The majority summarily dismissed the amparo as inadmissible because the dispute concerned technical findings whose validity had to be litigated outside constitutional jurisdiction and the applicant supplied insufficient evidence of discrimination; two justices dissented and would have admitted it for processing.

SummaryResumen

The Constitutional Chamber (Sala Constitucional) summarily dismissed as inadmissible an amparo proceeding against the Asociación Administradora de Acueductos y Alcantarillados (ASADA) of Colonia Puntarenas de Upala and the Instituto Costarricense de Acueductos y Alcantarillados concerning a second denial of water and sewer service availability for a home. The majority held that service providers may deny or condition service when duly supported technical or legal impediments exist and that the challenged denial rested on an asserted lack of water-system capacity. It concluded that reviewing the validity of that technical assessment or the proper application of subconstitutional rules fell outside constitutional jurisdiction and could instead be pursued before the respondent authority or in the competent judicial forum. It also found insufficient evidence to infer unequal treatment. Justices Cruz Castro and Rueda Leal dissented: given the constitutional priority of access to drinking water, they would have admitted the amparo for processing and obtained further evidence to determine whether a constitutional violation had occurred.

Key excerptExtracto clave

The application shows that the challenged denial is based on technical criteria, and disagreement with those criteria is not a matter for this Chamber, given that this Court does not review the legality of governmental action and is not responsible for determining the correct application of the subconstitutional rules governing the matter. Such issues fall outside the jurisdiction of this specialized constitutional forum. Consequently, for the reasons stated, the amparo is inadmissible, as is hereby declared. The application is summarily dismissed. Justices Cruz Castro and Rueda Leal dissent and would order that the amparo be admitted for processing.

Document Review CASE FILE N° 26-031581-0007-CO PROCEEDING: AMPARO PROCEEDING DECISION Nº 2026034568 CONSTITUTIONAL CHAMBER (SALA CONSTITUCIONAL) OF THE SUPREME COURT OF JUSTICE. San José, at 10:30 a.m. on 8 September 2026.

Amparo proceeding filed by Nombre02, identity card CED01, against the ASOCIACIÓN DE ACUEDUCTOS DE COLONIA PUNTARENAS UPALA and the INSTITUTO COSTARRICENSE DE ACUEDUCTOS Y ALCANTARILLADOS.

Background:

