The majority denied the amparo because neither agency inaction nor a pending administrative complaint was established, while the dissent would have added Coopeguanacaste R.L. to the proceeding and required further evidence before deciding the merits.

SummaryResumen

The Constitutional Chamber (Sala Constitucional) denied the amparo application alleging that the Municipality of Upala and MINAE had failed to control the cumulative impacts of hydroelectric projects and material extraction in the Zapote River. The majority found that the competent agencies had conducted inspections, assessments, and monitoring; that the activities operated under environmental approvals; and that the reviewed files contained no alerts, incidents, or noncompliance demonstrating an environmental danger warranting constitutional protection. It also found no violation of the right to prompt and proper administrative proceedings because the applicant had not shown that a prior complaint remained unresolved. In a dissent, three justices considered the decision premature. They identified confusion between hydroelectric and mining concessions, SETENA's failure to explain whether it addressed the Canalete reservoir sediment-discharge issue, and the need to add Coopeguanacaste R.L. to the amparo proceeding and obtain further evidence before deciding the merits.

Key excerptExtracto clave

In view of the foregoing, this Court determines that the respondent authorities have not engaged in any inaction or omission tending to violate the protected person's fundamental rights, because they are performing the tasks within their respective powers to exercise the required oversight of the concessions granted in the Zapote River. According to the information provided to date, those concessions have recorded no risk alerts, incidents, or noncompliance; consequently, no violation capable of being declared in this jurisdiction is apparent. Nor has a violation of the fundamental right to prompt and proper administrative proceedings been established, because the amparo applicant does not refer to any specific complaint filed with the respondent authorities. It has therefore not been shown that the applicant submitted a complaint reporting the facts alleged in the application which remains unresolved. Consequently, the application cannot be granted as presented. The application is denied. Justices Cruz Castro and Rueda Leal and Justice Hess Herrera dissent and consider that, before deciding the merits, the amparo proceeding should have been expanded to include Coopeguanacaste R.L. and the respondent authorities should have been required to provide further evidence so that, on the basis of that information, it could be determined whether the mining concession holders also needed to be joined to the proceeding.

Document Review Decision No. 2026034717 CONSTITUTIONAL CHAMBER (SALA CONSTITUCIONAL) OF THE SUPREME COURT OF JUSTICE. San José, at 9:20 a.m. on 10 September 2026.

Amparo proceeding filed by Nombre02, identification card CED02, against the MUNICIPALIDAD DE UPALA and the MINISTERIO DE AMBIENTE Y ENERGIA (MINAE).

Background:

  1. 1In a submission added to the digital case file on 30 May 2026, the amparo applicant filed an amparo application against the Municipalidad de Upala and MINAE. According to the order admitting the proceeding, the applicant states as follows:

“[The applicant] states that the río Zapote, located in the canton of Upala, is being affected by multiple hydroelectric power-generation and material-extraction activities, which have caused cumulative and progressive environmental impacts. Among these, the applicant mentions the reduction in flow—particularly during the dry season—the alteration of the natural riverbed, a significant increase in sediment, the deterioration of water quality, and harm to aquatic biodiversity. The applicant indicates that, during 2026, there has been an evident sustained deterioration of the river’s ecosystem, observable in physical and biological changes. The applicant also asserts that these impacts directly affect productive and subsistence activities such as livestock farming, agriculture, domestic water use, and water-based tourism. The applicant maintains that, despite the magnitude of the impacts described, the competent authorities have not exercised effective oversight over those activities, allowing the environmental harm to continue. The applicant requests the intervention of this Chamber.”

  1. 2By decision issued at 17:06 on 5 June 2026, this proceeding was admitted and the respondent authorities were asked to report on the facts alleged by the amparo applicant.
  2. 3In a submission added to the digital case file on 12 June 2026, José Miguel Zeledón Calderón, in his capacity as Director of Waters at MINAE, reports under oath as follows:

“ON THE MERITS The first matter we must report is that the only concessions granted on the río Zapote are those under case files 960-H and 980-H, held by CoopeGuanacaste. On 16 April 2026, the Water Directorate received official letter MU-CM-SC-ACUE-018- 167-2026 from the Upala Municipal Council, reporting the resolution adopted at session N°167-2026 to refer to this Directorate the situation concerning the alleged sedimentation of the río Zapote riverbed, in connection with the CoopeGuanacaste case files and alleged environmental problems. On 4 May 2026, officials from this Directorate inspected the site in question, visiting the intakes on the río Bijagua (Proyecto de Generación Bijagua) and the río Zapote (Proyecto de Generación Canalete) operated by CoopeGuanacaste. The inspection resulted in technical report DA-UHSAN-0587-2026, which is attached to this report and states: ‘With regard to the conditions of the río Zapote, the conditions of the riverbeds of both the río Bijagua and the río Zapote were verified, and no traces of sediment deposited in the riverbed could be located.

The riverbeds of both rivers were found to be unaffected by sedimentation, which could also be observed at the discharge site of the Proyecto Hidroeléctrico Bijagua.’ The report cites the existence of a reservoir or embalse Bijagua, where that Cooperative has an associated facility for separating sludge and subsequently extracting it manually. The report also states that the conditions of the río Zapote riverbed immediately downstream from the intake site were verified and no traces of sediment deposited in the riverbed could be located. The report cited above states: ‘No sedimentation or impact on the water body of the río Zapote was found, and in the inspected section no unpleasant odors were detected in the water, which appeared colorless and showed no evident impact.’ This document states that although the inspection did not establish the presence of sludge or sediment originating from the CoopeGuanacaste hydroelectric project, or any impact on the evaluated water body, because the methods for disposing of sediment in reservoirs vary, and pursuant to the preventive and precautionary principles of environmental legislation, SETENA was notified so that it could verify the process approved for those purposes.

CoopeGuanacaste was also notified regarding the company’s proper management of retained sediment. The foregoing was done pursuant to official letters DA-UHSAN-0585-2026 AND DA-UHSAN-0586-2026. Now, responding specifically to the statements made by the amparo applicant in the amparo application and in accordance with the field inspection and site visits, the following is established pursuant to official letter DAUHSAN-0587-2026: I-It should be noted that the Canalete de Upala area is located in the Northern Climatic Region, where, according to the Instituto Meteorológico Nacional (IMN) map of risk from extreme dry events, the area has a MEDIUM-HIGH risk classification; in other words, it is an area with a high probability or susceptibility of experiencing droughts or severe precipitation deficits that may have significant effects on human activities, ecosystems, and infrastructure. In addition, according to the Instituto Meteorológico Nacional (IMN) seasonal forecast for June - November 2026, under which the ENOS Early Warning System known as ‘SAT-ENOS’ advanced to a ‘Warning’ stage based on the ‘Niño’ ENOS phenomenon, precipitation deficits of up to -25% are forecast between May and June 2026 and of up to -30% between September and November 2026 (available on the website: https://www.imn.ac.cr/web/imn/pronostico- climatico).

The foregoing demonstrates that, because of the geographical location of the area and climate-related conditions, water availability in the río Zapote basin may vary significantly depending on the period analyzed, and this is not attributable to human activity. It should also be noted that the inspection conducted in May 2026 did not determine that the río Zapote was experiencing alarmingly low flows. It is further stated that hydroelectric activity constitutes a non-consumptive use of water resources because the captured flow is returned to the riverbed after being used to generate energy. Although marginal losses may occur as a result of phenomena such as evaporation, infiltration, or operational inefficiencies in the infrastructure, these are insignificant in comparison with the total volume used, and therefore would not materially affect downstream water availability.’ In other words, the effects on the flows of the río Zapote depend on natural climatic phenomena, which are affecting not only the río Zapote but the entire world, and those effects are not due to human activities that this Directorate has failed to monitor.

II_ According to the inspection conducted, no impact on the riverbed from works carried out in it, discharge of effluents, illegal uses, or extraction of materials was found. To date, the environmental complaint system known as SITADA records no complaints at this site. III-No impact from sedimentation on the riverbed or on the quality of the inspected water bodies was found.”

  1. 4In a submission added to the digital case file on 17 June 2026, Ana Sofía Huapaya Rodríguez-Parra, in her capacity as Acting Director of the MINAE Directorate of Geology and Mines, reports under oath as follows:
“Dear Sir: Please accept my cordial greetings. Official letters DGM-CMRHN-51-2026 of 5 May 2026 and DGM-CMRHN-65-2026 of 15 June 2026 are hereby forwarded; they contain the ‘Compliance Report’ concerning what this Directorate was ordered to do in case file 26-016928-0007-CO. Thanking you in advance for your attention, respectfully submitted” (Sic).
  1. 5In a submission added to the digital case file on 17 June 2026, Ulises Álvarez Acosta, in his capacity as Secretary General of the Secretaría Técnica Nacional Ambiental (SETENA), reports under oath as follows:

“THIRD: Identified case files and methodological framework for the environmental impact assessment (evaluación de impacto ambiental, EIA) With regard to the request for a report and on the basis of technical opinion CARTA-SETENA-DT-0030-2026—issued to better inform the decision by Engineer Kenner Quirós Brenes, Technical Director—as well as the case files held by this Secretariat and the allegations in the amparo application at issue, the following is determined concerning the area identified by the applicant: I. Classification and status of case files in the area at issue First, the existence of five (5) case files in the area of interest is confirmed: three (3) have Environmental Viability Licenses (Viabilidad Licencia Ambiental, VLA) and are in the operational stage, and two (2) are at the environmental assessment (EIA) stage for the possible granting of such a license. The status of each is set out below: (…) II.

