The Chamber summarily rejected the amparo as inadmissible because challenges to the legality and technical merits of the sanitary order had to be brought before the competent administrative or judicial authorities, and no specific act or omission was attributed to the Municipalidad de Santa Bárbara.

SummaryResumen

The Constitutional Chamber (Sala Constitucional) declared inadmissible an amparo application challenging a Ministry of Health sanitary order that declared several structures uninhabitable and required eviction, demolition of buildings, and waste collection, among other measures concerning wastewater, structural conditions, and electrical installations. The applicant alleged that the properties, findings, and responsible persons had not been sufficiently individualized and that conditions at the site had subsequently changed. He requested a new inspection, suspension of the measures, and partial annulment or modification of the order. The Chamber held that amparo protects fundamental rights but cannot be used to ask the court to mediate with public authorities or to review the legality or technical merits of administrative action. It explained that a sanitary order is the initial act of the relevant proceeding and that, upon notification, the affected person could submit defenses, objections, and evidence through the competent administrative and judicial channels. The Chamber made no specific ruling concerning the Municipalidad de Santa Bárbara because no concrete act or omission by that municipality had been alleged.

Second, this Chamber does not oversee the legality of the Administration’s actions or decisions, nor may it usurp the powers of the respondent authorities in their role as the active Administration and, after verifying the technical and legal requirements, determine the technical propriety of the sanitary order issued in this case, the technical requirements for resolving the matter, or the persons responsible, because that work belongs to the respondent authorities and any disputes must be resolved through the ordinary administrative or judicial channels. In this regard, the sanitary orders issued by the Ministry of Health in the exercise of its powers constitute the initial acts of the respective proceedings; accordingly, due process requirements must be observed from the time notice is given. Consequently, the application is inadmissible and is so declared. Case file: 26-031862-0007-CO Decision No. 2026034581 CONSTITUTIONAL CHAMBER (SALA CONSTITUCIONAL) OF THE SUPREME COURT OF JUSTICE. San José, at 10:30 a.m. on 8 September 2026.

Amparo proceeding filed by Nombre01, identity card number CED01, against the MINISTRY OF HEALTH (MINISTERIO DE SALUD) AND THE MUNICIPALITY OF SANTA BÁRBARA (MUNICIPALIDAD DE SANTA BÁRBARA).

Background:

  1. 1In a filing submitted to the Office of the Clerk of the Chamber at 11:18 a.m. on 01 de septiembre de 2026, the amparo applicant files an amparo application and states that health order MS-DRRCN-DARSSB 08-55-2026 of 25 May 2026, served on 25 June 2026, was issued against him in his capacity as principal administrator. The order declares the existing structures uninhabitable and therefore orders their evacuation, prohibits persons from remaining inside the structures, and orders the demolition of the buildings and collection of waste. He states that the order groups various problems into a single decision, including wastewater, ordinary and non-traditional waste, structural conditions, ventilation, gutters, and electrical installations presumed to pose risks. It also encompasses the main house, apartments, former restaurant, rear house, easement (servidumbre), and an adjoining property. He asserts that this variety of areas requires technical and legal individualization to determine what pertains to each owner, possessor, tenant, administrator, or third party. He maintains that several of the situations described do not relate to his property and that material improvements and corrective work have been carried out since the inspections; consequently, the photographs and reports on which the administrative act is based no longer reflect the property's current condition. He alleges that the structures, findings, and responsible persons were not sufficiently individualized and that, as the order is drafted, consequences that do not pertain to him may be attributed to him. He requests a new inspection because circumstances have changed, pursuant to the principles of substantive truth, reasonableness, and due process, including a structural delineation that distinguishes ownership, possession, administration, responsibility, and current condition; that the health order be revoked or partially modified; and that a reasonable, phased, and verifiable health-compliance plan be granted, with appropriate deadlines for addressing the matters for which he is responsible. He states that several working families, including minors, live on the property and that the amparo applicant is ill, has high blood pressure, has undergone a colostomy, and has a mental illness. He requests assistance, an order staying the health order for evacuation and demolition, that the amparo be granted, that the declaration of uninhabitability be annulled, and that the procedure be conducted in accordance with the law.
  2. 2Article 9 of the Ley de la Jurisdicción Constitucional authorizes the Chamber to summarily dismiss or reject on the merits, at any time, including upon filing, any application submitted for its consideration that is manifestly inadmissible, when it finds that there are sufficient grounds to reject it, or when the application merely reiterates or reproduces a prior identical or similar application that was rejected.

