The Chamber summarily rejected the amparo without deciding the merits of the environmental complaint because the applicant did not timely comply with the order to sign or ratify the filing and submit the required documentation.

SummaryResumen

The Constitutional Chamber (Sala Constitucional) summarily rejected an amparo application against the Municipalidad de Oreamuno concerning its alleged failure to address accumulations of nontraditional waste, other refuse, and apparently abandoned vehicles near a school in San Rafael de Oreamuno. The amparo applicant alleged potential environmental and public-health risks and interference with pedestrian traffic despite a municipal complaint recorded as REF 151-2026. Before examining those allegations, the Chamber ordered the applicant to sign or properly ratify the initial filing and to provide the complaint, proof that it had been received, and any additional supporting evidence. Although that order to cure the defects was served by email, the applicant did not comply within the three-day period. Relying on Article 42 of the Ley de la Jurisdicción Constitucional, the Chamber rejected the amparo at the threshold. The ruling is strictly procedural: it neither determines whether the municipality violated any rights nor decides the merits of the reported environmental conditions.

CASE FILE: N° 26-028926-0007-CO PROCEEDING: AMPARO PROCEEDING DECISION Nº 2026034290 CONSTITUTIONAL CHAMBER (SALA CONSTITUCIONAL) OF THE SUPREME COURT OF JUSTICE. San José, at 10:30 a.m. on 8 September 2026.

Amparo application filed by Nombre01, identity card CED01, against the MUNICIPALITY OF OREAMUNO.

Background:

  1. 1By a written submission added to this Chamber’s Judicial Offices Management System at 4:50 p.m. on 10 August 2026, the amparo applicant, Nombre01, files an amparo application against the Municipality of Oreamuno and states that: he is a resident of San Rafael de Oreamuno, Cartago, and that in the vicinity of Dirección01 there is an environmental and public-health problem involving the repeated accumulation of non-traditional waste and other refuse, as well as apparently abandoned vehicles, which affects pedestrian traffic. That one of the affected sites is located approximately 100 meters north and 10 meters east of Dirección01. That the situation was formally reported to the Municipality of Oreamuno and has been recorded since 28 May 2026 through the request identified as REF 151-2026, in which the Municipality itself described the location as approximately 150 meters northeast of Dirección01.He adds that “(…) That same day, a female neighbor followed up and expressly requested municipal assistance to clean the property, stating that, although she recognizes the residents’ responsibility for the areas fronting their properties, she needed institutional assistance to clean the affected location. SIXTH. On 28 May 2026, at 2:40 p.m., the Municipality responded that the report would be entered so that the cleanup could be scheduled according to the route and the availability of work crews, and stated that it would subsequently provide a response by official letter with evidence of the work performed. SEVENTH. Regarding non-traditional waste, the Municipality indicated that this service is not provided regularly and requires special machinery, but stated that it would endeavor to include the location in a scheduled route for this type of collection. EIGHTH. On 1 June 2026, additional follow-up was conducted by email, specifically inquiring about the placement of ‘No Dumping’ signs, the cleaning of drainage ditches and roads, and the collection of non-traditional waste. That communication also explained that the lack of cleanup encourages other people to deposit more refuse at the same locations. NINTH. Despite the report, the follow-up, and the Municipality’s commitment to schedule the work, the photographs taken on 10 August 2026 show that the problem persists. Approximately seventy-four days have elapsed since the first municipal communication without, according to the information and evidence in the applicant’s possession, a comprehensive and permanent solution. TENTH. The accumulation of waste may create conditions conducive to the presence of rodents and insects and to the accumulation of water in certain containers or objects. The applicant does not assert that there is a confirmed breeding site for mosquitoes that transmit dengue, Zika, or chikungunya; rather, he reports the existence of conditions warranting a preventive public-health and environmental inspection.ELEVENTH. The proximity of the reported locations to Dirección01 increases the significance of the situation because the area is used daily by students and other persons traveling through the sector. TWELFTH. There is a second problematic location approximately 80 meters north of Dirección01. Two apparently abandoned vehicles, one a truck and the other a pick-up truck, can be seen in that sector, together with an accumulation of waste and objects around them. (…)”. He complains that the accumulation of objects, waste, and vehicles near the road may obstruct or impede pedestrian traffic and particularly affects those who use the roads near the educational center every day.
  2. 2By a decision issued at 1:39 p.m. on 17 August 2026, the applicant was ordered, within three days of service of that order and under warning that the application would be summarily rejected if he failed to comply, to: “(…) appear before the Office of the Clerk of this Chamber to sign the initial submission, as he omitted to do so; or submit a duly signed filing ratifying the application in all respects. A RECORD OF THAT ACTION SHALL BE ENTERED IN THE CASE FILE. The foregoing is required because the initial submission in this proceeding is not duly signed. He is further advised that, within the same period, he must provide the following: • A complete and legible copy, together with the corresponding proof of receipt or email transmission, of the report that he states he filed with the respondent authority and whose lack of response he alleges in the initial submission in this proceeding. • Likewise, he must submit any additional evidence on which he bases his assertions. (…)”
  3. 3According to the notice record contained in the electronic case file, the applicant was served by email at 8:40 a.m. on 18 August 2026 through the means designated for receiving notices.
  4. 4In a certification dated 28 August 2026, signed by Arturo Durán Barquero and Nazareth María Quesada, respectively Chamber Technician and Acting Clerk, both of the Constitutional Chamber, they stated that “(…) upon review, in the COSTA RICAN JUDICIAL OFFICES MANAGEMENT SYSTEM, of the RECEIVED DOCUMENTS LOG AND THIS CASE FILE, there is no indication that, from 17 August 2026 through 24 August 2026, the applicant submitted any filing or document to comply with the order contained in the decision issued at 1:39 p.m. on 17 August 2026 in the AMPARO PROCEEDING being processed under case file number 26-028926-0007-CO, brought by Nombre01. The record contains only the submission and documents through which the AMPARO PROCEEDING was initiated. (…)”.
  5. 5Article 42 of the Ley de la Jurisdicción Constitucional authorizes the Chamber to summarily reject an amparo application when defects present at the time of filing have not been corrected.

Justice Castillo Víquez drafts the decision; and, Reasons:

In view of the foregoing and pursuant to Article 42 of the Ley de la Jurisdicción Constitucional, the application must be summarily rejected.

PROCESO: RECURSO DE AMPARO RESOLUCIÓN Nº 2026034290 SALA CONSTITUCIONAL DE LA CORTE SUPREMA DE JUSTICIA.