Technical-analysis and environmental-protection criteria As part of the EIA procedure, for both projects that have been granted environmental viability and those still under review, SETENA strictly applies the technical and legal criteria of environmental regulations. The objective is to ensure that authorized activities coexist under strict protection of natural resources, maintaining a balance between human development and the environment. For this purpose, the following areas of analysis are mandatory: A. Assessment of Cumulative and Synergistic Effects The analysis of cumulative effects has been and remains an ongoing requirement under environmental law and is conducted pursuant to the regulations in force during each period: Historical Methodological Framework 1. (Decretos Ejecutivos N.° 31849 and N.° 32966): While the General EIA Regulations and the EIA Manual (Part IV) were in force, from June 2004 through 19 August 2023, the analysis of cumulative effects was structured according to the following mandatory parameters within the Environmental Impact Study (Estudio de Impacto Ambiental, EsIA): In Anexo 2, item 2, Environmental Impact Significance Matrix (Matriz de Importancia de Impactos Ambientales, MIIA): (…) Once the actions and the environmental factors/aspects presumably affected by them have been identified, the significance matrix provides a qualitative assessment for an EsIA or other environmental-assessment instruments.

Once the possible impacts have been identified, they must be forecast and assessed. The EsIA is a fundamentally analytical mechanism involving prospective research into what may occur; it is therefore absolutely necessary to clarify all the aspects defining it, including impacts (the interrelationship between a project action and an environmental factor/aspect). Accordingly, the aspects assessed in order to assign a weight to each impact, which must subsequently be included in the Environmental Management Plan (Plan de Gestión Ambiental), are as follows: Intensity (I), Extent (EX), Timing (MO), Persistence (PE), Reversibility (RV), Recoverability (MC), Synergy (SI), Accumulation (Ac), Effect (EF), and Periodicity (PR). All the foregoing aspects are assessed to produce the Impact Significance (I) result according to this formula: I = ± [IN + 2 EX + MO + PE + PV + SI + AC + EF + PR + MC] Impacts with significance values below 25 are irrelevant, meaning compatible, or the environmental measures were incorporated into the project design.

Moderate impacts have a significance between 25 and 50. They are severe when the significance is between 50 and 75 and critical when the value exceeds 75. Accordingly, synergy and accumulation are indeed considered in the environmental assessment. • Section 11.4 indicated and assessed the following: Analysis of cumulative effects: Based on the individual analysis of the environmental impacts examined in this Chapter, and particularly their environmental-impact significance assessment, those that will produce Cumulative Effects must be listed and analyzed. For this purpose, consideration must be given to those negative impacts for which a residual effect remains after application of the corrective measures described. Once the principal cumulative effects have been identified and characterized, the environmental-compensation measures that the Project will implement to restore environmental balance to the situation must be identified. • Section 11.5 required and assessed the following: Analysis of the Synergistic Effects of other projects under construction and in operation: Analyze the synergistic effects that the project, works, or activity will have, taking into consideration the existence of other projects, works, or activities under construction and in operation within the project’s indirect area of influence (biophysical and social).

This analysis must be prepared using a scientifically recognized methodology, and its principal postulates, concepts, and technical criteria must be detailed, explained, and described. • Section 11.6 required assessment of the following: Summary of the environmental-impact assessment: Prepare a summary table presenting all environmental impacts that the project will produce during its various stages and the result of the environmental-impact significance assessment. Impacts that generate cumulative effects must be identified. Comparatively discuss the rating of environmental impacts, particularly the balance between negative and positive impacts, and summarize the most significant impacts the Project would produce. Along the same lines, the issue of the alternatives analyzed must be revisited, and the selected alternative must be compared briefly with the others that were considered.(…) Current Methodological Framework. 2.

(Decreto Ejecutivo N.° 43898-MINAE-S-MOPT-MAG-MEIC): Under the current Environmental Assessment, Oversight, and Monitoring Regulations, in force since 20 August 2023, the substantive issue remains subject to the same degree of rigor: (…) Anexo 6-Guide for EsIA, ANEXO F: Instructions for Environmental Impact Assessment, Table of Measures, and Guide to Indicators, ITEM 2. The Environmental Impact Significance Matrix (MIIA): As stated above concerning Decreto 32966, the Environmental Impact Significance Matrix (MIIA) is assessed, and the aspects evaluated to assign a weight to each impact, which must subsequently be included in the Environmental Management Plan, are as follows: Intensity (I), Extent (EX), Timing (MO), Persistence (PE), Reversibility (RV), Recoverability (MC), Synergy (SI), Accumulation (Ac), Effect (EF), and Periodicity (PR).

They are severe when the significance is between 50 and 75 and critical when the value exceeds 75.(…) Accordingly, synergy and accumulation are indeed considered in the environmental assessment. B. Assessment of the Hydrological Component Under both regulatory frameworks (historical and current), the hydrological component is a fundamental component of environmental oversight. This section analyzes and assesses the quality and availability of water resources through the following: Water quality is analyzed by means of the bacteriological, physicochemical, and biological characterization of surface waters that could be directly affected by the Project, in order to establish the baseline and the monitoring required for environmental follow-up. The flow factor (maximum, minimum, and average flows) is also analyzed, establishing environmental flows that prevent harm to the aquatic ecosystem.

For water-use projects, this same section requires calculation of the ecological flow if the flow to be extracted exceeds 50% of the gauged total minimum flow. It is clarified that the decrease in water during the dry season is a normal climatic dynamic that affects the ecosystem with or without a project. C. Assessment of the Aquatic Environment Under both decrees, the aquatic environment is assessed by analyzing aquatic fauna, indicator and endemic species, and species with reduced populations or at risk of extinction. The fragility of the aquatic environment is also examined. D. Assessment of These Factors in Cases Approved by SETENA It is confirmed that the case files that currently have a valid Environmental Viability License duly underwent the respective assessment of cumulative and synergistic effects in accordance with the regulatory framework applicable when they were approved. For case files still under review, that technical assessment is a mandatory and indispensable requirement incorporated into the studies that must be submitted for evaluation by this Secretariat.

In addition, authorized extraction volumes, the river’s recharge capacity, and dynamic and static reserves are assessed by the Directorate of Geology and Mines to ensure that no overexploitation occurs. This ensures balanced exploitation in which only those dynamic reserves are extracted that, if not removed, could fill the hydraulic capacity of the riverbed and cause river flooding because there would be no channel through which the water could flow. SETENA has therefore taken care to ensure that environmental assessments consider effects that could impact the environment, so that the relevant activities implement environmental measures to prevent, mitigate, or offset possible impacts. By contrast, the applicant merely makes a series of observations without providing any technical studies substantiating the assertions made. It is imperative to emphasize that both projects in the operational stage and those undergoing environmental assessment are required to submit an Environmental Impact Study (EsIA).

Because this is the most rigorous and exhaustive assessment instrument under the regulations currently governing this subject, it is concluded that the proposals meet all the parameters and technical-study requirements for project development from the perspective of Environmental Impact Assessment (EIA). FOURTH: Environmental monitoring and oversight actions undertaken by SETENA With regard to the allegations made by the applicant concerning purported inaction by the Secretaría Técnica Nacional Ambiental (SETENA) in its oversight and inspection duties, this authority categorically rejects those assertions. Three projects in the operational stage have been identified within the area specified in the amparo application. In that regard, SETENA—through the Environmental Audit and Monitoring Department and the environmental officers retained by the developers—maintains strict oversight of the implementation of the environmental measures required to protect the surrounding environment.

Activities currently in the operational stage are subject to the environmental oversight and monitoring regime established in Decreto Ejecutivo N.° 43898-MINAE-S-MOPTMAG-MEIC. This regulatory framework requires the submission of Environmental Responsibility Reports (Informes de Responsabilidad Ambiental, IRA) every six months, mandatory use of the Digital Environmental Logbook (Bitácora Digital Ambiental, BDA), and appointment of an Environmental Officer (Responsable Ambiental, RA). Pursuant to Article 76 of the cited Decree, the Environmental Officer is one of this Secretariat’s principal oversight mechanisms. That professional is obligated to verify the commitments undertaken, supervise implementation of the mitigation measures approved during the Environmental Impact Assessment (EIA), conduct field visits, report noncompliance in the BDA, and issue technical recommendations to prevent unforeseen impacts.