  1. 1In a written submission added to this Chamber’s Judicial Office Management System at 4:25 p.m. on 28 August 2026, the amparo applicant filed an amparo proceeding against the ASOCIACION DE ACUEDUCTOS DE COLONIA PUNTARENAS UPALA and the INSTITUTO COSTARRICENSE DE ACUEDUCTOS Y ALCANTARILLADOS, stating: “(…) FACTS First: On 30 May 2014, the property recorded under real-property folio PRN01 was registered in my name by purchase in the National Registry, Alajuela Section. The property is intended for the construction of my home and is bounded to the north by a right-of-way easement (servidumbre de paso) providing access to the Asociación de Desarrollo Integral de Colonia Puntarenas. Second: On 1 August 2025, I submitted my first application to the ASADA de Colonia Puntarenas for the availability of potable water for residential use, with a required flow rate of 0.015 l/s. I must advise this Chamber that certification ACP-0030-2025, subsequently issued by the ASADA, bears a heading dated 16 July 2025—which predates the very application it purports to address—whereas the subsequent decisions in the case file (RE-003-2025 and GGR-2025-0638) consistently place the issuance of that act on 14 August 2025, evidencing a clerical error in the date entered by the Administration itself.Third: On 5 August 2025, the Board of Directors of the ASADA de Colonia Puntarenas discussed my application at a meeting and determined that the property was not technically feasible for service, citing an alleged lack of hydraulic capacity and the absence of frontage on a public road. Fourth: On 14 August 2025, the ASADA issued official letter ACP-0030-2025, entitled ‘Certification of NON-Availability of Services,’ by which it denied potable-water supply and sanitary-sewer service to my property, based on Articles 7.12, 8, 9, 14, and 36 of the Reglamento de Prestación de Servicios del AyA and Article 46 of the Reglamento de ASADAS. Fifth: On 18 August 2025, I collected official letter ACP-0030-2025 from the ASADA’s offices, at which point the time limits for seeking review began to run. Sixth: On 20 August 2025, within the three-business-day period, I filed a motion for reconsideration with a subsidiary administrative appeal (recurso de revocatoria con apelación en subsidio), requesting: (i) reversal of the denial; (ii) application of Directriz N.º 061-MP-MIVAH-S-MINAE-MAG to grant feasibility subject to my carrying out the works at my own expense; and (iii) alternatively, referral of the administrative appeal to AyA.In that filing, I expressly stated my willingness to pay for the connection works and to arrange for the easement to be recorded in the Registry. Seventh: On 1 September 2025, through decision RE-003-2025 (meeting N.º 325), the ASADA’s Board of Directors denied the motion for reconsideration, stating that the failure to record the easement could not be classified as a ‘clerical error’ capable of being resolved in that forum, and referred the subsidiary administrative appeal to AyA. Eighth: On 10 September 2025, AyA’s Legal Directorate requested, by email, a technical opinion from the Huetar Norte Regional Office for ASADA Services (ORAC) regarding the pending appeal. Ninth: On 22 September 2025, AyA’s Huetar Norte Regional Office issued memorandum GSD-UEN-GAR-2025-03668, concluding that the right-of-way easement appearing only on cadastral plan A-1438341-2010 was not recorded in the National Registry; according to that opinion, the property therefore lacked technical and legal feasibility, and the Office recommended denying the appeal.Tenth: On 30 September 2025, the General Management of A y A issued decision GG-R-2025- 0638, which DENIED the subsidiary administrative appeal and declared the administrative process exhausted. Nevertheless, the General Management itself acknowledged that, once the registry status of the access had been remedied, a technical study could potentially propose infrastructure improvements and the corresponding registration of the easement in favor of the operator. Eleventh: On 20 April 2026, through public deed N.º 187 of volume 16, executed before notary Yadriela Rodríguez Quesada in Bijagua de Upala, Mr. Nombre01, owner of the servient property recorded under real-property folio PRN02, formally established in favor of my property PRN01 a right-of-way and public-utility easement for electricity and potable water, including piping and works, measuring 61.92 meters in length and 6 meters in width. This directly remedied the sole registry-related obstacle that AyA had cited as grounds for the 2025 denial. Twelfth: On 21 and 24 April 2026, the corresponding tax stamps and notarial fees for that deed were paid (bank payment receipts N.º Cta.Bancaria01 and N.º 658935593). Thirteenth: Between 29 and 30 April 2026, the Real Property Registry recorded the easement under Volume 2026, Entry 00338956, Consecutive Number 01. The National Registry certification issued on 30 April 2026 confirms that, since 20 April 2026, my property PRN01 has had a duly recorded right-of-way and public-utility easement for electricity and potable water in its favor, thereby remedying the registry deficiency that had prompted the administrative denial. Fourteenth: On 20 May 2026, after the easement had been recorded, I submitted a new application to the ASADA de Colonia Puntarenas for potable-water availability for the same property (real-property folio PRN01, plan A-1438341-2010), again for residential use and with a flow rate of 0.015 l/s.Fifteenth: On 2 June 2026, at a special meeting, the ASADA’s Board of Directors submitted my new application for discussion. Sixteenth: On 8 June 2026, the ASADA issued Certification ACP-030-2026, by which it again denied both potable-water supply and sanitary-sewer service. On this occasion, the basis was no longer the lack of a recorded easement—a defect I myself had remedied—but the assertion that ‘THERE IS NO WATER CAPACITY,’ based on an internal document entitled ‘Technical Opinion on Service Availability for ASADA Colonia Puntarenas Upala,’ prepared by the Management Area, UEN Rural Aqueduct Management, and on the same Articles 7.12, 8, 9, 14, and 36 of the Reglamento de Prestación de Servicios del AyA and Article 46 of the Reglamento de ASADAS. I must advise this Chamber that I fully complied with the sole objective condition invoked by the Administration to deny the service—the registration of the right-of-way and public-utility easement for electricity and potable water—investing my own time and resources in executing and recording the public deed.Despite this, the ASADA denied the service for a second time, on this occasion invoking a ground (‘water capacity’) that has not been supported in my case by a specific, measurable, and verifiable technical study concerning my property, evidencing a pattern of successive and shifting denials in response to the same basic need.” She considers her fundamental rights to have been violated. She requests that the amparo be granted with the consequences prescribed by law and that the respondent be ordered to issue the requested certification of potable-water and sanitary-sewer availability or, alternatively, that an objective, reasoned, and documented technical study be performed and served on her, supporting any possible denial with verifiable data, in observance of the duty to state reasons for administrative acts and the principle prohibiting arbitrariness.
  2. 2Article 9 of the Ley de la Jurisdicción Constitucional authorizes the Chamber, at any time and even upon filing, to dismiss summarily or on the merits any application submitted for its consideration that is manifestly inadmissible, when it finds sufficient grounds to deny it, or when it merely reiterates or reproduces a prior identical or similar application that was denied.

