OutcomeResultado
The majority denied the amparo because insufficient water capacity and infrastructure made the requested connection technically unfeasible and the dispute belonged in the competent ordinary legality proceedings; two justices dissented and would have ordered concrete, progressive measures to secure access to water.
SummaryResumen
The Constitutional Chamber (Sala Constitucional) denied the amparo application filed against the ASADA of Volio de San Ramón and the Instituto Costarricense de Acueductos y Alcantarillados concerning the refusal to grant potable-water availability for a property. The majority reiterated that access to water is a fundamental right essential to life and health, but held that it does not entail unrestricted access to the service: applicants must satisfy general requirements, and supply must be materially feasible. It found that the availability granted in 2023 expired after twelve months and that the renewed request was denied because of insufficient water resources, distribution network, and sewerage infrastructure. The majority therefore characterized the dispute as disagreement with technical criteria that should be pursued before the respondent entities or through the competent ordinary legality proceedings, rather than constitutional jurisdiction. Justices Cruz Castro and Rueda Leal dissented; they would have ordered concrete, progressive measures to secure effective access to potable water within a reasonable period.
Key excerptExtracto clave
In repeated case law, this Court has recognized the fundamental right to water, under which all persons must be afforded the possibility of accessing potable-water services under equal conditions, because water is essential to life and health. The Chamber has likewise stated that, notwithstanding the foregoing, its status as a fundamental right does not entail unrestricted access to water services, since the Administration may validly establish general requirements that each applicant must satisfy so that the particular request can be assessed (see Judgment No. 2018-004915 of 9:30 a.m. on 23 March 2018). It has also been held that, although a fundamental right to water exists, provision of the service may be made subject to compliance with the requirements established for granting it and to the material feasibility of supply; that is, there must not be technical circumstances that prevent or make it inadvisable to provide potable-water service (see Judgments No. 2009-003825 of 4:49 p.m. on 10 March 2009 and No. 2018-004915 of 9:30 a.m. on 23 March 2018, among others).Este Tribunal, en reiterada jurisprudencia, ha reconocido el denominado derecho fundamental al agua, por el cual, debe concederse a todas las personas la posibilidad de acceder en condiciones de igualdad a los servicios de agua potable, al resultar esencial para la vida y la salud.

PJEDITOR Document Case: 26-026190-0007-CO Decision No. 2026033850 CONSTITUTIONAL CHAMBER (SALA CONSTITUCIONAL) OF THE SUPREME COURT OF JUSTICE. San José, at 9:20 a.m. on 3 September 2026.
Amparo proceeding processed under case N°26-026190-0007-CO, filed by Nombre02, identity card CED02, on behalf of Nombre01, passport Identificacion01, against the ASOCIACIÓN ADMINISTRADORA DEL ACUEDUCTO RURAL DE VOLIO DE SAN RAMÓN and the INSTITUTO COSTARRICENSE DE ACUEDUCTOS Y ALCANTARILLADOS.
BACKGROUND:
Justice Salazar Alvarado writes the opinion; and, REASONS:
With respect to amparo actions brought against private parties, as is the case here, the Chamber has clearly stated: “Given its exceptional nature, the ordinary processing of amparo applications against private-law persons requires first examining whether the case falls within any of the circumstances that make such an application admissible and—subsequently, if it does—determining whether or not it should be granted” (Judgment N°151-97). Article 57 of the Ley de la Jurisdicción Constitucional provides that this type of action may be brought against the acts or omissions of private-law persons when they act or are required to act in the exercise of public functions or powers, or when, as a matter of law or fact, they occupy a position of power in relation to which ordinary judicial remedies are clearly insufficient or untimely to safeguard the fundamental rights or freedoms referred to in Article 2(a) of that Law. In the sub judice case, the Chamber considers that the Asociación Administradora del Acueducto de Volio de San Ramón is acting in the exercise of a public function and that the amparo is therefore admissible (see Judgment N°2010-005400 issued at 10:15 a.m. on 19 March 2010).
The amparo applicant states that he requested drinking-water service from the Asociación Administradora del Acueducto y Alcantarillado Rural de Volio de San Ramón. Nevertheless, access to the water supply has not been provided. He considers that his fundamental rights have been violated.