Current regulations also provide that the RA is accountable for the truthfulness and technical suitability of the information signed by that officer and bears joint liability with the developer. The oversight and inspection status of the operational projects identified in the area is detailed below: 1. “Explotación de Aluvión en CDP Río Zapote” Mining Extraction Project (Case File D1-22639-2018) • Preliminary Assessment Stage: It is important to emphasize that, before the Environmental Viability License (VLA) was granted by Resolución N.° 2077-2020-SETENA, the project underwent the EIA procedure. During that process, the technical studies required to determine its viability were conducted, including a biological characterization of the water body through analysis of aquatic macroinvertebrates and application of the BMWP-CR index (Decreto Ejecutivo N.° 33903-MINAE-S). This baseline survey provided reference information on the river’s ecological conditions both upstream and downstream from the concession area. • Oversight of the Start of Operations: Although the VLA was granted in 2020, the developer did not formally report the commencement of activities until 29 October 2025.

This period is a key factor in assessing the timeliness and proportionality of this Secretariat’s monitoring actions. According to the Digital Environmental Logbook, on that date the Environmental Officer reported the commencement of operations, stating that only approximately 2 m³ of material had been extracted for quality-verification purposes at the downstream boundary of the concession, using the authorized access. • Recent Monitoring and Oversight (2026 Period): In an entry dated 23 April 2026, the Environmental Officer (RA) reported that extraction activities were conducted in accordance with the operating plan approved by the Directorate of Geology and Mines. In addition, on 29 May 2026, a new monitoring visit was recorded, during which it was stated that the extraction conducted was limited and complied with the authorized technical conditions. • Current Status and Compliance: The IRA corresponding to the period from October 2025 through March 2026 reported that the project was approximately twenty percent (20%) complete, with work concentrated on preparing the stockyard and conducting low-intensity extraction activities.

That report recorded no breaches, nonconformities, or risks warranting immediate corrective measures. As part of the approved commitments, the developer must conduct annual physicochemical monitoring and periodic biological assessments (macroinvertebrates and ichthyofauna) for comparison against the baseline. Because activities began recently, the full period for submitting the first monitoring report following the start of operations has not yet elapsed; accordingly, no technical results are yet available to determine ecological variations. The project’s Environmental Guarantee is currently valid, its Digital Environmental Logbook BDA remains enabled, and its IRA submissions are up to date. 2. Proyecto Hidroeléctrico Bijagua (Case File D1-1149-2010) • Background and Environmental Update: With respect to the presence of hydroelectric power-generation projects in the area identified by the applicant, this case file is identified; its Environmental Viability License (VLA) was granted by Resolución N.° 3233-2012-SETENA.

Subsequently, through Resolución N.° 1256-2022-SETENA of 20 July 2022, this Secretariat updated its Environmental Management Program (Programa de Gestión Ambiental, PGA) pursuant to the principle of continuous improvement. Because the original EIA process had been completed more than a decade earlier, it was appropriate to incorporate updated oversight measures and strengthen inspection mechanisms in response to the evolution of potential impacts. • New Technical Obligations: As a result of that update, additional environmental commitments were established, including annual physicochemical analyses of water quality, biomonitoring programs using benthic macroinvertebrates and ichthyofauna, periodic verification that the ecological flow is maintained, and submission of technical information to assess the area of influence. • Current Inspection Status: The project is in the operational stage and is subject to the regime established in Decreto Ejecutivo N.° 43898-MINAE-S-MOPTMAG-MEIC through the submission of Environmental Responsibility Reports (IRA) every six months, use of the Digital Environmental Logbook (BDA), maintenance of a valid Environmental Guarantee, and ongoing supervision by the Environmental Officer (RA). • Technical Analysis of the Recent Period (2025-2026): A review of the Environmental Responsibility Report (IRA) for the period from August 2025 through January 2026 confirmed the implementation of the current oversight measures, with the following technical findings standing out: o Ecological Flow: The reports indicate that the project maintains the values approved by the competent authorities without recording significant variations.

The intake and return system operates in a calibrated manner to ensure strict compliance with the authorized regime. o Biomonitoring: The implementation of monitoring programs for benthic macroinvertebrates and fish was reported at various monitoring points along the ríos Zapote and Bijagua (upstream and downstream from the intake works). The indicators reflect levels of impact previously identified in the historical baseline, without showing deviations from prior years or changes attributable to recent or progressive deterioration. o Physicochemical Quality: The analyses show isolated variations in certain parameters and at specific sites; nevertheless, the results remain within the historical ranges recorded for those water bodies, ruling out extraordinary alterations or trends of increasing impact. • Inspection Conclusion: The technical information provided by the developer, endorsed by the RA and subjected to SETENA’s ordinary oversight, reveals no objective elements supporting the conclusion that operation of the Proyecto Hidroeléctrico Bijagua is causing environmental noncompliance, damage to water resources, or unforeseen cumulative impacts. 3.

Proyecto Hidroeléctrico Canalete (Case File FEAP-0846-2002) • Background and Environmental Update: The case file for the Proyecto Hidroeléctrico Canalete is also found within the same area at issue; that project obtained its VLA through Resolución N.° 1823-2004-SETENA. Consistent with the principle of continuous improvement in environmental management, this Secretariat issued Resolución N.° 0743-2022-SETENA to update its environmental measures. This action incorporated commitments for periodic monitoring of benthic macroinvertebrates, verification of ecological flow, and physicochemical analyses of water quality, strengthening technical monitoring within its area of influence. • Current Status and Compliance: The project is currently in the operational stage and fully subject to the oversight mechanisms in force (IRA every six months, use of the BDA, and supervision by the RA). The technical information in the institutional case file shows no environmental noncompliance, alterations to the ecological flow, or monitoring results supporting a conclusion that significant impacts are attributable to the operation of this hydroelectric facility.

FIFTH: Multimodal Inspection Model and the Conduct of Field Inspections. It should be clarified that the legal framework for environmental monitoring establishes an inspection model structured as a comprehensive system for prioritization and preventive and continuous environmental oversight. That system simultaneously coordinates the protection exercised by the Environmental Officer (RA), the automated record in the Digital Environmental Logbook (BDA), the submission of Environmental Responsibility Reports (IRA) every six months, and the provision of environmental guarantees; these documentary and digital inspection mechanisms complement this Secretariat’s field-inspection powers. In the cases identified, conducting on-site field inspections in the area covered by the amparo has not, to date, been considered necessary under technical and proportionality criteria based on the following objective factors: • Recent Start of Operations: In the specific case of mining extraction in the río Zapote, the start of activities was formally reported in October 2025.

Because the operation is recent and low in intensity, this factor directly affects how this Secretariat prioritizes its inspection resources. • Absence of Technical Alerts: For the group of three identified operational case files, the ordinary monitoring mechanisms (IRA and BDA) have recorded no indications of noncompliance, entries concerning nonconformities, environmental complaints, or elements demonstrating an environmental impact warranting emergency on-site intervention. • Demonstrated Active Oversight: Institutional monitoring has continued without interruption through the ordinary regulatory instruments. Evidence of this constant and timely oversight is that the environmental measures were updated on the Secretariat’s own initiative in 2022. • Discretionary Nature of Field Inspections: On-site visits constitute a discretionary inspection power that SETENA exercises when required by technical conditions, environmental monitoring, the existence of properly substantiated complaints, or any other objective factor.

Consequently, the fact that no on-site inspection has yet occurred does not constitute an omission, abandonment, or relinquishment of authority, nor does it exempt the identified projects from future field-oversight actions. It has therefore been demonstrated that there has been no inactivity, neglect, or relinquishment of the functions assigned to this Secretariat, but rather a reasoned and proportionate exercise of environmental-monitoring powers in accordance with the current regulatory framework and the particular circumstances of the study area. Conclusions Based on the factual, technical, and regulatory considerations set forth above, this Secretaría Técnica Nacional Ambiental (SETENA) concludes as follows: 1. No Constitutional Violation: No violation of the right to a healthy and ecologically balanced environment (Article 50 of the Constitución Política) has been established, because the activities identified in the area at issue operate under validly granted and current Environmental Viability Licenses (VLA). 2.

Technical Sufficiency and Rigor: The challenged projects underwent the Environmental Impact Assessment (EIA) procedure using the most rigorous instrument in the legal system: the Environmental Impact Study (EsIA). This ensures that the works have adequate environmental baselines and the technically required prevention, mitigation, and compensation measures. 3. Active Oversight and Continuous Improvement: This Secretariat has not failed to act or neglected its authority. On the contrary, it exercises constant and dynamic oversight of the environment and applied the principle of continuous improvement to update and strengthen the environmental measures for the hydroelectric projects (Case Files D1-1149-2010 and FEAP-0846-2002) through decisions issued in 2022. 4. Validity of the Multimodal Oversight Model: The projects are monitored continuously through lawful and effective mechanisms such as the Digital Environmental Logbook (BDA), the Environmental Responsibility Reports (IRA) submitted every six months, and the jointly liable supervision of the Environmental Officer (RA); to date, those instruments record no risk alerts, incidents, or instances of noncompliance in the case files under review.”