Justice Castillo Víquez writes the decision; and, Reasons:

I. SUBJECT MATTER OF THE AMPARO

The amparo applicant alleges that, on 8 June 2026, the ASADA issued Certification ACP-030-2026, by which it denied both potable-water supply and sanitary-sewer service for a second time. On this occasion, the basis was no longer the lack of a recorded easement—a defect that she herself had remedied—but the assertion that “THERE IS NO WATER CAPACITY,” despite her full compliance with the sole objective condition invoked by the Administration to deny the service, evidencing a pattern of successive and shifting denials in response to the same basic need.

II. SPECIFIC CASE

In light of the amparo applicant’s assertions and the evidence submitted, it should be noted that this Court has held that associations administering aqueducts and sewer systems, municipalities, and other institutions providing potable-water services may validly deny or condition such applications when justified by technical or legal reasons. Thus, in judgment n.°2016-006027 at 9:05 a.m. on 6 May 2016, this Chamber held as follows:

“(...) In judgment 2014-9134 at 2:05 p.m. on 19 June 2014, which addressed an issue very similar to the one raised in this amparo, this Constitutional Court ruled: ‘(...) In repeated judgments on this matter, this Chamber has stated that the supply of potable water is regarded under the Costa Rican legal system as a public service and that, as such, every public-service provider—whether a public or private entity—is required to provide the service continuously, efficiently, under equal conditions, and with adaptation to technological changes (see, in this regard, judgment 2001-09676 at 11:25 a.m. on 26 September 2001 and judgment 2004-08161 at 10:53 a.m. on 23 July 2004). It is therefore clear that the Instituto Costarricense de Acueductos y Alcantarillados, as one of the state entities responsible for providing the public service of potable water, is likewise required to provide this service continuously, adaptably, efficiently, and equally to all inhabitants. Nevertheless, this Constitutional Court’s case law has also held that, where there is a legal impediment (meaning failure to satisfy requirements established in the applicable regulations) or a formal impediment (meaning the absence of a Water Distribution Network), it is reasonable not to grant service applications or to require the interested party to bear the installation costs when there is no potable-water distribution network and infrastructure must be constructed. In such cases, it has been made clear that this is not a denial of access to potable-water service, but rather an inability to provide it or the need for the interested party to participate in overcoming a technical impediment, namely, the lack of infrastructure. In other words, provided that the failure to supply potable-water service is not capricious, arbitrary, or unfounded, but is justified by a legal or material impediment, there is no violation of fundamental rights. In the specific case, the evidence submitted and the report given under oath confirm that AyA did not arbitrarily deny the application submitted by the amparo applicant, but did so because not all the technical and legal requirements imposed by the Reglamento de Prestación de Servicios a los Clientes de Instituto Costarricense de Acueductos y Alcantarillados for approving new services had been satisfied (...)’.”