The following facts are deemed duly established and relevant to the decision in this matter, either because they have been substantiated or because the respondent failed to address them as required by the initial order:
In its consistent case law, this Court has recognized the fundamental right to water, under which every person must be afforded the opportunity to access drinking-water services on equal terms because water is essential to life and health. Likewise, this Chamber has held that, notwithstanding the foregoing, its status as a fundamental right does not entail unrestricted access to water services, because the Administration may validly establish general requirements with which every applicant must comply so that the applicant’s particular request may be assessed (see, to that effect, Judgment N° 2018-004915 issued at 9:30 a.m. on 23 March 2018). It has also been stated that, although there is a fundamental right to water, the provision of the service may be made subject to compliance with the requirements established for granting it and to the material possibility of supplying it; that is, there must not be technical circumstances that make the provision of drinking-water service impossible or inadvisable (see, to that effect, Judgments N° 2009-003825 issued at 4:49 p.m. on 10 March 2009 and N° 2018-004915 issued at 9:30 a.m. on 23 March 2018, among others).
In the sub lite case, the amparo applicant states that he requested drinking-water service for the property of the person protected by the amparo. Nevertheless, as of the date this application was filed, the property did not have access to the water supply.
In this regard, both the representative of the respondent association and the authority of the Instituto Costarricense de Acueductos y Alcantarillados explain that there is currently neither sufficient water capacity nor the infrastructure needed to provide new services, as the applicant was notified on 08 October 2025.
Thus, in accordance with the established factual basis and as stated in the preceding section, this Court cannot disregard the legal and technical requirements for providing a service. On that understanding, it has been established that in 2023, drinking-water availability was granted but sewerage availability was denied, and that the availability granted was valid for twelve months. After it expired, a new request was submitted and denied on 08 October 2025, with the explanation that service would not be granted because of insufficient water capacity and lack of sewerage, and that new services could not be provided because of the absence of both water resources and sewerage. Accordingly, the circumstances described by the amparo applicant do not violate his fundamental rights because they in fact amount to disagreement with the technical determinations that prevent the requested service connection. Such disagreements must not be examined or resolved within this Constitutional Jurisdiction, but instead must be brought before the respondents themselves or through the competent ordinary legal channels so that the matter may be decided as provided by law. Consequently, the application must be denied, as is hereby ordered.
For the reasons set forth below, we consider that the present application should be granted. The majority opinion denies the amparo because, in its view, the challenged refusal is not the result of arbitrary or discriminatory conduct but is instead based on technical criteria. It fails, however, to give adequate weight to the fact that access to drinking water is a fundamental right indispensable to life, health, and human dignity.
Article 21 of the Constitución Política protects human life, and this Court has recognized that access to water for human consumption is a material prerequisite for that right. Likewise, Article 50 of the Constitution imposes upon the State the duty to guarantee the well-being of all inhabitants, which necessarily includes effective, sufficient, and continuous access to drinking water. At the international level, instruments such as the International Covenant on Economic, Social and Cultural Rights—as interpreted by the Committee on Economic, Social and Cultural Rights in its General Comment No. 15—recognize the human right to water and require States to adopt positive measures for its full realization. The State bears a heightened obligation in a social and democratic state governed by the rule of law; for this reason, supplying water is a priority obligation of the public authorities.
The public-service provider cannot merely note deficiencies in the system; it has a legal duty to plan, anticipate, and carry out the actions necessary to progressively guarantee access to water service, especially when the water is intended for human consumption.
The issue is not one of requiring the impossible, but of requiring the adoption of reasonable, alternative, or progressive measures so that people are not left without protection.
Water is not just another service; it is an essential human right. The respondent entity therefore cannot disregard its duty to guarantee it by invoking technical limitations without offering effective solutions.
For these reasons, we consider that the application should be granted, at least to order the adoption of concrete and progressive measures that would guarantee, within a reasonable period, effective access to drinking water for the party protected by the amparo. Water is both a good and a fundamental right whose effective enjoyment must be ensured; this is an inescapable duty.
The parties are advised that if they submitted any paper document, as well as objects or evidence contained on any additional electronic, computer, magnetic, optical, or telematic device, or any device produced through new technologies, these materials must be collected from the Court within no more than thirty business days from service of this judgment. Otherwise, any material not collected within that period will be destroyed, as provided in the “Reglamento sobre Expediente Electrónico ante el Poder Judicial,” approved by the Corte Plena at Session N° 27-11 of 22 August 2011, Article XXVI, and published in Boletín Judicial N° 19 of 26 January 2012, as well as in the resolution approved by the Consejo Superior del Poder Judicial at Session N° 43-12, held on 3 May 2012, Article LXXXI.