  1. 6In a submission added to the digital case file on 22 June 2026, Aura Yamileth López Obregón, in her capacity as Mayor of the Municipalidad de Upala, reports under oath as follows:

“I. ON MUNICIPAL ENVIRONMENTAL MANAGEMENT, THE ABSENCE OF A FORMAL COMPLAINT, AND KNOWLEDGE OF THE FACTS THROUGH OTHER MEANS The Environmental Management Unit of the Municipalidad de Upala performs functions aimed at cantonal environmental management, promoting good environmental practices, receiving and routing environmental complaints, and coordinating with institutions having jurisdiction over environmental matters when appropriate. This Municipality also serves as a technical participant in addressing environmental complaints within the canton that are referred through the Integrated System for Processing and Addressing Environmental Complaints (Sistema Integrado de Trámite y Atención de Denuncias Ambientales, SITADA) of the Ministerio de Ambiente y Energía; as part of that process, the Municipality conducts a preliminary inspection to verify the reported facts and determine the corresponding institutional jurisdiction.

When the reported situation falls within municipal jurisdiction, the Administration undertakes the appropriate administrative and technical measures pursuant to the applicable legal framework; when the reported facts fall within the jurisdiction of other institutions, the Municipality refers the case through the same SITADA system to the competent entity, together with the corresponding inspection report and the findings obtained during the field visit. Upon reviewing the records of environmental complaints processed through the SITADA system and the internal records of this Municipality’s Environmental Management Unit, no formal complaint filed by Mr. Nombre02 concerning the facts described in the amparo proceeding regarding the río Zapote was located. Consequently, the Municipality has not received through this channel information that would have enabled it to conduct a field inspection, verify the reported facts, or prepare a technical report to determine the corresponding institutional jurisdiction.

Notwithstanding the foregoing, this Municipality did become aware of various public statements and complaints made by citizens through social media concerning material-extraction activities in the río Zapote and other watercourses in the canton during the current year. In this regard, it is important to clarify that concessions for the extraction of materials from watercourses in the public domain are not granted by the Municipalidad de Upala, but by the competent national institutions pursuant to the regulations in force. Nevertheless, in order to follow up on the concerns raised by citizens and promote proper interinstitutional coordination, on 19 February 2026, through resolution N.° 12 adopted at session N.° 0156-2026, the Concejo Municipal de Upala established a Special Commission, originally in response to the issue of material-extraction concessions in the río Pizote de Birmania and the environmental damage caused by that activity, for the purpose of ensuring that crusher operations did not continue to cause environmental damage in the canton.

That Commission, whose members include Environmental Manager Luis Diego Mora Jiménez as the representative of the Mayor’s Office, has in practice performed functions involving oversight of environmental compliance by companies holding current concessions for the extraction of materials from the canton’s rivers generally, not exclusively the río Pizote de Birmania, and actively participates in the oversight and coordination measures undertaken within the scope of its functions. On 26 May 2026, a coordination and consultation meeting was held with the participation of representatives of the Secretaría Técnica Nacional Ambiental (SETENA), the Dirección de Geología y Minas, members of the Special Commission of the Concejo Municipal, and interested citizens, for the purpose of presenting the existing concerns regarding material-extraction activities in the canton’s rivers and requesting greater participation, inspection, and oversight by the competent national institutions.

II. ON THE LACK OF MUNICIPAL JURISDICTION OVER THE MATTER The Municipalidad de Upala has no legal authority to grant, modify, suspend, or revoke water-use concessions, permits for hydroelectric projects, concessions for the extraction of materials from watercourses in the public domain, or environmental approvals (viabilidades ambientales). Those powers belong to the Ministerio de Ambiente y Energía, through its technical and administrative divisions, as well as to other institutions with specific jurisdiction over the subject matter. This Municipality likewise lacks legal authority to determine, from a technical standpoint, compliance with ecological-flow requirements, the conditions of water-use concessions, impacts on aquatic ecosystems, or compliance with environmental obligations established in permits and concessions granted by Central Government entities. Regarding the amparo applicant’s reference to Article 4 of the Código Municipal as the basis for the alleged failure of oversight attributed to this Municipal Corporation, it should be clarified that this provision governs the political, administrative, and financial autonomy of municipalities and lists their powers in general terms; its text does not confer specific authority to approve, inspect, or oversee water-use concessions, environmental approvals, hydroelectric-generation activities, or the extraction of materials from watercourses in the public domain.

Those powers are expressly and exclusively reserved to the Ministerio de Ambiente y Energía and its technical divisions pursuant to Ley Orgánica del Ambiente N.° 7554, the Ley de Aguas, and the applicable sectoral regulations; the cited Article 4 cannot be interpreted as conferring authority where the legislature did not grant it. III. ON THE ABSENCE OF A CURRENT REGULATORY PLAN The Municipalidad de Upala is currently preparing the proposed Regulatory and Land-Use Plan (Plan Regulador y Ordenamiento Territorial) for the canton; to date, there is no approved, current Regulatory Plan establishing specific land-use regulations or zoning applicable to the río Zapote area. Consequently, this Municipality has no territorial-planning instrument specifically regulating hydroelectric or material-extraction activities in that area. The absence of a current Regulatory Plan does not exempt anyone from compliance with the applicable national environmental regulations; in protected areas surrounding rivers, streams, springs (nacientes), wetlands, and other environmental-management categories, inspection, protection, authorization, and oversight fall to the Ministerio de Ambiente y Energía and the other specialized bodies according to their subject-matter jurisdiction, as stated by the Regulatory Plan Commission in official letter MU-CPR-OFIC-009-2026 of 18 June 2026.

IV. ON THE REDUCTION IN FLOW, ALTERATION OF THE WATERCOURSE, SEDIMENTATION, WATER QUALITY, AND AQUATIC BIODIVERSITY Regarding the increase in sediment and the alteration of the watercourse alleged by the amparo applicant, it must be clarified that on 4 April 2026, Cooperativa de Electrificación Rural de Guanacaste R.L. (Coopeguanacaste R.L.) performed cleaning work at its dam, during which, according to publicly known information, instead of dredging the accumulated sediment, it deposited that sediment directly into the río Zapote watercourse, causing extraordinary sedimentation that prompted discontent among residents of the canton. In response to these events, through resolution N.° 18 adopted at session N.° 0167-2026 of 9 April 2026, the Concejo Municipal de Upala censured the conduct of Coopeguanacaste R.L. for the actions that caused that sedimentation, referred the resolution to the Tribunal Ambiental Administrativo, the Dirección de Aguas of the Ministerio de Ambiente y Energía, the Sistema Nacional de Áreas de Conservación (SINAC), and the Fiscalía Ambiental of the Ministerio Público so that they could conduct the corresponding investigations within their respective jurisdictions, and summoned the cooperative’s General Management to appear before that collegial body and provide explanations; that appearance took place on 29 April 2026.

The matter is currently under consideration by the Fiscalía Ambiental of the Ministerio Público, which requested clarification of the exact location of the events; the Office of the Secretary of the Concejo Municipal responded through official letter MU-CM-SC-OFIC-020-2026 of 28 April 2026 expediente . The foregoing demonstrates that although the technical determination and possible sanctioning of these events fall to the Central Government institutions having jurisdiction over the matter, and not to this Municipality, the Concejo Municipal acted within the scope of its political and oversight powers by censuring the identified conduct and promptly referring the matter to the competent authorities for investigation. It is placed on record that this episode is referenced solely to establish the diligence and timeliness with which the Concejo Municipal acted within the scope of its political and oversight powers by referring the matter to the corresponding technical and judicial authorities.

Under no circumstances should this account be interpreted as an acknowledgment, attribution, or acceptance by this Municipality of any responsibility for the alleged environmental damage, the technical determination, causation, and possible sanctioning of which fall exclusively to the Central Government institutions having jurisdiction over the matter, as explained in section Il of this report. Regarding the reduction in flow, deterioration in water quality, and harm to aquatic biodiversity alleged by the amparo applicant, this Municipality has no hydrological, hydrogeological, or water-quality studies, biological assessments, or scientific research that would permit it to determine or attribute such impacts to the hydroelectric-generation or material-extraction activities mentioned in the amparo proceeding. The canton of Upala is vulnerable to climate variability and the effects associated with phenomena such as El Niño, which have historically caused periods of drought, reduced precipitation, and diminished flow in various bodies of water in the canton.