Justice Castillo Víquez drafts the decision; and, Reasons:

I. SUBJECT MATTER OF THE APPLICATION

The amparo applicant states that health order MS-DRRCN-DARSSB 08-55-2026 of 25 May 2026, served on 25 June 2026, was issued against him in his capacity as principal administrator. It also encompasses the main house, apartments, former restaurant, rear house, easement, and an adjoining property.

II. INADMISSIBILITY OF THE AMPARO

Having reviewed the amparo applicant's allegations, the applicant is first advised that the purpose of an amparo proceeding is to provide timely protection against violations or threats to fundamental rights and freedoms, not to serve as a generic instrument for submitting other types of requests. In this case, the applicants seek assistance, asking this Court to intervene or use its good offices with the respondent authorities so that the health order may be partially annulled with respect to his property. This, however, does not fall within the scope of this jurisdiction's authority because it is not for the Chamber to intercede or mediate on behalf of the persons protected by the amparo (amparados) before any public authority so that they may obtain the relief sought.

Second, this Chamber is not an overseer of the legality of the Administration's actions or decisions, nor may it usurp the powers of the respondent authorities in their role as the active Administration and, after verifying the technical and legal requirements, determine the technical propriety of the health order issued in this case, the technical requirements for resolving the matter, or the persons responsible for it. This is work incumbent upon the respondent authorities, and disputes concerning it must be resolved through ordinary administrative or judicial channels. In this regard, health orders issued by the Ministerio de Salud in the exercise of its authority constitute the initiating acts of the respective proceedings; therefore, the requirements of due process must be satisfied beginning upon service of the order. In this particular case, the amparo applicant himself acknowledges that he was served with the health order, and from that moment he could exercise his defense and submit any claims, challenges, and evidence he deemed relevant, which he does not indicate having done.

Instead, he comes directly before this Chamber to challenge the content of the health order, which is a matter of ordinary legality that this Chamber may not hear through an amparo proceeding. Accordingly, due process begins upon service of the health order, and the amparo applicant has the opportunity to submit his claims or requests directly to the competent authorities and even through the competent judicial channel, forums in which he may fully litigate the merits of the matter and assert his claims.

Furthermore, although the amparo applicant directs this proceeding against the Municipalidad de Santa Bárbara, the fact remains that his initial filing does not identify any act or omission by that municipality that would constitute a violation or threat to any fundamental right. The Chamber therefore makes no specific ruling regarding that authority.

Consequently, the application is inadmissible, and it is so declared.

III. DOCUMENTATION SUBMITTED TO THE CASE FILE

The amparo applicant is hereby advised that if any paper document was submitted, as well as any objects or evidence contained on any additional electronic, computer, magnetic, optical, or telematic device or produced through new technologies, they must be collected from the Court's offices within a maximum period of 30 business days following service of this judgment. Otherwise, any material not collected within that period will be destroyed pursuant to the "Reglamento sobre Expediente Electrónico ante el Poder Judicial," approved by the Corte Plena at session N° 27-11 of 22 August 2011, Article XXVI, and published in Boletín Judicial number 19 of 26 January 2012, as well as the resolution approved by the Consejo Superior del Poder Judicial at session N° 43-12 held on 3 May 2012, Article LXXXI.

Therefore:

The application is summarily dismissed.

Considerando:

I. OBJETO DEL RECURSO