The filing shows that the challenged denial is based on technical criteria. Disagreement with those criteria is not a matter for this Chamber, given that this Court does not review the legality of official acts and is not responsible for determining the proper application of the sub-constitutional rules governing the matter. Such issues fall outside the jurisdiction of this specialized court. Moreover, as stated above, the Chamber has held that applications for the provision of potable-water service may be denied when there are technical impediments, as in this case, or when technical and/or legal criteria justify doing so. Nor is it for the Chamber to determine whether the reasons given for denying water-service availability are valid. This Court must not act as an intermediary before a particular natural or legal person to intercede on behalf of a third party so that the latter may obtain what she seeks, as requested by the person protected by the amparo in this case.

Therefore, the protected person may—if she deems it appropriate—raise her objections or claims before the respondent authority or through the competent judicial proceedings, in which she may fully litigate the merits of the matter and assert her claims. Furthermore, regarding the alleged discrimination, this Chamber has repeatedly stated that, in cases alleging a violation of Article 33 of the Political Constitution, it is not sufficient for the amparo applicant to assert that several persons have received different treatment in order to establish a breach of the constitutional provision. Rather, the person alleging a violation of this principle must provide, ab initio, sufficient evidence suggesting—with a reasonable degree of probability—that equal situations have unjustifiably received different treatment. In this case, there is insufficient evidence to indicate a possible violation of the principle of equality; nor is there any indication of a possible violation of fundamental rights that would warrant admitting this matter for consideration on the merits. Consequently, for the reasons stated, the amparo is inadmissible, as is hereby declared.

III. DISSENTING OPINION OF JUSTICES CRUZ CASTRO AND RUEDA LEAL, WRITTEN BY THE LATTER

In the sub lite, the Chamber’s majority dismisses the amparo on the grounds that institutions providing potable-water services may validly deny or condition applications for potable-water service when justified by technical or legal reasons. We dissent, however, based on the following considerations:

Article 50 of the Constitution provides that every person holds the basic and non-waivable human right of access to potable water as an essential resource for life. It adds that water is an asset of the Nation, indispensable for the protection of that human right. It also provides that its use, protection, sustainability, conservation, and exploitation shall be governed by the law enacted for those purposes and that the supply of potable water for consumption by individuals and communities shall take priority.

In view of the foregoing, it is clear that the priority status constitutionally afforded to the supply of potable water obliges the competent entities to adopt appropriate measures to ensure that this public service is provided equally, continuously, and efficiently. This, in turn, requires appropriate adaptation or modification so that, within a framework of reasonableness, infrastructure and technologies are adapted to society’s new requirements and to changes in nature.

Accordingly, we consider that additional evidentiary elements are required to establish or rule out whether, in the sub examine, a constitutional violation warranting the Chamber’s intervention occurred.

IV. DOCUMENTATION SUBMITTED TO THE CASE FILE

The parties are advised that any paper document submitted, as well as any objects or evidence contained on an additional electronic, computer, magnetic, optical, or telematic device, or produced by new technologies, must be collected from the judicial office within a maximum period of 30 business days from service of this judgment. Otherwise, any material not collected within that period will be destroyed, pursuant to the “Reglamento sobre Expediente Electrónico ante el Poder Judicial,” approved by the Full Court at meeting N° 27-11 on 22 August 2011, Article XXVI, and published in Judicial Bulletin number 19 on 26 January 2012, as well as the agreement approved by the Superior Council of the Judiciary at meeting N° 43-12 held on 3 May 2012, Article LXXXI.

Therefore:

The amparo is summarily dismissed. Justices Cruz Castro and Rueda Leal dissent and would order that the amparo be processed.

Considerando:

I. OBJETO DEL RECURSO