Determining the specific causes that may influence the hydrological behavior of the río Zapote requires specialized technical studies that exceed this Municipality’s jurisdiction. V. ON THE MUNICIPAL MORATORIUM AND EXISTING PROJECTS IN THE WATERSHED In the canton of Upala, there is a moratorium on the construction of hydroelectric dams, extended by the Concejo Municipal through resolution N.° 17 adopted at session N.° 0113-2025, held on 14 August 2025, for a period of ten years beginning on 3 March 2025, under which no construction permits for hydroelectric dams will be authorized in the canton while no Regulatory Plan exists; in that same resolution, the Centro de Investigación y Estudios Políticos of the Universidad de Costa Rica was asked to conduct a study of the social and environmental impact of existing and potential future dams in the canton. That resolution was approved as final and was expressly forwarded to this Municipality’s Construction Oversight Office, with instructions not to authorize construction permits in this area, in compliance with the decision of the collegial body.

According to the information available to this Administration, two hydroelectric project, belonging to Cooperativa de Electrificación Rural de Guanacaste R.L. (Coopeguanacaste R.L.), operates in the río Zapote watershed; therefore, the statement in the amparo proceeding concerning the existence of multiple hydroelectric plants in that watershed does not match the information available to this Municipality. Regarding a specific incident attributed to that cooperative in April 2026, see section IV of this report. VI. ON THE ENVIRONMENTAL-PROTECTION MEASURES UNDERTAKEN BY THE MUNICIPALITY Notwithstanding its lack of authority to directly authorize or inspect the reported activities, the Municipalidad de Upala, through its Environmental Management Unit, continuously undertakes environmental-protection and conservation measures within the río Zapote watershed and other watersheds in the canton.

These notably include campaigns to collect ordinary, recyclable, and nontraditional solid waste; reforestation events along the banks of rivers and streams; environmental-education activities; attention to environmental complaints; and coordination with public institutions and community organizations to protect the canton’s natural resources. These actions are documented in this Municipality’s 2025 Annual Activities Report (MU-ALM-INF-001-2026), specifically on pages 42 and 46 through 50 of the chapter concerning Territorial Development Management, in the Environmental Management section. Its contents were certified in a certification signed on 18 June 2026 by Architect Leonardo Mora Mora, identification card N.° CED01, Territorial Development Coordinator of the Municipalidad de Upala, in compliance with the request made through official letter MU-MA-OFIC-84-2026 of the Environmental Management Unit, within the framework of expediente N.° 26-019349-0007-CO. That report was forwarded to the Concejo Municipal through official letter MU-ALM-OFIC-0384-2026 of 10 March 2026, in compliance with Article 17, subsection g), of the Código Municipal.”

  1. 7In a written submission added to the digital case file on 23 June 2026, Luis Wilberto Tenorio García, in his capacity as President of the Concejo of the Municipalidad de Upala, reports under oath that:

“1. The Concejo Municipal de Upala has indeed considered the complaints of several community residents, including the amparo applicant, concerning alleged environmental damage to rivers located in the Canton of Upala. In that regard, they have asserted that this problem is allegedly being caused by mineral-resource extraction activities, as well as by a hydroelectric dam operated by the cooperative COOPEGUANACASTE. 2. In this respect, it should be recalled that these activities are governed by a legal framework combining water-concession laws, environmental regulations, mining law, and legislation concerning electricity, regulation, and land-use planning. In that regard, there are various stakeholders whom the undersigned believes should be joined to these proceedings, particularly considering that both reported activities—hydroelectric generation and mining—are covered by current concessions under which those stakeholders, institutions, and private-law entities have obligations relating to the reported problem.

Accordingly, the undersigned believes that this High Court should join the Dirección de Aguas of MINAE, SETENA, COOPEGUANACASTE, and the companies holding concessions for mining activities in Upala’s rivers to the proceedings: the first two in their capacity as bodies having environmental oversight and inspection powers, and the latter through an amparo against a private-law entity, in their capacity as holders of the current concessions and environmental approvals under which the reported activities operate. This does not imply any determination by this Concejo regarding the existence or attribution of the alleged environmental damage, the technical determination of which falls exclusively to the authorities and institutions having jurisdiction over the matter. 3. For their part, within the limited scope of their jurisdiction over the matter, the Concejo and the municipal administration have diligently addressed this problem through the following measures: A) On 26 May 2026, a special municipal commission composed of officials from the environmental unit and the Concejo Municipal was established, and its members visited the locations along the rivers where impacts were alleged to exist.

This served as a basis for summoning the communities and officials from SINAC, SETENA, and the Dirección de Geología y Minas to a special session at which the report was considered and those authorities undertook to conduct the appropriate investigations; B) Through resolution N.° 18 adopted at session N.° 0167-2026 of 9 April 2026, the Fiscalía de Ambiente of the Ministerio Público was asked to investigate the possible commission of environmental crimes by COOPEGUANACASTE; C) On 14 August 2025, through resolution N.° 17 adopted at session N.° 0113-2025, a resolution was adopted declaring a moratorium on the construction of hydroelectric dams in the Canton; D) At a session held on 18 June 2026, the members of the Commission promoting the Regulatory Plan process for the Canton of Upala received a verbal request that restrictions on these mining and hydroelectric activities be included in the Regulatory Plan under preparation. In this regard, the Concejo Municipal will seek to ensure that this problem is discussed during the public consultations conducted as part of that process.”

  1. 8The legal requirements have been observed in the proceedings conducted.

Drafted by Justice Garro Vargas; and, Reasons:

I.Subject matter of the application. The amparo applicant complains that the río Zapote, located in the canton of Upala, is being affected by multiple hydroelectric-generation and material-extraction activities (crusher operations), which are causing cumulative and progressive environmental impacts, including: “• Reduced river flow, especially during the dry season. • Alteration of the natural watercourse. • Significant increase in sediment. • Deterioration of water quality. • Harm to aquatic biodiversity.” This directly affects productive activities such as livestock farming, agriculture, domestic water use, and water-based tourism; nevertheless, he claims that the competent authorities have not exercised effective oversight, allowing the damage to continue.

II.Proven facts. The following facts relevant to the decision in this matter are deemed duly established:

a. Two mining concessions have been granted and remain current in the río Zapote under expedientes 960-H and 980-H, in the name of CoopeGuanacaste R.L. (see reports submitted under oath).

b. The Mining Oversight Department of the Huetar Norte Region of the Dirección de Geología y Minas of MINAE conducted the following routine oversight inspections of the granted concessions: on 7 February 2024, 21 August 2024, 21 February 2025, 24 April 2026, and 10 June 2026. The following was recorded from those inspections:

“During the first three dates, no extraction operations were observed, and preparation of the operations yard had not begun. No personnel or machinery were located within the concession during those three dates either. On 24/04/2026, as recorded on folios N°206108 and 206109 of geological logbook N°8030-26 (see Anexo II, photograph 2), mining operations involving the extraction and hauling of materials to the authorized operations yard were verified. The materials were being stockpiled without any additional sorting or crushing process. More recently, during the inspection of 10/06/2026, no extraction, hauling, processing, or sale of materials was taking place. No personnel or machinery were located in the watercourse or operations yards, as recorded in geological logbook N°8030-26, folio N°206111. According to the concession’s daily activity log, reviewed on 10/06/2026, the most recent extraction activity was recorded on 07/05/2026” (see evidence submitted).

c. On 9 April 2026, the authorities of the Municipalidad de Upala filed a complaint against CoopeGuanacaste R.L. with the Tribunal Ambiental Administrativo, the Dirección de Aguas of MINAE, the Sistema Nacional de Áreas de Conservación (SINAC), and the Fiscalía Ambiental of the Ministerio Público for allegedly depositing sediment directly into the río Zapote watercourse (see report submitted under oath).

d. On 4 May 2026, the authorities of the Dirección de Agua of MINAE conducted an inspection of the río Bijagua (Proyecto de Generación Bijagua) and the río Zapote (Proyecto de Generación Canalete), where CoopeGuanacaste operates (see report submitted under oath and evidence submitted).

e. On 26 May 2026, a coordination and consultation meeting was held with participants from SETENA, the Dirección de Geología y Minas of MINAE, and the members of the Special Commission of the Concejo of the Municipalidad de Upala, for the purpose of providing greater participation, inspection, and oversight regarding material-extraction activities in the canton’s rivers (see report submitted under oath).

f. On 9 June 2026, the authorities of the Dirección de Agua and the Dirección de Geología y Minas, both of MINAE, were served with the decision admitting these proceedings (see certificates of service).

g. Through technical report DA-UHSAN-0587-2026 of 10 June 2026, the authorities of the Dirección de Agua of MINAE recorded the following concerning the inspection conducted:

“The inspection was conducted at the hydroelectric-generation project comprising the intakes on the río Bijagua and the first intake on the río Zapote (Proyecto de Generación Bijagua), as well as the second intake on the río Zapote (Proyecto de Generación Canalete). The points recorded in the field by the undersigned using GPS PLA01 are shown below (…) Both the powerhouse of Proyecto Hidroeléctrico Bijagua (P.H Bijagua, Point 2878) and the powerhouse of Planta Hidroeléctrica Canalete (P.H Canalete, Point 2883) were inspected. The various components of the P.H Bijagua generation complex were inspected: ● Río Bijagua Intake Point: Point 2870 ● Río Zapote Intake Point: Point 2873 ● Desander: Point 2874 ● Reservoir: Point 2875 ● Penstock: Point 2876 ● Powerhouse: Point 2878 ● Discharge into río Zapote: vicinity of Point 2878. The conditions of the río Bijagua and río Zapote watercourses immediately downstream from their respective intake sites were inspected, and no traces of sediment deposited in the watercourse could be located.

