion in that regard; moreover, none of those neighbors, as the allegedly affected persons, came before the Chamber to present such claims. Consistent with the foregoing, it is relevant to note that the claimant’s allegations concerning his own meter were presented as future and uncertain events, which, in any event, cannot be protected through amparo. The protected person states that the distance between the meter and his property could create a risk to the water supply. He also states that it “exposes the hose to constant mechanical damage, breakages caused by vehicle traffic, and vandalism, which will result in hidden leaks, unjustifiably high bills, and a high risk of drinking-water contamination through back-siphonage.” As is perfectly clear, these matters are presented as potential events that have not occurred and therefore cannot be protected at this procedural stage through this particular amparo proceeding.
Fourth: Under the circumstances, it cannot be maintained that Article 41 of the Constitution was violated because of the failure to address the request submitted on 9 July 2026. Although this is an exceptional circumstance in which this Chamber may hear this aspect of the application based on the alleged violation of the right to prompt and effective administrative proceedings, because the underlying matter relates to the drinking-water supply, the fact remains that, when this amparo was filed on 27 July 2026, an excessive and unreasonable period had not elapsed for the respondent Administration to resolve the request. Only eighteen days elapsed between those dates. Accordingly, regardless of the period established internally by the municipality for addressing the request, it is clear that the amparo application was premature as to this issue.
* In view of the foregoing, because no violation of fundamental rights has been established, this amparo application must be denied.
V.Separate note by Justice Castillo Víquez concerning prompt and effective administrative justice. I have supported this Court’s position that, when a litigant alleges a violation of the right to prompt and effective justice in administrative proceedings, the Administrative-Litigation Courts, and not this Chamber, are the bodies with jurisdiction to hear the legal dispute. That said, the recent enactment of Ley n.° 9097, Ley de Regulación del Derecho de Petición, established that this right is eligible for judicial protection through the amparo proceeding established by Article 32 of the Constitutional Jurisdiction Law, in relation to Article 27 of the Political Constitution of the Republic of Costa Rica, in cases in which petitioners consider that the Administration’s physical actions, its administrative acts, or its response are affecting their fundamental rights. In my view, the recently enacted legislation does not mean that this Court must modify its body of precedent, as Article 7 of its Law vests it with exclusive authority to define its own jurisdiction.
Accordingly, except for those constitutional-law disputes that this Chamber itself has recognized as exceptional circumstances that may be heard in this jurisdiction through the constitutional guarantee proceeding of amparo, in all other cases, and for the reasons given by this Court (judgment N° 2008-02545 issued at 8:55 a.m. on 22 February 2008), jurisdiction lies with the judges of the administrative-litigation jurisdiction (jurisdicción de lo contencioso-administrativo). All of this is consistent with Article 25 of the American Convention on Human Rights, the Law of the Constitution—its values, principles, and rules—and the corresponding statutory provisions, based on a logical, systemic, and purposive interpretation of the legal system.
VI.Documentation submitted to the case file. The parties are advised that, if they submitted any paper document or any objects or evidence stored on any additional electronic, computer, magnetic, optical, or telematic device, or produced through new technologies, these items must be collected from the Court within a maximum period of 30 business days from notice of this judgment. Otherwise, all material not collected within that period will be destroyed, as provided in the “Reglamento sobre Expediente Electrónico ante el Poder Judicial,” approved by the Full Court at meeting number 27-11 of 22 August 2011, Article XXVI, and published in Boletín Judicial number 19 of 26 January 2012, as well as in the agreement approved by the Superior Council of the Judiciary at meeting number 43-12 held on 3 May 2012, Article LXXXI.