The watercourses of both rivers were identified as unaffected by sedimentation, which could likewise be observed at the discharge site of P.H Bijagua (…) In both the río Zapote and the río Bijagua, within the sections specified above, no unpleasant odors were detected in the water, which appeared colorless and visibly unaffected. It was possible to identify that, for the Bijagua reservoir located at Point 2875, the Cooperative has an ancillary facility for separating sludge and subsequently extracting it manually: (…) The various components of the P.H Canalete generation complex were inspected: ● Río Zapote Intake Point: Point 2880 ● Reservoir: Point 2877 ● Powerhouse: Point 2883 ● Discharge into río Zapote: Point 2884. The conditions of the río Zapote watercourse immediately downstream from the intake site were inspected, and no traces of sediment deposited in the watercourse could be located.

The watercourse was identified as unaffected by sedimentation, which could likewise be observed at the discharge site of P.H Canalete (…) As shown in the preceding figures, no sedimentation or impact on the río Zapote body of water was identified. In the inspected section of the río Zapote, no unpleasant odors were detected in the water, which appeared colorless and visibly unaffected. At the Canalete reservoir located at Point 2877, no ancillary sludge- or sediment-treatment facility was identified at the site, meaning that its sediment is treated differently from the sediment at the Bijagua reservoir located at Point 2875. According to Mr. Nombre01, the sludge or sediment deposited in the Canalete reservoir is discharged into the río Zapote watercourse in a controlled manner. Based on the foregoing and under the preventive and precautionary principles, although no accumulation of sludge or sediment from the hydroelectric project was identified in the watercourse, the following instructions are issued: ● Sediment retained in structures associated with hydroelectric use must be properly managed by the company.

Although such material may have a natural origin, its accumulation, concentration, and eventual removal result from operation of the facility; therefore, any disposal or discharge into the receiving body of water must be performed in accordance with the applicable environmental instruments and authorizations, ensuring that it does not produce significant alterations in the watercourse’s natural dynamics, increases in turbidity, siltation processes, or impacts on aquatic ecosystems. ● Consideration must be given to the fact that when sediment has remained trapped for prolonged periods and exhibits characteristics differing from the watercourse’s natural transport conditions, it is necessary to assess mechanisms for its management, treatment, or controlled disposal, according to the characteristics of the material and the potential associated environmental impacts. ● It should also be stated that the matter was duly referred to the Secretaría Técnica Nacional Ambiental so that it may take the appropriate action within its jurisdiction” (see evidence submitted).

h. On 10 June 2026, the authorities of the Dirección de Agua of MINAE referred the situation concerning the río Zapote watercourse to SETENA (see report submitted under oath and evidence submitted).

i. On 12 June 2026, the authorities of SETENA were served with the decision admitting these proceedings (see certificates of service).

j. The authorities of the Mining Oversight Department of the Huetar Norte Region of the Dirección de Geología y Minas of MINAE stated:

“During the inspections conducted by this Department at mining concessions N°2017-CDP-PRI-077 and N°2017-CDP-PRI-017, it has been verified that extraction operations have remained within their respective boundaries. During some of the inspections conducted, sediment plumes associated with active extraction faces and the release of fine particles were indeed detected. However, they were of low density and confined to the first few meters from the work sites. On this point, technical recommendations have been issued in a timely manner for the application of methods that promote the deposition of these suspended particles, limit the extent of these plumes, and mitigate potential effects” (see evidence submitted).

k. The SETENA authorities described the status of oversight and inspection of the operational projects identified in the area:

“1. Mining Extraction Project ‘Explotación de Aluvión en CDP Río Zapote’ (Expediente D1-22639-2018) • Prior Assessment Phase: It is important to emphasize that, before the Environmental Approval License (Viabilidad Licencia Ambiental, VLA) was granted through Resolution N.° 2077-2020-SETENA, the project underwent the environmental impact assessment procedure (Evaluación de Impacto Ambiental, EIA). During this process, the technical studies required to determine its viability were conducted, including a biological characterization of the body of water through the analysis of aquatic macroinvertebrates and application of the BMWP-CR index (Decreto Ejecutivo N.° 33903-MINAE-S). This baseline survey provided reference information on the river’s ecological conditions both upstream and downstream from the concession area. • Inspection of Commencement of Operations: Although the VLA was granted in 2020, the developer did not formally report the commencement of activities until 29 October 2025.

This period is a key factor to consider in assessing the timeliness and proportionality of this Secretariat’s oversight activities. According to the Environmental Digital Logbook, on that date the Environmental Officer reported the commencement of operations, indicating that only approximately 2 m³ of material had been extracted for quality-verification purposes at the concession’s downstream boundary, using the authorized access route. • Recent Oversight and Inspection (2026 Period): In an entry dated 23 April 2026, the Environmental Officer (Responsable Ambiental, RA) reported that extraction operations had been conducted in accordance with the development plan approved by the Dirección de Geología y Minas. Likewise, on 29 May 2026, a new oversight visit was recorded, during which it was noted that extraction had been limited and conducted under the authorized technical conditions. • Current Status and Compliance: The Environmental Responsibility Report (Informe de Responsabilidad Ambiental, IRA) for the period from October 2025 through March 2026 reported that project implementation was approximately twenty percent (20%) complete, concentrated on preparation of the stockpiling yard and low-intensity extraction operations.

That report recorded no violations, nonconformities, or risks warranting immediate corrective measures. As part of the approved commitments, the developer must conduct annual physicochemical monitoring and periodic biological assessments of macroinvertebrates and fish fauna to compare them with the baseline. Because activities began only recently, the full period for submitting the first post-commencement monitoring report has not yet elapsed; consequently, no technical results are yet available from which ecological changes could be determined. The project’s Environmental Guarantee is currently valid, its Environmental Digital Logbook (Bitácora Digital Ambiental, BDA) is enabled, and it is current in submitting its IRA. 2. Proyecto Hidroeléctrico Bijagua (Expediente D1-1149-2010) • Background and Environmental Update: Regarding the presence of hydroelectric-generation projects in the area identified by the applicant, this expediente has been identified; its Environmental Approval License (VLA) was granted through Resolution N.° 3233-2012-SETENA.

Subsequently, through Resolution N.° 1256-2022-SETENA of 20 July 2022, this Secretariat updated its Environmental Management Program (Programa de Gestión Ambiental, PGA) in application of the principle of continuous improvement. Because the original EIA process had been completed more than a decade earlier, it was appropriate to incorporate updated oversight measures and strengthen inspection mechanisms in response to the evolution of potential impacts. • New Technical Obligations: As a result of that update, additional environmental commitments were established, including annual physicochemical water-quality analyses, biomonitoring programs using benthic macroinvertebrates and fish fauna, periodic verification of the maintenance of ecological flow, and the submission of technical information to assess the area of influence. • Current Inspection Status: The project is in its operational phase and is subject to the system established in Decreto Ejecutivo N.° 43898-MINAE-S-MOPT-MAG-MEIC, through the submission of semiannual Environmental Responsibility Reports (IRA), use of the Environmental Digital Logbook (BDA), maintenance of a valid Environmental Guarantee, and permanent supervision by the Environmental Officer (RA). • Technical Analysis of the Recent Period (2025-2026): A review of the Environmental Responsibility Report (IRA) for the period from August 2025 through January 2026 verified the implementation of current oversight measures, with the following technical findings being particularly noteworthy: o Ecological Flow: The reports indicate that the project maintains the values approved by the competent authorities, with no significant variations recorded.

The intake and return system operates in a calibrated manner to ensure strict compliance with the authorized regime. o Biomonitoring: Biomonitoring programs for benthic macroinvertebrates and fish at various monitoring points on the río Zapote and río Bijagua, both upstream and downstream from the intake works, were reported as having been implemented. The indicators reflect levels of impact previously identified in the historical baseline, without evidence of deviations from prior years or changes attributable to recent or progressive deterioration. o Physicochemical Quality: The analyses show isolated variations in certain parameters and at specific sites; nevertheless, the results remain within the historical ranges recorded for those bodies of water, ruling out extraordinary alterations or trends of increasing impact. • Inspection Conclusion: The technical information submitted by the developer, endorsed by the RA, and subject to SETENA’s routine oversight provides no objective basis for concluding that operation of Proyecto Hidroeléctrico Bijagua is causing environmental violations, damage to water resources, or unforeseen cumulative impacts. 3.

Proyecto Hidroeléctrico Canalete (Expediente FEAP-0846-2002) • Background and Environmental Update: In addition, within the same reference area, there is an expediente for Proyecto Hidroeléctrico Canalete, which obtained its VLA through Resolution N.° 1823-2004-SETENA. In keeping with the principle of continuous improvement in environmental management, this Secretariat issued Resolution N.° 0743-2022-SETENA to update its environmental measures. That act incorporated commitments for periodic monitoring of benthic macroinvertebrates, verification of ecological flow, and physicochemical water-quality analyses, strengthening technical oversight of its area of influence. • Current Status and Compliance: The project is currently in its operational phase and fully subject to current oversight mechanisms—semiannual IRA, use of the BDA, and supervision by the RA. The technical information in the institutional case file discloses no environmental violations, alterations to ecological flow, or monitoring results supporting a conclusion that significant impacts are attributable to the operation of this hydroelectric facility” (see report submitted under oath).

l. The SETENA authorities concluded:

“1. Absence of a Constitutional Violation: No violation of the right to a healthy and ecologically balanced environment (Article 50 of the Constitución Política) has been established, because the activities identified in the reference area operate under validly granted and current Environmental Approval Licenses (VLA). 2. Technical Sufficiency and Rigor: The challenged projects underwent the Environmental Impact Assessment (EIA) procedure using the most rigorous instrument in the legal system: the Environmental Impact Study (Estudio de Impacto Ambiental, EsIA). This ensures that the works have adequate environmental baselines and the technically required prevention, mitigation, and compensation measures. 3. Active Inspection and Continuous Improvement: This Secretariat has not failed to act or neglected its powers. On the contrary, it exercises constant and dynamic oversight of the environment and has applied the principle of continuous improvement to update and strengthen the environmental measures governing the hydroelectric projects (Expedientes D1-1149-2010 and FEAP-0846-2002) through resolutions issued in 2022. 4.

Validity of the Multimodal Oversight Model: The projects are continuously monitored through legal and effective mechanisms such as the Environmental Digital Logbook (BDA), semiannual Environmental Responsibility Reports (IRA), and the shared-liability supervision of the Environmental Officer (RA); to date, these instruments have recorded no risk alerts, incidents, or violations in the expedientes under review” (see report submitted under oath).

III.Unproven fact. The following fact is not deemed duly established: Sole fact. That before filing this application, the amparo applicant had submitted a petition reporting the facts alleged in the application and that it remained pending decision (the record).

IV.The specific case. In deciding the specific case, it is important to refer to the constitutional principles governing environmental matters, namely, the preventive and precautionary principles. In judgment no. 2021024807 issued at 9:20 a.m. on 5 November 2021, this Chamber stated:

“In this regard, specialized legal scholarship has observed that the preventive principle requires that, when there is certainty of possible environmental harm, the harmful activity must be prohibited, restricted, or conditioned upon compliance with certain requirements. In general, this principle applies when risks are clearly defined and identified as at least probable; it is also useful when no technical reports or administrative permits guarantee the sustainability of an activity, but sufficient elements exist to anticipate potential adverse impacts. The precautionary principle, by contrast, provides that when there is a threat of serious and irreversible damage, the lack of absolute scientific certainty must not be used as a reason to postpone cost-effective measures to prevent environmental degradation. It follows that the principle is premised on reasonable scientific uncertainty combined with the threat of serious and irreversible environmental harm.

In general terms, a relevant distinction between the preventive and precautionary principles lies in the level of knowledge and certainty regarding the risks posed by an activity or project. Under the former, such certainty exists; under the latter, there is a state of doubt resulting from scientific information or technical studies.” From this perspective, the precautionary principle in environmental matters requires the State to act in those cases where there is a risk of serious and irreversible environmental harm; uncertainty therefore cannot be invoked as a reason for failing to adopt the appropriate measures. Nevertheless, it should be noted that although the precautionary principle is linked to scientific uncertainty, this does not mean that it may be applied without limit, because the danger or risk must be identified to a certain degree as definite, real, and imminent, which plainly varies according to the particular circumstances of the specific case.

With the foregoing clarification, analysis of the reports submitted by the respondent authorities—with timely warning of the consequences, including criminal consequences, established in Article 44 of the Law governing this Jurisdiction—rules out the existence of any potential danger in the terms stated by the amparo applicant. In this regard, it is apparent that the authorities of the Mining Oversight Department for the Huetar Norte Region of MINAE’s Directorate of Geology and Mines have conducted various routine oversight inspections of the concessions granted—as detailed in established fact b—. The record shows that, during the two most recent inspections, no personnel or machinery were found in the riverbed, nor was any extraction, hauling, processing, or marketing of materials observed. Likewise, the authorities of MINAE’s Directorate of Water conducted an inspection to verify conditions in the Zapote River channel, concluding that no traces of sediment deposited in the channel could be found and therefore determining that it showed no sediment-related impact—as reflected in technical report DA-UHSAN-0587-2026, cited in established fact g—.

Similarly, it has been established that the SETENA authorities stated that the activities identified in the Zapote River operate under validly granted and current environmental approvals and licenses and were therefore subjected to the environmental impact assessment procedure (Evaluación de Impacto Ambiental), which makes it possible to ensure that the works undertaken have adequate environmental baselines and the technically required prevention, mitigation, and compensation measures—see the status of the oversight and monitoring of those projects set out in established fact k—.

In view of the foregoing, this Court determines that there has been no inaction or omission by the respondent authorities tending to violate the fundamental rights of the person whose rights are protected by the amparo, because those authorities are performing the duties within their respective spheres of authority to exercise the necessary oversight of the concessions granted on the Zapote River. According to the information provided to date, those concessions have generated no risk alerts, incidents, or instances of noncompliance, and therefore no violation susceptible to being declared in this jurisdiction is apparent. Furthermore, no infringement of the fundamental right to prompt and proper administrative proceedings has been established, because the amparo applicant does not refer to any specific complaint filed with the respondent authorities. Accordingly, it has not been demonstrated that he filed any submission reporting the facts alleged in the application and that such submission remains pending resolution.

Consequently, the application cannot be granted on the terms presented.

V.Dissenting opinion of Justices Cruz Castro and Rueda Leal and Justice Hess Herrera. With customary respect, we depart from the majority’s position. We believe that this matter was not ready for decision and that, before judgment was rendered, the scope of the amparo proceeding should have been expanded to include the Cooperativa de Electrificación Rural de Guanacaste R.L. (Coopeguanacaste R.L.), and that the authorities identified below should have been required to provide evidence to facilitate adjudication (prueba para mejor resolver), because the very materials in the case file on which the denial rests leave unanswered the precise issue on which there may have been a specific omission by the environmental authorities.

The amparo applicant claims that the Zapote River, in the canton of Upala, is being affected by hydroelectric-generation and material-extraction activities that cause cumulative impacts, including reduced flow, alteration of the natural channel, increased sediment, and deterioration of water quality, without effective oversight by the competent authorities. The majority denies the application on the ground that, according to the reports submitted under oath, the authorities of the Ministry of Environment and Energy (MINAE) and the National Environmental Technical Secretariat (SETENA) have exercised the necessary oversight of “the concessions granted on the Zapote River,” which have generated no risk alerts, incidents, or instances of noncompliance, thus ruling out the existence of any potential danger in the terms stated by the amparo applicant.

In particular, established fact a) of the judgment finds it proven that, on the Zapote River, “two mining concessions have been granted and remain in force, under case files 960-H and 980-H, in the name of CoopeGuanacaste R.L.” That statement does not correspond to the report submitted under oath by MINAE’s Director of Water, who expressly stated that case files 960-H and 980-H concern water-use concessions for hydroelectric generation, namely the intakes for the Bijagua and Canalete hydroelectric projects operated by Coopeguanacaste R.L. The mining concessions on the river channel are different ones: numbers 2017-CDP-PRI-077 and 2017-CDP-PRI-017, mentioned by the Directorate of Geology and Mines in established fact j), which correspond to SETENA case file D1-22639-2018 (the “Explotación de Aluvión en CDP Río Zapote” project), and whose holder is not identified anywhere in the judgment. This error carries over into Reason IV, which discusses “the concessions granted on the Zapote River” as though they formed a homogeneous group, when in fact there are two distinct activities, with different holders, subject to different authorization regimes, and challenged on different grounds.

Reduced river flow and the management of sediment retained in the reservoirs are linked to the hydroelectric activity; alteration of the river channel and the sediment plumes that the Directorate of Geology and Mines itself acknowledges having detected at the extraction sites are linked to the mining activity. By conflating the two, the judgment ultimately uses evidence relating to one activity to reject the claims made against the other. Thus, it invokes the fact that no personnel or machinery were found in the channel during the two most recent inspections by the Directorate of Geology and Mines—a fact pertaining exclusively to the mining concession—and the inspection by the Directorate of Water—which concerned only Coopeguanacaste R.L.’s hydroelectric works—to conclude generally that there is no sedimentation impact. Neither of those two findings, standing alone, addresses what is alleged with respect to the other activity.

Furthermore, in established fact h), the judgment finds it proven that, on 10 June 2026, MINAE’s Directorate of Water referred the situation involving sediment management in the Zapote River channel to SETENA. The sequence appearing in the case file should be reconstructed precisely. On 4 April 2026, Coopeguanacaste R.L. performed cleaning work at its dam and, according to the mayor of Upala herself, the accumulated sediment was deposited directly into the Zapote River channel, causing extraordinary sedimentation. On 9 April, the Municipal Council censured that conduct and referred the matter to the Administrative Environmental Tribunal, the Directorate of Water, the National System of Conservation Areas, and the Environmental Prosecutor’s Office (established fact c). One month later, on 4 May 2026, the Directorate of Water inspected the works and, although it found no traces of sediment in the channel, determined that at the Canalete reservoir “no associated sludge- or sediment-treatment structure was found to exist,” unlike at the Bijagua reservoir, and that, according to personnel of the cooperative itself, “the sludge or sediment deposited in the Canalete reservoir is discharged in a controlled manner into the Zapote River channel” (established fact g).

Precisely for that reason, expressly invoking the preventive and precautionary principles, the Directorate of Water referred the matter to SETENA through official letter DA-UHSAN-0585-2026 so that it could verify the sediment-disposal procedure approved for that project, and notified Coopeguanacaste R.L. through official letter DA-UHSAN-0586-2026 regarding the proper management of retained sediment.

SETENA’s report is dated 17 June 2026, that is, one week after that referral. Nevertheless, none of its sections mentions official letters DA-UHSAN-0585-2026 and DA-UHSAN-0586-2026, the referral made by the Directorate of Water, or any action taken as a result. On the contrary, SETENA states that, with respect to the three operational case files, the ordinary monitoring mechanisms “have recorded no indications of noncompliance, nonconformity entries, environmental complaints, or elements demonstrating an environmental impact warranting an on-site intervention”; that “to date, conducting field inspections” in the area “has not been considered necessary”; and that, with respect to the Canalete Hydroelectric Project, “no environmental noncompliance is evident.” That conclusion is based solely on the documentary information submitted by the developer itself through the Digital Environmental Logbook (Bitácora Digital Ambiental) and the Environmental Responsibility Reports (Informes de Responsabilidad Ambiental), with no indication that SETENA verified the specific matter the Directorate of Water asked it to verify: whether the discharge of sediment from the Canalete reservoir into the river channel, in the absence of a sludge-treatment structure, complies with the environmental instruments approved for that project.

In connection with the foregoing, the majority judgment finds that the referral occurred but does not examine whether it was acted upon. In our view, this is the point at which a specific omission may have occurred in this matter, and it is also the point on which the case file is silent. It is inconsistent for the substantive reasoning to invoke the precautionary principle, under which a lack of scientific certainty cannot be used as a reason to postpone the adoption of effective measures, while simultaneously treating as sufficient a SETENA report that says nothing about the only specific technical alert referred to it by another unit of the same Ministry, invoking that very principle, only one week earlier. Nor can it be overlooked that the Directorate of Water’s inspection was conducted one month after the incident of 4 April 2026, so the absence of traces of sediment on that date does not, standing alone, rule out either the event reported by the Municipality or the existence of a discharge procedure repeated each time the reservoir is cleaned.

The case file shows that the President of the Municipal Council of Upala expressly asked this Chamber to join MINAE’s Directorate of Water, SETENA, Coopeguanacaste R.L., and the companies holding concessions for mining activity in Upala’s rivers to the proceeding, the latter two through an amparo proceeding against private-law entities, in their capacity as holders of the concessions and environmental approvals under which the reported activities operate. The judgment does not address that request or explain why the scope of the amparo proceeding was not expanded, even though the case file itself identifies conduct attributed to one of those entities. Regarding Coopeguanacaste R.L., we believe there were sufficient grounds to join it to the proceeding. It holds the two concessions for the use of public-domain waters on the Zapote River, operates the Bijagua and Canalete hydroelectric projects, and provides a public service, placing it within the circumstances in which Article 57 of the Ley de la Jurisdicción Constitucional permits an amparo proceeding against private-law entities.

In addition, it was reported by the municipal authorities on 9 April 2026 for depositing sediment directly into the river channel on 4 April, and the Directorate of Water found that its Canalete reservoir lacks a sludge-treatment structure and that retained sediment is discharged into the river channel. Joining that cooperative to the dispute (litis) would have enabled it, on the one hand, to exercise its right of defense against the specific acts attributed to it and, on the other, would have provided this Chamber with firsthand information concerning the Canalete reservoir’s sediment-management procedure, the environmental instrument authorizing it, and the actions taken following official letter DA-UHSAN-0586-2026.

The situation of the mining concession holders is different, but that did not justify omitting all consideration of them. The Directorate of Geology and Mines acknowledges that, during some of its inspections, it detected sediment plumes associated with active extraction sites, and SETENA reports that extraction activity formally began in October 2025 and that the first monitoring after the start of operations—which would allow river conditions to be compared with the baseline—is not yet available. The holder of concessions 2017-CDP-PRI-077 and 2017-CDP-PRI-017 is not identified in the case file; therefore, before deciding whether that holder should be joined to the proceeding, the appropriate course was to request that information from the Directorate of Geology and Mines. What was not permissible, in our view, was to decide the merits without addressing an express request by one of the respondent authorities to join additional parties to the dispute, when that authority itself acknowledges that the obligations concerning the reported problem fall, to a large extent, upon the concession holders.

For the foregoing reasons, we believe it was necessary to obtain additional evidence on the Chamber’s own initiative before deciding the merits; that is, the Administrative Environmental Tribunal should have been required, as evidence to facilitate adjudication, to report on the status of the complaint referred by the Municipal Council of Upala in April 2026 against Coopeguanacaste R.L.; SETENA should have been required to state whether it acted upon official letters DA-UHSAN-0585-2026 and DA-UHSAN-0586-2026 from the Directorate of Water and, if so, what steps it took to verify the sediment-disposal procedure for the Canalete reservoir; and the Directorate of Geology and Mines should have been required to identify the holder of mining concessions 2017-CDP-PRI-077 and 2017-CDP-PRI-017. With that information, this Chamber would have been able to determine whether SETENA committed a specific omission with respect to the referral made by the Directorate of Water and whether the mining concession holders also needed to be joined to the proceeding.

The foregoing does not mean that we consider an infringement of the right to a healthy and ecologically balanced environment guaranteed by Article 50 of the Constitución Política to have been established without more, or that this Chamber should take the place of the technical authorities in determining the causes of the deterioration described by the amparo applicant. Our position is that the matter was decided on the basis of a case file that was incomplete on the decisive issue, and that the denial closes the discussion on the basis of reports that, when read together, are inconsistent: while the Directorate of Water identified a specific risk in the management of sediment from the Canalete reservoir and referred it to SETENA while invoking the preventive and precautionary principles, SETENA stated one week later that there were no alerts, complaints, or grounds for a field inspection.

Given that discrepancy, and because the matter concerns the protection of an interest whose safeguarding requires action before the damage becomes established, the insufficiency of the evidence should not have been resolved against the applicant without first exhausting the measures indicated. The proper course, therefore, was to expand the scope of the amparo proceeding to include Coopeguanacaste R.L., require the evidence to facilitate adjudication described in the preceding Reason, and, in light of the result, decide whether the mining concession holders should also be joined to the proceeding, before ruling on the merits with the necessary evidentiary basis.

VI.Documentation submitted to the case file. This Chamber must advise the applicant that, if any paper documents, objects, or evidence stored on any additional device or on any electronic, computerized, magnetic, optical, or telematic medium, or produced using new technologies, have been submitted, they must be retrieved from the Chamber’s offices within 30 business days after notice of this judgment is received. Otherwise, all such materials will be destroyed in accordance with the “Reglamento sobre Expediente Electrónico ante el Poder Judicial,” approved by the Full Court at session No. 27-11 of 22 August 2011, Article XXVI, and published in Boletín Judicial number 19 of 26 January 2012, as well as the resolution approved by the Consejo Superior del Poder Judicial at session No. 43-12 held on 3 May 2012, Article LXXXI.

Therefore:

The application is Denied. Justices Cruz Castro and Rueda Leal and Justice Hess Herrera dissent and believe that, before deciding the merits of the matter, the amparo proceeding should have been expanded to include Coopeguanacaste R.L. and the respondent authorities should have been required to provide evidence to facilitate adjudication, in order to determine, based on that information, whether the mining concession holders also needed to be joined to the proceeding.- Fernando Castillo V.

Resultando:

Considerando:

I.Objeto del recurso.

III.Hecho no probado.
